The following draft of certain regulations which the Bureau with the previous approval of the Central Government proposes to amend, that is the Bureau of Energy Efficiency Particulars and Manner of their Display on Labels of Self ballasted

L.-33004/99 xxxGIDHxxx सी.जी.-डी.एलxx.x-GअID.-E0x5x0x 42023-244945 CG-DL-E-05042023-244945 असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 215] नई ददल्ली, िाक्रअनार, माचा 31, 2023/चत्रै 10, 1945 No. 215] NEW DELHI, FRIDAY, MARCH 31, 2023/CHAITRA 10, 1945 ऊिा ादक्षता ब्यूरो अजधसचू ना नई ददल्ली, 31 माचा, 2023 स.ं बीईई/एसएंडएल/ एलईडी/52/2023.—ब्यूरो, केन्‍द रीय सरकार कर वूअना अना ा से, ऊिाा दक्षता ब् यूरो ेसेल्ब बालास्ट् एलईडी लैंव के लेबल वर उनके संप्रदिान करने का जअनअनरण और रीजत), संिोधन जअनजनयमन 2018, ऊिाा संरक्षण अजधजनयम, 2001 े2001 का 52) कर धारा 58 कर उवधारा 2 के खंड ेi), धारा 13 कर उवधारा े2) के खंड ेएन) के साथ वढा िाये, द्वारा प्रदत्त अजधकारों का उवयोग करते हुए, जनम्नजलजखत मसौदा जनयम संिोधन के जलये प्रस्ट्ताजअनत करता है, और इस अजधजनयम कर धारा 59 कर उवधारा े1) कर अवेक्षानासार, इससे प्रभाजअनत होने अनाले सभी लोगों कर िानकारी के जलये यहां प्रकाजित करता है। नोट स ददया िाता ह ैदक इस मसौदा जअनजनयमों वर, इस अजधसूचना के साथ रािवत्र कर प्रजतयां साअनािजनक दकये िाने कर तारीख से तीस ददन कर अअनजध वूरी होने वर या बीत िाने के बाद, जअनचार दकया िायेगा। कोई भी आवजत्त या साझाअन, यदद हो तो, महाजनदिे क, ऊिाा दक्षता ब् यूरो, जअनद्यात मंत्रालय, चौथा तल, सेअना भअनन, आर.के.वारम, सेक् र 1, नयी ददल्ली-110066 को भेिा िा सकता है। मसौदा जअनजनयमों के संदभा में दकसी भी व्यजि से, उवयााि वैरा 1 में जनर्दष्टा तीस ददन कर अअनजध समाप्त होने से वहले, प्राप्त साझाअनों वर ऊिाा दक्षता ब्यूरो द्वारा जअनचार दकया िायेगा।

1. लघा िीर्ाक और प्रारंभ - े1) ये जअनजनयम ऊिाा दक्षता ब्यूरो ेसेल्ब बालास एलईडी लैंव के लेबल वर उनके संप्रदिान करने का जअनअनरण और रीजत), संिोधन जअनजनयम 2023 कहे िायेंगे। े2) ये जअनजनयम सरकारी गि में प्रकाजित होने कर तारीख से लागू हो िायेंगे।

2. वटरभार्ा –(1) इन जअनजनयमों में यदद संदभा कर अलग अवेक्षा नहीं ह ैतो – (क) “अजधजनयम'' का अथा ह ैऊिाा संरक्षण अजधजनयम 2001 (2001 का 52);

2182 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) “बैजमली मॉडल'' का अथा ह ैअनैसे मॉडल का समूह जिनके जलये कायाजनष्वादन के सभी मानक समान हैं; (ग) “ प्ररूव'' का अथा ह ैइन जअनजनयमों से संबंजधत प्ररूव;

(घ) “लेबल'' का अथा ह ै सेल्ब बालास्ट् लैंव से लगी या इसवर दीख रही दकसी भी प्रकार कर जलजखत, छवी, जचजन्‍दहत, माहर लगी या ग्रादबक सामग्री (ङ) “लेबल अअनजध'' का अथा ह ै अजधजनयम कर धारा 14 के खंड ेक) के तहत केन्‍द रीय सरकार द्वारा अजधसूजचत ऊिाा उवभोग मानदडं के अंतगात प्रकाि क्षमता कर अनैधता अअनजध;

(च) यदद प्रकािन क्षमता कर अनैधता समाप्त होने कर अअनजध अजधसूजचत नहीं ह ै तो यह केन्‍द रीय सरकार द्वारा इसके जलये नये मूल्य अजधसूजचत होने तक अनैध माना िायेगा; (छ) “अना ावत्रधारी'' का अथा है ऐसा व्यजि या एिेंसी जिसे जअनजनयम 7 के तहत लेबल लगाने कर अना ा दी गयी है;

