1. लघ ुिीषकड और प्रारंभ:

(1) इि जिजियमों को पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (सामान्य िाहक या संजििा िाहक के रूप में िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड की घोषणा करिे के जलए मागडििी जसद्ांत) जिजियम, 2024 कहा िाएगा।

(2) ये सरकारी रािपत्र में अपिे प्रकािि की तारीख से लागू होंगे।

2. पररभाषाएं:

(1) इि जिजियमों में, िब तक दक संिभड से अन्यथा अपेजित ि हो, - 2711 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (क) "अजधजियम" का अथड पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड अजधजियम, 2006 (2006 का 19) ह;ै (ख) दकसी व्यजक्त के संबंध में "संबद्" में ऐसा कोई अन्य व्यजक्त या इसका जिपरीत िाजमल होगा:-

(i) िो प्रत्यि या अप्रत्यि रूप से, स्ट्ियं द्वारा, या कुछ अन्य व्यजक्तयों के साथ जमलकर, प्रथम उक् त व्यजक्त पर जियंत्रण रखता ह;ै या

(ii) िो प्रथम व्यजक्त के कुल मतिाि अजधकार का कम से कम बीस प्रजतित जियंत्रण रखता है; या

(iii) िो उक् त प्रथम व्यजक्त की धाररता कंपिी या सहायक कंपिी है; या

(iv) जिसे बोडड के जिचार में तथ्यों और कारकों के आधार पर सहयोगी मािा िाता है, जिसमें जियंत्रण, स्ट्ितंत्रता, जहतों का टकराि िाजमल है; (ग) "अजधकृत िेत्र" का अथड िह होगा िैसा दक पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (िगर या प्राकृजतक गैस जितरण िेटिकड जबछािा, जिमाडण, प्रचालि या जिस्ट्तार करिे के जलए संस्ट् थाओं को प्राजधकार प्रिाि करिा) जिजियम, 2008 के जिजियम 2 के उप-जिजियम (1) के खंड (ग) में पररभाजषत दकया गया है;

(घ) "अजधकृत संस्ट् था" का अथड अजधजियम की धारा 2 के खंड (घ) में पररभाजषत अिुसार होगा; (ड.) "बोडड" का अथड पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड होगा; (च) "सीिीडी िेटिकड" का अथड "िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड" िैसा दक अजधजियम की धारा 2 के खंड (i) में पररभाजषत दकया गया है;

(छ) "सामान्य िाहक या संजििा िाहक िमता" का अथड ह ैओपि एक् सेस के जलए सीिीडी िेटिकड में िमता, िैसा दक अजधकृत संस्ट्था की अपिी आिश्यकता के अलािा पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड के जलए एक्सेस कोड) जिजियम, 2020 के तहत घोजषत दकया गया ह;ै (ि) "सीिीडी िेटिकड िमता" का िही अथड होगा िो पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड की िमता का जिधाडरण) जिजियम, 2015 के जिजियम 2 के उप-जिजियम

(1) के खंड (छ) में पररभाजषत है; (झ) "जिपणिकताड" का िही अथड होगा, िो पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड के जलए एक्सेस कोड) जिजियम, 2020 के जिजियम 2 के खंड (ि) में पररभाजषत ह;ै (ञ) "जिपणि जिजिष्टता" का अथड पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड के जलए जिजिष्टता) जिजियम, 2008 के जिजियम 6 में जिर्िडष्ट अिुसार सामान्य िाहक या संजििा िाहक के कायडिेत्र से जिजिष्टता होगी;

(ट) दकसी अजधकृत संस्ट् था के संबंध में, "जििी आिश्यकता" का अथड सीिीडी िेटिकड िमता का िह जहस्ट्सा है, िो प्राजधकृत संस्ट् था या उसके सहयोजगयों द्वारा उपयोग की िाती है, जिसमें जसस्ट्टम द्वारा गैस का उपयोग िाजमल ह;ै (ठ) "जसस्ट्टम द्वारा प्रयुक् त गैस" का िही अथड होगा, िो पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड के जलए एक्सेस कोड) जिजियम, 2020 के जिजियम (2) के उप-जिजियम

