1. लघ ुिीर्का और प्रारंभ

1.1 आन जिजनयमों को “संयुक्त जिद्युत जिनयामक अयोग, केंद्र िाजसत प्रदेि जम्मू और कश्मीर ि केंद्र िाजसत प्रदेि लद्दाख (सलाहकारों की जनयुजक्त) जिजनयम, 2023 कहा जाएगा।

1.2 ये जनयम राजपत्र म ें ईनके प्रकािन की तारीख स ेलाग ूहोंगे:

2.1 आन जिजनयमों म ें जब तक कक सदं भा स े ऄन्यथा ऄपेजक्षत न हो:- a. "ऄजधजनयम" का ऄथ ा ह ैजिद्युत ऄजधजनयम, 2003 (2003 का 36);

"अयोग" का ऄथा जम्म ू और कश्मीर केंद्र िाजसत प्रदेि और लद्दाख केंद्र िाजसत प्रदेि के जलए संयुक्त जिद्युत जिजनयामक अयोग ह ै; c. "सजमजत" का ऄथ ा प्रस्ट्तािों के ऄनुरोध के मूल्यांकन के जलए अयोग द्वारा गठित सजमजत ह;ै d. "सलाहकार" म ें कोइ भी व्यजक्त िाजमल ह ै - जो अयोग, फम,ा जनकाय या व्यजक्तयों के संघ के रोजगार म ें नहीं ह,ै जजसके पास या जजनके पास कोइ जििेर् ज्ञान, ऄनुभि या कौिल ह ैया ईसकी पहुचं ह;ै e. "सजचि" का ऄथा अयोग के सजचि स े ह।ै

2.2 आन जिजनयमों म ें अने िाल े ऐसे िब्द या ऄजभव्यजक्तया ाँ जो यहााँ पठरभाजर्त नहीं ह ैं लेककन ऄजधजनयम म ें पठरभाजर्त ह,ैं ईनका िही ऄथ ा होगा जो ऄजधजनयम म ें ह।ै

3. कायक्षा त्रे

3.1 अयोग समय-समय पर जििेर् कायों को जनष्पाकदत करने के जलए जजनके जलए अयोग के कमचा ाठरयों के भीतर कौिल ईपलब्ध नहीं ह ैं या जहां नौकरी की प्रकृजत जिजिष्ट और समयबद्ध ह ै या जहां अयोग सलाहकार की जनयुजक्त को गुणित्ता, लागत, समय या ककसी ऄन्य जिचार या ऐसे ऄन्य कायों को करने के जलए काय ा को पूरा करने के जलए ऄनुकूल या ऄजधक प्रभािी और कुिल जिजध मानता ह ै और अम तौर पर अयोग को ऄपने कायों के प्रदिान म ें सहायता करने के जलए, यकद अयोग आस ेअिश्यक समझता ह ैतो परामिादाताओं को जनयुक्त कर सकता ह।ै

3.2 सलाहकारों की जनयुजक्त के जनयम और ितें प्रत्येक मामल े म ें तयै ार ककए जाएंगे और काम देन े स े पहले सलाहकार और अयोग के बीच सहमजत बनाइ जाएगी।

3.3 ऄनुबंध की ितों म ें सलाहकार द्वारा ककए जान े िाल े कायों की सटीक प्रकृजत, प्रत्येक काय ा को पूरा करन े के जलए ऄनुमत समय, और आस संबंध में ऄनुमोकदत सदं भा की ितों के ऄनुसार प्रत्येक काय ा के संबंध म ें सलाहकार द्वारा प्रदान ककए जाने िाले जिजिष्ट अईटपटु का ईल्लेख होगा।

4. जनयजु क्त की ऄिजध

4.1 सलाहकार न्यूनतम ऄिजध के जलए जनयक्तु ककया जाएगा: बिते कक ककसी जिजिष्ट काय ा पर सलाहकार की प्रारंजभक जनयुजक्त की ऄिजध सामान्यतः दो िर्ा स ेऄजधक नहीं होगी: बिते अग े कक जनयुजक्त की ऄिजध को आस ित ा के ऄधीन बढाया जा सकता ह ै कक सलाहकार की जनरंतर जनयुजक्त की ऄजधकतम ऄिजध ककसी भी मामले म ेंचार िर् ा स ेऄजधक नहीं होगी।

5. सलाहकारों का िगीकरण

5.1 सलाहकारों को आस प्रकार िगीकृत ककया जाएगा: (क) संस्ट्थागत सलाहकार, (ख) व्यजक्तगत सलाहकार, (ग) पेिेिर, जििेर्ज्ञ, और (घ) स्ट्टाफ सलाहकार।

6. सस्ट्ं थागत सलाहकार अयोग, आस बात स े संतष्टु होन े पर कक परामि ा सेिाओं का लाभ ईिाने की अिश्यकता ह,ै जो कक अयोग राय म,ें िायद एक फमा, या एक कंपनी या एक सघं या व्यजक्तयों के जनकाय द्वारा ऄजधक ईपयक्तु रूप स े प्रदान की जाती ह,ै एक संस्ट्थागत सलाहकार को जनयुक्त करेगा।

7. व्यजक्तगत सलाहकार

7.1 अयोग, एक व्यजक्तगत सलाहकार जनयुक्त करन े का जनणाय ले सकता ह ै जब ि े आस बात स े संतुष्ट होंगे कक परामि ा सेिाओं का लाभ ईिाने की अिश्यकता ह,ै जो कक अयोग राय में, ककसी काय ा के जलए अिश्यक योग्यता और ऄनुभि रखने िाले व्यजक्त द्वारा ऄजधक कुिलता स े जनष्पाकदत की जा सकती ह,ै जजसके जलए कर्ममयों की टीमों की अिश्यकता नहीं ह।ै

7.2 यकद अयोग आस बात स े संतष्टु ह ै कक अयोग के काय ा की मात्रा म ें िृजद्ध हुइ ह ै या जिजभन्न बाधाओं के कारण एक जनयजमत पद नहीं भरा जा सका ह,ै तो अयोग को ईसके कायों के जनिाहन म ें सहायता करने के जलए व्यजक्तगत सलाहकार भी जनयुक्त ककया जा सकता ह।ै

7.3 व्यजक्तगत सलाहकार का मुख्यालय सामान्यतः अयोग का मख्ु यालय होगा।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3

7.3 व्यजक्तगत सलाहकारों का िगीकरण

7.3.1 ऄनुभि के अधार पर, व्यजक्तगत सलाहकारों को आस प्रकार िगीकृत ककया जाएगा िग ा जनयजु क्त के क्षत्रे म ेंन्यनू तम ऄनभु ि सलाहकार 15 साल िठरष्ठ कंसल्टेंट्स 10 िर् ा कंसल्टेंट्स 3 िर् ा

7.3.2 अयोग काय ा की प्रकृजत और परामि ा के जिर्य क्षत्रे स े संबंजधत प्रासंजगक पिे ेिर योग्यता के अधार पर न्यूनतम िैजक्षक योग्यता जनधााठरत कर सकता ह।ै

7.3.3 अयोग ईजचत मामले म,ें जलजखत रूप म ें दजा ककए जान े िाले कारणों स,े व्यजक्तगत सलाहकार के रूप म ें जनयुजक्त के जलए जिचार ककए जा रह े व्यजक्त की समग्र जििेर्ज्ञता को ध्यान म ें रखत े हुए िैक्षजणक योग्यता म ें छूट दे सकता ह।ै

