2. पठरभार्ा:- (1) आन जवजनयमों म,ें जब तक दक संदभ ा स े ऄन्‍दयथा ऄपेजक्षत न ह ,- (क) "ऄजधजनयम" का ऄथ ा ह ैउजाा सरं क्षण ऄजधजनयम, 2001 (2001 का 52); (ख ) "फॉमा" का ऄथ ा आन जवजनयमों स े जुडा हुअ फॉमा ह;ै (ग) "लेबल" का ऄथ ा ह ै क इ भी जलजखत, मुदरत, जचजननत, मुरांदकत या ग्रादफक सामग्री ज वाशिग मिीन पर जचपकाइ गइ ह ैया ददखाइ दे रही ह;ै (घ) "लेबल ऄवजध" का ऄथ ा ऄजधजनयम की धारा 14 के खंड (क) के तहत केंर सरकार द्वारा ऄजधसूजचत उजा ा प्रदिान मानकों के तहत प्रजत चक्र उजाा खपत प्रजत दकल ग्राम की वैधता ऄवजध ह:ै हालांदक, लेबल की वैधता ऄवजध समाि ह ने तक, यदद ऄजधजनयम की धारा 14(क) के तहत नए उजा ा प्रदिान मानकों क ऄजधसूजचत नहीं दकया जाता ह ै त मौजूदा मानकों क तब तक वैध माना जाएगा जब तक दक केंर सरकार के द्वारा नए मूल्यों क ऄजधसूजचत नहीं दकया जाता ह;ै (ड.) "ऄनुज्ञजिधारक" का ऄथा ईस व्यजि या एजेंसी स े ह ै जजसे जवजनयम 7 के तहत लेबल लगान े की ऄनुमजत दी गइ ह;ै (च) "वॉशिग मिीन" का ऄथ ा ऄजधजनयम की धारा 14 के खडं (ख) के तहत ऄजधसूचना म ें जनर्ददष्ट एक ईपकरण ह;ै (छ) "स्ट्टार रेटटग या स्ट्टार स्ट्तर" का ऄथ ा ऄजधजनयम की धारा 14 के खंड (क) के तहत केंर सरकार द्वारा ऄजधसूजचत प्रजत चक्र उजाा खपत के अधार पर वाशिग मिीन के लेबल पर प्रदर्शित उजाा दक्षता का ग्रडे ह।ै एक स्ट्टार के ऄतं राल म ें ईपलब्ध स्ट्टार कम स े कम एक और ऄजधकतम पांच के मध्य ह।ैं (ज) दकसी भी वाशिग मिीन के संबधं म ें "व्यापारी या जवक्रेता" का ऄथा ईस व्यजि स े ह ै ज ऐसी वाशिग मिीन क बेचता या जवतठरत करता ह ै और आसम ें दकु ानदार, व्यापारी, जनमााता और ऄनज्ञु जिधारक िाजमल ह ैं जजन्‍दह ें ऐसी वाशिग मिीन पर लेबल लगान े की ऄनुमजत दी गइ ह।ै (झ) "ऄनुसूची" का ऄथा आन जवजनयमों स े जुडी ऄनुसूची ह;ै

(2) यहां प्रयुि िब्द और ऄजभव्यजियां पठरभाजर्त नहीं ह ैंपरंतु ऄजधजनयम म ें पठरभाजर्त ह,ैं ईनके ऄथा क्रमिः ऄजधजनयम में जनधााठरत ऄथा म ेंहोंगे।

3. लबे ल पर प्रदर्शित दकए जान े वाल े जववरण - (1) प्रत्येक वाशिग मिीन पर ईसके लेबल पर जनम्नजलजखत जववरण प्रदर्शित दकए जाएगं े ऄथाात:्- (क) स्ट्टार स्ट्तर; (ख) उजाा दक्षता ब्यरू का ल ग ; (ग) ईपकरण का नाम;

(घ) वाशिग मिीन का प्रकार; (ड.) ब्ांड/बनाना; (च) जनमााण या अयात का मॉडल/वर्;ा (छ) भार क्षमता;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 (ज) पानी की खपत; (झ) ऄजद्वतीय लेबल श्ृंखला क ड; (झ) लेबल ऄवजध।

(2) लेबल का जडजाआन, रंग, अकार और सामग्री आन जवजनयमों के साथ संलग्न ऄनुसूची में जनर्ददष्ट ऄनुसार ह गी।

4. लबे लों क प्रदर्शित करन े की समय सीमा—

(1) स्ट्वैजछछक स े ऄजनवाय ा व्यवस्ट्था म ें पठरवतान- आन जनयमों के लागू ह न े की तारीख स े छह महीन े की ऄवजध के ऄंदर प्रत्येक वाशिग मिीन पर जवजनयम 3 म ें जनर्ददष्ट सभी जववरणों वाला एक लेबल प्रदर्शित दकया जाएगा।

(2) ऄजनवाय ा उजाा प्रदिान मानकों का संि धन- ऄजधजनयम की धारा 14 के खंड (क) के तहत केंर सरकार द्वारा ऄजधसूजचत संि जधत उजा ा प्रदिना मानकों के प्रारंभ ह न े पर, प्रत्येक ऄनुज्ञजिधारक या व्यापारी या जवक्रेता- (क) वाशिग मिीन का ईत्पादन जपछले उजाा प्रदिान मानकों के ऄनुसार नहीं ह गा;

