1. संजिप्त िीर्कड और प्रारंभण:

(1) आन जिजनयमों को पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के जलए पहुचं संजहता) जिजनयम, 2020 कहा जा जाएगा।

(2) ये जिजनयम सरकारी राजपत्र म ेंईनके प्रकािन की तारीख से लागू होंगे।

2. पररभार्ाए:ँ

(1) आन जिजनयमों म,ें जब तक दक संदभड स े ऄन्यथा ऄपेजित न हो, — (क) "पहुचं प्रबधं न" का ऄथ ड ह ै प्राजधकृत संस्ट्था और जिपर के बीच ऄनुबंध, जो ऄनुसूची-। म ें जनर्ददष्ट प्रािधानों का ऄनुपालन करता ह ै और प्रिेि बबद ु िमता, जनकास बबद ु िमता और नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड पर सीएनजी जनकास बबद ु िमता तक पहुचं के जलए जनबंधन एि ं ितों को पररभाजर्त करता ह।ै 5713 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ख) "ऄजधजनयम" का ऄथ ड पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड ऄजधजनयम, 2006 (2006 का 19) के तहत स्ट्थाजपत पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड ह;ै (ग) "अिरं टत िमता" का ऄथड ह ै प्रिेि बबद ु पर एमएमबीटीयू म ें जनधाडररत ऄजधकतम दैजनक िमता जजस पर प्राजधकृत संस्ट्था और जिपर के बीच जनकास बबद ुया सीएनजी जनकास बबद ुके जलए सहमजत हुइ हो;

(घ) "बोडड" का ऄथ ड ह ैपेरोजलयम और प्राकृजतक गैस जिजनयामक बोड;ड (ड.) "सीएनजी जनकास बबद"ु का ऄथड िह बबद ु ह ै जजस पर प्राजधकृत संस्ट्था द्वारा सीएनजी कंप्रेसर के अईटलेट पर मीटररग के जलए ईजचत व्यिस्ट्था के साथ जिपर को जडलीिरी के जलए सीएनजी कंप्रेसर अईटलेट बबद ु स े सीएनजी का ईठान दकया जाता ह:ै बिते दक सीएनजी जनकास बबद ु ट्यूबबग कनेक्िन या यूजनयन पर समाप्त हो जाएगा जहा ं कंप्रेसर का जनकास जडस्ट् पेंसर स े जुडा हुअ ह ैऔर यदद यह नोजल को भरने पर जिपर के सीएनजी कैसकेड स े जडु ा ह।ै (च) "सीएनजी जनकास बबद ु िमता" का ऄथ ड ह ै खुली पहुचं के जलए सीएनजी की ऄजधकतम मात्रा, जजसे प्राजधकृत संस्ट्था एक ददन म ें संबजं धत सीएनजी जनकास बबद ुपर जिपर को जितररत करेगी:

(छ) "सीएनजी जनकास बबद ु ऄजधकतम दैजनक मात्रा या "सीएनजी जनकास बबद ु एमडीक्य"ू का ऄथ ड ह ै दकलोग्राम (दक.ग्रा.) म ें मापी गइ खुली पहुचं के जलए ईपलब्ध प्राकृजतक गैस की ऄजधकतम दैजनक मात्रा जजसके जलए प्राजधकृत संस्ट् था द्वारा जिपर को िमता अिंरटत की गइ ह,ै जजसका सीएनजी जनकास पर जिपर द्वारा ईठान दकया जा सकता ह;ै (ज) "ददन" का ऄथ ड ह ै लगातार चौबीस घंटे जो एक ददन म ें 0600 बज े स े िरूु होकर ऄगल े ददन 0600 बज े समाप्त होता ह;ै (झ) "जिजनर्ददष्ट जनकास बबद"ु का ऄथड ह ै िह जनकास बबद ु जजसके जलए तकनीकी और सरु िा अधार पर जिपर और प्राजधकृत संस्ट्था के बीच गसै जितरण पर सहमजत हुइ ह;ै (ञ) "जडलीिर की गइ मात्रा" का ऄथ ड ह ै जिपर के जनधाडररत जनकास बबद ु पर प्राजधकृत संस्ट्था द्वारा जितररत गैस की मात्रा;

(ट) "प्रििे बबद"ु का ऄथड ईस बबद ु स े ह ै जजस पर दकसी जिपर द्वारा जितररत प्राकृजतक गैस को नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड म ें आंजेक्ट दकया जाता ह:ै प्रिेि बबद ुसीजीएस या सब-रांसजमिन पाआपलाआन (एसटीपीएल) या सीजीडी नेटिकड के दकसी ऄन्य बबद ु पर हो सकता ह;ै (ठ) "प्रििे बबद ु िमता" का ऄथ ड ह ै खुली पहुचं के जलए ईपलब्ध एमएमबीटीय ू म ें प्राकृजतक गैस की ऄजधकतम मात्रा, जजसे प्राजधकृत संस्ट्था एक ददन म ें संबंजधत प्रिेि बबद ुपर जिपर स े प्राप्त करेगी तादक आसे जिजनर्ददष् ट जनकास बबद ुपर पहुचं ाया जा सके;

(ड) "प्रििे बबद ु ऄजधकतम दैजनक मात्रा" या "प्रििे बबद ु एमडीक्य"ू का ऄथ ड ह ै प्राकृजतक गैस की ऄजधकतम दैजनक मात्रा जजसके जलए प्राजधकृत संस्ट्था द्वारा जिपर को ओपन एक् सेस के अधार पर पहुचं प्रबंध म ें हुइ सहमजत के ऄनुसार संबंजधत प्रिेि बबद ुपर िमता अिंरटत की गइ ह;ै (ढ) "जनकास बबद"ु का ऄथड ईस बबद ु स े ह ै जजस पर नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड स े जिपर द्वारा प्राजधकृत संस्ट्था और जिपर के बीच पहुचं प्रबंध पर हुइ सहमजत के ऄनुसार प्राकृजतक गसै का ईठान दकया जाता ह ै और ऐस े जनकास बबद ु जिपर और प्राजधकृत संस्ट्था के बीच तकनीकी और सुरिा अधार पर सभी मीटररग स्ट् टेिनों, सीएनजी जनकास बबद ुऔर ऐसे सहमत सभी ऄन् य बबदओंु पर होंग:े[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 बिते दक —

(i) घरेलू पाआप् ड प्राकृजतक गैस (पीएनजी) के जलए, कस्ट्टडी रांसफर के ईद्देश्य से जनकास बबद ु व्यजिगत ईपभोिा का सुरिा होज होगा। जनकास बबद ु के िमता जनधाडरण जैसे ऄन्य ईद्देश्य के जलए, संबंजधत डीपीअरएस को जनकास बबद ुमाना जाएगा।

(ii) दकसी भी नए जनकास बबद ु का जनणडय तकनीकी और सुरिा अधार पर जिपर और प्राजधकृत संस्ट्था के बीच दकया जाएगा। (ण) "जनकास बबद ु िमता" का ऄथड ह ै खलु ी पहुचं के जलए ईपलब्ध एमएमबीटीय ू म ें प्राकृजतक गैस की ऄजधकतम मात्रा, जो प्राजधकृत संस्ट्था एक ददन म ेंसंबंजधत जनकास बबद ुपर जिपर को जितररत करेगी;

(त) "जनकास बबद ु ऄजधकतम दैजनक मात्रा" या "जनकास बबद ु एमडीक्य"ू का ऄथ ड ह ै खलु ी पहुचं के अधार पर प्राकृजतक गैस की ऄजधकतम मात्रा, जजसका जिपर द्वारा एक ददन म ें जिजिष्ट मीटररग स्ट्टेिन और सीएनजी जनकास बबद ुपर ईठान दकया जा सकता ह;ै (थ) एक ददन म ें "ऄसतं लु न मात्रा" का ऄथ ड ह ै जिजनयम 16 म ें जनर्ददष्ट ऄनुसार सकारात्मक ऄसंतलु न मात्रा या नकारात्मक ऄसंतुलन मात्रा;

(द) "लाआन पकै " या "एलपी" गैस का ऄथ ड ह ै गैस की मात्रा जजसे दबाि बनाए रखने और नेटिकड के माध्यम स े प्राकृजतक गैस का जनबाडध पररिहन और अपूर्तत करन े के जलए हर समय नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड म ें बनाए रखा जाना चाजहए;

(ध) "गसै के जलए लप्ु त और बजे हसाब" या "एलयएू जी" का ऄथ ड ह ैप्राकृजतक गैस की मात्रा, जो दकसी भी कारण स े बेजहसाब ह,ै लेदकन नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के जनयजमत संचालन या रखरखाि के दौरान ब्लो डाईन, जनकासी या ररलीज तथा प्रिेि और जनकास बबद ु पर मीटर रीबडग के बेमेल होन े तक ही सीजमत नहीं ह;ै (न) "जिपणन" का ऄथड प्राकृजतक गसै के जिपणन या व्यापार स े जनपटने िाली संस्ट्थ ा ह;ै (प) "जिपणन जिजिष्टता ऄिजध" का ऄथड पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के जलए जिजिष्टता) जिजनयम, 2008 के ऄनुसार सामान्य िाहक या संजिदा िाहक के दायरे स े जिजिष्टता की ऄिजध ह;ै (फ) "ऄजधकतम दैजनक मात्रा" ("एमडीक् य "ू ) का ऄथड ह ै दकसी जििेर् ददन म ें जितरण के जलए प्राकृजतक गैस, ऄनुबंजधत, बुक की गइ ऄजधकतम मात्रा;

(ब) "ऄजधकतम जितरण दर" ("एमडीअर") का ऄथ ड ह ै ऄजधकतम प्रजत घंटा दर, जजसके जलए प्राजधकृत संस्ट्था पहुचँ व्यिस्ट्था म ें जनर्ददष्ट ऄनुसार संगत जनकास बबद ुपर जिपर को प्राकृजतक गैस जितररत करेगी; (भ) "ऄजधकतम ईठान दर" या "एमओअर" का ऄथड ऄजधकतम प्रजत घंटा दर ह,ै जजसके जलए जिपर पहुचं प्रबंधन म ें जनर्ददष्ट ऄनुसार संबजं धत जनकास बबद ु पर प्राकृजतक गैस का ईठान करेगा और एमओअर का मूल् य एमडीअर के मल्ू य के समान होगा;

(म) "ऄजधकतम प्राजप्त दर" या "एमअरअर" का ऄथ ड ह ै ऄजधकतम प्रजत घंटा दर, जजसके जलए प्राजधकृत संस्ट्था पहुचँ व्यिस्ट्था म ें जनर्ददष्ट प्रासंजगक प्रिेि बबद ुपर प्राकृजतक गसै प्राप्त करेगी; (य) "एमएमबीटीय"ू का ऄथड ह ै सकल कैलोरी मान (जीसीिी) के अधार पर एक जमजलयन जिरटि थमलड यूजनट और यह अइएसओ 6976 म ेंपररभाजर्त ऄनुसार प्राकृजतक गसै की उजाड सामग्री की यूजनट होगी;

(यक) "जिजनर्ददष्ट मात्रा" का ऄथड प्राकृजतक गैस की मात्रा स े ह,ै जजसकी पुजष्ट जिपर द्वारा प्राजधकृत संस्ट्था को ऄजधकृत जनकास बबद ु पर जडलीिरी के जलए की जाती ह,ै जजसम ें जितरण के जलए या ऄपन े जनजी आस्ट् तेमाल के जलए दैजनक अधार पर संगत जनकास बबद ुपर ईठान का जििरण होता ह;ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (यख) "ऑफ-स्ट्पके गसै " का ऄथड ह ै प्रिेि द्वार पर जिपर द्वारा या जनकास बबद ु पर दकसी प्राजधकृत संस्ट्था द्वारा पहुचं ाइ गइ प्राकृजतक गैस जो जिजनयम 9 के ईप-जिजनयम (1) म ें जनर्ददष्ट गैस मापदंडों के ऄनरूु प नहीं ह;ै (यग) "ऑपरेरटग प्रिे र" का ऄथ ड ह ै एक जििेर् प्रिाह दर के ऄनसु ार दबाि, जजस पर नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के संबंजधत खंड को संचाजलत दकया जाता ह:ै बिते दक दकसी भी समय नटे िकड के जलए ऑपरेरटग प्रेिर जडजाआन प्रेिर या ऄजधकतम स्ट्िीकाय ड ऑपरेरटग प्रिे र (एमएओपी) स े ऄजधक न हो जैसा दक प्रासंजगक तकनीकी मानकों और जिजनदेिों म ें सुरिा मानकों के जनयमों सजहत जनर्ददष्ट दकया गया ह;ै (यघ) "जनधारड रत मात्रा" का ऄथड ह ै प्राकृजतक गैस की मात्रा, जो जनधाडररत जनकास बबद ु या जितरण के जनकास बबद ु या नाजमत िमता पर अधाररत जनजी अिश् यकता के जलए प्राजधकृत संस्ट्था द्वारा जिपर के जलए जनधाडररत की गइ हो और जो पहुचं प्रबंधन के प्रािधानों के ऄनसु ार हो;

(यड.) "जिपर" का ऄथड ह ै ईपभोिा या जिक्रेता या कोइ ऄन्य संस्ट्था जो सीजीडी नेटिकड म ें िमता का ईपयोग करने का आरादा रखती ह;ै (यच) "मानक घन मीटर" या "एससीएम" का ऄथड होगा गैस की मात्रा जो एक दिमलि िून्य एक तीन दो पांच बॉर (1.01325 बार) के पूणड दबाि के ऄंतगडत पंद्रह सेजल्सयस (15° सेजल्सयस) के तापमान पर एक (1) घन मीटर की मात्रा म ेंरहती ह;ै (यछ) "जसस्ट्टम द्वारा प्रयक्ु त गसै " या "एसयजू ी" का ऄथ ड ह ै प्राकृजतक गैस की मात्रा, जजसका ईपयोग प्राजधकृत संस्ट्था द्वारा नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के संचालन और रखरखाि के जलए दकया जाता ह,ै लेदकन यह केिल कंप्रसे र, प्राआम मूिसड के जलए गैस के सामान्य ईपयोग, गैस हीटर और सुरिा अिश्यकताओं के जलए िेंरटग या फ्लेयररग तक सीजमत नहीं ह;ै (यज) "माप यजू नट" का ऄथ ड गैस की मात्रा को मापने की यूजनट ह।ै माप की यूजनट जमजलयन जिरटि थमलड यूजनट (एमएमबीटीय)ू में होगी। बिते दक सीएनजी जनकास बबद ु मात्रा को दकलोग्राम (दक.ग्रा.) म ें मापा जाएगा लेदकन प्राकृजतक गैस मात्रा सामंजस्ट्य के ईद्देश्य के जलए आस े एमएमबीटीय ू म ें पररिर्ततत दकया जाएगा।

(2) आन जिजनयमों म ें प्रयुि िब्द और ऄजभव् यजक्त यां जजन् ह ें पररभाजर्त नहीं दकया गया ह,ै लेदकन जजन् ह ें ऄजधजनयम या जिजनयमों, जैसा भी मामला हो, म ें पररभाजर्त दकया गया ह,ै का क्रमि: ईन् ह ेंददया गया ऄथ ड होगा।

3. ऄनप्रु योग: य े जिजनयम दकसी भौगोजलक ित्रे म ें दकसी प्राजधकृत संस्ट्था और दकसी भी जिपर पर लागू होंग,े जो ऐसे भौगोजलक ित्रे के सीजीडी नेटिकड म ें िमता का ईपयोग करन े का आरादा रखता ह:ै बिते दक दकसी प्राजधकृत भौगोजलक ित्रे को पेरोजलयम या प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड घोजर्त करने के जलए मागडदिी जसद्ांत) जिजनयम, 2020 और पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के जलए जिजिष्टता) जिजनयम, 2008 म ें सामान् य िाहक या संजिदा िाहक के रूप म ेंघोजर्त दकया गया हो। बिते अग े दक— (क) प्राजधकृत संस्ट्था ऄजधकृत ित्रे म ें दकसी नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड म ें गरै -भेदभािपूण ड अधार पर जिपसड तक पहुचं की ऄनुमजत दगे ी;

