(1) के अधीन यथा अपेजक्षत, जनम् नजलजखत प्रारूप जिजनयमों को लोक परामि ाके जलए प्रकाजित दकया गया था, अथाात्, (क) तारीख 10 िलु ाई, 2025 की अजधसूचना संख्या 5506/बीईई/एसएंडएल/एएल/2025-26 द्वारा ऊिाा दक्षता ब्यरू ो (उपकरण लेबललंग) जिजनयम, 2025;

और उि प्रारूप जिजनयमों की प्रजतयां 16 िुलाई, 2025 को िनसाधारण को उपलब्ध कराई गई थीं; और उि प्रारूप जिजनयमों के संबंध में प्राप्त सुझािों पर जिचार दकया गया ि;ै अत:, अब, ब्यूरो, केन्‍द रीय सरकार के पूि ा अनुमोदन से, ऊिाा संरक्षण अजधजनयम, 2001 (2001 का

52) की धारा 58 की उप-धारा (2) के खंड (i) और (ठ) द्वारा प्रदि िजियों का प्रयोग करते हुए और इन जिजनयमों की अनुसूची-घ में जिजनर्दाष्ट जिजनयमों को उन बातों के जसिाय अजधिांत करत े हुए, जिन्‍द ि ें ऐसे अजधिमण से पूिा दकया गया ि ै अथिा करने का लोप दकया गया िै, जनम्नजलजखत जिजनयम बनाता ि,ै अथाता ्:

जिजनयम अध्य ाय I साधारण

1. सजं क्षप्त नाम और प्रारंभ- (1) इन जिजनयमों का संजक्षप् त नाम ऊिाा दक्षता ब्यरू ो (उपकरण लेबललंग और अनुपालन) जिजनयम, 2026 ि।ै

(2) ये जिजनयम 1 िनिरी 2026 को प्रिृत्त िोंगे।

2. पररभाषाए-ँ (1) इन जिजनयमों में, िब तक दक संदभा से अन्‍दयथा अपेजक्षत न िो:[भाग III—खण् ड 4] भारत का रािपि : असाधारण 3 (क) “अजधजनयम” से ऊिाा संरक्षण अजधजनयम, 2001 (2001 का 52) अजभप्रेत ि;ै (ख) "मूल देि" से िि देि अजभप्रेत ि ै ििां उपकरण अथिा उपस्ट्क र जिजनर्मात, एसेंबल अथिा पयााप्त त: संसाजधत दकए गए ि,ैं और इसके कुछ घटकों की उत्पजि पर ध् यान निीं ददया िाएगा। (ग) “पृष ठांकन लेबल” िि जचह्न ि ै िो यि आश्वस्ट्त करते हुए, दकसी उपकरण अथिा यंि की दक्षता की गारंटी देता िै, दक संबंजधत उपकरण अथिा उपस्ट्क र, उस उपकरण अथिा उपस्ट्क र के जलए जनर्दाष्ट रेटटंग प्रणाली में जिजनर्दाष्ट न्‍दयूनतम ऊिाा प्रदिान मानकों को पूरा करता िै, तथा यि संभाजित िेताओं को सूजचत करता ि ै दक उि उत्पाद अपनी श्रेणी के जलए ऊिाा दक्ष ि।ै (घ) "लेबल" से इन जिजनयमों की अनुसूची ग में जनर्दाष्ट दकसी उपकरण अथिा उपस्ट्क र पर जचपकाई गई अथिा प्रदर्िात मुदरत सामग्री अजभप्रेत ि;ै (ङ) "लेबल श्रृंखला" से जनर्दाष्ट उपकरण अथिा उपस्ट्क र के ऊिाा प्रदिान मानक की जिजधमान्‍द यता अजभप्रेत ि;ै (च) "आज्ञाजपत उपकरण अथिा उपस्ट्क र" में, इन जिजनयमों की अनुसूची क के अधीन जनर्दाष्ट उपकरण अथिा उपस्ट्क र सजम्मजलत िोंगे। (छ) “अनुज्ञजप्तधारी” से ऐसा कोई व्यजि अजभप्रेत ि ै िो इन जिजनयमों की अनुसूची-क तथा अनुसूची-ख में जिजनर्दाष्ट दकसी उपकरण अथिा उपस्ट् कर का व्यिसाय करता िो और जिसे ब्यूरो द्वारा दकसी उपकरण अथिा उपस्ट्क र पर लेबल जचपकाने की अनुमजत प्रदान की गई िो। (ि) "व्यजि" स े कोई व्यजि, संघ अथिा व्यजियों के जनकाय, साझेदारी फम,ा सीजमत दने दारी साझेदारी और कंपनी अजभप्रेत ि ै और िि इसमें सजम्मजलत ि,ै चाि े जनगजमत िो अथिा न िो;

(झ) "अनुसूची" स े इन जिजनयमों के साथ संलग्न अनुसूजचयां अजभप्रेत ि;ैं (ञ) "स्ट्टार रेटटंग अथिा स्ट्टार लिे ल" स े अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा िारी उनकी संबंजधत अजधसूचना के आधार पर उपकरण अथिा उपस्ट्क र के लेबल पर प्रदर्िात ऊिाा प्रदिान का स्ट्तर अजभप्रेत ि।ै (ट) "राज्य पदाजभजित अजभकरण" से अजधजनयम की धारा 15 के खंड (घ) के अधीन पदाजभजित कोई अजभकरण अजभप्रेत ि।ै (ठ) "स्ट्िैजछछक उपकरण अथिा उपस्ट्क र" में इन जिजनयमों की अनुसूची ख के अधीन जनर्दाष्ट उपकरण अथिा उपस्ट्क र सजम्मजलत िोंगे।

(2) ऐसे िब् द और पद, िो यिां प्रयुक् त ि ैं और पररभाजषत निीं ि,ैं ककंतु अजधजनयम म ें पररभाजषत ि,ैं उनके ििी अथा िोंगे िो उनके अजधजनयम में ि।ैं4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] अध्याय II उपकरण लेबललंग और रजिस्ट्टडा करण

3. इन जिजनयमों की अनसु ूची क और अनुसचू ी ख म ें यथा जनर्दाष्ट दकसी उपकरण अथिा उपस्ट्क र पर ब्यरू ो की पूि ा जलजखत अनुमजत के जबना कोई लेबल निीं लगाया िाएगा।

4. लबे ल प्रदिना की अनमु जत िते ु आिदे न- (1) इन जिजनयमों की अनुसूची क में जनर्दष्टा उपकरणों अथिा उपस्ट्क रों का जिजनमााण अथिा जििय अथिा आयात करने िाली प्रत्येक कंपनी को ब्यूरो के साथ रजिस्ट्टडा करण कराना और पांच ििार रुपय े के एकबारगी आिेदन फीस सजित आिेदन प्रस्ट्तुत करना िोगा।

