NOTIFICATION The draft of the following rules further to amend the Karnataka Motor Vehicle Rules, 1989 which the Government of Karnataka proposes to make in exercise of the powers conferred by section 176 read with section 212 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988) is hereby published as required by sub-section (1) of

section 212 of the said Act, for the information of all the persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after thirty days from the date of its publication in the Official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect to the said draft before the expiry of the period specified above will be considered by the State Government. Objections and Suggestions may be addressed to the Secretary to Government, Transport Department, Room No. 153, Ground Floor, MS Building, 3rd Gate, Bengaluru-560 001.

DRAFT RULES

1. Title and Commencement.-(1) These rules may be called, the Karnataka Motor Vehicles (Amendment) Rules, 2023.

(2) They shall come into force from the date of their final publication in the Official Gazette.

2. Insertion of new rule 200A.- In the Karnataka Motor Vehicles Rules, 1989, after rule 200 the following shall be inserted, namely:- “200A, Levy of fine and penalty through Electronic Enforcement Device.- In addition to the Check Report (C.R) and Check Report Cum Receipt (C.R.R) issued at the time of levying fines and penalties under

section 200 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988), an Officer notified by the State Government is authorised to levy, collect fine and penalty through e-Challan using an Electronic Enforcement Device.

Note: “An `Electronic Enforcement Device’ shall have the same meaning as assigned to it in rule 167A of the Central Motor Vehicles Rules, 1989.” By order and in the name of the Governor of Karnataka (PUSHPA .V.S) Under Secretary to Government, Transport Department.
