1. सजं िप्त िीर्कड और प्रारंभ, -
(1) इन जिजनयमों को पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन को जबछाने, जनमाडण, प्रचालन या जिस्ट्तार करने के जलए कंपजनयों को प्राजधकृत करना) संिोधन जिजनयम, 2023 कहा जाएगा।
(2) ये जिजनयम सरकारी राजपत्र में प्रकािन की तारीख से प्रिृत् त होंगे।
2. पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन को जबछाने, जनमाडण, प्रचालन या जिस्ट्तार करने के जलए कंपजनयों को प्राजधकृत करना) जिजनयम, 2010 में, - (क) जिजनयम 2 के उप-जिजनयम (1) में, (क) खडं (च) म-ें
(i) "मौजूदा" िब्दों के बाद, "रंक" िब्द िाजमल दकया जाएगा;
(ii) "ब्ांच लाइन" िब्दों के बाद, "या स्ट्पर लाइन" िब्द िाजमल दकए जाएंग;े 7800 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(iii) "पाइपलाइन की "िब्द के बाद "प्राजधकृत" िब्द िाजमल दकए जाएँग;े (ख) खडं (ञ) म-ें
(i) तथा पेरोजलयम िब्दों "से िुरू होने िाले और "द्वारा जनदजे ित होगा" िब्दों से समाप्त होने िाले भाग के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया जाएगा, अथाडत्:-
(ii)"सामान्य या अनुबंध िाहक के रूप में पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन प्रणाली के संचालन के जलए आिश्यक भंडारण सुजिधाओं के प्रभाि सजहत" (ग) खडं (त) के पश्चात ्जनम्नजलजखत जोडा जाएगा, अथातड ्:- ‘’थ "स्ट्पर-लाइन" का अथड रंक या दकसी अन्य स्ट्पर लाइन से जनकलने या जिस्ट् तार करने िाली पाइपलाइन ह,ै जजसका व्यास और िमता रंक पाइपलाइन से अजधक नहीं ह,ै, लेदकन जजसमें एक या अजधक उपभोिाओं को पेरोजलयम और पेरोजलयम उत्पादों की आपूर्तत के जलए कोई पंपपग सुजिधा नहीं ह।ै दकसी भी पाइपलाइन को, जजसमें एक अलग पेरोजलयम और पेरोजलयम उत्पाद स्रोत या एक पंप ह,ै को स्ट्पर-लाइन के रूप में नहीं माना जाएगा। स्ट्पर-लाइन की लंबाई रंक पाइपलाइन की लंबाई पर जनभडर नहीं हो सकती ह।ै पेरोजलयम उत्पादों के पररिहन के जलए एक स्ट्पर-लाइन को रंक पाइपलाइन की िमता का उपयोग करना चाजहए। स्ट्पर लाइन में ब्ांच लाइन भी िाजमल ह;ै "(द) "टाई-इन कनेजटटजिटी" का अथड ह ै एक सामान्य िाहक या संजिदा िाहक पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन और जनम्नजलजखत में से दकसी एक के बीच पेरोजलयम और पेरोजलयम उत्पादों के पररिहन के जलए पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन कनेजटटजिटी, अथाडत्: -
(i) पेरोजलयम और पेरोजलयम उत्पाद स्रोत; या
(ii) दकसी अन्य सामान्य िाहक या संजिदा िाहक पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन से एक नया इंजेटिन पिाइंट । (ख) जिजनयम 5 में, - (क) उप-जिजनयम (1) में, "कम स ेकम" िब्दों स ेिरूु होन े िाल े भाग के जलए और कोष्ठक और "(िबे होपस्ट्टग सजहत) प्रकािन सजहत" के साथ समाप्त होन ेिाल ेिब्द ों के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया जाएगा, अथातड :्- "पीएनजीआरबी की िेबसाइट पर इसे व्यापक प्रचार दते े हुए िेबहोस्ट्ट करें;" (ख) उप-जिजनयमन (5) म,ें-