(2) इस जिजनयम के उप-जिजनयम (1) के अधीन रजिस्ट्टडा फीस को, प्रत्येक उपकरण अथिा उपस्ट्क र के रजिस्ट्टडा करण िते ु पृथक् रूप से आिेदन करना िोगा और आिेदन, प्रजत उपकरण अथिा उपस्ट्क र तीन लाख रुपये की लेबल प्रजतभूजत िमा राजि के साथ प्रस्ट्ततु दकया िाएगा:

परन्‍दतु लघु उद्योग के मामल े में, लेबल प्रजतभूजत िमा राजि माि पचास ििार रुपए िोगी।

(3) इस जिजनयम के उप-जिजनयम (1) के अधीन रजिस्ट्टडा दकसी कंपनी को, उपकरण अथिा उपस्ट्क र के प्रत्येक मॉडल का रजिस्ट्टडा करण कराना िोगा और आिदे न, प्रजत आिेदन पाँच ििार रुपये के मॉडल रजिस्ट्टडा करण फीस के साथ प्रस्ट्तुत दकया िाएगा:

परंतु कोई कंपनी िो अनसु चू ी-ख में जिजनर्दाष्ट उपकरणों अथिा उपस्ट्क रों का जिजनमााण अथिा आयात अथिा जििय करती ि,ै अपनी कंपनी तथा अपने उपकरणों अथिा उपस्ट्क रों का प्रचालन मैनुअल में जिजनर्दाष्ट प्रदिया के अनुसार रजिस्ट्टडा करण कराएगी।

5. अनमु जत प्रदान करना- (1) ब्यूरो, आिेदन प्राप्त िोन े की जतजथ स े अजधकतम तीस काया ददिसों की अिजध के भीतर, इन जिजनयमों के जिजनयम 16 के अधीन प्रचालन मैनुअल में जनधााररत प्रदिया के अनुसार, इन जिजनयमों के जिजनयम 4 के अधीन प्राप्त आिेदनों की संिीक्षा पूरी करेगा। परंतु ऐसे मामलों में ििां प्राप्त आिेदनों में जिसंगजतयां पाई िाती ि,ैं ब्यूरो इन आिेदनों को अिलंजबत रखेगा और आिेदकों को उपयुि कारािाई करने के जलए अजधकतम 60 (साठ) ददन की अिजध प्रदान करेगा, जिसमें जिफल रिन े पर आिेदन रद्द कर ददया िाएगा।

(2) इस बात से सतं ुष्ट िोने के बाद दक इन जिजनयमों के जिजनयम 4 के अधीन प्राप्त आिेदन इन जिजनयमों में जनर्दाष्ट सभी अपेक्षाओं का अनुपालन करत े ि,ैं ब्यरू ो: क) कंपनी और उपकरणों अथिा उपस्ट्क रों को रजिस्ट् टर करेगा;

ख) अनुमत मॉडलों पर तीन िषा की अिजध के जलए लेबल जचपकाने की अनुमजत प्रदान करेगा; ग) अनुज्ञजप्तधारी रजिस्ट्टर में प्रजिजष्टया ं करेगा।[भाग III—खण् ड 4] भारत का रािपि : असाधारण 5

(3) अनुमत मॉडल पर लेबल जचपकाना िारी रखने की अनुमजत को निीकृत करन े के जलए, प्रत्येक अनुज्ञजप्तधारी, ब्यरू ो को, पिू ा में प्रदान की गई ऐसी अनुमजत की समाजप्त स े पिले, एक आिेदन प्रस्ट्तुत करेगा। निीकरण आिेदन, आिेदन की प्राजप्त की जतजथ स े तीस ददन की अिजध के भीतर संसाजधत दकया िाएगा:

परंतु ऐसे अनुमत मॉडल पर लेबल जचपकाने के निीकरण के जलए अथिा इसे िारी रखन े के जलए, ििां स्ट्टार रेटटंग अथिा पृषठ ांकन लेबल को संिोजधत दकया गया िो अथिा मौिूदा स्ट्टार रेटटंग योिना अथिा पृषठ ांकन लेबल, िैसा भी मामला िो, को िारी रखने के जलए, कोई फीसदेय निीं िोगा।

(4) यदद अनुमजत अिजध की जिजधमान्‍द यता के दौरान ऊिाा प्रदिान मानकों को संिोजधत दकया िाता ि,ै तो ब्यूरो अनुज्ञजप्तधारी को संिोजधत ऊिाा प्रदिान मानकों की सूचना देगा। ऐसी सूचना प्राप्त िोने पर, अनुज्ञजप्तधारक अजधसूचना की जतजथ स े साठ ददन की अिजध के भीतर अथिा लेबल श्रृंखला म ें उजल्लजखत जिजधमान्‍द यता अिजध स े पिले ब्यूरो को एक स्ट्ि-घोषणा फॉम ा प्रस्ट्तुत करेगा, िो संिोजधत ऊिाा प्रदिान मानकों के अनुपालन और संिोजधत मानकों को दिााने िाल े लेबल को जचपकान े की पुजष्ट करे।

(5) यदद अनुज्ञजप्तधारी जनम्नजलजखत का पालन करन े में जिफल रिता ि ै तो, ब्यूरो लेबल जचपकाने के जलए दी गई अनुमजतयों को रद्द कर सकता ि:ै (क) अनुसूची-क तथा अनुसूची-ख के अधीन आने िाले उपकरण अथिा उपस्ट्क र के संबंध में, अजधजनयम के अधीन जनधारा रत जिजिष्ट ऊिाा प्रदिान मानकों का अनपु ालन करना;

(ख) इन जिजनयमों के अधीन लेबल के प्रदिान की जिजध का उपबंध करन े िाले जिजनयम 7 के उपबंध का अनुपालन करना; (ग) इन जिजनयमों के जिजनयम 9 के अधीन यथा जनधााररत लेबल फीसका भुगतान करना; (घ) केिल अनुमत मॉडलों पर िी लेबल जचपकाना;

(ङ) यि सुजनजित करना दक जचपकाए गए लेबल सुपाठ्य िों और उनका उजचत रख-रखाि दकया गया िो; (च) प्रत्येक िषा 30 अप्रैल तक प्राजधकृत जििेताओं की अद्यतन सूची उपलब्ध कराना; (छ) मानक एिं लेबललंग संबंधी प्रचालन मैनुअल में यथा जिजनर्दाष्ट अन्‍दय जनबंधन एिं ितों का अनुपालन करना;

(ि) इन जिजनयमों के अध्याय III में यथा जिजनर्दाष्ट जनदेिों का अनुपालन करना : परंतु अनुज्ञजप्तधारी को सनु िाई का उजचत अिसर ददए जबना कोई अनुमजत रद्द निीं की िाएगी।

