1. सजं िप्त नाम और प्रारंभ.

(1) इन जिजनयमों का संजिप् त नाम भारतीय प्रजतस्ट् पधाा आयोग (साधारण) जिजनयम, 2024 ह।ै

(2) ये जिजनयम रािपत्र म ेंउनके प्रकािन की तारीख को प्रिृत् त होंगे।

2. पररभाषाए.ं

(1) इन जिजनयमों में, िब तक दक संिभा से अन् यर्ा अपेजित न हो,— 5934 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (क) “अजधजनयम” से प्रजतस्ट् पधा ाअजधजनयम, 2002 (2003 का 12) अजभप्रेत ह;ै (ख) “अजधिक्त ा” से अजधिक्त ा अजधजनयम, 1961 में यर्ापररभाजषत कोई अजधिक्त ा अजभप्रेत ह;ै (ग) “अध् यि” से अजधजनयम की धारा 8 की उपधारा (1) के अधीन जनयुक्त अध् यि अजभप्रेत ह;ै (घ) “आयोग” से अजधजनयम की धारा 7 की उपधारा (1) के अधीन स्ट् र्ाजपत भारतीय प्रजतस्ट्प धाा आयोग अजभप्रेत ह;ै (ङ) “परामिी” से अजधजनयम की धारा 35 के स्ट् पष्ट ीकरण म ें यर्ापररभाजषत कोई जिजध व् यिसायी या सनिी लेखाकार या कंपनी सजचि या लागत लेखाकार अजभप्रेत है;

(च) “महाजनिेिक” से अजधजनयम की धारा 16 की उपधारा (1) के अधीन जनयुक्त आयोग का महाजनिेिक अजभप्रेत ह ै और इसके अतं गात अजधजनयम की उस धारा के अधीन जनयुक्त कोई अपर, संयुक् त, उप या सहायक महाजनिेिक सजम्मजलत ह;ै (छ) “इलेक्र ोजनक रूप” का िही अर् ाहोगा िो सूचना प्रौद्योजगकी अजधजनयम की धारा 2(1)(ध) म ेंहै;

(ज) “जििेषज्ञ” स े अजधजनयम की धारा 17 की उपधारा (3) के अधीन आयोग की सहायता करन े के जलए जनयोजित कोई जििेषज्ञ या अजधजनयम की धारा 36 की उपधारा (3) के अधीन दकसी िांच या कायािाही में आयोग की सहायता के जलए बुलाया गया कोई जििेषज्ञ अजभप्रेत है;

(झ) “अंतिती आिेिन” से आयोग के कोई आिेि या जनिेि की अनुपालना म ें की गई प्रस्ट् तुजतयों के जसिाय, अजधजनयम की धारा 19 के अधीन संजस्ट्र्त मामले या प्रकीणा आिेिन के अनुसरण में आरंभ की गई कायािाजहयों के अजनणीत रहने के िौरान आयोग के समि में फाइल दकया गया आिेिन अजभप्रेत ह;ै (ञ) “मीजडया” म ें समाचार पत्र, मैगिीन, पजत्रकाए,ं िनाल, रेजडयो, जसनेमा, टेलीजििन और इंटरनेट सजम्मजलत ह;ै (ट) “प्रकीणा आिेिन” स े आयोग के कोई आिेि या जनिेि की अनुपालना में की गई प्रस्ट्त ुजतयों के जसिाय, अजधजनयम की धारा 19 के अधीन संजस्ट्र्त मामल े में अंजतम आिेि पाररत करने के पश् चात आयोग के समि फाइल दकया गया आिेिन अजभप्रेत है;

(ठ) “सामान् य बैठक” का िही अर्ा होगा िो उसका भारतीय प्रजतस्ट् पधाा आयोग (कारबार सव्ं यिहार हते ु बैठक) जिजनयम, 2009 में ह;ै (ड) “प्रजतजनिेि” स ेकोई जनम्न जलजखत प्रजतजनिेि अजभप्रते ह–ै

(i) अजधजनयम की धारा 19 की उपधारा (1) के खडं (ख) के अधीन केन् द्रीय सरकार या दकसी राज्य सरकार या दकसी कानूनी प्राजधकारी से आयेाग को प्राप् त कोई प्रजतजनिेि, या

(ii) अजधजनयम की धारा 21 के अधीन दकसी कानूनी प्राजधकारी से आयोग को राय के जलए प्राप्त कोई प्रजतजनिेि, या

(iii) अजधजनयम की धारा 21क के अधीन आयोग द्वारा दकसी कानूनी प्राजधकारी को राय के जलए भेिा गया कोई प्रजतजनिेि, या

(iv) अजधजनयम की धारा 49 की उपधारा (1) के अधीन केन् द्रीय सरकार या दकसी राज्य सरकार से राय के जलए आयोग को प्राप् त कोई प्रजतजनिेि।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (ढ) “सजचि” से अजधजनयम की धारा 17 की उपधारा (1) के अधीन जनयुक्त सजचि अजभप्रेत ह ै और इसम ें सजचि के रूप म ेंकाया करने के जलए अध् यि द्वारा प्राजधकृत आयोग का कोई प्राजधकारी सजम्मजलत है;

(ण) “अजधकरण” से अजधजनयम की धारा 53क की उपधारा (1) के अधीन जनर्िाष् ट राष्र ीय कंपनी जिजध अपील अजधकरण अजभप्रेत ह;ै (त) आयोग के नई दिल्ल ी जस्ट्र्त कायाालय या दकसी अन् य कायाालय के ‘‘कायादििस’’ से ऐसा दििस अजभप्रेत ह,ै जिसको िह कृत् य करता ह ै ककंतु इसमें िजनिार या रजििार या ऐसा कोई अन् य दििस सजम्मजलत नहीं ह,ै जिसे केन् द्रीय सरकार द्वारा, यर्ाजस्ट्र्जत, नई दिल् ली के जलए या ऐसे दकसी अन् य स्ट्र् ान के जलए परक्राम् य जलखत अजधजनयम, 1881 (1881 का 26) के अधीन लोक अिकाि के रूप में घोजषत दकया गया ह;ै

(2) इन जिजनयमों में प्रयुक् त ऐसे िब् िों और पिों का, िो पररभाजषत नहीं ह ैं क्रमि: िही अर् ा होगा, िो उनका, यर्ाजस्ट्र्जत, अजधजनयम या कंपनी अजधजनयम, 2013 (2013 का 18) म ेंह।ै

3. कजतपय पररजस्ट्र्जतयों म ेंप्रदक्रया अिधाररत करन ेकी िजि. ऐसी दकसी पररजस्ट्र्जत में, जिसके जलए इन जिजनयमों में उपबंध नहीं दकया गया है, आयोग लेखबद्ध दकए िाने िाले कारणों से, दकसी जिजिष्ट मामले म ेंप्रदक्रया अिधाररत कर सकेगा।

4. मद्रु ा और प्रतीक. आयोग की िासकीय मुद्रा और प्रतीक इसके सार् अनलु ग् नक में उपिर्िात आलेख के अनुसार होंगे।

5. आयोग की भाषा. आयोग की भाषा अग्रं ेिी होगी।

6. हहिं ी म ेंिस्ट्त ाििे ों को फाइल करना. इन जिजनयमों म ें दकसी बात के होत े हुए भी, पिकार यदि ि े ऐसी िांछा करते ह ैं तो िस्ट्त ािेि हहिं ी म ें फाइल कर सकेंगे: परंतु उनसे संबंजधत कोई भी सूचना, प्रजतजनिेि या आिेिन या अन् य पत्र अग्रं ेिी भाषा से जभन् न दकसी अन्य भाषा में आयोग द्वारा तब तक स्ट् िीकार नहीं दकए िाएंगे िब तक दक उनके सार् जिजनयम 7 में यर्ाजिजहत अनुसार, उनकी अंग्रेिी में सत् य अनुिाि की एक प्रजत न लगी हो।

7. िस्ट्त ाििे ों का अनिु ाि. अंग्रेिी म ेंअनुदित िस्ट् तािेि को आयोग द्वारा सही अनुिाि के रूप में प्रजतग्रहीत दकया िाएगा यदि: (क) पिकार का परामिी, अनुिाि का सत् य अनुिाि होना प्रमाजणत करता ह;ै या (ख) अनुिाि, दकसी न् यायालय के िासकीय अनुिािक द्वारा दकया िाता ह;ै या (ग) अनुिाि, ऐसे दकसी प्राजधकारी/जनकाय, केन् द्रीय या राज्य सरकार के िासकीय अनुिािक द्वारा दकया िाता ह ै िो न् यायालयों द्वारा सत् य अनुिाि के रूप म ेंभी स्ट् िीकार दकया िाता ह:ै परंत ु यह दक उपयुक् त मामलों म ें ऐसा कोई अनुिाि, जिस पर कायािाजहयों के सभी पिकार सहमत हैं, आयोग द्वारा सत् य अनुिाि के रूप म ेंस्ट् िीकार दकया िा सकेगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

8. आयोग द्वारा मनाए िान ेिाल ेअिकाि.

(1) आयोग का प्रधान कायाालय, िजनिार और रजििार के अलािा दिल् ली म ें केन् द्रीय सरकार द्वारा परक्राम् य जलखत अजधजनयम, 1881 (1881 का 26) के अधीन घोजषत अिकािों को भी मनाएगा।

(2) दिल् ली से जभन् न स्ट्र् ानों पर जस्ट्र्त आयोग को कोई अन् य कायाालय, िजनिार और रजििार के अलािा उस स्ट्र् ान के जलए केन् द्रीय सरकार द्वारा परक्राम् य जलखत अजधजनयम, 1881 (1881 का 26) के अधीन घोजषत अिकािों को भी मनाएगा।

9. समय की सगं णना.

(1) िहां दकसी कारािाई को करने या कायािाही को प्रारंभ करने के जलए इन जिजनयमों के द्वारा या अधीन दकसी काया या घटना के जलए दकसी दििस से दकसी कालािजध की गणना करना जिजहत या अनुज्ञात दकया गया है, िहां िह समय, उक्त दिन या ऐसे काया या घटना, जिससे िह समय प्रारंभ होना ह,ै को छोड़कर संगजणत दकया िाएगा।

(2) िहां इन जिजनयमों के अधीन दकसी कारािाई को करने या कायािाही को प्रारंभ करने के जलए कोई समय जिजहत या अनज्ञु ात दकया गया ह ै और िह समय िजनिार या रजििार या दकसी ऐसे दििस को समाप् त हो रहा ह,ै जिस दिन आयोग का कायाालय बंि है, िहा ं ऐसी कारािाई को या ऐसी कायािाही को िजनिार, रजििार या कायाालय बंि रहने के दििस के पश् चात् अगल ेप्रर्म कायादििस को प्रारंभ दकया िा सकेगा।

10. सचू ना या प्रजतजनििे की अतं िस्ट्ा त .ु

(1) अजधजनयम की धारा 19 के अधीन फाइल की गई सूचना या प्रजतजनिेि म ें अन् य बातों के सार्-सार्, पर्ृ क और स्ट् पष्ट रूप से जनम्न जलजखत क्रमबद्ध कर्न होगा- (क) सूचना या प्रजतजनिेि को प्रस्ट्त ुत करन े िाले व् यजि या उद्यम का जिजधक नाम;

(ख) आयोग द्वारा समनों या सूचनाओं के प्रेषण के जलए पोस्ट् टल इंडेक्स नंबर (जपन) कोड सजहत भारत में पणू ा डाक पता; (ग) संपका का ब् यौरा (टेजलफोन न.ं , मोबाइल नं. जिसके अंतगात िेि/नगर/िेत्र का कोड, इलेक्र ोजनक मेल पता भी ह)ैं ;

(घ) परामिी या अन् य प्राजधकृत प्रजतजनजध, यदि कोई हो, का जिजधक नाम और पता; और (ङ) ऐसे उद्यम(उद्यमों) का, जिसने अजभकजर्त रूप से अजधजनयम के उपबंधों का उल्ल ंघन दकया ह,ै जिजधक नाम और पता(पत)े ।

(2) उपजिजनयम (1) में जनर्िाष्ट सूचना या प्रजतजनििे म ेंजनम्न जलजखत अतं र्िाष्ट होंगे – (क) घटनाओं के उसके समय के अनसु ार तथ्य ों का संजिप् त कर्न; (ख) अजधजनयम के अजभकजर्त उल्ल घं न के ब् यौरे, प्रत् यके अजभकजर्त उल्ल ंघन के समर्ान में प्रस्ट् ततु दकए िाने िाले, यर्ाजस्ट्र्जत, सभी िस्ट्त ािेिों, िपर्पत्रों और साक्ष्य ों को सूचीबद्ध करने िाली सूची सजहत;

(ग) िह तारीख जिसको िाि हते ुक उद्भूत हुआ; (घ) अजभकजर्त उल् लघं न के समर्ान में संजिप् त िणान;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 (ङ) क्या यर्ाजस्ट्र्जत, सूचना या प्रजतजनिेि म ें समुत् र्ाजपत िही या सारत: िही तथ्य और मुद्दे, आयोग द्वारा अपन ेदकसी पूिा आििे (आिेिों) में पहले ही जिजनजित दकए िा चुके हैं, तत्स ंबंधी ब्यौरे सजहत;

(च) मांगा गया अनतु ोष, यदि कोई हो; (छ) सूचना की जिषय-िस्ट् त ु के संबंध में दकसी न् यायालय, अजधकरण, कानूनी प्राजधकरण या मध् यस्ट्र् के समि सूचना िेने िाल ेऔर पिकारों के बीच अजनणीत मुकिमेबािी या जििाि, यदि कोई हो, के ब् यौरे; और (ज) ऐसी अन् य जिजिजियां, िो आयोग को अपेजित हो।

(3) यदि उपजिजनयम (1) म ें जनर्ििा सूचना या प्रजतजनििे , उस तारीख, जिसको िाि हते ुक उद्भूत हुआ र्ा, स े तीन िषा के पश् चात् फाइल दकया िाता ह,ै तो उसके सार् जिलंब के जलए पयााप्त कारण ििाात े हुए जिलंब की माफी मांगने िाला अंतिाती आिेिन, इन जिजनयमों के जिजनयम 50 के उपजिजनयम (2) के जनबधं नों के अनुसार लाग ू िुल्क के सार् सलं ग्न दकया िाएगा।

(4) उपजिजनयम (1) और (2) के अधीन उजल्लजखत सूचना या प्रजतजनिेि की अंतिास्ट्तु, उनके पररजिि और संलग्नक सजहत, उपजिजनयम (3) के अधीन आिेिन के सार् पूण ा होगी और उन् ह ें प्रस्ट्ततु करन े िाल े व्यजि द्वारा उसकी अंतिास्ट्त ुका सम् यक रूप से सत्यापन करन े िाल े िपर्पत्र के सार् सम् यक रूप से समर्र्ता होगी।

11. सचू ना या प्रजतजनििे पर हस्ट्त ािर.

(1) कोई सूचना या प्रजतजनििे या आयोग द्वारा िारी दकसी सूचना या जनिेि का कोई उत् तर जनम्न जलजखत द्वारा हस्ट्त ािररत दकया िाएगा - (क) स्ट् ियं व् यजि द्वारा, जिसमें दकसी प्रोपराइटरी फम ाका एकमात्र प्रोपराइटर सजम्मजलत है;

(ख) दकसी जहन्ि ुअजिभक्त कुटुंब (एचयूएफ) की ििा में कता;ा (ग) दकसी कंपनी की ििा म ें प्रबंध जनिेिक, जनिेिक बोड ा द्वारा सम् यक रूप स े प्राजधकृत कोई अन्य जनिेिक या कोई कमाचारी; (घ) दकसी संगम या सोसाइटी या उसी प्रकार के दकसी जनकाय की ििा में अध् यि या सजचि या उस जिजधक जलखत, जिसके द्वारा सगं म या सोसाइटी या जनकाय का सृिन दकया गया र्ा, इस प्रकार प्राजधकृत कोई व् यजि;

(ङ) दकसी भागीिारी फमा की ििा में भागीिार या भागीिारी फामा द्वारा सम् यक रूप से प्राजधकृत कोई कमाचारी; (च) दकसी सहकारी सोसाइटी या स्ट् र्ानीय प्राजधकरण की ििा में मुख्य कायापालक अजधकारी या बोडा द्वारा सम् यक रूप से प्राजधकृत तत्स ंबधं ी कोई कमाचारी/अजधकारी;

(छ) दकसी अन् य व् यजि की ििा म ें िह व् यजि या उसकी ओर से कारािाई करने के जलए सम्य क रूप स े प्राजधकृत कोई अन् य व् यजि।

(2) कोई प्रजतजनिेि, यदि िह केन्द्र ीय सरकार या राज्य सरकार से या काननू ी प्राजधकरण स े प्राप् त होता ह ै तो भारत सरकार के संयुक् त सजचि या राज्य सरकार के दकसी समतुल् य अजधकारी या दकसी काननू ी प्राजधकरण के मुख्य कायापालक अजधकारी या कानूनी प्राजधकरण के बोडा द्वारा सम् यक रूप से प्राजधकृत कोई अन् य से जनम्न स्ट् तर के अजधकारी द्वारा हस्ट् तािररत और अजधप्रमाजणत नहीं दकया िाएगा।

(3) इन जिजनयमों के उपबंधों पर कोई प्रजतकूल प्रभाि डाल े जबना, परामिी भी, यर्ाजस्ट्र्जत, सूचना या प्रजतजनिेि पर अपन ेहस्ट्त ािर कर सकेगा/सकेगी।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

12. सचू ना या प्रजतजनििे फाइल करन ेकी प्रदकया.

(1) सूचना या प्रजतजनिेि या आयोग को उनके प्रत् युत् तर को सजचि या सजचि द्वारा इस जनजमत्त प्राजधकृत दकसी अजधकारी को स्ट् िय ं व् यजि द्वारा प्रस्ट् तुत दकया िाएगा या सजचि या ऐसे प्राजधकृत अजधकारी के नाम स े रजिस्ट् रीकृत डाक या कुररयर सिे ा या फैक्स ीमाइल प्रेषण द्वारा भेिा िाएगा।

(2) ऐसे दकन् हीं पर्ृ क या अजतररक्त िस्ट्त ािेि(िस्ट् तािेिों), जिन् ह ें सचू ना िेन े िाला, यर्ाजस्ट्र्जत, अपनी सूचना या प्रजतजनिेि के समर्ान म ें प्रस्ट्त ुत करना चाहता ह,ै को यर्ाजस्ट्र्जत, सूचना या प्रजतजनििे फाइल करने के 14 (चौिह) दििसों के भीतर ‘’पुजस्ट्तका’’ रूप में फाइल करेगा। ऐसे िस्ट् तािेिों को क्रम संख् यांदकत दकया िाएगा और उनकी अनुक्रमजणका तैयार की िाएगी और िे उन् हें प्रस्ट्तुत करन े िाले व्यजि द्वारा उसकी अंतिास्ट्तु का सम् यक रूप से सत्यापन करन े िाले िपर्पत्र के सार् सम् यक रूप से समर्र्ात होगी।

(3) उपजिजनयम (1) के अधीन डाक या कुररयर सेिा या फैक्स ीमाइल प्रेषण द्वारा भेिी गई सूचना या प्रजतजनििे को उस तारीख को सजचि या सजचि द्वारा प्राजधकृत दकसी अजधकारी को प्रस्ट् तुत दकया गया माना िाएगा, जिसको िह, यर्ाजस्ट्र्जत, सजचि या प्राजधकृत अजधकरी के कायाालय में प्राप् त होता ह।ै

13. सचू ना या प्रजतजनििे को इलक्ै र ॉजनक रूप म ें फाइल करन ेकी प्रदक्रया. जिजनयम 10 और 11 के अधीन रहत े हुए, आयोग को कोई सूचना या प्रजतजनिेि दकसी व्य जि या उद्यम द्वारा आयोग के सजचि को इलैक्र ाजनक रूप में भेि िा सकेगा, िो िब कभी आयोग द्वारा दकसी लोक सूचना के माध् यम स े िांछा की िाए, अजभिायी के अकं ीय हस्ट् तािर और/ या इलैक्र ाजनक हस्ट् तािर से सम् यक रूप स ेअजधप्रमाजणत होगी:

व्य ाख्य ा – इस जिजनयम के प्रयोिन के जलए,– (क) “अंकीय हस्ट्त ािर” स े सूचना प्रौद्योजगकी अजधजनयम, 2000 (2000 का 21) की धारा 2 की उपधारा (1) के खंड (त) के अधीन यर्ापररभाजषत अंकीय हस्ट् तािर अजभप्रेत ह;ै (ख) दकसी सूचना या िस्ट् तािेि के प्रजतजनिेि से “इलैक्र ॉजनक रूप” से सूचना प्रौद्योजगकी अजधजनयम, 2000 (2000 का 21) की धारा 2 की उपधारा (1) के खंड (ि) के अधीन यर्ापररभाजषत इलैक्र ॉजनक रूप अजभप्रते ह;ै (ग) “इलैक्र ॉजनक हस्ट् तािर” स े सूचना प्रौद्योजगकी अजधजनयम, 2000 (2000 का 21) की धारा 2 की उपधारा

(1) के खंड (नक) के अधीन यर्ापररभाजषत इलैक्र ॉजनक हस्ट्त ािर अजभप्रेत ह;ै (घ) “अजभिायी” से सूचना प्रौद्योजगकी अजधजनयम, 2000 (2000 का 21) की धारा 2 की उपधारा (1) के खडं (यछ) के अधीन यर्ापररभाजषत अजभिायी अजभप्रेत ह।ै

14. और प्रस्ट्त तु ीकरण फाइल करना. सभी और प्रस्ट्त तु ीकरणों जिसके अंतगात कोई पिकार द्वारा फाइल दकए गए उत्तर, पत्र, िस्ट्तािेि, आिेिन, आिेप या सुझाि आदि भी ह,ैं पर फाइल करन े और हस्ट् तािर करन े के संबंध म ें इन जिजनयमों के जनम् नजलजखत उपबधं लाग ू होंगे:

(क) जिजनयमन 10 के उपजिजनयम (1) के खडं (क), (ख) और (ग); (ख) जिजनयमन 10 का उपजिजनयम (4); (ग) जिजनयमन 11 का उपजिजनयम (1); (घ) जिजनयमन 11 का उपजिजनयम (3);[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 (ङ) जिजनयमन 12 का उपजिजनयम (1);

(च) जिजनयमन 12 का उपजिजनयम (3); और (छ) जिजनयमन 13: परंत ु यह दक उपरोि खंड (ख) और (ग) म ें अतं र्िाष्ट उपबंध, दकसी पिकार द्वारा फाइल दकए गए समय जिस्ट् तारण और/या स्ट्र्गन की मांग करने िाल ेआिेिनों पर लागू नहीं होंगे।

15. सजचि की िजिया ंऔर कृत्य .

(1) आयोग के अजभलेख सजचि की अजभरिा म ें रहगें े और िह ऐस े अन् य कृत् यों का जनिाहन करेगा िो अध् यि द्वारा समनुिेजित दकए िाएं।

(2) भारतीय प्रजतस्ट् पधा ा आयोग (कारबार संव् यिहार हते ु बैठक) जिजनयम, 2009 के अधीन रहत े हुए, सजचि सभी संबंजधत व् यजियों को अध् यि के जनिेिों के अनुसार प्रत् येक बठै क की तारीख, समय और स्ट् र्ान का पररचालन करेगा।

(3) सजचि जनम्न जलजखत के जलए आयोग की ओर से नोडल अजधकारी होगा, – (क) सभी कानूनी संसूचनाओं को िेने या प्राप् त करने: परंत ु यह दक अध् यि, प्रयोिन के जलए आयोग के अन् य अजधकारी को भी प्राजधकृत कर सकेगा। (ख) अजधजनयम की धारा 18 के अनुसार आयोग और केन्द्र ीय सरकार के पूि ा अनुमोिन से दकसी औपचाररक संबंध को बनाने, जिसके अंतगता दकसी जििेिी प्रजतस्ट् पधाा प्राजधकरण या अन् य अजभकरण के सार् दकसी ज्ञापन या इंतिाम पर हस्ट्त ािर करना भी ह।ै (ग) अजधजनयम की धारा 18 के अनुसार आयोग के पूिा अनुमोिन से दकसी औपचाररक संबंध को बनाने, जिसके अंतगता कानूनी प्राजधकरण या सरकार के जिभाग के सार् दकसी ज्ञापन या इंतिाम पर हस्ट्त ािर करना भी ह।ै

(4) आयोग सजचि के नाम स े कोई िाि कर सकेगा या उसपर कोई िाि दकया िा सकेगा और आयोग का सभी कायािाजहयों में, जिसके अंतगता अजधकरण के समि अपील ें भी हैं, सजचि के नाम स े प्रजतजनजधत्ि दकया िाएगा।

(5) अजधजनयम की धारा 51 के उपबंधों के अधीन रहते हुए, सजचि अजधजनयम की धारा 51 की उपधारा (3) के अधीन गरठत सजमजत के सिस्ट् यों की जनम्न जलजखत के संबंध म ेंसहायता करेगा, – (क) आयोग के िार्षाक बिट को तैयार करन े और उसका अनुमोिन कराने;

(ख) प्रजतस्ट् पधाा जनजध के प्रिासन।

(6) सजचि आयोग की िासकीय मुद्रा को अपनी अजभरेिा में रखेगा। आयोग की िासकीय मद्रु ा को सजचि के जलजखत प्राजधकार के अधीन और उसके जसिाय दकसी भी िस्ट् तािेि, जिसके अतं गता आयोग के आिेिों की प्रमाजणत प्रजतयां भी ह,ैं पर नहीं लगाया िाएगा।

(7) उपजिजनयम (1) के अधीन रहते े हुए, आयोग के समि लाए गए जिषयों का समयपूिाक और िि जनपटान सुजनजित करने तर्ा अजधजनयम के उद्देश् यों की प्राजप्त के जलए सजचि के पास जनम्न जलजखत िजियां होंगी और िह जनम् नजलजखत कृत् य करेगा, – (क) सभी सूचनाओं, प्रजतजनिेिों, आिेिनों या िस्ट्त ािेिों को प्राप् त, पृष्ठ ादं कत और प्रिगीकृत करना;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) िहां कहीं लाग ू हो, प्राप् त फीस की राजि की िांच करना और उसे समय पर आयोग के खाते म ें िमा कराना सुजनजित करना;

(ग) इस प्रकार प्राप् त सभी सूचनाओं, प्रजतजनिेिों, आिेिनों या िस्ट्त ािेिों की यह पता लगान े के जलए संिीिा करना दक क्य ा ि ेजनयमों और जिजनयमों के अनरूु प ह;ैं (घ) ऐसी सूचना(सूचनाओं), प्रजतजनिेिों, आिेिनों या िस्ट्त ािेिों की त्रुरटयों को इंजगत करना और पिकारों स े ऐसी त्रुरटयों को सुधारने की अपेिा करना;

(ङ) ऐसी सूचना, प्रजतजनिेि, आिेिन या िस्ट्त ािेि की प्रजत को उनके संलग् नकों के सार् संबंजधत पिकारों, जिसके अंतगता महाजनिेिक भी ह,ैं पर युजियुक् त समय के भीतर तामील करना; (च) सूचना या प्रजतजनिेि या िस्ट् तािेि पर, यह जिजनश् चय करने के जलए दक क्य ा कोई प्रर्म िष्ृ ट या मामला जिद्यमान ह,ै जिचार करन े के जलए आयोग की सामान् य बैठक की तारीख की सूचना की तामील करना और महाजनिेिक ररपोटा की प्राजप्त और उस पर जिचार करन े के पश् चात ् अन् िेषण या िांच की सूचना िारी करन े संबंधी आयोग के जनिेिों को संप्रेजषत करना;

(छ) दकसी पिकार की मृत् यु या दकसी पिकार को दििाजलया अजधजनणीत दकए िाने की ििा में, कायािाजहयों के पिकारों द्वारा आिेिन दकए िाने पर जनष्प ािकों, प्रिासकों या अन्य जिजधक प्रजतजनजधयों को अजभलेख पर लाना ; (ज) सूचना या अन् य आिेजिका की तामील को सत् याजपत करना और यह सुजनजित करना दक पिकारों को समुजचत रूप से तामील की गई ह;ै (झ) आयोग के जनिेि पर दकसी अन्य प्राजधकरण की अजभरिा से अजभलेखों की अध् यपेिा करना;

(ञ) आयोग के अजभलेखों का जनरीिण अनुज्ञात करना; (ट) आयोग के आिेि पर दकसी पिकार या प्राजधकरण द्वारा फाइल दकए गए िस्ट्त ािेिों को िापस करना; (ठ) आयोग के आिेिों को प्रमाजणत करना और उनकी प्रजतयां पिकारों को िारी करना;

(ड) इन जिजनयमों के अनुसार कायिा ाजहयों में फाइल दकए गए िस्ट्त ािेिों की प्रमाजणत प्रजतयां पिकारों को प्रिान करना; (ढ) इन जिजनयमों के अनुसार, प्रकािन के जलए आयोग के आिेिों की प्रमाजणत प्रजतया ंप्रिान करना;

(ण) सूचनाओं या अन् य संबंजधत आिेजिकाओं की तामील, नई सूचना िारी करने के जलए या समय के जिस्ट् तारण के जलए आिेिनों या दकसी पिकार पर दकसी जिजिष्ट पद्धजत से तामील करन े का आिेि िेने, जिसके अंतगात, यर्ाजस्ट्र्जत, समाचार पत्र म ें जिज्ञापन द्वारा सूचना का प्रकािन या इसे िबे साइट पर रखना भी ह,ै से संबंजधत सभी मामलों का जनपटारा करना;

(त) दकसी सामान् य बैठक के िौरान दकसी कायािाही के अजभलेख का संकलन करना और उसे सरु जित रखना, जिसके अंतगता जनम्न जलजखत भी ह:ै -

(i) घटनाओं को उनके समय के अनसु ार सूचीबद्ध करना;

(ii) िस्ट् तािेिों को प्रारंभ करना;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9

(iii) बैठक की सूचना;

(iv) महाजनिेिक की ररपोटा, यदि कोई हो;

(v) जििेषज्ञ की राय, यदि कोई हो;

(vi) दकया गया कोई अतं ररम आििे ;

(vii) फाइल दकए गए सभी िस्ट् तािेिी साक्ष्य ;

(viii) दिए गए मौजखक साक्ष्य की प्रजतजलजप, यदि कोई हो;

(ix) आयोग के अंजतम आिेि या जनणाय; (थ) अजधजनयम की धारा 57 के अधीन रहत ेहुए िानकारी प्रकट करना; (द) इन जिजनयमों के अनुसार िस्ट्त ािेिों या साक्ष्य ों या जििरणों या दकसी जिश् लेषण की गोपनीयता को, उन् ह ें सुरजित अजभरिा म ेंरखकर सुजनजित करना;

(ध) प्रिृत् त प्रजतधाररता अनुसूची और अध् यि द्वारा समय-समय पर िारी जनिेिों के अनुसार अजभलेखों का अनुरिण प्रारंभ करना, जिसके अंतगता अजभेलखों का व् ययन करना भी ह;ै (न) यदि आयोग ऐसा जनिेि ि े तो अजधजनयम की धारा 42 की उपधारा (3) के अधीन आयोग के आिेिों या जनिेिों के अननुपालन के जलए मुख्य मेरोपोजलटन मजिस्ट् रेट, दिल् ली के समि जिकायत फाइल करना।

16. सचू ना या प्रजतजनििे की सिं ीिा की प्रदक्रया.