(i) " कम से कम " िब्दों से िुरू होने िाले और "जिज्ञापन प्रकाजित करेगा" िब् दों के साथ समाप्त होने िाले भाग को , "िेबहोस्ट्ट" िब्द से प्रजतस्ट्थाजपत दकया जाएगा;
(ii) "पेरोजलयम उत्पाद पाइपलाइन" िब्द के बाद, "पीएनजीआरबी की िेबसाइट पर" िब्दों को और िाजमल जाएंग;े
(iii) उप-जिजनयम (9) को लोप कर ददया जाएगा। (ग) जिजनयम 7 में, - (क) उप-जिजनयम (1) में,-
(I) खण्ड (क) में-
(i) "दस िर्ड की अिजध" िब्दों के स्ट्थान पर जनम्नजलजखत िब्द प्रजतस्ट् थाजपत दकए जाएंगे, अथाडत्:- "इसके प्रचालन से िुरू होने िाली पाइपलाइन के उपयोजगता काल का प्रत्येक िर्ड"; (ii "प्रिुल् क की बोली प्रत्येक दस िर्ड के जलए लगाई जाएगी", िब्दों को "प्रिुल् क की बोली प्रत्येक पच्चीस िर्ड के जलए लगाई जाएगी।" िब् दों से प्रजतस्ट्थाजपत दकया जाएगा;
(iii) "पचास" िब्द के स्ट्थान पर "चालीस" िब्द प्रजतस्ट्थाजपत दकया जाएगा;[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3
(II) खण्ड (ख) में,-
(i) िब्द "दस िर्ड की अिजध" के स्ट्थान पर, ""इसके प्रचालन से िुरू होने िाली पाइपलाइन के उपयोजगता काल का प्रत्येक िर्ड"; िब्द प्रजतस्ट्थाजपत दकए जाएंग;े
(ii), "प्रिुल् क की बोली प्रत्येक दस िर्ों के जलए लगाई जाएगी" िब्दों को "प्रिुल् क की बोली प्रत्येक पच्चीस िर्ों के जलए लगाई जाएगी" िब् दों से प्रजतस्ट्थाजपत दकया जाएगा;
(iii) "बीस" िब्द के स्ट्थान पर "चालीस" िब्द को प्रजतस्ट्थाजपत दकया जाएगा;
(III) खंड (ग) में, िब्द "तीस" के स्ट्थान पर "बीस" िब्द को प्रजतस्ट्थाजपत दकया जाएगा; (ख) उप-जिजनयम (3) म,ें-
(i) "उप-जिजनयम" िब्द के स्ट्थान पर िब्द, कोष्ठक और अंक (1) प्रजतस्ट् थाजपत दकए जाएंग;े
(ii) "मात्रा" िब्द के स्ट्थान पर िब् द , कोष् ठक और अिर " सृजजत दकए जाने के जलए प्रस्ट्ताजित िमता (एमएमटीपीए) को प्रजतस्ट्थाजपत दकये जाएंगे;
(iii) "पररयोजना का डीएफआर" अिरों और िब्दों के बाद, िब्द, कोष्ठक और आंकडे, "जैस,े पाइपलाइन की लंबाई, व्यास, स्ट्पर लाइनें, पंप तथा पेरोजलयम और पेरोजलयम उत्पादों की पाइपलाइन के जलए अन्य संबंजधत सुजिधा, जैसा दक जिजनयम 2 के उप-जिजनयम (1) के खंड (i) के तहत पररभाजर्त दकया गया ह,ै को जोडा जाएगा;
(ग) उप-जिजनयम (4) के बाद, जनम्नजलजखत जोडा जाएगा, अथातड :्- “(5) उप-जिजनयम (1) के खंड (क) से (ख) के तहत पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन टैररफ के जलए िर्ड 1 टैररफ बोजलयां पाइपलाइन के प्रचालन के पहले िर्ड से लागू होंगी। पाइपलाइन को तब चालू माना जाएगा जब इसकी रंक पाइपलाइन पूरी तरह चालू हो जाएगी। आंजिक रूप से चालू की गई रंक पाइपलाइन के जलए, केिल प्रथम िर्ड का टैररफ तब तक लाग ूहोगा जब तक दक इसकी रंक पाइपलाइन पूरी तरह से चालू नहीं हो जाती।
(6) बोडड पाइपलाइन के आर्तथक जीिन के बाद प्राजधकार की मंजूरी की तारीख और पाइपलाइन के प्रचालन की िुरुआती तारीख के बीच की समय अिजध के बराबर अिजध के जलए उद्धृत टैररफ का जिस्ट्तार करेगा।”; (घ) जिजनयम 12 में, -
