L.-33004/99 सी.जी.-डी.एल.-अ.-31012024-251663 CG-DxLx-xEG-I3D1H0x1x2x0 24-251663 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 346] नई दिल्ली, मगं लवार, िनवरी 30, 2024/माघ 10, 1945 No. 346] NEW DELHI, TUESDAY, JANUARY 30, 2024/MAGHA 10, 1945 पर्ाावरण, वन और िलवार् ु पररवतना मत्रं ालर् अजधसचू ना नई दिल्ली, 30 िनवरी, 2024 का.आ. 367(अ).—जनम्नजलजखत ‘प्रारूप अजधसूचना’, जिसे केंद्र सरकार पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 6, 8 और 25 के तहत प्रित्त िजिर्ों का प्रर्ोग करत े हुए, प्रर्ोग की अवजध समाजि वाल े वाहनों के जलए जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व (ईपीआर) हते ु जवजनर्म लान े के जलए िारी करने का प्रस्ट्ताव करती ह,ै पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के तहत र्था आवश्र्क और उससे संभाजवत रूप स े प्रभाजवत होने वाली िनता और अन्र् जहतधारकों की िानकारी के जलए एतिद्वारा प्रकाजित की िाती ह ै और, एतद्द्वारा, र्ह भी नोरिस दिर्ा िाता ह ै दक उि अजधसूचना पर केंद्र सरकार द्वारा उस तारीख स े साठ दिन की समाजि पर र्ा उसके बाि जवचार दकर्ा िाएगा, जिस दिन भारत के रािपत्र म ें र्था प्रकाजित इस अजधसूचना की प्रजतर्ां िनता के जलए उपलब्ध करा िी िाती ह;ै इस े प्रारूप अजधसूचना म ें जनजहत प्रस्ट्तावों पर कोई आपजत्त र्ा सुझाव िेने म ें रुजच रखने वाला कोई भी व्यजि सजचव, पर्ावा रण, वन और िलवार् ु पररवतान मंत्रालर्, इंदिरा पर्ाावरण भवन, िोरबाग रोड, अलीगंि , नई दिल्ली - 110003 को जनर्िाष्ट अवजध के भीतर जलजखत रूप स े डाक के माध्र्म स े र्ा इलेक्ट्रॉजनक रूप स े ईमले पत:े sohsmd- mef@gov.in पर ऐसा कर सकता ह।ै अत: अब, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (1), उपधारा (2) के खंड (v) और खडं (vii), धारा 6 की उपधारा 1, उपधारा (2) के खडं (ग) और खंड (घ), धारा 8, धारा 25 की उपधारा 2 के खंड (ख), के तहत प्रित् त िजिर्ों का प्रर्ोग करते हुए केंद्र सरकार एतद्द्वारा जनम्नजलजखत जनर्म बनाती ह ैर्था:- 597 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

1. सजं क्षि नाम और प्रारंभ. - (1) इन जनर्मों को प्रारुप प्रर्ोग-अवजध-समाजि वाल े वाहन (प्रबंधन) जनर्म, 2024 कहा िा िाएगा।

(2) र् ेजनर्म सरकारी रािपत्र म ें अपने प्रकािन की जतजथ स े प्रवृत् त होंग।े

2. अनप्रु र्ोिन. - (1) र्े जनर्म इन पर लाग ू होंग,े - (i) उत् पािक, उपभोिा, वाहनों के परीक्षण, प्रर्ोग- अवजध-समाजि वाले वाहनों के हडैं ललगं , प्रसंस्ट्करण और पनु चाक्रण म ेंसंलग्न जनकार्, ककंतु इन पर लाग ू नहीं होंगे:

क. बैिरी अपजिष्ट प्रबंधन जनर्म, 2022 के तहत आन ेवाली अपजिष्ट बैिररर्ााँ; ख. प्लाजस्ट्िक अपजिष्ट प्रबंधन जनर्म, 2016 के तहत आन े वाली प्लाजस्ट्िक पैकेलिंग; ग. पररसंकिमर् और अन्र् अपजिष्ट (प्रबंधन और सीमापार संचलन) संिोधन जनर्म, 2022 के तहत आने वाल े अपजिष्ट िार्र;

घ. पररसंकिमर् और अन्र् अपजिष्ट (प्रबंधन और सीमापार संचलन) संिोधन जनर्म, 2023 के तहत आने वाल े प्रर्ुि तेल। ङ. ई-अपजिष्ि (प्रबंधन) जनर्म, 2022 के तहत आन े वाले ई-अपजिष्ि ।

(ii) मोिर वाहन अजधजनर्म, 1988 (1988 का 59) की धारा 2 के खंड (28) के अनुसार सभी प्रकार के वाहन।

3. पररभाषाए.ाँ- (1) इन जनर्मों म,ें िब तक दक सिं भा स ेअन्र्था अपेजक्षत न हो, - (क) "अजधजनर्म" का अजभप्रार् पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) स ेह;ै (ख) "स्ट्वचाजलत परीक्षण स्ट्िेिन" का अजभप्रार् दकसी भी स्ट्वचाजलत परीक्षण केन् द्र से ह,ै िैसा दक केंद्रीर् मोिर वाहन (इक्कीसवां संिोधन) जनर्म, 2021 और उसके बाि के सिं ोधनों म ें पररभाजषत दकर्ा गर्ा ह;ै (ग) "केंद्रीर् प्रिषू ण जनर्त्रं ण बोडा" का अजभप्रार् ह ै िल (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) की धारा 3 की उपधारा (1) के तहत गरठत केंद्रीर् प्रिषू ण जनर्त्रं ण बोडा स ेह;ै (घ) "िमा प्रमाणपत्र" का अजभप्रार् मोिर वाहन (वाहन स्ट्क्रैलपंग केन् द्र के पंिीकरण और कार्)ा जनर्म, 2021 और उसके बाि के संिोधनों के तहत पररभाजषत पंिीकृत वाहन स्ट्क्रैलपंग केन् द्र द्वारा िारी प्रमाण पत्र स ेह;ै (ड.) "सग्रं ह केंद्र" स े अजभप्रार् दकसी ऐसे र्ा क्षत्रे स े ह ै जिसका उपर्ोग मोिर वाहन (वाहन स्ट्क्रैलपंग केन् द्र के पंिीकरण और कार्)ा जनर्म, 2021 और बाि के संिोधनों के तहत र्था पररभाजषत प्रर्ोग- अवजध-समाजि वाले वाहनों को इकट्ठा करने और संगृहीत करन े के एकमात्र उद्देश्र् के जलए दकर्ा िा सकता ह;ै (च) "उपभोिा" का अजभप्रार् वाहन के अंजतम उपर्ोगकता ा स े ह;ै (छ) "थोक उपभोिा" का अजभप्रार् ह ै100 स े अजधक वाहनों का स्ट्वाजमत्व रखने वाला उपभोिा स े ह;ै (ि) "जनपिान" का अजभप्रार् ह ै कोई भी ऐसा कार् ा जिसके फलस्ट् वरूप पुन: उपर्ोग, पुनप्रााजि, पुनचाक्रण/नवीनीकरण नहीं होता ह ै और जिसम,ें अन्र् बातों के साथ-साथ, भौजतक -रासार्जनक और/र्ा िैजवक उपचार और/र्ा सुरजक्षत लैंडदफल म ें िमा करना िाजमल होता ह;ै (झ) "पर्ावा रण के अनकु ूल प्रबधं न" का अजभप्रार् ह ै प्रर्ोग-अवजध-समाजि वालेवाहन का प्रबंधन, जिससे मानव स्ट्वास्ट््र् और पर्ाावरण को ऐस े दकसी भी प्रजतकूल प्रभाव स े बचार्ा िा सके, िो प्रर्ोग-अवजध-समाजि वाल े वाहन म ें जनजहत दकसी भी पिाथा स ेउत् पन् न हो सकता ह;ै (ञ) "प्रर्ोग-अवजध-समाजि वाल ेवाहन" का अजभप्रार् ह ैकोई ऐसा वाहन -

(i) िो अब वैध रूप स े पंिीकृत नहीं ह;ै र्ा

(ii) जिसे केंद्रीर् मोिर वाहन (इक्कीसवां संिोधन) जनर्म, 2021 र्ा केंद्रीर् मोिर वाहन (आठवा ं संिोधन) जनर्म, 2022 के प्रावधानों के तहत जनर्िष्टा परीक्षण र्ा पुन: परीक्षण के बाि स्ट्वचाजलत परीक्षण केन्द्र द्वारा अनुपर्ुक्ट्त घोजषत कर दिर्ा गर्ा ह;ै र्ा

(iii) जिसका पंिीकरण केंद्रीर् मोिर वाहन अजधजनर्म, 1988 (1988 का 59) के अध्र्ार् IV के तहत रद्द कर दिर्ा गर्ा ह;ै र्ा[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3

(iv) जिसे दकसी न्र्ार्ालर् के आिेि के कारण परु ाना घोजषत कर दिर्ा गर्ा ह;ै र्ा

(v) जिसे आग, क्षजत, प्राकृजतक आपिा, िंगों र्ा िघु ािनाओं, र्ा अन्र्था उत्पन्न होने वाली दकसी भी पररजस्ट्थजत के कारण वैध पंिीकृत माजलक द्वारा अनपु र्ुक्ट् त वाहन के रूप म ेंस्ट्व-घोजषत कर दिर्ा गर्ा ह।ै (ि) "जवस्ट्ताररत उत्प ािक उत्त रिाजर्त्व " का अजभप्रार् प्रर्ोग-अवजध-समाजि वाल े वाहन के पर्ाावरणीर् रूप स े सुिढ़ृ प्रबंधन के जलए वाहनों के दकसी भी उत् पािक का उत् तरिाजर्त् व स े ह;ै (ठ) "जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व पिं ीकरण" का अजभप्रार् ह-ै जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व के जलए दकसी उत् पािक का केंद्रीर् प्रिषू ण जनर्त्रं ण बोडा द्वारा पंिीकरण;