(ख) वाशिग मिीन संि जधत स्ट्टार स्ट्तर और संि जधत उजाा खपत मानक के साथ लेबल ऄवजध और संि जधत उजाा प्रदिान मानकों के साथ शसक्रनाआजेिन म ें वाशिग मिीन का जनमााण वर् ा प्रदर्शित करेगी; (ग) डीलरों, खुदरा जवक्रेताओं के बारे म ें सभी अरंजभक ईपाय, ईनकी जिक्षा के साथ-साथ ईपभ िाओं की जागरूकता के जलए अवश्यक प्रचार सजहत सभी प्रारंजभक कदम सुजनय जजत हों और की जाने वाली कारावाइ तीन महीने पहल े की जाती ह।ै

5. लबे ल के प्रदिना का तरीका -

(1) प्रत्येक वाशिग मिीन पर लेबल ह गा ज जबक्री स्ट्थल पर प्रदर्शित दकया जाएगा और ऐसे लेबल क वाशिग मिीन पर जनम्नजलजखत तरीके से जचपकाया जाएगा ऄथाात्: -

(i) लेबल प्रत्येक ईपकरण के सामन े के जडस्ट््ले पर मजबूती स े जचपका ह ना चाजहए और जवजनयम 3 के ईप- जवजनयम (2) म ें संदर्शभत ऄनुसार असानी स े ददखाइ देना चाजहए और ऄनुज्ञजिधारक यह सजु नजित करेगा दक लेबल प्रत्येक पंजीकृत आकाइ या मॉडल के जडस्ट््ल े पर, जबक्री या दकराए के जलए पहचान के ईद्देश्य के जलए ददखाइ दे और लेबल क आकाइ या मॉडल वाले अवरण के बाहरी जहस्ट्स े म ेंभी मुदरत या जचपकाया जाएगा।

(ii) लेबल स्ट्वय ं जचपकन े वाली सामग्री का ह गा। ऄनुसूची के जलए अवश्यक जचनन सुपाठ्य, ऄजमट और ठटकाउ होंगे।

(2) ज आकाआयां प्रदिान के जलए नहीं हैं, ईन पर भी लेबल क मुदरत या अवरण के बाहरी जहस्ट्से में जचपकाया जा सकता है और यह लेबल आकाइ या मॉडल से जुडा ह सकता है जब आकाइ या मॉडल क आसकी पैकेशजग से हटाया जाता ह ैया लेबल क ग्राहक या ईपय गकताा क ददए गए दस्ट्तावेज का एक जहस्ट्से के रूप में िाजमल दकया जा सकता ह।ै

6. लबे ल प्रदर्शित करन े के जलए ऄनमु जत - (1) ब्यूर स े पूवा ऄनुमजत प्राि दकए जबना वाशिग मिीन पर क इ स्ट्टार लेबल नहीं लगाया जाएगा।

(2) कंपनी पजं ीकरण - ईप-जवजनयम (1) के तहत ब्यरू की ऄनमु जत प्राि करन े के प्रय जनों के जलए, पजं ीकरण हते ु फॉम ा 1-क म ें अवदे न, जनर्ददष्ट प्रत्यके ब्ाडं के जलए ऄलग स े दकया जाएगा), जजसके साथ एक लाख रुपय े की राजि लबे ल सरु क्षा जमा के रूप म ेंआलक्े रॉजनक म ड द्वारा दये स्ट्वीकाय ा ह गी:4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] हालांदक लघ ु ईद्य ग के मामल ेम,ें लेबल सुरक्षा िुल्क पच्चीस हजार रुपय ेही ह गा।

(3) मॉडल पंजीकरण - ईप-जवजनयम (2) के तहत ऄनुज्ञजिधारक के प्रत्येक अवेदन के साथ- (क) भगु तान के आलेक्रॉजनक म ड द्वारा दये प्रजत मॉडल द हजार रुपय े का अवेदन िल्ु क; और (ख) भगु तान के आलेक्रॉजनक म ड द्वारा दये एक लाख रुपय ेका लेबल सुरक्षा िुल्क:

हालांदक लघ ु ईद्य ग के मामल ेम ें लेबल सुरक्षा िल्ु क केवल पच्चीस हजार रुपय ेह गा; और (क) फॉम ा1 - (ख) म ेंजनर्ददष्ट दस्ट्तावेज।

7. ऄनमु जत प्रदान करना - (1) जवजनयम 6 के तहत अवदे न प्राि ह ने पर और संतुष्ट ह ने के बाद दक ईसम ें सभी अवश्यकताओं का ऄनपु ालन दकया गया ह,ै ब्यूर ददिा (मानक और लेबशलग पर ब्यरू के संचालन मनै ुऄल) म ें जनर्ददष्ट ऄवजध के ऄंदर ऐसे जनयमों और ितों के ऄधीन जैसा दक जवजनयम 8 म ें जवजनर्ददष्ट ह,ै ऄनुमजत दे सकता ह ै- (क) आलेक्रॉजनक रूप म ें फॉमा 2 - (क) म ें ब्ांड क पंजीकृत करें; और (ख) आलेक्रॉजनक फॉमा म ेंफॉमा 2 -(ख) म ेंवॉशिग मिीन पर लबे ल लगान े की ऄनुमजत द।ें

(2) ब्यूर फॉम ा3 म ें एक रजजस्ट्टर बनाएगा और ईसम ेंऄनुमजत प्रािकत्ताा का नाम दजा करेगा।

