(2) के खंड (द) के साथ पठित धारा 58 की उपधारा (2) के खंड (ि) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, ऊिाा दक्षता ब्यूरो, केंद्रीय सरकार के पूवा अनुमोदन से, ऊिाा दक्षता ब्यरू ो (ऊिाा प्रबंधकों के जलए प्रमाणन प्रदियाएं), 2010 का अजधिमण करत े हुए, ऊिाा दक्षता ब्यूरो का (ऊिा ा संपरीक्षकों, ऊिा ा संपरीक्षकों (भवन) और ऊिाा प्रबंधकों का प्रमाणन) जवजनयम, 2024 को अजधसूजचत करने का प्रस्ट्ताव ह,ै प्रस्ट्ताजवत प्रारूप जवजनयमों को भारत के रािपत्र, असाधारण म,ें िैसा दक उि अजधजनयम की धारा 58 की उपधारा (1) द्वारा यथा अपेजक्षत ह,ै उनसे प्रभाजवत होन े वाले सभी संभाजवत व्यजियों की िानकारी के जलए और उनके सुझाव और आपजत्तयां (यदद कोई हो) आमंजत्रत करन े के जलए एतद्द्वारा प्रकाजित दकया िाता ह;ै और इसके द्वारा यह सूचना दी िाती ह ै दक उि प्रारूप जवजनयमों पर भारत के रािपत्र, असाधारण म ें उनके प्रकािन की तारीख से तीस ददनों की अवजध की समाजि पर या उसके पश्चात जवचार दकया िाएगा;

1. सजं क्षि नाम और प्रारंभ. - (1) इन जवजनयमों का संजक्षि नाम ऊिाा दक्षता ब्यूरो (ऊिाा संपरीक्षकों, ऊिा ा संपरीक्षकों (भवन) और ऊिाा प्रबंधकों का प्रमाणन) जवजनयम, 2025 ह।ै

(2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे।

2. पठरभाषाएँ. - (1) इन जवजनयमों में िब तक दक संदभा से अन्यथा अपेजक्षत न हो- (क) “अजधजनयम” स ेऊिाा सरं क्षण अजधजनयम, 2001 अजभप्रेत ह;ै (ख) “सलाहकार सजमजत” से जवजनयम 13 के उप-जवजनयम (1) के अंतगात ब्यूरो द्वारा गठित सजमजत से ह:ै (ग) “अजभकरण” स े ऊिाा सरं क्षण (ऊिाा संपरीक्षकों, ऊिाा संपरीक्षकों (भवन) और ऊिाा प्रबधं कों के जलए न्यूनतम अहता ा) जनयम, 2020 के जनयम 2 म ेंपठरभाजषत अजभकरण अजभप्रेत ह।ै (घ) “प्रमाजणत ऊिाा संपरीक्षक” या “प्रमाजणत ऊिाा संपरीक्षक (भवन)” या “प्रमाजणत ऊिाा प्रबंधक” से ऐसा व्यजि अजभप्रेत ह ैजिसे जवजनयम 7 के अंतगता प्रमाण पत्र िारी दकया गया ह;ै (ङ) कंपनी प्रायोजित अभ्यर्थायों से ऐसे अभ्यथी अजभप्रते ह ै िो या तो केंद्र सरकार, राज्य सरकार, दकसी स्ट्वायत्त जनकाय या दकसी जनिी संगिन द्वारा प्रायोजित हैं, इनके अलावा सभी उम्मीदवारों को गैर प्रायोजित उम्मीदवार माना िाएगा। (च) “प्ररूप” से इन जवजनयमों स ेसंलग्न प्ररूप अजभप्रत ह;ै (छ) "राष्ट्रीय परीक्षा" से इन जवजनयमों के अनुसार ऊिाा संपरीक्षक, ऊिाा संपरीक्षक (भवन) और ऊिाा प्रबंधक के प्रमाणन के जलए ब्यूरो या उसके अजभकरण द्वारा आयोजित राष्ट्रीय परीक्षा अजभप्रेत ह;ै (ि) "रजिस्ट्टर" से जवजनयम 9 के उप-जवजनयम (1) के अंतगता ब्यूरो द्वारा रख े गए प्रमाजणत ऊिा ा संपरीक्षकों, प्रमाजणत ऊिाा संपरीक्षकों (भवन) और प्रमाजणत ऊिाा प्रबंधकों का रजिस्ट्टर अजभप्रेत ह;ै (झ) "अनुसूची" से इन जवजनयमों से संलग्न अनुसूची अजभप्रेत है;

(2) उन िब्दों और पदों के, िो इनमें प्रयुि ह ैंऔर पठरभाजषत नहीं ह ैं ककंतु अजधजनयम अथवा उसके अधीन बनाए गए जनयमों में पठरभाजषत ह,ैं िमि: वही अथ ाहोंगे िो अजधजनयम अथवा जनयमों म ेंह।ैं

3. राष्ट्रीय परीक्षा का आयोिन. -

(1) ऊिाा संपरीक्षकों या ऊिाा संपरीक्षकों (भवन) या ऊिाा प्रबंधकों के प्रमाणन के प्रयोिनाथा, ब्यरू ो स्ट्वयं या अजभकरण के माध्यम स ेराष्ट्रीय परीक्षा का संचालन करेगा।

(2) ब्यूरो समाचार पत्र में प्रकािन द्वारा तारीख, समय और स्ट्थान अजधसूजचत करेगा िहां ऐसी राष्ट्रीय परीक्षा संचाजलत की िाएगी।

(3) राष्ट्रीय परीक्षा अंग्रेिी माध्यम में संचाजलत की िाएगी।

4. राष्ट्रीय परीक्षा म ेंसजम्मजलत होन ेके जलए पात्रता. - कोई भी व्यजि राष्ट्रीय परीक्षा में सजम्मजलत होन े के जलए तब तक पात्र नहीं होगा िब तक दक उसके पास ऊिा ा संरक्षण (ऊिा ा संपरीक्षकों, ऊिा ा संपरीक्षकों (भवन) और ऊिा ा प्रबंधकों के जलए न्यनू तम अहता ा) जनयम, 2020 के जनयम 4 म ें जवजनर्दाष्ट अहता ा न रखता हो।

5. राष्ट्रीय परीक्षा के जलए फीस और आवदे न प्रदिया.–

(1) राष्ट्रीय परीक्षा के जलए फीस में आवेदन फीस, ऊिाा संपरीक्षक या ऊिाा प्रबंधक या ऊिाा संपरीक्षक (भवन) के जलए प्रमाणन िुल्क और ऊिाा प्रबंधक से ऊिा ासंपरीक्षक के जलए प्रमाणन का उन्नयन सजहत परीक्षा िुल्क िाजमल ह।ै

(2) कोई व्यजि िो जवजनयम 4 के अधीन राष्ट्रीय परीक्षा में सजम्मजलत होने के जलए पात्र ह ै और ऐसी परीक्षा के जलए प्रवेि चाहता ह,ै उसे ब्यरू ो द्वारा जवकजसत पोटाल पर ऑनलाइन फॉमा (फॉम ा I) म ेंब्यूरो को आवेदन करना होगा।