(ड) "जवस्ट्ताररत उत्प ािक उत्तरिाजर्त्व प्रमाणपत्र" का अजभप्रार् ह-ै पंिीकृत वाहन स्ट्क्रैलपगं केन् द्र के जलए केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा िारी प्रमाण पत्र, जिसे जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व लक्ष्र् को पूरा करन े के जलए उत् पािक द्वारा खरीिा िा सकता ह;ै (ढ) "केन्द्र " का अजभप्रार् ह ै ऐसा कोई भी स्ट्थान िहा ं प्रर्ोग-अवजध-समाजि वाले वाहनों के संग्रहण, भंडारण, पृथक्करण, पुनचाक्रण/नवीनीकरण, जनपिान स े सबं ंजधत प्रदक्रर्ा को अंिाम दिर्ा िाता ह;ै (ण) "प्रपत्र" का अथ ा इन जनर्मों स े िुड े प्रपत्र ह;ैं (त) "पररसकं िमर् अपजिष्ट" का अजभप्रार् ह ै खतरनाक अपजिष्ट, िैसा दक पररसंकिमर् और अन्र् अपजिष्ट (प्रबंधन और सीमा पारीर् संचलन) जनर्म, 2016 के तहत पररभाजषत दकर्ा गर्ा ह।ै (थ) "जवजनमाता ा" का अजभप्रार् ह ै कंपनी अजधजनर्म, 2013 (2013 का 18) र्ा फैक्ट्री अजधजनर्म, 1948 (1948 का 63) के अनुसार पररभाजषत कोई व्यजि र्ा इकाई र्ा कंपनी, जिसम ें वाहनों के जनमााण की सुजवधाएं ह;ैं (ि) "उत्प ािक" का अजभप्रार् ह ैऐसी इकाई िो जनम्न के जलए घरेल ू बािार म ें सलं ग्न ह:ै

(i) अपन े ब्ांड के तहत वाहनों के जनमााण/असेंबली और जबक्री; र्ा

(ii) अन्र् उत् पािकओं र्ा आपूर्तका तााओं द्वारा उत्पादित वाहनों की अपन े ब्ांड के तहत जबक्री; र्ा

(iii) वाहनों का आर्ात;

(iv) अपन े स्ट्वर् ं के ब्ांड के तहत न करके, 3 (ि) (ii) म ें र्था पररभाजषत उत् पािक को वाहनों का जनमााण/असेंबली और जबक्री। (ध) "पिं ीकृत माजलक" का अजभप्रार् ह ै वह व्यजि जिसके नाम पर कोई मोिर वाहन पंिीकृत ह,ै और िहां ऐसा व्यजि नाबाजलग ह,ै ऐसे नाबाजलग का अजभभावक, और ऐस े मोिर वाहन के संबंध म ें िो दकरार्ा-खरीि, समझौता, र्ा पट्टे का समझौता र्ा िजृ ष्टबंधक समझौता द्वारा जलर्ा गर्ा ह,ै उस समझौते के तहत वाहन पर कब्िा रखने वाला व्यजि;

(न) "पनु चक्रा णकता"ा का अजभप्रार् ह ैप्रर्ोग की अवजध समाि होने वाले वाहनों की सामग्री के पुनचाक्रण में लगी इकाई ; (प) "नवीनीकरणकता"ा का अजभप्रार् ह ै प्रर्ोग की अवजध समाि होने वाले वाहनों की सामग्री के नवीनीकरण में लगी इकाई;

(फ) "पिं ीकृत वाहन स्ट्क्रैलपगं केन्द्र " मोिर वाहन (वाहन स्ट्क्रैलपगं केन् द्र के पंिीकरण और कार्)ा जनर्म, 2021 और तत्प श् चात दकए गए संिोधनों के तहत र्था पररभाजषत; (ब) "अनसु चू ी" का अजभप्रार् इन जनर्मों स े िडु ी अनुसूची ह;ै (भ) "राज्र् प्रिषू ण जनर्त्रं ण बोडा" का अजभप्रार् ह ै िल (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) की धारा 4 के तहत गरठत राज्र् प्रिषू ण जनर्ंत्रण बोडा और इसम ें केंद्र िाजसत प्रिेि के संबंध म ें प्रिषू ण जनर्ंत्रण सजमजत िाजमल ह ै;

(म) "भडं ारण" का अजभप्रार् ह ैप्रर्ोग की अवजध समाजि वाल ेवाहनों का भंडारण; (र्) "िोधन" का अजभप्रार् ह ै प्रर्ोग-अवजध-समाजि वाल े वाहन प्रिषू ण मुजि, जवघिन, कतरनी, कतरन, पुनप्रााजि र्ा श्रेडर कचरे के जनपिान की तैर्ारी के जलए सौंपे िाने के बाि कोई कार्ाकलाप और प्रर्ोग-अवजध-समाजि वाले वाहन और उसके घिकों की पुनप्रााजि/पुनचाक्रण र्ा जनपिान के जलए दकर्ा गर्ा कोई अन्र् कार्;ा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (र्क) " वाहन" का अजभप्रार् ह ैमोिर वाहन र्ा वाहन - (क) िैसा दक मोिर वाहन अजधजनर्म, 1988 ( 1988 का 59) की धारा 2 के खंड (28) में पररभाजषत दकर्ा गर्ा है;

और (ख) ई-ररक्ट्िा और ई-कािा सजहत इलेजक्ट्रक वाहन र्ा बैिरी चाजलत वाहन ।

(2) इन जनर्मों म ेंपररभाजषत नहीं दकए गए िब्िों और अजभव्यजिर्ों का वही अथा होगा िो पर्ाावरण (संरक्षण) अजधजनर्म, 1986 म ेंर्था पररभाजषत ह।ै

4. उत्प ािक के उत्त रिाजर्त्व - (1) र्ह उत् पािक का उत् तरिाजर्त् व होगा दक, -

(i) अनुसूची I म ें जनर्िष्टा पुनचाक्रण लक्ष्र्ों को सुजनजित करन े के जलए स्ट्व-उपर्ोग म ेंलाए गए वाहनों सजहत घरेल ू बािार म ें उतारे गए वाहनों के जलए जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व की िेर्ताओं को परू ा करे;

(ii) बािार म ें उपलब्ध कराए गए वाहनों के जलए अनुसूची I म ेंउजल्लजखत प्रर्ोग-अवजध-समाजि वाले वाहनों के पुनचाक्रण लक्ष्र्ों को पूरा करे;

(iii) र्दि, उत् पािक वाहनों का जनमााण र्ा असेंबली कर रहा ह ै और इस े अपन े ब्ांड नाम स े बािार म ें नहीं ला रहा ह,ै तो ऐस े उत् पािक को जवजनमााण/असेंबली के िौरान उत्पन्न प्रत्र्क्ष उपभोिा-पूवा अपजिष्ट, िो पहले स े ही अन्र् अपजिष्ट प्रबंधन नीजतर्ों के अतं गता िाजमल नहीं ह,ै के पर्ाावरणीर् रूप से सुिढ़ृ प्रबंधन के जलए जवस्ट्ताररत उत्प ािक उत् तरिाजर्त् व िेर्ताओं को पूरा करने की सीमा तक वाहन के उत् पािक के रूप म ें खुि को पंिीकृत करना होगा।

(iv) वाहनों के प्रर्ोग की अवजध समाप् त होन ेपर उन् ह ेंपंिीकृत वाहन स्ट्क्रैलपगं केन्द्र र्ा जनर्िाष्ट संग्रह केंद्रों पर िमा करने हते ु प्रोत्साजहत करन े के जलए आवश्र्क उपार् करे;

(v) जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व को र्ा तो अपने स्ट्वर् ं के पिं ीकृत वाहन स्ट्क्रैलपंग केन् द्र र्ा पंिीकृत वाहन स्ट्क्रैलपगं सुजवधा वाली दकसी इकाई द्वारा तैर्ार जवस्ट्ताररत उत् पािक उत्त रिाजर्त् व प्रमाणपत्र की खरीि के माध्र्म स े पूरा करे;

(vi) दकसी भी र्ोिना िैसे वापसी खरीि र्ोिना, िमा वापसी र्ोिना र्ा दकसी अन्र् र्ोिना को लाग ू करे, और जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व िेर्ताओं को पूरा करन े के जलए दकसी अन्र् इकाई को नाजमत करे;

(vii) प्रपत्र 1(क) म ें केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा स े उत् पािक के रूप म ें एक बारगी पंिीकरण प्राि करे। पंिीकरण प्रमाणपत्र प्रपत्र 1(ख) म ेंिारी दकर्ा िाएगा;

(viii) जपछल े जवत्तीर् वष ा म ें स्ट्वर् ं उपर्ोग म ें आन े वाल े वाहनों सजहत बािार म ें लाए गए वाहनों म ें प्रर्ुि इस्ट्प ात की संख्र्ा, प्रकार और विन के सबं ंध म ें जपछल े जवत्तीर् वषा के जलए सीपीसीबी को प्रपत्र 1 (ग) म ें वार्षाक जववरणी 30 िून तक प्रस्ट्तुत करे।

(ix) केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा जनधााररत प्रपत्र के अनुसार, जपछले जवत्तीर् वषा के िौरान जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व िेर्ताओं की पूर्त ाके संबंध म ें 30 िून तक वार्षाक जववरणी प्रस्ट्तुत करे;

(x) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा जनधााररत प्रपत्र के अनसु ार चालू वषा के जलए अपने जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व िेर्ताओं की उसी वषा 30 अप्रैल तक घोषणा करे;

(xi) जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व पंिीकरण म ें जनजहत िानकारी म ें दकसी भी पररवतान के बारे म ें और जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व पंिीकरण म ें जनर्िष्टा वाहनों को बािार म ें उपलब्ध करान े के संबंध म ें दकसी भी स्ट्थार्ी समाजि के बारे म ें केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा को सूजचत करना;

(xii) उपर्ोग अवजध समाप् त हो चकु े वाहनों के संचालन और प्रबंधन म ें िाजमल दकसी जनकार् द्वारा इन जनर्मों के उल्लघं नों को केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा र्ा राज्र् प्रिषू ण जनर्ंत्रण बोडा के ध्र्ान म ेंलाना;

(xiii) भारत सरकार द्वारा केन्द्रीर् मोिर वाहन जनर्मावली, 1989 के अंतगात र्था अजधसूजचत एआईएस-219 के प्रावधानों के अनुपालन के जलए उपार् करना।

(2) जवजनमााता दकसी अन्र् संस्ट्था के साथ संव्यवहार नहीं करेगा जिसका इन जनर्मों के तहत र्ा ईपी अजधजनर्म के तहत अजधिेजित पंिीकरण नहीं दकर्ा गर्ा ह।ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(3) जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व के िाजर्त्वों को पूरा करने के जलए, जवजनमााता स्ट्वर् ं को सलं ग्न कर सकता ह ै र्ा दकसी अन्र् संस्ट्था को अजधकृत कर सकता ह।ै हालांदक, जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व के लक्ष्र्ों को पूरा करन े का िाजर्त्व जवजनमााता का रहगे ा।