8. पिे िे र जििर्े ज्ञ जििेर्ज्ञ प्रकृजत की व्यािसाजयक जििेर्ज्ञता की अिश्यकता पर संतष्टु होने पर अयोग ऄत्यािश्यक और जिजिष्ट प्रकृजत के मुद्द े पर सलाह के जलए एक पेिेिर जििेर्ज्ञ को जनयक्तु करने का जनणाय ल ेसकता ह।ै 9 स्ट्टाफ कंसल्टेंट्स यकद अयोग संतष्टु ह ै कक अयोग के काय ा की मात्रा म ें िृजद्ध हो रही ह ै या जिजभन्न बाधाओं के कारण एक जनयजमत पद नहीं भरा जा सका ह ैतो अयोग के कायों के जनिाहन म ें सहायता के जलए स्ट्टाफ सलाहकार जनयक्तु ककया जा सकता ह।ै 10 सस्ट्ं थागत सलाहकार की जनयजु क्त

10.1 अयोग, आस बात स े संतुष्ट होने पर कक ककसी भी काय ा के जलए संस्ट्थागत सलाहकार की सेिाओं का लाभ ईिाने की अिश्यकता ह,ै सजचि को जनदिे दगे ा कक िह जिस्ट्ततृ संदभा की ितें तैयार करें या तैयार करिाएं।

10.2 सजचि ककसी जिजिष्ट काय ा के जलए सलाहकार की जनयुजक्त के जलए जिस्ट्तृत संदभा की ित ें तैयार करेगा या तैयार करिाएगा और अयोग का ऄनमु ोदन प्राप्त करेगा।

10.3 काय ा के ईद्देश्यों, लक्ष्यों और दायरे को जनर्ददष्ट करन े के जलए संदभा की ितें तैयार की जाएंगी और सलाहकार को ऄपन े प्रस्ट्ताि की तैयारी में मदद करने के जलए मौजूदा प्रासजं गक ऄध्ययनों की सूची और बुजनयादी डेटा सजहत पृष्ठभूजम की जानकारी प्रदान की जाएगी:

बिते कक संदभा की ित ें ऄसाआनमेंट को पूरा करन े के जलए अिश्यक सेिाओं और सिेक्षणों तथा संदभ ा की ितों म ें िाजमल प्रत्येक काय ा स े जुडे ऄपेजक्षत अईटपुट (ईदाहरण के जलए ठरपोट,ा डेटा, सिेक्षण अकद) को भी सूचीबद्ध करेंगी। बिते कक जहां ज्ञान का हस्ट्तांतरण और प्रजिक्षण एक ईद्देश्य ह,ै संदभा की ितें प्रजिजक्षत ककए जाने िाल े कमाचाठरयों की संख्या का जििरण देंगी।

10.4 अयोग द्वारा संदभा की ितों के ऄनुमोदन के बाद, सजचि को संस्ट्थागत सलाहकार के रूप म ें जनयुजक्त के हते ु प्रस्ट्तािों को अमंजत्रत करने के जलए प्रस्ट्तािों का ऄनरु ोध जारी करना चाजहए या जारी करिाना चाजहए और ऐसा प्रचार करना चाजहए जैसा कक अयोग द्वारा ईजचत समझा जा सकता ह।ै

10.5 अयोग या तो संयुक्त तकनीकी और जित्तीय प्रस्ट्तािों को अमंजत्रत करने या तकनीकी और जित्तीय प्रस्ट्तािों को ऄलग-ऄलग अमंजत्रत करन े का जनणाय ले सकता ह।ै

10.6 अयोग तकनीकी बोली के जलए न्यूनतम योग्यता ऄंक जनधााठरत कर सकता ह।ै 11 प्रस्ट्तािों के जलए ऄनरु ोध प्रस्ट्तािों के ऄनरु ोध म ेंजनम्नजलजखत िाजमल होना चाजहए:-

11.1 परामिी सेिाओं के प्रािधान, योजना के जििरण, और प्रस्ट्तािों को प्रस्ट्तुत करन े की जतजथ, समय और पते के जलए एक ऄनुबंध म ेंप्रिेि करने के जलए अयोग के आरादे को बतात ेहुए अमंत्रण पत्र।

11.2 सलाहकारों को दी जान े िाली जानकारी म ें सभी अिश्यक जानकारी िाजमल होनी चाजहए जो ईन्ह ें मल्ू यांकन प्रकिया के बारे म ें जानकारी प्रदान करके और मल्ू यांकन मानदंड और कारकों और ईनके संबंजधत भार और न्यनू तम पूि-ा योग्यता स्ट्कोर और जििेर् योग्यता खंड, यकद कोइ हो, को आंजगत करके ईत्तरदायी प्रस्ट्ताि तैयार करन े म ें मदद करेगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

11.3 ईपरोक्त जिजनयम (10.3) के ऄनुसार आस संबंध म ें तैयार ककए गए संदभा की ितें। 12 प्रस्ट्तािों की प्राजप्त

12.1 अयोग िह समय जनधााठरत करेगा जजसके भीतर परामिादाता ऄपन े प्रस्ट्ताि प्रस्ट्ततु करेंगे।

12.2 अयोग, जहां ईजचत समझे, प्रस्ट्तािों को प्रस्ट्तुत करने की समय सीमा बढाने का जनणाय ल ेसकता ह।ै

12.3 समय सीमा समाप्त होने के बाद तकनीकी या जित्तीय प्रस्ट्तािों म ें कोइ संिोधन स्ट्िीकार नहीं ककया जाएगा।

12.4 प्रस्ट्ताि सीलबंद जलफाफे में प्रस्ट्तुत ककए जान े चाजहए। 13 प्रस्ट्तािों का मल्ू याकं न

13.1 प्रस्ट्ताि का मल्ू यांकन तकनीकी क्षमता और ईद्धृत लागत दोनों के अधार पर ककया जाएगा।

13.2 जहा ं अयोग जनणाय लेता ह ै कक तकनीकी और जित्तीय प्रस्ट्तािों का ऄलग-ऄलग मूल्यांकन ककया जाना चाजहए, तब तकनीकी प्रस्ट्तािों का मल्ू यांकन पूरा होन े तक सजमजत के पास जित्तीय प्रस्ट्तािों तक पहुचं नहीं होगी।

13.3 आस संबंध म ें प्रस्ट्ताि का मूल्याकं न अयोग द्वारा जनयुक्त सजमजत द्वारा ककया जाएगा। सजमजत तकनीकी और जित्तीय दोनों प्रकार की बातचीत कर सकती ह।ै जहां तकनीकी बातचीत अयोजजत की जाती ह,ै िही सलाहकारों की पूिा- योग्यता स े पहले अयोजजत की जाएगी। जित्तीय प्रस्ट्ताि के ककसी भी पहलू के जलए जित्तीय बातचीत की जा सकती ह,ै जजसम ें कमाचाठरयों के महीनों के जलए आकाइ दर, अकजस्ट्मक राजि, यात्रा और रहने के खच ा की एकमश्ु त प्रजतपूर्मत और भुगतान की ितें िाजमल ह।ैं 14 तकनीकी मल्ु याकं न

14.1 तकनीकी मूल्यांकन ईपरोक्त जिजनयम (13.3) के तहत जनयुक्त सजमजत द्वारा नीच े जिजनयम (14.2) के तहत कदए गए मानदडं ों को ध्यान म ेंरखत े हुए ककया जाएगा।