(ि) “जिड्यूल'' का अथा ह ैइन जअनजनयमों से संलग्न जनधाारण; (झ) “सेल्ब बालास्ट् एलईडी लैंव'' का तात्वया अजधजनयम कर धारा 14 के खंड ेक) के तहत अजधसूचना में जनर्दष्टा उवकरण से ह;ै (ञ) “स्ट् ार रेट ंग'' का तात्वया ह ैअजधजनयम कर धारा 14 के खंड ेक) के तहत केन्‍द रीय सरकार द्वारा अजधसूजचत प्रकािन क्षमता मानक के आधार वर सेल्ब बालास्ट् एलईडी लैंव के लेबल वर प्रद्िात ऊिाा सक्षमता कर ्ेणी;

( ) “व्यावारी'' का अथा लेबल लगे सेल्ब बालास्ट् एलईडी लैंव कर जबक्रर या जअनतरण करने अनाले से ह ै और इसमें दका ानदार, व्यावारी, जनमााता और अना ावत्रधारी आते ह ैंजिन्‍दह ेंसेल्ब बालास्ट् एलईडी लैंव वर लेबल लगाने कर अना ा दी गयी ह।ै े2) यहााँ प्रयाि और अवटरभाजर्त, ककंता अजधजनयम में वटरभाजर्त, िब्द और अजभव्यजियों का अनही अथा होगा िो अथा उनके जलये अजधजनयम में प्रयाि ह।ै

3. लोगो वर प्रद्िता दकया िान े अनाला जअनअनरण – (1) प्रत्येक सेल्ब बालास्ट् एलईडी लैंव के लेबल वर जनम्नजलजखत जअनर्य प्रद्िात दकया िायेगा – (क) ऊिाा दक्षता ब् यूरो का लोगो; (ख) जअनजनमाता ा या आयातक और ब्ांड का नाम;

(ग) रेड नाम और संख्या; (घ) मॉडल और जअनजनमााण या आयात अनर्ा; (ङ) जअनजिष्ट ्रंखला कोड; (च) अना में जबिली उवभोग; (छ) ल्यूमेन में ल्यूजमनस फ्लक्स; (ि) एलएम/डबल्यू में प्रकािन प्रभाअनकाटरता; (झ) सेल्ब बालास्ट् एलईडी लैंव का स्ट् ार लेअनल;

(ञ) लेबल अअनजध; ( ) केडबल्यूएच में जबिली बचत; (ठ) केिीसीओ में काबान डायक्साइड उत्सिान में कमी;

2 े2) लेबल का जडिाइन, रंग, आकार, और जअनर्यअनस्ट्ता इन जअनजनयमों में संलग्न अनासूची में जनर्दष्टा दकये अनासार होना चाजहये।

4. लेबल सप्रं द्िता के जलय ेसमय सीमा – (1) जअनजनयम 3 म ेंजनर्दष्टा सभी जअनअनरण के साथ लेबल प्रत्येक सेल्ब बालास्ट् एलईडी लैंव वर, इन जअनजनयमों के लागू होने के बाद, 6 महीने के भीतर लगा ददये िायेंगे। े2) अजधजनयम कर धारा 14 के खंड ेक) के तहत केन्‍द रीय सरकार द्वारा अजधसूजचत संिोजधत ऊिाा उवभोग मानक लागू हो िाने वर, प्रत्येक अना ावत्रधारी या व्यावारी या जअनक्रेता-[भाग III—खण् ड 4] भारत का रािवत्र : असाधारण 3 (क) वहले के ऊिाा खवत मानकों के साथ सेल्ब बालास्ट् एलईडी लैंव नहीं बेच सकेगा;

(ख) संिोजधत ऊिाा उवभोग मानकों और सेल्ब बालास्ट् एलईडी लैंव के जअनजनमााण अनर्ा के साथ संिोजधत उवभोग मानकों के अनारूव संिोजधत स्ट् ार लेअनल और लेबल अअनजध प्रद्िात करेगा; (ग) डीलरों, खादरा जअनक्रेताओं कर िागरुकता सजहत उनकर िानकारी और उवभोिाओं कर सिगता के जलये िरूरी प्रचार सजहत साजनयोजित और आअनश्यक अजग्रम उवाय करेगा।

5. लेबल सप्रं द्िता करन ेका तरीका –

(1) प्रत्येक सेल्ब बालास्ट् एलईडी लैंव वर क्यूआर कोड के साथ लेबल लगा होगा और इसे जबक्रर स्ट्थल वर प्रद्िात दकया िायेगा। यह लेबल सेल्ब बालास्ट् एलईडी लैंव वर इस तरीके से लगाया िायेगा - (क) वैकेजिंग वर जप्रं ेड क्यूआर कोड के साथ स्ट्अनयं जचवकने अनाला लेबल;