(1) आयोग में प्राप् त प्रत् येक सूचना या प्रजतजनिेि की सजचि द्वारा यह िांच करने के जलए संिीिा की िाएगी दक क्य ा िे इन जिजनयमों के अनरूु प ह ैऔर त्रुरटयों, यदि कोई हों, को युजियुक्त समय, िो जनम्न जलजखत से अजधक नहीं होगा, के भीतर पिकार को संसूजचत दकया िाएगा, – (क) अजधजनयम की धारा 19 की उपधारा (1) के खंड (ख) के अधीन प्राप् त दकसी सूचना या प्रजतजनिेि की ििा में 15 (पन् द्रह) दििस; या (ख) अजधजनयम की धारा 21 या धारा 49 की उपधारा (1) के अधीन प्राप् त दकसी प्रजतजनििे की ििा में 7 (सात) दििस।

(2) यर्ाजस्ट्र्जत, अजधजनयम की धारा 19 की उपधारा (1) के खडं (क) म ें जनर्िाष् ट सूचना िेन े िाला या केन् द्रीय सरकार या राज्य सरकार या अजधजनयम की धारा 19 की उपधारा (1) के खंड (ख) या धारा 49 की उपधारा

(1) के अधीन जनर्िाष् ट कानूनी प्राजधकरण, उपजिजनयम (1) के अधीन त्रुरटयों की संसूचना की प्राजप्त पर यर्ासंभििीघ्र, जनम्न जलजखत कालािजध के भीतर त्रुरटयों को िरू करेगा: - (क) अजधजनयम की धारा 19 की उपधारा (1) के खंड (ख) के अधीन प्राप् त दकसी सूचना या प्रजतजनिेि की ििा में संसूचना की प्राजप्त से 30 (तीस) दििस; या (ख) अजधजनयम की धारा 21 या धारा 49 की उपधारा (1) के खडं (ख) के अधीन प्राप् त दकसी सूचना या प्रजतजनिेि की ििा म ेंसंसूचना की प्राजप्त से 15 (पंद्रह) दििस।

(3) उस ििा में, िहां यर्ाजस्ट्र्जत, केन् द्रीय सरकार या राज्य सरकार या कानूनी प्रजधकरण या संबंजधत पिकार द्वारा उपजिजनयम (2) के उपबधं ों के अनुसार त्रुरटयों को िरू नहीं दकया िाता है, िहां सूचना या प्रजतजनिेि को अजिजधमान् य माना िाएगा:10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु यह दक केन् द्रीय सरकार या राज्य सरकार या कानूनी प्राजधकरण या संबंजधत पिकार लाग ूफीस के सार् आयोग द्वारा जिचार दकए िाने के जलए नई सूचना, प्रजतजनिेि या आिेिन फाइल करने का हकिार होगा।

(4) उपजिजनयम (3) के अधीन दकसी सूचना को अजिजधमान् य माने िाने की ििा में ऐसी सूचना पर संित् त फीस को िब् त कर जलया िाएगा।

(5) इसमें ऊपर जिजनर्िाष् ट कोई बात, आयोग को ऐसी दकसी सूचना या प्रजतजनिेि की अंतािस्ट् तु को, अजधजनयम के दकन् हीं उपबंधों के दकसी संभाव् य उल् लघं न हते ु िांच के जलए ऐसी रीजत म ें उपयेाग करन े से जनिाररत नहीं करेगी जिसे िह उजचत समझे:

परंत ु यह दक ऐसे प्रजतजनिेिों में त्रुरटयों को िरू करने म ें लगने िाल े समय को अजधजनयम की, यर्ाजस्ट्र्जत, धारा 21 की उपधारा (2) या धारा 49 की उपधारा (1) में आयोग द्वारा राय िेन े के जलए उपबंजधत 60 (साठ) दििस की कालािजध की संगणना में जगनती में नहीं जलया िाएगा।

(6) दकसी मामले में फाइल दकया गया प्रत्येक अंतिाती या प्रकीणा आिेिन रजिस्ट् रीकृत और क्रमांदकत दकया िाएगा। ऐसे सभी आिेिनों की 7 (सात) दििसों के भीतर संिीिा की िाएगी और त्रुरटयां, यदि कोई हो, पिकार को संसूजचत की िाएंगी। आिेिन करन े िाला पिकार त्रुरटयों को िरू करेगा और संसूचना प्राजप्त से 7 (सात) दििसों के भीतर उसे प्रस्ट्तुत करेगा, ऐसा न करन े पर आिेिन को अजिजधमान् य माना िाएगा।

17. प्रर्म िष्ृ ट या मामला जिद्यमान होन ेसबं धं ी राय.

(1) सजचि, यर्ाजस्ट्र्जत, दकसी सूचना या प्रजतजनििे की संिीिा और त्रुरटयों, यदि कोई हों, के जनिारण के पश् चात,् उसे आयोग के समि रखेगा तादक िह दकसी प्रर्म िष्ृ ट या मामले की जिद्यमानता के संबंध में अपनी राय रख सके।

(2) अजभकजर्त प्रजत – प्रजतस्ट् पधा ा करारों और/या प्रभुत् ि की जस्ट्र्जत के िरूु पयोग के मामलों में आयोग, यर्ािक् य रूप से 60 (साठ) दििसों के भीतर प्रर्म िष्ृ ट या मामले की जिद्यमानता के संबंध में अपनी राय अजभजलजखत करेगा।

(3) आयोग, यर्ासंभििीघ्र, यह जिचार करने के जलए दक क्य ा प्रर्म िष्ृ ट या मामला जिद्यमान ह,ै सजचि द्वारा उपजिजनयम (1) के अधीन उसके समि मामला रखे िाने की तारीख से 15 (पंद्रह) दििसों के भीतर अपनी पहली सामान् य बैठक आयोजित करेगा।

18. प्रारंजभक सम्म ले न.

(1) आयोग, यदि यह आिश् यक समझे, तो इस संबंध में अपनी राय बनाने के जलए दक क्य ा प्रर्म िष्ृ ट या जिद्यमान ह,ै प्रारंजभक सम् मले न बलु ा सकेगा।

(2) आयोग, प्रारंजभक सम् मेलन के जलए, सूचना िेन े िाल े और ऐस े अन् य व् यजियों, िो आिश् यक हों, को आमंजत्रत कर सकेगा।

(3) प्रारंजभक सम् मले न की प्रदक्रया के औपचाररक जनयमों को अपनाया िाना आिश् यक नहीं ह।ै

19. प्रर्म िष्ृ ट या मामल ेके सबं धं म ेंअन्ि ेषण करान ेके जलए जनिेि िारी करना.

(1) िहां आयोग की यह राय ह ै दक प्रर्म िष्ृ ट या मामला जिद्यमान ह,ै िहां सजचि, महाजनिेिक को 7 (सात) दििसों के भीतर, आयोग के मामले का अन् िेषण करने के जनिेिों की संसूचना िेगा।

(2) महाजनिेिक को अन् िेषण करन े के जलए जनििे के संबंध म ें यह माना िाएगा दक अजधजनयम की धारा 26 के अधीन कोई िांच प्रारंभ की गई ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11

(3) िहां आयोग कोई राय बना लते ा ह ै दक अजधजनयम की धारा 3 की उपधारा (4) या अजधजनयम की धारा 4 के उल् लघं न का प्रर्म िष्ृ ट या मामला जिद्यमान ह,ै िहां सजचि, संबंजधत पिकारों को आयोग द्वारा पाररत आिेि की प्रजत, उन पर तामील करात े हुए 7 (सात) दििसों के भीतर आयोग के जनिेिों को भी संप्रेजषत करेगा।

20. अजधजनयम की धारा 26(2) या 26(2क) के अधीन पाररत आििे की ससं चू ना.

(1) यदि आयोग की यह राय ह ै दक प्रर्म िष्ृ ट या मामला जिद्यमान नहीं ह,ै िहां सजचि, आयोग अजधजनयम की धारा 26 की उपधारा (2) में उपबंजधत दकए गए अनुसार, यर्ाजस्ट्र्जत, केन् द्रीय सरकार या राज्य सरकार या कानूनी प्राजधकरण या संबंजधत पिकारों को तत्ि ण मामले को बंि करने के संबंध म ें आयोग के आिेि की प्रमाजणत प्रजत भेिेगा।

(2) यदि आयोग की यह राय ह ै दक आयोग म ें प्राप् त, यर्ाजस्ट्र्जत, सूचना या प्रजतजनििे म ें समुत् र्ाजपत िही या सारत: िही तथ्य और मुद्द,े आयोग द्वारा अपन े दकसी पूि ा आिेि(आिेिों) म ें पहल े ही जिजनजित दकए िा चुके ह,ैं िहां सजचि, यर्ाजस्ट्र्जत, केन् द्रीय सरकार या राज्य सरकार या कानूनी प्रजधकरण या संबंजधत पिकारों को तत्ि ण, अजधजनयम की धारा 26 की उपधारा (2क) के अधीन मामले को बंि करने के संबंध में आयोग के आिेि की प्रमाजणत प्रजत भेिगे ा।

21. महाजनिेिक द्वारा अन्ि षे ण.

(1) सजचि, जिजनयम 19 के अधीन आयोग के जनििे ों को संप्रेजषत करत े समय, यर्ाजस्ट्र्जत, सूचना या प्रजतजनिेि की, अन् य सभी िस्ट् तािेिों या सामजग्रयों या िपर्पत्रों या कर्नों के सार्, जिन् ह ें दकसी पिकार द्वारा उक्त सूचना या प्रजतजनिेि के सार् या उसके पश् चात ् या प्रारंजभक सम् मेलन के समय महाजनिेिक को फाइल दकया गया ह,ै प्रजत भेिेगा।

(2) आयोग, महाजनिेिक को, आयोग द्वारा यर्ाजिजनर्िाष् ट ऐसे समय के भीतर ररपोटा प्रस्ट् तुत करने का जनिेि िगे ा िो साधारणतया आयोग के जनिेिों की प्राजप्त की तारीख से 90 (नब् बे) दििसों से अनजधक होगा।

(3) आयोग, महाजनिेिक द्वारा पयााप् त कारण िेते हुए आिेिन दकए िाने पर, ररपोटा प्रस्ट् ततु करने के जलए ऐसी कालािजध जिस्ट् ताररत कर सकेगा िो िह युजियक् त समझे।

(4) महाजनिेिक की ररपोटा म,ें उसके जनष्क ष ा और सार् ही सभी साक्ष्य या िस्ट्त ािेि या कर्न या अन् िेषण ररपोटा में दकए गए जिश् लषे ण अतं र्िाष्ट होंगे: परंत ु यह दक महाजनिेिक, आयोग को, ररपोटा के सार्, अन्ि ेषण के िौरान एकजत्रत सभी साक्ष्य या िस्ट् तािेि या कर्न या जिश् लेषण भी भेिगे ा जिसे मामल े का अजभलेख कहा िाएगा:

परंतु यह और दक िब आिश् यक समझा िाए, महाजनिेिक, गोपनीयता रखते हुए, अपनी ररपोटा और मामले का अजभलेख, िो भागों में प्रस्ट्त ुत कर सकेगा। एक भाग में ि े िस्ट् तािेि अतं र्िाष्ट होंग े जिन तक पिकारों को पहुचं प्रिान की गई ह ैऔर िसू रे भाग म ें ऐसी गोपनीय सचू ना और िस्ट् तािेि अंतर्िाष्ट होंगे जिन तक पहुचं आंजिक रूप से या पूणता या जनबजं धत ह।ै

(5) महाजनिेिक, आयोग द्वारा जिजनर्िाष् ट समय के भीतर, पीडीएफ फामेट में एक इलैक्र ाजनक प्रजत के सार् अपनी ररपोटा की पांच प्रजतया ंसजचि को अग्रेजषत करेगा: परंत ु यह दक सजचि िब कभी अपेजित हो, और अजधक प्रजतयों के जलए अनरु ोध कर सकेगा।

(6) यदि ररपोटा पर जिचार करने के पश् चात् आयोग की यह राय ह ै दक आगे और अन् िेषण करना आिश् यक ह ै तो िह, महाजनिेिक को ऐसा और अन् िेषण करन े और आयोग द्वारा यर्ाजिजनर्िाष् ट ऐसे समय के भीतर ककंत ु12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] साधारणतया 60 (साठ) दििसों के अपश् चात,् जिजनर्िाष् ट मुद्दों पर अनुपरू क ररपोटा प्रस्ट् तुत करने का जनििे ि े सकेगा।

22. अजधजनयम की धारा 26 के अधीन िाचं की प्रदक्रया.

(1) अजधजनयम की धारा 26 की उपधारा (3) के जनबंधनों के अनसु ार महाजनिेिक से अन् िेषण ररपोटा प्राप् त होन े पर, सजचि, उसे 04 (चार) सप्त ाह की कालािजध के भीतर आयोग के जिचार के जलए रखगे ा।

(2) आयोग, उपजिजनयम (1) के अधीन प्राप् त महाजनििे क की अन्ि ेषण ररपोटा पर जिचार करने के पश् चात, या तो:

(i) सजचि को जनिेि िे सकेगा दक िह, यर्ाजस्ट्र्जत, केन्द्रीय सरकार या राज्य सरकार या कानूनी प्राजधकरण या संबंजधत पिकारों को, ररपोटा की प्राजप्त से 08 (आठ) सप्ताह की कालािजध के भीतर, उसमें आिेप या सुझाि, यदि कोई हों, फाइल करने के जलए ररपोटा के अगोपनीय पाठ की भौजतक या इलैक्राजनक प्रजत अग्रेजषत करे; या

(ii) आिेि िे सकेगा दक महाजनििे क द्वारा अजधजनयम की धारा 26 की उपधारा (3क) के जनबंधनों के अनुसार, मामल े में और अन् िेषण दकया िाए; या

(iii) मामले में आगे ऐसी िांच करा सकेगा या स्ट् ियं आगे ऐसी िांच कर सकेगा िो आयोग उजचत समझे।

(3) आयोग, महाजनिेिक की अन् िषे ण ररपोटा को, यर्ाजस्ट्र्जत, केन्द्रीय सरकार या राज्य सरकार या काननू ी प्राजधकरण या संबंजधत पिकारों को उसमें आिेप या सुझाि, यदि कोई हों, फाइल करन े के जलए अग्रेजषत करन े का जनिेि िेत े समय, संबंजधत पिकारों को भारतीय प्रजतस्ट्पधाा आयोग (आित ा या आय का अिधारण) जिजनयम, 2024 और भारतीय प्रजतस्ट्पधा ा आयोग (मौदद्रक िाजस्ट्त का अिधारण) मागाििाक जसद्धांत, 2024 के अनुसार, अपनी जित्तीय िानकारी, जिसके अंतगात जित् तीय जििरण भी ह,ै फाइल करन े का भी जनििे ि े सकेगा।

(4) यर्ाजस्ट्र्जत, केन्द्रीय सरकार या राज्य सरकार या काननू ी प्राजधकरण या संबंजधत पिकारों स े उपजिजनयम (2) के अधीन आिेप या सुझाि प्राप् त होने पर, आयोग या तो:

(i) अजधजनयम की धारा 26 की उपधारा (6) के अधीन मामल े को बंि करन े का अंजतम आिेि या अजधजनयम की धारा 27 के अधीन कोई आिेि पाररत कर सकेगा; या

(ii) आिेि ि े सकेगा दक महाजनिेिक द्वारा अजधजनयम की धारा 26 की उपधारा (7) के जनबंधनों के अनुसार, मामले म ेंऔर अन् िेषण दकया िाए; या

(iii) अजधजनयम की धारा 26 की उपधारा (7) या (8) के जनबंधनों के अनुसार, मामले म ें और िांच करा सकेगा या स्ट् ियं आगे िांच कर सकेगा।

(5) महाजनिेिक स े पूरक अन् िेषण ररपोटा प्राप् त होन े पर, सजचि, उसे 04 (चार) सप् ताह की कालािजध के भीतर आयोग के जिचार के जलए रखेगा।

(6) आयोग, उपजिजनयम (5) के अधीन प्राप् त महाजनिेिक की पूरक अन् िेषण ररपोटा पर जिचार करने के पश् चात, या तो:

(i) सजचि को जनिेि िे सकेगा दक िह, यर्ाजस्ट्र्जत, केन्द्रीय सरकार या राज्य सरकार या कानूनी प्राजधकरण या संबंजधत पिकारों को, ररपोटा की प्राजप्त स े 08 (आठ) सप्ताह की कालािजध के भीतर, उसमें आिेप या[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13 सुझाि, यदि कोई हों, फाइल करने के जलए ररपोटा के अगोपनीय पाठ की भौजतक या इलैक्राजनक प्रजत अग्रेजषत करे; या

(ii) मामले में आगे और िांच करा सकेगा या स्ट् ियं आगे ऐसी िांच कर सकेगा िो आयोग उजचत समझे।

(7) यर्ाजस्ट्र्जत, केन्द्रीय सरकार या राज्य सरकार या कानूनी प्राजधकरण या संबंजधत पिकारों स,े परू क अन् िेषण ररपोटा पर, उपजिजनयम (6) के अधीन आिेप या सुझाि प्राप् त होने पर, आयोग या तो:

(i) अजधजनयम की धारा 26 की उपधारा (9) के अधीन मामल े को बंि करन े का अंजतम आिेि या अजधजनयम की धारा 27 के अधीन कोई आिेि पाररत कर सकेगा; या

(ii) अजधजनयम की धारा 26 की उपधारा (7) या (8) के जनबंधनों के अनुसार, मामले म ें और िांच करा सकेगा या स्ट् ियं आगे िांच कर सकेगा।

(8) अजधजनयम की धारा 26 की उपधारा (7) या (8) के जनबंधनों अनुसार आग े की िांच पूणा होने पर, आयोग, अजधजनयम की धारा 26 की उपधारा (9) के अधीन मामले को बंि करने के जलए अंजतम आिेि पाररत कर सकेगा या धारा 27 के अधीन कोई आिेि पाररत कर सकेगा, जिसके पूिा िह, अजधजनयम की धारा 26 की उपधारा (9) के परंतुक के जनबधं नों के अनुसार, संबंजधत पिकारों को, अजभकजर्त उल्लघं न के होने और सूचना का प्रत् यत्ु तर िने े की कालािजध उपिर्िात करते हुए कारण बताओ सूचना िारी करेगा।

(9) संबंजधत पिकारों से उपजिजनयम (8) म ें जनर्िाि कारण बताओ सूचना का उत्तर प्राप्त होने पर, और उन्ह ें सुनिाई का युजियुक् त अिसर िेने के पिात, आयोग, मामले को बंि करने का अंजतम आिेि या अजधजनयम की धारा 27 के अधीन कोई आिेि पाररत कर सकेगा।

(10) सजचि, यर्ाजस्ट्र्जत, केन्द्रीय सरकार या राज्य सरकार या कानूनी प्राजधकरण या संबंजधत पिकारों को आयोग द्वारा पाररत अंजतम आििे ों को, तत्स ंबंधी प्रमाजणत प्रजत उपलब्ध करात े हुए संप्रेजषत करेगा।

(11) आयोग द्वारा प्राजधकृत दकसी अजधकारी द्वारा, उसे इस जिजनयम के अधीन आग े िांच करन े के जलए अपेजित जिजनर्िाि पुस्ट्तकों या अन्य िस्ट्तािेिों की प्रस्ट् तुजत को उजचत ठहराते हुए िी गई ररपोटा पर, आयोग दकसी व्यजि को, अजधजनयम की धारा 36 की उपधारा (4) के उपबंधों के अनुसार ऐसे व्यजि या उद्यम द्वारा दकए िा रह ेदकसी व्यापार के संबंध में ऐसी जिजनर्िाि पुस्ट्तकों या अन्य िस्ट्तािेिों को प्रस्ट्ततु करन े का जनिेि िगे ा:

स्ट् पष्ट ीकरण – इस उपजिजनयम के प्रयोिन के जलए, ‘’अजधकारी’’ पि में अजधजनयम की धारा 17 की उपधारा (3) या धारा 36 की उपधारा (3) के अधीन उजल्लजखत जििेषज्ञ और िृजत्तक सजम्मजलत होंगे।

(12) सजचि आयोग की बैठकों की सचू ना महाजनिेिक को िेगा, तादक िह अजधजनयम की धारा 35 के उपबंधों के अनुसार स्ट् ियं या अपन ेदकसी अजधकारी के माध् यम स ेबैठक में उपजस्ट्र्त हो सके।

23. सचू ना तामील करन ेकी पद्धजत, आदि.

(1) इन जिजनयमों के अधीन दकसी व् यजि पर तामील करन े या पररित् त करन े के जलए अपेजित प्रत् येक सूचना या अन् य िस्ट्त ािेि को व् यजिगत रूप से तामील दकया िाएगा या इलैकराजनक मेल पते पर या रजिस्ट् रीकृत डाक या द्रतु डाक या कुररयर सेिा द्वारा उस व् यजि द्वारा तामील के जलए प्रस्ट्त ुत उसके पत े पर या ऐसे स्ट् र्ान पर या उसके प्राजधकृत प्रजतजनजध को ऐसे व् यजि या उसके प्राजधकृत प्रजतजनजध द्वारा दिए गए पत े पर भेिा िा सकेगा िहां िह व् यजि सामान् यत: जनिास करता ह ै या कारबार या व् यिसाय करता ह ै या अजभलाभ के जलए संकम ा करता ह:ै14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु यह दक उस व्यजि, जिसने पता या इलैक्राजनक मेल पता या प्राजधकृत प्रजतजनजध का ब्यौरा दिया प्रस्ट् तुत दकया ह,ै का कताव्य होगा दक िह उस े समय-समय पर, िब भी आिश्यक हो, आयोग के अजभलेखों म ें उसका अद्यतन करे, अन्यर्ा अजभलेख पर उपलब्ध पते या इलैक्राजनक मेल पत े पर की गई तामील पयााप्त होगी।

(2) डाक या कुररयर कमाचारी द्वारा इस संबंध म ें दकया गया पृष्ठ ांकन दक प्राजप्तकताा या उसके अजभकताा न े सूचना को स्ट् िीकार करन े से इन् कार कर दिया ह,ै को लने े स ेइन् कार द्वारा तामील का सबूत माना िाएगा।

(3) यदि कोई इलक्ै राजनक मेल, अन्य पिकारों की प्रणाली द्वारा पढे िाने योग्य रूप में, उजचत रूप से प्राजप्तकता ा को संबोजधत या जनिेजित ह,ै िब िह प्रेषक के जनयंत्रण से बाहर होता ह ैऔर ऐसे संिेिों को प्राप्त करने के जलए प्राजप्तकताा की सूचना प्रक्रमण प्रणाली म ें प्रिेि करता ह,ै चाह े प्राजप्तकताा द्वारा उस े खोला न गया हो या िेखा न गया हो तो उसे पररित्त माना िाएगा।

(4) उस ििा में, िहा ंडाक या कुररयर कमाचारी यह ररपोटा िते ा ह ैदक प्राजप्तकताा न े दिए गए पत े पर रहना बंि कर दिया ह ै या िह उपलब् ध नहीं ह,ै िहां आयोग उसे प्रस्ट् ततु िानकारी का अिलंब लेत े हुए ऐसा मत बना सकेगा िो उसे उपयुक् त लगे और प्रजतस्ट्र् ाजपत तामील के जलए उपाय करने संबंधी कायािाही कर सकेगा।

(5) िहां समनों या सूचना पर उजचत रूप स े पता जलखा गया र्ा, पूि ा संिाय दकया गया र्ा और अजभस्ट् िीकृजत सजहत रजिस्ट् रकृत डाक द्वारा सम् यक रूप स े भेिा गया र्ा और अजभस्ट् िीकृजत खो गई ह ै या गलत प्रस्ट्त ुत कर िी गई ह ैया दकसी अन् य कारण से समन िारी करने की तारीख स ेतीस दिन के भीतर आयोग को प्राप् त नहीं हुई ह ै िहां आयोग इसे पयााप् त तामील मानेगा और तद्नुसार घोषणा करेगा।

(6) िहां ऊपर जनर्िाष् ट पद्धजतयों द्वारा सूचना की तामील संभि नहीं ह ै और िहां प्राजप्तकताा का पता नहीं लगाया िा सकता, िहां तामील को ऐसे गृह के, जिसमें प्राजप्तकताा सामान् यत: जनिास करता ह,ै दकसी प्रमुख भाग पर समन या सूचना की प्रजत को जचपकाकर दकया िाएगा और ऐसी तामील को जसजिल प्रदक्रया संजहता, 1908 (1908 का 5) के जनयम 20 के आिेि V को ध् यान म ेंरखत े हुए पयााप् त माना िाएगा।

(7) िहां आयोग का यह समाधान हो िाता ह ै दक सूचना का प्राजप्तकताा तामील से बचने की चेष् टा कर रहा ह ै या दकसी अन् य कारण स े सूचना की तामील सामान् य ढगं से नहीं की िा सकती ह,ै िहां िह ऐसे अिस्ट् र्ान म,ें िहा ं प्राजप्तकताा अंजतम ज्ञात रूप स े जनिास करता र्ा, पररचाजलत दकसी िैजनक समाचार पत्र में जिज्ञापन िेकर तामील करने का आिेि िगे ा।

24. आयोग के समि फाइल करना.

