आक्षेप या सुझार्, यदद कोई हो, महाजनदिे क, ऊजाा दक्षता ब्यूरो, जर्द्युत मंत्रालय, चौथी मंजजल, सेर्ा भर्न, नॉथ ा वर्ग, सेक्टर -1, आर.के. पुरम, नई ददल्ली-110066 को संबोजधत दकया जा सकता है और ब्यूरो के ई-मेल dg-bee@nic.in पर भी भेजा जा सकता है;

1. सजं क्षि नाम और प्रारंभ :- (1) इन जर्जनयमों को ऊजाा दक्षता ब् यूरो (लाइट कमर्शियल एयर कंडीिनर के लेबल पर उनके संप्रदिान करने का जर्र्रण और रीजत) जर्जनयम, 2022 कहा जा सकता ह।ै

2. पठरभाषाएं.- (1) इन जर्जनयमों में, जब तक संदभा में अन्यथा अपेजक्षत न हो,- (क) “अजधजनयम“ से ऊजाा संरक्षण अजधजनयम, 2001 (2001 का 52) अजभप्रेत ह;ै (ख) “फॉमा“ से इन जर्जनयमों के साथ संलग्न एक फॉमा से अजभप्रेत है;

(ग) “लेबल“ से दकसी भी जलजखत, मुदद्रत, जचजननत, मुद्रांदकत या ग्रादफक पदाथा से अजभप्रेत है जो लाइट कमर्शियल एयर कंडीिनर पर जचपकाया गया ह ैया उस पर ददखाई द ेरहा ह ै ; (घ) “लेबल अर्जध“ से अजधजनयम की धारा 14 के खंड (क) के तहत केंद्र सरकार द्वारा अजधसूजचत ऊजाा खपत मानकों की र्धै ता अर्जध अजभप्रेत हैःै बिते दक, यदद लेबल र्ैधता अर्जध की समाजि की समय-सीमा तक, अजधजनयम की धारा 14 (ए) के तहत नए ऊजाा खपत मानकों को अजधसूजचत नहीं दकया जाता है, मौजूदा मानकों को तब तक र्ैध माना जाएगा जब तक दक केंद्र सरकार द्वारा इसके जलए नए मूल्यों को अजधसूजचत नहीं दकया जाता है;

(ङ) “अनुज्ञा-पत्र धारी“ से एक व्यजि या एजेंसी अजभप्रेत ह ै जजसे जर्जनयम 7 के तहत लेबल जचपकाने की अनुमजत दी गई ह;ै (च) “अनुसूची“ से इन जर्जनयमों स ेजुड़ी अनुसूची अजभप्रेत है; (छ) “लाइट कमर्शियल एयर कंडीिनर“ से अजधजनयम की धारा 14 के खंड (ख) के तहत अजधसूचना में जर्जनर्ददष्ट रूम एयर कंडीिनर अजभप्रेत ह।ै इसमें लाइट कमर्शियल एयर कंडीिनर िाजमल ह ैंजजनकी रेटेड क्षमता 10,500 र्ाट से ऊपर ह ैऔर जजसमें 18,000 र्ाट तक और िाजमल है;

(ज) “स्ट्टार रेटटग या स्ट्टार लेर्ल“ से अजधजनयम की धारा 14 के खंड (क) के तहत केंद्र सरकार द्वारा अजधसूजचत ऊजा ा खपत मानकों के आधार पर लाइट कमर्शियल एयर कंडीिनर के लेबल पर प्रदर्शित ऊजाा दक्षता का ग्रेड अजभप्रेत है;

(झ) दकसी लाइट कमर्शियल एयर कंडीिनर के संबंध में “व्यापारी या जर्क्रेता“ से एक ऐसा व्यजि अजभप्रेत ह ैजो ऐसे लाइट कमर्शियल एयर कंडीिनर को बेचता या जर्तठरत करता है और इसमें दकु ानदार, व्यापारी, जनमाता ा और अनुज्ञा प्राि व्यजि िाजमल ह ैंजजन्ह ेंऐसे एयर कंडीिनर पर लेबल जचपकाने की अनुमजत दी गई ह।ै

(2) यहााँ पर प्रयुि िब्दों और अजभव्यजियों और गैर पठरभाजषत िब्दों से, लेदकन अजधजनयम म ें पठरभाजषत दकये गये से अजभप्रेत ह ैजजनके अथा क्रमिैः अजधजनयम में ददए गए ह।ैं

3. लेबल पर प्रदर्शित दकए जान े र्ाल े जर्र्रण - (1) प्रत्येक लाइट कमर्शियल एयर कंडीिनर पर, जनम्नजलजखत जर्र्रण एर्ं जर्जिजष्टयााँ उसके लेबल पर संप्रदर्शित की जाएंगी, अथाात्ैः - (क) स्ट्टार लेबल; (ख) भारतीय मौसमी ऊजाा दक्षता अनुपात;

(ग) लेबल र्ैधता की अर्जध; (घ) एयर कंडीिनर के उपकरण/प्रकार; (ङ) जर्जनमााता या आयातकताा का नाम और ब्ांड; (च) मॉडल तथा जर्जनमााण या आयात का र्षा;[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 (छ) िीतलन क्षमता (ित प्रजतित) र्ाट में ;