(ख) अधारभूत ढांच े का जिकास परे ोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड जबछान,े जनमाडण, प्रचालन या जिस्ट् तार के जलए कंपजनयों को ऄजधकृत करना) जिजनयम, 2008 द्वारा ऄजधिाजसत होगा और जिपर ईपयुडक् त सस्ट्ं था के माध् यम स े ऄपनी गैस का पररिहन या जडलीिरी करेंग े—[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5

(i) घरेलू कनेक्िनों के बनडर से जुडी सुरिा होज़ तक; या

(ii) िाजणजययक और औद्योजगक कनक्े िनों के मामले में मीटररग बबद ुतक; या

(iii) सीएनजी स्ट्टेिनों के मामले म ेंकंप्रेसर जनकास बबद ुतक। बिते यह भी दक

(i) प्राजधकृत संस्ट्था पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के जलए सुरिा मानकों सजहत तकनीकी मानक और जिजिजष्टयां) जिजनयम, 2008 के ऄनरूु प हर समय ऄपनी पूरी पररसंपजत्तयों को सुरिा होज़ तक बनाए रखगे ा; और

(ii) मीटररग बबद ु का ऄथ ड ईस स्ट्थान स े ह ै जहा ं गैस की माप की जाती ह,ै जजसम ें मीटररग ईपकरण, ईपकरण और जनकास बबद ुपर ऄपेजित दबाि तक दबाि को कम करना िाजमल होगा।

(iii) कम्प्रेसर जनकास बबद ुम ें दफबलग नोजल और सीएनजी माप की सुजिधा िाजमल होगी।

4. िमता घोर्णा:

(1) प्राजधकृत संस्ट्था, ऄपन े सीजीडी नेटिकड की घोर्णा के नब् बे ददनों के भीतर, सामान्य िाहक या संजिदा िाहक के रूप म ें लागू जिजनयमों के ऄनसु ार और प्रिेि बबद ु िमता, सभी प्रिेि बबदओंु और जनकास बबदओंु पर खलु ी पहुचं के जलए सीएनजी जनकास बबद ुिमता तथा पीएनजी के जलए डीपीअरएस स्ट्तर पर िमता और मदर और ऑनलाआन स्ट्टेिनों की िमता (कैसकेड दफबलग िमता) का लागू जिजनयमों के प्रािधानों के ऄनुसार सीएनजी के जलए ऄपनी िेबसाआट पर प्रकािन करके घोर्णा करेगी।

(2) सभी प्रिेि बबदओंु पर संचयी अधार पर खलु ी पहुचं के जलए सीजीडी नेटिकड की िमता, सीजीडी नेटिकड और संपीडन िमता या गैस की ऄजधकतम मात्रा का कम स े कम बीस प्रजतित होगी जो जपछल े एक ददन की ऄिजध के जलए सीजीडी नेटिकड म ें या कंप्रेसर के माध्यम स े प्रिाजहत हुइ ह,ै जो भी ऄजधक हो। यदद सीजीडी नेटिकड में ऐसी खुली पहुचं िमता दस प्रजतित स े कम हो जाती ह,ै तो प्राजधकृत संस्ट्था सीजीडी नेटिकड की िमता को बढाएगी, तादक खुली पहुचं िमता को दस प्रजतित स े नीच े जगरने की तारीख स े छह महीन े की ऄिजध के भीतर कम स े कम बीस प्रजतित तक बहाल दकया जा सके।

(3) बोडड स्ट् ि-प्रेरणा के अधार पर और ईप जिजनयम (2) के प्रािधानों के बािजूद, लेदकन सािडजजनक परामि ड की जनधाडररत प्रदक्रया का पालन करन े के बाद, ऐसी ऄिजध के भीतर सीजीडी नेटिकड की िमता का जिस्ट्तार करन े के जलए और जनबंधन एिं ितों के ऄनुसार जैसा िह ईजचत समझे, दकसी प्राजधकृत संस्ट्था को अदेि द े सकता ह।ै

(4) कोइ प्राजधकृत संस्ट्था ऄपन े सीजीडी नेटिकड म ें खुली पहुचँ िमता का ईपयोग, ऄजतररि िमता के ऐस े भाग को छोडकर, ऄपनी अिश्यकता के जलए नहीं करेगी, जजसके जलए बुककग दकसी भी जिपर से नब्बे ददनों की लगातार ऄिजध के जलए प्राप्त नहीं हुइ ह।ै बिते दक प्राजधकृत सस्ट्ं था दकसी भी जिपर स े िमता बुककग के ऄनुरोध की प्राजप् त स े तीस ददनों के भीतर ऄपनी जनजी अिश्यकता द्वारा ईपयोग की जा रही सामान्य िाहक िमता को खाली कर दगे ी।

5. िमता बकु कग:

(1) प्राजधकृत संस्ट्था, सामान्य िाहक या संजिदा िाहक के रूप म ें ऄपने नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड की घोर्णा के आक्क ीस ददनों के भीतर, ऄपनी िेबसाआट पर ऄनुसूची-।। म ें जनर्ददष्ट प्रारूप म ें जानकारी प्रकाजित करेगी तथा राष्ट्रीय दैजनक और स्ट् थानीय भार्ा समाचार-पत्र म ें ऐस े प्रकािन की जानकारी ऄपनी िेबसाआट पर दी जाएगी, जजसम ें ऄपन े सीजीडी नेटिकड पर प्रिेि बबद ु और जनकास बबद ु िमता के जलए िमता बुककग की मागं की जाती ह ै और ईसके बाद ईसके सीजीडी नटे िकड म ें जब भी ऄजतररि िमता ईपलब्ध होगी, ईसके आक्कीस ददनों के भीतर आसी तरह की कारडिाइ की जाती ह।ै6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(2) आच्छुक जिपर ऄनुसूची-III म ें जनर्ददष्ट प्रारूप म ें िमता बुककग के जलए सािडजजनक नोरटस के प्रकािन होने की तारीख स े नब्बे ददनों के भीतर िमता ("एमडीक्य "ू ) की बुककग प्राप् त करने के जलए प्राजधकृत संस्ट्था को ऄपन े प्रस्ट्ताि प्रस्ट्तुत करेंगे।

(3) दकसी जिपर द्वारा ऄनुरोध दकए गए प्रििे बबद ु एमडीक्य ू का योग प्रजतददन 500 एमएमबीटीयू स े कम नहीं होगा, और दकसी भी जनकास बबद ुपर ईठान प्रजत ददन 50 एमएमबीटीयू स े कम नहीं होगा। बिते दक जिपर और ऄजधकृत जनकाय दकसी स्ट्िीकृत ऄिजध में बुक की गइ मात्रा को प्राप्त करने के जलए पहुचं प्रबंधन स े सहमत हों।

(4) िमता का अबंटन प्राजधकृत संस्ट्था द्वारा पारदिी और गैर-भेदभािपूणड तरीके स े दकया जाएगा। यदद ईपलब्ध सामान्य िाहक िमता सभी जिपरों के कुल बुककग ऄनुरोध स े ऄजधक ह,ै तो ऄनरु ोध की गइ िमता प्रत् यके जिपर को अिंरटत की जाएगी। तथाजप, ईन मामलों म ें जहा ं दकसी जििेर् ददन के जलए कुल बुककग ऄनुरोध सामान्य िाहक िमता से ऄजधक ह,ै तो ऐसी सामान् य िाहक िमता जिपरों को प्रिेि बबद ु एमडीक् यू के योग के ईत्पाद की ईच्चता के अधार पर अिंरटत की जाएगी।

(5) ईप-जिजनयम 2 के तहत जनर्ददष्ट ऄिजध के समाप् त होन े के तीस ददनों के भीतर प्राजधकृत सस्ट्ं था द्वारा िमता बुककग को ऄंजतम रूप ददया जाएगा।

(6) प्राजधकृत संस्ट्था नगर या स्ट्थानीय प्राकृजतक गैस जितरण नटे िकड पर खुली पहुचं के जलए प्रिेि बबद ु िमता, जनकास बबद ु िमता, डीपीअरएस िमता और सीएनजी जनकास बबद ु िमता के बारे म ें ऄपनी िेबसाआट पर ऄगल े माह की प्रत् यके 15 तरीख तक सतत अधार पर जानकारी आस प्रकार स े प्रकाजित करेगी दक िमता बुककग की प्रदक्रया की ऄनुसूची का ईपयोग हर महीन े के पहल े काय ड ददिस स े प्रभािी ढंग स े दकया जा सके। ऐस े डेटा को बोड ड द्वारा दकसी भी समय या ऐस े ऄतं राल पर सत्याजपत दकया जा सकता ह ै जैसा दक समय-समय पर बोडड द्वारा तय दकया जाएगा।

(7) पहुचं प्रबंध के माध्यम स े प्रििे बबद ु एमडीक्य ू और जनकास बबद ु एमडीक्य ू और ऄन्य प्रासंजगक जनबंधन एि ं ितों के संदभ ड म ें िमता बुककग को ऄंजतम रूप ददया जाएगा।

(8) कोइ प्राजधकृत संस्ट्था जजसके सीजीडी नेटिकड को एक सामान्य िाहक या संजिदा िाहक के रूप म ें घोजर्त दकया गया ह,ै ऐसी घोर्णा के नब्ब े ददनों के भीतर सामान्य िाहक या संजिदा िाहक िमता की बुककग के जलए प्रस्ट्ताि प्राप्त करने के जलए एक पोटडल स्ट्थ ाजपत करेगी। अिेदनों को प्राप् त करन,े अिंटन और ररकाडो का रखरखाि करने की परू ी प्रदक्रया खुल,े पारदिी और गरै -भेदभािपूणड तरीके स े की जाएगी और आस े दकसी भी समय बोडड द्वारा सत् यापन के जलए ईपलब्ध कराया जाएगा। ऐस े पोटडल पर ऄपनाइ जान े िाली प्रदक्रया प्रिाह ऄनुसूची-IV म ें जनर्ददष्ट ददिाजनदेिों के ऄनुरूप होगी।

(9) संबंजधत प्राजधकृत संस्ट्था ऄपनी िेबसाआट पर िमता बुककग के ऄनुरोध को स्ट् िीकार करेगी और ऐसी िमता का अिंटन ऑनलाआन करेगी तथा ऄनुसूची-V म ें जनर्ददष्ट ऄनुसार प्राप् त अिेदनों का ऑनलाआन ररकॉडड रखेगी तथा ऄपनी िेबसाआट पर आसकी सूचना भी प्रकाजित करेगी।

6. ततृ ीय पि जिपर सीएनजी या एल-सीएनजी स्ट्टेिनों तक पहुचं का प्रािधान: कोइ प्राजधकृत संस्ट्था जजसके सीजीडी नेटिकड को एक सामान्य िाहक के रूप म ें घोजर्त दकया गया ह,ै जबना दकसी भेदभाि के ऄपन े सीजीडी नेटिकड के ऄजधकृत ित्रे के भीतर सीएनजी या एल-सीएनजी स्ट्टेिन के जलए तीसरे पि के जिपर तक पहुचं प्रदान करेगा। यदद मौजूदा कंप्रेसर सामान्य िाहक िमता की सीमा के भीतर तीसरे पि के जिपर की अिश्यकताओं को परू ा करन े म ें ऄसमथ ड ह,ै तो ऐसे तृतीय पि जिपर तकनीकी व्यिहायडता के ऄधीन अिश्यकताओं को पूरा करने के जलए ऄजतररि कंप्रेिन सुजिधाओं की स्ट्थ ापना के जलए ऄजधकृत सीजीडी संस्ट् था स े ऄनुरोध कर सकते ह।ैं यदद प्राजधकृत संस्ट्था तकनीकी बाधाओं के कारण ऄजतररि कंप्रिे न सजु िधाओं को स्ट्थाजपत करने म ें ऄसमथड ह,ै तो तदनुसार प्राजधकृत सीजीडी संस्ट् था तीसरे पि के जिपर को ऐस े ऄजतररि कंप्रेसर सुजिधाओं के जलए ऄनरु ोध की तारीख स ेपैंतालीस ददनों के भीतर जलजखत रूप म ेंसूजचत करेगी।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7 स्ट्पष्टीकरण: ऄजतररि बुजनयादी ढाँच े के जनमाणड के जहत म,ें आन जिजनयमों की ऄजधसूचना की जतजथ को मौजूद सीएनजी या एल-सीएनजी स्ट्टेिन, जो प्राजधकृत संस्ट्थाओं के डीलरों और फ्रेंचाआजी द्वारा चलाए जा रह े ह ैं(जजनम ें सीएनजी या एल-सीएनजी स्ट्टेिन िाजमल ह,ैं जो तरल पेरोजलयम ईत्पादों की खुदरा जबक्री में संलग् न कंपजनयों द्वारा ऄपनी खुदरा दकु ानों पर चलाए जाते ह)ै को सीएनजी या एलसीएनजी स्ट्टेिनों म ें प्रिेि की ऄनुमजत देने के ईद्देश्य स ेतीसरे पि के जिपर के रूप म ें नहीं माना जाएगा।

7. जिपर और प्राजधकृत सस्ट्ं था की बाध्यता:

(1) प्राजधकृत संस्ट्था गैस प्राजप् त स े जितरण बबद ु तक सीजीडी नेटिकड के जलए सभी लाग ू जनयमों और जडलीिरी बबद ु स े गैस की प्राजप् त स े समय-समय पर बोड ड द्वारा जारी जनदेिों का पालन करने के जलए जजम्मेदार होगी।

(2) प्राजधकृत संस्ट्था सहमत प्रिेि बबद ु पर जिपर स े गैस प्राप् त करेगी, ईसका सीजीडी नेटिकड के माध्यम स े पररिहन करेगी और सहमत जनकास बबद ुपर गैस जितररत करेगी।

(3) प्राजधकृत संस्ट्था ऄपन े सीजीडी नेटिकड और ईससे संबंजधत सेिाओं के समग्र प्रबंधन के जलए जजम्मेदार होगी।

(4) प्राजधकृत संस्ट्था दकसी भी जिपर द्वारा दकसी भी चूक के मामले म ें घरेल ू ग्राहकों के जलए ऄंजतम ईपाय के अपूर्ततकताड के रूप म ें काय डकरेगी।

(5) जिपर प्राजधकृत संस्ट्थ ा द्वारा गसै प्राजप्त स े पहले और बाद म ें गसै को जिपर तक पहुचं ाने के जलए सीजीडी नेटिकड के जलए सभी लागू जिजनयमों के ऄनपु ालन के जलए जजम्मेदार होगा।

(6) जिपर प्रिेि बबद ुपर गसै जडलीिर करेगा और सहमत जनकास बबद ुपर गैस प्राप्त करेगा।

(7) जिपर यह सुजनजित करेगा दक ईसके द्वारा प्रिेि बबद ु पर जडलीिर की गइ गैस जिजनयम 8 म ें जिजनर्ददष् ट मापदंडां के ऄनरूु प हो।

(8) जिपर प्राजधकृत संस्ट्थ ा को सभी बकाया राजि का भगु तान करेगा और ऐसी गारंटी, सुजनजितता और सुरिा प्रदान करेगा, जो पहुचं प्रबंधन के तहत ऄपन े िाजणजययक दाजयत्िों को पूरा करने के जलए तकडसंगत रूप स ेअिश्यक हो सकती ह।ै

