आक्षेव या सनझाअन, यदद कोई हो, महाजनदिे क, ऊजाा दक्षता ब् यूरो, जअनद्यनत मंत्रालय, चौथा तल, सेअना भअनन, रामकृष् ण वनरम, सेक् टर-1, नई ददल् ली-110066 को प्रेजित दकए जा सकते ह ैंऔर ब्यूरो के ई-मेल dg-bee@nic.in वर भी भेजे जा सकते हैं;

ऊजाा दक्षता ब्यूरो द्वारा उवरोि वैरा 1 में जनर्ददष्ट तीस ददनों की अअनजध की समाजि से वहले उि मसौदा जअनजनयमों के संबंध में व्यजियों से प्राि होने अनाली आवजत्तयों या सनझाअनों वर जअनचार दकया जाएगा।

1. सजं क्षि नाम और प्रारंभ- (1) इन जअनजनयमों का संजक्षि नाम ऊजाा दक्षता ब्यूरो (जडस्ट्रीब्यूिन रांसफॉमार के लेबल वर जअनअनरण और उनके प्रदिान की प्रजअनजध) जअनजनयम, 2022 ह।ै

(2) ये जअनजनयम भारत के राजवत्र, असाधारण में इनके प्रकािन की तारीख से लागू होंगे।

2. वठरभािा :- (1) इन जअनजनयमों म,ें जब तक संदभा में अन्‍द यथा अवेजक्षत न हो,- (क) “अजधजनयम” से तात् वया ऊजाा संरक्षण अजधजनयम, 2001 (2001 का 52) ह;ै 5749 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) "जडस्ट् रीब् यूिन रांसफामार" का अथा अजधजनयम की धारा 14 के खंड (बी) के तहत अजधसूचना में जनर्ददष्ट एक उवकरण है;

(ग) “प्रवत्र” से तात् वया इन जअनजनयमों के साथ संल्‍न प्रवत्र है; (घ) “लेबल” से तात् वया जडस्ट् रीब् यूिन रासं फामार वर जचवकाई गई अथअना प्रदशितित जलजखत, मनदरत, जचजननत, मनहर लगी या ग्रादफक सामग्री ह;ै (ड.) "लेबल की अअनजध" का अथा ह ैसावेक्ष ऊजाा दक्षताओं की अनैधता अअनजध या हाजन के मानक जो धारा 14 के खंड (क) के तहत केंर सरकार द्वारा लोडडग वर अजधसूजचत जडस्ट् रीब् यूिन रांसफामरा के 50 प्रजतित और 100 प्रजतित कनल ननकसान ह ै और यदद सावेक्ष ऊजाा दक्षता या हाजन मानकों की अनैधता अअनजध की समाजि अअनजध अजधसूजचत नहीं की गई है, इसे तब तक अनैध माना जाएगा जब तक दक केंर सरकार द्वारा इसके जलए नए मान अजधसजू चत नहीं दकए जाते हैं;

(च) “अननज्ञाधारक” से तात् वया ससे ्‍ यजि या ससी एजेंसी से ह ैजजसे जअनजनयम 7 के तहत लेबल जचवकाने के जलए अननज्ञा दी गई है; (छ) "स्ट्टार रेटटग या स्ट्टार लेअनल" का अथा है अजधजनयम की धारा 14 के खंड (क) के तहत जडस्ट् रीब् यूिन रांसफामार के लेबल वर ऊजाा दक्षता का ग्रेड जजसमें केंर सरकार द्वारा अजधसूजचत 50 प्रजतित और 100 प्रजतित लोडडग के आधार वर सावेक्ष ऊजाा दक्षता या हाजन का मानक प्रदशितित दकया जाता है, जो जडस्ट् रीब् यूिन रांसफामार के लेबल वर जडस्ट् रीब् यूिन रांसफामार की 50 प्रजतित और 100 प्रजतित लोडडग वर होने अनाला कनल ननकसान है;

(ज) लेबल लगे जडस्ट् रीब् यूिन रांसफॉमार के संबंध में “्‍ यावारी अथअना जअनरेता” से तात् वया उस ्‍ यजि से ह ै जो सस े जडस्ट् रीब् यूिन रांसफॉमार की जबरी अथअना जडस्ट् रीब् यूिन करता है और इसमें ससे दकन ानदार, ्‍ यावारी, जअनजनमााता और जडस्ट् रीब् यूिन रांसफॉमार वर लेबल जचवकाने के जलए अननमजत प्राप्त अननज्ञाधारक िाजमल हैं।

(i) "अननसूची" का अथा इन जअनजनयमों से जनडी अननसूची है;

(2) यहां इसमें प्रयनक् त जो िब् द और अजभ्‍ यजियां अवठरभाजित हैं लेदकन अजधजनयम में वठरभाजित की गई हैं, उनका अजधजनयम म ें उन्‍द ह ेंरमि: ददया गया आिय ही होगा।