6. लबे ल पर प्रदर्िता दकए िान े िाले जििरण - इन जिजनयमों की अनुसचू ी क में जनर्दाष्ट प्रत्येक उपकरण अथिा उपस्ट्क र पर, इसके लेबल पर जनम्नजलजखत जििरण प्रदर्िात दकए िाएंगे, अथाात्: - (क) उपकरणों अथिा उपस्ट्क रों के नाम;

(ख) ब्ांड का नाम;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ग) मॉडल संख्या; (घ) ऊिाा प्रदिान पैरामीटर; (ङ) लेबल श्रृंखला; (च) रेटेड क्षमता/आउटपुट (िैसा लाग ू िो); (छ) स्ट्टार स्ट्तर अथिा पृषठ ांकन। (ि) उत् पजि का देि (झ) ऊिाा दक्षता बयूरो का लोगो (ञ) इन जिजनयमों की अनसु ूची ग म ें यथा जनर्दाष्ट कोई अन्‍दय उपकरण अथिा उपस्ट्क र जिजिष्ट मापदंड।

7. लबे ल के प्रदिना की पद्धजत- (1) इन जिजनयमों की अनुसूची क तथा अनसु ूची ख में यथा जनर्दाष ट प्रत्येक उपकरण अथिा उपस्ट्क र पर, उस उपकरण अथिा उपस्ट्क र के जलए, इन जिजनयमों की अनुसचू ी ग में जनर्दाष ट प्रदिया के अनुरूप, इन जिजनयमों के जिजनयम 6 के अधीन अपेजक्षत जििरण के साथ एक त्िररत प्रजतदिया कोड सजित लेबल लगा िोगा।

(2) अनुज्ञजप्तधारी सुजनजित करेगा दक लेबल: (क) सिि रूप से ददखाई दे; और (ख) प्रत्येक रजिस्ट्ट डा यूजनट अथिा मॉडल पर ऑनलाइन और ऑफलाइन दोनों जििय लबंद ु पर ददखाई दे;

(3) स्ट्टार लेबल को रजिस्ट् टडा मॉडल की प्रत्येक यूजनट के पैकेलिंग बॉक्स पर मुदरत अथिा जचपकाया िाए।

(4) लेबल का जडजाइन, रंग, आकार, सामग्री और स्ट्थान इन जिजनयमों की अनुसचू ी ग में जनर्दाष्ट अनुसार िोगा।

(5) त् िररत प्रजतदिया कोड सजित लेबल स्ट्ियं जचपकने िाले पदाथा का िोगा।

(6) इन जिजनयमों की अनुसचू ी ग के उपबंध के अनसु ार अपेजक्षत जचह्नांकन सुपाठ्य, अजमट और स्ट्थ ायी िोंगे। त् िररत प्रजतदिया कोड को सबं ंजधत उपकरण (उपकरणों) के स्ट्टार लेबल के बगल में रखा िाएगा और त् िररत प्रजतदिया कोड के आयाम, न्‍दयूनतम आधार पर, इन जिजनयमों की अनुसूची ग में जनर्दष्टा अनुसार िोंगे।

8. लबे ल के प्रदिना के जलए समय सीमा- (1) स्ट्िैजछछक व्यिस्ट्था से अजनिाया व्यिस्ट्था में पारगमन करत े समय, इन जिजनयमों के प्रितान की जतजथ से छि माि की अिजध के भीतर, इन जिजनयमों की अनसु ूची-क में यथा जिजनर्दाष्ट प्रत्येक उपकरण अथिा उपस्ट्क र पर, जिजनयम 6 एिं 7 के उपबंध के अनुसार एक लेबल प्रदर्िात दकया िाएगा।

(2) दकसी उपकरण अथिा उपस्ट्क र के जलए ऊिा ा प्रदिान मानकों के पुनरीक्षण दकए िान े और उनके प्रभािी[भाग III—खण् ड 4] भारत का रािपि : असाधारण 7 िो िान े पर, अनुज्ञजप्तधारी ––– (क) समाप्त िो चकु े मानकों के अधीन आने िाल े उपकरणों अथिा उपस्ट्क र का उत्पादन बदं कर देगा;

और (ख) तैयारी संबंधी उपाय (डीलर िागरूकता एिं उपभोिा जिक्षा) करेगा।

(3) डमी जडस्ट्प्ल े यूजनट के जलए, डमी यूजनटों पर जिजिषट मॉडल के अनुरूप स्ट्टार लेबल की एक डुजप्लकेट अथिा प्रजतकृजत दिाायी िाएगी। लेबल पर स्ट्पष्ट रूप से "डमी" िब्द अंदकत िोगा तादक यि इंजगत दकया िा सके दक यि मूल लेबल निीं ि।ै

9. लबे ल फीस - (1) प्रत्येक अजनिाया उपकरण अथिा उपस्ट्क र के जलए, अनुज्ञजप्तधारी ब्यूरो को, समय-समय पर यथा संिोजधत, अनुसूची क के अनुसार लेबल फीस का भगु तान करेगा।

(2) प्रत्येक स्ट्िैजछछक उपकरण अथिा उपस्ट्क र के जलए, अनुज्ञजप्तधारी ब्यूरो को, अनसु ूची ख के अनसु ार लेबल फीस का भुगतान करेगा।

(3) उपयुाक् त उप-जिजनयम (1) और (2) के अधीन जनर्दाष्ट लेबल फीस का भुगतान जििीय िषा की प्रत्यके जतमािी के समाजप्त जतजथ स े तीस ददन की अिजध के भीतर िैमाजसक रूप से दकया िाएगा।

(4) अनुज्ञजप्तधारी ब्यूरो को एक जििरण प्रस्ट्तुत करेगा जिसमें जििीय िष ा की प्रत्येक जतमािी की समाजप्त जतजथ स े तीस ददन की अिजध के भीतर लेबल दकए गए उपकरणों अथिा उपस्ट्क रों के उत्पादन और प्रत्यके जतमािी के जलए देय उपार्िात लेबललंग फीस के ब् यौरे सजम्मजलत िोंगे और प्रत्येक जििीय िष ा की समाजप्त जतजथ से दो माि की अिजध के भीतर ब्यरू ो को चाटाडा एकाउंटेंट द्वारा जिजधित प्रमाजणत उत्पादन डेटा का पुनर्मला ान प्रस्ट्तुत दकया िाएगा। परंतु इस जिजनयम के अधीन जनर्दाष्ट अिजध के भीतर लबे ल फीस का भुगतान करने में जिफल रिन े पर, ब्यूरो, देय राजि की जिजनयम 4 के अधीन दकए गए लेबल प्रजतभूजत िमा से प्रजत िषा दस प्रजतित की दर स े ब्याि सजित िसूली कर लगे ा और यदद प्रस्ट्त ुत करने की अंजतम जतजथ स े एक िषा की अिजध के भीतर पूणा लेबललंग फीस की िसूली निीं की िाती तो, ब्यरू ो अनज्ञु जप्तधारी को प्रदान दकए गए सभी लेबलों को रद्द कर देगा और अनुज्ञजप्तधारी का नाम समाचार पिों में चूककता ा के रूप में प्रकाजित दकया िाएगा।

