1. लघ ुिीर्कड और प्रारंभ:

(1) इन जिजनयमों को पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन टैररफ का जनधाडरण) तीसरा संिोधन जिजनयम, 2020 कहा जाएगा।

(2) य े जिजनयम सरकारी राजपत्र म ेंउनके प्रकािन की तारीख स ेलागू होंगे।

2. पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन टैररफ का जनधारड ण) जिजनयम, 2008, म ें- (क) जिजनयम 2 म,ें उप-जिजनयम (1) म,ें

(i) खंड (घ) के बाद, जनम्नजलजखत खंड जोडा जाएगा, अथातड ्:- "(घक) "असंतलु न प्रबंधन सेिा" का िही अथ ड होगा जो पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (असंतलु न प्रबंधन सेिा) जिजनयम, 2016 म ें ददया गया ह।ै " 5711 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(ii) खंड (झ) के स्ट्थान पर, जनम्नजलजखत खंड प्रस्ट्थ ाजपत दकया जाएगा, अथातड ्:- “(झ) "टैररफ जोन" का अथ ड ह ैिह जोन जजसकी -

(i) इंजेक्िन के बबद ु स े अंजतम बबद ु तक प्राकृजतक गैस पाइपलाइन के मागड के साथ प्रत्येक तीन सौ दकलोमीटर की लंबाई हो: बिते दक प्राकृजतक गैस पाइपलाइन का अंजतम क्षत्रे तीन सौ दकलोमीटर या उससे कम लंबाई का हो:

आग े यह भी दक तीन सौ दकलोमीटर स े कम लंबाई की दकसी भी प्राकृजतक गैस पाइपलाइन को एक जोन के रूप म ें जगना जाएगा; और

(ii) प्राकृजतक गैस पाइपलाइन के साथ एक कोररडोर, जजसकी चौडाई प्राकृजतक गैस पाइपलाइन की कुल लंबाई का दस प्रजतित तक हो, लेदकन इसम ें स्ट् पर लाइनों की लंबाई या दोनों जसरों पर प्राकृजतक गैस पाइपलाइन की सतह पर जनकटतम बबद ुस े पचास दकलोमीटर की दरू ी िाजमल न हो, तथा मलू बबद ुऔर प्राकृजतक गैस पाइपलाइनों के अंजतम बबद,ु जो भी कम हो, िाजमल हों - (क) पहल े टैररफ जोन को दकसी भी उस जोन के संदभ ड म ें जगना जाएगा जजसमें प्राकृजतक गैस पाइपलाइन म ें प्राकृजतक गैस का इंजेक्िन बबद ुिाजमल होता ह;ै और (ख) बाद का टैररफ जोन या एक स े अजधक टैररफ जोन, जैसा भी मामला हो, की गणना प्राकृजतक गैस पाइपलाइन म ें प्राकृजतक गैस की जडलीिरी के जलए संजिदा मागड के साथ-साथ दोनों ओर अलग-अलग की जाएगी;

बिते दक एक ही स्रोत स े प्राकृजतक गैस के पररिहन के जलए प्राकृजतक गैस पाइपलाइन टैररफ जोन के भीतर जस्ट्थत सभी ग्राहकों के जलए समान हो: आग े यह भी दक संस्ट् था प्राकृजतक गैस पाइपलाइन स े एक नई स्ट् पर लाइन जबछान,े जनमाडण, प्रचालन या जिस्ट्तार के जलए तकनीकी-व्यािसाजयक व्यिहायडता के अधीन क्षत्रे म ें जस्ट्थत दकसी भी ग्राहक को प्राकृजतक गैस की आपूर्तत करेगी। स्ट्पष्टीकरण इस खंड के प्रयोजनों के जलए, संस्ट् था बोडड को जिजभन्न टैररफ जोन और इंजेक्िन के प्रत्येक बबद ु स े प्राकृजतक गैस पाइपलाइन म ें उनकी क्रजमक संख्या के बारे म ेंजानकारी दगे ी।" (ख) अनुसूची क म ें–