(1) के खंड (यछ) के रूप में पररभाजषत ह ै।

(2) इि जिजियमों में प्रयुक्त िब्ि और अजभव्यजक्तयााँ, और जिन् ह ें जिजियमों में पररभाजषत िहीं दकया गया है, लेदकि अजधजियम या उसके अंतगडत बिाए गए जियमों या अन् य जिजियमों में पररभाजषत दकया गया है, क्रमिः अजधजियम म ें या ऐसे जियमों या अन्य जिजियमों, िैसा मामला हो, में उन्ह ेंजिर्िडष्ट दकया गया अथड होगा।

3. प्रयोज्यता - ये जिजियम दकसी प्राजधकृत िेत्र के प्राजधकार पत्र में यथा उजल्लजखत सामान्य िाहक अथिा संजििा िाहक के कायडिेत्र से जिजिष्टता के जलए समयािजध पूरी होिे के बाि प्राजधकृत संस्ट् था पर लागू होंगे।

4. उद्देश्य: इि जिजियमों का उद्देश्य उिमें बताए गए उद्देश्यों को प्राप्त करिे के जलए अजधजियम की धारा 20 की उप-धारा (5) के प्रािधािों को लाग ूकरिा ह,ै अथाडत्: - (क) संस्ट्थाओं के बीच जिष् पि व्यापार और प्रजतस्ट्पधाड को बढािा िेकर उपभोक्ताओं के जहतों की रिा करिा;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (ख) संस्ट्थाओं के बीच प्रजतस्ट्पधाड को बढािा िेिा;

(ग) जिष् फल जििेि से बचिा; या (घ) आपूर्तड को बिाए रखिा या बढािा या समाि जितरण हाजसल करिा या उपभोक्ताओं को प्राकृजतक गैस की पयाडप्त उपलब्धता सुजिजित करिा। पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड के जलए जिजिजष्टता) जिजियम, 2008 के अिुसार, प्राजधकृत संस्ट् थाओं द्वारा सेिा िाजयत्िों को पूरा करिे अजििायड ह ैऔर िे सामान्य िाहक अथिा संजििा िाहक के कायडिेत्र से जिजिष् टता अिजध के भीतर प्राजधकृत भौगोजलक िेत्रों में प्रत्येक चािड िेत्र तक पहुचं िे के जलए बाध्य ह।ैं ऐसे मामले में, िहां प्राजधकृत संस्ट् था जिजिष्टता अिजध के भीतर सभी चािड िेत्रों तक पहुचं गई है, िहां संस्ट्थाओं के बीच प्रजतस्ट्पधाड को बढािा िेिे और प्रजतस्ट्पधी िरों पर गैस उपलब्धता के संिभड में उपभोक्ताओं के जहतों की रिा के जलए प्राजधकृत भौगोजलक िेत्रों के भीतर िए भागीिारों या आपूर्तडकताडओं का जिकल्प होिा चाजहए। तििुसार, ऐसे मामले में बोडड उपरोक्त जिजियम में उजल्लजखत प्रदक्रयाओं का पालि करते हुए अपिे सीिीडी िेटिकों को सामान्य िाहक या संजििा िाहक घोजषत कर सकता ह ै। ऐसे मामले में, िहां प्राजधकृत संस्ट् था सभी चािड िेत्रों तक िहीं पहुचं ी है, ऐसे मामले में प्राजधकृत संस्ट् था द्वारा किर दकया गया िेत्र खुली पहुंच के जलए खोला िाएगा तादक संस्ट्थाओं के बीच प्रजतस्ट्पधाड को बढािा दिया िा सके और गैस उपलब्धता के संिभड में प्रजतस्ट्पधी िरों पर उपभोक्ताओं के जहतों की रिा की िा सके। िेष िेत्र को पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड के जलए जिजिष्टता) जिजियम, 2008 के औजचत् य के आधार पर खुली पहुचं के जलए जिचार दकया िाएगा।

