1. (1) ये िविनयम सससस(cid:3)(cid:3)ेे(cid:3)(cid:3)ेे (cid:5)(cid:5) (cid:5)(cid:5) लललल बबबबकक(cid:8)(cid:8)कक(cid:8)(cid:8) ऑऑऑऑफफफफ इइइइंंंंििििडडडडययययाााा (अिधकारी) सेवा (संशोधन) िविनयम 2017 कह ेजाएंग।े

(2) जब तक संबंिधत िविनयम(cid:15) म7 अ.य था न कहा गया हो, ये िविनयम माह नवंबर, 2007 के !थम 8दवस से !भावी माने जाएंगे, िसवा उसके जो इन िविनयम(cid:15) म7 अ.यथा उ:लेिखत हो।

2. सससस(cid:3)(cid:3)ेे(cid:3)(cid:3)ेे (cid:5)(cid:5) (cid:5)(cid:5) लललल बबबब(cid:8)क(cid:8)क(cid:8)क(cid:8)क ऑऑऑऑफफफफ इइइइंंंंििििडडडडययययाााा (अिधकारी) सेवा िविनयम 1979 (इसम7 इसके बाद किथत िविनयम के @प म7 उि:लिखत) म7 िविनयम 3 म7 - i. खंड (एफ) के 1 थान पर िन6 निलिखत,खंड को !ित1थ ािपत 8कया जायेगा यथा- ‘(एफ) ‘प(cid:30)रवार’ से अिभ!ाय, अिधकारी का पित/प#न ी पूण(cid:18)तया आिFत अिववािहत बGच े (आिFत सौतेले और िविधपूव(cid:18)क गोद िलए (ए बJ(cid:15) सिहत) चालीस !ितशत अथवा अिधक अपंगता के साथ अ.यथा सKम भाई अथवा बहन एवं अिधकारी पर पूण(cid:18)त: आिFत एवं आमतौर पर उसके साथ रह रह ेउसके माता-िपता’, (cid:21)(cid:21)(cid:21)(cid:21)पपपप(cid:23)(cid:23)(cid:23)(cid:23)ीीीीककककररररणणणण –––– इस खंड के उMेNय हते ु कोई बJा अथवा माता-िपता अथवा शारी(cid:30)रक @प से अपंग भाई बहन को अिधकारी पर पूण(cid:18)तया आिFत तब माना जायेगा जब ऐसे बG च(cid:15) अथवा माता-िपता, भाई, बहन क(cid:26) आय @. 3500/- !ितमाह से अिधक न हो’, 4268GI/17 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] यह भी 8क माता-िपता म7 से 8कसी एक क(cid:26) आय @. 3500/- !ितमाह से अिधक होने अथवा माता-िपता दोन(cid:15) क(cid:26) कुल आय T.3500/- !ितमाह से अिधक होने,पर माता-िपता दोन(cid:15) को ही अिधकारी पर पूण(cid:18)तया आिFत नहU माना जाएगा। ii खंड (ओ) को हटा 8दया जाएगा :-

3. किथत िविनयम(cid:15) के िविनयम 4 म7

(i) उप िविनयम (4ए) हटाया जाएगा

(ii) हटाए गए उप िविनयम (4ए) के 1 थान पर िन6न िलिखत उप िविनयम जोड़े जाएंगे, यथा :- “(5) 8दनांक 01 नवंबर, 2007, से !# येक Fेणी के समK िविनXदYट वेतनमान िन6न वत ह(cid:15)गे:- (ए) शीष(cid:18) काय(cid:18)पालक Fेणी :

वेतनमान VII = @.46800 – 1300/4-52000 वेतनमान VI= @.42000 – 1200/4-46800 (बी) व(cid:30)र^ !बंधन Fेणी : वेतनमान V = @.36200 – 1000/2 – 38200 - 1100/2 - 40400 वेतनमान IV= @.30600 – 900/4 - 34200 - 1000/2 - 36200 (सी) म_ यम !बंधन Fेणी :

वेतनमान III= @.25700 – 800/5 – 29700 - 900/2 - 31500 वेतनमान II= @.19400 – 700/1-20100 - 800/10-28100 (डी) किनY ठ !बंधन Fेणी : वेतनमान I= @.14500 – 600/7-18700 - 700/2 - 20100-800/7-25700 (cid:21)(cid:21)(cid:21)(cid:21)पप पप (cid:26)(cid:26)(cid:26)(cid:26)टट टट ीीीीककककररररणणणण – 8दनांक 31 अ` तबू र, 2007 को !भावी वेतनमान ारा शािसत !#य के अिधकारी का 8दनांक 01 नवंबर, 2007 को इस उप िविनयम म 7 िनधा(cid:18)(cid:30)रत वेतनमान म7 चरण दर चरण आधार पर िनयतन 8कया जायेगा, संबंिधत वेतनमान म7 !थम चरण और उसके आगे सदशृ चरण(cid:15) म7 तथा वेतन वृिa सामा.य तौर पर !ितवाbषक ितिथ होगी जब तक 8क अ.यथा न बताया गया हो,

(6) उप िविनयम (1)(2) (3) और (4) क(cid:26) 8कसी बात का यह अथ(cid:18) नहU लगाया जायेगा 8क ब(cid:2)क के िलए हर समय इन सभी Fेिणय(cid:15) म7 अिधकारी रखना अपेिKत ह।ै