(i) उप-जिजनयम (1) का लोप कर ददया जाएगा;
(ii) उप-जिजनयम (2) के जलए, जनम्नजलजखत को प्रजतस्ट्थाजपत दकया जाएगा, अथाडत्: - “(2) यदद पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन की िमता का जिस्ट्तार करने का प्रस्ट्ताि ह,ै तो कंपनी बोडड के जिचार के जलए एक प्रस्ट्ताि प्रस्ट्तुत करेगी तथा बोडड पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन में िमता के जिस्ट्तार की अनुमजत द ेसकता ह।ै ”;
(iii) उप-जिजनयम (2) के बाद, जनम्नजलजखत जोडा जाएगा, अथाडत्- “(3) उप-जिजनयम (2) के तहत पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन में िमता के जिस्ट्तार से संबंजधत प्रािधान सभी पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन पर लागू होंगे जो या तो जिजनयम 4, 18, 19 के तहत बोडड द्वारा अजधकृत ह ैंया जिजनयम 17 के तहत स्ट्िीकृत ह ैंजैसा दक केंद्र सरकार द्वारा प्राजधकृत ह:ै बिते दक बोडड ऐसे प्रस्ट्ताजित जिस्ट्तार के स्ट्थान पर िैकजल्पक रूप से बोजलयां आमंजत्रत कर सकता ह,ै यदद बोड ड समझता ह ैदक बोजलयां आमंजत्रत करने से जनम्नजलजखत उद्देश्यों में से एक या अजधक की पूर्तत होगी, अथाडत्:-
(i) कंपजनयों के बीच प्रजतस्ट्पधाड को बढािा दनेा;
(ii) जनरथडक जनिेि से बचना;
(iii) आपूर्तत बनाए रखना या बढाना या समान जितरण सुजनजश्चत करना या पूरे दिे में पेरोजलयम और पेरोजलयम उत्पादों की पयाडप्त उपलब्धता सुजनजश्चत करना;
(iv) उजचत पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन टैररफ पर पेरोजलयम और पेरोजलयम उत्पादों की उपलब्धता के संदभ डमें ग्राहकों के जहतों की सुरिा करना;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(v) पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन बुजनयादी ढांचे के तीव्र जिकास को प्रोत्साजहत करना।"; (ड) जिजनयम 21 में, -
(i) िीर्डक में, "सुधार या जिस्ट्तार" िब्दों के बाद, "या टाई-इन कनेजटटजिटी या स्ट्पर-लाइन जबछाना" िब्द अंत:स्ट् थाजपत दकए जाएंगे;
(ii) उप-जिजनयम (1) में,- (क) "प्रेर्ण टर्तमनल-" िब्दों के जलए,, जनम्नजलजखत अंत:स्ट् थाजपत दकया जाएगा, अथाडत्: - "प्रेर्ण टर्तमनल, या
(v) टाई-इन कनेजटटजिटी जबछाकर एक नया स्रोत जोडना, या
(vi) स्ट्पर लाइन जबछाना – ”; (ख) पहले जनयम का लोप दकया जाएगा; (ग) दसू रे जनयम में, "पाइपलाइन के जिस्ट्तार के बाद पाइपलाइन टैररफ में कोई बदलाि नहीं होगा" िब्दों के स्ट्थान पर, "ऐसे प्रभाि के कारण टैररफ में कोई बदलाि नहीं होगा" िब्द अंत:स्ट् थाजपत दकए जाएंगे;
(iii) उप-जिजनयम (2), का लोप दकया जाएगा;
(iv) उप-जिजनयम (3) के जलए, जनम्नजलजखत को प्रजतस्ट् थाजपत दकया जाएगा, अथाडत्:- “(3) यदद पाइपलाइन की िमता का जिस्ट्तार करने का प्रस्ट्ताि ह,ै तो कंपनी जिजनयम 12 के प्रािधानों के अनुरूप बोडड के जिचार के जलए एक प्रस्ट्ताि प्रस्ट्तुत करेगी और बोडड पाइपलाइन द्वारा सेिा प्राप्त करने िाले ग्राहकों पर प्रजतकूल प्रभाि डाले जबना पाइपलाइन की िमता पर जिचार करने के बाद, जिस्ट्तार की अनुमजत द ेसकता ह।ै
