1. सजं िप्त िीर्कड और प्रारंभण:

(1) आन जिजनयमों को पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (ऄसंतलु न प्रबंधन सिे ाए)ं तृतीय संिोधन जिजनयम, 2020 कहा जाएगा।

(2) ये सरकारी राजपत्र म ेंऄपन े प्रकािन की तारीख स ेलागू होंगे।

2. पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (ऄसंतलु न प्रबधं न सेिाए)ं जिजनयम, 2016 म,ें -

(i) जिजनयम 1 म,ें ईप-जिजनयम (2) का लोप दकया जाएगा;

(ii) जिजनयम 2 म,ें ईप-जिजनयम (1) म,ें खंड (घ) के बाद जनम्नजलजखत खंड जोडा जाएगा ऄथातड ्:- "(घक) प्रचालनात् मक संतलु न समझौता" ("ओबीए")" का ऄथ ड ह ै सहमत जडलीिरी और प्राजि बबदओंु पर प्राकृजतक गैस की जनधाडररत और िास्ट्तजिक मात्रा म ें ऄंतर को संतुजलत करन े के संबंध म ें परस्ट्पर संबद्ध प्राकृजतक गैस पाआपलाआन के रांसपोर्डरों के बीच समझौता;";

(iii) जिजनयम 3 म,ें जनम्नजलजखत जिजनयम प्रजतस्ट्थाजपत दकया जाएगा, ऄथाडत्: - "3. ऄनप्रु योग य े जिजनयम, जिजनयम 9, 17, 18 के प्रािधानों के तहत किर की गइ समर्पपत पाआपलाआन ऄथाडत ् प्राकृजतक गैस पाआपलाआन पर लाग ू होंग,े जो पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गसै पाआपलाआनों को जबछाने, जनमाडण, प्रचालन या जिस्ट्तार करने के जलए संस्ट्थाओं को प्राजधकृत करना), जिजनयम, 2008 के जिजनयम 19 के ईप-जिजनयम (1) या (2) के प्रािधानों के तहत एक प्राकृजतक गैस पाआपलाआन और ऄजधजनयम की धारा 42 की ईप-धारा (2) के ऄतं गतड केंद्र सरकार द्वारा जारी नीजत जनदेि के ऄनुसरण म ें बोडड द्वारा ऄजधकृत एक प्राकृजतक गैस पाआपलाआन म ें पररिर्पतत हो जाती ह।ै ";

(iv) जिजनयम 4 म,ें (क) ईप-जिजनयम (1) के जलए, जनम्नजलजखत ईप-जिजनयम प्रजतस्ट्थाजपत दकया जाएगा, ऄथाडत:्- "(1) बिते दक रांसपोर्डर पाआपलाआन िमता की ईपलब्धता और दकसी भी जिपर की सेिाओं को प्रभाजित दकए जबना, पररिहन ऄसंतलु न को प्रबंजधत करन े के जलए जिपर को जनम्नजलजखत ऄसंतलु न प्रबंधन सेिाए ं प्रदान करेगा:- (क) पार्ककग सेिा का अिय एक ऐसी सेिा स े होगा जजसके तहत रांसपोर्डर और जिपर एक ददन की योजना पर सहमत होत े ह ैं जो पाआपलाआन म ें जिपर की प्राकृजतक गैस की स्ट्िीकृत मात्रा की प्राजि के जलए पाआपलाआन म ें पार्ककग के जलए एक या एक स े ऄजधक सहमत बबदओंु पर और बाद म ें ददन के जहसाब स े रांसपोर्डर द्वारा जिपर को सहमत मात्रा म ें पुनः जडलीिरी, या तो ईसी बबद ु पर या पाआपलाआन पर दकसी ऄन्य बबद ुपर की जाएगी:

बिते दक जिपर जो जिक्रेता या व्यापारी ह,ैं िे भी रांसपोर्डर स े एक समझौत े के माध्यम स े गैस को एक बबद ु स े दसू रे स्ट्थान तक पहुचं ाने के जलए प्राकृजतक गसै पाआपलाआन म ें संचरण सेिाओं के जलए कोइ िमता बुक दकए जबना ईक्त सेिा का लाभ ईठा सकते ह।ैं बिते अगे दक यदद स्ट्थ ल या ऄनेक स्ट्थ ल, जजन पर प्राकृजतक गैस प्राि की जाती ह,ै स े जभन्न होते ह,ैं तो ऐसे स्ट् थल या स्ट् थलों जजन पर ऐसी गैस को दफर स े जितररत दकया जाना ह,ै ईसके जलए जिपर रांसपोर्डर को लाग ू पररिहन िल्ु क का भी भगु तान करेगा। अग े यह भी दक पाकड की गइ प्राकृजतक गैस लेदकन जजसे सहमत ऄिजध के भीतर िापस नहीं जलया गया ह,ै को एक सकारात्मक ऄसंतुलन माना जाएगा तथा आस पर पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (सामान् य िाहक या संजिदा िाहक प्राकृजतक गैस पाआपलाआनों के जलए पहुचं संजहता), जिजनयम 2008 के ऄनुसार जनपर्ा जाएगा। पाकड की गइ प्राकृजतक गैस, लेदकन जजसे जिक्रेताओं या व्यापाररयों द्वारा सहमत ऄिजध के भीतर िापस नहीं जलया गया हो, जजन्होंने रांसपोर्डर स े रांसजमिन सेिाओं का लाभ नहीं जलया ह,ै ईन पर भी ईसी तरह स े जनपर्ा जाएगा जैसे दक रांसपोर्डरों स े रांसजमिन की सुजिधा पाने िाले जिपस ड के जलए लाग ू होता ह;ै (ख) ऋण देन े की सेिा, जजसका ऄथ ड एक ऐसी सेिा होगी जजसके तहत रांसपोर्डर और जिपर एक या ऄजधक सहमत बबदओंु पर जिपर द्वारा प्राकृजतक गैस की स्ट्िीकृत मात्रा को ईधार देने के जलए एक ददन की योजना पर सहमत होते ह ैं और बाद म ें जिपर द्वारा रांसपोर्डर को एक ही बबद ु पर या पाआपलाआन पर दकसी ऄन्य बबद ुपर सहमत ददन के जहसाब स े ऐसी ईधार ली गइ मात्रा को लौर्ाते ह।ैं बिते दक जिपर जो दक जिक्रेता या व्यापारी ह,ैं िे भी रांसपोर्डर स े एक समझौते के माध् यम स े ईक्त सेिा का लाभ ईठा सकते ह,ैं जजन् होंने प्राकृजतक गैस पाआपलाआन म ें रांसजमिन सेिाओं के जलए गैस को एक बबद ुस े दसू रे बबद ुतक ले जान े की कोइ िमता बुक नहीं की ह।ै[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 बिते अग े यह दक यदद जजस बबद ु या बबदओंु पर प्राकृजतक गसै को ईधार ददया जाता ह,ै िह ईस बबद ु या बबदओंु स े जभन्न होती ह,ैं जजस पर ऐसी गैस लौर्ाइ जाती ह,ै तो जिपर रांसपोर्डर को लाग ू पररिहन िल्ु क का भी भगु तान करेगा। अग े यह भी दक ईधार ली गइ प्राकृजतक गैस लेदकन जजसे सहमत ऄिजध के भीतर लौर्ाया नहीं गया ह,ै को एक नकारात्मक ऄसंतुलन पदै ा करने िाला माना जाएगा तथा आस े पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (सामान्य िाहक या संजिदा िाहक प्राकृजतक गैस पाआपलाआनों के जलए पहुचं संजहता), जिजनयम 2008 के ऄनुसार जनपर्ा जाएगा। ईधार ली गइ प्राकृजतक गैस, लेदकन जजसे जिक्रेताओं या व्यापाररयों द्वारा सहमत ऄिजध के भीतर लौर्ाया नहीं गया ह,ै जजन्होंने रांसपोर्रड स े रांसजमिन सेिाओं का लाभ नहीं ईठाया ह,ै को भी ईसी तरह स े जनपर्ा जाएगा जैसा दक ईन जिपसड के जलए लाग ू होता ह ैजजन्होंन े रासं पोर्डसड स े रांसजमिन सेिाए ं ली ह;ैं (ग) नेटर्ग सेिा का ऄथ ड होगा ऐसी सेिा जजसके तहत जिपर रांसपोर्डर के साथ जिजभन्न गसै पररिहन समझौतों के तहत ऄपन े सकारात्मक और नकारात्मक ऄसंतलु न को दरू करता ह;ै तथा (घ) व् यापार सेिा का ऄथड एक ऐसी सेिा ह ै जजसके तहत एक स े ऄजधक जिपर ऄपन े जिजभन्न ऄसंतुलन को कम करन े के पररणामस्ट्िरूप जिजभन्न गैस पररिहन समझौतों के तहत ऄपन े संबंजधत सकारात्मक और नकारात्मक ऄसंतुलन को दरू करते ह।ैं ";