4. उपयु(cid:18)% िविनयम(cid:15) के िविनयम 5 म,7 - (ए) उप-िविनयम (1) के िलए, िनdिलिखत उप-िविनयम !ित1थािपत ह(cid:15)ग,ेयथा:- “(1) िविनयम 4 के उप-िविनयम (5) के !ावधान(cid:15) के अधीन, 8दनांक 1 नव6बर, 2007 को और से, वेतन वृिa िनdिलिखत के अधीन !दान क(cid:26) जाएगी, यथा:- (ए) िविनयम 4 के उप-िविनयम (5) म7 वbणत िविभe वेतनमान(cid:15) म7 िनXदf वेतन वृिaयां,सKम !ािधकारी क(cid:26) मंजूरी के अधीन वाbषक आधार पर उपिचत ह(cid:15)गी और ये उस महीने क(cid:26) पहली तारीख को !दान क(cid:26) जाएंगी, िजसम7 दये होती ह(cid:15)गी।।।। (बी) किन^ !बंधन Fेणी वेतनमान I के अिधकारी जो म_यम !बंधन Fेणी वेतनमान II म 7 उJतर वेतनमान के अिधकतम 1तर तक प(चं ने के पgात प(चं ते ह,(cid:2) वे उनक(cid:26) सेवा के !#येक तीन वष(cid:18) के पूण(cid:18)ता पर चार गितरोध वेतन वृिa के िलए पाh ह(cid:15)गे,िजनम7 से पहले दो !#येक T. 800 के एवं अगले दो !#येक T. 900 के ह(cid:15)गे:¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 ले8कन यह 8क ऐसे अिधकारी िज.ह 7दसू री गितरोध वेतनवृिa क(cid:26) !ािi के पgात 8दनांक 1 नव6बर, 2007 को तीन अथवा अिधक वष(cid:18) पूण(cid:18) हो चुके ह(cid:15), वे 8दनांक 1 नव6बर, 2007 को तीसरी गितरोध वेतनविृ a !ाi कर7गे एवं अ.य गितरोध वेतनवृिa 8दनांक 1 नव6बर, 2008 को अथवा उसके पgात,छ: वष(cid:18) पूण(cid:18) होने पर दसू री गितरोध वेतनवृिa क(cid:26) !ािi कर7गे;

(सी) म_यम !बंधन Fेणी वेतनमान II के अिधकारी जो म_यम !बंधन Fेणी वेतनमान III म7 उJतर वेतनमान के अिधकतम तक प(चं ने के पgात प(चं ते ह,(cid:2) वे उनक(cid:26) सेवा के !#येक तीन वष(cid:18) क(cid:26) पूण(cid:18)ता पर !#येक T. 900 !#येक क(cid:26) तीन गितरोध वेतन वृिaय(cid:15) के िलए पाh ह(cid:15)गे:

ले8कन यह 8क ऐसे अिधकारी जो पहली गितरोध वेतनवृिa क(cid:26) !ािi के पgात 8दनांक 1 नव6बर, 2007 को तीन अथवा अिधक वष(cid:18) को पूण(cid:18) कर चुके ह,(cid:2) वे अगली गितरोध वेतनवृिa 8दनांक 1 नव6बर, 2007 से और परवतk गितरोध वेतन वृिa उनक(cid:26) पहली गितरोध वेतनवृिa क(cid:26) !ािi के पgात छ: वष(cid:18) पूरे हो जाने पर 8दनांक 1 नव6बर, 2008 को अथवा उसके पgात !ाi कर7गे;

आगे यह भी 8क जो अिधकारी म_यम !बंधन Fेणी वेतनमान III म7 पूण(cid:18)त: िनयु% अथवा पदोeत (ए ह,(cid:2)वे उनक(cid:26) सेवा के !#येक तीन वष(cid:18) क(cid:26) पूण(cid:18)ता पर T. 900 !#येक क(cid:26) तीन गितरोध वेतनवृिa के िलए पाh ह(cid:15)गे अथवा :

यह भी 8क जो अिधकारी दो गितरोध वेतनवृिa पहले ही !ाi कर चुके ह (cid:2)एवं दसू री गितरोध वेतनवृिa क(cid:26) !ािi के पgात 8दनांक 1 नव6बर, 2007 को तीन अथवा अिधक वष(cid:18) क(cid:26) सेवा पूण(cid:18) कर चुके ह,(cid:2) वे 8दनांक 1 नव6बर, 2007 को तीसरी गितरोध वेतनवृिa !ाi कर7गे एवं चौथी गितरोध वेतनवृिa 8दनांक 1 नव6बर, 2008 को अथवा उसके पgात दसू री गितरोध वेतनवृिa क(cid:26) !ािi के पgात छ: वष(cid:18) पूरे होने पर वेतनवृिa !ाi कर7ग।े िववेचना–इस उपिनयम के अंतगत(cid:18) अगले उJतर वेतनमान म7 !दान क(cid:26) गई ऐसी वेतनवृिaय(cid:15) का ता#पय(cid:18) पदोeित नहU होगा और अिधकारी को उसके वा1तिवक पद के अनुसार ही िवशेषािधकार, प(cid:30)रलिlधयां,कत(cid:18)m तथा उnरदािय#व ह(cid:15)ग।े (बी) उप-िविनयम (2) म,7-

(i) िववेचना म,7 खoड (ई) के पgात एवं नोट के पूव(cid:18), िनdिलिखत खoड डाला जाएगा, यथा:- “(एफ) नव6बर, 2007 क(cid:26) पहली तारीख को एवं से, अ.य बात(cid:15) के समान रहते (ए mावसाियक योpयता वेतन क(cid:26) रािश िनdानुसार संशोिधत ह(cid:15)गी:- ततततााााििििललललककककाााा िज.ह(cid:15)न ेजूिनयर एसोिशएqस ऑफ इंिडयन इंि1टsूट ऑफ (i) वेतनमान के अिधकतम पर प(ंचने के एक वष(cid:18) ब(cid:2)कस(cid:18) अथवा सtटफाईड एसोिशएqस ऑफ इंिडयन पgात T. 410 !ित माह। इंि1टsूट ऑफ ब(cid:2)कस(cid:18) परीKा उnीण(cid:18) क(cid:26) हो िज.ह(cid:15)न ेसtटफाईड एसोिशएqस ऑफ इंिडयन इंि1टsूट (i) वेतनमान के अिधकतम पर प(चं ने के एक वष(cid:18) ऑफ ब(cid:2)कस(cid:18) के दोन(cid:15) भाग उnीण(cid:18) 8कए ह(cid:15) पgात T. 410 !ित माह।

(ii) वेतनमान के अिधकतम पर प(चं ने के दो वष(cid:18) पgात T. 1030 !ित माह। यह भी 8क य8द कोई अिधकारी वेतनमान के अिधकतम 1तर तक प(चं ने के पgात जूिनयर एसोिशएqस ऑफ इंिडयन इंि1टsूट ऑफ ब(cid:2)कस(cid:18) अथवा सtटफाईड एसोिशएqस ऑफ इंिडयन इंि1टsूट ऑफ ब(cid:2)कस(cid:18) (एक अथवा दोन(cid:15) पाट(cid:18)) क(cid:26) अहत(cid:18) ा !ाi करता है तो mावसाियक योpयता वेतन क(cid:26) पहली 8क1त ऐसी अहत(cid:18) ा !ाi करने क(cid:26) ितिथ से एवं mावसाियक योpयता वेतन क(cid:26) परवतk 8क1त का भुगतान, mावसाियक योpयता वेतन क(cid:26) पहली 8क1त के भुगतान क(cid:26) ितिथ के आधार पर जारी 8कया जाएगा:

इसके अलावा ऐसे मामले जहां कोई अिधकारी, उ% अहत(cid:18) ाu म7 से कोई आहता(cid:18) पहले ही हािसल कर चुका ह ैपरंतु ऐसी अहत(cid:18) ा हािसल करने पर 8कसी !कार क(cid:26) वेतन वृिa अथवा mावसाियक योpयता वेतन !ाi नहU 8कया उ.ह 74 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 8दनांक 1 नव6बर, 2007 से अथवा ऐसी अहत(cid:18) ा !ाi करने क(cid:26) ितिथ म7 से, जो भी बाद म7 हो, उ.ह 7mावसाियक योpयता वेतन का भुगतान 8कया जाएगा.”;

(ii) खoड(v) के नोट म,7 िनdिलिखत खoड !ित1थािपत होगा, यथा:- “(v) य8द कोई अिधकारी,8दनांक 27 अ!ैल, 2010 को खoड (iv) म7 संदbभत उ% अहत(cid:18) ाu म7 से 8कसी क(cid:26) !ािi पहले ही कर चुका है एवं ऐसी अहत(cid:18) ा !ाi करने पर 8कसी वेतनवृिa अथवा mावसाियक योpयता वेतन क(cid:26) !ािi नहU क(cid:26) ह,ैउसे 8दनांक 1 नव6बर, 2007 से अथवा ऐसी अहत(cid:18) ा !ाi करने क(cid:26) ितिथ म7 से, जो भी बाद म7 हो,से mावसाियक योpयता वेतन का भुगतान 8कया जाएगा.”;

(सी) उप-िविनयम (3) म,7-

(i) खoड (डी) के पgात एवं नोट के पूव,(cid:18) िनdिलिखत खoड जोड़ा जाएगा, यथा:- “(ई) 8दनांक 1 नव6बर, 2007 को और से, अ.य बात7 समान रहते (ए, आवास 8कराया भn ेके साथ ि1थर वैयि%क वेतन िनdिलिखत दर से 8दया जाएगा एवं ये संपूण(cid:18) सेवाकाल के िलए ि1थर रहेगा:- ततततााााििििललललककककाााा वेतनवृिa घटक (T.) वेतनवृिa घटक पर 8दनांक कुल दये ि1थर वैयि%क वेतन जहां

01.11.2007 से मंहगाई भnा (T.) ब(cid:2)क ारा आवास उपलlध कराया गया ह ै(T.) (ए) (बी) (सी) 800 58 858 900 65 965 1000 72 1072 1100 79 1179 1200 86 1286 1300 94 1394”

(ii) नोट म 7खoड(i) एवं (ii) के िलए, िनdिलिखत खoड !ित1थािपत ह(cid:15)गे, यथा:- “(i) खoड (बी),(सी),(डी) अथवा (ई) के अंतग(cid:18)त कॉलम (सी) क(cid:26) तािलका म7 इंिगत ि1थर वैयि%क भnा अथवा ि1थर वैयि%क वेतन, उन अिधका(cid:30)रय(cid:15) को भुगतान 8कया जाएगा िज.ह 7 ब(cid:2)क का आवास उपलlध कराया गया ह।ै

(ii) आवास 8कराया भnे के िलए पाh अिधका(cid:30)रय(cid:15) के िलए ि1थर वैयि%क भnा अथवा ि1थर वैयि%क वेतन, खoड (ई) क(cid:26) तािलका के कॉलम (ए) एवं (बी) म7 िनXदf रािश एवं संबa अिधकारी कम(cid:18)चारी ारा आह(cid:30)रत आवास 8कराया भnा के योग क(cid:26) रािश होगी जब िविनयम 4 के उप-िविनयम(cid:15) (2), (3), (4) अथवा (5) म7 िनXदf संगत वेतनमान क(cid:26) अंितम वेतनवृिa !ाi कर ली गई हो.”;

(iii) नोट के पgात आने वाले खoड (ई) को उप-खoड (v) के @प म7 पुन: संxयां8कत 8कया जाएगा एवं संxयां8कत खoड (v) िनdिलिखत खoड से !ित1थािपत होगा, यथा:- “(v) कोई अिधकारी जो उ% खoड (ए) के अनुसार अिyम वेतनवृिa !ाi कर चुका ह(cid:2),वह वेतनमान के अिधकतम 1तर पर प(ंचने के एक वष(cid:18) पgात, उ% खoड (बी), (सी), (डी) अथवा (ई) म7 8कए उ:लेख के अनुसार ि1थर वैयि%क भnा/ि1थर वैयि%क वेतन क(cid:26) रािश आह(cid:30)रत कर7गे”;

5. उ% िविनयम(cid:15) के िविनयम 21 म,7 -

(i) उप-िविनयम(3) म,7 नोट हटा 8दया जाएगा;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5

(ii) उप-िविनयम(4) म,7 नोट हटा 8दया जाएगा;

(iii)उप-िविनयम (4) के पgात, िनdिलिखत उप-िविनयम एवं नोट जोड़ा जाएगा, यथा:- “(5) नव6बर, 2007 क(cid:26) पहली तारीख को और से, अिखल भारतीय औसत कामगार वग(cid:18) उपभो%ा मू:य सूचकांक (सामा.य) आधार 1960=100 के 2836 zबदuु म7 !#येक 4 zबद ुके बढ़ने अथवा घटने के िलए वेतन का 0.15% मंहगाई भnा दये होगा। िववेचना- इस उप-िविनयम के उMेNय के िलए,- (ए) महगाई भnा के िलए “वेतन” से ता#पय(cid:18) ग#यारोध वेतनवृिa सिहत मूल वेतन से है;

(बी) िविनयम 5 के उप-िविनयम (2) के (सी), (डी), (ई) एवं (एफ) म7 िविनXदf mावसाियक योpयता भnा अथवा mवसाियक योpयता वेतन, महगाई भnे क(cid:26) गणना म7 8कए जाएंग।े

6. उ% िविनयम(cid:15) के िविनयम 22 म,7 उप-िविनयम (1) एवं (2) के िलए, िनdिलिखत उप-िविनयम !ित1थािपत ह(cid:15)गे, यथा:- “(1) नव6बर, 2002 क(cid:26) !थम तारीख को और से, (ए) जहां 8कसी अिधकारी को ब(cid:2)क ारा आवासीय सुिवधा उपलlध कराई जाती है,तो वह िजस वेतनमान म7 ह (cid:2)उसके !ारंिभक मूल वेतन के 1.75 !ितशत के समान अथवा आवास के िलए मानक 8कराया म7 से जो भी कम हो,के समान रािश उनसे वसूल क(cid:26) जाएगी;