(1) सभी सूचनाएं या प्रजतजनििे या उनके प्रत् युत् तर या ऐस े अन् य िस्ट् तािेि, जिन् ह ें आयोग के समि फाइल करना अपेजित ह,ै ए4 आकार (210 x 297 जममी या 8.27’’ x 11.69’’) के सफेि बांड पृष्ठ पर एररयल 12 के फॉंट में डबल स्ट् पेस और बांई ओर िो इंच का और अन् य सभी ओर से एक इंच का मार्िान छोड़ते हुए केिल िोनों ओर टंदकत दकए िाएंग:े परंत ु यह दक दकसी व् यजि के पत्रिीषा (लैटर हडै ) पर दकए िाने िाल ेफाइहलंग की अनुज्ञा नहीं होगी।

(2) प्रििों या अनलु ग् नकों के रूप म ें केिल स्ट् पष्ट और सुपठनीय फोटो प्रजतयों या स्ट् कैन दकए गए िस्ट् तािेिों को ही, िो सत् यप्रजतयों के रूप में सत् याजपत हों, फाइल दकया िा सकेगा।

(3) उपजिजनयम (1) में जनर्िाष् ट प्रत्य के िस्ट् तािेि की िो प्रजतयों को (एक मूल और एक प्रजत), िहां कहीं संभि हो, पीडीएफ फामेट में एक अजतररक्त इलैक्र ाजनक प्रजत के सार् फाइल दकया िाएगा:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15 परंत ु यह दक सजचि, लोक उद्घोषणा के माध् यम से, आयोग के सिस्ट् यों की संख् या और कायािाजहयों के पिकारों की संख् या पर जनभरा करते हुए फाइल की िाने िाली प्रजतयों की संख् या म ेंिृजद्ध या कमी कर सकेगा:

परंत ु यह और दक सजचि, लोक उद्घोषणा के माध् यम से, ऐस े फारमेट म ें पररितान कर सकेगा, जिसम ें इलैक्र ाजनक प्रजत फाइल की िानी ह।ै

25. आयोग की दकसी कायिा ाही म ेंपिकार सजम्मजलत करन ेया प्रजतस्ट्र् ाजपत करन ेकी िजि.

(1) आयोग दकसी सामान् य बैठक म,ें कायािाजहयों के दकसी पिकार द्वारा जलजखत आिेिन दकए िाने पर, व् यजियों या उद्यमों की दकसी भी संख् या को संयुक् त रूप स,े संयुक् त या पृर्क रूप से, पृर्क रूप से या जिकल् प के रूप म ें उन् हीं कायािाजहयों में पिकार के रूप में सजम्मजलत कर सकेगा, यदि,– (क) उस कारािाई या संव् यिहारों की श्ृंखला के संबंध में या उनसे उिभूत होने िाले अनतु ोष के संबंध में अजभकजर्त रूप से ऐसे आिेिकों में कोई अजधकार जिद्यमान है, चाह े िह संयुक् त और पर्ृ क रूप से या जिकल् प के रूप म ेंहो;

(ख) आिेिक, आयोग के समाधानप्रि रूप में यह िर्िता कर सकते ह ैं दक जिजध या तथ्य का कोई समान प्रश् न उिभूत होगा; और (ग) आयोग का यह समाधान हो िाता ह ै दक यर्ाजस्ट्र्जत, ऐसे व् यजि या उद्यम द्वारा उसके समि जिद्यमान दकसी मुद्दे के अिधारण के जलए भाग लेना आिश् यक ह।ै

(2) यदि दकन् हीं कायािाजहयों में दकसी जिद्यमान पिकार को दकसी व् यजि या उद्यम द्वारा प्रजतस्ट् र्ाजपत करना आिश् यक हो िाता ह,ै िहां आयोग ऐसे प्रजतस्ट् र्ापन के जलए आिेि कर सकेगा।

(3) इन जिजनयमों के जिजनयम 38 के जनबंधनों के अनुसार, उपजिजनयम (1) या उपजिजनयम (2) के अधीन कायािाजहयों में सजम्मजलत दकए गए दकसी पिकार द्वारा कोई आिेिन दकए िाने पर, सजचि, िस्ट् तािेिों की प्रमाजणत प्रजतयां मागं े िान े पर, उन् ह ें 10 (िस) दििसों के भीतर अग्रेजषत करेगा।

(4) उपजिजनयम (1) या उपजिजनयम (2) के अधीन दकया गया कोई आिेि कायािाजहयों में दकसी पूिा प्रक्रम पर की गई दकसी कारािाई को प्रभाजित नहीं करेगा।

26. आयोग की दकसी व्य जि या उद्यम को कायिा ाजहयों म ेंभाग लने ेकी अनमु जत प्रिान करन ेकी िजि.

(1) यदि आयोग का, दकसी सामान् य बैठक म ें दकसी मामल े पर जिचार करत े समय, उसे जलजखत म ें दकए गए आिेिन पर यह समाधान हो िाता ह ै दक दकसी व् यजि या उद्यम का कायािाजहयों के पररणाम में कोई सारिान जहत ह ै और यह दक ऐसे व् यजि या उद्यम को उस मामल े में उसका जिचार प्रस्ट्त ुत करन े की अनुज्ञा िने ा लोकजहत में ह,ै तो िह ऐसे व्य जि या उद्यम को अपनी ऐसी राय प्रस्ट् तुत करन े और मामले की आगे और कायािाजहयों में भाग लेन,े िैसा दक आयोग जिजनर्िाष् ट करे, की अनुमजत िे सकेगा।

(2) उपजिजनयम (1) म ें जनर्िाष् ट आिेिन के सार् जिजनयम 50 के उपजिजनयम (1) के अनुसार फीस के संिाय का सबूत संलग् न होगा।

(3) उपजिजनयम (1) में जनर्िाष्ट आिेिन में जनम् नजलजखत अंतर्िाष्ट होगा, – (क) अनुरोध करन े िाल ेव् यजि या उद्यम का जिजधक नाम; (ख) सूचना या िस्ट् तािेिों की तामील के जलए भारत म ेंपता;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ग) संपका का ब् यौरा (टेजलफोन नं., मोबाइल न.ं जिसके अंतगात िेि/नगर/िेत्र का कोड, इलैक्र ाजनक मेल पता भी ह)ैं ;

(घ) कायािाजहयों में ऐसे मद्दु े के मामले का संजिप् त जििरण, िो अनुरोध करने िाले व् यजि या उद्यम को प्रभाजित करता ह;ै (ङ) कर्न के समर्ान में िस्ट् तािेि या िपर्पत्र या साक्ष्य , तत्स ंबंधी सूची के सार्

(4) उपजिजनयम (1) के अधीन कोई आिेि दकए िान े पर, यदि कायािाजहयों में भाग लने े की अनमु जत प्रिान दकए गए व् यजि या उद्यम द्वारा, इन जिजनयमों के अधीन जिजनयमन 38 के जनबंधनों के अनुसार, आिेिन दकया िाता ह ैतो सजचि 10 (िस) दििसों के भीतर मांग ेगए िस्ट् तािेिों की प्रमाजणत प्रजतयों को उस ेप्रस्ट् ततु करेगा।

27. अनािश्य क पिकारों को हटान ेकी िजि. आयोग, उसके समि कायािाजहयों के दकसी पिकार द्वारा सामान् य बैठक के िौरान अपने स्ट्ि यं के प्रस्ट् ताि पर या दकए गए दकसी आिेिन पर, यह कर्न करते हुए दक दकसी पिकार द्वारा या उसके जिरुद्ध कोई अनुतोष नहीं मागं ा गया ह ै या उसे या उसके जिरुद्ध कोई अनतु ोष मंिूर नहीं दकया िाना है, ऐस े पिकार को कायािाजहयों से हटाने की अनुमजत प्रिान कर सकेगा।

28. बहु सचू नाएं सजम्मजलत करन ेसबं धं ी आयोग की िजि.

(1) यदि आयोग का, कोई सूचना या कोइ प्रजतजनिेि या कोई आिेिन प्राप् त होन े के पश् चात ् दकसी भी समय यह समाधान हो िाता ह ै दक दकसी पश् चातिती सूचना या प्रजतजनिेि या आिेिन म ें समुत् र्ाजपत मामले प्रत् यित:

और सारिान रूप स े एक समान ह ै तो िह िो या अजधक एक समान, यर्ाजस्ट्र्जत, सूचनाओं या प्रजतजनिेिों या ओििनों को जिचारार् ासमेदकत कर सकेगा।

(2) यदि महाजनिेिक का, अजधजनयम की धारा 26 की उपधारा (1) के अधीन आयोग से अन् िेषण के जलए कोई सूचना या प्रजतजनिेि प्राप् त होने के पश् चात् दकसी भी समय पर यह समाधान हो िाता ह ै दक दकसी पश् चातिीत सूचना या प्रजतजनििे या ओििन म ें समुत् र्ाजपत मामले प्रत् यित: और सारिान रूप स े एक समान ह ै तो िह आयोग से िो या अजधक एक समान, यर्ाजस्ट्र्जत, सूचनाओं या प्रजतजनिेिों या ओििनों पर समान अन् िेषण करन े के जलए समेदकत करन े का अनुरोध कर सकेगा।

(3) िहां आयोग उपजिजनयनम (1) और उपजिजनयम (2) के अनसु ार िो या अजधक सूचनाओं या प्रजतजनिेिों या आिेिनों को समेदकत करता ह,ै िहा,ं – (क) यर्ाजस्ट्र्जत, ऐसी प्रत् यके सूचना या प्रजतजनिेि, उसके स्ट् ियं की डाकेट संख् या द्वारा पर्ृ क रूप से पहचाना िाता रहगे ा;

(ख) आयोग द्वारा सूचनाओं या प्रजतजनिेिों को समेदकत करने संबंधी जनणाय अजनणीत करन े के िौरान महाजनिेिक मामलों का अन् िेषण िारी रख सकेगा।

29. सचू ना का ससं ोधन. आयोग, इस संबंध में कोई आििे न दकए िान े पर दकसी सूचना में संिोधन की अनुमजत ि े सकेगा ककंतु ऐसे संिोधन को अनुज्ञा नहीं िाएगी िो सूचना की प्रकृजत और जिस्ट् तार में सारिान पररितान करता ह।ै

30. आयोग के समि पिकारों द्वारा प्रस्ट्त तु ीकरण या तका-जितका करन ेकी रीजत.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 17

(1) अजधजनयम की धारा 36 की उपधारा (1) पर प्रजतकूल प्रभाि डाल े जबना, यर्ाजस्ट्र्जत, दकसी कायािाही के पिकार या उनके प्राजधकृत प्रजतजनजध, िीघ्राजतिीघ्र अिसर पर आयोग के समि यह घोषणा करेंग े दक क्य ा ि े अजधजनयम की धारा 26 के अधीन दकसी िांच के अनुक्रम के िौरान मौजखक प्रस्ट् तुतीकरण करेंग ेया जलजखत तका फाइल करेंगे।

(2) उपजनजयनम (1) के अधीन रहते हुए, आयोग ऐसे समय को, जिसके िौरान, यर्ाजस्ट्र्जत, दकसी कायािाही के पिकार या उनके प्राजधकृत प्रजतजनजधयों द्वारा फाइल दकए गए मौजखक प्रस्ट्त ुतीकरण या जलजखत तकों को संबोजधत दकया िाएगा, तय या सीजमत कर सकेगा और िह दकसी ऐसे पिकार की अनुपजस्ट्र्जत म ें मामल े का जिजनश् चय करन े के जलए कायािाही कर सकेगा, िो जिजनयम 31 के अनुसार ऐसे समयों स े आबद्ध नहीं रहता ह।ै

31. आयोग की दकसी पिकार की अनपु जस्ट्र्जत म ेंकायिा ाही िारी रखन ेकी िजि.

(1) िहां दकसी सामान् य बैठक के िौरान दकसी जिजिष्ट मामले के जलए जनयत दििस को, जिसके अंतगता आस्ट्र् गन पर पुन: बैठक करने का दििस भी ह,ै यदि कायिााही कोई पिकार सूचना की तामील के पश् चात् या तारीख को नोट कर लेने के पश् चात,् भी उपसंिात नहीं होते ह ें तो आयोग, यर्ाजस्ट्र्जत, ऐसे पिकार या पिकारों की अनुपजस्ट्र्जत म ें कायािाही िारी रखन े का जिजनिय कर सकेगा और ऐसे उजचत आििे पाररत कर सकेगा जिस े िह उजचत समझे।

(2) यदि कोई पिकार जिजहत समय के भीतर आिश् यक िानकारी तक पहुचं प्रिान करन े या उसे उपलब् ध करान े स े इन् कार करता ह ैया महत् िपूण ा रूप स े अन् िेषण में बाधा डलता ह ैतो आयोग, उस े उपलब् ध तथ्य ों के आधार पर, िो िह उजचत समझे आिेि पाररत कर सकेगा।

(3) िहां आयोग द्वारा उपजिजनयम (1) या उपजिजनयम (2) के अधीन कोई आिेि पाररत दकया गया ह ै और पिकार यह उपिर्िात करता ह ै दक उसे आयोग के समि कायािाजहयों में भाग लेन े और/या अपेजित सूचना प्रस्ट् तुत करने स,े उसके जनयंत्रण के परे दकन् हीं कारणों से जनिाररत दकया गया र्ा, िहां आयोग इस प्रकार समाधान हो िाने पर आिेि को रद्द कर सकेगा।

32. अतं ररम आिेि.

(1) िहां आयोग ने, दकसी िांच के िौरान, आिेि द्वारा दकसी पिकार को अजधजनयम की धारा 3 की उपधारा (1) या धारा 4 की उपधारा (1) के उल्ल ंघन म ें तब तक कोई कारािाई करन े से अस्ट्र् ायी रूप स े जनबंजधत दकया ह,ै िब तक दक अजधजनयम की धारा 33 के अधीन ऐसी िांच का जनष्क षा न जनकल े या अगल े आिेि न दकए िाएं, िहां ऐसे आिेि पर, यदि कोई हो, सिस्ट् यों द्वारा हस्ट्त ािर दकए िाएंग े और तारीख डाली िाएगी, जिसके अंतगता यदि कोई जिसम् मजत का मामला ह ै तो जिसम् मजत करन े िाले सिस्ट् य द्वारा जिसम् मजत रटप् पण भी ह ै और ऐसा आिेि िीघ्राजतिीघ्र दकया िाएगा।

(2) िहां आयोग न े दकसी िांच के िौरान, उपजिजनयम (1) म ें जिजनर्िाष्ट कोई अतं ररम आििे पाररत दकया है, िहा ं उसके पश् चात् यर्ासंभििीघ्र, उस पिकार की, जिसके जिरुद्ध ऐसा कोई आिेि दकया गया, सनु िाई करेगा।

(3) िहां मामले म,ें अजधजनयम की धारा 33 के अधीन कोई अंतररम आिेि पाररत दकया गया है, िहां आयोग, अंतररम आिेि की तारीख से 180 (एक सौ अस्ट् सी) दििसों के भीतर, यर्ासंभििीघ्र, अंजतम आिेि पाररत करेगा।

33. अजं तम आिेि.

(1) आयोग के प्रत् येक आििे पर सिस्ट् यों द्वारा हस्ट्त ािर दकए िाएंग े और तारीख डाली िाएगी जिसके अंतगात यदि कोई जिसम् मजत का मामला ह ैतो जिसम् मजत करने िाल ेसिस्ट् य द्वारा जिसम् मजत रटप् पण भी ह।ै18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) आयोग के प्रत् येक आिेि या जिजनश् चय को, यर्ािक् य रूप से अंजतम बहस की समाजप्त की तारीख से 21 (इक्क ीस) काया दििसों के भीतर दकया िाएगा।

(3) आिेि की सजचि द्वारा या सजचि द्वारा प्राजधकृत ऐसे दकसी अजधकारी द्वारा सम् यक रूप से प्रमाजणत प्रजत को, आिेि की तारीख से 4 (चार) सप् ताह के भीतर जिजनयम 23 में उपबंजधत दकए गए अनुसार कायािाजहयों के पिकारों पर तामील दकया िाएगा।

34. काननू ी प्राजधकरण या केन्द्र ीय सरकार या राज्य सरकार स ेप्रजतजनिेि.

(1) अजधजनयम की धारा 21 के अधीन राय के जलए दकसी कानूनी प्राजधकरण से या अजधजनयम की धारा 49 के अधीन केन् द्रीय सरकार या राज्य सरकार स े प्राप् त प्रजतजनिेि में ऐसी जिजिजियां अंतर्िाष्ट होंगी, िो आयोग द्वारा जिजनिाष्ट की िाएं।

(2) उपजिनजयम (1) पर कोई प्रजतकूल प्रभाि डाल े जबना धारा 21 के अधीन दकसी कानूनी प्राजधकरण के प्रजतजनिेि म ेंजनम्न जलजखत अतं र्िाष्ट होंगे: - (क) प्रजतस्ट् पधा ा से संबंजधत जिजध की ऐसी जिजनर्िाष् ट प्रस्ट्र् ापना या तथ्य या जिजनर्िाष् ट मद्दु ा या नीजत या कोई अन् य जिषय, जिस पर राय मांगी गई ह;ै (ख) प्रस्ट् र्ापना या मुद्द े या नीजत या दकसी अन् य मामले के अिधारण के जलए सुसंगत पृष्ठ भूजम और ऐजतहाजसक आंकड़े;

(ग) सुसंगत कानूनों, जिसके अंतगात आिश् यक समझे गए जनयम, जिजनयम, अजधसूचनाए,ं आिेि भी ह,ैं की सम् यक रूप से अजधप्रमाजणत प्रजतयां, यदि लागू हो; (घ) पिकारों की सम् यक रूप से अजधप्रमाजणत और अद्यतन सूची, उनके पूणा पत,े टेलीफोन नं; फैक्स नं., ई- मेल पता सजहत;

(ङ) अजधजनयम की धारा 21 के अधीन राय के जलए आयोग को जनर्िाष् ट दकए गए मामले के संबधं में संबंजधत पिकारों को सूचना िने े का सबतू , यदि लागू हो।

(3) धारा 21 के अधीन ऐसे प्रजतजनिेि पर राय िेन े के जलए समय सीमा जिजनयम 15 के उपजिजनयम (5) के परंतुक के अध् ययीन होगी।

(4) यह समाधान हो िाने पर दक प्रजतजनिेि पणू ा ह,ै सजचि दकसी सामान् य बैठक के िौरान उसे आयोग के समि रखेगा और ऐसे पिकारों के, जिन् ह ें बैठक की सूचना िारी की िानी ह,ै संबंध में आिश् यक अनिु ेि प्राप् त करेगा।

(5) सजचि सामान् य बैठक के जलए उक्त पिकारों को, कायािाजहयों में भाग लने े के जलए, जिजनर्िाष् ट रीजत में, कम स े कम 10 (िस) दििस की सूचना िेगा।

(6) ऐसे पिकार, जिन् ह ें उपजिजनयम (5) के अधीन सूचनाएं िारी की गई हैं, सूचना की प्राजप्त स े 7 (सात) दििसों के भीतर, प्रत् यके पिकार को सचू ना पर अपनी रटप् पजणयों या उत् तर की एक प्रजत तामील करने के पश् चात् उन् ह ें फाइल कर सकेंगे।

(7) आयोग जिचार-जिमिा के जलए या साक्ष्य के जलए कानूनी प्राजधकरण या केन् द्रीय सरकार या राज्य सरकार के दकसी प्रजतजनजध या िेत्र के जििेषज्ञ को, जिसे िह मामले म ेंआिश् यक समझे, बुला सकेगा।

(8) आयोग, दकसी व् यजि या उद्यम या दकसी केन् द्रीय या राज्य सरकार या कानूनी प्राजधकरण से ऐसी कोई जिजिजियां और सूचनाएं एकजत्रत कर सकेगा, िो उसकी राय में आयोग को प्राप् त प्रजतजनिेि से सुसंगत ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 19

(9) आयोग कोई राय बना सकेगा और उसे संबंजधत पिकारों को भेि सकेगा तर्ा उसके द्वारा जिजनजित समय के भीतर उन पर उनस े आिपे और/या सुझाि मांग सकेगा तर्ा ऐसे आिपे या सुझाि पर जिचार करन े के पश् चात ् िह, यर्ाजस्ट्र्जत, कानूनी प्राजधकरण या केन् द्रीय सरकार या राज्य सरकार को अंजतम राय प्रिान कर सकेगा।

(10) उस ििा म,ें िहां प्रजतजनिेि दकसी कानूनी प्राजधकरण द्वारा स्ट्िप्रेरणा से दकया गया है, िहां उसे उपजिजनयम

(2) के खंड (घ) और (ड.) तर्ा उपजिजनयम (5), (6) और (9) म ें अंतर्िाष्ट उपबधों के आिेिन स े छूट िी िा सकेगी।

35. आयोग द्वारा राय के जलए काननू ी प्राजधकरण को प्रजतजनिेि.

(1) धारा 21क के अधीन आयोग द्वारा राय के जलए दकसी कानूनी प्राजधकरण को दकए गए प्रजतजनिेि म ें जनम्न जलजखत अंतर्िाष्ट होंग,े – (क) प्रजतस्ट् पधाा से संबंजधत जिजध की ऐसी जिजनर्िाष् ट प्रस्ट् र्ापना या तथ्य सा जिजनर्िाष् ट मुद्दा, जिस पर राय मांगी गई ह;ै (ख) प्रस्ट् र्ापना या मुद्द ेके अिधारण के जलए सुसंगत पृष्ठ भूजम और ऐजतहाजसक आंकड़े;

(ग) अजधजनयम, तिधीन जिरजचत सुसंगत जनयमों और जिजनयमों, अजधसूचनाओं और आििे ों, यदि कोई आयोग द्वारा अजनणीत मामल े में पाररत दकए गए हों, िो िह आिश् यक समझे, की सम् यक रूप से अजधप्रमाजणत प्रजतयां; (घ) पिकारों की सम् यक रूप से अजधप्रमाजणत और अद्यतन सूची, उनके पूण ा पते, टेलीफोन न.ं , फैक्स नं., ई- मेल पते आदि सजहत;

(ङ) अजधजनयम की धारा 21क के अधीन राय के जलए आयोग को जनर्िाष् ट दकए गए मामले के संबंध में संबंजधत पिकारों को सूचना िने े का सबूत; (च) सजचि यह प्रमाजणत करेगा दक अग्रेजषत दकया िा रहा प्रजतजनििे ऊपर खंड (क) से (ड.) के अनरूु प ह।ै परंतु यह दक यदि उस ििा म,ें िहां प्रजतजनिेि, आयोग द्वारा स्ट्िप्रेरणा से दकया िा रहा है, िहां उसे उपयुाि खडं (घ) और (ङ) में अतं र्िाष्ट उपबंधों के लाग ूहोने से छूट िी िा सकेगी।

(2) िहां कानूनी प्राजधकरण दकए गए प्रजतजनििे में अजतररक्त सचू ना की मांग करता ह,ै िहा,ं सजचि, यर्ािक् य रूप से, संबंजधत कानूनी प्राजधकरण से उसकी प्राजप्त की तारीख से 15 (पंद्रह) दििसों के भीतर संबंजधत प्राजधकरण को ऐसी अजतररक्त सूचना उपलब्ध कराएगा।

(3) उस ििा म,ें िहा ं उपजिजनयम (1) या उपजिजनयम (2) के अधीन कोई प्रजतजनिेि अग्रेजषत करन े के 60 (साठ) दििस के भीतर कानूनी प्राजधकरण से कोई राय प्राप् त नहीं होती ह,ै िहां सजचि, अजग्रम आिेिों के जलए मामल े को सामान् य बैठक के िौरान आयोग के समि रखगे ा।

(4) कानूनी प्रजधकरण के अजधजनयम की धारा 21क की उपधारा (2) के अधीन राय प्राप् त होने पर सजचि आिेिों के जलए उसको सामान् य बैठक के िौरान आयोग के समि रखगे ा।

36. गोपनीयता.