(3) प्रत्येक आवेदन के साथ ऊिाा दक्षता ब्यूरो नई ददल्ली के पक्ष में तैयार जडमांड ड्राफ्ट या भुगतान के दकसी भी स्ट्वीकाया इलेक्ट्रॉजनक मोड द्वारा देय फीस की जनम्नजलजखत राजि संलग्न करनी होगी।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

(4) ब्यूरो, या अजभकरण, िैसा भी मामला हो, आवेदन पत्र की िांच करन े के बाद और यह समाधान होन े के बाद दक आवेदक राष्ट्रीय परीक्षा में सजम्मजलत होने के जलए पात्र है, उसे राष्ट्रीय परीक्षा की तारीख से कम से कम पंद्रह ददन पहले राष्ट्रीय परीक्षा का स्ट्थान, तारीख और समय बताते हुए एक प्रवेि पत्र िारी करके राष्ट्रीय परीक्षा के जलए प्रवेि दगे ा।

(5) िहां उप-जवजनयम (4) के अधीन आवेदन की िांच करन े पर, कोई आवेदक राष्ट्रीय परीक्षा में बैिने के जलए अयोग्य पाया िाता ह,ै तो उसके आवदे न को अस्ट्वीकार करन े के कारणों को लेखबद्ध दकया िाएगा और उसे तदनुसार सूजचत दकया िाएगा।

(6) ऊिाा संपरीक्षक या ऊिाा प्रबधं क या ऊिाा संपरीक्षक (भवन) के जलए परीक्षा फीस और उन्नयन िुल्क सजहत आवेदन फीस और प्रमाणन िल्ु क- सारणी -I आवदे न फीस और प्रमाणन फीस उन्नयन फीस ि.स.ं अभ्यर्थया ों की श्रणे ी ऊिा ाप्रबधं क ऊिा ासपं रीक्षक (ऊिा ाप्रबधं क स े ऊिा ासपं रीक्षक (भवन) ऊिा ासपं रीक्षक)

(i) सामान्य अभ्यर्थायों के दस हिार पांच आि हिार आि हिार रुपये; प्रजत प्रश्न-पत्र दो जलए सौ रुपय;े रुपय;े हिार पांच सौ रुपय े

(ii) अनुसूजचत िाजत या चार हिार चार हिार रुपए; एक हिार दो सौ पांच हिार दो सौ अनुसूजचत िनिाजत के रुपए; पचास रुपये प्रजत पचास रुपय े अभ्यर्थायों के जलए प्रश्न-पत्र

(iii) अन्य जपछडा वग ा के पांच हिार दो सौ चार हिार चार हिार रुपए; एक हिार दो सौ अभ्यर्थायों के जलए पचास रुपये; रुपए; पचास रुपये प्रजत जिनकी वार्षाक आय 8 प्रश्न-पत्र लाख रुपये से कम हो या भारत सरकार द्वारा समय-समय पर यथा संिोजधत हो।

(iv) उन अभ्यर्थायों के जलए पांच हिार दो सौ चार हिार चार हिार रुपए; एक हिार दो सौ िो अनुसूजचत िाजत, पचास रुपये; रुपए; पचास रुपये प्रजत अनुसूजचत िनिाजत या प्रश्न-पत्र अन्य जपछडा वग ा की श्रेणी के अंतगात नहीं आते ह ैं और आर्थाक रूप से कमिोर वगा के जलए आय और संपजत्त के मानदंडों को परू ा करत े ह,ैं िैसा दक केंद्र सरकार द्वारा अजधसूजचत दकया िाए।

(v) कंपनी प्रायोजित दस हिार पांच आि हिार आि हिार रुपए; दो हिार पांच सौ अभ्यर्थायों के जलए सौ रुपये; रुपए; रुपये प्रजत प्रश्न-पत्र4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (क) ऊिा ा संपरीक्षक (भवन) के जलए अभ्यथी द्वारा भुगतान की गई फीस, िैसा दक ऊपर दी गई सारणी म ें जनर्दाष्ट ह,ै तीन प्रश्न-पत्रों के जलए ह।ै तथाजप, यदद अभ्यथी ऊिा ा प्रबंधक और ऊिा ा संपरीक्षक ह,ै तो उसे सारणी-II म ें जनर्दाष्ट प्रश्न-पत्र I के जलए उपजस्ट्थत होने स े छूट दी िाएगी और तत्पश्चात प्रश्न-पत्र I के जलए फीस में स े िमांक (i) और (v) श्रेजणयों के जलए 2500 रुपय े तथा सारणी I म ें जनर्दष्टा िमांक (ii), (iii) और (iv) श्रजे णयों के जलए 1250 रुपये की कटौती की िाएगी। (ख) राष्ट्रीय परीक्षा में प्रवेि पाने वाल े अभ्यथी द्वारा भगु तान की गई फीस दकसी भी आधार पर या दकसी भी पठरजस्ट्थजत में वापस या समायोजित नहीं की िाएगी। (ग) तथाजप, िो अभ्यथी पात्र नहीं पाए िात े हैं, उन्ह ेंपरीक्षा में प्रवेि नहीं ददया िाएगा और उन अभ्यर्थायों द्वारा भुगतान की गई फीस, पांच सौ रुपये के आवेदन िल्ु क की कटौती के बाद वापस कर दी िाएगी।

6. जवषय, परीक्षा की अवजध और प्रत्यके प्रश्न-पत्र के जलए अजधकतम अकं

(1) प्रश्नपत्रों का ब्यौरा, ऐस े प्रश्नपत्रों में परीक्षा की अवजध तथा उनमें स े प्रत्येक के जलए अजधकतम अंक नीचे यथा जवजनर्दाष्ट अनुसार होंग:े - क) ऊिाा संपरीक्षक या ऊिाा प्रबंधक, ऊिाा संपरीक्षक (भवन) के प्रमाणन के जलए राष्ट्रीय परीक्षा, अथाात:् सारणी – II प्रश्न-पत्र प्रश्न-पत्र का जवषय परीक्षा की अवजध अजधकतम स.ं अकं I ऊिाा प्रबंधन एवं ऊिाा संपरीक्षा के सामान्य पहलू 3 घंटे 150 II थमाल उपयोजगताओं म ेंऊिा ादक्षता 3 घंटे 150 III जवद्युत उपयोजगताओं म ेंऊिाा दक्षता 3 घंटे 150 IV उपस्ट्कर और उपयोजगता प्रणाजलयों के जलए ऊिा ा जनष्पादन 2.5 घंटे 100 मूल्यांकन (ओपन बुक परीक्षा) V भवनों में ऊिा ादक्षता और जस्ट्थरता के मलू जसद्धांत 3 घंटे 150 VI भवनों में ऊिाा दक्षता और जस्ट्थरता के जलए कोड अनुपालन 3 घंटे 150 (ओपन बुक परीक्षा: बीईई द्वारा प्रकाजित वाजणजज्यक और आवासीय भवनों के जलए जबलल्डंग कोड) ख) ऊिाा प्रबंधक, ऊिाा संपरीक्षक और ऊिाा संपरीक्षक (भवन) द्वारा उत्तीणा दकए िाने वाले परीक्षा/ प्रश्न-पत्रों की सूची सारणी -III ि.स.ं अभ्यथी की श्रणे ी अर्हता होन ेके जलए प्रश्न-पत्र 1 ऊिाा प्रबंधक सारणी-II में जवजनर्दाष्ट तीन प्रश्न-पत्र (प्रश्न-पत्र-I, प्रश्न-पत्र-II और प्रश्न-पत्र-III) 2 ऊिाा संपरीक्षक सारणी II में जवजनर्दाष्ट चार प्रश्न-पत्र (प्रश्न-पत्र-I, प्रश्न-पत्र-II, प्रश्न- पत्र-III और प्रश्न-पत्र-IV) 3 ऊिाा संपरीक्षक (भवन) सारणी II म ें जवजनर्दाष्ट तीन प्रश्न-पत्र (प्रश्न-पत्र - I, प्रश्न-पत्र - V और प्रश्न-पत्र - VI)[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5

