1. सजं िप्त िीर्डक और प्रारंभ

(1) इि जियमों को पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (प्राकृजतक गैस पाइपलाइि टैररफ का जिधाडरण) संिोधि जिजियम, 2023 कहा िाएगा।

(2) ये रािपत्र में इिके प्रकािि की तारीख से प्रिृत् त होंगे।

2. परे ोजलयम और प्राकृजतक गसै जिजियामक बोडड (प्राकृजतक गसै पाइपलाइि टैररफ का जिधारड ण) जिजियम, 2008 म,ें - क. जिजियम 2 में, उप-जिजियम (1) में; i. खंड (ड.क) के जलए, "प्राकृजतक गैस पाइपलाइि " से िुरू होिे िाले िब्ि और "........का जहस्ट् सा ह ै " के साथ समाप्त होिे िाले िब्ि को जिम्नजलजखत द्वारा प्रजतस्ट्थाजपत दकया िाएगा:- 2032 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] "राष्ट्रीय गैस जिड प्रणाली का जहस्ट्सा बििे िाली प्राकृजतक गैस पाइपलाइि(िें) जबछािे, जिमाडण करिे, प्रचालि या जिस्ट्तार करिे िाली एक या अजधक अजधकृत कंपजियां, िो एकीकृत संजििात्मक पथ के जलए जिपर(रों) के जलए चालाि िारी करती ह"ैं ;

ii. खंड ि के बाि, जिम्नजलजखत खंड िोडा िाएगा, अथाडत् - "(िक) "समाधाि तंत्र" का अथड अिुसूची घ के रूप में सूचीबद्ध एक तंत्र है जिसे बोडड द्वारा समय-समय पर पाइपलाइि कंपजियों के परामिड से अिुसूची ग में जिस्ट्तृत रूप से तैयार दकया िा सकता है।";

iii. खंड (ि) के स्ट्थाि पर जिम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा, अथाडत्:- "(ि) "एकीकृत संजििात्मक पथ" का अथड जिपर(रों) के जलए एकीकृत प्रिेि बबंि ुऔर एकीकृत जिकास बबंि ुके बीच राष्ट्रीय गैस जिड प्रणाली पर माग डह;ै बिते दक िमता बुककंग के समय जिपर(रों) द्वारा एकीकृत संजििात्मक पथ की पुजि की िाए और रांसपोटडर(रों) द्वारा सहमजत िी िाए। आग े बिते दक एकीकृत संजििात्मक पथ पर गैस के पररिहि में कई जिपरों के िाजमल होिे की जस्ट्थजत में, ऐसे सभी जिपरों के जििरण की भी िमता बुककंग के समय पुजि की िाएगी और रांसपोटडर(रों) द्वारा उसे स्ट्िीकार दकया िाएगा।";

iv. खंड (ड) के जलए, अंत में जिम्नजलजखत अंतःस्ट्थाजपत दकया िाएगा, अथाडत्:- "जिसकी िमता बुककंग के समय जिपर द्वारा पुजि की िाएगी और रांसपोटडर द्वारा सहमजत िी िाएगी"; v. खंड (ढ) के जलए, अंत में जिम्नजलजखत अंत:स्ट् थाजपत दकया िाएगा, अथाडत्:- "जिसकी िमता बुककंग के समय जिपर द्वारा पुजि की िाएगी और रांसपोटडर(रों) द्वारा सहमजत िी िाएगी।" ख. "एकीकृत टैररफ के जिधाडरण की प्रदिया और उससे संबंजधत मामले" िीर्ड के अंतगडत जिजियम 5क में;- i. खंड (1) में, अंत म,ें जिम्नजलजखत अंत:स्ट् थाजपत दकया िाएगा, अथाडत;् - "बिते दक यदि ऐसे एकीकृत संजििात्मक माग ड में जिजभन्न कंपजियों की पाइपलाइिें िाजमल हैं, तो ऐसी सभी कंपजियां समाधाि तंत्र के अिुसार पूिड-जिधाडररत अिुपात पर लाग ू एकीकृत िेत्रीय टैररफ के जलए चालाि प्रस्ट् तुत करेगी और उिके संबंजधत चालािों के अिुसार ऐसी चालाि करिे िाली कंपजियों को ऐसे एकीकृत िेत्रीय टैररफ का भुगताि करिे के जलए जिपर उत्तरिायी होंगे;

बिते आगे दक इस तरह के एकीकृत संजििात्मक पथ के जलए ऐसे एकीकृत टैररफ का कुल योग, िो ऐसी चालाि करिे िाली कंपजियों द्वारा ऐसे जिपर(रों) के िाम पर िारी दकया िाता ह,ै ऐसे एकीकृत संजििात्मक पथ के जलए लागू एकीकृत िेत्रीय टैररफ के बराबर होगा। बिते आगे दक लाग ू एकीकृत िेत्रीय टैररफ को अिुमोदित अिुपात से गुणा करिे के बाि ििमलि के िो (02) स्ट्थािों तक पूणाांदकत दकया िाएगा। स्ट्पिीकरण: यह स्ट्पि दकया िाता है दक एकीकृत सजं ििात्मक पथ के जलए लागू टैररफ ित्रे ों के आधार पर जिपर(रों) स ेिल्ु क जलया िाएगा।";

ii. खंड (2) में, "चालाि टांसपोटडर" से िुरू होिे िाले िब्ि और "……. िहाि या भुगताि मात्रा के जलए:" के साथ समाप्त होिे िाले िब्ि को जिम्नजलजखत द्वारा प्रजतस्ट्थाजपत दकया िाएगा, अथाडत्; - "एििीिीएस का जहस्ट्सा बििे िाले संबंजधत पाइपलाइि िेटिकड के जिकास बबंि ु पर रांसपोटडर। िहाि या भगु ताि की मात्रा रांसपोटडर(रों) द्वारा दकए गए संबंजधत गैस रांसजमिि समझौते के अिुसार होगी। िहाि के चालाि या भुगताि मात्रा सजहत चालाि लाग ू एकीकृत टैररफ के पूि-ड जिधाडररत अिुपात पर संजििात्मक पथ म ें िाजमल प्रत्येक पररिहि कंपिी द्वारा प्रस्ट् तुत दकया िाएगा। अिुपात समाधाि तंत्र के अिुसार जिकाला िाएगा।" बिते दक राष्ट्रीय गैस जिड प्रणाली के अलािा अन्य प्राकृजतक गैस पाइपलाइि जबछािे, जिमाडण, प्रचालि या जिस्ट्तार करिे िाली कंपिी ऐसी कंपिी को अिुमोदित टैररफ का भुगताि करिा िारी रखेगी।" iii. खंड (3) में, अंत म,ें जिम्नजलजखत परंतुक िोडा िाएगा, अथाडत्;- "बिते एकीकृत टैररफ जिजियमों (कंपजियों के बीच समाधाि सजहत) के कायाडन्ियि के कारण दकसी भी कंपिी पर कोई अजतररि माल और सेिा कर ("िीएसटी") लाग ू होिे की जस्ट्थजत में, उसे उस िर्ड के जलए संबंजधत कंपिी के रािस्ट्ि पात्रता में िाजमल दकया िाएगा।"[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 ग. "एकीकृत टैररफ के जिधाडरण की प्रदिया" िीर्डक के तहत अिुसूची ख के भाग क में;– i. खंड (3) में, – क) "गैस की मात्रा का योग ..." िब्िों के बाि और "........पररिहि और िहाि या भुगताि की मात्रा", िब्िों के पहले "होिे का अिुमाि", िब् ि िोडे िाएंगे;

ख) "और िहाि की मात्रा या भुगताि ..." िब्िों के बाि और "........ जिसके जलए पाइपलाइि कंपिी" िब्िों से पहले, "यदि कोई हो", िब्ि िोडे िाएंगे; ग) अंत म,ें जिम्नजलजखत परंतुक को प्रजतस्ट् थाजपत दकया िाएगा, अथाडत्,- बिते दक कई पाइपलाइिों के माध्यम से पररिहि की िािे िाली अिुमाजित गैस की मात्रा पर केिल एक बार जिचार दकया िाएगा;

बिते आग े दक एकीकृत टैररफ जिजियमों (कंपजियों के बीच समाधाि सजहत) के कायाडन्ियि के कारण दकसी भी कंपिी पर दकसी भी अजतररि माल और सेिा कर ("िीएसटी") के मामले म,ें उसे उस िर्ड के जलए संबंजधत कंपिी की रािस्ट्ि पात्रता में िाजमल दकया िाएगा;

ii. खंड (4) में, – क) उप खंड (ii) में, "और जिप या भुगताि की मात्रा सजहत ....." िब्िों के बाि "यदि कोई हो", और "…….जिधाडण की जतजथ से पूि’ड’ िब् िों के बाि और " बारह महीिों के िौराि’’ िब्िों से पहले ‘’और यथा उपलब् ध कम समय’’ िोडे िाएंगे;

ख) अंत म,ें जिम्नजलजखत अंत:स्ट् थाजपत दकया िाएगा, अथाडत,्- "(iii) एकीकृत टैररफ जिजियमों (यूजिटों के बीच समाधाि सजहत) के कायाडन्ियि के कारण दकसी भी कंपिी पर कोई अजतररि माल और सेिा कर ("िीएसटी") लाग ू होता ह,ै उसे उस िर् डके जलए संबंजधत कंपिी की रािस्ट्ि पात्रता में अिुमाजित आधार पर िाजमल दकया िाएगा। बोडड द्वारा इस तरह का अिुमाि अंजतम होगा और पाइपलाइि कंपजियों और जिपरों सजहत सभी पर बाध्यकारी होगा। बोडड द्वारा जिचार दकए गए अिुमािों और िास्ट्तजिक के बीच अंतर, यदि कोई हो, का प्रभाि एकीकृत टैररफ के अगले जिधाडरण में बोडड द्वारा समायोजित दकया िाएगा।" iii. खंड 5(1) में, – क) बबंि ु(i) में, "बोडड को. अिुमोदित" से िुरू होिे िाले और "...... और अिुमािों के जलए जलए होगी " के साथ समाप्त होिे िाले िब्िों का लोप दकया िाता है;