(v) उप-जिजनयम (5) के बाद, जनम्नजलजखत जोडा जाएगा, अथाडत्: - ‘’(6) पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन का जिस्ट्तार:
(i) कंपनी पेरोजलयम और पेरोजलयम उत्पादों की पाइपलाइन की प्राजधकृत लंबाई को मांग केंद्रों में मूल पबद ु या अंजतम पबद ुसे दस प्रजतित या 50 दक.मी., जो भी कम हो, तक बढा सकती ह ैऔर बोडड को प्रस्ट्ताि के औजचत्य सजहत पूणड जििरण, सभी सुजिधाओं की रूपरेखा प्रस्ट् तुत करेगी और बोडड से पूि ड प्राजधकार प्राप्त करेगी:
बिते दक दकसी भी तकनीकी समस्ट् या उत् पन् न होने पर, पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन के ऐसे जिस्ट्तार के मूल पबद ु या अंजतम पबद ु से मूल पबद ु में अनुमेय अंतर जनकटतम सेटिनलाइपजग िाल्ि (एसिी) स्ट्टेिन से अजधक नहीं होगा, लेदकन कंपनी को तकनीकी बाधाओं के जलए जिस्ट्तृत औजचत्य प्रदान करने की आिश्यकता होगी।
(ii) बोडड, सािडजजनक परामिड के बाद, अनुरोध प्राप्त होने के साठ ददनों के भीतर कंपनी को जनणडय दगे ा।
(iii) जिस्ट्तार के बाद पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन टैररफ में कोई बदलाि नहीं होगा।
(7) टाई-इन कनेजटटजिटी: (क) दकसी सामान्य िाहक या सजं िदा िाहक पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन के पास अपस्ट्रीम कनेजटटजिटी की आिश्यकता के मामले में, कनेजटटजिटी के जलए एक जिस्ट्तृत प्रस्ट्ताि संबंजधत कंपनी द्वारा बोडड को प्रस्ट्तुत दकया जाएगा जजसमें स्रोतों या इंजेटिन पबद ु सुजिधाओं, आसपास के िेत्र में मौजूदा पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन बुजनयादी ढांचे और प्रस्ट्ताजित टाई-इन कनेजटटजिटी की लंबाई और िमता के साथ मांग-आपूर्तत अनुमान का जििरण दिाडया जाएगा। (ख) बोडड जहतधारकों से जिचार और रटप्पजणयां मांगने के जलए सािडजजनक परामिड प्रदिया िुरू करने हते ु तीस ददनों की अिजध के जलए प्रस्ट्ताि को िेबहोस्ट् ट करेगा । (ग) सािडजजनक परामिड प्रदिया के दौरान प्राप्त जिचारों और रटप्पजणयों के आधार पर, बोडड उन जहतधारकों के साथ खुली चचाड आयोजजत कर सकता ह ैजजन्होंने अपने जिचार प्रदान दकए ह।ैं[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5 (घ) बोडड जनम्नजलजखत पद्धजत के अनुसार ऐसी टाई-इन कनेजटटजिटी को अजधकृत कर सकता ह,ै अथाडत्:-
(i) टाई-इन कनेजटटजिटी का जनमाडण मुख् यत: उत्पाद स्रोत या इंजेटिन पबद ु के पास मौजूद सामान्य िाहक या सजं िदा िाहक पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन के स्ट्िाजमत्ि िाली कंपनी द्वारा दकया जाएगा, बिते दक ऐसी टाई-इन कनेजटटजिटी की लंबाई सामान्य िाहक या संजिदा िाहक पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन की प्राजधकृत लंबाई बीस प्रजतित हो, या यह अजधकतम 200 दक.मी.