(3) ईप-जवजनयम (1) के तहत दी गइ ऄनुमजत ईस ऄवजध के जलए वैध ह गी जब तक दक केंर सरकार द्वारा ऄजधजनयम की धारा 14 के खंड (क) के तहत ऄजधसूजचत उजा ा खपत मानक द्वारा जनर्ददष्ट स्ट्टार स्ट्तर प्रभावी ह ।

(4) स्ट्टार रेटटग य जना के सिं धन के मामले म,ें ऄनुमजत के नवीनीकरण हते ु अवेदन, ऄनुज्ञजिधारक द्वारा आसकी समाजि स े ऄजधकतम एक महीने पहल े दकया जाएगा और आसके साथ उजा ा दक्षता ब्यरू , नइ ददल्ली के पक्ष म,ें आलेक्रॉजनक म ड म ें दये एक हजार रुपय ेका िल्ु क ह गा। हालांदक, स्ट्टार रेटटग य जना के जवस्ट्तार के मामल े म,ें एक हजार रुपये के ईि नवीनीकरण िल्ु क स े छूट दी जाएगी।

(5) वैधता ऄवजध की समाजि के बाद दकसी भी अवेदन का नवीनीकरण नहीं दकया जाएगा, आस मामले म ें ऄनुज्ञजिधारक नए जसरे स ेअवदे न करेगा।

(6) ईप-जवजनयम (4) के तहत नवीनीकरण के जलए अवेदन प्राि ह न े पर और संतुष्ट ह ने के बाद दक सभी अवश्यकताओं का ऄनुपालन दकया जाता ह,ै ब्यूर ऐसी प्राजि की तारीख स े एक महीने की ऄवजध के ऄंदर फॉमा 2 (ख) म ें ऄनुमजत का नवीनीकरण कर सकता ह।ै

(7) ऄनुज्ञजिधारक ज वाशिग मिीन के मौजूदा मॉडल पर ईस तारीख स े लेबल लगाना जारी रखन े की ऄनुमजत चाहता ह,ै जजस तारीख स े संि जधत स्ट्टार स्ट्तर लागू ह ता ह,ै केवल फॉमा 4 म ें एक घ र्णा प्रस्ट्तुत करेगा।

(8) यदद वाशिग मिीन के नए मॉडल क संि जधत स्ट्टार लेवल के साथ शसक्र नाआज करने के जलए लॉन्‍दच करन े की य जना ह ै त ऄनुज्ञजिधारक नए जसरे स े लेबल लगाने की ऄनमु जत मांगेगा और आस तरह की ऄनुमजत के जलए अवेदन, संि जधत स्ट्टार स्ट्तर लाग ू ह ने से छह महीन े पहले दकया जा सकता ह।ै

8. लबे ल पर जवजिजष्टया ं प्रदर्शित करन े के जलए जनयम और ित:ें- प्रत् यके ऄनुज्ञापत्रधारी और व्य ापारी एवं जवक्रेता लेबल पर जवजिजष्टयां प्रदर्शित करने म ेंजनम् नजलजखत जनयमों एव ंितों का पालन करेगा, ऄथाात - (क) प्रिीतक के लेबल पर प्रदर्शित स्ट् टार स्ट् तर ऄजधजनयम की धारा 14 के खण् ड (क) के ऄधीन केंरीय सरकार द्वारा ऄजधसूजचत प्रिीतक के जलए उजाा खपत मानकों के ऄनुरूप होंगे;

(ख) यह लेबल प्रिीतक के ऐसे मॉडलों पर ही जचपकाया जाएगा जजसके जलए ऄनुज्ञा ली गइ है;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5 (ग) लेबल क ऄनुज्ञापत्रधारी की लागत पर मुदरत और प्रिीतकों पर जचपकाया जाएगा;

(घ) ऄनुज्ञापत्रधारी, व् यापारी और जवक्रेता यह सुजनजित करेगा दक प्रिीतक के लेबल पर प्रदर्शित स्ट् टार स्ट् तर हर समय बना रहगे ा; (ङ) ऄनुज्ञापत्रधारी जवजनयम 9 में यथा जवजनर्ददष् ट लेबल िुल् क का भुगतान करेगा;

(च) ऄनुज्ञापत्रधारी ब् यूर क जववरण मुहयै ा कराएगा जजसमें लेबल लग ेईपकरणों क बनाने का ब् यौरा और जवत्तीय वर् ाकी प्रत् येक जतमाही के ऄंत में जनम् नजलजखत माह के ऄंदर प्रत् येक जतमाही के जलए दये प्र द्भूत लेबशलग िुल् क का जववरण ह ;

(छ) ऄनुज्ञापत्रधारी, ब् यूर क ऄपने लेबल लग े ईत् पादों के जवक्रय के जलए जनयुक्त प्रत् येक वर् ा 30 ऄप्रैल क ऄजधकृत जवतरकों, डीलरों और थ क जवक्रेताओं एव ंजवक्रेताओं की सूची मुहयै ा कराएगा; (ज) ऐसे ऄन्‍द य जनयमों एव ंितों का पालन करेंगे ज ब् यूर द्वारा, मानक और लेबल लगाने की के संबंध में ब् यूर की प्रचालन पुजस्ट्तका में जनजहत जनयमों एव ंितों सजहत जवजनर्ददष् ट दकए गए हों;

9. लबे क िल्ु क - (1) वाशिग मिीन पर जचपकाए गए प्रत्येक लेबल के जलए प्रत्येक ऄनुज्ञजिधारक ब्यूर क भारतीय रुपय े 30/- (तीस रुपय े केवल) के लेबल िुल्क का भुगतान करेगा।