(ज) िीतलन क्षमता (पचास प्रजतित) र्ाट म;ें (झ) ऊजाा खपत यूजनट प्रजत र्षा में; (ञ) कंप्रेसर टाइप; (ट) ऊजाा दक्षता ब्यूरो का लोगो; (ठ) उपकरण का नाम; (ड) यूजनक श्ृंखला कोड;

(2) जडज़ाइन, रंग, आकार और लेबल की अंतर्ास्ट्तु र्ह होगी जो इन जर्जनयमों से उपाबद्ध अनुसूची में जर्जनर्ददष् ट ह।ै

4. लेबल प्रदर्शित करन ेकी समय सीमा –

(1) .- जर्जनयम 3 में जर्जनर्ददष्ट सभी जर्र्रणों र्ाला एक लेबल इन जर्जनयमों के लागू होने की तारीख से छह महीने की अर्जध के भीतर प्रत्येक लाइट कमर्शियल एयर कंडीिनर पर संप्रदर्शित दकया जाएगा।

(2) खप .- उपकरण के जलए अजधजनयम की धारा 14 के खंड (क) के तहत केंद्र सरकार द्वारा अजधसूजचत संिोजधत ऊजाा खपत मानकों के िुरू होने पर, प्रत्येक अनुमती या व्यापारी या जर्क्रेता यह सुजनजित करेगा दक- (क) जबक्री पर रखे गये लाइट कमर्शियल एयर कंडीिनर में संिोजधत स्ट्टार लेर्ल और संिोजधत लेबल अर्जध को संिोजधत ऊजाा खपत मानकों के साथ वसक्रनाइज़ दकया जाएगा और जर्जनमााण र्षा या लाइट कमर्शियल एयर कंडीिनर का आयात र्षा भी इस तरह के संिोजधत ऊजाा खपत मानकों के साथ वसक्रनाइज़ दकया जाएगाैः बिते दक सुचारू पारगमन के जलए, जनमााता संिोजधत ऊजाा प्रदिान मानकों के साथ, ऐसे प्रारंभ की तारीख से दो महीन े पहले उत्पाद का उत्पादन या आयात कर सकता है;

(ख) डीलरों, खुदरा जर्क्रेताओं और उपभोिाओं की जागरूकता, उनकी जिक्षा के जलए अपेजक्षत प्रचार सजहत सभी प्रारंजभक कदम सुजनयोजजत होंगे और इन जर्जनयमों के तहत ऐसे प्रारंभ की तारीख से तीन महीने पहले उठाए जाएंगे।

5. लेबल प्रदर्शित करन े की रीजत - (1) प्रत्येक जनमाता ा, जर्क्रेता या व्यापारी प्रत्येक लाइट कमर्शियल एयर कंडीिनर पर जर्क्रय के समय एक लेबल संप्रदर्शित करेगा और ऐसा लेबल उस पर संप्रदिा फ्रंट पर लटकते हुए टैग (वस्ट्र्ग टैग) के रूप में जचपकाया या संलग्न दकया जाएगा।

(2) जो यूजनटें संप्रदिान नहीं कर रही हैं, र्हााँ लेबल को लाइट कमर्शियल एयर कंडीिनर की मंजूषा या आर्रण के बाहरी भाग पर संलग्न दकया जा सकेगा और यूजनट में तभी संलग्न दकया जा सकेगा जब उसकी पैकेवजग से यूजनट को हटा ददया गया हो या लेबल को उपभोिा या उपभोिा को ददए गए प्रलेखनों (दस्ट्तार्ेजों) के भाग के रूप में सजममजलत दकया गया हो।

6. लेबल प्रदर्शित करन े की अनमु जत - (1) ब्यूरो की पूर्ा अनुमजत प्राि दकए जबना दकसी लाइट कमर्शियल एयर कंडीिनर पर कोई स्ट्टार लेबल नहीं लगाया जाएगा।

(2) कंपनी पजं ीकरणैः - ब्यूरो की अनुमजत प्राि करने के प्रयोजनों हेतू, प्रत्येक ब्ांड को जैसा दक फॉमा । - (क) में जनर्ददष्ट के रूप में अलग से पंजीकृत दकया जाएगा, जजसमें एक लाख रुपये का लेबल सुरक्षा िुल्क होगा, जो भुगतान के दकसी भी स्ट्र्ीकाया इलेक्रॉजनक मोड द्वारा देय होगाैः परन्तु लघु उद्योग के मामले में लेबल सुरक्षा िुल्क केर्ल पच्चीस हजार रुपये होगा।

(3) मॉडल पंजीकरणैः- उप-जर्जनयम (2) के तहत अनुमती के प्रत्येक आर्ेदन के साथ-साथ जनम्नजलजखत होंगे - (क) प्रजत मॉडल दो हजार रुपये का आर्ेदन िुल्क, जो भुगतान के दकसी भी स्ट्र्ीकाया इलेक्रॉजनक मोड द्वारा दये है; और ; तथा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) फॉमा I - (ख) में जनर्ददष्ट दस्ट्तार्ेज।