5. सामान्य िाहक या सजं ििा िाहक के रूप म ेंअजधकृत ित्रे के िगर या स्ट्थािीय प्राकृजतक गसै जितरण िटे िकड की घोषणा करि े के जलए मागिड िी जसद्ातं - बोडड प्राजधकृत संस्ट् था के सीिीडी िेटिकड को एक सामान्य िाहक या संजििा िाहक के रूप में घोजषत करते समय, इि जिजियमों के प्रािधािों का पालि करेगा जिसमें अजधजियम की धारा 20 के तहत एक सामान्य िाहक या संजििा िाहक के रूप में सीिीडी िेटिकड घोजषत करिे के जलए बोडड द्वारा जििेजित जसद्ातं ों का पालि करिा िाजमल होगा। प्राजधकृत कंपिी को अजधजियम के अजधिेि और पीएििीआरबी (कंपजियों को िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड जबछािे, जिमाडण, प्रचालि या जिस्ट्तार करिे के जलए प्राजधकार िेिा) जिजियम, 2008 के प्रािधािों के अिुपालि म ें प्राजधकार के अिुसार सीिीडी िेटिकड जिकजसत करिा अपेजित ह।ै सामान्यत: , प्राजधकृत संस्ट् था को िो प्रकार की जिजिष्टता प्रिाि की िाए ; अथाडत् क) सीिीडी िेटिकड जबछािे, जिमाडण या जिस्ट्तार करिे के जलए; और ख) सीजमत अिजध के जलए संजििा िाहक या सामान्य िाहक के कायडिेत्र से छूट के संिभड में। जिजिष्टता प्रिाि करिे का औजचत्य ितडमाि सीिीडी जिजिष्टता जिजियमों के तहत प्रिाि दकया गया है। अजधजियम की धारा 11 के खंड (क) में बोडड द्वारा "संस्ट्थाओं के बीच जिष्पि व्यापार और प्रजतस्ट्पधाड को बढािा िेकर उपभोक्ताओं के जहतों की रिा करिा" का प्रािधाि है । तििुसार, संजििा िाहक या सामान्य िाहक के कायडिेत्र से छूट की जिजिष् टता अिजध के पूरा होिे के बाि, संबंजधत सीिीडी िेटिकों को सामान्य िाहक/संजििा िाहक के रूप में घोजषत दकया िाएगा तादक अजधजियम की धारा 11 के खंड (क) के कायों को कायाडजन्ित दकया िा सके। चूंदक प्रत्येक सीिीडी िेटिकड भूगोल, ििसंख्या, मांग, प्राकृजतक गैस की उपलब्धता के संिभड में जभन्न होते हैं और अन्य गैस की तरह, सभी सीिीडी िेटिकड के जलए एक जसद्ांत लागू िहीं दकया िा सकता ह।ै तििुसार, बोडड इि जिजियमों के तहत सीिीडी िेटिकड को सामान्य िाहक या ठेका िाहक के रूप में घोजषत करते समय अजधजियम की धारा 20 (5) के तहत दिए गए कारकों द्वारा मागडिर्िडत होगा,

6. दकसी अजधकृत ित्रे के सीिीडी िटे िकड को एक सामान्य िाहक या सजं ििा िाहक के रूप म ें घोजषत करि े या अजधजियम की धारा 20 के तहत जिजियजमत करि ेया अिमु जत ििे ेकी प्रदक्रया:4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(1) दकसी सीिीडी िेटिकड को सामान्य िाहक या संजििा िाहक घोजषत करिे के जलए बोडड अपिी राय बिािे से पूिड प्राजधकृत संस्ट् था को सुििाई का अिसर िेगा और सुििाई के पिात् , सुििाई की तारीख से पंद्रह दिि के भीतर उस संिभड में प्राजधकृत संस्ट्था के जलए अपिी राय बिाएगा।

(2) उसके पश् चात् बोडड (िेबहोसस्ट्टंग सजहत) एक राष्ट्रीय और एक स्ट् थािीय िैजिक समाचार-पत्र (संबंजधत प्राजधकृत िेत्र का) में, दकसी अजधकृत संस्ट् था के सीिीडी िेटिकड को सामान्य िाहक या संजििा िाहक या जिजियजमत करिे की घोषणा करिे के जलए या ऐसे सीिीडी िेटिकड तक पहुचं की अिुमजत िेिे के जलए एक सािडिजिक िोरटस िारी करेगा, दक जिसमें संबंजधत सीिीडी िेटिकड का संजिप्त जििरण दिया िाएगा, बोडड जिसे एक सामान्य िाहक या संजििा िाहक के रूप में जिजियजमत करिे या इसकी अिुमजत िेिे के जलए लागू करिा चाहता ह ै और ऐसे सािडिजिक िोरटस िारी होिे के तीस दिि के अंिर इस जिणडय से प्रभाजित होिे की संभाििा िाले सभी व् यजक् तयों और संस्ट् थाओं से आपजत्त और सुझाि, यदि कोई हों, आमंजत्रत करेगा। बिते दक, यदि कोई अजधकृत संस्ट्था कोई आपजत्त और सुझाि प्रस्ट्तुत िहीं करती है, तो यह मािा िाएगा दक उस े सािडिजिक सूचिा में बताए गए बोडड के आिय पर कोई आपजत्त िहीं ह।ै