14.2 प्रत्येक तकनीकी मानदंड को 1 स े 100 के पैमाने पर ऄंककत ककया जाएगा और कफर प्रत्येक मानदंड के ऄंकों को औसत तकनीकी स्ट्कोर बनाने के जलए भाठरत ककया जाएगा। प्रत्येक प्रस्ट्ताि के जलए मल्ू यांकन औसत तकनीकी स्ट्कोर की गणना करन ेके जलए अयोग के ऄनुमोदन स ेसजमजत द्वारा जनम्नजलजखत श्रेजणयों म ें भार का ईपयोग ककया जाएगा:- मापदंड ऄकं न ऄसाआनमेंट के जलए सलाहकार का प्रासंजगक ऄनुभि 0.10 स े 0.40 प्रस्ट्ताजित कायाप्रणाली की गुणित्ता 0.20 स े 0.50 प्रस्ट्ताजित प्रमुख कमाचाठरयों की योग्यता 0.30 स े 0.60 अयोग के कमाचाठरयों को ज्ञान के हस्ट्तांतरण की सीमा 0.05 स े 0.35 ठटप्पणी: अयोग द्वारा ऄनुमोकदत ऄंकों का जमश्रण कुल 1 होगा। जिजनयम (13.3) के तहत जनयक्तु मल्ू यांकन सजमजत बोजलयों के तकनीकी मूल्यांकन के ईद्देश्य स े प्रत्येक परै ामीटर को अिंठटत ककए जान े िाल े भाराकं (उपर जनधााठरत सीमा म)ें का जनणाय करेगी और अिंटन के जलए अयोग के ऄध्यक्ष का ऄनुमोदन प्राप्त करेगी। अयोग के पास ऄसाआनमेंट की प्रकृजत और अिश्यकता के अधार पर ऄंकों के जितरण का ऄजधकार होगा।

14.3 जहा ं ऄसाआनमेंट मुख्य कमाचाठरयों के प्रदिान पर गंभीर रूप स े जनभार करता ह,ै िहा ं प्रस्ट्ताि का मूल्यांकन जनम्नजलजखत मानदंडों का ईपयोग करते हुए जनयुक्त ककए जाने िाले प्रस्ट्ताजित व्यजक्तयों की योग्यता पर ककया जाएगा:- a) सामान्य योग्यताए:ं सामान्य जिक्षा और प्रजिक्षण, ऄनुभि की ऄिजध, धाठरत पद, स्ट्टाफ के रूप म ें सलाहकार फम ा म ें जबताया हुअ समय, जिकासिील दिे ों म ेंऄनुभि, अकद। b) ऄसाआनमेंट के जलए पयााप्तता: जिक्षा, प्रजिक्षण, जिजिष्ट क्षत्रे म ें ऄनुभि, क्षत्रे , जिर्य और जििेर् ऄसाआनमेंट के जलए प्रासंजगकता।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5

14.4 तकनीकी मूल्यांकन परू ा होन े के बाद, अयोग ईन सलाहकारों को सूजचत करेगा जजनके प्रस्ट्ताि न्यूनतम योग्यता ऄंकों को पूरा नहीं करत े थ े या संदभा की ितों के प्रजत ऄनुत्तरदायी मान े जात े थ,े और ईनके जित्तीय प्रस्ट्तािों को चयन प्रकिया परू ी करन े के बाद जबना खोले िापस कर कदया जाएगा।

14.5 आसके साथ ही, जजन सलाहकारों ने तकनीकी मूल्यांकन के बाद न्यूनतम ऄहका ऄंक प्राप्त ककए ह,ैं ईन्ह ें जित्तीय प्रस्ट्तािों को खोलन े की तारीख और समय के बारे म ें सूजचत ककया जाएगा, ऄगर िे चाह ें तो सलाहकारों को ईद्घाटन के समय ईपजस्ट्थत होन ेके जलए पयााप्त समय कदया जाएगा। 15 जित्तीय मल्ू याकं न

15.1 तकनीकी रूप स े योग्य सलाहकारों के जित्तीय प्रस्ट्ताि सलाहकारों या ईनके प्रजतजनजधयों की ईपजस्ट्थजत म ें सजमजत द्वारा खोले जाएंगे जजनकी बोजलयों को जित्तीय मूल्यांकन के जलए चुना गया ह।ै प्रस्ट्ताजित कीमतों को जोर स े पढा जाएगा और कायािाही के जमनटों म ें दजा ककया जाएगा।

15.2 सजचि ककए जाने िाल े जित्तीय प्रस्ट्तािों की समीक्षा कराएगं े। ऄंकगजणतीय त्रुठटया ं सुधारी जाएंगी। लागत भारतीय रुपय ेम ें ईद्धृत की जाएगी।

15.3 न्यूनतम लागत िाल े प्रस्ट्ताि को 100 का जित्तीय स्ट्कोर कदया जाएगा और ऄन्य प्रस्ट्तािों को ईनकी लागत के व्युत्िमानुपाती जित्तीय स्ट्कोर कदया जाएगा। 16 जित्तीय और तकनीकी स्ट्कोर का मल्ू याकं न

16.1 तकनीकी एि ं जित्तीय ऄंकों को भाठरत कर तथा ईन्ह ें जोडकर कुल ऄंक प्राप्त ककय े जायेंग े तथा ईच्चतम कुल ऄकं िाले परामिादाता को अयोग द्वारा जनधााठरत समय सीमा के ऄन्दर ऄनुबंध करन े के जलय े अमंजत्रत ककया जायेगा। तकनीकी और जित्तीय स्ट्कोर के जलए मल्ू यांकन प्रत्येक मामल े म ें ऄसाआनमेंट की जठटलता और गणु ित्ता के सापेक्ष महत्ि को ध्यान म ें रखते हुए अयोग द्वारा जनधााठरत ककया जाएगा। हालांकक, ककसी भी मामले म ें जित्तीय स्ट्कोर के जलए मल्ू यांकन कभी भी 0.3 स ेऄजधक नहीं होगा।

16.2 अयोग ककसी या सभी प्रस्ट्तािों को ऄस्ट्िीकार कर सकता ह ै यकद िे ऄप्रजतसादी या ऄनुपयक्तु पाए जाते ह ैं या तो ि े संदभा की ितों के ऄनुपालन म ें प्रमुख कजमयों को दिााते ह ैं या मूल ऄनुमान स े काफी ऄजधक लागत िाजमल करते ह।ैं 17 व्यजक्तगत सलाहकारों की जनयजु क्त व्यजक्तगत सलाहकारों को ऄसाआनमेंट के जलए ईनकी योग्यता और ऄनुभि के अधार पर चुना जा सकता ह।ै अयोग सजचि को जनदिे द े सकता ह ै कक ि े अिश्यकता के ऄनसु ार काय ा के दायरे और ऄन्य जनयमों और ितों को आंजगत करत े हुए संदभ ा की ित ें तैयार करें, जजन्ह ें ऄनुमोदन के जलए अयोग को प्रस्ट्ततु ककया जाएगा। व्यजक्तगत सलाहकारों का चयन संदभों के अधार पर या ईन लोगों म ें स े ककया जा सकता ह ै जजन्होंन े आस संबंध म ें अयोग द्वारा प्रकाजित नोठटस के संदभा म ें अिेदन ककया ह।ै ईनकी ईपयुक्तता का जनणाय िक्षै जणक पष्ठृ भूजम, ऄनुभि, और, ईपयुक्त के रूप म ें स्ट्थानीय पठरजस्ट्थजतयों, प्रिासजनक प्रणाली और सरकारी सगं िन के ज्ञान के अधार पर ककया जाएगा।