5. पिं ीकृत माजलक के उत्त रिाजर्त् व - (1) र्ह सुजनजित करना पंिीकृत माजलक की जिम्मेिारी होगी दक उपर्ोग अवजध समाजि वाले वाहन पर्ाावरण अनुकूल तरीके स े प्रबंजधत दकए िाते ह ैं और पंिीकृत वाहन स्ट्क्रैलपंग केंद्र र्ा नाजमत संग्रह केंद्र म ेंिमा दकए िात े ह।ैं

(2) पंिीकृत माजलक छह महीन े स े अजधक समर् तक उस वाहन को नहीं रखगे ा और लाग ू जनर्मों के अनुसार उसके उपर्ोग अवजध समाजि वाले वाहन के रूप म ेंघोजषत होने के बाि िमा प्रमाण पत्र प्रस्ट्तुत करेगा।

6. थोक उपभोिा के उत्तरिाजर्त्व- (1) थोक उपभोिा का र्ह उत्तरिाजर्त्व होगा,-

(i) पोिाल पर पंिीकृत होना;

(ii) र्ह सुजनजित करना दक उपर्ोग अवजध समाजि वाल े वाहनों का प्रबंधन पर्ाावरण अनकु ूल तरीके स े दकर्ा िाता ह ैऔर उन् ह ेंपंिीकृत वाहन स्ट्क्रैलपंग केंद्र र्ा नाजमत संग्रह केंद्र म ेंिमा दकर्ा िाता ह;ै और

(iii) वाहन बेडे के साथ-साथ पंिीकृत वाहन स्ट्क्रैलपंग केंद्र म ें िमा दकए गए उपर्ोग अवजध समाजि वाले वाहनों के बारे म ें वार्षाक जववरणी प्रस्ट्त ुत करना।

(2) थोक उपभोिा वाहन को छह महीने स े अजधक समर् तक नहीं रखगे ा और लाग ू जनर्मों के अनुसार उसके उपर्ोग अवजध समाजि होने वाल े वाहन के रूप म ेंघोजषत होने के बाि िमा प्रमाणपत्र प्रस्ट्तुत करेगा।

7. सग्रं हण केंद्र के उत्त रिाजर्त्व - (1) सग्रं हण केंद्र उपर्ोग अवजध समाजि वाले वाहनों को एकत्र और सगं ृहीत करेगा और उन्ह ेंआगे की प्रदक्रर्ा के जलए पंिीकृत वाहन स्ट्क्रैलपंग केंद्र को भेिेगा।

(2) सग्रं हण केंद्र पर्ाावरण अनकु ूल तरीके स े उपर्ोग अवजध समाजि होने वाले वाहनों को संभालेगा।

8. स्ट्वचाजलत परीक्षण केंद्र के उत्त रिाजर्त् व: – (1) स्ट्वचाजलत परीक्षण केंद्र केंद्रीर् मोिर वाहन (इक्कीसवां संिोधन) जनर्म, 2021 के प्रावधानों के अनुसार स्ट्वचाजलत वाहन परीक्षण उपकरण के माध्र्म से वाहन उपर्ुक्ट् तता परीक्षण करेगा।

(2) स्ट्वचाजलत परीक्षण केंद्र केंद्रीर् मोिर वाहन (इक्कीसवां संिोधन) जनर्म, 2021 के प्रावधानों के अनुसार स्ट्वचाजलत उपर्ुक्ट् तता परीक्षण म ें जवफल रहन े पर दकसी वाहन को उपर्ोग अवजध समाजि वाला वाहन घोजषत करेगा।

(3) स्ट्वचाजलत परीक्षण केंद्र परीक्षण दकए गए वाहनों की संख्र्ा का ररकॉडा रखेगा और डेिा को केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा केंद्रीकृत ऑनलाइन पोिाल स े ललंक करेगा।

9. पिं ीकृत वाहन स्ट्क्रैलपगं केंद्र के उत्त रिाजर्त्व – पंिीकृत वाहन स्ट्क्रैलपंग केंद्र.-

(1) इन केंद्रों के पास जनम्न जलजखत के जलए पर्ाावरण की िजृ ष्ट स े अनुकूल प्रबंधन सुजवधा होगी;- i. िोधन (तरल पिाथ,ा गैसों, उत्प्रेरक, पारा र्ुि भागों, बैिरी और खतरनाक कचरे को प्रिषू ण-रजहत बनाना, संग्रह करना);

ii. जवघिन (जवजभन्न प्रकार के अपजिष्टों का पथृ क्करण करना और अलग-अलग रखना); iii. अलग-अलग कूडेिानों म ें जवजभन्न श्रेजणर्ों के कचरे का सुरजक्षत संग्रहण;

(iv) सामजग्रर्ों (प्लाजस्ट्िक, धात,ु िार्र, बैिरी और ई-कचरा) का स्ट्वर् ं द्वारा अथवा प्राजधकृत पुनचाक्रणकतााओं/ नवीकरणकतााओं के माध्र्म स ेपुनचाक्रण/नवीनीकरण।

(2) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा जवजहत दििा-जनििे ों के अनसु ार कार् ा करेगा;

(3) संबंजधत राज्र् प्रिषू ण जनर्ंत्रण बोडा स े एक बार पंिीकरण प्राि करन े के जलए फॉमा 2 (क) म ें आवेिन करेगा। पंिीकरण का प्रमाण पत्र फॉमा 2 (ख) म ें िारी दकर्ा िाएगा;

(4) उपचार, प्रिषू ण रजहत बनाने, जवघिन, पृथक्करण और पनु चाक्रण/नवीनीकरण गजतजवजधर्ों को करने के जलए अनुपर्िु वाहन र्ा पुरान ेवाहन प्राि करेगा;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(5) पुनचाक्रण/नवीनीकरण सुजवधा न होने की जस्ट्थजत म ें उपर्ोग अवजध समाजि वाले वाहनों स े प्राप् त और अलग की गई सामजग्रर्ों को पुिों र्ा सामजग्रर्ों के पनु चाक्रण और पुन: उपर्ोग के जलए पंिीकृत पुनचक्रा णकतााओं/नवीकरणकतााओं, सह-प्रसंस्ट् करणकताओंा को भेिगे ा;

(6) सभी गैर-पनु चाक्रणीर्/ गरै -नवीनीकरणीर् सामग्री और ररकवर न दकए िान े र्ोग्र् खतरनाक सामग्री को साझा खतरनाक अपजिष्ट िोधन, भंडारण और जनपिान केंद्र म ेंभेिेगा;

(7) खतरनाक और गैर-पुनचाक्रणीर्/गरै -नवीनीकरणीर् सामजग्रर्ों को साझा खतरनाक अपजिष्ट उपचार, भंडारण और जनपिान केंद्र को सौंपगे ा;

(8) उपर्ोग अवजध समाजि वाले वाहनों स े इस्ट् पात की मात्रा के आधार पर इन वाहनों के प्रसंस्ट्करण के उपरांत जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाण पत्र तैर्ार करेगा और केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा र्ा इसकी अजधकृत एिसें ी द्वारा सत्र्ापन के जलए ऑनलाइन पोिाल पर डेिा अपलोड करेगा;

(9) उपर्ोग अवजध समाजि वाल े वाहनों की प्राजि, इनस े उत्पन्न सामग्री और अजधकृत पनु चाक्रणकतााओं/ नवीनीकरणकतााओं र्ा िोधन केंद्रों और जनपिान केंद्रों को सौंपी गई जवजभन्न प्रकार की अपजिष्ट सामग्री के विन का ररकॉड ा रखेगा;

(10) जपछली जतमाही के अगले महीने की 30 तारीख तक प्राि उपर्ोग अवजध समाजि वाले वाहनों के भार और पुनचाक्रण/नवीनीकरण की गई र्ा पुनचाक्रण/नवीनीकरण, प्रसंस्ट्करण हते ु साझा खतरनाक अपजिष्ट िोधन, भंडारण और जनपिान केंद्रों को भेिी गई सामजग्रर्ों के विन (श्रेणी-वार) के संबंध म ें राज्र् प्रिषू ण जनर्ंत्रण बोड ा को प्रपत्र-3 म ें जतमाही जववरणी िाजखल करेगा और ररकाडा रखगे ा।

10. जवस्ट्ताररत उत्प ािक उत्तरिाजर्त्व प्रमाणपत्र तर्ै ार करना – (1) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा ऑनलाइन पोिाल के माध्र्म स े पंिीकृत वाहन स्ट्क्रैलपंग केंद्र के पक्ष म ें तैर्ार दकए गए जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व प्रमाण पत्र को सत्र्ाजपत और प्रमाजणत करेगा।

(2) जवस्ट्ताररत उत्पािक उत् तरिाजर्त् व प्रमाणपत्र मोिर वाहन (वाहन स्ट्क्रैलपंग केंद्र के पंिीकरण और कार्)ा जनर्म, 2021 के अनुसार पंिीकृत वाहन स्ट्क्रैलपंग केंद्र प्रसंस्ट् कृत उपर्ोग अवजध समाजि वाले वाहनों स े प्राप् त इस्ट् पात र्ा पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा पर संसाजधत अन्र् स्ट्िील स्ट्क्रैप सामग्री के विन के आधार पर तैर्ार दकर्ा िाएगा।

(3) ईपीआर िाजर्त्वों को पूरा करने के जलए पंिीकृत वाहन स्ट्क्रैलपंग केंद्र द्वारा तैर्ार दकए गए जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व प्रमाण पत्र जवजनमााताओं द्वारा केंद्रीकृत ऑनलाइन पोिाल के माध्र्म स े खरीिे िा सकते ह।ैं

(4) पंिीकृत वाहन स्ट्क्रैलपंग केंद्र के जलए जवस्ट्ताररत उत् पािक उत्त रिाजर्त् व प्रमाण पत्र का अनमु ान लगान े के जलए जनम्नजलजखत सूत्र का उपर्ोग दकर्ा िाएगा: जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व प्रमाण पत्र (दकग्रा म)ें = आरवीएसएफ पर उत्पन्न इस्ट् पात स्ट्क्रैप का भार (दकग्रा म)ें परन् तु दक जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाण पत्र अन्र् सभी उपर्ोग अवजध समाजि वाले वाहन सामजग्रर्ों के पुनचाक्रण/नवीनीकरण के लेखांकन और उपर्ोग अवजध समाजि वाले वाहन के कुल विन म ें स े ररकवर न करने र्ोग्र्/गरै - पुनचाक्रणीर्/गैर-नवीनीकरणीर् खतरनाक सामजग्रर्ों के पर्ाावरणीर् रूप स े अनुकूल ढंग स े जनपिान की ित ा पर तैर्ार दकए िाएंगे।