(बी) जहां 8कसी अिधकारी को ब(cid:2)क ारा कोई आवासीय सुिवधा उपलlध नहU क(cid:26) गई हो, वे िनdिलिखत तािलका म7 िविनXदf दर(cid:15) पर आवास 8कराया भn ेके िलए पाh ह(cid:15)गे, यथा: काय(cid:18)1थल िनdिलिखत 1थान(cid:15) पर होने पर दये आवास 8कराया भnा होगा

(1) (2)

(i) “ए” Fेणी के !मुख शहर एवं yुप ए म7 प(cid:30)रयोजना के./ वेतन का 8.5%

(ii) वग (cid:18)I के अ.य 1थान एवं समूह बी म7 प(cid:30)रयोजना के./ वेतन का 7.5%

(iii) अ.य 1थान वेतन का 6.5% परंतु, य8द कोई अिधकारी 8कराए क(cid:26) रसीद !1तुत करता ह,ैतो वे िजस वेतनमान म7 ह (cid:2)उसके !ारंिभक मूल वेतन के 1.75 !ितशत से अिधक क(cid:26) वा1तिवक रािश िजसका 8कराए के @प म7 उनके ारा भुगतान 8कया गया ह(cid:15), के समान आवास 8कराया भnा दये होगा जो उपयु(cid:18)% तािलका म7 दये आवास 8कराया भnे के अिधकतम 150 !ितशत के अधीन होगा।

(2) 1 नव6बर, 2007 को और उसके बाद से (ए) जब 8कसी अिधकारी को ब(cid:2)क ारा आवासीय सुिवधा उपलlध कराई जाती है, तो वह िजस वेतनमान म7 ह,(cid:2) उसके !ारंिभक मूल वेतन के 1.20 !ितशत के समान अथवा आवास के िलए मानक 8कराया म7 से जो भी कम हो, के समान रािश उनस े वसूल क(cid:26) जाएगी। (बी) जब 8कसी अिधकारी को ब(cid:2)क ारा कोई आवास उपलlध नहU क(cid:26) गई हो, वे िनdिलिखत तािलका म7 िविनXदf दर(cid:15) पर आवास 8कराया भnे के िलए पाh ह(cid:15)गे, यथा :

(iv) उप-िविनयमन (8) के िलए िनdिलिखत उप-िविनयमन !ित1थािपत 8कया जाएगा:- “(8) 8दनांक 1 नव6बर, 2007 को और उसके बाद से य8द काय(cid:18) 8दवस का काय(cid:18)काल .यूनतम 2 घंट(cid:15) के अंतराल म7 िवभ% होता ह,ै तो अिधकारी T.165/- !ित माह क(cid:26) दर से ि1~लट (cid:127)ूटी भnे के िलए पाh होगा।

(ii) 8दनांक 1 मई, 2010 को अथवा उसके बाद से, इस िविनयम के अधीन अिधकारी को अ1पताल के खच‚ क(cid:26) !ितपूbत, कम(cid:18)कार कम(cid:18)चा(cid:30)रय(cid:15) के 8दनांक 27 अ!ैल, 2010 के ि पKीय समझौते के अंतग(cid:18)त िनधा(cid:18)(cid:30)रत अ1पताल म7 भतk होने क(cid:26) योजना के िनयम एवं शत‚ के अनु@प होगी जो िनd तािलका म7 िविनXदf सीमाu के अधीन क(cid:26) जाएगी :- ततततााााििििललललककककाााा (ए) किन^ !बंधन Fेणी वेतनमान I और म_य !बंधन (i) िब1तर !भार Fेणी वेतनमान II तथा III 1वयं - T.700/- !ित 8दन प(cid:30)रवार – T. 525/- !ित 8दन

9. उपयु(cid:18)% िविनयम(cid:15) के िविनयम 25 म7 उप-िविनयम (2) के िलए िनdिलिखत िविनयम !ित1थािपत 8कया जायेगा यथा : “(2) उप िविनयम (1) म7 कुछ भी िनिहत होते (ए, 8दनांक 1 नव6ब र 2007 से 8कसी भी अिधकारी को वह िजस वेतनमान म7 हो, उसके !ारि6भक मूल वेतन के 1.20 !ितशत के समान रािश अथवा आवास के िलए मानक 8कराया, जो भी कम हो, के अिधकारी ारा भुगतान के आधार पर अिधकारी को आवास उपलlध कराने का ब(cid:2)क का खलु ा अिधकार होगा। य8द 8कसी अिधकारी को इस आवास पर फनkचर क(cid:26) सुिवधा भी उपलl ध करायी गयी ह ैतो िजस वेतनमान म7 वह अिधकारी हो, उसके !ारि6भक मूल वेतन का 0.25 !ितशत और वसूल 8कया जाएगा। यह भी 8क य8द इस !कार का आवास ब(cid:2)क ारा उपलl ध कराया गया है, तो िबजली, पानी,गैस एवं संरKण का „य य अिधकारी ारा वहन 8कया जाएगा।

10. उपयु(cid:18)` त िविनयम के िविनयम 36 म,7 उप िविनयम (2) के पNच ात, िन6न िलिखत उप िविनयम जोड़ा जाएगा, यथा:- “(3) 8दनांक 1 मई, 2010 से, कुल 12 महीन(cid:15) क(cid:26) अविध के अंदर िह1टरे`टॉमी के िलए भी अिधकतम 45 8दन(cid:15) का अवकाश 1 वीकृत 8कया जाएगा।

11. उपयु(cid:18)` त िविनयम के िविनयम 41 के उप िविनयम (4) म,7 खंड (ए) के िलए, िन6न िलिखत खंड को !ित1थ ािपत 8कया जाएगा, यथा:- ‘(ए) िवराम (हॉz: टग) भ# ता – 8दनांक 1 मई, 2010 को और उसके बाद से, नीचे दी गयी तािलका के कॉलम नं. 1 म7 दी गयी संगत Fेणी अथवा वेतनमान के अिधकारी इस तािलका के कॉलम नं. 2 म7 दी गयी संगत दर के अनुसार “!ित8द” िवराम भnा (हॉz:टग) के िलए पाh होगा, यथा:- ततततााााििििललललककककाााा अिधकारी क(cid:26) Fेणी/वेतनमान ‘ए’ Fेणी के बड़े शहर ए(cid:30)रया I अ.य 1थ ान