(2) ईप-जवजनयम (1) के तहत जनर्ददष्ट लेबल िल्ु क का भगु तान प्रत्येक जवत्तीय वर्ा के समाि ह ने की तारीख स े एक महीने के ऄंदर दकया जाएगा: हालांदक दक जनर्ददष्ट ऄवजध के ऄंदर लेबल िुल्क का भुगतान करने म ें जवफल रहन े पर, ब्यूर जवजनयम 6 के ईप-जवजनयम

(3) के खडं (ख) के तहत भुगतान दकए गए लेबल सरु क्षा जमा स े दस प्रजतित प्रजत वर्ा की दर स े ब्याज सजहत दये राजि की वसूली कर सकता ह ैऔर यदद जमा करन े की ऄंजतम जतजथ के एक वर्ा के ऄंदर पूण ा लेबशलग िुल्क वसलू नहीं दकया जाता ह ै त ब्यरू ऄनुज्ञजिधारक क दी गइ लेबल की ऄनुमजत क रद्द कर सकता ह ै और ऄनुज्ञजिधारक का नाम राष्ट्रीय या क्षेत्रीय दैजनक समाचार पत्रों और आलेक्रॉजनक म,ें जडफॉल्टर के तौर पर, प्रकाजित कर सकता ह।ै

10. लबे ल सरु क्षा िल्ु क की वापसी - जवजनयम 9 के ईप-जवजनयम (2) के प्रावधानों के ऄधीन, वाशिग मिीन का जनमााण बंद करन े पर, क इ भी ऄनज्ञु जिधारक लेबल सुरक्षा जमा राजि की वापसी का हकदार ह गा।

11. ब्यरू द्वारा सत्यापन - (1) ब्यूर या आसकी नाजमत एजेंसी या त स्ट्वत: या आसके द्वारा प्राि जिकायत के अधार पर, यह सुजनजित करन े के जलए सत्यापन कर सकती ह ै दक वाशिग मिीन स्ट्टार स्ट्तर और आसके लेबल पर प्रदर्शित ऄन्‍दय जववरणों के ऄनुरूप ह ैऔर यह ऄनुमजत के ऄन्‍दय जनयम और ितें का ऄनुपालन करती ह।ै सभी परीक्षणों म ें धुलाइ प्रदिना , खंगालने का प्रदिान, उजाा खपत, पानी की खपत और जल जनष्कर्ाण प्रदिान (ऄवजिष्ट जल सामग्री) िाजमल ह।ैं

(2) सत्यापन के प्रय जन के जलए, ब्यूर या ईसकी नाजमत एजसें ी द्वारा, जैसा वह ईजचत समझे, यादजृ छछक रूप से जवजनमााण सुजवधा, ग दाम या ठरटेल अईटलेट स ेनमून े जलए जाएंगे।

(3) जहां, ईप-जवजनयम (1) के तहत प्राि जिकायत पर, ब्यूर क परीक्षण और जाचं प्रय गिालाओं (एनएबीएल) के जलए राष्ट्रीय प्रत्यायन ब ड ा द्वारा जवजधवत मान्‍दयता प्राि दकसी स्ट्वतंत्र प्रय गिाला म,ें वाशिग मिीन का परीक्षण करके, परीक्षण का सत्यापन करना अवश्यक ह,ै - (क) ब्यूर आस तरह के परीक्षण करने के जलए फॉम ा 5 म ें ऄनुज्ञजिधारक क न ठटस जारी करेगा और जिकायतकता ा क , नमूना लागत, परीक्षण, पठरवहन और ब्यूर के साथ ऄन्‍दय प्रासंजगक खचों स े संबंजधत ऐस े खचा, ऐसे समय के ऄंदर, जैसा दक ब्यूर द्वारा जनधााठरत दकया जा सकता ह,ै जमा करने के जलए कहा जाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) यदद चुनौती परीक्षण के तहत जलया गया नमूना जवफल ह जाता ह ै त नमून े की लागत, नमनू े के पठरवहन और परीक्षण िल्ु क के सभी खचों की प्रजतपूर्शत ऄनज्ञु जिधारक द्वारा ब्यूर क की जाएगी और ब्यूर जिकायतकता ा क पूवोि खच ावापस कर दगे ा; और (ग) जहां ईपकरण चनु ौती परीक्षण म ें सफल ह जाता ह ै त जिकायतकता ा द्वारा जमा दकए गए खचा क जब्त कर जलया जाएगा।

(4) जहां, ईप-जवजनयम (1) के तहत प्राि जिकायत पर, यदद ऄनुज्ञजिधारक ईप-जवजनयम (3) म ें जनर्ददष्ट आस तरह के खच ा क ऐसे समय के ऄदं र जमा करने म ें जवफल रहता ह ैत ब्यरू - (क) ईप-जवजनयम (3) म ें संदर्शभत वाशिग मिीन के सत्यापन क चुनौती परीक्षण द्वारा जारी रखेगा; और (ख) जवजनयम 6 के तहत प्राि अवेदन की प्रदक्रया क तब तक स्ट्थजगत रखा जा सकता ह ैजब तक दक आस तरह के व्यय क जमा नहीं दकया जाता ह।ै

