1. सजं िप्त नाम एर् ंप्रारंभ

(i) यह जर्जनयमार्ली जर्देिी मुद्रा प्रबंध (भुगतान माध्यम तथा गैर-कज़व जलखतों की ररपोर्टिंग) (सिं ोधन) जर्जनयमार्ली, 2026 कहलाएगी।

2. मलू जर्जनयमार्ली के जर्जनयम 3.1 म,ें क्रम सख्ं या III और X पर ददए गए मौिदू ा प्रार्धानों को जनम्नजलजखत स े प्रजतस्ट्थाजपत दकया िाएगा, यथा: - जनयमों की भुगतान माध्यम एर् ंजबक्रीगत आय के जर्प्रषे ण के सबं धं म ेंअनदु िे अनसु चू ी III. अनसु चू ी III ए. भगु तान माध्यम

(1) प्रजतफल राजि का भुगतान जर्देि से बैंककंग चैनल के माध्यम से आर्क जर्प्रेषण के रूप में अथर्ा जर्देिी मुद्रा (अजनर्ासी भारतीय प्रबंध (िमा) जर्जनयमार्ली, 2016 के अनुसरण में बनाए गए दकसी प्रत्यार्तवनीय खाते म ेंरखी गई जनजधयों में स े (एनआरआई) दकया िाएगा। अथर्ा जर्दिे ी भारतीय नागररक

(2) भारत के बाहर निवासी व्यनि द्वारा जर्देिी मुद्रा प्रबंध (िमा) जर्जनयमार्ली, 2016 के अनुसरण में बनाए गए (ओसीआई)सजहत प्रत्यावततिीय रुपया खाता, जर्निर्दष्टत ककया जाएगा और इसका उपयोग नवशेष रूप से इस अिुसूची के तहत अिुमत भारत के बाहर रहन ेर्ाल ेदकसी निवेश के निए ककया जाएगा। व्यजि द्वारा प्रत्यार्तनव ीय

(3) एनआरआई/ओसीआई द्वारा राष्ट्रीय पेंिन प्रणाली में अंिदान का भुगतान बैंककंग चैनलों के माध्यम से या जर्देिी आधार पर जनर्िे ) मुद्रा प्रबंध (िमा) जर्जनयमार्ली, 2016 के अनुसरण में रखे गए दकसी प्रत्यार्तवनीय जर्देिी मुद्रा या रुपया खात े या एनआरओ खाते में रखी गई जनजधयों में से जर्देि से आर्क जर्प्रेषण के रूप में दकया िाएगा। बी. जबक्रीगत आय का जर्प्रषे ण

(1) जबक्रीगत आय को (लागू करों की कटौती के पश्चात) भारत के बाहर जर्प्रेजषत दकया िा सकता है या संबंजधत व्यजि के प्रत्यार्तवनीय रुपये खाते में िमा दकया िा सकता ह।ै

(2) म्यूचुअल फंड की यूजनटों की जबक्रीगत आय (लागू करों की कटौती के पश्चात) और एनआरआई/ओसीआई द्वारा राष्ट्रीय पेंिन प्रणाली में अंिदान को भारत के बाहर जर्प्रेजषत दकया िा सकता ह ैया एनआरआई/ओसीआई जनर्ेिक के जर्कल्प अनुसार जर्देिी मुद्रा प्रबंध (िमा) जर्जनयमार्ली, 2016 के अनुसरण में रखे गए दकसी भी खाते में िमा दकया िा सकता ह।ै X. अनसु चू ी XI ए. भगु तान का माध्यम

(1) अंतरराष्ट्रीय एक्सचेंि पर सूचीबद्ध दकसी भारतीय कंपनी के साधारण िेयरों की खरीद/अजभदान के जलए (अनज्ञु ये धारक प्रजतफल की राजि का भुगतान – द्वारा भारत म ें

(i) समय-समय पर यथासंिोजधत जर्दिे ी मुद्रा प्रबंध (भारत में जनर्ासी व्यजि द्वारा जर्देिी मुद्रा खाते) जनगजमत कंपजनयों के साधारण िये रों जर्जनयमार्ली, 2015 के अनुसार धाररत उि भारतीय कंपनी के जर्देिी मुद्रा खाते में बैंककंग चैनलों के की अतं रराष्ट्रीय माध्यम से दकया िाएगा; या एक्सचिें ों पर खरीद या (ii) बैंककंग चैनलों के माध्यम से जर्देि से आर्क प्रेषण के रूप अथर्ा जर्देिी मुद्रा प्रबंध (िमा) अजभदान योिना) जर्जनयमार्ली, 2016 के अनुसरण में बनाए गए दकसी प्रत्यार्तवनीय जर्देिी मुद्रा या रुपया खाते में धाररत की गई जनजधयों में से दकया िाएगा। स्ट्पष्टीकरण: अतं रराष्ट्रीय एक्सचेंि पर सूचीबद्ध भारतीय कंपनी के साधारण िेयरों की खरीद/अजभदान से हुए आगम का जर्प्रेषण या तो भारत में जस्ट्थत दकसी बैंक खाते में दकया िाएगा या उस भारतीय कंपनी के जर्देिी मुद्रा खाते में िमा दकया िाएगा िो समय-समय पर यथासंिोजधत जर्देिी मुद्रा प्रबंध (भारत में जनर्ासी व्यजि द्वारा जर्देिी मुद्रा खाते) जर्जनयमार्ली, 2015 का पालन करते हुए धाररत दकया गया हो। बी. जबक्रीगत आय का जर्प्रषे ण साधारण िेयरों की जबक्री आय (लागू करों की कटौती के पश्चात) का जर्प्रेषण भारत के बाहर दकया िा सकता ह ै या उसे अनुज्ञेय धारक के ऐसे बैंक खाते में क्रेजडट कराया िा सकेगा जिनका रखरखार् जर्देिी मुद्रा प्रबंध (िमा) जर्जनयमार्ली, 2016 के अनुसार दकया िा रहा हो।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