(3) उप-जिजियम (2) के तहत आपजत्तयां और सुझाि, यदि कोई हों, प्रस्ट्तुत करिे के जलए स्ट् िीकृत अिजध समाप्त होिे पर, बोडड प्राप्त आपजत्तयों सुझािों को अजधकृत संस्ट्था को अग्रेजषत करेगा और अपिी प्रजतदक्रया पंद्रह दििों के अंिर प्रस्ट् तुत करिे का जििेि िेगा ।

(4) उप-जिजियम (3) के तहत दकसी प्राजधकृत संस्ट्था द्वारा प्रत्युत्तर प्रस्ट्तुत करिे की समयािजध की समाजप्त के पिात्, बोडड दकसी प्राजधकृत संस्ट् था को इस मुद्दे पर सुििाई का अिसर प्रिाि करेगा दक उसके सीिीडी िेटिकड को सामान्य िाहक या संजििा िाहक घोजषत क्यों िहीं दकया िािा चाजहए या दकसी तीसरे पि को सीिीडी पहुचं प्रिाि क्यों िहीं की िािी चाजहए।

(5) बोडड ऐसे व्यजक्तयों सजहत सभी जहतधारकों को एक ओपि हाउस बैठक के जलए आमंजत्रत कर सकता है, जिन्होंिे उप- जिजियमि (2) के तहत एक अजधकृत इकाई के साथ अपिी आपजत्तयां और सुझाि प्रस्ट् तुत दकए हैं, जििके सीिीडी िेटिकड को एक सामान्य िाहक या संजििा िाहक के रूप में घोजषत दकया िािा ह।ै

(6) बोडड उपयुडक् त उप-जिजियम (5) के तहत ओपि हाउस के आयोिि की प्रदक्रया के पूरा होिे के पश् चात्, अपिे जिणडय को अजधसूजचत करेगा दक क्या िह दकसी सीिीडी िेटिकड को एक सामान्य िाहक या संजििा िाहक िेटिकड के रूप में घोजषत कर रहा ह ै या पहुंच को जिजियजमत करिे या उस तक पहुचं बिािे की अिुमजत िे रहा है, और लागू जिबंधि एिं ितें क् या होंगी और यह ऐसा जिणडय दकस तारीख से प्रभािी होगा।

(7) अजधकृत संस्ट् था, अपिे स्ट्ियं के अजधकृत िेत्र में सीिीडी िेटिकड की घोषणा के जलए एक सामान्य िाहक या संजििा िाहक िेटिकड के रूप में आिेिि कर सकती ह।ै बोडड उप-जिजियम (1) से (7) में जिर्िडष्ट प्रदक्रया का पालि करिे के बाि आिश् यक पररितडिों सजहत ऐसी जिबंधि एिं ितों पर तथा ऐसी तारीख, िैसा बोडड जिधाडररत करे, सीिीडी िेटिकड को एक सामान्य िाहक या संजििा िाहक िेटिकड घोजषत कर सकता ह।ै

7. जिजिध:

(1) बोडड को इि जिजियमों के संबंध में स्ट्पष्टीकरण िारी करिे का अजधकार होगा और दकसी भी जििाि के मामले में, बोडड द्वारा दिया गया स्ट्पष्टीकरण अंजतम और बाध्यकारी होगा।

(2) यदि इि जिजियमों की व्याख्या के संबंध में कोई प्रश्न उठता ह ैतो उस पर बोडड द्वारा जिणडय जलया िाएगा।

8. जिरसि: पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (िगर या स्ट्थािीय प्राकृजतक गैस जितरण िेटिकड को सामान्य िाहक या संजििा िाहक घोजषत करिे के जलए मागडििी जसद्ांत) जिजियम, 2020 जिरस्ट्त हो िाएंगे। िन् ििा िमाड, सजचि [जिज्ञापि-III/4/असा./048/2024-25][भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 PETROLEUM AND NATURAL GAS REGULATORY BOARD

No. PNGRB/Auth/1-CGD(16)/2020 (Vol-II) (E-4599)- In exercise of the powers conferred by clause (r) of sub-section (1) of section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006) and other applicable provisions of the said Act, the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations, in supersession of the Petroleum and Natural Gas Regulatory Board (Guiding Principles for Declaring City or Local Natural Gas Distribution Networks as Common Carrier or Contract Carrier) Regulations, 2020, so as to be guided by the objectives laid down under sub-section (5) of section 20of the Petroleum and Natural Gas Regulatory Board Act, 2006:-

