आ(cid:7)ेप या सुझाव, य(cid:21)द कोई हो, महािनदेशक, ऊजा (cid:4) द(cid:7)ता (cid:9) यूरो, -वWुत मंSालय, चौथा तल, सवेा भवन, रामकृष ण् पुरम, सैक्ट र-1, नई (cid:21)दलल ् ी-110 066 को संबोिधत (cid:21)कए जा सक7गे। ऐसे (cid:21)कसी आ(cid:7)ेप या सुझाव पर, जो (cid:21)कसी P य-K से उ(cid:27) त -विनयम0 के 45प क> बाबत उपयु(cid:27)(cid:4) त अविध के अवसान से पूव(cid:4) 4ा^त हो, (cid:9)य रू ो Hारा -वचार (cid:21)कया जाएगा। ----ववववििििननननययययमममम0000 ककककाााा ममममससससौौौौददददाााा

1. ललललघघघघुु ुु शशशशीीीीषषषषकक(cid:4)(cid:4)कक(cid:4)(cid:4) औऔऔऔरररर आआआआररररंंंंभभभभ :-(1) इन -विनयम0 को ऊजा (cid:4) द(cid:7)ता (cid:9)य ूरो (घरेलू सीधे ठंडे 4शीतक0 के लबेल0 पर उनके सं4दशन(cid:4) क> -विश-‘यां और रQित), -विनयम, 2015 कहा जाए।

(2) ये राजपS म7 उनके अंितम 4काशन क> तारQख को 4वतृ त् ह0गे।

2. पपपपaaaaररररभभभभााााषषषषाााा :- (1) इन -विनयम0 म7, जब तक संदभ (cid:4) म7 अनय ् था अपे2(cid:7)त न हो,- (क) ''अिधिनयम” से ऊजा (cid:4) संर(cid:7)ण अिधिनयम, 2001 अिभ4ेत है;

(ग) “45प” से इन -विनयम0 के साथ संलdन 45प अिभ4ेत है; (घ) “लबेल” से सीधे ठंडे 4शीतक पर िचपकाया गया अथवा 4दिशत(cid:4) िल2खत, मु(cid:21)9त, िच(cid:21)eत, मुहर लगी या fा(cid:21)फक सामfी अिभ4ेत है; (ङ) “लबेल अविध” से धारा 14 के खण ड् (क) के अधीन केन 9् सरकार Hारा -विन(cid:21)द(cid:4)ष ट् ऊजा (cid:4) खपत मानक के अधीन तुलनातम ् क ऊजा (cid:4) खपत क> -विधमाhय ता अविध से है और य(cid:21)द तुलनातम ् क ऊजा (cid:4) खपत क> -विधमाhय ता क> अविध क> अंितम अविध -विन(cid:21)द(cid:4)ष ट् नहQं क> गई है, इस अविध को केन9 ् Qय सरकार Hारा -विन(cid:21)द(cid:4)ष ट् नए मूलय ् 0 तक -विधमाhय मानी जाएगी;

(च) “मॉडल अथवा मॉडल0 के पaरवार” से (cid:21)कसी -विशcट jाण ड् का मॉडल या मॉडल0 क> kणेी है 2जसके संबंध म7 परQ(cid:7)ण aरपोटl का एकल समुmच य लागू है और जहां 4तय ् ेक मॉडल के समान भौितक ल(cid:7)ण, वा-षक(cid:4) -वWुत खपत, ऊजा (cid:4) कुशलता सत ् र और िनषप ् ादन ल(cid:7)ण समान अिभ4ेत हn;

(छ) “अनुpाधारक” से ऐसे वय ् -K या ऐसी एज7सी से है 2जसे -विनयम 7 के अधीन लबेल िचपकाने के िलए अनुpा दQ गई अिभ4ेत है; (ज) “सट ् ार रे(cid:21)टंग अथवा सट ् ार सत ् र” से सीधे ठंडे 4शीतक क> तुलनातम ् क -वWुत खपत को दशान(cid:4) े के िलए अिधिनयम क> धारा 14 के खण ड् (क) के अधीन केन 9् सरकार Hारा अिधसूिचत ऊजा (cid:4) खपत मानक पर आधाaरत सीधे ठंडे 4शीतक के लबेल पर 4दिशत(cid:4) ऊजा (cid:4) कुशलता का fडे है;