(5) कोई जवजनमााता जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व प्रमाण-पत्र अपनी चालू वषा की जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व िेर्ता के साथ-साथ पूवावती वषों की कोई िेष िर्े ता और चाल ू वषा की िेर्ता के बीस प्रजतित की सीमा तक खरीि सकता ह।ै

(6) जवजनमााता द्वारा खरीिे गए जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाण पत्रों को उनकी िेर्ता के जलए स्ट् वत: समार्ोजित दकर्ा िाएगा। i. समार्ोिन में प्राथजमकता पूव ाकी िेर्ता को िी िाएगी । ii. जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व संबंधी िाजर्त्वों को पूरा करने के जलए जवजनमााता द्वारा उपर्ोग दकए गए जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाणपत्रों को दफर स ेआिान-प्रिान नहीं दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 iii. जवजनमााता द्वारा खरीि े गए जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाण पत्रों को दकसी अन्र् जवजनमााता को हस्ट्तांतररत नहीं दकर्ा िाएगा।

(7) ऐस े सभी लने िने पंिीकृत वाहन स्ट्क्रैलपगं केंद्रों द्वारा जतमाही जववरणी िाजखल करन े के समर् ऑनलाइन पोिाल पर िि ाऔर प्रस्ट्त ुत दकए िाएंग।े

(8) पंिीकृत वाहन स्ट्क्रैलपंग केंद्रों द्वारा तैर्ार दकए गए जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व प्रमाण-पत्र जवजनमााता के िाजर्त्वों को पूरा करन े के जलए पंद्रह साल की अवजध के जलए वधै होंग।े

11. केन्द्रीर् प्रिषू ण जनर्त्रं ण बोडा के उत्तरिाजर्त्व:- (1) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा पणू ा आवेिन-पत्र प्रस्ट् ततु करने के िो सिाह के भीतर केन्द्रीकृत ऑनलाइन पोिाल के माध्र्म स े जवजनमााता का पंिीकरण (एक बार) करेगा।

(2) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड,ा पंिीकरण और जववरणी के जलए आवेिन पत्रों पर कारावाई करने हते ु िल्ु क जनधााररत कर सकेगा।

(3) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा केन्द्रीकृत ऑनलाइन जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व पोिाल को जवकजसत एव ं अनुरजक्षत करेगा तथा केन्द्रीकृत ऑनलाइन पोिाल पर जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व प्रमाणपत्रों के आिान-प्रिान के जलए तंत्र जवकजसत करेगा।

(4) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा ररकवर दकए गए इस्ट्पात की मात्रा के आधार पर पंिीकृत वाहन स्ट्क्रैलपंग केंद्र के पक्ष म ें जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व प्रमाण पत्र तैर्ार करेगा।

(5) अनुसूची-I के अनुसार जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी िाजर्त्वों का अनुपालन न दकए िान े की जस्ट्थजत म ें केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा सुनवाई का र्ुजिर्ुि अवसर िेने के पिात ् पंिीकरण को जनलंजबत और/र्ा रद्द करेगा, और/र्ा पर्ाावरणीर् क्षजतपूर्त ाअजधरोजपत करेगा।

(6) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा र्ह सुजनजित करेगा दक िब तक दक इन जनर्मों के अधीन अन्र्था जनलजम्बत और/र्ा रद्द न दकर्ा िाए, तब तक पंिीकरण दकर्ा िाए और र्दि आपजत्त न की िाए तो इस े िो सिाह के भीतर िारी दकर्ा िाए।

(8) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा र्ा दकसी नाजमत एिेंसी के िररए जनरीक्षण और आवजधक सपं रीक्षा के माध्र्म स े जवजनमााता द्वारा अनुपालन का सत्र्ापन करेगा।

(9) जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संपरीक्षा िाजर्त्वों सजहत इन जनर्मों के तहत उल्लंघनों के जलए और िाजर्त्वों को पूरा न करन े के जलए जनर्म 13 के अनुसार कारावाई होगी। दकसी राज्र् र्ा संघ राज्र् क्षत्रे के साथ संचालन करन े वाली संस्ट् था के मामले म,ें केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड,ा र्दि आवश्र्क हो, तो राज्र् प्रिषू ण जनर्ंत्रण बोडा को कारावाई करने का जनिेि ि े सकता ह।ै

(10) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा इन जनर्मों के अधीन स्ट्वर् ं र्ा पिं ीकृत वाहन स्ट्क्रैलपंग केंद्र की नाजमत एिेंसी द्वारा माल और सेवा कर नेिवका पोिाल स े िानकारी का उपर्ोग करने सजहत डेिा की संपरीक्षा करेगा।

(11) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा पिं ीकृत कंपनी द्वारा इन जनर्मों के उल्लंघन के मामल े म ें जवजनमााता के पंिीकरण को जनलंजबत और/र्ा रद्द करेगा और/र्ा पर्ाावरणीर् क्षजतपूर्त ाअजधरोजपत करेगा।

(12) जवजनमााता के पंिीकरण के जनलबं न र्ा जनरस्ट्तीकरण के संबंध म ें केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा के आििे ों के जवरुद्ध पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् म ें अपील की िाएगी और अपील प्रस्ट्तुत करने के पतैं ालीस दिनों के भीतर उसका जनपिान कर दिर्ा िाएगा।

(13) पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् म ें संर्ुि सजचव र्ा समकक्ष अजधकारी को अपीलीर् प्राजधकारी के रूप म ें नाजमत दकर्ा िाएगा। अपीलकता ा द्वारा नाजमत अपीलीर् प्राजधकारी को आिेि पाररत होने की तारीख स े तीस दिनों के भीतर जलजखत रूप म ेंऔर उस आिेि, जिसके जवरूद्ध अपील की गई ह,ै की एक प्रजत के साथ अपील की िाएगी।

(14) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड,ा पंिीकरण के जनलंबन और/र्ा रद्द करने के संबंध म ें राज्र् प्रिषू ण जनर्ंत्रण बोड ा के आिेि के जवरुद्ध पंिीकृत वाहन स्ट्क्रैलपंग केंद्र द्वारा की गई अपील को अपील की प्राजि के तीस दिनों के भीतर जनपिाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(15) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा म ें सिस्ट्र् सजचव को अपीलीर् प्राजधकारी के रूप म ें नाजमत दकर्ा िाएगा। अपीलकता ा द्वारा आििे पाररत होन े की तारीख स े तीस दिनों के भीतर नाजमत अपीलीर् प्राजधकारी को जलजखत रूप म ें अपील की िाएगी और इसके साथ अपील दकए गए आिेि की एक प्रजत सलं ग् न की िाएगी।

(16) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा, उपर्ोग अवजध समाप् त हुए वाहनों की सामजग्रर्ों के हथालन, प्रसंस्ट्करण और पुनचाक्रण/पुननावीनीकरण के जलए पर्ाावरणीर् िजृ ष्ट स ेअनुकूल प्रबंधन संबंधी दििाजनििे िारी करेगा।

(17) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा, इन जनर्मों के तहत िाजर्त्वों को पूरा न करने के मामले म ें उत्पािकों और पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा पर पर्ाावरणीर् क्षजतपूर्त ालगान ेऔर इसे एकत्र करन े संबंधी दििाजनििे तैर्ार करेगा।

(18) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा, राज्र् प्रिषू ण जनर्ंत्रण बोडों स े प्रत्र्ेक वष ा प्राि आंकडों का संकलन और प्रकािन करेगा।

(19) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड,ा उन उत्पािकों की सूची प्रकाजित करेगा िो वार्षाक आधार पर जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी लक्ष्र्ों और िाजर्त्वों को पूरा करने म ें जवफल रह े ह।ैं

(20) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा, उत्पािकों के जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी लक्ष्र्ों और वार्षाक जववरजणर्ों को साझा करेगा।

(21) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा, उत्पािक द्वारा जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी िाजर्त्वों की घोषणा के जलए प्रपत्र जनधााररत करेगा।

(22) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड,ा उत्पािक द्वारा जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी िाजर्त्वों को पूरा करन े के संबंध म ें वार्षाक जववरजणर्ां प्रस्ट्तुत करने के जलए प्रपत्र जनधााररत करेगा।

(23) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड,ा इन जनर्मों के भीतर प्ररूपों को अपेक्षानुसार संिोजधत करेगा और िहां र्ह जनधााररत नहीं ह ैवहा ं प्ररूप जनधााररत करेगा।

(24) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा, इन जनर्मों के तहत िाजर्त्वों को पूरा करने म ें जहतधारकों के बीच जनर्जमत रूप स े संवाि सुजनजित करन े के जलए एक कार्ातंत्र स्ट्थाजपत करेगा।

(25) केन्द्रीर् सरकार, इन जनर्मों के प्रभावी कार्ाान्वर्न के जलए जनर्म 15 के अनुसार एक कार्ाान्वर्न सजमजत का गठन करेगी और इस े सिक्ट् त बनाने की जसफाररिें करेगी। र्ह सजमजत, पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को अपनी ररपोिा और जसफाररि ें प्रस्ट्तुत करन े के जलए छह महीन ेम ें कम स े कम एक बार बैठक करेगी।

(26) केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा, वार्षाक ररपोिा प्रकाजित करेगा।

(27) प्रत् र्ाजर्त अजभकरण के माध्र्म स े और केंद्रीर् सरकार के अनुमोिन स े केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी दििाजनिेिों के अनुसार, जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व प्रमाणपत्रों की जबक्री और खरीि के जलए एक र्ा अजधक व्यापार मंच स्ट्थाजपत दकर्ा िा सकता ह।ै

(28) बाध्र् संस्ट्थाओं के बीच जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व प्रमाणपत्रों के व्यापार के जलए उप-जनर्म 27 के तहत स्ट्थाजपत इलेक्ट्रॉजनक प्लेिफॉमा (प्लेिफामों) का प्रचालन और जवजनर्मन, इस उद्दश्े र् के जलए केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा की अनुिंसाओं के आधार पर केंद्रीर् सरकार द्वारा अजधसूजचत मागाििी जसद्धांतों के अनुसार होगा।