हो: बिते दक उत्पाद स्रोत या इंजेटिन पबद ुके पास मौजूद एक से अजधक पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन के मामले में, स्रोत के जनकटतम सामान्य िाहक या संजिदा िाहक पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन का स्ट्िाजमत्ि और संचालन करने िाली कंपनी को भौजतक रूप से जनकट होने पर टाई-इन कनेजटटजिटी जबछाने से इनकार करने का पहला अजधकार होगा;
बिते दक यदद सामान्य िाहक या संजिदा िाहक पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन का स्ट्िाजमत्ि और संचालन करने िाली कंपजनयां उि टाई-इन कनेजटटजिटी जबछाने से इनकार करती ह,ैं तो बोड ड उस इच्छुक कंपनी को अजधकृत कर सकता ह ैजजसने जनयमों और ितों के साथ उट त टाई-इन कनेजटटजिटी को जबछाने का प्रस्ट्ताि ददया था और ऐसे मामले में, इच्छुक कंपनी को पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (सामान्य िाहक या संजिदा िाहक पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइनों के जलए पहुंच आचार संजहता) जिजनयम, 2016 के संदभ ड में "जिपर" माना जाएगा;
(ii) बोडड जिजनयम 5 के उप-जिजनयम (5) के प्रािधानों के अनुसार संबंजधत टाई-इन कनेजटटजिटी के जलए बोजलयां आमंजत्रत करने पर भी जिचार कर सकता ह;ै
(iii) उप-खंड (i) में दी गई लंबाई से अजधक टाई-इन पाइपलाइन कनेजटटजिटी के जनमाडण के दकसी भी प्रस्ट्ताि को प्रजतस्ट्पधी बोली माग डके जलए जनयमों के प्रासंजगक प्रािधानों के अनुरूप जनपटाया जाएगा;
(8) स्ट्पर-लाइन ेंजबछाना: स्ट्पर लाइन के जलए अनुरोध िुरू करने िाली कंपनी को बोडड को अपने इरादों के साथ-साथ स्ट्पर-लाइन की लंबाई, मागड, िमता और सेिा प्रदान दकए जान े िाले ग्राहकों के जििरण के बारे में सूजचत करना होगा और बोडड अनुरोध प्राप्त होने के साठ ददनों के भीतर कंपनी को सािडजजनक परामिड के बाद अपना जनणडय दगे ा।
(9) बोडड इस जिजनयम के तहत प्रस्ट्ततु ऐसे प्रस्ट्ताि के स्ट्थान पर िैकजल्पक रूप स े बोजलया ं आमजं त्रत कर सकता ह,ै यदद बोडड यह समझता ह ैदक बोजलयों आमजं त्रत करन ेस ेजनम्नजलजखत उद्देश्यों म ेंस ेएक या अजधक की पर्तू त होगी, अथातड :्-
(i) कंपजनयों के बीच प्रजतस्ट्पधाड को बढािा दने ा;
(ii) जनरथडक जनिेि से बचना;
(iii) आपूर्तत बनाए रखना या बढाना या समान जितरण सुजनजश्चत करना या पूरे दिे में पेरोजलयम और पेरोजलयम उत्पादों की पयाडप्त उपलब्धता सुजनजश्चत करना;
(iv) उजचत पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन टैररफ पर पेरोजलयम और पेरोजलयम उत्पादों की उपलब्धता के संदभ डमें ग्राहकों के जहतों की सुरिा करना;
(v) पेरोजलयम और पेरोजलयम उत्पाद पाइपलाइन बुजनयादी ढांचे के तीव्र जिकास को प्रोत्साजहत करना।"; (च) अनुसूची ख के भाग-II में, -
(i) "दस िर्ड" िब्द के स्ट्थान पर "पच्चीस िर्ड" िब्द प्रजतस्ट् थाजपत दकये जाएंग;े
(ii) "िर्ड 10" िब्द और अंक के स्ट्थान पर "िर्ड 25" िब्द और अंक प्रजतस्ट्थाजपत दकए जाएंग;े
(iii) "बोडड दस िर्ड के" िब्दों से िुरू होने िाले और "जनधाडररत करेगा" िब्दों पर समाप्त होने िाले भाग, का लोप दकया जाएगा:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (छ) अनुसूची ग में, -
(i) िब्द "दस िर्ड" के स्ट्थान पर "पच्चीस िर्ड" िब्द प्रजतस्ट् थाजपत दकए जाएंग;े

NOTIFICATION New Delhi, the 18th December, 2023 F.No. PNGRB/Auth/3-PPPL(06)/2022.—In exercise of the powers conferred by section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations, namely:-
1. Short title and commencement,-
(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Petroleum and Petroleum Products Pipelines) Amendment Regulations,
2023.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Petroleum and Natural Gas Regulatory Board (Authorizing Entities to Lay, Build, Operate or Expand Petroleum and Petroleum Products Pipelines) Regulations, 2010, -
(a) in sub -regulation (1) of regulation 2,-
(A) in Clause (f),-
(i) after, the words ―from an existing‖, the word ―trunk‖ shall be inserted;
(ii) after, the words, ―branch line‖, the words ―or spur line‖ shall be inserted;
(iii) after the words ―without increase‖ the words ―authorized‖ shall be inserted;
(B) in clause (j),-
(i) for the word, ―tonnes‖, at both places, the word ―ton‖ shall respectively be substituted;
(ii) for the portion beginning with the words ―and for the‖ and ending with the words, ―of the Act‖, the following shall be substituted, namely:- ―including the impact of storage facilities essential for operating a petroleum and petroleum products pipeline system as common or contract carrier‖
