24) की िारा 130 की उपिारा (1) और उपिारा (2) के खंड (क), खंड (ख), खंड (छ) और खंड (ज) द्वारा प्रित्त शक्ततयों का प्रयोग करते हुए, और वाणिज्य पोत पररवहन (पोत और पत्तन सुवविा सुरक्षा) ननयम, 2024 को उन बातों के ससवाय अधिक्ांत करते हुए, क्जन्हें ऐसे अधिक्मि से पहले ककया गया है या करने का लोप ककया गया है, ननम्नसलणखत ननयम बनाती है, अर्ाात:्-

1. संक्षिप्त नाम औि प्रािंभ. — (1) इन ननयमों का संक्षक्षप्त नाम वाणिज्य पोत पररवहन (पोत और पत्तन सुवविा सुरक्षा) ननयम, 2026 है।

2. लार्ू होना. –– जब तक स्पष्ट रूप से अन्यर्ा उपबंधित न ककया गया हो, ये ननयम ननम्नसलणखत की रक्षा और सुरक्षा से संबंधित मामलों पर लागू होंगे – (क) प्रत्येक भारतीय पोत क्जसमें मोबाइल ऑफशोर ड्रिसलगं इकाइयां और हाई-स्पीड क्ाफ्ट सक्म्मसलत हैं, जैसा कक सुरक्षा समझौते के ववननयमन XI-2/1 में पररभावित है, चाहे वह ककसी भी प्रकार का हो या उसका प्रचालन जो भी क्षेत्र में हो, चाहे वह कहीं भी हो, जो अनुसूची I में ववननदिाष्ट अपेक्षाओं को पूरा करता हो:

(ख) भारतीय पोत के सभन्न कोई भी पोत, जब ऐसा पोत ककसी भारतीय पत्तन या भारतीय अपतटीय सुवविा पर आता है, या भारतीय क्षेत्राधिकार के भीतर लंगर डाले हुए है; (ग) कोई भी भारतीय पत्तन सुवविा; और (घ) कोई भी कंपनी जो ऐसे ककसी भी पोत या पत्तन सुवविा, क्जस पर ये ननयम लागू होते हैं, की स्वामी है, या उसका प्रबंिन करती है।

3. परिभाषाएँ. — (1) इन ननयमों में, जब तक संिभ ा से अन्यर्ा अपेक्षक्षत न हो,— (क) “अधिननयम” से वाणिज्य पोत पररवहन अधिननयम, 2025 (2025 का 24) असभप्रेत है; (ख) "प्रशासन" से महाननिेशक, समुद्री प्रशासन असभप्रेत है;

(ग) "लेखा परीक्षा" से वस्तुपरक साक्ष्य प्राप्त करके व्यवक्स्र्त और स्वतंत्र सत्यापन की एक ववधि या प्रकक्या असभप्रेत है ताकक यह ननिााररत ककया जा सके कक पत्तन सुवविा संबंिी या पोत संबंिी सुरक्षा गनतववधियां अनुमोदित सुरक्षा योजना को ध्यान में रखत े हुए सुरक्षा समझौत े की लागू अपेक्षाओं का अनुपालन करती या नहीं;

(घ) ''कंपनी'' से अधिननयम की िारा 115 के खंड (क) के अिीन पररभावित कंपनी असभप्रेत है; (ड.) "कंपनी सुरक्षा अधिकारी" से ननयम 14 के उपननयम (1) के अिीन कंपनी द्वारा नामननदिाष्ट व्यक्तत असभप्रेत है; (च) "संवविाकारी सरकार" से ककसी िेश की सरकार असभप्रेत है जो सुरक्षा असभसमय से आबद्ि होने के सलए सहमत है;

(छ) ''नामननदिाष्ट प्राधिकारी'' से अधिननयम की िारा 13 की उपिारा (1) के अन्तगता गदित पत्तन सुरक्षा ब्यूरो असभप्रेत है; (ज) "अंतरााष्रीय पोत सुरक्षा प्रमािपत्र" से प्रशासन या उसके द्वारा अधिकृत व्यक्तत द्वारा इन ननयमों या अंतरााष्रीय पोत और पत्तन सुवविा सुरक्षा संदहता के अनुसार जारी ककया गया प्रमािपत्र असभप्रेत है;

(झ) "आईएसपीएस संदहता" स े सुरक्षा समझौत े के अिीन समय-समय पर यर्ा संशोधित, अंतरााष्रीय समुद्री संगिन द्वारा अपनाए गए अंतरााष्रीय पोत और पत्तन सुवविा सुरक्षा संदहता असभप्रेत है;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (झ) "समुद्री वाणिज्य ववभाग" से अधिननयम की िारा 11 के अन्तगता स्र्ावपत समुद्री वाणिज्य ववभाग असभप्रेत है;

(ञ) "पत्तन सुवविा सुरक्षा सलाहकार ससमनत" से ननयम 20 में ववननदिाष्ट ससमनत असभप्रेत है; (ट) "पत्तन सुवविा सुरक्षा मूल्यांकन" से ननयम 18 के अनुसार ककया गया पत्तन सुवविा सुरक्षा आकलन असभप्रेत है; (ि) "पत्तन सुवविा सुरक्षा अधिकारी" से ननयम 21 में ववननदिाष्ट अधिकारी असभप्रेत है;

(ड) "पत्तन सुवविा सुरक्षा योजना" से पत्तन सुवविा और पोतों, व्यक्ततयों, कागों, कागों पररवहन इकाइयों तर्ा पत्तन सुवविा के भीतर पोतों के भंडार को ककसी सुरक्षा घटना के जोणखमों से बचान े के सलए ड्रडजाइन ककए गए उपायों को लागू करना सुननक्चचत करने की योजना असभप्रेत है;

(ढ़) “मान्यता प्राप्त सुरक्षा संगिन” स े कोई भी संगिन, कंपनी, फम ा या व्यक्ततयों का समूह असभप्रेत है, क्जसे सुरक्षा से जुडे मामलों और पोत व पत्तन प्रचालन कायो की ववशेिज्ञता हो, और क्जस े केंद्रीय सरकार ने इन ननयमों के अंतगता अपेक्षक्षत आकलन, सत्यापन, मंजूरी या प्रमािन करने के सलए अधिकृत ककया हो;

(ि) "अनुसूची" से इन ननयमों के सार् संलग्न अनुसूची असभप्रेत है; (त) "सुरक्षा घटना" से ककसी पोत, क्जसमें मोबाइल अपतटीय ड्रिसलगं इकाई और उच्च गनत वाले यान, या पत्तन सुवविा या ककसी पोत और पत्तन इंटरफेस, या ककसी पोत-से-पोत गनतववधि सक्म्मसलतहै, की सुरक्षा के सलए खतरा पैिा करने वाली कोई संिेहास्पि पररक्स्र्नत असभप्रेत है;

(र्) "सुरक्षा स्तर" से उस जोणखम की ड्रडग्री की अहाता असभप्रेत है क्जससे सुरक्षा घटना का प्रयास ककया जा सकता है या घदटत हो सकती है; (ि) "सुरक्षा स्तर 1" से वह स्तर असभप्रेत है क्जसके सलए हर समय न्यूनतम उधचत बचाव सुरक्षा उपाय बनाए रखे जाएंगे;

(ि) "सुरक्षा स्तर 2" से वह स्तर असभप्रेत है क्जसके सलए सुरक्षा घटना के बढ़े हुए जोणखम के पररिामस्वरूप एक समयावधि के सलए उपयुतत अनतररतत संरक्षात्मक सरु क्षा उपायों को बनाए रखा जाएगा; (न) "सुरक्षा स्तर 3" से वह स्तर असभप्रेत है, क्जसके सलए उस सीसमत समय के सलए ववसशष्ट सुरक्षा उपायों को बनाए रखा जाएगा, जब सुरक्षा घटना संभाववत या आसन्न हो, हालांकक ववसशष्ट लक्ष्य की पहचान करना संभव नहीं हो सकता है;

(प) “पोत” से अधिननयम के खंड 3 के उपखंड (59) में पररभावित पोत से असभप्रेत है; (फ) "पोत सुरक्षा अधिकारी" पोत पर मौजूि वह व्यक्तत असभप्रेत है जो मास्टर के प्रनत उत्तरिायी है, क्जसे कंपनी द्वारा पोत की सुरक्षा के सलए उत्तरिायी नामननदिाष्ट ककया गया है, क्जसमें पोत4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] सुरक्षा योजना का कक्यान्वयन और रखरखाव, और कंपनी सुरक्षा अधिकारी तर्ा पत्तन सुवविा सुरक्षा अधिकाररयों के सार् संपका सक्म्मसलतहै;

(ब) "पोत सुरक्षा योजना" से पोत पर मौजूि व्यक्ततयों, माल, माल पररवहन इकाइयों, पोत के भंडार या पोत को सुरक्षा घटना के जोणखमों से बचाने के सलए तैयार ककए गए उपायों के अनुप्रयोग को सुननक्चचत करने के सलए ववकससत की गई योजना असभप्रेत है;

(भ) "प्रसशक्षि संस्र्ान" से प्रशासन द्वारा अनुमोदित संस्र्ान असभप्रेत है।

(2) उन शब्िों और पिों के, जो इन ननयमों में प्रयतु त हैं और पररभावित नहीं है ककंतु अधिननयम, या आईएसपीएस अर्वा सुरक्षा असभसमय में पररभावित हैं, वहीं अर् ा होंगे, जो उनके उनमें हैं।

4. सुििा के संबंि में उत्तिदानयत्व. — (1) नामननदिाष्ट प्राधिकारी अपने अधिकार क्षेत्र के भीतर प्रत्येक पत्तन सुवविा के सलए उधचत सुरक्षा स्तर ननिााररत करेगा और यह सुननक्चचत करेगा कक लागू सुरक्षा स्तर और उसमें ककसी भी पररवतना की जानकारी अववलंब संबंधित पत्तन सवु विाओं और पोतों को उसके अधिकार क्षेत्र में ककसी भी पत्तन में प्रवेश करने से पहले या उसके भीतर रहने के िौरान संप्रेवित की जाए।

(2) प्रशासन अपने ध्वज को फहराने के हकिार जहाजों के सलए उधचत सुरक्षा स्तर ननिााररत करेगा और ऐसे सुरक्षा स्तर के बारे में समय पर सूचना िेना सुननक्चचत करेगा तर्ा सुरक्षा स्तर में ककसी भी पररवतना को पररक्स्र्नतयों के अनुसार अद्यतन ककया जाएगा।

(3) उप-ननयम (1) तर्ा (2) में ववननदिाष्ट सुरक्षा स्तर का ननिाारि करते समय ननम्नसलणखत पर उधचत ध्यान दिया जाएगा- (क) खतरे की सूचना की ववचवसनीयता; (ख) ऐसी सूचना की पुक्ष्ट का स्तर; (ग) खतरे की ववसशष्टता या संननकटता; और (घ) ककसी सुरक्षा घटना के संभाववत पररिाम।

(4) सुरक्षा समझौते के ववननयम XI-2/3 और XI-2/7 के अध्यिीन रहते हुए, प्रशासन और नामननदिाष्ट प्राधिकारी, जैसी भी क्स्र्नत हो, सुरक्षा घटनाओं स े बचाव के सलए मागिा शान प्रिान करेंगे।

(5) नामननदिाष्ट प्राधिकारी ककसी मान्यताप्राप्त सुरक्षा संगिन को सुरक्षा समझौते के अध्याय XI-2 और आईएसपीएस संदहता के भाग क के अिीन ववननदिाष्ट सुरक्षा संबंिी कतव्ा यों, ननम्नसलणखत के ससवाय करने के सलए अधिकृत कर सकता है, जैसा वह उधचत समझे, ननम्नसलणखत अर्ाात:् - (क) पत्तन सुवविा सुरक्षा आकलन और पत्तन सुवविा सुरक्षा योजनाओं से संबंधित सुरक्षा- संवेिनशील सामग्री की सुरक्षा सुननक्चचत करना;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ख) पत्तन सुवविा सुरक्षा आकलन तर्ा पत्तन सुवविा सुरक्षा योजना और उसमें संशोिनों को मंजूरी िेना;

(ग) पत्तन सुवविा सुरक्षा अधिकारी को नामननदिाष्ट करने के सलए अपेक्षक्षत पत्तन सुवविाओं का ननिाारि करना;

(6) प्रशासन ननम्नसलणखत के सलए उत्तरिायी होगा— (क) पोत सुरक्षा आकलन तर्ा पोत सरु क्षा योजनाओं से संबंधित सुरक्षा-संवेिनशील सामग्री की सुरक्षा सुननक्चचत करना; (ख) सुरक्षा समझौते के ववननयमन XI-2/9 के अनुसार पोतों के संबंि में ननयंत्रि और अनुपालन उपाय करना;

(ग) ननयम 6 में यर्ा ववननदिाष्ट सुरक्षा की घोििा के सलए अपेक्षाओं को स्र्ावपत करना; (घ) ककसी भी सुरक्षा उल्लंघन और प्रसंगत शमन उपायों से संबंधित सूचना अंतरााष्रीय समुद्री संगिन को संप्रेवित करना और ऐसी सूचना जनता को उपलब्ि कराना; और (ड.) पोत के प्रचालन में रक्षा और सुरक्षा की अपेक्षाओं के बीच ककसी भी अंतर को िरू करना, ताकक सुरक्षा की अपेक्षा प्रभावी रहें, और जरूरी ननिेश जारी करना।

(7) प्रशासन तर्ा नामननदिाष्ट प्राधिकारी, जहां तक उधचत समझे जाएं, पोत सुरक्षा योजनाओं तर्ा पत्तन सुवविा सुरक्षा योजनाओं, क्जसमें संशोिन भी सक्म्मसलतहैं, की प्रभावशीलता का परीक्षि करेंगे।

5. पोत की सुििा के ललए मास्टि की शक्तत. - (1) कंपनी, चाटारर या ककसी अन्य व्यक्तत द्वारा मास्टर को ऐसा कोई ननिया लेने या ननष्पादित करने से बाधित नहीं ककया जाएगा, जो मास्टर के पेशेवर ननिया के अनुसार पोत की रक्षा और सुरक्षा बनाए रखन े के सलए आवचयक है, क्जसमें ककसी व्यक्तत (प्रशासन द्वारा ववधिवत अधिकृत लोगों के सभन्न) या उनके सामान को पहुंच से वंधचत करने और माल, कंटेनरों या अन्य बंि माल पररवहन इकाइयों को लोड करने से मना करने का अधिकार सक्म्मसलतहै।

(2) जहााँ पोत के प्रचालन के िौरान उसकी रक्षा और सुरक्षा के बीच कोई संघि ा उत्पन्न होता है, तो मास्टर- (क) पोत की सुरक्षा बनाए रखने के सलए आवचयक अपेक्षाओं को लागू करेगा; (ख) अस्र्ायी सुरक्षा उपाय लागू कर सकते हैं;

(ग) प्रशासन या उस संवविा करने वाली सरकार को सूधचत करेगा क्जसके पत्तन पर पोत चल रहा है या क्जसमें प्रवेश करने का इरािा है।

(3) उप-ननयम (2) के अन्तगता अपनाए गए कोई भी अस्र्ायी सुरक्षा उपाय, यर्ासंभव उच्चतम सीमा तक, ववद्यमान सुरक्षा स्तर के समानुपानतक होंग।े6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(4) उप-ननयम (2) के अन्तगात ऐसे मामलों की जानकारी समलने पर, प्रशासन, संघि ा को सुलझाने के सलए आवचयक किम उिाएगा तर्ा यह सुननक्चचत करेगा कक पुनराववृ त्त की संभावना न्यूनतम हो।

6. सुििा घोषणा. — (1) प्रशासन या नामननदिाष्ट अधिकारी, जैसी भी क्स्र्नत हो, यह ननिााररत करेगा कक पोत और पत्तन के बीच संपका या पोत-से-पोत गनतववधि से लोगों, संपवत्त या पयाावरि को होने वाले जोणखम को िेखते हुए सुरक्षा घोििा की कब अपेक्षक्षत है।

(2) कोई पोत ननम्नसलणखत पररक्स्र्नतयों में सुरक्षा घोििा का अनुरोि कर सकता है:–– (क) पोत, पत्तन सुवविा की तुलना में उच्च सुरक्षा स्तर पर काम कर रहा है, या कोई िसू रा पोत उसके सामने आ रहा है; या (ख) कनतपय अंतरराष्रीय समुद्री यात्राओं या उन यात्राओं पर ववसशष्ट पोतों को सक्म्मसलतकरते हुए सरकारों के बीच सुरक्षा घोििा पर कोई समझौता है; या (ग) पोत या पत्तन सुवविा से संबंधित कोई सुरक्षा खतरा या सुरक्षा घटना हुई है; या (घ) पोत ऐसे पत्तन पर है जहां अनुमोदित पत्तन सुवविा सुरक्षा योजना या उसके कायाान्वयन होना अपेक्षक्षत नहीं है; या (ड.) पोत, ककसी ऐसे िसू रे पोत के सार् पोत-से-पोत गनतववधियां कर रहा है क्जसके सलए स्वीकृत पोत सुरक्षा योजना या उसका कायाान्वयन अपेक्षक्षत नहीं है।

(3) सुरक्षा घोििा के ककसी भी अनुरोि को लागू पत्तन सुवविा या पोत द्वारा अनुसूची-III के अनुसार अंग्रेजी में स्वीकार ककया जाएगा।

(4) सुरक्षा की घोििा ननम्नसलणखत द्वारा पूरी की जाएगी – (क) पोत की ओर से मास्टर या पोत सुरक्षा अधिकारी द्वारा; और (ख) पत्तन सुवविा की ओर से पत्तन सुवविा सुरक्षा अधिकारी या, यदि नामननदिाष्ट प्राधिकारी अन्यर्ा ननिााररत करते है, तो तट पर सुरक्षा के सलए उत्तरिायी कोई अन्य ननकाय।

(5) सुरक्षा घोििा में उन सुरक्षा अपेक्षाओं को सक्म्मसलतककया जाएगा क्जन्हें पत्तन सुवविा और पोत के बीच या पोतों के बीच साझा ककया जा सकता है और उनमें से प्रत्येक की उत्तरिानयत्व का उल्लेख ककया जाएगा।

(6) प्रत्येक पोत, सुरक्षा घोििा का ररकॉड ा कम से कम तीन वि ा की अवधि के सलए रखेगा।

(7) सुरक्षा स्तर में ककसी पररवतना के सलए सुरक्षा की नई अर्वा संशोधित घोििा अपेक्षक्षत हो सकती है।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7

7. कंपननयों औि पोतों की उत्तिदानयत्व. — (1) कंपननयां, सुरक्षा समझौते के अध्याय XI-2 और आईएसपीएस संदहता के भाग ‘क’ की लागू अपेक्षाओं का अनुपालन करेंगी, तर्ा उतत संदहता के भाग ‘ख’ में दिए गए मागिा शान को ध्यान में रखेंगी।