(29) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा, उपर्ोग अवजध समाप् त हुए वाहनों के संग्रहण और पर्ाावरणीर् िजृ ष्ट स े सुिढ़ृ प्रबंधन की लागत और लाग ू पर्ाावरणीर् क्षजतपूर्ता व्यवस्ट्था को ध्र्ान म ें रखत े हुए प्रत्र्ेक छह महीने म ें र्ा आवश्र्कतानुसार जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व प्रमाणपत्र के जलए उच्चतम और न्र्नू तम मल्ू र् जनर्त करेगा।

12. राज्र् सरकार/राज्र् प्रिषू ण जनर्त्रं ण बोडा के उत्त रिाजर्त् व –

(1) राज्र् प्रिषू ण जनर्ंत्रण बोडा, केंद्रीकृत पोिाल म ें पंिीकृत वाहन स्ट्क्रैलपगं सुजवधा का एक बारगी ऑनलाइन पंिीकरण करेगा।

(2) र्दि पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा द्वारा प्रिान की गई िानकारी गलत पाई िाती ह,ै तो राज्र् प्रिषू ण जनर्ंत्रण बोडा, सुनवाई का उजचत अवसर िने े के बाि जनर्म 13 के तहत जनर्त की गई कारावाई सजहत उक्ट्त सुजवधा के पंिीकरण को पांच वषा की अवजध तक जनलंजबत और/र्ा रद्द करेगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9

(3) राज्र् प्रिषू ण जनर्ंत्रण बोडा, पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा द्वारा प्रस्ट्तुत की गई त्रैमाजसक ररपोिों को संकजलत करेगा, केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा को अग्रेजषत करेगा और उन्ह ें ऑनलाइन प्रकाजित करेगा।

(4) राज्र् प्रिषू ण जनर्ंत्रण बोडा, इन जनर्मों के तहत िाजर्त्वों की पूर्त ा म ें िाजमल संबंजधत जहतधारकों के बीच जनर्जमत संवाि सुजनजित करेगा।

(5) राज्र् प्रिषू ण जनर्ंत्रण बोडा, इन जनर्मों के प्रभावी कार्ाान्वर्न के संबंध म ें हर वषा 30 िून तक केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा को वार्षाक ररपोिा प्रस्ट्ततु करेगा।

(6) राज्र् प्रिषू ण जनर्ंत्रण बोडा र्ा कोई नाजमत अजभकरण, जनरीक्षण और आवजधक लेखा परीक्षा के माध्र्म स े पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा द्वारा अनुपालन को सत्र्ाजपत करेगा और इन जनर्मों के उल्लंघन के मामले म ें पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा के पंिीकरण को जनलंजबत और/र्ा रद्द करेगा और/र्ा उस पर पर्ाावरणीर् क्षजतपूर्ता लगाएगा।

(7) राज्र् सरकार र्ह सुजनजित करेगी दक संबंजधत राज्र्ों म ें पर्ााि संख्र्ा म ें पंिीकृत वाहन स्ट्क्रैलपंग सुजवधाएं और स्ट्वचाजलत परीक्षण स्ट्िेिन एक समान तरीके स े स्ट्थाजपत दकए िाएं। सडक पररवहन और रािमागा मंत्रालर्, इस संबंध म ें दििाजनिेि िारी कर सकता ह।ै

(8) उपर्ोग अवजध समाप् त हुए वाहनों को पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा र्ा नाजमत सग्रं ह केंद्र म ें सुरजक्षत तरीके स े पहुचं ाने के कार् ा को प्रोत्साजहत करने के जलए िागरूकता अजभर्ान चलाना और ग्राहकों को प्रोत्साहन िेना।

13. उल्लघं न पर कारावाई और पर्ावा रणीर् क्षजतपर्ू त ालगाना –

(1) इन जनर्मों के जनम्न जलजखत उपबंधों का अनुपालन न करने पर पर्ाावरणीर् क्षजतपूर्ता लगाई िाएगी, अथाात्: i. जनधााररत ईपीआर लक्ष्र्ों को परू ा नहीं करने के जलए; ii. इन जनर्मों के तहत अजधिेजित दकए गए अनुसार पंिीकरण के जबना कार्ाकलाप करन े के जलए;

iii. इन जनर्मों के तहत पंिीकृत संस्ट्थाओं द्वारा गलत िानकारी प्रिान करन/े िानबूझकर महत् वपूणा त्र्ों को जछपाने के जलए; iv. इन जनर्मों के तहत पंिीकृत सस्ट्ं थाओं द्वारा िाली/हरे ा-फेरी कर िस्ट्तावेि प्रस्ट्तुत करन े के जलए;

v. पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा र्ा अन्र् संस्ट्थाओं के मामल े म ें उपर्ोग अवजध समाप् त हुए वाहनों के पर्ाावरणीर् िजृ ष्ट स ेअनुकूल हथालन/प्रबंधन का अनुपालन नहीं करने के जलए।

(2) इकाई द्वारा इकाई द्वारा स्ट्वर् ं जनर्मों स े बचने र्ा इनका उल्लंघन करने र्ा दकसी भी बाध्र् इकाई को िाजर्त्वों स े बचने र्ा उल्लघं न करने में मिि िेने के मामले म ें इनके संबंध म ें सुनवाई का अवसर िने े के बाि पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 15 के उपबंधों के तहत भी कारावाई की िा सकती ह।ै

(3) इन जनर्मों म ें जनधााररत अपने जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी लक्ष्र्ों, उत् तरिाजर्त् वों और िाजर्त्वों को पूरा न करन े के संबंध म ें प्रचालन करन े वाल े उत्पािक पर केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड ा द्वारा पर्ाावरणीर् क्षजतपूर्त ा लगाई िाएगी।

(4) इन जनर्मों के तहत जनधााररत अपन े उत् तरिाजर्त् वों और िाजर्त्वों को पूरा न करन े के सबं ंध म ें संबंजधत राज्र् प्रिषू ण जनर्ंत्रण बोडा द्वारा अपन े अजधकार क्षत्रे म ें प्रचाजलत पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा पर पर्ाावरणीर् क्षजतपूर्ता लगाई िाएगी। राज्र् प्रिषू ण जनर्ंत्रण बोडा द्वारा साठ दिनों म ें कारावाई न करने के मामल े म ें केन्द्रीर् प्रिषू ण जनर्ंत्रण बोड,ा राज्र् प्रिषू ण जनर्ंत्रण बोड ा को जनििे िारी करेगा।

(5) पर्ाावरणीर् क्षजतपूर्त ा का भगु तान करन े स े इन जनर्मों के तहत जनधााररत जनमााता का जवस्ट्ताररत उत्पािक उत् तरिाजर्त् व संबंधी िाजर्त्व समाि नहीं होगा।

(i) दकसी जविेष वषा के जलए अधूरे जवस्ट्ताररत उत्पािक उत् तरिाजर्त्व संबंधी िाजर्त् व को उससे अगल े तीन वषों की अवजध के जलए अगल े वषा म ेंबढ़ार्ा िाएगा।

(ii) बाि के वषों म ें तीन वषों के भीतर जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व संबंधी िाजर्त्व की कमी का जनराकरण दकए िान े के मामले म ेंउत् पािक को नीच े दिए गए अनुसार पर्ाावरणीर् क्षजतपूर्ता वापस की िाएगी, – क. पर्ाावरणीर् क्षजतपूर्त ालगान े के एक वषा के भीतर : 75 प्रजतित वापसी;10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ख. िो वषा के भीतर : 60 फीसिी वापसी;

ग. तीन वषा के भीतर : 40 फीसिी वापसी

(6) पर्ाावरणीर् क्षजतपूर्ता के िर्े होने के तीन वषा परू ा होने के बाि, संपूणा पर्ाावरणीर् क्षजतपूर्त ा की राजि िब्त कर ली िाएगी और इस व्यवस्ट्था स े बाि के वषों म ें भी संबंजधत संस्ट्थाओं द्वारा उपर्ोग अवजध समाप् त हुए वाहनों की सामजग्रर्ों के पुनचाक्रण/पुननावीनीकरण की अनुमजत होगी।

(7) पर्ाावरणीर् क्षजतपूर्त ा के तहत एकत्र की गई जनजधर्ों को केंद्रीर् प्रिषू ण जनर्ंत्रण बोडा र्ा राज्र् प्रिषू ण जनर्ंत्रण बोडा द्वारा एक अलग खाते म ें रखा िाएगा।

(i) एकत्र की गई जनजधर्ों का उपर्ोग, असंग्रहीत उपर्ोग अवजध समाप् त हुए वाहनों, जिनके जवरुद्ध पर्ाावरणीर् क्षजतपूर्ता लगार्ा गर्ा ह,ै के संग्रहण और पनु चाक्रण म ें दकर्ा िाएगा।

(ii) उपर्ोग अवजध समाप् त हुए वाहनों के प्रबंधन के जलए जनजधर्ों के उपर्ोग की कार्ारीजतर्ों को कार्ाान्वर्न सजमजत द्वारा अंजतम रूप दिर्ा िाएगा।

(8) इन दििा-जनििे ों के तहत जनधााररत िाजर्त्वों को पूरा न करने पर पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 15 के उपबंधों के तहत िडं ात्मक कारावाई की िाएगी।

14. केंद्रीकृत ऑनलाइन पोिाल – (1) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा, इन जनर्मों के लागू होन े के छह माह के भीतर उत्पािकों द्वारा पंिीकरण और जववरजणर्ां िाजखल करने और पंिीकृत वाहन स्ट्क्रैलपगं सुजवधा के पंिीकरण और उपर्ोग अवजध समाप् त हुए वाहनों के साथ-साथ सभी संस्ट्थाओं के सभी िाजर्त्वों के संबंध म ें जववरजणर्ां भरने के जलए एक केन्द्रीकृत ऑनलाइन पोिाल स्ट्थाजपत करेगा।

(2) इस प्रणाली स े ऐसा कार्ातंत्र सुजनजित होगा जिसम ें उपर्ोग अवजध समाप् त हुए वाहनों की प्राजि के सामग्री िेष और पंिीकृत वाहन स्ट्क्रैलपंग सुजवधा द्वारा उत् सर्िात जवजभन्न प्रकार की अपजिष्ट सामजग्रर्ा ं प्रिर्िात होंगी।

(3) र्ह पोिाल, उत्पािकों और आरवीएसएफ को उत्पािकों के जवस्ट्ताररत उत् पािक उत् तरिाजर्त्व संबंधी िाजर्त् वों को पूरा करने के जलए जवस्ट्ताररत उत् पािक उत् तरिाजर्त् व प्रमाण-पत्र का आिान-प्रिान करन े की सजु वधा प्रिान करेगा।