(2) यदद ऊिाा संपरीक्षक (भवन) परीक्षा में सजम्मजलत होन े वाला अभ्यथी पहल े से ही ऊिाा प्रबंधक/ऊिाा संपरीक्षक के जलए अहता ा प्राि कर चुका ह,ै तो उसे प्रश्न-पत्र-I से छूट दी िाएगी।

(3) ऊिाा संपरीक्षक या ऊिा ा संपरीक्षक (भवन) या ऊिाा प्रबंधक के प्रमाणन के जलए राष्ट्रीय परीक्षा के जवषय जववरजणका में यथा जवजनर्दाष्ट अनुसार होंगे। ऐसे जवषय ब्यूरो की वेबसाइट www.beeindia.gov.in पर भी प्रदर्िात दकए िाएगं े।

(4) पूरक परीक्षा में बैिने वाले अभ्यर्थायों के मामले में, पुस्ट्तकों का नवीनतम संस्ट्करण पूवोि ब्यरू ो की वेबसाइट पर उपलब्ध होगा अथवा अभ्यथी इन पस्ट्ु तकों की हाडा कॉपी ब्यूरो से अथवा एिेंसी से खरीद सकते हैं, जिसके जलए उन्ह ें अजतठरि लागत, यदद कोई हो, देनी होगी, िैसा दक समय-समय पर जववरजणका म ें जवजनर्दाष्ट दकया िा सकता ह।ै

(5) राष्ट्रीय परीक्षा के जलए एक जववरजणका जिसमें पात्रता, पाठ्यिम और संदभा सामग्री सजहत योिना और तौर- तरीके अन्तर्वाष्ट ह,ैं परीक्षा की वास्ट्तजवक तारीख स े कम से कम तीन महीन े पहले ब्यूरो द्वारा उपलब्ध कराई िाएगी।

(6) दकसी अभ्यथी को राष्ट्रीय परीक्षा में उत्तीणा घोजषत दकया िाएगा यदद वह राष्ट्रीय परीक्षा के प्रत्येक प्रश्न-पत्र म ें न्यूनतम पचास प्रजतित अंक प्राि करता ह।ै

(7) असफल अभ्यर्थायों के जलए परू क फीस एवं परीक्षा के प्रयासों की अजधकतम संख्या: क) ब्यूरो या अजभकरण द्वारा संचाजलत लगातार छह परीक्षाओं म ेंप्रजत प्रश्न-पत्र अजधकतम प्रयास सारणी - IV अभ्यर्थया ों की श्रणे ी प्रश्न-पत्र I प्रश्न-पत्र II प्रश्न-पत्र III प्रश्न-पत्र IV प्रश्न-पत्र V प्रश्न-पत्र VI ऊिाा प्रबंधक 3 प्रयास 3 प्रयास 3 प्रयास लाग ूनहीं लाग ूनहीं लाग ूनहीं ऊिाा संपरीक्षक 3 प्रयास 3 प्रयास 3 प्रयास कोई सीमा लाग ूनहीं लाग ूनहीं नहीं ऊिाा संपरीक्षक (भवन) 3 प्रयास लाग ूनहीं लागू नहीं लाग ूनहीं 3 प्रयास 3 प्रयास ख) भुगतान की िान े वाली पूरक फीस नीचे दी गई है, िो ऊिाा दक्षता ब्यरू ो के पक्ष में ददल्ली में देय जडमाडं ड्राफ्ट या भुगतान के दकसी भी स्ट्वीकाया इलेक्ट्रॉजनक मोड के माध्यम से होगी। सारणी-V ि.स.ं अभ्यर्थया ों की श्रणे ी परू क फीस प्रजत प्रश्न-पत्र एक हिार पांच सौ

(i) सामान्य अभ्यर्थायों या कंपनी प्रायोजित के जलए रुपय े प्रजत प्रश्न-पत्र सात सौ पचास रुपये

(ii) अनुसूजचत िाजत या अनुसूजचत िनिाजत के अभ्यर्थायों के जलए6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] अन्य जपछडा वगा के अभ्यर्थायों के जलए जिनकी वार्षाक आय 8 प्रजत प्रश्न-पत्र सात सौ पचास रुपये

(iii) लाख रुपय े से कम हो या भारत सरकार द्वारा समय-समय पर यथा संिोजधत। उन अभ्यर्थायों के जलए िो अनसु ूजचत िाजत, अनुसूजचत िनिाजत प्रजत प्रश्न-पत्र सात सौ पचास रुपये या अन्य जपछडा वगा की योिना के अंतगात नहीं आते ह ैं और

(iv) आर्थाक रूप से कमिोर वग ा के जलए आय और संपजत्त के मानदंडों को पूरा करत े ह,ैं िैसा दक केंद्र सरकार द्वारा अजधसूजचत दकया िाए।

7. ऊिा ासपं रीक्षकों, ऊिा ासपं रीक्षक (भवन) और ऊिा ाप्रबधं कों का प्रमाणन. -

(1) ऊिाा संपरीक्षकों, ऊिाा संपरीक्षकों (भवन) और ऊिाा प्रबधं क के प्रमाणन के प्रयोिन के जलए ब्यूरो उस व्यजि को प्रमाण पत्र िारी करेगा जिसने िमिः प्ररूप-आईआईए, प्ररूप आईआईबी और प्ररूप आईआईसी में राष्ट्रीय परीक्षा उत्तीणा की ह।ै

8. ऊिा ासपं रीक्षक, ऊिा ासपं रीक्षक (भवन) और ऊिा ाप्रबधं कों के कतव्या /जिम्मदे ाठरया.ं -

(1) प्रमाजणत ऊिाा संपरीक्षक या प्रमाजणत ऊिाा प्रबधं क, ऊिा ा सघन उद्योगों और अन्य प्रजतष्ठानों म ें ऊिा ा के दकसी उपयोगकताा या उपयोगकतााओं के वग ा द्वारा ऊिाा के कुिल उपयोग और इसके संरक्षण के जलए गजतजवजधयों के प्रभारी ऊिाा प्रबंधक के रूप में जनयुजि या पदनाम के जलए पात्र होगा, िैसा दक अजधजनयम की अनुसूची में जवजनर्दाष्ट ह।ै

(2) प्रमाजणत ऊिाा संपरीक्षक (भवन) ब्यूरो या राज्यों द्वारा प्रकाजित या अजधसूजचत भवन संजहताओं या जनयमों िैसा की मामला ह ैके अनपु ालन के जलए पात्र होगा।