(5) 1 अप्रैल, 2027 और उसके पश् चात् से, अनुज्ञजप्तधारी द्वारा त् िररत प्रजतदिया कोड की मांग करते समय, ऊिाा दक्षता ब्यूरो के िेब पोटाल, अथाात्, मानक और लेबललंग िेब पोटाल पर प्रीपेड लेबल फीसदेय िोगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु, ब्यूरो के िेब पोटाल पर उपयुाि प्रीपेड लेबल फीस तंि के अभाि में, इन जिजनयमों के उप-जिजनयम

(3) और (4) प्रिृत्त रिगें े।

10. लेबल प्रजतभूजत िमा की िापसी - (1) जिजनयम 4 के उपबंध के अधीन, अनुज्ञजप्तधारी, यथाजस्ट्थजत, अजनिाय ा अथिा स्ट्िैजछछक उपकरण अथिा उपस्ट्क र के जिजनमााण को समाप्त दकए िान े पर, ब्याि-मुि लेबल सुरक्षा िमा राजि की िापसी का िकदार िोगा।

(2) यथाजस्ट्थजत, अनुज्ञजप्तधारी द्वारा ब्यरू ो को ऐस े जिजनमााण को स्ट्थायी रूप स े बंद दकए िाने की जलजखत सचू ना प्रस्ट्तुत दकए िाने की तारीख से तीस ददन की अिजध के भीतर, ब्यरू ो द्वारा अनुज्ञजप्तधारी को प्रजतभूजत िमा राजि िापस लौटा दी िाएगी।

11. भुगतान की पद्धजत - सभी भुगतान स्ट्िीकाया भुगतान पद्धजत के माध्यम से दकए िाएंगे, जिनमें पिले से िी जिद्यमान भुगतान पद्धजतयों के अजतररि इलेक्रॉजनक पद्धजत के माध्यम से दकया गया भुगतान भी सजम्मजलत िोगा। अध्याय - III लबे ललंग अनपु ालन और प्रितना

12. ब्यूरो द्वारा अनुपालन सत्यापन - ब्यरू ो अथिा राज्य पदाजभजित अजभकरण, दकसी उपकरण अथिा उपस्ट्क र द्वारा इन जिजनयमों के अधीन जिजनर्दाष्ट अपेक्षाओं का अनुपालन सुजनजित करने के जलए, यथािश्यक अंतराल पर, जनम्नजलजखत दकसी भी पद्धजत से सत्यापन करेगी, अथाात ् :– (क) इन जिजनयमों के जिजनयम 13 के अधीन यथा जिजनर्दाष ट लेबल सत्यापन;

(ख) इन जिजनयमों के जिजनयम 14 के अधीन यथा जिजनर्दाष ट परीक्षण िाँच; (ग) ब्यूरो द्वारा अनुपालन को सत्याजपत करन े के जलए आिश्यक मानी गई कोई अन्‍द य उजचत जिजध।

13. लबे ल सत्यापन- (1) ब्यूरो अथिा राज्य पदाजभजित अजभकरण, ई-कॉमसा प्लेटफॉमा माध् यम सजित ऑफलाइन अथिा ऑनलाइन पद्धजत के माध्यम स े बािार जनगरानी के संचालन द्वारा दकसी उपकरण अथिा उपस्ट्क र पर जचपकाए गए लेबल पर प्रदर्िात जििरणों का सत्यापन करेगी।

(2) ब्यूरो अथिा राज्य पदाजभजित अजभकरण द्वारा, दकसी उपकरण अथिा उपस्ट्क र के संबंध में, दकसी प्रकार के गैर-अनुपालन का पता लगाए िाने की जस्ट्थजत में, जिनमें, िाली लेबल जचपकाना अथिा िाली लेबल िाले अथिा जबना लेबल के उपकरण अथिा उपस्ट्क र का जििय करना, असली लेबलों में पररितान करना, िास्ट्तजिक लेबलों को अनजधकृत लेबलों से प्रजतस्ट्थाजपत करना तथा ब्यरू ो द्वारा िारी दकए गए िास्ट्तजिक लेबलों[भाग III—खण् ड 4] भारत का रािपि : असाधारण 9 के जडिाइन, जिन्‍दयास अथिा सामग्री की नकल करने िाल े लेबलों का जनमााण करना सजम्मजलत ि,ै ककंत ु इन्‍दिीं तक सीजमत निीं ि,ै ब्यूरो अथिा राज्य पदाजभजित अजभकरण संबंजधत अनुज्ञजप्तधारी को कारण बताओ नोरटस िारी करेगी, जिसम ें उस े जचजह्नत गैर-अनुपालन स े अिगत कराया िाएगा तथा कारण बताओ नोरटस िारी दकए िान े की तारीख से तीस ददन की अिजध के भीतर जलजखत स्ट्पष्टीकरण प्रस्ट्तुत करने के जलए किा िाएगा।

(3) ब्यूरो अथिा राज्य पदाजभजित अजभकरण, अजधजनयम अथिा भारत के क्षेिाजधकार में लागू दकसी अन्‍दय सुसंगत जिजध, जनयम, जिजनयम अथिा अजधसूचना के उपबंध के अनुसार भी आिश्यक कारािाई करेगी।

(4) यदद अनुज्ञजप्तधारी, जनधााररत समय सीमा के भीतर ब्यरू ो की सतं ुजष्ट के अनरूु प स्ट्पष्टीकरण प्रस्ट्तुत निीं करता ि,ै तो ब्यूरो कजथत पररजमटधारी के जिरुद्ध जनम्नजलजखत कारािाई करेगा, अथाात:् (क) लेबल प्रजतभूजत िमा िब्त करेगा;

(ख) उपकरण अथिा उपस्ट्क र श्रेणी के अधीन मॉडल रजिस्ट्टडा करण को एक िषा की अिजध के जलए जनलजं बत कर देगा और जनलंबन के ब् यौरे ब्यूरो की िासकीय िेबसाइट पर प्रदर्िात करेगा; तथा (ग) ब्यूरो अथिा राज्य पदाजभजित अजभकरण ऊिाा संरक्षण (अनुपालन प्रितान) जनयम, 2025 के अनुसार िुमााना लगाने के जलए कारािाई िुरू करेगी।