7. अनमु जत प्रदान करनाैः - (1) जर्जनयम 6 के तहत एक आर्ेदन प्राि होने पर और संतजु ष्ट होने के बाद दक सभी अजनर्ायता ाओं का अनुपालन दकया गया है, ब्यूरो मानकों और लेबवलग पर अपने मैनुअल में जनर्ददष्ट अर्जध के भीतर, जर्जनयम 8 में जनर्ददष्ट ऐसे जनयमों और ितों के अधीन हो सकता ह ै- (क) ब्ांड को फॉमा II- (क) या इलेक्रॉजनक रूप में पंजीकृत करें; तथा (ख) फॉमा II- (ख) या इलेक्रॉजनक रूप में लाइट कमर्शियल एयर कंडीिनर पर लेबल लगाने की अनुमजत प्रदान करना।

(2) ब्यूरो प्रपत्र III में जनर्ददष्ट एक रजजस्ट्टर बनायेगा और उसमें अनुमती का नाम दजा करेगा।

(3) उप-जर्जनयम (1) के तहत दी गई अनुमजत उस अर्जध के जलए र्ैध होगी, जजसके जलए धारा 14 के खंड (क) के तहत केंद्र सरकार द्वारा अजधसूजचत ऊजाा खपत मानक द्वारा जनर्ददष्ट स्ट्टार स्ट्तर लागू है।

(4) स्ट्टार रेटटग योजना के संिोधन के मामले में, अनुमजत के नर्ीनीकरण के जलए आर्ेदन अनुमती द्वारा छह महीने के जलए दकया जाएगा लेदकन इसकी समाजि से तीन महीने पहले नहीं दकया जाएगा और ऊजाा दक्षता ब्यूरो, नई ददल्ली के पक्ष म ें इलेक्रॉजनक मोड में दये एक हजार रुपये के िुल्क के साथ होगा। बिते, स्ट्टार रेटटग योजना के जर्स्ट्तार के मामले में, एक हजार रुपये के उि नर्ीनीकरण िुल्क से छूट दी जाएगी।

(5) उप-जर्जनयम (4) के तहत नर्ीनीकरण के जलए आर्ेदन प्राि होने पर और संतुष्ट होने के बाद दक सभी अजनर्ायाताओं का अनुपालन दकया जाता है, ब्यूरो, ऐसी प्राजि की तारीख से एक महीने की अर्जध के भीतर, फॉमा II - (ख) में अनुमजत का नर्ीनीकरण कर सकता ह।ै

(6) र्ैधता अर्जध की समाजि के बाद दकसी भी आर्ेदन का नर्ीनीकरण नहीं दकया जाएगा, जजस जस्ट्थजत में अनुमती नया आर्ेदन कर सकता है।

(7) ऐसा अनुज्ञा-पत्र धारी (परजमटी) जो उस तारीख स ेलाइट कमर्शियल एयर कंडीिनर के मौजूदा मॉडल पर लेबल जचपकाने के जलए अनुमजत चाहता ह,ै जजस तारीख से संिोजधत स्ट्टार स्ट्तर लागू होता है, र्ह फॉमा iv के अनुसार एक घोषणा प्रस्ट्तुत करेगा।

(8) अनुज्ञा-पत्र धारी (परजमटी) नए जसरे से लेबल लगाने के जलए अनुमजत लेने का प्रयास करेगा, यदद लाइट कमर्शियल एयर कंडीिनर का एक नया मॉडल संिोजधत स्ट्टार स्ट्तर के साथ वसक्रनाइज़ दकया जाना है, और ऐसी अनुमजत के जलए आर्ेदन संिोजधत स्ट्टार स्ट्तर के लागू होने के छह महीने पहले दकया जाएगा।

8. लेबल पर जर्जिजष्टयों को संप्रदर्शित करने के जलए जनयम और ितें :- प्रत्येक अनुज्ञा-पत्र धारी (परजमटी), जर्क्रेता या व्यापारी लेबल पर जर्र्रण संप्रदर्शित करने में जनम्नजलजखत जनयमों और ितों का पालन करेगा, अथाात्ैः - (क) लाइट कमर्शियल एयर कंडीिनर के लेबल पर संप्रदर्शित स्ट्टार लेर्ल अजधजनयम की धारा 14 के खंड (क) के तहत अजधसूजचत ऊजाा खपत मानकों के अनुरूप होगा;

(ख) लेबल केर्ल लाइट कमर्शियल एयर कंडीिनर के ऐसे मॉडल पर जचपकाया जाएगा जजसके जलए अनुज्ञा की मंजूरी दी गई है; (ग) अनुज्ञा-पत्र धारी (परजमटी) अपनी लागत पर लेबल को मुदद्रत करेगा और लाइट कमर्शियल एयर कंडीिनर पर जचपकाएगा;

(घ) लाइट कमर्शियल एयर कंडीिनर के लेबल पर संप्रदर्शित स्ट्टार लेर्ल हर समय अनुरजक्षत रखा जाएगा; (ङ) आर्ेदक जर्जनयम 9 में यथाजर्जनर्ददष्ट लेबल िुल्क का संदाय करेगा;[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5 (च) लेबलीकृत उपस्ट्कर के उत्पादन के ब्यौरों से अंतर्शर्ष्ट एक जर्र्रण और जर्त्तीय र्षा की प्रत्येक जतमाही के आगामी समापन माह के भीतर प्रत्येक जतमाही के जलए दये उद्भूत िुल्क ब्यूरो को प्रस्ट्तुत दकया जाएगा;

