L.-33004/99 EXTRAORDINARY III— 4 PART III—Section 4 PUBLISHED BY AUTHORITY 465] No. 465] NEW DELHI, TUESDAY, DECEMBER 12, 2017/AGRAHAYANA 21, 1939 बकैं ऑफ़ बड़ौदा ऄधधसचू ना बड़ौदा, 15 नवम् बर, 2017 फा. स.ं एचओ:एचअर- परर:ओएसअर & अइअर:282.—बैंककारी कंपनी (ईपक्रमों का ऄजजन और ऄंतरण) ऄधधधनयम, 1970 (1970 का 5) की धारा 12 की ईपधारा (2) के साथ पढ़ी जान े वाली धारा 19 द्वारा प्रदत्त शधियों का प्रयोग करते हुए, बकैं ऑफ़ बड़ौदा का धनदेशक मडं ल भारतीय ररज़वज बैंक से परामशज कर और केंद्र सरकार की धपछली मंजूरी के साथ, एतद्द्वारा बकैं ऑफ़ बड़ौदा (“ऄधधकारी”) सवे ा धवधनयम, 1979 में संशोधन करने के धलए अग े धनम्नधलधखत धवधनयम बनाता ह,ै यथा:—

1. (1) आन धवधनयमों को बैंक ऑफ़ बड़ौदा (“ऄधधकारी”) सवे ा (सशं ोधन) धवधनयम, 2017 के नाम से जाना जाएगा.

(2) आन धवधनयमों में ऄधभव्यि रूप से ऄन्यथा ईपबंधधत हो, ये नवंबर, 2007 की पहली तारीख से प्रभावी समझे जाएंगे.

2. बकैं ऑफ़ बड़ौदा (“ऄधधकारी”) सवे ा धवधनयम, 1979 (आसके पश्चात आन धवधनयमों के रूप म ें ईल्लेधखत) म,ें धवधनयम 3 में –

(i) ईपखंड (एफ) के स्थान पर धनम्नधलधखत ईपखंड को प्रधतस्थाधपत ककया जाएगा, यथा: - ‘(एफ) “पररवार” का ऄथ ज ह ै ऄधधकारी का/की जीवनसाथी, पूण ज रूप से अधित ऄधववाधहत संतान (स़ौतेल े बच्चों और काननू ी रूप से गोद धलए गए बच्चों सधहत), 40 प्रधतशत या ऄधधक की धवकलागं ता वाले भाइ या बहन, सामान्यत: ऄधधकारी के साथ रह रह ेहों और ईस पर पूण ज रूप से अधित माता-धपता.’ स्पष्टीकरण- आस खंड के धलए बच्चे या माता-धपता या धवकलांग भाइ या बहन धजनकी माधसक अय रु. 3,500 से ऄधधक नहीं ह ैईन्ह ेंऄधधकारी पर अधित समझा जाएगा.

परंतु यकद माता या धपता म ें से ककसी एक की माधसक अय रु. 3,500 से ऄधधक होती ह ै या माता-धपता की कुल माधसक अय रु. 3,500 से ऄधधक होती ह,ै तो माता-धपता दोनों ऄधधकारी पर पणू ज रूप से अधित नहीं समझ े जाएंगे.

(ii) खंड (ओ) हटा कदया जाएगा.

3. ईपरोि धवधनयमों के धवधनयम 4 म–ें i. ईप-धवधनयम (4A) हटा कदया जाएगा. ii. आस प्रकार ईप-धवधनयम (4A) हटा कदए जाने के बाद, धनम्नधलधखत ईप-धवधनयम जोडा जाएगा, यथा :- “(5) 1 नवंबर, 2007 से प्रभावी होने के साथ, प्रत्येक िेणी के धलए धवधनर्ददष्ट वेतनमान धनम्नानुसार होंगे:

a. ईच्च कायजपालक िणे ी वेतनमान VII = रु. 46800 -1300/4 - 52000 वेतनमान VI = रु. 42000-1200/4 – 46800 b. वररष्ठ प्रबंधन िणे ी वेतनमान V = रु. 36200-1000/2-38200-1100/2-40400 वेतनमान IV = रु. 30600-900/4-34200-1000/2-36200 c. मध्य प्रबंधन िणे ी वेतनमान III = रु. 25700 -800/5-29700-900/2-31500 वेतनमान II = रु. 19400-700/1-20100 -800/10-28100 d. कधनष्ठ प्रबंधन िणे ी वेतनमान I = रु. 14500-600/7-18700-700/2-20100-800/7-25700 स्पष्टीकरण : – आस वेतनमान द्वारा 31 ऄक्टूबर, 2007 तक शाधसत प्रत्येक ऄधधकारी को आस ईप-धवधनयम में वर्णणत वेतनमान म ेंस्टेज टू स्टेज अधार पर 1 नवंबर, 2007 को कफट कर कदया जाएगा, ऄथातज संबंधधत वेतनमान म ें प्रथम स्टेज के बाद से तदनुरूपी स्टेज पर और ऄधभव्यि रूप से ऄन्यथा ईपबंधधत हो वेतनवृधियां सामान्यत: वार्णषक धतधथ पर दी जाएंगी.

(6) आन सभी ग्रडे ों म ें सेवा द े रह ें ऄधधकारीगण के धलए, ईप-धवधनयमों (1), (2), (3), (4) और (5) म ें ऐसा कुछ नहीं होगा जो बैंक के धलए हर समय ऄपेधित होगा.

4. ईपरोि धवधनयमों के धवधनयम 5 म-ें

(a) ईप-धवधनयम (1) के स्थान पर धनम्नधलधखत ईप-धवधनयम प्रधतस्थाधपत ककया जाएगा, यथा:-

(1) 1 नवंबर, 2007 को एव ं तब स े धवधनयम 4 के ईप-धवधनयम (5) के प्रावधानों के ऄधीन, वेतनवृधियां धनम्नधलधखत के ऄधीन मंजरू की जाएंगी, यथा:-

(a) धवधनयम 4 के ईप-धवधनयम (5) में धनर्ददष्ट वेतनमान में वर्णणत वेतनवृधियां, सिम प्राधधकारी की मंजूरी के ऄधीन होंगी, वार्णषक अधार पर प्राप्त होंगी और धजस महीन े यह देय होगी ईस महीने के पहले कदन मंजूर की जाएगी;

(b) कधनष्ठ प्रबधं न िणे ी वेतनमान I के ऄधधकारी, जो ईच्च वेतनमान के ईच्चतम स्तर पर पहुचं न े के बाद मध्य प्रबंधन िेणी वेतनमान II के वेतनमान म ें चले गए ह,ैं वे सेवाकाल का प्रत्येक तीन वष ज पूण ज करने के बाद चार ऄवरुि वेतनवृधियों के धलए पात्र होंग,े धजनमें पहली दो वेतनवृधियां रु. 800/- एवं बाद की दो रु. 900/- होंगी:

परंतु कक जो ऄधधकारी दसू री वते नवृधि प्राप्त करने के बाद 1 नवंबर, 2007 को तीन वषज या आससे ऄधधक का समय पूरा कर चुके ह,ैं वे 1 नवंबर, 2007 को तीसरी ऄवरुि वेतनवृधि प्राप्त करेंग े तथा दसू री ऄवरुि वेतनवृधि प्राप्त करने के बाद छ: वष ज पणू ज करने पर 1 नवंबर, 2008 को या आसके बाद ऄन्य ऄवरुि वेतनवृधि प्राप्त करेंगे.

