1. (1) इन जनयमों का संजिप्त नाम जसगरेट और अन्य तंबाकू उत्पाि (जवज्ञापन का प्रजतषेध और व्यापार तथा वाजणज्य, उत्पािन, प्रिाय और जवतरण का जवजनयमन) संिोधन जनयम, 2023 ह।ै

(2) ये रािपत्र में उनके प्रकािन की तारीख से तीन मास की समाजप्त पर और उसके पश्चात प्रवृत्त होंगे।

2. जसगरेट और अन्य तंबाकू उत्पाि (जवज्ञापन का प्रजतषधे और व्यापार तथा वाजणज्य, उत्पािन, प्रिाय और जवतरण) जनयम, 2004 म,ें जनयम 10 के पश्चात, जनम्नजलजखत जनयम अतं : स्ट्थाजपत दकया िाएगा, अथाता : - "11 प्रकािक द्वारा तम्बाकू उत्पािों के ऑनलाइन क्यरू ेरटड कंटेंट में स्ट्वास्ट््य स्ट्पॉट्स, संिेि और िावात्याग (जडस्ट्क्लेमर):

(1) तम्बाकू उत्पािों या उनके उपयोग को प्रिर्िता करत े हुए ऑनलाइन क्यरू ेरटड कंटेंट का प्रत्येक प्रकािक 3428 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) कायाक्रम की िरुु आत में और मध्य म ें कम से कम तीस सके ंड की अवजध के तम्बाकू रोधी स्ट्वास्ट््य स्ट्पॉट्स को प्रिर्िात करेगा;

(ख) कायाक्रम में तम्बाकू उत्पािों या उनके उपयोग के प्रििान की अवजध के िौरान स्ट्क्रीन के नीचे सुपष्ट जस्ट्थर संििे के रूप में तम्बाकू रोधी स्ट्वास्ट््य चेतावनी प्रिर्िता करेगा; (ग) कायाक्रम की िुरूआत और मध्य में तंबाकू के उपयोग के कुप्रभावों पर न्यूनतम बीस सेकंड की अवजध का एक िश्ृ य-श्रव्य जडस्ट्क्लेमर प्रिर्िात करेगा;

(2) ऑनलाइन क्यूरेरटड कंटेंट के प्रकािक को “mohfw.gov.in” या "ntcp.mohfw.gov.in" वेबसाइट पर स्ट्वास्ट््य स्ट्पॉट्स, संिेि और जडस्ट्क्लेमर उपलब्ध कराया िाएगा।

(3) उप जनयम (1) के खंड (ख) म ें यथाजवजनर्िष्टा तंबाकू रोधी स्ट्वास्ट््य चते ावनी संिेि सफेि पृष्ठभूजम पर काल े रंग के फॉन्ट में "तंबाकू से कैंसर होता ह"ै या "तंबाकू िानलेवा ह"ै चेतावनी के साथ सुपाठ्य और पठनीय होगी"।

(4) तम्बाकू रोधी स्ट्वास्ट््य चते ावनी संिेि, स्ट्वास्ट््य स्ट्पॉट्स और िश्ृ य-श्रृव्य जडस्ट्क्लेमर, उसी भाषा में होगी जिसका उपयोग ऑनलाइन क्यरू ेरटड कंटेंट में दकया गया ह।ै

(5) ऑनलाइन क्यूरेरटड कंटेंट में तम्बाकू उत्पािों या उनके उपयोग का प्रििान जनम्नजलजखत पर लाग ूनहीं होगा - (क) जसगरेट या अन्य तम्बाकू उत्पािों के ब्ांड या दकसी तरह के तम्बाकू उत्पाि स्ट्थापन की प्रििानी;

(ख) प्रचार सामग्री में तंबाकू उत्पािों या उनके उपयोग का प्रििान । स्ट्पष्टीकरण - इस जनयम के प्रयोिनों के जलए "कायाक्रम" का अजभप्रेत ऑनलाइन क्यूरेरटड ऑजडयो-जविुअल कंटेंट से ह ै।