(3) प्रमाजणत ऊिाा संपरीक्षक, प्रमाजणत ऊिाा संपरीक्षक (भवन) और प्रमाजणत ऊिा ा प्रबंधक अजधजनयम की धारा 14 के खंड (ि) के अधीन इन जवजनयमों से संलग्न अनुसूची में जवजनर्दाष्ट कृत्यों और कताव्यों का पालन करने के जलए पात्र होंगे।

9. प्रमाजणत ऊिा ासपं रीक्षकों, प्रमाजणत ऊिा ासपं रीक्षकों (भवन) और प्रमाजणत ऊिा ाप्रबधं कों का रजिस्ट्टर.-

(1) ब्यूरो प्ररूप-III में प्रमाजणत ऊिाा संपरीक्षकों, प्रमाजणत ऊिा ा संपरीक्षकों (भवन) और प्रमाजणत ऊिा ा प्रबंधकों के रजिस्ट्टर का अनरु क्षण करेगा और उि रजिस्ट्टर म ें उन व्यजियों के नाम िाजमल करेगा जिन्ह ें जवजनयम 7 के अंतगता प्रमाण-पत्र िारी दकए गए ह।ैं

(2) उप-जवजनयम (1) के अधीन प्रमाजणत ऊिाा संपरीक्षक, प्रमाजणत ऊिाा संपरीक्षक (भवन) और प्रमाजणत ऊिा ा प्रबंधक के रूप में रजिस्ट्रीकृत होने पर, प्रमाजणत ऊिा ा संपरीक्षक, प्रमाजणत ऊिाा संपरीक्षक (भवन) और प्रमाजणत ऊिाा प्रबंधक को प्रपत्र-IV म ेंददए गए प्ररूप म ेंपहचान पत्र िारी दकया िाएगा।

10. प्रमाणन की जवजधमान्यता. -

(1) जवजनयम 7 के अधीन ददया गया प्रमाणन पांच वष ा की अवजध के जलए जवजधमान्य होगा और प्ररूप-V में ब्यूरो को आवेदन करन े पर प्रत्येक पांच वषा के पश्चात नवीकरण होगा:

(2) प्रमाण पत्र का नवीकरण केवल तभी दकया िाएगा िब प्रमाजणत ऊिा ा संपरीक्षक, ऊिाा संपरीक्षक (भवन) और ऊिाा प्रबंधक न े पुनश्चयाा पाठ्यिम में भाग जलया हो और जनधााठरत बेंचमाका के साथ ब्यूरो या उसके अजधकरण द्वारा आयोजित मल्ू यांकन म ेंअहता ा प्राि की हो।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7

11. प्रमाण-पत्र का रद्द दकया िाना. -

(1) ब्यूरो जनम्नजलजखत के जलए दकसी ऊिाा संपरीक्षक, ऊिाा संपरीक्षक (भवन) और ऊिाा प्रबंधक का प्रमाणन उसके जवरुद्ध की गई जिकायत पर रद्द कर सकता है- (क) वृजत्तक कदाचार स ेसंबंजधत कोई काया या लोप; (ख) ऊिाा खपत पर तथ्यों, आकं डों या ठरपोटों का कोई दव्यु ापदेिन;

(ग) कपट से संबंजधत कोई काया; (घ) पुनश्चयाा पाठ्यिम में भाग लेन े से चूक: परंत ु यह दक ब्यरू ो द्वारा ऐस े ऊिाा संपरीक्षक, ऊिा ा संपरीक्षक (भवन) और ऊिा ा प्रबंधक को सुनवाई का अवसर ददए जबना ऐसा कोई रद्दीकरण नहीं दकया िाएगा। परंत ु यह दक उप-जवजनयम (1) के खडं (क) स े खंड (ग) म ें जवजनर्दाष्ट आधारों पर उपयुाि वृजत्तकों में स े दकसी का प्रमाणन रद्द दकया िाता ह,ै तो उि वृजत्तक का प्रमाणन ऐसे खंडों में जवजनर्दाष्ट दकसी घटना के संज्ञान म ें आने या घठटत होने पर िांच परू ी होने तक तत्काल जनलंजबत कर ददया िाएगा; और यदद ऐसे वृजत्तक के जखलाफ लगाए गए आरोप उि िांच म ें जनणाया क रूप से साजबत हो िात े ह,ैं तो उि वृजत्तक का प्रमाणन रद्द कर ददया िाएगा और उसका नाम सक्षम प्राजधकारी के अनुमोदन से ऐसे वृजत्तकों की सूची वाले रजिस्ट्टर से हटा ददया िाएगा। इसके अलावा, ब्यूरो द्वारा रजिस्ट्टर म ेंउसके नाम की कोई पुन: वापसी नहीं की िाएगी। परंतु यह दक रद्दीकरण उप-जवजनयम (1) के खंड (घ) में जवजनर्दाष्ट आधारों पर दकया गया हो, िैसे ही ऊिा ा संपरीक्षक या ऊिा ा संपरीक्षक (भवन) या ऊिा ा प्रबंधक ब्यूरो को सूजचत करता ह ै दक उसन े जवजनयमन 10 के अनुसार पुनश्चयाा पाठ्यिम और मल्ू यांकन म ें सफलतापूवाक भाग जलया ह ै और उत्तीणा हुआ है, प्रमाण-पत्र का रद्दीकरण प्रत्यावर्तात हो िाएगा।

(2) उप-जवजनयम (1) में जवजनर्दाष्ट िांच नब्बे ददन से अवजधक अवजध में परू ी की िाएगी। 90 (नब्ब)े ददनों की जवजनर्दाष्ट अवजध के भीतर उि िांच पूरी करने में जवफलता के मामले में, सक्षम प्राजधकारी के अनुमोदन से अवजध को 60 (साि) ददनों स ेअवजधक तक की उपयिु अवजध के जलए बढाया िाएगा।

12. प्रमाण पत्र या पहचान पत्र की दसू री प्रजत िारी करना -

(1) िहां जवजनयम 7 के अधीन िारी प्रमाणपत्र या जवजनयम 9 के उपजवजनयम (2) के अधीन िारी पहचान पत्र प्रमाजणत ऊिाा लेखा परीक्षक, प्रमाजणत ऊिाा संपरीक्षक(भवन) और प्रमाजणत ऊिाा प्रबंधक द्वारा खो िाता है, वहां ब्यूरो, इस जनजमत उसके द्वारा दकए गए आवेदन पर, सबं ंजधत पुजलस थाने म ें दि ा प्रथम इजत्तला ठरपोटा की प्रजत द्वारा सम्यक रूप स े समर्थात, यथाजस्ट्थजत, ऊिा ा दक्षता ब्यूरो के पक्ष म ें नई ददल्ली म ें संदेय जडमांड ड्राफ्ट द्वारा एक सौ रुपए की फीस या भुगतान के दकसी स्ट्वीकाया इलेक्ट्रॉजनक तरीके का भगु तान करने पर, जद्वप्रजतक प्रमाण-पत्र या पहचान पत्र िारी करेगा।

(2) िहां ब्यूरो द्वारा िारी कोई प्रमाण-पत्र या पहचान-पत्र क्षजतग्रस्ट्त हो िाता ह,ै वहां ब्यरू ो इस जनजमत दकए गए आवेदन पर और क्षजतग्रस्ट्त प्रमाण-पत्र या पहचान-पत्र के अभ्यपाण पर, ऊिा ा दक्षता ब्यूरो के पक्ष म ें नई ददल्ली म ें संदेय जडमांड ड्राफ्ट द्वारा एक सौ रुपए की फीस या भुगतान के दकसी स्ट्वीकाया इलेक्ट्रॉजनक तरीके का भुगतान करने पर जद्वप्रजतक प्रमाण-पत्र या पहचान-पत्र िारी करेगा।