(ख) सेल्ब बालास्ट् एलईडी के कैव वर रेट ंग के अनासार स्ट् ार मा्कगग अंदकत या छवी होगी; और (ग) एलईडी लैंव वर स्ट् ार मा्कगग के जलये स्ट् ैंव का आकार ऊंचाई में 11.5 जम.मी. और चौडाई में 8.5 जम.मी. होना चाजहये और क्यूआर कोड 8.5 जम.मी.ऊंचा और 8.5 जम.मी. चौडा होना चाजहये।

6. लेबल सप्रं द्िता करन े के जलये अन ा ा – (1) ब्यूरो कर वूअना अना ा के जबना दकसी भी सेल्ब बालास्ट् एलईडी लैंव वर स्ट् ार लेबल नहीं लगाया िा सकता।

(2) कंवनी वंिीकरण – ब्यूरो कर अना ा प्राप्त करने के जलये प्रत्येक ब्ांड को अलग से वंिीकरत होना होगा, िैसा दक प्ररूव I-(क) में जनर्दष्टा है, इलेक्रॉजनक भागतान माध्यम से भागतान योग्य एक लाख रुवए के लेबल सारक्षा बरस के साथ। वरन्‍दत ा यह उवबंजधत ह ैदक लघा उद्योगों जलये लेबल सारक्षा बरस केअनल 25 हिार रुवए होगा।

(3) मॉडल वंिीकरण – उवजअनजनयम 2 के तहत अना ावत्रधारी के प्रत्येक आअनेदन के साथ होना चाजहये – (क) प्रजत मॉडल दो हिार रुवए का आअनेदन बरस, इलेक्रॉजनक भागतान माध्यम से भागतान योग्य, और (ख) प्ररूव I में जनर्दष्टा दस्ट्ताअनेि

7. अन ा ा प्रदान दकया िाना – (1) जअनजनयम 6 के अंतगात आअनेदन प्राप्त होने और सभी अवेक्षाओं के अनावालन से संताष्ट होने के बाद, ब्यूरो, मानक और लेबजलंग जनयमाअनली में जनर्दष्टा समयाअनजध के भीतर, जअनजनयम 8 में जनर्दष्टा जनयम और ितों के अधीन – (क) ब्ांड को प्ररूव II – (क) में, इलेक्रॉजनक रूव से रजिस्ट् र कर लेता है; और (ख) सेल्ब बालास्ट् एलईडी लैंव वर लेबल लगाने कर अना ा प्ररूव II में, इलेक्रॉजनक रूव से प्रदान कर दते ा ह।ै े2) ब्यूरो प्ररूव III में एक रजिस्ट् र का प्रबंध करेगा और उसमें अना ावत्रधारी का नाम दिा कर लेगा। े3)उव जअनजनयम े1) के तहत इस प्रकार स्ट्अनीकरत मंिूरी उस अअनजध तक अनैध रहेगी िबतक केन्‍द रीय सरकार द्वारा धारा 14 के खंड ेक) के तहत अजधसूजचत ऊिाा उवभोग मानक द्वारा जनर्दष्टा स्ट् ार लेअनल लागू रहेगा।

(4)स्ट् ार रेट ंग योिना में संिोधन कर जस्ट्थजत में, अना ावत्रधारी द्वारा नअनीकरण कर अना ा के जलये, स्ट् ार रेट ंग कर अअनजध समाप्त होने के वहले एक महीने के अंदर आअनेदन दने ा होगा और साथ में ऊिाा दक्षता ब्यूरो, नयी ददल्ली के वक्ष में इलेक्रॉजनक माध्यम स े भागतान योग्य एक हिार रुवए का बरस दने ा होगा। वरन्‍दत ा, यह उवबंजधत ह ैदक स्ट् ार रेट ंग योिना जअनस्ट्ताटरत होने कर जस्ट्थजत में एक हिार रुवए के नअनीकरण बरस से छू दी िायेगी।

(5)अनैधता अअनजध समाप्त होने के बाद दकसी भी आअनेदन वर नअनीकरण नहीं दकया िायेगा और तब अना ावत्रधारी को नया आअनेदन दने ा होगा।

(6)उवजअनजनयम े4) के अंतगात नअनीकरण के जलये आअनेदन प्राप्त होने वर और सभी अवेक्षाओं के अनावालन के प्रजत संताष्ट होने वर, ब्यूरो आअनेदन प्राप्त होने के एक महीने के अंदर ब्यूरो प्ररूव II में अना ा का नअनीकरण कर सकता है।

