1. (1) य े विवियम बैंक ऑफ़ बड़ौदा (कममचारी) पेंशि (संशोधि) विवियम, 2025 कहलाएंगे। 7768 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) इस विवियम को आजधकाररक राजपत्र म ें प्रकाशि की तारीख स े प्रभावी माना िाएगा।

2. बैंक ऑफ़ बड़ौदा (कममचारी) पशें ि विवियम, 1995 (इसके बाद उक्त विवियम के रूप म ेंसंदर्भमत) म,ें विवियम 2 म,ें खंड (डब्ल्य)ू के बाद, विम्नविवखत खंड को िाजमल दकया गया ह,ै यथा: – "(डब्ल्यूए) 'त्यागर्पत्र देिे िािे पूिम कममचारी' का अर् म ह ैवह कममचारी, जो - ए) 1 जििरी, 1986 को या उसके बाद बैंक की सेिा म ें र्;े बी) 1 अप्रैि, 2010 स े पहि े बैंक म ें जनय ि हो गए थे;

सी) 26 अप्रैल, 2010 को या उसस े पहिे बैंक की सेिा स े त्यागपत्र दे च के थ;े और डी) िो अन्यर्ा बैंक की सेिा म ेंरहत े हुए पेंशि योजिा म ेंशावमि होि े के विए पात्र थ;े "।

3. उि विवियमन के विवियम 3 म,ें उप-विवियम (14) के बाद, विम्नविवखत को िाजमल दकया जाएगा, यथा: - "(15) वह व्यजि, िो विवियमि 2 के खडं (डब्ल्यूए) म ें पररभावित त्यागर्पत्र दिे े िािे पूिम कमचम ारी की पररभािा के अन कूल ह ै और जिसने बैंक स े त्यागर्पत्र के समय या बाद म ें बकैं से प्राप्त भविष्य विवध के संर्पूण ज अंि को (उस पर संवचत ब्लयाज सजहत) बैंक को िापस करि ेके विए सहमजत दी ह ैऔर उसन ेबैंक द्वारा विधामररत समय सीमा के भीतर बैंक द्वारा प्रदाि ककए गए प्रारूर्प के अिुसार एक िचि र्पत्र कदया ह।ै “।

4. उि जवजनयमन के विवियम 22 म,ें उप-विवियम (1) म,ें प्रावधान के पश्चात,् विम्नविवखत प्रावधान को िाजमल ककया जाएगा, यथा:- "बशते कक विवियमि 2 के खडं (डब्ल्यूए) म ें पररभावित दकए अन सार त्यागर्पत्र देि े िाि े पूिम कममचारी जो विवियम 3 के उप-विवियम (15) म ेंविधाजररत शतों को र्पूरा करता ह,ै के द्वारा त्यागर्पत्र दने े र्पर, उसकी र्पूवज सेवा का न कसान नहीं होगा।“ ।

5. उि विवियमन के विवियम 29 म,ें –

(i) उप-विवियमि (1) में, तृतीय प्रावधान के बाद, विम्नविवखत प्रावधान को िाजमल दकया िाएगा, यथा: - "बशत ेयह भी कक त्यागर्पत्र दिे े िाले पूि मकममचारी, जैसा कक विवियमि 2 के खंड (डब्ल्यूए) म ेंपररभावित दकया गया ह ैऔर िो विवियमि 3 के उप-विवियमि (15) म ेंविधाजररत शतों के अिसु ार योग्य ह,ै वह पेंशि का भी हकदार होगा, बशत े दक उन्होंन े जनधाजररत सेवा अवजध पूरी कर िी हो।“।

(ii) उप-विवियमि (5) म,ें विम्नविवखत प्रावधान को िाजमल दकया िाएगा,,यथा: – "बशत ेकक विवियमि 2 के खंड (डब्ल्यूए) म ेंपररभावित त्यागर्पत्र देि ेिािा पूिम कममचारी उजल्लजखत अहकज सेिा में िृवि के िाभ के विए पात्र िहीं होगा।“।