(5) जहां परीक्षण के जलए ईपय ग की जान े वाली वॉशिग मिीन के नमून े स्ट्वत: परीक्षण या चनु ौती परीक्षण के दौरान परीक्षण म ें जवफल ह जाते ह,ैं ब्यूर ऄनुज्ञजिधारक क एक और ऄवसर प्रदान करेगा और स्ट्वतंत्र परीक्षण म,ें पहल े परीक्षण म ें ईपय ग की गइ वाशिग मिीन की द गुनी मात्रा के साथ दसू रा परीक्षण ऄनुज्ञजिधारक की लागत पर ईस प्रय गिाला म ें करेगा ज ईस प्रय गिाला स े ऄलग ह जहां पहला जांच परीक्षण दकया गया था और ज परीक्षण और जांच प्रय गिालाओं के जलए राष्ट्रीय प्रत्यायन ब डा (एनएबीएल) द्वारा जवजधवत मान्‍दयता प्राि ह गी। ब्यूर ईप-जवजनयम (3) म ें संदर्शभत चुनौती परीक्षण या ईप-जवजनयम (4) म ें संदर्शभत दसू रे परीक्षण और नमनू े की खरीद और परीक्षण के जलए दकए जाने वाले खचों क देखने के जलए फॉमा 5 म ें ऄनुज्ञजिधारक क सूजचत करेगा।

(6) जहां दसू रा परीक्षण जवफल ह जाता ह,ै ब्यूर , - (क) सभी राज्य नाजमत एजेंजसयों क सूचना के तहत फॉमा 6 म ें ऄनज्ञु जिधारक क जनदेि द ें दक द महीने की ऄवजध के भीतर ऄनुज्ञजिधारक, -

(i) वाशिग मिीन के लेबल पर प्रदर्शित स्ट्टार स्ट्तर क सही करें या परीक्षण के दौरान पाए गए द र्ों और कजमयों क दरू करें;

(ii) ब्यूर के जनदिे ों का पालन करने के जलए बाजार स े सभी स्ट्टॉक वापस ले ल;ें और

(iii) जवज्ञापन सामग्री पर प्रदर्शित जववरणों क बदल;ें (ख) ईपभ िाओं के लाभ के जलए, दकसी भी ऄनुज्ञजिधारक का नाम, ब्ांड नाम, मॉडल का नाम या मॉडल संख्या, ल ग और ऄन्‍दय जवजिष्टताओं क दकसी भी राष्ट्रीय या क्षेत्रीय दैजनक समाचार पत्र म ें और दकसी भी आलेक्रॉजनक माध्यम स े या दकसी ऄन्‍दय तरीके स ेजैसा वह ईजचत समझे, द महीने के ऄंदर प्रकाजित करें;

(ग) ऄजधजनयम की धारा 27 के तहत ऄनुज्ञजिधारक और व्यापारी के जखलाफ न्‍दयाजयक कायावाही िुरू करन े के जलए संबंजधत राज्य नाजमत एजसें ी क सूजचत करें।

(7) ऄनज्ञु जिधारक ईप-जवजनयम (6) म ें जनर्ददष्ट द महीने की ऄवजध के समापन के दस ददनों के ऄंदर - (क) जनदेि के ऄनुपालन म ेंकी गइ कारावाइ के संबंध म ेंफॉमा 7 म ें ऄनुपालन ठरप ट ा ब्यरू क भेज;ें और (ख) यदद खंड (क) म ें जनर्ददष्ट ऄनुपालन ठरप ट ा जनर्ददष्ट ऄवजध के ऄंदर दकसी भी जनदेि का ऄनुपालन दकए जबना प्राि ह ती ह ै या प्राि नहीं ह ती ह ै त आस े जारी दकए गए जनदेि का ऄनुपालन नहीं माना जाएगा और आस अिय के अदेि ब्यूर द्वारा पाठरत दकया जाना ह।ै[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7

(9) जहा ं ऄनुज्ञजिधारक ब्यरू द्वारा ईप-जवजनयम (5) के तहत जारी दकए गए जनदेिों का पालन करन े म ें जवफल रहता ह,ै ब्यूर सभी राज्य नाजमत एजेंजसयों क सूचना के तहत - (क) जवजनयम 7 के ईप-जवजनयम (1) के तहत ऄनज्ञु जिधारक क दी गइ ऄनुमजत क वापस ले ल;ें (ख) ऄजधजनयम की धारा 14 के खंड (क) के तहत केंर सरकार द्वारा ऄजधसूजचत उजाा प्रदिान मानकों के ऄनुरूप करने के जलए ऄनुज्ञजिधारक द्वारा जवफलता के समथान म ें परीक्षण ठरप ट ा के साथ केंर सरकार क ठरप ट ा भेजें। केंर सरकार द्वारा ऄजधजनयम की धारा 14 के खंड (ग) के तहत जवचार करने और कारावाइ करन े हते ु ईप-जवजनयम (7) के खंड (क) के बारे म ें ब्यरू संदर्शभत करे;

(ग) ईपभ िाओं के लाभ के जलए, दकसी भी ऄनुज्ञजिधारक का नाम, ब्ांड का नाम, मॉडल का नाम या मॉडल संख्या, ल ग और ऄन्‍दय जवजनदिे क द महीन े के ऄंदर, दकसी भी राष्ट्रीय या क्षेत्रीय दैजनक समाचार पत्र म ें और दकसी भी आलेक्रॉजनक या दकसी ऄन्‍दय तरीके स े जैसा दक वह ईजचत समझे, प्रकाजित करें;

1. उजाा दक्षता ब्यूर (वॉशिग मिीन के लेबल पर ईनके प्रदिान के जववरण और तरीका) जवजनयम, 2023 के जवजनयम 7 के प्रावधानों के ऄनुसार, ब्यूर अपक आस पत्र के ऄनुबंध क-3 में जनधाठा रत ऄनुम दन के जववरणों के ऄनुसार ऄपने ब्ांड क पंजीकृत करने की ऄनुमजत दते ा ह।ै