(7)िो अना ावत्रधारी, संिोजधत स्ट् ार लेबल लागू हो िाने कर तारीख के बाद से सेल्ब बालास्ट् एलईडी लैंव के अनतामान मॉडल वर लेबल लगाना िारी रखने कर अनाजमत चाहता है, उसे केअनल प्ररूव IV में घोर्णा िमा करनी होगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(8)यदद संिोजधत स्ट् ार लेबल कर अनारूवता में सेल्ब बालास्ट् एलईडी लैंव का नया मॉडल िारू दकये िाने कर योिना ह ै तो अना ावत्रधारी को नया लेबल लगाने कर अना ा लेनी होगी और इस अना ा के जलये आअनेदन संिोजधत स्ट् ार लेअनल के लागू होने के 6 महीने वहले करना होगा।

8. लेबल वर ब्योरा सप्रं द्िता दकय े िान े के जनयम और ित ें – प्रत्येक अना ावत्रधारी, व्यावारी और जअनक्रेता को लेबल वर जअनअनरण प्रस्ट्तात में जनम्नजलजखत जनयम और ितों का अनावालन करना होगा – (क) प्रत्येक सेल्ब बालास्ट् एलईडी लैंव के लेबल वर प्रद्िात दकया िाने अनाला स्ट् ार लेअनल केन्‍द रीय सरकार द्वारा अजधजनयम कर धारा 14 के खंड ेक) के तहत सेल्ब बालास्ट् लैंव के जलये अजधसूजचत ऊिाा उवभोग मानकों के अनारूव होगा ;

(ख) सेल्ब बालास्ट् लैंव के केअनल उन मॉडल वर ही लेबल लगाया िा सकेगा जिनके जलये अना ा दी गयी है; (ग) सेल्ब बालास्ट् लैंव वर लेबल केअनल अना ावत्रधारी के व्यय वर ही जप्रं होगा और लगाया िायेगा (घ) अना ावत्रधारी, व्यावारी और जअनक्रेता यह साजनजित करेंगे दक सेल्ब बालास्ट् लैंव के लेबल वर प्रद्िात लेबल हर समय बना रहे;

(ङ) अना ावत्रधारी जअनजनयम 9 में जनर्दष्टा लेबल बरस का भागतान करेगा; (च) अना ावत्रधारी ब्यूरो को एक जअनअनरण प्रस्ट्तात करेगा जिसमें लेबल याि उवकरण के जनमााण तथा जअनत्तीय अनर्ा कर प्रत्येक जतमाही कर समाजप्त के बाद अनाले महीने में प्रत्येक जतमाही के जलये बकाया प्रोद्भूत लेबजलंग बरस का ब्योरा होगा ;

(छ) अना ावत्रधारी प्रत्येक अनर्ा के 30 अप्रैल तक अवने लेबलयाि उत्वादों कर जबक्रर के जलये जनयाि दकये अजधकरत जअनतरकों, डीलरों, खादरा जअनक्रेताओं और जअनक्रेताओं का जअनअनरण ब्यूरो को सौंवेगा; (ि) अना ावत्रधारी, व्यावारी और जअनक्रेता ब्यूरो कर जनयमाअनली में मानक और लेबजलंग वर िाजमल जअनजनयमों सजहत ऐसे अन्‍दय जनयम और ितों का भी अनावालन करेंगे जिसे ब्यूरो जनर्दष्टा करेगा।

9. लेबल बरस – (1) प्रत्येक अना ावत्रधारी ब्यूरो को सेल्ब बालास्ट् एलईडी लैंवों वर लगने अनाले प्रत्येक लेबल के जलये ब्यूरो को वांच वैसे प्रजत लेबल कर दर से लेबल बरस का भागतान करेगा। े2) उवजअनजनयम े1) के तहत जनर्दष्टा लेबल बरस का भागतान ब्यूरो को अना्र्ाक रूव से प्रत्येक जअनत्तीय अनर्ा कर समावन तारीख से एक महीने के अंदर करना होगा। वरन्‍दत ा, यह उवबंजधत ह ैदक जनर्दष्टा अअनजध के भीतर लेबल बरस का भागतान नहीं करने वर ब्यूरो बकाया राजि कर अनसूली दस प्रजतित अना्र्ाक ब्याि के साथ, जअनजनयम 6 के उवजअनजनयम े3) के तहत िमा दकये गये लेबल सारक्षा बरस से करेगा, और यदद वूरा लेबजलंग बरस िमा दकये िाने कर तारीख के एक अनर्ा के अंदर अनसूल नहीं होता ह ै तो ब्यूरो अना ावत्रधारी को स्ट्अनीकरत दकये गये सभी लेबल रद्द कर सकता ह ै और अना ावत्रधारी का नाम समाचार वत्रों में जडबॉल् र के रूव में प्रकाजित कर सकता ह।ै

