1. लघ ुिीर्कड और प्रारंभण:
(1) इि जिजियमों को पेरोजलयम और प्राकृजतक गैस जियामक बोडड (ऑटोमोटटि ईंधिों के जितरण के जलए सुरक्षा मािकों सजित तकिीकी मािक और जिजििेि) संिोधि जिजियम, 2023 किा िाएगा।
(2) ये सरकारी रािपत्र में उिके प्रकािि की तारीख स ेप्रिृत् त िोंगे।
2. पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (ऑटोमोटटि ईंधिों के जितरण के जलए सुरक्षा मािकों सजित तकिीकी मािक और जिजििेि) जिजियम, 2018 म,ें -
(1) जिजियम 6, उप-जिजियम (1) में, "अिुसचू ी-I" िब्िों को "अिुसूची-1" िब्िों के सार् प्रजतस्ट्र्ाजपत दकया िाएगा।
(2) अिुसूची 1 म,ें खंड 3.4 (xi) म,ें "खाली की िाि े िाली टैंक लॉरी चाल ू अिस्ट्र् ा म ें ि िो" िब्िों के बाि, जिम्नजलजखत िोडा िाएगा, अर्ाडत्:- 6939 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] "कंपजियों को उि टरटेल आउटलेट्स की पिचाि करिी चाजिए जििमें ितडमाि म ें जिकास पर् उपलब्ध ििीं ि ै और टैंक लॉरी के जडकैंटेिि के िौराि ड्राइि आउट जस्ट्र्जत सुजिजित करिे के जलए इस जिजियमि की अजधसूचिा के छि मिीिे के भीतर लेआउट म ें संिोधि करिा चाजिए। िैकजल्पक रूप से, मौिूिा पेरोजलयम टरटेल आउटलेट्स में, ििां भी जिकास पर् संभि ििीं ि,ै ऐसे टरटेल आउटलेट्स की पिचाि की िािी चाजिए और इस जिजियम की अजधसूचिा के 3 िर् ड के भीतर इन् ि ें अन्य उपयिु स्ट्र्ाि पर स्ट्र्ािांतटरत दकया िािा चाजिए। इस बीच, अल्प ीकरण उपाय के रूप म,ें टैंक लॉरी जडकैंटेिि के जलए, अिलु ग्नक IX में जिर्िष्टड आिश्यकताओं का अिपु ालि उि टरटेल आउटलेट्स म ें दकया िाएगा ििा ं जिकास पर् ििीं ि।ै ''
(3) अिुसूची 1 म,ें खंड "3.4(xi), अन् त म ें”;” को लोप कर दिया िाएगा ।
(4) अिुसूची 1 म,ें खडं 6.2.1(ii) म,ें "टैंक रक से भंडारण टैंक तक रोक दिया िाएगा", िब्िों के बाि, जिम्ि जलजखत िब् िों को िोडा िाएगा, अर्ाडत:् - " िैकजल्पक रूप से, टरटेल आउटलेट्स के जलए ड्राइि आउट सजित अिुलग्ि क-X म ेंजिर्िडष्ट आिश्यकताओं का अिुपालि दकया िाएगा।"
(5) अिुसूची 1 म,ें अिलु ग् िक-VIII के बाि अिलु ग् िक- IX और अिलु ग् िक -X िोडे िाएंग,े अर्ाडत्: - अिलु ग्ि क-IX उि परे ोजलयम टरटेल आउटलट्े स के जलए आिश्यकताएँ, ििा ँटैंक लॉटरयों के जलए जडकैंटेिि के िौराि ड्राइि आउट सभं ि ििीं ि ै
1. सभी मौिूिा टरटेल आउटलेट्स में, ििां टैंक लॉरी को ड्राइि आउट जस्ट्र्जत म ें जडकैंटेिि संभि ििीं ि,ै ििा ं टैंक लॉरी का जडकैंटेिि केिल जडस्ट् पैंससंग गजतजिजधयों के पूणड रूप से रोकिे के पश् चात और टरटेल आउटलेट पटरसर म ें जिजिटसड के जलए आिश् यक मिसूस की िाि े िाली सभी गजतजिजधयों के बंि िोिे के बाि िी दकया िाएगा।
2. टैंक लॉरी को जडकैंटेिि के जलए ले िािे के बाि सभी जडस्ट्पेंसरों को लॉक करिे के जलए टरटेल आउटलेट ऑटोमेिि म ें इंटरलॉक प्रिाि दकए िाएगं े।
3. टैंक लॉटरयों के जिकास पर् की योििा बिाई िाएगी और टरटेल आउटलेट पर स्ट्र्ायी फिड जचह्िों और बैटरकेड्स/ कोि लगाकर स्ट्पष्ट रूप से जचजह्ित दकया िाएगा। जडकैंटेिि के िौराि इस े खाली रखा िाएगा। यदि एक स े अजधक जिकास मागड उपलब्ध ि,ैं तो ऐसे सभी मागों को स्ट्र्ायी फिड जचह्िों के माध्यम से भी जचजह्ित दकया िाएगा और जडकैंटेिि के िौराि खाली रखा िाएगा।
