1. सवं क्षप्त िाम, विस्तार और प्रारंभ

1.1 इि विवियमों को संयुक्त विद्युत विवियामक आयोग (चंडीगढ़ पािर वडस्रीब्यूशि विवमटेड पर िाग ू वितरण िाइसेंस की विवशष्ट शत)ें विवियम, 2026 कहा जाएगा। 8129 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

1.2 इि विवियमों का विस्तार केंद्रशावसत प्रदेश चडं ीगढ़ के उस िाइसेंस प्राप्त क्षत्रे तक होगा, वजसका उल्िेि चडं ीगढ़ प्रशासि द्वारा राजपत्र म ेंददिांक 31.01.2025 तथा 30.01.2026 को अविसूवचत अंतरण योजिाओं (Transfer Schemes), यथा समय-समय पर संशोवित, म ें दकया गया ह।ै ये विवियम केंद्रशावसत प्रदेश चंडीगढ़ के भीतर चडं ीगढ़ पािर वडस्रीब्यशू ि विवमटेड (संक्षेप म,ें सीपीडीएि) द्वारा विद्युत के वितरण एि ं िुदरा आपूर्त व पर िाग ू होंग।े य े विवियम राजपत्र म ें इिके प्रकाशि की तारीि स े प्रिृत्त होंगे।

1.3 इि विवियमों के प्राििाि आयोग के अन्य विवियमों के परू क होंग ेतथा उिकी व्याख्या उि विवियमों के साथ सामंजस्य स्थावपत करते हुए की जाएगी। ऐसे दकसी विषय के संबंि म,ें वजसके विए इि विवियमों म ेंविशेष रूप स ेकोई प्राििाि िहीं दकया गया ह,ै संयुक्त विद्युत विवियामक आयोग (गोिा राज्य एि ंसंघ राज्य क्षेत्रों के विए) (पारेषण एिं वितरण िाइसेंससंग) विवियम, 2020 के प्राििाि िागू होंगे।

2. पठरभाषाए ँ

2.1 इि विवियमों म,ें जब तक दक संदभव स े अन्यथा अपेवक्षत ि हो:—

(a) “सामान्य शत”ें (General Conditions) स ेअवभप्राय िाइसेंस की उि शतों स ेह,ै जो सयं ुक्त विद्युत विवियामक आयोग (गोिा राज्य एि ं संघ राज्य क्षेत्रों के विए) (पारेषण एि ं वितरण िाइसेंससंग) विवियम, 2020 म ें विविर्दवष्ट ह ैं तथा िाइसेंसिारी पर िाग ू होती ह।ैं

(b) “विवशष्ट शत”ें (Specific Conditions) स ेअवभप्राय िाइसेंस की उि शतों स े ह,ै जो इि विवियमों म ें विविर्दवष्ट ह ैंतथा संबंवित िाइसेंसिारी पर िाग ूहोती ह।ैं

2.2 इि विवियमों म ें प्रयक्तु ऐसे शब्दों एि ं अवभव्यवक्तयों, वजन्ह ें इि विवियमों म ें विशेष रूप स े पठरभावषत िहीं दकया गया ह,ै ककंत ु वजन्ह ें अविवियम म ें पठरभावषत दकया गया ह,ै के िही अथव होंगे जो उन्ह ें विद्युत अविवियम, 2003 म ें ददए गए ह।ैं यदद ऐसे शब्दों एि ं अवभव्यवक्तयों को अविवियम अथिा आयोग के विवियमों म ें पठरभावषत िहीं दकया गया ह,ै ककंतु संसद द्वारा अविवियवमत दकसी अन्य विवि म ेंपठरभावषत दकया गया ह ैतथा िह विवि संबंवित राज्य या संघ राज्य क्षत्रे म ेंविद्युत क्षत्रे पर िागू होती ह,ै तो ऐस ेशब्दों एि ंअवभव्यवक्तयों के िही अथव होंग े जो उक्त विवि म ेंवििावठरत ह।ैं