10. लेबल सारक्षा बरस कर अनावसी – जअनजनयम 9 के उवजअनजनयम े2) के प्राअनधानों के अधीन अना ावत्रधारी, सेल्ब बालास्ट् एलईडी लैंव का जअनजनमााण बंद कर दने े वर, लेबल सारक्षा बरस अनावस ले सकेगा।

11. ब्यरू ो द्वारा वजा ष्ट- े1) ब्यूरो और उसकर मनोनीत एिेंसी, या तो स्ट्अनत सं ान से या कोई जिकायत जमलने वर, इस बात कर वाजष्ट करा सकती ह ैदक सेल्ब बालास्ट् एलईडी लैंव स्ट् ार लेअनल और इसके लेबल वर प्रद्िात ब्योरे के अनारूव ह ैंऔर ये अना ा के अन्‍दय जनयम और ितों का अनावालन करते ह।ैं े2) वाजष्ट के जलये ब्यूरो या उसकर मनोनीत एिेंसी जअनजनमााण केंर, भंडार, खादरा जबक्रर केंर, िहां से भी अने उजचत समझें, अचानक नमूने उठा सकती ह।ै े3) उवजअनजनयम े1) के तहत जिकायत प्राप्त होने वर ब्यूरो को सल्े ब बालास्ट् एलईडी लैंव के वरीक्षण कर वाजष्ट, वरीक्षण और अंिावन प्रयोगिालाओं के जलये राष्ट्रीय प्रत्यायन बोडा द्वारा प्रत्याजयत दकसी स्ट्अनतंत्र प्रयोगिाला में करानी चाजहये। यह िांच कराये िाने के बारे में अना ावत्रधारी को प्ररूव V में नोट स िारी दकया िाना होगा और जिकायतकताा को नमूना लागत, वरीक्षण, वटरअनहन और अन्‍दय संभाजअनत व्यय, ब्यूरो द्वारा जनधााटरत समय वर िमा करने के जलये कहा िायेगा। उवबंजधत ह ैदक यदद वरीक्षण कर चानौती ददया गया सैंवल िांच में जअनबल रहता है तो अना ावत्रधारी वरीक्षण में लगे सभी व्यय का भागतान ब्यूरो को करेगा,[भाग III—खण् ड 4] भारत का रािवत्र : असाधारण 5 और ब्यूरो इसे जिकायतकताा को अनावस कर देगा। और यदद उवकरण वरीक्षण वर खरा उतरता ह ै तो जिकायतकताा द्वारा वरीक्षण के जलये िमा करायी गयी राजि ज़ब्त हो िायेगी। े4) िहां स्ट्अनत सं ान वरीक्षण या चानौती वरीक्षण के दौरान सेल्ब बालास्ट् एलईडी लैंव के नमूने कसौ ी वर खरे नही उतर वाते अनहां अना ावत्रधारी को एक मौका और ददया िायेगा। ब्यूरो दसू रा वरीक्षण, वहली बार से दगा ानी संख्या में सेल्ब बालास्ट् एलईडी लैंव लेकर करेगा। इस बार यह िांच, वरीक्षण और अंिावन प्रयोगिालाओं के जलये राष्ट्रीय प्रत्यायन बोडा द्वारा प्रत्याजयत दकसी अन्‍दय स्ट्अनतंत्र प्रयोगिाला में, अना ावत्रधारी के व्यय वर करायी िायेगी। ब्यूरो अना ावत्रधारी को उवजअनजनयम े3) और दसू रे वरीक्षण के जलये उवजअनजनयम े4) में संद्भात यह चानौती वरीक्षण देखने और नमूनों कर खरीद और वरीक्षण में लगने अनाले व्यय के जलये प्ररूव V में सूजचत करेगा। े5) यदद दसू री िांच भी जअनबल हो िाती ह ैतो ब्यूरो – (क) सभी राज्य प्राजधकरत एिेंजसयों को सूचना के तहत, प्ररूव VI में अना ावत्रधारी को सूजचत करेगा दक अनह दो महीने के अंदर –

(i) सेल्ब बालास्ट् एलईडी लैंव वर ददया गया स्ट् ार लेअनल जअनअनरण सही करा ले या वरीक्षण के दौरान वायी गयी त्राट यों और खाजमयो को दरू करे।

(ii) ब्यूरो के जनदिे का अनावालन करते हुए बािार से वूरा स्ट् ॉक अनावस ले ले, और

1. ऊिाा दक्षता ब्यूरो ेजअनअनरण और प्रवत्र 1क. क्या अंतर है? सेल् ब-बालास्ट् एलईडी लैंव के लेबल वर उनके संप्रदिान करने का जअनअनरण और रीजत) जअनजनयम, 2023, के जअनजनयम 7 के प्राअनधानों के अनावालन में ब्यूरो एतद्वारा आवको इस वत्र के अनालग्नक में ददए गए जनधााटरत अनामोदन के ब्यौरे के अनासारअवना ब्ांड वंिीकरण करने कर अना ा प्रदान करता है।