(1) (2) T. T. T. वेतनमान IV एवं ऊपर के अिधकारी 1000 800 700 वेतनमान I/II/III 800 700 600 ले8कन वेतनमान IV एवं ऊपर के अ.यh 1थान पर काय(cid:18)रत अिधका(cid:30)रय(cid:15) के मामल(cid:15) म7, चार महानगर(cid:15) अथा(cid:18)त 8द:ल ी, मु6ब ई, कोलकाता एवं चे. नै म7 !ित8दन दये “िवराम” (हॉz:ट ग) भ#त ा T.1200/- क(cid:26) दर से होगा जब8क वेतनमान I अथवा II अथवा III के अिधका(cid:30)रय(cid:15) को !ित8दन दये “िवराम” (हॉz:टग) भnा T.1000/- होगा। इसके अित(cid:30)र` त यह भी 8क य8द कुल अनुपि1थ ित अविध आठ घंट(cid:15) से कम परंतु चार घंट(cid:15) से अिधक है तो िवराम (हॉz:ट ग) भ# ता उपयु(cid:18)` त दर क(cid:26) आधे दर से दये होगा। िववेचना–––– िवराम (हॉz: टग) भ# ते क(cid:26) गणना के उMेNय से “!ित8दन” से ता#पय(cid:18) हवाई याhा के मामले म7 !1थान हते ु (cid:30)रपो†टग समय से एवं अ.य मामल(cid:15) म7 िनधा(cid:18)(cid:30)रत !1थान से !ार6भ कर प(ंचने के वा1तिवक समय तक !#येक 24 घंटे क(cid:26) अविध अथवा उसका भाग माना जाएगा।¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 9

12. उपयु(cid:18)% िविनयम(cid:15) के िविनयम 42 म7 उप-िविनयम (3) के पgात िनdिलिखत िविनयम जोड़ा जाएगा: “(4) माह मई, 2010 के !थम 8दन से और उसके बाद से अिधकारी 1थानांतरण पर पै‡कग, 1थानीय प(cid:30)रवहन, सामान का बीमा इ#या8द से संबंिधत खच‚ के िलए िनd तािलका म7 िविनXदf एक मुNत रािश !ाi करने के िलए पाh ह(cid:15)गे, यथा:- ततततााााििििललललककककाााा Fेणी एकमुNत रािश शीष(cid:18) काय(cid:18)पालक एवं व(cid:30)र^ !बंधन @.12,000 म_य !बंधन एवं किन^ !बंधन @.9,000

13. उपयु(cid:18)% िविनयम(cid:15) के िविनयम 44 के उपिनयम (3) म7 िनdिलिखत !ावधान जोड़ा जाएगा : - “8दनांक 1 मई, 2010 से, किनY ठ !बंधतंh Fेणी वेतनमान I का अिधकारी, अवकाश याhा (cid:30)रयायत सुिवधा का उपयोगा करते समय वह . यूनतम 8कराया इकॉनॉमी Fेणी म7 हवाई याhा के िलए पाh होगा एवं ऐसे मामले म7 वा1तिवक हवाई 8कराया अथवा तय क(cid:26) गई याhा क(cid:26) दरू ी के िलए एसी !थम Fेणी के 8कराए क(cid:26) !ितपूbत क(cid:26) जाएगी एवं इसी !कार यह िनयम म_य म !बंधतंh Fेणी के वेतनमान II व वेतनमान III के अिधका(cid:30)रय(cid:15) के िलए भी अवकाश याhा (cid:30)रयायत सुिवधा के उपयोग के समय लागू ह(cid:15)गे, य8द दरू ी 1000 8कमी से कम हो।”

14. उपयु(cid:18)% िविनयमन के िनयमन 45 म7

(i) उप िनयमन (1) म,7 िनdिलिखत !ावधान जोड़ा जाएगा, अथा(cid:18)त – “!ावधान ह ै8क 8दनांक 1 अ!ैल , 2010 को या उसके बाद ब(cid:2)क(cid:15) क(cid:26) सेवा म 7शािमल होने वाले अिधका(cid:30)रय(cid:15) के िलए कोई भिवYय िनिध नहU होगी।”

(ii) उप िनयमन (3) म,7 खंड (बी) के बाद और नोट से पहले, िनdिलिखत खंड जोड़ा जाएगा, अथा(cid:18)त – “(सी) वे अिधकारी जो अंशदायी भिवYय िनिध योजना के तहत शािमल ह ैऔर िज.ह(cid:15)ने प7शन योजना का िवक:प नहU िलया है, वे अंशदायी भिवYय िनिध योजना के तहत जारी रह7गे.”

(iii) उप िनयमन (3) के पgात, िनdिलिखत उप-िनयमन जोड़ा जाएगा, अथा(cid:18)त – “(4) जो अिधकारी 8दनांक 1 अ!ैल , 2010 को या उसके बाद ब(cid:2)क म7 भतk होते ह (cid:2)वे प(cid:30)रभािषत अंशदायी प7शन योजना के तहत कवर ह(cid:15)गे, िजसम7 अिधकारी वेतन तथा महगं ाई भnे का 10 !ितशत योगदान करेगा तथा ब(cid:2)क, भारत सरकार क(cid:26) अिधसूचना एफ.नं. 5/7/2003-ईसीबी तथा पीआर 8दनांक 22 8दस6बर, 2003 समय-समय पर यथा संशोिधत के मा_यम से के./ सरकार ारा अिधसूिचत नई प7शन योजना के !ावधान(cid:15) के अनुसार समान रािश का अशं दान करेगा।

NOTIFICATION Mumbai, the 27th June, 2017 No.CO:HRD:IRP:2017-18:116 -In exercise of the powers conferred by section 19, read with sub-section (2) of section 12 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the Central Bank of India in consultation with the Reserve Bank of India and with the previous sanction of the Central Government, hereby makes the following regulations further to amend the Central Bank Of India (Officers’) Service Regulations, 1979, namely:-

1. (1) These regulations may be called the Central Bank Of India (Officers’) Service (Amendment) Regulations,

2017.

(2) They shall be deemed to have come into force with effect from the 1st day of November, 2007, except as otherwise provided in these regulations.