6. उि जवजनयमों के जवजनयमन 36 म,ें खंड (िी) के बाद, जनम्नजलजखत खंड को िाजमल दकया िाएगा, यथा:-[भाग III—खण् ड 4] भारत का रािर्पत्र : असाधारण 3 “(एच) अिं काजलक कमजचारी से इतर, कमजचारी िो 1 नवंबर, 2022 या उसके बाद सेवाजनवृत्त हुए ह ैंउन्ह ेंर्पांच हिार र्पचहत्तर रुर्पये प्रजत माह और 1/3 वेतनमान र्पर वेतन प्राप्त वाले अंिकाजलक कमजचारी के संबंध में, एक हिार सात सौ रुर्पये प्रजत माह, ½ वेतनमान र्पर वेतन प्राप्त करने वाल े अंिकाजलक कमजचारी को दो हिार र्पांच सौ सैंतालीस रुर्पये प्रजत माह, और ¾ वेतनमान र्पर वेतन प्राप्त करने वाले अिं काजलक कमजचारी के जलए तीन हिार आठ सौ बीस रुर्पये प्रजत माह, िहां अंिकाजलक कमजचारी 1 नवंबर, 2022 को या उसके बाद सेवाजनवृत्त हुए ह।ैं ”।

7. उि जवजनयम के जवजनयमन 39 म,ें उर्प-जवजनयमन (1) में खडं (सी) म,ें प्रावधान के र्पश्चात, जनम्नजलजखत प्रावधान को िाजमल दकया िाएगा, यथा:- “बिते यह भी दक जवजनयमन 2 के खंड (डब्लल्यूए) म ेंर्पररभाजित त्यागर्पत्र देने वाले मृतक र्पूवज कमचज ारी का र्पररवार भी र्पाररवाररक र्पेंिन के जलए र्पात्र होगा, बिते दक त्यागर्पत्र देने वाले मृतक र्पूवज कमजचारी ने जवजनयम 29 के उर्प- जवजनयम (1) में उजल्लजखत अनस ार बैंक में आवश्यक अहकज सेवा र्पूरी कर ली हो, इस ितज के अधीन दक मृतक त्यागर्पत्र देने वाल े र्पूव ज कमजचारी (अर्पनी मृत्य से र्पहले)/ र्पररवार के सदस्ट्य न े त्यागर्पत्र देन े के समय या बाद में बैंक से प्राप्त भजवष्य जनजध में बैंक का संर्पूणज अंिदान (उस र्पर संजचत ब्लयाि सजहत) बैंक को वार्पस करने के जलए सहमजत व्यि की हो और बैंक द्वारा जनधाजररत समय के भीतर बैंक द्वारा प्रदान दकए गए प्रारूर्प के अन सार एक वचनर्पत्र ददया हो।“।

8. उि जवजनयमन के जवजनयम 40 के उर्प – जवजनयमन (1) म,ें-

(i) खंड (बी) म,ें प्रथम प्रावधान को जनम्नजलजखत प्रावधान से प्रजतस्ट्थाजर्पत दकया िाएगा, यथा:- "बिते दक र्प त्र/ र्प त्री (जवधवा/तलाकि दा सजहत) को देय र्पाररवाररक र्पेंिन उस समय समाप्त कर दी िाएगी या लाग ूनहीं रहगे ी िब र्पात्र र्प त्र/ र्प त्री की आय सरकारी/ जनिी क्षत्रे में जनयोिन/ स्ट्व-रोज़गार आदद स ेअठारह हिार रुर्पए प्रजत माह से अजधक हो िाएगी।"।

(ii) खंड (सी) के जलए जनम्नानजलजखत खंड प्रजतस्ट्थाजर्पत दकया िाएगा, यथा:- “माता-जर्पता के मामले में, र्पाररवाररक र्पेंिन उस समय समाप्त कर दी िाएगी या लाग ूनहीं रहगे ी यदद माता-जर्पता में से दकसी एक की या दोनों की सकल आय सरकारी/जनिी क्षत्रे में जनयोिन/स्ट्व-रोिगार आदद से अठारह हिार रुर्पए प्रजत माह से अजधक हो िाएगी।” ।