2. यह अना ा जनम्नांदकत के अधीन है— (क) सेल्ब-बालास्ट् एलईडी लैंव के लेबल वर प्रद्िात स्ट् ार स्ट्तर अजधजनयम कर धारा 14 के खंड ेक) के तहत अजधसूजचत सेल्ब-बालास्ट् एलईडी लैंव के जलए ऊिाा खवत मानकों और उवरोि जअनजनयमों में प्रदान कर गई ितों के अनारूव होगा;

(ख) केअनल सेल्ब-बालास्ट् एलईडी लैंव के ऐसे मॉडल वर लेबल कर मोहर लगाना जिसके जलए अना ा दी गई है; (ग) अना ावत्रधारक कर लागत वर सेल्ब-बालास्ट् एलईडी लैंव वर लेबल कर जप्रंट ंग और जचवकाना ; (घ) अना ावत्रधारी साजनजित करेगा दक सेल्ब-बालास्ट् एलईडी लैंव वर प्रद्िात स्ट् ार स्ट्तर हर समय बनाए रखा िाएगा;

(ङ) अना ावत्रधारक, ब्यूरो द्वारा जनर्दष्टा लेबल बरस का भागतान ; (च) अना ावत्रधारक लेबल याि उवकरण के उत्वादन के जअनअनरण और जअनत्तीय अनर्ा कर प्रत्येक जतमाही कर समाजप्त के अगले महीने के भीतर दये प्रोद्भूत लेबल बरस का ब्यौरा ब्यूरो को प्रस्ट्तात करेगा। यही जअनअनरण ब्यूरो को स्ट्अनचाजलत प्रणाली के माध्यम से भी प्रस्ट्तात दकया िाएगा;

(छ) अना ावत्रधारक अना ा प्रदान दकए गए सेल्ब-बालास्ट् एलईडी लैंव के बारे में ब्यूरो द्वारा मांगे िाने वर अन्‍दय जअनअनरण उवलब्ध कराएगा।[भाग III—खण् ड 4] भारत का रािवत्र : असाधारण 13

3. अना ावत्रधारक अनैधता अअनजध के दौरान ब्यूरो के वूअना अनामोदन के जबना वंिीकरत ब्ांड और सेल्ब-बालास एलईडी लैंव को बािार से अनावस नहीं लेगा।

2. यह अना ा जनम्नांदकत के अधीन है— (क) सेल्ब-बालास्ट् एलईडी लैंव के लेबल वर प्रद्िात स्ट् ार स्ट्तर अजधजनयम कर धारा 14 के खंड ेक) के तहत अजधसूजचत सेल्ब-बालास्ट् एलईडी लैंव के जलए ऊिाा खवत मानकों और उवरोि जअनजनयमों में प्रदान कर गई ितों के अनारूव होगा;

(ख) केअनल सेल्ब-बालास्ट् एलईडी लैंव के ऐसे मॉडल वर लेबल लगाना, जिसके जलए अना ा दी गई है; (ग) अना ावत्रधारक कर लागत वर सेल्ब-बालास्ट् एलईडी लैंव वर लेबल कर जप्रंट ंग और जचवकाना ; (घ) अना ावत्रधारक साजनजित करेगा दक सेल्ब-बालास्ट् एलईडी लैंव वर प्रद्िात स्ट् ार स्ट्तर हर समय बनाए रखा िाएगा;

(ङ) अना ावत्रधारक, ब्यूरो द्वारा जनर्दष्टा लेबल बरस का भागतान ; (च) अना ावत्रधारक लेबल याि उवकरण के उत्वादन के जअनअनरण और जअनत्तीय अनर्ा कर प्रत्येक जतमाही कर समाजप्त के अगले महीने के भीतर दये प्रोद्भूत लेबल बरस का ब्यौरा ब्यूरो को प्रस्ट्तात करेगा। यही जअनअनरण ब्यूरो को स्ट्अनचाजलत प्रणाली के माध्यम से भी प्रस्ट्तात दकया िाएगा;

(छ) अना ावत्रधारक अना ा प्रदान दकए गए सेल्ब-बालास्ट् एलईडी लैंव के बारे में ब्यूरो द्वारा मांगे िाने वर अन्‍दय जअनअनरण उवलब्ध कराएगा।