4. टैंक लॉरी के पीछे के क्षेत्र की घरे ाबंिी की िाएगी तादक आपात जस्ट्र्जत म ें टैंक लॉरी जबिा दकसी बाधा के पीछे की ओर िा सके।
5. जडकैंटेिि टैंक लॉरी िल, डीलर या टरटेल आउटलेट पयडिेक्षक की उपजस्ट्र्जत में दकया िाएगा।
6. यातायात को जियंजत्रत या प्रबंजधत करिे के जलए दकसी जिजिष्ट व्यजि को तैिात दकया िाएगा तादक यि सुजिजित दकया िा सके दक जडकैंटेिि की अिजध के िौराि पार्किंग, ग्रािक आिािािी के द्वारा टैंक लॉटरयों के मागड में कोई बाधा ि आए।
7. जडकैंटेिि काय ड और उसकी जिकासी के िौराि टैंक लॉरी को टरिसड करि े के माग ड पर ग्रािक िाििों और दकसी भी व्यजि की आिािािी प्रजतबंजधत िोगी।
8. टैंक लॉटरयों के जिकास पर् पर प्रमुख चेताििी संकेत प्रिर्िडत दकए िािे चाजिए और पीछे का मागड जिम्नजलजखत संििे के सार् अलग दकया िािा चाजिए: "चते ाििी: यि पर् टैंक रक के जिकास के जलए आरजक्षत िै। इसे ब् लॉक ि करें।
9. टरटेल आउटलेट के प्रििे या जिकास पर प्रमुख संकेत-पट्ट प्रिर्िडत दकया िािा चाजिए जिसमें बताया गया िो दक टैंक लॉटरयों की अिलोसडगं चल रिी ि ैऔर जबक्री रोक िी गई ि।ै अिलु ग्नक-X टैंक लॉरी जडकैंटेिि के िौराि जबक्री की अिमु जत िेि ेकी आिश्यकताएँ
1. टरटेल आउटलेट में टैंक लॉरी का जडकैंटेिि ड्राइि आउट जस्ट्र्जत में िोगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3
2. टरटेल आउटलेट्स में न्यिू तम 1.2 मीटर की ऊंचाई तक पक् की या गैर-जछदित चारिीिारी िोिी चाजिए।
3. टैंक लॉरी के सेन् टर से 9 मीटर व्य ास का क्षेत्र, दफसलंग प् िाइंट के सेन् टर से 3 मीटर व् यास का क्षेत्र और संबंजधत िेंट स े 4 मीटर का क्षेत्र अलग कर दिया िाएगा। इस क्षेत्र को फि ड पर स्ट्पष्ट रूप से जचजह्ित दकया िाएगा और इसकी घेराबंिी की िाएगी। टैंक लॉरी जडकैंटेिि के िौराि इस क्षेत्र के भीतर कोई जितरण या िािि की आिािािी या कोई अन्य गजतजिजध ििीं की िाएगी।
4. टरटेल आउटलेट्स पर अन्य सभी गजतजिजधयां िैसे सी-स्ट्टोर, एटीएम, ईिी चार्ििंग को जडकैंटेिि के िौराि टैंक लॉरी के मध् य स े 9 मीटर के िायरे म ेंबंि कर दिया िाएगा।
5. जडकैंटेिि टैंक लॉरी िल, डीलर या टरटेल आउटलेट पयडिेक्षक की उपजस्ट्र्जत म ेंदकया िाएगा।
6. जडकैंटेिि के िौराि टैंक लॉरी के जिकास पर् को खाली रखा िाएगा। इस क्षेत्र म ें यातायात को जियंजत्रत या प्रबंजधत करिे के जलए दकसी जिजिष्ट व्यजि को तैिात दकया िाएगा तादक यि सुजिजित दकया िा सके दक जडकैंटेिि की अिजध के िौराि पार्किंग, ग्रािकों की आिािािी आदि के द्वारा टैंक लॉटरयों के माग डमें कोई बाधा ि आए।
7. दकसी भी समय केिल एक टैंक लॉरी का जडकैंटेिि दकया िाएगा। इसके अलािा, एलपीिी, सीएििी या एलएििी िैसे दकसी भी अन्य उत्पाि की लोसडंग या अिलोसडंग की अिमु जत ििीं िी िाएगी। टरटेल आउटलटे पर टैंक लॉरी के जडकैंटेिि के िौराि घरे ाबिं ी दकए िाि ेिाले क्षत्रे का जिजिष्ट िक्ि ा 9 मी. व् यास 3 मी. व् यास
(6) अिुसूची 2, खडं 3.3.2 (v) म,ें "के जलए जचजह्ित दकए िाएंगे" िब्िों को "के जलए रखे िाएंगे " िब्िों के सार् प्रजतस्ट्र्ाजपत दकया िाएगा।