(6) यदि ऑनलाइन क्यूरेरटड कंटेंट का प्रकािक उप-जनयम (1) से (5) के उपबंधों का पालन करने म ें असफल रहता ह,ै तो स्ट्वास्ट््य और पररवार कल्याण मंत्रालय, सूचना और प्रसारण मंत्रालय और इलेक्रॉजनकी और सूचना प्रौद्योजगकी मंत्रालय के प्रजतजनजधयों वाली एक अतं र-मंत्रालयी सजमजत, स्ट्वत: प्रेरणा से या दकसी जिकायत पर कारावाई करेगी, और ऑनलाइन क्यूरेरटड कंटेंट के प्रकािक की पहचान करन े के पश्चात, ऐसी असफलता को स्ट्पष्ट करने और कंटेंट में समुजचत उपांतरण करने का युजियिु अवसर िेते हुए सूचना िारी करेगी। स्ट्पष्टीकरण. - इस जनयम के प्रयोिन के जलए,- (क) पि"ऑनलाइन क्यरू ेरटड कंटेंट" से अजभप्रेत, समाचार और समसामजयक सामग्री से जभन्न कोई िश्ृ य-श्रृव्य सामग्री का कोई भी क्यूरेरटड कैटलॉग, िो ऑनलाइन क्यूरेरटड कंटेंट के प्रकािक के स्ट्वाजमत्व, उसके द्वारा अनुज्ञप्त या प्रसाररत दकए िाने के जलए अनुबंजधत ह,ै और मागं पर उपलब्ध कराया िाता ह,ै इसमें इंटरनेट या कंप्यूटर नेटवका पर अजभिान के माध्यम स े सजम्मजलत, ककंतु वहीं तक सीजमत नहीं, और जिसमें दफल्मों, िश्ृ य-श्रृव्य कायाक्रम, वृत्तजचत्र, टेलीजविन कायाक्रम, धारावाजहक, श्रृंखला, पॉडकास्ट्ट और ऐसी अन्य सामग्री सजम्मजलत ह;ै (ख) पि "ऑनलाइन क्यूरेरटड कंटेंट का प्रकािक" से अजभप्रते ह ै कोई प्रकािक िो उपलब्ध कराई िा रही ऑनलाइन क्यूरेरटड कंटेंट को अवचाररत करन े म ें महत्वपूणा भूजमका जनभा रहा है, िो उपयोगकताओंा को एक कंप्यूटर संसाधन उपलब्ध कराता ह ै िो ऐस े उपयोगकतााओं को इंटरनेट या कंप्यूटर नेटवका पर ऑनलाइन क्यूरेरटड कंटेंट तक पहुचं न े म ें सिम बनाता ह,ै और ऐसी अन्य इकाई जिसे दकसी भी नाम से िाना िाता हो, िो कायाात्मक रूप से ऑनलाइन क्यूरेरटड कंटेंट के प्रकािकों के समान ह,ै ककंतु इसमें ऐसा कोई भी व्यजि या उपयोगकता ा िाजमल नहीं है, िो व्यवजस्ट्थत व्यवसाय, वृजत्तक या वाजणजज्यक दक्रयाकलाप के िौरान ऑनलाइन क्यूरेरटड कंटेंट प्रसाररत नहीं कर रहा हो । [फ़ा. सं. पी.16012/08/2017-टीसी] वी. हके ाली जिमोमी, अपर सजचव रटप्पण : तारीख मलू जनयम भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखण्ड ( i ) में संख्याक सा.का.जन. 137, दिनांक 25 फरवरी, 2004, द्वारा प्रकाजित दकए गए थ े और तत्पश्चात अजधसूचना सा.का.जन. 345 (अ) तारीख 31 मई 2005, संख्याक सा.का.जन. 619(अ), तारीख 11 अगस्ट्त, 2011, संख्याक सा.का.जन. 786(अ), तारीख 27 अक्टूबर, 2011 और संख्याक सा.का.जन. 708(अ), तारीख 21 जसतंबर, 2012 द्वारा संिोजधत दकए गए थे।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health and Family Welfare)

NOTIFICATION New Delhi, the 31st May, 2023 G.S.R. 400(E).—In exercise of the power conferred by section 31 of the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 (34 of 2003), the Central Government hereby makes the following rules, further to amend the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Rules, 2004, namely:-

1. (1) These rules may be called the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Amendment Rules, 2023.

(2) They shall come into force on and after the expiration of three months from the date of their publication in the Official Gazette.

2. In the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Rules, 2004, after rule 10, the following rule shall be inserted, namely. - “11. Health spots, message and disclaimer in online curated contents of tobacco products by the publisher. (1) Every publisher of online curated contents displaying tobacco products or their use shall.-

(a) display anti-tobacco health spots, of minimum thirty seconds duration each at the beginning and middle of the programme;

(b) display anti-tobacco health warning as a prominent static message at the bottom of the screen during the period of display of the tobacco products or their use in the programme;

(c) display an audio-visual disclaimer on the ill-effects of tobacco use, of minimum twenty seconds duration each, in the beginning and middle of the programme;

(2) The health spots, message and disclaimer shall be made available to the publisher of the online curated content on the website “mohfw.gov.in” or “ntcp.mohfw.gov.in”

(3) The anti-tobacco health warning message as specified in clause(b) of sub-rule (1) shall be legible and readable, with font in black colour on white background and with the warnings "Tobacco causes cancer" or "Tobacco kills".

(4) The anti-tobacco health warning message, health spot and audio-visual disclaimer, shall be in the same language as used in the online curated content.

(5) The display of tobacco products or their use in online curated content shall not extend to -

(a) display of the brands of cigarettes or other tobacco products or any form of tobacco product placement;

(b) display of tobacco products or their use in promotional materials.

Explanation.- For the purposes of this rule “programme” means online curated audio-visual content.

(6) If the publisher of online curated content fails to comply with the provisions of sub-rules (1) to (5), an inter- ministerial committee consisting of representatives from the Ministry of Health and Family Welfare, Ministry of Information and Broadcasting and Ministry of Electronics and Information Technology, shall take action suo motu or on a complaint, and after identifying the publisher of online curated content, issue notice giving reasonable opportunity to explain such failure and make appropriate modification in the content.

Explanation.- For the purpose of this rule,- a. the expression “online curated content” means, any curated catalogue of audio-visual content, other than news and current affairs content, which is owned by, licensed to, or contracted to be transmitted by a publisher of online curated content, and made available on demand, including but not limited through subscription, over the internet or computer networks, and includes films, audio visual programmes, documentaries, television programmes, serials, series, podcasts and other such content;

b. the expression “publisher of online curated content” means, a publisher who, performing a significant role in determining the online curated content being made available, makes available to users a computer resource4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] that enables such users to access online curated content over the internet or computer networks, and such other entity called by whatever name, which is functionally similar to publishers of online curated content but does not include any individual or user who is not transmitting online curated content in the course of systematic business, professional or commercial activity.