(5) दकसी ई-कॉमस ा प्लेटफॉमा सजित ऑनलाइन पद्धजत में पाए गए दकसी गैर-अनुपालन की जस्ट्थजत में, ब्यूरो ई- कॉमसा प्लेटफॉम ा को उपकरण अथिा उपस्ट्क र के जनर्दाष्ट मॉडल का रजिस्ट्टडा करण समाप्त करन े का जनदेि देगा।

(6) ब्यूरो, इन जिजनयमों के जिजनयम 16 के अधीन मानक एिं लेबललंग कायािम संबंधी प्रचालन मनै ुअल में अनुसरण की िाने िाली जिस्ट्तृत प्रदिया जिजनर्दाष्ट करेगा।

14. परीक्षण िाँच - (1) ब्यरू ो अथिा राज्य पदाजभजित अजभकरण, यथाजस्ट्थजत, स्ट्ि त: संज्ञान लेते हुए अथिा दकसी जिकायत की प्राजप्त पर, यि सुजनजित करने के जलए दक उपकरण अथिा उपस्ट्क र, अजधजनयम की धारा 14 के खंड (क) के अधीन जिजनर्दाष्ट ऊिाा प्रदिान मानकों एिं मानदंडों तथा अनुसचू ी-ख में जिजनर्दाष्ट उपकरण अथिा उपस्ट्क र के अनुरूप ि,ैं परीक्षण िांच करेगी।

(2) स्ट्ित: संज्ञान सत् यापन के जलए, ब्यूरो अथिा राज्य पदाजभजित अजभकरण, यथोजचत रूप से, जिजनमााण सुजिधाओं, खुल े बािार, ऑनलाइन प्लेटफॉम ा अथिा दकसी अन्‍दय माध्यम से उपकरण का एक नमनू ा प्राप्त करे।

(3) ब्यूरो अथिा राज्य पदाजभजित अजभकरण, मॉडलों के ऊिाा प्रदिान का, ऐस े प्रयोिन के जलए जचजह्नत प्रयोगिालाओं में दकए गए िांच परीक्षण के माध्यम स े अथिा जचजह्नत उपकरणों अथिा उपस्ट्क रों के सीध े भारतीय मानक ब्यूरो द्वारा दकए गए परीक्षण के ऊिाा प्रदिान पररणामों को प्राप्त कर और उन पर भरोसा कर सत्यापन करे।

(4) प्रथम परीक्षण िांच के जिफल िो िाने की जस्ट्थजत में, ब्यूरो अथिा राज्य पदाजभजित अजभकरण, पिल े परीक्षण में प्रयुक् त उसी मॉडल के दोगुनी मािा के साथ दो पृथक् रूप से जचजह्नत प्रयोगिालाओं में दसू रा परीक्षण10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] करेगी। ब्यरू ो अथिा राज्य पदाजभजित अजभकरण दसू री परीक्षण िाचं को देखन े के जलए अनुज्ञजप्तधारी को जनधााररत जतजथ से कम से कम पंरि ददन पिले सूजचत करेगी। परंतु, दसू री परीक्षण िांच दकए िाने की जस्ट्थजत में, अनज्ञु जप्तधारी दसू री परीक्षण िाचं के सचं ालन के दौरान िोने िाली सभी लागतों और खचों के ििन िते ु पूणारूपेण उिरदायी िोगा। यदद दसू री परीक्षण िांच के जलए एकि दकए गए कोई एक अथिा दोनों नमूने जिफल िो िाते ि,ैं तो इस े परीक्षण िांच में जिफलता किा िाएगा। परंतु यदद अनुज्ञजप्तधारी परीक्षण िांच के साक्ष याकं न में जिफल रिता ि,ै तो परीक्षण के पररणाम िैध और बाध्यकारी माने िाएंगे, और तदनसु ार कारािाई िुरू की िाएगी। परंतु यि भी दक यदद दसू री परीक्षण िांच के जलए दो नमूने ई-कॉमसा प्लेटफॉम ा सजित बािार में उपलब्ध निीं ि,ैं और नमूनों का पता लगाने के सभी प्रयास जिफल िो िाते ि,ैं तो पिले नमूने के िांच परीक्षण के पररणाम को अंजतम माना िाएगा और अनुज्ञजप्तधारी के जलए बाध्यकारी िोगा।

(5) उप-जिजनयम (1) के अधीन प्राप्त जिकायत पर िुरू की गई परीक्षण िांच के जलए, जिकायतकताा परीक्षण स े संबंजधत सभी लागत और खचों को, ब्यरू ो द्वारा जनधााररत समय के भीतर, ब्यूरो के पास िमा करेगा, और यदद परीक्षण िांच के अधीन जलया गया नमूना जिफल िो िाता ि ै तो, अनुज्ञजप्तधारी द्वारा सभी लागत और खचों की ब् यरू ो को प्रजतपूर्ता की िाएगी और ब्यूरो जिकायतकताा को उपरोि खचों को िापस कर देगा; और ििा ं नमूना परीक्षण िांच में सफल रिता ि,ै तब, जिकायतकताा द्वारा िमा दकए गए खचों को िब्त कर जलया िाएगा।

15. परीक्षण िांच में जिफलता - (1) यदद उपकरण अथिा उपस्ट्क र, जिजनयम 14 के उपबंध के अनुसार सचं ाजलत परीक्षण िांच में जिफल रिता ि,ै तो ब्यूरो अथिा राज्य पदाजभजित अजभकरण जनम् नजलजखत कारािाई करेगी: (क) उपभोिाओं के लाभ के जलए, परीक्षण िांच की जिफलता की सूचना की जतजथ से दो माि की अिजध के भीतर, दकसी राष्ट्रीय दैजनक समाचार पि, इलेक्रॉजनक अथिा सोिल मीजडया अथिा ब् यूरो की िेबसाइट अथिा यथोजचत दकसी अन्‍दय रीजत से अनुज्ञजप्तधारी के नाम, ब्ांड नाम, मॉडल के नाम अथिा मॉडल नंबर, लोगो एिं अन्‍दय जिजनदेिनों सजित ब् यौरे प्रकाजित करेगा, ककंतु यि इसी तक सीजमत निीं िोगा। ब्यूरो इस प्रकार के जिज्ञापन को प्रकाजित करन े की लागत की अनुज्ञजप्तधारी स े िसूली करेगा िो जिजनयम 4 में यथा जिजनर्दाष ट प्रजतभूजत िमा की राजि तक सीजमत िोगा। परंतु यदद अनुज्ञजप्तधारी उपयुाि जिज्ञापन के प्रकािन की लागत स े संबंजधत व्यय को एक माि की अिजध के भीतर िमा करने में जिफल रिता िै, तो ब्यरू ो, उि लागत के िमा दकए िाने तक, उस उपकरण अथिा उपस्ट्क र श्रेणी का रजिस्ट्टडा करण जनलंजबत कर देगा;