17.1 न्यनू तम योग्यता और अय ु मानदंड: आच्छुक ईम्मीदिार के पास (ए) ककसी मान्यता प्राप्त कॉलेज / जिश्वजिद्यालय स े आंजीजनयररग म ें स्नातक की जडग्री होनी चाजहए। (बी) ईम्मीदिार को जिद्युत ऄजधजनयम, 2003, ऄजधजनयम के तहत बनाए गए जनयमों और जिजनयमों, और लागू नीजतयों, जबजली क्षत्रे स े संबंजधत कानूनी और जनयामक ढाचं े की स्ट्पष्ट समझ होनी चाजहए। (सी) टैठरफ जनधारा ण प्रकिया और संबंजधत मामलों के दौरान िाजमल जनयामक कायािाही के दौरान राज्यों / संयुक्त / केंद्रीय जिद्युत जनयामक अयोगों को सहायता प्रदान करने म ें जसद्ध ऄनुभि होना चाजहए । (डी) अिेदन की जतजथ पर 60 िर्ा की अय ुतक का ईम्मीदिार एक व्यजक्तगत सलाहकार के रूप म ें काम करन े के जलए पात्र ह ै और 65 िर् ा की अय ु प्राप्त करन े तक अयोग को सेिाए ं प्रदान कर सकता ह;ै बाद म ें कोइ अय ुछूट की ऄनुमजत नहीं दी जाएगी। 18 व्यजक्तगत सलाहकारों के मामल ेम ेंिल्ु क और ऄन्य प्रभार

18.1 जसिाय जहां अयोग ऄन्यथा जनदेजित करता ह,ैव्यजक्तगत सलाहकार को अम तौर पर ऄसाआनमेंट की प्रकृजत या माजसक िुल्क के अधार पर समके कत िुल्क के अधार पर जनयक्तु ककया जाएगा।

18.2 व्यजक्तगत सलाहकारों के मामले म ें ईप-जिजनयम (1) के ऄनसु ार समेककत िुल्क के ऄजतठरक्त कोइ भुगतान नहीं ककया जाएगा:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] बिते कक अयोग अकजस्ट्मक प्रकृजत के व्यय को िाजमल करन े के जलए सलाहकार को दये िल्ु क के 10% स े ऄजधक की ऄजतठरक्त राजि की ऄनुमजत द।े

18.3 जहा ं सलाहकार को अयोग के मुख्यालय स े दरू ककसी स्ट्थान पर अन-े जाने और रहन े पर खच ा करना पडता ह,ैअयोग केंद्र सरकार के एक समूह ए ऄजधकारी को ऄनुमत श्रेणी स े कम नहीं एक ईपयुक्त श्रेणी द्वारा यात्रा की लागत की प्रजतपूर्मत करेगा और आन जिजनयमों के तहत दये िल्ु क और ऄन्य िुल्कों के ऄजतठरक्त, जजतन े कदनों के जलए अयोग ईजचत समझे, दैजनक भत्त े के भुगतान को प्राजधकृत करेगा।

18.4 आन जिजनयमों के ऄधीन व्यजक्तगत परामिादाताओं को दये िुल्क एि ं ऄन्य प्रभार अयोग द्वारा परामिादाताओं के रूप म ेंजनयुक्त पूिा एि ंसेिाजनिृत्त सरकारी सेिकों को भी दये होंगे।

18.5 व्यजक्तगत सलाहकारों के जलए िुल्क िग ा ऄजधकतम िल्ु क प्रजत व्यजक्त कदिस दैजनक भत्ता सलाहकार रु.7500/- बोर्डडग और लॉजजग के जलए िास्ट्तजिक खचा िठरष्ठ कंसल्टेंट्स रु.5500/- बोर्डडग और लॉजजग के जलए िास्ट्तजिक खचा कंसल्टेंट्स रु.3000/- बोर्डडग और लॉजजग के जलए िास्ट्तजिक खचा ठटप्पणी:

1. अयोग के पास व्यजक्तगत सलाहकार के ऄनुभि और साख के अधार पर दैजनक/माजसक अधार पर व्यजक्तगत सलाहकार को दये िल्ु क के बारे म ें जनणाय लेन े का ऄजधकार सुरजक्षत ह,ै जैसा कक अयोग द्वारा ईजचत समझा जाता ह।ै

2. अयोग दैजनक भत्त े के रूप म ें ऄनुमेय राजियों को जनर्ददष्ट करने, िह ईजचत सीमा जनधााठरत करने जजसके भीतर िास्ट्तजिक व्यय को मामला-दर-मामला अधार पर ऄनुमजत दी जानी ह,ै और ईसके द्वारा प्रस्ट्तुत ककए गए ककसी भी दाि े की तकासंगतता का अकलन करन े का ऄजधकार भी सरु जक्षत रखता ह।ै 19 पिे िे र जििर्े ज्ञों की जनयजु क्त अयोग द्वारा पेिेिर जििेर्ज्ञों को जनयुक्त करन े का जनणाय लने े पर, अयोग के सजचि प्रस्ट्तािों को औपचाठरक रूप दगें े। िह जििेर् क्षत्रे म ें अिश्यक जििेर्ज्ञता रखन े िाल,े परामिा काया को स्ट्िीकार करन े की आच्छा रखने िाले और ईनमें स े प्रत्येक द्वारा मांगे गए िल्ु क के अधार पर कम स े कम दो पेिेिरों की एक सूची तैयार करेगा। अयोग आस तरह के िल्ु क के भगु तान पर और ऐसी ितों पर सलाहकार के रूप म ें जनयुजक्त के जलए जििेर्ज्ञ के नाम को मंजूरी द े सकता ह,ै जैसा ईजचत समझा जा सकता ह,ै बित े कक आस प्रकार जनधााठरत िुल्क काया के एक व्यजक्तगत जििेर् काय ा के जलए 10 (दस) लाख रुपय ेस ेऄजधक नहीं होना चाजहए। 20 स्ट्टाफ सलाहकार की जनयजु क्त

20.1 अयोग, आस बात स े संतष्टु होन े पर कक अयोग के काय ा की मात्रा म ें िृजद्ध हुइ ह,ै या जनयजमत पदों को दाजखल करन े म ें ईत्पन्न होन े िाली कठिनाआयों, काम म ें तेजी लाने के जलए, अयोग को ऄपने कायों के प्रभािी ढंग स े जनिाहन म ें सहायता करन े और सजचि को अग े कदम ईिान े का जनदिे दने े के जलए एक कमाचारी सलाहकार को जनयक्तु करन े का जनणाय ले सकता ह।ै

20.2 अयोग ने एक स्ट्टाफ सलाहकार जनयुक्त करने का जनणाय लेने के बाद, राष्ट्रीय दैजनक समाचार पत्रों और अयोग की िेबसाआट पर नोठटस प्रकाजित करके, और जहााँ तक संभि हो, आच्छुक व्यजक्तयों द्वारा अिेदन अमंजत्रत करन े के जलए चार सप्ताह की ऄिजध देकर, कायाकाल के अधार पर अिेदन अमंजत्रत करेगा।

20.3 नोठटस प्रकाजित करन े स े पहल,े अयोग के सजचि एक जनयजमत पद के जलए भती को जनयंजत्रत करने िाल े अयोग के जिजनयमों के प्रासंजगक प्रािधानों को ध्यान म ेंरखते हुए योग्यता और ऄनुभि की अिश्यकताओं की पहचान करेंगे ।

20.4 स्ट्टाफ सलाहकार को योग्यता और 3 स े 15 या ऄजधक िर्ों के ऄनुभि की ऄिजध के अधार पर िगीकृत ककया जा सकता ह ै और एक समेककत िल्ु क की पेिकि की जा सकती ह ै जो मूल िेतन और ईस पद के महगं ाइ भत्त े के बराबर होगी जजसके जलए स्ट्टाफ सलाहकार जनयुक्त ककया जा रहा ह।ै