2. यह ऄनुमजत जनम्न के ऄधीन है- (क) वाशिग मिीन के लेबल पर प्रदर्शित स्ट्टार का स्ट्तर ऄजधजनयम की धारा 14 के खंड (क) के तहत ऄजधसूजचत वाशिग मिीन के जलए उजाा प्रदिान मानकों और पूवोि जवजनयमों में प्रदान गइ ितों के ऄनुरूप ह गा;

(ख) वाशिग मिीन के केवल ऐसे मॉडल पर लेबल की मुहर लगाइ जाएगी जजसके जलए ऄनुमजत दी गइ है; (ग) लेबल ईत्पाद वाशिग मिीन पर जचपकाया जाएगा और ऄनुज्ञजिधारक की लागत पर ईत्पाद की पैकेशजग पर मुदरत/जचपकाया जाएगा; (घ) ऄनुज्ञजिधारक यह सुजनजित करेगा दक वाशिग मिीन पर प्रदर्शित स्ट्टार का स्ट्तर हर समय बनाए रखा जाए;

(ङ) ऄनुज्ञजिधारक ब्यूर द्वारा जनर्ददष्ट लेबल िुल्क का भुगतान करेगा; (च) ऄनुज्ञजिधारक ब्यूर क जवत्तीय वर्ा की प्रत्येक जतमाही की समाजि के बाद के महीने के ऄंदर,प्रत्येक जतमाही के जलए लेबल दकए गए ईपकरणों के ईत्पादन और ऄर्शजत लेबशलग िुल्क के जववरण के साथ जववरण प्रस्ट्तुत करेगा। यही जववरण ब्यूर क भी एक स्ट्वत: प्रणाली के माध्यम से प्रस्ट्तुत दकया जाएगा;

(छ) ऄनुज्ञजिधारक,ऄनुमजत दी गइ वाशिग मिीन के ऐसे ऄन्‍दय जववरण ईपलब्ध कराएगा जजन्‍दह ेंब्यूर द्वारा मांगा जाएगा।

3. ऄनुज्ञजिधारक वैधता ऄवजध के दौरान ब्यूर के पूवा ऄनुम दन के जबना पंजीकृत ब्ांड और वाशिग मिीन क बाजार से वापस नहीं लेगा।

4. ब्ांड के जलए उजाा दक्षता ब्यूर द्वारा जनर्ददष्ट ऄजद्वतीय लेबल श्ृंखला क ड ......... ह ै और ऄनुम ददत जडजाआन के ऄनुसार यह लेबल पर ददखाइ दने ा चाजहए।

2. यह ऄनुमजत जनम्न के ऄधीन ह ै- (क) वाशिग मिीन के लेबल पर प्रदर्शित स्ट्टार का स्ट्तर वाशिग मिीन के जलए ऄजधजनयम की धारा 14 के खंड (क) के तहत ऄजधसूजचत उजाा प्रदिान मानकों और पूवोि जवजनयमों में प्रदान की गइ ितों के ऄनुरूप ह गा;

(ख) वाशिग मिीन के केवल ऐसे मॉडल पर लेबल लगाया जाएगा जजसके जलए ऄनुमजत दी गइ है;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ग लेबल क ऄनुज्ञजिधारक की लागत पर वाशिग मिीन पर मुदरत और जचपकाया जाएगा;

(घ) ऄनुज्ञजिधारक यह सुजनजित करेगा दक वाशिग मिीन पर प्रदर्शित स्ट्टार का स्ट्तर हर समय बनाए रखा जाए; (ड.) ऄनुज्ञजिधारक प्रजत लेबल तीस रुपये (30 रुपये) के लेबल िुल्क का भुगतान करेगा; (च) ऄनुज्ञजिधारक ब्यूर क जवत्तीय वर्ा की प्रत्येक जतमाही की समाजि के बाद के महीने के ऄंदर प्रत्येक जतमाही के जलए लेबल दकए गए ईपकरणों के ईत्पादन और ऄर्शजत लेबशलग िुल्क के जववरण के साथ एक जववरण प्रस्ट्तुत करेगा। यही जववरण ब्यूर क भी स्ट्वत: प्रणाली के माध्यम से प्रस्ट्तुत दकया जाएगा;

(छ) ऄनुज्ञजिधारक, ऄनुमजत दी गइ ईस वाशिग मिीन के ऐसे ऄन्‍दय जववरण, ब्यूर द्वारा मांगे जाने पर ईपलब्ध कराएगा।

3. यह ऄनुमजत ............ से........... तक के जलए मान्‍दय ह गी और आसे जनधााठरत दकए गए ऄनुसार नवीनीकृत दकया जा सकता है। ऄनुज्ञजिधारक, ऄनुमजत की वैधता ऄवजध के दौरान, ब्यूर की पूवा स्ट्वीकृजत के जबना, वाशिग मिीन क बाजार से वापस नहीं लेगा।

5. जहां केंर सरकार द्वारा समीक्षा करने पर स्ट्टार स्ट्तर की य जनाओं क संि जधत दकया जाता है, वाशिग मिीन का स्ट्टार स्ट्तर जनम्नानुसार संि जधत दकया जाएगा: - (क) यदद नया मॉडल संि जधत स्ट्टार स्ट्तर के साथ शसक्रनाआज करते हुए लॉन्‍दच दकया जाता है त नया स्ट्टार स्ट्तर प्रभावी ह ने की तारीख से छ महीने पहले, आस तरह की ऄनुमजत के जलए अवेदन ब्यूर क प्रस्ट्तुत दकया जाएगा;