3. लबे ल वर प्रदशितित दकए जान ेअनाला जअनअनरण- (1) प्रत् येक जडस्ट् रीब् यूिन रांसफॉमार वर, इसके लेबल वर जनम् नजलजखत जअनअनरण प्रदशितित दकया जाएगा, नामत:- (क) ऊजाा दक्षता ब् यूरो का प्रतीक जचनन; (ख) उवकरण;

(ग) प्रकार; (घ) मेक / जनमााता / आयातक; (ङ) मॉडल / जनमााण अनिा; (च) केअनीए में रांसफामार क्षमता; (छ) केअनी में अनोल्टेज; (ज) अनॉट में 50 प्रजतित लोडडग वर कनल ननकसान; (झ) अनॉट में 100 प्रजतित लोडडग वर कनल ननकसान;

(ञ) जअनिेि श्ृंखला कोड; (ट) स्ट् टार स्ट्त र; (ठ) लेबल की अअनजध;

(2) लेबल का जडजाइन, रंग, आकार और सामग्री इन जअनजनयमों के साथ संल्‍न अननसूची में यथा: जअनजनर्ददष् ट होगा।

4. लेबलों के प्रदिना के जलए समय-सीमा- (1) जअनजनयम 3 में जअनजनर्ददष् ट सभी जअनअनरण अनाला लेबल इन जअनजनयमन के लागू होने की तारीख से छह माह की अअनजध के अंदर प्रत् येक जडस्ट् रीब् यूिन रांसफॉमार वर प्रदशितित दकया जाएगा।

(2) केन्‍द र सरकार द्वारा अजधजनयम की धारा 14 के खण् ड (क) के तहत अजधसूजचत ऊजाा खवत मानकों के आरंभ होने वर और आरंभ होने से, प्रत् येक अननज्ञाधारक या ्‍ यावारी या जअनरेता स जन नजित करेगा दक- (क) जवछले ऊजाा खवत मानकों के साथ जडस्ट् रीब् यूिन रांसफॉमार का उत्वादन नहीं करेगा;[भाग III—खण् ड 4] भारत का राजवत्र : असाधारण 3 (ख) जडस्ट् रीब् यूिन रांसफॉमार वर ऊजाा खवत मानक के साथ स्ट्टार स्ट्तर और लेबल अअनजध और ऊजाा खवत मानकों के साथ जडस्ट् रीब् यूिन रांसफॉमार के जनमााण अनिा को प्रदशितित करेगा;

(ग) डीलरों, खनदरा ्‍ यावाठरयों को जानकारी दने े के जलए उनको जिजक्षत करने के साथ ही उवभोक् ताओं को जिजक्षत करने के जलए अवेजक्षत प्रचार-प्रसार सजहत सभी प्रारंजभक कदम उठाए गए ह ैं और तीन महीने वहले काराअनाई की जाएगी।

5. लेबल प्रदशितित करन ेकी जअनजध-

(1) प्रत्येक जडस्ट् रीब् यूिन रांसफामार वर, लेबल वर जनम्नाननसार मनहर लगाई जाएगी, अथाात्:-

(i) लेबल को इकाई के सामने के जडस्ट् प्ल े वर जचवकाया जाएगा और यह जअनजनयम 3 के उव-जअनजनयम (2) में जनर्ददष्ट अननसार आसानी से ददखाई दने ा चाजहए और अननज्ञाधारक यह सनजनजित करेगा दक लेबल प्रत्येक वंजीकृत इकाई या मॉडल वर वहचान के उद्देश्य से, जबरी या दकराए की जगह वर प्रदशितित होता ह ै और लेबल को इकाई या मॉडल आअनरण के बाहरी अनाले जहस्ट्से में मनदरत दकया या जचवकाया जाएगा।

(ii) जडस्ट् प् ले न करने अनाली इकाइयों के जलए, लेबल मनदरत दकया जा सकता ह ैया इसे बाहरी आअनरण वर जचवकाया जा सकता ह ै और जब इकाई या मॉडल को उसकी वैकेडजग से बाहर जनकाल जलया जाता ह ै तो यह लेबल इकाई या मॉडल से जनडा हो सकता ह ैया लेबल को ग्राहक या प्रयोक् ता को ददए गए दस्ट्ताअनेीीकरण के एक भाग के रूव में िाजमल दकया जा सकता है।

6. लेबल प्रदशितित करन ेकी अनज्ञन ा-(1) ब् यूरो की वूअना अननमजत के जबना जडस्ट् रीब् यूिन रांसफॉमार वर कोई स्ट् टार नहीं जचवकाया जाएगा।

(2) कंवनी वंजीकरण - ब्यूरो की अननमजत प्राि करने के प्रयोजनों के जलए, प्रत्येक ब्ांड को एक लाख रुवए के लेबल प्रजतभूजत िनल्क के साथ, अलग से वंजीकृत दकया जाएगा जैसा दक प्रवत्र I - (क) में जनर्ददष्ट दकया गया ह,ै भनगतान के इलेक्रॉजनक मोड द्वारा दये ह ै:

बिते दक लघन उद्योग के मामले में, लेबल प्रजतभूजत िनल्क केअनल वच्चीस हजार रुवए होगा।

(3) मॉडल वंजीकरण- उव-जअनजनयम (2) के तहत अननज्ञावी के प्रत्येक आअनेदन के साथ- (क) भनगतान के इलेक्रॉजनक मोड द्वारा दये प्रजत मॉडल दो हजार रुवए का आअनेदन िनल्क; तथा (ख) प्रवत्र-1 – (ख) में यथा जअनजनर्ददष् ट दस्ट् ताअनेज

7. अनज्ञन ा प्रदान करना - (1) जअनजनयम 6 के तहत कोई आअनेदन प्राप्त होने वर और इससे संतनष् ट होने वर दक इसमें दी गई सभी अवेक्षाओं का वालन दकया गया है, ब् यूरो मानक और लेबडलग वर इस मैननअल में जनर्ददष् ट के रूव में अअनजध के अंदर, जअनजनयम 8 में यथा:

जअनजनर्ददष् ट जनयमों एअनं िततों के अ्‍य धीन के जलए अननज्ञा प्रदान कर सकता ह।ै (क) प्रवत्र II-(क) में इलेक्रॉजनक रूव में ब्ांड वंजीकृत करना; तथा (ख) प्रवत्र II-(ख) में इलेक्रॉजनक रूव में जडस्ट् रीब् यूिन रांसफामार वर लेबल लगाने की अननमजत दने ा।

(2) ब् यूरो द्वारा प्रवत्र-III में रजजस्ट्ट र का अननरक्षण दकया जाएगा और इसमें अननज्ञाधारक का नाम प्रजअनष् ट दकया जाएगा;

(3) उव-जअनजनयम (1) के तहत इस प्रकार प्रदत्त अननज्ञा उस अअनजध तक मान्‍द य होगी जो केन्‍द रीय सरकार द्वारा धारा 14 के खण् ड (क) के तहत यथा: अजधसूजचत ऊजाा खवत मानक द्वारा स्ट्ट ार स्ट्त र के जलए जअनजनर्ददष् ट की गई है;

(4) अननज्ञाधारक द्वारा स्ट्टार रेटटग योजना के संिोधन के मामले म,ें अननमजत के नअनीनीकरण का आअनेदन इसकी समाजि से एक महीने बाद नहीं दकया जाएगा और इसके साथ ऊजाा दक्षता ब्यूरो, नई ददल्ली के वक्ष में इलेक्रॉजनक मोड में दये एक हजार रुवए का िनल्क होगा। स्ट्टार रेटटग योजना के जअनस्ट्तार के मामले में, उि नअनीनीकरण के एक हजार रुवए के िनल्क से छूट दी जाएगी।

(5) अनैधता की अअनजध समाप्त होने के बाद दकसी आअनेदन का नअनीकरण नहीं दकया जाएगा और अननज्ञावी को नया आअनेदन वत्र दने ा होगा;

(6) उव- जअनजनयम (4) के तहत नअनीकरण के जलए आअनेदन-वत्र जमलने वर और सभी अवेक्षाएं वूरी होने के संबंध में संतनष् ट होन े वर, ब् यूरो उक् त आअनेदन प्राप्त होने की तारीख से एक माह की अअनजध के अंदर प्रवत्र-II में अननज्ञा का नअनीकरण कर सकता है;

(7) जो अननज्ञाधारक उस तारीख से जडस्ट् रीब् यूिन रांसफॉमार के मौजूदा मॉडल वर लेबल जचवकाने को जारी रखने की अननज्ञा की मांग करता है, जजस तारीख से संिोजधत स्ट्ट ार स्ट्त र लागू हुआ है, केअनल प्रवत्र IV में एक घोिणा प्रस्ट् तनत करेगा;

(8) यदद जडस्ट् रीब् यूिन रांसफॉमार के नए मॉडल की योजना संिोजधत स्ट् टार स्ट् तर के साथ ताल-मेल जबठाकर िनरू करने की योजना ह ै तो अननज्ञाधारक को नया लेबल जचवकाने की अननज्ञा लेगा और ससी अननज्ञा के जलए आअनेदन संिोजधत स्ट् टार स्ट् तर के लागू होने से छह माह वूअना दकया जाए;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

8. लेबल वर जअनअनरण प्रदशितित करन ेके जलए जनयम और ित:ें- प्रत् येक अननज्ञाधारक और ्‍ यावारी एअनं जअनरेता लेबल वर जअनअनरण प्रदशितित करने में जनम् नजलजखत जनयमों एअनं िततों का वालन करेगा, नामत:- (क) जडस्ट् रीब् यूिन रांसफॉमार के लेबल वर प्रदशितित स्ट् टार स्ट् तर अजधजनयम की धारा 14 के खण् ड (क) के तहत केंर सरकार द्वारा अजधसूजचत जडस्ट् रीब् यूिन रांसफॉमरा के जलए ऊजाा खवत मानकों के अननरूव होंगे;