ख) बबंि ु (ii) में, "प्रत् येक कैलेण् डर..." से िुरू होिे िाले िब्िों और "उपलब् ध कराती रहगें ी से ..." के िब्िों का लोप दकया िाता है; ग) बबंि ु(iii) में, " प्रत्येक कैलेंडर " से िुरू होिे िाले और ‘’मात्रा भी िाजमल होगी।" के साथ समाप्त होि े िाले िब्िों का लोप दकया िाता ह;ै घ) बबंि ु (iv) को, "ऐसी अिजध के जलए अिुमािों और िास्ट्तजिकताओं के बीच जभन्नता के कारण प्रिाि करें और ऐसे प्रारूप में ि ेंिो बोडड द्वारा आिश्यक हों" प्रजतस्ट्थाजपत दकया िाएगा। iv. खंड 6 में "िोट्स" के िीर्ड के तहत बबंि ु(ii) में "45%" को "52.5%" द्वारा प्रजतस्ट्थाजपत दकया िाएगा । घ. अिुसूची ख के भाग ख में;– i. बबंि ु(1) में, अंत म,ें जिम्नजलजखत परंतुक अंत:स्ट् थाजपत दकया िाएगा, अथाडत्,- "बिते दक एकीकृत टैररफ जिजियमों (कंपजियों के बीच समाधाि सजहत) के कायाडन्ियि के कारण दकसी भी पाइपलाइि कंपिी पर दकसी भी अजतररि माल और सेिा कर ("िीएसटी") के मामले में, उसे उस िर्ड के जलए संबंजधत कंपिी की रािस्ट्ि पात्रता में िाजमल दकया िाएगा;" ii. बबंि ु(3) में, ताजलका में उप बबंि ुi) में कोष्ठक के बाि, िब्ि " +IT1...ITn" अंत:स्ट् थाजपत िाएगा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] iii. बबंि ु (3) में, उप जबन् ि ु i) में "...........पाइपलाइि 1 से n अिजध के जलए" िब्िों के बाि जिम्नजलजखत लाइि अंत:स्ट् थाजपत की िाएगी, अथाडत,् - = एकीकृत टैररफ जिजियमों (कंपजियों के बीच समाधाि सजहत) के कायाडन्ियि के कारण IT ….IT दकसी भी पाइपलाइि कंपिी पर कोई अजतररि माल और सेिा कर ("िीएसटी") लागू 1 n होता ह,ै उसे उस िर्ड के जलए संबंजधत कंपिी के रािस्ट्ि पात्रता में िाजमल दकया िाएगा। iv. बबंि ु (3) में उप जबन् ि ु ii) में, ताजलका में िब्ि "यूएफटी = संबंजधत अिजध के जलए जिधाडररत एकीकृत टैररफ" को जिम्नजलजखत से प्रजतस्ट्थाजपत दकया िाएगा, अथाडत,् - AUFT = समाधाि तंत्र के अिुसार पूिड-जिधाडररत अिुपात पर एकीकृत संजििात्मक पथ के जलए n कंपिी द्वारा प्रभाररत लाग ूएकीकृत िेत्रीय टैररफ िर v. रटप्पजणयों म,ें अंत म,ें जिम्नजलजखत प्रजतस्ट् थाजपत दकया िाएगा, अथाडत्, - "इसके अलािा, एकीकृत टैररफ जिजियमों के कायाडन्ियि के कारण दकसी भी पाइपलाइि कंपिी पर कोई अजतररि माल और सेिा कर ("िीएसटी") लाग ू होता है, (कंपजियों के बीच समाधाि सजहत) तो उसे उस िर् ड के जलए संबंजधत कंपिी के रािस्ट्ि पात्रता में िाजमल दकया िाएगा।” ड. अिुसूची ख में, "अिुसूची ख के अिुलग्नक-1..." से िुरू होिे िाले और "..... रटप्प ण: उपयुडक् त प्रारूपों का उपयोग अिुमाजित मात्रा प्रिाि करिे के जलए भी दकया िाएगा" के साथ समाप्त होिे िाले िब्िों का लोप दकया िाएगा;

च. अिुसूची ग के बाि, जिम्नजलजखत अंत:स्ट् थाजपत दकया िाएगा: अिसु चू ी घ {जिजियम 2(1) (िक)} समाधाि तत्रं का प्रारूप

2. समाधाि तंत्र, राष्ट्रीय गैस जिड प्रणाली ("एििीिीएस") का जहस्ट्सा बििे िाली प्राकृजतक गैस पाइपलाइिों के माध्यम से पररिहि सेिाओं का लाभ उिािे िाले जिपरों सजहत सभी कंपजियों और पाइपलाइि कंपजियां िो अिुसूची ग में िर्णडत एििीिीएस का जहस्ट्सा ह,ैं पर लाग ूहोगा।

3. पररभार्ाएं

4. इस समाधाि तंत्र के प्रयोिि के जलए, िब तक दक संिभड में अन्यथा आिश्यक ि हो, जिम्नजलजखत िब्िों और अजभव् यजक् तयों का िही अथड होगा िो यहां िीचे दिया गया ह:ै (क) "सामान्य मात्रा" का अथड प्राकृजतक गैस की मात्रा से ह ैिो एििीिीएस के तहत आपूर्तड बबंि ुसे अंजतम जिकास बबंि ु तक कई कंपजियों की पाइपलाइि(िों) के माध्यम से गुिरती ह।ै (ख) "घाटे म ेंकंपिी" का अथड उस कंपिी से होगा, जिसे एकीकृत टैररफ प्रभार लेिे से गैस का पररिहि करिे पर रािस्ट्ि में घाटा होिे की उम्मीि है, िो संबंजधत अिजध के िौराि अिुमोदित टैररफ को िखे ते हुए इसकी पात्रता से कम होता ह।ै (ग) "घाटे की राजि", िैसा दक संिभड में अपेजित हो सकता ह,ै का अथड एकीकृत टैररफ के माध्यम से सभी कंपजियों की चालाि राजि और सभी कंपजियों द्वारा रािस्ट्ि पात्रता के बीच जहसाब लगाया गया कोई िकारात्मक अंतर होगा। (घ) "अजं तम जिकास बबिं "ु का अथड उस बबंि ु से होगा िहां से पहले पहचािे गए जिपर(रों) को जडलीिरी के जलए प्राकृजतक गैस पाइपलाइि से गैस जिकाली िाती ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 (ङ) "उद्योग सजमजत" का अथड बोडड द्वारा गरित सजमजत होगी, जिसमें अिसु ूची ग में एििीिीएस का जहस्ट्सा बििे िाली पाइपलाइि कंपजियों द्वारा जिजधित अजधकृत प्रजतजिजधयों को िाजमल दकया िाएगा, िो समाधाि तत्रं के जिकास और प्रचालि के उद्देश्य से तथा एकीकृत टैररफ से संबंजधत मामलों पर संबंजधत पाइपलाइि कंपिी की ओर से कायड करेंगी और जिणडय लेंगी। (च) "इंटरकिेक्िि प्िाइंट" का अथड उस बबंि ुसे ह ै िहां िो अलग-अलग पाइपलाइि कंपजियों के िो सामान्य िाहक या संजििा िाहक पाइपलाइि आपस में िुडते ह ैं और जिस पर एक कंपिी की प्राकृजतक गैस पाइपलाइि में िसू री कंपिी, िो एििीिीएस का एक जहस्ट्सा है, की प्राकृजतक गैस पाइपलाइि से गैस इंिेक्ट की िाती है। (छ) "पाइपलाइि कंपिी" का अथड उस कंपिी से ह ै िो प्राकृजतक गैस पाइपलाइि जबछािे, जिमाणड , प्रचालि या जिस्ट्तार करिे के जलए बोडड द्वारा अजधकृत ह।ै (ि) "समाधाि सजमजत" का अथड इस अिुसूची के पैरा 3.1 (क) के अिुसार गरित सजमजत स े होगा, िो चालाि तैयार करिे, संिह, अजधिेर्/घाटे के समाधाि आदि से संबंजधत डेटा के सत्यापि सजहत इस समाधाि तंत्र के प्रचालि की सुजिधा प्रिाि करेगी। (झ) "एकल कंपिी मात्रा" का अथड एििीिीएस का जहस्ट्सा बििे िाली एकल कंपिी की प्राकृजतक गैस पाइपलाइि(िों) पर एकीकृत संजििात्मक पथ के साथ प्राकृजतक गैस की मात्रा से ह।ै (ञ) "आपर्ू त ड बबिं "ु का अथड उस बबंि ु से ह ै जिस पर आगे के पररिहि के जलए स्रोत से एििीिीएस में गैस इंिेक्ट की िाती ह।ै (ट) "अजधिर्े राजि" िैसा दक संिभड में अपेजित हो सकता है, का अथड एकीकृत टैररफ के माध्यम से सभी कंपजियों की चालाि राजि और सभी कंपजियों द्वारा रािस्ट्ि पात्रता के बीच जहसाब लगाया गया कोई सकारात्मक अंतर होगा। (ि) "अजधिर्े कंपिी" का अथड उस कंपिी से होगा िो एकीकृत टैररफ के प्रभार द्वारा गैस के पररिहि के जलए अजधिेर् रािस्ट्ि प्राप्त करिे की उम्मीि करती ह,ै िो दक संबंजधत अिजध के िौराि अिुमोदित टैररफ को िखे ते हुए पात्रता स े अजधक है। (ड) "लिे -ििे दििस/टी" का अथड चालाि अिजध (पाजिक) का अंजतम दिि होगा, जिसके जलए प्रत्येक व्यजिगत कंपिी जिपर को चालाि भेिती ह।ै (ढ) "काय ड दििस" िजििार, रजििार या सािडिजिक अिकाि के रूप में घोजर्त दिि के अलािा दकसी भी दिि स े संबंजधत होगा। (ण) यहां प्रयुक् त अन्य सभी िब्ि और अजभव्यजियां, जिन् ह ें पररभाजर्त िहीं दकया गया ह,ै तथा पीएििीआरबी अजधजियम, 2006 में और इसके तहत बिाए गए मौिूिा जिजियमों में पररभाजर्त दकया गया ह,ै का िमिः उस अजधजियम में उन्ह ेंदिया गया अथड होगा।