(9) जिपर ऄपन े ग्राहकों को जबल देन े और बकाया राजि की िसूली करन े के जलए जजम्मेदार होगा। मीटर रीबडग प्राजधकृत संस्ट्था की जजम्मेदारी होगी, जसिाय पीएनजी घरेलू ईपभोिाओं को छोडकर, जजसकी जजम् मदे ारी जिपर की होगी। पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के जलए सेिा की गणु ित्ता हते ु अचार संजहता) जिजनयम, 2010 के ऄनसु ार जिपर ऄपन े ग्राहकों को जबल देन े और ईसकी िसूली स े संबंजधत दकसी भी जिकायत के जलए जजम्मेदार होगा।

(10) प्राजधकृत संस्ट्था और जिपर दोनों ही पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के जलए सेिा की गणु ित्ता हते ु अचार संजहता) जिजनयम, 2010 का ऄनुपालन करेंगे।

8. गसै मापदंड:

(1) प्राजधकृत संस्ट्था, जबना दकसी भेदभाि के प्रिेि बबद ु पर गैस मापदंडों के जलए प्रारंजभक सीमा जनर्ददष्ट करेगी, जैसे दबाि, तापमान और कैलोरी मान और गैस म ें ऄन्य तत्िों के जलए स्ट्िीकायड प्रारंजभक सीमा, पहुचँ व्यिस्ट्था म ें काबडन डाआऑक्साआड (CO ), नाआरोजन (N ) और ऑक्सीजन (O ):

2 2 2 बिते दक पूिोि श्रेजणयाँ या प्रारंजभक सीमाए ं ऄनुसूची-VI म ें जनर्ददष्ट ऄनुसार होंगी। बिते दक खुली कास्ट्ट खनन स े कोयला बेड मीथने (सीबीएम) गैस, या कोयला खदान मीथेन (सीएमएम) गैस के अधार पर सीजीडी नेटिकड स्ट्थाजपत दकया गया हो, बोडड प्राजधकृत संस्ट्था के अिेदन पर ऄनुसूची- VI म ें ददए गए जिजनदेिों स ेछूट की ऄनुमजत द ेसकता ह।ै8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(2) यदद प्रिेि बबदओंु पर जिपर द्वारा जडलीिर की गइ गैस पहुचं प्रबंध म ें जनर्ददष्ट ऄनुसार और आन जिजनयमों म ें जनर्ददष्ट ऄनुसार गैस मापदंडों की अिश्यकताओं को पूरा नहीं करती ह,ै तो प्राजधकृत सस्ट्ं था - (क) आस े स्ट्िीकार करन े स े आनकार कर सकती ह;ै या (ख) नेटिकड अिश्यकताओं को गैस स े ऄपग्रडे करने के जलए दकसी भी ऄजतररि सुजिधाओं या ईपचार के जलए आसे स्ट्िीकार कर सकती ह ै और जबना दकसी भेदभाि के जिपर स े सेिा की लागत ("ऑफ- स्ट्पेक गैस प्रभार") पहुचं प्रबंधन के ऄनुसार प्रभार ले सकती ह।ै बिते दक ऐसी ऑफ-स्ट्पेक गसै मौजूदा ग्राहकों के जनकास बबदओंु पर प्राजधकृत संस्ट्था द्वारा प्रजतबद् गणु ित्ता-जिजनदेिों पर प्रजतकूल प्रभाि न डालती हो।

(3) प्राजधकृत संस्ट्था जनकास बबदओंु पर कबमगलेड गैस पहुचं ा सकती ह,ै और जनकास बबदओंु पर गैस की गुणित्ता पहुचं प्रबंध म ेंसहमत स्ट्िीकाय ड बैंड के भीतर होगी।

(4) प्राजधकृत संस्ट्था बोडड द्वारा ऄजधसूजचत जिजनयम के प्रािधानों के ऄनुसार जिपर को गैस जडलीिर करन े स े पहले पूरी गैस को गंध युक् त बनाएगी।

9. प्रििे बबद ुऔर जनकास बबद ुपर सजु िधाएं:

(1) जिपर प्रिेि बबद ु पर प्राकृजतक गैस पहुचं ान े की व्यिस्ट्था करेगा। प्राजधकृत संस्ट्था माप ईपकरण सजहत जिपर की लागत पर प्रिेि बबद ु पर ऄजभरिा के हस्ट् तातं रण और प्राकृजतक गैस के जितरण के जलए सुजिधाएं प्रदान करेगी:

बिते दक ऐसा होन े पर जिपर ऄपनी लागत स ेप्रिेि बबद ुपर ऄपना चेक मीटर लगा सके।

(2) जिपर ऄपने पररसर म ें प्राजधकृत संस्ट्था द्वारा स्ट् थाजपत दकए जाने िाले ईपकरण को मापने के जलए प्राजधकृत संस्ट्था को हमेिा पहुचं प्रदान करेगा।

(3) प्राजधकृत संस्ट्था पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (सीजीडी के जलए पररिहन दर और सीएनजी के जलए पररिहन दर का जनधाडरण) जिजनयम, 2020 के ऄनुसार जनधाडररत सीजीडी की पररिहन दरों और सीएनजी की पररिहन दरों के भगु तान को ध्यान म ें रखते हुए सीजीडी नटे िकड और सीएनजी केंप्रिन सुजिधा प्रदान करेगी।

(4) प्राजधकृत संस्ट्था ऄपनी जनजी लागत पर ईपकरण, दबाि को कम और जनयंजत्रत करन,े गैस क्रोमैटोग्राफी या दकसी ऄन्य प्रणाली के जलए सुजिधाएं प्रदान करेगी, जो प्राजधकृत संस्ट्था और जिपर के बीच सहमजत के ऄनुसार सभी जनकास बबदओंु पर जिपर को ऄजभरिा के हस्ट्तांतरण और प्राकृजतक गैस के जितरण के जलए अिश्यक ह।ै बिते दक जिपर यदद चाह े तो जनकास बबद ुपर ऄपनी लागत स े ऄपना चेक मीटर स्ट्थाजपत कर सकता ह।ै

(5) प्रिेि बबद ु और जनकास बबद ु पर सुजिधाओं का रखरखाि क्रमिः जिपर और प्राजधकृत संस्ट्थ ा द्वारा दकया जाएगा जब तक दक पहुचं प्रबंधन म ेंऄन्यथा सहमत न हों।

10. नामांकन, जनधारड ण, मीटररग, अिटं न और जबबलग:

(1) नामांकन, िेड्यूबलग, मीटररग, अिंटन और जबबलग प्रदक्रया पहुचं प्रबंधन म ें जनर्ददष्ट की जाएगी और जिपर जपछल े ददन के बाद ऄगले ददन 10:00 बज े और जपछले सप् ताह के िुक्रिार को 10:00 बज े तक साप्ताजहक नामांकन की मात्रा नाजमत करेगा। प्रत्येक प्रिेि बबद ु और जनकास बबद ु के जलए नामांकन और ऄनुसूची, ऄगल े ददन प्रत्येक घटं े के जलए जसस्ट् टम प्रचालन ईद्देश्य के जलए सिोत्तम प्रयास के अधार पर बनाइ जाएगी;

(2) प्राजधकृत संस्ट्था जनयजमत रूप स े गैस क्रोमैटोग्राफ द्वारा गैस की गुणित्ता को मापगे ी जब तक दक प्राजधकृत संस्ट् था और पहुचं प्रबंधन के बीच जिपर के बीच सहमजत न हो।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 9

(3) माप ईपकरणों की कुल त्रुरट सीमा और सटीकता प्राजधकृत संस्ट्थ ा और जिजनयमों के माध्यम स े बोड ड द्वारा जनधाडररत दकसी भी ऄजनिाय ड जिजनदेिों, यदद कोइ हो, के ऄधीन जिपर के बीच सहमजत के ऄनुसार होगी।

(4) प्राजधकृत संस्ट्था संबंजधत कोड और मानकों के ऄनुसार माप ईपकरण के सत्यापन, ऄंिांकन या प्रमाणन का काय ड करेगी।

11. गसै लखे ाकं न और समायोजन:

(1) गैस का लेखा-जोखा रोज़ाना उजाड के संदभ ड म ें एमएमबीटीयू म ें दकया जाएगा, और यह समय-समय पर संिोजधत या अिोजधत अइएसओ 6976-1:1983(इ) म ें पररभाजर्त ऄनुसार सकल कैलोरी मान पर अधाररत होगा: बिते दक — (क) संबंजधत प्रिेि बबदओंु पर जितररत दैजनक गैस को प्राजधकृत संस्ट्था और जिपर के बीच सहमजत के ऄनुसार सीध े जसस्ट्टम के द्वारा मापा जाएगा;

(ख) औद्योजगक और िाजणजययक ग्राहकों के जलए, संबंजधत जनकास बबदओंु पर दैजनक ईठान प्राजधकृत संस्ट्था और जिपर के बीच सहमजत के ऄनुसार प्रणाली के माध्यम स ेमापा जाएगा; (ग) पीएनजी घरेलू ग्राहकों के जलए, गैस का लेखा-जोखा रखने के जलए रोज़ाना ईठान सगं त पीएनजी घरेलू ग्राहकों द्वारा गैस की औसत खपत के अधार पर माना जाएगा और आसका समायोजन प्रत्येक जबबलग चक्र के समाप् त होने के सात ददनों के भीतर पहुचं प्रबधं न म ें सहमत कायडप्रणाली के ऄनुसार दकया जाएगा;

(घ) सीएनजी के जलए, गैस के दैजनक ईठान को ऑनलाआन कंप्रेसर के अईटलेट पर दकलोग्राम (दक.ग्रा.) म ें मीटर पर मापा जाएगा और यदद सीएनजी स्ट् टेिन पर गैस गणु ित् ता माप ईपलब् ध नहीं ह ै तो संगत ददिस को नेटिकड म ें गैस के औसत गुणित्ता मापदंडों के अधार पर गैस के लेखांकन हते ु ईस े एमएमबीटीय ू म ें पररिर्ततत दकया जाएगा। यह संभि ह ै दक हर सीएनजी स्ट्टेिन पर गैस क्रोमैटोग्राफ ईपलब्ध न हो। क्रोमैटोग्राफी के बबद ु पर गैस की गुणित् ता नेटिकड के एक जििेर् ित्रे म ें समान मानी जाएगी और तदनुसार, सीएनजी स्ट्टेिन के जलए गैस की गणु ित्ता के मापदडं ों पर जिचार दकया जाएगा।

(2) जिस्ट्तृत माप और गैस लेखांकन प्रदक्रया पहुचं प्रबंधन म ेंजनर्ददष्ट की जाएगी।

12. प्रभार:

(1) जिपर प्राजधकृत संस्ट्था को ऄपने सीजीडी नेटिकड या कंप्रेिन सुजिधा और ऄन् य सेिाओं का लाभ ईठानेके जलए जनम्नजलजखत प्रभार का भगु तान करेगा, ऄथाडत:्— क) पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (सीजीडी के जलए पररिहन दर और सीएनजी के जलए पररिहन दर का जनधाडरण) जिजनयम, 2020 के ऄनुसार "सीजीडी की पररिहन दर"। ख) पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (सीजीडी के जलए पररिहन दर और सीएनजी के जलए पररिहन दर का जनधाडरण) जिजनयम, 2020 के ऄनुसार "सीएनजी की पररिहन दर" को। ग) ऄजधक िल्ु क प्रभार, यदद लाग ूहो;

घ) प्रणाली ऄसंतलु न प्रभार, यदद लाग ू हो; ड.) पहुचं प्रबंधन में सहमजत के ऄनसु ार ऑफ-स्ट्पेक गैस प्रभार, यदद लागू हो; च) लाग ू कर और िल्ु क; छ) पहुचं प्रबंधन में कोइ ऄन्य प्रभार जैसे -10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] i. जिप या भुगतान;

ii. पररिहन या भुगतान; iii. प्रणाली का तकनीकी ईन्नयन यदद ऐसी सेिाओं के जलए जिपर द्वारा जििेर् रूप स े ऄनरु ोध दकया गया ह;ै iv. ऄनुसंधान एि ं जिकास, यदद ऐसी सेिाओं के जलए जिपर द्वारा जििेर् रूप स े ऄनरु ोध दकया गया ह;ै ज) बोडड द्वारा समय-समय पर ऄनुमोददत ऄन् य कोइ िल्ु क खंड (ग) स े (छ) म ें जनर्ददष्ट प्रभार ऄनुसूची-। के प्रािधानों और जिजनयम 14, 15 और 16 म ें ददए गए प्रभारों के ऄनुसार होंगे।

13. प्राजधकृत सस्ट्ं थ ा के कमी सबं धं ी प्रभार: प्राजधकृत संस्ट्था का दाजयत् ि जिपर को जनधाडररत मात्रा तक िमता प्रदान करना होगा, जब तक दक जिजनयम 19 म ें जनर्ददष् ट ऄनुसार जनयोजजत रखरखाि दकया जाना हो या जिजनयम 20 म ें जनर्ददष्ट ऄनुसार ऄप्रत्य ाजित जस्ट् थजतयां हों या जिजनयम 21 म ें जिजनर्ददष् ट ऄनुसार कोइ अपातकाल हो।

14. ऄजधक प्रभार लगाना:

(1) प्रत्येक प्रिेि बबद ु पर जिपर के जलए ऄजधक मात्रा की गणना की पद्जत को एक ददिस के जलए एमएमबीटीयू म ेंजबना दकसी भेदभाि के पहुचं प्रबंधन म ें जनर्ददष्ट दकया जाएगा।

(2) जनधाडररत मात्रा के पांच प्रजतित तक ऄजधक होन े पर जिपर को कोइ ऄजतररि प्रभार नहीं देना होगा। जनधाडररत मात्रा स े पांच प्रजतित ऄजधक होने पर ऄजधक प्रभार लगगे ा।

(3) जनधाडररत मात्रा के पांच प्रजतित स े ऄजधक होन े पर ऄजतररक्त प्रभार ईजचत, पारदिी और गैर-भेदभािपूणड होगा और आस ेपहुचं प्रबंधन म ेंजनर्ददष्ट दकया जाएगा।

(4) जिपर द्वारा एक ददन का दये ऄजतररक् त प्रभार ईस ददन प्रत्येक प्रिेि बबद ुके संबंध म ें दये ऄजतररक्त प्रभार के योग के बराबर होगा।

15. प्रणाली ऄसतं लु न प्रभार:

(1) एमएमबीटीय ू म ें एक ददन की सकारात्मक ऄसंतुलन मात्रा, सभी जनकास बबदओंु स े ली गइ जिपर की कुल मात्रा की तुलना म ेंसभी प्रिेि बबदओंु पर जितररत जिपर की कुल मात्रा स ेऄजधक होगी।

(2) एमएमबीटीय ू म ें एक ददन की नकारात् मक ऄसंतलु न मात्रा, सभी जनकास बबदओंु स े ली गइ जिपर की कुल मात्रा की तुलना म ेंसभी प्रिेि बबदओंु पर जितररत जिपर की कुल मात्रा स ेऄजधक होगी।

(3) ददन की िुरुअत म ें संचयी ऄसंतुलन जपछले ददन के ऄतं म ें संचयी ऄसंतुलन के बराबर होगा। पहले ददन की िुरुअत म ेंजब प्राकृजतक गैस जिपर द्वारा जितररत की जाती ह,ै तो संचयी ऄसंतलु न िून्य होगा।

(4) ददन के ऄतं म ें संचयी ऄसंतुलन ददन की िुरुअत म ें संचयी ऄसंतुलन और ददन म ें हुए ऄसतं ुलन के योग के बराबर होगा।