9. उि जवजनयमन के जवजनयम 41 म,ें उर्प-जवजनयम (1) में प्रावधान के र्पश्चात जनम्नजलजखत प्रावधान को िाजमल दकया िाएगा। यथा:- "बिते यह भी दक त्यागर्पत्र दने े वाला र्पूवज कमजचारी, िैसा दक जवजनयम 2 के उर्प-जवजनयम (डब्ललूए) में र्पररभाजित दकया गया ह ै और िो जवजनयम 3 के उर्प-जवजनयमन (15) में जनधाजररत ितों के अन सार र्पात्र है, वह अर्पनी र्पेंिन की राजि के कम्यूटेिन के जलए र्पात्र नहीं होगा।"।

10. उि जवजनयमों के जवजनयम 55 म ें“अध्यक्ष एव ंप्रबंध जनदेिक” िब्लदों के स्ट्थान र्पर “प्रबंध जनदेिक एवं म ख्य कायर्पज ालक अजधकारी” िब्लद प्रजतस्ट्थाजर्पत दकए िाएंगे।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

11. उि जवजनयमों म,ें र्पररजिष्ट-II के स्ट्थान र्पर जनम्नजलजखत र्पररजिष्ट प्रजतस्ट्थाजर्पत दकया िाएगा, यथा:- “र्पररजिष्ट-II (जवजनयमन 37 देख)ें मूल र्पिें न र्पर महगं ाई राहत जनम्नान सार होगी:

(1) ऐसे कमजचाररयों के मामले में िो कामगार संवगज म ें थ े और िो 1 िनवरी, 1986 को या उसके बाद, लेदकन 1 नवंबर, 1992 स े र्पहल े सेवाजनवृत्त हुए और उन कमजचाररयों के मामल े में, िो अजधकारी संवग ज रह े एव ं िो 1 िनवरी, 1986 को या उसके बाद, लेदकन 1 ि लाई, 1993 से र्पहले सेवाजनवृत्त हुए, उन्ह ें महगं ाई राहत 1960=100 िृंखला म ें औधोजगक श्रजमकों के जलए अजखल भारतीय औसत उर्पभोिा मूल्य सूचकांक के जतमाही औसत में 600 अंकों से अजधक हर 4 अंकों की वृजि देय होगी या कमी र्पर वसूली िाएगी, िसै ा भी मामला हो। उि प्रत्येक 4 अंकों के जलए महगं ाई भत्त े म ें ऐसी वृजि या कमी की गणना जनम्नजलजखत ताजलका म ेंदी गई र्पिजत के अन सार की िाएगी, यथा:- ताजलका क्रम. स.ं प्रजत माह मलू र्पिें न का मलू र्पिें न के प्रजतित के रूर्प म ेंमहगं ाई भत्त ेकी दर वते नमान

4. ₹ 2130/- से अजधक ₹ 1250/- का 0.67 प्रजतित धन (+) ₹ 2000/- और ₹ 1250/- के बीच के अंतर का 0.55 प्रजतित धन (+) ₹ 2130/- और ₹ 2000/- के बीच के अंतर का 0.33 प्रजतित धन (+) ₹ 2130/- से अजधक के जलए मलू र्पिें न का 0.17 प्रजतित बिते दक 1 अिूबर, 2023 को और उसके बाद से 1960=100 िृंखला में औधोजगक श्रजमकों के जलए अजखल भारतीय औसत उर्पभोिा मल्ू य सूचकांक के जतमाही औसत में 600 अंकों से अजधक प्रजत स्ट्लैब र्पर 0.67 प्रजतित की एक समान दर से महगं ाई राहत देय होगी। बिते यह भी दक 1 अिूबर, 2023 स,े उर्परोि ताजलका म ेंदी गई महगं ाई राहत के अजतररि, नीच ेदी गई ताजलका में जनर्दष्टज ान सार अनग्र ह राजि भी देय होगी। ताजलका क्र. सं. मूल र्पिें न अन ग्रह राजि