(छ) प्रत्येक र्षा अप्रैल माह के 30र्ें ददन तक अपने लेबल र्ाले उत्पादों को बेचने के जलए जनयुि अजधकृत जर्तरकों, डीलरों, खुदरा जर्क्रेताओं और जर्क्रेताओं की एक अद्यतन सूची ब्यूरो को प्रस्ट्तुत की जाएगी; (ज) ऐसे अन्य जनबंधनों और ितों का अनुपालन दकया जाएगा जजन्ह ें ब्यूरो मानकों और लेबवलग पर ब्यूरो के प्रचालन मैनुअल में जनजहत जनयमों सजहत जर्र्शनददष्ट करेगा।

9. लेबल िल्ु कैः - (1) प्रत्येक अनुज्ञा-पत्र धारी ब्यूरो को लाइट कमर्शियल एयर कंडीिनर पर इस प्रकार जचपकाए गए लेबल पर तीस रुपये की लेबल फीस का संदाय करेगा।

(2) उप-जर्जनयमन (1) के तहत जर्जनर्ददष्ट लेबल फीस प्रत्येक जर्त्तीय र्षा की अंजतम तारीख से एक महीने के भीतर र्ार्शषक रूप से संदाय की जाऐगीैः परन्तु इस प्रकार जर्जनर्ददष्ट अर्जध के भीतर लेबल िुल्क का संदाय करने में जर्फल रहने पर जर्जनयमन 6 के उप-जर्जनयमन

(2) के अधीन ब्यूरो लेबल प्रजतभूजत िुल्क उस पर दस प्रजतित की दर से ब्याज सजहत संदत्त िोध रकम र्सूल कर सकेगा और यदद भुगतान की अंजतम जतजथ के एक र्षा के भीतर लेबवलग िुल्क की कुल राजि की र्सूली नहीं की जाती है, तो ब्यूरो अनुज्ञा-पत्र धारी को ददए गए सभी लेबलों को रद्द कर सकता ह ै और समाचार पत्रों म ें जडफॉल्टर के रूप में अनुमती का नाम प्रकाजित कर सकता ह।ै

10. लेबल प्रजतभजू त फीस का प्रजतदायैः - जर्जनयमन 9 के उप-जर्जनयमन (2) के परंतुक के अधीन, अनुज्ञा-पत्र धारी लाइट कमर्शियल एयर कंडीिनर का जनमााण बंद करने पर लेबल प्रजतभूजत िुल्क के संदाय का हकदार होगा।

11. ब्यूरो द्वारा सत्यापन - (1) ब्यूरो स्ट्र्प्रेरणा और स्ट्र्तैः संज्ञान से या प्राि दकसी जिकायत पर यह सुजनजित करने के जलए सत्यापन करेगा दक लाइट कमर्शियल एयर कंडीिनर स्ट्टार लेर्ल और उसके लेबल पर संप्रदर्शित अन्य जर्जिजष्टयों के अनुरूप और दक अनुज्ञा (परमीिन) के अन्य जनबंधनों और ितों का अनुपालन करता ह।ै जबजली की खपत, क्षमता परीक्षण, पार्र फैक्टर और अजधकतम पठरचालन जस्ट्थजत परीक्षण सजहत सभी परीक्षण ब्यूरो द्वारा या इसकी नाजमत एजेंसी के माध्यम से सत्यापन और चुनौती परीक्षण के उद्देश्य से थैलेपी जर्जध या कैलोरीमीटर का उपयोग करके आयोजजत दकए जाएंगे।

(2) सत्यापन के प्रयोजन के जलए, नमूने को ब्यूरो या इसकी नाजमत एजेंसी द्वारा जर्जनमााण सुजर्धा, गोदाम या खुदरा आउटलेट से यादजृछछक रूप से उठाया जाएगा जैसा र्ह उजचत समझता ह।ै

(3) जहााँ, उप-जर्जनयम (1) के तहत प्राि की गयी जिकायत पर, ब्यूरो को परीक्षण और अंिांकन (केलीब्ेिन) प्रयोगिालाओं के जलए राष्ट्रीय प्रत्यायन बोडा द्वारा जर्जधर्त मान्यता प्राि एक स्ट्र्तंत्र प्रयोगिाला में लाइट कमर्शियल एयर कंडीिनर का परीक्षण करके सत्यापन करना अपेजक्षत ओर आर्श्यक है, र्हााँ इस तरह के परीक्षण करने के जलए फॉमा ट में समनुदजे िती को एक सूचना (नोठटस) जारी की जाएगी और जिकायतकताा को नमूना लागत, परीक्षण, पठरर्हन और अन्य आनुषंजगक व्यय एर्ं खचों से संबंजधत जो ब्यूरो द्वारा अजग्रम में अर्धाठरत दकये जाएं, ऐसे खचा को ब्यूरो के पास जमा करने के जलए कहा जाएगा, जैसे दक ब्यूरो द्वारा जनधााठरत दकया जा सकता ह।ै यदद चुनौती परीक्षण के तहत जलया गया नमूना जर्फल हो जाता ह,ै तो जर्जनर्ददष्ट सभी खचों की प्रजतपूर्शत अनुज्ञा-पत्र धारी (परजमटी) द्वारा ब्यूरो को की जाएगी और ब्यूरो जिकायतकताा को उपरोि खचा र्ापस कर दगे ा; और जहााँ उपकरण चुनौती परीक्षण पास करता है, तो जिकायतकताा द्वारा जमा दकए गए खचा को जब्त कर जलया जाएगा।