(1) आयोग दकसी सूचना िने े िाले व् यजि की इसकी जलजखत में अनरु ोध दकए िान े पर उसकी पहचान की गोपनीयता बनाए रखगे ा:20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु िहां अजधजनयम के प्रयोिनों के जलए सूचना िने े िाले व् यजि की पहचान प्रकट करना आिश् यक या समीचीन ह,ै िहां आयोग सचू ना िेने िाल े व् यजि को आयोग के समि अपना मामला प्रस्ट्त ुत करने के जलए युजियुक् त अिसर िने े के पश् चात् उसकी पहचान प्रकट करेगा।

(2) कोई पिकार उसके द्वारा प्रस्ट् तुत सूचना या िस्ट् तािेि(िस्ट्ताििे ों) पर गोपनीयता की मांग करता ह ै तो िह ऐस े व् यिहार के जलए अकाट्य कारण िगे ा और स्ट्ियं प्रमाजणत करेगा दक दकसी सूचना या िस्ट् तािेि(िस्ट्तािेिों) या उसके दकसी भाग(भागों) को गोपनीय न रखने के पररणामस्ट् िरूप व्यापार रहस्ट्यों का प्रकटन होगा या दकसी सूचना के िाजणजज्यक मल्ू य म ें बबाािी होगी या सारिान कमी होगी या उससे युजियुक् त रूप स े कोई गंभीर िजत होन े की आिंका ह।ै आगे, पिकार स्ट्ि-प्रमाणन के आधार पर, उस तारीख के सार् जिसको ऐसा गोपनीय व् यिहार समाप् त हो िाएगा, जनम्नजलजखत की पुजि करेगा:

(क) दक सूचना सािािजनक प्रभाि िेत्र में उपलब् ध नहीं ह;ै (ख) दक सूचना पिकार के कारबार के सीजमत कमाचाररयों, प्रिायकतााओं, जितरकों और उसम ें अंतिाजलत अन् य व् यजियों को ज्ञात ह;ै (ग) दक पिकार द्वारा सूचना की गोपनीयता की सुरिा के जलए पयााप् त उपाय दकए गए ह;ैं (घ) दक सूचना अन् य व् यजियों द्वारा अर्िात नहीं की िा सकती ह ैया अनुजलजप नहीं बनाई िा सकती ह।ै गोपनीयता का िािा करने िाला पिकार, यर्ा उपयुाक् त अपेिाओं के जनबंधनों के अनुसार िािे प्रमाजणत करत े हुए एक िपर्पत्र के स्ट् िरूप म ें िचनबंध उपलब् ध कराएगा और ऐसा िचनबंध या तो पिकार स्ट् िय ं या उसका कोई कमाचारी फाइल करेगा िो संबंजधत पिकार की ओर स े ऐसे प्राजधकार िारी करन े के जलए पिकार द्वारा सम् यक रूप से प्राजधकृत हो:

परंतु यह दक जमथ् या िचनबंध प्रस्ट् तुत करने िाले पिकार, अजधजनयम के उपबंधों के अनुसार, कायािाही दकए िाने के भागी होंगे।

(3) गोपनीयता का िािा करने िाला पिकार, उसके प्रर्म पृष् ठ के ऊपरी भाग पर और ऊपरी भाग के जनकट लाल स्ट् याही में स्ट् पष्ट और सुपठनीय रूप म ें क्रमि: ‘प्रकािन के जनबधं न का िािा’ और ‘गोपनीय’ िब् िों और िािे की अंतािस्ट् त,ु िो लाल स्ट् याही में जचन् हांदकत/टंदकत ह,ै को जचन् हांदकत करत े हुए ऐसी सूचना या िस्ट् तािेि(िस्ट्त ािेिों) का पूण ा पाठ फाइल करेगा जिसके सार् उसका ‘अगोपनीय’ पाठ भी फाइल दकया िाएगा िो संपादित होगा/जिसमें ऐसी सूचना या ऐसा िस्ट् तािेि(ऐसे िस्ट् तािेिों) या उसका भाग (उनके भाग) सजम्मजलत नहीं होगा (होंग)े जिसकी गोपनीयता का िािा दकया गया ह।ै

(4) ऐसी सूचना या िस्ट् तािेि(िस्ट्त ािेिों) का अगोपनीय पाठ उस गोपनीय पाठ की सही प्रजत होगी, जिसमें उपजिजनयम (3) में यर्ा अनुबद्ध सुस्ट्प ष्ट रीजत में उपिर्िात गोपनीय सूचना का लोप होगा।

(5) ऐसी सूचना या ऐसा िस्ट्त ािेि(ऐसे िस्ट् तािेिों) या उसका भाग (उसके भागों) जिनका इस जिजनयम के अधीन गोपनीय होन े का िािा दकया गया है, उसे अगोपनीय अजभलखे से पृर्क दकया िाएगा और उसे सुरजित रूप से कायािाजहयों का िीषाक, डॉकेट संख् या ‘गोपनीय’ रटप् पणी और िह तारीख जलखी िाएगी, जिसको गोपनीय व् यिहार की कालािजध समाप् त हो िाएगी:

परंतु यह दक जनम्नजलजखत को यर्ाजस्ट्र्जत, 'गोपनीय (तलािी और िब्ती/ई-मेल डंप/कॉल जडटेल ररकॉड ा आदि)' के रूप में जचन् हांदकत दकया िाएगा और अलग से रखा िाएगा: (क) तलािी और िब्ती अजभयान के द्वारा प्राप् त िस्ट् तािेि/सामग्री;

(ख) ई-मेल डपं ;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 21 (ग) कॉल जडटेल ररकॉडा; या (घ) व् यजिगत सूचना की प्रकृजत म ेंकोई अन् य िस्ट् तािेि/सामग्री

(6) आयोग यदि आिश् यक या समीचीन समझे, अजधजनयम की धारा 35 के अधीन जिजनर्िाष् ट प्राजधकृत प्रजतजनजध िो उपजिजनयम (5) में यर्ा उजल्लजखत सूचना तक पहुचं रखने में सिम होगा िो इन जिजनयमों के जिजनयम 38 के जनबंधनों के अनुसार असंपादित स्ट् िरूप में यर्ापेजित ह,ै सजहत लेदकन यहीं तक सीजमत नहीं, पिकारों के ऐसे प्राजधकृत प्रजतजनजध को जमलाकर गोपनीयता िलय(िलयों) को स्ट्र् ाजपत कर सकेगा:

परंतु यह दक आयोग, गोपनीयता िलय स्ट् र्ाजपत करते समय, पहुचं योग् य बनाये िान े िाली सूचना के सार्-सार् गोपनीयता िलय म ें प्रयोिन के जलए सजम्मजलत होने िाल े िाले पिकारों और उनके सिस्ट् यों की सीमा, िो उजचत हो जिजनजित कर सकेगा:

परंतु यह और दक उपजिजनयम (5) के परंतुक म ें उजल्लजखत िस्ट्त ािेि(िस्ट् तािेिों)/सामग्री जिन पर महाजनिेिक के प्रजतिेिन के गोपनीय पाठ म ें भरोसा दकया गया है, गोपनीय िलय के सिस्ट् यों तक पहुचं योग् य बनाया िाएगा।

(7) (क) गोपनीय सूचना तक पहुचं की मांग करने िाल े पिकार, एक आिेिन की रीजत स,े यर्ासंभििीघ्र, गोपनीयता िलय स्ट्र् ाजपत करने का अनुरोध करेगा। (ख) उस ििा म,ें िहां पिकार ने अन् िेषण ररपोटा की अगोपनीय पाठ की प्राजप्त के पश् चात, ऐसा अनुरोध दकया ह ैिहां उसे, उसकी प्राजप्त के 10 (िस) दििसों के भीतर कर दिया िाएगा:

परंतु यह दक यदि आयोग का यह समाधान हो िाता ह ै दक पिकार को 10 (िस) दििसों की कजर्त कालािजध के भीतर अनुरोध करने से पयााप्त कारण स े रोका गया र्ा, तो िह 7 (सात) दििसों की आगे की कालािजध के भीतर दकए गए अनुरोध पर जिचार कर सकेगा।

(8) गोपनीयता िलय में सजम्मजलत होने िाले पिकारों को उपजिजनयम (6) के जनबंधनों के अनसु ार असंपादित सूचना तक पहुचं , उनके द्वारा यह कर्न करत े हुए दक सूचना जिस तक ऐस े िलय के अनुसरण म ें उनके सिस्ट् यों की पहुचं ह,ै उसे दकसी अन् य व्य जि जिसके अंतगात संबंजधत उद्यम का कोई अजधकारी और/या अन् य कमाचारी या संबंजधत उद्यम का कोई सह-उद्यम, अनुषगं ी, समूह अजस्ट्तत्ि का कोई अजधकारी और/या कमाचारी, या कोई अन् य व् यजि, िो भी हो, भी ह,ैं को साझा नहीं करेंग े और/या प्रकटन नहीं करेंग े और दक िे ऐसी सूचना और िस्ट् तािेिों का केिल अजधजनयम के अधीन कायािाजहयों के प्रयोिन के जलए ही उपयोग करेंगे, और िे ऐसी सूचना और िस्ट् तािेिों को अपनी एकमात्र अजभरिा के अंतगता रखगें े, और ितामान कायािाजहयों की पररणजत पर उसे नष्ट कर िगें े, पर एक िपर्पत्र के स्ट् िरूप म ेंिचनबंध फाइल करने पर, प्रिान की िाएगी:

परंत ु यह दक गोपनीयता िलय में सजम्मजलत प्रत् येक पिकार, अन् य पिकारों को भी जिन् ह ें उनके सिस्ट् यों द्वारा गोपनीयता सूचना की पहुचं िी िा रही ह,ै के जिषय में उपयुाक् त जनबंधनों पर, एक िपर्पत्र के स्ट् िरूप म ें अलग िचनबधं (िचनबंधों) को प्रिान करेंग,े और पिकारों के पास ऐसे िचनबंध (िचनबंधों) के कोई उल्ल ंघन के मामले म,ें जिजधनुसार, समुजचत प्रजतकारों का लाभ उठान ेकी स्ट् ितंत्रता होगी:

परंत ु यह और दक गोपनीयता िलय का भाग बनन े िाल े संबंजधत पिकार और उनके सिस्ट् य, िचनबंधों के उल्ल ंघन के जलए अजधजनयम के उपबंधों के अनुसार, कायािाही दकए िाने के भागी होंगे।

(9) पिकार गोपनीय िलय स्ट्र् ाजपत करने के आिेि की प्राजप्त की तारीख 10 (िस) दििसों की कालािजध के भीतर, उपयुाक् त उपजिजनयम (8) के जनबधं नों के अनुसार िचनबंध फाइल करेंगे:22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु यह दक यदि आयोग का यह समाधान हो िाता ह ै दक पिकार को 10 (िस) दििसों की कजर्त कालािजध के भीतर, िचनबंध फाइल करने स े पयााप्त कारण से रोका गया र्ा, तो िह 5 (पांच) दििसों की आग ेकी कालािजध के भीतर, उसका प्रजतग्रहण कर सकेगा।

(10) सूचना िेन े िाला, गोपनीयता िलय का भाग नहीं बनगे ा और उसके पास केिल अगोपनीय अजभलेख तक ही पहुचं होगी: परंत ु यह दक आयोग, उपयुक्त मामलों म,ें सूचना िेन े िाल े को गोपनीयता िलय म ें सजम्मजलत कर सकेगा, यदि िह सूचना िने े िाले का िलय म ें समािेिन प्रभािी िांच के जलए आिश् यक या समीचीन समझता ह।ै

(11) (1) गोपनीयता िलय म ें सजम्मजलत पिकार, इन जिजनयमों के जिजनयम 51 के सार् परठत, जिजनयम 38 के अधीन, िचनबंध(िचनबंधों) को प्रस्ट् तुत करने की तारीख से 7 (सात) दििसों की कलािजध के भीतर, जनरीिण की मांग करने के आिेिन(आििनों) को कर सकेंगे।

(2) पिकारों को ऐसा जनरीिण, अनुज्ञा दिय े िाने के 21 (इक्क ीस) दििसों की कालािजध के भीतर पणू ा करना होगा।

(3) पिकार, इसके पश् चात 7 (सात) दििसों की कालािजध के भीतर, इन जिजनयमों के जिजनयम 51 के सार् परठत जिजनयम 38 के अधीन, प्रमाजणत प्रजतयां प्रिान करन े की मांग के आिेिन(आिेिनों) को कर सकेंगे।

(4) माजणत प्रजतयों की मागं करन े के आिेिन की प्राजप्त पर, उसकी 14 (चौिह) दििसों की कालािजध के भीतर प्रिायगी कर िी िाएगी: परंतु यह दक सजचि, उपयुाक्त उपखंड (2) के अधीन जिजहत समयािजध(समयािजधयों) को आग े 7 (सात) दििसों की कालािजध ककंतु अपश् चात, बढा सकेगा।

(12) (1) आयोग, आपिादिक मामलों में, जिजिष्ट जिषय के तथ्य ों और पररजस्ट्र्जतयों पर जिचार करते हुए, कारणों को जलजखत में लेखबद्ध करके, इस जिजनयम के अधीन जिजहत समयािजध बढा सकेगा।

(2) उस ििा म,ें िहां पिकार, प्रित् त समयािजध का पालन करन े में जिफल रहता ह/ैरहत े हैं, िहा ं आयोग, कानून के अनुसार कायािाही िारी रखगे ा।

(13) यदि आयोग दकसी ऐसे आििे या जिजनश् चय या राय, सूचना में ऐसा कोई भाग सजम्मजलत करता ह ै जिसे इस जिजनयम के अधीन गोपनीय िािा दकया गया है, तो आयोग, यर्ाजस्ट्र्जत, आिेि या जिजनश्च य या राय के िो पाठ बनाएगा। अगोपनीय पाठ, जिसमें ऐसी गोपनीय सूचना, िो पूणा पाठ में जिद्यमान ह,ै का लोप ह,ै पिकारों पर तामील की िाएगी, और अगोपनीय अजभलखे में सजम्मजलत की िाएगी। पूणा पाठ को उपजिजनयम (4) में उपबंजधत दकए गए अनुसार गोपनीय अजभलेखों में रखा िाएगा और उस ेगोपनीयता िलय के सिस्ट् यों के सार् साझा दकया िाएगा।

(14) कोई व् यजि या पिकार, जिसके अंतगात अजधजनयम की धारा 17 की उपधारा (1) के अधीन आयोग द्वारा जनयुक्त कोई अजधकारी या कमाचारी या अजधजनयम की धारा 16 की उपधारा (1) के अधीन केन् द्रीय सरकार द्वारा जनयुक्त कोई अजधकारी या अजधजनयम की धारा 17 की उपधारा (3) के अधीन आयोग द्वारा जनयोजित कोई जििेषज्ञ या िृजत्तक या अजधजनयम की धारा 36 की उपधारा (3) के अधीन आयोग की सहायता के जलए बुलाया गया कोई जििेषज्ञ भी है, ऐसी सूचना या ऐस े िस्ट् ताििे (ऐसे िस्ट् तािेिों) या उसका भाग (उसके भागों) की, जिसका इस जिजनयम के अधीन गोपनीयता का िािा दकया गया ह,ै अतं िास्ट् त ु की गोपनीयता बनाए रखगे ा[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 23 और इस अजधजनयम या तत्स मय प्रिृत् त दकसी अन् य जिजध के प्रयोिन से जभन् न दकसी प्रयोिन के जलए ऐसी गोपनीय सूचना का उपयोग या प्रकटन या उसके संबंध में व् यिहार नहीं करेगा:

परंतु यह दक आयोग/कायाालय महाजनिेिक का कोई अजधकारी या कमाचारी द्वारा गोपनीयता के उल् लघं न को, यर्ाजस्ट्र्जत, सुसगं त जनयमों या जिजनयमों के अधीन अनुिासनात् मक कायािाही प्रारंभ के जलए आधार माना िाएगा: परंत ु यह और दक यदि अजधजनयम की धारा 17 की उपधारा (3) के अधीन आयोग द्वारा जनयोजित दकसी जििेषज्ञ या िृजत्तक या अजधजनयम की धारा 36 की उपधारा (3) के अधीन आयोग की सहायता के जलए बुलाए गए दकसी जििेषज्ञ द्वारा गोपनीयता का उल्ल ंघन दकया िाता ह ै तो िह, यर्ाजस्ट्र्जत, ऐसे जनयोिन या संजििा को समाप् त करने के जलए पयााप् त आधार होगा।

37. आयोग के आििे ों का अनपु ालन. आयोग के पास संबंजधत पिकारों को यह जनिेि िने े की िजि होगी दक िे उसके आििे के अनुपालन या आिेि म ें जिजनर्िाष् ट रीजत में ऐसे अन् य िस्ट्त ािेिों के अनुपालन के संबंध में िपर्पत्र फाइल करें।

38. िस्ट्त ाििे ों का जनरीिण एि ंउसकी प्रमाजणत प्रजतयां.

(1) अजधजनयम 57 के उपबंधों और इन जिजनयमों के जिजनयम 36 के अधीन रहते हुए, आयोग की दकसी सामान् य बैठक में कायािाजहयों के दकसी पिकार को, उसके द्वारा इस जनजमत् त सजचि को संबोजधत जलजखत म ें आिेिन दकए िाने पर, जिजनयम 51 में यर्ाजनर्िाष् ट फीस का संिाय दकए िान े पर कायािाजहयों के िौरान प्रस्ट् तुत िस्ट् तािेिों या अजभलेखों का जनरीिण करन े या उनकी प्रजतया ंअजभप्राप् त करन े की अनुज्ञा िी िाएगी:

परंतु यह और दक आंतररक िस्ट्त ािेिों के जनरीिण या उसकी प्रमाजणत प्रजतयों के अनुरोध को अनुज्ञा नहीं िी िाएगी।

(2) आयोग, ऐसे दकसी व् यजि द्वारा, िो कायािाजहयों का पिकार नहीं ह ै और उसके द्वारा पयााप् त कारण उपिर्िता दकए िाने पर, ऐसे व् यजि को जिजनयम 51 में यर्ाजिजनर्िाष् ट फीस का संिाय दकए िाने पर उपजिजनयम (1) में उजल् ल् खत िस्ट्त ािेिों या अजभलेखों के जनरीिण करने और/या उनकी प्रमाजणत प्रजतयां अजभप्राप् त करने की अनुज्ञा ि ेसकेगा।

(3) जनरीिण की अनज्ञु ा केिल सजचि द्वारा इस प्रकार प्राजधकृत दकसी अजधकारी की उपजस्ट्र्जत म ेंही िी िाएगी: परंतु यह दक उपजिजनयम (1) या उपजिजनयम (2) के अनसु ार िस्ट् तािेिों का जनरीिण या उनकी प्रमाजणत प्रजतया ं अजभप्राप् त करने की अनुज्ञा, सजचि या उसके द्वारा इस जनजमत् त प्राजधकृत दकसी अजधकारी द्वारा जिजनर्िाष् ट समय सीमाओं और उसके अधीिण के अधीन रहते हुए िी िाएगी:

परंत ु यह और दक गोपनीय िस्ट्त ािेिों का जनरीिण और उसकी प्रमाजणत प्रजतयां अजभप्राप् त करने के प्रयोिनों के जलए, इन जिजनयमों के जिजनयम 36 के अधीन यर्ाअनुबद्ध समय सीमाएं लागू होंगी।

(4) केन् द्रीय या राज्य सरकार के दकसी अजधकारी या महाजनिेिक या कानूनी प्रजधकरण को, उसके द्वारा इस प्रयोिन के जलए सजचि को जलजखत अनरु ोध दकए िान े पर उपजिजनयम (1) म ें उजल्लजखत िस्ट् तािेिों या अजभलेखों का जनरीिण करन ेऔर उनकी प्रजतयां प्राप् त करने की अनुज्ञा िी िाएगी।

39. दकसी पिकार की मत्ृ य ु या उस े दििाजलया के रूप म ें न्य ायजनणीत दकए िान े के पश्च ात ् कायिा ाजहयों का िारी रहना. िहां दकसी कायािाही के पिकार की आयोग की सामान् य बैठक में मृत् यु हो िाती ह ै या उसे दििाजलया न् यायजनणीत दकया िाता ह ै या दकसी कंपनी की ििा में, उसका समापन दकया िा रहा ह ै तो िहां कायािाजहयों का उपिमन नहीं24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] होगा और उन् ह,ें यर्ाजस्ट्र्जत, पिकारों के जनष्प ािक, प्रिासक, या अन् य जिजधक प्रजतजनजधयों के द्वारा या जिरुद्ध या समनुिेजिजतयों, ररजसिर या पररसमापक द्वारा जिरुद्ध िारी रखा िा सकेगा।

40. अननपु ालन का प्रभाि. इन जिजनयमों की दकन् हीं अपिे ाओं के अनुपालन म ें असफलता दकसी कायािाही को, केिल ऐसी असफलता के कारण अजिजधमान् य नहीं बनाएगी, िब तक दक आयोग का यह जिचार न हो दक ऐसी असफलता के पररणामस्ट् िरूप न् याय का अजतक्रमण हुआ ह।ै

41. साक्ष्य लने ा.

(1) अजधजनयमों के अधीन रहते हुए, यर्ाजस्ट्र्जत, आयेाग या महाजनिेिक ऐसी रीजत को अिधाररत कर सकेगा जिसमें उसके समि जिद्यमान कायािाजहयों में साक्ष्य प्रस्ट् तुत दकया िा सकेगा।

(2) उपजिजनयम (1) पर कोई प्रजतकूल प्रभाि डाले जबना आयोग या महाजनिेिक, यर्ाजस्ट्र्जत, िांच या अन् िेषण के प्रयोिन के जलए, – (क) सत् याजपत दकए िाने योग् य टेप ररकार्डंगों की प्रजतकृजतयों, िीजडयो ररकार्डंगों के असंपादित पाठों, इलैक्र ाजनक मले , टेलीफोन अजभलेखों, जिनके अंतगात अजधप्रमाजणत मोबाइल टेलीफोन ररकाडा भी हैं, जलजखत, हस्ट् तािररत अिपर्पिू ाक दिए गए व् यजिक बयानों या जलजखत प्रश् नोत् तरों या सािात् कारों के हस्ट्त ािररत प्रत् यत्ु तरों या बािार सिेिणों या आर्र्ाक अध् ययनों के आधार पर जििेषज्ञों की रटप् पजणयों या रायों या जिश् लेषणों या अन्य प्राजधकृत पाठों के रूप में या अन् यर्ा को सारिान साक्ष्य के रूप में ग्रहण कर सकेगा;

(ख) दकसी प्रमाणपत्र, प्रमाजणत प्रजत या अन् य िस्ट्त ािेि के रूप म ें तात् पर्यात प्रत् येक ऐसे िस्ट् तािेि को जिसे जिजध द्वारा ग्रहण योग् य घोजषत दकया गया हो, दकसी जिजिष्ट तथ्य के साक्ष्य के रूप में िास्ट् तजिक मानत े हुए अजभलेख पर ग्रहण कर सकेगा, परंतु यह दक िह, यर्ाजस्ट्र्जत, केन्द्र ीय सरकार या राज्य सरकार या कानूनी प्रजधकरण के दकसी रािपजत्रत अजधकारी या दकसी मजिस्ट् रेट या नोटरी अजधजनयम, 1952 (1952 का 53) के अधीन जनयक्ु त दकसी नोटरी या आयेाग के सजचि द्वारा सम् यक रूप स ेप्रमाजणत हो;

(ग) लेखा बजहयों में, जिनके अंतगता इलैक्र ाजनक रूप में रखी गई लेखा बजहयां भी हैं, जिन् ह ें कारबार के अनुक्रम म ें जनयजमत रूप से रखा िाता ह ै और इसम ें दकसी ऐसी लोक या अन् य िासकीय बही, रजिस्ट् टर या अजभलेख या इलैक्र ाजनक अजभलेख भी सजम्मजलत ह,ैं जिसे दकसी लोक सेिक द्वारा उसके िासकीय कताव् य के जनिाहन म ें रखा गया ह ै या दकसी अन् य व् यजि द्वारा िेि की जिजध द्वारा जििेष रूप से उसे सौंप े गए कताव् य के जनष्प ािन के जलए दकसी अन् य व् यजि द्वारा रखा गया ह,ै जिसमें दकसी बही, रजिस्ट् टर, अजभलेख या इलैक्र ाजनक अजभलेख को रखा िाता ह,ै की गई प्रजिजियों को िस्ट् तािेिी साक्ष्य के रूप म ें ग्रहण कर सकेगा;

(घ) दकसी ऐसे व् यजि की राय को, िस्ट् तािेि जलखन े या हस्ट्त ािररत करन े िाले व् यजि को जलखािट को साजबत करने के जलए एक सुसंगत तथ्य के रूप म ें ग्रहण कर सकेगा, िो उस व् यजि की जलखािट से भली भांजत पररजचत ह,ै जिसके द्वारा ऐसा कोई िस्ट् तािेि जलखा या हस्ट् तािररत दकया गया ह;ै (ङ) जलखािट के जििेषज्ञों या उंगजलयों के जनिानों की पहचान करने िाले जििेषज्ञों या जििेिी जिजध या दकसी जिज्ञान या कला के जनिचा न में जििेष रूप से िि व् यजियों की राय को ग्रहण कर सकेगा;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 25 (च) ऐसे तथ्य ों को सूचना म ें लगे ा, जिनकी सूचना भारतीय साक्ष्य अजधजनयम, 2023 (2023 का 47) की धारा 52 के अधीन दकसी जिजध के न् यायालय द्वारा ली िाती ह;ै (छ) ऐसे तथ्य ों को स्ट् िीकार कर सकेगा, जिन् ह ें कायािाजहयों के पिकार प्रस्ट् तुत या जलजखत में स्ट् िीकार करते ह ें और जिन् ह ें साजबत दकया गया ह;ै (ज) यह मान लेगा दक भारत का भाग न बनन े िाले दकसी िेि के दकसी प्राजधकरण, न् यायालय या सरकार के दकसी अजभलेख की प्रमाजणत प्रजत के रूप म ें तात् पर्यात कोई िस्ट् तािेि िास्ट् तजिक और सही ह,ैं यदि ऐसा िस्ट् तािेि ऐसे िेि की राष्र ीय सरकार के प्रजतजनजध द्वारा दकसी ऐसी रीजत में प्रमाजणत दकया िाना तात् पर्यात ह,ै िो उस िेि म ें ऐसे अजभलेखों की प्रजतयों के प्रमाणन के जलए सामान् यत: उपयोग की िाती ह,ै इसके अंतगात भारत में उस िेि के ितू ािास या उच् चायोग द्वारा दकया गया प्रमाणन भी ह;ै (झ) ऐसे िस्ट्त ािेिों को, जिनके अंतगात कायािाजहयों के जलए सुसंगत और सारिान मान े गए साक्ष्य रूप म ें इलैक्र ाजनक अजभलेख भी ह,ैं ग्रहण कर सकेगा।

(3) उपजिजनयम (2) के उपबंधों के अधीन रहत े हुए, भारतीय साक्ष्य अजधजनयम, 2023 (2023 का 47) के जनम्न जलजखत धाराएं, िहां तक िे यर्ािक् य रूप से जनम्न जलजखत मामलों से संबंजधत ह,ैं यर्ाजस्ट्र्जत, आयोग या महाजनिेिक द्वारा िांच या अन् िेषण के प्रयोिन के जलए उसी प्रकार लागू हो सकेंगी, – (क) धारा 20 – िब दकसी इलैक्र ाजनक अजभलेख की अतं िास्ट् त ु के सबं ंध में मौजखक प्रस्ट्त ुतीकरण ससु ंगत हो;

(ख) धारा 41 (2) - इलैक्र ाजनक हस्ट्त ािर संबंध में राय, िब सुसंगत हो; (ग) धारा 63 - इलैक्र ाजनक अजभलखे ों की ग्राह्यता; (घ) धारा 66 - इलैक्र ाजनक हस्ट् तािर के संबंध में सबूत; (ङ) धारा 73 - अंकीय हस्ट्त ािर के सत् यापन संबंध में सबूत;

(च) धारा 81 - इलैक्र ाजनक और अकं ीय अजभलेख म ेंरािपत्रों के संबंध में माना िाना; (छ) धारा 85 - इलैक्र ाजनक करारों के संबंध में माना िाना; (ज) धारा 86 - इलैक्र ाजनक ररकाडों और इलैक्र ाजनक हस्ट्त ािरों के संबंध में माना िाना;

(झ) धारा 87 - इलैक्र ाजनक हस्ट् तािर प्रमाणपत्रों के संबंध म ेंमाना िाना; (ञ) धारा 90 - इलैक्र ाजनक संििे ों के संबंध में माना िाना; (ट) धारा 91 - प्रस्ट् ततु न दकए गए िस्ट् तािेिों के सम् यक जनष्प ािन के संबंध में माना िाना;

(ठ) धारा 93 - पांच िषा परु ान े इलक्ै र ाजनक अजभलेखों के संबंध में माना िाना।

(4) यर्ाजस्ट्र्जत, आयोग या महाजनिेिक पिकारों को िपर्पत्रों के माध् यम से साक्ष्य प्रस्ट् तुत करने या मामले म ें मौजखक साक्ष्य प्रस्ट् तुत करन े के जलए कह सकेगा।

(5) यदि, यर्ाजस्ट्र्जत, आयोग या महाजनिेिक दकसी पिकार को मौजखक प्रस्ट् तुतीकरण द्वारा साक्ष्य प्रस्ट् तुत करने का जनिेि िेता ह ै तो, यर्ाजस्ट्र्जत, आयोग या महाजनिेिक, यदि िह ऐसा आिश् यक या समीचीन मानता ह ै तो, यर्ाजस्ट्र्जत, अन् य पिकार या पिकारों को साक्ष्य िेने िाले व् यजि की प्रजत-परीिा करने का अिसर प्रिान कर सकेगा:26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु यह दक यदि दकसी पिकार द्वारा मौजखक प्रस्ट् तुतीकरण की रीजत से दिये गए साक्ष्य पर, महाजनिेिक द्वारा दकसी अन्य व्यजि या पिकार के जिरुद्ध अपनी अन् िेषण ररपोटा में भरोसा करने की मांग की िाती ह,ै तो महाजनिेिक संबंजधत व्यजि या पिकार को, जिसके जिरुद्ध ऐस े साक्ष्य पर भरोसा करन े की मागं की िाती ह,ै साक्ष्य िेने िाले व्यजि से प्रजत-परीिा करन े का अिसर प्रिान करेगा।

(6) यर्ाजस्ट्र्जत, आयोग या महाजनिेिक, यदि िह ऐसा आिश् यक या समीचीन मानता ह ै तो िह यह जनिेि ि े सकेगा दक दकसी पिकार के साक्ष्य को उक्त प्रयोिन के जलए अजभजहत अजधकारी या व् यजि द्वारा लेखबद्ध दकया िाए।

(7) आयोग पिकारों को मामले म ेंबहस या प्रस्ट् तुतीकरणों का जलजखत रटप् पण फाइल करन े का जनिेि ि ेसकेगा।

42. िपर्पत्र फाइल करके तथ्य ों का समर्ना करना.