(ख) यह लेबल जडस्ट् रीब् यूिन रांसफॉमार के ससे मॉडलों वर ही जचवकाया जाएगा जजसके जलए अननज्ञा ली गई है; (ग) लेबल को अननज्ञाधारक की लागत वर मनदरत और जडस्ट् रीब् यूिन रांसफॉमार वर जचवकाया जाएगा; (घ) अननज्ञाधारक, ्‍ यावारी और जअनरेता यह सनजनजित करेगा दक जडस्ट् रीब् यूिन रांसफॉमार वर लेबल वर प्रदशितित स्ट् टार स्ट् तर हर समय बना रहगे ा;

(ङ) अननज्ञाधारक जअनजनयम 9 में यथा: जअनजनर्ददष् ट लेबल िनल् क का भनगतान करेगा; (च) अननज्ञाधारक ब् यूरो को जअनअनरण मनहयै ा कराएगा जजसमें लेबल लगे उवकरणों को बनाने का ब् यौरा और जअनत्तीय अनिा की प्रत् येक जतमाही के अंत में जनम्न जलजखत माह के अंदर प्रत् येक जतमाही के जलए दये प्रोद्भूत ले बडलग िनल् क का जअनअनरण हो;

(छ) अननज्ञाधारक, ब् यूरो को अवने लेबल लगे उत् वादों की जबरी के जलए जनयनक्त प्रत् येक अनिा 30 अप्रैल को अजधकृत जअनतरकों, डीजरों और थोक जअनरेताओं एअनं जअनरेताओं की सूची मनहयै ा कराएगा; (ज) अननज्ञाधारक, ्‍ यावारी और जअनरेता ससे अन्‍द य जनयमों एअनं िततों का वालन करेंगे जो ब् यूरो द्वारा, मानक और लेबडलग के संबंध में ब् यूरो की जनयम वनजस्ट्तका में जनजहत जनयमों एअनं िततों सजहत जअनजनर्ददष् ट दकए गए हों;

9. लेबल िल्न क- (1) प्रत् येक अननज्ञाधारक, ब् यूरो को जडस्ट् रीब् यूिन रांसफॉमार वर प्रत् येक जचवकाए गए लेबल के जलए सौ रुवए के िनल् क का भनगतान करेगा।

(2) उव-जअनजनयम (1) के तहत जअनजनर्ददष् ट लेबल िनल् क, प्रत् येक जअनत्तीय अनिा की अंजतम तारीख से एक माह के अंदर अनाशितिक तौर वर दकया जाएगा; बिते दक यथा जअनजनर्ददष् ट अअनजध के अंदर लेबल िनल् क का भनगतान न करने वर, ब् यूरो जअनजनयम 6 के उव-जअनजनयम (3) के खण् ड (ख) के तहत प्रजतभूजत जमानत राजि से इस वर प्रजतअनिा दस प्रजतित की दर से इस वर ब् याज का भनगतान करेगा और यदद इसे जमा दकए जाने की अंजतम तारीख से एक माह के अंदर वूरा लेबडलग िनल् क अनसूल नहीं दकया जाता, ब् यूरो अननज्ञाधारक को प्रदत्त सभी अननज्ञा प्रदान कर सकता है और अननज्ञाधारक का नाम चूककताा के रूव में समाचार वत्र में प्रकाजित कर सकता ह।ै

10. लेबल प्रजतभजू त िल्न क का प्रत्य वणा :- जअनजनयम 9 के उव-जअनजनयम (2) के प्राअनधान के अधीन, अननज्ञाधारक को जडस्ट् रीब् यूिन रांसफॉमार का जअनजनमाणा बंद करने वर लेबल प्रजतभूजत िनल्क के प्रत् यवाण का अजधकार होगा।

11. ब् यूरो द्वारा सत्य ावन- (1) ब् यूरो अथअना इसकी नामोदद्दष् ट एजेंसी, स्ट् अनयमेअन अथअना इसे जिकायत प्राप्त होने वर, यह सनजनजित करन े के जलए सत् यावन करेगा दक जडस्ट् रीब् यूिन रांसफॉमार इसके लेबल वर प्रदशितित स्ट् टार स्ट् तर और अन्‍द य जअनअनरण के अननरूव ह ै और दक यह अननज्ञा के अन्‍द य जनयमों एअनं िततों के अननवालन में ह।ै

(2) सत् यावन के प्रयोजन के जलए, ब् यूरो अथअना जअनजनमााता सनजअनधा से इसकी नामोदद्दष् ट एजेंसी, द्वारा जैसे यह उजचत समझे, भण् डारगृह अथअना फनटकर जअनरय केन्‍द र से यादजृक छक तौर नमूने एकत्र करेगा; और (क) अनाइंडडग प्रजतरोध वरीक्षण का मावन (ख) प्रजतबाधा अनोल्टेज या िॉटा सर्दकट प्रजतबाधा और लोड हाजन का मावन (ग) नो-लोड हाजन और अनतामान वरीक्षण का मावन (घ) तावमान अनृजि वरीक्षण और (ड.) िॉटा सर्दकट वरीक्षण।