(5) सभी प्रिेि बबदओंु पर एमडीक्यू की राजि के पांच प्रजतित के संचयी सकारात्मक या नकारात्मक ऄसंतुलन तक जिपर को कोइ ऄसतं ुलन िल्ु क नहीं देना होगा। प्राजधकृत संस्ट्था प्रजतददन के अधार पर जिपर को ऄसंतुलन की मात्रा बताएगी तादक बाद की ऄिजध के जलए नामांदकत राजि जमा करते समय ऄसंतुलन को ठीक करने का ऄिसर प्रदान दकया जा सके।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 11 यदद पंद्रह ददनों की ऄिजध म ें जिपर आस तरह के ऄसंतलु न को ठीक करने म ें ऄसमथ ड रहता ह,ै तो, प्राजधकृत संस्ट्था को प्रिेि बबदओंु पर दैजनक नामांकन को समायोजजत करने का ऄजधकार होगा और सीजीडी नेटिकड की सुरिा और ऄखंडता को सुजनजित करने के जलए ऐसे ऄसतं ुलन को ठीक करने के जलए जनकास बबद ुहोंगे। आन सीमाओं स े ऄजधक म ें संचयी सकारात्मक ऄसंतुलन और संचयी नकारात्मक ऄसंतुलन के जलए ऄसंतुलन िुल्क ईजचत, पारदिी और जबना दकसी भेदभाि के होगा।

(6) दकसी जििेर् ददन के जलए जिपर द्वारा दये ऄसंतुलन प्रभार ईप-जिजनयम 4 म ें जनधाडररत की गइ संचयी ऄसंतुलन मात्रा के ईत्पाद और पहुचं प्रबंधन म ें जनर्ददष्ट प्रजत एमएमबीटीय ू ऄसंतुलन प्रभार के बराबर होगा।

(7) दैजनक ऄसंतलु न गैस की मात्रा को हर पखिाडे औद्योजगक, िाजणजययक और सीएनजी खडं ों के जलए िास्ट् तजिक दैजनक पैमाआि राजि पर जिचार करते हुए तथा घरेल ू ित्रे के जलए गैस की परस्ट् पर रूप स ेसहमत दैजनक खपत मात्रा मानते हुए जिपर और प्राजधकृत संस्ट्था के बीच जनपटाया जाएगा; जनपटान की कायप्रड णाली को पहुचं प्रबंधन म ें जनर्ददष्ट दकया जाएगा। घरेल ू ित्रे के जलए िास्ट्तजिक पैमाआि मात्रा के साथ सामंजस्ट्य को जिपर और प्राजधकृत संस्ट्था के बीच पहुचं प्रबंधन के ऄनुसार सहमजत दी जाएगी।

(8) एस्ट्क्रो खात े का रखरखाि (क) आन जिजनयमों के प्रारंभ होने की तारीख स े बोडड द्वारा एक एस्ट्क्रो खाता स्ट्थाजपत करके ईसका रखरखाि दकया जाएगा, जजसमें ऄसंतलु न और ऄजधक प्रभार के कारण प्राजधकृत संस्ट्था द्वारा प्राप्त सभी प्रभार जमा दकए जाएंगे। (ख) प्राजधकृत संस्ट्थ ा लाग ू करों और िल्ु कों सजहत ऄसंतलु न और ऄजधक प्रभार के जलए ऄलग स े जबल प्रस त् ुत करेगी। प्राजधकृत संस्ट्था संबंजधत प्राजधकाररयों के पास कर और िुल्क जमा करेगी। (ग) प्राजधकृत संस्ट्था, जिपर स े ईस ऄिजध म ें ईप-जिजनयम 6 म ें ईजल्लजखत ऄसंतलु न और ऄजधक प्रभारों की िसूली के जलए सभी ईजचत प्रयास करेगी, जजस ऄिजध म ें यह जिपर को ईसके पररिहन िल्ु क का भुगतान करने की ऄनुमजत देती ह।ै (घ) प्राजधकृत संस्ट्था ईप-जिजनयम 6 (करों और िल्ु कों को छोडकर) म ें ईजल्ल जखत प्रभारों को ईसके द्वारा जिपर स े प्राप् त करन े पर ईस े कैलण्े डर जतमाही, जजसके दौरान ईसके द्वारा ऐसी राजि प्राप् त की गइ, को समय- समय पर बोड ड की ऄपेिा ऄनसु ार रखे गए जििरण सजहत पद्रं ह ददनों की ऄिजध के भीतर बोडड द्वारा रख े गए एस्ट् क्रो खाते म ेंजमा करेगी। परंतु प्राजधकृत संस्ट्था को खंड (ज) के तहत बोडड द्वारा ऄनुमोददत दाि े को छोडकर ईसके द्वारा प्राप्त दकसी भी राजि (करों और िुल् कों को छोडकर) को रखन े या कटौती करने की ऄनुमजत नहीं ह।ै (ड.) प्राजधकृत संस्ट्थ ा बोड ड को महीन-े िार, भौगोजलक ित्रे -िार और जिपर-िार ऐस े प्रभारों का जििरण प्रस्ट्तुत करेगी, जो प्रत्येक जिपर स े िसूली जानी हों, जिपर से प्राप्त राजि और जिप् परों द्वारा दये राजि और खंड (घ) के प्रािधानों के ऄनुसार जमा की गइ राजि के साथ आसका समायोजन करन े के बाद प्राजधकृत सस्ट्ं था द्वारा प्रत्येक जतमाही की समाजप् त स े साठ ददनों की ऄिजध के भीतर जतमाही अधार पर तथा ऐसे जििरण को चाटडडड एकाईंटेंट स े एक प्रमाण-पत्र द्वारा प्रमाजणत करत े हुए और आसके बाद प्रत्येक जित्तीय िर्ड के ऄंत म ें एक िार्तर्क प्रमाण-पत्र स े प्रमाजणत करते हुए ईि जििरण को चौथी जतमाही के प्रमाण-पत्र के साथ बोडड को प्रस्ट्तुत दकया जाएगा। (च) प्राजधकृत संस्ट्था ईसके द्वारा सजं िदात्मक दाजयत्िों की अपूर्तत के जलए तथा जिपर के ऐसे ऄसंतुलन के कारण अपूर्तत या भुगतान और सीजीडी नेटिकड के जसस्ट्टम प्रबंधन के संदभ ड म ें ईसके द्वारा खचड की गइ राजि का बोडड द्वारा रख े गए एस्ट्क्रो खाते स े दािा कर सकता ह:ै बिते दक आस तरह का दािा एस्ट्क्रो खाते म ें ईसके द्वारा जमा की गइ राजि स े ऄजधक न हो। (छ) खंड (घ) के तहत दािे को प्रत्येक जित्तीय िर्ड के समाप् त होने के 60 ददनों के भीतर बोडड को प्राजधकृत संस्ट्था द्वारा प्रजतिर्ड प्रस्ट्ततु दकया जा सकता ह,ै जजसम ें आसके द्वारा दी गइ राजि का जििरण, आसके बैंक12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] खाते का जििरण, स्ट्थायी खाता संख्या और आस तरह के दाि े के जिस्ट्तृत जििरण सजहत चाटडड ड ऄकाईंटेंट स े ऐसे जििरण को प्रमाजणत करत े हुए एक प्रमाण-पत्र िाजमल होगा। (ज) बोडड ऐसे दािों की योग्यता के अधार पर पुजष्ट करेगा और िह जैसा ईजचत समझे ऐसी और जानकारी की मांग कर सकता ह ै तथा बोड ड पूरी जानकारी प्राप्त होने के 60 ददनों के भीतर प्राजधकृत सस्ट्ं था को ऄनुमोददत दाि े की मात्रा सूजचत करेगा, जजसकी बाद म ें बोडड द्वारा जिजिष्ट जलजखत ऄनुमोदन के बाद ही ऄजधकृत कंपनी द्वारा एस्ट्क्रो खाते म ें ईसके द्वारा बाद में जमा की जाने िाली राजि स े कटौती की जा सकती ह।ै (झ) एस्ट्क्रो खाते म ें ईपलब्ध िेर् राजि को प्राजधकृत संस्ट्था द्वारा पात्र जनकासी के बाद, खंड (ज) के तहत आस तरह स ेऔर ऐस े ईद्देश्यों के जलए ईपयोग दकया जाएगा जैसा दक बोडड द्वारा जनर्ददष्ट दकया जा सकता ह।ै

16. हर घटं े की जडलीिरी, ईठान और प्राजप्त दरें:

(1) एमडीअर, एमओअर और एमअरअर, तथा प्रजत घंटा जनधारड रत दरों स े ऄजधकृत जिचलन जजसके जलए जिपर को कोइ िल्ु क नहीं देना होगा, को पहुचं प्रबंधन म ेंजनर्ददष्ट दकया जाएगा।

(2) प्रजत घंटे जडलीिरी और आन सीमाओं स े ऄजधक दरों म ें जिचलन संबंधी प्रभार को पहुचं प्रबंधन म ें जनर्ददष्ट दकया जाएगा: बिते दक यदद जिपर ने जिजनयम 5 के तहत िमता बुक की ह ैतो जिपर को प्रजत घंटे जडलीिरी म ें जिचलन के जलए और सीजीडी नेटिकड पर प्रिेि और जनकास बबद ुिमता तक आसका एक् सेस िरूु होन े के पहल े साठ ददनों तक पहुचं प्रबंधन म ें जनर्ददष्ट सीमा स े ऄजधक की दरों के जलए कोइ िुल्क देने की अिश्यकता नहीं होगी।

17. जसस्ट्टम ईपयोग गसै (एसयजू ी), लप्ु त और ऄनकाईंटेड गसै (एलयएू जी) के जलए: प्राजधकृत संस्ट्था एसयूजी और एलयूएजी, यदद कोइ हो, को ऄििोजर्त करेगी और जिपर पर आसका कोइ दाजयत्ि नहीं डालेगी: बिते दक प्राजधकृत संस्ट्था दकसी भी स्रोत स ेएसयूजी और एलयएू जी की व्यिस्ट्था करने के जलए स्ट्ितंत्र हो।

18. लाआन पकै (एलपी): प्राजधकृत संस्ट्था एलपी को ऄपने अप ही व्यिजस्ट्थत और ऄििोजर्त करेगी और जिपर पर आसका कोइ दाजयत्ि नहीं डालेगी:

19. जनयोजजत रखरखाि:

(1) प्राजधकृत संस्ट्था समय स े पहले पररभाजर्त ऄिजध के जलए ऄपनी रखरखाि योजना के जबना दकसी भेदभाि के जिपर को पहुचं प्रबधं न म ें हुइ सहमजत के ऄनुसार सूजचत करेगी, जजसम ें ईन प्रिेि और जनकास बबदओंु की पहचान की जाएगी जहां प्राकृजतक गैस प्रिाह को ऐसे रखरखाि, प्रजतबंधों की सीमा और आनके घटने के दौरान जनयंजत्रत दकया जा सकता ह।ै प्राजधकृत सस्ट्ं था जनयजमत गैस अपूर्तत म ें व्यिधान को न् यनू तम करन े के जलए आस तरह के रखरखाि की योजना बनाएगी।

(2) घरेलू पीएनजी को छोडकर सभी खंडों म ें दकसी भी ग्राहक के जलए जनयोजजत रखरखाि दकसी भी कैलेंडर िर्ड म ें दस ददनों की संचयी ऄिजध स े ऄजधक नहीं होगा। पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड जबछान,े जनमाडण, प्रचालन या जिस्ट् तार करने के जलए संस्ट् थाओं को ऄजधकृत करना) जिजनयम, 2008 म ें जनर्ददष्ट सेिा दाजयत्ि और ऄन्य संबंजधत जिजनयम घरेल ू पीएनजी ग्राहकों पर लाग ू होंगे।

20. ऄप्रत्याजित जस्ट्थ जतया:ं ऄप्रत्याजित जस्ट्थ जतयां प्राजधकृत संस्ट्था और जिपर के बीच संजिदा द्वारा ऄजधिाजसत होंगी।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 13

21. सचं ालन प्रदक्रयाए ं और अपात जस्ट्थजत:

(1) संचालन प्रदक्रयाओं को प्राजधकृत संस्ट्था और जिपर द्वारा जनयजमत प्रचालन के साथ-साथ कोइ अपात जस्ट्थजत होन े पर पहुचं प्रबंधन म ेंिाजमल दकया जाएगा।

(2) एक अपात जस्ट्थजत हो सकती ह ै- (क) गैस के ररसाि, या संददग्ध ररसाि के कारण; या (ख) जनम्नजलजखत पररजस्ट्थजतयों म,ें ऄथाडत:्-

(i) नेटिकड की सुरिा खतरे म ेंह;ै

(ii) नेटिकड के माध्यम स ेगैस का सुरजित संिहन जोजखम में ह;ै

(iii) नेटिकड द्वारा सूजचत गैस ऐस े दबाि में या ऐसी गुणित्ता की हो, जो ग्राहक के पररसर म ें अपर्तू त करने पर जीिन या संपजत्त के जलए खतरा हो; या

(iv) ऄन्य कोइ पररजस्ट्थजत जजसके बारे में प्राजधकृत संस्ट्था को यह जिश्वास हो दक यह अपातकाल है, जजसमें संदेह से बचन े के जलए दकसी प्रिेि बबद ु की पररजस्ट्थजतयों को िाजमल दकया जा सकता है, और जहाँ संदभड में ऄपेजित हो, दकसी अपात जस्ट्थजत के संदभड में ऐसी घटना या पररजस्ट्थजत िाजमल हो सकती ह ैजजससे आस तरह का अपातकाल ईत् पन् न हो सकता ह।ै

(3) प्राजधकृत संस्ट्था अपातकाल के बाद नेटिकड के सामान्य प्रचालन को जल्द स े जल्द बहाल करने के जलए कदम ईठाएगी। सीजीडी नेटिकड म ें अपात जस्ट्थजत या व्यिधान या रुकािट के मामल े म ें जिजभन्न ग्राहक खंडों म ें सेिाओं की बहाली जनम्नजलजखत प्राथजमकता के क्रम म ेंकी जाएगी, ऄथाडत्:- (क) घरेलू पीएनजी ग्राहक;

(ख) अिश्यक सेिाए,ं जैसे ऄस्ट्पताल, क्लीजनक, दधू की अपूर्तत; (ग) सीएनजी ग्राहक; (घ) ऄन्य ।

22. सचू ना की गोपनीयता: खुलासा की गइ, जितररत या अदान-प्रदान दकए गए सभी प्रलेखन, सूचना, डेटा, प्रस्ट्तुजतयाँ, रटप्पजणयां, अदद को चाह े जलजखत रूप म ें हों या ऄन् यथा दकसी संस्ट् था, प्राजधकृत संस्ट्था, जिपर या दकसी ऄन्य पाटी के बीच या आन जिजनयमों की अिश्यकताओं के पररणामस्ट् िरूप या दकसी ऄन्य पि के बीच गोपनीय माना जाएगा और आसका पूण ड या अंजिक रूप म ें खुलासा नहीं दकया जाएगा, जजसम ें दकसी भी न्यायालय, बोडड या ऄन्य जिजनयामक प्राजधकाररयों म ें दकसी भी कायडिाही के संबंध म ें या दकसी भी कानून म ें ऄपेजित ऄनुसार खुलासा नहीं दकया जाएगा, जब तक दक आस तरह के प्रलेखन, सूचना, डेटा, प्रस्ट्तुजतयाँ, रटप्पजणयां, अदद पहले स े ही सािडजजनक डोमेन म ेंन हों।

23. जिजिध:

(1) बोडड के पास आन जिजनयमों के संबंध म ें स्ट्पष्टीकरण जारी करन े का ऄजधकार होगा और दकसी भी जििाद के मामले म,ें बोडड द्वारा ददया गया स्ट्पष्टीकरण ऄंजतम और बाध्यकारी होगा।

(2) यदद आन जनयमों की व्याख्या के ऄनुसार कोइ प्रश्न ईठता ह,ै तो आसका जनणडय बोड ड द्वारा जलया जाएगा।