5. केन्‍द रीय सरकार द्वारा समीक्षा वर स्ट् ार स्ट्तर कर योिनाओं को संिोजधत दकया िाता है, अनहां सेल्ब-बालास्ट् एलईडी लैंव के स्ट् ार स्ट्तर को जनम्नानासार संिोजधत दकया िाएगा:- (क) यदद नया मॉडल संिोजधत स्ट् ार स्ट्तर के साथ जसंक्रनाइज़ करते हुए लॉन्‍दच दकया िाता है, तो इस तरह कर अना ा के जलए एक आअनेदन ब्यूरो को उस तारीख से छह महीने वहले दकया िाएगा, िब से नया स्ट् ार स्ट्तर लागू होता है;

NOTIFICATION New Delhi, the 31st March, 2023 No. BEE/S&L/LED/52/2023.—The following draft of certain regulations which the Bureau with the previous approval of the Central Government proposes to amend, that is the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps), Amendment Regulations 2018., in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of

section 13 of the Energy Conservation Act, 2001 (52 of 2001), is hereby published as required by sub-section (1) of

section 58 of the said Act for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public;

Objections or suggestions, if any, may be addressed to the Director-General of Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, R.K.Puram, Sector-1, New Delhi-110066;

Objections or suggestions which may be received from any person with respect to the said draft regulations before the expiry of the period of thirty days specified in para 1 above shall be taken into consideration by the Bureau of Energy Efficiency.

1. Short title and commencement. - (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps), (Amendment) Regulations,

2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition: - (1) In these regulations, unless the context otherwise requires, —

(a) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “Family of models” means group of models for which all the performance parameters are same;

(c) “Form” means a form appended to these regulations;

(d) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the self-ballasted LED lamp;

(e) “label period” means the validity period of the luminous efficacy under energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, the end period of the validity period of the luminous efficacy is not notified, it shall be deemed to be valid until new values for the same are notified by the Central Government;

(f) “permittee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(g) “Schedule” means the schedule annexed to these regulations;

(h) “self-ballasted LED lamp” means an appliance as specified in the notification under clause (b) of

section 14 of the Act;

(i) “star rating or star level” means the grade of energy efficiency displayed on the label of the self- ballasted LED lamp based on luminous efficacy standard notified by the Central Government under clause (a) of section 14 of the Act;

(j) “trader or seller” in relation to any labelled self-ballasted LED lamp means a person who sells or distributes such self-ballasted LED lamp and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such self-ballasted LED lamp.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label. - (1) On every self-ballasted LED lamp, the following particulars shall be displayed on its label, namely: —

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand;

(c) trade name and number;26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(d) model and year of manufacturing or import;

(e) unique series code;

(f) power consumption in watts ;

(g) luminous flux in lumens;

(h) luminous efficacy in lm/W;

(i) star level of self-ballasted LED lamp; and

(j) label period;

(k) electricity savings in kWh;

(l) CO emission reduction in KgCO 2 2

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.— (1) A label containing all the particulars specified in regulation 3 shall be displayed on every self-ballasted LED lamp within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller-

(a) shall not produce the self-ballasted LED lamp with the previous energy consumption standards;

(b) shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the self-ballasted LED lamp in synchronisation with revised energy consumption standards;

(c) shall take necessary preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken in advance.

5. Manner of display of label. —

(1) There shall be a label on every self-ballasted LED lamp along with QR code which shall be displayed at the point of sale and such label shall be affixed on the self-ballasted LED lamp in the following manner, namely:-

(a) self-adhesive label along with QR code printed on packaging;

(b) the star marking as per the rating shall be stamped or printed on the lamp cap of self-ballasted LED lamp; and

(c) the size of the stamp for star marking shall be 11.5 millimetre height x 8.5 millimetre width and for QR code it shall be 8.5 millimetre height x 8.5 millimetre width on the LED lamps.

6. Permission for display of label. — (1) No star label shall be affixed on a self-ballasted LED lamp without obtaining the prior permission of the Bureau.

(2) Company registration. — For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees,

payable by electronic mode of payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only.

(3) Model registration. — Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by electronic mode of payment; and

(b) documents specified in Form I.

7. Grant of permission.- (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its Manual on standards and labelling, subject to such terms and conditions as specified in regulation 8, —

(a) register the brand in Form II-(A) in electronic form; and

(b) grant permission for affixing label on self-ballasted LED lamp in Form II in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

Provided that in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the self- ballasted LED lamp from the date from which the revised star level comes into force shall submit only a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the self-ballasted LED lamp is planned to be launched to synchronise with the revised star level and application for such permission shall be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely: —

(a) the star level displayed on the label of self-ballasted LED lamp shall conform to energy consumption standards for self-ballasted LED lamp notified by the Central Government under clause (a) of

section 14 of the Act;

(b) the label shall be affixed only on such model of self-ballasted LED lamp for which permission has been granted;

(c) the label shall be printed and affixed on the self-ballasted LED lamp at the cost of permittee;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of self-ballasted LED lamp shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year; and

(h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau shall specify including those contained in the Bureau’s Manual on Standard and Labelling.