(4) जहााँ परीक्षण के जलए उपयोग दकए जाने र्ाले लाइट कमर्शियल एयर कंडीिनर का एक नमूना स्ट्र्तैः परीक्षण या चुनौती परीक्षण के दौरान परीक्षण में जर्फल रहता है, ब्यूरो अनुज्ञा-पत्र धारी (परजमटी) को एक और अर्सर प्रदान करेगा और पहले परीक्षण में इस्ट्तेमाल दकए गए लाइट कमर्शियल एयर कंडीिनर की दोगुनी मात्रा के साथ दसू रा परीक्षण को संचाजलत करेगा। यह जांच-परीक्षण, एक स्ट्र्तंत्र परीक्षण प्रयोगिाला में होगा, जो उस प्रयोगिाला से अलग होगा जहााँ पहला जााँच परीक्षण दकया गया था और अनुज्ञा-पत्र धारी (परजमटी) की कीमत पर परीक्षण और अंिांकन प्रयोगिालाओं के जलए राष्ट्रीय प्रत्यायन बोडा द्वारा जर्जधर्त मान्य होगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(5) ब्यूरो उप-जर्जनयमन (3) या उप-जर्जनयमन (4) में उजल्लजखत दसू रे परीक्षण और नमूने की खरीद और परीक्षण के जलए दकए जाने र्ाले खचों को दखे ने के जलए फॉमा v में अनुमजत प्राि व्यजि को सूजचत करेगा।

(6) जहााँ पर, अनुज्ञा-पत्र धारी (परजमटी) ऐसे खचा करने में जर्फल रहता है, र्हां ब्यूरो - (क) उप-जर्जनयम (3) में संदर्शभत चुनौती परीक्षण या उप-जर्जनयम (4) में संदर्शभत दसू रे परीक्षण द्वारा सत्यापन जारी रखेगा;

(ख) जर्जनयम 6 के तहत प्राि आर्ेदन की आगे की प्रदक्रया को रोकेगा; (ग) फॉमा V के जारी होने की तारीख से छह महीने के बाद, जर्जनयम 7 के तहत अनुज्ञा-पत्र धारी (परजमटी) को ददए गए सभी लेबल रद्द कर देगा।

(7) जहााँ पर दसू रा परीक्षण जर्फल हो जाता है, ब्यूरो करेगा - (क) सभी राज्य नाजमत एजेंजसयों को सूचना के तहत फॉमा vi में अनज्ञु ा-पत्र धारी (परजमटी) को जनदिे दगे ा दक दो महीने की अर्जध के भीतर अनुज्ञापत्र धारी -

(i) लाइट कमर्शियल एयर कंडीिनर के लेबल पर संप्रदर्शित स्ट्टार लेर्ल को िुद्ध एर्ं ठीक करेगा या परीक्षण के दौरान पाई गई कजमयों और त्रुठटयों को दरू करेगा;

(ii) ब्यूरो के जनदिे ों का पालन करने के जलए बाजार से सभी स्ट्टॉक र्ापस लेगा; और

(iii) जर्ज्ञापन सामग्री पर संप्रदर्शित जर्र्रणों को बदलन देगा और जर्जिजष्टयों में पठरर्तान करेगा। (ख) उपभोिाओं के लाभ के जलए, दकसी भी राष्ट्रीय या क्षेत्रीय दजै नक समाचार पत्र में दकसी भी अनज्ञु ा-पत्र धारी, ब्ांड नाम, मॉडल नाम या मॉडल नंबर, लोगो और अन्य जर्जनदिे का नाम और दकसी भी इलेक्रॉजनक या दकसी अन्य तरीके से प्रकाजित करेगा, जैसा दक यह दो महीने के भीतर उजचत समझता है;

(ग) संबंजधत राज्य नाजमत एजेंसी को अजधजनयम की धारा 27 के तहत अनुज्ञा-पत्र धारी (परजमटी) और व्यापारी के जखलाफ न्याजयक कायार्ाही िुरू करने के जलए सूजचत करेगा।

(8) अनुज्ञा-पत्र धारी (परजमटी), उप-जर्जनयम (7) में जनर्ददष्ट दो माह की अर्जध के समापन के दस ददनों के भीतर, जनदिे के अनुपालन में की गई कारार्ाई के संबंध में प्रपत्र vii में अनुपालन ठरपोटा ब्यूरो को भेजेगा।

(9) यदद उप-जर्जनयमन (8) में जनर्ददष्ट अनुपालन ठरपोटा जनर्ददष्ट अर्जध के भीतर दकसी भी जनदिे का पालन दकए जबना प्राि या प्राि नहीं की जाती है, तो यह समझा जाएगा दक जारी दकए गए जनदिे का अनुपालन नहीं दकया गया ह ैऔर ब्यूरो उस प्रभार् का आदिे दगे ा।