5. समाधाि तत्रं

6. समाधाि सजमजत इस समाधाि तंत्र के प्रचालि को सुजिधाििक बिािे के जलए, िीचे जिधाडररत दकए गए अिुसार एक समाधाि सजमजत का गिि दकया िाएगा: (क) समाधाि सजमजत का गिि

7. समाधाि सजमजत में उद्योग सजमजत के 5 (पांच) सिस्ट्य िाजमल होंगे।

8. समाधाि सजमजत के 5 (पांच) सिस्ट्यों में से 3 (तीि) स्ट्थायी सिस्ट्य होंगे। ("स्ट्थायी सिस्ट्य")।

9. िेर् 2 (िो) सिस्ट्यों का चयि ऐसी कंपजियों द्वारा दकया िाएगा जिन्होंिे ऐसी िेर् कंपजियों ("अस्ट्थायी सिस्ट्य") के प्रजतजिजध के रूप में कायड करिे के जलए स्ट्थायी सिस्ट्य उपलब्ध िहीं कराए हैं। अस्ट्थायी सिस्ट्य को िार्र्डक आधार पर बारी-बारी से जलया िाएगा।

10. स्ट्थायी सिस्ट्यों में से, 1 (एक) सिस्ट्य को स्ट्थायी सिस्ट्यों द्वारा समाधाि सजमजत के प्रमुख सिस्ट्य के रूप में कायड करिे के जलए6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] िार्र्डक आधार पर चुिा िाएगा। प्रमुख सिस्ट्य का कायडकाल पूरा होिे से एक महीिे पहले, स्ट्थायी सिस्ट्य अगले िर्ड के जलए प्रमुख सिस्ट्य तय करेंगे। प्रमुख सिस्ट्य का कायडकाल 1 अप्रैल से अगले िर्ड के 31 माचड तक होगा, िब तक दक समाधाि सजमजत द्वारा बढाया/ घटाया िहीं िाता। पहली बार प्रमुख सिस्ट्य का कायडकाल बोडड द्वारा इस समाधाि तंत्र के अिुमोिि की जतजथ से िुरू होगा।

11. गुिरात स्ट्टेट पेरोिेट जलजमटेड (िीएसपीएल), गेल (इंजडया) जलजमटेड और पाइपलाइि इंफ्रास्ट्रक्चर जलजमटेड (पीआईएल) के प्रजतजिजध तब तक समाधाि सजमजत के स्ट्थायी सिस्ट्य होंगे, िब तक दक उद्योग सजमजत द्वारा बिला/ प्रजतस्ट्थाजपत िहीं दकया िाता ह ैऔर इसके द्वारा बोडड को अजधसूजचत िहीं दकया िाता ह।ै

12. पीआईएल का प्रजतजिजध समाधाि सजमजत का पहला प्रमुख सिस्ट्य होगा, और उसके बाि, प्रमुख सिस्ट् य के दकसी भी बिलाि/ प्रजतस्ट्थापि को समाधाि सजमजत द्वारा बोडड को संपकड जििरण के साथ सूजचत दकया िाएगा। (ख) समाधाि सजमजत का काय:ड

(i) समाधाि सजमजत जियजमत आधार पर और प्रत् येक 15 (पंद्रह) दििों के भीतर बैिक बुलाएगी।

(ii) समाधाि सजमजत के सभी सिस्ट्य समाधाि सजमजत द्वारा जिधाडररत तंत्र के माध्यम से बोडड को यूएफटी/ समाधाि कायड राजि से संबंजधत डेटा प्रस्ट्तुत करिे से पहले इसकी पुजि करेंगे।

(iii) प्रमुख सिस्ट्य के साथ समाधाि सजमजत तब तक काम करेगी िब तक दक टीएसओ/ पूल ऑपरेटर/ स्ट्ितंत्र कंपिी को बोडड/ भारत सरकार द्वारा जियुि िहीं कर दिया िाता ह ैऔर िह उद्योग और/या समाधाि सजमजत की जिम्मेिारी िहीं ले लेता ह।ै

(iv) समाधाि सजमजत 10 िर्ड की अिजध तक पररभाजर्त समाधाि तंत्र के अिुसार की गई सभी गणिाओं का ररकॉडड रखेगी।

13. प्रमखु सिस्ट्य की भजू मकाएं और उत्तरिाजयत्ि प्रमुख सिस्ट्य की भूजमका जिम्न प्रकार होगी: (क) समाधाि सजमजत की बैिकों का समन्िय करिा। (ख) यूएफटी और समाधाि तंत्र के सभी पहलुओं के संबंध में उद्योग सजमजत और बोडड के साथ संचार और समन्िय करिा। (ग) यूएफटी से संबंजधत दकसी भी प्रश्न को स्ट्पि/ समाधाि करिे में बोडड को सहायता ििे ा और समन्िय करिा। (घ) समाधाि सजमजत या उद्योग सजमजत द्वारा जिधाडररत कोई अन्य गजतजिजध। (ङ) दकसी प्रजतजष्ठत स्ट्ितंत्र लेखा परीिक की जियुजि करिा िो सभी समाधाि राजियों और जतमाही आधार पर इसकी कायडप्रणाली की लेखापरीिा करेगी। समाधाि सजमजत द्वारा उद्योग सजमजत के परामिड से संयुि रूप से लेखा परीिक के कायडिेत्र को अंजतम रूप दिया िाएगा। लेखापरीिकों का व् यय उद्योग सजमजत के सभी सिस्ट्यों द्वारा संयुि रूप से िहि दकया िाएगा।

3.3 समाधाि सजमजत का कायिड त्रे (क) बोडड द्वारा एकीकृत टैररफ (“यएू फटी”) की गणिा समाधाि सजमजत (इसके बाि पररभाजर्त) द्वारा प्रिाि की िाएगी। उद्योग सजमजत समाधाि सजमजत की जिजधित और समय पर सहायता करेगी। उद्योग सजमजत के सिस्ट्य यहां दिए गए अिलु ग्ि क-1 के अिुसार होंगे। उद्योग सजमजत में बाि में होिे िाले दकसी भी बिलाि या िए सिस्ट्यों को िाजमल करिे की सूचिा बोडड द्वारा बाि में िी िाएगी। उद्योग सजमजत/ समाधाि सजमजत के प्रत्येक सिस्ट्य का प्रजतजिजधत्ि उसके मुख्य एि ं िैकजल्पक प्रजतजिजध द्वारा हर समय दकया िाएगा। उद्योग सजमजत की सिस्ट्य कंपजियां मुख्य और िैकजल्पक प्रजतजिजधयों से संबंजधत पररितडिों को बोडड को अजिम रूप से सूजचत करेंगी और 5 कायड दििसों की अजतव्यापी समय अिजध सुजिजित करेंगी िहां पि छोडिे िाले और पि िहण करिे िाले िोिों प्रजतजिजध उपजस्ट्थत होंगे। (ख) समाधाि सजमजत बोडड द्वारा यूएफटी जिधाडरण के जलए सामान्य मात्रा के जलए प्रत्येक पाइपलाइि कंपिी के साथ उजचत समाधाि करिे के बाि पाइपलाइि कंपजियों के जलए अन्य बातों के साथ-साथ प्रत्याजित िेत्रीय मात्रा सजहत सभी आिश्यक िस्ट्तािेि/ सूचिा प्रिाि करिे में बोडड की सहायता करेगी। समाधाि सजमजत यह सुजिजित करेगी दक बोडड द्वारा अपेजित कोई भी िस्ट्तािेि/ सूचिा समय पर उपलब्ध कराई िाए। (ग) समाधाि सजमजत समाधाि राजि की गणिा करिे और संबंजधत कंपजियों के साथ समायोिि करिे के जलए कंपजियों[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 द्वारा प्रस्ट्तुत िास्ट्तजिक डेटा का समय-समय पर जमलाि करेगी।

3.4 मात्रा अिमु ािों के जलए डेटा यूएफटी के जिधाडरण के जलए बोडड को अिुमाजित/ प्रत्याजित मात्रा, कैलोरी माि, िेत्रीय िरूरयों के जलए पूिाडिुमाजित डेटा िार्र्डक आधार पर प्रिाि दकया िाएगा, िब तक दक बोडड द्वारा अपेजित ि हो, िो कई कारणों से हो सकता ह ै जिसमें अन्य बातों के साथ-साथ पाइपलाइिों, िो एििीिीएस का एक जहस्ट्सा ह,ैं में पररितडि, मात्रा पूिाडिमु ािों में बड े बिलाि आदि िाजमल ह।ै बोडड के साथ डेटा साझा करिे से पहले सामान्य मात्रा सजहत डेटा का उद्योग सजमजत द्वारा जिजधित जमलाि दकया िाएगा। पीएििीआरबी (प्राकृजतक गैस पाइपलाइि टैररफ का जिधाडरण) जिजियम, 2008 और समय-समय पर दकसी भी संिोधि के प्रािधािों के अिुसार यूएफटी का जिधाडरण और अिुमोिि बोडड द्वारा दकया िाएगा।