(4) राज्र् प्रिषू ण जनर्ंत्रण बोड,ा पिं ीकृत वाहन स्ट्क्रैलपंग सुजवधा के पंिीकरण और आरवीएसएफ द्वारा जववरजणर्ा ं िाजखल करन े के जलए इस केंद्रीकृत ऑनलाइन पोिाल का उपर्ोग करेगा।

(5) र्ह केंद्रीकृत ऑनलाइन पोिाल, इन जनर्मों के कार्ाान्वर्न स े सबं ंजधत आिेिों और दििाजनिेिों के संबंध म ें एकल लबंि ुडेिा संग्रह के रूप म ेंकार्ा करेगा।

(6) उत् पािक, इस ऑनलाइन पोिाल के जवकास को सुजवधािनक बनाएंगे।

15. कार्ान्ा वर्न सजमजत. – (1) केंद्रीर् सरकार द्वारा इन जनर्मों के प्रभावी कार्ाान्वर्न के जलए पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर् को उपार्ों की जसफाररि करन े के जलए अध्र्क्ष, केंद्रीर् प्रिषू ण जनर्ंत्रण बोड ा की अध्र्क्षता म ें एक सजमजत गरठत की िाएगी।

(2) र्ह सजमजत इन जनर्मों के कार्ाान्वर्न की जनगरानी करेगी।

(3) र्ह सजमजत इन जनर्मों के प्रभावी कार्ाान्वर्न म ें आने वाली करठनाइर्ों को िरू करने के उपार् करेगी और संिोधन, र्दि कोई हो, के प्रस्ट्तावों की जसफाररि करेगी।

(4) इस सजमजत को इस ऑनलाइन पोिाल के जवकास और प्रचालन संबंधी मागाििान और पर्ावेक्षण का कार् ा भी सौंपा िाएगा।

(5) सजमजत द्वारा इन जनर्मों स े संबद्ध प्ररूपों म ें कोई भी संिोधन दकर्ा िा सकता ह।ै

(6) इस सजमजत म ें सडक पररवहन और रािमाग ा मंत्रालर्, इस्ट्पात मंत्रालर्, भारतीर् मानक ब्र्रू ो, एआरएआई िैस े संगठनों, राज्र् प्रिषू ण जनर्ंत्रण बोडों, राष्ट्रीर् पर्ाावरणीर् अजभर्ांजत्रकी अनुसंधान संस्ट्थान के प्रजतजनजधर्ों तथा उत्पािकों एव ं पुनचाक्रणकतााओं का प्रजतजनजधत्व करने वाले संघों और सजमजत के अध्र्क्ष द्वारा आमंजत्रत दकसी अन्र् जहतधारक िाजमल होंगे।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 अनसु चू ी I [जनर्म 4(1)(i) िेख]ें जवस्ट्ताररत उत्प ािक उत्तरिाजर्त्व के जलए लक्ष्र् – (i) इन जनर्मों के प्रकािन के उपरांत, बाि के वषों म ें र्दि कोई नर्ा जवजनमााता बािार म ें वाहनों को लाता ह,ै तो वाहनों की जवजभन् न श्रेजणर्ों के जलए जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व संबंधी लक्ष्र्, वाहन की उक्ट्त के जलए नीच े िी गई ताजलकाओं म ें उजल्लजखत औसतन उपर्ोग अवजध के आधार पर लाग ू होंगे।

(ii) जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व लक्ष्र्ों म ें संबंजधत वषों के पुनचाक्रण लक्ष्र् िाजमल ह ैं िैसा दक नीच े िी गई ताजलकाओं म ेंउजल्लजखत ह।ै

(iii) वाहनों की समर्ावजध समाि होने के बाि उनके पुनचक्रा ण का अथ ा ह ै समर्ावजध समाि हुए वाहनों म ें स े बचे हुए स्ट्िील का पुनचाक्रण।

(iv) बैिरी संबंधी जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व लक्ष्र् बैिरी अपजिष्ट प्रबंधन जनर्म, 2022 म ें दिए गए अनुसार होंगे।

(v) िार्रों के जलए जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व खतरनाक और अन्र् अपजिष्ट (प्रबंधन और सीमापारीर् संचलन) संिोधन जनर्म, 2022 म ें दिए गए अनुसार होंगे।

(vi) प्रर्ुि तले के जलए जवस्ट्ताररत उत्पािक उत्तरिाजर्त्व, खतरनाक और अन्र् अपजिष्ट (प्रबंधन और सीमापारीर् संचलन) संिोधन जनर्म, 2023 म ें दिए गए अनुसार होंगे।

(vii) जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व संबंधी लक्ष्र् वाहन की श्रेणी (जनिी वाहन और वाजणजज्र्क वाहन) के जलए जवजिष्ट होंगे।

(viii) केंद्रीकृत पोिाल के माध्र्म स े पंिीकृत वाहन स्ट्क्रैलपंग सुजवधाओं द्वारा उपलब्ध कराए गए जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाणपत्रों के माध्र्म स े जनमााता अपने जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व के तहत िाजर्त्वों को पूरा करेगा। पंिीकृत वाहन स्ट्क्रैलपंग सुजवधाओं के पास जवस्ट्ताररत उत् पािक उत्तरिाजर्त्व प्रमाण पत्र की अनुपलब्धता के मामल े म,ें उत् पािक के पास एकत्रण की जिम्मेिारी भी होगी।

NOTIFICATION New Delhi, the 30th January, 2024 S.O. 367(E).—The following draft notification, which the Central Government proposes to issue, in exercise of the powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), for bringing out regulations for Extended Producer Responsibility (EPR) for End-of-Life Vehicles, is hereby published as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for information of the public and other stakeholders likely to be affected thereby and notice is hereby given that the said notification will be taken into consideration by the Central Government on or after the expiry of sixty days from the date on which copies of this

notification as published in the Gazette of India are made available to the public;

Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (vii) of sub-

section (2) of section 3, sub-section (1), clause (c) and clause (d) of sub-section (2) of section 6, section 8, clause (b) of sub-section 2 of section 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules, namely:-18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

1. Short title and commencement. – (1) These rules may be called the Draft End-of-Life Vehicles (Management) Rules, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. – (1) These rules shall apply to, –(i) Producer, consumer, entities involved testing of vehicles, handling, processing and recycling of End-of life Vehicles, but shall not apply to: a. waste batteries as covered under the Battery Waste Management Rules, 2022;

b. packaging plastics as covered under the Plastic Waste Management Rules, 2016; c. waste tyres as covered under Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2022;

d. used oil as covered under the Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2023. e. E-waste as covered under E-Waste (Management) Rules, 2022.

(ii) all types of vehicles as per clause (28) of section 2 of the Motor Vehicles Act, 1988 (59 of 1988).

3. Definitions. – (1) In these rules, unless the context otherwise requires, –

(a) “Act” means the Environment (Protection) Act, 1986 (29 of 1986);

(b) “Automated Testing Station” means any automated testing facility, as defined in the Central Motor Vehicles (Twenty first Amendment) Rules, 2021and amendments thereafter;

(c) “Central Pollution Control Board” means the Central Pollution Control Board as constituted under sub-section

(1) of section 3 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974);

(d) “Certificate of Deposit” means the certificate issued by the Registered Vehicle Scrapping Facility as defined under the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 20221 and amendments thereafter;

(e) “Collection Centre” means a facility or an area that may be used for the sole purpose of collecting and storing the End of Life Vehicles as defined under the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 20221 and amendments thereafter;

(f) “consumer” means end user of vehicle;

(g) “bulk consumer” means consumer having ownership of more than 100 vehicles;

(h) “disposal” means any operation which does not lead to reuse, recovery, recycling/refurbishing and inter-alia include physico-chemical and/or biological treatment and/or deposition in secured landfill;

(i) “environmentally sound management” means management of End-of-Life Vehicle in a manner to protect human health and environment against any adverse effects, which may result from any substance contained in the End-of-Life Vehicle;

(j) “End-of-Life Vehicle” means a vehicle,-

(i) which is no longer validly registered; or

(ii) which has been declared unfit by Automated Testing Station after undergoing test or re-test as specified under the provisions of the Central Motor Vehicles (Twenty first Amendment) Rules, 2021 or Central Motor Vehicles (Eight Amendment) Rules, 2022; or

(iii) of which registration has been cancelled under Chapter IV of the Central Motor Vehicles Act, 1988 (59 of

1988); or

(iv) declared as End-of-Life due to an order of a Court of Law; or

(v) which is self-declared by the legitimate registered owner as a waste vehicle due to any circumstances that may arise from fire, damage, natural disaster, riots or accidents, or otherwise.

(k) “Extended Producer Responsibility” means responsibility of any Producer of vehicles for environmentally sound management of End-of-Life Vehicle;

(l) “Extended Producer Responsibility registration” means registration by Central Pollution Control Board of a producer for Extended Producer Responsibility;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19

(m) “Extended Producer Responsibility certificate” means a certificate issued by Central Pollution Control Board for Registered Vehicle Scrapping Facility that may be purchased by producer to meet the Extended Producer Responsibility target;

(n) “facility” means any location wherein the process incidental to the collection, storage, segregation, recycling/ refurbishing, disposal of End-of-Life Vehicles is carried out;

(o) “form” means Forms appended to these rules;

(p) “hazardous waste” means hazardous waste as defined under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.

(q) “manufacturer” means a person or an entity or a company as defined in the Companies Act, 2013 (18 of 2013) or a factory as in the Factories Act, 1948 (63 of 1948) which has facilities for manufacturing of vehicles;

(r) “producer” means an entity who engages in domestic market for:

(i) manufacture/assembly and sale of vehicles under its own brand; or

(ii) sale of vehicles under its own brand produced by other manufacturers or suppliers; or

(iii) import of vehicles;

(iv) manufacture/assembly and sale of vehicles to producer defined in 3 (r) (ii), not under its own brand.

(s) “registered owner” means a person in whose name a motor vehicle stands registered, and where such person is a minor, the guardian of such minor, and in relation to a motor vehicle which is the subject of a hire-purchase, agreement, or an agreement of lease or an agreement of hypothecation, the person in possession of the vehicle under that agreement;

(t) “recycler” means entity engaged in recycling of materials of End-of-Life Vehicles;

(u) “refurbisher” means entity engaged in refurbishing of materials of End-of-Life Vehicles;

(v) “Registered Vehicle Scrapping Facility” as defined under Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021 and amendments thereafter;

(w) “Schedule” means Schedule appended to these rules;

(x) “State Pollution Control Board" means the State Pollution Control Board constituted under Section 4 of Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and includes in relation to Union territory, the Pollution Control Committee;

(y) “storage” means storage of End-of-Life Vehicles;

(z) “treatment” means any activity after the end of life vehicle has been handed over for depollution, dismantling, shearing, shredding, recovery or preparation for disposal of the shredder wastes, and any other operation carried out for the recovery/recycling or disposal of the end of life vehicle and its components;

(za) “vehicle” means a motor vehicle or vehicle, -

(a) as defined in clause (28) of section 2 of the Motor Vehicles Act, 1988 (59 of 1988); and

(b) electric vehicles or battery operated vehicles including e-rikshaw and e-carts.