(i) खंड 5 के उप-खंड 8 के जलए, जनम्नजलजखत खंड प्रस्ट्थ ाजपत दकया जाएगा, अथाडत;्- "[(8) जनयोजजत पूंजी म ें िाजमल दकसी जनयत पररसंपजत्त स े प्राप्त होन े िाली जिजिध आय या दकसी पररचालन लागत के रूप म ें मान े गए व् यय, जजसम ें पेरोजलयम और प्राकृजतक गैस जिजनयामक बोड ड (असंतुलन प्रबंधन सेिा) जिजनयम, 2016 के प्रािधानों के अनुसार असंतलु न प्रबंधन सेिा स े प्राप् त आय िाजमल ह,ै लेदकन इसम ें दकसी जनजित या अन्य पररसंपजत्त की जबक्री या हस्ट्तांतरण पर ब्याज स े प्राप् त आय, लाभ या हाजन िाजमल नहीं ह,ै को जनिल पररचालन लागत माना जाएगा।”

(ii) खंड 6, म ें- (क) उप खंड (1) म,ें मद (घ) के बाद जनम्न जलजखत खंड को जोडा जाएगा, अथातड ्:- “(ड.) पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (प्राकृजतक गैस पाइपलाइन जबछान,े जनमाडण, प्रचालन या जिस्ट् तार के जलए संस्ट्थ ाओं को अजधकृत करना) जिजनयम 2008 के जिजनयम 12 और जिजनयम 21 सजहत दकसी भी अन्य जिजनयम म ें िाजमल दकसी बात के होते हुए, यदद प्राकृजतक गैस पाइपलाइन की क्षमता का बोडड द्वारा अजधकृत दस प्रजतित स े अजधक का जिस्ट्तार करन े का प्रस्ट्ताि ह ै तो संस्ट्थ ा बोड ड के जिचाराथड एक प्रस्ट्ताि प्रस्ट्तुत करेगी और बोड ड प्राकृजतक गैस पाइपलाइन म ें क्षमता के जिस्ट्तार की अनुमजत द े सकता ह,ै बित े दक पाइपलाइन का टैररफ कैपेक्स, ओपेक्स और जिस्ट्ताररत प्राकृजतक गैस पाइपलाइन की मात्रा के आधार पर जिस्ट्तार के जबना पाइपलाइन के कैपेक्स, ऑपेक्स और मात्रा के आधार पर लाग ूटैररफ के स्ट्त र पर जनधाडररत हो।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 यह स्ट्पष्ट दकया जाता ह ै दक दो प्राकृजतक गैस पाइपलाइनों के बीच दकसी भी प्रकार के संपकड को कनेजक्टजिटी म ें िृजि/ जिस्ट्तार/ टाई नहीं माना जाएगा। (ख) उप-खंड (2) के बाद जनम्न जलजखत खंड जोडा जाएगा, अथाडत:् - "(3) दकसी भी जिजनयम म ें दकसी बात के होत े हुए, इन जिजनयमों के तहत टैररफ जनधाडरण के उद्देश्य स े एक िर्ड म ें 350 काय ड ददिसों पर जिचार दकया जाएगा।"

(iii) खंड 7 के जलए, जनम्नजलजखत खडं प्रस्ट् थाजपत दकया जाएगा, अथाडत्:- "7. आर्तथक आय ु दकसी भी जिजनयम में दकसी बात के होत े हुए, पाइपलाइन की आर्तथक आय ु को इन जिजनयमों के तहत टैररफ जनधाडरण के उद्देश्य स े कमीिन की तारीख स े तीस िर्ड माना जाएगा। यदद प्राकृजतक गैस पाइपलाइन को तीस स े अजधक िर्ों के जलए अजधकृत दकया गया ह ै या इसके प्राजधकार को बाद म ें तीस िर्ों स े आगे बढाया गया ह ै या तीस िर्ों स े अजधक पररचालन म ें ह,ै तो टैररफ की गणना के जलए डीसीएफ मॉडल को प्राजधकार की पूरी अिजध तक या जिस्ट्ताररत अिजध सजहत अगली टैररफ समीक्षा तक सचं ालन के जलए बनाया जाएगा। उि आर्तथक आय ु के पूरा होने स े पहल,े जजसमें स्ट् पर-लाइनें और टाई-इन लाइनें िाजमल ह,ैं पाइपलाइन की 5% स ेअजधक की सीमा को टैररफ जनधाडरण के जलए नहीं माना जाएगा यदद ऐसे प्रजतस्ट्थापन के जलए संस्ट्थ ा द्वारा बोडड स े अनुमोदन प्राप्त नहीं दकया गया ह।ै "