24. जनरसन: पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के जलए एक्सेस कोड) जिजनयम, 2011 जनरस्ट्त माना जाएगा, जसिाय आस प्रकार जनरस्ट् त जिजनयमों के ऄंतगडत कारडिाइ की गइ हो या लोप दकया गया हो।14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] ऄनसु चू ी- I पहुचं प्रबधं न ददिाजनदेि के जलए प्रािधान (जिजनयम 2(1)(क) देखें)

1.0 पहुचं प्रबधं न प्रािधान आस ऄनुसूची म ें ईन प्रािधानों का ईल्ल ेख दकया गया ह ै जजनका ऄनपु ालन ऄजधकृत संस्ट्था द्वारा आन जिजनयमों की ऄन्य अिश्यकताओं के ऄलािा, जिपर के साथ ऄपनी मानकीकृत पहुचं व्यिस्ट्था तैयार करत े हुए दकया जाएगा। प्राजधकृत संस्ट्था ऄपने सीजीडी नेटिकड की घोर्णा के पैंतालीस ददनों के भीतर ऄपनी िेबसाआट पर ऐसी व्यिस्ट्था के मानक प्रारूप को सामान्य िाहक या संजिदा िाहक के रूप में प्रकाजित करेगी।

2.0 सेिाए ं पहुचं प्रबंधन म ेंप्राजधकृत संस्ट्था द्वारा जिपर को प्रदान की जान े िाली जनम्नजलजखत सेिाए ंिाजमल होंगी:- क) प्रिेि बबद ुपर गैस की प्राजप्त; ख) प्रिेि बबद ुस े जनकास बबद ुतक गैस का पररिहन; ग) जनकास बबद ुपर गैस का जितरण;

घ) सीजीडी नेटिकड की पैमाआि, जबबलग, पररचालन और सरु िा अिश्यकताओं के ईद्देश्य से गसै की मात्रा, गुणित्ता, दबाि, तापमान और दकसी ऄन्य परै ामीटर का माप; ड.) ग्राहकों को सेिा देन े के जलए स्ट्थाजपत सभी संबंजधत सामग्री, ईपकरण और ईपकरणों सजहत नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड का रखरखाि;

च) सीजीडी नेटिकड म ें जिपर की गसै आन्िेंरी का प्रबंधन करना। प्राजधकृत संस्ट्था जिपर को ऐसी ऄन्य सेिाए ं प्रदान कर सकती ह,ै जजसके जलए जिपर द्वारा जलजखत म ें ऄनुरोध दकया गया ह ै और जजन पर सीजीडी नेटिकड के संबंध म ेंप्राजधकृत संस्ट्था और जिपर के बीच सहमजत हुइ हो।

3.0 प्राजधकृत सस्ट्ं था को 'ऄपना जिपर जान'ें प्रस्ट्त जु त और गारंटी। क) जिपर को ऄजधकृत संस्ट्था को ईनके द्वारा ऄपेजित ऄनुसार जिपर की प्रामाजणकता स्ट्थाजपत करने के जलए ‘ऄपना जिपर जान’ें ("केिाइएस") सूचना प्रस्ट्तुत करन े की अिश्यकता होगी। तथाजप, यह प्रदक्रया दकसी भी सीजीडी नेटिकड की मौजूदा ऄजधकृत संस्ट्था पर लागू नहीं होगी, बिते दक बोडड द्वारा ऐसा प्राजधकार समाप्त या रद्द नहीं दकया गया हो। िमता बुककग के जलए जिपर द्वारा अिेदन प्रस्ट् ततु करने से पहले केिाइएस प्रदक्रया पूरी की जाएगी। यदद जिपर द्वारा ऄपना केिाइएस पहले प्रस्ट्तुत दकया गया ह ै और ईसे प्राजधकृत संस्ट् था द्वारा पूि ड म ें स्ट्िीकार दकया गया ह,ै तो प्राजधकृत सस्ट्ं था जिपर को िमता बुककग के समय ऐसी जानकारी प्रस्ट्तुत करने के जलए कहगे ी। केिाइसी की प्रदक्रया को सूचना की तारीख स े पद्रं ह ददनों की ऄिजध के भीतर परू ा दकया जाएगा। ख) जिपर, पारस्ट्पररक समझौते के ऄनुसार जबना ित ड समर्तथत साख-पत्र या दकसी ऄन्य साधन के रूप म ें प्राजधकृत संस्ट्था को साठ ददनों की ऄजधकतम दैजनक मात्रा (एमडीक्यू) के बराबर भगु तान गारंटी प्रदान करेगा और बनाए रखगे ा। घरेल ू ईपभोिाओं को गैस की अपूर्तत के मामले म,ें जिपर द्वारा गसै की अपूर्तत म ें जिफलता के मामल े में आस खडं को अपूर्तत के जडस्ट् कनेक्ि न स े बचने के जलए परस्ट् पर रूप से सहमत जित्तीय साधन के रूप म ेंऔसत गैस खपत के एक सौ पैंताजलस ददनों के भुगतान की सुरिा प्रदान की जाएगी।

4.0 जिपर और प्राजधकृत सस्ट्ं था की बाध्यताए ं जिपर और प्राजधकृत संस्ट्था की बाध्यताए ं जिजनयम 7 म ेंजिजनर्ददष् ट ऄनुसार होंगी।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 15

5.0 प्रििे बबद ुऔर जनकास बबद ुपर सजु िधाएं। क) प्राजधकृत संस्ट्था द्वारा पहुचं प्रबधं न म ेंजिपर को दी जान े िाली सुजिधाओं का ईल् लेख दकया जाएगा। ख) पहुचं प्रबंधन म ें यह दिाडया जाएगा दक प्राजधकृत संस्ट्था या जिपर प्रिेि बबद ु और जनकास बबद ु पर सभी सुजिधाओं का माजलकाना ऄजधकार रखती ह,ैं ईसे बनाए रखती ह ैंया ईसका संचालन करती ह।ैं ग) प्राजधकृत संस्ट् था के पास ऄजधजनयम के तहत पहुचं प्रबंधन और ऄन्य संगत ऄजधसूजचत जिजनयमों के प्रािधानों को लागू करने के जलए जिजनयम 9 के ऄनुसार तकडसंगत पहुचं होगी। जिपर संगत नोरटस जमलन े पर प्राजधकृत संस्ट् था के प्रिेि बबद ुऔर जनकास बबद ुसुजिधाओं का ऄपनी लागत पर जनरीिण कर सकता ह।ै घ) प्राजधकृत संस्ट्था और जिपर माप प्रयोजन के जलए संबंजधत स्ट्थ लों पर ईद्योग द्वारा ऄपनाए जाने िाल े 6.00 बज े के मानक समय का पालन करेंगे। ड.) जिपर या प्राजधकृत संस्ट्था द्वारा धाररत सुजिधाओं का रखरखाि जिजनयम 20 के संबंजधत प्रािधानों और ऄजधजनयम के तहत ऄजधसूजचत ऄन्य संगत जनयमों के ऄनुसार समय-समय पर दकया जाएगा। च) स्ट्िचालन सजहत ऄजतररि सुजिधाओं के जलए प्रभार जो या तो जिपर द्वारा या प्राजधकृत संस्ट् था द्वारा प्रिेि बबद ुया जनकास बबद ुपर अिश्यक हो सकत े ह,ैं को ईस पाटी द्वारा िहन दकया जाएगा जजसे ऐसी सुजिधाओं की अिश्यकता ह।ै छ) जिपर या जिपर के ग्राहकों द्वारा चोरी करने या कदाचार के जसद् मामल े म,ें प्राजधकृत संस्ट्था जिपर को आसके िैध कारणों स े ऄिगत कराते हुए प्राकृजतक गैस की अपूर्तत को जनलंजबत या जडस्ट्कनेक्ट करन े का ऄजधकार होगा। आसके बाद जिपर यह सुजनजित करेगा दक गैस की अपूर्तत को बहाल करन े स ेपहले प्राजधकृत संस्ट्था को गैस जमलान के ऄंतर का भुगतान दकया जाए।

6.0 सेिा दाजयत्ि (क) मीटररग प्राजधकृत संस्ट् था द्वारा नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड म ें गैस पररिहन के माप और जिश्लेर्ण के संबंध म ें जिपर और प्राजधकृत संस्ट्था के ऄजधकार, रुजच, पारस्ट् पररक संजिदा और दाजयत्ि मीटररग के जलए प्राजधकृत संस्ट्थाओं की अचार संजहता म ेंजनधारड रत ऄनुसार होंगे। मीटररग के जलए प्राजधकृत संस्ट्थाओं की अचार संजहता पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गसै जितरण नेटिकड के जलए सेिा गुणित्ता की अचार संजहता) जिजनयम, 2010; पेरोजलयम और प्राकृजतक गैस जिजनयामक बोडड (नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के जलए सुरिा मानकों सजहत तकनीकी मानक और जिजिजष्ट यां) जिजनयम, 2008 और ऄन् य सभी कानूनों और जिजनयमों के ऄनरूु प होगी। प्राजधकृत संस्ट्था जिपर की लागत पर या पहुचं प्रबधं न म ें हुइ सहमजत के ऄनुसार प्रिेि बबद ुपर मीटर की सुजिधा प्रदान करेगी। गैस की मात्रा को मापन े के जलए प्राजधकृत संस्ट्था द्वारा माप ईपकरण लगाए जाएंग े और ईनका रखरखाि दकया जाएगा – i. प्रत्येक प्रिेि बबद ुपर सीजीडी नेटिकड में प्राप्त गैस; तथा ii. प्रत्येक जनकास बबद ुके माध्यम स े जडलीिर की गइ गैस। प्राजधकृत संस्ट्थ ा प्रत्येक प्रिेि बबद ु पर गैस की गणु ित्ता को मापने के जलए प्रािधान करेगी या ऄपस्ट्रीम पाआपलाआन सेिा प्रदाता या गसै अपूर्ततकता ड द्वारा प्रदान की गइ सुजिधा का ईपयोग करेगी। यदद जिपर प्राजधकृत संस्ट्था के मीटर म ें कोइ दोर् होन े के मामले की जिकायत करती ह ै तो दोर् की जांच करने और ईसम ें सुधार करने का खचड प्राजधकृत संस्ट्था द्वारा िहन दकया जाएगा यदद जांच के दौरान कोइ भी दोर् पाया जाता ह,ै ऄन् यथा ऐसा खचड जिपर द्वारा िहन दकया जाएगा।16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] मीटररग सुजिधा का जडजाआन सभी लागू कानूनों और जिजनयमों के साथ-साथ मीटररग के जलए प्राजधकृत संस्ट्था की अचार सजं हता जिजनर्ददष्ट ऄनुसार होगा। (ख) माप ईपकरण का िकै जल्पक स्ट्िाजमत्ि यदद अिश्यक हो, तो माप ईपकरण का िैकजल्पक स्ट्िाजमत्ि, पहुचं प्रबंधन म ें प्राजधकृत संस्ट्था और जिपर के बीच परस्ट् पर सहमजत स े होगा। प्राजधकृत संस्ट्था, जहां अिश्यक हो, मापक ईपकरण के स्ट्िाजमत्ि िाले जिपर की जांच कर सकती ह।ै (ग) सत्यापन और ऄिं ाकं न माप ईपकरण पर दकए जान े िाले सत्यापन और ऄंिांकन की प्रदक्रया और पद्जत पैमाआि के जलए प्राजधकृत संस्ट् था की अचार संजहता के ऄनुसार होगी। माप ईपकरण के संचालन और रखरखाि के जलए जजम्मेदार पाटी जब भी अिश्यक समझा जाएगा, ऐसे ईपकरण के सत्यापन और ऄंिाकं न की प्रदक्रया ऄपन े खचड पर और मीटर लगान े के जलए प्राजधकृत संस्ट्था की अचार संजहता म ेंजनधाडररत ऄनुसार करेगी। सत्यापन या ऄंिांकन करन े स े पहल,े जैसा भी मामला हो, आसके माप ईपकरण पर प्राजधकृत संस्ट्था प्रदक्रया को देखन े के जलए संगत जिपर को अमंजत्रत करेगी। तथाजप, जिपर की ऄनुपलब्धता के कारण आस तरह के सत्यापन या ऄंिांकन को रोका या अस्ट्थजगत नहीं दकया जाएगा। यदद माप ईपकरणों के सत्यापन के पररणाम पर जििाद होता ह,ै तो जििाददत पि सत्यापन या ऄंिाकन की तारीख स े सात ददनों के भीतर प्राजधकृत संस्ट् था को सूजचत करेगा। प्राजधकृत संस्ट्था सत्यापन को सत्याजपत करन े के जलए दकसी स्ट्ितंत्र जििेर्ज्ञ को जनदेि दे सकती ह।ै यदद जििेर्ज्ञ सत्यापन को सही पाता ह,ै तो जिपर ईि सत् यापन की लागत और स्ट्ितंत्र जििेर्ज्ञ की लागत को िहन करेगा। यदद माप ईपकरण का सत्यापन गलत पाया जाता ह,ै तो प्राजधकृत संस्ट्था न केिल प्रदक्रया की पूरी लागत िहन करेगी, बजल्क जििाद की तारीख स े त्रुरट की सीमा तक नुकसान, यदद कोइ हो, की भरपाइ भी करेगी जो ऄगल े जबबलग चक्र म ेंदोर्पणू ड माप के कारण ईत् पन्न होती ह।ै (घ) मापन ईपकरणों का सचं ालन और रखरखाि। माप ईपकरण की माजलक सस्ट्ं थ ा प्राजधकृत सस्ट्ं था की मीटररग अचार संजहता के ऄनुसार सभी माप ईपकरण के संचालन और रखरखाि के जलए जजम् मदे ार होगी। तथाजप, प्रिेि बबद ु के मामले म ें तथा औद्योजगक और िाजणजययक ग्राहकों के मामले म,ें जजसम ें माप ईपकरण की लागत जिपर द्वारा िहन की जाती ह,ै प्राजधकृत संस्ट्था अपसी समझौते के ऄनुसार माप सजु िधा की स्ट्थापना, संचालन और रखरखाि (अिश्यक प्रजतस्ट्थापन सजहत यदद कोइ हो) के जलए प्रभार लगे ी।

7.0 गसै की गणु ित्ता। (क) गसै जिजिजष्ट और दबाि। प्राजधकृत संस्ट्था द्वारा नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड के माध्यम स े जितरण के जलए प्रिेि बबद ुपर जिपर द्वारा जितररत या जितररत की जान े िाली सभी गैस जिजनयमों के ऄनुसार गैस मापदडं ों के ऄनरूु प होगी। सीजीडी नेटिकड म ें प्रिेि करन ेिाली सभी गैस सीजीडी प्रचालन दबाि और तापमान की सीमा के भीतर होगी। (ख) ऑफ-स्ट्पजे सदफकेिन गसै ।

(i) ऐसी जस्ट् थजत म ें जब दकसी प्रििे बबद ु पर जितररत की जान े िाली गैस, ऄनुसूची-VI के ऄनुसार गैस जिजनदेि (ऑफ-स्ट्पेजसदफकेिन गैस) का पालन नहीं करती ह,ै तो जिपर प्राजधकृत संस्ट्था को गसै जिजनदेि स े जिचलन के बारे म ेंसूजचत करेगा।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 17

(ii) प्राजधकृत संस्ट्था को प्रिेि बबद ु पर ऑफ-स्ट्पेजसदफकेिन गैस को लेन े स े मना करन े का ऄजधकार होगा, लेदकन ऄन्यथा िह ऐस ेऑफ-स्ट्पेजसदफकेिन गैस को स्ट्िीकार कर सकती ह।ै