(c) मध्य प्रबंधन िेणी वते नमान II के ऄधधकारी, जो ईच्च वेतनमान के ईच्चतम स्तर पर पहुचं न े के बाद मध्य प्रबंधन िेणी वेतनमान III के वेतनमान में चल े गए ह,ैं वे सेवाकाल का प्रत्येक तीन वष ज पणू ज करने के बाद रु. 900 प्रधत वेतनवृधि के धहसाब से तीन ऄवरुि वेतनवृधियों के धलए पात्र होंगे:III 3 परंतु कक जो ऄधधकारी पहली वेतनवृधि प्राप्त करने के बाद 1 नवंबर, 2007 को तीन वष ज या आससे ऄधधक का समय पूरा कर चुके ह,ैं व े 1 नवंबर, 2007 स े ऄगली ऄवरुि वते नवृधि प्राप्त करेंग ेतथा पहली ऄवरुि वेतनवृधि के प्राप्त करन े के बाद छ: वषज पूण जकरने पर 1 नवंबर, 2008 को या आसके बाद ऄन्य ऄवरुि वेतनवृधि प्राप्त करेंगे.

परंत ु यह कक मलू रूप से मध्य प्रबंधन िेणी वेतनमान III म ें धनयुि या पदोन्नत हुए ऄधधकारी सेवाकाल का प्रत्येक तीन वषज पूरी करन े के बाद रु. 900 प्रधत वेतनवृधि के धहसाब से चार ऄवरुि वेतनवृधियों के धलए पात्र होंगे या:

परंत ु यह और कक व े ऄधधकारी, जो पहल े ही दो ऄवरुि वेतनवृधियां प्राप्त कर चुके ह ैं और 1 नवंबर, 2007 तक दसू री वेतनवृधि प्राप्त करने के बाद सेवाकाल का तीन वषज से ऄधधक का समय पूण ज कर चुके हैं, ऄपनी तीसरी वेतनवृधि 1 नवंबर, 2007 को तथा दसू री ऄवरुि वेतनवृधि प्राप्त करने के बाद छ: वषज पूणज करने पर च़ौथी वेतनवृधि 1 नवंबर, 2008 को या ईसके बाद प्राप्त करेंगे.

स्पष्टीकरण :- आस ईप-धवधनयम के तहत ऄगले ईच्च वेतनमान में ऐसी वेतनवृधियों की मजं ूरी पदोन्नधत के पररणामस्वरूप नहीं होंगी तथा ईनके धवशेषाधधकार, पररलधधधयां, कायजदाधयत्व एवं ईत्तरदाधयत्व मूल पदों के ऄनुसार जारी रहगें ी.

(b) ईप-धवधनयम (2) म,ें -

(I) स्पष्टीकरण म,ें खंड (e) के बाद एवं नोट के पहल,े धनम्नधलधखत खंड शाधमल ककया जाएगा, यथा:- “(f) नवंबर, 2007 की पहली तारीख को एव ं तब स,े ऄन्य बातें एक समान रखत े हुए, व्यावसाधयक शैिधणक भत्ते की राधश धनम्नानुसार संशोधधत की जाएंगी:- टेबल जो आंधडयन आंस्टीट्यूट ऑफ़ बकैं सज के जुधनयर एसोधसएट्स (I) वेतनमान के ईच्चतम स्तर पर पहुचं जाने के एक वष ज ऑफ़ आंधडयन आंस्टीट्यूट ऑफ़ बैंकसज या सर्टटफाआड बाद, रु. 410 प्रधत माह.

एसोधसएट्स ऑफ़ आंधडयन आंस्टीट्यूट ऑफ़ बैंकसज ईत्तीण ज कर चुके ह.ैं जो आंधडयन आंस्टीट्यूट ऑफ़ बैंकसज के सर्टटफाआड एसोधसएट्स (i) वेतनमान के ईच्चतम स्तर पर पहुचं जाने के एक वष ज के दोनों भाग ईत्तीणज कर चुके ह ैं बाद, रु. 410 प्रधत माह.

(ii) वेतनमान के ईच्चतम स्तर पर पहुचं जाने के दो वष ज बाद रु. 1030 प्रधत माह. परंतु कक वेतनमान के ईच्चतम स्तर पर पहुचं जाने के बाद आंधडयन आंस्टीट्यूट ऑफ़ बैंकसज के जुधनयर एसोधसएट्स ऑफ़ आंधडयन आंस्टीट्यूट ऑफ़ बैंकसज या सर्टटफाआड एसोधसएट्स ऑफ़ आंधडयन आंस्टीट्यूट ऑफ़ बैंकसज (कोइ एक या दोनों भाग) की योग्यताएं प्राप्त करने वाला ऄधधकारी, ऐसी योग्यताएं प्राप्त करने की तारीख से व्यावसाधयक योग्यता भत्ते की पहली ककश्त प्राप्त करेगा तथा व्यावसाधयक योग्यता भत्ते की बाद वाली ककश्त ें व्यावसाधयक योग्यता भत्ते की जारी की गइ पहली ककश्त की तारीख के संदभज के साथ जारी की जाएंगी:

परंतु यह कक यकद ऄधधकारी ने पहल े ही ईपरोि में से कोइ योग्यता प्राप्त कर ली ह ै एवं ऐसी योग्यता प्राप्त करने के फलस्वरूप कोइ वेतनवृधि या व्यावसाधयक योग्यता भत्ता प्राप्त नहीं ककया है, तो ईसे 1 नवंबर, 2007 से या ऐसी योग्यता/ं प्राप्त करने की तारीख से, जो भी बाद में हो, व्यावसाधयक योग्यता भत्ता मंजूर ककया जा सकता ह.ै

(Ii) नोट म,ें खंड (v) के स्थान पर धनम्नधलधखत खंड प्रधतस्थाधपत ककया जाएगा, यथा:- “(v) यकद ककसी ऄधधकारी न,े 27 ऄप्रलै , 2010 को खडं (iv) म ें संदर्णभत ईपरोि म ें स े कोइ योग्यता प्राप्त कर ली ह ै एवं ऐसी योग्यता प्राप्त करने के फलस्वरूप कोइ वेतनवृधि या व्यावसाधयक योग्यता भत्ता प्राप्त नहीं ककया है, तो ईसे 1 नवंबर, 2007 से या ऐसी योग्यता/ं प्राप्त करने की तारीख से, जो भी बाद में हो, व्यावसाधयक योग्यता भत्ता मंजूर ककया जा सकता ह”ै .