14. उपयुडक् त के प्रजत पूिाडिह के जबिा, कंपजियां प्रत्येक िर्ड िििरी के पहले सप्ताह तक बोडड को अगले जित्तीय िर्ड के जलए पूिाडिुमाजित डेटा प्रिाि करेंगी। पूिाडिुमाजित डेटा को अिुलग्ि क-2 में दिए गए प्रारूप के अिुसार या यूएफटी के जिधाडरण के जलए बोडड द्वारा अपेजित अन्य प्रारूप के अिुसार साझा दकया िाएगा। यूएफटी प्रणाली के पररपक्व होिे पर, उद्योग सजमजत मात्रा अिुमािों की अिजध को िार्र्डक से घटाकर अधड-िार्र्डक करिे पर जिचार कर सकती ह ै और इस प्रकार एक अजधक सटीक एकीकृत टैररफ गणिा तय कर सकती ह।ै

3.5 चालाि िारी करि ेके जलए यएू फटी अिपु ात की गणिा (यएू फटी अिपु ात) बोडड प्रत् येक िर्ड 31 िििरी तक यूएफटी अिुपात कायों के जलए पैरा 3.3 में उजल्लजखत पूिाडिुमाजित डेटा के आधार पर समाधाि सजमजत के साथ अपेजित यूएफटी कायों को साझा करेगा। समाधाि सजमजत एििीिीएस का जहस्ट्सा बििे िाली प्रत्येक प्राकृजतक गैस पाइपलाइि के जलए यूएफटी अिुपात और संभाजित अजधिेर् कंपिी और घाटे िाली कंपिी का जहसाब लगाएगी, जिसका उपयोग संबंजधत कंपजियों द्वारा जिपरों को सामान्य मात्रा के चालाि िारी करिे के जलए यूएफटी के जहस्ट्से को जिधाडररत करिे के उद्देश्य से दकया िाएगा। एकल कंपिी मात्रा के मामले में, संबंजधत कंपिी यूएफटी के 100% चालाि िारी करेगी। समाधाि सजमजत प्रत्य ेक िर् ड 15 फरिरी तक बोडड को संभाजित अजधिेर् और घाटे िाली कंपिी के जििरण के साथ यूएफटी अिुपात प्रिाि करेगी। यूएफटी और यूएफटी अिुपात बोडड द्वारा अिुमोदित दकए िाएंग े और प्रत् येक िर्ड माचड के पहले सप्ताह तक इसकी िेबसाइट पर होस्ट्ट दकए िाएंगे। 1 अप्रैल 2023 से प्रभािी यूएफटी के जलए, यूएफटी गणिा उपयुि आईटी मॉडल/या दकसी अन्य मोड के माध्यम से की िाएगी, िैसा दक समाधाि सजमजत द्वारा जिधाडररत दकया गया ह ै और बाि में उद्योग सजमजत के अिुभि के आधार पर, अंजतम यूएफटी जिकालिे के जलए एक उन् ित आईटी टूल जिकजसत और उपयोग दकया िाएगा। सामान् य मात्रा के जलए चालाि प्रस्ट् तुत करिे हते ु यूएफटी अिुपात का उद्देश्य प्रत्येक व्यजिगत कंपिी द्वारा समि अिुमाजित रािस्ट्ि पात्रता प्राप्त करिे के जलए प्राथजमक रूप से अजधिेर् कंपजियों और घाटे िाली कंपजियों के बीच समाधाि की राजि को कम करिा होगा। इसी उद्देश्य के जलए, कंपजियों को अिुमाजित मात्रा के जलए सूचिा के डेटा (केिल अिुमाजित िेत्रीय मात्रा को साझा करिे की आिश्यकता ह ै और व्यजिगत संजििा-िार डेटा साझा करिे की आिश्यकता िहीं ह)ै तथा समाधाि सजमजत के अिुसार अिमु ोदित टैररफ जिधाडररत प्रारूप को समय पर साझा करिे आिश्यकता होगी। सूचिा को सुचारू रूप से और समय पर प्राप्त करिे के अिुभि के आधार पर प्रारूप, जिसमें कंपजियों द्वारा िािकारी साझा की िाएगी, में कोई भी संिोधि को समाधाि सजमजत द्वारा अिुमोदित दकया िाएगा। समाधाि राजि और प्रदिया को अिुकूल बिािे के जलए समाधाि सजमजत द्वारा िीचे दिए गए जसद्धांतों और आधार का पालि करके यूएफटी अिुपात को अंजतम रूप दिया िाएगा:

(क) अजधिेर् कंपजियां कम से कम अजधिेर् उत्पन्न करिे के जलए न्यूितम सहमत अिुपात का चालाि प्रस्ट् तुत करेंगी। िो से अजधक कंपजियों के मामले में, उच्च अिुमाजित अजधिेर् िाली कंपिी न्यूितम सहमत अिुपात का उपयोग करेगी। (ख) िो कंपजियों के मामले में, िह कंपिी जिसके द्वारा अपिे अिुमाजित रािस्ट्ि पात्रता को पूरा करिे की संभाििा है, समायोजित अिुपात पर चालाि प्रस्ट् तुत करेगी िो अपिे अिुमाजित रािस्ट्ि पात्रता के बराबर दकसी भी राजि का चालाि प्रस्ट् तुत करिे के जलए पयाडप्त होगा। (ग) इसी प्रकार, तीि कंपजियों के मामले में, अजधिेर् कंपिी न्यूितम सहमत अिुपात पर चालाि प्रस्ट् तुत करेगी, और िेर् िो कंपजियों के साथ अिुपात को अजधिेर् कंपिी की अिुमाजित रािस्ट्ि पात्रता की सीमा तक सीजमत करिे का प्रयास करेगी।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (घ) िो अजधिेर् कंपजियों के मामले में, कम अिुमाजित रािस्ट्ि पात्रता िाली कंपिी को न्यूितम सहमत प्रजतित पर चालाि िारी करिे की अिुमजत िी िाएगी। (ङ) संजििात्मक पथ से संबंजधत प्रत्येक व्यजिगत कंपिी द्वारा न्यूितम सहमत प्रजतित पर चालाि िारी दकया िाएगा। चालाि िारी करिे के जलए न्यूितम प्रजतित रखिे का उद्देश्य समाधाि राजि को यथासंभि न्यूितम स्ट् तर तक कम करिा ह ैऔर साथ ही प्रत्येक पाइपलाइि कंपिी जिपर के साथ प्रत्यि संजििात्मक संबंध बिाए रख सकती ह।ै (च) ऐसे अन्य पहलू िो उद्योग सजमजत के परामिड से समाधाि संबंधी मद्दु ों पर जिचार करिे के जलए आिश्यक हो सकते ह।ैं (छ) उपयुडक् त जिधाडररत समय-सीमा के अिुसार इस प्रकार जिधाडररत अिुपात बोडड को अिुमोिि के जलए प्रस्ट्तुत दकया िाएगा।

15. इस समाधाि तंत्र को लाग ू करिे के जलए, सभी पाइपलाइि कंपजियां इस समाधाि तंत्र के प्रािधािों के अिुसार उद्योग सजमजत के प्रजतजिजधयों द्वारा पारस्ट् पररक रूप से और समय पर संजििा/ समाधाि तैयार करके उस पर हस्ट् तािर दकए िाएंगे। बिते दक कोई िया सिस्ट्य भी उद्योग सजमजत में िाजमल होिे पर ऐसे संजििा/ करार पर हस्ट्तािर करेगा।

16. 3.6 चालाि िारी करिा प्रत्येक कंपिी जिम्नजलजखत जसद्धांतों के आधार पर चालाि िारी करेगी: (क) चालाि मात्रा - चालाि मात्रा को पाइपलाइि कंपजियों और जिपरों के बीच संबंजधत संजििाओं/ समझौतों के अिुसार संबंजधत कंपिी िेटिकड के जिकास बबंि ुपर मापा िाएगा। (ख) टैररफ – कुल जमलाकर जिपर केिल िोिल यूएफटी लाग ू होिे पर चाि ड दकया िाएगा। अलग-अलग कंपजियां एकल मात्रा के जलए लागू िोिल यूएफटी पर चालाि प्रस्ट् तुत करेंगी। सामान् य मात्रा के जलए जिपरों को लाग ू जोिल यूएफ़टी, समाधाि सजमजत द्वारा जिधारड रत अिुपात और बोडड द्वारा अिुमोदित अिुपात के अिुसार चाि ड दकया िाएगा, बिते दक पूि-ड जिधाडररत अिपु ात के अिुसार चाि ड दकए गए टैररफ की कुल राजि लाग ूजोिल एकीकृत टैररफ़ के बराबर होगी। (ग) जिपर(रों) के एकीकृत संजििात्मक मागड में िाजमल प्रत्येक कंपिी समाधाि सजमजत द्वारा गणिा दकए गए और बोडड द्वारा अिुमोदित पूि डजिधाडररत अिुपात के अिुसार जिपर(रों) को चालाि िारी करेंगी। (घ) पेरोजलयम एि ं प्राकृजतक गैस मंत्रालय द्वारा समय-समय पर िारी दििा-जिििे ों के अिुसार सीिीडी कंपजियों को एपीएम/ गैर-एपीएम घरेलू गैस के आिंटि के जलए िमता की बुककंग के उद्देश्य से, कंपिी (कंपजियों) के पास मात्रा और जिकास बबंि ुको बिलिे की छूट होगी।