3. प्रयोज्यता ये विवशष्ट शत,ें संयक्तु विद्युत विवियामक आयोग (गोिा राज्य एि ंसंघ राज्य क्षेत्रों के विए) (पारेषण एिं वितरण िाइसेंससंग) विवियम, 2020 तथा समय-समय पर प्रिृत्त वितरण िाइसेंसिाठरयों पर िाग ू सामान्य शतों के अवतठरक्त, अविवियम के प्राििािों के अिुसार चंडीगढ़ म ें पंजीकृत कायाविय रिि े िािी सीपीडीएिm के िाइसेंस की शतें मािी जाएगँ ी।

4. वितरण क्षत्रे अथिा आपर्ू त वक्षत्रे

4.1 िह आपूर्तव क्षत्रे , वजसके भीतर सीपीडीएि विद्युत की आपूर्तव करिे के विए अविकृत ह,ै केंद्रशावसत प्रदेश चंडीगढ़ का संपूणव भौगोविक क्षत्रे होगा, जसै ा दक चंडीगढ़ प्रशासि द्वारा ददिांक 31.01.2025 तथा 30.01.2026 को जारी अंतरण योजिा म,ें यथा समय-समय पर संशोवित, उवल्िवित ह।ै यह क्षत्रे उक्त अविसूचिा म ेंविविर्दवष्ट शतों एिं अपिजविों के अिीि होगा।

4.2 िाइसेंसिारी की वस्थवत के वििंबि, समावप्त अथिा िाइसेंस विरस्तीकरण जैसी दकसी घटिा के घठटत होि े की वस्थवत में, सीपीडीएि ऐसी घटिा की तारीि स ेिाइसेंसिारी की वस्थवत िो दगे ा।

5. िाइससें की शत ें एि ंअिवि

5.1 सीपीडीएि विद्युत अविवियम, 2003 के अतं गतव एक मावित वितरण िाइसेंसिारी (deemed distribution licensee) ह,ै वजसे आग े “िाइसेंसिारी” कहा जाएगा। िाइससें , अंतरण योजिा, 2025 के कायावन्ियि की प्रभािी तारीि से 25 िष वकी अिवि के विए, अथावत ्31 जििरी, 2050 तक, अथिा अविवियम एि ंवियमों के अिुसार विरस्त या ििीिीकृत दकए जािे तक िैि रहगे ा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

5.2 िाइसेंसिारी िाइसेंस की अिवि समाप्त होिे स ेएक िष वपूिव उसके ििीिीकरण के विए आिेदि प्रस्ततु करेगा।

5.3 आयोग, स्िय ंकी पहि पर अथिा िाइसेंसिारी के आिेदि पर, अविवियम की िारा 18 तथा संयुक्त विद्युत विवियामक आयोग (गोिा राज्य एि ं संघ राज्य क्षेत्रों के विए) (पारेषण एि ं वितरण िाइसेंससंग) विवियम, 2020 के विवियम 25 के प्राििािों के अिीि रहते हुए, इि विवियमों म ेंपठरितवि, संशोिि अथिा पठरिििव कर सकता ह।ै विवशष्ट शत ें

6. विवशष्ट शतों एि ंिाइससें का विरीक्षण िाइसेंसिारी इि विवियमों की अविसूचिा की तारीि के तुरंत बाद िाइसेंस की इि विवशष्ट शतों को जिता के विरीक्षण हते ु उपिब्ि कराि े की व्यिस्था करेगा।

7. विबािव विद्यतु आपर्ू त व िाइसेंसिारी आपूर्त व क्षत्रे के भीतर प्रवतददि चौबीस घंटे विबावि विद्युत आपूर्त व सुविवश्चत करिे के विए आिश्यक व्यिस्था करेगा।

8. दडं िाइसेंसिारी अविवियम तथा उसके अंतगवत बिाए गए िाग ूवियमों एिं विवियमों के प्राििािों के अिुसार दडं ात्मक कारविाई के विए उत्तरदायी होगा।