सी) ईप-धवधनयमन (3) म,ें -

(i) खंड (डी) के बाद और नोट स े पहल,े धनम्नधलधखत खंड प्रधतस्थाधपत ककया जाएगा, ऄथाजत:् -4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] "(इ) 1 नवंबर 2007 को और तबसे और ऄन्य मामले समान होंग,े अवास ककराया भत्ते के साथ धनयत वैयधिक वेतन धनम्नधलधखत दरों पर होंगी और पूरी सेवा ऄवधध के धलए फ्रीज़ रहगें ी :- टेबल वेतनवृधि कम्पोनेंट पर कदनांक देय कुल धनयत वैयधिक वेतन जहां बैंक का अवास वेतनवृधि कम्पोनेंट

01.11.4007 तक महगं ाइ भत्ता ईपलधध कराया गया ह ै (रु.) (रु.) (रु.) (ए) (बी) (सी) 800 58 858 900 65 965 1000 72 1072 1100 79 1179 1200 86 1286 1300 94 1394”,

(ii) नोट म ेंखंड (i) और (ii) के धलए धनम्नधलधखत खंडों को प्रधतस्थाधपत ककया जाएगा, ऄथाजत:् - "(i) खंड (बी), (सी), (डी) या (इ) के तहत टेबल के कॉलम (सी) के तहत ईधल्लधखत ऄनुसार धनयत वैयधिक भत्ता या धनयत वैयधिक वेतन ऐस े ऄधधकाररयों को दये होगा धजन्ह ेंबैंक का अवास ईपलधध कराया गया ह.ै

(ii) अवास ककराया भत्ता हते ु पात्र ऄधधकाररयों के धलए धनयत वैयधिक भत्ता या धनयत वयै धिक वेतन खंड (इ) के तहत टेबल के कॉलम (ए) और (बी) के तहत धनर्ददष्ट कुल राधश होगी और अ संबंधधत ऄधधकारी कमजचारी द्वारा अहाररत अवास ककराया भत्ता होगा, जब धवधनयम 4 के ईप-धवधनयम (2), (3), (4) या (5) में धवधनर्ददष्ट संबंधधत वेतनमान की धपछली वेतनवृधि प्राप्त की ह.ै

(iii) नोट के बाद प्रधतस्थाधपत खंड (इ) को आसके बाद ईप-खंड (v) के रूप म ें पुनः क्रमांककत ककया जाएगा और आसी क्रम के रूप म ेंखंड (v) के धलए क्रमांककत ककया जाएगा, धनम्नधलधखत खंड को प्रधतस्थाधपत ककया जाना चाधहए, ऄथाजत:् "(v) धजस ऄधधकारी न े ईपयुजि खंड (ए) के ऄनुसार ऄधग्रम वते न वृधि प्राप्त की ह,ै वे ऄधधकतम वेतनमान तक पहुचुँ न े के एक वषज बाद ईपयुजि खंड (बी), (सी), (डी) या (इ) म ें ईधल्लधखत ऄनुसार धनयत वैयधिक भत्ता/ धनयत वैयधिक वेतन का भाग अहररत कर सकते ह.ैं

5. ईपरोि धवधनयमों के धवधनयमन 21 म,ें -

(i) ईप-धवधनयमन (3) में, नोट को हटाया जाएगा;

(ii) ईप-धवधनयमन (4) म,ें नोट को हटाया जाएगा;

(iii) ईप-धवधनयमन (4) के बाद धनम्नधलधखत ईप-धवधनयमन और नोट सधम्मधलत ककए जाएंग,े ऄथाजत:् - "(5) 1 नवंबर, 2007 को और तब से, महगं ाइ भत्ता ऄधखल भारतीय औसत िधमक वग ज ईपभोिा मल्ू य सूचकांक (सामान्य) अधार 1960=वेतन के 0.15% पर 100 की धतमाही औसत म ें 2836 ऄंकों पर चार ऄंकों की प्रत्येक वृधि या धगरावट के धलए दये होगा.

स्पष्टीकरण- आस ईप-धनयम के प्रयोजनों के धलए - (ए) महगं ाइ भत्त ेके ईद्देश्य से "वेतन" का ऄथज ह,ै ऄवरुिता वते नवृधि के साथ मूल वेतन; (बी) धवधनयम 5 के ईप-धवधनयम (2) के धलए स्पष्टीकरण (सी), (डी), (इ) और (एफ) म ें धवधनर्ददष्ट के रूप म ें व्यावसाधयक धशिा भत्ता या व्यावसाधयक धशिा वेतन को महगं ाइ भत्ता के धलए शाधमल ककया जाएगा’.III 5

6. ईप-धवधनयम (1) और (2) के धलए ईपयुजि धवधनयमों के धवधनयमन 22 म ें धनम्नधलधखत ईप-धवधनयमों को प्रधतस्थाधपत ककया जाएगा, ऄथाजत:् - "(1) 1 नवंबर, 2002 को और तब से, (ए) जहा ं ऄधधकारी को बैंक द्वारा अवासीय अवास प्रदान ककया जाता ह,ै वहाुँ ऄधधकारी धजस वेतनमान म ें ह,ै ईसके ऄपन े वेतनमान के फ़स्ट ज स्टेज के मूल वेतन का 1.75 % के बराबर या अवास के धलए मानक ककराया, जो भी कम हो, ईससे वसूल ककया जाएगा;

(बी) जहा ं ऄधधकारी को बैंक द्वारा अवासीय अवास ईपलधध नहीं कराया जाता ह,ै वह धनम्नधलधखत टेबल में धवधनर्ददष्ट दरों पर अवास ककराया भत्ता के धलए पात्र होगा, ऄथाजत्: टेबल धजस वग जके ऄतं गतज कायस्ज थल ह ै भगु तान ककया जान ेवाला एचअरए

(1) (2) i) प्रमुख “ए” वगज के नगर तथा समूह ‘ए’ के पररयोजना ित्रे केन्द्र वेतनमान का 8.5% ii) ित्रे I म ें ऄन्य स्थान तथा समूह बी के पररयोजना ित्रे केन्द्र वेतनमान का 7.5 % iii) ऄन्य स्थान वेतनमान का 6.5 % परंतु यह कक यकद कोइ ऄधधकारी ककराए की रसीद प्रस्ततु करता ह ै तो ईसे दये मकान ककराया भत्ता, धजस वेतनमान म ें वह ह ैईस वेतनमान के प्रथम स्टेज के वेतन के 1.75% स े उपर, ईसके द्वारा ऄपन े अवास के धलए कदया गया वास्तधवक ककराया दये होगा ऄथवा उपर टेबल के कालम II म ें दशाजयी गयी दर स ेदये मकान ककराया भत्त े का ऄधधकतम 150% दये होगा.

(2) 1 नवंबर 2007 को और तब से - (ए) जहा ं ऄधधकारी को बैंक द्वारा अवासीय अवास प्रदान ककया जाता ह,ै वहाुँ ऄधधकारी धजस वेतनमान म ें ह,ै ईस वेतनमान के फ़स्टज स्टेज के मूल वेतन का 1.20% के बराबर या अवास के धलए मानक ककराया, जो भी कम हो, ईससे वसूल ककया जाएगा;

(बी) जहा ं ऄधधकारी को बैंक द्वारा अवासीय अवास ईपलधध नहीं कराया जाता ह,ै वह धनम्नधलधखत सारणी म ें धनर्ददष्ट दरों पर अवास ककराया भत्ता के धलए पात्र होगा, ऄथाजत्: धजस वग जके ऄतं गतज कायस्ज थल ह ै भगु तान ककया जान ेवाला एचअरए

(1) (2) i) प्रमुख “ए” वगज के नगर तथा समूह ‘ए’ के पररयोजना ित्रे केन्द्र वेतनमान का 8.5% ii) ित्रे I म ें ऄन्य स्थान तथा समूह बी के पररयोजना ित्रे केन्द्र वेतनमान का 7.5 % iii) ऄन्य स्थान वेतनमान का 6.5 % परंतु यह कक यकद कोइ ऄधधकारी ककराए की रसीद प्रस्ततु करता ह ै तो ईसे दये मकान ककराया भत्ता, धजस वेतनमान म ें वह ह ैईस वेतनमान के प्रथम स्टेज के वेतन के 1.20% स ेउपर, ईसके द्वारा ऄपने अवास के धलए कदया गया वास्तधवक ककराया दये होगा ऄथवा उपर कालम II म ें दशाजयी गयी दर स े दये मकान ककराया भत्त े का ऄधधकतम 150% दये होगा.