(1) यर्ाजस्ट्र्जत, आयोग या महाजनिेिक, दकसी भी समय पयााप् त कारणों से यह आििे िारी कर सकेगा दक जिजिष्ट तथ्य या तथ्य ों का िपर्पत्र द्वारा समर्ान दकया िाए।

(2) प्रत् यके िपर्पत्र को ए4 आकार (210 x 297 जममी या 8.27’’ x 11.69’’) के सफेि बांड पृष्ठ पर एररयल 12 के फॉंट में डबल स्ट् पेस और बांई ओर िो इंच का और अन् य सभी ओर से एक इंच का मार्िान छोड़त े हुए केिल एक ओर टंदकत दकया िाएगा।

(3) प्रत् यके िपर्पत्र में ऐस ेहते ुक या मामले का स्ट् पष्ट कर्न होगा जिसमें ऐसी िपर् ली गई ह।ै

(4) प्रत् यके िपर्पत्र को प्रर्म व् यजि में जलखा िाएगा और यह पैराओं में जिभाजित होगा जिन् हें क्रमिार संख् यादकत दकया िाएगा और इसमें अजभिािी का िणना , उसके व् यिसाय और जनिास के सही स्ट् र्ान का कर्न होगा।

(5) आयोग के समि दकसी हते ु या मामले के प्रयोिनों के जलए िपर्पत्रों को दकसी न् यायालय या मजिस्ट् रेट या नोटरी अजधजनयम, 1952 )1952 का 53) के अधीन जनयुक्त दकसी नोटरी या दकसी ऐस े अन्य अजधकारी या व् यजि, जिसे उच् च न् यायालय द्वारा इस जनजमत् त दकया गया हो और जिसे दकसी राज्य सरकार द्वारा जसजिल प्रदक्रया संजहता, 1908 (1908 का 15) की धारा 139 में उजल्लजखत प्राजधकार द्वारा साधारणत: या जििेष रूप से इस जनजमत् त सिक्त दकया गया हो, के समि तैयार दकया िा सकेगा।

(6) दकसी िपर्पत्र म ें संलग्न प्रत्य के प्रिि ा पर उसका िीषाक और हते ुक या मामले का सख्ं यांक जचजन्हत दकया िाएगा और उस पर उस प्राजधकारी के, जिसके समि इसे तैयार दकया गया ह,ै संजिप् त हस्ट्त ािर होंगे और उसके द्वारा तारीख डाली िाएगी।

(7) यर्ाजस्ट्र्जत, आयेाग या महाजनिेिक के समि तब तक ऐसा कोई िपर्पत्र फाइल नहीं दकया िाएगा जिसम ें कोई अंतरापंजियां, पररितान हों या कुछ जमटाया गया हो, िब तक दक ऐसी अंतरापंजियों या पररितना ों पर संजिप् त हस्ट्त ािर न दकए गयए हों या जमटाए िाने की ििा में िब तक जमटाए गए स्ट् र्ान पर जलए गए िब्ि ों या अंकों को मार्िान के स्ट्र् ान पर पनु : न जलखा गया हो और ऐसे प्राजधकारी द्वारा, जिसके समि इसे तैयार दकया गया ह,ै संजिप् त हस्ट्त ािर न दकए गए हों।

(8) यर्ाजस्ट्र्जत, आयेाग या महाजनिेिक िहां ऐस े िपर्पत्र को प्राप् त करने स े इन् कार कर सकेगा िहां उसकी राय में अंतरापंजियां, पररितना या जमटाई गई अतं िास्ट् तु इतनी अजधक ह ें दक िपर्पत्र को पनु : जलखना समीचीन हो।

(9) िहां िपर्पत्र फाइल करन े के जलए कोई जिजनर्िाष् ट समय दिया गया ह ै िहां ऐसे समय के पश् चात ् कोई िपर्पत्र फाइल नहीं दकया िाएगा, जसिाय, यर्ाजस्ट्र्जत, आयोग या महाजनिेिक की अनुमजत से।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 27

(10) इन जिजनयमों म,ें दकसी ‘’िपर्पत्र’’ में ऐसा कोई िस्ट् तािेि सजम्मजलत ह ैजिस पर िपर् लेना, प्रजतज्ञान करना, या जिसे सत् याजपत करना अपेजित ह।ै याजचकाओं और अन् य कायािाजहयों के सत् यापन म,ें व्य जिगत िानकारी पर आधाररत कर्नों को िानकारी और जिश् िास पर आधाररत कर्नों से सुजभन् न दकया िाएगा।

(11) आयेाग या महाजनिेिक, कायािाजहयों के अनुक्रम के िौरान, िहां कहीं न् याय के जहत म ेंआिश्य क और समीचीन समझा िाए, इस जिजनयम के दकसी या सभी उपरोक्त उपबंधों को जिजर्ल कर सकेगा।

43. आयोग के समि अजतररक्त साक्ष्य प्रस्ट्त तु करना.

(1) कायािाजहयों के पिकारों को आयोग के समि ऐसा कोई अजतररक्त साक्ष्य , चाह े िह मौजखक हो या िस्ट् तािेिी, प्रस्ट् तुत करने का हक नहीं होगा, िो उनके कब् िे या िानकारी में र्ा ककंतु अजधजनयम की धारा 26 या धारा 29 की उपधारा (1क) के अधीन अन् िेषण के िौरान महाजनिेिक के समि प्रस्ट् तुत नहीं दकया गया र्ा, ककंत ु यदि आयोग दकसी िस्ट् तािेि को प्रस्ट्त ुत करन े या दकसी सािी की परीिा करने या दकसी िपर्पत्र को फाइल करन े की अपेिा करता ह ै तादक िह आिेि पाररत करन े में समर् ा हो सके या दफर दकसी सारिान कारण से या यदि महाजनिेिक ने पिकार को साक्ष्य प्रस्ट् तुत करने के जलए पयााप् त अिसर प्रिान नहीं दकया ह ैतो आयोग, लेखबद्ध दकए िाने िाल े कारणों स े ऐसे िस्ट् तािेि को प्रस्ट् ततु करन े या सािी की परीिा करन े या िपर्पत्र फाइल करन े की अनुज्ञा िे सकेगा या ऐसे साक्ष्य को प्रस्ट्त ुत करन े की अनुमजत िे सकेगा।

(2) ऐसे दकसी िस्ट् तािेि को या ऐसे दकसी सािी की या ऐसे दकसी साक्ष्य को आयोग के समि या आयोग द्वारा जनदिष् ट दकसी ऐसे प्राजधकारी के समि, क्रमि: प्रस्ट् ततु दकया िा सकेगा, परीिा की िा सकेगी या प्रस्ट्त ुत दकया िा सकेगा।

(3) यदि यह जनिेि दिया िाता ह ै दक दकसी प्राजधकारी के समि िस्ट् तािेि प्रस्ट् ततु दकया िाए या सािी की परीिा की िाए या साक्ष्य प्रस्ट् तुत दकया िाए तो िह आयोग के जनिेि का अनुपालन करेगा और अनपु ालन के पश् चात ् िस्ट् तािेि, सािी के बयान का अजभलेख या प्रस्ट् ततु दकए गए साक्ष्य के अजभलेख को आयोग को भेिेगा।

(4) अजतररक्त साक्ष्य /िस्ट् तािेि को आयोग द्वारा साक्ष्य प्रस्ट् तुत करने िाल े पिकार से जभन् न कायिा ाजहयों के अन् य पिकारों को उपलब्ध कराया िाएगा और उन् ह ें उक्त अजतररक्त साक्ष्य की अतं िास्ट् त ु को जमथ्य ा साजबत करन े के जलए अिसर प्रिान दकया िाएगा।

44. आयोग की सचू ना आदि मागं न ेकी िजि.

(1) आयेाग, दकसी कायािाही में आिेि पाररत करन े से पूिा दकसी भी समय, दकसी भी पिकार या दकसी ऐसे अन् य व् यजि से जिसे आयोग उपयुक्त समझता ह,ै ऐसे िस्ट् तािेि या अन् य सारिान िस्ट् तुए,ं साक्ष्य के रूप में प्रस्ट्त ुत करने की अपिे ा कर सकेगा, जिन् ह ें आयोग उस े आििे पाररत करन े म ें समर् ा बनाने के प्रयोिन के जलए आिश् यक समझता ह।ै

(2) यर्ाजस्ट्र्जत, आयेाग या महाजनिेिक, साजियों को समन करन,े साक्ष्य प्रस्ट् तुत करन े योग् य दकसी िस्ट् तािेि या अन् य सारिान िस्ट् तओंु को ढूंढन े और प्रस्ट् तुत करने का जनििे ि े सकेगा, दकसी कायाालय से लोक अजभलेख की अध् यपेिा कर सकेगा, आयोग के दकसी अजधकारी द्वारा दकसी व् यजि की अजभरिा या जनयत्रं ण म ें जिद्यमान ऐसी दकन् हीं बजहयों, लेखाओं या अन् य िस्ट् तािेिों या सूचना, जिसे आयोग इस प्रयोिन के जलए सुसंगत समझता ह,ै की परीिा करने का जनिेि िे सकेगा।

(3) यर्ाजस्ट्र्जत, आयेाग या महाजनिेिक, दकसी भी समय दकसी व्य जि को समन कर सकेगा और उसकी उपजस्ट्र्जत को बलपूिाक संभि बना सकेगा और उसकी परीिा ले सकेगा या उसकी िपर् पर परीिा करा सकेगा।28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

45. साजियों या िस्ट्त ाििे ों की परीिा के जलए आयोग या महाजनिेिक की कमीिन िारी करन ेकी िजि.

(1) अजधजनयम की धारा 36 की उपधारा (2) के खडं (घ) और धारा 41 की उपधारा (2) के उपबंधों के अधीन रहत े हुए, आयोग या महाजनििे क, यर्ाजस्ट्र्जत, स्ट् िप्ररे णा स े या आयोग या महाजनििे क के समि कायािाजहयों के दकसी पिकार द्वारा आिेिन दकए िान े पर ऐस े जिजनर्िाष् ट सािी (साजियों) की प्रश्न ोत् तरों या अन् यर्ा पर परीिा करने के जलए कमीिन िारी कर सकेगा, – (क) िो भारत म ेंजनिास कर रहा ह;ै (ख) िो उस तारीख, जिसको उससे एक सािी के रूप म ें परीिा िने ा अपेजित है, स े पूि ा भारत छोड़न े िाला ह;ै (ग) िो केन् द्रीय सरकार या दकसी राज्य सरकार या दकसी कानूनी प्राजधकरण की सेिा में होने के कारण, यर्ाजस्ट्र्जत, आयोग या महाजनिेिक की राय में लोक सेिा को बाजधत दकए जबना कायािाही में उपसंिात नहीं हो सकता;

(घ) िो बीमारी या जन:िक्त ता के कारण उपसंिात होन े में असमर्ा ह;ै (ङ) िो ऐसे स्ट् र्ान पर जनिास करता ह ै िो, यर्ाजस्ट्र्जत, आयोग या महाजनिेिक के कायाालय से पांच सौ दकलोमीटर से अजधक िरू जस्ट्र्त ह ै और, यर्ाजस्ट्र्जत, आयोग या महाजनिेिक की राय में जिसकी उपजस्ट्र्जत को जिजहत समय के भीतर अनािश् यक व् यय उपगत दकए जबना सुजनजित नहीं दकया िा सकता;

(च) िो खंड (क) से खडं (ड.) में उजल्लजखत दकसी भी पररजस्ट्र्जत के अतं गता नहीं आता है, यदि उसके साक्ष्य को न् याय के जहत में आिश् यक समझा िाता ह।ै

(2) उपजिजनयम (1) के उपबंधों के अधीन रहत े हुए, यर्ाजस्ट्र्जत, आयोग या महाजनिेिक, या तो स्ट् िप्रेरणा स े या आयोग या महाजनिेिक के समि कायािाजहयों के दकसी पिकार द्वारा आिेिन दकए िान े पर, भारत के भीतर दकसी स्ट् र्ान पर जनिास न करने िाल े सािी की प्रश् नोत् तरों पर या अन् यर्ा परीिा करन े के जलए भी कमीिन िारी कर सकेगा, यदि उसका यह समाधान हो िाता ह ै दक ऐसे सािी का साक्ष्य करना आिश् यक ह ै और िह इस जिजनयम के अधीन कमीिन के जनष्प ािन को सुकर बनाने के जलए भारतीय उच् चायोग या भारतीय ितू ािास को अनुरोध पत्र िारी कर सकेगा।

(3) उपजिजनयम (1) और उपजिजनयम (2) के उपबंधों के अधीन रहते हुए, यर्ाजस्ट्र्जत, आयोग या महाजनिेिक, या तो स्ट् िप्रेरणा से या आयोग या महाजनिेिक के समि कायािाजहयों के दकसी पिकार द्वारा आिेिन दकए िान े पर, दकसी जिजनर्िाष् ट िस्ट् तािेि, िस्ट् तािेिों की, चाह े ि े भारत में या भारत से बाहर जस्ट्र्त दकसी स्ट् र्ान पर उपलब् ध हों, और चाह े िह ऊपर उपजिजनयम (1) और उपजिजनयम (2) के अनुसार प्रश् नोत्त रों पर परीजित दकए िाने िाले दकसी सािी की अजभरिा में हों या नहीं, परीिा के जलए भी कमीिन िारी कर सकेगा।

(4) उपजिजनयम (1) या (2) या (3) के अधीन, दकसी सािी की दकन् हीं प्रश् नोत् तरों या अन् यर्ा परीिा करन े या दकन् हीं िस्ट् तािेिों की परीिा के जलए िारी कमीिन म ें भारतीय न् याय संजहता, 2023 (2023 का 45) की धारा 2 की उपधारा (28) के अर्ाान् तागत दकसी लोक सेिक या दकसी परामिी को सजम्मजलत दकया िा सकेगा और यर्ाजस्ट्र्जत, ऐस े दकसी लोक सेिक या परामिी को इस अयोग के जनष्प ािन के प्रयोिनों के जलए ही ‘‘कमीिनर’’ के रूप म ेंजनयुक्त दकया िाएगा।

(5) उपजिजनयम (4) म ें जनर्िाष् ट प्रत्य के लोक सेिक या परामिी, उपजिजनयम (4) के अधीन जनयुक्त कमीिन प्राप् त होने पर, यर्ाजस्ट्र्जत, सािी या िस्ट् तािेि की परीिा करेगा या उनके अनुसार सािी या िस्ट् तािेि की परीिा[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 29 कराएगा और सम् यक जनष्प ािन हो िान े पर, उसके अधीन दिए गए साक्ष्य के सार् कमीिन को यर्ाजस्ट्र्जत, आयोग या महाजनिेिक को िापस करेगा।

(6) यर्ाजस्ट्र्जत, अयोग या महाजनिेिक, उपजिजनयम (4) के अधीन जनयुक्त कमीिनर को कायािाजहयों के अजभलेख का ऐसा भाग और ऐसे अनुिेि िेगा, िो आिश् यक प्रतीत हों और अनुिेिों में स्ट् पष्ट रूप से यह जिजनर्िाष् ट दकया िाएगा दक कमीिन जनििे दिए गए अनुसार परीिा के माध् यम से तथ्य ों का पता लगान े तक जनबंजधत ह ै और कमीिनर से मात्र यह अपेिा की िाती ह ै दक िह परीिा के परू ा हो िान े पर आयोग को कायािाजहयों के अजभलेख संप्रेजषत करे।

(7) इन जिजनयमों के अधीन जनयुक्त कोई कमीिनर िब तक दक जनयुजि आिेि म ेंअन् यर्ा जनदद्रष् ट न दकया हो –

(a) सािी की स्ट् ियं परीिा करेगा;

(b) िस्ट् तािेिों और िांच के जिषय से सुसंगत अन् य िस्ट् तओंु की मागं करेगा और परीिा करेगा।

(8) इस जिजनयम के अधीन कमीिन िारी करन े िाला, यर्ाजस्ट्र्जत, आयोग या महाजनििे क ऐसी तारीख जनयत करेगा, जिसको या जिससे पूि ा जनष्प ािन के पश् चात् कमीिन लौटाया िाएगा और इस प्रकार जनयत की गई तारीख को जिस्ट् ताररत नहीं दकया िाएगा, जसिाय यदि लखे बद्ध दकए िाने िाले कारणों से, यर्ाजस्ट्र्जत, आयोग या महाजनिेिक का यह समाधान हो िाता ह ै दक तारीख को जिस्ट् ताररत करने के जलए पयााप् त कारण जिद्यमान ह।ैं

46. दकसी प्रजतजनजध को उपसिं ात होन ेके जलए प्राजधकृत करना.

(1) अजधजनयम की धारा 35 के उपबंधों के अधीन रहत े हुए, दकसी ऐसी कायािाही में, िहां अजभिाकों को दकसी प्राजधकृत प्रजतजनजध द्वारा भी हस्ट् तािररत दकया गया ह,ै िहां पिकार प्रजतजनजध को उसके जलए उपसंिात होन े के जलए प्राजधकृत करते हुए जिजनर्िाष् ट रीजत म ेंपत्र या िकालतनामा संलग् न करेगा।

(2) प्राजधकृत प्रजतजनजध को तब तक पिकार का प्रजतजनजधत्ि करन े की अनुज्ञा नहीं िी िाएगी िब तक दक ऐसा प्राजधकार पत्र या िकालतनामा सामान् य बैठक के प्रारंभ होने स ेपूिा सजचि को फाइल नहीं कर दिया िाता है: परंत ु यह दक प्रत् येक पिकार के जनजमत् त, दकसी भी समय, केिल एक ही प्राजधकार पत्र या िकालतनामा जिजधमान् य माना िाएगा जिस पर उसके सभी कानूनी प्रजतजनजध (प्रजतजनजधयों) द्वारा सामूजहक रूप स े हस्ट्तािर दकए िाएंग े और दकसी पिकार द्वारा नया प्राजधकार पत्र या िकालतनामा फाइल करन े पर पहल े िाले प्राजधकार पत्र या िकालतनामा को जनरस्ट्त माना िाएगा।

(3) आयोग के समि कायािाजहयों के िारी रहने के िौरान दकसी पिकार के जलए और उसके जनजमत् त उपसंिात होने िाले दकसी प्राजधकृत प्रजतजनजध द्वारा दकसी िव्ु यािहार की अनुमजत नहीं िी िाएगी और आयोग उपयुक् त पररजस्ट्र्जतयों में, लेखबद्ध दकए िान े िाल े कारणों से िव्ु य ािहार के िोषी व् यजि को आयोग और/ या महाजनिेिक के समि कायािाजहयों में भजिष्य म ें या ऐसे समय तक, जिस े आयोग आिश् यक समझे, उपसंिात होने से जििर्िात करन े िाले आिश् यक आििे पाररत कर सकेगा।

(4) दकसी परामिी द्वारा िव्ु यािहार दकए िाने की ििा में, सजचि, यदि उसे आयोग द्वारा ऐसा जनिेि दिया िाए, इस प्रभाि की एक जलजखत जिकायत उस राज्य जिजधज्ञ पररषि ् को अग्रेजषत करेगा, जिसका जिजध व् यिसायी सिस्ट् य ह ै या ऐसी जलजखत जिकायत यर्ाजस्ट्र्जत, भारतीय सनिी लेखाकार संस्ट्र् ान या भारतीय कंपनी सजचि संस्ट् र्ान या भारतीय लागत और संकमा लेखा संस्ट् र्ान को अग्रेजषत की िा सकेगी। स्ट् पष्ट ीकरण – इस जिजनयम के प्रयोिन के जलए, ‘’िव्ु यिा हार’’ पि में दकसी कायािाही की सम् यक प्रदक्रया पर प्रजतकूल प्रभाि डालना या उसमें बाधा डालना या बाधा डालने का प्रयास करना या आयोग के दकसी आिेि या जनििे के अनपु ालन या जनष्प ािन को बाजधत करना या बाजधत करन े का प्रयास करना या दकसी भी30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] रीजत म ें अपमानिनक भाषा का उपयोग करना या अिज्ञापूिका व् यिहार करना या आयोग के दकसी सिस्ट् य या अजधकारी की प्रजतष्ठ ा पर दकसी भी रीजत म,ें िो भी हो, प्रहार करना सजम्मजलत होंगे।

47. महाजनिेिक द्वारा समन दकए गए दकसी व्य जि के सार् दकसी अजधिक्त ा के रहन ेको प्राजधकृत करना. कोई अजधििा, जनम्नजलजखत ितों के अधीन, महाजनिेिक द्वारा समन दकए गए दकसी व्यजि के सार् उसके समि उपसंिात हो सकेगा, अर्ाात् - (क) अजधििा को ऐस े व्यजि के सार् होने की अनुज्ञा नहीं होगी, िब तक दक कायािाही आरंभ होने स े पूि ा महाजनिेिक को प्राजधकार पत्र या िकालतनामा संलग्न करत े हुए, सम् यक रूप से जलजखत अनुरोध प्रस्ट्ततु न कर दिया िाए। (ख) अजधििा ऐसे समन दकए गए व्यजि के सामने नहीं बैठेगा। (ग) अजधििा श्िणगोचर िरू ी पर नहीं रहगे ा और िपर् पर उसकी परीिा के िौरान व्यजि के सार् संपका नहीं बनाएगा, परामिा नहीं करेगा, िाताालाप नहीं करेगा या दकसी भी रीजत म ेंसंिाि नहीं करेगा।

48. आयोग के समि कायिा ाजहयों तक िनता की पहुचं न होना. जसिाय िहां के, िहा ं आयोग लेखबद्ध दकए िाने िाले कारणों से ऐसा जनिेि करे, दकसी सामान् य बैठक के िौरान आयोग के समि कायािाजहयों तक िनता की पहुचं नहीं होगी। कायिााजहयों तक िनता की पहुचं बनाने संबंधी जिजनश् चय करत ेसमय, आयोग जनम्न जलजखत सभी या दकसी जिषय को ध् यान में रखेगा, अर्ाात: – (क) क्य ा लोग प्रकटन के कारण दकसी पिकार को कोई सारिान िजत तो नहीं पहुचं ती है;

(ख) िनता को िानकारी उपलब्ध कराने में जनषेध या प्रोत् साहन की जडग्री; (ग) कायािाजहयों का िि और उजचत संचालन; (घ) आयोग के संसाधन;

49. अजधजनयम के अधीन िाजस्ट्त के अजधरोपण के जलए प्रदक्रया.

(1) आयोग के अजधजनयम के अधीन जिरजचत दकसी जनयम या जिजनयम में अंतर्िाष्ट दकसी प्रजतकूल बात के होत े हुए भी, अजधजनयम के अध् याय VI के अधीन कोई िाजस्ट्त अजधरोजपत करन े िाला आिेि या जनिेि तब तक नहीं दकया िाएगा, िब तक दक आयोग की सामान् य बैठक के िौरान दकसी व् यजि या उद्यम या कायािाही के पिकार को कारण बताओ सचू ना न िी गई हो और आयोग के समि उसे उसका मामला प्रस्ट् तुत करने का युजियुक् त अिसर प्रिान न दकया गया हो।

(2) उस ििा म,ें िहां अजधजनयम की धारा 48 के जनबंधनों के अनुसार जिन व्यजियों के जिरुद्ध कायािाही की गई ह,ै ऐसे व्यजियों को इन जिजनयमों के जिजनयम 22 के उपजिजनयम (8) के अधीन, यर्ाजस्ट्र्जत, अन् िेषण ररपोट ा और/या पूरक अन् िेषण ररपोटा अग्रेजषत करना या कारण बताओ सूचना िारी करना, उपयुाक्त उपजिजनयम (1) के जनबंधनों के अनुसार कारण बताओ सूचना माना िाएगा।

(3) उस ििा म,ें िहा ं आयोग उपजिजनयम (1) के अधीन, यर्ाजस्ट्र्जत, दकसी व् यजि या उद्यम या कायािाजहयों के दकसी पिकार को कारण बताओ सूचना िारी करन े का जिजनश् चय करता ह,ै िहां सजचि उसे कम से कम 15 (पंद्रह) दििसों का समय िेत े हुए एक कारण बताओ सूचना िारी करेगा जिसमें उससे, सूचना में जिजहत कालािजध के भीतर जलजखत म ेंस्ट् पष्ट ीकरण प्रस्ट् ततु करने के जलए कहा िाएगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 31

(4) आयोग, स्ट् पष्ट ीकरण की प्राजप् त पर और मौजखक सुनिाई, यदि मंिूर की िाती ह,ै के पश् चात् मामल े के तथ्य ों और पररजस्ट्र्जतयों के आधार पर िाजस्ट्त अजधरोजपत करने के मामले का जिजनश् चय करने के जलए कायािाही करेगा।

50. अजधजनयम की धारा 19 की उपधारा (1) के खडं (क) के अधीन फीस.