9. अतं रण योजिा इि विवियमों म ें दकसी बात के होते हुए भी, चडं ीगढ़ विद्युत सिु ार अतं रण योजिा, 2025 का इि विवियमों के ऐस े दकसी भी प्राििाि पर अविभािी प्रभाि होगा, जो उक्त अंतरण योजिा के विपरीत हो अथिा उससे असंगत हो।

10. विविि

10.1 िाइसेंसिारी विद्युत अविवियम, 2003 तथा उसके अंतगवत बिाए गए वियमों एि ंविवियमों के तहत विद्युत विरीक्षक को प्रदत्त शवक्तयों के अिुसरण म ें उसके द्वारा जारी विदेशों का अिुपािि करेगा।

10.2 िाइसेंसिारी अपिी संििै ाविक संरचिा अथिा ितवमाि शेयरिाठरता संरचिा म ें दकसी पठरितिव की वस्थवत म,ें ऐस े पठरितवि की तारीि स ेतत्काि और दकसी भी वस्थवत म ेंपंद्रह (15) ददिों के भीतर, आयोग को इसकी सूचिा देगा।

10.3 िाइसेंसिारी आयोग द्वारा समय-समय पर अपेवक्षत प्रपत्र म ेंऐसी ठरपोटव, सूचिा एि ंआँकडे प्रस्तुत करेगा, जैसा आयोग द्वारा अपेवक्षत हो।

11. वििाद विपटाि एि ं इि विवियमों की व्याख्या के सबं िं म ेंविणयव

11.1 िाइसेंस प्राप्त व्यिसाय स ेसंबंवित सभी वििादों का विपटारा विद्युत अविवियम, 2003 के प्राििािों के अिुसार दकया जाएगा।

11.2 इि विवियमों की व्याख्या स ेसंबंवित सभी मुद्द ेआयोग के वििावरण के अिीि होंग ेतथा ऐसे मुद्दों पर आयोग का विणयव अंवतम होगा।

12. राज्य विड कोड का अिपु ािि

12.1 िाइसेंसिारी संयुक्त विद्युत विवियामक आयोग (राज्य विड कोड) विवियम, 2010, यथा समय-समय पर संशोवित, के प्राििािों का, जहा ँ तक ि े उस पर िागू हों, अिुपािि करेगा।

13. वितरण कोड का अिपु ािि

13.1 िाइसेंसिारी संयक्तु विद्यतु विवियामक आयोग (वितरण कोड) विवियम, 2010, यथा समय-समय पर संशोवित, को िाग ू करेगा तथा उसके प्राििािों का अिुपािि करेगा।

14. ऊजा व ििे ाकं ि एि ंििे ापरीक्षा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

14.1 िाइसेंसिारी ऊजा व दक्षता ब्यूरो (विद्युत वितरण कंपवियों में ऊजा व िेिापरीक्षा के सचं ािि की रीवत एि ं अंतराि) विवियम, 2021, यथा समय-समय पर संशोवित, को िाग ू करेगा तथा उसके प्राििािों का अिुपािि करेगा।

14.2 िाइसेंसिारी प्रत्येक वित्तीय िषव के विए िार्षवक ऊजा व िेिापरीक्षा आयोवजत करेगा तथा संबंवित वित्तीय िषव की समावप्त स े चार माह के भीतर िार्षवक ऊजाव िेिापरीक्षा ठरपोटव आयोग को प्रस्तुत करेगा और उसे अपिी िेबसाइट पर भी उपिब्ि कराएगा।

15. उपभोक्ता चाटवर

15.1 िाइसेंसिारी एक उपभोक्ता चाटवर तैयार करेगा, उसका प्रचार-प्रसार करेगा तथा उसका पािि करेगा। इस चाटवर म ें उपभोक्ताओं के सभी अविकारों, हकदाठरयों एि ं उत्तरदावयत्िों तथा विद्युत आपूर्त व के संबंि म ेंिाइसेंसिारी के दावयत्िों का वििरण होगा। इसम ें िाइसेंसिारी द्वारा सुविवश्चत सेिा स्तर तथा अविवियम एि ं अन्य िागू विवियों और विवियमों के अंतगतव उिके पारस्पठरक संबंिों के अन्य पहि ू भी शावमि होंग।े उपभोक्ता चाटवर म ेंअन्य बातों के साथ-साथ अिुमोददत उपभोक्ता वशकायत वििारण प्रदिया, उपभोक्ता अविकारों का वििरण तथा उपभोक्ता को उसके विद्युत किेक्शि, िपत, आकिि आदद के संबंि म ेंसूचिा प्राप्त करि ेका अविकार शावमि होगा।