नोट- ऄधधकारी के माधलकाना अवास की लागत स े ललक अवास ककराया भत्ता के धलए ईनके दावों को ऄभी तक के अवास ककराया भत्ता का 150 प्रधतशत तक सीधमत ककया जाएगा.";

7. ईपरोि धवधनयमों के धवधनयम 23 म ें-

(i) ईप-धवधनयम (1) म ें 1 नवबं र, 2002 के अंकडे, ऄिरों और शधदों को 1 नवंबर, 2007 के अंकडे, ऄिरों और शधदों से प्रधतस्थाधपत ककया जाएगा.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(ii) ईप-धवधनयम (1) में 1 नवंबर, 2002 के अंकडे, ऄिरों और शधदों के धलए 1 नवंबर, 2007 के अंकडे, ऄिरों और शधदों से प्रधतस्थाधपत ककया जाएगा.

(iii) ईप-धवधनयम (3), (4) और (5) के धलए धनम्न ईप-धवधनयमों को प्रधतस्थाधपत ककया जाएगा, ऄथाजत्: - "(3) 1 नवंबर, 2007 को और तबसे, यकद ग्रपु ए या ग्रपु बी म ें अन े वाले पररयोजना िेत्र के रूप म ें धवधनर्ददष्ट िेत्र म ें कोइ ऄधधकारी सेवा कर रहा ह ै तो वह ग्रुप ‘ए’ या ग्रुप ‘बी’ के रूप में िेत्र के वगीकरण के ऄनुसार प्रधत माह रु. 290 या प्रधत माह रु. 255 की दर स ेपररयोजना िेत्र िधतपूर्णत भत्ता के धलए पात्र होगा.

(4) 1 नवंबर, 2007 को और तबसे, यकद कोइ ऄधधकारी ककसी शैिधणक वषज के बीच एक स्थान स े दसू रे स्थान पर स्थानांतररत होता ह ै और धपछल े स्थान में स्कूल या कॉलेज म ें ईनके एक या एक स े ऄधधक बच्च े पढ़ रह े ह,ैं तो वह सभी बच्चों के धलए शैिधणक वषज के ऄंत तक दसू रे स्थान पर ईसके ररपोटज करने की तारीख से प्रधत माह रु. 700 का मध्य- शैिधणक वष ज स्थानांतरण भत्ते के धलए पात्र होगा.

(5) 01 मइ, 2010 को और तबसे यकद कोइ ऄधधकारी बैंक के बाहर सेवा करन े के धलए प्रधतधनयुि ककया गया ह,ै तो वह प्रधतधनयुधि वाले पद स े जडु ी पररलधधधयों को प्राप्त करन े का धवकल्प चुन सकता ह,ै या वह ऄपन े वेतन के ऄधतररि प्रधत माह ऄधधकतम रु. 2300 के ऄधीन वेतन का 7.75 प्रधतशत की दर से प्रधतधनयुधि भत्ता और ऐसे ऄन्य भत्त े जो बैंक की सेवा में ईसके पद पर रहते हुए अहररत करता, अहररत कर सकता ह ै:

परंतु कक ईसे ककसी ऐसे संगठन में तैनात ककया गया ह ै जहां वह ईसी स्थान पर धस्थत ह ैजहां ईन्ह ें ऄपन े प्रधतधनयुधि स ेतुरंत पहल े तनै ात ककया गया था, तो ईस े प्रधत माह ऄधधकतम रु. 1200 के ऄधीन ऄपन े वते न के 4 प्रधतशत के बराबर प्रधतधनयुधि भत्ता प्राप्त होगा.

परंतु कक एक संकाय सदस्य के रूप म ें बैंक के प्रधशिण प्रधतष्ठान म ें प्रधतधनयुधि पर ऄधधकारी प्रधत माह ऄधधकतम रु. 1200 के ऄधीन ऄपने वेतन के 4 प्रधतशत के बराबर प्रधतधनयुधि भत्ता प्राप्त करन े के धलए पात्र होगा";

(iv) ईप-धवधनयमन (8) के धलए, धनम्न ईप-धनयम को प्रधतस्थाधपत ककया जाएगा, ऄथाजत:् - "(8) 1 नवंबर, 2007 को और तबस,े यकद ककसी कदन के द़ौरान काम के घंटे को दो घंटों के न्यूनतम ऄतं राल म ें धवभाधजत ककया गया ह,ै तो ऄधधकारी प्रधत माह रु.165 की दर स े धस्ललट ड्यूटी भत्ता के धलए पात्र होगा.";

(v) ईप-धवधनयमन (10) म,ें - (ए) 1 नवंबर, 2002 के अंकडे, ऄिरों और शधदों को 1 नवबं र 2007 के अंकडे, ऄिरों और शधदों से प्रधतस्थाधपत ककया गया ह.ै (बी) सारणी को धनम्नधलधखत सारणी से प्रधतस्थाधपत ककया जाएगा, ऄथातज :- “सारणी स्थान दर

(1) (2) क) 1000 मीटर और ईससे ऄधधक परंतु 1500 मीटर से वेतन का 2 प्रधतशत ऄधधकतम 550/- प्रधतमाह कम उंचाइ वाले स्थान और मरे करा नगर ख) 1500 मीटर और ईससे ऄधधक परंत ु 3000 मीटर स े वेतन का 2.5 प्रधतशत ऄधधकतम 680/- प्रधतमाह कम उंचाइ वाले स्थान पर ग) 3000 मीटर और ईससे ऄधधक उंचाइ वाल े स्थान पर वेतन का 5 प्रधतशत ऄधधकतम 1570/- प्रधतमाह

8. ईपरोि धवधनयमों के धवधनयम 24 म,ें ईप-धवधनयम (1) में, खंड (ए) के धलए धनम्नधलधखत खंड को प्रधतस्थाधपत ककया जाएगा, ऄथाजत:् - "(ए) धचककत्सा व्यय - 1 नवंबर, 2007 को और तबसे ऄधधकारी एवं ईसके पररवार के धचककत्सा व्ययों की प्रधतपूर्णत संबंधधत ऄधधकारी के प्रमाण-पत्र के अधार पर की जा सकती ह ै धजसमें धनम्नधलधखत टेबल म ें धवधनर्ददष्ट ऄनुसार ऐस े खचों के धय़ौरे के साथ दावा की गइ राधश का लेखा धववरण भी होता ह ैऄथाजत:-III 7 टेबल िेणी प्रधतपूर्णत की ऄधधकतम सीमा कधनष्ठ प्रबंधन और मध्य प्रबंधन िेणी रु. 5100 या ऄदत्त राधश जो भी कम ह ै वररष्ठ प्रबंधन और ईच्च कायजपालक िणे ी रु. 6320 या ऄदत्त राधश जो भी कम ह ै नोट- (i) ऄधधकारी को प्राप्त नहीं की गइ धचककत्सा सहायता को संचय करन े की ऄनुमधत होगी ताकक यह ईपरोि ईपलधध कराइ गइ ऄधधकतम राधश से ककसी भी समय तीन गुना ऄधधक न हो;