3. ₹3851/- स े ₹4100/- ₹ 2400/- का 0.35 प्रजतित धन (+) ₹ 3850/- और ₹ 2400/- के बीच के अंतर का 0.29 प्रजतित धन (+) ₹ 3850/- से अजधक मलू र्पेंिन का 0.17 प्रजतित

(4) 1 मई, 2005 को या उसके बाद सेवाजनवृत्त होने वाले कमजचाररयों के संबंध म,ें 1960=100 श्रृंखला म ें औद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उर्पभोिा मूल्य सूचकाकं के जतमाही औसत म ें2288 अंकों स ेअजधक प्रत्येक 4 अंकों की प्रत्येक वृजि या प्रत्येक जगरावट के जलए वसूली योग्य महगं ाई राहत देय होगी। प्रत्येक 4 अंकों के जलए महगं ाई भत्त े म ें ऐसी वृजि या कमी की गणना मूल र्पेंिन के 0.18 प्रजतित की दर स ेकी िाएगी:

बिते दक 1 मई, 2005 स,े 1 नवंबर, 2002 को या उसके बाद लेदकन 30 अप्रलै , 2005 को या उससे र्पहल े सेवाजनवृत्त हुए कमजचाररयों के संबंध म,ें इस खंड के अन सार महगं ाई राहत देय होगी: बिते यह भी दक 1 नवंबर, 2007 को या उसके बाद सेवाजनवृत्त हुए कमजचाररयों के संबंध म,ें 1960=100 श्रृंखला म ेंऔद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उर्पभोिा मूल्य सूचकांक के जतमाही औसत म ें2836 अंकों स े अजधक प्रत्येक 4 अंकों की प्रत्येक वृजि या प्रत्येक जगरावट के जलए वसूली योग्य महगं ाई राहत देय होगी। प्रत्येक उि 4 अंकों के जलए महगं ाई भत्त े म ेंऐसी वृजि या कमी की गणना मलू र्पिें न के 0.15 प्रजतित की दर से की िाएगी:

बिते यह भी ह ैदक 1 नवंबर, 2012 को या उसके बाद सेवाजनवृत्त हुए कमजचाररयों के संबंध म,ें 1960=100 श्रृंखला म ेंऔद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उर्पभोिा मूल्य सूचकांक के जतमाही औसत म ें4440 अंकों स े अजधक प्रत्येक 4 अंकों की प्रत्येक वृजि या प्रत्येक जगरावट के जलए वसूली योग्य महगं ाई राहत देय होगी। उि प्रत्येक 4 अंकों के जलए महगं ाई राहत म ेंऐसी वृजि या कमी की गणना मलू र्पेंिन के 0.10 प्रजतित की दर स े की िाएगी:

बिते दक 1 नवंबर, 2017 को या उसके बाद सेवाजनवृत्त हुए कमजचाररयों के संबंध म,ें 1960=100 श्रृंखला म ें औद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उर्पभोिा मूल्य सूचकांक के जतमाही औसत म ें 6352 अंकों से अजधक प्रत्येक 4 अंकों की प्रत्येक वृजि या प्रत्येक जगरावट के जलए वसूली योग्य महगं ाई राहत देय होगी। उि प्रत्येक 4 प्वाइंट्स के जलए महगं ाई राहत म ें ऐसी वृजि या कमी की गणना मलू र्पिें न के 0.07 प्रजतित की दर स े की िाएगी:8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] बिते दक 1 नवंबर, 2022 को या उसके बाद सेवाजनवृत्त होने वाले कमजचाररयों के संबंध म,ें औद्योजगक श्रजमकों के जलए अजखल भारतीय उर्पभोिा मल्ू य सूचकांक आधार 2016=100 के जतमाही औसत म ें123.03 अंकों स े अजधक की वृजि या जगरावट के प्रत्येक र्पररवतजन के जलए मलू र्पेंिन र्पर सूचकांक के प्रजत प्रजतित बबंद र्पर 1 प्रजतित की दर स े महगं ाई राहत देय होगी।

