NOTIFICATION

Whereas the draft of the following rules further to amend the Karnataka Excise (Manufacture of Wine) Rules, 2008, was published as required by sub-section (1) of Section 71 of the Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966) in Notification No: FD 11 PES 2024, dated: 13.08.2025 in Part-IVA of the Karnataka Gazette (Extraordinary) No.473 dated:

13.08.2025 inviting objections and suggestions from all persons likely to be affected within fifteen days from the date of its publication in the official Gazette.

And, whereas the said Gazette was made available to the public on 13th August, 2025.

And, whereas no objections and suggestions were received in respect of the said draft by the State Government.

Now, therefore, in exercise of the powers conferred by Section 71 of the Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966), the Government of Karnataka hereby makes the following rules, namely:- RULES

1. Title and commencement:- (1) These Rules may be called the Karnataka Excise (Manufacture of Wine) (Amendment) Rules, 2025.

(2) They shall come into force from the date of their final publication in the Official Gazette.

2. Amendment of rule 3:- In the Karnataka Excise (Manufacture of Wine) Rules, 2008 (hereinafter referred to as the said rules), in Rule 3-

(i) in sub-rule (1), for the words “Deputy Commissioner of the concerned district where the proposed Winery is to be located”, the words “Excise Commissioner” shall be substituted.

(ii) in sub-rule (4), for the words “Deputy Commissioner”, the words “Excise Commissioner” shall be substituted.

3. Amendment of rule 6:- In rule 6 of the said rules-

(i) in sub-rule (1), for the words “Deputy Commissioner”, the words “Excise Commissioner” shall be substituted.

(ii) in sub-rule (2), for the words “Deputy Commissioner”, the words “Excise Commissioner” shall be substituted.

4. Amendment of rule 7:- In rule 7 of the said rules, for the words “Deputy Commissioner of the district”, the words “Excise Commissioner” shall be substituted.

5. Amendment of rule 8:- In rule 8 of the said rules, for the words “Deputy Commissioner of the district”, the words “Excise Commissioner” shall be substituted.

6. Amendment of rule 9:- In rule 9 of the said rules-

(i) in sub-rule (4) for the words “Deputy Commissioner”, the words “Excise Commissioner” shall be substituted.

(ii) in sub-rule (6) for the words “Deputy Commissioner”, the words “Excise Commissioner” shall be substituted.

(iii) in sub-rule (10) for the words “Deputy Commissioner”, the words “Excise Commissioner” shall be substituted.

7. Amendment of rule 10:- In rule 10 of the said rules, for the words “Deputy Commissioner of the district”, the words “Excise Commissioner” shall be substituted.

8. Amendment of rule 10-A:- In rule 10-A of the said rules, for the words “Deputy Commissioner”, the words “Excise Commissioner” shall be substituted.

9. Amendment of rule 11:- In rule 11 of the said rules-

(i) in sub-rule (2) in clause (ii), for the words “Deputy Commissioner”, the words “Deputy Commissioner of Excise” shall be substituted.3

(ii) in sub-rule (4), for the words “Deputy Commissioner”, the words “Deputy Commissioner of Excise” shall be substituted.

(iii) in sub-rule (5), for the words “Deputy Commissioner”, in two places where they occur, the words “Deputy Commissioner of Excise” shall be substituted.

10. Amendment of rule 12:- In rule 12 of the said rules, for the words “Deputy Commissioner”, the words “Excise Commissioner” shall be substituted.

11. Amendment of rule 14:- In rule 14 of the said rules, in sub-rule (2) for the words “Deputy Commissioner”, the words “Excise Commissioner” shall be substituted.

12. Amendment of Form F.W.1:- In Form F.W.1 of the said rules, for the words, “The Deputy Commissioner, ………………District” the words “The Excise Commissioner in Karnataka, Bengaluru” shall be substituted.

13. Amendment of Form F.W.1-A:- In Form F.W.1-A of the said rules, for the words, “The Deputy Commissioner, ………………District” the words “The Excise Commissioner in Karnataka, Bengaluru” shall be substituted.

14. Amendment of Form F.W.2:- In Form F.W.2 of the said rules-

(i) in Condition Numbers (2),(5),(7),(12),(14) & (15), for the words “Deputy Commissioner”, wherever they occur, the words “Excise Commissioner” shall be substituted.

(ii) for the words, “Deputy Commissioner”, occurring at the end, the words “Excise Commissioner” shall be substituted.