(झ) लबेल लगे सीधे ठंडे 4शीतक के संबंध म7 “वय ् ापारQ अथवा -वqेता” से उस Pय -K से अिभ4ेत है जो ऐसे सीधे ठंडे 4शीतक क> -बq> अथवा -वतरण करता है और इसम7 ऐसे दकु ानदार, Pय ापारQ, -विनमात(cid:4) ा और सीधे ठंडे 4शीतक पर लेबल िचपकाने के िलए अनुमित 4ाप त् अनुpाधारक शािमल हn।

(2) यहां इसम7 4युक् त जो शब द् और अिभवय ् -Kया ं अपaरभा-षत हn ल(cid:21)ेकन अिधिनयम म7 पaरभा-षत हn, उनका अिधिनयम म7 उनह ् 7 qमश: (cid:21)दया गया अथ (cid:4) हQ होगा।

3. लबेल पर 4दिशत(cid:4) (cid:21)कए जाने वाली -विश-‘या।ं (1) 4तय ् के सीधे ठंडे 4शीतक पर, इसके लबेल पर िनम न् िल2खत -विश-‘यां 4दिशत(cid:4) क> जाएगी, अथात(cid:4) ् :- (क) ऊजा (cid:4) द(cid:7)ता बय ् ूरो का 4तीक िचe;

(ख) -विनमात(cid:4) ा अथवा आयातक और jाण ड् का नाम; (ग) सािधS का 4कार; (घ) िनधाa(cid:4)रत सकल आयतन; (ङ) िनधाa(cid:4)रत भ"ड ारण आयतन; (च) -विनमाण(cid:4) अथवा आयात का मॉडल नंबर और वष;(cid:4) (छ) -वशषे kखंृ ला कोड;

(ज) इकाई 4ित वष(cid:4) म7 -बजली क> खपत; (झ) सट ् ार r तर; और (ञ) लबेल क> अविध;

(2) लबेल का (cid:21)डजाइन, रंग, आकार और सामfी इन -विनयम0 के साथ उपांबध अनुसूची म7 यथा: -विन(cid:21)द(cid:4)ष ट् होगा।

4. लबेल0 के 4दशन(cid:4) के िलए समय-सीमा: (1) -विनयम 3 म7 -विन(cid:21)द(cid:4)cट सभी -विश-‘य0 वाला लबेल इन -विनयमन0 के लागू होने क> तारQख से छह माह क> अविध के भीतर 4tय के सीधे ठंडे 4शीतक पर 4दिशत(cid:4) (cid:21)कया जाएगा।¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3

(2) क79Qय सरकार Hारा अिधिनयम क> धारा 14 के खण ड् (क) के अधीन लागू संशोिधत ऊजा (cid:4) खपत मानक0 के 4ारंभ होने पर और 4ारंभ होने से, 4त य् के अनुpाधारक या वय ् ापारQ या -वqेता सुि न2uत करेगा (cid:21)क- (क) बाजार म7 सट् ार सत् र को 4दिशत(cid:4) करन ेवाल ेपूव (cid:4)-संशोिधत लबेल वाल ेसीधे ठंडे 4शीतक0 का उपलबध् सट् ॉक पूरQ तरह समापत् हो गया है अथवा इस पर पुन :संशोिधत लबेल लगाए गए हn अथवा उस तारQख से पहले बाजार से वापस ले िलया गया है 2जस तारQख को संशोिधत सट् ार सत् र लागू हुआ है;

(ख) -बq> के िलए रखे गए सीधे ठंडे 4शीतक संशोिधत ऊजा (cid:4) खपत मानक0 के साथ समqमण कर संशोिधत rट ार rत र और संशोिधत लबेल अविध भी 4दिशत(cid:4) कर7ग ेऔर ऐसे 4ारंभ से तीन माह पूव (cid:4)संशोिधत लबेल शु5 (cid:21)कए जाएं। (ग) डQलर0, खदु रा P यापाaरय0 को जानकारQ देन ेके िलए उनक> जाग5कता के साथ हQ उपभो(cid:27)त ाओं को िश2(cid:7)त करने के िलए अपे2(cid:7)त 4चार-4सार स(cid:21)हत सभी 4ारंिभक उपाय इन -विनयम0 के अधीन ऐसे 4ारंभ क> तारQख से छह माह पूव(cid:4) िनयो2जत (cid:21)कए जाएंग।े

