1. संजक्षप्त िीर्कड और प्रारंभण:

(1) इि जिजियमों को पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (पेरोजलयम, पेरोजलयम उत्पाि और प्राकृजतक गैस पाइपलाइि की क्षमता का जिधाडरण) सिं ोधि जिजियम, 2022 कहा िाएगा।

(2) य े सरकारी रािपत्र म ेंअपि े प्रकािि की तारीख स ेलागू होंगे।

2. पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (पेरोजलयम, पेरोजलयम उत्पाि और प्राकृजतक गैस पाइपलाइि की क्षमता का जिधाडरण) जिजियम, 2010 म,ें -

(i) जिजियम 2 म,ें उप-खंड ( ठ ) म,ें "(जमजलयि टि प्रजत िर्)ड " िब्िों को "(जमजलयि मीट्ररक टि प्रजत िर्)ड " िब् िों स े प्रजतस्ट्र्ाजपत दकया िाएगा ।

(ii) जिजियम 4 म,ें - 7701 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (क) उप-खंड (1) म,ें "पाइपलाइि की क्षमता की.......... " िब्िों के बाि और "…………. घोर्णा" िब्िों स े पहल,े "जिधाडरण या" िब् िों को िाजमल दकया िाएगा। (ख) उपखंड (2) और उपखडं (3) लोप कर दिए िाएंग े ।

(iii) जिजियम 5 के उप-जिजियम 3 म,ें - (क) खंड (क) के उप-खंड (vi) म ें , 'िेग' िीर्डक के तहत, िब्ि "2 मी/सेकण् ड" को "3 मी/ सैकण् ड" िब्िों स े प्रजतस्ट्र्ाजपत दकया िाएगा। (ख) खंड (क) के उप-खंड (vii) के जलए, "पाइपलाइि क्षमता ….. " स े िुरू होिे िाल े और "…… िबाि और तापमाि होगा:" स े समाप्त होिे िाले िब्िों को लोप कर दिया िाएगा। (ग) उपखंड (vii) के बाि, जिम्नजलजखत उपखंड को िोडा िाएगा, अर्ाडत:् - "(viii) अजधकतम स्ट्िीकाय ड पट्ररचालि िबाि (एमएओपी) - पेरोजलयम, पेरोजलयम उत्पािों या प्राकृजतक गैस पाइपलाइिों के जलए दकसी भी जस्ट्र्जत के कारण जडजाइि दकए गए एमएओपी या डी-रेटेड एमएओपी पर पाइपलाइि क्षमता जिधाडट्ररत की िाएगी।" (घ) खंड (ख) के उप-खंड (ix) म,ें संख्या "2009" को "2008" स े प्रजतस्ट्र्ाजपत दकया िाएगा और अंत म,ें जिम्नजलजखत को िोडा िाएगा, अर्ाडत:् - "प्राकृजतक गैस पाइपलाइि की जस्ट्र्जत म ें जिकास बबंि ु पर गसै की गुणित्ता पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (सामान्य िाहक या संजििा िाहक प्राकृजतक गैस पाइपलाइिों की प्राजप्त संजहता) जिजियम, 2008 के अिुसार होगी।" (ङ) खंड (ख) के उप-खंड (x) के जलए , "प्राकृजतक गैस पाइपलाइि की जस्ट्र्जत म.ें .." स े िुरू होिे िाल े और "…..जिजियम, 2008 के अिुसार होगी। " के सार् समाप्त होिे िाले िब्िों को हटा दिया िाएगा।

(iv) जिजियम 5 के उप-जिजियम (4) म,ें - (क) खंड 4 के उप खडं (i) के "तर्ा अक्टूबर के पहल े काय ड दििस पर" िब् िों को हटाया िाएगा एि ं िरुु आत म,ें जिम्ि जलजखत को िाजमल दकया िाएगा, अर्ाडत ्– "अगल े जित् तीय िर्ड के जलए" (ख) उप-खंड (4) में, पैराग्राफ म ें "कंपजियां प्रत् यके िर् ड ..." िब्िों स े िुरू होि े िाले और “.. भी उपलब् ध कराएंगी।" िब्िों के सार् समाप्त होिे िाल े िब्ि ों को जिम्नजलजखत स े प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ातड :् - "कंपजियां प्रत् यके िर्ड अप्रलै के पहले काय ड दििस को (अगले जित्तीय िर्ड के जलए) द्रि चाजलत अिपु ात तर्ा पाइपलाइि का प्रणाली प्रिाह आरेख भी उपलब् ध कराएंगी।"