(iii) यदद प्रिेि बबद ुपर प्राप्त गैस ऑफ-स्ट्पेजसदफकेिन गैस ह,ै तो प्राजधकृत संस्ट्था को तत्काल प्रभाि स े जिपर स े गैस की प्राजप्त (परू ी तरह या अंजिक रूप स)े को जनलंजबत करने का ऄजधकार होगा, जब तक दक प्राजधकृत संस्ट्था संतुष्ट नहीं होती ह ै दक कौन सी जिपर गैस जिजनदेि के भीतर गैस को नगर या स्ट्थानीय प्राकृजतक गैस जितरण नेटिकड म ेंजितररत करन े म ें सिम ह।ै

(iv) ईपरोि के बािजूद, यदद ऑफ-स्ट्पेजसदफकेिन गैस सीजीडी नेटिकड म ें एक या ऄजधक जिपर या प्राजधकृत संस्ट्था के माध् यम स े प्रिेि करती तो प्राजधकृत संस्ट्थ ा ऄन् य जिपरों स े पछू सकता ह ै दक क्य ा जिपर या ईसके ऄंजतम-ईपयोगकताड और ग्राहक ऑफ-स्ट्पेजसदफकेिन गैस को स्ट्िीकार करन े के जलए तैयार ह।ैं

(v) ऐस े जिपर आसकी स्ट् िीकृजत के जलए ईजचत प्रयास करेंग े या ऄन्य जनकास बबद ु पर ऑफ-जिजनदेि गैस की जडलीिरी लेन े स े आनकार कर सकते ह।ैं

(vi) प्राजधकृत संस्ट्था सीजीडी नेटिकड म ें प्रजिष्ट ऑफ-स्ट्पेजसदफकेिन गैस का जनपटान कर सकती ह ै यदद िह सीजीडी नेटिकड और ऄन्य सुजिधाओं की सुरिा के जलए प्राजधकृत संस्ट्था द्वारा दफट दकए गए तरीके स े नेटिकड की ऄखंडता के जलए ऄसुरजित ह।ै

(vii) ऑफ-स्ट्पेजसदफकेिन गैस का प्रबंधन करन े म ें लगन े िाला खचड जिपर द्वारा िहन दकया जाएगा जजसन े सीजीडी नेटिकड म ें ऐसी गसै को आंजेक्ट दकया ह।ै प्राजधकृत संस्ट्था द्वारा जनधाडररत ऐसे ऑफ- स्ट्पेजसदफकेिन गैस प्रभार की लागत तटस्ट्थ होगी।

8.0 प्रणाली की ऄखडं ता, ऄनिु ासन और जग्रड प्रबधं न (क) नामाकं न

(i) जिपर गैस की मात्रा के बारे में प्राजधकृत संस्ट्था को सूजचत करेगा जजसे जिपर प्रत्येक प्रिेि बबद ु पर जितररत करना चाहता ह ैऔर एक ददिस (डी) को सीजीडी नटे िकड के प्रत्येक जनकास बबद ुपर प्राप्त करता ह।ै

(ii) यदद जिपर की गैस जडलीिरी अिश्यकताओं (अतं ररक ददिस नामांकन) म ें कोइ भी पररितडन होता ह ैतो जिपर नामांकन को दफर स े जमा कर सकता ह,ै और प्राजधकृत संस्ट्था द्वारा ईजचत प्रयास के अधार पर आस पर जिचार दकया जा सकता ह।ै

(iii) जिपर जिस्ट्ततृ नामांकन प्रदक्रया का ऄनपु ालन करेगा जो पहुचं प्रबंधन के ऄनुसार ह।ै नामांकन में – क. ददन या ददनों को जनर्ददष्ट करें जजससे िह संबंजधत ह;ै ख. नामांदकत मात्रा जनर्ददष्ट करें; ग. ऄंजतम ईपयोगकताड की पहचान करें जो सीजीडी नेटिकड स े गैस की संबंजधत मात्रा का ईठान करेगा; तथा घ. प्रिेि बबद ुऔर जनकास बबद ुजनर्ददष्ट करें।

(iv) ईपरोि के ऄलािा, जिपर को प्राजधकृत संस्ट्था की प्रचालन प्रदक्रया के ऄनुरूप िार्तर्क ऄनुमान और साप्ताजहक नामांकन प्रदान करन े की अिश्यकता होती ह।ै

(v) दीघाडिजध म,ें नामांकन प्रदक्रया भौजतक रूप स े जिपर के जलए यथासंभि लचीली होगी। नइ नामांकन प्रदक्रयाओं (प्रारंजभक प्रणाजलयां और जनधाडररत लागत दोनों और चालू प्रिासजनक लागत म ें कोइ िृजद् या जरटलता) को िुरू करन े की लागत पर छूट के जसद्ांत म ेंएक संतुलन होगा।18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ख) अिटं न और जनधारड ण अबंटन एक गजणतीय व्यिस्ट्था ह ै जजसके द्वारा प्राजधकृत संस्ट्था दकसी सीजीडी नेटिकड म ें प्रत्येक जिपर को एक या संयुक् त प्रिेि बबदओंु पर प्राकृजतक गैस के पररिहन के जलए सीजीडी नेटिकड म ें प्रत् यके जिपर को िमता अिंरटत करती ह ै और सगं त प्रिेि बबद ु या जनकास बबद ु स े मापी गइ गैस की मात्रा का ईजचत जहस्ट्सा जनधाडररत करती ह।ै

(i) अिटं न प्रदक्रया प्राजधकृत संस्ट् था जमजलयन जिरटि थमलड यूजनट (एमएमबीटीयू) म ें माप े गए जिप् परों को प्रिेि बबद ुिमता और जनकास बबद ुिमता अिंरटत करेगी।

(ii) जनधारड ण प्रदक्रया प्राजधकृत संस्ट्था िास्ट्तजिक गैस पररिहन ददिस के बाद जिप् परों म ें जिपर और जनकास बबद ुमात्रा के जलए प्रिेि बबद ुपर प्राप्त गैस की िास्ट्तजिक मात्रा के अधार पर, प्रिेि बबद ुमात्रा अिंरटत करेगी। जिपर स्ट्िीकार करता ह ै दक प्रिेि बबद ु पर गैस की प्राजप्त या जनकास बबद ु पर गैस की जडलीिरी, आसके संबंध म ें दकए गए अतं ररक ददिस नामांकन स े जबल्कुल मले नहीं खाती ह ै और पररणामस्ट्िरूप गैस की जडलीिर और कम और ऄजधक जडलीिरी हो सकती ह।ै प्रिेि बबद ुपर प्रिेि की सभी मात्रा और प्रत्यके जनकास बबद ुपर जनकास मात्रा को जिपर को अिंरटत की जाएगी जो नामांकन के संबंध म ें ऐसी दकसी कम या ऄजधक जडलीिरी के कारण की परिाह दकए जबना होगी।

(iii) अिटं न और जनधारड ण डेटा प्राजधकृत संस्ट्था डेटा को प्रोसेस करेगी और जिपर को ऄजधक मात्रा, जभन् नता और ऄसतं लु न सजहत अिंरटत मात्रा सूजचत करेगी। प्राजधकृत संस्ट्था ऐस ेडेटा को ऄन्य जिप्पर को नहीं दगे ी। सामान्य संचालन के तहत, अिंरटत डेटा पुजष्ट नामांकन के अधार पर होगा, लेदकन जब िमता म ें कटौती होती ह,ै तो अिंरटत डेटा प्राजधकृत संस्ट्था द्वारा ऄजधरोजपत सुजनजश् चत कटौती मात्रा के अधार पर होगा। प्राजधकृत संस्ट् था डेटा को दैजनक अधार पर संगत जिपर को ईपलब्ध कराएगी।

(iv) ऄनसु जू चत मात्रा की गणना प्राजधकृत संस्ट्था द्वारा ऄनुसूजचत जनकास मात्रा की गणना जिजनयम 5(4) के ऄनुसार की जाएगी। (ग) ऄजधक मात्रा होना

(i) मात्रा का जनयम और जसद्ातं ों स ेऄजधक होना ऄजधक मात्रा तब होती ह ै जब कोइ जिपर जनधाडररत िमता स े ऄजधक गैस पररिहन मात्रा लते ा ह।ै सभी ऄजधक मात्रा को ऄनजधकृत माना जाएगा और ईस पर ऄनजधकृत ऄजधक मात्रा प्रभार लगगे ा। ऄजग्रम म ें ऄजधकृत ऄजधक मात्रा को छोडकर यदद िे प्राजधकृत संस्ट्था के जलए कोइ पररचालन बाधा नहीं ईत् पन् न कारती ह ैं ईदाहरण के जलए यदद दकसी जिपर ने एक ददन के जलए ऄजतररि गैस पररिहन मात्रा का ऄनरु ोध दकया ह,ै तो प्राजधकृत संस्ट्था जिपर को ऐसी मात्रा लेन े के जलए ऄजधकृत करेगी बित े दक पयाडप्त िमता ईपलब्ध हो। ऄजधकृत ऄजधक मात्रा के पररिहन की कीमत पहल े से जनधाडररत होगी जो – क. काफी ऄजधक होगी, लेदकन एक दिमलि पांच गनु ा जिजनयजमत प्रभार स े ऄजधक नहीं होगी, तादक जिपर सुजनजश् चत रांसजमिन सर्तिस के जलए ऄनुबंध करने की बजाय ऄजधक मात्रा सर्तिस पर जनभरड रहने के जलए प्रोत् साजहत न हों; लेदकन[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 19 ख. यह आतना ऄजधक न हो जो अर्तथक रूप स ेऄिम हो। प्राजधकृत संस्ट्था द्वारा ईपरोि को एक-समान, पारदिी और जबना दकसी भेदभाि के लाग ू दकया जाएगा। तथाजप, ऄनजधकृत ऄजधक मात्रा के जलए ऄनजधकृत ऄजधक मात्रा प्रभार जलया जाएगा। ऄनजधकृत ऄजधक मात्रा प्रिाजहत करने िाले जिप् परों पर दडं लगान े स े यह सुजनजित करने म ें मदद जमलती ह ै दक पररिहन ऄजधकारों के जनयजमत ईल्लंघन स े िमता ऄजधकारों के जलए बाजार बाजधत न हो। िमता स े ऄजधक मात्रा, चाह े ऄजधकृत हो या ऄनजधकृत, को सामान्य रूप स े हतोत्साजहत दकया जाएगा क्योंदक —

(i) गैर-दंडात्मक कीमतों पर प्राजधकृत संस्ट्था से ऄल्प सूचना पर िमता प्राप्त करने की िमता फम ड की िमता के ऄजधकार के मूल्य को रेखांदकत करेगी; तथा

(ii) ऄजधक मात्रा स े लागत बढेगी, और आसजलए जिपर ऄजधक मात्रा के ईपयोग पर जनभडर नहीं होंगे। जनम्नजलजखत जसद्ांतों को प्राजधकृत संस्ट्था और जिपसड द्वारा ऄनुपालन दकए जाने की अिश्यकता ह,ै ऄथाडत:्— (क) अिंरटत मात्रा के पांच प्रजतित स े ऄजधक पर कोइ प्रभार नहीं। (ख) ऄनजधकृत िमता लेन े पर काफी ऄजधक प्रभार लगाया जाता ह;ै (ग) जब नेटिकड पर ऄजतररि भौजतक िमता होती ह,ै तो ऄजधकृत जनकाय द्वारा एक समय म ें एक ददन की ऄिजध के जलए ऄजधक िमता को ऄजधकृत दकया जाता ह ै (जब तक यह कोइ पररचालन बाधा न डाली जाए और यह सिोत्तम प्रयास के अधार पर होता ह)ै ;

(घ) भौजतक िमता म ें कमी होन े पर िमता की ऄजधक मात्रा को ऄजधकृत नहीं दकया जाएगा; तथा (ड.) ऄजधकृत िमता के बढने की कीमत को आस तरह स े तय दकया जाता ह ै जजससे जिपर ऐस े व् यापार की ऄनुमजत होन े पर जद्वतीयक बाजार म ें क्रय िमता के बजाय बार-बार ऄजधकार मांगने के जलए हतोत्साजहत हों।

(ii) ऄनजधकृत ऄजधभार अरोप। जिपर को यह सुजनजित करना चाजहए दक प्रिेि बबद ु पर प्राप्त गैस की मात्रा और दकसी भी ददन जनकास बबद ुपर जडलीिरी पररिहन पथ की ऄजधकतम दैजनक मात्रा स े ऄजधक न हो। ऄनजधकृत ऄजधक मात्रा प्रभार = ऄनजधकृत ऄजधक मात्रा x ऄनजधकृत ऄजधक मात्रा दर ऄनजधकृत ऄजधक मात्रा दर = दो सौ प्रजतित x लागू प्रभार ऄनजधकृत ऄजधक प्रभार की गणना प्रत्येक प्रिेि और जनकास बबद ु पर स्ट्ितंत्र रूप स े और सकल अधार पर की जाएगी। (घ) सतं लु न (क) सतं लु न जसद्ातं ऄसंतुलन तब पैदा होता ह,ै जब भी दकसी संतुलन ऄिजध म ें प्रिेि बबद ु पर दकसी जिपर की जडलीिरी, ग्राहकों के ईठान से ऄलग होती ह,ै जजसे जिपर जनकास बबद ु पर प्रदान करता ह।ै यह तब हो सकता ह ै जब मांग ऄपेिा से ऄजधक या ऄपेिा स े कम ह ै या क्योंदक जडलीिरी ऄपेिा स े ऄजधक या कम या दोनों ह।ैं ऄसंतुलन को दरू करन े के जलए स्ट्पष्ट ईद्देश्य और कुिल व्यिस्ट्था की अिश्यकता होती ह।ै (ख) ऄसतं लु न प्रभार i. जिजनयम 15 के ईप-जिजनयम (6) म ें जनर्ददष्ट ऄनुसार, दकसी जििेर् ददन के जलए जिपर द्वारा दये ऄसंतुलन प्रभार संबंजधत जिजनयम के ईप-जिजनयम (4) म ें जनधाडररत की गइ संचयी ऄसंतलु न मात्रा के ईत्पाद और पहुचं प्रबंधन म ें जिजनर्ददष् ट ऄसंतलु न दरों के बराबर होगा।20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] ii. जिजनयम 15 के ईप-जिजनयम (7) म ें जनर्ददष्ट ऄनुसार, गैस की मात्रा का दैजनक ऄसंतलु न औद्योजगक, िाजणजययक और पररिहन िेत्रों के जलए िास्ट्तजिक दैजनक पैमाआि की मात्रा और घरेलू पीएनजी खंड के जलए गैस की परस्ट् पर सहमत दैजनक खपत मात्रा को देखते हुए जिपर और प्राजधकृत संस्ट्था के बीच जनधाडररत दकया जाएगा; जनपटान के जलए कायडप्रणाली पहुचं प्रबंधन म ें जनर्ददष्ट की जाएगी। घरेलू पीएनजी ित्रे के जलए िास्ट्तजिक पैमाआि मात्रा के साथ सामंजस्ट्य जिपर और प्राजधकृत संस्ट्था के बीच पहुचं प्रबंधन में सहमजत ऄनुसार होगा। iii. ऄसंतुलन प्रभार की गणना जनम्नजलजखत सूत्र के अधार पर जिजनयम 15 के ईप-जिजनयम (5) म ें जनर्ददष्ट प्रजतित का प्रयोग करके अिंरटत मात्रा पर की जाती ह।ै दैजनक ऄसंतलु न प्रभार = संचयी ऄसंतुलन मात्रा x ऄसंतुलन दर जहाँ, संचयी ऄसंतलु न मात्रा = जिजनयम 15 के ईप-जनयम (4) म ें जनर्ददष्ट एक ददन की समाजप् त पर संचयी ऄसंतुलन। (ग) ऄसतं लु न दर i. नकारात्मक ऄसंतलु न दर जिजनयम 15 के ईप-जिजनयम (5) म ें जनर्ददष्ट प्रजतित स े ऄजधक की नकारात्मक ऄसंतुलन मात्रा की गणना ऄसंतलु न होन े के ददन प्राजधकृत संस्ट्थाओं के नेटिकड म ें गैस की ईच्चतम लागत के एक सौ बीस प्रजतित की दर स े की जाएगी:

बिते दक जिजनयम 16 के ईप-जिजनयम (5) म ें जनर्ददष्ट प्रजतित तक नकारात्मक ऄसंतलु न मात्रा जिजनयम 15 के ईप-जिजनयम (5) म ेंजनर्ददष्ट सुधार के प्रािधानों के ऄनुसार जनधाडररत होगी। ii. सकारात्मक ऄसंतुलन दर। जिजनयम 15 के ईप-जिजनयम (5) म ें जनर्ददष्ट प्रजतित स े ऄजधक के सकारात्मक ऄसंतुलन की मात्रा की गणना एक सौ प्रजतित की दर स े की जाएगी। ऄसंतलु न होने के ददन प्राजधकृत संस्ट्थाओं के नेटिकड म ेंगैस की लागत सबस ेकम होगी:

बिते दक जिजनयम 15 के ईप-जिजनयम (5) में जनर्ददष्ट प्रजतित तक सकारात्मक ऄसंतलु न मात्रा जिजनयम 15 के ईप-जिजनयम (5) म ेंजनर्ददष्ट सुधार के प्रािधानों के ऄनुसार जनधाडररत की जाएगी। (ड.) पररितनड प्रभार पररितडन प्रभार गैस की प्रजत घटं ा जडलीिरी ऄनुसूची दर म ेंजिचलन होने का प्रभार ह।ै पररितडन के संबंध म ें स्ट्िीकाय ड सीमाए ँ और संबंजधत प्रभार का भुगतान प्राजधकृत संस्ट्था को पहुचं प्रबंधन म ें परस्ट् पर सहमत जनबंधन एि ंितों और दरों के ऄनुसार दकया जाएगा।

9.0 साजं िजधक िल्ु क जिपर के जलए दकसी भी सर्तिस के प्रािधान के दौरान प्राजधकृत संस्ट्था द्वारा खचड दकए गए सभी िैधाजनक िुल्क जिपर द्वारा िहन दकए जाएगं े।

10.0 ऄन्य िल्ु क प्राजधकृत सस्ट्ं था की कमी सबं धं ी प्रभार प्राजधकृत संस्ट्था, जिपर को पयाडप्त मुअिजा दगे ी, यदद प्राजधकृत संस्ट्था माजसक अधार पर गणना की गइ मात्रा के ऄस्ट्सी प्रजतित तक िमता प्रदान करन े म ेंऄसमथ ड ह,ै जब तक दक जिपर और प्राजधकृत संस्ट्था के बीच पहुचं प्रबंधन म ें जनर्ददष्ट ऄनुसार कोइ जनयोजजत रखरखाि, िेकडाईन, जसस्ट्टम या नेटिकड जिफलता, तीसरे पि को िजत, ऄप्रत्य ाजित जस्ट्थ जतयां या कोइ अपात जस्ट्थ जत या कोइ भी ऄन्य मुद्दे न हों।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 21 ऄजधकृत संस्ट्था और जिपर के बीच मुअिजे के जलए सहमजत होगी, बिते दक पीएनजी के जलए प्रदान की जान े िाली िमता म ें प्रजत एमएमबीटीयू न्यूनतम पद्रं ह रुपए प्रजत टन और सीएनजी के जलए प्रदान की जान े िाली िमता म ेंप्रजत दकलोग्राम एक रुपय े की कमी हो।

11.0 चालान और भगु तान प्राजधकृत संस्ट्थ ा और जिपर जबबलग चक्र, जबबलग जतजथ, ऊण ऄिजध, सेट-ऑफ और समायोजन और जििाद प्रािधानों, जिलंजबत और गरै -भुगतान के पररणामों के रूप म ें पारस्ट्पररक रूप स े सहमत होंगे जो ईजचत और प्रचजलत ईद्योग प्रथा के ऄनरूु प हो सकते ह।ैं

12.0 सचं ार (क) प्रस्ट्त ािना पार्टटयों के जलए जििेर् रूप स े अपातकालीन जस्ट्थजत म ें समय पर ईजचत प्रकार स े प्रजतदक्रया करने के जलए एक स्ट्पष्ट और सुपररभाजर्त संचार प्रदक्रया जान-माल की रिा और गैस अपूर्तत म ें रुकािट को कम करने के जलए अिश्यक ह।ै यह नगर या स्ट्थानीय गैस जितरण नेटिकड के सुरजित, जिश्वसनीय और कुिल सचं ालन को सुजनजित करने के लक्ष्य को पूरा करने के जलए प्राजधकृत संस्ट्था और जिपरों के बीच एक ऄच्छा तालमले और संबंध स्ट्थाजपत करने के साथ-साथ अपसी समझ और सहयोग को स्ट्थाजपत करने म ेंभी मदद करेगी। प्राजधकृत संस्ट्था और जिपर सचं ार प्रोटोकॉल स्ट्थाजपत करेंग े जो सामान्य और अपातकालीन जस्ट्थजत के दौरान प्राजधकृत संस्ट्था और जिपर का मागडदिडन करेगा। सीजीडी नटे िकड का सुरजित, जिश्वसनीय और कुिल संचालन सुजनजित करन े के जलए आस प्रोटोकॉल का हर समय पालन दकया जाएगा। (ख) गसै प्रबधं न प्रणाली प्राजधकृत संस्ट्था िेब-अधाररत, गैस प्रबंधन प्रणाली (जीएमएस) की स्ट्थापना और संचालन को सुरजित कर सकती ह ैजो प्राजधकृत संस्ट्था और जिपर के बीच सूचना का आलेक्रॉजनक हस्ट्तांतरण प्रदान करती ह।ै प्राजधकृत संस्ट्था और जिपर जीएमएस के माध्यम स े नगर या स्ट्थानीय गैस जितरण नेटिकड के दैजनक संचालन और जनगरानी के प्रयोजनों के जलए एक दसू रे के साथ संिाद कर सकते ह।ैं जीएमएस के माध्यम स े प्राजधकृत संस्ट्था द्वारा दी गइ जानकारी केिल संबंजधत जिपर के पोटडफोजलयो तक ही सीजमत रहगे ी। प्राजधकृत संस्ट्था जिपर को जनम्नजलजखत एक् सेस और ईपयोग प्रदान कर सकती ह-ै i. जीएमएस म ें जिपर का पोटडफोजलयो;

ii. जीएमएस के संबंध में स्ट्थाजपत सॉफ्टिेयर; तथा iii. जीएमएस के संबंध में प्राजधकृत संस्ट्था द्वारा जनयमािली या कोइ सामग्री।

13.0 कटौती (क) प्रस्ट्त ािना प्राजधकृत संस्ट् था एक ददन म ें सीजीडी नेटिकड म ें सेिाओं की कटौती करना ऄजनिाय ड कर सकती ह,ै तादक पहुचं प्रबंधन के तहत सभी जिप् परों द्वारा नामांदकत गैस की कुल मात्रा के ऄपयाडप् त होन े पर ईसका पररिहन दकया जा सके और आस तरह कटौती से प्राजधकृत संस्ट्था पर कोइ जित्तीय प्रभाि नहीं पडेगा। (ख) ऄप्रत्य ाजित जस्ट्थ जतयों के जलए कटौती प्राजधकृत संस्ट्था जिपर की सेिाओं के प्रािधान म ेंकटौती कर सकती ह ैयदद – क. ऄप्रत्य ाजित जस्ट्थ जतयां ईत् पन् न होती ह;ैं तथा22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] ख. ऄप्रत्य ाजित जस्ट्थ जतयों की घटना के पररणामस्ट्िरूप, सीजीडी नेटिकड की जनधाडररत िमता बाजधत होती ह,ै तादक प्राजधकृत संस्ट्था जनधाडररत मात्रा म ें गैस का पररिहन न कर सके। ग. पररचालन या सुरिा कारणों के जलए कटौती। प्राजधकृत संस्ट्था जिपर को जडलीिरी म ें कटौती कर सकती ह ै यदद िह ऄपने जििेक स े यह जिचार करता ह ैदक ऐसा करना अिश्यक ह ै– i. सीजीडी नेटिकड के रखरखाि, प्रजतस्ट्थापन, स्ट्थापना या मरम्मत या प्रिेि बबद ु और जनकास बबद,ु परस् पर कनेक् िन, और जजला जिजनयमन स्ट्टेिनों (डीपीअरएस) सजहत संबद् सुजिधाओं के जलए;

ii. नगर या स्ट्थानीय गैस जितरण नेटिकड खंड या संबद् सुजिधा जो जिपर को सेिाएं प्रदान करता ह,ै को िजत पहुचं ाए जान े के कारण, जजससे कटौती की अिश् यकता ईत् पन् न हो सकती ह।ै (ग) अपातकाल म ेंकटौती प्राजधकृत संस्ट्था जिपर को जडलीिरी की कटौती कर सकती ह ै यदद िह ऄपने जििेक स े यह समझती ह ै दक ऐसा करना अपातकाल के कारण अिि् यक ह,ै जजससे कटौती की अिश्यकता ईत् पन्न हो सकती ह।ै दकसी अपातकाल जस्ट् थजत का ऄजस्ट्तत्ि प्राजधकृत संस्ट्था द्वारा जनधाडररत दकया जाएगा चाह े िह दकसी भी अपात जस्ट्थजत के कारण हो या िह प्राजधकृत संस्ट्था या दकसी ऄन्य व्यजि के कारण ईत् पन् न हुइ हो। अपातकालीन जस्ट्थजत म ें लाग ू होने िाली प्रदक्रया को पार्टटयों के बीच पहुचं प्रबंधन और संचार प्रोटोकॉल म ें जनधाडररत दकया जाएगा। (घ) कटौती के जलए सिे ाओं की प्राथजमकता प्राजधकृत संस्ट्था ऄन्य जिपरों को ऄपन े दाजयत्िों को पूरा करने के जलए जिपर की सेिाओं के प्रािधान को रोक सकती ह।ै कटौती सीजीडी एक्सेस संजहता और ऄन्य ऄजधसूजचत जिजनयमों के प्रािधानों के ऄनुसार होगी। ऄनसु चू ी-।। (जिजनयम 5(1) देख)ें नगर या स्ट्थानीय प्राकृजतक गसै जितरण नटे िकड म ेंिमता बकु कग प्राप्त करन े का प्रपत्र

8. प्रारंभ जतजथ और ऄंजतम जतजथ जजसके जलए िमता तक पहुचँ की अिश्यकता होती ह।ै ऄनसु चू ी-IV (देख ें जिजनयम 5(8)) सामान्य िाहक या सजं िदा िाहक अधार पर िमता की बकु कग के जलए िबे साआट अधाररत खलु ी पहुचं प्रणाली के जलए ऄनदु ेि प्राजधकृत संस्ट्था की िेबसाआट पर ऄपनाइ जान े िाली प्रदक्रया का प्रिाह िेबसाआट अधाररत ओपन एक्सेस प्रणाली के जलए जनम्नजलजखत अिश् यकताओं को पूरा करेगा, जो सामान्य िाहक या संजिदा िाहक अधार पर िमता की बुककग के जलए लाग ू होंगे:

1. प्राजधकृत संस्ट्था एक ऑनलाआन पोटडल बनाए रखेगी, जजस पर सामान् य िाहक या संजिदा िाहक िमता की बुककग के जलए अिेदन-पत्र जिपर द्वारा प्रस्ट्तुत दकए जा सकत े ह।ैं24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

2. प्राजधकृत संस्ट्था की िेबसाआट सीजीडी िमता बुककग के रूप म ें सुलभ बलक प्रदान करके िमता की बुककग की ऄनुमजत दे सकती ह-ै ऄभी अिदे न करें- नए जिपर/ मौजूदा जिपर।

3. नए जिपर के मामल े म,ें िमता बुककग के जलए ऑनलाआन अिदे न-पत्र के साथ केिाइएस दस्ट् तािेज प्रस्ट् तुत करन े के जलए एक बलक ईपलब्ध कराया जाएगा जजस े जिपर द्वारा जनधाडररत जििरण को जिजधित भरकर प्रस्ट्तुत दकया जाएगा। आसके बाद, अिेदन जमा करने की इमेल पुजष्ट के साथ एक जिजिर् ट् अिेदन सख्ं या ईत्पन्न होगी।

4. यदद कोइ मौजूदा जिपर िमता को बुक करना चाहता ह,ै तो ऐसे जिपर को ऄपनी पंजीकृत अइडी और पासिडड के साथ लॉजगन करना होगा और सीजीडी नेटिकड िमता बुककग के ऑनलाआन ऄनुरोध के जलए नए ऄनुरोध के बलक पर जाना होगा। अिश्यक जििरण के साथ नए ऄनुरोध के जलए अिेदन फॉमड भरने पर, मौजूदा जिपर को अिेदन जमा करने की इमेल पुजष्ट के साथ एक जिजिष्ट अिेदन संख्या प्राप्त होगी।

5. नए जिपर स े अिेदन प्राप्त होन े पर प्राजधकृत संस्ट्था यह अकलन करेगी दक ईसका सीजीडी नेटिकड ऄंजतम ग्राहक के जितरण बबद ु स े जडु ा ह ै या नहीं। यदद सीजीडी नेटिकड को जितरण बबद ु स े नहीं जोडा जा सकता ह,ै तो ईस े जिपर को सूजचत दकया जाना चाजहए।

6. यदद सीजीडी नेटिकड को ग्राहक के जितरण बबद ु स े जोडा जा सकता ह,ै तो प्राजधकृत संस्ट्था सत्याजपत करेगी दक क्य ा जिपर के ऄनरु ोध पर कारडिाइ करन े के जलए ईसके नेटिकड पर पयाडप्त सामान्य िाहक िमता ईपलब्ध ह ै या नहीं।

7. यदद पयाडप्त सामान्य िाहक िमता ईपलब्ध ह,ै तो अिेदन-पत्र पर पारदिी गरै -भेदभािपूणड तरीके स े अिश्यक ऑनलाआन कारडिाइ की जाएगी और ऐसे मामलों म ें जहां दकसी जििेर् ददन के जलए प्राप्त िमता की बुककग ईपलब्ध सामान्य िाहक या ऄनुबंध िाहक िमता स े ऄजधक ह,ै जैसे सामान्य िाहक या संजिदा िाहक िमता ईन संस्ट्थाओं को अिंरटत की जाएगी जजनस े बुककग जिजनयम 5(4) के ऄनुसार प्राप्त हुइ ह।ै

8. एक् सेस के जलए जनबंधन एि ं ितें ऄनुसूची-I म ें दी गइ पहुचं प्रबंधन के ददिाजनदेिों के ऄनसु ार होंगी। एक बार िमता अिंरटत हो जान े के बाद, जिपर को आन जिजनयमों के ऄनुसार ईस िमता को एक्सेस करन े की ऄनुमजत दी जाएगी जो ईसे अिंरटत की गइ ह।ै

9. यदद ईपलब्ध सामान्य िाहक या संजिदा िाहक िमता नहीं ह,ै तो अिेदन पर अग े कारडिाइ नहीं की जाएगी और ईस े बंद कर ददया जाएगा।

10. जसस्ट्टम द्वारा जेनरेट दकया गया इमेल सभी घटनाक्रमों को सूजचत करन े के जलए भेजा जाएगा। ऄनसु चू ी- V (देख ेंजिजनयम 5(9)) प्राजधकृत सस्ट्ं था द्वारा सीजीडी नटे िकड म ेंबकु कग और िमता के अिटं न के जलए अिदे नों के ररकॉडड को बनाए रखन ेके जलए प्रारूप

6. िमता की बुककग के जलए सीजीडी नेटिकड अिेदन की प्राजप्त की तारीख स े पहले सभी प्रिेि/ जनकास बबद ुपर (एमएमडीटीय ू म)ें सीजीडी नेटिकड म ें ईपलब्ध सामान्य िाहक या संजिदा िाहक िमता।

NOTIFICATION New Delhi, the 23rd November, 2020 F. No. PNGRB/Auth/1-CGD(16)/2020 (P-2748).—In exercise of the powers conferred by section 61 of the Petroleum and Natural Gas Regulatory Board Act, 2006 (19 of 2006), the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations, namely:—

1. Short title and commencement:

(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Access Code for City or Local Natural Gas Distribution Networks) Regulations, 2020.