5. लबेल 4दिशत(cid:4) करने क> रQित-(1) -बq> r थल पर 4tय के सीधे ठंडे 4शीतक पर लेबल 4दिशत(cid:4) (cid:21)कया जाएगा और ऐसे लबेल सीधे ठंडे 4शीतक पर िनwन -विध म7 िचपकाए जाएंगे, नामत:- (क) सीधे ठंडे 4शीतक पर के ऊपरQ दाएं (cid:21)हrस े म7 सामने क> ओर िचपकाया हुआ rव - आसंजक लबेल;

(ख) काट(cid:4)न बॉ(cid:27) स पर सामने क> ओर िचपकाया हुआ rव - आसंजक लेबल;

(2) 4दिशत(cid:4) न (cid:21)कए गए सीधे ठंडे 4शीतक के िलए, लबेल पे(cid:21)कंग के बाहर िचपकाया जाए और जब इसे -बq> के िलए रखा जाए तो यह लबेल इकाई के साथ लगाया जाए।

6. लबेल 4दिशत(cid:4) करने क> अनुpा-(1) बय ् ूरो क> पूव(cid:4) अनुpा के -बना सीधे ठंडे 4शीतक पर कोई सट ् ार नहQं िचपकाया जाएगा।

(2) उप- -विनयम (1) के तहत ब य् ूरो क> अनुpा लनेे के 4योजन के िलए, आवेदन 45प-I म7 और इले(cid:27)x ॉिनक 45प म7 (cid:21)कया जाएगा; परंत ु सीधे ठंडे 4शीतक के 4t यके मॉडल के िलए पथृ क आवेदन (cid:21)कया जाए;

(3) उप- -विनयम (2) के अधीन 4तय ् के आवेदन- पS के साथ िनम न् िल2खत संलग न् ह0गे – (क) ऊजा (cid:4) द(cid:7)ता ब य् ूरो, नई (cid:21)दलल ् ी के प(cid:7) म7 दो हजार yपए का आवेदन शुल क् अथवा भुगतान के (cid:21)कसी 4ितfाहय इलके्x ॉिनक ढंग म7 देय होगा;

(ख) ऊजा (cid:4) द(cid:7)ता ब य् ूरो, नई (cid:21)दलल ् ी के प(cid:7) म7 देय एक लाख yपए क> लबेल जमानत रािश; मांग पS या भुगतान के (cid:21)कसी 4ितfाहय इलेक्x ॉिनक ढंग म7। परंत,ु लघु उWोग के मामले म7, जमानत रािश केवल पचच ् ीस हजार yपए होगी-; और (ग) 45प-1 म7 यथा: -विन(cid:21)द(cid:4)cट दसत ् ावेज ;

7. अनुpा 4दान करना- (1) -विनयम 6 के अधीन कोई आवेदन 4ा^ त होन ेपर और इससे संतुcट होन ेपर (cid:21)क इसम7 दQ गई सभी अपे(cid:7)ाओं का पालन (cid:21)कया गया है, (cid:9)य ूरो ऐसी 4ािT क> तारQख से एक माह क> अविध के भीतर, -विनयम 8 म7 यथा: -विन(cid:21)द(cid:4)cट िनबंधन0 एवं शतl के अzय धीन सीधे ठंडे 4शीतक पर 45प-II अथवा इल(cid:27)ेx ॉिनक 45प म7 लबेल िचपकाने के िलए अनुpा 4दान कर सकता है।

(2) बय ् ूरो, 45प -III म7 र2जrट र बनाकर रखेगा और इसम7 अनुpाधारक के नाम 4-वcट करेगा;