20.5 स्ट्टाफ सलाहकार को कायाकाल के अधार पर िरूु म ें एक िर् ा की ऄिजध के जलए जनयुक्त ककया जाएगा, जहां दये िुल्क िर् ा के जलए 10 लाख रुपये स े ऄजधक नहीं ह।ै[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7

20.6 अयोग एक चयन सजमजत का गिन करेगा जो ईम्मीदिारों के साथ बातचीत करेगी और अयोग के ऄनुमोदन के जलए स्ट्टाफ सलाहकार के रूप म ें जनयुजक्त के जलए ईपयुक्त व्यजक्तयों के नामों की जसफाठरि करेगी।

20.7 न्यूनतम योग्यता और अय ु मानदंड: आच्छुक ईम्मीदिार के पास ककसी मान्यता प्राप्त कॉलजे / जिश्वजिद्यालय स े आंजीजनयररग म ें स्नातक की जडग्री होनी चाजहए। अिेदन की जतजथ पर 60 िर्ा की अय ु तक का ईम्मीदिार एक व्यजक्तगत सलाहकार के रूप म ें काम करने के जलए पात्र ह ै और 65 िर्ा की अय ु प्राप्त करने तक अयोग को सेिाए ं प्रदान कर सकता ह;ै बाद म ें कोइ अय ुछूट की ऄनुमजत नहीं दी जाएगी । 21 एकल स्रोत चयन अयोग द्वारा ईपयुक्त मामलों में एकल स्रोत चयन का सहारा जलया जा सकता ह ै जहां यह एक स्ट्पष्ट लाभ को दिाता ा ह,ै क्योंकक काय ा परामिादाता द्वारा ककए गए जपछले काय ा की स्ट्िाभाजिक जनरंतरता को दिााता ह,ैं या जहां एक तत्काल चयन अिश्यक ह,ै या छोटे कायों के जलए जहां दये िल्ु क 10 लाख रुपय े स े ऄजधक नहीं ह ै या जहा ं केिल एक फमा के पास योग्यता या काय ा का ऄनुभि ह।ै 22 जहत द्वद्वं परामिादाता को ऐसे ककसी भी काय ा के जलए जनयुक्त नहीं ककया जाएगा जो ऄन्य ग्राहकों के प्रजत ईसके पूिा या ितामान दाजयत्िों के जिरोध म ें हो या जो ईसे ईद्देश्यपूण ा और जनष्पक्ष रूप स े काय ा करन े म ें सक्षम न होने की जस्ट्थजत म ें रखता हो। 23 सलाहकारों की जनयजु क्त जनयुजक्त के जलए चयजनत सलाहकार को आन जिजनयमों के ऄंत म ें ऄनुसूची म ें कदए गए प्रारूप में एक समझौत े को जनष्पाकदत करने की अिश्यकता होगी, ऐसे बदलािों और संिोधनों को ऄलग-ऄलग मामलों म ें ईपयुक्त माना जाएगा। 24 अयोग की जनजहत िजक्त की बचत आन प्रािधानों म ें कुछ भी अयोग को ऐसी प्रकिया ऄपनान े स े नहीं रोकेगा जो आन जिजनयमों के ककसी भी प्रािधान स े जभन्न हो, यकद अयोग मामल े की जििेर् पठरजस्ट्थजतयों या मामलों के िगा को देखते हुए और जलजखत रूप म ें दजा ककए जाने िाले कारणों के जलए, आन जिजनयमों म ें जनधााठरत प्रकिया स े हटना अिश्यक या समीचीन समझता ह।ै 25 सिं ोधन करन ेकी सामान्य िजक्त अयोग ईजचत समझे जाने पर ककसी भी समय और ऐसी ितों पर, ईन ईद्देश्यों को परू ा करने के हते ु स े आन जिजनयमों के ककसी भी प्रािधान म ें संिोधन कर सकता ह ैजजसके जलए य ेजिजनयम बनाए गए ह।ैं 26 कठिनाआयों को दरू करन ेकी िजक्त यकद आन जिजनयमों के ककसी भी प्रािधान को प्रभािी करने म ें कोइ कठिनाइ ईत्पन्न होती ह,ै तो अयोग, सामान्य या जििेर् अदेि द्वारा, कुछ भी कर सकता ह,ै जो ऄजधजनयम के प्रािधानों स े ऄसंगत न हो, जो कठिनाआयों को दरू करन े के ईद्देश्य स े अिश्यक या समीचीन प्रतीत हो। अयोग के अदेि द्वारा, िी. के. धर, सजचि [जिज्ञापन-III/4/ऄसा./49/2023-24] ऄनसु चू ी एक (प्रथम) भाग (परामिादाता) के __________ और जम्म ू और कश्मीर के केंद्र िाजसत प्रदेि और दसू रे (जद्वतीय) भाग के लद्दाख केंद्र िाजसत प्रदिे के जलए संयुक्त जिद्युत जिजनयामक अयोग आसके बाद "अयोग" रूप म ें जाना जाएगा) के बीच __________________ के ________________ कदिस को ककए गए समझौते। जबकक अयोग ने परामिादाता के रूप म ें पहले भाग की पाटी को िाजमल ककया ह ैऔर पहले भाग की पाटी अयोग को परामिी सेिाए ं प्रदान करन े के जलए आसम ें जनजहत जनयमों और ितों पर सहमत हुइ ह।ै ऄब, यह प्रस्ट्तुत करता ह ैकक गिाह और पक्षकार िमिः जनम्नानुसार सहमत ह:ैं

2) पहले भाग (परामिादाता) की पाटी ऄनुसूची - 'ए' म ें जनजहत ऄसाआनमेंट को _______________________ स े िरूु होने िाली ऄिजध के भीतर परू ा करेगी।

3) पहले भाग (परामिादाता) की पाटी को जनम्नानुसार भगु तान ककया जाएगा:

6) िुल्क का भुगतान अयोग द्वारा ईस समय लागू कानून के ऄनुसार स्रोत पर कर की कटौती के बाद ककया जाएगा।

7) गोपनीय प्रकृजत की कोइ भी जानकारी, जो आस ऄनुबधं की जिर्य िस्ट्त ु के अधार पर परामिादाता या ईसके ककसी कमाचारी के ज्ञान या कब्ज े म ेंअती ह,ै सलाहकार या ईसके कमाचाठरयों द्वारा ककसी भी ऄनजधकृत व्यजक्त को ककसी भी तरीके स े प्रकट नहीं की जाएगी। कानून के ऄनुसार िरूु की जा सकने िाली ककसी भी ऄन्य कायािाही पर प्रजतकूल प्रभाि डाले जबना आस खंड का कोइ भी ईल्लघं न, सलाहकार को अयोग को भुगतान करने के दाजयत्ि के ऄधीन होना चाजहए, ऐसा मअु िजा, जैसा कक अयोग द्वारा प्रकट की गइ जानकारी की प्रकृजत, तरीके और मकसद को ध्यान म ें रखते हुए और आस तरह के ऄनजधकृत प्रकटीकरण स े हुइ क्षजत की सीमा को ध्यान म ेंरखत ेहुए तय ककया जा सकता ह।ै

8) पहले भाग की पाटी यह िचन देती ह ै कक, यह ऄसाआनमेंट ऄन्य ग्राहकों के जलए आसके पिू ा या ितामान दाजयत्ि के जिरोध म ें नहीं होगा न ही यह खुद को ईद्देश्यपूणा और जनष्पक्ष रूप स े काय ा करने म ें सक्षम नहीं होने की जस्ट्थजत म ें रखेगा।