(2) Words and expressions not defined in these rules will have the same meaning as defined in the Environment

(Protection) Act, 1986.

4. Responsibilities of producer – (1) It shall be the responsibility of the producer to,-

(i) fulfil the obligation of Extended Producer Responsibility for the vehicles that they introduce in the domestic market including vehicles put to self-use to ensure the recycling targets as specified in Schedule I;

(ii) meet the recycling targets of End-of-Life Vehicles as mentioned in Schedule I for vehicles made available in the market;

(iii) in case, the Producer is manufacturing or assembling vehicles and not placing it in the market in its own brand name, such Producer shall register themselves as the Producer of vehicle to the extent of meeting the Extended Producer Responsibility obligations for environmentally sound management of direct pre- consumer waste generated during manufacturing/assembly which is not already covered under other waste management policies.

(iv) take necessary measures to encourage End-of-Life Vehicles are deposited at the Registered Vehicle Scrapping Facility or designated Collection Centres;20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(v) fulfil the Extended Producer Responsibility either through purchase of Extended Producer Responsibility certificate generated by its own Registered Vehicle Scrapping Facility or by any entity having Registered Vehicle Scrapping Facility;

(vi) deploy any schemes such as buy back scheme, deposit refund scheme or any other, and designate any other entity to fulfil the obligation of Extended Producer Responsibility;

(vii) obtain one-time registration as a producer from Central Pollution Control Board in Form 1(A). The certificate of registration shall be issued in Form 1(B);

(viii) furnish annual returns in Form 1(C) to CPCB by 30th June for the previous financial year in respect of the information regarding number, type and weight of steel used in vehicles placed in the market including vehicles put to self-use in previous financial year;

(ix) furnish annual returns by 30th June in respect of fulfilment of Extended Producer Responsibility obligations during the previous financial year, as per the form prescribed by Central Pollution Control Board;

(xi) declare their Extended Producer Responsibility obligations for the current year by 30th April of the same year as per the form prescribed by Central Pollution Control Board;

(xi) inform the Central Pollution Control Board of any changes to the information contained in the Extended Producer Responsibility Registration and of any permanent cessation as regards to the making available on the market of the vehicles referred to in the Extended Producer Responsibility Registration;

(xii) bring to the notice of the Central Pollution Control Board or State Pollution Control Board of violations of these rules by any entity involved in handling and management of End-of-Life Vehicles;

(xiii) take measures to comply with the provisions of AIS-219, as notified by the Government of India, under Centre Motor Vehicles Rules, 1989.

(2) Producer shall not deal with any other entity not having registration mandated under these rules or under the EP Act.

(3) In order to meet the obligations of Extended Producer Responsibility, the producer may engage itself or authorize any other entity. However, the obligations of meeting the Extended Producer Responsibility targets shall remain with the producer.

5. Responsibilities of registered owner – (1) It shall be the responsibility of the registered owner to ensure that End-of-Life Vehicles are managed in an environmentally sound manner and deposited at the Registered Vehicle Scrapping Facility or the designated Collection Centre.

(2) Registered owner shall not hold the vehicle for more than six months and shall produce Certificate of Deposit after its declaration as End-of-Life Vehicle as per the prevailing rules.

6. Responsibilities of bulk consumer- (1) It shall be the responsibility of the bulk consumer to,-

(i) get registered on the portal;

(ii) ensure that End-of-Life Vehicles are managed in an environmentally sound manner and deposited at the Registered Vehicle Scrapping Facility or the designated Collection Centre; and

(iii) file annual returns about the vehicle fleet as well as the End-of-Life Vehicles deposited at Registered Vehicle Scrapping Facility.

(2) Bulk consumer shall not hold the vehicle for more than six months and shall produce Certificate of Deposit after its declaration as End-of-Life Vehicle as per the prevailing rules.

7. Responsibilities of Collection Centre- (1) Collection Centre shall collect and store End-of-Life Vehicles and send them for further processing to Registered Vehicle Scrapping Facility.

(2) Collection Centre shall handle the End-of-Life Vehicles in an environmentally sound manner.

8. Responsibilities of Automated Testing Station. – (1) Automated Testing Station shall conduct vehicle fitness testing through automated vehicle testing equipment in accordance with provisions of Central Motor Vehicles (Twenty First Amendment) Rules, 2021.

(2) Automated Testing Station shall declare a vehicle as End-of-Life Vehicle if it fails the automated fitness test in accordance with provisions of Central Motor Vehicles (Twenty First Amendment) Rules, 2021.

(3) Automated Testing Station shall maintain the record of number of vehicles tested and link the data to the centralised online portal by Central Pollution Control Board.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21

9. Responsibilities of Registered Vehicle Scrapping Facility.– Registered Vehicle Scrapping Facility shall.-

(1) have environmentally sound management facility for;- i. treatment (de-pollution, collection of liquids, gases, catalyst, mercury containing parts, batteries and hazardous waste); ii. dismantling (segregation and separation of various types of wastes);

iii. safe storage of various categories of wastes in separate bins; iv. recycling/refurbishing of materials (plastic, metals, tyres, batteries and e-waste) on its own or through authorized recyclers/refurbishers.

(2) function in accordance with the guidelines prescribed by the Central Pollution Control Board;

(3) make an application in Form 2(A) to obtain one-time registration from the concerned State Pollution Control Board. The certificate of registration shall be issued in Form 2(B);

(4) receive unfit vehicles or end-of-life vehicles for carrying out treatment, depolluting, dismantling, segregation and recycling/refurbishing activities.

(5) send all the recovered and segregated materials from End-of-life Vehicles to registered recyclers/refurbishers, co-processors for recycling and reuse of components or materials, in case of not having recycling/refurbishing facility,

(6) send all non-recyclable/ non-refurbishable materials and non-recoverable hazardous materials to Common Hazardous Waste Treatment, Storage and Disposal Facility;

(7) hand over the hazardous and non-recyclable/ non-refurbishable materials to Common Hazardous Waste Treatment, Storage and Disposal Facility;

(8) generate Extended Producer Responsibility certificates upon processing of End-of-life vehicles based on the quantity of steel from the End-of-Life Vehicles and upload the data on online portal for verification by Central Pollution Control Board or its authorised agency;

(9) maintain records of receipt of End-of-Vehicles, weight of various types of waste materials generated and handed over to authorized recyclers/refurbishers or treatment facilities and disposal facilities;

(10) file quarterly returns to State Pollution Control Board in Form 3 on weight of End-of-Life Vehicles received and weight of materials (category-wise) recycled/refurbished or sent for recycling/refurbishing, processing, and Common Hazardous Waste Treatment, Storage and Disposal Facilities by 30th of the next month of the previous quarter, and keep a record.

10. Extended Producer Responsibility Certificate Generation. – (1) The Central Pollution Control Board shall verify and authenticate the Extended Producer Responsibility certificates through the online portal generated in favour of the Registered Vehicle Scrapping Facility.

(2) Extended Producer Certificate shall be generated on basis of the weight of steel recovered from the End-of-Life vehicles processed at the Registered Vehicle Scrapping Facility or other steel scrap materials processed at Registered Vehicle Scrapping Facility in accordance with the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021.

(3) Extended Producer Responsibility certificates generated by Registered Vehicle Scrapping Facility can be purchased by Producers through the centralised online portal to meet the EPR obligations.

(4) The following formula shall be used to estimate the Extended Producer Responsibility certificates for

Registered Vehicle Scrapping Facility:

Extended Producer Responsibility certificates (in kg) = Weight of the steel scrap generated (in kg) at RVSF

Provided that the Extended Producer Responsibility certificate shall be generated subject to the accounting of recycling/refurbishing of all other End-of-Life Vehicles materials and environmentally sound disposal of non- recoverable/non-recyclable/non-refurbishable hazardous materials out of the total weight of the End-of-Life Vehicle.

(5) A Producer can purchase Extended Producer Responsibility certificates limited to its Extended Producer Responsibility liability of current year plus any leftover liability of preceding years plus twenty percent of the current year liability.

(6) Extended Producer Responsibility certificates purchased by the Producer will be automatically adjusted against their liability. i. Priority in adjustment will be given to earlier liability.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ii. Extended Producer Responsibility certificates used by producer to meet Extended Producer Responsibility obligations shall not be exchanged again.

iii. Extended Producer Responsibility certificates purchased by the producer are not transferrable to any other producer.

(7) All such transactions shall be recorded and submitted by the Registered Vehicle Scrapping Facilities on the online portal at the time of filing quarterly returns.

(8) Extended Producer Responsibility certificates generated by Registered Vehicle Scrapping Facilities shall be valid for a period of fifteen years for meeting the obligations of producer.

11. Responsibilities of Central Pollution Control Board. – (1) Central Pollution Control Board shall register the producer (one-time) through the centralized online portal in Form within two weeks from the submission of a completed application.

(2) Central Pollution Control Board may determine the fee for processing of applications for registration as well as returns.

(3) Central Pollution Control Board shall develop and maintain the centralized online Extended Producer Responsibility portal and develop the mechanism for exchange of Extended Producer Responsibility certificates on the centralized online portal.

(4) Central Pollution Control Board shall generate Extended Producer Responsibility certificates in favour of Registered Vehicle Scrapping Facility based on the quantity of steel recovered.

(5) Central Pollution Control Board shall suspend and/or cancel the registration, and/or impose Environmental Compensation, in case of non-compliance of Extended Producer Responsibility obligations as per Schedule I after giving reasonable opportunity of being heard.

(6) Central Pollution Control Board shall ensure that registration is done unless otherwise suspended and/or cancelled under these rules and deemed to be issued if not objected within two weeks.

(8) Central Pollution Control Board or through a designated agency shall verify compliance by the producer through inspection and periodic audit.

(9) The actions against violations and for non-fulfilment of obligations under these rules including Extended Producer Responsibility obligations shall be as per rule 13. In case of entity operating with a State or Union Territory, Central Pollution Control Board may, if required, direct State Pollution Control Board to take action.