(3) उप- -विनयम (1) के अधीन इस 4कार 4दI अनुpा उस अविध तक -विधमाhय होगी जो केh9 Qय सरकार Hारा धारा 14 के ख" ड (क) के अधीन यथा: अिधसूिचत ऊजा (cid:4) खपत मानक Hारा rट ार r तर के िलए -विन(cid:21)द(cid:4)ष ट् क> गई है;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(4) अनpु ाधारक Hारा अनुpा के नवीकरण के िलए आवेदन छह माह के भीतर (cid:21)कंत ु इस अविध क> समािT से तीन माह पूव (cid:4) (cid:21)कया जाएगा। ऐसा आवेदन, अनुpा क> समािT से कम से कम तीन माह पूव (cid:4) (cid:21)कया जाएगा और इसके साथ ऊजा (cid:4) द(cid:7)ता (cid:9)य ूरो, नई (cid:21)द(cid:22)ल ी के प(cid:7) म7 मांग पS के 5प म7 या इल(cid:27)ेx ॉिनक ढंग म7 एक हजार yपए का देय शु(cid:22)क होना चा(cid:21)हए;

(5) -विधमाhय ता क> अविध समाप त् होने के पUच ात ् (cid:21)कसी आवेदन का नवीकरण नहQं (cid:21)कया जाएगा और अनुpाधारक को नया आवेदन पS 4r तुत होगा;

(6) उप- -विनयम (4) के अधीन नवीकरण के िलए आवेदन-पS िमलन ेपर और सभी अपे(cid:7)ाओं का अनुपालन होने के संबंध म7 संतुcट होने पर, (cid:9)य ूरो ऐसा आवेदन 4ा^ त होने क> तारQख से एक माह क> अविध के भीतर 45प-II म 7 अनुpा का नवीकरण कर सकता है;

(7) जो अनुpाधारक उस तारQख से सीधे ठंडे 4शीतक के मौजूदा मॉडल पर लबेल िचपकाने को जारQ रखने क> अनुpा क> मांग करता है, 2जस तारQख से संशोिधत सट ् ार सत ् र लागू हुआ है, केवल 45प-IV म7 एक घोषणा 4rत ुत करेगा;

(8) य(cid:21)द सीधे ठंडे 4शीतक के नए मॉडल क> योजना संशोिधत सट ् ार सत ् र के साथ समqमण कर शु5 करने क> है तो अनुpाधारक को नया लबेल िचपकाने क> अनुpा लगेा और ऐसी अनुpा के िलए आवदेन संशोिधत स ट ् ार सत ् र के लागू होने से छह माह पूव (cid:4) (cid:21)कया जाए;

8. लबेल पर -विश-‘यां 4दिशत(cid:4) करने के िलए िनबंधन और शत:{ - 4t यके अनुpाधारक और Pय ापारQ और -वqेता िनमन ् िल2खत िनबंधन0 एवं शतl का पालन करेगा, अथात(cid:4) :- (क) सीधे ठंडे 4शीतक के लबेल पर 4दिशत(cid:4) सट ् ार सत ् र अिधिनयम क> धारा 14 के खण ड् (क) के अधीन क79Qय सरकार अिधसूिचत सीधे ठंडे 4शीतक के िलए ऊजा (cid:4) खपत मानक0 के अनु5प ह0गे; ;

(ख) यह लबेल सीधे ठंडे 4शीतक के ऐसे मॉडल0 पर हQ िचपकाया जाएगा 2जसके िलए अनुpा 4दान क> गई है; (ग) लबेल को अनुpाधारक क> लागत पर मु(cid:21)9त और सीधे ठंडे 4शीतक पर िचपकाया जाएगा; (घ) अनुpाधारक, वय ् ापारQ और -वqेता यह सुिन2uत करेगा (cid:21)क सीधे ठंडे 4शीतक पर लबेल पर 4दिशत(cid:4) सट ् ार सत ् र हर समय बना रहेगा;

(ङ) अनुpाधारक -विनयम 9 म7 यथा: -विन(cid:21)द(cid:4)ष ट् लबेल शुल क् का भुगतान करेगा; (च) अनुpाधारक बय ् ूरो को -विश-‘यां देगा करेगा 2जसम7 लबेल लगे उपrक र0 को बनाने का बय ् ौरा और -वIीय वष(cid:4) क> 4तय ् ेक ितमाहQ के अंत म7 िनम न् िल2खत मास के भीतर 4तय ् के ितमाहQ के िलए देय 4ो}तू लबे िलंग शुल क् क> -विश-‘या ं हो;