(ख) परीक्षण िांच की जिफलता की सूचना की तारीख से दो माि की अिजध के भीतर, सभी राज्य पदाजभजित अजभकरणो को सजू चत करते हुए, अनुज्ञजप्तधारी को जनदेजित करेगा दक -

(i) ब्यूरो के जनदेिों का पालन करने के जलए बािार से सभी स्ट्टॉक िापस ल े ल;े[भाग III—खण् ड 4] भारत का रािपि : असाधारण 11

(ii) सभी जिज्ञापन सामजग्रयों पर प्रदर्िात जििरण बदल दे;

(iii) उपकरण के लेबल पर प्रदर्िात स्ट्टार स्ट्तर को ठीक करे; तथा

(iv) संबंजधत उपकरण अथिा उपस्ट्क र के मौिूदा और नए स्ट्टॉक स े िांच के दौरान पाए गए दोषों और कजमयों अथिा गैर-अनुपालनों को दरू करन े िते ु सुधारात्मक कारािाई करे। (ग) अनुज्ञजप्तधारी को उपयुाक् त सचू ना िारी दकए िाने की तारीख से दो माि की अिजध की समाजप्त के उपरांत दस ददनों की अिजध के भीतर, प्रचालन मनै ुअल म ें जिजनर्दाष्ट प्रारूप के अनसु ार, ब्यरू ो को की गई कारािाई की ररपोटा प्रस्ट्तुत करने का जनदेि देगा;

(घ) ऊिाा संरक्षण (अनुपालन प्रितान) जनयम, 2025 के अनुसार िुमााना लगाने की कारािाई िुरू करेगी।

(2) यदद अनुज्ञजप्तधारी इस जिजनयम के उप-जिजनयम (1) के अधीन िारी जनदेिों का अनपु ालन करने में जिफल रिता ि,ै तो ब्यूरो, जिजनयम 4 के अधीन उि उपकरण अथिा उपस्ट्क र की श्रेणी के जलए अनुज्ञजप्तधारी को प्रदान की गई लेबल जचपकाने की अनुमजत को न्‍दयूनतम तीन माि की अिजध के जलए अथिा अनुपालन दकए िाने तक िापस लेने का आदेि पाररत करेगा तथा ऐसे आदेि की प्रजत सभी राज्य पदाजभजित अजभकरणों को भी भेिेगा।

16. मानक और लबे ललगं कायिा म स े सबं जं धत प्रचालन मनै अु ल (1) ब्यूरो अजधजनयम के उपबंधों और उसके अधीन बनाए गए जनयमों के अनुरूप मानक और लेबललंग कायािम के कायाान्‍दियन के जलए अपनी िेबसाइट पर एक प्रचालन मैनुअल प्रकाजित करेगा। उि प्रचालन मैनुअल में, अन्‍दय बातों के साथ-साथ, जनम्नजलजखत सजम्मजलत िोंग,े अथाात्:

NOTIFICATION New Delhi, the 26th December, 2025 No. 5506/BEE/S&L/AL/2025-26.—Whereas to establish a comprehensive framework governing the display of essential information on labels, including their particulars, manner and time-limits, to establish the process for applying for and granting permission to affix such labels, the following draft regulations were published for public consultation as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections and suggestions from persons likely to be affected thereby, namely :–

(a) the Bureau of Energy Efficiency (Appliance Labelling) Regulations, 2025, vide notification number 5506/BEE/S&L/AL/2025-26, dated the 10th July, 2025;

(b) the Bureau of Energy Efficiency (Label Particulars) Regulations, 2025, vide notification number 5506/BEE/S&L/LP/2025-26, dated the 10th July, 2025;

(c) the Bureau of Energy Efficiency (Labelling Fees) Regulations, 2025, vide notification number 5506/BEE/S&L/FR/2025-26, dated the 10th July, 2025; and

(d) the Bureau of Energy Efficiency (Labelling Compliance) Regulations, 2025, vide notification number 5506/BEE/S&L/LC/2025-26, dated the 10th July, 2025;

And whereas copies of the said draft regulations were made available to the public on 16th day of July, 2025;

And whereas suggestions received with respect to the said draft regulations, have been taken into consideration.

Now, therefore, in exercise of the powers conferred by clause (i) and (l) of sub-section (2) of section 58 of the Energy Conservation Act, 2001 (52 of 2001) and in supersession of the regulations specified in Schedule D of these regulations, except as respects things done or omitted to be done before such supersession, the Bureau, with the previous approval of the Central Government hereby makes the following regulations, namely :––[भाग III—खण् ड 4] भारत का रािपि : असाधारण 45 REGULATIONS

CHAPTER I General

1. Short title and commencement.––– (1) These regulations may be called the Bureau of Energy Efficiency (Appliance Labeling and Compliance) Regulations, 2026.

(2) These regulations shall come into force on the 1st day of January, 2026.

2. Definitions.–––(1) In these regulations, unless the context otherwise requires,–

(a) “Act” means the Energy Conservation Act, 2001 (52 of 2001);

(b) “country of Origin” means country where the appliances or equipments have been manufactured, assembled or substantially processed, irrespective of the origin of some of its components.

(c) “endorsement label” is a mark that guarantees efficiency of an appliance or equipment, by assuring that the appliance or equipment meet minimum energy performance standards specified in the rating system of the respective appliance or equipment and it informs prospective purchasers that the product is energy efficient for its category;

(d) “label” means a printed matter, affixed to, or displayed on an appliance or equipment as specified in Schedule C of these regulations;

(e) “label series” means the validity of the energy performance standard of the specified appliance or equipment;

(f) “mandatory appliance or equipment” shall include appliance or equipment as specified under Schedule A of these regulations;

(g) “permittee” means any person dealing in any appliance or equipment specified in the Schedule A and B of these regulations and to whom permission has been granted by the Bureau to affix the label on any appliance or equipment;

(h) “person” means and includes any individual, association or body of persons, partnership firm, limited liability partnership and company, whether incorporated or not;

(i) “Schedule” means schedules annexed to these regulations;

(j) “star rating or star level” means the level of energy performance displayed on the label of the appliance or equipment based on their respective notification issued by the Central Government under clause (a) of Section 14 of the Act;

(k) “State designated agency” means any agency designated under clause (d) of section 15 of the Act;

(l) “voluntary appliance or equipment” shall include appliance or equipment specified under Schedule B of these regulations.

(2) Words and expressions used herein and not defined but defined in the Act shall have the meaning assigned to them in the Act.46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

CHAPTER II APPLIANCE LABELLING AND REGISTRATION

3. No label on any appliances or equipment as specified in Schedule A and Schedule B of these regulations shall be affixed without prior written permission from the Bureau.