1. Short title and commencement:

(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Guiding Principles for Declaring City or Local Natural Gas Distribution Networks as Common Carrier or Contract Carrier) Regulations, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions:

(1) In these regulations, unless the context otherwise requires, -

(a) “Act” means the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006);

(b) "Associate", in relation to a person, includes such another person or vice versa; —

(i) who, directly or indirectly, by himself, or in combination with some other persons, exercises control over the first said person; or

(ii) who holds control of at least twenty percent of the total voting right of the first person; or

(iii) who is a holding company or a subsidiary company of the first said person; or

(iv) who in the view of the Board is considered as an associate based on the facts and factors including the extent of control, independence and conflict of interest;

(c) “Authorized area” shall have the meaning as defined in clause (c) of sub-regulation (1) of regulation 2of the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Regulations, 2008;

(d) “Authorized entity” shall have the meaning as defined in clause (d) of section 2 of the Act;

(e) “Board” shall mean the Petroleum and Natural Gas Regulatory Board;

(f) “CGD network” means a “city or local natural gas distribution network” as defined in clause (i) of section 2 of the Act;

(g) “common carrier or contract carrier capacity” means the capacity in a CGD network for open access, as declared by the authroised entity under the Petroleum and Natural Gas Regulatory Board (Access Code for City or Local Natural Gas Distribution Networks) Regulations, 2020, over and above the authorized entity’s own requirement;

(h) “CGD network capacity” shall have the same meaning as defined in clause (g) of sub-regulation

(1) of regulation 2 of the Petroleum and Natural Gas Regulatory Board (Determining Capacity of City or Local Natural Gas Distribution Network) Regulations, 2015;

(i) “marketer” shall have the same meaning as defined in clause (t) of regulation 2 of the Petroleum and Natural Gas Regulatory Board (Access Code for City or Local Natural Gas Distribution Networks) Regulations, 2020;

(j) “marketing exclusivity” shall mean the exclusivity from the purview of common carrier or contract carrier as specified in regulation 6 of the Petroleum and Natural Gas Regulatory Board (Exclusivity for City or Local Natural Gas Distribution Network) Regulations, 2008;

(k) “own requirement”, in respect of an authorized entity, means that part of the CGD network capacity, which is utilized by the authorized entity or its associates, including the system use gas;

(l) “system use gas” shall have the same meaning as defined in clause (zg) of sub-regulation (1) of regulation 2 of the Petroleum and Natural Gas Regulatory Board (Access Code for City or Local Natural Gas Distribution Networks) Regulations, 20206 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) Words and expressions used and not defined in these regulations, but defined in the Act or in the rules or other regulations made thereunder, shall have the meanings respectively assigned to them in the Act or in such rules or other regulations, as the case may be.

3. Applicability. — These Regulations shall apply to an authorised entity after completion of time period for exclusivity from the purview of common carrier or contract carrier as mentioned in the Authorization Letter of an authorised area.

4. Objectives. — The objective of these regulations is to implement the provisions of sub-section (5) of section 20 of the Act to achieve the objectives stated therein, namely: -

(a) protecting the interests of consumers by fostering fair trade and competition amongst the entities;

(b) promoting competition among entities;

(c) avoiding infructuous investment; or

(d) maintaining or increasing supplies or for securing equitable distribution or ensuring adequate availability of natural gas to consumers.

As per the Petroleum and Natural Gas Regulatory Board (Exclusivity for City or Local Natural Gas Distribution Network) Regulations, 2008, the authorized entities are mandated to meet the service obligations and are obliged to reach out to every charge area in the authorized GAs within the exclusivity period from the purview of common carrier or contract carrier.

In case, wherein authorized entity has reached all the charge areas within the exclusivity period there should be option of new players or suppliers within the authorized Geographical areas to foster competition among entities and protect the interests of the consumers in terms of gas availability at competitive rates. Accordingly, in such case the Board may declare their CGD networks as common carrier or contract carrier following the procedures mentioned in the aforesaid Regulation.

In case, wherein authorized entity has not reached all the charge areas, in such case the area which has been covered by the authorized entity shall be opened for open access to foster competition among entities and protect the interests of the consumers in terms of gas availability at competitive rates. The rest area shall be considered for open access based on rationale of the Petroleum and Natural Gas Regulatory Board (Exclusivity for City or Local Natural Gas Distribution Network) Regulations, 2008.