(छ) अनुpाधारक, बय ् ूरो को अपने लबेल लगे उतप ् ाद0 क> -बq> के िलए िनयुक् त 4तय ् के वष (cid:4) 30 अ4ैल को अिधकृत -वतरक0, डQलर0 और थोक -वqेताओं एवं -वqेताओं क> सूची देगा; (ज) अनुpाधारक, वय ् ापारQ और -वqेता ऐसे अन य् िनबंधन0 एवं शतl का पालन कर7ग ेजो बय ् ूरो Hारा, मानक और लबेिलंग के संबंध म7 बय ् ूरो क> िनद~िशका म7 अंत-व(cid:4)cट िनबंधन0 और शतl स(cid:21)हत -विन(cid:21)द(cid:4)ष ट् (cid:21)कए गए ह0;

9. लबेल शुल क् - (1) 4तय ् के अनुpाधारक, ब य् ूरो को सीधे ठंडे 4शीतक पर 4त य् के िचपकाए गए लबेल के िलए पांच yपए क> फ>स का भुगतान करेगा।

(2) उप--विनयम (1) के अधीन -विन(cid:21)द(cid:4)ष ट् लबेल फ>स, 4तय ् के -वIीय वष (cid:4) क> अंितम तारQख से एक माह के भीतर वा-ष(cid:4)क तौर पर संदI (cid:21)कया जाएगा; परंत ु यथा -विन(cid:21)द(cid:4)ष ट् अविध के भीतर लबेल फ>स के भुगतान म7 चूक पर,,,, (cid:9)य ूरो -विनयम 6 के उप--विनयम

(3) के खण ड् (ख) के अधीन 4ितभूित िन(cid:7)पे से इस पर दस 4ितशत 4ित वष(cid:4) क> दर से इस पर बय ् ाज के साथ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5 बकाया रकम वसूल करेगा। य(cid:21)द इसे जमा (cid:21)कए जाने क> अंितम तारQख से एक वष(cid:4) के भीतर पूरा लबेिलंग शुल क् वसूल नहQं (cid:21)कया जाता, बय ् ूरो अनुpाधारक को 4दI सभी अनुpा र(cid:127) कर सकता है और अनुpाधारक का नाम Pय ितqमी के 5प म7 समाचार पS म7 4कािशत कर सकता है।

10. लबेल जमानत शुल क् का 4ितदाय:- -विनयम 9 के उप--विनयम (2) के उपबंध0 के अध य् धीन, अनुpाधारक सीधे ठंडे 4शीतक का -विनमाण(cid:4) न करन ेपर लबेल जमानत शु(cid:22)क के 4ितदाय का हकदार होगा।

11. बय ् ूरो Hारा सत य् ापन- (1) बय ् ूरो अथवा इसक> नामिन(cid:21)द(cid:4)cट एज7सी, सव ् यमवे अथवा इसे िशकायत 4ाप त् होने पर, यह सुिन2uत करन ेके िलए सतय ् ापन करेगा (cid:21)क सीधे ठंडे 4शीतक इसके लबेल पर 4दिशत(cid:4) सट ् ार सत ् र और अन य् -विश-‘य0 के अनु5प है और (cid:21)क यह अनुpा के अन य् िनबंधन0 एवं शतl के अनुपालन म7 है।

(2) सतय ् ापन के 4योजन के िलए, बय ् ूरो अथवा -विनमात(cid:4) ा सु-वधा से इसक> नामिन(cid:21)द(cid:4)cट एज7सी, Hारा जैसे वह उिचत समझे, भांडागार अथवा फुटकर -वqय केन 9् से या(cid:128)2mछक तौर नमूने एकS करेगा;