16. उपभोक्ता वशकायत वििारण प्रदिया

16.1 िाइसेंसिारी आयोग द्वारा विविर्दवष्ट वशकायत वििारण प्रदिया का अिुपािि करेगा। िाइसेंसिारी विम्नविवित सुविवश्चत करेगा:—

(a) समय-समय पर संशोवित वशकायत वििारण प्रदिया की एक प्रवत, सामान्य काय वघंटों के दौराि, संबंवित प्रत्येक पठरसर में जिता के विरीक्षण हते ु उपिब्ि कराई जाएगी; तथा

(b) समय-समय पर संशोवित वशकायत वििारण प्रदिया की एक प्रवत प्रत्येक िए उपभोक्ता को वििःशुल्क उपिब्ि कराई जाएगी। इसके अवतठरक्त, अिरु ोि करिे िाि े दकसी अन्य व्यवक्त को भी उक्त प्रदिया की प्रवत ऐसी कीमत पर उपिब्ि कराई जाएगी, जो उसकी प्रवतविवप तयै ार करि े की िागत स ेअविक ि हो।

17. उपभोक्ताओं के अविकार एि ं सचू िा का अविकार

17.1 िाइसेंसिारी विद्युत (उपभोक्ताओं के अविकार) वियम, 2020, यथा समय-समय पर संशोवित, के प्राििािों का अिुपािि करेगा।

17.2 उपभोक्ता के अिुरोि पर, िाइसेंसिारी अपिी युवक्तसगं त रूप स े उपिब्ि जािकारी की सीमा तक, विम्नविवित जािकारी उपिब्ि कराएगा:—

(a) िाइसेंसिारी द्वारा प्रदाि की जािे िािी सभी सेिाओं के संबंि म ें जािकारी, वजसम ें आयोग द्वारा अिुमोददत प्रभारों अथिा टैठरफ स े संबंवित जािकारी भी शावमि होगी;

(b) िाइसेंसिारी द्वारा उपभोक्ता के पठरसर म ेंप्रदाि की जा रही विद्युत सेिा के संबंि म ेंमीटर रीसडगं की जािकारी; तथा

(c) िाइसेंसिारी के पास उपभोक्ता के िाते की वस्थवत के संबंि म ें जािकारी।

17.3 िाइसेंसिारी इस िडं के अंतगवत जािकारी उपिब्ि करािे के विए उवचत रावश का शल्ु क ि े सकता ह,ै जब तक दक अिुरोवित जािकारी सामान्य प्रकृवत की ि हो।

18. विवियों, वियमों एि ं विवियमों का अिपु ािि िाइसेंसिारी अविवियम तथा उसके अतं गतव बिाए गए वियमों और आयोग द्वारा समय-समय पर जारी विवियमों, ददशाविदेशों, आदशे ों एि ं विदशे ों का अिपु ािि करेगा, वसिाय उस वस्थवत के जब िाइसेंसिारी को दकसी विचिि के विए आयोग की पूिव विवित स्िीकृवत प्राप्त हो।

18.1 िाइसेंसिारी केंद्रीय विद्युत प्राविकरण तथा केंद्रीय विद्युत विवियामक आयोग द्वारा जारी विवियमों एि ं ददशाविदेशों का, जहाँ तक िे िागू हों, अिुपािि करेगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5

18.2 िाइसेंसिारी उपभोक्ता वशकायत वििारण मंच (CGRF) अथिा िोकपाि द्वारा जारी आदशे ों एि ं विदशे ों का अिुपािि करेगा।