(3) जहां उव- जअनजनयम (1) के तहत जिकायत प्राप्त होने वर, ब् यूरो द्वारा जांच और अंिांकन प्रयोगिालाओं हते न राष् रीय वरीक्षण प्रत् यायन बोडा द्वारा जअनजधअनत प्रत् याजयत स्ट् अनतंत्र प्रयोगिाला के जडस्ट् रीब् यूिन रांसफामार की जांच को चननौती दके र सत् यावन करना अवेजक्षत ह,ै अननज्ञाधारक को ससे वरीक्षण के जनष् वादन के जलए प्रवत्र 5 में नोठटस जारी दकया जाएगा और जिकायतकताा को ब् यूरो के वास नमूना लागत, वरीक्षण, वठरअनहन संबंधी खचा और अन्‍द य आकजस्ट्मक ्‍ यय, ससी समयाअनजध में जमा कराने की मांग करेगा जो ब् यूरो द्वारा जअनजनधााठरत की गई हो और यदद जांच वरीक्षण के तहत जलए गए नमूने जअनफल रहते हैं, ब् यूरो को नमूने लेने, नमूने के वठरअनहन और जांच प्रभारों की लागत के जलए सभी ्‍ यय की प्रजतवूशितत अननज्ञाधारक द्वारा अनहन की जाएगी और ब् यूरो उजल्लजखत ्‍ यय की प्रजतवूशितत जिकायतकताा को करेगा और जहां उवकरण चननौती वरीक्षण वर खरे उतरते हैं, तब जिकायतकताा द्वारा जमा कराए गए ्‍ यय जब् त कर जलए जाएंगे;

(4) जहां जांच के जलए जडस्ट् रीब् यूिन रांसफॉमार के नमूने स्ट्अन यमेअन वरीक्षण अथअना चननौती वरीक्षण के दौरान वरीक्षण में जअनफल रहते ह,ैं अननज्ञाधारक को एक अन्‍द य अअनसर ददया जाएगा और ब् यूरो, अननज्ञाधारक की लागत वर राष् रीय वरीक्षण और अंिांकन प्रयोगिाला बोडा द्वारा जअनजधअनत प्रत् याजयत स्ट् अनतंत्र प्रयोगिाला में प्रथम जांच में प्रयनक्त जडस्ट् रीब् यूिन रांसफॉमार के दो गनने वठरमाण में दसू रा वरीक्षण करेगा। ब्यूरो उव-जअनजनयम (3) में संदशितभत चननौती वरीक्षण या उव-जअनजनयम (4) में संदशितभत दसू रे वरीक्षण और नमूने की खरीद और वरीक्षण के जलए दकए जाने अनाले खचतों को दखे ने के जलए प्रवत्र 5 में अननज्ञाधारक को सूजचत करेगा।[भाग III—खण् ड 4] भारत का राजवत्र : असाधारण 5

(5) जहां, दसू रा वरीक्षण जअनफल होता है, ब् यूरो,- (क) प्रवत्र VI, में अननज्ञाधारक को सभी राज्य नामोदद्दष् ट एजेंजसयों को जनदिे दगे ा दक अननज्ञाधारक दो माह की अअनजध के अंदर, i. जडस्ट् रीब् यूिन रांसफॉमार के लेबल वर सही स्ट् टार स्ट् तर प्रदशितित करेगा अथअना वरीक्षण के दौरान त्रनठटयों और खाजमयों को दरू करेगा;

ii. ब् यूरो के ददिा- जनदिे ों के अननवालन में बाजार से सभी स्ट्ट ॉक को अनावस लेगा; और iii. जअनज्ञाजवत सामग्री वर प्रदशितित जअनअनरण में वठरअनतान करेगा। (ख) उवभोक् ताओं के लाभ के जलए, दो माह के अंदर अननज्ञाधारक का नाम, ब्ाण् ड का नाम, मॉडल का नाम अथअना मॉडल संख्य ा, प्रतीक जचनन और अन्‍द य जअनजनर्ददष् टता दकसी दजै नक राष् रीय अथअना क्षेत्रीय समाचारवत्र अथअना इलेक् रॉजनक अथअना यथोजचत दकसी अन्‍द य तरीके से प्रकाजित करेगा। (ग) संबंजधत राज्य नामोदद्दष्ट एजेंसी को ईसी अजधजनयम, 2001 की धारा 27 के तहत अननज्ञाधारक और ्‍ यावारी के जखलाफ न्‍द याजयक कानूनी काराअनाई करने की सूचना द।ें