(1) दकसी व् यजि से अजधजनयम की धारा 19 की उपधारा (1) के खंड (क) के अधीन प्राप् त प्रत् यके सूचना के सार् संित् त फीस का सबूत इस प्रकार संलग् न होगा, - (क) व् यजि या जहन्ि ूअजिभक्त पररिार (एचयूएफ) के मामले म ें6,000 (छह हिार) रुपए, या (ख) गैर सरकारी संगठन (एनिीओ) या उपभोिा सगं म, या सहकारी सोसाइटी या न् यास के मामले म ें 12,000 (बारह हिार) रुपए, या (ग) ऐसी फमा (जिसके अंतगात प्रोराइटरजिप, पाटानरजिप या जलजमटेड लाइजबजलटी पाटानरजिप फमा भी ह)ैं या कंपनी (जिसके अतं गता एकल व्यजि कंपनी भी ह)ै , पूिािती िषा म ें जिनका आित ा िो करोड़ रुपय े तक का रहा हो, के मामल े में 50,000 (पचास हिार) रुपए, (घ) ऐसी फमा (जिसके अंतगात प्रोराइटरजिप, पाटानरजिप या जलजमटेड लायजबजलटी पाटानरजिप फमा भी ह)ैं या कंपनी (जिसके अतं गता एकल व्यजि कंपनी भी ह)ै , पूिािती िषा में जिनका आिता िो करोड़ रुपय े स े पचास करोड़ रुपये तक का रहा हो, के मामल े में 1,25,000 (एक लाख पच् चीस हिार) रुपए, (ङ) अन् य सभी मामलों िो खंड (क) या (ख) या (ग) या (घ) में आिृत् त नहीं ह,ैं में 6,00,000 (छह लाख) रुपए।

(2) जिजनयम 16 के उपजिजनयम (6) के अधीन प्राप् त प्रत् यके अंतिती आिेिन के सार् संित् त फीस का सबूत इस प्रकार संलग्न होगा, -

(a) व् यजि या जहन्ि ूअजिभक्त पररिार (एचयूएफ) के मामले म ें500 (पााँच सौ) रुपए, या

(b) गैर सरकारी संगठन (एनिीओ) या उपभोिा संगम, या सहकारी सोसाइटी या न् यास के मामले म ें1,000 (एक हिार) रुपए, या

(c) ऐसी फमा (जिसके अंतगात प्रोराइटरजिप, पाटानरजिप या जलजमटेड लायजबजलटी पाटानरजिप फमा भी ह)ैं या कंपनी (जिसके अतं गता एकल व्यजि कंपनी भी ह)ै , पूिािती िषा म ें जिनका आित ा िो करोड़ रुपय े तक का रहा हो, के मामल े में 1,000 (एक हिार) रुपए,

(d) अन् य सभी मामलों में 5,000 (पांच हिार) रुपए।

(3) जिजनयम 16 के उपजिजनयम (6) के अधीन प्राप् त प्रत् यके प्रकीणा आिेिन के सार् संित् त फीस का सबूत इस प्रकार संलग्न होगा, - (क) व् यजि या जहन्ि ूअजिभक्त पररिार (एचयूएफ) के मामले म ें3,000 (तीन हिार) रुपए, या (ख) गैर सरकारी संगठन (एनिीओ) या उपभोिा संगम, या सहकारी सोसाइटी या न् यास के मामले म ें6,000 (छह हिार) रुपए, या32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ग) ऐसी फमा (जिसके अंतगात प्रोराइटरजिप, पाटानरजिप या जलजमटेड लायजबजलटी पाटानरजिप फमा भी ह)ैं या कंपनी (जिसके अतं गता एकल व्यजि कंपनी भी ह)ै , पूिािती िषा म ें जिनका आित ा िो करोड़ रुपय े तक का रहा हो, के मामल े में 25,000 (पच् चीस हिार) रुपए, (घ) ऐसी फमा (जिसके अंतगात प्रोराइटरजिप, पाटानरजिप या जलजमटेड लायजबजलटी पाटानरजिप फमा भी ह)ैं या कंपनी (जिसके अतं गता एकल व्यजि कंपनी भी ह)ै , पूिािती िषा में जिनका आिता िो करोड़ रुपय े स े पचास करोड़ रुपये तक का रहा हो, के मामल े में 60,000 (साठ हिार) रुपए, (ङ) अन् य सभी मामलों िो खंड (क) या (ख) या (ग) या (घ) म ें आिृत् त नहीं ह,ैं म ें 3,00,000 (तीन लाख) रुपए।

(4) इस फीस को केन् द्रीय प्रत् यि कर बोडा, रािस्ट् ि जिभाग, जित मंत्रालय द्वारा िार्षाक लागत महं गाई सूचकांक के आधार पर आयोग द्वारा बढाया या कम दकया िा सकेगा।

(5) इस फीस का संिाय, भारतीय प्रजतस्ट् पधाा आयोग (प्रजतस्ट् पधा ा जनजध), नई दिल्ल ी के पि में संिये मांगिेय ड्राफ्ट, िेय आिेि या बैंकसा चेक द्वारा या भारतीय प्रजतस्ट् पधाा आयोग (प्रजतस्ट् पधाा जनजध), ‘पंिाब नेिनल बैंक, भीकािी कामा प् लेस, नई दिल् ली-110066’’ के खाता संख्य ाक 1988002100187687 म ें इलैक्र ाजनक समािोधन सेिा (ईसीएस) द्वारा सीधे िमा कराके दकया िा सकेगा।

51. जनरीिण और प्रजतजलजप फीस.

(1) कायािाजहयों के दकसी पिकार को, आििेन दकए िाने पर और सजचि द्वारा जिजनर्िाष् ट की िाने िाली ितों पर और िो हिार पांच सौ रुपये प्रजत दििस प्रजत मामले की फीस का संिाय करने पर, उसके मामलों से संबंजधत अजभलेखों का जनरीिण करन े की अनुज्ञा िी िा सकेगी।

(2) प्रमाजणत प्रजतयों की प्रिायगी के जलए फीस बीस रुपये प्रजत पष्ठृ होगी।

52. आयोग द्वारा जििषे परामिी को पनै लबद्ध करना.

(1) आयोग, अजधजनयम की धारा 53क में जनर्िाष् ट राष्र ीय कंपनी जिजध अपील अजधकरण या दकसी अन् य अद्ध-ा न् याजयक जनकाय या न् यायालय के समि कायािाजहयों के संचालन म ें उसकी सहायता करने के जलए जिजध व् यिसाजययों या सनिी लेखाकारों या कंपनी सजचिों या लागत लेखाकारों का एक पैनल तैयार कर सकेगा।

(2) महाजनिेिक, यदि ऐसा अपेजित हो तो, पैनल से जिजध व् यिसाजययों या सनिी लेखाकारों या कंपनी सजचिों या लागत लेखाकारों को आयोग के समि कायािाजहयों में सहायता के जलए बुला सकेगा।

(3) दकसी परामिी को संिेय अनज्ञु ात पाररश्जमक और अनुज्ञेय अन् य भत् त े और प्रजतकर, आयोग के परामि ा स े जिजनर्िाष् ट दकए िाएंगे।

53. आयोग की सहायता के जलए जिख्य ात जििषे ज्ञों को आमजं त्रत करना. अजधजनयम की धारा 36 की उपधारा (3) या तद्धीन िारी दििाजनिेिों पर कोई पजतकूल प्रभाि डाले जबना, आयोग जिख् यात जििेषज्ञों को, ऐसे जनबंधनों और ितों पर तर्ा ऐसे समयों पर, िो आयोग जिजनजित करे, अजधजनयम के अधीन आयोग के कृत् यों के जनिाहन में सहायता करने के जलए आमंजत्रत कर सकेगा:

परंतु यह दक आयोग के पास, आयोग की सहायता के जलए आमंजत्रत व् यजियों की जििेषज्ञता या प्रजसद्धी के मूल् यांकन के संबंध में पणू ा जििके ाजधकार होगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 33

54. आयोग द्वारा पाररत आिेिों का कायान्ा ि यन और अनश्ु िण करना.

(1) िहां आयोग की यह राय ह ै दक अजधजनयम की धारा 31 या धारा 48क या धारा 48ख या को अन् य उपबंधों और तद्धीन बनाए गए जिजनयमों के अधीन पाररत उसके आिेिों के कायाान्ियन के अनश्ु िण करन े की आिश्यकता ह,ै िहां िह ऐस े कायाान्ियन के पयािेिण के जलए ऐसे जनबंधनों और ितों पर, िो आयोग उजचत समझे, अजभकरणों की जनयुजि कर सकेगा।

(2) उपजिजनयम (1) के अधीन जनयुि अजभकरण, मामले की कायािाही में सजम्मजलत पिकारों से स्ट्ितंत्र होंगी तर्ा यह संपुजि करेंगी दक उनका उि पिकारों के सार् जहतों का कोई टकराि नहीं ह।ै

(3) इस जिजनयमन में जनर्ििा ऐस े अजभकरणों म ें लेखांकन फमा, प्रबंधन परामिी, कोई अन्य व् यािसाजयक संगठन या सनिी लेखाकार/कंपनी सजचि/लागत लेखाकार सजम्मजलत हो सकेंगे।

(4) उपजिजनयम (1) के अधीन जनयुि अजभकरण, अन् य बातों के सार्-सार्, जिसके अंतगता जनम् नजलजखत भी ह,ै आयोग द्वारा समय-समय पर यर्ाजिजनर्िाि उत् तरिाजयत् ि काररत करेंग:े (क) अपन ेजनयोिन के जनबंधनों के अनुसार आयोग के आिेिों के कायाान् ियन का अनश्ु िण करना;

(ख) ऐसे आिेिों का कायाान् ियन न होने या अननुपालन की सूचना आयोग को िेना; (ग) दकसी प्रत्यि या अप्रत्यि धनीय या अधनीय जहत का पयाप्ता रूप से प्रकटन करना, जिससे उसके जनयोिन के जनबंधनों के अनुसार उसके कताव्यों का पालन करने पर प्रजतकूल प्रभाि पड़न े की संभािना हो;

(घ) आयोग के आिेिों के कायाान्ियन के अनुश्िण से संबंजधत ररपोटा, ऐसे आिजधक अंतराल पर प्रस्ट्तुत करना िो आयोग जनदिष् ट करे; (ङ) अपन े िाजयत्िों के जनिाहन के िौरान प्राप्त या एकजत्रत िानकारी के संबंध म ें गोपनीयता के उच्चतम मानकों को बनाए रखना; और (च) ऐसे अन्य कताव्यों का पालन करना िो उसके जनयोिन के अधीन अनुबद्ध ह ैंया आयोग द्वारा जनदिष् ट ह।ैं

(5) आयोग उपजिजनयम (1) के अधीन जनयुि अजभकरणों के जनयोिन को ऐसी रीजत से जनलंजबत या समाप्त कर सकेगा, िो उसके जनयोिन के जनबंधनों द्वारा अिधाररत हो: परंतु यह दक जनयोिन के जनबंधनों में दकसी बात के होते हुए भी, आयोग, यदि आिश्यक समझे, लेखबद्ध दकए िाने िाले कारणों से, जनयोिन को प्रजतसंह्रत कर सकेगा और ऐसे प्रजतसंहरण पर दकसी जिजध के न्यायालय में या अन्यर्ा म ेंप्रश्नगत नहीं दकया िाएगा।

(6) उपजिजनयम (1) के अधीन जनयुि अजभकरणों को संिाय उस व्यजि द्वारा दकया िाएगा, जिसन े भारतीय प्रजतस्ट्पधाा आयोग (पररजनधाारण) जिजनयम, 2024 के जिजनयम 3 या भारतीय प्रजतस्ट्पधा ा आयोग (प्रजतबद्धता) जिजनयम, 2024 के जिजनयम 3 के अधीन आिेिन फाइल दकया ह ै या जिसने भारतीय प्रजतस्ट्पधाा आयोग (संयोिन) जिजनयम, 2024 के जिजनयम 9 के अधीन या आयोग द्वारा यर्ाजनदिष् ट दकसी अन्य मामल े में, अजभकरणों द्वारा उत् तरिाजयत् िों के संतोषिनक जनिाहन के अध् ययीन, यर्ाजस्ट्र्जत, इसे आयोग के पास िमा कराके या आयोग द्वारा यर्ाजनदिष्ट , दकसी अन्य व्यजि द्वारा सचू ना फाइल की गई ह।ै34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

55. प्रकािन.

(1) यदि आयोग लोक जहत म ेंऐसी िांछा करता ह ैतो िह अपन ेआिेिों या जनणायों के संजिप् त सार या पूणा पाठ को मीजडया में प्रकाजित करा सकेगा, ककंत ु ऐसा करते समय, संबंजधत व् यजियों के कारबार रहस्ट्य ों का ध् यान रखा िाएगा और आिेि या जनणाय के ऐसे भागों को हटा िेने का जनिेि ि ेसकेगा, िो िह उजचत समझे।

(2) आयोग द्वारा, यर्ाजस्ट्र्जत, अजधजनयम की धारा 26 की उपधारा (2) या उपधारा (2क) या उपधारा (6) या उपधारा (9) के अधीन मामला समाप् त करने का जनििे िने े िाले या अजधजनयम की धारा 27 या धारा 28 या धारा 31 या धारा 33 या धारा 42 के अधीन दिए गए सभी आिेि या जनणाय आयोग की िेबसाइट पर प्रकाजित दकए िाएंगे।

(3) सजचि का यह कताव् य होगा दक िह इस जिजनयम में जनर्िाष् ट आिेिों या जनणायों का प्रकािन करे।

56. करठनाईयों को िरू करना. इन जिजनयमों के कायाान् ियन के जिषय में यदि कोई संिेह या करठनाई उिभूत होती ह ै तो उस पर आयोग का जिजनश् चय बाध् यकर होगा।

57. जनरसन और व्य ािजृ त्तया.ं

(1) भारतीय प्रजतस्ट्पधाा आयोग (साधारण) जिजनयम, 2009, उस तारीख से जनरस्ट्त हो िाएंगे जिस तारीख को ये जिजनयम प्रिृत् त होंगे।

(2) ऐसे जनरसन दकसी बात के होते हुए भी, – (क) ऐसे जनरसन से पूिा, जनरजसत दकए गए जिजनयमों के अधीन, दकया गया कुछ भी या की गई या दकया िाना या की गई तात् पर्यात कोई कारािाई, या कोई कायािाही या जनणाय, आरंभ की गई िांच या आरंभ दकया गया अन् िेषण, इन जिजनयमों के तत्स्ट् र्ानी उपबंधों के अधीन दकया िाना या दकया गया माना िाएगा;

(ख) जनरजसत जिजनयमों का प्रितान या तिधीन सम् यक रूप से दकया गया या भुक्त कुछ भी, तिधीन अर्िात, प्रोद्भूत या उपगत कोई अजधकार, जििेषाजधकार, बाध् यता या िाजयत्ि, या तिधीन घरटत कोई अन् िेषण, जिजधक कायािाही या उपचार अप्रभाजित रहगें े मानो जनरजसत जिजनयम कभी जनरजसत ही न दकए गए हों;

NOTIFICATION New Delhi, the 17th September, 2024 THE COMPETITION COMMISSION OF INDIA (GENERAL) REGULATIONS, 2024 (No. 08 of 2024) No. CCI/ Reg-G.R./08/ 2024-25. – In exercise of the powers conferred by section 64 of the Competition Act, 2002 (12 of 2003) the Competition Commission of India hereby makes the following regulations, namely: –

1. Short title and commencement.

(1) These regulations may be called the Competition Commission of India (General) Regulations, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.

(1) In these regulations, unless the context otherwise requires, –

(a) “Act” means the Competition Act, 2002 (12 of 2003);

(b) “Advocate” means an advocate as defined in the Advocates Act, 1961;

(c) “Chairperson” means the Chairperson appointed under sub-section (1) of section 8 of the Act;

(d) “Commission” means the Competition Commission of India established under sub-section (1) of

section 7 of the Act;

(e) “Counsel” means a legal practitioner or a chartered accountant or a company secretary or a cost accountant as defined in the explanation to section 35 of the Act;

(f) “Director General” means the Director General appointed under sub-section (1) of section 16 of the Act and includes any Additional, Joint, Deputy or Assistant Directors General appointed under that section;

(g) “Electronic Form” shall have the same meaning as assigned to it under section 2(1)(r) of the Information Technology Act, 2000;

(h) “Expert” means an expert engaged to assist the Commission under sub-section (3) of section 17 of the Act or an expert called upon by any party to provide opinion in connection with any matter related to a case under sub-section (2) of section 35 of the Act or an expert called upon to assist the Commission in any inquiry or proceeding under sub-section (3) of section 36 of the Act;

(i) “Interlocutory Application” means an application filed before the Commission during pendency of, a case instituted under section 19 of the Act or proceedings initiated pursuant to a Miscellaneous Application, except submissions made in compliance of any order or direction of the Commission;

(j) “Media” includes newspapers, magazines, periodicals, journals, radio, cinema, television and internet;

(k) “Miscellaneous Application” means an application filed before the Commission post passing of final

order in a case instituted under section 19 of the Act, except submissions made in compliance of any

order or direction of the Commission;

(l) “Ordinary Meeting” shall have the same meaning as assigned to it in the Competition Commission of India (Meetings for Transaction of Business) Regulations, 2009;

(m) “Reference” means a reference–

(i) received in the Commission from the Central Government or a State Government or a statutory authority under clause (b) of sub-section (1) of section 19 of the Act, or

(ii) received in the Commission from a statutory authority under section 21 of the Act for opinion, or

(iii) sent to a statutory authority for opinion by the Commission under section 21A of the Act, or

(iv) received in the Commission from the Central Government or a State Government for opinion under sub-section (1) of section 49 of the Act.

(n) “Secretary” means the Secretary appointed under sub-section (1) of section 17 of the Act and includes an officer of the Commission authorized by the Chairperson to function as Secretary;

(o) “Tribunal” means National Company Law Appellate Tribunal referred to under sub-section (1) of

(p) “Working Day” for the office of the Commission at New Delhi or any other office of the Commission means the day on which it functions but does not include Saturday or Sunday or any other day which is declared to be a public holiday by the Central Government under the Negotiable Instruments Act, 1881 (26 of 1881) for New Delhi or for such other place, as the case may be.

(2) Words and expressions used but not defined in these regulations shall have the same meanings respectively assigned to them in the Act or in the Companies Act, 2013 (18 of 2013), as the case may be.

3. Powers to determine procedure in certain circumstances.

In a situation not provided for in these regulations, the Commission may, for reasons to be recorded in writing, determine the procedure in a particular case.

4. Seal and emblem.

The official seal and emblem (with tagline) of the Commission shall be such as indicated by a drawing given in Annexure.

5. Language of the Commission.

The language of the Commission shall be English.

6. Filing of documents in Hindi.

Notwithstanding anything contained in these regulations, the parties may file documents drawn up in Hindi, if

they so desire:

Provided that no information, reference or other papers contained in any language other than English shall be accepted by the Commission unless the same is accompanied by a true translation thereof in English as stipulated in regulation 7.

7. Translation of documents.

A document translated in English shall be accepted by the Commission as true translation if:

(a) the counsel for the party certifies the translation to be a true translation; or

(b) the translation is done by an official translator of any Court; or

(c) the translation is done by an official translator of any authority/ body, central or state government,

which is also accepted by the Courts as true translation:

Provided that a translation, which is agreed to by all the parties to the proceedings, may also be accepted by the Commission, in appropriate cases, as a true translation.

8. Holidays to be observed by the Commission.

(1) The head office of the Commission shall observe, besides Saturday and Sunday, holidays as declared by the Central Government at Delhi under the Negotiable Instruments Act, 1881 (26 of 1881).

(2) Any other office of the Commission at places other than Delhi shall observe, besides Saturday and Sunday, holidays as declared by the Central Government under the Negotiable Instruments Act, 1881 (26 of 1881) for such place.

9. Computation of time.

(1) Where a period of time dates from a given day, act or event is prescribed by or allowed under these regulations for doing an act or taking a proceeding, the time shall be reckoned exclusive of the said day, or of the day of the act or event, from which the time runs.

(2) Where the time prescribed by or allowed under these regulations for doing an act or taking a proceeding expires on a Saturday or Sunday or on a day on which the office of the Commission is closed, the act may be done or the proceeding may be taken on the first working day following the Saturday, Sunday or the day on which that office is closed.

10. Contents of information or the reference.

(1) The information or reference filed under section 19 of the Act shall, inter alia, separately and categorically state the following in seriatum-

(a) legal name of the person or the enterprise giving the information or the reference;

(b) complete postal address in India for delivery of summons or notice by the Commission, with Postal Index Number (PIN) code;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 37

(c) contact details (telephone number, mobile number including country/ city/ area code, electronic mail address);

(d) legal name and address of the counsel or other authorized representative, if any; and

(e) legal name and address(es) of the enterprise(s) alleged to have contravened the provisions of the Act.

(2) The information or reference referred to in sub-regulation (1) shall contain –

(a) a statement of facts with chronology of events;

(b) details of the alleged contraventions of the Act together with a list enlisting all documents, affidavits and evidence, as the case may be, in support of each of the alleged contraventions;

(c) the date on which the cause of action had arisen;

(d) a succinct narrative in support of the alleged contraventions;

(e) whether same or substantially same facts and issues raised in the information or reference, as the case may be, have already been decided by the Commission in any of its previous order(s), along with details thereof;

(f) relief sought, if any;

(g) details of litigation or dispute pending, if any, between the informant and parties before any court, tribunal, statutory authority or arbitrator in respect of the subject matter of information; and

(h) such other particulars as may be required by the Commission.

(3) If the information or reference referred to in sub-regulation (1) is filed after three years from the date on which the cause of action had arisen, it shall be accompanied with an interlocutory application seeking condonation of delay demonstrating sufficient cause for the delay, together with applicable fee in terms of sub-regulation (2) of regulation 50 of these regulations.

(4) The contents of the information or the reference mentioned under sub-regulations (1) and (2), along with the appendices and attachments thereto, as well as application under sub-regulation (3), shall be complete and duly supported with an affidavit of the person submitting it duly verifying the contents of the same.

11. Signing of information or reference.

(1) An information or a reference or a reply to a notice or direction issued by the Commission shall be signed by–

(a) the individual himself or herself, including a sole proprietor of a proprietorship firm;

(b) the Karta in the case of a Hindu Undivided Family (HUF);

(c) the Managing Director, any other Director or any employee duly authorized by the board of directors in the case of a company;

(d) the President or the Secretary or any employee in the case of an association or society or similar body or the person so authorized by the legal instrument that created the association or the society or the body;

(e) a partner in the case of a partnership firm or any employee duly authorized by the partnership firm;

(f) the chief executive officer or any employee/ officer thereof duly authorised by the Board, in the case of a co-operative society or local authority;

(g) in the case of any other person, by that person or by some person duly authorized to act on his behalf.

(2) A reference shall be signed and authenticated by an officer not below the rank of a Joint Secretary to the Government of India or equivalent in the State Government or the Chief Executive Officer or any other officer duly authorised by the Board of the Statutory Authority if the same has been received from the Central Government or State Government or Statutory Authority.

(3) Without prejudice to the provisions of this regulation, the counsel may also append his or her signature to the information or reference as the case may be.

12. Procedure for filing of information or reference.

(1) Information or reference or responses thereto to the Commission shall be presented to the Secretary or to an officer authorized in this behalf by the Secretary, in person or sent by registered post or courier service or facsimile transmission addressed to the Secretary or to such authorized officer.38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) Any separate or additional document(s) that the information provider wishes to rely upon in support of its information or reference, as the case may be, shall be filed in the form of a “Paper Book”, within 14

(fourteen) days of filing the information or reference, as the case may be. Such documents shall be serially numbered, prefaced by an index and shall be duly supported with an affidavit of the person submitting it duly verifying the contents of the same.

(3) An information(s) or reference sent by post or courier service or facsimile transmission under sub- regulation (1) shall be deemed to have been presented to the Secretary or to the officer authorized by the Secretary, on the day on which it is received in the office of the Secretary or the authorized officer, as the case may be.

13. Procedure for filing of information or reference in electronic form.

Subject to the provisions of regulations 10 and 11, information or a reference to the Commission may be sent by a person or an enterprise to the Secretary in an electronic form duly authenticated with digital signature and/ or electronic signature by the subscriber as and when so desired by the Commission through a public notice.

Explanation – For the purpose of this regulation, –

(a) “digital signature” means the digital signature as defined under clause (p) of sub-section (1) of

section 2 of the Information Technology Act, 2000 (21 of 2000);

(b) “electronic form” with reference to an information or a document means the electronic form as defined under clause (r) of sub-section (1) of section 2 of the Information Technology Act, 2000 (21 of 2000);

(c) “electronic signature” means electronic signature as defined under clause (ta) of sub-section (1) of section 2 of the Information Technology Act, 2000 (21 of 2000);

(d) “subscriber” means the subscriber as defined under clause (zg) of sub-section (1) of section 2 of the Information Technology Act, 2000 (21 of 2000).

14. Filing of further submissions.

The following provisions of these regulations with respect to filing and signing shall be applicable upon all further submissions including replies, letters, documents, applications, objections or suggestions etc., filed by

any party:

(a) clauses (a), (b) and (c) of sub-regulation (1) of regulation 10;

(b) sub-regulation (4) of regulation 10;

(c) sub-regulation (1) of regulation 11;

(d) sub-regulation (3) of regulation 11;

(e) sub-regulation (1) of regulation 12;

(f) sub-regulation (3) of regulation 12; and

(g) regulation 13:

Provided that the provisions contained in clauses (b) and (c) above shall not be applicable upon applications seeking extension of time and/ or adjournment, filed by a party.

15. Powers and functions of the Secretary.

(1) The Secretary shall have the custody of records of the Commission and shall exercise such other functions as may be assigned by the Chairperson.

(2) Subject to the Competition Commission of India (Meetings for Transaction of Business) Regulations, 2009, the Secretary shall circulate to all concerned, the date, time and place of each meeting, as per the directions of the Chairperson.

(3) The Secretary shall be the nodal officer on behalf of the Commission for, –

(a) making or receiving all statutory communications:

Provided that the Chairperson may also authorize other Officers of the Commission for the purpose.

(b) entering into any formal relationships, including signing of any memorandum or arrangement, with competition authority or any agency of any foreign country, with the prior approval of the Commission and the Central Government, as per section 18 of the Act.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 39

(c) entering into any formal relationships, including signing of any memorandum or arrangement, with any statutory authority or department of the Government, with the prior approval of the Commission, as per section 18 of the Act.

(4) The Commission may sue or be sued in the name of the Secretary and the Commission shall be represented in the name of the Secretary in all legal proceedings, including appeals before the Tribunal.

(5) Subject to the provisions of section 51 of the Act, the Secretary shall assist the Committee of Members constituted under sub-section (3) of section 51 of the Act for, –

(a) preparation and approval of the annual budget of the Commission;

(b) administration of the competition fund.

(6) The Secretary shall keep in custody the official seal of the Commission. The official seal of the Commission shall not be affixed to any document including the certified copies of the orders of the Commission, save and under the authority in writing of the Secretary.

(7) Subject to sub-regulation (1), to ensure a timely and efficient disposal of the matters brought before the Commission and for achieving the objectives of the Act, the Secretary shall have the following powers and functions, –

(a) to receive, endorse and categorize all the information, references, applications or documents;

(b) to check the amount of fee received where applicable and to ensure the timely deposit of the same in the bank account of the Commission;

(c) to scrutinize all information, references, applications or documents so received to find out whether they are in conformity with the rules and regulations;

(d) to point out defects in such information(s), references, applications or documents to the parties requiring them to rectify such defects;

(e) to serve copy of the information, reference, application or document along with the enclosures to the concerned parties including the Director General, within a reasonable time;

(f) to serve the notice of the date of the ordinary meeting of the Commission to consider the information or reference or document to decide if there exists a prima facie case and to convey directions of the Commission for investigation or to issue notice of inquiry after receipt and consideration of the report of the Director General;

(g) to bring on record executors, administrators or other legal representatives, in case of death of any party or adjudication of a party as insolvent, upon an application by any party to the proceedings;

(h) to verify the service of notice or other processes and to ensure that the parties are properly served;

(i) to requisition records on the direction of the Commission from the custody of any authority;

(j) to allow inspection of records of the Commission;

(k) to return the documents filed by any party or authority on orders of the Commission;

(l) to certify and issue copies of the orders of the Commission to the parties;

(m) to grant certified copies of documents filed in the proceedings to the parties, in accordance with these regulations;

(n) to grant certified copies of the orders of the Commission for publication, in accordance with these regulations;

(o) to dispose of all matters relating to the service of notices or other related processes, applications for issue of fresh notice or for extending the time for or ordering a particular method of service on a party including a substituted service by publication of notice by way of advertisement in the newspaper or putting it on the website, as the case may be;

(p) to compile and preserve record of any proceeding during an ordinary meeting including: -

(i) the chronology of events;

(ii) the initiating document;

(iii) the notice of the meeting;

(v) opinion of expert, if any;

(vi) any interim order made;

(vii) all documentary evidence filed;

(viii) the transcript, if any, of the oral evidence given;

(ix) the final order or decision of the Commission;

(q) to disclose information subject to section 57 of the Act;

(r) to ensure confidentiality of documents or evidences or statements or any analysis as per these regulations, by keeping them in safe custody;

(s) to undertake maintenance of records including weeding out of records in accordance with retention schedule in force and in accordance with directions of the Chairperson issued from time to time;

(t) to file complaint before the Chief Metropolitan Magistrate, Delhi for non-compliance with the orders or directions of the Commission under sub-section (3) of section 42 of the Act, if so directed by the Commission.

