और, केन्द्रीय सरकार का यह समाधान हो गया ह ै दक साउथ ईस्ट्टनज कोलफील््स जलजमटेड, सीपत रोड, पोस्ट्ट बॉक्स नं 60, जिला जबलासपरु 495006, छत्तीसगढ़ (जिसे इसमें इसके पश्चात उक्त सरकारी कम्पनी कहा गया ह)ै ऐस े जनबंधनों और ितों का, िो केन्द्रीय सरकार इस जनजमत्त अजधरोजपत करना उजचत समझे, अनपु ालन करन े के जलय े सहमत ह;ै अतः, अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 11 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए यह जनििे िते ी ह ैदक इस प्रकार जनजहत उक्त 202.113 हक्े टर (लगभग) या 499.42 एकड़ (लगभग) माप िाली उक्त भूजम में या उस पर के सभी अजधकार तारीख 02 िनिरी 2026 से केन्द्रीय सरकार में इस प्रकार जनजहत बन े रहन े की बिाय, जनम्नजलजखत जनबंधनों और ितों के अधीन रहत ेहुए, उक्त सरकारी कम्पनी में जनजहत हो िाएंगे, अथाजत:- 6780 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

1. सरकारी कंपनी, उक्त अजधजनयम और अन्द्य सुसंगत जिजधयों के उपबंधों के अधीन यथा अिधाररत प्रजतकर, ब्याि, क्षजतयों आदि और िैसी ही मिों की बाबत सभी संिाय करेगी;

2. उक्त अजधजनयम की धारा 14 के अधीन एक अजधकरण का गठन दकया िाएगा, जिसमें ितज (1) के अधीन सरकारी कंपनी द्वारा केन्द् रीय सरकार को संिेय रकमों का अिधारण करने के प्रयोिनों के जलए, और ऐसे दकसी अजधकरण और उक्त अजधकरण की सहायता करन े के जलए जनयुक्त व्यजक्तयों के संबंध म ें उपगत सभी व्यय, उक्त सरकारी कंपनी द्वारा िहन दकए िाएंगे, और इसी प्रकार जनजहत उक्त भूजम म ें या उस पर के अजधकारों के जलए या उनके संबंध में अपील आदि सभी जिजधक कायजिाजहयों की बाबत उपगत, सभी व्यय भी, सरकारी कंपनी द्वारा िहन दकए िाएंग;े

3. सरकारी कंपनी, केन्द्रीय सरकार और उसके पिाजधकाररयो की, ऐसे दकसी अन्द्य व्यय के संबंध में क्षजतपूर्त ज करेगी, िो इस प्रकार जनजहत उक्त भूजम म ें या उस पर के अजधकारों के बारे में, केन्द्रीय सरकार या उसके पिाजधकाररयो द्वारा या उनके जिरूद्ध दकन्द्हीं कायजिाजहयों के संबंध में आिश्यक हो;

4. सरकारी कंपनी को, केन्द्रीय सरकार के पूिज अनुमोिन के जबना, उक्त भूजम और उसके अजधकारों को दकसी अन्द्य व्यजक्त को अन्द्तरण करन े की िजक्त नहीं होगी; और

5. सरकारी कंपनी, ऐसे जनििे ों और ितों का पालन करेगी, िो केन्द्रीय सरकार द्वारा, िब कभी आिश्यक हो, उक्त भूजम के जिजिष्ट क्षेत्रों के जलए दिए िाएं या अजधरोजपत दकए िाएं। [फा. सं. 43015/7/2024-एलएआईआर] डॉ. गोपाल ससंह, संयक्तु सजचि MINISTRY OF COAL

NOTIFICATION New Delhi, the 3rd September, 2026 S.O. 4869(E).—Whereas, on the publication of the notification of the Government of India in the Ministry of Coal, number S.O. 17(E), dated the 2nd January, 2026, published in the Gazette of India, Extraordinary, Part II,

Section 3, Sub-section (ii), dated the 2nd January, 2026, issued under sub-section (1) of section 9 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), the land and all rights in or over the land specified in the Schedule appended to the said notification (hereinafter referred to as the said land) vested absolutely in the Central Government free from all encumbrances under sub-section (1) of section 10 of the said Act;

And whereas, the Central Government is satisfied that the South Eastern Coalfields Limited, Seepat Road, P.

B. No. 60, District-Bilaspur 495006, Chhattisgarh (hereinafter referred to as the Government company) is willing to comply with such terms and conditions as the Central Government thinks fit to impose in this behalf;

Now, therefore, in exercise of the power conferred by sub-section (1) of section 11 of the said Act, the Central Government hereby direct that the said land measuring 202.113 hectares (approximately) or 499.42 acres

(approximately) land and all rights in or over the said land so vested shall with effect from 2nd January, 2026, instead of continuing to so vest in the Central Government shall vest in the Government company subject to the following terms and conditions, namely:

1. the Government company shall make all payments in respect of compensation, interest, damages, etc. and the like, as determined under the provisions of the said Act and other relevant laws;

2. a Tribunal shall be constituted under section 14 of the said Act, for the purpose of determining the amounts payable by the Government company under condition (1) and all expenditure incurred in connection with any such tribunal and persons appointed to assist the Tribunal shall be borne by the Government company and similarly, all expenditure incurred in respect of all legal proceedings like appeals, etc., for or in connection with the rights, in or over the said land, so vested, shall also be borne by the Government company;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3

3. the Government company shall indemnify the Central Government and its officials against any other expenditure that may be necessary in connection with any proceedings by or against the Central Government or its officials regarding the rights in or over the said land so vested;

4. the Government company shall have no power to transfer the said land and rights to any other persons without the prior approval of the Central Government; and

5. the Government company shall abide by such directions or conditions as may be given or imposed by the Central Government for particular areas of the said land, as and when necessary. [F. No. 43015/7/2024-LAIR] Dr. GOPAL SINGH, Jt. Secy.