13. सलाहकार सजमजतयों का गिन. –

(1) ब्यूरो, इन जवजनयमों के प्रयोिन के जलए, ऊिा ा संपरीक्षक, ऊिाा संपरीक्षक (भवन) और ऊिाा प्रबंधक के जलए राष्ट्रीय परीक्षा और उनके प्रमाणन और रजिस्ट्रीकरण के जलए एक परीक्षा सलाहकार सजमजत, एक तकनीकी सलाहकार सजमजत और एक प्रमाणन और रजिस्ट्रीकरण सलाहकार सजमजत का गिन करेगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

01. प्रमाजणत ऊिा ाप्रबधं क (सीईएम) प्रमाजणत ऊिाा प्रबंधक एक महत्वपूणा पद पर होता ह ै और संगिन में ऊिाा प्रबंधन से संबंजधत सभी गजतजवजधयों का केंद्र लबंद ुहोता ह।ै प्रमाजणत ऊिा ा प्रबंधक ऊिाा प्रबंधन काया योिना पर नीजत के जवकास में नेतृत्व प्रदान करता ह ैऔर कॉपोरेट20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ऊिाा नीजत के जनमााण में महत्वपूणा भूजमका जनभाता ह।ै प्रमाजणत ऊिाा प्रबंधक संयंत्र स्ट्तर पर ऊिाा प्रबंधन, पठरयोिना प्रबंधन, कार्माक प्रबंधन और जवत्तीय प्रबंधन से संबंजधत गजतजवजधयाँ भी करते ह।ैं इसके अलावा उनके पास जनम्नजलजखत काया और जिम्मेदाठरयाँ भी होती ह।ैं संयंत्र स्ट्तर पर सीईएम द्वारा की िान े वाली गजतजवजधयों की सांकेजतक रेखा इस प्रकार ह:ै • ऊिाा संरक्षण प्रकोष्ठ की स्ट्थापना करना तथा कॉपोरेट ऊिा ानीजत तैयार करना। • संगिन म ेंऊिाा प्रबंधन से संबंजधत वार्षाक गजतजवजध योिना तैयार करना;

• प्रत्येक जवत्त वषा के अंत में ऊिाा खपत की जस्ट्थजत पर एक ठरपोटा तैयार करना और ऊिाा संरक्षण (नाजमत उपभोिा जनयम, 2007 [(खडं 14 (ि)] के तहत ब्यूरो को एक प्रजत के साथ राज्य नाजमत एिेंसी को प्रस्ट्तुत करना;

• यह सुजनजश्चत करना दक ऊिा ा दक्षता ब्यरू ो (ऊिा ा लेखा परीक्षा के संचालन के जलए तरीके और समय अतं राल) जवजनयम, 2010 के अनुसार एक मान्यता प्राि ऊिाा संपरीक्षकद्वारा आयोजित ऊिा ा लेखा परीक्षा के संचालन के संबंध में अपने नाजमत उपभोिा को िारी दकए गए जनदेिों का अनुपालन दकया िाए और मान्यता प्राि ऊिा ा संपरीक्षककी जसफाठरिों पर की गई कारावाई का ब्यौरा संबंजधत राज्य नाजमत एिेंसी को भेिा िाए, जिसकी एक प्रजत ऊिाा सरं क्षण (उपभोग की गई ऊिा ा के संबंध म ें सूचना प्रस्ट्तुत करने का प्रारूप और तरीका और समय तथा मान्यता प्राि ऊिाा संपरीक्षककी जसफाठरिों पर की गई कारावाई) जनयम, 2008 [14(ट)] के अनुसार ब्यूरो को भेिना;

• पठरचालन स्ट्तर पर ऊिाा दक्षता के जलए प्रजिक्षण कायािम जवकजसत एवं प्रबंजधत करना; • ऊिाा दक्षता और पयाावरण सुधार की एकीकृत प्रणाली जवकजसत करना; • ऊिाा लागत को कम करने के जलए जनगरानी और प्रदिया जनयंत्रण में सुधार के जलए गजतजवजधयाँ िुरू करना;

• बाहरी एिेंजसयों के माध्यम से ऊिाा लेखा परीक्षा/दक्षता सुधार पठरयोिनाओं के कायाान्वयन का समन्वय करना; • सहयोग के माध्यम से समान क्षत्रे के अन्य ऊिाा प्रबंधकों के साथ सूचना आदान-प्रदान स्ट्थाजपत करना / उसमें भाग लेना;

• अजधजनयम के अनुसार मांग के अनुसार ब्यरू ो और संबंजधत राज्य नाजमत एिेंसी को सूचना उपलब्ध कराना।

02. प्रमाजणत ऊिा ासपं रीक्षक (सीईए) प्रमाजणत ऊिाा संपरीक्षकऊिा ा की खपत करन े वाल े प्रमुख खडं ों और उपकरणों पर एक व्यवजस्ट्थत अध्ययन करवाता है, जिसमें ऊष्मा और द्रव्यमान सतं ुलन की तैयारी िाजमल होती है, तादक प्रत्येक चरण में ऊिाा के कुिल उपयोग के प्रवाह की पहचान की िा सके और ऊिाा की बबाादी को जचजन्हत दकया िा सके। एक अच्छी तरह से संचाजलत ऊिाा लेखा परीक्षा ऊिा ा की बबाादी के क्षेत्रों को उिागर करेगी और इससे संयंत्र के सभी खंडों म ें संभाजवत ऊिा ा बचत के जलए सुझाव जमलगें े। इसके अलावा उसके जनम्नजलजखत काया और जिम्मेदाठरयाँ भी होती ह।ैं संयंत्र स्ट्तर पर सीईए द्वारा की िान े वाली सांकेजतक गजतजवजधयाँ इस प्रकार ह:ैं • ऊिाा लेखा परीक्षा दल के सहयोगी या सदस्ट्य के रूप में मान्यता प्राि ऊिाा संपरीक्षकके जनदिे न में जवस्ट्तृत ऊिा ा लेखा परीक्षा करना;

• ऊिाा खपत का पठरमाणन करना और आधारभूत ऊिा ािानकारी स्ट्थाजपत करना; • ऊिाा और सामग्री संतलु न जवकजसत करना; • ऊिाा और उपयोजगता प्रणाजलयों का दक्षता मल्ू यांकन करना; • ऊिाा मानदडं ों की मौिूदा ऊिाा खपत स्ट्तरों से तलु ना करना;

• ऊिाा बचत उपायों की पहचान करना और उन्ह ेंप्राथजमकता दने ा;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 21 • ऊिाा बचत उपायों की तकनीकी और जवत्तीय व्यवहायाता का जवश्लेषण करना; • ऊिाा कुिल प्रौद्योजगदकयों और वैकजल्पक ऊिाा स्रोतों की जसफाठरि करना;