(C) after clause (p), the following shall be added, namely: - ―(q) ―spur-line‖ means a pipeline necessarily originating or branching out from the trunk or another spur line with diameter and capacity not greater than the trunk pipeline but having no pumping facility for supply of petroleum and petroleum products to one or more consumers. Any pipeline having a separate petroleum and petroleum products source or a pump shall not be treated as a spur- line. The length of spur-line may not depend upon the length of the trunk pipeline. A spur-line must use the capacity of trunk pipeline in order to transport the petroleum products. Spur line includes branch line also;‖[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 7 ―(r) ―tie-in connectivity‖ means the petroleum and petroleum products pipeline connectivity for transport of petroleum and petroleum products between a common carrier or contract carrier petroleum and petroleum products pipeline and any one of the following, namely:-
(i) a petroleum and petroleum products source; or
(ii) a new injection point from another common carrier or contract carrier petroleum and petroleum products pipeline.‖
(b) in regulation 5, -
(A) in sub- regulation (1), for the portion beginning with the words ―issue an open‖ and ending with the brackets and words ―(including webhosting) publishing‖, the following shall be substituted, namely: - ―webhost the same at PNGRB’s website giving wide publicity regarding;‖
(B) in sub-regulation (5),-
(i) for the portion beginning with the words, ―publish through an‖ and ending with the brackets and words ―newspaper (including webhosting)‖, the word ―webhost‖ shall be substituted;
(ii) after the words ―petroleum products pipeline‖, the words and letter ―on PNGRB’s website‖, shall be inserted;
(iii) sub-regulation (9) shall be omitted.
(c) in regulation 7, -
(A) in sub- regulation (1),-
(I) in clause (a),-
(i) for the words, ―a period of ten years‖, the words, following shall be substituted, namely:- ―each year of the economic life of the pipeline starting from its operation‖;
(ii) for the words ―The tariff shall be bid for each of the ten years‖ , the words ―The tariff shall be bid for each of the twenty-five years.‖ shall be substituted;
(iii) for the word "fifty" the word "forty" shall be substituted;
(II) in Clause (b),-
(i) for the words ―a period of ten years‖, the words, ―each year of the economic life of the pipeline starting from its operation‖ shall be substituted;
(ii) for the words, ―The tariff shall be bid for each of the ten years‖ the words ―The tariff shall be bid for each of the twenty-five years‖ shall be substituted;
(iii) for the word ―twenty‖, the word ―forty‖ shall be substituted;
(III) in clause (c), for the word ―thirty‖, the word ―twenty‖ shall be substituted;
(B) in sub-regulation (3),-
(i) for the words ―sub-regulation‖, the words, brackets and figure (1) shall be substituted;
(ii) for the word ―volume‖, the words, brackets and letters ―capacity (MMTPA) proposed to be created‖, shall be substituted;
(iii) after the letters and words ―DFR of the project‖, the words, brackets and figures, ―like, pipeline length, diameters, spur lines, pumps and other associated facility for petroleum and petroleum products pipeline as defined under clause (i) of sub- regulation (1) of regulation 2‖, shall be inserted;
(C) after sub-regulation (4), the following shall be added, namely: - ―(5) Year 1 tariff bids for the petroleum and petroleum products pipeline tariff under clauses (a) to (b) of sub-regulation (1) shall be applicable from 1st year of operation of the pipeline. The pipeline shall be considered operational when its trunk pipeline is fully commissioned. For partially commissioned trunk pipeline, only 1st year tariff shall be applicable till its trunk pipeline is fully commissioned.