18.3 िाइसेंसिारी िाइसेंस म ें विविर्दवष्ट सामान्य शतों के अिसु ार काय व करेगा, वसिाय उि वस्थवतयों के जहा ँ आयोग द्वारा उसे विशेष रूप स ेछूट प्रदाि की गई हो अथिा अिुमवत दी गई हो।

18.4 िाइसेंसिारी विद्युत अविवियम, 2003 तथा उसके अतं गवत बिाए गए वियमों एि ं विवियमों के अिुसार अपिे कायों के वििवहि म ेंराज्य भार प्रेषण केंद्र (SLDC), राज्य पारेषण उपयोवगता (STU) तथा अन्य िैिाविक प्राविकरणों द्वारा जारी आदेशों एि ंविदेशों का अिुपािि करेगा।

18.5 िाइसेंसिारी अपिे आपूर्तव क्षत्रे म ें विद्युत आपूर्त व के संबिं म ें संयुक्त विद्युत विवियामक आयोग (गोिा राज्य एि ं संघ राज्य क्षेत्रों के विए) (वितरण िाइसेंसिाठरयों के विए विष्पादि मािक) विवियम, 2015 तथा संयुक्त विद्युत विवियामक आयोग (गोिा राज्य एि ंसघं राज्य क्षेत्रों के विए) (विद्युत आपूर्तव संवहता) विवियम, 2018, यथा समय-समय पर संशोवित, का पािि करेगा।

19. कठििाइयों को दरू करि ेकी शवक्त यदद इि विवियमों के प्राििािों को प्रभािी बिािे म ेंकोई कठििाई उत्पन्न होती ह,ै तो आयोग, सामान्य अथिा विवशष्ट आदेश द्वारा, अविवियम के प्राििािों स े असंगत ि होि े िािे ऐसे प्राििाि कर सकता ह,ै जो उक्त कठििाई को दरू करिे के विए आिश्यक प्रतीत हों।

20. छूट प्रदाि करि ेकी शवक्त आयोग जिवहत म ें तथा विवित रूप म ें कारण दज व करत े हुए, इि विवियमों के दकसी भी प्राििाि म ें छूट प्रदाि कर सकता ह।ै रािेि िागं ी, सजचि (प्रभारी) [जिज्ञापि-III/4/असा./406/2026-27] JOINT ELECTRICITY REGULATORY COMMISSION (For the State of Goa and UTs)

NOTIFICATION Gurugram, the 5th October, 2026 JOINT ELECTRICITY REGULATORY COMMISSION (SPECIFIC CONDITIONS OF DISTRIBUTION LICENSE APPLICABLE TO CHANDIGARH POWER DISTRIBUTION LIMITED) REGULATIONS, 2026.

No. JERC-38/2026.—In exercise of powers vested under Section 14, 15 and 16 read with Section 181 of the Electricity Act, 2003, and Regulation 71 of the Joint Electricity Regulatory Commission for the State of Goa and Union Territories (Transmission and Distribution Licensing) Regulations, 2020, and all other powers enabling it in this behalf, and after previous publication the Joint Electricity Regulatory Commission (for the State of Goa and Union Territories), hereby makes the following Regulations, namely: —

1. Short title, Extent and Commencement. –

1.1 These Regulations may be called the Joint Electricity Regulatory Commission (Specific Conditions of Distribution License applicable to Chandigarh Power Distribution Limited) Regulations, 2026.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

1.2 These Regulations shall extend to the licensed area of Union Territory of Chandigarh as mentioned in the Transfer Schemes 2025 notified by Chandigarh Administration in official gazette dated 31.01.2025 and 30.01.2026 as amended from time to time for Distribution and Retail Supply of Electricity by Chandigarh Power Distribution Limited (in short CPDL) within the Union Territory of Chandigarh. These Regulations shall come into force from the date of their publication in the Official Gazette.