17. 3.7 डेटा साझा करिा चालाि िारी करिे के बाि, एििीिीएस का जहस्ट्सा बििे िाली संबंजधत कंपिी पाइपलाइि से संबंजधत डेटा को पाजिक आधार पर समाधाि सजमजत के साथ साझा करेगी। कंपजियों को समाधाि सजमजत को टी+5 कायड दििसों पर या उससे पहले िास्ट्तजिक डेटा प्रस्ट्तुत करिा होगा। डेटा को अिुलग्ि क-3 में प्रिाि दकए गए प्रारूप के अिुसार साझा दकया िाएगा या ऐसे अन्य प्रारूप के रूप में समाधाि सजमजत द्वारा पारस्ट्पररक रूप से सहमजत िी िा सकती ह।ै

18. 3.8 समाधाि राजि की गणिा

19. उपयुडक् त पैरा 3.6 में संिर्भडत कंपजियों द्वारा साझा दकए गए डेटा के आधार पर, समाधाि सजमजत जमलाि काय ड पूरा करेगी और समाधाि राजि की प्रोसेबसंग के जलए एक कायड दििस के भीतर अथाडत् टी+6 कायड दििसों द्वारा उद्योग सजमजत को सजू चत करेगी। घाटे िाली कंपजियों से समाधाि चालाि के प्राप्त होिे की तारीख से अजधिेर् कंपजियां िो कायड दििसों के भीतर भुगताि पूरा कर लेंगी। (क) समाधाि सजमजत अलग-अलग कंपजियों द्वारा प्रस्ट्तुत दकए गए डेटा का जमलाि करेगी और दकसी कंपिी द्वारा डेटा प्रस्ट्तुत करिे में िरे ी के मामले में, िरे ी करिे िाली कंपिी द्वारा जपछले पखिाडे में प्रस्ट्तुत दकए गए डेटा पर अिंजतम आधार पर जिचार दकया िाएगा और अगले पखिाडे आिश्यक समायोिि दकया िाएगा। सभी कंपजियां डेटा के समय पर जमलाि के जलए आिश्यक सहायता/ अजतररि िािकारी प्रिाि करेंगी। (ख) समाधाि राजि का जहसाब लगािे की पद्धजत जिम्नािुसार होगी:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9

20. दकसी भी व्यजिगत कंपिी के जलए समाधाि राजि [जिपरों को िारी दकए गए चालाि की कुल राजि के योग िो लाग ू िेत्रीय यूएफटी अिुपात घटा (-) एििीिीएस का भाग बििे िाली संबंजधत पाइपलाइिों के जलए लाग ूहोिे िाले स्ट्िीकृत टैररफ के आधार पर रािस्ट्ि पात्रता] के बराबर होगी।

21. सकारात्मक समाधाि राजि िाली कंपजियों (अजधिेर्) को ऋणात्मक समाधाि राजि िाली कंपजियों (घाटा) द्वारा चालाि िारी दकया िाएगा।

22. समाधाि सजमजत अजधिेर् कंपजियों और घाटे िाली कंपजियों का जििरण प्रिाि करेगी तथा उद्योग सजमजत को समाधाि राजि की प्रोसेबसंग के बारे में जििरण िते े हुए यह बताएंगी दक कौि दकसके साथ दकतिी राजि को समायोजित करेगी। (ग) अजधिेर् कंपिी द्वारा भुगताि में िरे ी के मामले में, भारतीय स्ट्टेट बैंक की आधार िर (एसबीआईबीआर) की िर से भुगताि की जतजथ पर लाग ूहोिे िाली ब्याि िर प् लस 6.25% प्रजत िर् डजिलंजबत राजि पर लाग ूहोगा। (घ) यदि अजधिेर् कंपिी द्वारा भुगताि में 2 कायड दििसों से अजधक की िरे ी होती ह,ै िैसा दक ऊपर दिया गया ह,ै तो घाटे िाली कंपिी को ब् याि सजहत अजधिेर् राजि से समाधाि चालाि की प्राजप्त की तारीख से तीसरे कायड दििस पर मुआििा दिया िाएगा और ऐसी अजधिेर् कंपिी चालाि की गई राजि और लाग ू ब्याि को िमा करिे की तारीख तक अजधिेर् राजि के प्रासंजगक खाते में िमा करेगी। यदि कोई अजधिेर् राजि िहीं है, तो ब्याि सजहत िये राजि अगले पखिाडे के जिपटारे में ऐसी अजधिेर् कंपिी की रािस्ट्ि पात्रता से समायोजित की िाएगी जिसिे राजि का भुगताि िहीं दकया है। (ङ) इस समाधाि तंत्र के कायाडन्ियि की तारीख से पहले चार महीिों के जलए भुगताि में िरे ी के जलए कोई िंडात्मक िुल्क/ब्याि िहीं होगा, यदि ऐसी िरे ी अजधिेर् कंपिी के जियंत्रण से परे कारणों से हुई है और अजधिेर् कंपिी ि े दकसी भी चूक करिे िाले जिपर भुगताि को छोडकर, अपिी रािस्ट्ि पात्रता से अजधक प्राप्त राजि का समय पर भुगताि दकया ह।ै (च) पहले चार महीिों की अिजध के बाि, जिपर द्वारा दकसी भी िेरी या चूक के बाि, समाधाि सजमजत, जिपर(रों) द्वारा िीटीए के तहत िये राजि का भुगताि ि करिे या जिपर(रों) द्वारा भुगताि में िरे ी करिे, िहां ि तो भुगताि सुरिा तंत्र को लागू दकया िा सकता ह ै और ि ही गैस संचरण को रोका िा सकता ह,ै के संबंध में अजधिेर् कंपिी द्वारा भुगताि ि करिे के मामलों के जलए दकसी सौहािपड ूणड समाधाि पर पहुचं िे के जलए िेकिीयती से चचाड िुरू करेगी। (छ) दकसी भी न् यायालय से दकसी स्ट्थगि आििे और/या ऐसे जिपर के साथ संजििा के तहत सभी भुगताि सुरिा िस्ट् तािेि के समाप्त होिे के कारण जिपर से भुगताि प्राप्त िहीं होिे की जस्ट्थजत में, अजधिेर् कंपिी (कंपजियों) को उस सीमा तक घाटे िाली कंपिी (कंपजियों) को भुगताि करिे की आिश्यकता िहीं होगी। घाटे िाली कंपिी (कंपजियां) इस तरह के भुगताि को अजधिेर् राजि से प्राप्त करेगी। यदि अजधिेर् राजि में कोई िेर् राजि िहीं है, तो कमी की राजि को बाि के पखिाडे के समाधाि कायड में आिश्यक समायोिि करके रािस्ट्ि पात्रता के अिुपात में एििीिीएस का जहस्ट्सा बििे िाली सभी पाइपलाइि कंपजियों द्वारा साझा दकया िाएगा और उसे ऐसे िाहक से राजि प्राप्त होिे के बाि, या अगले पखिाडे में, या अगली यूएफटी समीिा में समायोिि के माध्यम से, िो भी पहले हो, पूरा दकया गया। इसके अलािा, ऐसे जिजिि िाहक के जलए, उस िाहक के रािस्ट्ि और मात्रा को अगली यूएफटी समीिा के समय बाि के पखिाडे के समाधाि कायड और यूएफटी जिधाडरण से रािस्ट्ि पात्रता के जलए िहीं मािा िाएगा। स्ट् थगि के हटिे के बाि ऐसे िाहक से प्राप्त दकसी भी राजि को समाधाि तंत्र के एक भाग के रूप म ें मािा िाएगा। (ि) पहले महीिे के समाधाि डेटा के आधार पर, समाधाि सजमजत अगली जतमाही के जलए अजधिेर् और घाटे िाली कंपिी(कंपजियों) की पहचाि करेगी। अजधिेर् कंपिी (कंपजियां) घाटे िाली कंपिी (कंपजियों) को भुगताि सुरिा प्रिाि करेगी। इस संबंध में समाधाि सजमजत पहले महीिे के िौराि भुगताि सुरिा तंत्र तैयार करेगी। इसके अलािा, समाधाि सजमजत सॉफ्टिेयर के जिकजसत होिे/आईटी प्रणाली के लागू होिे के बाि डेटा िेयररंग, भुगताि की समय-सीमा और भुगताि सुरिा तंत्र की भी समीिा करेगी।

3.9 जििाि समाधाि तत्रं : (क) िुरुआत में जििाि में िाजमल कंपजियों के बीच जििाि को पारस्ट्पररक रूप से हल करिे का प्रयास दकया िाएगा। समाधाि करिे में जिफल होिे की जस्ट्थजत में, जििाि के समाधाि के जलए प्रभाजित कंपिी (कंपजियों) द्वारा समाधाि10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] सजमजत से संपकड दकया िाएगा। (ख) समय पर समाधाि के जलए जििाि/ मुद्दे पर समाधाि सजमजत और संबंजधत कंपजियों के बीच आयोजित एक संयुि बैिक में चचाड की िाएगी। (ग) यदि पार्टडयां उपयुडक् त तंत्र के माध्यम से अपिे समाधाि जििाि को हल करिे में जिफल रहती हैं, तो ऐसे जििािों को अंजतम जिणडय के जलए बोडड को भेिा िा सकता ह।ै

3.10 अजधिेर् राजि प्रबधं ि (क) एक पखिाडे के भीतर अजधिेर् रािस्ट्ि संिह के मामले में, घाटे िाली कंपजियों को भुगताि के बाि, ऐसी अजधिेर् राजि की पहचाि समाधाि सजमजत द्वारा की िाएगी और उसे संबंजधत कंपिी द्वारा स्ट्िीकार दकया िाएगा। (ख) महीिे के अंत में इस अजधिेर् राजि को सेबी के साथ पंिीकृत कम से कम िो िेजडट रेरटंग एिेंजसयों से कम से कम एए+ की िीघडकाजलक िेजडट रेरटंग िाली संबंजधत कंपजियों द्वारा प्रजतिेय सािजध िमा (एफडी) में जििेि दकया िाएगा, बिते दक कंपिी के पास अजधिेर् राजि न्यूितम िस लाख रुपए हो। (ग) कटौती के बाि अर्िडत ब्याि के साथ सािजध िमा राजि और अन्य कोई भी खचड, िैसा दक समाधाि सजमजत द्वारा सहमजत व्यि की गई है, िर् ड भर प्रबंधि का खचड पूरे िर्ड के समाधाि के जलए या बाि के यूएफटी समायोिि के जलए उपयोग दकया िाएगा। (घ) अजधिेर् राजि से जिकासी तंत्र की प्रदिया जिम्नािुसार होगी:

(i) समाधाि सजमजत आंतररक रूप से लाग ूकटौजतयों की गणिा और चचाड करेगी, और सजमजत की प्रत्येक बैिक में उपार्िडत अजधिेर् राजि उपलब्ध कराई िाएगी।

(ii) समय-समय पर, समाधाि सजमजत या तो समाधाि के जलए या बाि के यूएफटी समायोिि के जलए अिेिीत अजधिेर् राजि के उपयोग पर जिचार-जिमिड करेगी। (ड.) पहले चार महीिों के अिुभि के आधार पर, समाधाि सजमजत बोडड के अिुमोिि से यूएफटी सिं ह में कमी की अप्रत्याजित पररजस्ट्थजतयों के जलए जिजधयों की सीमा जिधारड रत करेगी। (च) घाटे की राजि के मामले में, समाधाि सजमजत इस तरह की घाटे की राजि को िीक करिे के जलए तंत्र पर चचाड करेगी िब तक दक ऐसी घाटे की राजि को पूरा िहीं दकया िाता ह।ै उद्योग सजमजत घाटे की राजि को उिकी रािस्ट्ि पात्रता के अिुपात में साझा करेगी।

3.11 असतं ुलि प्रभार (क) कंपजियों द्वारा जिपरों के साथ उिकी संजििाओं के अिुरूप उिके संबंजधत िेटिकड के जलए प्रासंजगक जिजियम के अिुसार असंतुलि मात्रा की गणिा की िाएगी। (ख) असंतुलि प्रभार संजििात्मक पथ में प्रत्येक व्यजिगत कंपजियों के जलए यूएफटी के लागू चालाि अिुपात पर होगा।

NOTIFICATION New Delhi, the 27th March, 2023 PNGRB/Com/10-NGPL Tariff (11)/2022 (P-4142).—In exercise of the powers conferred by clause (t) of sub-section (2) of section 61 read with clause (e) of section 11 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations further to amend the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Regulations, 2008, namely: -

1. Short title and commencement.

(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Amendment Regulations, 2023.

(2) They shall come into force on the date of their publication in the OfficialGazette.

2. In the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Regulations, 2008, — a. In regulation 2, in sub-regulation (1); i. for clause (ea), the words starting with “the authorised entity……” and ending with “……. natural gas grid system ” shall be substituted by the following namely: —[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13 “one or more authorized entities laying, building, operating or expanding natural gas pipeline(s) constituting part of national gas grid system and which raises the invoice on the shipper(s) for the Unified Contractual Path”;

ii. after clause h, following clause shall be inserted, namely— “(ha) “Settlement Mechanism” means a mechanism enlisted as Schedule D which may be framed by the Board from time to time in consultation with pipeline entities as detailed at Schedule C.”;

iii. for clause (l), the following shall be substituted, namely: — “(l) “unified contractual path” means the route on the national gas grid system between the unified entry point and the unified exit point for the shipper(s); Provided that the Unified Contractual Path is to be confirmed by the shipper(s) at the time of capacity booking(s) and agreed by the transporter(s). Provided further that in case there are multiple shippers involved in transportation of gas on the Unified Contractual Path, details of all such shippers shall also be confirmed at the time of capacity booking and accepted by the transporter(s).”;

iv. for clause (m), at the end the following shall be inserted, namely: — “which shall be confirmed by the shipper at the time of capacity booking and agreed by the transporter(s)”; v. for clause (n), at the end the following shall be inserted, namely: — “which shall be confirmed by the shipper at time of capacity booking and agreed by the transporter(s).” b. In regulation 5A under the head “Procedure for Determination of Unified Tariff and matters incidental thereto;– i. in clause (1), at the end, the following shall be inserted, namely; – “Provided that if such unified contractual path consists of pipelines of different entities, then all such entities shall raise invoice towards applicable unified zonal tariff at a pre-defined ratio determined in accordance with the Settlement Mechanism and the shipper(s) shall be liable to pay such unified zonal tariff to such invoicing entities as per their respective invoices;

Provided further that the sum total of such unified tariff for a unified contractual path, charged by such invoicing entities on such shipper(s), shall be equal to the unified zonal tariff applicable for such unified contractual path.

Provided further that the applicable unified zonal tariff after multiplication with approved ratio shall be rounded to two (02) places of decimal.

Clarification: This is to clarify that the shipper(s) will be charged tariff based on the applicable tariff zones for the unified contractual path.”; ii. in clause (2), the words starting with “transporter at the……” and ending with “…….ship or

for pay quantity:”, shall be substituted by the following, namely; – “transporter(s) at the exit point of the respective pipeline network forming part of the NGGS.

The ship or pay quantity will be as per the respective Gas Transmission Agreement entered by the transporter(s). The invoice, including the invoice for ship or pay quantity, will be raised by14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] each transporting entity involved in contractual path at a predefined ratio of applicable unified tariff. The ratio shall be derived in accordance with the Settlement Mechanism.

Provided that the entity laying, building, operating or expanding natural gas pipeline other than the one which is part of national gas grid system shall continue to pay the approved tariff to such entity.” iii. in clause (3), at the end, the following proviso shall be inserted, namely; – “Provided that in case of any additional Goods and Service tax (“GST”) implication on any entity due to implementation of unified tariff regulations (including settlement between entities), the same shall be included in the revenue entitlement of the respective entity for that year.” c. In Part A of Schedule B under the head “Procedure for determination of Unified Tariff”;– i. in clause (3), – a) after the words “the summation of quantity of gas.....” and before the words “........transported and the quantity of ship or pay”, the words “estimated to be”, shall be inserted;

b) after the words “and the quantity of ship or pay.....” and before the words “........for which the pipeline entity”, the words “, if any”, shall be inserted; c) at the end, the proviso shall be substituted as under, namely, –

Provided that the quantities of gas estimated to be transported through multiple pipelines shall be considered only once;

Provided further that in case of any additional Goods and Service tax (“GST”) implication on any entity due to implementation of unified tariff regulations (including settlement between entities), the same shall be included in the revenue entitlement of the respective entity for that year;

ii. in clause (4), – a) in sub-clause (ii), after the words “including ship or pay quantity.....” and before the words “by each pipeline”, the words “, if any”, and after the words “….during the twelve months” and before the words “preceding the date of determination” “or lesser periodas available”shall be inserted;

b) at the end, the following shall be inserted, namely, – “(iii) any additional Goods and Service tax (“GST”) implication on any entity due to implementation of unified tariff regulations (including settlement between entities), the same shall be included in the revenue entitlement of the respective entity for that year on estimated basis. Such estimation by the Board shall be final and binding on all, including pipeline entities and shippers. The impact of the difference, if any, between the estimates considered by the Board and the actuals shall be adjusted by the Board in the next determination of the unified tariff.” iii. in clause 5(1) , – a) in point (i), the words starting with “provide to the Board.......” and ending with “......from the end of that month” is omitted;

b) in point (ii), the words starting with “continue to provide to the Board .......” and ending with “......from the end of that month” is omitted;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15 c) in point (iii), the words starting with “provide to the Board estimates .......” and ending with “......notification of this para.” is omitted;

d) point (iv),the words starting with “provide every month reasons.......” and ending with “.......and actuals of previous month” shall be substituted with the words “provide reasons for variation between estimates and actuals for such period and in such format as may be required by the Board.”;

iv. In clause 6, under the head “Notes” – a) for point (ii) the word “45%” shall be substituted by “52.5%” d. In Part B of Schedule B, – i. in point (1), at the end, the following proviso shall be inserted, namely, – “Provided that in case of any additional Goods and Service tax (“GST”) implication on any pipeline entity due to implementation of unified tariff regulations (including settlement between entities), the same shall be included in the revenue entitlement of the respective entity for that year;” ii. in point (3), after the brackets in sub point i) in the table, the words shall be inserted “+ IT ….ITn”;

1 iii. in point (3), in sub-point i) after the words “………pipelines 1 to n for the period” the following row shall be inserted, namely, – IT IT = any additional Goods and Service tax (“GST”) implication on any pipeline 1…. n entity due to implementation of unified tariff regulations (including settlement between entities), the same shall be included in the revenue entitlement of the respective entity for that year.

iv. in point (3), in sub-point ii), the words in the table “UFT = unified tariff determined for the respective period” the following shall be substituted, namely, – AUFT = Applicable unified zonal tariff rate charged by the entity for unified n contractual path at a predefined ratio determined in accordance with the Settlement Mechanism v. in Notes, at the end, the following shall be inserted, namely, – “Further, any additional Goods and Service tax (“GST”) implication on any pipeline entity due to implementation of unified tariff regulations, (including settlement between entities) the same shall be included in the revenue entitlement of the respective entity for that year.” e. in Schedule B, the words starting with “Attachment 1 to Schedule B......” and ending with “.....Note: Above formats shall be used for providing estimated quantities also” shall be deleted;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] f. After Schedule C, the following schedule shall be inserted:

“ Schedule D {See Regulation 2(1)(ha)} DRAFT SETTLEMENT MECHANISM

1. APPLICABILITY

1.1. The Settlement Mechanism, shall be applicable to all the entities including shippers availing transportation services through the natural gas pipelines forming part of the National Gas Grid System ("NGGS") and pipeline entities which are part of NGGS as detailed at Schedule C.

2. DEFINITIONS

1.2. For the purpose of this settlement mechanism, unless the context otherwise requires, the following words

and expressions shall have the meanings assigned to them herein under: a) “Common Volume” shall mean the quantity of natural gas which traverses through pipeline(s) of multiple entities under the NGGS from the Supply Point to the Final Exit Point.

b) “Deficit Entity” shall mean the entity which is expected to obtain deficit revenue for transportation of gas by charging Unified Tariff which is less than its entitlement considering approved tariff during the relevant period.

c) “Deficit Amount”, as the context may require, shall mean any negative difference calculated between the invoiced amount of all the entities through Unified Tariff and the revenue entitlement by all the entities.

d) “Final Exit Point” shall mean the point at which the gas is evacuated from the natural gas pipeline for delivery to the pre-identified Shipper(s). e) “Industry Committee” shall mean the committee as constituted by Board comprising of duly authorized representatives as nominated by the pipeline entities forming the part of NGGS at Schedule C, for the purpose of development and operationalisation of settlement mechanism and to act and decide on behalf of respective pipeline entity, on matters related to Unified Tariff .

f) “Interconnection Point” means the point where two common carrier or contract carrier pipeline of two different pipeline entities interconnect and at which the gas is injected into the natural gas pipeline of one entity from a natural gas pipeline of other entity which is a part of NGGS.

g) “Pipeline Entity” means an entity who is authorized by the Board to lay, build, operate or expand the natural gas pipeline. h) “Settlement Committee” shall mean the committee constituted in accordance with paragraph 3.1(a) of this Schedule, to facilitate the operationalization of the settlement mechanism including the validation of data pertaining to invoicing, collection, settlement of surplus/deficit, etc.

i) “Single Entity Volume” shall mean the quantity of Natural Gas with Unified Contractual Path on the natural gas pipeline(s) of a single entity forming part of NGGS. j) “Supply Point” means the point at which the gas is injected in the NGGS from the source for further transportation.

k) “Surplus Amount” as the context may require, shall mean any positive difference calculated between the invoiced amount of all the entities through Unified Tariff and the revenue entitlement by all the entities.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 17 l) “Surplus Entity” shall mean the entity which is expected to obtain surplus revenue for transportation of gas by charging Unified tariff, which is more than its entitlement considering approved tariff during the relevant period.

m) “Transactional Day/T” shall mean the last day of the invoicing period (fortnightly) for which each of the individual entities invoice the Shipper. n) “Working Day” shall refer to any day other than a Saturday, a Sunday or a day declared as public holiday.

o) All other words and expressions used herein but not defined, and defined in the PNGRB Act, 2006 an extant regulations framed thereunder, have the meanings respectively assigned to them in that Act.

2. SETTLEMENT MECHANISM

2.1. Settlement Committee In order to facilitate the operation of this settlement mechanism, a Settlement Committee will be formed as

set out hereunder: a) Constitution of Settlement Committee i. The Settlement Committee shall comprise of 5 (five) members from the Industry Committee. ii. 3 (three) out of the 5 (five) members of Settlement Committee shall be permanent members. (“Permanent Member(s)”).

iii. The remaining 2 (two) members shall be selected by the entities which are not Permanent Members, to act as the representative of such remaining entities (“Non-Permanent Member(s)”). The Non-Permanent Member shall be rotated on an annual basis.

iv. Amongst the Permanent Members, 1 (one) member shall be selected on an annual basis to act as the Lead Member of the Settlement Committee by the Permanent Members. One month prior to completion of tenure of the Lead Member, Permanent Members shall decide the Lead Member for the next year. Tenure of Lead Member shall be from 1st of April to 31st March of the following year, unless extended/ reduced by the Settlement Committee.

For the first time Lead Member tenure shall start from the date of approval of this Settlement Mechanism by Board. v. The representative(s) of Gujarat State Petronet Limited (GSPL), GAIL (India) Limited and Pipeline Infrastructure Limited (PIL) will constitute Permanent Members of the Settlement Committee until substituted/replaced by the Industry Committee and notified accordingly by it to the Board.

vi. The representative of PIL shall be the first Lead Member of the Settlement Committee, and thereafter, any substitution/replacement of the Lead Member shall be informed by the Settlement Committee to Board along with contact details.

b) Working of Settlement Committee: i. The Settlement Committee shall convene meetings on a regular basis and not later than every 15 (fifteen) days. ii. All the members of the Settlement Committee shall confirm the data relating to UFT /Settlement working amount before submission to Board through the mechanism as decided by Settlement Committee.

iii. The Settlement Committee along with lead member shall be functional till the time TSO/Pool Operator/ Independent entity is appointed by Board/GoI and takes over the responsibilities of the Industry and/or Settlement Committee.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] iv. The settlement committee shall maintain records of all the calculations carried out as per the defined settlement mechanism upto a period of 10 years.

2.2. Roles and Responsibility of Lead Member

The role of the Lead Member shall be to: a) Co-ordinate the Settlement Committee meetings. b) Communicate and co-ordinate with the Industry Committee and Board with respect to all aspects of the UFT and settlement mechanism.

c) to facilitate and co-ordinate with Board in clarifying/resolving any queries related to UFT. d) Any other activity decided by the Settlement Committee or Industry Committee. e) Appointment of an independent auditor of repute which shall audit all the settlement amounts and its working on a quarterly basis. The scope of the auditor shall be jointly finalized by the Settlement committee in consultation with the Industry Committee. The payment to the auditor shall be released by the entity of the lead member and the expenses of auditors shall be equally shared by all the members of an industry committee.

2.3. Scope of Settlement Committee a) The calculation of unified tariff (“UFT”) by Board shall be facilitated by the Settlement Committee (defined hereinafter). Industry Committee shall duly and timely support the Settlement Committee.

The members of the Industry Committee shall be as per Annexure-1hereto. Any subsequent changes or addition of new members to the Industry Committee shall be notified by the Board subsequently.

Each member of the Industry committee/Settlement Committee shall be represented by its main and alternate representative at all the times. The Industry committee member entities shall notify the changes related to main and alternative representatives to the Board in advance and shall ensure an overlapping time period of 5 working days where both the outgoing and incoming representatives shall be present.

b) The Settlement Committee shall facilitate the Board in providing all the required support documentation/information including, inter alia, anticipated zonal volumes for Pipeline entities after due reconciliation with each Pipeline entity for the common volumes for the UFT determination by the Board. The Settlement Committee shall ensure that any support documentation/information required by Board is provided on a timely basis.

c) The Settlement Committee shall undertake periodic reconciliation of actual data submitted by entities to work out the settlement amount and its adjustment with relevant entities.

2.4. Data for Volume Estimates The forecasted data for estimated/anticipated volumes, calorific values, zonal distances across entities shall be provided on annual basis to Board for determination of UFT, unless as may be required by Board which could be due to several reasons including, inter alia, change of the pipelines which forms part of the NGGS, major changes in volumes forecasts, etc.

The data shall be duly reconciled by the Industry Committee including common volumes prior to such data being shared with the Board. TheUFT shall be determined and approved by Board as per the provisions of PNGRB (Determination of Natural Gas Pipeline Tariff) Regulations, 2008 and any amendments from time to time.

Without prejudice to the above, the entities shall provide the forecasted data for the following financial year with Board by the first week of January of every year. The forecasted data shall be shared as per the format

provided in Annexure-2 or such other format as may be required by Board for determination of UFT. As the UFT system matures, the Industry Committee may look into reducing the duration of the volumes estimations from annual to half-yearly and so on to arrive at a more accurate Unified Tariff calculations.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 19

2.5. Computation of UFT Ratio for Invoicing (UFT Ratio) The Board would share the required UFT working with Settlement Committee based on the forecasted data as mentioned in paragraph 3.3 for UFT Ratio working by 31st January of every year. The Settlement Committee shall calculate the UFT ratio and the likely Surplus Entity and Deficit Entity, for each of the natural gas pipelines forming part of NGGS, which shall be used for the purpose of determining share of UFT for invoicing of Common Volumes to the Shippers by respective entities. In case of Single Entity Volumes, the concerned entity will invoice at 100% of UFT. The Settlement Committee shall provide UFT ratios along with details of likely Surplus and Deficit entity to the Board by 15th February every year.

The UFT and UFT ratios applicable for the subsequent financial year shall be approved by the Board and hosted on its website by the first week of March of every year. For the UFT applicable w.e.f. from 1st April 2023, the UFT calculations shall be performed through suitable IT model/or any other mode as decided by Settlement Committee and subsequently based on the experience of Industry committee, an improved IT tool shall be developed and used for arriving at the final UFT.

