20) (जिसे इसमें इसके पश् चात उक्त अजधजनयम कहा गया ह)ै की धारा 4 की उपधारा (1) के अधीन भारत सरकार न े कोयला मंत्रालय द्वारा िारी की गई अजधसूचना संख याकं का. आ. 4120 (अ), तारीख 19 जसतंबर, 2023, िो भारत के रािपत्र के भाग 2, खण् ड 3, उपखण् ड (ii), तारीख 19 जसतंबर, 2023 म ें प्रकाजित की गई थी, उक्त अजधसूचना स े उपाबद्ध अनुसूची में जिजनर्िजष्ट पररक्षेत्र की भूजम में जिसका माप 145.74 हक्े ट र (लगभग) या 360.12 एकड़ (लगभग) ह,ै कोयल े का पूिेक्षण करने के अपने आिय की सूचना िी थी;

और, केन्‍दर ीय सरकार का यह समाधान हो गया ह ैदक इस अजधसूचना से संलग्न अनुसूची म ें जिजनर्िजष्ट की गई उक्त भूजम के दकसी भाग में कोयला अजभप्राप् त ह;ै अत:, अब, केन्‍द रीय सरकार उक्त अजधजनयम की धारा 7 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, इससे सलं ग् न अनुसूची में िर्णिंत 127.93 हक्े ट र (लगभग) या 316.12 एकड़ (लगभग) माप िाली भूजम म ें या उस पर के सभी अजधकार का अिजन करने के अपन ेआिय की सूचना िते ी है;

रटप् पण 1: इस अजधसूचना के अधीन आन े िाले क्षेत्र के रेखांक धारक संख या सी-। (ई)/III/िेिेआर/0624/1017, तारीख 07 िून, 2024 का जनररक्षण कलेक्ट र, जिला यितमाल, महाराष्र के कायाजलय में या कोयला जनयंत्रक, कोयला जनयंत्रक का संगठन, कोयला मत्रं ालय, स्ट्कोप मीनार, 5th फ्लोर, कोर-2, लक्ष्मी नगर, नई दिल्ली– 110092 के कायाजलय में या महाप्रबंधक, िेस्ट् टनज कोलफील् ्स जलजमटेड (रािस्ट् ि जिभाग), कोल इस्ट् टेट, जसजिल लाईन्‍द स, नागपरु - 440001 (महाराष्र ) के कायाजलय म ेंदकया िा सकेगा। 4747 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] रटप् पण 2: पूिोक्त अजधजनयम की धारा 8 के उपबंधों की ओर ध् यान आकृष्ट दकया िाता ह,ै जिसमें जनम् नजलजखत उपबंध करना ह ैं:- “8. अिजन की बाबत् आपजत् तया.ं - (1) कोई व् यजक्त िो दकसी भूजम में, जिसकी बाबत् धारा 7 के अधीन अजधसूचना िारी की गई ह,ै जहतबद्ध ह,ै अजधसूचना के िारी दकए िान े से तीस दिन के भीतर सम् पूण ज भूजम या उसके दकसी भाग या ऐसी भूजम में या उस पर के दकन्‍द हीं अजधकारों का अिजन दकए िाने के बारे म ेंआपजि कर सकेगा । स्ट् पष्ट ीकरण.- इस धारा के अधीन यह आपजि नहीं मानी िाएगी, दक कोई व् यजक्त दकसी भूजम में कोयला उत् पाि के जलए स्ट् िय ं खनन संदियाएं करना चाहता ह ै और ऐसी संदियाएं केन्‍द रीय सरकार या दकसी अन्‍द य व् यजक्त को नहीं करनी चाजहए।

(2) उपधारा (1) के अधीन प्रत्येक आपजि सक्षम अजधकारी को जलजखत रूप म ें की िाएगी और सक्षम अजधकारी, आपजिकता ज को स्ट्िय ं सुने िान े या दकसी जिजध व्यिसायी द्वारा सुनिाई का अिसर िगे ा और ऐसी सभी आपजियों को सुनने के पश् चात और ऐसी अजतररक्त िांच, यदि कोई हो, करन े के पश् चात िो िह आिश्यक समझे, िह या तो धारा 7 की उपधारा (1) के अधीन अजधसूजचत भूजम के या ऐसी भूजम म ें उस पर के अजधकारों के संबंध म ें जिजभन्न ररपोटज या ऐसी भूजम के जिजभन्न टुकडों या ऐसी भूजम म ें या उस पर के अजधकारों के संबंध म ें केन्‍दरीय सरकार को आपजियों पर अपनी जसफाररिों और उसके द्वारा की गई कायजिाही के अजभलेख सजहत जिजभन्न ररपोटज उस सरकार को उसके जिजनश्चय के जलए िेगा ।

NOTIFICATION New Delhi, the 31st July, 2024 S.O. 3057(E).—Whereas by the notification of the Government of India in the Ministry of Coal number S.

O. 4120(E), dated the 19th September, 2023, issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), and published in the Gazette of India, Extraordinary Part II, Section 3, Sub-section (ii), dated the 19th September, 2023, the Central Government gave notice of its intention to prospect for coal in 145.74 hectares (approximately) or 360.12 acres

(approximately) of the land in the locality specified in the Schedule annexed to the said notification;

And whereas the Central Government is satisfied that coal is obtainable in a part of the said land specified in the Schedule appended to this notification;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 127.93 hectares

(approximately) or 316.12 acres (approximately) and all rights in or over the said land specified in the Schedule appended hereto;

Note 1: The plan bearing number C-I(E)/III/JJR/0624/1017, dated the 7th June, 2024, of the area covered by this notification may be inspected in the office of the Collector, District Yavatmal (Maharashtra) or in the office of the Coal Controller, Coal Controller Organisation, Scope Minar, 5th floor, Core-2, Laxmi Nagar, New Delhi-110092 or in the office of the General Manager, Western Coalfields Limited (Revenue Department), Coal Estate, Civil Lines, Nagpur, (Maharashtra)-440001.

Note 2: Attention is hereby invited to the provisions of section 8 of the aforesaid Act which provides as

follows:- “8. Objections to acquisition.- (1) Any person interested in any land in respect of which a notification under

section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or of any rights in or over such land.

Explanation.- It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person.

(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of proceedings held by him, for the decision of that Government.

(3) For the purpose of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act”.

Note 3: The Coal Controller, Coal Controller’s Organisation, Ministry of Coal, Scope Minar, 5th Floor, Core-2, Laxmi Nagar, Delhi -110092 has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S.O. 2519 dated the 27th May, 1983, published in the Gazette of India, Part II, Section 3, Sub-section (ii) dated the 11th June, 1983.