9) यकद पहल े भाग के पक्ष की ओर स े पार्टटयों के बीच सहमत समय-साठरणी के भीतर काम पूरा करन े म ें कोइ चूक होती ह,ै तो दसू रे भाग (अयोग) की पाटी पहले भाग (सलाहकार) की पाटी के जोजखम और लागत पर ककसी ऄन्य एजेंसी स े काम पूरा करने के जलए स्ट्ितंत्र होगी।

10) अयोग जबना कोइ कारण बताए सलाहकार की जनयुजक्त को रोकने, समाप्त करन े या रद्द करन े का ऄजधकार सुरजक्षत रखता ह।ै ऐसे मामलों म ें पहल े भाग की पाटी (परामिादाता) को आस तरह के फौजदारी, समाजप्त, या काय ा को रद्द करन े स े पहल े परू ा ककए गए काम के जहस्ट्स े को ध्यान म ें रखते हुए पाठरश्रजमक का भुगतान ककया जाएगा जैसा कक अयोग द्वारा तय ककया जा सकता ह ै और अयोग का जनणाय जनणाायक और बाध्यकारी हो। ऐसे मामलों म ें जनधााठरत और भुगतान ककया गया पाठरश्रजमक ऄंजतम भगु तान माना जाएगा।

11) आस समझौते स े पार्टटयों के बीच ईत्पन्न ककसी भी मतभेद या जििाद के मामल े म,ें ईस े अयोग द्वारा नाजमत व्यजक्त की मध्यस्ट्थता के जलए भेजा जाएगा। कायािाही समय-समय पर संिोजधत मध्यस्ट्थता और सलु ह ऄजधजनयम 1996 के ऄधीन होगी।

12) सलाहकार के कार्ममक पहले भाग की पाटी (सलाहकार) नाम, पद और योग्यता के साथ कर्ममयों का जििरण प्रदान करेगी।

13) कर्ममयों का जनष्कासन और / या प्रजतस्ट्थापन जब तक अयोग ऄन्यथा सहमत न हो, प्रमुख कर्ममयों म ें कोइ बदलाि नहीं ककया जाएगा। यकद, ककसी कारण स,े परामिादाता के ईजचत जनयंत्रण स े परे, यह अिश्यक हो जाता ह ै कक कोइ प्रमुख कार्ममक हो, तो परामिादाता ईसके स्ट्थान पर समकक्ष या बेहतर योग्यता िाला व्यजक्त प्रदान करेगा, जो अयोग को स्ट्िीकाय ा होगा।

14) यकद अयोग को पता चलता ह ै कक (1) कर्ममयों म ें स े ककसी न े गंभीर कदाचार ककया ह ै या ईस पर अपराजधक काय ा करने का अरोप लगाया गया ह ै या (2) ककसी भी कार्ममक के प्रदिना स े ऄसंतष्टु होन े का ईजचत कारण ह,ै तो सलाहकार सजचि के जलजखत ऄनुरोध पर, आस अधार को जनर्ददष्ट करते हुए स्ट्िीकाय ा योग्यता और ऄनुभि के साथ एक व्यजक्त को तुरंत प्रजतस्ट्थापन के रूप म ें अयोग को प्रदान करेगा। सलाहकार के पास ककसी भी हटाने योग्य और/या कर्ममयों के प्रजतस्ट्थापन स े ईत्पन्न या अकजस्ट्मक होने िाली ऄजतठरक्त लागत के जलए कोइ दािा नहीं होगा।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 9

NOTIFICATION Jammu, the 6th April 2023 No. JERC-JKL/Reg/2023/09: In exercise of powers conferred on it by subsection (4) of Section 91 read with Section 181 of the Electricity Act, 2003 (36 of 2003), and all other powers enabling it in that behalf, the Joint Electricity Regulatory Commission for UT of Jammu & Kashmir and UT of Ladakh, after previous publication, hereby makes the following regulations, namely:

1. Short Title and Commencement

1.1 These regulations may be called the Joint Electricity Regulatory Commission for UT of Jammu & Kashmir and UT of Ladakh (Appointment of Consultants) Regulations, 2023.

1.2 These regulations shall come into force from the date of their publication in the Official Gazette:

2. Definitions

2.1 In these regulations unless the context otherwise requires: - a. "Act" means the Electricity Act, 2003 (36 of 2003); b. "Commission" means the Joint Electricity Regulatory Commission for UT of Jammu & Kashmir and UT of Ladakh ;

c. “Committee” means the committee constituted by the Commission for evaluation of request of proposals; d. "Consultant" includes any individual - not in the employment of the Commission, firm, body or association of persons, who or which possesses or has access to any specialized knowledge, experience or skill;

e. "Secretary" means the Secretary of the Commission.

2.2 Words or expressions occurring in these regulations and not defined herein but defined in the Act shall bear the same meaning as in the Act.

3. Scope of Work

3.1 The Commission may from time to time appoint Consultants for executing specialized tasks for which skills are either not available within the staff of the Commission or where the nature of job is specific and time- bound or where the Commission considers appointment of consultant to be conducive or more efficacious and efficient method of completing the task in terms of quality, cost, time or for any other consideration or performing such other functions and for generally assisting the Commission in the performance of its functions, if the Commission considers it necessary.

3.2 The terms and conditions of engagement of Consultants will be drawn up in each case and agreed to between the Consultant and the Commission prior to the award of work.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

3.3 The terms of engagement would specify the exact nature of the tasks to be undertaken by the Consultant, the time allowed for the completion of each task, and the specific outputs that are to be provided by the Consultant in relation to each work as per terms of reference approved in this regard.

4. Period of Appointment

4.1 The consultant shall be appointed for the minimum period:

Provided that the period of the initial appointment of a consultant on any specific assignment shall not

normally exceed two years:

Provided further that period of appointment may be extended subject to the condition that the maximum period of continuous appointment of a consultant in no case shall exceed four years.

5. Categorisation of Consultants

5.1 The consultants shall be categorized as: (a) Institutional consultants, (b) Individual consultants, (c) Professional, Expert, and (d) Staff Consultant.

6. Institutional Consultant The Commission, on being satisfied that there is a need for availing consultancy services which, in its opinion, maybe more appropriately provided by a firm, or a company or an association or body of persons, shall engage an Institutional Consultant.

7. Individual Consultant

7.1 The Commission, on being satisfied that there is a need for availing consultancy services which, in its opinion, can be more efficiently performed by an individual having required qualifications and experience for an assignment, for which teams of personnel are not required, may decide to engage an Individual Consultant.

7.2 Individual Consultant may also be appointed for assisting the Commission in the discharge of its function-, if the Commission is satisfied that there has been an increase in the quantum of work of the Commission or a regular post could not be filled due to various constraints.

7.3 The Headquarters of the individual consultant normally shall be the Headquarters of the Commission.

7.3 Categorization of Individual Consultants

7.3.1 Based on experience, individual consultants shall be categorized as Category Minimum Experience in the Area of Appointment Advisors 15 years Senior Consultants 10 years Consultants 3years

7.3.2 The Commission may prescribe minimum educational qualifications, depending on the nature of the work, and the relevant professional qualifications related to subject area of the consultancy.

7.3.3 The Commission may in appropriate case, for reasons to be recorded in writing, relax the educational qualifications, keeping in view the overall expertise of the person being considered for engagement as individual consultant.

8. Professional Expert The Commission on being satisfied on the need for the professional expertise of specialized nature may decide to engage a professional expert for advice on the issue of urgent and specialized nature.

9 Staff Consultant Staff Consultant may be appointed for assisting the commission in discharging its functions. If the Commission is satisfied that there has been increasing in the quantum of work of the Commission or a regular post could not be filled due to various constraints.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 11 10 Appointment of Institutional Consultant

10.1 The Commission, on being satisfied that there is a need to avail services of the Institutional Consultant for any task, shall direct the Secretary to prepare or cause to be prepared the detailed terms of reference.