(iv) खंड 8 म,ें उप-खंड (1) के जलए, जनम्न जलजखत खंड प्रस्ट्थ ाजपत दकया जाएगा, अथाडत:्- “(1) संस्ट् था बोडड के अनुमोदन के जलए, संलग्नक 1(i) भाग II म ें जनर्ददष्ट प्रपत्र म ें पररयोजना की आर्तथक आय ु के दौरान सभी टैररफ जोन पर यूजनट प्राकृजतक गैस पाइपलाइन टैररफ को बांटने स े संबंजधत गणना प्रस्ट्तुत करेगी, जहााँ X% एक सौ प्रजतित स े कम एकल संख्या होगी और Y% पचास प्रजतित स े कम एकल संख्या होगी। यदद संस्ट् था जनधाडररत समय के भीतर सूचना प्रस्ट्तुत करने म ें जिफल रहती ह,ै तो बोडड उस पाइपलाइन के संबंध म ें तत्काल पूि ड जोनल टैररफ जनधाडरण के दौरान जिजभन्न टैररफ जोन के जलए टैररफ के अनुपात म ें या दकसी भी अन्य तरीके स े जैसा बोडड द्वारा उपयक्ु त समझा जाए, सभी प्राकृजतक क्षेत्रों म ें यूजनट प्राकृजतक गैस पाइपलाइन टैररफ को बांट सकता ह।ै ” िन्दना िमा,ड सजचि [जिज्ञापन-III/4/असा.378/2020] पाद रटप्प णी : मूल जिजनयम भारत के राजपत्र (असाधारण) म ें 807(अ.), 20 निंबर, 2008 को प्रकाजित हुआ था और इसम ें जी.एस.आर. 986(अ.), ददनांक 20 ददसंबर, 2010, फा.स.ं पीएनजीआरबी/एम(सी)/11/अंजतम टैररफ फाइबलग, ददनांक 30 मई, 2012, पीएस/ सजचि/एम(सी)/ 2012, ददनांक 13 जसतंबर, 2012, फा.स.ं पीएनजीआरबी/ एम(सी)/48, ददनांक 17 फरिरी, 2014, फा.स.ं पीएनजीआरबी/एम(सी)/100, ददनांक 27 फरिरी, 2014, फा.स.ं एल- जिजिध/VI/I/20017, ददनांक 01 जनिरी, 2015, पीएनजीआरबी/एम(सी)/110, ददनांक 08 जनिरी, 2016, फा.स.ं पीएनजीआरबी/सीओएम/2-एनजीपीएल टैररफ (3)/2019, ददनांक 27 मई, 2019, फा.सं. पीएनजीआरबी/सीओएम/2- एनजीपीएल/ टैररफ (3)/2019 खंड-II, ददनांक 27 माच,ड 2020 और फा.सं. पीएनजीआरबी/िाजण./2- एनजीपीएल/टैररफ(3)/2014 खंड-IV (भाग-1) (पी-1439) 23 निम्बर 2020.द्वारा संिोधन दकया गया था। THE PETROLEUM AND NATURAL GAS REGULATORY BOARD

NOTIFICATION New Delhi, the 23rd November, 2020 F. No. PNGRB/COM/2-NGPL/Tariff (3)/2014 Vol-IV(Part-1) (P-1439): In exercise of the powers conferred by clause (t) of sub-section (2) of section 61 read with clause (e) of section 11 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations, namely: —4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

1. Short title and commencement.

(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Third Amendment Regulations, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Petroleum and Natural Gas Regulatory Board (Determination of Natural Gas Pipeline Tariff) Regulations, 2008, —

(a) in regulation 2, in sub-regulation (1),-

(i) after clause (d), the following clause shall be inserted, namely: — ―(da) "Imbalance Management Services" shall have the same meaning as assigned to it in the Petroleum and Natural Gas Regulatory Board (Imbalance Management Services) Regulations, 2016;‖;

(ii) for clause (i), the following clause shall be subsituted, namely: – ―(i) ―tariff zone‖ means the zone –

(i) of a length of three hundred kilometers each along the route of the natural gas pipeline from the

point of injection to the end point:

Provided that the last zone of the natural gas pipeline may be of a length of three hundred

kilometers or less:

Provided further that any natural gas pipeline of a length less than three hundred kilometers shall be counted as a zone; and

(ii) a corridor along the natural gas pipeline with a width of up to ten percent of the total length of the natural gas pipeline without including the length of the spur lines or fifty kilometers measured from the nearest point on the surface of the natural gas pipeline on both sides, and includes the point of origin and the end point of the natural gas pipelines, whichever is less, and-

(a) the first tariff zone shall be counted with reference to any zone in which the point of injection of natural gas into the natural gas pipeline falls; and

(b) the subsequent tariff zone or tariff zones, as the case may be, shall be counted separately on either side along the contractual path for delivery of natural gas in the natural gas pipeline;

Provided that natural gas pipeline tariff for transport of natural gas from the same source

shall be uniform for all the customers located within the zone:

Provided further that the entity shall supply natural gas to any customer located in the zone subject to the techno-commercial feasibility of laying, building, operating or expanding a new spur line from the natural gas pipeline.

Explanation For the purposes of this clause, the entity shall submit to the Board information regarding various tariff zones and their sequential numbering in the natural gas pipeline from each point of injection.‖;

(b) in Schedule A,-

(i) for sub-clause (8) of clause 5, following clause shall be substituted, namely:- “(8) Miscellaneous income realizable from a fixed asset included in the capital employed or out of an expense considered as an operating cost, including income from imbalance management services in accordance with the provisions of Petroleum and Natural Gas Regulatory Board (Imbalance Management Services) Regulations, 2016, but excluding interest income, profit or loss on sale or transfer of any fixed or other asset, shall be netted from the operating cost.‖;

(ii) in clause 6,-

(A) in sub-clause (1), after item (d), the following shall be inserted, namely: — ―(e) notwithstanding anything contained in any other regulation including regulation 12 and regulation 21 of Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build,[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5 Operate or Expand Natural Gas Pipelines) Regulations, 2008, in case it is proposed to expand the capacity of the natural gas pipeline by more than ten percent of that authorized by the Board, the entity shall submit a proposal for consideration of the Board and the Board may allow for expansion of the capacity in the natural gas pipeline, but the tariff of the pipeline so determined based on the capex, opex and volumes of expanded natural gas pipeline shall be capped at the levels of the applicable tariff based on the capex, opex and volumes of the pipeline without expansion.

It is clarified that any interconnection between two natural gas pipelines shall not be considered as extension or expansion or tie in connectivity.‖;

(B) after sub-clause (2), the following clause shall be inserted, namely:- ―(3) Notwithstanding anything contained in any regulations made under the Act, 350 working days shall be considered in a year for the purpose of tariff determination under these regulations.‖;

(iii) for clause 7, the following clause shall be substituted, namely:- ―7. Economic Life.

Notwithstanding anything contained in any regulations made under the Act, economic life of the pipeline shall be considered as thirty years from the date of commissioning for the purpose of tariff determination under these regulations. In case, the natural gas pipeline has been authorized for more than thirty years or its authorisation has been subsequently extended beyond thirty years or is in operation beyond thirty years, the DCF model for the tariff computation may be made for the entire period of authorization or operation till the next tariff review, including the extended period. Any replacement of the pipeline, in excess of five per cent of the length of the pipeline including spur-lines and tie-in lines, before the completion of the aforesaid economic life, shall not be considered for tariff determination if approval of the Board has not been obtained by the entity for such replacement.‖

(iv) in clause 8, for sub-clause (1), the following clause shall be substituted, namely:- ― (1) The entity shall submit for the Board’s approval, the calculations in respect of apportioning of the unit natural gas pipeline tariff over all the tariff zones during the economic life of the project in the form specified in Part II of Attachment 1(i), where X% shall be a single number lower than one hundred per cent and Y% shall be a single number lower than fifty per cent.

In case the entity fails to submit the required information within the time determined by the Board for such purpose, the Board may apportion the unit natural gas pipeline tariff over all the tariff zones in the ratio of tariff for various tariff zones during the immediate preceding zonal tariff determination in respect of that pipeline or in any other manner as may be deemed fit by the Board.‖ VANDANA SHARMA, Secy.