• कायाान्वयन के जलए ठरपोटा जलखना, प्रस्ट्तुत करना और अनुवती कारावाई करना। प्रमाजणत ऊिाा लेखा परीक्षक, नीचे परै ा 03 में जनर्दष्टा ऊिाा संरक्षण अजधजनयम के तहत अजनवाया ऊिाा लेखा परीक्षा आयोजित करन े के जलए अजधकृत नहीं ह।ै प्रमाणन अन्य ितों के साथ-साथ एक पूवाापेक्षा ह,ै जिसे मान्यता के जलए आवेदन करने से पहल े ऊिा ासंपरीक्षकद्वारा पूरा दकया िाना चाजहए।

03. प्रमाजणत ऊिा ासपं रीक्षक (भवन) प्रमाजणत ऊिा ा सपं रीक्षकों (भवन) के काय ा और जिम्मदे ाठरयां: (1) प्रमाजणत ऊिाा संपरीक्षक(भवन), जिनकी सेवाएं भवन के माजलक द्वारा दकराए पर ली िाती हैं, जनम्नजलजखत को सत्याजपत और प्रमाजणत करेंगे, अथाात: - क) जडिाइन मानदंड, पठरयोिना के ऊिाा लक्ष्य, ऊिाा प्रणाजलयों के प्रदिना सत्यापन योिना और मॉडललगं दजृ ष्टकोण को ध्यान म ेंरखत े हुए भवन का जडिाइन;

ख) जवचाराधीन पठरयोिना के जलए जडिाइन दजृ ष्टकोण पर आधाठरत ऊिाा संरक्षण उपाय; ग) जनमााण और अनुपालन दस्ट्तावेि, अनपु ालन प्रपत्र और चेकजलस्ट्ट िो यह सुजनजश्चत करन े के जलए जनर्दष्टा ह ैं दक भवन इन जनयमों का अनुपालन करता ह;ै घ) प्रस्ट्ताजवत भवन जडिाइन का ऊिाा प्रदिान सूचकांक अनुपात या आवासीय आवरण संचरण मूल्य;

ङ) ऐसे असामान्य तकनीकी मुद्दों पर ठरपोटा दने ा िो भवन जनमााण की अनुमजत िारी करने या भवन जनमााण के दौरान या अजधभोग अवस्ट्था के दौरान उत्पन्न हो सकत े हैं, िो भवन उप-जनयमों के अतं गता क्षेत्राजधकार रखन े वाले प्राजधकारी के अनुमोदन के अधीन होगा;

च) ऊिाा संरक्षण और सतत भवन संजहता जनयमों के जलए तैयार जनयमों के कायाान्वयन को सुजवधािनक बनाने और देि के जवजभन्न िलवायु क्षेत्रों के तहत भवनों की जवजभन्न श्रेजणयों के जलए मानदंडों और मानकों को बढावा देने के जलए राष्ट्रीय और राज्य ऊिाा सरं क्षण भवन संजहता सजमजतयों को इनपुट प्रदान करना।

(2) प्रमाजणत ऊिाा संपरीक्षक (भवन) अपनी मुहर और हस्ट्ताक्षर के तहत एक प्रमाण पत्र प्रस्ट्ततु करेंगे तादक यह सुजनजश्चत दकया िा सके दक ऊिाा संरक्षण और सतत भवन संजहता अनुपालन से संबंजधत सभी सहायक दस्ट्तावेि (जचत्र, जवजनदेि, जनमााण दस्ट्तावेि, भवन आवरण, सुजवधा प्रणाली और जनयंत्रण, प्रकाि व्यवस्ट्था और जवद्युत िजि प्रणाजलयों को कवर करन े वाल ेअनुपालन प्रपत्र) अजधकार क्षेत्र वाले प्राजधकारी को प्रस्ट्तुत करने के जलए तैयार ह।ैं

(3) प्रमाजणत ऊिाा संपरीक्षक (भवन) ऊिाा संरक्षण और सतत भवन संजहता के जलए तैयार जनयमों के तहत भवनों के जडिाइन चरण से लेकर उनके उपयोग सजहत जनमााण कायों के जनरीक्षण की िजियों का प्रयोग करेगा और उसके प्रमाणीकरण के आधार पर अजधकार क्षेत्र वाला प्राजधकारी भवन परजमट िारी करेगा, भवन के जनमााण को मंिरू ी देगा, जनमााण पूरा होन े और अजधभोग प्रमाण पत्र िारी करेगा।

(4) प्रमाजणत ऊिाा संपरीक्षक (भवन) यह सुजनजश्चत करेंग े दक उनके अधीन काम करने वाला कोई भी वृजत्तक या कमाचारी इन जनयमों के अंतगता आन े वाल े संबंजधत भवन के जनमााण या पठरवतना के संबंध म ें दकसी भी काया म ें संलग्न न हो, तादक यह सुजनजश्चत दकया िा सके दक क्षेत्राजधकार वाले प्राजधकारी के जहतों के साथ उनके आजधकाठरक कताव्यों म ें कोई टकराव न हो। श्रीकांत नगलु ापल्ली, महाजनदिे क [जवज्ञापन-III/4/असा./967/2024-25]22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] THE BUREAU OF ENERGY EFFICIENCY

NOTIFICATION New Delhi, the 11th February, 2025 DRAFT AMENDMENT REGULATIONS No. 08/05/EA/EE(S)/08-BEE.—In exercise of the powers conferred by clause (h) of sub-section (2) of

section 58 read with clause (r) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau of Energy Efficiency with the previous approval of the Central Government, proposes to notify the Bureau of Energy Efficiency (Certification of Energy Auditors, Energy Auditors (Building) and Energy Managers) Regulations, 2024, in supersession of Bureau of Energy Efficiency (Certification Procedures for Energy Managers),2010, the proposed draft regulations are hereby published in the Gazette of India, Extraordinary, as required by sub-section (1) of section 58 of the said Act, for the information of all the persons likely to be affected thereby and inviting their suggestions and objections (if any); and the notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date of their publication in the Gazette of India, Extraordinary;

Objections or suggestions, if any, may be addressed to the Director-General, Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, R.K. Puram, New Delhi-110066 and may be sent at the e- mail address of the Bureau at dg-bee@nic.in;

Objections or suggestions which may be received from any person with respect to the said draft regulations before the expiry of the aforesaid period of thirty days, shall be considered by the Bureau.

Draft Regulations

1. Short title and commencement. - (1) These regulations may be called the Bureau of Energy Efficiency (Certification of Energy Auditors, Energy Auditors (Building) and Energy Managers) Regulations, 2025

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. - (1) In these regulations, unless the context otherwise requires-

(a) “Act” means the Energy Conservation Act, 2001;

(b) “Advisory Committee” means a committee constituted by the Bureau under sub-regulation (1) of regulation 13:

(c) “Agency” means the agency as defined in of rule 2 of the Energy Conservation (Minimum Qualification for Energy Auditors, Energy Auditors (Building) and Energy Managers) Rules, 2020.

(d) “Certified Energy Auditor” or “Certified Energy Auditor (Building)” or “Certified Energy Manager” means a person who has been issued a certificate under regulation 7;

(e) Company sponsored candidates means the candidates who are either sponsored by central government, state government, any autonomous body or any private organization, other than these all candidates are considered to be non sponsored candidates.