(ii) वषज 2007 के धलए धचककत्सा सहायता योजना के तहत धचककत्सा व्यय की प्रधतपूर्णत दो महीने, ऄथाजत नवंबर 2007 और कदसंबर 2007 के धलए अनुपाधतक रूप स े बढ़ा दी जाएगी. स्पष्टीकरण - आस धवधनयम के प्रयोजनों के धलए –

(i) ऄधधकारी के मामल े में जहां हॉधस्पटलाआजेशन की अवश्यकता होती ह,ै हॉधस्पटलाआजेशन प्रभार 100 प्रधतशत और ऄपन े पररवार के सदस्यों के सभी मामलों में 75 प्रधतशत की प्रधतपूर्णत की जाएगी;

(ii) 1 मइ, 2010 को और तबसे आस धवधनयमन के तहत हॉधस्पटलाआजेशन व्ययों की प्रधतपूर्णत, धनम्नधलधखत टेबल में धवधनर्ददष्ट सीमां के ऄधीन कामगार कमजचाररयों के धलए कदनांक 27 ऄप्रैल 2010 के धद्वपिीय समझ़ौत े के तहत धनधाजररत हॉधस्पटलाआजेशन योजना के धनयमों और शतों के ऄनुसार होगी, ऄथाजत:् - टेबल (ए) कधनष्ठ प्रबंधन िणे ी वेतनमान I और मध्य प्रबंधन (i) बेड प्रभार िेणी वेतनमान II और III स्वयं – रु. 700 प्रधत कदन पररवार – रु. 525 प्रधत कदन

(ii) ऄन्य प्रभार कामगार कमजचाररयों के धलए लाग ू हॉधस्पटलाआजेशन योजना के तहत धनधाजररत सीमां के 125% के वते नमान पर. (बी) वररष्ठ प्रबंधन िेणी वेतनमान IV और V और ईच्च (i) बेड प्रभार कायजपालक िेणी वेतनमान VI और VII स्वयं – रु. 900 प्रधत कदन पररवार – रु. 675 प्रधत कदन

(ii) ऄन्य प्रभार कामगार कमजचाररयों के धलए लागू हॉधस्पटलाआजशे न योजना के तहत धनधाजररत सीमां के 150% के वेतनमान पर.

9. ईपरोि धवधनयमों के धवधनयम 25 म,ें ईप-धवधनयम (2) के धलए, धनम्नधलधखत ईप-धवधनयम को प्रधतस्थाधपत ककया जाएगा, ऄथाजत:्- "(2) ईप-धवधनयमन (1) म ें धनधहत कुछ भी होने के बावजूद, 01 नवंबर 2007 को और तब से धजस वेतनमान म ें ऄधधकारी ह ै ईस वेतनमान के प्रथम स्टेज के मूल वेतन के 1.20% के बराबर या अवास के धलए मानक ककराया, जो भी कम हो, ईसके धलए बैंक के पास यह धवकल्प होगा कक ऄधधकारी द्वारा भगु तान करने पर ऄधधकारी को अवास प्रदान करे.

परंत ु कक जहां ऄधधकारी को ऐसा अवास फनीचर के साथ कदया जाता ह,ै वहाुँ धजस वेतनमान म ें वह ह ै ईस वेतनमान के प्रथम स्टेज के मलू वेतन के 0.25% के बराबर ईससे बैंक द्वारा वसूल ककया जाएगा: परंत ु यह भी कक जहा ं ऐसे अवासीय अवास बैंक द्वारा प्रदान ककए जात े ह,ैं वहा ुँ धबजली, पानी, गैस और सफाइ-व्यवस्था के धलए प्रभार ऄधधकारी द्वारा वहन ककया जाएगा."8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

10. ईपरोि धवधनयमों के धवधनयमन 36 म,ें ईप-धवधनयमन (2) के बाद धनम्नधलधखत ईप-धवधनयमन समायोधजत की जाएगी, ऄथाजत:् - "(3) 1 मइ, 2010 स े 12 महीने की ऄधधकतम ऄवधध के भीतर धहस्टेरेक्टोमी के मामल े म ेंऄधधकतम 45 कदन की छुट्टी भी दी जा सकती ह.ै"

11. ईपरोि धवधनयमों के धवधनयम 41 म,ें ईप-धवधनयम (4) म,ें खंड (a) के स्थान पर धनम्नधलधखत खंड को प्रधतस्थाधपत ककया जाएगा, यथा:- ‘(a) धवराम भत्ता – मइ, 2010 के पहले कदन को एवं तब से धनम्न टेबल के कॉलम (1) म ें वर्णणत िेधणयों या वेतनमानों का ऄधधकारी आसके कॉलम (2) में वर्णणत तदनुरूपी दरों पर ‘दधै नक’ धवराम भत्ता हते ु पात्र होगा:- टेबल ऄधधकाररयों की िधे णया/ं वते नमान मजे र ‘A’ क्लास के शहर ित्रे - I ऄन्य स्थान

(1) (2) रु. रु. रु. वेतनमान IV और ईससे उपर के ऄधधकारी 1000 800 700 वेतनमान I/II/III के ऄधधकारी 800 700 600 परंतु वेतनमान IV और ईससे उपर के ऄधधकाररयों के मामल े में, कदल्ली, मुंबइ, कोलकाता और चन्ने इ आन चार महानगरों म ें बाहरी कायज के समय देय दैधनक धवराम भत्ता रु. 1200 होगा और वेतनमान I या II या III के ऄधधकाररयों के धलए दैधनक धवराम भत्ता रु. 1000 होगा:

परंत ु यह कक जहा ं ऄनुपधस्थधत की ऄवधध 8 घंटे स े कम पर 4 घंटे से ऄधधक है, देय धवराम भत्ता ईपरोि दरों का अधा होगा. स्पष्टीकरण:- धवराम भत्त े की गणना के धलए, ‘दैधनक’ का ऄथज 24 घंटे की प्रत्येक ऄवधध और आसके बाद का कोइ भाग होगा, हवाइ यात्रा के मामले म ें प्रस्थान के धलए ररपोट ज करन े का समय तथा ऄन्य मामलों में प्रस्थान के धलए धनधाजररत समय स े लेकर अगमन के वास्तधवक समय तक माना गया ह ै तथा जहां ऄनुपधस्थधत की ऄवधध 24 घंटों से कम है, “दैधनक” का ऄथ ज 8 घंटे की ऄवधध स ेकम नहीं होगा.

12. ईपरोि धवधनयमों के धवधनयम 42 म,ें ईप-धवधनयम (3) के बाद धनम्नधलधखत ईप धवधनयम को शाधमल ककया जाएगा, यथा:- “4 मइ, 2010 के पहले कदन को एवं तब से, ऄधधकारी के स्थानांतरण होने पर, वह पैककग, स्थानीय ट्ांसपोटेशन, सामानों का बीमा कराने अकद के संबंध में धनम्न टेबल म ें धनधाजररत ककए गए ऄनुसार एक मुश्त राधश अहररत करन े का पात्र होगा, यथा:- टेबल िणे ी एक मश्ु त राधश ईच्च कायजपालक एवं वररष्ठ प्रबधं न रु. 12,000 मध्य प्रबंधन एवं कधनष्ठ प्रबंधन रु. 9,000

13. ईपरोि धवधनयमों के धवधनयम 44 म,ें ईप-धवधनयम (3) के बाद धनम्नधलधखत परंतुक को शाधमल ककया जाएगा, यथा:- परंतु कक 1 मइ, 2010 से, कधनष्ठ प्रबंधन िणे ी वेतनमान I का ऄधधकारी छूट्टी यात्रा ररयायत प्राप्त करते समय न्यूनतम भाडा आकोनॉमी क्लास म ें हवाइ यात्रा करन े का पात्र होगा और आस मामल े म ें तय की गइ दरू ी के धलए वास्तधवक ककराए या ट्ेन स े एसी प्रथम िणे ी को लाग ू ककराए, जो भी कम हो, की प्रधतपूर्णत की जाएगी और यही धनयम 1000III 9 कक.मी से कम की दरू ी के धलए छूट्टी यात्रा ररयायत प्राप्त करत े समय मध्य प्रबंधन िेणी वेतनमान II और वररष्ठ प्रबधं न िेणी वेतनमान III के ऄधधकारी को लाग ूहोगा.