(3) जहां उप- -विनयम (1) के अधीन िशकायत 4ाप त् होने पर, बय ् ूरो Hारा जांच और अंशांकन 4योगशालाओं हेतु राषx ् Qय परQ(cid:7)ण 4त य् ायन बोड(cid:4) (एनएबीएल) Hारा -विधवत 4त य् ाियत सव ् तंS 4योगशाला म7 सीधे ठंडे 4शीतक क> जांच पर आ(cid:7)ेप कर सतय ् ापन करना अपे2(cid:7)त है, अनुpाधारक को ऐसे परQ(cid:7)ण के िनषप ् ादन के िलए नो(cid:21)टस जारQ (cid:21)कया जाएगा और िशकायतकता (cid:4) से बय ् ूरो के पास परQ(cid:7)ण, पaरवहन संबंधी खच (cid:4) और अन य् आक2rमक व य् य, ऐसी समयाविध म7 जमा कराने क> मांग क> जाएगी जो बय ् ूरो Hारा अवधाaरत क> गई हो और य(cid:21)द आ(cid:7)ेप परQ(cid:7)ण के अधीन िलए गए नमूने -वफल रहते हn, बय ् ूरो को नमूने लेने, नमूने के पaरवहन और जांच 4भार0 क> लागत के िलए सभी वय ् य क> 4ितपूित (cid:4) अनुpाधारक Hारा क> जाएगी और ब य् ूरो उ2(cid:22)ल2खत वय ् य िशकायतकता (cid:4) को 4ितदाय करेगा और जहां उपrक र आ(cid:7)ेप परQ(cid:7)ण पर पास हो जाते हn, तब िशकायतकता (cid:4) Hारा जमा कराए गए वय ् य जब त् कर िलए जाएंगे;

(5) जहां, दसू रा परQ(cid:7)ण -वफल होता है, बय ् ूरो,- (क) 45प V, म7 अनpु ाधारक को सभी रा(cid:129) य नामिन(cid:21)द(cid:4)cट एज7िसय0 को िनदेश देगा (cid:21)क अनुpाधारक दो माह क> अविध के अंदर, i. सीधे ठंडे 4शीतक के लबेल 4दिशत(cid:4) पर rट ार rत र सहQ करेगा अथवा परQ(cid:7)ण के दौरान Sु(cid:21)टय0 और किमय0 को दरू करेगा;

ii. बय ् ूरो के (cid:21)दशा- िनद~श0 के अनुपालन म7 बाजार से सभी rट ॉक को वापस लगेा; और iii. -वpा-पत सामfी पर 4दिशत(cid:4) -विश-‘य0 म7 पaरवतन(cid:4) करेगा। (ख) उपभोक्त ाओं के लाभ के िलए, दो माह के भीतर अनुpाधारक का नाम, jा"ड का नाम, मॉडल का नाम अथवा मॉडल सं(cid:130) या, 4तीक िचe और अhय -विनद~श (cid:21)कसी दैिनक राcx Qय अथवा (cid:7)ेSीय समाचार पS अथवा इल(cid:27)ेx ॉिनक अथवा यथोिचत (cid:21)कसी अhय रQित से 4कािशत करेगा। (ग) संबंिधत रा(cid:129)य नामिन(cid:21)द(cid:4)cट एज7सी को अिधिनयम, क> धारा 27 के अधीन अनुpाधारक और Pय ापारQ के -व5(cid:131) hय ायिनणय(cid:4) न कार(cid:4)वाई करने के िलए सूिचत करेगा।

NOTIFICATION New Delhi, the 5th October, 2015 No. BEE/S&L/Ref/70/2015-16.—The following draft of certain regulations, which the Bureau, with the previous approval of the Central Government, proposes to make in exercise of the powers conferred by clause (d) of

section 14 read with clause (i) of sub-section (2) of section 58 and clause (n) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), is hereby published as required by sub-section (1) of section 58 of the said Act for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of forty-five days from the date on which copies of this notification as published in the Official Gazette are made available to the public;

Objections or suggestion, if any, may be addressed to Director-General of Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhavan, R.K.Puram, Sector-1, New Delhi-110 066;

Any objection or suggestion which may be received from any person with respect to the said draft regulations before the expiry of the aforesaid period shall be taken into consideration by the Bureau.

Draft Regulations

1. Short title and commencement.-(1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Household Direct Cool Refrigerators) Regulations, 2015.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. Definition.- (1) In these regulations, unless the context otherwise requires,-

(a) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “direct cool refrigerators” means an appliance as specified in the notification under clause (b) of section 14 of the Act;

(c) “Form” means a form appended to these regulations;

(d) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon, direct cool refrigerator;

(e) “label period” means the validity period of the comparative electricity consumption under energy consumption standard specified by the Central Government under clause (a) of section 14 and in case the end period of the validity period of the comparative electricity consumption is not specified, it shall be deemed to be valid until new values for the same are specified by the Central Government;

(f) “models or family of models” means the model or range of models of one particular brand, to which a single set of test reports is applicable and where each of the models has the same physical characteristics, annual electricity consumption, energy efficiency level and performance characteristics;