(6) The Board shall extend the quoted tariff after the economic life of the pipeline for a period equivalent to the time period between the date of grant of authorization and the starting date of operation of the pipeline.‖ ;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(d) in regulation 12, -
(i) sub-regulation (1) shall be omitted;
(ii) for sub-regulation (2), the following shall be substituted, namely:- ―(2) In case it is proposed to expand the capacity of the petroleum and petroleum products pipeline, the entity shall submit a proposal for consideration of the Board and the Board may allow for expansion of the capacity in the petroleum and petroleum products pipeline.‖;
(iii) after sub-regulation (2), the following shall be added, namely- ―(3) The provisions regarding expansion of capacity in petroleum and petroleum products pipeline under sub-regulation (2) shall be applicable to all petroleum and petroleum products pipeline either authorized by the Board under regulation 4, 18, 19 or accepted under regulation 17 as authorized by
the Central Government:
Provided that the Board may alternatively invite bids in place of such proposed expansion, if it is opined by the Board that invitation of bids shall serve one or more of the following objectives,
namely:-
(i) promoting competition among entities;
(ii) avoiding infructuous investment;
(iii) maintaining or increasing supplies or for securing equitable distribution or ensure adequate availability of petroleum and petroleum products throughout the country;
(iv) protection of customers’ interest in terms of availability of petroleum and petroleum products at reasonable petroleum and petroleum products pipeline tariff;
(v) incentivizing rapid development of petroleum and petroleum products pipeline infrastructure.”;
(e) in regulation 21,-
(i) in heading, after the words ―expansion or extension‖, the words, ―or tie-in connectivity or laying of spur-lines‖ shall be inserted;
(ii) in sub-regulation (1),-
(A) for the words, ―the dispatch terminal-‖, the following shall be inserted, namely: - ―dispatch terminal, or
(v) add a new source by laying Tie-in connectivity, or
(vi) lay a spur line – ‖;
(B) the first proviso shall be omitted;
(C) in the second proviso, for the words ―there shall be no change in pipeline tariff post-extension of pipeline‖ the words, ―that there shall be no change in the tariff due to such effect‖ shall be substituted;
(iii) sub-regulation (2), shall be omitted;
(iv) for sub-regulation (3), the following shall be substituted, namely:- ―(3) In case it is proposed to expand the capacity of the pipeline, the entity shall submit a proposal for consideration of the Board in consonance with the provisions of regulation 12 and the Board may, after considering the proposal, allow for expansion of the capacity in the pipeline without adversely affecting the customers served by the pipeline.‖;
(v) after sub-regulation (5), the following shall be added, namely: - ―(6) Extension of a petroleum and petroleum products pipeline:
(i) The entity may extend the authorized length of the petroleum and petroleum products pipeline up to ten per cent. or 50 kilometer, whichever is lower, from the point of origin or the end point in the demand centres and shall submit to the Board the full particulars, map of all facilities including justification for the proposal and seek prior authorization

Provided that in case of any technical constraints, the allowed variation in the originating point of such extension of the petroleum and petroleum products pipeline from the point of origin or the end point shall not exceed beyond the nearest sectionalizing valve (SV) station, but the entity shall be required to provide the detailed justifications for the technical constraints.
(ii) The Board, after public consultation, shall give a decision to the entity within sixty days of the receipt of the request.
(iii) There shall be no change in the petroleum and petroleum products pipeline tariff post extension.