(i) ईपर ि जनर्ददष्ट जतजथ पर चुनौती परीक्षण/जद्वतीय परीक्षण दखे ने के जलए दकसी एक ऄजधकारी का नामांकन, ऄजधकारी के नाम, पदनाम और हस्ट्ताक्षर (मूल रूप में) दिााते हुए प्राजधकार पत्र के साथ (पत्र पर ऄजधकृत हस्ट्ताक्षरकताा द्वारा जवजधवत हस्ट्ताक्षठरत और मुहर लगाया जाएगा) नाजमत करें।

(ii) आस पत्र के जारी ह ने की तारीख से पंरह ददनों के ऄंदर खरीद, पठरवहन, परीक्षण और ऄन्‍दय अकजस्ट्मक खचों की लागत जमा करें (व्ययों क आलेक्रॉजनक म ड के माध्यम से जमा दकया जाएगा) जैसा दक ऄनुबंध में ईल्लेख दकया गया ह।ै

NOTIFICATION New Delhi, the 23rd January, 2023 No. BEE/S&L/WM/06/22-23.—In exercise of the powers conferred by clause (i) of sub-section (2) of

section 58 read with clause (n) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau of Energy Efficiency (the Bureau) with the previous approval of the Central Government , proposes to notify the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Washing Machine) Regulation 2023, the proposed draft regulations are hereby published in the Gazette of India, Extraordinary, as required by sub-section (1) of section 58 of the said Act, for the information of all the persons likely to be affected thereby and inviting their suggestions and objections (if any); and the notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date of their publication in the Gazette of India, Extraordinary;

Objections or suggestions, if any, may be addressed to the Director-General, Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, North Wing, Sector-1, R.K. Puram, New Delhi-110066 and may also be sent at the e-mail address of the Bureau at dg-bee@nic.in;

1. Short title and commencement. - (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Washing Machine), Regulations, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition: - (1) In these regulations, unless the context otherwise requires, -

(a) ―Act‖ means the Energy Conservation Act, 2001(52 of 2001);

(b) ―Form‖ means a form appended to these regulations;

(c) ―label‖ means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the Washing Machine;

(d) ―label period‖ means the validity period of per-cycle energy consumption per kg under energy performance standards notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, by the ending timeline of the label validity period, the new energy performance standards under

section 14(a) of the Act are not notified, the existing standards shall deemed to be valid until new values for the same are notified by the Central Government;

(e) ―permittee‖ means a person or agency to whom permission has been granted to affix label under regulation 7;

(f) ―Washing Machine‖ means an appliance as specified in the notification under clause (b) of section 14 of the Act;

(g) ―Star rating or star level‖ means the grade of energy efficiency displayed on the label of the washing machine based on energy consumption per cycle notified by the Central Government under clause (a) of section 14 of the Act. The available stars are between a minimum of one and a maximum of five shown in one star interval.

(h) ―trader or seller‖ in relation to any washing machine means a person who sells or distributes such washing machine and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such washing machine.

(i) ―Schedule‖ means the Schedule annexed to these regulations;

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label. - (1) On every washing machine, the following particulars shall be displayed on its label, namely: -

(a) Star level;

(b) The logo of the Bureau of Energy Efficiency;

(c) name of appliance;

(d) brand/make;

(e) model/ year of manufacturing or import;

(f) type of washing machine;

(g) load Capacity;

(h) water Consumption;

(i) unique label series code;

(j) label period.

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.—

(1) Transition from Voluntary to Mandatory regime.- A label containing all the particulars specified in regulation 3 shall be displayed on every washing machine within a period of six months from the date of coming into force of these regulations.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) Revision of Mandatory Energy performance standards.- On and from commencement of revised energy performance standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller-

(a) shall not produce the washing machine with the previous energy performance standards;

(b) the washing machine shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the washing machine in synchronization with revised energy performance standards;

(c) All preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken three months in advance.

5. Manner of display of label. -

(1) There shall be label on every washing machine which shall displayed at the point of sale and such label shall be affixed on washing machine in the following manner, namely:-

(i) The label shall be firmly affixed at the front display of each appliance and should be easily visible as referred in sub-regulation (2) of regulation 3 and the permittee shall ensure that the label appears on every registered unit or model on display for identification purpose, at point of sale or hire and the label shall also be printed or pasted to the exterior to the casing containing the unit or model.

(ii) The label shall be of self – adhesive material. The markings required by the schedule shall be legible, indelible and durable.

(2) For units not on display, the label may be printed or pasted to the exterior to the casing and this label may be attached to the unit or model when the unit or model is removed from its packaging or the label may be included as a part of the documentation given to the customer or user.

6. Permission for display of label. - (1) No star label shall be affixed on a washing machine without obtaining the prior permission of the Bureau.

(2) Company registration. - For the purposes of obtaining permission of the Bureau, an application for registration shall be made for every brand separately as specified in Form I-(A), accompanied by a label security deposit of One lakh rupees, payable by acceptable electronic mode of payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only.

(3) Model registration. - Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by electronic mode of payment; and

(b) a label security fee of one lakh rupees, payable in favour of the Bureau of Energy Efficiency, New Delhi; by acceptable electronic mode of payment:

Provided that in case of small scale industry label security fee shall be only twenty -five thousand rupees; and

(a) documents specified in Form I – (B).