(g) “permitee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(h) “star rating or star level” means the grade of energy efficiency displayed on the label of the direct cool refrigerator based on energy consumption standard notified by the Central Government under clause (a) of

section 14 of the Act to denote the comparative electricity consumption of direct cool refrigerator;

(i) “trader or seller” in relation to any labelled direct cool refrigerator means a person who sells or distributes any such direct cool refrigerator and includes the shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such direct cool refrigerator.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on the label.- (1) On every direct cool refrigerator, the following particulars shall be displayed on its label, namely:-

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand:

(c) appliance type:

(d) rated Gross Volume;

(e) rated Storage Volume;

(f) model number and year of manufacturing or import;

(g) unique series code;

(h) electricity consumption in units per year;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 21

(i) star level; and

(j) label period.

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.- (1) A label containing all the particulars specified in regulation 3 shall be displayed on every direct cool refrigerator within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of the revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller shall ensure that-

(a) the stock of direct cool refrigerators available in the market with pre-revised label displaying the star level is fully exhausted or re-labeled or withdrawn from the market before the date from which the revised star level comes into force;.

(b) the direct cool refrigerator put on sale shall also display revised star level and revised label period synchronizing with the revised energy consumption standards and introduce revised label period three months prior to such commencement.

(c) all the preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers shall be well planned and taken six months in advance of the date of such commencement under these regulation.

5. Manner of display of label.-(1) On every direct cool refrigerator, shall be displayed label at the point of sale and such label shall be affixed on the direct cool refrigerator in the following manner, namely:-

(a) self-adhesive label affixed on the front side of the upper right portion of direct cool refrigerator;

(b) self-adhesive label affixed on the front side of the carton box.

(2) For direct cool refrigerator not on display, the label may be affixed to the exterior of the packing and the label may be attached to the unit when put on sale.

6. Permission for display of label.- (1) No star label shall be affixed on a direct cool refrigerator without obtaining the prior permission of the Bureau.

(2) For the purpose of obtaining permission of the Bureau under sub-regulation (1), an application shall be made in Form-I and in electronic form:

Provided that separate application shall be made for each model of direct cool refrigerator.

(3) Every application under sub-regulation (2) shall be accompanied by –

(a) an application fee of two thousand rupees shall be payable by demand draft in favour of Bureau of Energy Efficiency, New Delhi or by any acceptable electronic mode of payment;

(b) a label security deposit of one lakh rupees payable by demand draft in favour of the Bureau of Energy Efficiency, New Delhi; or by any acceptable electronic mode of payment:

Provided that in case of small scale industry, label security fee shall be only twenty five thousand rupees ; and

(c) documents specified in Form-1.

7. Grant of permission.- (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period of one month from the date of such receipt, grant, subject to such terms and conditions as specified in regulation 8, permission for affixing label on direct cool refrigerator in Form II or in electronic form.

(2) The Bureau shall maintain a register in Form-III and enter the name of the permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 is in force.

(4) An application for renewal of permission shall be made by the permittee from six months but not later than three months before its expiry and shall be accompanied by a fee of one thousand rupees payable in the form of demand draft or electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall submit fresh application.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the direct cool refrigerator from the date from which the revised star level comes into force shall submit only a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the direct cool refrigerator is planned to be launched to synchronisize with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely:-

(a) the star level displayed on the label of direct cool refrigerator shall conform to energy consumption standards for direct cool refrigerator notified by the Central Government under clause (a) of section 14 of the Act;

(b) the label shall be affixed only on such model of direct cool refrigerator for which permission has been granted;

(c) the label shall be printed and affixed on the direct cool refrigerator at the cost of permittee;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of direct cool refrigerator shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers and sellers appointed to sell their labelled products by 30th day of April of each year;

(h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Manual on Standard and Labelling.

9. Label fee.- (1) Every permittee shall pay to the Bureau a label fee of five rupees for each label affixed on the direct cool refrigerator.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date

of closure of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit made under clause (b) of sub- regulation (3) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of label security fee.- Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture direct cool refrigerator.