14. ईपरोि धवधनयमों के धवधनयम 45 म,ें

(i) ईप-धवधनयम (1) के बाद धनम्नधलधखत परंतुक को शाधमल ककया जाएगा, यथा:- “परंत ु ऄप्रैल, 2010 की पहली तारीख को या आसके बाद बैंक की सेवा में धनयुि ऄधधकाररयों के धलए कोइ भधवष्य धनधध नहीं होगी.”,

(ii) ईप-धवधनयम (3) म,ें खंड (b) के बाद और नोट के पहले धनम्नधलधखत खडं शाधमल ककया जाएगा, यथा:- “(c) ऄंशदायी भधवष्य धनधध योजना के तहत कवर ककए गए ऄधधकारी, धजन्होंन े पेंशन योजना का धवकल्प नहीं धलया ह,ै ऄंशदायी भधवष्य धनधध योजना के तहत रहगें .े ”

(iii) ईप-धवधनयम (3) के बाद धनम्नधलधखत ईप-धवधनयम को शाधमल ककया जाएगा, यथा:- “4 ऄप्रलै , 2010 की पहली तारीख को या आसके बाद बैंक की सेवा में धनयुि अधधकारी पररभाधषत ऄंशदायी भधवष्य धनधध योजना के द्वारा कवर ककए जाएंगे, धजसमें समय-समय पर संशोधधत, भारत सरकार की ऄधधसूचना, एफ. नं. 5/7/2003-इसीबी एंड पीअर कदनांक 22 कदसंबर, 2003 के द्वारा केंद्र सरकार द्वारा न्य ू पेंशन स्कीम के ऄनुसार, ऄंशदायी भधवष्य धनधध योजना के प्रावधानों के ऄनरूु प, ऄधधकारी ऄपने वेतन + महगं ाइ भत्ते का 10 प्रधतशत ऄशं दान करेगा और बैंक आसके बराबर की राधश का ऄंशदान करेगा.

NOTIFICATION Baroda, the 15th November, 2017 F. No. HO: HR-OPS:OSR&IR:282.—In exercise of the powers conferred by section 19, read with sub-

section (2) of section 12 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the Bank of Baroda, in consultation with the Reserve Bank of India and with the previous sanction of the Central Government, hereby makes the following regulations further to amend Bank of Baroda (Officers‘) Service Regulations, 1979, namely:-

1. (1) These regulations may be called the Bank of Baroda, (Officers‘) Service (Amendment) Regulations, 2017.

(2) They shall be deemed to have come into force with effect from the 1st day of November, 2007, except as otherwise provided in these regulations.

2. In the Bank of Baroda, (Officers‘) Service Regulations, 1979 (hereinafter referred to as the said regulations), in regulation 3,-

(i) for clause (f), the following clause shall be substituted, namely:- ‗(f) ―family‖ means the spouse of the officer, wholly dependent unmarried children (including step children and legally adopted children), physically challenged brother or sister with forty per cent, or more disability and parents ordinarily residing with and wholly dependent on the officer‘.

Explanation.- For the purposes of this clause a child or parent or physically challenged brother or sister shall be deemed to be dependent on the officer if the monthly income of such child, parent, brother or sister does not exceed Rs.3,500 per month.

Provided that if the income of one of the parents exceeds Rs.3,500 per month or the aggregate income of both the parents exceeds Rs.3,500 per month, both the parents shall not be considered as wholly dependent on the officer.‘

(ii) Clause (o) shall be omitted.

3. In regulation 4 of the said regulations,-

(i) sub-regulation (4A) shall be omitted;

(ii) after sub-regulation (4A) as so omitted, the following sub-regulations shall be inserted, namely:- ―(5) With effect from the 1st November, 2007, the scales of pay specified against each grade shall be as under :

(a) Top Executive Grade Scale VII = Rs.46800 – 1300/4 – 52000 Scale VI = Rs.42000 - 1200/4 – 46800

(b) Senior Management Grade Scale V = Rs.36200 – 1000/2 – 38200 – 1100/2 - 40400 Scale IV = Rs.30600 – 900/4 – 34200– 1000/2 – 36200

(c) Middle Management Grade Scale III = Rs.25700 - 800/5-– 29700 - 900/2 - 31500 Scale II = Rs.19400 - 700/1 - 20100 -800/10 - 28100

Explanation.-Every officer who is governed by the scales of pay in force as on the 31st October, 2007 shall be fitted in the scale of pay set out in this sub-regulation as on 1st November, 2007 on stage to stage basis, i.e. on corresponding stages from first stage onwards in the respective scales and the increments shall fall on the anniversary date as usual except where provided otherwise.

(6) Nothing in sub-regulations (1), (2), (3), (4) and (5) shall be construed as requiring the Bank to have at all times, officers serving in all these grades.‖.

4. In regulation 5 of the said regulations, -

(a) for sub-regulation (1), the following sub-regulation, shall be substituted, namely: - ―(1) Subject to the provisions of sub-regulation (5) of regulation 4, on and from the 1st November, 2007, the increments shall be granted subject to the following, namely: -

(a) the increments specified in the scales of pay set out in sub-regulation (5) of regulation 4 shall, subject to the sanction of the Competent Authority, accrue on an annual basis and shall be granted on the first day of the month in which these fall due;

(b) officers in Junior Management Grade Scale I who have moved to scale of pay for Middle Management Grade Scale II after reaching maximum of the higher scale shall be eligible for four stagnation increments for every three completed years of service of which first two shall be Rs.800 each and next two Rs.900 each:

Provided that officers who have completed three years or more after receipt of the second stagnation increment as on 1st November, 2007 shall get the third stagnation increment on 1st November, 2007 and another stagnation increment on or after the 1st November, 2008 on their completion of six years after receipt of second stagnation increment;

(c) officers in Middle Management Grade Scale II who have moved to scale of pay for Middle Management Grade Scale III after reaching maximum of higher scale shall be eligible for three stagnation increments of Rs.900 each for every three completed years of service:

Provided that officers who have completed three years or more after receipt of the first stagnation increment as on the 1st November, 2007 shall get the next stagnation increment with effect from the 1st November, 2007 and a subsequent stagnation increment on or after the 1st November, 2008

on their completion of six years after receipt of the first stagnation increment:

Provided further the officers appointed to or promoted in substantive Middle Management Grade Scale III, shall be eligible for four stagnation increments of Rs.900 each for every three completed

years of service or :

Provided also that the officers who have already received two stagnation increments and completed more than three years of service after receipt of second stagnation increment as on the 1st November, 2007 shall get the third stagnation increment on the 1st November, 2007 and the fourth stagnation increment, on or after the 1st November, 2008 on completion of six years after receipt of second stagnation increment.