1.3 The provisions of these Regulations shall be supplemental to the other Regulations of the Commission and shall be construed harmoniously with them. In the event of any matter not specifically provided for in these Regulations, the provisions of the Joint Electricity Regulatory Commission for the State of Goa and Union Territories (Transmission and Distribution Licensing) Regulations, 2020, shall apply.

2. Definitions:

2.1 In these Regulations, unless the context otherwise requires: —

(a) “General Conditions” means conditions of the Licence which are applicable to the Licensee specified in Joint Electricity Regulatory Commission for the State of Goa and Union Territories (Transmission and Distribution Licensing) Regulations, 2020.

(b) “Specific Conditions” mean Conditions of the Licence which is applicable to the Licensee as specified in these Regulations;

2.2 Words and expressions used in these Regulations if not specifically defined herein, but defined in the Act, shall have the meanings assigned to them in the Electricity Act, 2003, but if are not defined under the Act and Regulations of the Commission and defined under any other law enacted by Parliament and applicable to the electricity sector in the State or Union territory, shall have the meanings assigned to them under such law.

3. Applicability:

These Specific Conditions, in addition to the Joint Electricity Regulatory Commission for the State of Goa and Union Territories (Transmission and Distribution Licensing) Regulations, 2020 specifying the general conditions for Distribution Licensees, as may be in force from time to time, shall be deemed to be the conditions of licence of CPDL, having its registered office in Chandigarh, the licensee in accordance with the provisions of the Act.

4. Area of Distribution or Area of Supply:

4.1 The Area of Supply within which CPDL is authorized to supply electricity shall be the whole of the geographical area of Union Territory of Chandigarh. as mentioned in the Transfer Scheme issued by the Chandigarh Administration dated 31.01.2025 and 30.01.2026 as amended from time to time subject to such conditions and exclusions as specified in the said notification.

4.2 In case of events such as suspension / termination, or revocation of the licensee period etc., the CPDL shall lose its status as a licensee from date of such event.

5. Terms / Tenure of the Licence:

5.1 CPDL is a deemed distribution licensee under the Electricity Act, 2003 (hereinafter referred to as Licensee) and the license shall be valid for a period of 25 years till 31st January 2050, from the effective date for implementation of the Transfer Scheme, 2025 or until revoked or renewed in accordance with the Act and Rules.

5.2 The Licensee shall file an application for renewal of license, one year before the expiry of license tenure.

5.3 The Commission may suo-moto or on application by the licensee may alter or amend or modify these Regulations subject to provision of Section 18 of the Act and Regulation 25 of the JERC (Transmission and Distribution Licensing) Regulations, 2020.

SPECIFIC CONDITIONS

6. Inspection of Specific Conditions and Licence:

The Licensee shall make provision for public inspection of these Specific Conditions of Licence, immediately after the date of notification of these Regulations.

7. Un-interrupted power supply:

The Licensee shall make provisions for uninterrupted power supply for twenty-four hours in a day within the area of supply.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7

8. Penalty:

The Licensee shall be liable for penal action under the applicable provisions of the Act and the Rules and the Regulations made thereunder.

9 Transfer Scheme:

Notwithstanding anything contained in these Regulations, the Chandigarh Electricity Reforms Transfer Scheme, 2025 shall have an overriding effect on any provision of these Regulations that is contrary to or in conflict with the Chandigarh Electricity Reforms Transfer Scheme, 2025.

10 Miscellaneous:

10.1 The Licensee shall comply with the directions of the Electrical Inspector pursuant to the power vested in it under the Electricity Act, 2003 and Rules & Regulations made there under.

10.2 The Licensee shall, in the event of a change in its constitution or existing share holding pattern, immediately and in no case later than fifteen (15) days from the date thereof, inform the Commission of such change.

10.3 The Licensee shall submit such report, information, data in such form as called by the Commission from time to time.

11 Dispute Resolution and Decision on Interpretation of these Regulations:

11.1 All dispute in terms of licensed business shall be dealt in accordance with the provisions of the Electricity Act, 2003.