16. Procedure for scrutiny of information or reference.

(1) Each information or reference received in the Commission shall be scrutinized by the Secretary to check whether it conforms to these regulations and the defects, if any, shall be communicated to the party within a reasonable time not exceeding, –

(a) 15 (fifteen) days in case of an information or reference received under clause (b) of sub-section (1) of

section 19 of the Act; or

(b) 7 (seven) days in case of a reference received under section 21 or sub-section (1) of section 49 of the Act.

(2) The information provider referred to in clause (a) of sub-section (1) of section 19 of the Act or the Central Government or the State Government or the statutory authority referred under clause (b) of sub-section

(1) of section 19 or in sub-section (1) of section 49 of the Act, as the case may be, shall, on receipt of the communication about the defects under sub-regulation (1), remove the defects within: -

(a) 30 (thirty) days of receiving the intimation in case of an information or reference under clause (b) of sub-section (1) of section 19 of the Act; or

(b) 15 (fifteen) days of receiving the intimation in case of a reference under section 21 or sub-section

(1) of section 49 of the Act.

(3) In case the defects are not removed by the Central Government or the State Government or the statutory authority or the concerned party, as the case may be, as per the provision of sub-regulation (2), the

information or the reference or the application connected therewith shall be treated as invalid:

Provided that the Central Government or the State Government or the Statutory Authority or the concerned party shall be entitled to file fresh information, reference or application for consideration by the Commission together with applicable fees.

(4) In the event of the information having been treated as invalid under sub-regulation (3), the fee paid on such information shall stand forfeited.

(5) Nothing contained herein above shall preclude the Commission from using the contents of such information or reference in any manner as may be deemed fit, for inquiring into any possible

contravention of any provision of the Act:

Provided that the time taken in removing the defects in such references shall not count towards the period of 60 (sixty) days provided for giving of opinion by the Commission in sub-section (2) of section 21 or sub-section (1) of section 49 of the Act, as the case may be.

(6) Every Interlocutory or Miscellaneous Application filed in a case shall be registered and numbered. All such applications shall be scrutinized within 7 (seven) days and defects, if any, shall be communicated to the party. The party making application shall remove the defects and submit the same within 7 (seven) days from the receipt of communication failing which the application shall be treated as invalid.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 41

17. Opinion on existence of prima facie case.

(1) The Secretary, after scrutiny and removal of defects, if any, in an information or reference, as the case may be, shall place the same before the Commission to form its opinion on existence of a prima facie case.

(2) In cases of alleged anti-competitive agreements and/ or abuse of dominant position, the Commission shall, as far as possible, record its opinion on existence of a prima facie case within 60 (sixty) days.

(3) The Commission shall, as far as possible, hold its first ordinary meeting to consider whether prima facie case exists, within 15 (fifteen) days of the date of placement of the matter by the Secretary under sub- regulation (1).

18. Preliminary conference.

(1) The Commission may, if it deems necessary, call for a preliminary conference to form an opinion whether a prima facie case exists.

(2) The Commission may invite the information provider and such other person as is necessary for the preliminary conference.

(3) A preliminary conference need not follow formal rules of procedure.

19. Issue of direction to cause investigation on prima facie case.

(1) Where the Commission is of the opinion that a prima facie case exists, the Secretary shall convey the directions of the Commission within 7 (seven) days to the Director General to investigate the matter.

(2) A direction of investigation to the Director General shall be deemed to be the commencement of an inquiry under section 26 of the Act.

(3) Where the Commission has formed an opinion that a prima facie case of contravention of the provisions of sub-section (4) of section 3 of the Act or section 4 of the Act exists, the Secretary shall also convey the directions of the Commission within 7 (seven) days to the parties concerned by serving upon them, a copy of the order passed by the Commission.

20. Communication of order passed under Section 26(2) or 26(2A) of the Act.

(1) If the Commission is of the opinion that there exists no prima facie case, the Secretary shall send a certified copy of the order of the Commission regarding closure of the matter forthwith to the Central Government or the State Government or the Statutory Authority or the parties concerned, as the case may be, as provided in sub-section (2) of section 26 of the Act.

(2) If the Commission is of the opinion that same or substantially the same facts and issues raised in an information or reference received in the Commission, as the case may be, have already been decided by the Commission in any of its previous order(s), the Secretary shall send a certified copy of the order of the Commission regarding closure of the matter under sub-section (2A) of section 26 of the Act forthwith to the Central Government or the State Government or the Statutory Authority or the parties concerned, as the case may be.

21. Investigation by Director General.

(1) The Secretary shall, while conveying the directions of the Commission under regulation 19, send a copy of the information or reference, as the case may be, with all other documents or materials or affidavits or statements which have been filed either along with the said information or reference or thereafter or at the time of preliminary conference, by any party, to the Director General.

(2) The Commission shall direct the Director General to submit a report within such time as may be specified by the Commission which ordinarily shall not exceed 90 (ninety) days from the date of receipt of the directions of the Commission.

(3) The Commission may, on an application made by the Director General, giving sufficient reasons extend the time for submission of the report by such period as it may consider reasonable.

(4) The report of the Director General shall contain his findings together with all the evidences or documents

or statements or analyses relied upon in the investigation report:

Provided that the Director General shall also, along with the report, forward to the Commission, all evidences or documents or statements or analyses collected during the investigation, which shall be called

Provided further that when considered necessary, the Director General may, for maintaining confidentiality, submit his report and case record in two parts. One of the parts shall contain the documents to which access to the parties may be accorded and another part shall contain confidential information and documents to which access may be partially or totally restricted.

(5) Five copies of the report of the Director General, along with an electronic copy in pdf format, shall be

forwarded to the Secretary within the time specified by the Commission:

Provided that the Secretary may ask for more copies of the report as and when required.

(6) If the Commission, on consideration of the report, is of the opinion that further investigation is called for, it may direct the Director General to make further investigation and submit a supplementary report on specific issues within such time as may be specified by the Commission but ordinarily not later than 60

(sixty) days.

22. Procedure for inquiry under section 26 of the Act.

(1) Upon receipt of the investigation report from the Director General in terms of sub-section (3) of section 26 of the Act, the Secretary shall place the same for consideration of the Commission within a period of 04

(four) weeks.

(2) The Commission, upon consideration of the investigation report of the Director General received under sub-regulation (1), may either:

(i) direct the Secretary to forward a physical or electronic copy of the non-confidential version of the report to the Central Government or the State Government or the Statutory Authority or the parties concerned, as the case may be, for filing objections or suggestions, if any, thereto, within a period of 08 (eight) weeks from the receipt of the report; or

(ii) order further investigation to be made by the Director General in the matter in terms of sub-section

(3A) of section 26 of the Act; or

(iii) cause further inquiry to be made or itself proceed with further inquiry in the matter, as the Commission deems fit.

(3) The Commission may, while directing to forward the investigation report of the Director General to the Central Government or the State Government or the Statutory Authority or the parties concerned, as the case may be, for filing objections or suggestions, if any, thereto, also direct the parties concerned to file their financial information including financial statements, in accordance with the Competition Commission of India (Determination of Turnover or Income) Regulations, 2024 and the Competition Commission of India (Determination of Monetary Penalty) Guidelines, 2024.

(4) Upon receipt of objections or suggestions under sub-regulation (2) from the Central Government or the State Government or the Statutory Authority or the parties concerned, as the case may be, the

Commission may either:

(i) pass a final order closing the matter under sub-section (6) of section 26 of the Act or pass an order under section 27 of the Act; or

(ii) order further investigation to be made by the Director General in the matter in terms of sub-section

(7) of section 26 of the Act; or

(iii) cause further inquiry to be made or itself proceed with further inquiry in the matter in terms of sub- sections (7) or (8) of section 26 of the Act.

(5) Upon receipt of the supplementary investigation report from the Director General, the Secretary shall place the same for consideration of the Commission within 04 (four) weeks.

(6) The Commission, upon consideration of the supplementary investigation report of the Director General received under sub-regulation (5), may either:

(i) direct the Secretary to forward a physical or electronic copy of the non-confidential version of the report to the Central Government or the State Government or the Statutory Authority or the parties concerned, as the case may be, for filing objections or suggestions, if any, thereto, within a period of 08 (eight) weeks from the receipt of the report; or

(ii) cause further inquiry to be made or itself proceed with further inquiry in the matter, as the Commission deems fit.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 43

(7) Upon receipt of objections or suggestions under sub-regulation (6) from the Central Government or the State Government or the Statutory Authority or the parties concerned, as the case may be, on the supplementary investigation report, the Commission may either:

(i) pass a final order closing the matter under sub-section (9) of section 26 of the Act or pass an order under section 27 of the Act; or

(ii) cause further inquiry to be made or itself proceed with further inquiry in the matter in terms of sub- sections (7) or (8) of section 26 of the Act.

(8) Upon completion of further inquiry in terms of sub-sections (7) or (8) of section 26 of the Act, the Commission may pass a final order closing the matter under sub-section (9) of section 26 of the Act or pass an order under section 27, before which it shall issue a show-cause notice to the parties concerned, in terms of the proviso to sub-section (9) of section 26 of the Act, indicating the contraventions alleged to have been committed and the time period for responding to the notice.

(9) Upon receipt of reply to the show-cause notice referred to in sub-regulation (8) from the parties concerned, and after giving them a reasonable opportunity to be heard, the Commission may pass a final

order closing the matter or pass an order under section 27 of the Act.

(10) The Secretary shall convey the final orders passed by the Commission to the Central Government or the State Government or the statutory authority or the parties concerned, as the case may be, by providing them a certified copy thereof.

(11) On a report given by an officer authorized by the Commission justifying the production of specified books or other documents, as may be required to make further inquiries under this regulation, the Commission may direct any person to produce such specified books or other documents relating to any trade carried out by such person or enterprise, as per the provisions of sub-section (4) of section 36 of the Act.

Explanation – For the purpose of this sub-regulation, the word “officer” shall include the experts and professionals mentioned under sub-section (3) of section 17 or sub-section (3) of section 36 of the Act.

(12) The Secretary shall keep the Director General informed of the dates of the meetings of the Commission for inquiry to appear in person or through any of his officers in accordance with the provisions of section 35 of the Act.

23. Mode of service of notice, etc.

(1) Every notice or other document required to be served on or delivered to any person under these regulations, may be served personally or sent by electronic mail address, or by registered post or by speed post or by courier service at the address furnished by him or her or it for service, or at the place where the person ordinarily resides or carries on business or occupation or works for gain, or to his or her or its authorised

representative at the address furnished by such person or its authorised representative:

Provided that it shall be duty of the person who has furnished the address or the electronic mail address or details of authorised representative, to update the same in the records of the Commission from time to time, as and when necessary, else the service made at the address or the electronic mail address available on record shall be sufficient.

(2) An endorsement made by a postal or courier employee that the addressee or his agent has refused to take delivery of the notice shall be deemed to be proof of service by way of refusal.

(3) An electronic mail shall be deemed to be delivered if properly addressed or directed to the recipient, in a form capable of being read by the other parties’ system, when it is out of the control of the sender and enters the information processing system of the recipient for receiving such messages, whether or not opened or seen by the recipient.

(4) In case the postal or courier employee reports that the addressee has since left or is not available at the given address, the Commission relying on the information so furnished, may take a view as it may deem appropriate and may proceed to take steps for substituted service.

(5) Where summons or notice was properly addressed, prepaid and duly sent by registered post acknowledgement due, and the acknowledgement having been lost or mislaid or for any other reason, has not been received by the Commission within 30 (thirty) days from the date of issue of summons, the Commission may deem the service to be sufficient and may make a declaration accordingly.

(6) Where the service of notice is not possible under the above referred modes and where the addressee cannot be found or is not traceable, the service may be effected by way of affixing a copy of summons or44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] notice on the conspicuous part of the house in which the recipient ordinarily resides, the service may be deemed to be sufficient in view of Rule 20 of Order V of the Code of Civil Procedure, 1908 (5 of 1908).

(7) Where the Commission is satisfied that the recipient of the notice is avoiding service or that for any other reason notice cannot be served in the ordinary way, it shall order service by an advertisement in the daily newspaper circulated in the locality where the recipient is last known to have resided.

24. Filings before Commission.

(1) All information(s) or references or responses thereto, or other documents which are required to be filed before the Commission shall be typed in Arial 12 fonts on both side of A4 size (210 x 297mm or

8.27”x11.69”) white bond paper in double space with 2” margin on the left and 1” margin on all other sides:

Provided that no filings shall be allowed to be made upon letter-heads of any person.

(2) Only neat and legible photocopies or scanned documents duly certified as true copies may be filed as exhibits or annexes.

(3) Two copies of each document referred to in sub-regulation (1), in addition to an electronic copy in pdf format, wherever possible, shall be filed (one original and one copy):

Provided that the Secretary may, through public announcement, increase or decrease the number of copies depending on the number of Members of the Commission and the number of parties to the

proceedings:

Provided further that the Secretary may, through public announcement, vary the format in which the electronic copy is to be filed.

25. Power of Commission to join or substitute parties in proceedings.

(1) The Commission, on an application made in writing, by any party to the proceedings, may combine any number of persons or enterprises, whether jointly, jointly and severally, separately, or in the alternative, as parties in the same proceedings, in an ordinary meeting if, –

(a) any right to relief in respect of, or arising out of, the same act or transaction or series of acts or transactions is alleged to exist in such applicants, whether jointly, severally or in the alternative;

(b) the applicants can show, to the satisfaction of the Commission, that common question of law or fact would arise; and

(c) the Commission is satisfied that participation of such person or enterprise, as the case may be, is necessary for the determination of the issues before it.

(2) If in any proceedings it becomes necessary to substitute a person or enterprise for an existing party, the Commission, may make an order of such substitution.

(3) On an application made, by a party admitted to the proceedings under sub-regulation (1) or sub-regulation

(2), in terms of regulation 38 of these regulations, the Secretary shall furnish to it, certified copies of the documents sought, within 10 (ten) days.

(4) No order under sub-regulation (1) or sub-regulation (2) shall affect any prior steps taken in the proceedings.

26. Power of Commission to permit a person or enterprise to take part in proceedings.

(1) While considering a matter in an ordinary meeting, the Commission, on an application made to it in writing, if satisfied, that a person or enterprise has substantial interest in the outcome of proceedings and that it is necessary in the public interest to allow such person or enterprise to present his or its opinion on that matter, may permit that person or enterprise to present such opinion and to take part in further proceedings of the matter, as the Commission may specify.

(2) The application referred to in sub-regulation (1) shall be accompanied by proof of payment of fees, in accordance with sub-regulation (1) of regulation 50.

(3) The application referred to in sub-regulation (1) shall contain, –

(a) legal name of the person or the enterprise making the request;

(b) address in India for service of notice or documents;

(c) contact details (telephone number, mobile number including country/ city/ area code, and electronic mail address);[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 45

(d) a concise statement of the matters in issue in the proceedings which affect the person or the enterprise making the request;

(e) documents or affidavits or evidence in support of the statement, with a list thereof.

(4) On an order made under sub-regulation (1), if an application is made, by the person or enterprise permitted to participate in the proceedings, in terms of regulation 38 of these regulations, the Secretary shall furnish to it, certified copies of the documents sought, within 10 (ten) days.

27. Power to strike out unnecessary party.

The Commission may, on its own motion or on an application by a party to the proceedings before it, during an ordinary meeting, stating that no relief has been claimed by or against him or that no relief has to be granted to or against him, permit the striking out of such party from the proceedings.

28. Power of Commission to join multiple information.

(1) At any time after receipt of an information or a reference or an application, the Commission, if satisfied that the matter raised in any information or reference or application received subsequently is directly and substantially similar, may consolidate two or more similar information or references or applications, as the case may be, for consideration.

(2) At any time after receipt of an information or a reference for investigation from the Commission under sub-section (1) of section 26 of the Act, the Director General, if satisfied, that the matter raised in any information or reference received subsequently for investigation from the Commission is directly and substantially similar, may request the Commission to consolidate such similar information or references, as the case may be, for common investigation.

(3) Where the Commission consolidates two or more information or references or applications, in accordance with sub-regulation (1) and sub-regulation (2), –

(a) each such information or references, as the case may be, shall continue to be separately identified by its own docket number;

(b) pending consolidation of information or references by the Commission, the Director General may continue to investigate the matters.

29. Amendment of information.

The Commission may permit amendment of any information, upon an application made in this regard but such amendment shall not be allowed if it substantially changes the nature and scope of the information.

30. Manner of making submissions or arguments by parties before Commission.

(1) Without prejudice to sub-section (1) of section 36 of the Act, the parties to the proceedings or their authorized representatives, as the case may be, shall declare to the Commission at the earliest opportunity whether they would make oral submissions or file written arguments during the course of an inquiry under

section 26 of the Act.

(2) Subject to sub-regulation (1), the Commission may fix or limit the time during which the oral submissions or written arguments shall be addressed or filed by the parties or their authorized representatives, as the case may be, before it and may proceed to decide a matter in the absence of the party which does not abide by such timings as per regulation 31.

31. Power of the Commission to continue proceedings in absence of party.

(1) Where on the day fixed for any particular matter during an ordinary meeting, including the day of the meeting re-fixed on adjournment, if any party or parties to the proceeding do not appear even after service of notice or having noted the date, the Commission may decide to continue proceedings in the absence of party or parties, as the case may be, and pass appropriate orders as it deems fit.

(2) If any party refuses access to or otherwise does not provide necessary information within the stipulated time or significantly impedes investigation, the Commission may pass such order as it may deem fit on the basis of available facts.

(3) Where an order has been passed by the Commission under sub-regulation (1) or sub-regulation (2) and the party shows that it was prevented from participating in the proceeding before the Commission and/ or furnishing the information required, for reasons beyond its control, the Commission, on being satisfied, may recall the order.46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

32. Interim order.

(1) Where the Commission, during an inquiry, has, by an order, temporarily restrained any party from carrying on any act in contravention of sub-section (1) of section 3 or sub-section (1) of section 4 of the Act, until the conclusion of such inquiry or until further orders, under section 33 of the Act, such order, if any, shall be signed and dated by the Members, including a dissenting note by the dissenting Member, if that be the case, and shall be made at the earliest.

(2) Where during an inquiry, the Commission has passed interim order, referred to in sub-regulation (1), it shall hear the party against whom such an order has been made thereafter, as soon as possible.

(3) Where in a case an interim order under Section 33 of the Act has been passed, a final order, as far as possible, shall be passed by the Commission, within 180 (one hundred and eighty) days from the date of interim order.

33. Final order.

(1) Every order of the Commission shall be signed and dated by the Members including a dissenting note by the dissenting Member, if that be the case.

(2) Every order or decision of the Commission shall, as far as practicable, be made within 21 (twenty-one) working days from the date of conclusion of final arguments.

(3) A copy of the order duly certified by the Secretary or such other officer authorized by the Secretary shall be served on the parties to the proceeding as provided in regulation 23 within 4 (four) weeks of the date of the order.

34. Reference from statutory authority or the Central Government or a State Government.

(1) A reference from statutory authority under section 21 of the Act or the Central Government or State Government under section 49 of the Act for opinion made to the Commission shall contain such particulars as may be specified by the Commission.

(2) Without prejudice to sub-regulation (1), a reference from statutory authority under section 21 of the Act,

shall contain: -

(a) the specific proposition of law or fact or specific issue or policy or any other matter relating to competition on which the opinion is solicited;

(b) background and historical data relevant for the determination of the proposition or the issue or the policy or any other matter;

(c) duly authenticated copies of the relevant statutes including the rules, the regulations, the notifications, the orders as considered necessary, if applicable;

(d) duly authenticated and updated list of the parties with their complete addresses, telephone numbers, fax numbers, e-mail addresses;

(e) proof of having informed the parties concerned about the matter having been referred to the Commission for opinion under section 21 of the Act, if applicable.

(3) The time to be reckoned for giving opinion on such reference under section 21 of the Act shall be subject to the proviso to sub-regulation (5) of regulation 15.

(4) On being satisfied that the reference is complete, the Secretary shall place it during an ordinary meeting of the Commission and seek necessary instructions regarding the parties to whom notice of meeting is to be issued.

(5) The Secretary shall give notice of the ordinary meeting to the said parties giving not less than 10 (ten) days, in the manner specified, to take part in the proceedings.

(6) The parties to whom the notices are issued under sub-regulation (5), may file comments or reply to the notice after having served a copy thereof to each party within 7 (seven) days of receipt of the notice.

(7) The Commission may call upon a representative of the statutory authority or the Central Government or the State Government or an expert in the field for discussion or evidence as it may consider necessary in the matter.

(8) The Commission may collect particulars and information from any person or enterprise or Central or State Government or statutory authority, which in its opinion is relevant to the reference received by the Commission.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 47

(9) The Commission may form an opinion and send the same to the concerned parties and seek their objections and/or suggestions thereon within the time decided by it and after considering such objections or suggestions it shall give its final opinion to the statutory authority or the Central Government or the State Government, as the case may be.

(10) In case the reference has been made by a statutory authority suo motu, the same may be exempt from application of the provisions contained in clauses (d) and (e) of sub-regulation (2) and sub-regulations (5),

(6) and (9).

35. Reference by the Commission to statutory authority for opinion.

(1) A reference from the Commission to any statutory authority for opinion under section 21A of the Act shall contain, –

(a) the specific proposition of law or fact or specific issue relating to competition on which the opinion is solicited;

(b) background and historical data relevant for the determination of the proposition or the issue;

(c) duly authenticated copies of the Act, the relevant rules and regulations framed thereunder, the notifications and the orders, if any, passed by the Commission in the pending matter as considered necessary;

(d) duly authenticated and updated list of the parties with their complete addresses, telephone numbers, fax numbers, e-mail addresses etc.;

(e) proof of the Secretary having informed the parties concerned about the matter having been referred to the statutory authority for opinion under section 21A of the Act;

(f) the Secretary shall certify that the reference being forwarded is in conformity with clauses (a) to (e):

Provided that in case the reference is being made by the Commission suo motu, the same may be exempt from application of the provisions contained in clauses (d) and (e) above.

(2) Where the statutory authority seeks additional information in the reference made, the Secretary shall, as far as practicable, provide such additional information to the concerned statutory authority within 15

(fifteen) days of receipt of the same from the statutory authority.

(3) In case the opinion is not received from the statutory authority within 60 (sixty) days of forwarding a reference under sub-regulation (1) or sub-regulation (2), the Secretary shall place the matter during an ordinary meeting of the Commission for further orders.

(4) On receipt of the opinion from the statutory authority by sub-section (2) of section 21A of the Act, the Secretary shall place the same during an ordinary meeting of the Commission for orders.

36. Confidentiality.

(1) The Commission shall maintain confidentiality of the identity of an Informant on a request made to it in

writing:

Provided that where it is necessary or expedient to disclose the identity of the Informant for the purposes of the Act, the Commission may do so after providing a reasonable opportunity to the Informant, to represent its case before the Commission.

(2) A party seeking confidentiality over the information or the document(s) furnished by it shall set out cogent reasons for such treatment and shall self-certify that making the information or document(s) or part(s) thereof public will result in disclosure of trade secrets or destruction or appreciable diminution of the commercial value of any information or can be reasonably expected to cause serious injury. Further, the party shall confirm the following, along with the date on which such confidential treatment shall expire, on self-certification basis:

(a) that the information is not available in the public domain;

(b) that the information is known only to limited employees, suppliers, distributors and others involved in the party’s business;

(c) that adequate measures have been taken by the party to guard the secrecy of the information;

(d) that the information cannot be acquired or duplicated by others.

The party claiming confidentiality shall provide an undertaking in the form of an affidavit certifying the claims in terms of the requirements as above and such undertaking shall be filed by either the party itself48 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] or any of its employee, who has been duly authorised by the party to issue such authorisation on behalf of

the party concerned:

Provided that the parties furnishing false undertaking shall be liable to be proceeded against, as per the provisions of the Act.

(3) The party claiming confidentiality shall file a complete version of such information or document(s) with the words ‘restriction of publication claimed’ in red ink on top of the first page, the word ‘confidential’ clearly and legibly marked in red ink near the top on each page, and the content on which confidentiality has been claimed highlighted/ typed in red ink, together with a non-confidential version thereof, which shall redact/ not contain such information or document(s) or part(s) thereof upon which confidentiality has been claimed.

(4) The non-confidential version of such information or document(s) shall be an exact copy of the confidential version with the omissions of the confidential information being indicated in a conspicuous manner, as stipulated in sub-regulation (3).

(5) The information or document(s) or part(s) thereof that have been claimed to be confidential under this regulation shall be segregated from the non-confidential record and kept securely, bearing the title, the docket number of the proceeding, the notation ‘confidential’ and the date on which confidential treatment

expires:

Provided that the following shall be marked ‘confidential (search and seizure/ e-mail dumps/ call detail records etc.)’, as the case may be, and shall be kept separately:

(a) documents/ material obtained through search and seizure operations;

(b) e-mail dumps;

(c) call detail records; or

(d) any other document/ material in the nature of personal information.

(6) The Commission may, if considered necessary or expedient, set up Confidentiality Ring(s) comprising of such authorised representatives of the parties, including, but not limited to, the authorised representatives specified under Section 35 of the Act, who would be able to access the information as mentioned in sub- regulation (5), as required, in unredacted form in terms of regulation 38 of these regulations:

Provided that the Commission, while setting up a Confidentiality Ring, may decide the extent of information to be made accessible, as well as the parties and their members to be included, in the Confidentiality Ring, as deemed appropriate, for the purpose:

Provided further that the document(s)/ material mentioned in proviso to sub-regulation (5) which have been relied upon in the confidential version of the report of the Director General, shall be made accessible to the members of the Confidentiality Ring.

(7) (a) The party seeking access to confidential information shall make a request for setting up a Confidentiality Ring, by way of an application, at the earliest.

(b) In case such request is made by a party post receipt of the non-confidential version of the investigation report, the same shall be made within a period of 10 (ten) days from the receipt thereof:

Provided that if the Commission is satisfied that the party was prevented by sufficient cause from making the request within the said period of 10 (ten) days, it may entertain the request made within a further period of 7 (seven) days.

(8) Access to unredacted information in terms of sub-regulation (6) shall be provided on filing of undertakings in the form of an affidavit by the parties to be included in the Confidentiality Ring stating that the information accessed by their members pursuant to such ring, shall not be shared and/ or disclosed by them, to any other person including to any official and/ or other employee of enterprise concerned or to any official and/ or employee of any joint-venture, subsidiary, group entity of the concerned enterprise, or to any other person, whatsoever, and that they shall use such information and document(s) only for the purposes of the proceedings under the Act, and shall keep such information and documents within their sole custody, and shall destroy the same at the culmination of the present

proceedings:

Provided that separate undertaking(s) on aforesaid terms in the form of an affidavit shall also be

provided by each party included in the Confidentiality Ring, to the other parties in the matter, whose confidential information is being accessed by its members, and the parties shall have the liberty to avail suitable remedies as per law, in case of any breach of such undertaking(s):[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 49

Provided further that the parties concerned and their members forming part of Confidentiality Ring shall be liable to be proceeded against as per the provisions of the Act for breach of undertakings.