(6) उव-जअनजनयम (5) में संदशितभत दो माह की अअनजध समाप्त होने के दस ददनों के अंदर,- (क) ब् यूरो को ददिा-जनदिे के अननवालन में की गई काराअनाई के संबंध में प्रवत्र VII में अननवालन ठरवोटा भेजेगा; और (ख) यदद खण् ड (क) में संदशितभत अननवालन ठरवोटा प्राप्त नहीं हुई ह ै अथअना जअनजनधााठरत अअनजध के अंदर जनदिे का वालन दकए जबना प्राप्त होती ह,ै इसे जारी जनदिे ों का गैर-अननवालन माना जाएगा और ब् यूरो द्वारा इस आिय के आदिे क् या है? दकस जअनजनयम के तहत दकया गया ह ैआदद जअनजनर्ददष् ट दकया जाना चाजहए।

(7) ब् यूरो अजधजनयम की धारा 17 के तहत काराअनाई करने के प्रयोजनाथा सभी राज्य नामोदद्दष् ट एजेंजसयों को जअनजनयम-(6) के खण् ड (क) में संदशितभत अननवालन ठरवोटा और खण् ड (ख) में जारी आदिे ों की छाया प्रजत, आअनश् यक दस्ट् ताअनेजों सजहत भेजेगा और कजथत उव-जअनजनयम के खण् ड (ख) के तहत जारी आदिे ों का प्रत् याअनतान करेगा;

(8) जहां अननज्ञाधारक, ब्यूरो द्वारा उव-जअनजनयम (5) के तहत जारी दकए गए ददिा-जनदिे ों का अननवालन करने में जअनफल रहता है, अनहां ब्यूरो सभी राज्य नामोदद्दष्ट एजेंजसयों को सूचना दते े हुए - (क) जअनजनयम 7 के उव-जअनजनयम (1) के तहत अननज्ञाधारक को प्रदत्त अननमजत अनावस ले लेगा;

(ख) केन्‍दरीय सरकार को अननज्ञाधारक द्वारा ऊजाा खवत अजधजनयम की धारा 14 के खण्ड (क) के तहत केन्‍दरीय सरकार द्वारा अजधसूजचत ऊजाा खवत मानक और ब्यूरो द्वारा उव-जअनजनयम (6) के खण्ड (क) द्वारा संदशितभत आदिे ों का अननवालन करने में जअनफलता के समथान में जांच ठरवोटा के साथ, जअनचाराथा और केन्‍दरीय सरकार द्वारा अजधजनयम की धारा 14 के खण्ड (ग) के तहत काराअनाई करने हते न ठरवोटा भेजेगा। (ग) उवभोिाओं के लाभ के जलए, दो माह के अंदर, दकसी राष्ट्रीय या क्षेत्रीय दजै नक समाचार वत्र म ें और दकसी इलेक्रॉजनक या दकसी अन्‍दय तरीके से जैसा उजचत समझा जाए, अननज्ञाधारक का नाम, ब्ांड नाम, मॉडल का नाम या मॉडल संख्या, लोगो और अन्‍दय जअनजनदिे न प्रकाजित करेगा। (घ) संबंजधत राज्य नामोदद्दष्ट एजेंजसयों को अजधजनयम की धारा 27 के तहत अननज्ञाधारक और व्यावारी के जखलाफ आगे अजधजनणाय काराअनाई िनरू करने के जलए सूजचत करेगा।

12. अनमन जत जनरस्ट्त करना :- ब्यूरो जअनजनयम 7 के तहत प्रदत्त अननमजत को जनरस्ट् त कर सकता है, यदद अननज्ञाधारक – (क) जअनजनयम 8 के तहत जअनजनर्ददष्ट दकसी जनयम और िता का वालन नहीं करता; (ख) जअनजनयम 9 के तहत जअनजनर्ददष्ट अअनजध के अंदर लेबल िनल्क का भनगतान नहीं करता;

2. यह अननमजत जनम् नजलजख त के अ्‍य धीन ह ै— (क) जडस्ट् रीब् यूिन रांसफामार के लेबल वर प्रदशितित स्ट्टार स्ट्तर अजधजनयम की धारा के 14 खंड (क) और उवरोि जअनजनयमों म ें प्रदान दकए गए जनयमों और िततों के तहत अजधसूजचत जडस्ट् रीब् यूिन रांसफामार के जलए ऊजाा खवत मानकों के अननरूव होगा;

(ख) लेबल केअनल जडस्ट् रीब् यूिन रांसफामार के ससे मॉडल वर लगाया जाएगा जजसके जलए अननमजत दी गई है; (ग) लेबल, अननज्ञाधारक के खचा वर मनदरत दकया और जडस्ट् रीब् यूिन रांसफामार वर जचवकाया जाएगा; (घ) अननज्ञाधारक यह सनजनजित करेगा दक जडस्ट् रीब् यूिन रांसफामार वर प्रदशितित स्ट्ट ार स्ट्त र हमेिा बना रहगे ा;