(v) जिजियम 5 के उप-जिजियम (5) म,ें - (क) खंड (क) के उपखंड (x) म,ें िब्ि "या" को िब् ि "और" स े प्रजतस्ट्र्ाजपत दकया िाएगा। (ख) खंड (ख) के उपखंड (viii) म,ें िब्ि "या" को िब्ि "और" स े प्रजतस्ट्र्ाजपत दकया िाएगा। (ग) खंड (घ) के बाि, जिम्नजलजखत खंडों को िाजमल दकया िाएगा, अर्ाडत:् - "(ड.) एकीकृत या इंटरकिेक्टेड पाइपलाइि िेटिकड की क्षमता ऊपर जिजिर्िष्टड पद्धजत के अिुसार जिधाडट्ररत की िाएगी। (च) बोडड के पूिाडिुमोिि स े डी-रेटटंग की जस्ट्र्जत को छोडकर, पाइपलाइि क्षमता म ें कमी की अिुमजत िहीं िी िाएगी। (छ) िहां कहीं भी पीएििीआरबी के बोडड द्वारा यर्ा अिुमोदित कारणों स े अतीत या भजिष्य म ें प्राकृजतक गैस पाइपलाइि की क्षमता म ें कोई पट्ररितिड होता ह,ै ऐसी जस्ट्र्जतयों म ें कंपिी प्राकृजतक गैस पाइपलाइि की संिोजधत क्षमता, प्रत् यके ऐस े कारणों का अलग स,े क्षमता जिधाडरण के इि जिजियमों के अिुसार पीएििीआरबी बोड ड को अिुमोिि के जलए प्रस्ट्ततु करेगी।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

(vi) जिजियम 7 म ें - (क) खंड (i) म,ें - i. "... की क्षमता प्रत् यके िर्ड " िब् िों के बाि और "अप्रैल के पहले काय ड दििस" िब्िों स े पहल,े "अगल े जित्तीय िर्ड के जलए" िब् िों को िाजमल दकया िाएगा । ii. िब्ि "या िब भी" के बाि और प्रतीक "-" स े पहल,े "जिम्नजलजखत कारकों के कारण क्षमता म ें प्लस या माइिस 10% का कुल पट्ररितिड होता ह"ै िब् िों को िोडा िाएगा। (ख) खंड (i) के उप-खंड (ग) म ें, "िब कभी" एि ं "अजधसूजचत हो" िब् ि लोप हो िाएंगे। (ग) खंड (ii) म,ें "पुि: जिधाडट्ररत क्षमता" िब्िों के बाि एिं "का ब्य ौरा प्रस्ट्त ुत" िब्िों स े पहल े "(जिजियम 5 के अिुसार)" िब् ि िोडे िाएगं े ।

(vii) अिुसूची क म ें- (क) "प्राकृजतक गैस पाइपलाइि की क्षमता जिधाडट्ररत करिे के संबंध म ें सूचिा प्रस्ट्तुत करि े के जलए प्रपत्र" िब्िों के िीच ेऔर ताजलका के ऊपर, िब्ि "जित्तीय िर्ड: 20… - 20…" िोडे िाएंग े । (ख) ताजलका के जलए, पंजि 12 और 13 म,ें "खण् ड" िब्ि को "जिजियमि" िब्ि स ेप्रजतस्ट्र्ाजपत दकया िाएगा। (ग) िोट म,ें जिम्नजलजखत खडं प्रजतस्ट्र्ाजपत दकए िाएगं ,े अर्ाडत:् - "(i) क्षमता जिधाडरण के जलए उपयोग दकए िािे िाल े सॉफ्टिये र पैकेि के प्रणाली प्रिाह आरेख, द्रिचाजलत अिुपात और सतत अिुकरण फाइलें िमा करें।

(ii) उपरोि िािकारी कंपिी के बोडड द्वारा प्राजधकृत व्यजि द्वारा अिुमोदित की िाएगी ।"

(viii) अिुसूची ख म ें- (क) "प्राकृजतक गैस पाइपलाइि की क्षमता जिधाडट्ररत करिे के संबंध म ें सूचिा प्रस्ट्तुत करि े के जलए प्रपत्र" िब्िों के िीच ेऔर ताजलका के ऊपर, िब्ि "जित्तीय िर्ड: 20…- 20…" िाजमल दकए िाएगं े । (ख) िोट म,ें जिम्नजलजखत खडं प्रजतस्ट्र्ाजपत दकए िाएगं ,े अर्ाडत:् - "(i) क्षमता जिधाडरण के जलए उपयोग दकए िािे िाल े सॉफ्टिये र पैकेि के प्रणाली प्रिाह आरेख, द्रिचाजलत अिुपात और सतत अिुकरण फाइलें िमा करें।

NOTIFICATION New Delhi, the 18th November, 2022 F. No. PNGRB/Tech/10-Cap/NGPL&PPPL/(2)/2022(P-3745).—In exercise of the powers conferred by

Section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations further to amend the Petroleum and Natural Gas Regulatory Board (Determining Capacity of Petroleum, Petroleum Products and Natural Gas Pipeline) Regulations, 2010, namely: -4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

1. Short title and commencement:

(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Determining Capacity of Petroleum, Petroleum Products and Natural Gas Pipeline) Amendment Regulations, 2022.