(f) “Form” means a form appended to these regulations;

(g) “National Examination” means the national examination conducted by Bureau or its agency for Certification of Energy Auditor, Energy Auditor (Building) and Energy Manager in accordance with these regulations;

(h) “Register” means a Register of Certified Energy Auditors, Certified Energy Auditors (Building) and Certified Energy Managers maintained by the Bureau under sub-regulation (1) of regulation 9;

(i) “Schedule” means the Schedule appended to these regulations;

(2) Words and expressions used herein and not defined but defined in the Act or the rules made there under shall have the meanings respectively assigned to them in the said Act or rules.

3. Conduct of National Examination. -

(1) For the purpose of Certification of Energy Auditors or Energy Auditors (Building) or Energy Managers, the Bureau shall, either by itself or through agency, conduct National Examination.

(2) The Bureau shall, by publication in the newspaper, notify the date, time and place where such National Examination shall be conducted.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 23

(3) The National Examination shall be conducted in English medium.

4. Eligibility for appearing in National Examination. - No person shall be eligible to appear for National Examination unless he possesses qualifications specified in the

rule 4 of the Energy Conservation (Minimum Qualification for Energy Auditors, Energy Auditors (Building) and Energy Managers) Rules, 2020.

5. Fees and application process for National Examination. –

(1) The fees for National Examination includes Application Fee, Examination Fees including Certification fee for Energy Auditor or Energy Manager or Energy Auditor (Building) and upgradation of certification from Energy Manager to Energy Auditor.

(2) A person who is eligible to appear for the National Examination under regulation 4 and seeking admission for such examination shall make by making an application to the Bureau in online Form (Form I) at portal developed by bureau.

(3) Each application shall be accompanied by the following amount of fee payable by demand draft drawn in favor of the Bureau of Energy Efficiency New Delhi or any acceptable electronic mode of payment.

(4) The Bureau, or the agency, as the case may be, shall, after scrutiny of application form and being satisfied that the applicant is eligible to appear for the National Examination, admit him for the National Examination by issuing him an admission card stating the place, date and time of the National Examination at least fifteen days before the date of the National Examination.

(5) Where on scrutiny of the application under sub-regulation (4), an applicant is found ineligible to appear for National Examination, his application shall be rejected for reasons to be recorded in writing and he shall be intimated accordingly.

(iv) for candidates who are rupees five rupees four rupees four rupees one thousand not covered under thousand two thousand; thousand; two hundred fifty category of Scheduled hundred and per paper Castes, Scheduled fifty;

(v) for company sponsored rupees ten rupees eight rupees eight rupees two thousand candidates thousand and thousand; thousand; five hundred per five hundred; paper

(a) The fees paid by the candidate for the Energy Auditor (Building) as specified in the table above is for three papers. However, if the candidate is Energy Manager and Energy Auditor, he/she shall be exempted to appear for Paper I as specified in Table-II and subsequently the fees for paper I will be deducted as Rs. 2500 for categories at Sno. (i) and (v) and Rs. 1250 for categories at Sno. (ii), (iii) and (iv) as specified in Table I.

(b) The fees paid by a candidate who has been admitted to the National Examination, shall not be refunded or adjusted on any ground or under any circumstances.

(c) However, those candidates who are not found to be eligible shall not be admitted for the examination and the fees paid by those candidates shall be refunded, after deduction of application fee of rupees five hundred.

6. Subjects, duration of examination and maximum marks for each paper

(1) The details of papers, the duration of examination, in such papers and maximum marks for each of them shall

be as specified below: -

(a) The National Examination for Certification of Energy Auditor or Energy Manager, Energy Auditor

(Buildings), namely:

(2) In case candidate appearing for Energy Auditor (Building) examination has already qualified for either Energy Manager/Energy Auditor, he/she will be exempted from Paper I.

(3) Subjects for National Examination for Certification of Energy Auditor or Energy Auditor (Buildings) or[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 25 Energy Manager shall be as specified in the prospectus. Such subjects shall also be displayed on the website of Bureau, namely www.beeindia.gov.in.

(4) In case of candidates appearing for supplementary examination, latest version of books shall be available on aforesaid Bureau’s website or candidate may purchase hard copy of these books from Bureau or from the agency, with an additional cost, if any, as may be specified in the prospectus from time to time.

(5) A prospectus containing scheme and modalities for the National Examination including eligibility, syllabus and reference material for such examination, shall be made available by the Bureau at least three months before the actual date of examination.

(6) A candidate shall be declared to have passed the National Examination if he secures a minimum of fifty percent marks in each paper for the National Examination.

(7) Supplementary Fee and maximum number of attempts of examination for unsuccessful candidates:

7. Certification of Energy Auditors, Energy Auditor (Building), and Energy Managers. -

(1) For the purpose of Certification of Energy Auditors , Energy Auditors (Building) and Energy Manager the Bureau shall issue a certificate to the person who has passed the National Examination in Form-IIA, Form IIB and Form IIC, respectively.

8. Duties/Responsibilities of Energy Auditors, Energy Auditor (Building), and Energy Managers-

(1) The Certified Energy Auditor or Certified Energy Manager shall be eligible for appointment or designation as Energy Manager in-charge of activities for efficient use of energy and its conservation by any user or class of users of energy in the energy intensive industries and other establishment, as specified in the Schedule to the Act.

(2) Certified Energy Auditor (Building) shall be eligible to conform compliance for building codes or rules as published or notified by Bureau or States as the case may be.

(3) The Certified Energy Auditor, Certified Energy Auditor (Building) and Certified Energy Manager shall be eligible to perform the functions and duties as specified in Schedule annexed to these regulations under clause (l) of section 14 of the Act.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

9. Register of Certified Energy Auditors, Certified Energy Auditors (Building) and Certified Energy Managers.-

(1) The Bureau shall maintain a Register of Certified Energy Auditors, Certified Energy Auditors (Building) and Certified Energy Managers in Form-III and include in the said registers the name of persons to whom certificates have been issued under regulation 7.

(2) On being registered as Certified Energy Auditor, Certified Energy Auditor (Building) and Certified Energy Manager under sub-regulation (1), the Certified Energy Auditor, Certified Energy Auditor (Buildings) and Certified Energy Manager shall be issued an identity card in the format given in Form-IV.

10. Validity of certification. -

(1) The certification made under regulation 7 shall be valid for a period of five years and renewable after every five years on an application made to the Bureau in Form -V:

(2) Renewal of certificate shall be made only when the Certified Energy Auditor, Energy Auditor (Building), and Energy Manager has attended the Refresher Course and qualified the Assessment conducted by the Bureau or its agency with prescribed benchmark.

11. Cancellation of certification. -

(1) The Bureau may cancel the certification of an Energy Auditor, Energy Auditor (Building) and Energy Manager on a complaint made against him for-

(a) any commission or omission amounting to professional misconduct;

(b) any misrepresentation of facts, data or reports on energy consumption;

(c) any act amounting to fraud;

(d) failure to attend the refresher course:

Provided that no such cancellation shall be done by the Bureau without giving an opportunity of being heard to such Energy Auditor, Energy Auditor (Building) and Energy Manager.

Provided that the certification of any of the aforesaid professionals is cancelled on the grounds specified in clause (a) to clause (c) of sub-regulation (1), the certification of the said professional shall be placed under suspension immediately on coming to notice or happening of an event specified in such clauses until inquiry is completed; and in case, the allegations leveled against such professional are conclusively proved in the said inquiry, the certification of the said professional shall be cancelled and his name shall be removed from the register containing the list of such professionals with the approval of the competent authority. Further, no restoration of his name in the register shall be made by the Bureau.