(5) 1 फरवरी स ेप्रारंभ होकर 31 ि लाई तक की छमाही के जलए महगं ाई राहत जर्पछल ेवि जके अिूबर, नवंबर और ददसंबर महीनों के जलए प्रकाजित सूचकांक आंकड़ों के जतमाही औसत र्पर दये होगा और 1 अगस्ट्त स े प्रारंभ होकर 31 िनवरी तक की छमाही के जलए उसी विज के अप्रलै , मई और िनू महीनों के जलए प्रकाजित सूचकांक आकं ड़ों के जतमाही औसत र्पर दये होगा।

(6) पाररिाररक पेंशि, अशक्त पेंशि और अिुकंपा भत्त े के मामि े म,ें महगं ाई राहत उपय जि दरों के अिुसार दये होगी।

(7) महगं ाई राहत संरािीकरण र्पश्चात भी र्पूण ज मलू र्पिें न र्पर अनज्ञ ात होगी ।

(8) अवतररक्त पेंशि पर महगं ाई राहत दये िहीं ह।ै

(9) ऐसे र्पेंिनभोगी जिनकी मूल र्पिें न न्यूनतम र्पेंिन स े कम ह,ै दकन्त मूल र्पेंिन और अजतररि र्पेंिन का योग न्यूनतम र्पेंिन स ेअजधक ह,ै वह न्यूनतम र्पेंिन र्पर लाग ू महगं ाई राहत आहररत करेंगे ।“। उि जवजनयमों म,ें र्पररजिष्ट-III के स्ट्थान र्पर जनम्नजलजखत र्पररजिष्ट प्रजतस्ट्थाजर्पत दकया िाएगा, यथा:- र्पररजिष्ट-III (जवजनयम 39 देख)ें 1 अप्रलै , 2021 स े र्पाररवाररक र्पेंिन की सामान्य दरें जनम्नान सार होंगी:

3. ₹22,200/- 'वेतन' का 30 प्रजतित मूल र्पररवार र्पेंिन होगी तथा इसके साथ उन भत् तों का 30 प्रजतित से ऊर्पर जिनकी गणना भजवष्य जनजध म ें अंिदान के जलए की िाती ह ैर्परंत महगं ाई भत् ते के जलए नहीं, अजतररक्त र्पररवार र्पेंिन होगी:

NOTIFICATION Mumbai, the 20th November, 2025 F. No. HO:HROPS:117:2567(E).—In exercise of the powers conferred by clause (f) of sub-section (2) of

section 19 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the Bank of Baroda, after consultation with the Reserve Bank of India and with the previous sanction of the Central Government, except as respects things done or omitted to be done in pursuance of the Government of India, Ministry of Finance, Department of Financial Services, letter number 4/2/1/2022-IR, dated the 13th March, 2024, on and from the 1st November, 2022 till the date of publication of this notification in the Official Gazette, hereby makes the following regulations further to amend the Bank of Baroda (Employees’) Pension Regulations, 1995, namely:–

1. (1) These regulations may be called the Bank of Baroda (Employees’) Pension (Amendment) Regulations, 2025.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Bank of Baroda (Employees’) Pension Regulations, 1995 (hereinafter referred to as the said regulations), in regulation 2, after clause (w), the following clause shall be inserted, namely:– “(wa) ‘resigned former employee’ means an employee, who –

(a) was in the services of the Bank on or after the 1st January, 1986;

(b) joined the Bank before the 1st April, 2010;

(c) has resigned from the services of the Bank on or before the 26th April, 2010; and[भाग III—खण् ड 4] भारत का रािर्पत्र : असाधारण 15

(d) was otherwise eligible to join the pension scheme while in service of the Bank;”.