2. In the Central Bank Of India (Officers’) Service Regulations, 1979 (hereinafter referred to as the said regulations), in regulation 3,-

(i) for clause (f), the following clause shall be substituted, namely:- ‘(f) “family” means the spouse of the officer, wholly dependent unmarried children (including step children and legally adopted children), physically challenged brother or sister with forty per cent, or more disability and parents ordinarily residing with and wholly dependent on the officer’.

Explanation.- For the purposes of this clause a child or parent or physically challenged brother or sister shall be deemed to be dependent on the officer if the monthly income of such child, parent, brother or sister does not exceed Rs.3,500 per month.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 15

Provided that if the income of one of the parents exceeds Rs.3,500 per month or the aggregate income of both the parents exceeds Rs.3,500 per month, both the parents shall not be considered as wholly dependent on the officer.’

(ii) Clause (o) shall be omitted.

3. In regulation 4 of the said regulations,-

(i) sub-regulation (4A) shall be omitted;

(ii) after sub-regulation (4A) as so omitted, the following sub-regulations shall be inserted, namely:- “(5) With effect from the 1st November, 2007, the scales of pay specified against each grade shall be as under :

(a) Top Executive Grade Scale VII = Rs.46800 – 1300/4 – 52000 Scale VI = Rs.42000 - 1200/4 – 46800

(b) Senior Management Grade Scale V = Rs.36200 – 1000/2 – 38200 – 1100/2 - 40400 Scale IV = Rs.30600 – 900/4 – 34200– 1000/2 – 36200

(c) Middle Management Grade Scale III = Rs.25700 - 800/5-– 29700 - 900/2 - 31500 Scale II = Rs.19400 - 700/1 - 20100 -800/10 - 28100

(d) Junior Management Grade Scale I = Rs.14500-600/7- 18700-700/2- 20100- 800/7-25700.

Explanation.-Every officer who is governed by the scales of pay in force as on the 31st October, 2007 shall be fitted in the scale of pay set out in this sub-regulation as on 1st November, 2007 on stage to stage basis, i.e. on corresponding stages from first stage onwards in the respective scales and the increments shall fall on the anniversary date as usual except where provided otherwise.

(6) Nothing in sub-regulations (1), (2), (3), (4) and (5) shall be construed as requiring the Bank to have at all times, officers serving in all these grades.”.

4. In regulation 5 of the said regulations, -

(a) for sub-regulation (1), the following sub-regulation, shall be substituted, namely: - “(1) Subject to the provisions of sub-regulation (5) of regulation 4, on and from the 1st November, 2007, the increments shall be granted subject to the following, namely: -

(a) the increments specified in the scales of pay set out in sub-regulation (5) of regulation 4 shall, subject to the sanction of the Competent Authority, accrue on an annual basis and shall be granted on the first day of the month in which these fall due;

(b) officers in Junior Management Grade Scale I who have moved to scale of pay for Middle Management Grade Scale II after reaching maximum of the higher scale shall be eligible for four stagnation increments for every three completed years of service of which first two shall be Rs.800 each and next two Rs.900 each:

Provided that officers who have completed three years or more after receipt of the second stagnation increment as on 1st November, 2007 shall get the third stagnation increment on 1st November, 2007 and another stagnation increment on or after the 1st November, 2008 on their completion of six years after receipt of second stagnation increment;

(c) officers in Middle Management Grade Scale II who have moved to scale of pay for Middle Management Grade Scale III after reaching maximum of higher scale shall be eligible for three stagnation increments of Rs.900 each for every three completed years of service:

Provided that officers who have completed three years or more after receipt of the first stagnation increment as on the 1st November, 2007 shall get the next stagnation increment with effect from the 1st November, 2007 and a subsequent stagnation increment on or after the 1st November, 2008 on their completion of six years after receipt of the first stagnation increment:16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

Provided further the officers appointed to or promoted in substantive Middle Management Grade Scale III, shall be eligible for four stagnation increments of Rs.900 each for every

three completed years of service or :

Provided also that the officers who have already received two stagnation increments and completed more than three years of service after receipt of second stagnation increment as on the 1st November, 2007 shall get the third stagnation increment on the 1st November, 2007 and the fourth stagnation increment, on or after the 1st November, 2008 on completion of six years after receipt of second stagnation increment.

Explanation.- Grant of such increments in the next higher scale under this sub-regulation shall not amount to promotion and the privileges, perquisites, duties and responsibilities of the officers shall continue as of their substantive posts.

(b) in sub-regulation (2),-

(i) in the Explanation, after clause (e) and before the Note, the following clause shall be inserted,

namely:- “(f) on and from the 1st day of November, 2007, other things being equal, the quantum of Professional

Qualification Pay shall stand revised as under:- TABLE Those who have passed Junior Associate of (i) Rs.410 per month one year after Indian Institute of Bankers or Certified reaching maximum of the Scale.

Associate of Indian Institute of Bankers Those who have passed both parts of Certified (i) Rs.410 per month after one year on Associate of Indian Institute of Bankers reaching maximum of the Scale.

(ii) Rs.1030 per month after two years on reaching maximum of the Scale;

Provided that an Officer acquiring Junior Associate of Indian Institute of Bankers or Certified Associate of Indian Institute of Bankers (either or both parts) qualifications after reaching the maximum of the scale of pay, shall be granted from the date of acquiring such qualification the first installment of Professional Qualification Pay and the release of subsequent installments of Professional Qualification Pay shall be

with reference to the date of release of first installment of Professional Qualification Pay:

Provided further that in a case where an officer, has already acquired any of the above qualifications and has not earned any increment or Professional Qualification Pay on account of acquiring such qualification, he may be granted the Professional Qualification Pay, with effect from the 1st November 2007 or the date of acquiring such qualification/s, whichever is later.”;

(ii) in the Note, for clause (v), the following clause shall be substituted, namely:- “(v) if an officer, as on the 27thApril 2010 has already acquired any of the said qualifications referred to in clause (iv) and has not earned any increment or Professional Qualification Pay on account of acquiring such qualification, he shall be granted the Professional Qualification Pay, with effect from the 1st day of November, 2007 or the date of acquiring such qualification, whichever is later.”;

(c) in sub-regulation (3),-

(i) after clause (d) and before the Note, the following clause shall be inserted, namely:- “(e) on and from the 1st November, 2007, other things being equal, Fixed Personal Pay together with House Rent Allowance shall be at the following rates and shall remain frozen for the entire

(ii) in the Note, for clauses (i) and (ii), the following clauses shall be substituted, namely:- “(i) Fixed Personal Allowance or Fixed Personal Pay as indicated under column (C) of the Table under clauses (b), (c), (d) or (e) shall be payable to those officers who are provided with bank’s accommodation.