(10) ब्यूरो उप-जर्जनयमन (8) में जनर्ददष्ट अनुपालन ठरपोटा और उप-जर्जनयमन (9) में पाठरत आदिे ों को धारा 17 के तहत कारार्ाई करने और उप-जर्जनयमन (9) के तहत पाठरत आदिे के प्रर्तान के उद्देश्य से सभी राज्य नाजमत एजेंजसयों को भेजेगा।

(11) जहााँ पर अनुज्ञा-पत्र धारी (परजमटी) उप-जर्जनयम (7) के तहत ब्यूरो द्वारा जारी जनदिे ों का पालन करने में जर्फल रहता है, ब्यूरो करेगा, - (क) जर्जनयम 7 के उप-जर्जनयम (1) के तहत अनुज्ञापी (परजमटी) को दी गई अनुमजत को र्ापस लेगा;

(ख) केंद्र सरकार को धारा 14 के खंड (क) के तहत केंद्र सरकार द्वारा अजधसूजचत ऊजाा खपत मानकों के अनुरूप अनुज्ञा- पत्र धारी (परजमटी) द्वारा जर्फलता के समथान में परीक्षण ठरपोटा के साथ ब्यूरो द्वारा जारी आदिे खंड (क) के तहत जर्चार के जलए और धारा 14 के खंड (ग) के तहत केंद्र सरकार द्वारा कारार्ाई करने के जलए केंद्र सरकार को एक ठरपोटा भेजेगा;[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 7 (ग) उपभोिाओं के लाभ के जलए, दकसी भी राष्ट्रीय या क्षेत्रीय दजै नक समाचार पत्र में और दकसी भी इलेक्रॉजनक या दकसी अन्य तरीके से दकसी भी परजमट के नाम, ब्ांड नाम, मॉडल नाम या मॉडल नंबर, लोगो और अन्य जर्जनदिे प्रकाजित करेगा जैसा दक यह दो महीने के भीतर उजचत समझता है;

(घ) संबंजधत राज्य नाजमत एजेंजसयों को अजधजनयम की धारा 27 के तहत अनुज्ञा-पत्र धारी और व्यापारी के जखलाफ आगे की न्याजयक कायार्ाही िुरू करने के जलए सूजचत करेगा।

12. अनज्ञु ा का जनरस्ट्त ीकरण : - ब्यूरो जर्जनयम 7 के तहत दी गई मंजूर की गयी अनुज्ञा या अनुमोदन को रद्द कर सकता है, यदद अनुज्ञापी- (क) जर्जनयमन 8 के तहत जर्जनर्ददष्ट दकसी भी जनबंधन और ितों का अनुपालन करने में जर्फल रहता है;

1. ब्यूरो आपको इस पत्र के अनुबंध में ददए गए अनुमोदनों के जर्र्रण के अनुसार अपने ब्ांड को पंजीकृत करने की अनुमजत दते ा ह।ै

2. यह अनुमजत जनम्नजलजखत के अधीन है- (क) लाइट कमर्शियल एयर कंडीिनर के लेबल पर संप्रदर्शित स्ट्टार लेर्ल अजधजनयम की धारा 14 के खंड (क) और पूर्ोि जर्जनयमों में प्रदान दकए गए जनयमों और ितों के तहत अजधसूजचत लाइट कमर्शियल एयर कंडीिनर के जलए ऊजाा खपत मानकों के अनुरूप होगा;

(ख) केर्ल लाइट कमर्शियल एयर कंडीिनर के ऐसे मॉडल पर लेबल जचपकाना जजसके जलए अनुमजत दी गई है; (ग) अनुज्ञा-पत्र धारी की लागत पर लाइट कमर्शियल एयर कंडीिनर पर लेबल की छपाई की जाएगी और इसे जचपकाया जाएगा; (घ) अनुज्ञा-पत्र धारी यह सुजनजित करता ह ै दक लाइट कमर्शियल एयर कंडीिनर पर संप्रदर्शित स्ट्टार लेर्ल हर समय अनुरजक्षत रखा जाएगा;

(ड.) अनुज्ञा-पत्र धारी ब्यूरो द्वारा जर्जनर्ददष्ट लेबल िुल्क संदाय करेगा ; (च) अनुज्ञा-पत्र धारी जर्त्तीय र्षा की प्रत्येक जतमाही के अंत में आगामी मास के भीतर प्रत्येक जतमाही के जलए लेबलीकृत उपस्ट्कर के उत्पादन के ब्योरों का एक जर्र्रण ब्यूरो को प्रस्ट्तुत करेगा। र्ही ब्यौरे ब्यूरो को एक स्ट्र्चाजलत प्रणाली के माध्यम से भी प्रस्ट्तुत दकए जाएंगे;

(छ) अनुज्ञा-पत्र धारी लाइट कमर्शियल एयर कंडीिनर के ऐसे अन्य जर्र्रण उपलब्ध कराएगा जैसा और जब ब्यूरो चाहगे ा, जजसके जलए अनुज्ञा को मंजूरी दी गई है।

3. अनुज्ञा-पत्र धारी, ब्यूरो के पूर्ाानुमोदन के जबना, अनुज्ञा की जर्जधमान्य अर्जध के दौरान बाजार से पंजीकृत ब्ांड और लाइट कमर्शियल एयर कंडीिनर को र्ापस नहीं लेगा।