3. In regulation 3 of the said regulations, after sub-regulation (14), the following shall be inserted, namely:– “(15) qualifies the definition of resigned former employee defined in clause (wa) of regulation 2 and has agreed to refund to the Bank the entire Banks’ contribution to Provident Fund (along with accumulated interest thereon) received by him at the time of resignation or later, from the Bank and has given an undertaking as per the draft

provided by the Bank within the time as stipulated by the Bank.”.

4. In regulation 22 of the said regulations, in sub-regulation (1), after the proviso, the following proviso shall be inserted, namely:– “Provided further that resignation by a resigned former employee defined in clause (wa) of regulation 2, and who also conforms to the conditions contained in sub-regulation (15) of regulation 3, shall not entail forfeiture of the past service.”.

5. In regulation 29 of the said regulations, –

(i) in sub-regulation (1), after the third proviso, the following proviso shall be inserted, namely:– “Provided also that a resigned former employee as defined in clause (wa) of regulation 2 and conforming to the conditions specified in sub-regulation (15) of regulation 3, shall also be entitled for pension provided he has completed such qualifying service.”;

(ii) in sub-regulation (5), the following proviso shall be inserted, namely: – “Provided that the resigned former employee defined in clause (wa) of regulation 2 shall not be eligible for the benefit of increase of such qualifying service.”.

6. In regulation 36 of the said regulations, after clause (g), the following clause shall be inserted, namely: – “(h) rupees five thousand and seventy-five per month in respect of an employee, other than a part- time employee, where the employee retired on or after the 1st November, 2022, rupees one thousand seven hundred per month in respect of a part-time employee drawing 1/3 scale of wages, rupees two thousand five hundred and forty seven per month in respect of part-time employee drawing ½ scale wages, and rupees three thousand eight hundred and twenty per month in respect of a part-time employee drawing ¾ scale wages, where the part-time employee retired on or after the 1st November, 2022.”.

7. In regulation 39 of the said regulations, in sub-regulation (1), in clause (c), after the proviso, the following proviso shall be inserted, namely: – “Provided further that family of a deceased resigned former employee as defined in clause (wa) of regulation 2 shall also be eligible for family pension provided that the deceased resigned former employee has completed required qualifying service in the Bank under sub-regulation (1) of regulation 29, subject to the condition that the deceased resigned former employee (before his death) or family member has agreed to refund to the Bank the entire Bank’s contribution to Provident Fund (along with accumulated interest thereon) received at the time of resignation or later, from the Bank and has given an undertaking as per the draft provided by the Bank within the time as stipulated by the Bank.”.

8. In regulation 40 of the said regulations, in sub-regulation (1),–

(i) in clause (b), for the first proviso, the following proviso shall be substituted, namely:– “Provided that the family pension payable to son or daughter (including widowed or divorced) shall be discontinued or not be admissible when the eligible son or daughter starts earning a sum in excess of rupees eighteen thousand per month from employment in Government or Private Sector or self– employment etc.:”;

(ii) for clause (c), the following clause shall be substituted, namely: – “(c) in the case of parents, the family pension shall be discontinued or not be admissible, if the income of one of the parents or the aggregate income of both the parents from employment in Government or Private Sector or self–employment, etc. exceeds rupees eighteen thousand per month.”.

9. In regulation 41 of the said regulations, in sub-regulation (1), after the proviso, the following proviso shall be inserted, namely:– “Provided further that a resigned former employee as defined in clause (wa) of regulation 2 and who conforms to conditions contained in sub-regulation (15) of regulation 3, shall not be eligible for commutation of his pension.”.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

10. In regulation 55 of the said regulations, for the words “The Chairman and Managing Director”, the words “The Managing Director and Chief Executive Officer” shall be substituted.