(7) Tie-in Connectivity:
(a) In case of the upstream connectivity requirement near a common carrier or contract carrier petroleum and petroleum products pipeline, a detailed proposal for the connectivity shall be submitted by the concerned entity to the Board indicating the details of the sources or injection points facilities, existing petroleum and petroleum products pipeline infrastructure in vicinity and demand-supply projections along with the length and capacity of the proposed tie-in connectivity.
(b) The Board shall webhost the proposal for a period of thirty days for initiating the public consultation process seeking views and comments from the stakeholders.
(c) Based upon the views and comments received during the public consultation process, the Board may conduct an open house discussion with the stakeholders who have provided their views.
(d) The Board may authorize such tie-in connectivity as per the following methodology,
namely:-
(i) Tie-in connectivity shall be preferably constructed by the entity owning the common carrier or contract carrier petroleum and petroleum products pipeline existing near the product source or injection point provided that the length of such tie-in connectivity is twenty per cent. of the authorized length of the common carrier or contract carrier petroleum and petroleum products pipeline subject to a maximum of 200 kilometer:
Provided that in case of more than one petroleum and petroleum products pipeline existing near the product source or injection point, the entity owning and operating the common carrier or contract carrier petroleum and petroleum products pipeline nearest to the source shall have first right of refusal for laying tie-in connectivity subsequently in the order of physical proximity;
Provided further that in case the entities owning and operating the common carrier or contract carrier petroleum and petroleum products pipeline refuse to lay the said tie-in connectivity, the Board may authorize the interested entity who initiated the proposal with the terms and conditions to lay the said tie-in connectivity and in such a case, the interested entity shall be considered as ―shipper‖ in terms of the Petroleum and Natural Gas Regulatory Board (Access Code of Conduct for Common Carrier or Contract Carrier Petroleum and Petroleum Products Pipelines) Regulations, 2016;
(ii) The Board may also consider inviting bids for the subject tie-in connectivity as per the provisions of sub-regulation (5) of regulation 5;
(iii) Any proposal to construct tie-in pipeline connectivity exceeding the length as
provided in sub-clause (i) shall be dealt in line with the relevant provisions of the regulations for competitive bidding route;
(8) Laying of spur-lines:
The entity initiating the request for a spur line shall inform the Board of its intentions along with the full details on the spur-line length, route, capacity and details of the customers to be served and the Board after public consultation shall give its decision to the entity within sixty days of the receipt of the request.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(9) The Board may alternatively invite bids in place of such proposal submitted under this regulations, if it is opined by the Board that invitation of bids shall serve one or more of the following objectives, namely:-
(i) promoting competition among entities;
(ii) avoiding infructuous investment;
(iii) maintaining or increasing supplies or for securing equitable distribution or ensure adequate availability of petroleum and petroleum products throughout the country;
(iv) protection of customers’ interest in terms of availability of petroleum and petroleum products at reasonable petroleum and petroleum products pipeline tariff;
(v) incentivizing rapid development of petroleum and petroleum products pipeline infrastructure.‖;
(f) in Part – II of Schedule B,-
(i) for the words ―ten years‖, the words ―twenty five years‖, shall be substituted;
(ii) for the word and figures ―Year 10‖ the word and figures ―Year 25‖ shall be substituted;
(iii) The portion beginning with the words ―The Board shall‖ and ending with the words ―on prospective basis.‖ shall be omitted :
(g) in Schedule C,-
(i) for the words ―ten years‖ the words, ―twenty five years‖ shall be substituted;
(ii) for the figures, marks and letters, ―0.50 x LFT1 + 0.20 x LVT1 + 0.30 x HC1‖, the figures, marks and letters ―0.40 x LFT1 + 0.40 x LVT1 + 0.20 x HC1‖ shall be substituted ;
(iii) for the figures, marks and letters, ―0.50 x LFT2 + 0.20 x LVT2 + 0.30 x HC2‖ the figures, marks and letters ―0.40 x LFT2 + 0.40 x LVT2 + 0.20 x HC2‖ shall be substituted ;
(iv) for the figures, marks and letters, ―0.50 x LFT3 + 0.20 x LVT3 + 0.30 x HC3‖ the figures, marks and letters ―0.40 x LFT3 + 0.40 x LVT3 + 0.20 x HC3‖ shall be substituted.