NOTIFICATION New Delhi, the 24 August, 2022 No. BEE/S&L/LCAC/37/2022-23.- In exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of

2001), the Bureau of Energy Efficiency (the Bureau) with the previous approval of the Central Government, proposes to notify the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Light Commercial Air Conditioners) Regulations, 2022, the proposed draft regulations are hereby published in the Gazette of India, Extraordinary, as required by sub-section (1) of section 58 of the said Act, for the information of all the persons likely to be affected thereby and inviting their suggestions and objections (if any); and the notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date of their publication in the Gazette of India, Extraordinary;

Objections or suggestions, if any, may be addressed to the Director-General, of Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, North Wing, Sector-1, R.K. Puram, New Delhi-110066 and may also be sent at the e-mail of the Bureau at dg-bee@nic.in;

Objections or suggestions which may be received from the persons with respect to the said draft regulations before the expiry of the period of thirty days specified in para 1 above, shall be taken into consideration by the Bureau of Energy Efficiency.

Draft Regulations28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

1. Short title and commencement.– (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Light Commercial Air Conditioners) Regulations, 2022.

2. Definitions.- (1) In these regulations, unless the context otherwise requires,-

(a) ―Act‖ means the Energy Conservation Act, 2001(52 of 2001);

(b) ―Form‖ means a form appended to these regulations;

(c) ―label‖ means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the light commercial air conditioner;

(d) ―label period‖ means the validity period of the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, by the ending timeline of the label validity period, the new energy consumption standards under section 14 (a) of the Act are not notified, the existing standards shall deemed to be valid until new values for the same are notified by the Central Government;

(e) ―permittee‖ means a person or agency to whom permission has been granted to affix label under regulation 7;

(f) ―Schedule‖ means the schedule annexed to these regulations;

(g) ―Light Commercial Air Conditioners‖ means room air conditioner specified in the notification under clause (b) of section 14 of the Act. It covers light commercial air conditioner having rated capacity above 10,500 Watts up to and including 18,000 Watts;

(h) ―Star rating or Star level‖ means the grade of energy efficiency displayed on the label of the light commercial air conditioner based on energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act;

(i) ―trader or seller‖ in relation to any light commercial air conditioner means a person who sells or distributes such light commercial air conditioner and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such air conditioner.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label.- (1) On every light commercial air conditioner, the following particulars shall be displayed on its label, namely:-

(a) Star level;

(b) Indian Seasonal Energy Efficiency Ratio;

(c) Label validity period;

(d) Appliance/type of air conditioner;

(e) the name of manufacturer or importer and brand;

(f) Model/year of manufacturing or import;

(g) cooling capacity (hundred per cent.) in Watts;

(h) cooling capacity (fifty per cent.) in Watts;

(i) Electricity Consumption in units per year;

(j) Compressor Type;

(l) name of appliance;

(m) unique series code;

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.-

(1) Transition from Voluntary to Mandatory Regime.- A label containing all the particulars specified in regulation 3 shall be displayed on every light commercial air conditioner within a period of six months from the date of coming into force of these regulations.

(2) Revision of Mandatory Energy Consumption Standards.- On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act for the appliance, every permittee or trader or seller shall ensure that-

(a) the light commercial air conditioner put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year or importing year of the light commercial air conditioner shall also be in synchronization with such

revised energy consumption standards:

Provided that for smooth transition, manufacturer may produce or import the product two month in advance from the date of such commencement, with the revised energy performance standards;

(b) all preparatory steps including awareness of the dealers, retailers and consumers, requisite publicity for their education shall be well planned and taken three months in advance of the date of such commencement, under these regulations.

5. Manner of display of label.- (1) Every manufacturer, seller or trader shall display on every light commercial air conditioner a label at the time of sale and the label shall be either adhere to, or be attached as a swing tag, on it.

(2) For units not on display, the label may be attached to the exterior of the casing of the light commercial air conditioner and the label may be attached to the unit when the unit is removed from its packaging or the label may be included as a part of the documentation given to the customer or user.

6. Permission for display of label.- (1) No star label shall be affixed on a light commercial air conditioner without obtaining the prior permission of the Bureau.

(2) Company registration.- For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees,

payable by any acceptable electronic mode of payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only.

(3) Model registration.- Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by any acceptable electronic mode of payment; and

(b) documents specified in Form I – (B).

7. Grant of permission. - (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its Manual on standards and labeling, subject to such terms and conditions as specified in regulation 8, –

(a) register the brand in Form II-(A) or in electronic form; and

(b) grant permission for affixing label on light commercial air conditioner in Form II-(B) or in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of permittee therein.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) The permission granted under sub-regulation (1) shall be valid for the duration for which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of

section 14 is in force.

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee from six months but not later than three months before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

Provided, in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.

(5) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II – (B).

(6) No application shall be renewed after expiry of validity period, in which case the permittee may make a fresh application.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the light commercial air conditioner from the date from which the revised star level comes into force shall submit a declaration according to Form IV.