(ii) Fixed Personal Allowance or Fixed Personal Pay for officers eligible for House Rent Allowance shall be the aggregate amount specified under columns (A) and (B) of the Table under clause (e) and House Rent Allowance drawn by the concerned officer employees when the last increment of the relevant scale of pay as specified in sub-regulations (2), (3), (4) or (5) of regulation 4 is earned.”;

(iii) clause (e) occurring after the Note shall be renumbered as sub-clause (v) thereof and for clause (v) as so numbered, the following clause be substituted, namely:- “(v)An officer who has earned the advance increment as in clause (a) above shall draw the quantum of Fixed Personal Allowance/Fixed Personal Pay as mentioned in clauses (b), (c),

(d) or (e) above, one year after reaching the maximum of the scale”;

5. In regulation 21 of the said regulations, -

(i) in sub-regulation (3), the Note shall be omitted;

(ii) in sub-regulation (4), the Note shall be omitted;

(iii) after sub-regulation (4), the following sub-regulation and Note shall be inserted, namely:- “(5) On and from the 1st day of November, 2007, dearness allowance shall be payable for every rise or fall of four points over 2836 points in the quarterly average of the All India Average Working Class Consumer Price Index (General) Base 1960=100 at 0.15% of Pay.

Explanation.- For the purposes of this sub-regulation,-

(a) “pay” for the purpose of Dearness Allowance shall mean basic pay including Stagnation Increments;

(b) Professional Qualification Allowance or Professional Qualification Pay as specified in Explanations (c), (d), (e) and (f) to sub-regulation (2) of regulation 5 shall rank for dearness allowance’.

6. In regulation 22 of the said regulations, for sub-regulations(1) and (2), the following sub-regulations shall be substituted, namely:- “(1)on and from the 1st day of November, 2002,

(a) where an officer is provided with residential accommodation by the Bank, a sum equal to 1.75 per cent of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less, shall be recovered from him;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(b) where an officer is not provided any residential accommodation by the Bank, he shall be eligible for House Rent Allowance at the rates specified in the following table, namely:

Provided that if an officer produces a rent receipt, the House Rent Allowance payable to him shall be the actual rent paid by him for the residential accommodation in excess over 1.75 per cent of pay in the first stage of the scale of pay in which he is placed with a maximum of 150 per cent of the House Rent Allowance payable as per column (2) of the above Table.

(2) on and from the 1st day of November, 2007, -

(a) where an officer is provided with residential accommodation by the Bank, a sum equal to 1.20 per cent of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less, shall be recovered from him;

(b)where an officer is not provided any residential accommodation by the Bank, he shall be eligible for House Rent Allowance at the rates specified in the following table, namely: - TABLE Where the place of work is in HRA payable shall be

Provided that if an officer produces a rent receipt, the House Rent Allowance payable to him shall be the actual rent paid by him for the residential accommodation in excess over 1.20 per cent of Pay in the first stage of the Scale of Pay in which he is placed with a maximum of 150 per cent of the House Rent Allowance payable as per aforesaid rates mentioned in column (2) above.

Note.- The claims of officers for House Rent Allowance linked to the cost of their ownership accommodation shall also be restricted to 150 per cent of House Rent Allowance as hitherto.”;

7. In regulation 23 of the said regulations,-

(i) in sub-regulation (1), for the figures, letters and words “1st day of November 2002”, the figures, letters and words “1st day of November 2007” shall be substituted;

(ii) in sub-regulation (2), for the figures, letters and words “1st day of November 2002, the figures, letters and words “1st day of November 2007” shall be substituted;

(iii) for sub-regulations (3), (4) and (5), the following sub-regulations shall be substituted, namely:- “(3) On and from the 1st day of November, 2007, if an officer is serving in an area to be specified as Project Area falling in Group A or Group B, he shall be eligible for a Project Area Compensatory Allowance at the rate of Rs.290 per month or Rs.255 per month according to the classification of area as Group A or Group B.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 19

(4) On and from the 1st day of November, 2007, if an officer is transferred from one place to another in the midst of an academic year and if he has one or more children studying in school or college, in the former place, he shall be eligible for a mid-academic year transfer allowance of Rs.700 per month from the date he reports to the latter place upto the end of the academic year in respect of all the children, provided that such allowance shall cease if all the children cease studying at the former place.

(5) On and from the 1st day of May, 2010, if an officer is deputed to serve outside the Bank, he may opt to receive the emoluments attached to the post to which he is deputed, or he may in addition to his pay, draw a deputation allowance at the rate of 7.75 per cent of pay subject to a maximum Rs.2300 per month and such other allowances he would have drawn had he been posted in the Bank’s service at that place:

Provided that where he is deputed to an organisation which is located at the same place where he was posted immediately prior to his deputation, he shall receive a deputation allowance equal to 4 per cent of his pay subject to a maximum Rs.1200 per month:

Provided further that an officer on deputation to the Training Establishment of the Bank as a faculty member shall be eligible for deputation allowance at the rate of 4 per cent of his pay subject to a maximum Rs.1200 per month.”;

(iv) for sub-regulation (8), the following sub-regulation shall be substituted, namely:- “(8) on and from the 1st day of November 2007, if the working hours during a day are split with minimum interval of two hours, an officer shall be eligible for a Split Duty Allowance at the rate of Rs.165 per month.”;

(v) in sub-regulation (10),-

(a) for the figures, letters and words “1st day of November 2002”, the figures, letters and words “1st day of November, 2007” shall be substituted;

(b) for the Table, the following Table shall be substituted, namely:- “TABLE Place Rate

(i) Place with an altitude of 1000 metres and above 2% of pay subject to a maximum of but less than 1500 metres and Mercara Town Rs.550 per month

(ii) Place with an altitude of 1500 metres and 2½% of pay subject to a maximum of above but less than 3000 metres Rs.680 per month

(iii) Place with an altitude of 3000 metres and above 5% of pay subject to a maximum of Rs.1570 per month”;

In regulation 24 of the said regulations, in sub-regulation (1), for clause (a), the following clause shall be substituted, namely:- “(a) Medical Expenses.- On and from the 1st day of November 2007, an officer shall be eligible for reimbursement of medical expenses for self and family on the strength of the officer’s own certificate of having incurred such expenditure supported by a statement of accounts for the amounts claimed as specified in the table below, namely:- TABLE Grade Maximum limit of reimbursement Junior Management and Middle Rs.5100 or the amount incurred Management Grade whichever is less Senior Management and Top Rs.6320 or the amount incurred Executive Grade whichever is less20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] Note.- (i) an officer may be allowed to accumulate unavailed medical aid so as not to exceed at any time three times the maximum amount provided above or;

(ii) for the year 2007, the reimbursement of medical expenses under the medical aid scheme shall be enhanced proportionately for two months, that is, November 2007 and December, 2007.