(2) प्रत्येक पोत सुरक्षा समझौते के अध्याय XI-2 और आईएसपीएस संदहता के भाग ‘क’ की लागू अपेक्षाओं का अनुपालन करेगा, उतत संदहता के भाग ‘ख’ में दिए गए मागिा शना को ध्यान में रखेगा, और ऐसे अनुपालन को उतत संदहता के भाग ‘क’ के अनुसार सत्यावपत और प्रमाणित ककया जाएगा।

(3) ककसी संवविाकारी सरकार के क्षेत्र में ककसी पत्तन में प्रवेश करने से पहले या पत्तन में रहते हुए, पोत को उस संवविाकारी सरकार द्वारा ननिााररत सुरक्षा स्तर की अपेक्षाओं का अनुपालन करना होगा।

(4) पोत उच्च सुरक्षा स्तर पर ककसी भी पररवतना पर बबना ककसी िेरी के प्रनतकक्या िेंगे।

(5) जहां कोई पोत उप-ननयम (2) में ववननदिाष्ट अपेक्षाओं या प्रशासन द्वारा या उप-ननयम (3) के अंतगता ककसी अन्य संवविाकारी सरकार द्वारा ननिााररत सुरक्षा स्तर का अनुपालन करने में असमर् ा है, तो पोत ककसी भी पोत और पत्तन इंटरफेस को शुरू करने से पहले या पत्तन में प्रवेश करने से पहले, जो भी पहले हो, सक्षम प्राधिकारी को तिनुसार अधिसूधचत करेगा, ताकक सक्षम प्राधिकारी अपेक्षक्षत सुरक्षा स्तर को बनाए रखने के सलए आवचयक उपाय कर सकें।

(6) कंपनी यह सुननक्चचत करेगी कक मास्टर के पास पोत पर हर समय ऐसी सूचना उपलब्ि हो, क्जससे प्रशासन द्वारा अधिकृत अधिकारी यह पता लगा सकें कक- (क) चालक िल के सिस्यों या पोत के कारोबार के ससलससले में ककसी भी क्षमता में पोत पर कायरा त या ननयुतत ककसी अन्य व्यक्तत की ननयुक्तत के सलए उत्तरिायी व्यक्तत;

(ख) पोत के उपयोग का ननिाारि करने के सलए उत्तरिायी व्यक्तत; और (ग) ककसी भी चाटार पाटी के पक्षकार, क्जसके अंतगता पोत का उपयोग ककया जा रहा है।

(7) प्रत्येक कंपनी-- (क) यह सुननक्चचत करेगी कक पोत सुरक्षा योजना में मास्टर के अधिकार पर जोर िेने वाला एक स्पष्ट वववरि सक्म्मसलतहो; (ख) पोत सुरक्षा योजना में यह उपबंि करना कक मास्टर का पोत की सुरक्षा के संबंि में आवचयक ननिया लेने का सवोपरर प्राधिकार और उत्तरिानयत्व होगी और जहां आवचयक हो, वहा ं कंपनी, प्रशासन या ककसी संवविाकारी सरकार की सहायता लेने का अधिकार होगा;

(ग) कोई कम्पनी सुरक्षा अधिकारी नामननदिाष्ट करना; और (घ) यह सुननक्चचत करना कक कंपनी सुरक्षा अधिकारी, मास्टर और पोत सुरक्षा अधिकारी को सुरक्षा समझौते के अनुसार अपने कतव्ा यों को पूरा करने के सलए आवचयक सहायता िी जाए।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

8. मान्यता प्राप्त सुििा संर्ठन के कतव्ग य. — मान्यता प्राप्त सुरक्षा संगिन उन कतव्ा यों का पालन करेगा जो इन ननयमों के उद्िेचयों के सलए प्रशासन द्वारा ववननदिाष्ट ककया जाएं।

9. पोत की सुििा. — (1) प्रत्येक पोत, प्रशासन द्वारा ननिााररत सुरक्षा स्तरों पर प्रचासलत होगा।

(2) सुरक्षा स्तर 1 पर, हर पोत सुरक्षा से जुडी घटनाओं की पहचान करने और उन्हें रोकने के सलए उधचत उपाय लागू करेगा, क्जनमें ये उपाय सक्म्मसलतहैं— (क) पोत की सुरक्षा से जुडे सभी कायों को िीक से पूरा करना सुननक्चचत;

(ख) पोत पर आने-जाने को ननयंबत्रत करना; (ग) लोगों और उनके सामान के पोत पर चढ़ने को ननयंबत्रत करना; (घ) प्रनतबंधित क्षेत्रों की ननगरानी करना ताकक यह पतका ककया जा सके कक वहााँ केवल अधिकृत लोग ही जा सकें; (ड.) डेक क्षेत्रों और पोत के आस-पास के क्षेत्रों की ननगरानी करना;

(च) पोत में कागो और सामान को संभालने की िेखरेख करना; और (छ) यह सुननक्चचत करना कक सुरक्षा संचार तत्काल उपलब्ि हो।

(3) सुरक्षा स्तर 2 पर, प्रत्येक पोत, उप-ननयम (2) में ववननदिाष्ट प्रत्येक उपाय के सलए, आईएसपीएस संदहता के भाग ‘ख’ और प्रशासन द्वारा जारी दिशा-ननिेशों को ध्यान में रखते हुए, पोत सुरक्षा योजना में बताए गए अनतररतत सुरक्षा उपाय लागू करेगा।

(4) सुरक्षा स्तर 3 पर, हर पोत, उप-ननयम (2) में ववननदिाष्ट हर उपाय के सलए, आईएसपीएस संदहता के भाग ‘ख’ और सुरक्षा स्तर 3 को लागू करन े के सलए प्रशासन द्वारा जारी ननिेशों को ध्यान में रखते हुए, पोत सुरक्षा योजना में ववननदिाष्ट ववसशष्ट सुरक्षा उपाय लागू करेगा।

(5) जहां सुरक्षा स्तर बिले जाते हैं, तो पोत को ऐसे बिलाव से जुडे ननिेशों की पावती की पुक्ष्ट करनी होगी।

(6) पत्तन में प्रवेश करन े से पहले, पत्तन में रहन े के िौरान, या भारत के भूभगीय जलक्षेत्र में रहने के िौरान, जहााँ सुरक्षा स्तर 2 या सुरक्षा स्तर 3 लागू हो, पोत को— (क) लागू सुरक्षा स्तर से जुडे ननिेशों की पावती की पुक्ष्ट करनी होगी;

(ख) पत्तन सुवविा सुरक्षा अधिकारी को यह पुक्ष्ट करेगा कक पोत सुरक्षा योजना में ववननदिाष्ट उधचत उपाय और प्रकक्याएाँ शुरू कर िी गई हैं; और (ग) जहााँ सुरक्षा स्तर 3 लागू हो, वहााँ प्रशासन द्वारा जारी ककसी भी अनतररतत ननिेश का पालन करना होगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9

(7) यदि ककसी पोत को इस ननयम के अंतगता उपाय लागू करने में कोई कदिनाई आती है, तो पोत सुरक्षा अधिकारी तुरंत इस मामले की सूचना पत्तन सुवविा सुरक्षा अधिकारी को िेगा, और िोनों अधिकारी उधचत कारावाई ननिााररत करने के सलए आपस में संपका और समन्वय करेंगे।

(8) जहां कोई पोत ककसी ऐसे पत्तन पर उस स्तर से उंचें स्तर पर प्रचालन कर रहा है जो उससे अधिक है जहां उसे प्रवेश करना है या क्जसमें वह पहले से अवक्स्र्त है, या प्रशासन ने ऐसा करने को कहां है, तो पोत को बबना ककसी िेरी के प्रशासन और पत्तन सुवविा सुरक्षा अधिकारी को इस ऊाँ चे सुरक्षा स्तर के बारे में बताना होगा:

परन्तु यह कक पोत का सुरक्षा अधिकारी, पत्तन सवु विा सुरक्षा अधिकारी के सार् तालमेल बबिाए और जरूरी अनतररतत उपाय करेगा।

(9) जहां प्रशासन को ककसी अन्य संवविाकारी सरकार के पत्तन में ककसी भारतीय पोत से सुरक्षा स्तर 2 या सुरक्षा स्तर 3 पर प्रचालन करने की अपेक्षा है, तो वह बबना िेरी के उस राज्य की सरकार को तिनुसार सूधचत करेगा।

(10) जहां प्रशासन भारत के भूभागीय जल क्षेत्र में प्रचालन करने वाले पोतों या ऐसे जल में प्रवेश करने का इरािा रखने वाले पोतों के सलए सुरक्षा स्तर ननिााररत करता है, वह ऐसे पोतों को लागू सुरक्षा स्तर की जानकारी िेगा और- (क) उन्हें सतकाता बनाए रखने की सलाह िेगा और उनके ध्यान में आने वाली ककसी भी सूचना, जो क्षेत्र में समुद्री सुरक्षा को प्रभाववत कर सकती है, की प्रशासन और ककसी नजिीकी तटीय राज्य को तुरंत ररपोटा करेगा; और (ख) उन्हें ककसी सभी सुरक्षा उपायों के बारे में सलाह िेगा क्जन्हें उन्हें लागू करना है और, जहा ाँ उधचत हो, पहचाने गए खतरे से बचाने के सलए प्रशासन द्वारा उिाए गए उपायों के बारे में बताएगा।

10. पोत सुििा आकलन. — (1) कंपनी सुरक्षा अधिकारी यह सुननक्चचत करेगा कक कंपनी के बेडे के प्रत्येक पोत के सलए पोत की सुरक्षा का आकलन करने के सलए उपयुतत कौशल वाले व्यक्ततयों द्वारा पोत सुरक्षा आकलन ककया जाए।

(2) कोई मान्यताप्राप्त सुरक्षा संगिन ककसी ववसशष्ट पोत का पोत सुरक्षा आकलन कर सकता है।

(3) पोत सुरक्षा आकलन में कम से कम ननम्नसलणखत तत्वों का सत्यापन करने के सलए घटनास्र्ल पर सुरक्षा सवेक्षि सक्म्मसलतहोगा, अर्ाात: - (क) ववद्यमान सुरक्षा उपायों, प्रकक्याओं और पररचालनों की पहचान; (ख) पोत पर मुख्य प्रचालनों की पहचान और मूल्यांकन, क्जनकी सुरक्षा करना महत्वपूि ा है;

(ग) पोत पर होन े वाले मख्ु य प्रचालन कायों को सभं ाववत खतरों और उनके होने की संभावना की पहचान, ताकक सुरक्षा उपाय स्र्ावपत ककए जा सकें और उन्हें प्रार्समकता िी जा सके; और10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (घ) कमजोररयों की पहचान, क्जसमें अवसंरचना, नीनतयों और प्रकक्याओ ं में मानवीय पहलू भी सक्म्मसलतहैं।

(4) पोत सुरक्षा आकलन आईएसपीएस संदहता के भाग ‘ख’ के उपबंिों को ध्यान में रखने के पचचात ् तैयार ककया जाएगा।

(5) पोत को सेवा में लगाने से पहले प्रारंसभक पोत सुरक्षा आकलन ककया जाएगा।

(6) पोत की सुरक्षा का आकलन तब ककया जाएगा जब प्रशासन इसे जरूरी समझे।

(7) पोत सुरक्षा आकलन का कंपनी द्वारा सलणखत िस्तावेज तैयार ककया जाएगा, उसकी समीक्षा, स्वीकृनत की जाएगी और उसे बनाए रखा जाएगा।

11. पोत सुििा योजना. — (1) प्रत्येक पोत पर प्रशासन द्वारा अनुमोदित एक पोत सुरक्षा योजना होगी, क्जसमें इन ननयमों और आईएसपीएस संदहता में यर्ा उपबंधित सुरक्षा स्तर 1, 2 और 3 पर लागू सुरक्षा उपाय उपलब्ि होंगे।

(2) पोत सुरक्षा योजना या उसमें ककसी संशोिन की समीक्षा ऐसे मान्यता प्राप्त सुरक्षा संगिन द्वारा की जाएगी जो पोत सुरक्षा आकलन, पोत सुरक्षा योजना या समीक्षा के अंतगता संशोिन को तैयार करने में सक्म्मसलतनहीं र्ा।

(3) पोत सुरक्षा योजना को आईएसपीएस संदहता के भाग ‘ख’ में दिए गए मागिा शना को ध्यान में रखत े हुए तैयार और ववकससत ककया जाएगा और इस े अंग्रेजी तर्ा पोत की कामकाज की भािा में सलखा जाएगा।

(4) पोत सुरक्षा योजना में ननम्नसलणखत सक्म्मसलतहोंगे, अर्ाात:् - (क) हधर्यारों, खतरनाक पिार्ों और ऐसे उपकरिों, क्जनका उद्िेचय लोगों, पोतों और पत्तनों के ववरूद्व उपयोग करना है और क्जन्हें पोत पर ले जाने का अधिकार नहीं है, को रोकने के सलए तैयार ककए गए उपाय;

(ख) प्रनतबंधित क्षेत्रों की पहचान और अनधिकृत पहुंच की रोकर्ाम के उपाय; (ग) पोत तक अनधिकृत पहुंच की रोकर्ाम के उपाय; (घ) सुरक्षा खतरों या सुरक्षा उल्लंघनों का जवाब िेने के सलए प्रकक्याएाँ, क्जनमें पोत या पोत और पत्तन इंटरफेस के महत्वपूि ा प्रचालन को बनाए रखने के उपबंि सक्म्मसलतहैं;

(ड.) सुरक्षा स्तर 3 पर प्रशासन द्वारा दिए गए ककसी भी सुरक्षा ननिेश पर प्रनतकक्या िेने की प्रकक्याएं; (च) सुरक्षा खतरों या सुरक्षा उल्लंघनों की क्स्र्नत में ननकासी की प्रकक्या (छ) सुरक्षा उत्तरिानयत्व सौंपे गए पोत पर तैनात कासमका ों तर्ा सुरक्षा पहलुओं के संबंि में पोत[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 पर तैनात अन्य कासमका ों के कतव्ा य;

(ज) अनुसूची III के अनुसार सुरक्षा गनतववधियों की लेखापरीक्षा के सलए प्रकक्या; (झ) पोत सुरक्षा योजना से संबद्ि प्रसशक्षि, ड्रिल और अभ्यास के सलए प्रकक्याएाँ; (ञ) पत्तन सुवविा सुरक्षा गनतववधियों के सार् इंटरफेस करने की प्रकक्या;

(ट) पोत सुरक्षा योजना की आवधिक समीक्षा और उसे अद्यतन करने की प्रकक्या; (ि) सुरक्षा घटनाओं की ररपोदटिंग के सलए प्रकक्या; (ड) पोत सुरक्षा अधिकारी की पहचान; (ढ़) कंपनी सुरक्षा अधिकारी की पहचान और चौबीसों घंटे संपका करने का ब्यौरा;

(ि) अनुसूची II के अनुसार बोड ा पर उपलब्ि कराए गए ककसी भी सुरक्षा उपकरि के ननरीक्षि, परीक्षि, अंशांकन और रखरखाव को सुननक्चचत करने की प्रकक्या; (त) बोड ा पर उपलब्ि कराए गए ककसी भी सुरक्षा उपकरि के परीक्षि या अंशांकन की आववृ त्त, यदि कोई हो;

(र्) उन स्र्ानों की पहचान जहां पोत सुरक्षा चेतावनी प्रिाली सकक्यि बबिं ु प्रिान ककए गए हैं; और (ि) पोत सुरक्षा चेतावनी प्रिाली के उपयोग पर प्रकक्याएं, ननिेश और मागिा शना , क्जसमें गलत चेतावनी को सीसमत करने के सलए परीक्षि, एक्तटवेशन, डीएक्तटवेशन और रीसेदटगं सक्म्मसलतहै।

(5) पोत सुरक्षा योजना अर्वा पूव ा में अनुमोदित योजना में संशोिनों के अनुमोिन हेतु प्रस्तुनतकरि के सार् सुरक्षा आकलन भी संलग्न ककया जाएगा क्जसके आिार पर योजना अर्वा संशोिन ववकससत ककए गए हैं।

(6) पोत सुरक्षा योजना में ववननदिाष्ट सुरक्षा गनतववधियों की आंतररक लेखा परीक्षा करने वाले, या ऐसी योजना के कायाान्वयन का आकलन करने वाले कासमका , लेखा परीक्षा की जा रही गनतववधियों से अलग होंगे, जब तक कक यह कंपनी या पोत के आकार और प्रकृनत के कारि अव्यवहाररक न हो।

(7) ककसी स्वीकृत पोत सुरक्षा योजना या ककसी स्वीकृत योजना में ववननदिाष्ट ककसी भी सुरक्षा उपकरि में कोई भी पररवतना तब तक लागू नहीं ककया जाएगा जब तक कक पोत सुरक्षा योजना में सुसंगत संशोिनों को प्रशासन द्वारा अनुमोदित नहीं ककया जाता है, और ऐसे कोई भी पररवतना सुरक्षा समझौत े और आईएसपीएस संदहता में ववननदिाष्ट उपायों के समान ही प्रभावी होंगे।

(8) प्रशासन द्वारा पोत सुरक्षा योजना या सुरक्षा उपकरि में अनुमोदित पररवतना ों को उस रीनत स े प्रलेणखत ककया जाएगा जो स्पष्ट रूप से ऐसी स्वीकृनत को िशााता हो क्जसे पोत पर उपलब्ि कराया जाएगा और इसे अंतरााष्रीय पोत सुरक्षा प्रमाि पत्र या अंतररम पोत सुरक्षा प्रमाि पत्र के सार् प्रस्तुत ककया जाएगा।

(9) पोत सुरक्षा योजना को इलैतरॉननक प्रारूप में रखा जा सकेगा और इसे अनधिकृत पहुंच, ववलोपन,12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] नष्ट होने या संशोिन से सुरक्षक्षत रखा जाएगा।

(10) पोत सुरक्षा योजना के असभलेख को अनधिकृत पहुंच या प्रकटीकरि से सुरक्षक्षत रखा जाएगा।

(11) जहां प्रशासन द्वारा ववधिवत अधिकृत अधिकारी के पास यह मानने के सलए उधचत आिार हो कक कोई पोत सुरक्षा समझौते के अध्याय XI-2 या आईएसपीएस संदहता के भाग ‘क’ की अपेक्षाओं का अनुपालन नहीं करता है, और यह कक इस तरह के गैर-अनुपालन को सत्यावपत करने या सुिारने का एकमात्र सािन पोत सुरक्षा योजना के सुसंगत उपबंिों की समीक्षा करना है, अधिकारी को संवविाकारी सरकार या संबंधित पोत के मास्टर की पूव ा सहमनत से, पोत सुरक्षा योजना के ऐसे दहस्से तक सीसमत पहुंच िी जा सकती है, जो गैर-अनुपालन को सत्यावपत करने या सुिारने के प्रयोजन के सलए आवचयक है:

परन्तु यह कक उप-ननयम (5) के खंड (ख), (घ), (ड), (छ), (ि), (र्) और (ि) से संबंधित पोत सुरक्षा योजना के उपबंि- (क) गोपनीय जानकारी होंगे; और (ख) ये ननरीक्षि के अध्यिीन नहीं होगा, जब तक कक संवविाकारी सरकार द्वारा अन्यर्ा सहमनत न िी जाए।

12. पोत सुििा चेतावनी प्रणाली. — (1) भारत में रक्जस्रीकृत ननम्नसलणखत पोतों में पोत सुरक्षा चेतावनी प्रिाली स्र्ावपत की जाएगी, अर्ाात:- (क) 1 जुलाई, 2004 को या उसके पचचात ् ननसमात पोत; (ख) 1 जुलाई, 2004 स े पहले बने यात्री पोत क्जनमें तेज गनत वाले यात्री यान भी सक्म्मसलतहैं), और जो यह प्रिाली 1 जुलाई, 2004 के पचचात ् रेड्रडयो संस्र्ापन के पहले सवेक्षि से पहले लगाया जाना चादहए;

(ग) 500 सकल टन भार और उससे अधिक के तेल टैंकर, रासायननक टैंकर, गैस वाहक, र्ोक वाहक और मालवाहक हाई स्पीड सशल्प जो 1 जुलाई, 2004 से पहले ननसमता हों, और 1 जुलाई 2004 के पचचात ् रेड्रडयो स्र्ापना के पहले सवेक्षि के पचचात ् न बने हों; और (घ) 500 टन के सकल भार या उससे ज़्यािा वजन वाले अन्य कागो पोत और मोबाइल ऑफ़शोर ड्रिसलगं यूननट जो 1 जुलाई, 2004 से पहले बने हों, और जो प्रिाली 1 जुलाई, 2006 के पचचात ् रेड्रडयो इंस्टॉलेशन के पहले सवे से पहले उपयोग में लाया गया हो।

(2) जब पोत सुरक्षा चेतावनी प्रिाली चालू ककया जाएगा, तो यह — (क) संबंधित कंपनी और प्रशासन द्वारा नामननदिाष्ट केंद्र को पोत से तट तक सुरक्षा चेतावनी भेजेगा, क्जससे पोत और उसकी अवक्स्र्नत की पहचान हो सकेगी और यह पता चलेगा कक पोत की सुरक्षा खतरे में है या उसमें कोई कमी हुई है;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 (ख) ककसी भी अन्य पोत को पोत सुरक्षा चेतावनी नहीं भेजना;

(ग) पोत पर कोई भी अलाम ा नहीं बजाएगा; और (ग) तब तक सुरक्षा चेतावनी जारी रखेगा जब तक इसे बंि या कफर से िीक न रखा जाए।

(3) पोत सुरक्षा चेतावनी प्रिाली- (क) नौचालन बिज से तर्ा कम से कम एक अन्य स्र्ान से सकक्य की जा सकने में सक्षम होगी तर्ा पावर बैकअप के सार् एक सुरक्षक्षत कक्ष में कफट की जाएगी; और (ख) अंतरााष्रीय समुद्री संगिन द्वारा अपनाए गए ननष्पािन मानक से कमतर न हों।

(4) पोत सुरक्षा चेतावनी प्रिाली सकक्यि बबिं ओु ं को इस प्रकार ननिााररत ककया जाएगा ताकक पोत सुरक्षा चेतावनी के अनजाने में सकक्य होने से रोका जा सके।

(5) जब ककसी भारतीय रक्जस्रीकृत पोत से सरु क्षा की क्स्र्नत की चेतावनी प्राप्त होती है, तो प्रशासन ऐसे चेतावनी पर कारावाई करने के सलए पोत स्वामी या कंपनी के सुरक्षा अधिकारी और सुरक्षा एजेंसी से संपका करेगा।

(6) भारतीय पोत से सुरक्षा चेतावनी की जानकारी समलने पर, प्रशासन द्वारा ननिााररत केन्द्र – यदि जलयान भारत के बाहर है - उन तटीय राज्यों को सूधचत करेगा क्जनके आस-पास संबंधित पोत चल रहा है।

13. अलभलेख. — (1) पोत सुरक्षा योजना में अंतववष्ा ट ननम्नसलणखत कायका लापों के असभलेख को कम से कम तीन वि ा की अवधि या, जो प्रशासन द्वारा सुरक्षा असभसमय को ध्यान में रखते हुए ववववननदिाष्ट की जाए के सलए पोत पर रखा जाएगा, अर्ाात:्– (क) प्रसशक्षि, ड्रिल और अभ्यास;

(ख) सुरक्षा से जुडे खतरे और सुरक्षा से जुडी घटनाएं; (ग) सुरक्षा भंग; (घ) सुरक्षा स्तर में पररवतना ; (ड.) पोत की प्रत्यक्ष सुरक्षा से संबंधित संचार, जैसे पोत के सलए या पत्तन सुवविाओं के सलए ववसशष्ट खतरे जहां पोत है, या रहा है;

(च) सुरक्षा कायका लापों की आंतररक लेखा परीक्षा और समीक्षा; (छ) पोत सुरक्षा ननिाारि की आवधिक समीक्षा; (ज) पोत सुरक्षा योजना की आवधिक समीक्षा; (झ) योजना में ककसी भी संशोिन का कायाान्वयन; (ञ) सुरक्षा उपस्कर का रखरखाव, अंशांकन और परीक्षि, यदि कोई हो; और14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ट) पोत सुरक्षा चेतावनी प्रिाली का परीक्षि।

(2) उपननयम (1) में ववववननदिाष्ट असभलेख अंग्रेजी तर्ा पोत की कामकाज की भािा में बनाए रखे जाएंगे।

(3) उपननयम (1) में ववववननदिाष्ट असभलेखों को इलैतरॉननक रूपवविान में रखा जा सकेगा और उन्हें अप्राधिकृत पहुंच, ववलोपन, नष्ट करने या संशोिन को रोकने के सलए प्रकक्याओं द्वारा संरक्षक्षत ककया जाएगा।

(4) उपननयम (1) में ववववननदिाष्ट असभलेखों को अप्राधिकृत पहुंच या प्रकटीकरि से संरक्षक्षत ककया जाएगा।

14. कंपनी सुििा अधिकािी. — (1) प्रत्येक कंपनी एक या एक स े अधिक कंपनी सुरक्षा अधिकाररयों को नामववननदिाष्ट करेगी जो कंपनी द्वारा प्रचासलत पोतों की संख्या या प्रकार के आिार पर एक या एक से अधिक पोतों के सलए कंपनी सुरक्षा अधिकारी के रूप में काय ा कर सकें गे:

(2) जहां कंपनी सुरक्षा अधिकारी एक या एक से अधिक पोतों के सलए कंपनी सुरक्षा अधिकारी के रूप में काय ा करता है, तो यह स्पष्ट रूप से धचक्न्हत ककया जाएगा कक कंपनी सुरक्षा अधिकारी ककस पोत के सलए उत्तरिायी होगा।

(3) कंपनी सुरक्षा अधिकारी के पास ननम्नसलणखत न्यूनतम अहाताएं होंगी, अर्ाात:्- (क) 500 सकल टन भार से अधिक के पोत वाली कंपनी के सलए वाणिज्य समुद्री पष्ृ िभूसम वाले प्रशासन द्वारा जारी प्रबंिन स्तर सक्षमता प्रमािपत्र (वविेश गमन); और (ख) ककसी प्रसशक्षि संस्र्ान से कंपनी सुरक्षा अधिकारी प्रमाि-पत्र:

परन्तु यह कक, 500 सकल टनभार से कम वजन वाले पोतों वाली कंपनी के मामले में, कंपनी सुरक्षा अधिकारी के पास प्रशासन द्वारा जारी प्रचालन स्तर सक्षमता प्रमाि-पत्र (वविेश गमन) के सार् वाणिज्य पोतों पर नौकायन का अनुभव हो और उसके पास ककसी प्रसशक्षि संस्र्ान से कंपनी सुरक्षा अधिकारी प्रमाि-पत्र हो।

(4) कंपनी सुरक्षा अधिकारी ननम्नसलणखत कतव्ा यों का पालन करेगा, अर्ाात:् - (क) उधचत सुरक्षा ननिाारि और अन्य सुसंगत जानकारी का उपयोग करके पोत को समलने वाले संभाववत खतरों के स्तर के बारे में सलाह िेना; (ख) यह सुननक्चचत करना कक पोत सुरक्षा ननिाारि ककया जाए;

(ग) पोत सुरक्षा योजना का ववकास, अनुमोिन के सलए प्रस्तुत करना, कायाान्वयन और रखरखाव सुननक्चचत करना तर्ा इसे व्यक्ततगत पोत पर ले जाना; (घ) यह सुननक्चचत करना कक पोत सुरक्षा योजना को कासमका ों को िीक करने और व्यक्ततगत पोत की सुरक्षा अपेक्षाओं को पूरा करने के सलए उधचत रूप से संशोधित ककया गया है;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 (ड.) सुरक्षा कायका लापों की आंतररक लेखा परीक्षा और समीक्षा की व्यवस्र्ा करना;

(च) प्रशासन या मान्यता प्राप्त सुरक्षा संगिन द्वारा पोत के प्रारंसभक और पचचात्वती सत्यापन की व्यवस्र्ा करना; (छ) यह सुननक्चचत करना कक आंतररक लेखा परीक्षा, आवधिक समीक्षा, सुरक्षा ननरीक्षि और अनुपालन के सत्यापन के िौरान धचक्न्हत कासमका ों और गैर-अनुरूपताओ ं को तुरंत िीक ककया जाए और उनसे ननपटा जाए;

(ज) सुरक्षा जागरूकता और सतकाता बढ़ाना; (झ) पोत की सुरक्षा के सलए उत्तरिायी कासमका ों के सलए प्रभावी प्रसशक्षि सुननक्चचत करना; (ञ) पोत सुरक्षा अधिकारी और पत्तन सुवविा सुरक्षा अधिकाररयों के बीच प्रभावी संचार और सहयोग सुननक्चचत करना;

(ट) सुरक्षा अपेक्षाओं और संरक्षा अपेक्षाओं के बीच ननरंतरता सुननक्चचत करना; और (ि) यह सुननक्चचत करना कक ककसी पोत ववशेि या पोत के समूह के सलए अनुमोदित ककए गए ककसी भी वैकक्ल्पक या समतुल्य व्यवस्र्ा को कायााक्न्वत ककया जाए और बनाए रखा जाए।

15. पोत सुििा अधिकािी. — (1) ककसी प्रसशक्षि संस्र्ान से पोत सुरक्षा अधिकारी प्रमाि-पत्र िारक पोत के प्रबंिन स्तर के अधिकारी को कंपनी द्वारा पोत का पोत सरु क्षा अधिकारी नामववननदिाष्ट ककया जाएगा।

(2) पोत सुरक्षा अधिकारी ननम्नसलणखत कतव्ा यों का पालन करेगा, क्जसमें ससभसलत हैं – (क) यह सुननक्चचत करने के सलए कक समुधचत सुरक्षा उपाय बनाए रखे गए हैं, पोत का ननयसमत सुरक्षा ननरीक्षि करना; (ख) पोत सुरक्षा योजना के कायाान्वयन और संशोिन को बनाए रखना तर्ा पयवा ेक्षि करना;

(ग) पोतों में स्र्ोरा भंडार की संभाल के सुरक्षा पहलुओं का पोत पर मौजूि अन्य कासमका ों तर्ा सुसंगत पत्तन सुवविा सुरक्षा अधिकाररयों के सार् समन्वय करना; (घ) पोत सुरक्षा योजना में उपांतरि का प्रस्ताव करना;

(ड.) आंतररक लेखा परीक्षा, आवधिक समीक्षा, सुरक्षा ननरीक्षि और अनुपालन के सत्यापन और ककसी भी सुिारात्मक कारावाई को कायााक्न्वत करने के िौरान पहचानी गई ककसी भी कमी और गैर-अनुरूपता के बारे में कंपनी सुरक्षा अधिकारी को ररपोटा करना;

(च) पोत पर सुरक्षा जागरूकता और सतकाता बढ़ाना; (छ) यह सुननक्चचत करना कक पोत पर सवार कासमका ों को उधचत प्रसशक्षि प्रिान ककया गया है; (ज) सभी सुरक्षा घटनाओं की ररपोदटिंग;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (झ) कंपनी सुरक्षा अधिकारी और पत्तन सुवविा सुरक्षा अधिकारी के सार् पोत सुरक्षा योजना के कायाान्वयन का समन्वय करना; और (ञ) यह सुननक्चचत करना कक सुरक्षा उपस्कर, यदि कोई हों, को सही ढंग से चलाया, परीक्षि, अंशांकन और बनाए रखा जाए।

16. पोत सुििा पि प्रलशिण, ड्रिल औि अभ्यास. — (1) ववसशष्ट सुरक्षा कतव्ा य और उत्तरिानयत्व ननभाने वाले पोत पर तैनात कासमका ों के पास आईएसपीएस संदहता के भाग ‘ख’ में दिए गए मागिा शना को ध्यान में रखते हुए, उन्हें सौंपे गए कतव्ा यों को ननभाने के सलए पयााप्त ज्ञान और क्षमता होनी चादहए।

(2) पोत सुरक्षा योजना के प्रभावी कायाान्वयन को सुननक्चचत करने के सलए, पोत के प्रकार, पोत कासमका ों के पररवतना , कॉसलगं पत्तन सुवविाओं और आईएसपीएस संदहता के भाग ‘ख’ में दिए गए मागिा शना सदहत अन्य सुसंगत पररक्स्र्नतयों को ध्यान में रखते हुए हर तीन मास के अंतराल में कम से कम एक बार अभ्यास ककया जाएगा।

(3) कंपनी सुरक्षा अधिकारी आईएसपीएस संदहता के भाग ‘ख’ में दिए गए मागिा शना को ध्यान में रखते हुए उधचत अंतराल पर अभ्यास में भाग लेकर पोत सुरक्षा योजनाओं के प्रभावी समन्वय और कायाान्वयन को सुननक्चचत करेगा।

17. पत्तन सुवविा सुििा. — (1) पत्तन सुवविा, नामववननदिाष्ट प्राधिकारी द्वारा ननिााररत सुरक्षा स्तरों पर काय ा करेगी।

(2) सुरक्षा उपायों और प्रकक्याओं को पत्तन सुवविा पर ऐसी रीनत में लागू ककया जाएगा ताकक याबत्रयों, पोत कासमका ों, आगंतुकों, स्र्ोरा और सेवाओं को कम से कम व्यविान हो।

(3) सुरक्षा घटनाओं की पहचान करने और उनके ववरूद्ि ननवारक उपाय करने के सलए तर्ा आईएसपीएस संदहता के भाग ‘ख’ में दिए गए मागिा शना को ध्यान में रखत े हुए, सभी पत्तन सुवविाओं में सुरक्षा स्तर 1 पर उधचत उपाय ककए जाएंगे, क्जनमें सक्म्मसलत हैं – (क) सभी पत्तन सुवविा सुरक्षा कतव्ा यों का पालन सुननक्चचत करना;

(ख) पत्तन सुवविा तक पहुंच को ननयंबत्रत करना; (ग) लंगर डालने और बधर्गिं क्षेत्रों सदहत पत्तन सुवविा की मानीटरी; (घ) ननबधिं ित क्षेत्रों की मानीटरी करना ताकक यह सुननक्चचत ककया जा सके कक केवल प्राधिकृत व्यक्ततयों की ही पहुंच हो;

(ड.) स्र्ोरा की चढ़ाई उतराई का पयवा ेक्षि करना; (च) पोत में भंडार की चढ़ाई उतराई का पयवा ेक्षि करना; और (छ) यह सुननक्चचत करना कक सुरक्षा संचार तत्काल से उपलब्ि हो।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 17

(4) सुरक्षा स्तर 1 के सलए ववववननदिाष्ट सुरक्षा उपायों के अनतररतत, पत्तन सुवविा सुरक्षा योजना में ववववननदिाष्ट अनतररतत सुरक्षात्मक उपायों को आईएसपीएस संदहता के भाग ‘ख’ में दिए गए मागािशना को ध्यान में रखते हुए सुरक्षा स्तर 2 पर कायााक्न्वत ककया जाएगा।

(5) पत्तन सुवविा सुरक्षा योजना में ववववननदिाष्ट ववसशष्ट सुरक्षात्मक उपायों को सुरक्षा स्तर 1 और स्तर 2 के सलए ववववननदिाष्ट सुरक्षा उपायों के अनतररतत सुरक्षा स्तर 3 पर कायााक्न्वत ककया जाएगा, आईएसपीएस संदहता के भाग ‘ख’ में दिए गए मागिा शना को ध्यान में रखते हुए और पत्तन सुवविा, नामववननदिाष्ट प्राधिकारी द्वारा दिए गए ककसी भी सुरक्षा अनुिेश का जवाब िेगी।

(6) प्रत्येक पत्तन में एक स्वतंत्र, अदहता और प्रसशक्षक्षत पत्तन सुवविा सुरक्षा अधिकारी होगा।

(7) जहां पोत को – (क) सुरक्षा असभसमय की अपेक्षाओं का अनुपालन करने या पोत सुरक्षा योजना में ववववननदिाष्ट उधचत उपायों और प्रकक्याओं के कायाान्वयन में कदिनाई आती है और सुरक्षा स्तर 3 के मामले में, नामववननदिाष्ट प्राधिकारी द्वारा दिए गए ककसी सुरक्षा अनुिेशों का पालन करने में कदिनाई आती है, तो पत्तन सुवविा सुरक्षा अधिकारी और पोत सुरक्षा अधिकारी समन्वय करेंगे और उधचत कारावाई करेंगे;

(ख) यदि सुरक्षा का स्तर पत्तन सुवविा के स्तर से ज़्यािा है, तो पत्तन सुवविा सुरक्षा अधिकारी को इस मामले की जानकारी नामववननदिाष्ट अधिकारी को िेनी होगी और पोत सुरक्षा अधिकारी के समन्वय में काम करना होगा और उधचत किम, यदि आवचयक हो, उिाने होंगे।

18. पत्तन सुवविा सुििा ननिागिण. — (1) सभी भारतीय पत्तन सुवविाओं के सलए पत्तन सुवविा सुरक्षा ननिाारि नामववननदिाष्ट प्राधिकारी या मान्यता प्राप्त सुरक्षा संगिन द्वारा ककया जाएगा: परन्तु कक जहां पत्तन सुवविा सुरक्षा ननिाारि मान्यता प्राप्त सरु क्षा संगिन द्वारा ककया जाता है, ऐसे पत्तन सुवविा सुरक्षा ननिाारि की नामववननदिाष्ट प्राधिकारी द्वारा आईएसपीएस संदहता के अनुपालन में समीक्षा की जाएगी और उसे अनुमोदित ककया जाएगा।

(2) नामववननदिाष्ट प्राधिकारी या मान्यता प्राप्त सुरक्षा संगिन, पत्तन सुवविा सुरक्षा आकलन करने के सलए ककसी सवेक्षक को नामववननदिाष्ट कर सकता है।