10.2 The Secretary shall prepare or cause to be prepared the detailed terms of reference for the appointment of Consultant for any specific task and shall obtain approval of the Commission.

10.3 The terms of reference shall be prepared to specify the objectives, goals, and scope of the assignment and provide background information including a list of existing relevant studies and basic data to facilitate the

consultant in the preparation of his proposal:

Provided that the terms of reference shall also list the services and surveys necessary to carry out the assignment and the expected outputs (for example reports, data, surveys, etc.) linked to each task included in the terms of reference.

Provided further that where transfer of knowledge-, and training is an objective, the terms of reference shall detail the number of staff to be trained.

10.4 After approval of the terms of reference by the Commission, the Secretary shall issue or cause to be issued the request for proposals to invite proposals for appointment as Institutional Consultant and give such publicity as may be considered appropriate by the Commission.

10.5 The Commission may decide either to invite combined technical and financial proposals or separate technical and financial proposals.

10.6 The Commission may prescribe the minimum qualifying marks for the technical bid.

11 Request for proposals

The request for proposals shall include the following: -

11.1 A letter of invitation stating the intention of the Commission to enter into a contract for the provision of consultancy services, the details of the plan, and the date, time, and address for submission of proposals.

11.2 Information to the consultants shall contain all necessary information that will help them to prepare responsive proposals by providing information on the evaluation process and by indicating the evaluation criteria and factors and their respective weights and the minimum pre-qualification score and special qualifying clause if any.

11.3 Terms of reference as prepared in this regard as per regulation (10.3) above.

12 Receipt of proposals

12.1 The Commission shall prescribe the time within which the Consultants shall submit their proposals.

12.2 The Commission may, where it considers appropriate, decide to extend the time limit for the submission of proposals.

12.3 No amendment to the technical or financial proposals shall be accepted after the expiry of the time limit.

12.4 The proposals shall be submitted in sealed cover(s).

13 Evaluation of proposals

13.1 The proposal shall be evaluated both on the basis of technical competence as well as quoted cost.

13.2 Where the Commission decides that the technical and financial proposals be evaluated separately, the Committee shall not have access to the financial proposals, until the evaluation of the technical proposals is completed.

13.3 The proposal shall be evaluated by a Committee appointed by the Commission in this regard. The Committee may enter into both technical and financial negotiations. Where technical negotiations are conducted, the same will be conducted prior to the pre-qualification of consultants. Financial negotiations can be entered into for any aspect of the financial proposal including the unit rates for staff months, contingency amounts, lump sum reimbursement of travel and living expenses, and payment terms.

14 Technical Evaluation

14.1 Technical evaluation will be done by the Committee appointed under regulation (13.3) above taking into account the criteria given under regulation (14.2) below.

14.2 Each technical criterion shall be marked on a scale of 1 to 100 and then the marks for each criterion shall be weighted to become average technical scores. Weights in the following ranges will be used by the Committee, with the approval of the Commission, to calculate the weighted average technical score for each

proposal: -12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Criterion Range of Weights Consultant‟s relevant experience for the assignment 0.10 to 0.40 Quality of the methodology proposed 0.20 to 0.50 Qualifications of the key staff proposed 0.30 to 0.60 Extent of transfer of knowledge to the staff of the Commission 0.05 to 0.35

Note : The mix of weights approved by the Commission will total to 1.

The Evaluation Committee appointed under Regulation (13.3), shall decide the weightage to be allocated (in the range prescribed above) to each of the parameters for the purpose of technical evaluation of bids, and obtain the approval of the Chairperson of the Commission for the allocation. The Commission shall have the right of distribution of marks on the basis of the nature and requirement of the assignment.

14.3 Where the assignment depends critically on the performance of the key staff, the proposal shall be evaluated

on the qualifications of the individuals proposed to be appointed using the following criteria: - a) General qualifications: General education and training, length of experience, positions held, time with the consulting firm as staff, experience in developing countries, etc.

b) Adequacy for the assignment: Education, training, experience in the specific sector, field, subject, and relevance to the particular assignment.

14.4 After the technical evaluation is completed, the Commission shall inform those Consultants whose proposals did not meet the minimum qualifying marks or were considered non-responsive to the terms of reference, and their financial proposals will be returned unopened after completing the selection process.

14.5 Simultaneously, those Consultants who have secured the minimum qualifying marks after technical evaluation shall be informed about the date and time for opening the financial proposals, giving sufficient time for the Consultants to be present at the opening should they so desire.

15 Financial Evaluation

15.1 The financial proposals of the technically qualified Consultants will be opened by the Committee in the presence of consultants or their representatives whose bids are shortlisted for financial evaluation. The proposed prices shall be read aloud and recorded in minutes of the proceedings.

15.2 The Secretary will cause a review of the financial proposals to be done. Arithmetical errors will be corrected.

The cost shall be quoted in Indian Rupees.

15.3 The proposal with the lowest cost will be given a financial score of 100 and other proposals will be given financial scores that are inversely proportional to their cost.

16 Evaluation of financial and technical scores

16.1 The total score shall be obtained by weighting the technical and financial scores and adding them and the consultant with the highest total score shall be invited by the Commission to enter into a contract within the prescribed time limit. The weight for the technical and financial score shall be as prescribed by the Commission in each case taking into account the complexity of the assignment and the relative importance of quality. However, the weight will never exceed 0.3 for the financial score in any case.

16.2 The Commission may reject any or all proposals if they are found to be unresponsive or unsuitable either because they represent major deficiencies in complying with the terms of reference or they involve cost substantively higher than the original estimate.

17 Appointment of Individual Consultants Individual consultants may be selected on the basis of their qualifications and experience for the assignment.

The Commission may direct the Secretary to prepare the terms of reference indicating the scope of work and other terms and conditions as per the requirement, which shall be submitted to the Commission for approval.

Individual Consultants may be selected on the basis of references or from amongst those who have applied[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 13 against the notice published by the Commission in this regard, as the case may be. Their suitability shall be judged on the basis of academic background, experience, and adequate knowledge of local conditions, administrative system, and government organization.

17.1 Minimum Qualification and Age criteria: The aspirant candidate should possess (a) a Bachelor‟s degree in Engineering from a recognized college/ university. (b) The candidate must have a clear understanding of the Electricity Act, 2003, the rules and regulations made under the Act, and the applicable policies, legal and regulatory framework related to the power sector. (c) Proven experience in providing assistance to States/Joint/Central Electricity Regulatory Commissions during the regulatory proceedings involved during the tariff determination process and related matters. (d) the candidate up to the age of 60 years on the date of application are eligible to work as an individual consultant and can render services to the Commission till attaining the age of 65 years; afterward no age relaxation shall be allowed.

18 Fees and Other Charges in Case of Individual Consultants

18.1 Except where the Commission directs otherwise, the individual consultant shall be appointed generally on a consolidated fee basis, depending on the nature of the assignment or monthly fee basis.

18.2 No payments in addition to the consolidated fee in accordance with sub-regulation (1) shall be made in the

case of individual consultants:

Provided that the Commission may allow an additional amount not exceeding 10% of the fee payable to the consultant to cover expenditures of contingent nature.

18.3 Where the consultant has to incur expenditure on travel to and stay at a place away from the headquarters of the Commission, the Commission shall reimburse the cost of travel by an appropriate class, not lower than that permitted to a Group A Officer of the Central Government and authorize payment of Daily Allowance, in addition to the fee and other charges payable under these regulations, for such number of days as the Commission may consider appropriate.