(8) The permittee shall seek permission to affix a label afresh, if a new model of the light commercial air conditioner is to be launched synchronizing with the revised star level, and application for such permission shall be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, seller or trader shall comply with the following terms and conditions in displaying the particulars on label, namely:—

(a) the star level displayed on the label of the light commercial air conditioner shall conform to energy consumption standards notified under clause (a) section 14 of the Act;

(b) the label shall be affixed only on such model of light commercial air conditioner for which permission has been granted;

(c) the label shall be printed and affixed on the light commercial air conditioner at the cost of the permittee;

(d) star level displayed on the label of light commercial air conditioner shall be maintained at all time;

(e) pay the label fee as specified in regulation;

(f) furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers and sellers appointed to sell their labelled products by 30th day of April of each year;

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Operation Manual on Standards and Labelling.

9. Label fee. - (1) Every permittee shall pay to the Bureau a label fee of rupees thirty on each label affixed on the light commercial air conditioner.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date

of closure of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security fee made under sub-regulation (2)[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 31 of regulation 6 and if the total amount of labeling fee is not recovered within one year of the last date of payment, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of label security deposit. - Subject to the proviso to sub-regulation (2) of regulation 9, a permittee shall be entitled to refund of the label security fee on ceasing to manufacture light commercial air conditioner.

11. Verification by Bureau.- (1) The Bureau may, either suo motu, or on a complaint received by it, carry out verification to ensure that the light commercial air conditioner conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission. All tests including the power consumption, capacity tests, power factor and maximum operating condition tests shall be conducted by the Bureau or through its designated agency using enthalpy method or calorimeter for the purpose of verification and challenge testing.

(2) For the purpose of verification, the samples shall be picked up at random by the Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the light commercial air conditioner in an independent laboratory duly accredited by the National Accreditation Board for Testing and Calibration Laboratories, and a notice shall be issued to the permittee in Form V for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to sample cost, testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau. If the sample drawn under challenge testing fails, all expenses as specified shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then the expenses deposited by the complainant shall be forfeited.

(4) Where a sample of light commercial air conditioner used for testing fails the test during suo motu testing or challenge testing, the Bureau shall offer the permittee another opportunity and conduct a second test with twice the quantity of light commercial air conditioner used in the first test, in an independent test laboratory which is different from the lab where the first check testing was conducted and shall be duly accredited by the National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee.

(5) The Bureau shall intimate the permittee in Form V to witness the challenge testing referred to in sub- regulation (3) or the second test referred to in sub-regulation (4) and the expenses to be made towards the procurement and testing of sample.

(6) Where, the permittee fails to make such expenses, the Bureau shall -

(a) continue the verification by challenge testing referred to in sub-regulation (3) or the second test referred to in sub-regulation (4);

(b) stop further processing of application received under regulation 6;

(c) cancel all the labels granted to the permittee under regulation 7, after six months from the date of issuance of Form V.

(7) Where the second test fails, the Bureau shall -

(a) direct the permittee in Form VI, under intimation to all the State designated agencies, that the permittee within a period of two months shall,-

(i) correct the star level displayed on the label of the light commercial air conditioner or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau;

(iii) change the particulars displayed on advertising material.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months;

(c) intimate to the concerned State designated agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(8) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub- regulation (7) send the compliance report in Form VII to the Bureau with respect to action taken in compliance with the direction.

(9) If the compliance report referred to in sub-regulation (8) is not received or received without complying to any of the direction within the specified period, it shall be deemed to have been not complied with the direction issued and the Bureau shall order to that effect.

(10) The Bureau shall send the compliance report referred to in sub-regulation (8) and orders passed in sub- regulation (9) to all the State designated agencies for the purpose of taking action under section 17 and enforcement of order passed under the sub-regulation (9).

(11) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (7), the Bureau shall,-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send a report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14, the orders issued by the Bureau under clause (a) for consideration and for taking action by the Central Government under clause (c) of section 14;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months;

(d) intimate to the concerned State designated agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission. - The Bureau may cancel the permission granted under regulation 7, if the permittee,-

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(c) fails to comply with the directions issued under regulation 11.

The Bureau, under regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Light Commercial Air Conditioner) Regulations, 2022, had purchased a Bureau of Energy Efficiency star labelled light commercial air conditioner from your authorized distributor/dealer/retailer vide Invoice number .......dated…….. for a price of Rs................ and lifted as a sample dated by for the purpose of suo motu testing or challenge testing. (ii) deposit such cost towards procurement, transportation, testing and other incidental expenses as mentioned in Annexure, within fifteen days from the date of issuance of this letter (the expenses shall be deposited through an electronic mode).

You may note that the Bureau shall continue the verification by challenge test or second test, even if the aforementioned expenses are not made in time or the officials are not nominated as specified and shall take further follow up action in the matter in terms of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Light Commercial Air Conditioner) Regulations,

5. Pursuant to the provisions of clause (a) of sub-regulation (4) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of light commercial air conditioner) Regulations, 2022, you are hereby directed to comply with the following, namely:- • correct the star level displayed on the label of the light commercial air conditioner or remove the defects and deficiencies found during testing;

• withdraw all the stocks from the market to comply with the directions of the Bureau; and • change the particulars displayed on advertising material.

6.You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VII within ten days after the expiry of two months that is, by………………………………………………………………..

7.In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of sub- regulation(5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Light Commercial Air Conditioner) Regulations, 2022.