3. मलू जर्जनयमार्ली के जर्जनयम 4 म ेंसिं ोधन मूल जर्जनयमार्ली के जर्जनयम 4 के उप-जर्जनयमन (9) म ें मौिूदा प्रार्धान को जनम्नजलजखत द्वारा प्रजतस्ट्थाजपत दकया िाएगा, अथावत:् “एलईसी (आईएफआई): नाजमत प्राजधकृत व्यापारी श्रेणी I बकैं , भारत के बाहर रहने र्ाले दकसी व्यजि, जिसमें अजनर्ासी भारतीय या भारत के प्रर्ासी नागररक िाजमल ह,ैं द्वारा भारत के स्ट्टॉक एक्सचेंिों पर इदिटी जलखतों की खरीद/हस्ट्तांतरण की ररपोर्टिंग फॉमव एलईसी (आईएफआई) में भारतीय ररज़र्व बकैं को करेंगे।” रोजहत पी. दास, िेत्रीय जनदेिक [जर्ज्ञापन-III/4/असा./167/2026-27] फुट नोट:

NOTIFICATION Mumbai, the 13th June, 2026 Foreign Exchange Management (Mode of Payment and Reporting of Non-Debt Instruments) (Amendment) Regulations, 2026 No. FEMA. 395(4)/2026-RB.— In exercise of the powers conferred by Section 47 of the Foreign Exchange Management Act, 1999 (42 of 1999), the Reserve Bank of India hereby makes the following amendments to the Foreign Exchange Management (Mode of Payment and Reporting of Non-Debt Instruments) Regulations, 2019 [Notification No. FEMA.395/2019-RB dated October 17, 2019] (hereinafter referred to as ‘the Principal Regulations) namely:-

1. Short Title & Commencement

(i) These Regulations may be called the Foreign Exchange Management (Mode of Payment and Reporting of Non- Debt Instruments) (Amendment) Regulations, 2026.

(ii) They shall come into force from the date of their publication in the Official Gazette.

2. In the principal regulations, in regulation 3.1, for the existing provision at Sl. No. III and X, the following shall be substituted, namely :

Mode of Payment (Investments by an individual (1) The amount of consideration shall be paid as inward remittance from abroad person resident outside India through banking channels or out of funds held in any repatriable deposit account including Non-Resident Indian maintained in accordance with the Foreign Exchange Management (Deposit)

(NRI) or Overseas Citizen of Regulations,2016.

India (OCI) on repatriation basis) (2) A repatriable rupee account maintained in accordance with the Foreign Exchange Management (Deposit) Regulations,2016, shall be designated by an individual person resident outside India and the same shall be used exclusively for investments permitted under this Schedule.

(3) Subscription to National Pension System by NRIs/OCIs shall be paid as inward remittance from abroad through banking channels or out of funds held in any repatriable foreign currency or rupee account or NRO account, maintained in accordance with the Foreign Exchange Management (Deposit) Regulations, 2016.

B. Remittance of sale proceeds

(1) The sale proceeds (net of taxes) of equity instruments may be remitted outside India or may be credited to designated rupee account of the person concerned.

(2) The sale proceeds (net of taxes) of units of mutual funds and subscription to National Pension System by NRIs/OCIs may be remitted outside India or, may be credited to any accountmaintained in accordance with the Foreign Exchange Management (Deposit) Regulations, 2016at the option of the NRI/OCI investor.

X. Schedule XI A. Mode of Payment

(1) The amount of consideration for purchase / subscription of equity shares of (Purchase or Subscription of an Indian company listed on an International Exchange shall be paid, - Equity Shares of Companies

(i) through banking channels to a foreign currency account of the Indian Incorporated in India on company held in accordance with the Foreign Exchange Management International Exchanges Scheme (Foreign currency accounts by a person resident in India) Regulations, by Permissible Holder) 2015, as amended from time to time; or[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5

(ii) as inward remittance from abroad through banking channelsor out of funds held in any repatriable foreign currency or rupee account maintained in accordance with the Foreign Exchange Management (Deposit) Regulations, 2016

Explanation: The proceeds of purchase / subscription of equity shares of an Indian company listed on an International Exchange shall either be remitted to a bank account in India or deposited in a foreign currency account of the Indian company held in accordance with the Foreign Exchange Management (Foreign currency accounts by a person resident in India) Regulations, 2015, as amended from time to time.

B. Remittance of sale proceeds The sale proceeds (net of taxes) of the equity shares may be remitted outside India or may be credited to the bank account of the permissible holder maintained in accordance with the Foreign Exchange Management (Deposit) Regulations,

2016.

3. Amendment to Regulation 4 of the Principal Regulations In sub-regulation (9) of Regulation 4 of the Principal Regulations, the existing provision shall be substituted by the following, namely: “LEC(Individual Foreign Investor - IFI): The designated Authorised Dealer Category I banks shall report to the Reserve Bank in Form LEC (IFI) the purchase / transfer of equity instruments by an individual person resident outside India including Non-Resident Indians or Overseas Citizens of India on stock exchanges in India”.