(ड.) अननज्ञाधारक प्रजत लेबल सौ रुवए का िनल् क का भनगतान करेगा; (च) अननज्ञाधारक जअनत्तीय अनिा की प्रत्येक जतमाही की समाजि के अगले माह के अंदर ब्यूरो को एक जअनअनरण प्रस्ट्तनत करेगा जजसम ें लेबल दकए गए उवकरणों के उत्वादन और प्रत्येक जतमाही के जलए अशितजत लेबडलग िनल्क का जअनअनरण होगा। अनही ब्यौरे स्ट्अनचाजलत प्रणाजलयों के मा्‍यम से ब्यूरो को भी प्रस्ट्तनत दकए जाएंगे;

NOTIFICATION New Delhi, the 25th August, 2022 No. BEE/S&L/DT/01/22-23.- In exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau of Energy Efficiency (the Bureau) with the previous approval of the Central Government , proposes to amend the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Distribution Transformer) Regulation 2009, the proposed draft amendments are hereby published in the Gazette of India, Extraordinary, as required by sub-section (1) of section 58 of the said Act, for the information of all the persons likely to be affected thereby and inviting their suggestions and objections (if any); and the notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date of their publication in the Gazette of India, Extraordinary;

Objections or suggestions, if any, may be addressed to the Director-General, Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, North Wing, Sector-1, R.K.Puram, New Delhi-110066 and may also be sent at the e-mail of the Bureau at dg-bee@nic.in;

Objections or suggestions which may be received from the persons with respect to the said draft regulations before the expiry of the period of thirty days specified in para 1 above, shall be taken into consideration by the Bureau of Energy Efficiency.

1. Short title and commencement.- (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Distribution Transformer), Amendment Regulations, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition: - (1) In these regulations, unless the context otherwise requires,-

(a) “Act‖ means the Energy Conservation Act, 2001(52 of 2001);

(b) ―Distribution Transformer‖ means an appliance as specified in the notification under clause (b) of section 14 of the Act;

(c) ―Form‖ means a form appended to these regulations;

(d) ―label‖ means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon, distribution transformer;

(e) ―label period‖ means the validity period of the relative energy efficiencies or loss standards which is the total losses at 50% and 100% loading of the distribution transformer notified by the Central Government under clause (a) of section 14 and in case the end period of the validity period of the relative energy efficiencies or loss standards is not notified, it shall be deemed to be valid until new values for the same are notified by the Central Government;

(f) ―permitee‖ means a person or agency to whom permission has been granted to affix label under regulation 7;

(g) ―star rating or star level‖ means the grade of energy efficiency displayed on the label of the Distribution Transformer based on the total losses at 50% and 100% loading of Distribution Transformer notified by the Central Government under clause (a) of section 14 of the Act to denote the relative energy efficiencies or loss standards which is the total losses at 50% and 100% loading of the distribution transformer;

(h) ―trader or seller‖ in relation to any labelled Distribution Transformer means a person who sells or distributes any such Distribution Transformer and includes the shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such Distribution Transformer.

(i) ―Schedule‖ means the Schedule annexed to these regulations;

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label. - (1) On every Distribution Transformer, the following particulars shall be displayed on its label, namely:-

(a) the logo of the Bureau of Energy Efficiency;

(b) Equipment;

(c) Type;

(d) Make/ Manufacturer/Importer;26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(e) Model/ Manufacturing Year;

(f) Transformer Capacity in kVA;

(g) Voltage in kV;

(h) Total losses at 50% loading in watts;

(i) Total losses at 100% loading in watts;

(j) Unique label series code;

(k) star level; and

(l) label period.

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels: - (1) A label containing all the particulars specified in regulation 3 shall be displayed on every Distribution Transformer within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller-

(a) shall not produce the Distribution Transformer with the previous energy consumption standards;

(b) the Distribution Transformer shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the Distribution Transformer in synchronization with revised energy consumption standards;

(c) All preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken in advance.

5. Manner of display of label.-

(1) On every Distribution Transformer, the label shall be stamped as follows, namely:—

(i) The label shall be affixed at the front display of the unit and should be easily visible as referred in sub-regulation (2) of regulation 3 and the permittee shall ensure that the label appears on every registered unit or model on display for identification purpose, at point of sale or hire and the label shall also be printed or pasted to the exterior to the casing containing the unit or model.

(ii) For units not on display, the label may be printed or pasted to the exterior to the casing and this label may be attached to the unit or model when the unit or model is removed from its packaging or the label may be included as a part of the documentation given to the customer or user.

6. Permission for display of label. - (1) No star label shall be affixed on a Distribution Transformer without obtaining the prior permission of the Bureau.

(2) Company registration.- For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees, payable by electronic mode of payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only.

(3) Model registration.- Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by electronic mode of payment; and

(b) documents specified in Form I – (B).

7. Grant of permission.- (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its Manual on standards and labelling, subject to such terms and conditions as specified in regulation 8, –

(a) register the brand in Form II-(A) in electronic form; and

(b) grant permission for affixing label on Distribution Transformer in Form II-(B) in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein.[भाग III—खण् ड 4] भारत का राजवत्र : असाधारण 27

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 is in force.