11. Verification by the Bureau.- (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the direct cool refrigerator conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purpose of verification, samples shall be picked up at random by Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the direct cool refrigerator in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration laboratories (NABL) , a notice shall be issued to the permittee for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau, and if the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 23

(4) Where samples of direct cool refrigerator used for testing fails the test during suo motu testing or challenge testing, the permittee shall be afforded another opportunity and the Bureau shall conduct second test with twice the quantity of direct cool refrigerator used in the first test in an independent test laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL) at the cost of the permittee.

(5) Where the second test fails, the Bureau shall,-

(a) direct the permittee in Form V, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label of the direct cool refrigerator or remove the defects and deficiencies found during the testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months;

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(6) The permittee shall within ten days of the conclusion of the period of two months referred to in sub- regulation (5),- a) send the compliance report in Form VI to Bureau with respect to action taken in compliance with the direction; and b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non- compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause

(b) of sub-regulation (6) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.

(8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall,-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (6) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as deemed fit within two months;

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission.- The Bureau may cancel the permission granted under regulation 7, if the permittee –

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(c) does not comply with the direction issued under regulation 11.

1. Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their display on Label of Household Direct Cool Refrigerators) Regulations, 2015, the Bureau hereby permits you to affix label as per details of approvals set out in the Annexure to this Form II.

2. This permission is subject to—

(a) the star level displayed on the label of the direct cool refrigerator shall conform to energy consumption standards for direct cool refrigerator notified under clause (a) section 14 of the Act and terms and conditions provided in the aforesaid regulations;

(b) the label shall be affixed only on such model of direct cool refrigerator for which permission has been granted;

(c) the label shall be printed and affixed on the direct cool refrigerator at the cost of the permittee;

(d) the permittee shall ensure that the star level displayed on the direct cool refrigerator shall be maintained at all time;

(e) the permittee shall pay the labeling fee of five rupees per label;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labeled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year. The same details shall be furnished to the Bureau also through automated systems;28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(g) the permittee shall make available such other details of direct cool refrigerator as and when sought by the Bureau for which the permission has been granted.

3. This permission shall be valid from ............................... to .............................and may be renewed as prescribed. The permittee shall not withdraw the direct cool refrigerator from the market during the validity period of permission except with the prior approval of the Bureau.

4. The unique label series code assigned by BEE for the equipment is............. and should appear on the label as per the approved design.

5. Where the star level plan on review is modified by the Bureau, the star level of the direct cool

refrigerator shall stand modified as follows:-

(a) If new model is launched synchronizing with the revised star level, an application for such permission shall be made to Bureau six months in advance of the date from which new star level comes in to force;

(b) Where the existing model is continued to give effect to the modified star level, only a declaration in Form IV shall be submitted to the Bureau.

The Bureau through its aforesaid Verification Agency had transported the sample referred to in para 2 to M/s. ..................., a NABL accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 4 and 5 of S.O.number ……dated the …. for giving Test Report in accordance with the Form ….given in Annexure to S.O.. number…….. dated the ……..

4. The results of the Test Report on the sample bearing Unique Identification serial number is enclosed. The results of the Test Report indicated that the sampled Household direct cool Refrigerators failed to meet the electricity consumption in units per year, standard, specified gross volume and storage volume etc. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the Household direct cool Refrigerators manufactured/imported by you. The Test Results were sent to you vide BEE letter No. ………....... dated....................in the name of your authorised Contact person. You were also requested to attend and witness the Second Check Verification Test of the samples at the NABL Accredited Laboratory M/s. ...................................................

5. The Sample for second check verification Test were picked up …. dated the …. through our authorised Agency M/s. ............and transported to the NABL accredited Laboratory transported by our authorised Agency, duly sealed by M/s............... and was given Unique Identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification Agency as well as your representatives.

6. The Test results of second check testing are enclosed which are dully checked and counter signed by the competent authorised personnel of the NABL Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing. The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O.number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Household Direct Cool Refrigerators manufactured/imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Household Direct Cool Refrigerators) Regulations, 2015, the Bureau hereby directs to :-

(i) correct the star level displayed on the label of the Household direct Cool Refrigerators or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by ...............

In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b) of sub-regulation (6) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Household Direct Cool Refrigerators) Regulations, 2015.

9. The Bureau shall take further follow up action in the matter in terms of regulations (5) (6)(7) and (8) of regulation 11 of the Bureau of Energy Efficiency( Particulars and Manner of their Display on Labels of Household Direct Cool Refrigerators) Regulations, 2015.