(9) The parties shall file undertakings in terms of sub-regulation (8) above within a period of 10 (ten) days

from the date of receipt of the order setting up Confidentiality Ring:

Provided that if the Commission is satisfied that the party was prevented by sufficient cause from filing the undertaking within the said period of 10 (ten) days, it may accept the same filed within a further period of 5 (five) days.

(10) The Informant shall not be part of Confidentiality Ring and shall have access to non-confidential records

only:

Provided that the Commission may include the Informant in the Confidentiality Ring in appropriate cases, if the inclusion of the Informant in the ring is considered necessary or expedient for effective inquiry.

(11) (1) The parties included in the Confidentiality Ring may make application(s) seeking inspection under regulation 38 read with regulation 51 of these regulations, within a period of 7 (seven) days from the date of submission of undertaking(s).

(2) Such inspection shall be completed by the parties within a period of 21 (twenty-one) days of being allowed.

(3) The parties may make application(s) seeking grant of certified copies under regulation 38 read with regulation 51 of these regulations within a period of 7 (seven) days thereafter.

(4) On receipt of an application seeking certified copies, the same shall be supplied within a period of 14

(fourteen) days:

Provided that the Secretary may extend the time period(s) prescribed under sub-clause (2) above for a further period of 7 (seven) days but not thereafter.

(12) (1) The Commission may, considering the facts and circumstances of a particular matter, in exceptional cases, extend the timelines prescribed under this regulation for reasons to be recorded in writing.

(2) In case the party(s) fail to adhere to the given timelines, the Commission shall continue with the proceedings in accordance with law.

(13) If the Commission includes in any order or decision or opinion, information that has been claimed confidential under this regulation, the Commission shall make two versions of the order or decision or opinion, as the case may be. The non-confidential version which omits the confidential information that appears in the complete version, shall be served upon the parties, and shall be included in the non- confidential records. The complete version shall be placed in the confidential records as provided in sub- regulation (4) and the same shall be shared with the members of the Confidentiality Ring.

(14) Any person or party, including any officer or employee appointed by the Commission under sub-section

(1) of Section 17 of the Act or any officer appointed by the Central Government under sub-section (1) of

Section 16 of the Act or any expert or professional engaged by the Commission under sub-section (3) of

Section 17 of the Act or any expert called upon to assist the Commission under sub-section (3) of Section 36 of the Act privy to the contents of the information or document(s) or part(s) thereof that have been claimed confidential under this regulation, shall maintain confidentiality of the same and shall not use or disclose or deal with such confidential information for any purpose other than the purposes of the Act or

any other law for the time being in force:

Provided that breach of confidentiality by any officer or employee of the Commission/ Office of the Director General shall constitute a ground for initiation of disciplinary proceedings under the relevant rules or regulations, as the case may be:

Provided further that breach of confidentiality by any expert or professional engaged by the Commission under sub-section (3) of Section 17 of the Act or any expert called upon to assist the Commission under sub-section (3) of Section 36 of the Act shall be sufficient ground for termination of the engagement or contract, as the case may be.

37. Compliance of orders of Commission.

The Commission shall have power to direct the parties concerned to file an affidavit of compliance of its order or such other documents in the manner specified in its order.50 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

38. Inspection and certified copies of documents.

(1) Subject to the provisions of Section 57 of the Act and regulation 36 of these regulations, a party to any proceeding of an ordinary meeting of the Commission may on an application in writing in that behalf, addressed to the Secretary, be allowed to inspect or obtain copies of the documents or records submitted during proceedings on payment of fee as specified in regulation 51:

Provided further that no request for inspection or certified copies of internal documents shall be allowed.

(2) The Commission may, on an application of a person, who is not a party to the proceedings, on sufficient cause demonstrated, allow such person inspection and/ or grant of certified copies of documents or records mentioned in sub-regulation (1) on payment of fee as specified in regulation 51.

(3) An inspection shall be allowed only in the presence of an officer so authorized by the Secretary:

Provided that the inspection of documents or grant of certified copying thereof as per sub- regulation (1) or sub-regulation (2) shall be allowed under the supervision of and subject to the time limits

to be specified by the Secretary or an officer authorized by him in this behalf:

Provided further that for the purposes of inspection and grant of certified copies of confidential documents, the time limits as stipulated under regulation 36 of these regulations, shall apply.

(4) An officer of the Central or State Government or the Director General or a statutory authority shall be allowed inspection and obtain copies of documents or records mentioned in sub-regulation (1) on making written request to the Secretary for the purpose.

39. Continuation of proceedings after death of a party or adjudication of a party as insolvent.

Where a party to a proceeding in an ordinary meeting of the Commission dies or is adjudged insolvent or, in the case of a company, being wound up, the proceeding shall not abate and may be continued by or against the executor, administrator or other legal representative of the parties or by or against the assignee, receiver or liquidator, as the case may be.

40. Effect of non-compliance.

Failure to comply with any requirement of these regulations shall not invalidate any proceeding, merely by reason of such failure, unless the Commission is of the view that such failure has resulted in miscarriage of justice.

41. Taking of evidence.

(1) Subject to the provisions of the Act, the Commission or the Director General, as the case may be, may determine the manner in which evidence may be adduced in the proceedings before them.

(2) Without prejudice to sub-regulation (1), the Commission or the Director General, for the purpose of inquiry or investigation, as the case may be, may –

(a) admit evidence taken in the form of verifiable transcripts of tape recordings, unedited versions of video recording, electronic mail, telephone records including authenticated mobile telephone records, written signed unsworn statements of individuals or signed responses to written questionnaires or interviews or comments or opinions or analyses of experts based upon market surveys or economic studies or other authoritative texts or otherwise, as material evidence;

(b) admit on record every document purporting to be a certificate, certified copy or other document, which is by law declared to be admissible as evidence of any particular fact provided it is duly certified by a gazetted officer of the Central Government or by a State Government or a statutory authority, as the case may be or a Magistrate or a Notary appointed under the Notaries Act, 1952 (53 of 1952) or the Secretary of the Commission;

(c) admit the entries in the books of account, including those maintained in an electronic form, regularly kept in the course of business, including entries in any public or other official book, register or record or an electronic record, made by a public servant in the discharge of his official duty, or by any other person in performance of a duty specially enjoined by the law of the country in which such book, register or record or an electronic record is kept, as documentary evidence;

(d) admit the opinion of any person acquainted with the handwriting of the person by whom a document is supposed to have been written or signed, as relevant fact to prove the handwriting of the person by whom the document was written or signed;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 51

(e) admit the opinion of the handwriting experts or the experts in identifying finger impressions or the persons specially skilled in interpretation of foreign law or of science or art;

(f) take notice of the facts of which notice can be taken by a court of law under section 52 of the Bharatiya Sakshya Adhiniyam, 2023 (47 of 2023);

(g) accept the facts, which parties to the proceedings admit or agree in writing as proved;

(h) presume that any document purporting to be a certified copy of any record of any authority, court or government of any country not forming part of India as genuine and accurate, if the document purports to be certified in any manner which is certified by any representative of the National Government of such country to be the manner commonly in use in that country for the certification of copies of such records, including certification by the Embassy or the High Commission of that country in India;

(i) admit such documents including electronic records in evidence as may be considered relevant and material for the proceedings.

(3) Subject to the provisions of sub-regulation (2), the following sections of the Bharatiya Sakshya Adhiniyam, 2023 (47 of 2023), in so far as they are applicable to the matters relating to, –

(a) section 20 - when oral admissions as to contents of documents are relevant;

(b) section 41(2) - opinion as to the electronic signature when relevant;

(c) section 63 - admissibility of electronic records;

(d) section 66 - proof as to electronic signature;

(e) section 73 - proof as to verification of digital signature;

(f) section 81 - presumption as to Gazettes in electronic or digital record;

(g) section 85 - presumption as to electronic agreements;

(h) section 86 - presumption as to electronic records and electronic signatures;

(i) section 87 - presumption as to electronic signature certificates;

(j) section 90 - presumption as to electronic messages;

(k) section 91 - presumption as to due execution etc., of documents not produced;

(l) section 93 - presumption as to electronic records five years old; may be applicable for the purpose of inquiry or investigation, by the Commission or the Director General, as the case may be.

(4) The Commission or the Director General, as the case may be, may call for the parties to lead evidence by way of affidavit or lead oral evidence in the matter.

(5) If the Commission or the Director General, as the case may be, directs evidence by a party to be led by way of oral submission, the Commission or the Director General, as the case may be, if considered necessary or expedient, may grant an opportunity to the other party or parties, as the case may be, to cross

examine the person giving the evidence:

Provided that if evidence led by a party by way of oral submission is sought to be relied upon by the Director General in its investigation report against any other person or party, the Director General shall offer to the concerned person or party against whom such evidence is sought to be relied upon, an opportunity to cross examine the person giving the evidence.

(6) The Commission or the Director General, as the case may be, may, if considered necessary or expedient, direct that the evidence of any of the parties to be recorded by an officer or person designated for the said purpose.

(7) The Commission may direct the parties to file written note of arguments or submissions in the matter.

42. Supporting of facts by filing of affidavit.

(1) The Commission or the Director General, as the case may be, may at any time, for sufficient reason, order that any particular fact or facts may be supported by affidavit.

(2) Every affidavit shall be typed in Arial 12 fonts on one side of A4 size (210 x 297 mm or 8.27” x 11.69”) white bond paper in double space with 2” margin on the left and 1” margin on all other sides.52 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) Every affidavit shall clearly state the cause or matter in which it is sworn.

(4) Every affidavit shall be drawn up in the first person, and shall be divided into paragraphs to be numbered consecutively, and shall state the description, occupation and the true place of residence of the deponent.

(5) Affidavits for the purposes of any cause or matter before the Commission may be sworn before any Court or Magistrate or a Notary appointed under the Notaries Act, 1952 (53 of 1952) or any officer or other person a High Court may appoint in this behalf or any officer appointed by any other Court which the State Government has generally or specially empowered in this behalf vide authority mentioned in section 139 of the Code of Civil Procedure, 1908 (15 of 1908).

(6) Every exhibit annexed to an affidavit shall be marked with the title and number of the cause or matter and shall be initialed and dated by the authority before whom it is sworn.

(7) No affidavit having any interlineations, alteration or erasure shall be filed before the Commission or the Director General, as the case may be, unless the interlineations or alteration is initialed or unless in the case of an erasure the words or figures written on the erasure are re-written in the margin and initialed, by the authority before whom, the affidavit is sworn.

(8) The Commission or the Director General, as the case may be, may refuse to receive an affidavit where in its opinion the interlineations, alterations or erasures are numerous as to make it expedient that the affidavit should be re-written.

(9) Where a specific time is given for filing affidavits, no affidavit filed after that time shall be used except by leave of the Commission or the Director General, as the case may be.

(10) In these regulations, ‘affidavit’ includes a document required to be sworn, affirmed or verified. In the verification of petitions and other proceedings, statements based on personal knowledge shall be distinguished from statement based on information and belief.

(11) The Commission or Director General may, during the course of the proceedings, where considered necessary and expedient, in the interest of justice, relax any or all of the above provisions in this regulation.

43. Production of additional evidence before Commission.

(1) The parties to the proceedings shall not be entitled to produce before the Commission additional evidence, either oral or documentary, which was in their possession or knowledge but was not produced before the Director General during investigation under section 26 or sub-section (1A) of section 29 of the Act, but if the Commission requires any document to be produced or any witness to be examined or any affidavit to be filed to enable it to pass orders or for any other substantial cause, or if the Director General has not given sufficient opportunity to the party to adduce evidence, the Commission, for reasons to be recorded, may allow such document to be produced or witness to be examined or affidavit to be filed or may allow such evidence to be adduced.

(2) Such document may be produced or such witness examined or such evidence adduced either before the Commission or before such authority as the Commission may direct.

(3) If the document is directed to be produced or witness examined or evidence adduced before any authority, he or she shall comply with the direction of the Commission and after compliance send the document, the record of the deposition of the witness or the record of the evidence adduced, to the Commission.

(4) Additional evidence/ document shall be made available by the Commission to the parties to the proceedings other than the party adducing the evidence and they may be afforded an opportunity to rebut the contents of the said additional evidence.

44. Power of Commission to call for information etc.

(1) The Commission may, at any time before passing orders in a proceeding, require any of the parties or any other person whom the Commission considers appropriate, to produce such documents or other material objects as evidence as the Commission may consider necessary for the purpose of enabling it to pass orders.

(2) The Commission or the Director General, as the case may be, may direct the summoning of the witnesses, discovery and production of any document or other material objects producible in evidence, requisition of any public record from any office, examination by an officer of the Commission the books, accounts or other documents or information in the custody or control of any person which the Commission considers relevant for the purpose.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 53

(3) The Commission or the Director General, as the case may be, may at any time, summon and enforce the attendance of any person and examine him, or cause him to be examined on oath.

45. Power of Commission or Director General to issue commissions for examination of witnesses or documents.

(1) Subject to the provisions of clause (d) of sub-section (2) of section 36 and sub-section (2) of section 41 of the Act, the Commission or the Director General, as the case may be, either on its or his own motion or on an application made by a party to any proceeding before the Commission or the Director General, may issue a commission for the examination on questionnaires or otherwise of the specified witness(es), –

(a) residing within India;

(b) who is about to leave India before the date on which he or she is required to be examined as a witness;

(c) who, being in the service of the Central Government, a State Government or a statutory authority, cannot, in the opinion of the Commission or the Director General, as the case may be, attend without detriment to the public service;

(d) who is unable to attend due to sickness or infirmity;

(e) who resides at a place which is more than five hundred kilometres distance from the office of the Commission or the Director General, as the case may be, and whose attendance, in the opinion of the Commission or the Director General, as the case may be, cannot be procured without incurring unnecessary expense within the stipulated time;

(f) not being covered under any of the situations mentioned in clauses (a) to (e), if his or her evidence is considered necessary in the interest of justice.

(2) Subject to the provisions of sub-regulation (1), the Commission or the Director General, as the case may be, either on its or his own motion or on an application made by a party to any proceeding before the Commission or the Director General, may also issue a commission for the examination on questionnaires or otherwise of any witness residing at any place not within India if satisfied that the evidence of such witness is necessary and may issue a letter of request to the Indian High Commission or the Indian Embassy to facilitate the execution of the commission, under this regulation.

(3) Subject to the provisions of sub-regulations (1) and (2), the Commission or the Director General, as the case may be, either on its or his own motion or on an application made by a party to any proceeding before the Commission or the Director General, may also issue a commission for the examination of specific document(s) whether available in any place situated within or without India and whether or not held in the custody of any witness being examined on questionnaires as per sub-regulations (1) and (2).

(4) A commission for the examination of a witness on questionnaires or otherwise or for examination of a document issued under sub-regulation (1) or (2) or (3) may be issued to any public servant within the meaning of sub-section (28) to section 2 of the Bharatiya Nyaya Sanhita, 2023 (45 of 2023) or a counsel and such public servant or the counsel, as the case may be, shall be appointed as “the commissioner” only for the purposes of executing the commission.

(5) Every public servant or the counsel, referred to in sub-regulation (4), upon receiving a commission under sub-regulation (4) shall examine the witness or the document, as the case may be, or cause the witness or the document to be examined pursuant thereto and on due execution, shall return the commission together with the evidence taken under it to the Commission or the Director General, as the case may be.

(6) The Commission or the Director General, as the case may be, shall furnish the commissioner appointed under sub-regulation (4) with such part of record of the proceedings and such instructions as appear necessary and the instructions shall distinctly specify that the commission is restricted to finding the facts through the examination as directed and the Commissioner is merely required to transmit the record of the proceedings to the Commission on completion of the examination.

(7) Any Commissioner appointed under this regulation may, unless otherwise directed by the order of appointment –

(a) examine the witness himself;

(b) call for and examine the documents and other things relevant to the subject of inquiry.

(8) The Commission or the Director General, as the case may be, issuing a commission under this regulation shall fix a date on or before which the commission shall be returned after execution, and the date so fixed54 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] shall not be extended except, for reasons to be recorded, the Commission or the Director General, as the case may be, is satisfied that there is sufficient cause for extending the date.

46. Authorizing a representative to appear.

(1) Subject to the provisions of section 35 of the Act, in any proceeding, where the pleading is also signed by an authorized representative, the party shall append a letter or vakalatnama in the manner specified authorizing the representative to appear for him or her or it, as the case may be.

(2) The authorized representative shall not be allowed to represent the party unless such authorization letter

or vakalatnama is filed before the Secretary before commencement of the ordinary meeting:

Provided that at any point of time, only one authorization letter or vakalatnama on behalf of each party shall be deemed to be valid which shall be collectively signed by all its legal representative(s) and filing of a new authorization letter or vakalatnama by any party shall be considered deemed revocation of the earlier one.

(3) No misconduct on the part of any authorized representative, appearing for and on behalf of any party during continuance of a proceeding before the Commission as well as the Director General shall be permitted and the Commission in appropriate circumstances, for reasons to be recorded in writing, may pass necessary orders debarring the representative, guilty of misconduct, from appearing in the proceedings before the Commission and/ or the Director General in future or till such time as the Commission deems necessary.

(4) In the event of the misconduct being committed by any counsel, the Secretary, if so directed by the Commission shall forward a complaint to this effect in writing to the Bar Council of the State of which the legal practitioner is member or the Institute of Chartered Accountants of India or the Institute of Company Secretaries of India or the Institute of Cost and Works Accountants of India, as the case may be.

Explanation – For the purpose of this regulation, word “misconduct” shall include causing prejudice to or interfering with or attempting to interfere with, the due process of any proceeding or obstructing or attempting to obstruct, the compliance or execution of any order or direction of the Commission, in any manner, or using defamatory language or behaving defiantly or attempting to undermine or undermining the prestige of any Member or Officer of the Commission in any manner whatsoever.

47. Authorizing an Advocate to accompany any person summoned by the Director General.

An Advocate may accompany any person summoned by the Director General to appear before him, subject to the following conditions, namely –

(a) The Advocate shall not be allowed to accompany such person, unless a request in writing accompanied by an authorisation letter or vakalatnama is duly submitted to the Director General, prior to commencement of the proceedings.

(b) The Advocate shall not sit in front of the person so summoned.

(c) The Advocate shall not be at a hearing distance and shall not interact, consult, confer or in any manner communicate with the person, during his examination on oath.

48. Proceedings before Commission not to be open to public.

Except where the Commission may so direct, for reasons to be recorded, the proceedings before the Commission, during an ordinary meeting, shall not be open to public. In taking the decision to open the proceedings to public, the Commission may take into account all or any of the following matters namely: –

(a) whether disclosure to public does not cause significant harm to a party;

(b) degree of inhibition or encouragement in providing information in public;

(c) efficient and proper conduct of proceeding;

(d) resources of the Commission.

49. Procedure for imposition of penalty under the Act.

(1) Notwithstanding anything to the contrary contained in any regulations framed under the Act, no order or direction imposing a penalty under Chapter VI of the Act shall be made unless the person or the enterprise or a party to the proceeding, during an ordinary meeting of the Commission, has been given a show cause notice and reasonable opportunity to represent his case before the Commission.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 55

(2) In case of persons proceeded against in terms of section 48 of the Act, forwarding of the investigation report and/ or the supplementary investigation report or issue of show-cause notice under sub-regulation

(8) of regulation 22 of these regulations, as the case may be, to such persons, shall be deemed to be the show cause notice in terms of sub-regulation (1) above.

(3) In case the Commission decides to issue show cause notice to any person or enterprise or a party to the proceedings, as the case may be, under sub- regulation (1), the Secretary shall issue a show cause notice giving not less than 15 (fifteen) days asking for submission of the explanation in writing within the period stipulated in the notice.

(4) The Commission shall, on receipt of the explanation, and after oral hearing if granted, proceed to decide the matter of imposition of penalty on the facts and circumstances of the case.

50. Fee under clause (a) of sub-section (1) of section 19 of the Act.

(1) Each information received under clause (a) of sub-section (1) of section 19 of the Act from any person shall be accompanied by proof of having paid the fee as under, -

(a) rupees 6,000 (six thousand) in case of individual or Hindu Undivided Family (HUF), or

(b) rupees 12,000 (twelve thousand) in case of Non-Government Organisation (NGO), or Consumer Association, or a Co-operative Society, or Trust, or

(c) rupees 50,000 (fifty thousand) in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one-person company) having turnover in the preceding year upto rupees two crore, or

(d) rupees 1,25,000 (one lac twenty-five thousand) in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one-person company) having turnover in the preceding year exceeding rupees two crore and upto rupees 50 crore, or

(e) rupees 6,00,000 (six lacs) in the cases not covered under clause (a) or (b) or (c) or (d).

(2) Each Interlocutory Application received under sub-regulation (6) of regulation 16 shall be accompanied by proof of having paid the fee as under, -

(a) Rupees 500 (five hundred) in case of individual or Hindu Undivided Family (HUF), or

(b) Rupees 1,000 (one thousand) in case of Non-Government Organisation (NGO), or Consumer Association, or Co-operative Society, or Trust or

(c) Rupees 1,000 (one thousand) in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one-person company) having turnover in the preceding year upto rupees two crore, or

(d) Rupees 5,000 (five thousand) in all other cases.

(3) Each Miscellaneous Application received under sub-regulation (6) of regulation 16 shall be accompanied by proof of having paid the fee as under, -

(a) rupees 3,000 (three thousand) in case of individual or Hindu Undivided Family (HUF), or

(b) rupees 6,000 (six thousand) in case of Non-Government Organisation (NGO), or Consumer Association, or a Co-operative Society, or Trust, or

(c) rupees 25,000 (twenty-five thousand) in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one-person company) having turnover in the preceding year upto rupees two crore, or

(d) rupees 60,000 (sixty thousand) in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one-person company) having turnover in the preceding year exceeding rupees two crore and upto rupees 50 crore, or

(e) rupees 3,00,000 (three lacs) in the cases not covered under clause (a) or (b) or (c) or (d).

(4) The fee may be increased or decreased on the basis of annual notification of Cost Inflation Index by the Central Board of Direct Taxes, Department of Revenue, Ministry of Finance by an order of the Commission.

(5) The fee can be paid either by tendering demand draft or pay order or banker’s cheque, payable in favour of Competition Commission of India (Competition Fund), New Delhi or through Electronic Clearance Service (ECS) by direct remittance to the Competition Commission of India (Competition Fund), Account No. 1988002100187687 with “Punjab National Bank, Bhikaji Cama Place, New Delhi – 110066”.56 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

51. Inspection and copying fees.

(1) A party to the proceedings, on application, may be allowed inspection of records relating to its case by the Secretary, on such conditions as may be specified, on payment of rupees two thousand five hundred per day per case.

(2) Fees for supplying certified copies shall be rupees twenty per page.

52. Empanelment of special counsel by Commission.

(1) The Commission may draw up a panel of legal practitioners or chartered accountants or company secretaries or cost accountants to assist in proceedings before the National Company Law Appellate Tribunal referred to in section 53A of the Act or any other quasi-judicial body or Court.

(2) The Director General may call upon the legal practitioners or chartered accountants or company secretaries or cost accountants from the panel for assistance in the proceedings before the Commission, if so required.

(3) The remuneration payable and other allowances and compensation admissible to counsel shall be specified in consultation with the Commission.

53. Inviting experts of eminence to assist Commission.

Without prejudice to sub-section (3) of section 36 of the Act, or guidelines issued thereunder, the Commission may invite experts of eminence to assist the Commission in discharging of its functions under the Act on such

terms and conditions and at such times as may be decided by the Commission:

Provided that the Commission shall have absolute discretion as regards the evaluation of expertise or eminence of those invited to assist the Commission.

54. Implementation and monitoring of orders passed by the Commission.

(1) Where the Commission is of the opinion that the implementation of its orders passed under Section 31 or

Section 48A or Section 48B or any other provisions of the Act and regulations made thereunder, needs monitoring, it may appoint agencies to oversee such implementation, on such terms and conditions as deemed fit by the Commission.

(2) The agencies appointed under sub-regulation (1) shall be independent of the parties to the proceedings in the matter, and shall confirm that they do not have any conflict of interest with the said parties.

(3) Such agencies referred to in this regulation may include an accounting firm, management consultancy, any other professional organisation or chartered accountants/ company secretaries/ cost accountants.

(4) The agencies appointed under sub-regulation (1) shall carry out the responsibilities as specified by the Commission from time to time, inter alia, including:

(a) monitoring the implementation of the orders of the Commission in accordance with its terms of engagement;

(b) informing the Commission of any non-implementation or non-compliance of such orders;

(c) adequately disclosing any direct or indirect pecuniary or non-pecuniary interest that is likely to prejudice performance of its duties under the terms of its engagement;

(d) submit reports related to monitoring of the implementation of the orders of the Commission, at such periodic intervals as directed by the Commission;

(e) maintaining highest standards of confidentiality in respect of information received or collected during the discharge of its obligations; and

(f) performing such other duties as stipulated under the terms of its engagement or directed by the Commission.

(5) The Commission may, suspend or terminate the engagement of agencies appointed under sub-regulation

(1) in such manner as may be determined by terms of its engagement:

Provided that notwithstanding anything contained in the terms of engagement, the Commission may, if it deems necessary, revoke the engagement, for reasons to be recorded in writing and such revocation shall not be questioned in any court of law or otherwise.

(6) The payment to the agencies appointed under sub-regulation (1) shall be made by the person who has filed an application under regulation 3 of the Competition Commission of India (Settlement) Regulations, 2024 or regulation 3 of the Competition Commission of India (Commitment) Regulations, 2024 or who[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 57 has filed a notice under regulation 9 of the Competition Commission of India (Combinations) Regulations, 2024 or in any other case, by any other person as directed by the Commission, as the case may be, by depositing it with the Commission or as may be directed by the Commission, subject to satisfactory discharge of responsibilities by the agencies.

55. Publication.

(1) The Commission may cause publication of a brief summary or the full text of its orders or decisions in the media, if it so desires in the interest of public, but shall have regard to the business secrets of the persons concerned and may direct deletion of such portions of the orders or decisions as it deems fit.

(2) All orders or decisions made by the Commission under sub-section (2) or sub-section (2A) or sub-section

(6) or sub-section (9) of section 26 of the Act directing the closure of the matter, or under section 27 or

section 28 or section 31 or section 33 or section 42 of the Act, as the case may be, shall be published on the website of the Commission.

(3) It shall be the duty of the Secretary to publish the orders or decisions referred to in this regulation.

56. Removal of difficulty.

In the matter of implementation of these regulations, if any doubt or difficulty arises, the decision of the Commission thereon shall be binding.

57. Repeal and Savings.

(1) The Competition Commission of India (General) Regulations, 2009, stand repealed from the date on which these regulations come into force.

(2) Notwithstanding such repeal, –

(a) anything done or any action taken or purported to have been done or taken, or any proceedings or decision, inquiry or investigation commenced under the repealed regulations, prior to such repeal, shall be deemed to have been done or taken under the corresponding provisions of these regulations;

(b) the operation of the repealed regulations or anything duly done or suffered thereunder, any right, privilege, obligation or liability acquired, accrued or incurred thereunder, or any investigation, legal proceeding or remedy ensued thereunder, shall remain unaffected as if the repealed regulations have never been repealed;

(c) after the repeal of the Competition Commission of India (General) Regulations, 2009, any reference thereto including in any regulations, direction or decision issued by the Commission, shall be deemed to be a reference to the corresponding provisions of these regulations.