(ख) ईप-जिजनयम (4) म,ें जनम्नजलजखत ईप-जिजनयम प्रजतस्ट्थाजपत दकया जाएगा, ऄथाडत:् - “(4) रांसपोर्डर जिपर स े ईप-जिजनयम (1) के खंड (क) और (ख) म ें जनर्ददष्ट ऄसंतलु न प्रबंधन सेिाओं के जलए, प्रजत जमजलयन जिरर्ि थमडल यूजनर् ("एमएमबीर्ीयू") दस रुपए स े ऄजधक की राजि और ईप-जिजनयम (1) के खंड (ग) और (घ) म ें जनर्ददष्ट सेिाओं के जलए प्रजत एमएमबीर्ीयू एक रुपए स े ऄजधक की राजि का प्रभार नहीं लगे ा। ईक्त प्रभार लने देन पर लागू सभी करों और िुल क् ों के ऄलािा होगा।" (ग) ईप-जिजनयम (5) के जलए, जनम्नजलजखत ईप-जिजनयम प्रजतस्ट्थाजपत दकया जाएगा, ऄथाडत:्- "(5) ईप-जिजनयम (1) म ें ईजल्लजखत ऄसंतुलन प्रबंधन सेिाओं स े रांसपोर्डर को दी गइ राजि के पचास प्रजतित को पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाआपलाआन र्ैररफ का जनधाडरण) जिजनयम, 2008 के तहत र्ैररफ के जनधाडरण के जलए जिजिध अय के रूप म ें माना जाएगा। बिते दक पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाआपलाआनें जबछाने, जनमाडण, प्रचालन या जिस्ट्तार के जलए संस्ट्थाओं को प्राजधकृत करना) जिजनयम, 2008 के जिजनयम 9 के तहत प्राजधकृत पाआपलाआनों के संबंध म ें ईप-जिजनयम (1) म ें ईजल्लजखत ऄसंतुलन प्रबधं न सेिाओं स े रांसपोर्डर को दी जाने िाली राजि का पचास प्रजतित पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (सामान् य िाहक या संजिदा िाहक प्राकृजतक गैस पाआपलाआनों के जलए पहुचं संजहता), जिजनयम, 2008 म ें जिजनर्ददष् र् ऄनुसार समय और तरीके स े बोडड द्वारा बनाए गए एस्ट्क्रो खाते म ें जमा दकया जाएगा।";

(घ) ईप-जिजनयम (8) म,ें कोष्ठ क और िब्दों "(अस्ट्थजगत जितरण सेिाओं के ऄलािा)" का लोप दकया जाएगा; (ड.) ईप-जिजनयम (8) के बाद, जनम्न जलजखत ईप-जिजनयम जोडे जाएंग,े ऄथाडत्:- “(9) ओबीए के तहत, प्राकृजतक गैस पाआपलाआनों के आंर्रकनेक्र् बबद ु पर सभी ऄसंतलु न प्रचालनात् मक ऄसंतुलन ह ैं और आन् ह ें केिल ओबीए की पार्टर्यों द्वारा ठीक दकया जा सकता ह ै और यदद दो आंर्रकनेक्र्ेड पाआपलाआन के रांसपोर्डसड न े ओबीए करार दकया ह,ै तो रासं पोर्डर दोनों रांसपोर्डरों स े ऄसंतुलन प्रबंधन सेिाओं का लाभ ईठान े िाल े जिपर के ऄसतं ुलन की मात्रा को मापने के जलए एक गैस संतलु न नेर्िकड के रूप म ें जिचार करेंगे।