(2) They shall come into force on the date of their publication in the official gazette.

2. In the Petroleum and Natural Gas Regulatory Board (Determining Capacity of Petroleum, Petroleum Products and Natural Gas Pipeline) Regulations, 2010, -

(i) in Regulation 2, in sub-clause (l), the words “(million tones per annum)” shall be substituted by the words, “(Million Metric Tonne Per Annum)”.

(ii) in Regulation 4, –

(a) in sub-clause (1), after the words, “for the purpose of…..” and before the words “…..declaration of capacity”, the words “determination or” shall be inserted.

(b) the sub-clause (2) and sub-clause (3) shall be omitted.

(iii) in sub-regulation 3 of Regulation 5, –

(a) in sub-clause (vi) of clause (a) , under the heading ‘Velocity’, the words “2 m/sec” shall be substituted by the words “3 m/sec”.

(b) for sub-clause (vii) of clause (a), the words starting with “The pipeline capacity…..” and ending with “……Pressure and Temperature:”, shall be deleted.

(c) after sub-clause (vii), the following sub-clause shall be inserted, namely: - “(viii) Maximum Allowable Operating Pressure (MAOP) - The pipeline capacity shall be determined at the designed MAOP or de-rated MAOP due to any condition, for the petroleum, petroleum products or natural gas pipelines.”

(d) in sub-clause (ix) of clause (b), the number “2009” shall be substituted by “2008” and at the end, the following shall be inserted, namely:- “In case of natural gas pipeline, the gas quality at exit point shall be as per the Petroleum and Natural Gas Regulatory Board (Access Code for common or contract carrier Natural Gas Pipelines) Regulations, 2008.”

(e) for sub-clause (x) of clause (b), , the words starting with “In case of natural gas pipeline…..” and ending with “…..Regulations, 2008.”, shall be deleted.

(iv) in sub-regulation (4) of Regulation 5, –

(a) for sub-clause (i) of clause (4), the words “and first working day of October of every year”, shall be substituted by the words “every year for next financial year”.

(b) in sub-clause (4), in paragraph beginning from the words “The entities shall also...” and ending with the words “...for the pipeline.”, the following shall be substituted, namely: - “The entities shall also provide on first working day of April every year (for next financial year) the hydraulic gradient and system flow diagram for the pipeline.”

(v) in sub-regulation (5) of Regulation 5, –

(a) in sub-clause (x) of clause (a), the word “or” shall be substituted by the word “and”.

(b) in sub-clause (viii) of clause (b), the word “or” shall be substituted by the word “and”.

(c) after clause (d), the following clauses shall be inserted, namely: - “(e) The capacity of integrated or interconnected pipeline network shall be determined in line with methodology as specified above.

(f) Reduction of pipeline capacity shall not be permitted except in case of de-rating with prior approval from Board.

(g) Wherever there is any change in the capacity of natural gas pipeline in the past or in future due to reason(s) as approved by the PNGRB’s Board, in such cases entity shall submit the revised capacity of the natural gas pipeline, separately due to each such reasons, to PNGRB in terms of these regulations for capacity determination and approval of the Board.”[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5

(vi) in Regulation 7 –

(a) in clause (i), - i. after the words “…April every year” and before the words “or whenever-”, the words “for next financial year” shall be inserted. ii. after the words “or whenever” and before the symbol “-”, the words “there is an aggregate change of plus or minus 10% in capacity due to the following factors” shall be inserted.

(b) in sub-clause (c) of clause (i), the words “as and when notified” shall be omitted.

(c) in clause (ii), after the words “…of the pipeline” and before the words “to the Board…”, the words “(as per regulation 5)” shall be inserted.

(vii) in Schedule A –

(a) below the words “Format for furnishing information regarding determining capacity of Natural Gas Pipeline” and above the table, the words “Financial Year: 20…. - 20….” shall be inserted.

(b) for the table, in row 12 and 13, the word “section” shall be substituted by the word “regulation”.

(c) in Note, the following clauses shall be substituted, namely: - “(i) Submit the system flow diagram, hydraulic gradient and simulation files of software package used for capacity determination.

(ii) Above information shall be approved by person authorized by the board of entity.”

(viii) in Schedule B –

(a) below the words “Format for furnishing information regarding determining capacity of Petroleum and Petroleum Products Pipeline” and above the table, the words “Financial Year: 20…. - 20….” shall be inserted.

(b) in Note, the following clauses shall be substituted, namely: - “(i) Submit the system flow diagram, hydraulic gradient and simulation files of software package used for capacity determination.

(ii) Above information shall be approved by person authorized by the board of entity.”

(c) for the table, in row 13 and 14, the word “section” shall be substituted by the word “regulation”.

(d) for the table, the row below row 14 shall be numbered as “15”.