4. Application for permission for label display.–– (1) Each company that manufactures or sells or imports appliances or equipment as specified in Schedule A of these regulations shall be required to register with the Bureau and submit an application accompanied by a one-time application fee of five thousand rupees.

(2) A company registered under sub-regulation (1) of this regulation shall be required to apply for registration for each and every equipment or appliance separately and shall submit an application

accompanied by a label security deposit of three lakhs rupees per appliance or equipment :

Provided that in the case of a small-scale industry, the label security deposit shall be fifty thousand rupees only.

(3) A company registered in the sub-regulation (1) of this regulation, shall be required to register for each model of the appliance or equipments and shall submit an application accompanied by a model

registration fee of five thousand rupees per application:

Provided that a company that manufactures or imports or sells the appliances or equipments specified in Schedule B, may register their company and their appliances or equipments in accordance with the procedure provided in the Operational Manual.

5. Grant of permission.–– (1) The Bureau shall complete the scrutiny of applications received under regulation 4 of these regulations as per the procedure laid down in the Operational Manual under regulation 16 of these regulations within a period not exceeding thirty working days from the date of the

receipt of application:

Provided that in cases where discrepancies are found in the applications received, the Bureau shall put these applications on hold and shall provide the applicants a period not exceeding sixty days to take suitable action, failing which the application shall be cancelled.

(2) After being satisfied that the applications received under regulation 4 of these regulations comply with all the requirements specified in these regulations, the Bureau shall –

(a) register the company and appliances or equipment;

(b) grant permission to affix labels on permitted models for a period of three years;

(3) To renew permission for continuance to affix a label on the permitted model, each permittee shall, before the expiry of such permission previously granted, shall submit an application to the Bureau. The renewal application shall be processed within a period of thirty days from the date of receipt of the

application:

Provided that no fee shall be payable for the renewal or for continuance to affix a label on the permitted model, where the star ratings or endorsement label have been revised or for continuation of an existing star rating plan or endorsement label, as the case may be.

(4) If the energy performance standards are revised during the validity of the permission period, the Bureau shall inform the revised energy performance standards to the permittee. Upon receipt of such information, the permittee shall submit a self-declaration form to the Bureau within a period of sixty days from the date of notification or before the period of validity mentioned in the label series, confirming compliance with the revised energy performance standards and the affixation of labels reflecting the revised standards.

(5) The Bureau may revoke permissions granted for affixing labels, if the permittee fails to ––

(a) comply with the specific energy performance standards fixed under the Act, with respect to the appliance or equipment under Schedule A and Schedule B ;

(b) comply with the provisions of regulation 7, providing the manner of display of the label under these regulations;

(c) pay the label fee as fixed under regulation 9 of these regulations;

(d) affix labels only to permitted models;

(e) ensure that the affixed labels are legible and well maintained;

(f) provide an updated list of authorized sellers by 30th April of each year;

(g) comply with other terms and conditions as may be specified in the Operational Manual on Standards and Labelling;

(h) comply with the directions as specified in Chapter III of these regulations:

Provided that no permission shall be revoked without giving the permittee a reasonable opportunity to be heard.

6. Particulars to be displayed on the label.–– On every appliance or equipment as specified in Schedule A and Schedule B of these regulations, the following particulars shall be displayed on its label, namely:–

(a) name of appliances or equipment;

(b) name of brand;

(c) model number;

(d) energy performance parameter;48 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(e) label series;

(f) rated capacity/output (as applicable);

(g) star level or endorsement;

(h) country of origin;

(i) the logo of the Bureau of Energy Efficiency;

(j) any other appliances or equipment specific parameters as specified in Schedule C of these regulations.

7. Manner of display of label.– (1) There shall be a label along with a Quick Response code embedded with particulars required under regulation 6 of these regulations on every appliance or equipment as specified in Schedule A and Schedule B of these regulations, in accordance with the manner provided in Schedule C of these regulations, for that appliance or equipment.

(2) The permittee shall ensure that the label is –––

(a) easily visible; and

(b) appears on every registered unit or model at both online and offline point of sale.

(3) The star label may be printed or pasted on the packaging box of every unit of the registered model.

(4) The design, colour, size, content and placement of the label shall be as specified in Schedule C of these regulations.

(5) The label along with Quick Response code shall be of self-adhesive material.

(6) The markings required as per the provisions of Schedule C of these regulations shall be legible, indelible and durable. The Quick Response code shall be placed adjacent to the star label of the respective appliance and the dimensions of Quick Response code shall be such, as specified in Schedule C of these regulations on a minimum basis.

8. Time-limit for display of labels.–– (1) A label, in accordance with the provisions of regulation 6 and 7, shall be displayed on every appliance or equipment as specified in Schedule A of these regulations within a period of six months from the date of commencement of these regulations while transitioning from voluntary to mandatory regime.

(2) When the energy performance standards for an appliance or equipment shall be revised and become effective, the permittee shall –––

(a) stop production of appliances or equipment under the expired standards; and

(b) undertake preparatory measures (dealer awareness and consumer education).

(3) For a dummy display unit, a duplicate or replica of the star label corresponding to the particular model, shall be shown on the dummy units. The label shall clearly mark with the word “dummy” to indicate that it is not an original label.

9. Label Fee.––– (1) For every mandatory appliance or equipment, the permittee shall pay to the Bureau a label fee as per Schedule A.[भाग III—खण् ड 4] भारत का रािपि : असाधारण 49

(2) For every voluntary appliance or equipment, the permittee shall pay to the Bureau a label fee as per Schedule B.

(3) The label fee specified under sub-regulations (1) and (2) above, shall be paid quarterly within a period of thirty days from the date of closure of each quarter of the financial year.

(4) The permittee shall furnish to the Bureau a statement containing details of production of labelled appliances or equipment and the accrued labelling fee due for each quarter within a period of thirty days from the date of closure of each quarter of the financial year and a reconciliation of the production data which is duly certified by a Chartered Accountant, shall be submitted to the Bureau within a period of two months from

the date of closure of each financial year:

Provided that on failure to pay the label fee within the period specified under this regulation, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit made under regulation 4 and if complete labelling fees are not recovered within a period of one year from the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

(5) The prepaid label fee shall be payable by the permittee at the time of Quick Response code requisition on the web portal of the Bureau of Energy Efficiency, namely, Standards and Labeling web portal, with effect from the 1st day of April, 2027 onwards:

Provided that, in the absence of the above-mentioned prepaid label fee mechanism on the web portal of the Bureau, sub-regulations (3) and (4) of these regulations shall remain in force.