Explanation. - for the purposes of this regulation,-

(i) hospitalisation charges shall be reimbursed to the extent of 100 per cent in the case of an officer and 75 per cent, in the case of his family members in respect of all cases which require hospitalization or;

(ii) on and from the 1st day of May, 2010, reimbursement of hospitalisation expenses under this regulation shall be in accordance with the terms and conditions of Hospitalisation Scheme as laid down under the Bipartite Settlement dated the 27thday of April, 2010 for workmen employees, subject to the limits as specified in the table below, namely:- TABLE

(a) Junior Management Grade Scale I and (i) Bed Charges Middle Management Grade Scales II Self – Rs.700 per day and III.

Family – Rs.525 per day

(ii) Other charges At the scale of 125% of the limits laid down under the Hospitalisation Scheme applicable to workmen employees.

(b) Senior Management Grade Scales IV (i) Bed Charges and V and Top Executive Grade Scales Self – Rs.900 per day VI and VII.

Family – Rs.675per day

(ii) Other charges At the scale of 150% of the limits laid down under the Hospitalisation Scheme applicable to workmen employees.”;

9. In regulation 25 of the said regulations, for sub-regulation (2), the following sub-regulation shall be substituted,

namely:- “(2) Notwithstanding anything contained in sub-regulation(1), it shall be open to the Bank to provide residential accommodation to an officer on payment by the officer, on and from the 1st day of November, 2007, a sum equal to 1.20 per cent, of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less:

Provided that where the officer is provided with furniture at such residence, a further sum equal to

0.25 per cent of basic pay in the first stage of the scale of pay in which he is placed shall be

recovered by the Bank from him:

Provided further that, where such residential accommodation is provided by the bank, the charges for electricity, water, gas and conservancy shall be borne by the officer.”.

10. In regulation 36 of the said regulations, after sub-regulation (2), the following sub-regulation shall be inserted,

namely :- “(3) With effect from the 1st day of May 2010, within the overall period of 12 months, leave may also be granted in case of hysterectomy upto a maximum of 45 days.”.

11. In regulation 41 of the said regulations, in sub-regulation (4), for clause (a), the following clause shall be substituted, namely:- ‘(a) Halting Allowance – On and from the 1st day of May, 2010, an officer in the Grades or Scales set out in column (1) of the Table below shall be entitled to `per diem’ Halting Allowance at the corresponding¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 21 rates set out in column (2) thereof, namely:- TABLE Major `A’ Class Other Grades/Scales of officers Area I cities Places

Provided that in the case of officers in Scale IV and above, Halting Allowance payable per diem while on outstation work at the four metros, viz., Delhi, Mumbai, Kolkata and Chennai, shall be Rs.1200 and for officers in Scale I or II or III, the per diem Halting Allowance and shall be Rs.1000:

Provided further that where the total period of absence is less than eight hours but more than four hours, Halting Allowance at half the above rates shall be payable.

Explanation.- For the purpose of computing Halting allowance “per diem” shall mean each period of twenty-four hours or any subsequent part thereof, reckoned from the reporting time for departure in the case of air travel and the scheduled time of departure in other cases, to the actual time of arrival and where the total period of absence is less than twenty-four hours, “per diem” shall mean a period of not less than eight hours.’.

12. In regulation 42 of the said regulations, after sub-regulation (3), the following sub-regulation shall be inserted,

namely:- “(4) On and from the first day of May 2010, an officer on transfer shall be eligible to draw a lump sum amount for expenses connected with packing, local transportation, insuring the baggage, etc., as specified in the Table below, namely:- “TABLE Grade Lump Sum Top Executive and Senior Management Rs.12,000 Middle Management and Junior Management Rs.9,000”.

13. In regulation 44 of the said regulations, in sub-regulation (3), the following proviso shall be inserted, namely:- “Provided that with effect from the 1st May 2010, an officer in Junior Management Grade Scale I while availing Leave Travel Concession shall be entitled to travel by air in the lowest fare economy class in which case the reimbursement will be the actual fare or the fare applicable to AC First Class fare by train for the distance traveled, whichever is less and the same rules shall apply to an officer in Middle Management Grade Scale II and Middle Management Grade Scale III while availing Leave Travel Concession where the distance is less than 1000 kms.”.

14. In regulation 45 of the said regulations, -

(i) in sub-regulation (1), the following proviso shall be inserted, namely:- “Provided that there shall be no Provident Fund to Officers joining the services of the Banks on or after the 1st day of April, 2010.”;

(ii) in sub-regulation (3), after clause (b) and before the Note, the following clause shall be inserted,

namely:- “(c) Officers who are covered under the Contributory Provident Fund Scheme who do not opt for Pension Scheme shall continue under the Contributory Provident Fund Scheme.”;

(iii) after sub-regulation(3), the following sub-regulation shall be inserted, namely:-22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] “(4) The officers joining the services of the Bank on or after the 1st day of April 2010 shall be covered by a Defined Contributory Pension Scheme, where the officer shall contribute ten per cent, of pay plus Dearness Allowance and the Bank shall make the similar amount of contribution in accordance with the provisions of the Contributory Pension Scheme in accordance with New Pension Scheme notified by the Central Government vide notification of the Government of India, F.No.5/7/2003-ECB & PR dated the 22nd December, 2003, as amended from time to time.”

15. For the Schedule to the said regulations, the following Schedule shall be substituted, namely,:- “Schedule to Central Bank of India (Officers’) Service Regulations, 1979 (See sub-regulation (2) of regulation 23) With effect from the 1st day of November, 2007, an officer shall be eligible for the Special Area Allowance till such time they are withdrawn or modified either wholly or partially, as specified in the Table below, namely:- TABLE Allowances (Rs.) EXPLANATORY MEMORANDUM The Regulations which have been given retrospective effect are as per the agreed terms and conditions of the Joint Notes signed between the Indian Banks’ Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level officers’ associations of the Banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