9. Label fee. — (1) Every permittee shall pay to the Bureau a label fee of five paisa for each label affixed on the Self- ballasted LED lamps.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure

of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten percent per annum from the label security fee made under clause (b) of sub-regulation (3) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of label security fee. — Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture Self-ballasted LED lamps.

11. Verification by Bureau. — (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the self-ballasted LED lamp conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purpose of verification, samples shall be picked up at random by Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the self-ballasted LED lamp in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories, a notice shall be issued to the permittee in form V for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to sample cost, testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau, provided that the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited.

(4) Where samples of self-ballasted LED lamp used for testing fails the test during suo motu testing or challenge testing, the permittee shall be offer another opportunity and the Bureau shall conduct second test with twice the quantity of self-ballasted LED lamp used in the first test in an independent test laboratory which is different from the lab where the first check testing was conducted and shall be duly accredited by National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee and the Bureau shall intimate the permittee in Form V to witness the challenge testing referred to in sub-regulation (3) or the second test referred to in sub- regulation (4) and the expenses to be made towards the procurement and testing of sample.

(5) Where the second test fails, the Bureau shall, —

(a) direct the permittee in Form VI, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label of the self-ballasted LED lamp or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of the concerned permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months; and

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(6) The permittee shall within ten days of the conclusion of the period of two months referred to in sub-regulation (5),

(a) send the compliance report in Form VII to Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non- compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub-regulation (6) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub- regulation.

(8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall, —

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (6) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months; and

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission.—The Bureau may cancel the permission granted under regulation 7, if the permittee,

(a) fails to comply with any of the terms and conditions specified under regulation 8;[भाग III—खण् ड 4] भारत का रािवत्र : असाधारण 29

(b) fails to pay label fee within the period specified under regulation 9; and

(c) does not comply with the direction issued under regulation 11.

(d) Provided that no application shall be cancelled without giving permittee a reasonable opportunity of being heard in respect of cancellation of permission.

Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps) Regulations, 2023, you were permitted to affix label on the Self- ballasted LED lamps vide Bureau of Energy Efficiency letter No. ..............dated....... subject to the compliance of the terms and conditions specified therein.

2. The Bureau, under Regulation … of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps) Regulations, 2023, had purchased a Bureau of Energy Efficiency star labelled Self-ballasted LED lamps from your authorised Distributor, dealer, retailer vide Invoice number .......dated for a price of Rs................ and lifted as a sample dated ……by M/s......................, an agency appointed by the Bureau for verification of the particulars displayed on the label under regulation 3 of the aforesaid regulations, affixed by you on the aforesaid purchased Self-ballasted LED lamps. The sample duly sealed by M/s............... bearing42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] serial number……..was obtained from M/s..........(Name of the Distributor, dealer, retailer) under signatures of the duly authorised representative of the verification Agency.

3. The Bureau through its aforesaid Verification Agency had transported the sample referred to in para 2 to M/s. ..................., a National Accreditation Board for Testing and Calibration Laboratories accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 4 and 5 of S.O.number ……dated the …. for giving Test Report in accordance with the Form ….given in Annexure to S.O.. number…….. dated the ……..

4. The results of the Test Report on the sample bearing Unique Identification serial number is enclosed. The results of the Test Report indicated that the sampled Self-ballasted LED lamps failed to meet the type test at total losses at 50% loading and total loss at 100% etc. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the Self-ballasted LED lamps manufactured/imported by you. The Test Results were sent to you vide Bureau of Energy Efficiency letter No... .....

dated........in the name of your authorised Contact person. You were also requested to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

5. The Sample for second check verification Test were picked up …. dated the …. through our authorised Agency M/s. ............and transported to the National Accreditation Board for Testing and Calibration Laboratories accredited Laboratory transported by our authorised Agency, duly sealed by M/s............... and was given Unique Identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification Agency as well as your representatives.

6. The Test results of second check testing are enclosed which are dully checked and counter signed by the competent authorised personnel of the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing.

The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O.number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Self-ballasted LED lamps manufactured/imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps) Regulations, 2023, the Bureau hereby directs to :-

(i) correct the star level displayed on the label of the Self-ballasted LED lamps or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by .............. .In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b) of sub-regulation (6) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED lamps) Regulations, 2023.

9. The Bureau shall take further follow up action in the matter in terms of regulations (5) (6)(7) and (8) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self- ballasted LED lamps) Regulations, 2023.