5. Guiding Principles for Declaring the City or Local Natural Gas Distribution Network of an authorised area as Common Carrier or Contract Carrier. — The Board shall, in seeking to declare CGD Network of an authorised entity as a common carrier or contract carrier, follow the provisions of these regulations which constitute the guiding principles to be followed by the Board for declaring the CGD network as a common carrier or contract carrier under section 20 of the Act.

The authorized entity is required to develop CGD networks as per the authorization in compliance of the mandate of the Act and provisions of the PNGRB (Authorizing Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Regulations, 2008. In general, the authorized entity may be granted two kinds of Exclusivity; that it is to say a) for laying, building or expansion of the CGD network; and b) in terms of an exemption from the purview of the contract carriage or common carrier for a limited period of time.

The Rationale for granting exclusivity is provided under extant CGD exclusivity Regulations. Clause (a) of

section 11 of the Act provides for the function of Board as to “protect the interest of consumers by fostering fair trade and competition amongst the entities.” Accordingly, Post completion of exclusivity period of exemption from the purview of contract carrier or common carrier, the respective CGD networks shall be declared as common carrier/contract carrier so that the functions of clause (a) of section 11 of the Act can be implemented.

Since every CGD networks are different in terms of geography, population, demand, availability of natural gas and like other gas, one principle cannot be implemented to all CGD networks. Accordingly, the Board shall be guided by the factors as given under Section 20 (5) of the Act while declaring a CGD network as common carrier or contract carrier under these regulations,

6. Procedure for Declaring the CGD Network of an authorised area as a Common Carrier or Contract Carrier or Regulating or Allowing Access thereto under Section 20 of the Act. —[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7

(1) The Board before forming an opinion for declaring a CGD Network as Common Carrier or Contract Carrier, shall give an opportunity of being heard, to an authorised entity and after hearing, shall form its opinion thereof, within fifteen days from the date of hearing to an authorised entity.

(2) Thereafter, the Board shall issue (including webhosting), a public notice in one national and one vernacular daily newspaper (of the relevant authorized area) of its intention to declare the CGD network of an authorised entity as common carrier or contract carrier or regulate or allow access to such CGD network, giving brief details of the relevant CGD network that the Board is intending to regulate or allow access to, or declare as a common carrier or contract carrier and invite objections and suggestions, if any, within thirty days from the date of issuance of such public notice from all persons and entities (including the authorised entity) likely to be affected by such decision:

Provided that in case, an authorised entity does not submit any objections and suggestions, it shall be presumed that it has no objection to the Board’s intention stated in the public notice.

(3) On expiry of the period allowed for submission of objections and suggestions, if any, under sub- regulation (2), the Board shall forward the objections and suggestions so received, to the authorized entity with the direction to submit its response within fifteen days.

(4) After expiration of time period for submission of the response by an authorised entity under sub- regulation (3), the Board shall provide an opportunity of being heard, to an authorised entity, on the issue as to why its CGD network should not be declared a common carrier or contract carrier or why there no third party should be provided access to its CGD.

(5) The Board may invite all stakeholders including such persons who have offered their objections and suggestions under sub-regulation (2) along with an authorized entity, whose CGD Network is to be declared as a Common Carrier or Contract Carrier, for an open house meeting.

(6) The Board shall after completion of the process of holding an open house under sub-regulation (5), notify its decision as to whether it is declaring the CGD network as a common carrier or contract carrier network or regulating access or allowing access to the same, and the applicable terms and conditions and the date from which such decision shall come into effect.

(7) The authorized entity may, on its own, apply to the Board seeking declaration of the CGD network in its authorised area as a common carrier or contract carrier network. The Board may after following the process specified in sub-regulations (1) to (7) as may be mutantis mutandis applicable, declare such CGD network as a common carrier or contract carrier network on such terms and conditions and from such date as the Board may deem fit.

7. Miscellaneous. —

(1) The Board shall have the power to issue clarifications with regard to these regulations and in case of any dispute, the clarification given by the Board shall be final and binding.

(2) If any question arises as to the interpretation of these regulations, the same shall be decided by the Board.

8. Repeal:

The Petroleum and Natural Gas Regulatory Board (Guiding Principles for Declaring City or Local Natural Gas Distribution Networks as Common Carrier or Contract Carrier) Regulations, 2020 shall stand repealed.