(7) अिुसूची 2, खडं 3.8 में, "अिसु ूची-I" िब्िों को "अिुसूची-1" िब्िों के सार् प्रजतस्ट्र्ाजपत दकया िाएगा।
(8) अिुसूची 2, खडं 6 (iv) म,ें ताजलका में, चौर्ी पंजि के िसू रे कॉलम में, िब्ि "िर्ड म ेंएक बार" को "िोट-1" िब्िों से प्रजतस्ट्र्ाजपत दकया िाएगा।
(9) अिुसूची 2, खडं 6 (iv) म,ें ताजलका के अतं गतड , जिम्नजलजखत िोडा िाएगा, अर्ाडत:् - " िोट 1: क) िेसलों या भूजमगत िेसलों के अंिर स्ट्र्ाजपत अजतटरि प्रिाि िांच िाल्ि (ईएफसीिी) िो आसािी से पहुचं योग्य ििीं ि ैं और आइसोलेिि िाल्ि के जबिा स्ट्र्ाजपत ईएफसीिी, सक्षम व्यजि के4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] माध्यम से 5 साल में एक बार उिके प्रिाि रेटटंग माप के जलए बेंच परीक्षण दकया िाएगा। इि िाल्िों की कायडक्षमता का परीक्षण िर् ड में एक बार दकया िाएगा। ख) जडस्ट्पेंसर म ें या िेसल के बािर आइसोलेिि िाल्ि िाल े या आइसोलेिि प्रािधािों िाले अजतटरि फ्लो चेक िाल्ि (ईएफसीिी) का िर्ड में एक बार उिके प्रिाि रेटटंग माप के जलए बेंच परीक्षण दकया िाएगा। इि िाल्िों की कायडक्षमता का परीक्षण जतमािी में एक बार दकया िाएगा। “ िन्ििा िमा,ड सजचि [जिज्ञापि-III/4/असा./524/2023-24] पाि टटप्प णी:
1. मुख्य जिजियम भारत के रािपत्र (असाधारण), भाग III, धारा 4 म ें 16 ििंबर 2018 फा. सं. इंफ्रा / टी 4 एस / एससी - 6/4/2018 के माध्यम से प्रकाजित दकए गए र्े।
2. पेरोजलयम और प्राकृजतक गैस जिजियामक बोड ड (पेरोजलयम, ऑटो एलपीिी और (सीएििी) जितटरत करिे िाल े टरटेल आउटलेट के जलए सुरक्षा मािकों सजित तकिीकी मािक और जिजििेि) (संिोधि) जिजियम, 2020 को 15 जसतंबर 2020 को भारत के रािपत्र (असाधारण), भाग III, धारा 4 म ें फा.स.ं पीएििीआरबी/तक/5- टी4एसआरओ/(2)/2020 के माध्यम से प्रकाजित दकया गया र्ा।
3. पेरोजलयम और प्राकृजतक गैस जिजियामक बोडड (ऑटोमोटटि ईंधि के जितरण के जलए सुरक्षा मािकों सजित तकिीकी मािक और जिजििेि) (सिं ोधि) जिजियम, 2022 को 12 दिसंबर 2022 को भारत के रािपत्र (असाधारण), भाग III, धारा 4 में फा.सं. पीएििीआरबी/टेक/5-आरओ/(1)/2022 (पी-3803) के माध्यम स े प्रकाजित दकया गया र्ा। PETROLEUM AND NATURAL GAS REGULATORY BOARD
NOTIFICATION New Delhi, the 1st November, 2023 F. No. PNGRB/Tech/5-RO/(1)/2022 (P-3803).—In exercise of the powers conferred by section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations further to amend the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for dispensing of Automotive Fuels) Regulations, 2018, namely: -
1. Short title and commencement:
(1) These Regulations may be called the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for dispensing of Automotive Fuels) Amendment Regulations, 2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for dispensing of Automotive Fuels) Regulations, 2018, -
(1) In Regulation 6, sub-regulation (1), the words “Schedule-I”, shall be substituted with the words “Schedule-1”.