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

In case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the Distribution Transformer from the date from which the revised star level comes into force shall submit only a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the Distribution Transformer is planned to be launched to synchronise with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely:-

(a) the star level displayed on the label of Distribution Transformer shall conform to energy consumption standards for Distribution Transformer notified by the Central Government under clause (a) of section 14 of the Act;

(b) the label shall be affixed only on such model of Distribution Transformer for which permission has been granted;

(c) the label shall be printed and affixed on the Distribution Transformer at the cost of permittee;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of Distribution Transformer shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year;

(h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Manual on Standard and Labelling.

9. Label fee.- (1) Every permittee shall pay to the Bureau a label fee of hundred rupees for each label affixed on the distribution transformer.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure

of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten percent per annum from the label security fee made under clause (b) of sub-regulation (3) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of label security fee.- Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture distribution transformer.

11. Verification by Bureau.- (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the Distribution Transformer conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) For the purpose of verification, samples shall be picked up at random by Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit and shall be subjected to (a) Measurement of winding resistance test (b) Measurement of Impedance voltage or short circuit impedance and load loss (c) Measurement of No-load loss and current test (d) temperature rise test and (e) short circuit test.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the Distribution Transformer in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories, a notice shall be issued to the permittee in form V for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to sample cost, testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau, and if the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited.

(4) Where samples of Distribution Transformer used for testing fails the test during suo motu testing or challenge testing, the permittee shall be offer another opportunity and the Bureau shall conduct second test with twice the quantity of Distribution Transformer used in the first test in an independent test laboratory which is different from the lab where the first check testing was conducted and shall be duly accredited by National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee. The Bureau shall intimate the permittee in Form V to witness the challenge testing referred to in sub-regulation (3) or the second test referred to in sub- regulation (4) and the expenses to be made towards the procurement and testing of sample.

(5) Where the second test fails, the Bureau shall,-

(a) direct the permittee in Form VI, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label of the Distribution Transformer or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months;

(c) Intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(6) The permittee shall within ten days of the conclusion of the period of two months referred to in sub-regulation (5),-

(a) send the compliance report in Form VII to Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non- compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub-regulation (6) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.

(8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall,-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (6) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;[भाग III—खण् ड 4] भारत का राजवत्र : असाधारण 29

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months;

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission.- The Bureau may cancel the permission granted under regulation 7, if the permittee –

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(c) does not comply with the direction issued under regulation 11.

Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Distribution Transformer) Regulations, 2022, you were permitted to affix label on the Distribution Transformer vide Bureau of Energy Efficiency letter No. ..............dated....... subject to the compliance of the terms and conditions specified therein.

2. The Bureau, under Regulation … of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Distribution Transformer) Regulations, 2022, had purchased a Bureau of Energy Efficiency star labelled Distribution Transformer from your authorised Distributor, dealer, retailer vide Invoice number .......dated for a price of Rs................ and lifted as a sample dated ……by M/s......................, an agency appointed by the Bureau for verification of the particulars displayed on the label under regulation 3 of the aforesaid regulations, affixed by you on the aforesaid purchased Distribution Transformer. The sample duly sealed by M/s............... bearing serial number……..was obtained from M/s..........(Name of the Distributor, dealer, retailer) under signatures of the duly authorised representative of the verification Agency.

3. The Bureau through its aforesaid Verification Agency had transported the sample referred to in para 2 to M/s. ..................., a National Accreditation Board for Testing and Calibration Laboratories accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 4 and 5 of S.O.number ……dated the …. for giving Test Report in accordance with the Form ….given in Annexure to S.O.. number…….. dated the ……..

4. The results of the Test Report on the sample bearing Unique Identification serial number is enclosed. The results of the Test Report indicated that the sampled Distribution Transformer failed to meet the type test at total losses at 50% loading and total loss at 100% etc. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the Distribution Transformer manufactured/imported by you. The Test Results were sent to you vide Bureau of Energy Efficiency letter No... .....

dated........in the name of your authorised Contact person. You were also requested to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

5.The Sample for second check verification Test were picked up …. dated the …. through our authorised Agency M/s. ............and transported to the National Accreditation Board for Testing and Calibration Laboratories accredited Laboratory transported by our authorised Agency, duly sealed by M/s............... and was given Unique Identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification Agency as well as your representatives.

6. The Test results of second check testing are enclosed which are dully checked and counter signed by the competent authorised personnel of the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing.

The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O.number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Distribution Transformer manufactured/imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Distribution Transformer) Regulations, 2022, the Bureau hereby directs to :-

(i) correct the star level displayed on the label of the Distribution Transformer or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by .In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b) of44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] sub-regulation (6) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Distribution Transformer) Regulations, 2022.

9. The Bureau shall take further follow up action in the matter in terms of regulations (5) (6)(7) and (8) of regulation 11 of the Bureau of Energy Efficiency( Particulars and Manner of their Display on Labels of Distribution Transformer) Regulations, 2022.