Explanation.- Grant of such increments in the next higher scale under this sub-regulation shall not amount to promotion and the privileges, perquisites, duties and responsibilities of the officers shall continue as of their substantive posts.

(b) in sub-regulation (2),-

(i) in the Explanation, after clause (e) and before the Note, the following clause shall be inserted, namely:- ―(f) on and from the 1st day of November, 2007, other things being equal, the quantum of Professional

Provided that an Officer acquiring Junior Associate of Indian Institute of Bankers or Certified Associate of Indian Institute of Bankers (either or both parts) qualifications after reaching the maximum of the scale of pay, shall be granted from the date of acquiring such qualification the first installment of Professional Qualification Pay and the release of subsequent installments of Professional Qualification Pay shall be

Provided further that in a case where an officer, has already acquired any of the above qualifications and has not earned any increment or Professional Qualification Pay on account of acquiring such qualification, he may be granted the Professional Qualification Pay, with effect from the 1st November 2007 or the date of acquiring such qualification/s, whichever is later.‖;

(ii) in the Note, for clause (v), the following clause shall be substituted, namely:- ―(v) if an officer, as on the 27thApril 2010 has already acquired any of the said qualifications referred to in clause (iv) and has not earned any increment or Professional Qualification Pay on account of acquiring such qualification, he shall be granted the Professional Qualification Pay, with effect from the 1st day of November, 2007 or the date of acquiring such qualification, whichever is later.‖;

(c) in sub-regulation (3),-

(i) after clause (d) and before the Note, the following clause shall be inserted, namely:- ―(e) on and from the 1st November, 2007, other things being equal, Fixed Personal Pay together with House Rent Allowance shall be at the following rates and shall remain frozen for the entire

(ii) in the Note, for clauses (i) and (ii), the following clauses shall be substituted, namely:- ―(i) Fixed Personal Allowance or Fixed Personal Pay as indicated under column (C) of the Table under clauses (b), (c), (d) or (e) shall be payable to those officers who are provided with bank‘s accommodation.

(ii) Fixed Personal Allowance or Fixed Personal Pay for officers eligible for House Rent Allowance shall be the aggregate amount specified under columns (A) and (B) of the Table under clause (e) and House Rent Allowance drawn by the concerned officer employees when the last increment of the relevant scale of pay as specified in sub-regulations (2), (3), (4) or (5) of regulation 4 is earned.‖;

(iii) clause (e) occurring after the Note shall be renumbered as sub-clause (v) thereof and for clause (v) as so numbered, the following clause be substituted, namely:- ―(v) An officer who has earned the advance increment as in clause (a) above shall draw the quantum of Fixed Personal Allowance/Fixed Personal Pay as mentioned in clauses (b), (c),

(d) or (e) above, one year after reaching the maximum of the scale‖;

5. In regulation 21 of the said regulations, -

(i) in sub-regulation (3), the Note shall be omitted;

(ii) in sub-regulation (4), the Note shall be omitted;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(iii) after sub-regulation (4), the following sub-regulation and Note shall be inserted, namely:- ―(5) On and from the 1st day of November, 2007, dearness allowance shall be payable for every rise or fall of four points over 2836 points in the quarterly average of the All India Average Working Class Consumer Price Index (General) Base 1960=100 at 0.15% of Pay.

Explanation.- For the purposes of this sub-regulation,-

(a) ―pay‖ for the purpose of Dearness Allowance shall mean basic pay including Stagnation Increments;

(b) Professional Qualification Allowance or Professional Qualification Pay as specified in Explanations (c), (d), (e) and (f) to sub-regulation (2) of regulation 5 shall rank for dearness allowance‘.

6. In regulation 22 of the said regulations, for sub-regulations(1) and (2), the following sub-regulations shall be substituted, namely:- ―(1) on and from the 1st day of November, 2002,

(a) where an officer is provided with residential accommodation by the Bank, a sum equal to 1.75 per cent of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less, shall be recovered from him;

(b) where an officer is not provided any residential accommodation by the Bank, he shall be eligible for House Rent Allowance at the rates specified in the following table, namely:

Provided that if an officer produces a rent receipt, the House Rent Allowance payable to him shall be the actual rent paid by him for the residential accommodation in excess over 1.75 per cent of pay in the first stage of the scale of pay in which he is placed with a maximum of 150 per cent of the House Rent Allowance payable as per column (2) of the above Table.

(2) on and from the 1st day of November, 2007, -

(a) where an officer is provided with residential accommodation by the Bank, a sum equal to 1.20 per cent of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less, shall be recovered from him;

(b) where an officer is not provided any residential accommodation by the Bank, he shall be eligible for House Rent Allowance at the rates specified in the following table, namely: - TABLE Where the place of work is in HRA payable shall be

Provided that if an officer produces a rent receipt, the House Rent Allowance payable to him shall be the actual rent paid by him for the residential accommodation in excess over 1.20 per cent of Pay in the first stage of the Scale of Pay in which he is placed with a maximum of 150 per cent of the House Rent Allowance payable as per aforesaid rates mentioned in column (2) above.III 17 Note.-The claims of officers for House Rent Allowance linked to the cost of their ownership accommodation shall also be restricted to 150 per cent of House Rent Allowance as hitherto.‖;

7. In regulation 23 of the said regulations,-

(i) in sub-regulation (1), for the figures, letters and words ―1st day of November 2002‖, the figures, letters and words ―1st day of November 2007‖ shall be substituted;

(ii) in sub-regulation (2), for the figures, letters and words ―1st day of November 2002, the figures, letters and words ―1st day of November 2007‖ shall be substituted;

(iii) for sub-regulations (3), (4) and (5), the following sub-regulations shall be substituted, namely:- ―(3) On and from the 1st day of November, 2007, if an officer is serving in an area to be specified as Project Area falling in Group A or Group B, he shall be eligible for a Project Area Compensatory Allowance at the rate of Rs.290 per month or Rs.255 per month according to the classification of area as Group A or Group B.

(4) On and from the 1st day of November, 2007, if an officer is transferred from one place to another in the midst of an academic year and if he has one or more children studying in school or college, in the former place, he shall be eligible for a mid-academic year transfer allowance of Rs.700 per month from the date he reports to the latter place upto the end of the academic year in respect of all the children, provided that such allowance shall cease if all the children cease studying at the former place.