(2) In Schedule 1, clause 3.4 (xi), after the words "in drive out position", the following shall be inserted, namely: - “. Entities should identify Retail outlets in which drive out position is not available at present and make modification in the layout within six months of notification of this regulation, to ensure drive out position during tank lorry decantation. Alternatively, in existing Petroleum Retail Outlets, wherever the drive out position is not feasible, such Retail Outlets should be identified and relocated to other suitable location(s) within 3 years of notification of this regulation. In the meantime, as mitigation measure, for the tank lorry decantation, the requirements as specified in Annexure IX shall be complied with the retail outlets not having drive out position.”[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5
(3) In Schedule 1, clause 3.4 (xi), “;” at the end shall be omitted.
(4) In Schedule 1, clause 6.2.1 (ii), after the words "from tank truck to the storage tanks", the following words shall be inserted, namely :- ", alternatively, for Retail Outlets with drive out the requirements as specified in Annexure-X shall be complied with”
(5) In Schedule 1, Annexure-IX and Annexure-X shall be added after Annexure VIII , namely: - Annexure- IX Requirements for the petroleum retail outlets where tank lorries drive out position is not feasible during decantation
1. In all existing Retail outlets, where tank lorries decantation in drive out position is not feasible, tank lorries decantation shall be undertaken only after complete stoppage of dispensing activities and closure of all activities necessitating visitors at the Retail outlet premises.
2. Interlocks shall be provided in Retail Outlet Automation to lock all Dispensers once tank lorry is undertaken for decantation.
3. The drive out path of the tank lorries shall be planned and clearly marked at the Retail Outlet by way of permanent floor markings and barricades or cones. The same shall be kept clear during decantation. In case, more than one exit routes are available, all such routes shall also be marked by way of permanent floor markings and kept clear during decantation.
4. The area at the backside of the tank lorries shall be cordoned off so that in case of exigency, tank lorries can reverse without any hindrance.
5. Decantation shall be done in presence of tank lorry crew, the dealer or retail outlet supervisor.
6. Dedicated person shall be deployed to control or manage traffic to ensure that no obstruction in the path of tank lorries by way of parking, customer movement during the period of decantation.
7. Movement of the customer vehicles and of any person shall be prohibited on the reversing path of the tank lorry during decanting operation and its evacuation.
8. Prominent signage should be displayed along the tank lorries exit path and cordoned off path at the
back with the following message: "Warning: Reserved path for Tank Truck exit. Do not block.
9. Prominent signage should be displayed at entry or exit of Retail outlet stating that tank lorries unloading is underway and sales have been stopped.
Annexure- X Requirements for allowing sales during tank lorry decantation
1. The Retail Outlet shall have tank lorry decantation in drive out position.
2. Retail Outlets shall have masonry or non-perforated boundary wall of minimum height of 1.2 m.
3. An area of 9 m radius from the centre of Tank Lorry, an area of radius 3 m from centre of fill point and 4 meter from corresponding vent shall be cordoned off. This area shall be clearly marked on the floor and cordoned off. No dispensing or movement of vehicle or any other activity shall be undertaken within this area during tank lorry decantation.
4. All other activities at Retail Outlets such as C-Store, ATM, EV charging shall be stopped within the 9 m radius from the centre of Tank Lorry during decantation.
5. Decantation shall be done in presence of tank lorry crew, the dealer or retail outlet supervisor.
6. The drive out path of the tank lorry under decantation shall be kept clear. Dedicated person shall be deployed to control or manage traffic in this area to ensure that no obstruction in the path of tank lorries by way of parking, customer movement etc. during the period of decantation.
7. Decantation of only one tank lorry shall be undertaken at any point of time. Tank Lorry Fill Point
(6) In Schedule 2, clause 3.3.2 (v), the words “marked for”, shall be substituted with the words “maintained for”.
(7) In Schedule 2, clause 3.8, the words “Schedule-I”, shall be substituted with the words “Schedule-1”.
(8) In Schedule 2, clause 6 (iv), in the table, in second column of the fourth row, the words “Once in a year”, shall be substituted with the words “Note-1”.
(9) In Schedule 2, clause 6 (iv), under the table, the following shall be added, namely: - “Note-1: a) The Excess Flow Check Valve (EFCV) installed inside the vessels or underground vessels which are not accessible easily and EFCVs installed without isolation valves, shall be bench tested for their flow rating measurements, once in 5 years through competent person. The functionality test of these valves shall be done once in a year.
b) Excess Flow Check Valve (EFCV) in dispenser or located outside the vessel with isolation valves or having isolation provisions, shall be bench tested for their flow rating measurement, once in a year.