11.2 All issues arising in relation to interpretation of these Regulations shall be a matter for the determination of the Commission and the decision of the Commission on such issues shall be final.

12 Compliance with State Grid Code;

12.1 The Licensee shall comply with the provisions of the JERC (State Grid Code) Regulations, 2010 as amended from time to time, in so far as applicable to it.

13 Compliance with the Distribution Code:

13.1 The Licensee shall implement and comply with the JERC (Distribution Code) Regulations, 2010 as amended from time to time.

14 Energy Accounting and Audit:

14.1 The Licensee shall implement and comply with the Bureau of Energy Efficiency (Manner and Intervals for Conduct of Energy Audit in electricity distribution companies) Regulations, 2021 as amended from time to time.

14.2 The Licensee shall conduct an annual energy audit for every financial year and submit the annual energy audit report to the Commission and also make available on its website within a period of four months from the expiry of the relevant financial year.

15 Customer Charter:

15.1 The Licensee shall prepare, publicise and adhere to a Customer Charter detailing all the rights, entitlements and responsibilities of the consumers and obligations of the Licensee relating to supply of electricity including the Licensee’s guaranteed service levels and other aspects of their relationship under the Act and other applicable laws and Regulations. The Customer Charter shall include among other things approved consumer complaint handling procedure, consumer right statement and consumer right to information regarding his connection, consumption, assessment, etc.;

16 Consumer Complaint Handling Procedure:

16.1 The Licensee shall comply with the Complaint Handling Procedure specified by the Commission. The Licensee

shall:

(a) make a copy of the Complaint Handling Procedure, revised from time to time, available for inspection by the public at each of the relevant premises during normal working hours; and8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(b) provide free of charge a copy of the Procedure revised from time to time to each new Consumer, and to any other person who requests it at a price not exceeding the cost of duplicating it.

17 Consumer’s Rights and Right to Information:

17.1 The Licensee shall comply with the provisions of the Electricity (Rights of Consumers) Rules, 2020 as amended from time to time.

17.2 The Licensee, on request of the consumer, to the extent that is reasonably available to the Licensee provide:

(a) information on all services provided by the Licensee including the information on the charges or Tariff as approved by the Commission;

(b) information on meter readings for the electricity services provided to the consumer premises by the Licensee; and

(c) information on the status of the consumer’s account with the Licensee;

17.3 The Licensee may charge a reasonable amount for providing information under this section unless the information requested is of general nature.

18 Compliance with the Laws, Rules and Regulations:

The Licensee shall comply with the provisions of the Act and the Rules, and Regulations, Guidelines, Orders and Directions issued by the Commission from time to time except where the licensee obtains the prior written approval of the Commission for any deviation therefrom.

18.1 The Licensee shall comply with the Regulations, Guidelines, Directions issued by the Central Electricity Authority and Central Electricity Regulatory Commission as applicable.

18.2 The Licensee shall comply with the Orders or Directions issued by the Consumer Grievances Redressal Forum

(CGRF) or Ombudsman.

18.3 The Licensee shall act in accordance with these general conditions specified in the licence except where the Licensee is exempted specifically or permitted by the Commission.

18.4 The Licensee shall comply with the orders and directions issued by the State Load Despatch Centre, STU and other statutory authorities in the discharge of their functions vested in accordance with the Electricity Act, 2003 and Rules & Regulations made there under.

18.5 The Licensee shall adhere to the Joint Electricity Regulatory Commission for the State of Goa & UTs (Standard of Performance for Distribution Licensees) Regulations, 2015. and the Joint Electricity Regulatory Commission for the State of Goa and UTs (Electricity Supply Code) Regulations, 2018 as amended from time to time in regard to supply of electricity in its area of supply.

19 Power to remove difficulties:

If any difficulty arises in giving effect to the provisions of these Regulations, the Commission may, by general or specific Order, make such provisions not inconsistent with the provisions of the Act as may appear to be necessary for removing the difficulty.

20. Power to Relax:

The Commission may in public interest and for reasons to be recorded in writing, relax any of the provision(s) of these Regulations.