(5) On and from the 1st day of May, 2010, if an officer is deputed to serve outside the Bank, he may opt to receive the emoluments attached to the post to which he is deputed, or he may in addition to his pay, draw a deputation allowance at the rate of 7.75 per cent of pay subject to a maximum Rs.2300 per month and such other allowances he would have drawn had he been posted in the Bank‘s service at that place:

Provided that where he is deputed to an organisation which is located at the same place where he was posted immediately prior to his deputation, he shall receive a deputation allowance equal to 4 per cent of his pay subject to a maximum Rs.1200 per month:

Provided further that an officer on deputation to the Training Establishment of the Bank as a faculty member shall be eligible for deputation allowance at the rate of 4 per cent of his pay subject to a maximum Rs.1200 per month.‖;

(iv) for sub-regulation (8), the following sub-regulation shall be substituted, namely:- ―(8) on and from the 1st day of November 2007, if the working hours during a day are split with minimum interval of two hours, an officer shall be eligible for a Split Duty Allowance at the rate of Rs.165 per month.‖;

(v) in sub-regulation (10),-

(a) for the figures, letters and words ―1st day of November 2002‖, the figures, letters and words ―1st day of November, 2007‖ shall be substituted;

(b) for the Table, the following Table shall be substituted, namely:- ―TABLE Place Rate

8. In regulation 24 of the said regulations, in sub-regulation (1), for clause (a), the following clause shall be substituted, namely:- ―(a) Medical Expenses.- On and from the 1st day of November 2007, an officer shall be eligible for reimbursement of medical expenses for self and family on the strength of the officer‘s own certificate of having incurred such expenditure supported by a statement of accounts for the amounts claimed as specified in the table below, namely:-18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] TABLE Grade Maximum limit of reimbursement Junior Management and Middle Management Rs. 5100 or the amount incurred Grade whichever is less Senior Management and Top Executive Grade Rs. 6320 or the amount incurred whichever is less Note.- (i) an officer may be allowed to accumulate unavailed medical aid so as not to exceed at any time three times the maximum amount provided above or;

(ii) for the year 2007, the reimbursement of medical expenses under the medical aid scheme shall be enhanced proportionately for two months, that is, November 2007 and December 2007.

Explanation. - for the purposes of this regulation,-

(i) hospitalisation charges shall be reimbursed to the extent of 100 per cent in the case of an officer and 75 per cent, in the case of his family members in respect of all cases which require hospitalization or;

(ii) on and from the 1st day of May, 2010, reimbursement of hospitalisation expenses under this regulation shall be in accordance with the terms and conditions of Hospitalisation Scheme as laid down under the Bipartite Settlement dated the 27thday of April, 2010 for workmen employees, subject to the limits as specified in the table below, namely:- TABLE

(a) Junior Management Grade (i) Bed Charges Scale I and Middle Management Grade Scales Self – Rs. 700 per day II and III. Family – Rs. 525 per day

(ii) Other charges At the scale of 125% of the limits laid down under the Hospitalisation Scheme applicable to workmen employees. b) Senior Management Grade (i) Bed Charges Scales IV and V and Top Self – Rs.900 per day Executive Grade Scales VI and VII. Family – Rs.675per day

(ii) Other charges At the scale of 150% of the limits laid down under the Hospitalisation Scheme applicable to workmen employees.‖;

9. In regulation 25 of the said regulations, for sub-regulation (2), the following sub-regulation shall be substituted, namely:- ―(2) Notwithstanding anything contained in sub-regulation(1), it shall be open to the Bank to provide residential accommodation to an officer on payment by the officer, on and from the 1st day of November, 2007, a sum equal to 1.20 per cent, of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less:

Provided that where the officer is provided with furniture at such residence, a further sum equal to

0.25 per cent of basic pay in the first stage of the scale of pay in which he is placed shall be

recovered by the Bank from him:

Provided further that, where such residential accommodation is provided by the bank, the charges for electricity, water, gas and conservancy shall be borne by the officer.‖.III 19

10. In regulation 36 of the said regulations, after sub-regulation (2), the following sub-regulation shall be inserted,

namely :- ―(3) With effect from the 1st day of May 2010, within the overall period of 12 months, leave may also be granted in case of hysterectomy upto a maximum of 45 days.‖.

11. In regulation 41 of the said regulations, in sub-regulation (4), for clause (a), the following clause shall be substituted, namely:- ‗(a) Halting Allowance – On and from the 1st day of May, 2010, an officer in the Grades or Scales set out in column (1) of the Table below shall be entitled to `per diem‘ Halting Allowance at the corresponding rates set out in column (2) thereof, namely:- TABLE Major `A’ Class Other Grades/Scales of officers Area I cities Places

Provided that in the case of officers in Scale IV and above, Halting Allowance payable per diem while on outstation work at the four metros, viz., Delhi, Mumbai, Kolkata and Chennai, shall be Rs.1200 and for officers in Scale I or II or III, the per diem Halting Allowance and shall be Rs.1000:

Provided further that where the total period of absence is less than eight hours but more than four hours, Halting Allowance at half the above rates shall be payable.

Explanation.- For the purpose of computing Halting allowance ―per diem‖ shall mean each period of twenty-four hours or any subsequent part thereof, reckoned from the reporting time for departure in the case of air travel and the scheduled time of departure in other cases, to the actual time of arrival and where the total period of absence is less than twenty-four hours, ―per diem‖ shall mean a period of not less than eight hours.‘.

12. In regulation 42 of the said regulations, after sub-regulation (3), the following sub-regulation shall be inserted,

namely:- ―(4) On and from the first day of May 2010, an officer on transfer shall be eligible to draw a lump sum amount for expenses connected with packing, local transportation, insuring the baggage, etc., as specified in the Table below, namely:- ―TABLE Grade Lump Sum Top Executive and Senior Management Rs.12,000 Middle Management and Junior Management Rs.9,000‖.

13. In regulation 44 of the said regulations, in sub-regulation (3), the following proviso shall be inserted, namely:- ―Provided that with effect from the 1st May 2010, an officer in Junior Management Grade Scale I while availing Leave Travel Concession shall be entitled to travel by air in the lowest fare economy class in which case the reimbursement will be the actual fare or the fare applicable to AC First Class fare by train for the distance traveled, whichever is less and the same rules shall apply to an officer in Middle Management Grade Scale II and Middle Management Grade Scale III while availing Leave Travel Concession where the distance is less than 1000 kms.‖.

14. In regulation 45 of the said regulations, -

(i) in sub-regulation (1), the following proviso shall be inserted, namely:- ―Provided that there shall be no Provident Fund to Officers joining the services of the Banks on or after the 1st day of April, 2010.‖;20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(ii) in sub-regulation (3), after clause (b) and before the Note, the following clause shall be inserted,

namely:- ―(c) Officers who are covered under the Contributory Provident Fund Scheme who do not opt for Pension Scheme shall continue under the Contributory Provident Fund Scheme.‖;

(iii) after sub-regulation(3), the following sub-regulation shall be inserted, namely:- ―(4) The officers joining the services of the Bank on or after the 1st day of April 2010 shall be covered by a Defined Contributory Pension Scheme, where the officer shall contribute ten per cent, of pay plus Dearness Allowance and the Bank shall make the similar amount of contribution in accordance with the provisions of the Contributory Pension Scheme in accordance with New Pension Scheme notified by the Central Government vide notification of the Government of India, F.No.5/7/2003-ECB & PR dated the 22nd December, 2003, as amended from time to time.‖

15. For the Schedule to the said regulations, the following Schedule shall be substituted, namely,:- ―Schedule to, Bank of baroda (Officers‘) Service Regulations, 1979 [See sub-regulation (2) of regulation 23] With effect from the 1st day of November, 2007, an officer shall be eligible for the Special Area Allowance till such time they are withdrawn or modified either wholly or partially, as specified in the Table below, namely:- TABLE Sr. Area Allowances (Rs.) Uttarakhand Areas under Chamoli, Pithoragarh, Uttarkashi, Rudraprayag and 2000 2600‖ Champavat Districts.III 23 EXPLANATORY MEMORANDUM The Regulations which have been given retrospective effect are as per the agreed terms and conditions of the Joint Notes signed between the Indian Banks‘ Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level officers‘ associations of the Banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