(10) Central Pollution Control Board shall carry out audit of data, including using information from Goods and Services Tax Network portal, by itself or a designated agency of Registered Vehicle Scrapping Facility under these rules.

(11) Central Pollution Control Board shall suspend and/or cancel the registration of producer, and/or impose Environmental Compensation in case of violation of these rules by the registered entity.

(12) Appeal made against the orders of Central Pollution Control Board regarding suspension or cancellation of registration of producer lies with the Ministry of Environment, Forest and Climate Change and will be disposed off within forty-five days after the submission of the appeal.

(13) The Joint Secretary or the officer equivalent in the Ministry of Environment, Forest and Climate Change shall be designated as an Appellate Authority. The appeal shall be made by the appellant to the designated Appellate Authority in writing and accompanied with a copy of the order appealed against within thirty days from the date of passing of the order.

(14) Central Pollution Control Board shall dispose off an appeal made by the Registered Vehicle Scrapping Facility against the order of State Pollution Control Board regarding suspension and /or cancellation of registration within thirty days of the receipt of appeal.

(15) The Member Secretary in the Central Pollution Control Board would be designated as an Appellate Authority.

The appeal shall be made by the appellant to the designated Appellate Authority in writing and accompanied with a copy of the order appealed against within thirty days from the date of passing of the order.

(16) Central Pollution Control Board shall issue guidelines for environmentally sound management for handling, processing and recycling/ refurbishing of materials of End-of-Life Vehicles.

(17) Central Pollution Control Board shall prepare guidelines for imposition and collection of Environmental Compensation from producers and Registered Vehicle Scrapping Facility in case of non-fulfilment of obligations under these rules.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23

(18) Central Pollution Control Board shall compile and publish the data received every year from the State Pollution Control Boards.

(19) Central Pollution Control Board shall publish the list of producers who have failed to meet Extended Producer Responsibility targets and obligations on an annual basis.

(20) Central Pollution Control Board shall share the Extended Producer Responsibility targets and annual returns of producers.

(21) Central Pollution Control Board shall prescribe the format for declaration of Extended Producer Responsibility obligations by the producer.

(22) Central Pollution Control Board shall prescribe the format for furnishing annual returns in respect of meeting of Extended Producer Responsibility obligations by the producer.

(23) Central Pollution Control Board shall modify forms within these rules as required and prescribe forms where it is not prescribed.

(24) Central Pollution Control Board will establish a mechanism to ensure a regular dialogue between stakeholders in the fulfilment of obligations under these rules.

(25) Central Government shall constitute an Implementation Committee as per rule 15 for the effective implementation of these rules and make recommendations for making it robust. The Committee shall meet, at least, once in six months to submit its report and recommendations to Ministry of Environment, Forest and Climate Change.

(26) Central Pollution Control Board shall publish annual reports.

(27) One or more trading platform for sale and purchase of Extended Producer Responsibility certificates may be established through agency accredited and in accordance with the guidelines issued by the Central Pollution Control Board with the approval of the Central Government.

(28) The operation and regulation of electronic platform (s), so established under sub-rule 27 for trade of Extended Producer Responsibility certificates between obligated entities, shall be as per guidelines notified by the Central Government based on the recommendations of Central Pollution Control Board for the purpose.

(29) Central Pollution Control Board shall fix the highest and lowest price for Extended Producer Responsibility certificate every six month or as required, keeping in view the cost for collection and environmentally sound management of End-of-Life Vehicle and the environmental compensation regime in force.

12. Responsibilities of State Government / State Pollution Control Board. – (1) State Pollution Control Board shall carry out one-time registration of the Registered Vehicle Scrapping Facility online in the centralized portal.

(2) In case the information provided by Registered Vehicle Scrapping Facility is found to be false, the State Pollution Control Board shall suspend and/or cancel the registration up to a period of five years, after giving reasonable opportunity of being heard including actions under rule 13.

(3) State Pollution Control Board shall compile and forward the quarterly reports submitted by Registered Vehicle Scrapping Facility to Central Pollution Control Board and publish those online.

(4) State Pollution Control Board will ensure a regular dialogue between relevant stakeholders involved in the fulfilment of obligations under these rules.

(5) State Pollution Control Board shall submit annual report to Central Pollution Control Board by 30th June every year, regarding effective implementation of these rules.

(6) State Pollution Control Board or through a designated agency shall verify compliance by Registered Vehicle Scrapping Facility through inspection and periodic audit, and suspend and/or cancel the registration of Registered Vehicle Scrapping Facility, and/or impose Environmental Compensation in case of violation of these rules.

(7) State Government shall ensure that adequate number of Registered Vehicle Scrapping Facilities and Automated Testing Stations are established in the respective States in an even manner. Ministry of Road Transport and Highways may issue guidelines in this regard.

(8) Drive awareness campaigns & incentivization of customers to encourage safe deposition of End-of-Life Vehicles at the Registered Vehicle Scrapping Facility or the designated Collection Centre.

13. Action on violations and imposition of Environmental Compensation. – (1) Environmental Compensation shall be levied for non-compliance of provisions of these rules, viz: i. for not meeting prescribed EPR targets;

ii. for carrying out activities without registration as mandated under these rules;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] iii. for providing false information / wilful concealment of material facts by the entities registered under these rules;

iv. for submission of forged/manipulated documents by the entities registered under these rules; v. for not following environmentally sound handling/management of End-of-Life Vehicles in case of Registered Vehicle Scrapping Facility or other entities.

(2) These activities, may also be dealt with under the provisions of section 15 of the Environment (Protection) Act, 1986, in case of evasion or violation either by entity itself or help abet any obligated entity evade or violate obligations, after giving an opportunity of being heard.

(3) Environmental Compensation shall be levied by Central Pollution Control Board on producer operating with respect to non-fulfilment of their Extended Producer Responsibility targets, responsibilities and obligations set out in these rules.

(4) Environmental Compensation shall be levied by respective State Pollution Control Board on Registered Vehicle Scrapping Facility operating in their jurisdiction, with respect to non-fulfillment of their responsibilities and obligations set out under these rules. In case, the State Pollution Control Board does not take action in sixty days, the Central Pollution Control Board shall issue directions to the State Pollution Control Board.

(5) Payment of Environmental Compensation shall not absolve producer of Extended Producer Responsibility obligation set out under these rules.

(i) the unfulfilled Extended Producer Responsibility obligation for a particular year will be carried forward to the next year for a period of three years.

(ii) in case the shortfall of Extended Producer Responsibility obligation is addressed within subsequent years within three years, the Environmental Compensation levied shall be returned to the producer as given below, – A. Within one year of levying of Environmental Compensation: 75 percent return;

B. Within two years: 60 percent return;

C. Within three years: 40 percent return.

(6) After completion of three years after Environmental Compensation getting due, the entire Environmental Compensation amount shall be forfeited, this arrangement shall allow for recycling/refurbishment of materials of End-of-Life Vehicles by the concerned entities in later years as well.

(7) The funds collected under Environmental Compensation shall be kept in a separate account by Central Pollution Control Board or State Pollution Control Board.

(i) the funds collected shall be utilised in collection and recycling of uncollected End-of-Life Vehicles against which the Environmental Compensation is imposed.

(ii) modalities for utilisation of the funds for End-of-Life Vehicles management would be finalised by the Committee for Implementation.

(8) Non-fulfilment of obligations set out under these guidelines will attract penal actions under the provisions of

Section 15 of the Environment (Protection) Act, 1986.

14. Centralised Online Portal. – (1) Central Pollution Control Board shall establish a centralised online portal for the registration and filing returns by producers, and for registration of Registered Vehicle Scrapping Facility and filling returns in respect of End- of-Life Vehicles as well as for all obligations of all entities, within six months of commencement of these rules.

(2) The system shall ensure a mechanism wherein the material balance of the receipt of the End-of-Life Vehicles and the various types of waste materials generated by Registered Vehicle Scrapping Facility is reflected.

(3) The portal will facilitate producers and RVSFs to exchange Extended Producer Responsibility certificates for fulfilment of Extended Producer Responsibility obligations of producers.

(4) The State Pollution Control Board shall use the centralized online for registration of Registered Vehicle Scrapping Facility and filing of returns by RVSFs.

(5) The centralised online portal would act as the single point data repository with respect to orders and guidelines related to implementation of these rules.

15. Implementation Committee. – (1) A Committee shall be constituted by the Central Government under chairpersonship of Chairman, Central Pollution Control Board to recommend measures to Ministry of Environment, Forest and Climate Change for effective implementation of these rules.

(2) The Committee shall monitor the implementation of these rules.

(3) The Committee shall take measures for removal of difficulties & recommend proposals for amendments, if any, for effective implementation of these rules.

(4) The Committee shall also be tasked with the guiding and supervision of the development and operation of the online portal.

(5) Any modifications in the forms attached to these rules may be undertaken by the Committee.

(6) The Committee shall comprise of representatives from Ministry of Road Transport and Highways, Ministry of Steel, Bureau of Indian Standards, Organisations such as ARAI, State Pollution Control Boards, National Environmental Engineering Research Institute and stakeholders such as associations representing producers, recyclers, and any other stakeholder as invited by the chair of the Committee.

SCHEDULE I [see rule 4 (1)(i)] Targets for Extended Producer Responsibility. – (i) In case of a new producer introducing vehicle in the market in the subsequent years after the publication of these rules, the Extended Producer Responsibility targets shall be applicable for different categories of vehicle, based on the average life of the vehicle mentioned in the Tables below for the respective categories of vehicle.

(ii) The Extended Producer Responsibility targets comprise of recycling targets of the respective years as mentioned in the Tables below.

(iii) The recycling of End-of-Life Vehicles means recycling of steel from End-of-Life Vehicles.

(iv) Extended Producer Responsibility targets for batteries will be as under Battery Waste Management Rules, 2022.

(v) Extended Producer Responsibility for tyres will be as under the Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2022.

(vi) Extended Producer Responsibility for used oil will be as under the Hazardous and Other Wastes (Management and Transboundary Movement) Amendment Rules, 2023.

(vii) Extended Producer Responsibility targets for the producer shall be specific to the category of vehicle (private vehicle and commercial vehicle).

(viii) Producer shall meet their Extended Producer Responsibility obligations through the Extended Producer Responsibility certificates made available by Registered Vehicle Scrapping Facilities through centralized portal. In case of non-availability of Extended Producer Responsibility certificates with Registered Vehicle Scrapping Facilities, the producer shall have the responsibility of collection as well.

(ix) For private vehicles:
