1. सजं िप्त िी्कड और प्रारंभण:

(1) इन जिजनयमों को पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन टैररफ का जनधाडरण) दसू रा संिोधन जिजनयम, 2020 कहा जाएगा।

(2) इन जिजनयमों म ें अन्यथा उल ज् लजखत अनुसार को छोड़कर, ये उस ददन से लाग ू होंग,े जैसा दक बोडड द्वारा सरकारी राजपत्र म ेंअजधसूचना द्वारा जनधाडररत दकया जाएगा। 5710 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

2. पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन टैररफ का जनधाडरण) जिजनयम, 2008 म,ें - क) जिजनयम 2 म,ें उप-जिजनयम (1) म,ें

(i) खंड (ख) के बाद, जनम्नजलजखत खंड को सजम्मजलत दकया जाएगा, अथातड ्:- "(खक)" "अनुमोददत टैररफ" का अथड ह ै पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन ें जबछाने, जनमाडण, प्रचालन या जिस्ट् तार के जलए संस्ट्थ ाओं क को प्राजधकृत करना) जिजनयम, 2008 के जिजनयम 11 के अनुसार इन जिजनयमों या ित्रे -िार टैररफ के जिजनयम 4 के तहत जनधाडररत जोन-िार प्राकृजतक गैस पाइपलाइन टैररफ;”;

(ii) खंड (ड.) के बाद, जनम्नजलजखत खंड सजम्मजलत दकए जाएगं ,े अथाडत:्- "(ड.क) "चालान यूजनट" का अथड ह ै प्राकृजतक गैस पाइपलाइन जबछान,े जनमाडण, प्रचालन या जिस्ट्तार करने के जलए प्राजधकृत संस्ट्थ ा, जहां जिपर द्वारा प्राकृजतक गैस की एकीकृत जनकास बबद ुपर जनकासी की जाती ह ै और जो राष्ट्रीय गैस जिड प्रणाली का जहस्ट्सा ह;ै (ड.ख) "एमएमबीटीय"ू का अथ ड ह ैसकल कैलोरी मान ("जीसीिी") के आधार पर जमजलयन जिरटि थमलड यूजनट;

(ड.ग) "राष्ट्रीय गैस जिड प्रणाली" का अथड ह ै भारत के भीतर ऐसी सभी प्राकृजतक गैस पाइपलाइनों का नेटिकड, जो एक-दसू रे के साथ पूरी तरह स े जुड़ी हुई ह ैं (जजनम ें आंजिक रूप स े स्ट् थाजपत और एक-दसू रे स े जुड़े पाइपलाइन िाजमल ह)ैं और जैसा दक इन जिजनयमों की अनुसूची ग म ें सूचीबद्ध और बोड,ड आदेि द्वारा उक्त अनसु ूची ग में समय-समय पर संिोधन कर सकता ह;ै”

(iii) खंड (i) के बाद, जनम्न जलजखत खंड जोड़े जाएगं ,े अथाडत्:- "(ञ)" "एकीकृत टैररफ के जलए टैररफ जोन" का अथड होगा -

(i) राष्ट्रीय गैस जिड प्रणाली के दोनों ओर एकीकृत प्रििे बबद ुस े तीन सौ दकलोमीटर की लंबाई का "एकीकृत टैररफ के जलए पहला टैररफ जोन"; या

(ii) एकीकृत टैररफ के जलए प्रथम टैररफ जोन के दोनों ओर राष्ट्रीय गैस जिड प्रणाली की ि्े लंबाई के जलए "एकीकृत टैररफ हते ु दसू रा टैररफ जोन": (ट) "एकीकृत टैररफ" का अथड ह ै इन जिजनयमों के जिजनयम 5क के अनुसार जनधाडररत राष्ट्रीय गसै जिड प्रणाली के संबंध म ें यूजनट गैस प्राकृजतक गसै पाइपलाइन टैररफ, जजसे प्राकृजतक गैस के पररिहन के जलए (सांजिजधक कर और िल्ु क को छोड़कर) प्रजत एमएमबीटीय ू रुपए म ेंदिाडया जाता ह;ै, (ठ) "एकीकृत संजिदात्मक पथ" का अथड होगा एकीकृत प्रिेि बबद ु और जिपर के जलए एकीकृत जनकास बबद ु के बीच राष्ट्रीय गैस जिड प्रणाली मागड;

(ड) "एकीकृत प्रिेि बबद"ु का अथ ड राष्ट्रीय गैस जिड प्रणाली पर उस बबद ु स े होगा जहा ं एक जिपर प्राकृजतक गैस इंजेक्ट करता ह;ै (ढ) "एकीकृत जनकास बबद"ु का अथ ड राष्ट्रीय गैस जिड प्रणाली पर उस बबद ु स े होगा जहां स े कोई जिपर प्राकृजतक गैस की जनकासी करता ह।ै "[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 (ख) जिजनयम 3 म,ें खंड (3) के बाद, जनम्नजलजखत खडं सजम्मजलत दकए जाएंग,े अथाडत:्- “(4) अजधजनयम की धारा 42 की उप-धारा (2) के तहत केंद्र सरकार द्वारा जारी नीजतगत जनदेि के अनुसरण म ें बोड ड द्वारा प्राजधकृत;

(5) पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइनें जबछान,े जनमाडण, प्रचालन या जिस्ट् तार के जलए संस्ट् थाओं क को प्राजधकृत करना) जिजनयम, 2008 के जिजनयम 9 के तहत बोड ड द्वारा प्राजधकृत और जजसका टैररफ जिजनयम 5क के अनुसार एकीकृत टैररफ की सीजमत प्रयोज्यता के जलए पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (प्राकृजतक गैस पाइपलाइनें जबछान,े जनमाडण, प्रचालन या जिस्ट्तार के जलए संस्ट् थाओं क को प्राजधकृत करना) जिजनयम, 2008 के जिजनयम 11 के तहत जनधाडररत दकया जाता ह;ै” (ग) जिजनयम 5 के बाद, जनम्नजलजखत सजम्मजलत दकया जाएगा, अथाडत:्- "5क. एकीकृत टैररफ के जनधारड ण की प्रदिया और उसस ेसबं जं धत मामल:े

(1) इन जिजनयमों म ें दकसी बात के होत े हुए, पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन ें जबछान,े जनमाडण, प्रचालन या जिस्ट्तार के जलए संस्ट् थाओं क को प्राजधकृत करना) जिजनयम, 2008 और अजधजनयम के अतं गतड बनाए गए और समय-समय पर लागू अन्य कोई जिजनयम के तहत चालान संस्ट्थ ा चालान प्रस्ट् तुत करेगी और जिपर स े अनुमोददत टैररफ की बजाय एकीकृत संजिदात् मक पथ के जलए एकीकृत टैररफ एकत्र करेगी तथा जिपर ऐसी चालान संस्ट् था को ऐस ेएकीकृत टैररफ का भुगतान करन े के जलए उत्तरदायी होगा;

(2) उप-जिजनयम (1) में संदर्भभत चालान रांसपोटडर द्वारा ऐसा चालान एकीकृत जनकास बबद ुऔर जिप या भुगतान की मात्रा पर जिपर को जडलीिर की गई गैस की मात्रा के जलए ददया जाएगा। बिते दक प्राकृजतक गैस पाइपलाइन जबछान,े जनमाडण, प्रचालन या जिस्ट्तार करने िाली संस्ट्थ ा, राष्ट्रीय गैस जिड प्रणाली का एक जहस्ट्सा ह ै जो जिपर से अनुमोददत टैररफ लते ी रहगे ी और जिपर ऐसी संस्ट् था को अनुमोददत टैररफ़ का भुगतान करता रहगे ा।

(3) प्राकृजतक गैस पाइपलाइनें जबछान,े जनमाडण, प्रचालन या जिस्ट्तार करने िाली संस्ट्थाओं क की राजस्ट्ि पात्रता, जो एकीकृत टैररफ प्रणाली के तहत राष्ट्रीय गैस जिड प्रणाली का जहस्ट्सा ह,ैं ऐसी प्राकृजतक गैस पाइपलाइनों के जलए अनुमोददत टैररफ के संदभड म ें प्राप् त राजस्ट्ि होगा, अथाडत ् संस्ट्थाएँ राजस्ट्ि के प्रजत तटस्ट्थ रहगें ी और एकीकृत टैररफ के जनधाडरण की प्रदिया अनुसचू ी ख के भाग क म ें जिजनर्ददष् ट अनुसार होगी और पाइपलाइन संस्ट्थाओं क के बीच जनपटान की प्रदिया अनुसूची ख के भाग ख म ेंजिजनर्ददष् ट अनुसार होगी।

(4) पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गसै पाइपलाइन टैररफ का जनधारड ण) दसू रा संिोधन जिजनयम, 2020 की तारीख स े छह महीने की प्रारंजभक अिजध के दौरान जहतधारकों स े प्राप्त अनुभि और सझु ाि, यदद कोई हों, पर जिचार करत े हुए बोडड सरकारी राजपत्र में अजधसूजचत आदेि द्वारा, इस जिजनयम के प्रािधानों में जहां भी आिश् यक समझे उपयुक् त संिोधन कर सकता ह ै और ऐसा आदेि जारी होने पर, इस जिजनयम को तदनुसार संिोजधत माना जाएगा।" (घ) अनुसूची क के बाद, जनम्नजलजखत अनुसूजचयां सजम्मजलत की जाएंगी:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] “अनसु चू ी ख [जनयम 5क दखे ]ें भाग क. एकीकृत टैररफ के जनधारड ण की प्रदिया

1. बोडड द्वारा प्रत्येक जित्तीय ि्ड के जलए ऐस े जित्तीय ि्ड के िरूु होने से पहल े राष्ट्रीय गैस जिड प्रणाली के संबंध म ें एकीकृत टैररफ जनधाडररत दकया जाएगा। इस प्रयोजन के जलए जित्तीय ि्ड का अथ ड अप्रैल के पहले ददन स े िुरू होन े िाली अिजध और उसके तरु ंत बाद आन े िाल ेमाचड के इकत् तीसिें ददन समाप्त होना ह।ै बिते दक जजस जतजथ स े यह संिोधन लाग ू होता ह,ै पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (प्राकृजतक गैस पाइपलाइन टैररफ का जनधाडरण) दसू रा संिोधन जिजनयम, 2020 पहली अप्रलै और तीस जसतंबर के बीच होती ह,ै पहली एकीकृत दर उस तारीख स े िुरू होने िाली अिजध के जलए जनधाडररत की जाएगी जजस ददन 2020 का उक्त जिजनयम संिोधन लाग ू होता ह ैऔर उसके तरु ंत बाद आने िाली इकत् तीस माचड को समाप्त होता ह।ै बिते आगे यह दक जजस ददन से पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन टैररफ का जनधाडरण) दसू रा संिोधन जिजनयम, 2020 लागू होता ह,ै िह पहली अक् तूबर और इकत् तीस माचड के बीच होता ह,ै पहली एकीकृत टैररफ उस जतजथ स े िरूु होन े िाली अिजध के जलए जनधाडररत की जाएगी जजस ददन 2020 का उक्त जिजनयम लाग ू होता ह ै और उसके तरु ंत बाद आन े िाली इकत् तीस माच ड को समाप् त होता ह।ै अथातड ,् पहल े एकीकृत टैररफ को छह महीन ेस े अठारह महीने के बीच की अिजध के जलए जनधाडररत दकया जा सकता ह।ै

2. बोडड जित्तीय ि्ड के दौरान संिोजधत टैररफ का जनधाडरण कर सकता ह ै यदद िह ऐसा करना आिश्यक समझता ह।ै बोडड ऐसा कर सकता ह ै यदद पूिडिती प्रािधान की व्यापकता के जबना कोई नई इंटरकनेक्टेड पाइपलाइन जोड़ी जाती ह ै या मौजूदा इंटरकनेक्टेड पाइपलाइन को हटा ददया जाता ह,ै या दकसी इंटरकनेक्टेड पाइपलाइन के संबंध म ें अनुमोददत टैररफ संिोजधत दकया जाता ह,ै या जजसम ें बोडड द्वारा एकीकृत टैररफ का जनधाडरण करन े के जलए जहाज या भुगतान की मात्रा सजहत पररिहन की जान े िाली अनुमाजनत गैस की मात्रा म ें व् यापक पररितडन दकया जाता ह।ै

3. एकीकृत टैररफ राष्ट्रीय गैस जिड प्रणाली का जहस्ट्सा बनने िाली सभी पाइपलाइनों के संबंध म ें अनुमोददत िेत्रीय टैररफ का भाररत औसत होगी, जजसमें पररिहन की गई गैस की मात्रा और जहाज या भगु तान की मात्रा पर जिचार दकया जाता ह,ै जजसके जलए पाइपलाइन संस्ट्थ ा सजं िदात्मक रूप से ऐसी प्रत्येक पाइपलाइन के जलए अनुमोददत टैररफ िसूलने की पात्र ह।ै बिते दक पररिहन की गई गैस की मात्रा और जहाज की मात्रा या कई पाइपलाइनों के माध्यम स े भुगतान केिल एक बार माना जाएगा।

4. बोडड एकीकृत टैररफ का जनधाडरण करेगा जजसमें जनम् नजलजखत लाग ूहोगा -

(i) जनधाडरण की तारीख को लाग ूजोन-िार अनुमोददत टैररफ, और

(ii) जित्तीय ि्ड के दौरान राष्ट्रीय गसै जिड प्रणाली जजसके जलए ऐसे टैररफ का जनधाडरण दकया जा रहा ह,ै का भाग बनन े िाली प्रत् येक पाइपलाइन द्वारा जिप या भुगतान मात्रा सजहत पररिहन की जान े िाली गैस की अनुमाजनत मात्रा का प्रयोग करके एकीकृत टैररफ का जनधाडरण करेगा, और ऐसा अनमु ान लगात े समय, बोडड जनधाडरण की तारीख से पूि ड बारह महीनों के दौरान िास्ट्तजिक मात्रा पर जिचार कर सकता ह,ै जजसके जलए पाइपलाइन सस्ट्ं थाओं क द्वारा डेटा उपलब्ध कराया गया होगा, और पाइपलाइन संस्ट्थ ाओं क द्वारा मात्रा का अनुमान प्रस्ट्तुत दकया गया हो सकता ह ै तथा अन् य कोई कारक जैसा िह उजचत समझे। बोडड द्वारा लगाया गया ऐसा अनुमान अंजतम तथा पाइपलाइन संस्ट्थ ाओं क और जिपर सजहत सभी पर बाध्यकारी होगा। बोड ड द्वारा जनधाडररत अनुमानों और िास्ट्तजिक मात्रा के बीच अंतर, यदद कोई हो, के प्रभाि को बोडड द्वारा एकीकृत टैररफ के अगले जनधाडरण म ें समायोजजत दकया जाएगा।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5

5. (1) प्रत्येक पाइपलाइन संस्ट् था:

(i) बोडड को अनुमोददत टैररफ, पररिहन की गई गैस की िास्ट्तजिक मात्रा और राष्ट्रीय गैस जिड प्रणाली का जहस्ट्सा बनने िाली ऐसी प्रत्येक प्राकृजतक गैस पाइपलाइन के जलए जिप या भुगतान की मात्रा (ऐसी गैस की मानक घन मीटर (एससीएम) और एमएमबीटीय ू तथा कैलोरी मान के संदभ ड म ें व्यि) उपलब् ध कराएगी। पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन टैररफ का जनधाडरण) दसू रा संिोधन जिजनयम, 2020 के लागू होने की तारीख स े तीस ददनों की अिजध के भीतर इस तरह की जानकारी प्रदान की जाएगी, जो उस माह की समाजप् त से अगल े बारह कैलेंडर महीनों की अिजध के जलए इस खंड (जहाज या भगु तान की जाने िाली मात्रा के अनुमानों के अलािा) म ें िर्भणत डेटा-बबदओं कु के तत्क ाल पिू ड बारह कैलेंडर महीनों और माह-िार अनुमानों के जलए होगी।

(ii) प्रत्येक कैलेंडर माह के जलए उस महीने की समाजप् त स े पंद्रह ददनों के भीतर बोडड को खंड (i) म ें िर्भणत सूचना उपलब् ध कराती रहगे ी;

(iii) प्रत्येक कैलडें र माह की समाजप् त पर, बारी-बारी के आधार पर पंद्रह ददनों के भीतर अगल े बारह महीनों के जलए खंड (i) (जिप या भुगतान मात्रा के अनुमान के अलािा) म ें िर्भणत डेटा-बबदओं कु का अनुमान बोडड को प्रदान करेगी और उक्त सूचना म ें एकीकृत जोन-िार मात्रा और पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन टैररफ का जनधाडरण) दसू रा संिोधन जिजनयम, 2020 के लागू होने के बाद गैस की मात्रा भी िाजमल होगी।

(iv) जपछल े महीने के अनुमानों और िास्ट्तजिकता के बीच जभन्नता के जलए हर महीने कारण (पांच प्रजतित स े अजधक सकारात्मक या नकारात्मक) प्रदान करेगी; तथा

(v) बोडड को उसके द्वारा समय-समय पर अपेजित ऐसी अन्य एक-बारगी या आिजधक सूचना जनयजमत रूप से प्रस्ट्ततु करेगी।

(2) बोडड पाइपलाइन सस्ट्ं थाओं क को उप-पैरा (1) म ें िर्भणत अनुसार सूचना, जैसा िह उजचत समझ,े प्रस्ट् ततु करन े के जलए जनदेि जारी कर सकता ह ैजजसमें प्रारूप को स्ट्प ष्ट करना या उसे संिोजधत करना, सूचना प्रस्ट्ततु करन े के जलए ईमेल नाजमत करना तथा पोटलड जनधाडररत करना िाजमल ह ैजजस पर संस्ट्थाओं क द्वारा सूचना अपलोड की जानी ह।ै

(3) इस पैरा के संबंध में जनर्ददष्ट समय के भीतर दकसी भी संस्ट्था द्वारा कोई भी सूचना प्रस्ट्तुत नहीं करन े के मामल े म,ें बोडड एकीकृत टैररफ के जनधाडरण के उद्देश्य स ेअपन े सिोत्तम जनणडय के अनुसार सूचना पर जिचार कर सकता ह।ै

6. सूत्र के अनुसार, एकीकृत टैररफ को नीच ेताजलका म ेंददए गए अनुसार जनधाडररत दकया जाएगा, अथातड ्:- यूएफटी = {(((एटी *ईईिी ) + (एटी *ईईिी ) + (एटी *ईईिी )……+ (एटी * ईईिी )) + एडीज)े / 1 1 2 2 3 3 एन एन ((ईईिी + ईईिी + ईईिी ……+ ईईिी ) - ईडीिी )} 1 2 3 एन एन जहां:

यूएफटी = एकीकृत टैररफ एटी …… एटी = जनधाडरण की तारीख को लाग ू 1 स े एन तक की पाइपलाइनों के संबंध म ें अनुमोददत टैररफ 1 n ईईिी … ईईिी = पररिहन की जाने िाली प्राकृजतक गैस की अनुमाजनत मात्रा तथा जित्तीय ि्ड के दौरान 1 से 1 n एन तक की पाइपलाइनों के जलए जिप या भुगतान मात्रा जजसके जलए एकीकृत टैररफ जनधाडररत दकया जा रहा ह।ै एडीजे एकीकृत टैररफ के जपछले जनधारड ण के दौरान बोडड द्वारा जिचार की गई अनुमाजनत मात्रा और िास्ट्तजिक मात्रा के बीच अंतर, यदद कोई हो, का प्रभाि6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] ईडीिी एन = जित्तीय ि्ड के दौरान एक स े अजधक पाइपलाइनों के माध्यम स े पररिहन की जान े िाली अनुमाजनत प्राकृजतक गैस की मात्रा तथा अनुमाजनत जिप या भुगतान मात्रा जजसके जलए एकीकृत टैररफ जनधाडररत दकया जा रहा ह ै * : गुणन का संकेत दिाडता ह ै / : जिभाजन का संकेत दिाडता ह ै रटप्पजणया:ँ

(i) ऊपर उजल् लजखत ताजलका के अनुसार 1 स े एन तक की पाइपलाइन ें ऐसी पाइपलाइनों के जलए जोन-िार अनुमोददत टैररफ दिाडती ह।ैं इसी प्रकार, ऊपर उजल् लजखत 1 स े एन तक की पाइपलाइन के जलए जिप या भगु तान मात्रा सजहत पररिहन की जाने िाली अनमु ाजनत प्राकृजतक गैस की मात्रा, पररिहन की गई गैस की अनुमाजनत मात्रा तथा ऐसे पाइपलाइन जोन के जलए जिप या भुगतान की अनुमाजनत मात्रा दिाडती ह।ै

(ii) उपयुडक् त ताजलका में ददया गया सूत्र, समान स्ट् तर के एकीकृत टैररफ का जनधाडरण करेगा। बोडड द्वारा दो एकीकृत टैररफ जोन के जलए एकीकृत टैररफ इस तरह स े जनधाडररत दकया जाएगा दक एकीकृत टैररफ के जलए पहल े टैररफ जोन का टैररफ एकीकृत टैररफ के जलए दसू रे टैररफ जोन के टैररफ का 40% होगा।

(iii) इन जिजनयमों म ें गैस की मात्रा एससीएम के संदभ ड म ें व्यि गैस को संदर्भभत करती ह ै और गैस की मात्रा जीसीिी आधार पर एमएमबीटीय ू के सदं भड म ें व्यि की गई गैस को संदर्भभत करती ह।ै

7. समान स्ट् तर के एकीकृत टैररफ और जोनल एकीकृत टैररफ के कामकाज को इस अनुसूची के अनलु ग् नक 2 म ें एक संख्यात्मक उदाहरण की मदद स े ददखाया गया ह।ै भाग ख. जनपटान प्राकृजतक गैस पाइपलाइन संस्ट्थाओं क और ऐसी संस्ट्थ ाओं क द्वारा एकीकृत टैररफ चालान के बीच राजस्ट्ि पात्रता के अंतर को आिजधक आधार पर ऐसी पाइपलाइन संस्ट्थानों के बीच जनपटाया जाएगा, जजसके जलए पाइपलाइन संस्ट्थाओं क द्वारा पाइपलाइन तंत्र का जिकास दकया जाएगा, जजसकी सुजिधा पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गसै पाइपलाइन टैररफ का जनधाडरण) दसू रा संिोधन जिजनयम, 2020 के लागू होने की तारीख से दो महीने की अिजध म ें बोड ड के प्रजतजनजध द्वारा प्रदान की जाएगी।

1. प्राकृजतक गैस पाइपलाइनों की राजस्ट्ि पात्रता अथाडत ् दकसी पाइपलाइन के संबंध म ें प्राकृजतक गैस पाइपलाइन संस्ट् था की राजस्ट्ि पात्रता जो राष्ट्रीय गैस जिड प्रणाली का जहस्ट्सा बनती ह,ै पररिहन की गई गैस की जोन-िार िास्ट्तजिक मात्रा के आधार पर गणना दकए गए पाइपलाइन-िार पररिहन प्रभार के योग के बराबर होगी जजसम ें ऐसी प्रत् यके पाइपलाइन की जिप या भुगतान की मात्रा िाजमल ह ै जजसे उस पाइपलाइन के संबंजधत जोन-िार अनुमोददत टैररफ से गुणा दकया जाता ह।ै

2. चालान संस्ट्थ ा द्वारा ली जान े िाली राजि अथाडत ् प्राकृजतक गसै पाइपलाइनों के संबंध म ें चालान संस्ट्थ ा द्वारा ली जाने िाली राजि जो दक राष्ट्रीय गैस जिड प्रणाली का जहस्ट्सा ह,ै पररिहन की जान े िाली गसै के जलए जिपर को भेजे गए चालान की राजि के योग के बराबर होगी, जजसमें ऐसी प्रत् यके पाइपलाइन के सबं ंजधत एकीकृत टैररफ जोन म ें जिप या भुगतान की मात्रा िाजमल ह ै जजस े अिजध के जलए संबंजधत अनुमोददत एकीकृत जोन टैररफ से गुणा दकया जाता ह।ै

आरय ू = एकीकृत संजिदात् मक पथ के जलए जिप या भगु तान मात्रा सजहत एकीकृत जनकास बबद ु पर जनकाली गई गैस की मात्रा के जलए चालान संस्ट्थ ा द्वारा जलया गया टैररफ एिी ........एिी = पररिहन की गई िास्ट्तजिक मात्रा और संजिदात्मक पथ पर आने िाली प्राकृजतक गैस 1 एन पाइपलाइनों की संख्या के बािजूद एकीकृत संजिदात्मक पथ पर आन े िाल े एकीकृत जनकास बबदओं कु के आधार पर अिजध के दौरान जिप या भुगतान की मात्रा यूएफटी = संबंजधत अिजध के जलए जनधाडररत एकीकृत टैररफ * : गुणन संकेत को दिाडता ह ै रटप्पजणया:ँ ऊपर उजल् लजखत ताजलका के अनुसार पाइपलाइन 1 स े एन का अनुमोददत टैररफ, पाइपलाइन 1 स े एन के जलए प्रत्येक टैररफ जोन के जलए अनमु ोददत टैररफ को दिाडता ह।ै इसी प्रकार, ऊपर उजल्ल जखत ताजलका के अनुसार पाइपलाइन 1 से एन तक पररिहन की गई प्राकृजतक गैस की िास्ट्तजिक मात्रा, ऐसे प्रत् यके जोन में पररिहन की गई िास्ट् तजिक गैस और जिप या भुगतान की मात्रा को दिाडती ह।ै

4. राजस्ट्ि पात्रता और टैररफ चालान की कायडप्रणाली को इस अनुसूची ख के अनलु ग् नक 2 म ें सख्ं यात्मक उदाहरण की मदद स े ददखाया गया ह।ै

5. ऐसी संस्ट्थाओं क द्वारा राजस्ट्ि पात्रता और जिजभन्न संस्ट्थाओं क के बीच प्रभाररत राजि म ेंअंतर का जनपटान दकया जाएगा।

6. बोडड जैसा उजचत समझ,े आग े ऐस े जनदेि और ददिाजनदिे जारी कर सकता ह,ै जजसमें जबना दकसी सीमा के संस्ट्थ ाओं क द्वारा सूचना की आिजधक प्रस्ट् तुजत, राजस्ट्ि पात्रता की कायडप्रणाली और प्रभाररत राजि तथा संस्ट्थाओं क के बीच परस्ट् पर जनपटान िाजमल ह।ै

NOTIFICATION New Delhi, the 23rd November, 2020 F. No. PNGRB/COM/2-NGPL/Tariff (3)/2014 Vol-IV(Part-1) (P-1439).— In exercise of the powers conferred by clause (t) of sub-section (2) of section 61, read with clauses (a) and (e) of section 11 and section 22 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006) and paragraph 14 of the Policy for Development of Natural Gas Pipelines and City or Local Natural Gas Distribution Networks of the Government of India notified on

20.12.2006 in the Gazette of India, Extraordinary, Part-I Section 1 with F. No. L-12022/1/03-GP (Pt. II) to facilitate the creation of a National Gas Grid, the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations further to amend the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Regulations, 2008, namely: —

1. Short title and commencement:-

(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Second Amendment Regulations, 2020.

(2) Except as stated otherwise in these regulations, they shall come into force on such day as the Board may, by

notification in the Official Gazette, appoint.

2. In the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Regulations, 2008,—

(a) in regulation 2, in sub-regulation (1), —

(i) after clause (b), the following clause shall be inserted, namely: — ‗(ba) ―approved tariff‖ means zone-wise natural gas pipeline tariff determined under regulation 4 or zone-wise tariff as per regulation 11 of the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines) Regulations, 2008;‘;

(ii) after clause (e), the following clauses shall be inserted, namely: – ‗(ea) ―invoicing entity‖ means the authorised entity laying, building, operating or expanding natural gas pipeline, where natural gas is evacuated by the shipper at unified exit point, or which is part of national gas grid system;

(eb) ―MMBTU‖ means million British Thermal Units on gross calorific value (―GCV‖) basis;

(ec) ―national gas grid system‖ means network of all such natural gas pipelines within India which are fully interconnected with each other (including those which are partly commissioned and so interconnected) and as enlisted in Schedule C to these regulations and the Board may, by order, amend the said Schedule C from time to time;‘;

(iii) after the clause (i), the following clauses shall be inserted, namely: — ‗(j) ―tariff zones for unified tariff‖ means the-

(i) first tariff zone for unified tariff of a length of three hundred kilometres from the unified entry point on either side of the national gas grid system; or

(ii) second tariff zone for unified tariff, being the remaining length of the national gas grid system on either side

of first tariff zone for unified tariff:

(k) ―unified tariff‖ means unit natural gas pipeline tariff, in respect of the national gas grid system determined in accordance with regulation 5A, for transportation of natural gas (excluding statutory taxes and levies) denominated in rupees per MMBTU;

(l) ―unified contractual path‖ means the route on the national gas grid system between the unified entry point and the unified exit point for a shipper;

(m) ―unified entry point‖ means the point on the national gas grid system where a shipper injects natural gas;

(n) ―unified exit point‖ means the point on the national gas grid system from where a shipper evacuates natural gas.‘;

(b) in regulation 3, after clause (3), the following clauses shall be inserted, namely: — ‗(4) authorized by the Board pursuant to a policy directive issued by the Central Government under sub-section (2) of section 42 of the Act;

(5) authorised by the Board under regulation 9 of the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines) Regulations, 2008 and whose tariff is fixed under regulation 11 of the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] Expand Natural Gas Pipelines) Regulations, 2008, for the limited applicability of unified tariff in accordance with regulation 5A.‘

(c) after regulation 5, the following shall be inserted, namely: — “5A. Procedure for Determination of Unified Tariff and matters incidental thereto:

(1) Notwithstanding anything contained in these regulations, Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Natural Gas Pipelines) Regulations, 2008 and any other regulation made under the Act and for the time being in force, invoicing entity shall raise invoice towards and collect the unified tariff for unified contractual path instead of the approved tariff from the shipper and the shipper shall be liable to pay such unified tariff to such invoicing entity.

(2) The invoice referred to in sub-regulation (1), shall be raised for the quantity of gas delivered to the shipper by the

transporter at the unified exit point and the ship or for pay quantity:

Provided that the entity laying, building, operating or expanding natural gas pipeline other than the one which is part of national gas grid system shall continue to charge the approved tariff from the shipper and the shipper shall continue to pay the approved tariff to such entity.

(3) Revenue entitlement of the entities laying, building, operating or expanding natural gas pipelines which are part of the national gas grid system under unified tariff system, shall be the revenue with reference to approved tariff for such natural gas pipelines, that is to say that the entities shall remain revenue neutral and the procedure for determination of unified tariff shall be as specified in Part A of Schedule B of these regulations and the procedure for settlement amongst the pipeline entities shall be as specified in Part B of Schedule B.

(4) Considering the experience and suggestions, if any, received from the stakeholders during the initial period of six months from the date of the commencement of the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Second Amendment Regulation, 2020, the Board may, by order notified in the official gazette, suitably modify the provisions of this regulation, wherever considered necessary, and on the issue of such order, this regulation shall be deemed to be modified accordingly.‖

(d) after Schedule A, the following Schedules shall be inserted, namely: — “Schedule B [See regulations 5A] Part A. Procedure for determination of Unified Tariff:

1. Unified tariff shall be determined by the Board in respect of the national gas grid system for each financial year before start of such financial year. Financial year for this purpose shall mean a period commencing on the first day of April and ending on thirty-first day of March immediately following it:

Provided that in the event the date on which the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Second Amendment, Regulation, 2020 comes into force is between first April and thirtieth September, the first unified tariff shall be determined for the period commencing from the date on which the said regulations of 2020 comes into force and ending on the immediately following thirty-first March.

Provided further that in the event, the date on which the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Second Amendment, Regulation, 2020 comes into force is between first October and thirty-first March, the first unified tariff shall be determined for the period commencing from the date on which the said regulations of 2020 comes into force and ending on the thirty-first March next from the one immediately following. That is to say that the first unified tariff could be determined for a period ranging between six months to eighteen months.

2. The Board may determine revised unified tariff during the financial year in case it deems it necessary to do so.

Without prejudice to the generality of the foregoing provision, the Board may do so in case any new interconnected pipeline is added or an existing interconnected pipeline is removed, or approved tariff in respect of any interconnected pipeline is revised, or the quantity of gas estimated to be transported including ship or pay quantity considered by the Board for determining the unified tariff undergoes a significant change.

3. Unified tariff shall be the weighted average of approved zonal tariffs in respect of all the pipelines forming part of the national gas grid system, considering the summation of quantity of gas transported and the quantity of ship or pay for which the pipeline entity is contractually entitled to recover approved tariff for each such pipeline.

Provided that the quantities of gas transported and quantities of ship or pay through multiple pipelines shall be considered only once.

4. The Board shall determine the unified tariff applying-

(i) the zone-wise approved tariffs applicable on the date of determination; and[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 17

(ii) the quantity of gas estimated by it to be transported including ship or pay quantity by each pipeline forming part of the national gas grid system during the financial year for which such tariff is being determined and while making such estimates, the Board may consider the actual quantities during the twelve months preceding the date of determination, for which data may have been made available by the pipeline entities, the estimates of the quantities which may have been submitted by the pipeline entities and any other factor as it may deem fit. Such estimation by the Board shall be final and binding on all, including pipeline entities and shippers. The impact of the difference, if any, between the estimates considered by the Board and the actual quantities, shall be adjusted by the Board in the next determination of the unified tariff.

5. (1) Each pipeline entity shall—

(i) provide to the Board monthly zone-wise information of approved tariff, actual volume and quantity of gas transported and the quantity of ship or pay (expressed in terms of standard cubic meters (SCM) and MMBTU and the calorific value of such gas) for each such natural gas pipeline forming part of the national gas grid system. Such information shall be provided within a period of thirty days from the date of the commencement of Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Second Amendment Regulations, 2020, for immediately preceding twelve calendar months and month-wise estimates of the data-points described in this clause (other than estimates for the ship or pay quantities) for a period of next twelve calendar months, from the end of that month.

(ii) continue to provide to the Board information described in clause (i) for each calendar month within fifteen days from the end of that month;

(iii) provide to the Board estimates of the data-points described in clause (i) (other than estimates for the ship or pay quantities) for the next twelve months from the end of each calendar month, on a rolling basis, within fifteen days from the end of that month and the said information shall also include the data on unified zone-wise volumes and quantities of gas after the commencement of Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Second Amendment Regulations, 2020.

(iv) provide every month reasons for variation (either positive or negative exceeding five per cent) between estimates and actuals of previous month; and

(v) submit such other one-time or periodic regular information as may be required by the Board from time to time.

(2) The Board may issue such directions to the pipeline entities as it may deem fit regarding the manner in which information described in sub-paragraph (1) shall be submitted by them, including specifying or modifying formats, designating emails for submission of the information to the Board and specifying the portals on which the information is to be uploaded by the entities.

(3) In case of non-submission of any information by any entity within the specified time in this regard in this paragraph, the Board may consider the information as per its best judgement for the purpose of determination of unified tariff.

Notes:

(i) the approved tariff for pipelines 1 to n, as referred above table, denotes zone-wise approved tariff for such pipelines. Similarly, the quantities of natural gas estimated to be transported including ship or pay quantity for pipeline 1 to n, as referred to above, denotes the estimated quantity of gas transported and the estimated quantity of ship or pay for such pipelines zone;

(ii) the formula provided in the above table shall determine the levelised unified tariff. Unified tariff for the two unified tariff zones shall be determined by the Board in a manner that the tariff for first tariff zone for unified tariff shall be 40% of the tariff for second tariff zone for unified tariff;

(iii) in these regulations the volume of gas refers to gas expressed in terms of SCM and the quantity of gas refers to gas expressed in terms of MMBTU on GCV basis.

7. The workings of levelised unified tariff and the zonal unified tariffs are shown with the help of a numerical example in Attachment 2 to this Schedule.

Part B. Settlement Difference between revenue entitlement of natural gas pipeline entities and unified tariff invoiced by such entities shall be settled amongst such pipeline entities on a periodic basis for which settlement mechanism shall be developed by pipeline entities, facilitated by a representative from the Board within a period of two months from the date of the commencement of Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Second Amendment Regulations, 2020.

1. Revenue entitlement of natural gas pipelines that is to say the revenue entitlement for a natural gas pipeline entity in respect of a pipeline which forms part of national gas grid system shall be equal to the sum of pipeline-wise transportation charges calculated based on zone-wise actual quantity of gas transported including ship or pay quantities of each such pipeline, multiplied by the respective zone-wise approved tariff for that pipeline.

2. Amount charged by invoicing entity that is to say the amount charged by the invoicing entity in respect of natural gas pipelines which are part of national gas grid system shall be equal to the sum of amounts invoiced to the shippers, for natural gas transported including ship or pay quantities in respective unified tariff zones of each such pipeline, multiplied by the respective approved unified zonal tariff for the period.

3. In terms of a formula, entity-wise revenue entitlement and revenue charged by way of unified tariff shall be worked out as provided in the table below, namely:- i) RE = (EEV *AT + EEV *AT +……...+ EEV *AT ) 1 1 2 2 n n

4. The workings of revenue entitlement and tariff invoiced are shown with the help of a numerical example in Attachment 2 to this Schedule.

5. Settlement of difference in the revenue entitlement and amount charged between various entities shall be carried out by such entities.

6. The Board may issue such further instructions and guidelines as it may deem fit including, without limiting, on periodical submission of information by the entities, working of revenue entitlement and amount charged and inter-se settlement between the entities.

7. In case any dispute regarding interpretation arises among the entities relating to these regulations, such entities may approach the Board and Board‘s decision in this regard shall be final.