11. In the said regulations, for Appendix – II, the following Appendix shall be substituted, namely:– “Appendix-II (See regulation 37)

Dearness relief on basic pension shall be as under:

(1) In the case of employees who were in the workmen cadre and who retired on or after the 1st January, 1986, but before the 1st November, 1992, and in the case of employees, who were in the officers’ cadre and who retired on or after the 1st January, 1986, but before the 1st July, 1993, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 600 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960 = 100. Such increase or decrease in dearness relief for every said 4 points shall be calculated in the manner provided in the following Table, namely:– TABLE Sl. Provided further that on and from the 1st October, 2023, in addition to the dearness relief provided in the Table above, ex-gratia amount as specified in the Table below shall also be payable.

Provided also that on and from the 1st October, 2023, in addition to the dearness relief provided in the Table mentioned above, ex-gratia amount as specified in the Table below shall also be payable.

Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.18 per cent. of basic pension:

Provided that on and from the 1st May, 2005, in respect of employees who retired on or after the 1st November, 2002 but on or before the 30th April, 2005, dearness relief shall be payable in terms of this clause:

Provided further that in respect of employees who retired on or after the 1st November, 2007, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2836 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.15 per cent. of basic pension:

Provided also that in respect of employees who retired on or after the 1st November, 2012, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 4440 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.10 per cent. of basic pension:

Provided also that in respect of employees who retired on or after the 1st November, 2017, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 6352 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.07 per cent. of basic pension:

Provided also that in respect of employees who retired on or after the 1st November, 2022, dearness relief shall be payable at 1 per cent. per percentage point of Index on the Basic pension for every variation of rise or fall over 123.03 points in the quarterly average of the All India Consumer Price Index for Industrial Workers Base 2016=100.[भाग III—खण् ड 4] भारत का रािर्पत्र : असाधारण 19

(5) Dearness relief shall be payable for the half year commencing from the 1st February and ending with the 31st July on the quarterly average of the index figures published for the months of October, November and December of the previous year and for the half year commencing from the 1st August and ending with the 31st January on the quarterly average of the index figures published for the months of April, May and June of the same year.

(6) In the case of family pension, invalid pension and compassionate allowance, dearness relief shall be payable in accordance with the rates mentioned above.

(7) Dearness relief will be allowed on full basic pension even after commutation.

(8) Dearness relief is not payable on additional pension.

(9) Pensioner whose basic pension is less than minimum pension but the aggregate of basic pension and additional pension is more than the minimum pension shall draw dearness relief as applicable to minimum pension.”.

12. In the said regulations, for Appendix-III, the following Appendix shall be substituted, namely: — “Appendix-III (See regulation 39) On and from the 1st April, 2021, the ordinary rates of family pension shall be as under:

(a) In respect of employees other than part-time employees, where the employee was in the workmen cadre and retired before the 1st November, 1992 or where the employee was in the officers’ cadre and retired before the 1st July,1993:– Sl. Scale of pay per Amount of monthly family pension No. month

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.1262 per month.

3. Above Rs.8420 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional family pension:

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.1687 per month.

(d) In respect of employees (both officers and workmen) other than part-time employees retiring on or after the 1st May, 2005:– Scale of pay Sl. No. Amount of monthly family pension per month

Provided that the aggregate of basic and additional family pension shall be subject to minimum of Rs.1715 per month.

3. Above 30 per cent. of the pay shall be the basic family pension and additional 30 per Rs.11,440 cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional family pension:

Provided that on and from the 1st May, 2005, in respect of employees who retired on or after the 1st November 2002 but on or before the 30th April, 2005, ordinary rates of family pension shall be in terms of this clause.

1. Upto Rs.11,100 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional

2. Rs.11,101 to 30 per cent. of the pay shall be the basic family pension and additional Rs. 22,200 30 per cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional

Provided that the aggregate of basic and additional family pension shall be subject to minimum of Rs.3422 per month.

3. Above Rs.22,200 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional

EXPLANATORY MEMORANDUM These regulations which have been given retrospective effect are as per the agreed terms and conditions of the settlements and Joint Notes signed between the Indian Banks’ Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level workmen Unions and Officers’ Associations of the banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