10. Refund of label security deposit.–– (1) Subject to the provisions of regulation 4, a permittee shall be entitled to a refund of the interest free label security deposit upon ceasing the manufacturing of the mandatory or voluntary appliance or equipment, as the case may be.

(2) The Bureau shall refund the security deposit to the permittee within a period of thirty days from the date on which the permittee submits a written intimation of such permanent cessation of manufacture to the Bureau, as the case may be.

11. Mode of Payment.–All payments shall be made through an acceptable payment mode which includes payment through electronic mode in addition to already existing modes of payment.50 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

CHAPTER III LABELLING COMPLIANCE AND ENFORCEMENT

12. Compliance verification by the Bureau.–– The Bureau or State designated agency, shall undertake verification at such intervals as may be deemed necessary to ensure that any appliance or equipment complies with the requirements as specified under these regulations through any of the following manners, namely :–

(a) label verification as specified under regulation 13 of these regulations;

(b) check testing as specified under regulation 14 of these regulations; and

(c) any other reasonable methods deemed necessary by the Bureau to verify the compliance.

13. Label verification.–– (1) The Bureau or State designated agency, shall undertake verification of the particulars displayed on the label affixed on any appliance or equipment by conducting market surveillance either through offline or online mode including through e-commerce platforms.

(2) For any non-compliances, including but not limited to affixing or selling appliances or equipment with counterfeit label or without label, altering genuine labels, replacing genuine labels with unauthorised labels and creating labels that mimic design, layout or content of genuine labels issued by the Bureau, detected by the Bureau or the State designated agency with respect to any appliance or equipment, the Bureau or State designated agency shall issue a show-cause notice to the permittee concerned, informing him regarding the identified non-compliance and seeking an explanation in writing within a period of thirty days of issuance of the show-cause notice.

(3) The Bureau or State designated agency shall also take necessary action in accordance with the provisions of the Act, or any other relevant laws, rules, regulations, or notifications applicable within the jurisdiction of India.

(4) In case the permittee does not submit an explanation to the satisfaction of the Bureau, within the prescribed time- limit, the Bureau shall undertake the following actions against the said permittee,

namely:–

(a) forfeit the label security deposit;

(b) suspend the model registration under the appliance or equipment category for a period of one year and display the suspension details on official website of the Bureau; and

(c) the Bureau or State designated agency shall initiate action to impose a penalty as per the Energy Conservation (Compliance Enforcement) Rules, 2025.

(5) In the event of any non-compliance, found in online mode including at any e-commerce platforms, the Bureau shall direct the e-commerce platform to de-register the specified model of appliance or equipment.

(6) The Bureau shall specify the detailed procedure to be followed in the Operation Manual on Standards and Labeling program under regulation 16 of these regulations.[भाग III—खण् ड 4] भारत का रािपि : असाधारण 51

14. Check testing.– (1) The Bureau or State designated agency may either suo motu or on receipt of a complaint, as the case may be, carry out check testing to ensure that the appliances or equipments, conforms to the energy performance standards and norms as specified under clause (a) of section 14 of the Act and the appliance or equipment specified under schedule B.

(2) For suo moto verification, the Bureau or State designated agency may procure a sample of the equipment from the manufacturing facilities, open market, online platforms or any other means, as it deems fit.

(3) The Bureau or State designated agency may verify the energy performance of models through check testing conducted at identified laboratories for such purpose or by directly obtaining and relying upon the energy performance results of testing of the identified appliances or equipment undertaken by the Bureau of Indian Standards;

(4) In the event the first check test fails, the Bureau or State designated agency shall conduct a second check test with twice the quantity of the same model used in the first test in two different identified laboratories. The Bureau or State designated agency shall intimate the permittee at least fifteen days prior

to the scheduled date to witness the second check test :

Provided that in case the second check test is conducted, the permittee shall be solely liable to bear all costs and expenses incurred during the conduct of the second check test. In case any one or both samples collected for a second check test fail, it will be termed as failure in check testing :

Provided further that if the permittee fails to witness the check test, the test results shall be deemed to be valid and binding, and action shall be initiated accordingly:

Provided also that in case the two samples for second check test are not available in the market including e-commerce platforms, and all efforts to trace the samples fail, then result of check testing of the first sample shall be treated as final and shall be binding on the permittee.

(5) For check testing initiated upon a complaint received under sub-regulation (1), the complainant shall deposit all cost and expenses relating to testing, with the Bureau, within such time, as may be determined by the Bureau, and if the sample drawn under check testing fails, all cost and expenses, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant and where the sample passes the check test, then, the expenses deposited by the complainant shall stand forfeited.

15. Failure in check testing.–– (1) If the appliance or equipment fails in the check test, conducted as per the provisions of regulation 14 , the Bureau or State designated agency shall ––

(a) publish within a period of two months from the date of intimation of failure of check test, for the benefit of the consumers, the details including but not limited to the name of the permittee, brand name, model name or number, logo and other specifications, in any national daily newspaper, electronic or social media or on the website of the Bureau or any other manner as it deems fit. The Bureau shall recover the cost of publishing such advertisement from the permittee limited to the amount of security deposit as specified in regulation 4:52 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

Provided that in case the permittee fails to deposit the expenses towards the cost of publishing advertisement mentioned above within a period of one month , the Bureau shall suspend the registration of the appliance or equipment category until such cost is deposited ;

(b) direct the permittee, under intimation to all State designated agencies, within a period of two months from the date of intimation of failure of the check test, to––

(i) withdraw all the stocks from the market to comply with the directions of the Bureau;

(ii) change the particulars displayed on all advertising materials;

(iii) correct the star level displayed on the label of the equipment;

(iv) take corrective action to remove the defects and deficiencies or non- compliances found during check testing from the existing and new stock of the concerned appliance or equipment;

(c) direct the permittee to send an action taken report to the Bureau in the format as provided under the Operational Manual within a period of ten days of the conclusion of the period of two months from the date of issuance of aforesaid intimation;

(d) initiate action to impose a penalty as per the Energy Conservation (Compliance Enforcement) Rules, 2025.

(2) In the event, the permittee fails to comply with the directions issued under sub-regulation (1) of this regulation, the Bureau shall pass an order to withdraw the permission to affix the label granted to the permittee for said appliance or equipment category under regulation 4 for a minimum period of three months or till the compliance has been made and also send a copy of such order to all the State designated agencies.

16. Operational Manual on Standards and Labelling Programme.–The Bureau shall publish on its website an Operational Manual consistent with the provisions of the Act and rules made thereunder for the implementation of the Standards and Labelling Programme. The said Operational Manual shall, inter- alia, include the following, namely :––

(a) procedure for undertaking the market surveillance activity or any other similar activity by the Bureau or State designated agency;

(b) procedure for undertaking check testing; and

(c) required formats.