The objective of the UFT ratios for invoicing Common Volume shall be to primarily reduce the amount of settlement among the Surplus Entities and Deficit Entities, for achieving the overall estimated revenue entitlement by each individual entity. For the same purpose, entities shall be required to timely share the data of information for estimated volumes (only estimated zonal volumes needs to be shared and individual contract wise data is not required to be shared) and approved tariff with the Settlement Committee as per the prescribed format. Any amendment in the format in which the information shall be shared by the entities be approved by the Settlement committee based on expereince gained for smooth and timely flow of information. The UFT ratios shall be finalized by the Settlement Committee by following below mentioned

principles and basis in order to optimise the settlement amount and process: a) Surplus Entities shall invoice the minimum of the agreed ratios so as to generate lesser surplus. In case of more than two entities, the entity with a higher estimated surplus shall utilize the minimum of the agreed ratios.

b) In case of two entities, the entity which is likely to meet its estimated revenue entitlement shallinvoice at an adjusted ratio which shall besufficient to invoice any amount equal to its estimated revenue entitlement.

c) Similarly,in case of three entities, the Surplus Entity shall invoice at a minimum agreed ratio with the remaining two entities attempting to limit the ratio to the extent of estimated revenue entitlement of the Surplus Entity.

d) In case of two Surplus Entities, the entity with the lower estimated revenue entitlement shall be allowed to invoice at minimum agreed percentage. e) A Minimum agreed percentage shall be invoiced by each of the individual entities related to a contractual path. Purpose to keep minimum percentage for invoicing is to reduce the settlement amount to minimum possible and at the same time each Pipeline entity can maintain the direct contractual relationship with the shipper.

f) Such other aspects as may be necessary considering settlement issues in consultation with the Industry Committee. g) The ratios so determined shall be submitted to the Board for its approval, as per the timeline mentioned above.

To implement this settlement mechanism, all the Pipeline entities shall mutually and timely develop and enter into a contract/agreement among themselves by the representatives of the Industry committee in accordance with the provisions of this settlement mechanism. Provided that upon any new member joining the Industry Committee shall also sign such contract/agreement.

2.6. Invoicing

Each of the entity shall generate the invoice based on following principles:20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] a) Invoicing Quantity – Invoicing quantity shall be measured at the exit point of respective entity networksas per the respective contracts/agreements between Pipeline entities and Shippers.

b) Tariff – The Shipper(s) in total shall only be charged a Zonal UFT as applicable.The individual entities shall generate an invoice at the applicable Zonal UFT for Single Volume. For Common Volume the shippers shall be charged applicable Zonal UFT as per the ratios finalized by the Settlement Committee and approved by the Board provided that sum total of tariff charged as per the pre-determined ratio shall be equal to applicable Zonal unified tariff.

c) Each of the entities involved in the unified contractual path of the Shipper(s) shall invoice the Shipper(s) as per the predetermined ratio calculated by the Settlement Committee and approved by the Board.

d) For the purpose of booking of capacity for allocation of APM/Non-APM domestic gas to CGD entities in accordance with the guidelines issued by MoP&NG from time to time, entity(ies) will have flexibility to change the quantity and exit point.

2.7. Sharing of Data Post invoicing, the data pertaining to the respective entity pipeline forming part of NGGS shall be shared with the Settlement Committee on a fortnightly basis. Entities shall be required to submit the actual data on or before T+5 Working Days to the Settlement Committee. The data shall be shared as per the format

provided in Annexure-3 or such other format as may be mutually agreed by the Settlement Committee.

2.8. Calculation of Settlement Amount Based on the data shared by the entities as referred in paragraph 3.6 above, the Settlement Committee shall complete the reconciliation and convey to Industry Committee within one Working Day i.e. by T+6 Working Days, for settlement amount processing. Surplus Entities shall complete the payment within two Working Days from the date of receipt of settlement invoice from Deficit Entities.

a) The Settlement Committee shall reconcile the data submitted by individual entities and in case of any delay in submission of data by any entity, the data submitted by such delaying entity in previous fortnight shall be considered on a provisional basis and necessary adjustment shall be made in the following fortnight. All the entities shall provide necessary support / additional information required for timely reconciliation of data.

b) The methodology to calculate the settlement amount shall be as follows: i. Settlement amount for any individual entity shall be equal to [the sum of the total amount invoiced to the Shippers basis the applicable Zonal UFT ratio minus (-) the revenue entitlement on the basis of Approved tariffs as applicable for the respective pipelines forming part of the NGGS].

ii. The entities with positive settlement amount (Surplus Entities) shall be invoiced by the entities with negative settlement amount (Deficit Entities). iii. Settlement committee shall provide the details about the Surplus Entities and Deficit Entities and who will adjust with whom along with the amount while conveying the details about the settlement amount processing to Industry Committee.

c) In case of delay in payment by the Surplus Entity, an interest at the rate of State Bank of India’s Base Rate (SBIBR) as applicable on the date of payment plus 6.25 % per annum shall be applicable on the delayed amount.

d) In case there is a delay beyond 2 Working days, as provided above, in payment by the Surplus Entity, the Deficit Entity shall be compensated for the same on 3rd Working day, from the date of receipt of settlement invoice, from the Surplus Amount including interest and such Surplus Entity shall deposit the invoiced amount plus applicable interest accrued till the date of deposit to the relevant account of the Surplus Amount. In case there is no Surplus Amount, then payable amount along with the interest shall be adjusted in the following fortnight’s settlement from the revenue entitlement of such Surplus Entity which has not paid the amount.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 21 e) For the first four months from the date of implementation of this settlement mechanism there shall be no penal charges/interest for delay in payments, in the event such delay has been caused due to reasons beyond the Surplus Entity’s control and in the event the Surplus Entity has made timely payment of the amount received over and above its revenue entitlement, excluding any defaulting Shipper payment.

f) Post the period of the first four months, any delays or defaults by the Shipper, the Settlement Committee shall initiate discussions in good faith in order to arrive at an amicable solution for cases of non-payment by the Surplus Entity due to non-payment of dues under the GTAs by the Shipper(s) or delay in payment by the Shipper(s) where neither payment security mechanism can be invoked nor can the gas transmission be stopped.

g) In case of non-receipt of payment from the Shipper due to any stay order from any court and/or exhaustion of all the payment security instruments under the contract with such Shipper, then to that extent the Surplus Entit(ies) shall not be required to make payment to the Deficit Entit(ies). The Deficit Entit(ies) shall receive such payment from Surplus Amount. In case there is no balance in the Surplus Amount, then the shortfall amount shall be shared by all the pipeline entities forming part of the NGGS, in proportion to the revenue entitlement by making necessary adjustment in the following fortnight settlement working and the same shall be made good after the amount has been received from such customer, or in the following fortnight, or through adjustment in next UFT review, whichever is earlier. Further, for such a specific customer, the revenues and volumes from that customer shall not be considered for revenue entitlement from the following fortnight settlement workings and UFT determination at the time of next UFT review. Any amount received from such customer after the stay is vacated the same shall be considered as a part of the settlement mechanism.

h) Based on the settlement data of first month, the Settlement Committee shall identify the surplus and deficit entity(ies) for the following quarter. The surplus entity(ies) shall furnish the payment security to the deficit entity(ies). In this regard Settlement committee shall formulate a payment security mechanism during the first month. Further, Settlement Committee shall also review the data sharing, payment timelines and payment security mechanism once the software is developed/ IT system is in place.

2.9. Dispute Resolution Mechanism: a) Initially the dispute shall be attempted to be resolved mutually among the entities involved in the dispute. In case of failure to resolve, the Settlement Committee shall be approached by the affected entity(s) for resolution of the dispute.

b) The dispute/issue shall be discussed in a joint meeting held between Settlement Committee and the concerned entities for timely resolution. c) In the event parties fail to resolve their settlement dispute through above mechanism, such disputes may be referred to the Board for final decision.

2.10. Surplus Amount Management a) In case of surplus revenue collection within a fortnight, post payment to Deficit Entities,such Surplus Amount shall be identified by the Settlement Committee and the same shall be acknowledged by the relevant entity.

b) This Surplus Amount at the end of the month shall be invested in a callable fixed deposit (FD) by the respective entities with at-least having a long term credit rating of AA+ from at least two credit rating agencies registered with SEBI, provided that the surplus amount with the entity is minimum Rupees Ten Lakh.

c) The FD amount along with the interest accrued after deduction of applicable tax on the interest income and any other expenses, as agreed by Settlement Committee, incurred for management over the year shall be used for settlements throughout the year or for subsequent UFT adjustments.

d) The process of withdrawal mechanism from the Surplus Amount shall be as follows:22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] i. The Settlement Committee shall internally calculate and discuss the deductions applicable, and the available Surplus Amount accrued in each of the committee meetings.

ii. From time to time, the Settlement Committee shall deliberate on the usage of Surplus Amount either for settlement or as carryforward for subsequent UFT adjustments. e) Based on the first four months of experience, the Settlement Committee shall decide the threshold funds with the approval of the Board to be maintained for the unforeseen circumstances of shortfall in the UFT collection.

f) In case of Deficit Amount, the Settlement Committee shall discuss the mechanism to make good such Deficit Amount till such Deficit Amount is made good on. The Industry Committee shall share the deficit amount in proportion to their revenue entitlement.

2.11. Imbalance Charges a) Imbalance quantity shall be worked out by the entities as per the relevant regulation for their respective networks as per their contracts with the Shippers. b) The imbalance charges shall be at the applicable invoicing ratio of UFT for each of the individual entities in the contractual path.

2.12. Miscellaneous a) In case of revised invoices to Shippers, the same shall be settled in the next billing/payment cycle. b) Bad debts shall be dealt in respective Gas Transmission Agreements (GTAs) and the same shall not impact settlement amount and payment timelines except as provided in paragraph 3.7 above.