Provided that the cancellation has been done on grounds specified in clause (d) of sub-regulation (1), cancellation of the certificate shall be restored as soon as Energy Auditor or Energy Auditor (Building) or Energy Manager informs the Bureau that he/she has successfully attended and passed the refresher course and assessment in accordance with Regulation 10.

(2) the inquiry referred to in sub-regulation (1) above shall be completed in a period not exceeding ninety days.

In case of the failure to complete the said inquiry within the specified period of 90 (ninety) days, the term shall be extended for a suitable period not exceeding up to 60 (sixty) days with the approval of the competent authority.

12. Issue of duplicate certificate or identity card-

(1) Where the certificate is issued under regulation 7 or identity card issued under sub regulation (2) of regulation 9 has been lost by the Certified Energy Auditor, Certified Energy Auditor (Building) and Certified Energy Manager, the Bureau may, on an application made by him in this behalf, duly supported by a copy of first information report lodged with the concerned police station, issue a duplicate certificate or identity card, as the case may be, on payment of a fee of rupees one hundred by demand draft drawn in favour of the Bureau of Energy Efficiency, payable at New Delhi or any acceptable electronic mode of payment.

(2) Where any certificate or identity card issued by the Bureau is damaged, the Bureau may on an application made in this behalf and on surrender of damaged certificate or identity card, issue a duplicate certificate or identity card on payment of a fee of rupees one hundred by demand draft drawn in favour of the Bureau of Energy Efficiency, payable at New Delhi or any acceptable electronic mode of payment.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 27

13. Constitution of Advisory Committees. –

(1) The Bureau may, for the purpose of these regulations, national examination for Energy Auditor, Energy Auditor (Building) and Energy Manager and for their certification and registration constitute an Examination Advisory Committee, a Technical Advisory Committee and a Certification and Registration Advisory Committee.

(2) Each Advisory Committee shall consist of a Chairperson and not more than six other persons to be nominated by the Bureau from amongst members of the Advisory Committees constituted under regulation 3 of the Bureau of Energy Efficiency (Advisory Committees) Regulations, 2008 or its amendment.

SCHEDULE-II Functions and responsibilities of Energy Professionals specified in the Energy Conservation Act, 2001 (52 0f

2001)

01. Certified Energy Manager (CEM) Certified Energy Manager occupies an important position and is the focal point of all the activities pertaining to energy management in the organization. The Certified Energy Manager provides leadership in the development of policy on Energy Management Action Plan and plays a key role in the formulation of corporate energy policy.

Certified Energy Managers also perform the activities related with Energy Management, Project Management, Personnel Management and Financial Management at the plant level. S/He also further have following functions and responsibilities. The indicative line of activities to be performed by CEM at plant level are as below:

• Establish an energy conservation cell, and formulate corporate energy policy. • Prepare an annual activity plan pertaining to energy management in the organization; • Prepare a report on status of Energy Consumption at the end of every financial year and submit to the State Designated Agency, with a copy to the Bureau, under the Energy Conservation (the form and manner for submission of report on the status of energy consumption by the Designated Consumers’ Rules, 2007[(Clauses 14(l) ];

• Ensure direction issued to its Designated Consumer regarding conduct of energy audit conducted by an Accredited Energy Auditor in accordance with the Bureau of Energy Efficiency (Manner and Intervals of Time for Conduct of Energy Audit) Regulations, 2010 is complied with and details of the action taken on the recommendations of Accredited Energy Auditor is furnished to the concerned State Designated Agency, with a copy to the Bureau, in accordance with the Energy Conservation (Form and Manner and Time for Furnishing Information With Regard to the Energy Consumed and Action Taken on Recommendations of Accredited Energy Auditor) Rules, 2008 [14(k))].

• Develop and manage training programme for energy efficiency at operating levels; • Develop integrated system of energy efficiency and environmental improvement; • Initiate activities to improve monitoring and process control to reduce energy costs;

• Co-ordinate implementation of energy audit/efficiency improvement projects through external agencies; • Establish / participate in information exchange with other Energy Managers of the same sector through association;

• Provide information to Bureau and the concerned State Designated Agency as demanded in terms of the Act.

02. Certified Energy Auditor (CEA) Certified Energy Auditor involves a systematic study undertaken on major energy consuming sections and equipment including preparation of heat and mass balance with a view to identify the flow of energy efficient use of energy in each of the steps and pin-point wastage of energy. A well conducted energy audit would reveal the areas of wastage of energy and it would lead to suggestions for possible energy savings in all sections of a plant. S/He also further have following functions and responsibilities. The indicative lone of activities to be performed by CEA at plant level are as

below: • Carry out a detailed energy audit under the direction of Accredited Energy Auditor as an associate or member of energy audit team; • Quantify energy consumption and establish base line energy information;38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] • Develop energy and material balance;

• Perform efficiency evaluation of energy & utility systems; • Compare energy norms with existing energy consumption levels; • Identify and prioritization of energy saving measures; • Analyse technical and financial feasibility of energy saving measures;

• Recommend energy efficient technologies and alternate energy sources; • Report writing, presentation and follow up for implementation.

The Certified Energy Auditor, as such, is not authorized to conduct mandatory energy audits under the Energy Conservation Act as specified in para 03 below. Certification is one of the prerequisites along with other conditions, which have to be fulfilled by an Energy Auditor before applying for accreditation.

03. Certified Energy Auditors (Buildings) Functions and responsibility of the Certified Energy Auditors (Building): (1) The Certified Energy Auditors (Building), whose services are hired by the owner of the building shall verify and certify the following,

namely: -

(a) design of the building keeping in view the design criteria, energy goals of the project, energy systems performance verification plan, and the modeling approach;

(b) energy conservation measures based on the design approach for the project under consideration;

(c) construction and compliance documents, compliance forms and checklists specified to ensure that the building complies with these rules;

(d) energy performance index ratio or residential envelope transmittance value of the proposed building design;

(e) report on such unusual technical issues that may arise due to issue of building permit or construction of building or during occupancy stage subject to approval of the authority having jurisdiction under the building bye-laws;

(f) provide inputs to the National and State Energy Conservation Building Code Committees to facilitate the implementation of the rules prepared for Energy Conservation and Sustainable Building Code rules and to promote norms and standards for various categories of buildings under various climatic zones of the country.

(2) The Certified Energy Auditors (Building) shall furnish a certificate under his seal and signature to ensure that all supporting documents (drawings, specifications, construction documents, compliance forms prepared covering building envelope, comfort system and controls, lighting and electrical power systems) related to Energy Conservation and Sustainable Building Code compliance are prepared for submission to the authority having jurisdiction.

(3) The Certified Energy Auditors (Building) shall exercise the powers of inspection of the building works from the design stage to commissioning of buildings including their uses under the rules prepared for Energy Conservation and Sustainable Building Code and based on his certification the authority having jurisdiction shall issue building permit, approve construction of building, issue and completion and occupancy certificate.

(4) The Certified Energy Auditors (Building) shall ensure that no such professional or employee working under him/her is engaged in any work in connection with the construction or alteration of the concerned building covered under these rules to ensure that there is no conflict of interest with his/her official duties with the interests of the authority having jurisdiction.