(10) रांसपोर्रड ऄपनी िेबसाआर् पर लागू प्रभार के साथ ऄसंतलु न प्रबंधन सेिाओं के बारे म ें प्रासंजगक जानकारी प्रकाजित करेगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(11) आन जिजनयमों म ें दकसी बात के होते हुए, पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (प्राकृजतक गैस पाआपलाआन जबछान,े जनमाडण, प्रचालन, या जिस्ट् तार करने के जिपणन म ें लगी संस्ट्थाओं के जलए संबद्ध अचार संजहता), जिजनयम 2008 आन जिजनयमों के तहत ईजल् लजखत सिे ाओं पर लागू नहीं होंगे।" िन्दना िमा,ड सजचि [जिज्ञापन-III/4/ऄसा./379/2020] पाद रर्प्प णी : मूल जिजनयमों को फा.स.ं पीएनजीअरबी/एम(सी)/48, ददनांक 29 ऄप्रलै , 2016 द्वारा ऄजधसूजचत दकया गया था और आसम ें बाद म ें फा.स.ं पीएनजीअरबी/एम(सी)/48, ददनांक 23 माच,ड 2018, फा.स.ं पीएनजीअरबी/ िाजण./2-एनजीपीएल प्रिुल् क (2)/2012, ददनांक 19 जनू , 2020 और फा.स.ं पीएनजीअरबी/ िाजण./2-एनजीपीएल प्रिुल् क (2)/2012(पी-910), ददनाकं 11 निंबर, 2020 द्वारा संिोधन दकया गया था। PETROLEUM AND NATURAL GAS REGULATORY BOARD

NOTIFICATION New Delhi, the 23rd November, 2020 F. No. PNGRB/COM/2-NGPL Tariff (2)/2012 (P-3116)—In exercise of the powers conferred by clause (e) of sub-section (2) of Section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations, further to amend the Petroleum and Natural Gas Regulatory Board (Imbalance Management Services) Regulations, 2016, namely: –

1. Short title and commencement.

(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Imbalance Management Services) Third Amendment Regulations, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Petroleum and Natural Gas Regulatory Board (Imbalance Management Services) Regulations, 2016, –

(i) in regulation 1, sub-regulation (2) shall be omitted;

(ii) in regulation 2, in sub-regulation (1), after clause (d) the following clause shall be inserted,

namely: – ―(da) operational balancing agreement (“OBA”)‖ means an agreement among the transporters of interconnected natural gas pipeline in respect of balancing the differences in the scheduled and actual quantities of natural gas at agreed delivery and receipt points;‖;

(iii) for regulation 3, the following regulation shall be substituted, namely: - ―3. Application.

These regulations shall apply to a natural gas pipeline covered under the regulations 9, 17 and 18 of the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines) Regulations, 2008, a dedicated pipeline which is converted into a natural gas pipeline under the provisions of sub-regulation

(1) or (2) of regulation 19 of the said Regulations, 2008 and a natural gas pipeline authorized by the Board pursuant to a policy directive issued by the Central Government under sub-section (2) of section 42 of the Act.‖;

(iv) in regulation 4,

(a) for sub-regulation (1), the following sub-regulation shall be substituted, namely: - ―(1) Subject to availability of pipeline capacity and without affecting the services to any shipper, transporter shall provide the following imbalance management services to a shipper to manage transportation imbalances, namely: –[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5

(a) parking service, which shall mean a service under which the transporter and shipper agree on a day-wise plan for receipt of agreed quantities of shipper’s natural gas into the pipeline at one or more agreed points for parking in the pipeline and subsequent day- wise re-delivery of the agreed quantities by the transporter to shipper, either at the same

point or any other point on the pipeline:

Provided that shippers which are marketers or traders may also avail the said service from the transporter without booking any capacity for the transmission services in the

natural gas pipeline through an agreement:

Provided further that in case the point or points at which the natural gas is received is different than the point or points at which such gas is re-delivered, the shipper shall also

pay to the transporter the applicable transportation tariff:

Provided also that the natural gas parked but not withdrawn within the agreed period shall be treated to have created a positive imbalance and dealt with in accordance with Petroleum and Natural Gas Regulatory Board (Access Code for Common Carrier or Contract Carrier Natural Gas Pipelines) Regulations, 2008. The natural gas parked but not withdrawn within the agreed period by the marketers or traders who have not availed the transmission services from the transporter shall also be dealt in a similar manner as applicable for shippers who have availed transmission services from transporters;

(b) lending service, which shall mean a service under which the transporter and shipper agree on a day-wise plan for lending of agreed quantities of natural gas by the transporter to shipper at one or more agreed points and subsequent agreed day-wise return of such loaned quantities by shipper to the transporter either at the same point or

any other point on the pipeline:

Provided that shippers which are marketers or traders may also avail the said service from the transporter without booking any capacity for the transmission services in the

natural gas pipeline through an agreement:

Provided further that in case the point or points at which the natural gas is loaned is different than the point or points at which such gas is returned, the shipper shall also pay

to the transporter the applicable transportation tariff:

Provided also that natural gas loaned but not returned within the agreed period shall be treated to have created a negative imbalance and dealt with in accordance with Petroleum and Natural Gas Regulatory Board (Access Code for Common Carrier or Contract Carrier Natural Gas Pipelines) Regulations, 2008. The natural gas loaned but not returned within the agreed period by the marketers or traders who have not availed the transmission services from the transporter shall also be dealt in a similar manner as applicable for shippers who have availed transmission services from transporters;

(c) netting service, which shall mean a service under which the shipper offsets its positive and negative imbalances under different Gas Transportation Agreements with the transporter; and

(d) trading service, which shall mean a service under which more than one shippers offset their respective positive and negative imbalances under different Gas Transportation Agreements resulting into reduction of their total imbalances.‖ ;

(b) for sub-regulation (4), the following sub-regulation shall be substituted, namely: - ―(4) The transporter shall charge from the shipper an amount not exceeding rupees ten per Million British Thermal Unit (―MMBTU‖), for imbalance management services referred to in clauses (a) and (b) of sub-regulation (1) and an amount not exceeding rupee one per MMBTU, for services referred to in clause (c) and (d) of sub regulation(1).The said charges shall be excluding all taxes and duties as applicable to the transaction.‖6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(c) for sub-regulation (5), the following sub-regulation shall be substituted, namely: - ―(5) Fifty per cent of the amounts accrued to the transporter from imbalance management services referred to in sub-regulation (1) shall be considered as miscellaneous income for determination of tariff under Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Regulations, 2008:

Provided that fifty percent of the amounts accrued to the transporter from imbalance management services referred to in sub-regulation (1) in respect of pipelines authorised under regulation 9 of Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines) Regulations, 2008 shall be deposited in the Escrow account maintained by the Board within the time and manner as specified in Petroleum and Natural gas Regulatory Board (Access Code for Common Carrier or Contract Carrier Natural Gas Pipelines), Regulations, 2008.‖;

(d) in sub-regulation (8), the brackets and words ―(besides deferred delivery services)‖ shall be omitted;

(e) after sub-regulation (8), the following sub-regulations shall be inserted, namely: – ―(9) Under an OBA, all the imbalances at the interconnect point of natural gas pipelines are operational imbalances and may be cured only by the parties to an OBA and in case transporters of two interconnected pipeline have entered into an OBA, then, the transporters shall consider the two pipelines as single gas balancing network for measuring the imbalance quantities of the shipper who has availed the imbalance management services from both the transporters.

(10) Transporter shall publish relevant information about imbalance management services along with the applicable charges on its website.

(11) Notwithstanding anything contained in these regulations, the Petroleum and Natural Gas Regulatory Board (Affiliate Code of Conduct for Entities Engaged in Marketing of Natural Gas and Laying, Building, Operating, or Expanding Natural Gas Pipeline) Regulations, 2008 shall not be applicable to the services mentioned under these regulations.‖ VANDANA SHARMA, Secy.