7. Grant of permission. - (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in DISHA (Bureau’s Operation Manual on Standards and Labelling) subject to such terms and conditions as specified in regulation 8, –

(a) register the brand in Form II-(A) in electronic form; and

(b) grant permission for affixing label on washing machine in Form II-(B) in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 29

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level as specified in the energy consumption standard as notified by the Central Government under clause (a) of section 14 of the Act is in force.

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

Provided that in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II-B.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the washing machine from the date from which the revised star level comes into force, shall submit only a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the washing machine is planned to be launched to synchronise with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label. - Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely:-

(a) the star level displayed on the label of washing machine shall conform to energy performance standards for washing machine notified by the Central Government under clause (a) of section 14 of the Act;

(b) the label shall be affixed only on such model of washing machine for which permission has been granted;

(c) the label shall be printed and affixed on the washing machine at the cost of permittee;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of washing machine shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year;

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Manual on Standard and Labelling.

9. Label fee. - (1) Every permittee shall pay to the Bureau a label fee of INR 30/- (rupees thirty only) for each label affixed on the washing machine.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of

closure of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten percent per annum from the label security deposit paid made under clause

(b) of sub-regulation (3) of regulation 6, and if complete labelling fees are not recovered within one year of the30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] last date of submission, the Bureau may cancel the permission to labels granted to the permittee and publish the name of the permittee in the national or regional daily newspapers and in electronic means as a defaulter.

10. Refund of label security fee. - Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security deposit, on ceasing to manufacture washing machine.

11. Verification by Bureau. - (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the washing machine conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

All test includes wash performance, rinse performance, energy consumption, water consumption and water extraction performance (residual water content)

(2) For the purpose of verification, samples shall be picked up at random by Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the washing machine in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL),-

(a) The Bureau shall issue a notice to the permittee in form V for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to sample cost, testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau.

(b) if the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and

(c) where the equipment passes the challenge test, then, the expenses deposited by the complainant shall be forfeited.

(4) Where, upon a complaint received under sub-regulation (1), if the permittee fails to deposit such expense referred to in sub-regulation (3) within such time, the Bureau shall-

(a) continue the verification by challenge testing the washing machine referred to in sub-regulation (3); and

(b) the processing of application received under regulation 6 may be kept in abeyance till such expense are deposited.

(5) Where samples of washing machine used for testing fails the test during suo motu testing or challenge testing, the Bureau shall offer the permittee, another opportunity and conduct a second test with twice the quantity of washing machine used in the first test, in an independent test laboratory which is different from the lab where the first check testing was conducted and shall be duly accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL) at the cost of the permittee. The Bureau shall intimate the permittee in Form V to witness the challenge testing referred to in sub-regulation (3) or the second test referred to in sub-regulation

(4) and the expenses to be made towards the procurement and testing of sample.

(6) Where the second test fails, the Bureau shall, -

(a) direct the permittee in Form VI, under intimation to all the State Designated Agencies, that the permittee within a period of two months shall, -

(i) correct the star level displayed on the label of the washing machine or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 31

(c) Intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(7) The permittee shall within ten days of the conclusion of the period of two months referred to in sub-regulation

(6),-

(a) send the compliance report in Form VII to Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non-compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(8) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub-regulation (6) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub- regulation.

(9) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall, -

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy performance standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation

(7) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months;

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission. - The Bureau may cancel the permission granted under regulation 7, if the permittee–

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(c) does not comply with the direction issued under regulation 11.

Provided that no permission shall be cancelled unless the permittee has been given an opportunity of being heard in the matter.

2. The Bureau, under Regulation … of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Washing Machine) Regulations, 2023, had purchased a Bureau of Energy Efficiency star labelled washing machine from your authorised Distributor, dealer, retailer vide Invoice number .......dated for a price of Rs................

and lifted as a sample dated ……by M/s......................, an agency appointed by the Bureau for verification of the particulars displayed on the label under regulation 3 of the aforesaid regulations, affixed by you on the aforesaid purchased washing machine. The sample duly sealed by M/s............... bearing serial number……..was obtained from M/s..........(Name of the Distributor, dealer, retailer) under signatures of the duly authorised representative of the verification Agency.

3. The Bureau through its aforesaid Verification Agency had transported the sample referred to in para 2 to M/s. ..................., a National Accreditation Board for Testing and Calibration Laboratories accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 4 and 5 of S.O.number ……dated the …. for giving Test Report in accordance with the Form ….given in Annexure to S.O.. number…….. dated the ……..

4. The results of the Test Report on the sample bearing Unique Identification serial number is enclosed. The results of the Test Report indicated that the sampled washing machine failed to meet the energy consumption test. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the washing machine manufactured/imported by you. The Test Results were sent to you vide Bureau of Energy Efficiency letter No... ..... dated........in the name of your authorised Contact person. You were also requested to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

5.The Sample for second check verification Test were picked up …. dated the …. through our authorised Agency M/s. ............and transported to the National Accreditation Board for Testing and Calibration Laboratories accredited Laboratory transported by our authorised Agency, duly sealed by M/s............... and was given Unique Identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification Agency as well as your representatives.

6. The Test results of second check testing are enclosed which are dully checked and counter signed by the competent authorised personnel of the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing. The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O.number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Washing Machine manufactured/imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Washing Machine) Regulations, 2023, the

Bureau hereby directs to :-

(i) correct the star level displayed on the label of the washing machine or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by ..............

.In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b)[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 45 of sub-regulation (6) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Washing Machine) Regulations, 2023.