18.4 The fee and other charges payable to individual consultants under these regulations shall also be payable to former and retired Government servants appointed as consultants by the Commission.

Note:

1. The Commission reserves the right to decide about the fee payable to the Individual Consultant on a daily/monthly basis based on the experience and credentials of the Individual consultant as deemed proper by the Commission.

2. The Commission also reserves the right to specify the amounts permissible as daily Allowance, determine the reasonable limits within which actual expenses are to be allowed, on a case-to-case basis, and assess the reasonableness of any claim submitted thereof.

19 Appointment of Professional Experts On the Commission having decided to engage professional experts, the Secretary of the Commission shall formalize the proposals. He/ She shall prepare a list of not less than two professionals having the requisite expertise in the specialized field, their willingness to accept consultancy work, and the fee demanded by each of them.

The Commission may approve the name of the expert for engagement as a consultant on payment of such fee and on such terms, as may be considered appropriate provided that the fee so decided shall not exceed Rs. 10

(Ten) lakhs for an individual specialized assignment of work.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 20 Appointment of Staff Consultant

20.1 The Commission, on being satisfied that there has been an increase in the quantum of work of the commission, or difficulties arising in filing regular posts, may decide to engage a staff consultant to expedite the work, to assist the commission in the discharge of its functions effectively and direct the Secretary to take further steps.

20.2 The Commission, after having decided to engage a staff Consultant, shall invite applications on a tenure basis, by publishing a notice in the National Dailies and on the Commission‟s Website, and by giving, as far as possible, a period of four weeks for inviting application by the interested persons.

20.3 Before publishing the notice, the Secretary of the Commission shall identify the qualification and experience requirements keeping in view the relevant provisions of the Commission‟s Regulations governing recruitment against a regular post.

20.4 The staff consultant may be categorized based on qualification and length of experience ranging from 3 to 15 or more years and offered a consolidated fee which shall be equivalent to basic pay plus dearness allowance of the post against which the staff consultant is being engaged.

20.5 The staff consultant shall be engaged on a tenure basis, initially for a period of one year where the fee payable does not exceed Rs.10 lakhs for the year.

20.6 The Commission shall constitute a Selection Committee which shall interact with the candidates and recommend names of suitable persons for engagement as staff consultants for approval of the Commission.

20.7 Minimum qualification and age criteria: The aspirant candidate should possess Bachelor‟s degree in Engineering from a recognized college/ university. The candidate up to the age of 60 years on the date of application is eligible to work as an individual consultant and can render services to the Commission till attaining the age of 65 years; afterward no age relaxation shall be allowed.

21 Single source selection Single source selection may be resorted to by the Commission in appropriate cases where it represents a clear advantage because the tasks represent a natural continuation of previous work carried out by the consultant, or where an immediate selection is essential, or for small assignments where the fee payable does not exceed Rs.10 lakhs or where only one firm is qualified or has experience for the assignment.

22 Conflict of interest Consultant shall not be hired for any assignment that would be in conflict with his prior or current obligations to other clients or that may place him in a position of not being able to carry out the assignments objectively and impartially.

23 Appointment of Consultants The consultant selected for appointment shall be required to execute an agreement in the format given in the Schedule at the end of these regulations, with such variations and modifications considered appropriate in individual cases.

24 Saving of the inherent power of the Commission Nothing in these provisions shall bar the Commission from adopting a procedure which is at variance with any of the provisions of these Regulations, if the Commission, in view of the special circumstances of the matter or class of matters and for reasons to be recorded in writing, deems it necessary or expedient to depart from the procedure prescribed in these Regulations.

25 General power to amend The Commission may at any time and on such terms, as it may think fit, amend any provision of these Regulations for the purpose of meeting the objectives for which these Regulations have been framed.

26 Power to remove difficulties If any difficulty arises in giving effect to any of the provisions of these Regulations, the Commission may, by general or special order, do anything, not being inconsistent with the provisions of the Act, which appears to it to be necessary or expedient for the purpose of removing the difficulties.

[ADVT.-III/4/Exty./49/2023-24][भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 15 SCHEDULE Articles of Agreement made on this ________________day of __________________ between _____________of _______________one (first) part (Consultant) and the Joint Electricity Regulatory Commission for UT of Jammu & Kashmir and the UT of Ladakh (herein after called “the Commission”) of the other (Second) part.

Whereas the Commission has engaged the party of the first part as a Consultant and the party of the first part has agreed, to provide the consultancy services to the Commission, on the terms and conditions herein after contained.

Now, these presents witnesses and the parties hereto respectively agree as follows:

1) The party of the first part (Consultant) shall submit himself to the orders of the Commission and of the officers and authorities under whom he may from time to time be placed by the Commission.

2) The party of the first part (Consultant) shall complete the assignment as contained in Schedule – „A‟ within a period of _______________________ commencing from_______________________.

5) No TA/DA shall be admissible to the party of the first part for local journeys in connection with the consultancy assignment. (maybe varied depending on terms agreed for any individual assignment)

6) The payment of the fee shall be made by the Commission after the deduction of tax at source in accordance with the law for the time being in force.

7) Any information of confidential nature, which comes to the knowledge or into the possession of the consultant or any of its employees by virtue of the engagement subject matter of this contract shall not be disclosed by the consultant or its employees to any unauthorized person in any manner. Any breach of this clause without prejudice to any other action that may be initiated according to law-, shall also subject the consultant to a liability to pay to the Commission such compensation as may be decided by the Commission keeping in view the nature, manner, and motive of the information disclosed and the extent of the damage caused by such unauthorized disclosure.

8) The party of the first part undertakes that this assignment shall not be in conflict with its prior or current obligation to other clients nor shall it place itself in a position of not being able to carry out the assignments objectively and impartially.

9) In case of any default on the part of the party of the first part in the completion of the work within the time schedule agreed to between the parties as herein above, the party of the second part (the Commission) shall be at liberty to get the work completed from any other agency at the risk and cost of the party of the first part

(Consultant).

10) The Commission reserves its right to foreclose, terminate or cancel the engagement of the consultant without assigning any reasons. In such cases party of the first part (Consultant) shall be paid remuneration after taking into consideration the portion of work completed prior to such foreclosure, termination, or cancelation of the engagement as may be decided by the Commission and the decision of the Commission shall be conclusive and binding. The remuneration so fixed and paid shall be deemed to be the final payment in such cases.

11) In case of any differences or disputes between the parties arising out of this AGREEMENT, the same shall be referred for arbitration of a person nominated by the Commission. The proceedings shall be subject to the Arbitration and Conciliation Act 1996, as amended from time to time.

12) Consultant‟s Personnel The party of the first part (Consultant) shall provide a Description of personnel with names, positions and qualifications.

13) Removal and/or replacement of the personnel Except as the Commission may otherwise agree, no change shall be made in the key personnel. If, for any reason, beyond the reasonable control of the Consultant, it becomes necessary any of the key personnel, the Consultant shall forthwith provide as a replacement a person of equivalent or better qualifications, which is acceptable to the Commission.

14) If the Commission finds that any of the personnel (1) committed serious misconduct or has been charged with having committed a criminal action or (2) have reasonable cause to be dissatisfied with the performance of any of the personnel, then the Consultant shall, at the Secretary‟s written request, specifying the ground therefore, forthwith provides as a replacement a person with qualification and experience acceptable to the Commission.

The Consultant shall have no claim for additional costs arising out of or incidental to any removable and /or replacement of personnel.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

18) In respect of any matter for which no provision has been made in this agreement, the provisions contained in the general instructions of the Government of India on the subject of engagement of consultants shall apply.