(3) ननिाारि करने वाले व्यक्ततयों के पास आईएसपीएस संदहता के भाग ‘ख’ में दिए गए मागिा शना को ध्यान में रखते हुए, पत्तन सुवविा की सुरक्षा का ननिाारि करने के सलए उपयुतत कौशल होना चादहए।

(4) पत्तन सुवविा में पररवनतता खतरों को ध्यान में रखते हुए पत्तन सुवविा सुरक्षा ननिाारि की समय- समय पर समीक्षा की जाएगी और उसे अद्यतन ककया जाएगा और पत्तन सुवविा में बडे पररवतना होन े पर इसकी समीक्षा की जाएगी और उसे अद्यतन ककया जाएगा।18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(5) पत्तन सुवविा सुरक्षा ननिाारि में ननम्नसलणखत सक्म्मसलत होगा- (क) संरक्षि की अपेक्षा वाली महत्वपूि ा आक्स्तयों और अवसंरचना की पहचान और मूल्यांकन; (ख) आक्स्तयों तर्ा अवसंरचना के सलए संभाववत खतरों की पहचान तर्ा उनके घदटत होने की संभावना;

(ग) बचाव के उपायों और प्रकक्यात्मक पररवतना ों की पहचान, चयन और प्रार्समकता ननिााररत करना और संवेिनशीलता को कम करने में उनकी प्रभावशीलता का स्तर; और (घ) अवसंरचना, नीनतयों और प्रकक्याओं में कमजोररयों की पहचान, क्जसमें मानवीय कारक भी सक्म्मसलत हैं।

(6) नामववननदिाष्ट प्राधिकारी एक से अधिक पत्तन सुवविाओं को कवर करने के सलए पत्तन सुवविा सुरक्षा ननिाारि की अनुज्ञा िे सकेगा है यदि ऐसी पत्तन सुवविाओं के प्रचालक, स्र्ान, प्रचालन, उपस्कर और ड्रडजाइन समान हैं।

(7) पत्तन सुवविा सुरक्षा ननिाारि के पूरा होन े पर, एक ररपोटा तैयार की जाएगी क्जसमें ककए गए ननिारा ि का सार सक्म्मसलत होगा, क्जसमें प्रत्येक संवेिनशीलता पहलू का वववरि और ऐसी संवेिनशीलता को िरू करने के सलए उपयोग ककए जा सकने वाले प्रनतउपाय सक्म्मसलत होंगे।

(8) उपननयम (7) के अिीन तैयार की गई ररपोटा को अप्राधिकृत पहुंच या प्रकटीकरि से सुरक्षक्षत रखा जाएगा।

19. पत्तन सुवविा सुििा योजना. — (1) प्रत्येक पत्तन सुवविा की एक पत्तन सुवविा सुरक्षा योजना होगी क्जसे पत्तन सुवविा सुरक्षा अधिकारी द्वारा तैयार और कायााक्न्वत ककया जाएगा।

(2) पत्तन सुवविा सुरक्षा योजना–– (क) प्रत्येक पत्तन सुवविा के सलए पत्तन सुवविा सुरक्षा ननिाारि के आिार पर ववकससत और अनुरक्षक्षत की जाएगी, क्जसमें पोत और पत्तन इंटरफेस को ध्यान में रखा जाएगा; (ख) सुरक्षा स्तर-1, सुरक्षा स्तर-2 तर्ा सुरक्षा स्तर-3 के सलए उपबंि होंगे;

(ग) नामववननदिाष्ट प्राधिकारी द्वारा अनुमोदित ककया जाएगा; (घ) आईएसपीएस संदहता के भाग ‘ख’ में दिए गए मागिा शना को ध्यान में रखते हुए ववकससत ककया जाएगा और यह अंग्रेजी में होगा।

(3) पत्तन सुवविा सुरक्षा योजना में ननम्नसलणखत सक्म्मसलत होंगे-- (क) ऐसे उपाय जो लोगों, पोतों या पत्तनों के ववरुद्ि उपयोग के सलए असभप्रेत हधर्यारों या ककसी अन्य खतरनाक पिार् ा और उपकरिों को, क्जनका वहन प्राधिकृत नहीं है, पत्तन सुवविा में या ककसी पोत पर लाने से रोकने के सलए तैयार ककए गए हैं;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 19 (ख) पत्तन सुवविा तक, सुवविा पर खडे पोतों तक, तर्ा सुवविा के ननबधिं ित क्षेत्रों तक अप्राधिकृत पहुंच को रोकने के सलए तैयार ककए गए उपाय;

(ग) सुरक्षा खतरों या सुरक्षा भंग का जवाब िेने के सलए प्रकक्याएाँ, क्जसमें पत्तन सुवविा या पोत और पत्तन इंटरफेस के महत्वपूि ा प्रचालन को बनाए रखने के उपबंि सक्म्मसलत हैं; (घ) उस संवविाकारी सरकार द्वारा दिए गए सुरक्षा स्तर 3 पर ककसी भी सुरक्षा अनुिेशों का जवाब िेने के सलए प्रकक्याएाँ, क्जसके क्षेत्र में पत्तन सुवविा क्स्र्त है;

(ड.) सुरक्षा खतरों या सुरक्षा भंग के मामले में ननकासी के सलए प्रकक्या; (च) सुरक्षा उत्तरिानयत्व सौंपे गए पत्तन सुवविा कासमका ों और सुरक्षा पहलुओं संबंिी अन्य सुवविा कासमका ों के कतव्ा य; (छ) पोत सुरक्षा कायका लापों के सार् इंटरफेस करने के सलए प्रकक्याएाँ;

(ज) योजना की आवधिक समीक्षा और अद्यतनीकरि के सलए प्रकक्या; (झ) सुरक्षा घटनाओं की ररपोदटिंग के सलए प्रकक्या; (ञ) पत्तन सुवविा सुरक्षा अधिकारी की पहचान और चौबीसों घंटे संपका सूत्र के ब्यौरा; (ट) योजना में अंतववष्ा ट सूचना की सुरक्षा सुननक्चचत करने के उपाय;

(ि) पत्तन सुवविा पर स्र्ोरा तर्ा स्र्ोरा उिाई चढ़ाई उपस्कर की प्रभावी सुरक्षा सुननक्चचत करने के सलए तैयार ककए गए उपाय; (ड) पत्तन सुवविा सुरक्षा योजना की लेखा परीक्षा करने की प्रककया; (ढ़) पत्तन सुवविा पर ककसी पोत की पोत सुरक्षा चेतावनी प्रिाली सकक्य होने की क्स्र्नत में प्रनतकक्या करने की प्रकक्या और (ि) ककनारे पर छुट्टी, कमीिल सिस्य पररवतना , ववक्जटर और नाववकों के कल्याि और श्रम संगिन के प्रनतननधियों तक पहुाँच को आसान बनाने की प्रकक्या।

(4) नामववननदिाष्ट प्राधिकारी पत्तन सुवविा सुरक्षा योजना में ककए गए संशोिनों को अनुमोिन िेगा।

(5) पत्तन सुवविा सुरक्षा योजना को इलेतरॉननक रूपवविान में रखा जाएगा और इसकी अप्राधिकृत पहुाँच, ववलोपन, संशोिन को रोकने के सलए प्रकक्याओं द्वारा संरक्षक्षत ककया जाएगा।

(6) पत्तन सुवविा सुरक्षा योजना के असभलेखों को अप्राधिकृत पहुंच या प्रकटीकरि से सुरक्षक्षत रखा जाएगा।

(7) नामववननदिाष्ट प्राधिकारी एक पत्तन सुवविा सुरक्षा योजना को एक से अधिक पत्तन सुवविाओं को कवर करने की अनुज्ञा िे सकेगा यदि ऐसी पत्तन सुवविाओं के प्रचालक, स्र्ान, उपस्कर और तैयार समान हैं।

(8) योजना में ववववननदिाष्ट सुरक्षा कक्याकलापों की आंतररक लेखा-परीक्षा करने वाले या इसके कायाान्वयन20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] का मूल्यांकन करने वाले कासमका , लेखा-परीक्षा ककए जा रहे कक्याकलापों से अलग होंगे।

(9) यदि पत्तन सुवविा सुरक्षा योजना के संबंि में वैकक्ल्पक व्यवस्र्ा को नामववननदिाष्ट प्राधिकारी द्वारा अनुज्ञा िी गई है, तो इसकी ववसशक्ष्टयां प्रशासन द्वारा अंतरााष्रीय समुद्री संगिन को सूधचत ककए जाएंगे।

20. पत्तन सुवविा सुििा सलाहकाि सलमनत. — (1) पत्तन सुवविाओं की सुरक्षा के प्रयोजनों के सलए प्रयोजनार्,ा पत्तन ककसी पत्तन सुवविा सुरक्षा सलाहकार ससमनत का गिन कर सकेगा क्जसमें ननम्नसलणखत में से प्रत्येक का एक प्रनतननधि सक्म्मसलत होगा, अर्ाात:् - (क) संबंधित पत्तनों के पत्तन सुवविा सुरक्षा अधिकारी;

(ख) सीमा शुल्क ववभाग; (ग) स्वापक ननयंत्रि ब्यूरो; (घ) केंद्रीय आसूचना असभकरि; (ड.) राज्य आसूचना असभकरि; (च) केंद्रीय औद्योधगक सुरक्षा बल; (छ) स्र्ानीय पुसलस; (ज) आव्रजन ववभाग; (झ) भारतीय नौसेना; (ञ) भारतीय तटरक्षक बल;

(ट) राज्य समुद्री सुरक्षा समन्वयक; और (ि) केंद्रीय सरकार या राज्य सरकार का कोई भी अन्य असभकरि, जैसा कक संबंधित पत्तन के अध्यक्ष या मुख्य कायका ारी अधिकारी द्वारा उधचत समझा जाए।

(2) महापत्तन का अध्यक्ष, पत्तन सुवविा सुरक्षा सलाहकार ससमनत का प्रमुख होगा तर्ा उसकी ककसी भी बैिक की अध्यक्षता करेगा।

(3) महापत्तन से सभन्न अन्य पत्तन के मामले में, समुद्री बोड ा के प्रमुख या संबंधित राज्य सरकार, ऐस े पत्तन के कामकाज के संबंि में, अपनी अधिकाररता के अिीन के सभी पत्तन की पत्तन सुवविा सुरक्षा सलाहकार ससमनत की अध्यक्षता करेंगे:

परन्तु यह कक जहां महापत्तन (गैर-एक्तजम या गैर-कंटेनर पत्तन) से सभन्न अलावा अन्य पत्तन की पत्तन सुवविा सुरक्षा सलाहकार ससमनत की बैिक की अध्यक्षता मुख्य कायका ारी अधिकारी या समुद्री बोड ा या राज्य सरकार के सधचव के नामननदिाष्ट व्यक्तत द्वारा की जाती है, वहा ं पत्तन सुवविा सुरक्षा सलाहकार ससमनत की ररपोटा को पत्तन के अध्यक्ष या मुख्य कायका ारी अधिकारी द्वारा अनुमोदित की जाएगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 21

(4) पत्तन सुवविा सुरक्षा सलाहकार ससमनत पत्तन की सुरक्षा समीक्षा के सलए प्रत्येक छह मास कम से कम एक बार बैिक करेगी: परन्तु यह कक यदि अपेक्षक्षत हो, तो ससमनत संबंधित पत्तन की खतरे की िारिा के आिार पर ननयसमत अंतराल पर बैिक करेगी।

(5) पत्तन सुवविा सुरक्षा सलाहकार ससमनत पत्तन की अनुमोदित पत्तन सुवविा सुरक्षा योजना की समीक्षा करेगी: परन्तु यह कक ससमनत द्वारा स्वीकार ककए गए ककसी भी प्रस्ताववत संशोिन को पत्तन सुवविा सुरक्षा योजना में सक्म्मसलत ककया जाएगा और मान्यता प्राप्त सुरक्षा संगिन द्वारा समीक्षा के पचचात ् परीक्षा और अनुमोदित के सलए इसे नामववननदिाष्ट अधिकारी को भेजा जाएगा।

(6) जहााँ कोई नया पत्तन, पत्तन सुवविा सुरक्षा सलाहकार ससमनत गदित करता है, वहााँ ननम्नसलणखत शतों का अनुपालन ककया जाएगा, अर्ाात:्– (क) ऐसे पत्तन के सलए पत्तन सुवविा सुरक्षा तैयार करने में ससमनत के सिस्यों के ववचारों पर पयााप्त रूप से ध्यान दिया जाएगा;

(ख) पत्तन सुवविा सुरक्षा योजना की मान्यता प्राप्त सुरक्षा संगिन द्वारा समीक्षा की जाएगी; (ग) सत्यापन और अनुमोिन के सलए नामववननदिाष्ट प्राधिकारी को सौंपने से पहले ससमनत द्वारा पत्तन सुवविा सुरक्षा योजना की जााँच की जाएगी।

(7) पत्तन सुवविा सुरक्षा योजना के अनुमोिन के पचचात, संबंधित पत्तन, यर्ाक्स्र्नत सुरक्षा लेखापरीक्षा तर्ा अनुपालन वववरि जारी करने तर्ा उसके वाविका सत्यापन के सलए, अधिकाररता वाले समुद्री वाणिज्य ववभाग या नामववननदिाष्ट प्राधिकारी से संपका करेगा।

21. पत्तन सुवविा सुििा अधिकािी. — (1) प्रत्येक पत्तन सुवविा के सलए एक पत्तन सुवविा सरु क्षा अधिकारी नामववननदिाष्ट ककया जाएगा, क्जसके कतव्ा यों में ननम्नसलणखत सक्म्मसलत होंगे- (क) सुसंगत पत्तन सुवविा सुरक्षा ननिाारि को ध्यान में रखते हुए, पत्तन सुवविा का प्रारंसभक व्यापक सुरक्षा सवेक्षि करना;

(ख) पत्तन सुवविा सुरक्षा योजना की तैयारी सुननक्चचत करना; (ग) पत्तन सुवविा सुरक्षा योजना को कायााक्न्वत करना; (घ) उधचत सुरक्षा उपायों की ननरंतरता सुननक्चचत करने के सलए पत्तन सुवविा का ननयसमत सुरक्षा ननरीक्षि करना;

(ड.) कासमाकों को िीक करने और पत्तन सुवविा पर लागू पररवतना ों को ध्यान में रखने के सलए योजना को अद्यतन करने के सलए पत्तन सुवविा सुरक्षा योजना में उधचत संशोिनों की ससफाररश करना और उन्हें सक्म्मसलत करना;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (च) पत्तन सुवविा कासमाकों की सुरक्षा जागरूकता और सतकाता बढ़ाना;

(छ) पत्तन सुवविा की सुरक्षा के सलए उत्तरिायी कासमका ों को पयााप्त प्रसशक्षि प्रिान करना सुननक्चचत करना; (ज) अपने सुसंगत अधिकाररयों को ररपोटा करना और पत्तन सुवविा की सुरक्षा को खतरा पहुंचान े वाली घटनाओं का असभलेख रखना;

(झ) कंपनी और पोत सुरक्षा अधिकाररयों के सार् पत्तन सुवविा सुरक्षा योजना के कायाान्वयन का समन्वय करना; (ञ) सुरक्षा सेवाओं के सार् समन्वय करना, जैसा उपयुतत हो; (ट) यह सुननक्चचत करना कक पत्तन सुवविा की सुरक्षा के सलए उत्तरिायी कासमका ों के सलए मानक पूरे ककए गए हों;

(ि) यह सुननक्चचत करना कक सुरक्षा उपस्कर उधचत प्रकार से प्रचासलत, परीक्षि, अंशांककत और अनुरक्षक्षत हो; (ड) पोत पर चढ़ने के इच्छुक लोगों की पहचान की पुक्ष्ट करने में पोत सुरक्षा अधिकाररयों की सहायता करना;

(ढ) राज्य समुद्री सुरक्षा समन्वयकों के माध्यम से स्र्ानीय समुद्री सुरक्षा असभकरिों (भारतीय नौसेना या तटरक्षक बल या सुरक्षा प्रबंिन योजना) के सार् समन्वय स्र्ावपत करना ताकक ककसी घटना के संबंि में तटीय सुरक्षा स्तरों के संबंि में समुद्री सुरक्षा असभकरिों का आकलन ककया जा सके या पत्तन सुरक्षा स्तरों को उन्नयन या अवनयन ककया जा सके;

(ि) पत्तन के वाणिज्य प्रचालन को प्रभाववत ककए बबना, समुद्री सुरक्षा असभकरिों, भारतीय नौसेना, भारतीय तटरक्षक बल द्वारा या सुरक्षा प्रबंिन योजना के अिीन, यर्ाक्स्र्नत, पयााप्त पूव ा सूचना के अध्यिीन, सभी तटीय, पत्तन या समुद्री सुरक्षा अभ्यासों में पत्तन सुवविा सुरक्षा संगिन की भागीिारी सुननक्चचत करना।

(2) पत्तन, सुरक्षा असभसमय, आईएसपीएस संदहता तर्ा इन ननयमों के अिीन कत्तव्ा यों के पालन के सलए पत्तन सुवविा सुरक्षा अधिकारी को सुवविाएं प्रिान करेगा।

(3) पत्तन सुवविा सुरक्षा अधिकारी के पास ननम्नसलणखत न्यूनतम अहाताएं होंगी, अर्ाात:् - (क) महापत्तन के सलए, प्रशासन द्वारा जारी प्रबंिन स्तर सक्षमता प्रमािपत्र (वविेश गमन) क्जसमें वाणिज्य समुद्री पष्ृ िभूसम हो;

(ख) महापत्तनों से सभन्न पत्तनों के सलए –

(i) तीन सौ मीटर और उससे अधिक लंबाई वाले घाट के सार्– (क) प्रबंिन स्तर सक्षमता प्रमािपत्र (प्रशासन द्वारा जारी वविेश यात्रा); या[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 23 (ख) भूतपूव ा सैननकों के मामले में, कम से कम भारतीय नौसेना में कमाडं र के पि या भारतीय तटरक्षक बल में समतुल्य पि पर सेवा की हो;

(ii) तीन सौ मीटर से कम लंबाई वाले घाट के सार्,– (क) प्रचालन स्तर अधिकारी के स्तर पर वाणिज्य पोत पर नौकायन का अनुभव होना चादहए; या (ख) भूतपूव ा सैननकों के मामले में, कम से कम भारतीय नौसने ा में लेक्फ्टनेंट कमांडर के पि या भारतीय तटरक्षक बल में समतुल्य पि पर सेवा की हो;

(ग) तटीय जलयान के मास्टर या चीफ़ इंजीननयर: परन्तु यह कक नामववननदिाष्ट प्राधिकारी गैर-एक्ग्जम पत्तन के सलए ऊपर िी गई अहाता सशधर्ल कर सकेगा।

(4) एक्ग्जम पत्तन सुवविा एक उप पत्तन सुवविा अधिकारी ननयुतत करेंगी, क्जसके पास ये अहाताएं होनी चादहए: — (क) वाणिज्य समुद्री पष्ृ िभूसम वाले प्रशासन द्वारा जारी प्रबंिन स्तर सक्षमता प्रमाि-पत्र (ननकट तटीय पोत); या (ख) प्रशासन द्वारा जारी प्रचालन स्तर सक्षमता प्रमाि पत्र (वविेश गमन); या (ग) पत्तन सुवविा सुरक्षा अधिकारी प्रमािपत्र; और (घ) भारतीय नौसने ा और भारतीय तटरक्षक बल से कमीशन अधिकारी के रैंक पर हो और पत्तन सुवविा सुरक्षा अधिकारी पाठ्यक्म ककया हो।

(5) पत्तन सुवविा सुरक्षा अधिकारी और पत्तन सुवविा सुरक्षा कासमाकों के पास अपेक्षक्षत ज्ञान होगा और उन्होंने आईएसपीएस संदहता के भाग ‘ख’ में अंतववष्ा ट मागिा शना को ध्यान में रखते हुए प्रसशक्षि प्राप्त ककया होगा।

22. पत्तन सुवविा सुििा पि प्रलशिण, ड्रिल औि अभ्यास. — पत्तन सुवविा सुरक्षा योजना के प्रभावी कायाान्वयन और समन्वय को सुननक्चचत करने के सलए, आईएसपीएस सदं हता के भाग ‘ख’ में अतं ववष्ा ट मागिा शना को ध्यान में रखते हुए, प्रचालन के प्रकार, पत्तन के कासमका पररवतना , पत्तन क्जस प्रकार के पोत को सेवा िे रहा है और अन्य सुसंगत पररक्स्र्नतयों को ध्यान में रखते हुए उधचत अंतराल पर अभ्यास ककया जाएगा।

23. पोतों का सत्यापन. — (1) प्रत्येक पोत, क्जस पर आईएसपीएस संदहता का भाग क लागू होता है, ननम्नसलणखत सत्यापन के अध्यिीन होगा, अर्ाात:् - (क) पोत को सेवा में लगाने से पहले या इन ननयमों के अिीन अपेक्षक्षत प्रमािपत्र पहली बार जारी करने से पहले एक प्रारंसभक सत्यापन, क्जसमें पोत की सरु क्षा प्रिाली और सुरक्षा असभसमय,24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] आईएसपीएस संदहता के भाग ‘क’ और अनुमोदित पोत सुरक्षा योजना के सुसंगत उपबंिों द्वारा कवर ककए गए ककसी भी सहयुत त सुरक्षा उपस् कर का पूिा सत्यापन सक्म्मसलत होगा, ताकक यह सुननक्चचत ककया जा सके कक पोत की सुरक्षा प्रिाली और सहयुत त सुरक्षा उपस् कर –

(i) सुरक्षा असभसमय और आईएसपीएस संदहता के भाग ‘क’ की लागू अपेक्षाओं का अनुपालन करत े हैं; और

(ii) समािानप्रि क्स्र्नत में हैं और उस सेवा के सलए उपयुतत हैं जो पोत द्वारा िी जानी है; (ख) प्रशासन द्वारा ववववननदिाष्ट अंतराल पर नवीकरि सत्यापन, पांच विा से अधिक नहीं, इन ननयमों में अन्यर्ा ववववननदिाष्ट के ससवाय ताकक यह सुननक्चचत ककया जा सके कक पोत की सुरक्षा प्रिाली और ककसी सहयुत त सुरक्षा उपस् कर और अनुमोदित पोत सुरक्षा योजना -

(i) सुरक्षा असभसमय और आईएसपीएस संदहता के भाग ‘क’ की लागू अपेक्षाओं का अनुपालन करती है; और

(ii) समािानप्रि क्स्र्नत में है और उस सेवा के सलए उपयुतत है जो पोत द्वारा िी जानी है; (ग) प्रमािपत्र के िसू रे और तीसरे वि ा की दिनांक के बीच प्रमािपत्र पर कम से कम एक मध्यवती सत्यापन ककया जाएगा क्जसमें सुरक्षा प्रिाली और पोत के ककसी सहयुत त सुरक्षा उपस् कर का ननरीक्षि सक्म्मसलत होगा ताकक यह सुननक्चचत ककया जा सके कक यह उस सेवा के सलए समािानप्रि है जो पोत द्वारा िी जानी है;

(घ) प्रशासन द्वारा यर्ाअविाररत ककया गया कोई भी अनतररतत सत्यापन।

(2) उप ननयम (1) में ववववननदिाष्ट सत्यापन अनुसूची 4 के अनुसार प्रशासन के अधिकाररयों द्वारा ककया जाएगा: परन्तु यह कक प्रशासन, सत्यापन का काम ककसी मान्यता प्राप्त सुरक्षा संगिन या अधिकाररता वाले समुद्री वाणिज्य ववभाग के मुख्य अधिकारी को सौंप सकता है।

(3) प्रशासन सत्यापन की पूिता ा और प्रभावशीलता सुननक्चचत करेगा तर्ा इन ननयमों के अिीन अपनी बाध् यताओं का ननवहा न करने के सलए आवचयक व्यवस्र्ा करेगा।

(4) सत्यापन के पच चात,् पोत के सुरक्षा प्रिाली और ककसी सहयुत त सुरक्षा उपस् कर को इस तरह बनाए रखा जाएगा कक वे 'सुरक्षा असभसमय', 'आईएसपीएस संदहता' के 'भाग क' और अनुमोदित की गई 'पोत सुरक्षा योजना' के िसू रे उपबंिों के अनुरूप हों:

परन्तु यह कक ऐसे ककसी भी सत्यापन के पच चात,् प्रशासन की पहले स े अनुमोिन के बबना पोत की सुरक्षा प्रिाली, ककसी सहयुत त सुरक्षा उपस् कर या अनुमोदित की गई 'पोत सुरक्षा योजना' में कोई पररवतना न ककया जाए।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 25

24. अंतिागष्ट्रीय पोत सुििा प्रमाणपत्र जािी किना या उसका पष्ट्ृ ठांकन किना. — अंतरााष्रीय पोत सरु क्षा प्रमािपत्र, प्रारंसभक या नवीकरि सत्यापन के पच चात ् अनुसूची 5 में ववववननदिाष्ट रूपवविान में जारी ककया जाएगा। इसे प्रशासन, मान्यता प्राप्त सुरक्षा संगिन या अधिकाररता वाले समुद्री वाणिज्य ववभाग द्वारा जारी या पष्ृ िांककत ककया जाएगा:

परन्तु यह कक कोई िसू री संवविाकारी सरकार, प्रशासन के अनुरोि पर, पोत को सत् यावपत करवा सकेगी और यदि उसका यह समािान हो जाता है कक आईएसपीएस संदहता के उपबंिों का पालन ककया गया है, तो वह पोत के सलए अंतरााष्रीय पोत सुरक्षा प्रमािपत्र जारी कर सकेगी या जारी करने के सलए प्राधिकृत कर सकेगी, और जहााँ उधचत हो, इन ननयमों के अनुसार उस प्रमािपत्र का पष्ृ िांकन कर या पष्ृ िांकन के सलए प्राधिकृत कर सकेगी:

परंतु यह और कक प्रमािपत्र की एक प्रनत और सत्यापन ररपोटा की एक प्रनत शीघ्रानतशीघ्र अनुरोि करने वाली संवविाकारी सरकार को भेजी जाएगी: परन्तु यह भी कक इस प्रकार जारी ककए गए प्रमािपत्र में इस आशय का उल्लेख होगा कक इसे संवविाकारी सरकार के अनुरोि पर जारी ककया गया है और इसकी वही मान्यता और प्रभाव होगा जो प्रशासन द्वारा जारी प्रमाि-पत्र का होता है।

25. प्रमाणपत्र की अवधि औि ववधिमान्य ता. — (1) अंतरााष्रीय पोत सुरक्षा प्रमािपत्र ऐसी अवधि के सलए जारी ककया जाएगा, जैसा कक प्रशासन द्वारा ववववननदिाष्ट ककया जाए, जो पांच वि ा से अधिक नही ं होगी।

(2) जहां नवीकरि सत्यापन ववद्यमान प्रमािपत्र की समाक्प्त दिनांक से तीन माह के भीतर पूरा हो जाता है, वहां नया प्रमािपत्र ववद्यमान प्रमािपत्र की अवसान की दिनांक से पांच विा से अनधिक अवधि के सलए ववधिमान्य होगा।

(3) जहां नवीकरि सत्यापन, ववद्यमान प्रमािपत्र की समाक्प्त दिनांक के पच चात ् पूरा ककया जाता है, वहां नया प्रमािपत्र नवीकरि सत्यापन के पूरा होने की दिनांक से पांच वि ा से अनधिक अवधि के सलए ववधिमान्य होगा।

(4) जहााँ प्रमाि-पत्र पााँच वि ा से कम अवधि के सलए जारी ककया जाता है, वहााँ प्रशासन, प्रमािपत्र की ववधिमान्य ता को उसकी समाक्प्त दिनांक से आगे आईएसपीएस संदहता में ववववननदिाष्ट अधिकतम अवधि तक बढ़ा सकेगा:

परन्तु यह कक जहााँ ऐसा प्रमािपत्र पााँच वि ा की अवधि के सलए जारी ककया जाता है, वहााँ आईएसपीएस संदहता के अिीन अपेक्षक्षत सत्यापन, यर्ा लागू ककए जाएंगे।

(5) जहां नवीकरि सत्यापन पूरा हो गया है, ककंत ु ववद्यमान प्रमािपत्र के अवसान से पहले नया प्रमािपत्र जारी नहीं ककया गया है, प्रशासन, मान्यता प्राप्त सुरक्षा संगिन या समुद्री वाणिज्य ववभाग, ववद्यमान प्रमािपत्र का समर्ना कर सकते हैं और ऐसा प्रमािपत्र इसके अवसान की दिनांक से और पांच मास से अनधिक अवधि के सलए ववधिमान्य रहेगा।26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(6) जहााँ प्रमािपत्र के अवसान के समय पर, कोई पोत उस पत्तन पर नहीं है जहााँ उसका सत्यापन होना है, वहााँ प्रशासन, प्रमािपत्र की ववधिमान्य ता बढ़ा सकता है: परन्तु यह कक ऐसे ववस् तार का अनुित्त केवल इस प्रयोजन के सलए होगा कक पोत उस पत्तन जहााँ उसका सत्यापन होना है, तक अपनी यात्रा पूरी कर सके और केवल वहां जहां ऐसा करना उधचत और सही प्रतीत हो:

परन्तु यह और कक ऐसा ववस् तारि तीन माह से अधिक नहीं होगा, और क्जस पोत का ववस् तारि अनुित्त ककया गया है, वह उस पत्तन पर पहुाँचने पर जहााँ उसका सत्यापन होना है, ऐसे ववस् तारि के आिार पर नया प्रमािपत्र असभप्राप् त ककए बबना उस पत्तन से जाने का हकिार नहीं होगा:

परन्तु यह भी कक जहााँ नवीकरि सत्यापन पूरा हो गया है, वहा ाँ नया प्रमािपत्र, ऐसे ववस् तारि से पहले ववद्यमान प्रमािपत्र के अवसारन की दिनांक से पााँच वि ा से अनधिक अवधि के सलए ववधिमान्य होगा।

(7) यदि लघु यात्राओं पर जाने वाले ककसी पोत को जारी ककए गए प्रमािपत्र की अवधि पूवगा ामी उपबंिों के अिीन नहीं बढ़ाई गई है, तो प्रशासन प्रमािपत्र की ववधिमान्य ता को उसके अवसान की दिनांक से एक मास से अनधिक अवधि के सलए बढ़ा सकता है:

परन्तु यह कक जहां नवीनीकरि सत्यापन पूरा हो गया है, तो नया प्रमािपत्र, ऐसी ववस् तारि स े पूव ा ववद्यमान प्रमािपत्र के अवसान की दिनांक से पााँच वि ा से अनधिक अवधि के सलए ववधिमान्य होगा।

(8) जहााँ मध्यवती सत्यापन ववदहत अवधि से पहले पूरा हो जाता है, - (क) प्रमािपत्र में ववववननदिाष्ट अवसान की दिनांक को पष्ृ िांकन द्वारा संशोधित कर उस दिनांक के तीन वि ा से अधिक नहीं की जाएगी, क्जस दिनांक को मध्यवती सत्यापन पूरा ककया गया र्ा;

(ख) प्रमाि-पत्र में ववववननदिाष्ट अवसान की दिनांक को अपररवनतता भी रखा जा सकता है, परन्तु यह कक एक या अधिक अनतररतत सत्यापन ककए जाएं ताकक आईएसपीएस संदहता के अिीन ववववननदिाष्ट सत्यापन के बीच के अधिकतम अंतराल से अधिक न हो।

(9) इन ननयमों के अिीन जारी प्रमािपत्र ननम्नसलणखत ककसी भी मामले में ववधिमान्य नहीं रहेगा, अर्ाात:् - (क) यदि सुसंगत सत्यापन इस ननयम के अिीन ववववननदिाष्ट अवधि के भीतर पूरा नहीं ककए जाते हैं; (ख) यदि प्रमािपत्र लागू ननयमों के अनुसरि में समधर्ता नहीं है;

(ग) जहा ं कोई कंपनी ककसी ऐसे पोत के प्रचालन की उत्तरिानयत्व लेती है क्जसे पहले उस कंपनी द्वारा प्रचासलत नहीं ककया गया र्ा; और (घ) पोत को िसू रे िेश के ध्वज में स्र्ानांतररत करने पर।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 27

(10) जब ककसी पोत को अधिननयम के अिीन रक्जस् रीकरि के सलए ककसी िसू री संवविाकारी सरकार के ध्वज से अंतररत ककया जाता है, तो वह संवविाकारी सरकार, यर्ासाध् य शीघ्रता से, प्रशासन को पारेिि से िीक पहले पोत के पास मौजूि 'अंतरााष्रीय पोत सुरक्षा प्रमािपत्र' की प्रनतयां या उससे सहयुत त सभी जानकारी, उपलब्ि सत्यापन ररपोटा की प्रनतयों के सार् भेजेगी।

(11) जब कोई कंपनी ऐसे पोत के प्रचालन की क्जम्मेिारी लेती है क्जसे पहले उसके द्वारा प्रचासलत नही ं ककया गया र्ा, तो वपछली कंपनी, यर्ासाध् य शीघ्रता से, प्राप्तकताा कंपनी को 'अंतरााष्रीय पोत सुरक्षा प्रमािपत्र' की प्रनतयां या उससे सहयुत त सभी उपलब्ि पारेवित करेगी, और इस ननयम के अिीन अपक्षे क्षत सत्यापन को सुकर बनाने के सलए आवचयक सहायता प्रिान करेगी।

26. अंतरिम प्रमाणन. — (1) ननयम 24 के अिीन प्रमािपत्र केवल तभी जारी ककया जाएगा। यदि का यह समािान हो जाता है कक पोत आईएसपीएस संदहता और सुरक्षा असभसमय की अपेक्षाओं का अनुपालन करता है: परन्तु यह कक ननयम 24 के अिीन प्रमािपत्र जारी होने तक, प्रशासन ननम्नसलणखत मामलों में से ककसी में भी अंतररम अंतरााष्रीय पोत सुरक्षा प्रमािपत्र जारी कर सकता है, अर्ाात:् - (क) प्रमािपत्र के बबना एक पोत, सुपुिागी पर या सेवा में प्रवेश या पुनः प्रवेश से पहले;

(ख) अधिननयम के अिीन रक्जस् रीकरि के सलए ककसी संवविाकारी सरकार के ध्वज से पोत का अंतरि; (ग) ककसी ऐसे राज्य से, जो संवविाकारी सरकार नहीं है, अधिननयम के अिीन रक्जस् रीकरि के सलए पोत का अंतरि; या (घ) जब कोई कंपनी ककसी पोत के प्रचालन की क्जम्मेिारी लेती है, जो पहले उस कंपनी ने प्रचासलत नहीं ककया र्ा।

(2) अंतररम अंतरााष्रीय पोत सुरक्षा प्रमािपत्र केवल तभी जारी ककया जाएगा जब असभदहत प्राधिकारी या मान्यता प्राप्त सुरक्षा संगिन ने ननम्नसलणखत शतों के अनुपालन का सत्यापन ककया है, अर्ाात:् - (क) अंतरााष्रीय पोत और पत्तन सुवविा सुरक्षा सदं हता के भाग ‘क’ द्वारा अपेक्षक्षत पोत सरु क्षा ननिाारि पूरा कर सलया गया है;

(ख) सुरक्षा असभसमय और आईएसपीएस संदहता के भाग ‘क’ की अपेक्षाओं का अनुपालन करने वाले पोत सुरक्षा योजना की एक प्रनत पोत पर उपलब्ि है, और पोत सुरक्षा योजना–

(i) पुनववला ोकन और अनमु ोिन के सलए प्रस्तुत की गई है; और

(ii) पोत पर कायााक्न्वत की जा रही है; (ग) पोत को सुरक्षा असभसमय की अपेक्षाओं का अनुपालन करने वाली पोत सुरक्षा चेतावनी28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्रिाली प्रिान की गई है;

(घ) कंपनी सुरक्षा अधिकारी ने—

(i) आईएसपीएस संदहता के भाग ‘क’ के अनुपालन के सलए पोत सुरक्षा योजनाओं का पुनववला ोकन सुननक्चचत कर सलया है;

(ii) यह सुननक्चचत कर सलया है कक योजना अनुमोिन के सलए प्रस्तुत कर िी गई है;

(iii) यह सुननक्चचत कर सलया है कक योजना पोत पर कायााक्न्वत की जा रही है; और

(iv) आवचयक व्यवस्र्ाएं क्जनके अिीन ड्रिल और अभ्यास, आंतररक संपरीक्षा की व्यवस्र्ा भी है, स्र्ावपत कर ली हैं, और इस बात का समािान हो गया है कक पोत, ननयम 23 के उप-ननयम (1) के अिीन अपेक्षक्षत सत्यापन छह मास की अवधि के भीतर सफलतापूवका पूि ा कर लेगा;

(ड.) ननयम 23 के अिीन अपेक्षक्षत सत्यापन कक्याक्न्वत करने के सलए व्यवस्र्ा कर िी गई है; (च) मास्टर, पोत सुरक्षा अधिकारी तर्ा ववववननदिाष्ट सुरक्षा कतव्ा यों वाले अन्य पोत के कासमका ,-

(i) आईएसपीएस संदहता के भाग ‘क’ के अिीन अपने कतव्ा यों तर्ा उत्तरिानयत्वों तर्ा पोत पर रखी गई सुरक्षा योजना के सुसंगत उपबंिों से पररधचत हैं; और

(ii) उन्हें ऐसी जानकारी अंग्रेजी में उपलब्ि कराई गई हैं; और (छ) पोत सुरक्षा अधिकारी, आईएसपीएस संदहता के भाग ‘क’ की अपेक्षाओं की अनुपालना करता है।

(3) अंतररम अंतरााष्रीय पोत सुरक्षा प्रमािपत्र, प्रशासन या मान्यता प्राप्त सुरक्षा संगिन द्वारा जारी ककया जा सकता है।

(4) अंतररम अंतरााष्रीय पोत सुरक्षा प्रमािपत्र, इसके जारी होने की दिनाकं से छह मास की अवधि के सलए या इन ननयमों द्वारा अपेक्षक्षत प्रमािपत्र जारी होने तक, जो भी पूवोत्तर हो, ववधिमान्य रहेगा और इसे उस अवधि से आगे नहीं बढ़ाया जाएगा।

(5) प्रशासन ककसी पोत को पच चातवती, क्मानुगत अंतररम अंतरााष्रीय पोत सुरक्षा प्रमािपत्र जारी नही ं करेगा, यदि उसका यह समािान हो जाता है कक इस तरह के प्रमािपत्र का अनुरोि कंपनी या पोत द्वारा प्रारंसभक अंतररम अंतरााष्रीय पोत सुरक्षा प्रमािपत्र की ववधिमान् यता की अवधि से आगे सुरक्षा असभसमय और आईएसपीएस संदहता के भाग ‘क’ की अपेक्षाओं के अनुपालन से बचने के प्रयोजन से ककया गया है, जैसा कक इन ननयमों के अिीन अपेक्षक्षत है।

(6) सुरक्षा असभसमय के प्रयोजनों के सलए, प्रशासन ककसी अंतररम अंतरााष्रीय पोत सुरक्षा प्रमािपत्र को ववधिमान्य प्रमािपत्र के रूप में स्वीकार करने से पहले स्वयं का समािान कर सकता है कक इन ननयमों की अपेक्षाओं का अनुपालन ककया गया है।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 29

27. प्रमाणन का ननलंबन या वावपस ललया जाना. — प्रशासन, ननम्नसलणखत पररक्स्र्नतयों की िशा में अंतरााष्रीय पोत और पत्तन सुवविा सुरक्षा प्रमािपत्र को ननलंबबत या वापस ले सकता है, अर्ाात: - (क) ननिााररत समय के भीतर सुिारात्मक कारावाई पूि ा नहीं की जाती है;

(ख) आवधिक सत्यापन पूि ा नहीं ककया गया है; (ग) आईएसपीएस संदहता में संशोिनों पर ध्यान नहीं दिया गया है; (घ) मामूली गैर-अनुरूपता या प्रमुख गैर-अनुरूपता का साक्ष्य है; या (ड.) पोत या पत्तन सुवविा के सुरक्षा प्रबंिन प्रिाली में ककए गए सारभूत उपांतरिों की जानकारी प्रशासन को अधिसूधचत नहीं की गई है।

28. पत्तन सुवविाओं का सत्यापन औि प्रमाणन. — (1) ककसी पत्तन सुवविा के अनुपालन का वववरि जारी करने के प्रयोजन के सलए, असभदहत प्राधिकारी ननम्नसलणखत के द्वारा प्रारंसभक सत्यापन संचालन करेगा— (क) यह सत्यावपत करन े के सलए सुसंगत िस्तावजे ों की समीक्षा करना कक पत्तन सुवविा सुरक्षा प्रिाली आईएसपीएस संदहता की अपेक्षाओं का अनुपालन करती है; या (ख) पत्तन सुवविा की संपरीक्षा करके यह सत्यावपत ककया जाएगा कक पत्तन सुवविा सुरक्षा प्रिाली कम से कम तीन मास की अवधि से प्रभावी रूप प्रचालन कर रही है।

(2) प्रत्येक पत्तन सुवविा क्जसके संबंि में अनुपालन वववरि जारी ककया गया है, इन ननयमों के अिीन जारी प्रमािपत्र की िसू री और तीसरी विगा ांि की दिनांक के बीच एक मध्यवती सत्यापन ककया जाएगा ताकक ऐसे प्रमािपत्र की ववधिमान्य ता बनाई रखी जा सके और ननम्नसलणखत ववसशक्ष्टयों को सत्यावपत ककया जा सके, अर्ाात:- (क) पत्तन सुवविा सुरक्षा प्रिाली का प्रभावी कायका रि;

(ख) पत्तन सुवविा सुरक्षा प्रिाली में ककए गए कोई भी उपांतरि आईएसपीएस संदहता की अपेक्षाओं का अनुपालन करते हैं; और (ग) ककसी भी सुिारात्मक कारावाई का समािानप्रि कायाान्वयन।

(3) प्रत्येक पत्तन सुवविा का वाविका सत्यापन ककया जाएगा ताकक यह सुननक्चचत ककया जा सके कक उसकी पत्तन सुवविा सुरक्षा प्रिाली आईएसपीएस संदहता की अपेक्षाओं का ननरंतर अनुपालन कर रही है।

29. समतुल्य सुििा उपाय कायागक्न्वत किने की शक्तत. –– यर्ाक्स्र्नत प्रशासन या असभदहत प्राधिकारी, ककसी भारतीय पोत, पत्तन सुवविा, या भारतीय पोतों या पत्तन सुवविाओं के एक वग ा या समूह को जैसी30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] भी क्स्र्नत हो, इन ननयमों के अिीन ववदहत सुरक्षा उपायों के बिले में समतुल् य सुरक्षा उपायों को कायााक्न्वत करने की अनुमनत िे सकता है, यदि यह समािान हो जाता है कक ऐसे समतुल् य सुरक्षा उपाय कम स े कम इन ननयमों के अिीन उपबंधित उपायों क्जतने ही प्रभावी हैं:

परन्तु यह कक प्रशासन इस प्रकार अनुमत समतल्ु य सुरक्षा उपायों की ववसशक्ष्टयां अंतरााष्रीय समुद्री संगिन को संसूधचत करेगा।

30. पोतों के कतव्ग य. –– भारत की अधिकाररता में ककसी पत्तन में प्रवेश करने वाले प्रत्येक पोत को ऐस े पत्तन पर पहुंचने स े न् यूनतम नछयानवे घंटे पहले, अनुसूची 6 में ववववननदिाष्ट प्ररूप में असभदहत प्राधिकारी को आगमन-पूव ा अधिसूचना (पीएएनएस) प्रस्तुत करनी होगी:

परन्तु यह कक जहां यात्रा की अवधि नछयानवे घंटे से कम हो, आगमन-पूव ा अधिसूचना पोत के अंनतम पत्तन से प्रस्र्ान के िो घंटे के भीतर प्रस्तुत की जाएगी।

31. ननदेश औि मार्दग शगक लसदिांत जािी किने की शक्तत. –– केन्द्रीय सरकार ऐसे ननिेश या मागािशका ससद्िांत जारी कर सकती है, जो अधिननयम या इन ननयमों स े असंगत न हों, जैसा सुरक्षा असभसमय, आईएसपीएस संदहता या इन ननयमों के उपबंिों को प्रभावी करने के सलए आवचयक हो।

32. फीस. – (1) प्रत्येक पत्तन, पोत, कंपनी, व्यक्तत या व्यक्ततयों का समूह, क्जन पर ये ननयम लागू होते हैं, इन ननयमों के अिीन प्रिान की गई सेवाओं के सलए अनुसूची 7 में ववववननदिाष्ट फीस का संिाय करेंगे।

(2) ककसी गैर-अनुपालन के संबंि में संिेय फीस तर्ा उस पर लागू आवचयक उपाय अनुसूची 7 में ववववननदिाष्ट अनुसार होंगे।

(3) इन ननयमों के अिीन संिेय समस्त फीस भारत कोि पोटाल - www.bharatkosh.gov.in के माध्यम से संित्त की जाएगी।

(4) इन ननयमों के अिीन संित्त की कोई भी फीस प्रनतिाय नहीं की जाएगी।

10. पोत सुरक्षा योजना का खो जाना 1,00,000 रूपये दटप्पि: (क.) कंपनी सुरक्षा अधिकारी एक नई पोत सुरक्षा योजना[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 59 बनाएगा और पुराने पासवड,ा कोड वड,ा संपका वववरि या गोपनीय डाटा को तुरंत बिल िेगा और 'नौवहन महाननिेशालय' को ररपोटा करेगा। अनुमोदित पोत सुरक्षा योजना को शीघ्रता के सार् पोत से जोडने की व्यवस्र्ा की जानी चादहए;

(ख.) योजना खो जाने की क्स्र्नत में, नई पोत सुरक्षा योजना के अनुमोिन के सलए फ़ीस सामान्य फ़ीस से 1.5 गुना ज़्यािा होगी, अर्ाात ् - i. कागो पोत के सलए- 1,87,500 रुपये; ii. यात्री पोत के सलए- 1,95,000 रुपये

11. ननयमों का पालन न करने के अधिक 8,00,000 रूपय े मामलों के कारि अंतरााष्रीय या तटीय पोत सुरक्षा प्रमािपत्र वापस सलए जाने के पचचात ् पोत के िोबारा ननरीक्षि की फ़ीस

12. ननिााररत समय-सीमा के पचचात ् पोत का 3,00,000 रूपय े बाहरी सुरक्षा लेखा-परीक्षा करना और समयाि समाप्त अंतरााष्रीय या तटीय पोत सुरक्षा प्रमािपत्र के सार् पोत का चलना

13. यदि कंपनी समय पर (ननयत दिनांक से 6 कोई फीस नहीं महीने पहले) लेखा-परीक्षा के सलए अनुरोि करती है और मान्यता प्राप्त सुरक्षा संगिन लेखा-परीक्षा के सलए पोत का ननरीक्षि नहीं कर पाता है

15. पोत की समयाि समाप्त अंतरााष्रीय या ववधिमान्य अंतरााष्रीय या तटीय पोत सुरक्षा प्रमािपत्र के सार् चलना तटीय पोत सुरक्षा प्रमािपत्र प्रस्तुत करने तक जलयान को अवरोिन में रखा जाएगा और इसके सभन्न स्वामी द्वारा 8,00,000 रुपये की फ़ीस िेनी होगी।

16. पोत सुरक्षा संबंिी आगमन पूव ा अधिसूचना सही पत्तन ऑफ़ कॉल या ध्व्ज में समथ्या जानकारी जैसे गलत पोटा ऑफ़ पष्ृ िांकन के सार् सही कॉल या कोई अन्य गलत जानकारी घोवित जानकारी िेने तक जलयान को करना अवरोिन रखा जाएगा और इसके अनतररतत स्वामी द्वारा 2,00,000 रुपये की फ़ीस िेनी होगी।

17. ऐसे पोत क्जनके पास सुरक्षा उपस्कर नहीं खराबी वाले या गायब उपस्कर हैं या क्जनका रखरखाव िीक से नहीं ककया का अवरोिन और जा रहा है 1,00,000 रुपये का जुमााना।

18. ऐसे पोत क्जन के स्वत: पहचान प्रिाली में जब तक पोत के सुरक्षा उपस्कर समथ्या नाम, समथ्या कॉल साइन या गलत चालू या िीक से न लग जाएं, डाटा डाला गया है तब तक जलयान को अवरोिन में रखा जाएगा और इसके अनतररतत स्वामी को प्रत्येक खराब या गायब उपस्कर के सलए 1,00,000 रुपये की फीस िेनी होगी।

19. मास्टर या कंपनी सुरक्षा अधिकारी द्वारा 2,00,000 रुपये नौवहन महाननिेशालय को सुरक्षा या बबना दटकट यात्रा करने वाली घटनाओं की सूचना न िेना

20. समय पर आंतररक सुरक्षा लेखा-परीक्षा न 1,00,000 रुपये ककया जाना

NOTIFICATION New Delhi, the 23rd October, 2026 G.S.R. 909(E).— In exercise of the powers conferred by, sub-section (1) and clauses

(a), (b), (g) and (h) of sub-section (2) of section 130 of the Merchant Shipping Act, 2025 (24 of 2025), and in supersession of the Merchant Shipping (Ships and Port Facility Security) Rules, 2024, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely:–

1. Short title and commencement. — (1) These rules may be called the Merchant Shipping (Ships and Port Facility Security) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. –– Unless otherwise expressly provided, these rules shall apply to the matters relating to safety and security of —

(a) every Indian ship including mobile offshore drilling units and high-speed craft as defined in regulation XI-2/1 of the Safety Convention, irrespective of its type or area of operation, wherever it may be, which meets with the requirements specified in

Schedule I:

(b) any ship other than an Indian ship, when such ship calls at any Indian port or Indian offshore facility, or is at anchorage within Indian jurisdiction;

(c) any Indian port facility; and

(d) any company owning, operating, or managing any vessel or port facility to which these rules apply.

3. Definitions. — (1) In these rules, unless the context otherwise requires, —

(a) “Act” means the Merchant Shipping Act, 2025 (24 of 2025);

(b) “Administration” means the Director-General of Maritime Administration;

(c) “audit” means a method or process of systematic and independent verification by obtaining objective evidence to determine whether the port facility-related or ship-related security activities comply with the applicable requirements of the Safety Convention, considering the approved security plan;

(d) “company” means the company as defined under clause (a) of section 115 of the Act;

(e) “company security officer” means the person designated by a company under sub-

rule (1) of rule 14;64 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(f) “contracting government” means a government of any country that has agreed to be bound by the Safety Convention;

(g) “designated authority” means the Bureau of Port Security constituted under sub-section (1) of section 13 of the Act;

(h) “International Ship Security Certificate” means a certificate issued by the Administration or the person authorised by it, in accordance with these rules or the International Ship and Port Facility Security Code;

(i) “ISPS Code” means the International Ship and Port Facility Security Code adopted by the International Maritime Organization under the Safety Convention, as amended from time to time;

(i) “Mercantile Marine Department” means the Mercantile Marine Department established under section 11 of the Act;

(j) “port facility security advisory committee” means a committee referred to in

rule 20;

(k) “port facility security assessment” means a port facility security assessment carried out in accordance with rule 18;

(l) “port facility security officer” means an officer as referred to in rule 21;

(m) “port facility security plan” means a plan to ensure the application of measures designed to protect the port facility and ships, persons, cargo, cargo transport units and stores of ship within the port facility from the risks of a security incident;

(n) “recognised security organisation” means any organisation, company, firm or body of individuals having expertise in matters relating to security and knowledge of ship and port operations, authorised by the Central Government to carry out assessment, verification, approval or certification required by these rules;

(o) “Schedule” means a Schedule annexed to these rules;

(p) “security incident” means any suspicious circumstance threatening the security of a ship, including a mobile offshore drilling unit and a high-speed craft, or of a port facility or of any ship and port interface, or any ship-to-ship activity;

(q) “security level” means the qualification of the degree of risk that a security incident may be attempted or may occur;

(r) “security level 1” means the level for which minimum appropriate protective security measures shall be maintained at all times;

(s) “security level 2” means the level for which appropriate additional protective security measures shall be maintained for a period of time as a result of heightened risk of a security incident;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 65

(t) “security level 3” means the level for which further specific security measures shall be maintained for a limited period of time when a security incident is probable or imminent, although it may not be possible to identify the specific target;

(u) “ship” means ship as defined in sub-section (59) of section 3 of the Act;

(v) “ship security officer” means the person on board the ship, accountable to the master, designated by the company as responsible for the security of the ship, including implementation and maintenance of the ship security plan, and for liaison with the company security officer and port facility security officers;

(w) “ship security plan” means a plan developed to ensure the application of measures on board the ship designed to protect persons on board, cargo, cargo transport units, ship’s stores or the ship from the risks of a security incident;

(x) “training institute” means an institute approved by the Administration.

(2) The words and expressions used in these rules but not defined herein, shall have the respective meanings assigned to them in the Act, or the ISPS Code, or the Safety Convention.

4. Responsibility with respect to security. — (1) The designated authority shall set the appropriate security level for every port facility within its jurisdiction and shall ensure that information on the applicable security level, and any change therein, is communicated without delay to the port facilities concerned and to ships before entering, or while within, any port within its jurisdiction.

(2) The Administration shall set the appropriate security levels for ships entitled to fly its flag and ensure timely communication of such information on such security level and any change in the security level shall be updated as per the circumstances.

(3) In determining the security level referred to in sub-rules (1) and (2), due regard shall be given to—

(a) the credibility of threat information;

(b) the degree of corroboration of such information;

(c) the specificity or imminence of the threat; and

(d) the potential consequences of a security incident.

(4) Subject to regulations XI-2/3 and XI-2/7 of the Safety Convention, the Administration and the designated authority, as the case may be, shall provide guidance for protection against security incidents.

(5) The designated authority may authorise a recognised security organisation to undertake security related duties specified under Chapter XI-2 of the Safety Convention and Part A of the ISPS Code, as it considers appropriate, except the following, namely: ––66 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(a) ensuring protection of security-sensitive material relating to port facility security assessments and port facility security plans;

(b) approving a port facility security assessment and a port facility security plan, and amendments thereto;

(c) determining the port facilities required to designate a port facility security officer;

(6) The Administration shall be responsible for —

(a) ensuring protection of security-sensitive material relating to ship security assessments and ship security plans;

(b) exercising control and compliance measures in respect of ships in accordance with regulation XI-2/9 of the Safety Convention;

(c) establishing the requirements for a declaration of security as referred to in

rule 6;

(d) communicating information regarding any security breach and relevant mitigation measures to the International Maritime Organization and making such information available to the public; and

(e) resolving any inconsistency between safety and security requirements in ship operations to ensure that safety requirements prevail, and issuing necessary directions.

(7) The Administration and the designated authority shall, to the extent considered appropriate, test the effectiveness of ship security plans and port facility security plans, including amendments thereto.

5. Power of master for ship safety and security. — (1) The master shall not be constrained by the company, the charterer, or any other person from taking or executing any decision which, in the professional judgement of the master, is necessary for maintaining the safety and security of the ship including the authority to deny access to any person (other than those duly authorised by the Administration) or their effects and to refuse loading of cargo, containers or other closed cargo transport units.

(2) Where a conflict arises between the safety and security of the ship during its operations, the master–

(a) shall give effect to those requirements necessary to maintain the safety of the ship;

(b) may implement temporary security measures;

(c) shall inform the Administration or the contracting government in whose port the ship is operating or intending to enter.

(3) Any temporary security measures adopted under sub-rule (2) shall, to the highest practicable degree, be proportionate with the prevailing security level.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 67

(4) Upon being informed of such instances under sub-rule (2), the Administration shall take necessary steps to resolve the conflict and ensure that the possibility of recurrence is minimised.

6. Declaration of security. — (1) The Administration or the designated authority, as the case may be, shall determine as to when a declaration of security is required having regard to the risk posed by the ship and port interface or ship-to-ship activity, to persons, property, or the environment.

(2) A ship may request a declaration of security in the following circumstances, namely:––

(a) the ship is operating at a higher security level than the port facility, or another ship is interfacing with it; or

(b) there is an agreement on declaration of security between contracting governments covering certain international voyages or specific ships on those voyages; or

(c) there has been a security threat or a security incident involving the ship or port facility; or

(d) the ship is at a port which is not required to have an approved port facility security plan or its implementation; or

(e) the ship is conducting ship-to-ship activities with another ship not required to have an approved ship security plan or its implementation.

(3) Any request for a declaration of security shall be acknowledged by the applicable port facility or ship in accordance with Schedule-III in English.

(4) The declaration of security shall be completed by the —

(a) master or the ship security officer on behalf of the ship; and

(b) port facility security officer or, if the designated authority determines otherwise, by any other body responsible for shore-side security, on behalf of the port facility.

(5) The declaration of security shall address the security requirements that may be shared between a port facility and a ship or between the ships and shall state the responsibility for each of them.

(6) Every ship shall keep records of the declaration of security for a minimum period of three years.

(7) A change in the security level may require a new or revised declaration of security.

7. Duties of companies and ships. — (1) The companies shall comply with the applicable requirements of Chapter XI-2 of the Safety Convention and Part A of the ISPS Code, taking into account the guidance given in Part B of the said Code.

(2) Every ship shall comply with the applicable requirements of Chapter XI-2 of the Safety Convention and Part A of the ISPS Code, taking into account the guidance given in Part B68 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] of the said Code, and such compliance shall be verified and certified as provided for in Part A of the said Code.

(3) Prior to entering a port or while in a port within the territory of a contracting government, a ship shall comply with the requirements for the security level set by that contracting government.

(4) The ships shall respond without undue delay to any change to a higher security level.

(5) Where a ship is unable to comply with the requirements referred to in sub-rule (2) or with the security level set by the Administration or by another contracting government under sub-

rule (3), the ship shall notify the competent authority accordingly before commencing any ship and port interface or before entering the port, whichever is earlier, to enable the competent authority to take such measures as may be necessary to maintain the required security level.

(6) The company shall ensure that the master has available on board, at all times, information that enables officers duly authorised by the Administration to ascertain—

(a) the person responsible for the appointment of the members of the crew or of any other person who is employed or engaged on board the ship in any capacity in connection with the business of the ship;

(b) the person responsible for determining the employment of the ship; and

(c) the parties to any charter party under which the ship is employed.

(7) Every company shall––

(a) ensure that the ship security plan contains a clear statement emphasizing the authority of the master;

(b) provide in the ship security plan that the master shall have overriding authority and responsibility to take such decisions as are necessary with respect to the safety and security of the ship and to seek, where necessary, the assistance of the company, the Administration or any contracting government;

(c) designate a company security officer; and

(d) ensure that the company security officer, master, and the ship security officer are given necessary support to fulfill their duties in accordance with the Safety Convention.

8. Duties of recognised security organisation. — The recognised security organisation shall perform such duties as may be specified by the Administration for the purposes of these rules.

9. Ship security. — (1) Every ship shall operate at the security levels set by the Administration.

(2) At security level 1, every ship shall implement appropriate measures to identify and[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 69 prevent security incidents, including measures to—

(a) ensure the performance of all ship security duties;

(b) control access to the ship;

(c) control the embarkation of persons and their effects;

(d) monitor restricted areas to ensure access only by authorised persons;

(e) monitor deck areas and areas surrounding the ship;

(f) supervise the handling of cargo and stores in ship; and

(g) ensure that security communication is readily available.

(3) At security level 2, every ship shall implement the additional protective measures specified in the ship security plan for each of the measures referred to in sub-rule (2), having regard to Part B of the ISPS Code and such guidelines as may be issued by the Administration.

(4) At security level 3, every ship shall implement the specific protective measures specified in the ship security plan for each of the measures referred to in sub-rule (2), having regard to Part B of the ISPS Code and such instructions as may be issued by the Administration for the implementation of security level 3.

(5) Where the security levels are changed, the ship shall acknowledge receipt of the instructions relating to such change.

(6) Before entering a port, while in a port, or while within the territorial waters of India where security level 2 or security level 3 is in force, the ship shall—

(a) acknowledge receipt of the instructions relating to the applicable security level;

(b) confirm to the port facility security officer that the appropriate measures and procedures specified in the ship security plan have been initiated; and

(c) where security level 3 is in force, comply with any additional instructions issued by the Administration.

(7) Where a ship faces any difficulty in implementing the measures under this rule, the ship security officer shall immediately report the matter to the port facility security officer, and both officers shall liaise and coordinate to determine the appropriate action.

(8) Where a ship is operating at, or is required by the Administration to operate at, a security level higher than that applicable to the port which it intends to enter or in which it is already located, the ship shall, without delay, inform the Administration and the port facility security

officer of such higher security level:

Provided that the ship security officer shall coordinate with the port facility security officer and take such additional measures as may be necessary.70 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(9) Where the Administration requires an Indian ship to operate at security level 2 or security level 3 while in a port of another contracting government, it shall, without delay, inform the Government of that State accordingly.

(10) Where the Administration sets a security level for ships operating in the territorial waters of India or for ships intending to enter such waters, it shall communicate the applicable security level to such ships and shall—

(a) advise them to maintain vigilance and immediately report to the Administration and any nearby coastal State any information coming to their attention that may affect maritime security in the area; and

(b) advise them of any security measures required to be implemented by them and, where appropriate, of the measures taken by the Administration to protect against the identified threat.

10. Ship security assessment. — (1) The company security officer shall ensure that a ship security assessment is carried out for each of the ship in the fleet of the company by persons with appropriate skills to evaluate the security of a ship.

(2) A recognised security organisation may carry out the ship security assessment of a specific ship.

(3) The ship security assessment shall include an on-scene security survey to verify, at a minimum, the following elements, namely:—

(a) identification of existing security measures, procedures and operations;

(b) identification and evaluation of key ship board operations, which are important to protect;

(c) identification of possible threats to the key ship board operations and the likelihood of their occurrence, in order to establish and prioritise security measures; and

(d) identification of weaknesses, including human factors in the infrastructure, policies and procedures.

(4) The ship security assessment shall be prepared after taking into account the provisions of Part B of the ISPS Code.

(5) An initial ship security assessment shall be carried out before the ship is put into service.

(6) The ship security assessment shall be carried out as and when the Administration may deem necessary.

(7) The ship security assessment shall be documented, reviewed, accepted, and retained by the company.

11. Ship security plan. — (1) Every ship shall carry on board a ship security plan approved by the Administration providing for the security measures applicable at security levels 1, 2,[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 71 and 3 as provided in these rules and the ISPS Code.

(2) The review of a ship security plan or any amendment thereto, shall be undertaken by a recognised security organisation which was not involved in the preparation of the ship security assessment, the ship security plan or the amendment under review.

(3) The ship security plan shall be prepared and developed, taking into account the guidance given in Part B of the ISPS Code and shall be written in English and the working language of the ship.

(4) The ship security plan shall include the following, namely: –

(a) measures designed to prevent weapons, dangerous substances and devices intended for use against people, ships or ports and the carriage of which is not authorised to be taken on board the ship;

(b) identification of the restricted areas and measures for the prevention of unauthorised access;

(c) measures for the prevention of unauthorised access to the ship;

(d) procedures for responding to security threats or breaches of security, including provisions for maintaining critical operations of the ship or ship and port interface;

(e) procedures for responding to any security instructions given by the Administration at security level 3;

(f) procedures for evacuation in case of security threats or breaches of security;

(g) duties of shipboard personnel assigned security responsibilities and of other shipboard personnel on security aspects;

(h) procedures for auditing the security activities in accordance with Schedule III;

(i) procedures for training, drills and exercises associated with the ship security plan;

(j) procedures for interfacing with port facility security activities;

(k) procedures for the periodic review of the ship security plan and for updating;

(l) procedures for reporting security incidents;

(m) identification of the ship security officer;

(n) identification of the company security officer along with twenty-four-hour contact details;

(o) procedures to ensure inspection, testing, calibration and maintenance of any security equipment provided on board as per Schedule II;

(p) frequency for testing or calibration of any security equipment provided on board, if any;72 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(q) identification of the locations where the ship security alert system activation points are provided; and

(r) procedures, instructions and guidance on the use of the ship security alert system, including the testing, activation, deactivation and resetting to limit false alerts.

(5) The submission for approval of a ship security plan or amendments to a previously approved plan shall be accompanied by the security assessment on the basis of which the plan or the amendments have been developed.

(6) The personnel conducting internal audits of the security activities specified in the ship security plan, or evaluating the implementation of such plan, shall be independent of the activities being audited unless it is impracticable due to the size and the nature of the company or ship.

(7) No changes to an approved ship security plan or to any security equipment specified in an approved plan shall be implemented unless the relevant amendments to the ship security plan are approved by the Administration, and any such changes shall be as effective as those measures specified in the Safety Convention and ISPS Code.

(8) The changes to the ship security plan or the security equipment that has been approved by the Administration shall be documented in a manner that clearly indicates such approval which shall be made available on board and shall be presented together with the International Ship Security Certificate or the Interim Ship Security Certificate.

(9) The ship security plan may be kept in an electronic format and shall be protected from unauthorised access, deletion, destruction or amendment.

(10) The record of the ship security plan shall be protected from unauthorised access or disclosure.

(11) Where the officer duly authorised by the Administration has reasonable grounds to believe that a ship does not comply with the requirements of Chapter XI-2 of the Safety Convention or Part A of the ISPS Code, and that the only means of verifying or rectifying such non-compliance is by reviewing the relevant provisions of the ship security plan, the officer may, with the prior consent of the contracting government or the master of the ship concerned, be granted limited access to such part of the ship security plan as is necessary for the purpose of verifying or rectifying the non-compliance:

Provided that the provisions of the ship security plan relating to clauses (b), (d),

(e), (g), (o), (q) and (r) of sub-rule (5) shall–

(a) be a confidential information; and

(b) not be subject to inspection unless otherwise agreed to by the contracting government.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 73

12. Ship security alert system. — (1) A ship security alert system shall be installed in the following ships registered in India, namely:––

(a) ships constructed on or after 1st July, 2004;

(b) passenger ships, including high-speed passenger craft, constructed before 1st July, 2004 and not later than the first survey of the radio installation after 1st July, 2004;

(c) oil tankers, chemical tankers, gas carriers, bulk carriers and cargo high-speed craft of 500 gross tonnages and above constructed before 1st July, 2004, and not later than the first survey of the radio installation after 1st July, 2004; and

(d) other cargo ships of 500 gross tonnages and above and mobile offshore drilling units constructed before 1st July, 2004, and not later than the first survey of the radio installation after 1st July, 2006.

(2) The ship security alert system, when activated, shall —

(a) initiate and transmit a ship-to-shore security alert to the concerned company and the centre designated by the Administration, which shall identify the ship, its location and indicate whether the security of the ship is under threat or it has been compromised;

(b) not send the ship security alert to any other ship;

(c) not raise any alarm on board the ship; and

(d) continue the ship security alert until deactivated or reset.

(3) The ship security alert system shall —

(a) be capable of being activated from the navigation bridge and in at least one other location and to be fitted in a safe compartment with a power backup; and

(b) conform to performance standards not inferior to those adopted by the International Maritime Organization.

(4) The ship security alert system activation points shall be designed so as to prevent the inadvertent initiation of the ship security alert.

(5) When an alert of a security situation is received from an Indian registered vessel, the Administration shall contact the ship owner or company security officer and security agency to deal with such alert.

(6) On receipt of the information of ship security alert from an Indian ship, the centre designated by the Administration shall, in case the vessel is outside India, notify the coastal States in the vicinity of which the concerned ship is operating.

13. Records. — (1) The records of the following activities contained in the ship security plan shall be kept on board for a minimum period of three years, or as may be specified by the Administration, taking into account the Safety Convention, namely:––

(a) training, drills, and exercises;74 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(b) security threats and security incidents;

(c) breaches of security;

(d) changes in security level;

(e) communications relating to the direct security of the ship such as specific threats to the ship or to port facilities where the ship is, or has been;

(f) internal audits and reviews of security activities;

(g) periodic review of the ship security assessment;

(h) periodic review of the ship security plan;

(i) implementation of any amendments to the plan;

(j) maintenance, calibration and testing of security equipment, if any; and

(k) testing of the ship security alert system.

(2) The records specified in sub-rule (1) shall be maintained in English and the working language of the ship.

(3) The records specified in sub-rule (1) may be kept in an electronic format and shall be protected by the procedures to prevent unauthorised access, deletion, destruction, or amendment.

(4) The records specified in sub-rule (1) shall be protected from unauthorised access or disclosure.

14. Company security officer. — (1) Every company shall designate one or more company security officers who may act as the company security officer for one or more ships,

depending on the number or types of ships the company operates:

(2) Where the company security officer acts as a company security officer for one or more ships, it shall be clearly identified for which ship the company security officer shall be responsible.

(3) A company security officer shall possess the following minimum qualifications, namely:– –

(a) Management Level Certificate of Competency (Foreign Going) issued by Administration having merchant marine background for company having ships above 500 gross tonnage; and

(b) Company Security Officer Certificate from a training institute:

Provided that, in case of company having ships less than 500 gross tonnage, the company security officer shall have sailing experience on merchant ships with operation level Certificate of Competency (Foreign Going) issued by Administration and shall hold Company Security Officer Certificate from a training institute.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 75

(4) The company security officer shall perform the following duties, namely: —

(a) advising on the level of threats likely to be encountered by the ship, using appropriate security assessments and other relevant information;

(b) ensuring that ship security assessments are carried out;

(c) ensuring the development, the submission for approval, and implementation and maintenance of the ship security plan and to carry it on board of the individual ship;

(d) ensuring that the ship security plan is modified, as appropriate, to correct deficiencies and satisfy the security requirements of the individual ship;

(e) arranging for internal audits and reviews of security activities;

(f) arranging for the initial and subsequent verifications of the ship by the Administration or the recognised security organisation;

(g) ensuring that deficiencies and non-conformities identified during internal audits, periodic reviews, security inspections and verifications of compliance are promptly addressed and dealt with;

(h) enhancing security awareness and vigilance;

(i) ensuring adequate training for the personnel responsible for the security of the ship;

(j) ensuring effective communication and co-operation between the ship security officer and the port facility security officers;

(k) ensuring consistency between security requirements and safety requirements; and

(l) ensuring that any alternative or equivalent arrangements approved for a particular ship or group of ships are implemented and maintained.

15. Ship security officer. — (1) A management level officer of the ship holding ship security officer certificate from a training institute shall be designated as the ship security officer of the ship by the company.

(2) The ship security officer shall perform the following duties, including —

(a) undertaking regular security inspections of the ship to ensure that appropriate security measures are maintained;

(b) maintaining and supervising the implementation and amendment of the ship security plan;

(c) coordinating the security aspects of handling of cargo stores in ships with other ship-board personnel and with the relevant port facility security officers;

(d) proposing modifications to the ship security plan;

(e) reporting to the company security officer any deficiencies and non-conformities identified during internal audits, periodic reviews, security inspections and verifications76 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] of compliance and implementing any corrective actions;

(f) enhancing security awareness and vigilance on-board;

(g) ensuring that adequate training has been provided to ship-board personnel, as appropriate;

(h) reporting all security incidents;

(i) coordinating implementation of the ship security plan with the company security officer and the port facility security officer; and

(j) ensuring that security equipment is properly operated, tested, calibrated and maintained, if any.

16. Training, drills, and exercise on ship security. — (1) The ship-board personnel having specific security duties and responsibilities shall have sufficient knowledge and ability to perform their assigned duties, taking into account the guidance given in Part B of ISPS Code.

(2) To ensure the effective implementation of the ship security plan, drills shall be carried out at least once in every three months interval, taking into account the ship type, ship personnel changes, calling port facilities and other relevant circumstances including the guidance given in Part B of the ISPS Code.

(3) The company security officer shall ensure the effective coordination and implementation of ship security plans by participating in exercises at appropriate intervals, taking into account the guidance given in Part B of ISPS Code.

17. Port facility security. — (1) A port facility shall act upon the security levels set by the designated authority.

(2) The security measures and procedures shall be applied at the port facility in such a manner so as to cause a minimum interference to passengers, ship personnel, visitors, cargo and services.

(3) In order to identify and take preventive measures against security incidents and taking into account the guidance given in Part B of the ISPS Code, the appropriate measures at security level 1 in shall be undertaken in all port facilities including —

(a) ensuring the performance of all port facility security duties;

(b) controlling access to the port facility;

(c) monitoring of the port facility, including anchoring and berthing areas;

(d) monitoring restricted areas to ensure that only authorised persons have access;

(e) supervising the handling of cargo;

(g) ensuring that security communication is readily available.

(4) In addition to the security measures specified for security level 1, the additional protective measures specified in the port facility security plan shall be implemented at security level 2, taking into account the guidance given in Part B of the ISPS Code.

(5) Specific protective measures specified in the port facility security plan shall be implemented at security level 3 in addition to the security measures specified for security level 1 and level 2, taking into account the guidance given in Part B of the ISPS Code and the port facility shall respond to any security instructions as may be given by the designated authority.

(6) Each port shall have an independent qualified and trained port facility security officer.

(7) Where a ship ––

(a) encounters difficulties in complying with the requirements of Safety Convention or in implementing the appropriate measures and procedures specified in the ship security plan and in the case of security level 3, following any security instructions given by the designated authority, the port facility security officer and ship security officer shall coordinate and take appropriate actions;

(b) is at a security level, which is higher than that of the port facility, the port facility security officer shall report the matter to the designated authority and shall coordinate with the ship security officer and take appropriate actions, if necessary.

18. Port facility security assessment. — (1) The port facility security assessment shall be carried out by the designated authority or recognised security organisation for all Indian port

facilities:

Provided that where the port facility security assessment is carried out by the recognised security organisation, such port facility security assessment shall be reviewed and approved in compliance with the ISPS Code by the designated authority.

(2) The designated authority or recognised security organisation may nominate a surveyor to carry out the port facility security assessment.

(3) The persons carrying out the assessment shall have appropriate skills to evaluate the security of the port facility, taking into account the guidance given in Part B of the ISPS Code.

(4) The port facility security assessments shall periodically be reviewed and updated, taking into account changing threats in the port facility and be reviewed and updated when major changes to the port facility take place.

(5) The port facility security assessment shall include—

(a) identification and evaluation of important assets and infrastructure requiring protection;

(b) identification of possible threats to the assets and infrastructure and the likelihood of their occurrence;78 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(c) identification, selection and prioritisation of counter measures and procedural changes and their level of effectiveness in reducing vulnerability; and

(d) identification of weaknesses, including human factors, in the infrastructure, policies, and procedures.

(6) The designated authority may allow a port facility security assessment to cover more than one port facility if the operator, location, operation, equipment and design of such port facilities are similar.

(7) Upon completion of the port facility security assessment, a report shall be prepared, consisting of a summary of the assessment conducted, including a description of each vulnerability and counter measures that may be used to address such vulnerability.

(8) The report prepared under sub-rule (7) shall be protected from unauthorised access or disclosure.

19. Port facility security plan. — (1) Every port facility shall have a port facility security plan which shall be prepared and implemented by the port facility security officer.

(2) A port facility security plan shall––

(a) be developed and maintained, on the basis of a port facility security assessment, for each port facility, taking into account the ship and port interface;

(b) have provisions for the security level-1, security level-2 and security level-3;

(c) be approved by the designated authority;

(d) be developed taking into account the guidance given in Part B of ISPS Code and shall be in English.

(3) The port facility security plan shall include––

(a) measures designed to prevent weapons or any other dangerous substances and devices intended for use against people, ships or ports and the carriage of which is not authorised, from being introduced into the port facility or on board a ship;

(b) measures designed to prevent unauthorised access to the port facility, to ships moored at the facility, and to restricted areas of the facility;

(c) procedures for responding to security threats or breaches of security, including provisions for maintaining critical operations of the port facility or ship and port interface;

(d) procedures for responding to any security instructions at security level 3 given by the contracting government, in whose territory the port facility is located;

(e) procedures for evacuation in case of security threats or breaches of security;

(f) duties of port facility personnel assigned security responsibilities and of other facility personnel on security aspects;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 79

(g) procedures for interfacing with ship security activities;

(h) procedures for the periodic review of the plan and updating;

(i) procedures for reporting security incidents;

(j) identification of the port facility security officer along with twenty-four-hour contact details;

(k) measures to ensure the security of the information contained in the plan;

(l) measures designed to ensure effective security of cargo and the cargo handling equipment at the port facility;

(m) procedures for auditing the port facility security plan;

(n) procedures for responding in case the ship security alert system of a ship at the port facility has been activated; and

(o) procedures for facilitating shore leave, changes of crew members, access to visitors and representatives of seafarers’ welfare and labor organisations.

(4) The designated authority shall approve the amendments made to the port facility security plan.

(5) The port facility security plan may be kept in an electronic format and shall be protected by procedures to prevent its unauthorised access, deletion, destruction, or amendment.

(6) The records of the port facility security plan shall be protected from unauthorised access or disclosure.

(7) The designated authority may allow a port facility security plan to cover more than one port facility if the operator, location, equipment and design of such port facilities are similar.

(8) The personnel conducting internal audits of the security activities specified in the plan or evaluating its implementation shall be independent of the activities being audited.

(9) In case alternative arrangement with respect to the port facility security plan has been allowed by the designated authority, the particulars of the same shall be communicated to the International Maritime Organization by the Administration.

20. Port facility security advisory committee. — (1) For the purposes of security of port facilities, the port may constitute a port facility security advisory committee which shall consist of one representative from each of the following, namely: —

(a) port facility security officer of the respective ports;

(b) Customs Department;

(c) Narcotics Control Bureau;

(d) Central Intelligence Agencies;80 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(e) State Intelligence Agencies;

(f) Central Industrial Security Forces;

(g) Local Police;

(h) Immigration Department;

(i) Indian Navy;

(j) Indian Coast Guard;

(k) State Maritime Security Coordinator; and

(l) any other agency of the Central Government or State Government, as deemed fit by the Chairman or Chief Executive Officer of the port concerned.

(2) The Chairman of the major port shall head the port facility security advisory committee and chair any meeting thereof.

(3) In case of ports other than major ports, head of the Maritime Board or the concerned State Government with respect to the functioning of such ports shall chair the port facility

security advisory committee of all ports under their jurisdiction:

Provided that where the meeting of the port facility security advisory committee of ports other than major ports (non-Exim or non-container ports) is chaired by the nominee of the Chief Executive Officer or Secretary of the Maritime Board or the State Government, the report of port facility security advisory committee shall be approved by the Chairman or the Chief Executive Officer of the port.

(4) The port facility security advisory committee shall meet at least once in every six months

for security review of the port:

Provided that the committee shall meet at frequent intervals depending on the threat perception of the concerned port, if required.

(5) The port facility security advisory committee shall review the approved port facility security

plan of the port:

Provided that any proposed amendments accepted by the committee shall be incorporated in the port facility security plan and the same shall be forwarded to the designated authority for examination and approval after review by the recognised security organisation.

(6) Where a new port constitutes a port facility security advisory committee, the following conditions shall be complied with, namely:––

(a) the views of the committee members shall be addressed adequately in preparing the port facility security for such port;

(b) the port facility security plan shall be reviewed by the recognised security organisation;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 81

(c) the port facility security plan shall be vetted by the committee before its submission to the designated authority for verification and approval.

(7) After the approval of the port facility security plan, the concerned port shall approach the jurisdictional Mercantile Marine Department or the designated authority for the security audit and for issuance of statement of compliance and annual verification thereof, as the case may be.

21. Port facility security officer. — (1) A port facility security officer shall be designated for each port facility whose duties shall include—

(a) conducting an initial comprehensive security survey of the port facility, taking into account the relevant port facility security assessment;

(b) ensuring the preparation of the port facility security plan;

(c) implementing the port facility security plan;

(d) undertaking regular security inspections of the port facility to ensure the continuation of appropriate security measures;

(e) recommending and incorporating, as appropriate, amendments to the port facility security plan in order to correct deficiencies and to update the plan to take in to account applicable changes to the port facility;

(f) enhancing security awareness and vigilance of the port facility personnel;

(g) ensuring adequate training to be provided to personnel responsible for the security of the port facility;

(h) reporting to their relevant authorities and maintaining records of occurrences which threaten the security of the port facility;

(i) coordinating implementation of the port facility security plan with the company and ship security officers;

(j) coordinating with security services, as may be appropriate;

(k) ensuring that standards for personnel responsible for security of the port facility are met;

(l) ensuring that security equipment is properly operated, tested, calibrated and maintained;

(m) assisting ship security officers in confirming the identity of those seeking to board the ship;

(n) coordinating through the State maritime security coordinators with local maritime security agencies (Indian Navy or Coast Guard or Security Management Plan) for appraisal of the maritime security agencies on the coastal security levels in force of any incidents or upgrading or downgrading of port security levels;

(o) ensuring the participation of the port facility security organisation, without affecting82 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] the commercial operations of the port, in all coastal, port or maritime security exercises conducted by the maritime security agencies, the Indian Navy, the Indian Coast Guard or under the Security Management Plan, as the case may be, subject to sufficient prior notice.

(2) The port shall provide facilities to the port facility security officer for performing the duties under the Safety Convention, ISPS Code and these rules.

(3) The port facility security officer shall possess the following minimum qualification,

namely: —

(a) for major port, a Management Level certificate of competency (Foreign Going) issued by Administration having a merchant marine background;

(b) for ports, other than major ports,––

(i) with quay length of three hundred meters and above––

(A) a Management level certificate of competency (Foreign Going issued by Administration); or

(B) in case of ex-servicemen, shall have served in a post not below the rank of Commander in the Indian Navy, or equivalent in the Indian Coast Guard;

(ii) with quay length below three hundred meters,––

(A) shall have sailing experience on merchant ship at the level of Operation Level Officer; or

(B) in case of ex-servicemen, shall have served in a post not below the rank of Lieutenant Commander in the Indian Navy, or equivalent in the Indian Coast Guard;

(C) Master or Chief Engineer of near coastal vessel:

Provided that the designated authority may relax the above qualifications for non- EXIM ports.

(4) The EXIM port facilities shall engage one deputy port facility officer who shall possess the following qualifications, namely: —

(a) a Management level certificate of competency (near coastal vessel) issued by Administration having merchant marine background; or

(b) Operation level certificate of competency (Foreign Going) issued by Administration; or

(c) port facility security officer certificate; and

(d) be in the rank of Commission officer from the Indian Navy and the Indian Coast Guard with port facility security officer course.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 83

(5) The port facility security officer and port facility security personnel shall have the requisite knowledge and shall have undergone training, taking into account the guidance contained in Part B of the ISPS Code.

22. Training, drills and exercise on port facility security. — To ensure the effective implementation and coordination of the port facility security plan, drills shall be carried out at appropriate intervals, taking into account the types of operations, port’s personnel changes, the type of ship the port is serving and other relevant circumstances, taking into account the guidance contained in Part B of the ISPS Code.

23. Verification of ships. — (1) Every ship to which Part A of the ISPS Code applies, shall be subject to the following verifications, namely: —

(a) an initial verification, before the ship is put into service or before the certificate required under these rules is issued for the first time, which shall include a complete verification of the ship's security system and any associated security equipment covered by the relevant provisions of the Safety Convention, Part A of the ISPS Code and the approved ship security plan, so as to ensure that the ship's security system and associated security equipment—

(i) comply with the applicable requirements of the Safety Convention and Part A of the ISPS Code; and

(ii) are in a satisfactory condition and fit for the service for which the ship is intended;

(b) renewal verification at intervals specified by the Administration, not exceeding five years, except as otherwise specified in these rules so as to ensure that the security system and any associated security equipment of the ship and the approved ship security plan –

(i) comply with the applicable requirements of the Safety Conventions and Part A of the ISPS Code; and

(ii) is in satisfactory condition and fit for the service for which the ship is intended;

(c) at least one intermediate verification to be endorsed on the certificate between the second and third anniversary date of the certificate which shall include inspection of the security system and any associated security equipment of the ship so as to ensure that it remains satisfactory for the service for which the ship is intended;

(d) any additional verification as determined by the Administration.

(2) The verification specified in sub-rule (1) shall be carried out by officers of the

Administration in accordance with Schedule IV:

Provided that the Administration may entrust the verification to a recognised security organisation or principal officer at the jurisdictional Mercantile Marine Department.

(3) The Administration shall ensure the completeness and effectiveness of the verification and shall make the necessary arrangements to discharge its obligations under these rules.84 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(4) The ship's security system and any associated security equipment shall, after verification, be maintained so as to conform to the other provisions of the Safety Convention, Part A of the ISPS

Code and the approved ship security plan:

Provided that no change shall, after any such verification, be made to the ship's security system, any associated security equipment or the approved ship security plan except with the prior approval of the Administration.

24. Issue or endorsement of International Ship Security Certificate. — An International Ship Security Certificate shall be issued in the format specified in Schedule V after the initial or renewal verification and shall be issued or endorsed either by the Administration or by

the recognised security organisation or by the jurisdictional Mercantile Marine Department:

Provided that another contracting government may, at the request of the Administration, cause the ship to be verified and, if satisfied that the provisions of the ISPS Code are complied with, shall issue or authorise the issue of an International Ship Security certificate to the ship and, where appropriate, endorse or authorise the endorsement of that certificate on the ship, in accordance with these rules:

Provided further that a copy of the certificate and a copy of the verification report shall

be transmitted as soon as possible to the requesting contracting government:

Provided also that a certificate so issued shall contain a statement to the effect that it has been issued at the request of the contracting government and it shall have the same force and receive the same recognition as the certificate issued by the Administration.

25. Duration and validity of certificate. — (1) An International Ship Security Certificate shall be issued for such period as may be specified by the Administration, which shall not exceed five years.

(2) Where the renewal verification is completed within three months before the expiry date of the existing certificate, the new certificate shall be valid for a period not exceeding five years from the date of expiry of the existing certificate.

(3) Where the renewal verification is completed after the expiry date of the existing certificate, the new certificate shall be valid for a period not exceeding five years from the date of completion of the renewal verification.

(4) Where a certificate is issued for a period of less than five years, the Administration may extend the validity of the certificate beyond its date of expiry up to the maximum period

specified in the ISPS Code:

Provided that the verifications required under the ISPS Code, as applicable, shall be carried out where such certificate is issued for a period of five years.

(5) Where the renewal verification has been completed, but the new certificate has not been issued before the expiry of the existing certificate, the Administration, the recognised security organisation or the Mercantile Marine Department may endorse the existing certificate and such certificate shall remain valid for a further period not exceeding five months from the date of its expiry.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 85

(6) Where, at the time of expiry of a certificate, a ship is not in a port at which it is to undergo verification, the Administration may extend the validity of the certificate:

Provided that such extension shall be granted only for the purpose of enabling the ship to complete its voyage to the port at which it is to undergo verification, and only where it

appears proper and reasonable to do so:

Provided further that no such extension shall exceed three months, and a ship to which such extension has been granted shall not, upon its arrival at the port at which it is to undergo verification, be entitled, by virtue of such extension, to leave that port without first

obtaining a new certificate:

Provided also that where the renewal verification has been completed, the new certificate shall be valid for a period not exceeding five years from the date of expiry of the existing certificate prior to such extension.

(7) Where a certificate issued to a ship engaged on short voyages which has not been extended under the foregoing provisions, the Administration may extend the validity of the

certificate for a period of not exceeding one month from the date of its expiry:

Provided that where the renewal verification has been completed, the new certificate shall be valid for a period not exceeding five years from the date of expiry of the existing certificate prior to such extension.

(8) Where an intermediate verification is completed before the prescribed period, —

(a) the expiry date specified in the certificate shall be amended by endorsement to a date not more than three years after the date on which the intermediate verification was completed;

(b) the expiry date specified in the certificate may remain unchanged provided that one or more additional verifications are carried out so that the maximum intervals between the verifications specified under the ISPS Code are not exceeded.

(9) A certificate issued under these rules shall cease to be valid in any of the following cases, namely: —

(a) if the relevant verifications are not completed within the periods specified under this rule;

(b) if the certificate is not endorsed in accordance with the applicable rules;

(c) where a company assumes the responsibility for the operation of a ship not previously operated by that company; and

(d) upon transfer of the ship to the flag of another State.

(10) Where a ship is transferred from the flag of another contracting government for registration under the Act, that contracting government shall, as soon as practicable, transmit to the Administration copies of, or all information relating to, the International Ship Security Certificate held by the ship immediately before the transfer, together with copies of any available verification reports.86 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(11) Where a company assumes responsibility for the operation of a ship not previously operated by it, the previous company shall, as soon as practicable, transmit to the receiving company copies of, or all available information relating to, the International Ship Security Certificate, and provide such assistance as may be necessary to facilitate the verifications required under this rule.

26. Interim certification. — (1) A certificate under rule 24 shall be issued only if the Administration is satisfied that the ship complies with the requirements of the ISPS Code

and the Safety Convention:

Provided that pending the issue of a certificate under rule 24, the Administration may cause an Interim International Ship Security Certificate to be issued, in any of the following cases, namely: —

(a) a ship without a certificate, on delivery or prior to its entry or re-entry into service;

(b) transfer of a ship from the flag of a contracting government for registration under the Act;

(c) transfer of a ship for registration under the Act, from a State which is not a contracting government; or

(d) when a company assumes the responsibility for the operation of a ship not previously operated by that company.

(2) An Interim International Ship Security Certificate shall be issued only if the designated authority or the recognised security organisation has verified compliance with the following conditions, namely: —

(a) the ship security assessment required by Part A of the International Ship and Port Facility Security Code has been completed;

(b) a copy of the ship security plan, complying with the requirements of the Safety Convention and Part A of the ISPS Code is available on board, and the ship security plan–

(i) has been submitted for review and approval; and

(ii) is being implemented on the ship;

(c) the ship is provided with a ship security alert system complying with the requirements of the Safety Convention;

(d) the company security officer—

(i) has ensured review of the ship security plans for compliance with Part A of the ISPS Code;

(ii) has ensured that the plan has been submitted for approval;

(iv) has established the necessary arrangements, including arrangements for drills, exercises and internal audits, and is satisfied that the ship will successfully complete the verification required under sub-rule (1) of rule 23, within a period of six months;

(e) arrangements have been made for carrying out the required verifications under

rule 23;

(f) the master, the ship security officer and the personnel of other ship with specific security duties,–

(i) are familiar with their duties and responsibilities under Part A of the ISPS Code and the relevant provisions of the ship security plan kept on board; and

(ii) have been provided such information in the English; and

(g) the ship security officer complies with the requirements of Part A of the ISPS Code.

(3) An Interim International Ship Security Certificate may be issued by the Administration or by a recognised security organisation.

(4) An Interim International Ship Security Certificate shall remain valid for a period of six months from the date of its issue, or until the certificate required by these rules are issued, whichever is earlier, and shall not be extended beyond that period.

(5) The Administration shall not cause a subsequent, consecutive Interim International Ship Security Certificate to be issued to a ship if it is satisfied that the request for such certificate is made by the company or the ship for the purpose of avoiding compliance with the requirements of the Safety Convention and Part A of the ISPS Code beyond the period of validity of the initial Interim International Ship Security Certificate, as required under these rules.

(6) For the purposes of the Safety Convention, the Administration may, before accepting an Interim International Ship Security Certificate as a valid certificate, satisfy itself that the requirements of these rules have been complied with.

27. Suspension or withdrawal of certification. — The Administration may suspend or withdraw the International Ship and Port Facility Security Certificate, in case of the following circumstances, namely: —

(a) corrective actions are not completed within the stipulated time;

(b) periodical verification is not completed;

(c) amendments to ISPS Code are not taken into account;

(d) there is evidence of minor non-conformity or major non-conformity; or

(e) substantial modification to the ship or port facility Security Management System is not notified to the Administration.88 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

28. Verification and certification of port facilities. — (1) For the purpose of issuing a statement of compliance to a port facility, the designated authority shall conduct an initial verification, by—

(a) reviewing the relevant documents to verify that the port facility security system complies with requirements of the ISPS Code; or

(b) conducting an audit of the port facility to verify that the port facility security system has been operating effectively for a period of at least three months.

(2) Every port facility in respect of which a statement of compliance has been issued shall undergo an intermediate verification between the second and the third anniversary date of the certificate issued under these rules in order to maintain the validity of such certificate and to verify the following particulars, namely: –

(a) the effective functioning of the port facility security system;

(b) that any modifications made to the port facility security system complies with the requirements of the ISPS Code; and

(c) the satisfactory implementation of any corrective actions.

(3) Every port facility shall undergo an annual verification to ensure the continued compliance of its port facility security system with the requirements of the ISPS Code.

29. Power to implement equivalent security measures. –– The Administration or the designated authority, as the case may be, may permit an Indian ship, a port facility, or a class or group of Indian ships or port facilities to implement equivalent security measures in lieu of the security measures prescribed under these rules, if it is satisfied that such

equivalent security measures are at least as effective as those provided under these rules:

Provided that the Administration shall communicate the particulars of the equivalent security measures so permitted to the International Maritime Organization.

30. Duties of ships. –– Every ship entering a port within the jurisdiction of India shall submit a pre-arrival notification (PANS) to the designated authority at least ninety-six hours before its arrival at such port, in the form specified in Schedule VI:

Provided that where the duration of the voyage is less than ninety-six hours, the pre- arrival notification shall be submitted within two hours of the ship's departure from the last port.

31. Power to issue directions and guidelines. –– The Central Government may issue such directions or guidelines, not inconsistent with the Act or these rules, as may be necessary for giving effect to the provisions of the Safety Convention, the ISPS Code, or these rules.

32. Fees. – (1) Every port, ship, company, person or body of persons to whom these rules apply shall pay fees specified in Schedule VII for the services provided under these rules.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 89

(2) The fees payable in respect of any non-compliance and the necessary measures applicable thereto shall be as specified in Schedule VII.

(3) All fees payable under these rules shall be paid through Bharat Kosh portal - www.bharatkosh.gov.in.

(4) No fee paid under these rules shall be refunded.

33.