(2) These regulations shall come into force on the date of their publication in the Official Gazette.

2. Definitions:

(1) In these regulations, unless the context otherwise requires,—

(a) “access arrangement” means a contract between the authorised entity and the shipper, complying with the provisions specified in Schedule-I and defining the terms and conditions for access to entry point capacity, exit point capacity and CNG exit point capacity on the city or local natural gas distribution network.

(b) “Act” means the Petroleum and Natural Gas Regulatory Board established under the Petroleum and Natural Gas Regulatory Board Act, 2006 Act, 2006 (19 of 2006);

(c) “allocated capacity” means the scheduled maximum daily capacity in MMBTU at entry point agreed between the authorised entity and the shipper for delivery at exit point or CNG exit point;

(d) “Board” means the Petroleum and Natural Gas Regulatory Board;

(e) “CNG exit point” means the point at which the CNG is off-taken from a CNG compressor outlet point for delivery to the shipper with proper arrangement for metering at outlet of the CNG compressor by the

authorised entity:

Provided that the CNG exit point shall terminate at tubing connection or union where compressor exit is connected to dispenser and at filling nozzle in case it is connected to CNG cascade of the shipper;

(f) “CNG exit point capacity” means the maximum quantity of CNG for open access, which the authorised entity shall deliver to the shipper at the relevant CNG exit point in a day;

(g) “CNG exit point maximum daily quantity or “CNG exit point MDQ” means the maximum daily quantity of natural gas for which capacity has been allocated by the authorised entity to the shipper for open access, measured in kilogram (kg) which can be off-taken by the shipper at CNG exit point;

(h) “day” means a period of twenty-four consecutive hours beginning at 0600 hours on a day and ending at 0600 hours on the following day;

(i) ―designated exit point” means the exit point for which gas delivery has been agreed between the shipper and the authorised entity on technical and safety ground;

(j) “delivered quantity” means the quantity of gas delivered by the authorised entity at designated exit point of the shipper;

(k) “entry point” means the point at which the natural gas delivered by a shipper is injected into the city or local natural gas distribution network;

Entry point may be at CGS or Sub-transmission pipeline (STPL) or any other point in the CGD network;

(l) “entry point capacity” means the maximum quantity of natural gas in MMBTU available for open access, which the authorised entity shall receive from shipper at the relevant entry point in a day so as to deliver at designated exit point;

(m) “entry point maximum daily quantity” or “entry point MDQ” means the maximum daily quantity of natural gas for which capacity has been allocated by the authorised entity to the shipper on open access basis at the relevant entry point as agreed in the access arrangement;

(n) “exit point” means the point at which the natural gas is off-taken from city or local natural gas distribution network by the shipper as agreed between the authorised entity and the shipper in the access arrangement and such exit point shall be at all the metering stations, CNG exit point and all such other points agreed, on technical and safety ground, between the shipper and authorised entity in the access

Provided that—

(i) for domestic piped natural gas (PNG), the exit point shall be the suraksha hose of the individual consumer for the purpose of custody transfer. For other purpose such as capacity determination of exit points, concerned DPRS shall be considered as exit point;

(ii) any new exit point shall be decided between the shipper and authorised entity on technical and safety ground;

(o) “exit point capacity” means the maximum quantity of natural gas in MMBTU available for open access up to which the authorised entity shall deliver to the shipper at the relevant exit point in a day;

(p) “exit point maximum daily quantity” or “exit point MDQ” means the maximum quantity of natural gas on open access basis up to which can be off-taken by the shipper at specific metering station and CNG exit point in a day;

(q) “imbalance quantity” on a day means the positive imbalance quantity or the negative imbalance quantity as specified in regulation 16;

(r) “line pack” or “LP” means the volume of gas that must be maintained in the city or local natural gas distribution network at all times in order to maintain pressure and enable uninterrupted transportation and supply of natural gas through the network;

(s) “lost and unaccounted for gas” or “LUAG” means the quantity of natural gas which is unaccounted for whatsoever reason including, but not limited to blow downs, venting or release during regular operation or maintenance of the city or local natural gas distribution network and mismatch of meter readings at the entry and exit point;

(t) “marketeer” means an entity dealing with marketing or trading of natural gas;

(u) “marketing exclusivity period” means the period of exclusivity from the purview of common carrier or contract carrier as per the Petroleum and Natural Gas Regulatory Board (Exclusivity for City or Local Natural Gas Distribution Network) Regulations, 2008;

(v) ―maximum daily quantity” (“MDQ”) means the maximum quantity of natural gas, contracted, booked, scheduled for delivery in a particular day;

(w) “maximum delivery rate” (“MDR”) means the maximum per hour rate, up to which the authorised entity shall deliver natural gas to the shipper at the relevant exit point as specified in the access arrangement;

(x) “maximum off-take rate” or “MOR” means the maximum per hour rate, up to which the shipper shall off-take natural gas at the relevant exit point as specified in the access arrangement and MOR shall be the same in value as the MDR;

(y) “maximum receipt rate” or “MRR” means the maximum per hour rate, up to which the authorised entity shall receive natural gas at the relevant entry point as specified in the access arrangement;

(z) “MMBTU” means one Million British Thermal Units on the basis of Gross Calorific Value (GCV) and shall be the unit for energy content of natural gas as defined in ISO 6976;

(za) “nominated quantity” means the quantity of natural gas, confirmed by the shipper to the authorised entity for delivery at the designated entry point with details of off-takes at the relevant exit point on daily basis for distribution or for own use;

(zb) “off-spec gas” means the natural gas delivered by the shipper at the entry point or delivered by the an authorised entity at the exit point which does not conform to the gas parameters referred to in sub- regulation (1) of regulation 9;

(zc) “operating pressure” means the pressure corresponding to a particular flow rate at which the relevant

section of the city or local natural gas distribution network is operated:

Provided that at no point of time the operating pressure for the network shall exceed the design pressure or maximum allowable operating pressure (MAOP) as specified in the relevant technical standards and specifications including safety standards regulations;

(zd) “scheduled quantity” means the quantity of natural gas, scheduled for a shipper by the authorised entity at the designated entry point or exit point for distribution or own requirement based on the nominated capacity and in accordance with the provisions of the access arrangement;

(ze) “shipper” means a consumer or a marketeer or any other entity who intends to utilise the capacity in the CGD Network;28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(zf) “Standard Cubic Meter” or “SCM” shall mean the quantity of Gas that occupies a volume of one (1) cubic meter at a temperature of fifteen Celsius (15°C) under an absolute pressure of one decimal zero one three two five bar (1.01325 Bar);

(zg) “system use gas” or “SUG” means the quantity of natural gas, used by the authorised entity for operation and maintenance of the city or local natural gas distribution network including, but not limited to, general use of gas for compressors, prime movers, gas heaters and venting or flaring for safety requirements;

(zh) “Unit of Measurement” means unit for measurement of quantity of gas. Unit of measurement shall be in million British Thermal Units (MMBTU);

Provided that CNG exit point quantity shall be measured in kilogram (kgm) but shall be converted into MMBTU for the purpose of natural gas quantity reconciliation;

(2) Words and expressions used and not defined in these regulations, but defined in the Act or the rules or regulations made thereunder shall have the same meanings respectively assigned to them in the Act or in the Rules or Regulations, as the case may be.

3. Application:

These regulations shall apply to an authorised entity in a geographic area and to any shipper who intends to

utilise the capacity in the CGD Network in that geographical area:

Provided that an authorized Geographical Area has been declared as common carrier or contract carrier in terms of Petroleum and Natural Gas Regulatory Board (Guiding Principles for Declaring City or Local Natural Gas Distribution Networks as Common Carrier or Contract Carrier) Regulations, 2020 and Petroleum and Natural Gas Regulatory Board (Exclusivity for City or Local Natural Gas Distribution Network) Regulations, 2008.

Provided further that—

(a) the authorised entity shall allow access to shippers on non- discriminatory basis to a city or local natural gas distribution network in an authorised area;

(b) the development of the infrastructure shall be governed by the Petroleum and Natural Gas Regulatory Board (Authorising Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Regulations, 2008 and the shippers shall get their gas transported or delivered by the authorized entity—

(i) up to the suraksha hose connecting to the burner of the domestic connections;

(ii) up to the metering point in case of commercial and industrial connections;

(iii) up to compressor exit point in case of CNG stations:

Provided also that—

(i) the authorised entity shall maintain its entire assets up to suraksha hose for all times in conformity with the Petroleum and Natural Gas Regulatory Board (Technical Standards and Specifications Including Safety Standards for City or Local Natural Gas Distribution Networks) Regulations, 2008;

(ii) the metering point means the location where gas measurement is carried out which will include metering device, equipment and pressure reduction up to desired pressure at exit point; and

(iii) compressor exit point shall include the filling nozzle and CNG measurement facilities.

4. Capacity declaration:

(1) Authorised entity shall, within ninety days of declaration of its CGD network as common carrier or contract carrier, determine in accordance with applicable regulations and declare by publishing on its website the entry point capacity, the exit point capacity, the CNG exit point capacity for open access at all entry points and exit points and the capacity at DPRS level for PNG and capacity at mother and online stations (Cascade filling capacity) for CNG in accordance with the provisions of applicable regulations.

(2) The capacity in a CGD network for open access on a cumulative basis at all entry points shall be at least twenty percent of the capacity of the CGD network and compression capacity or the maximum quantity of gas that has flowed in the CGD network or through compressors even for a period of one day in the past, whichever is higher. If such open access capacity in the CGD network falls below ten percent, the authorised entity shall increase the capacity of the CGD network so as to restore the open access capacity to at least twenty percent within a period of six months from the date it has fallen below ten percent.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 29

(3) The Board may on a suo motu basis and notwithstanding the provisions of sub-regulation (2) but after following the due process of public consultation, may by order direct an authorised entity to expand the capacity of the CGD network within such period and on terms and conditions as it may deem fit.

(4) An authorised entity shall not utilise open access capacity in its CGD network for ownrequirement except with respect to such part of extra capacity for which booking has not been received from any shipper for a consecutive period of ninety days.

Provided that authorised entity shall vacate the common carrier capacity, being used by it for own requirement, within thirty days from receipt of capacity booking request fromany shipper.

5. Capacity booking:

(1) The authorised entity shall, within twenty-one days of declaration of its city or local natural gas distribution network as common carrier or contract carrier, publish information in the format specified in Schedule-II on its website and a short advertisement referring to such publication on its website in a national daily and a vernacular daily newspaper, seeking capacity booking for the entry points and exit points capacity on its CGD network and thereafter take similar action within twenty-one days as and when extra capacity is available in its CGD network.

(2) Interested shippers shall submit in the format specified in Schedule-III, their offers to the authorised entity for booking the capacity (―MDQ‖) within ninety days from the date of publication of the public notice seeking capacity booking.

(3) The sum of the requested entry points MDQ by any shipper shall not be less than 500 MMBTU per day and the off-take at any exit point shall not be less than 50 MMBTU per day.

Provided that the shipper and the authorised entity may agree in the access arrangement to achieve the booked quantities over an agreed period.

(4) The allotment of capacity shall be decided by the authorised entity in a transparent and non-discriminatory manner. If the available common carrier capacity is more than total booking requests from all the shippers then the requested capacity shall be allotted to each of the shippers. However, in cases where the total booking requests for a particular day is more than the available common carrier capacity, such common carrier capacity shall be allotted to the shippers based on the highness of the product of the sum of the entry points MDQ and the period of capacity booking.

(5) Capacity booking shall be finalised by the authorised entity within thirty days from the end of the period specified under sub-regulation 2.

(6) The authorised entity shall publish information on entry points capacity, exit points capacity, DPRS capacity and CNG exit points capacity for open access of the city or local natural gas distribution network on its website by fifteenth day of each month for the succeeding month on a continuous basis and shall schedule the process of capacity booking in such a manner that the capacity can be utilised effectively from the first working day of every month. Such data may be verified by the Board at any time and on such intervals as may be decided by the Board from time to time.

(7) Capacity booking shall be finalised in terms of entry points MDQ and exit points MDQ and other relevant terms and conditions through an access arrangement.

(8) An authorised entity whose CGD network has been declared as a common carrier or contract carrier shall establish within ninety days of such declaration, a portal for receiving offers for booking common carrier or contract carrier capacity and allotting the capacity against such offers. The entire process of receipt of applications, allotment and maintaining the records shall be made in an open, transparent and non- discriminatory manner and shall be available for verification by the Board at any time. The process flow that would be followed on such portal shall conform to the perticulars specified in Schedule-IV.

(9) The relevant authorised entity shall accept application in a transparent manner requesting capacity booking and make allotment of such capacity online on its website and maintain an online record of the applications received and allotments made as specified in Schedule-V and also publish such information on its website.

6. Provision of Access to third party shipper CNG or L-CNG stations:

An authorised entity whose CGD network has been declared as a common carrier, shall provide access to the third party shipper for CNG or L-CNG station within the authorised area of its CGD network on non- discriminatory basis. If the existing compressor is unable to meet the requirements of the third party shipper within the limits of common carrier capacity, then such third party shipper may request the authorised CGD entity to install additional compression facilities to meet the requirements subject to technical feasibility. In case the authorised entity is unable to install the additional compression facilities due to technical constraints,30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] the authorised CGD entity shall accordingly inform the third-party shipper in writing along with the reasons within a period of forty-five days from the date of request for such additional compressor facilities.

Explanation: In the interest of creation of additional infrastructure, CNG or L-CNG stations existing on the date of notification of these regulations run by dealers and franchises of authorised entities (including CNG or L-CNG stations run by companies engaged in retailing of liquid petroleum products on their retail outlets) shall not be considered as third party shipper for the purpose of allowing access in CNG or LCNG stations.

7. Obligations of shippers and authorised entity:

(1) Authorised entity shall be responsible to comply with all the applicable regulations and guidelines issued by the Board from time to time from receipt of gas to the delivery point.

(2) Authorised entity shall receive the gas from the shipper at the agreed entry point, transport the gas through its CGD network and shall deliver the gas at the agreed exit point.

(3) Authorised entity shall be responsible for the overall management of its CGD network and related services.

(4) Authorised entity shall act as supplier of the last resort for the domestic customers in case of any default by the shipper.

(5) Shipper shall be responsible for compliance with all the applicable regulations for the CGD network before the gas receipt by the authorised entity and after gas is delivered to the shipper.

(6) Shipper shall deliver gas at the agreed entry point and receive the gas at the agreed exit point.

(7) Shipper shall ensure that the gas delivered by it at the entry point conforms to the parameters specified in regulation 8.

(8) Shipper shall pay all dues and provide such guarantee, surety and security to the authorised entity as may reasonably be required to meet its commercial obligations under the access arrangement.

(9) Shipper shall be responsible for billing and collection of dues from its customers. Meter reading shall be the responsibility of the authorised entity, except for PNG domestic consumers which shall be the responsibility of the shipper. Shipper shall also be responsible for any complaints from its customers in relation to billing and collection as per the Petroleum and Natural Gas Regulatory Board (Code of Practice for quality of Service for City or Local Natural Gas Distribution Networks) Regulations, 2010.

(10) Both authorised entity and shipper shall comply with the Petroleum and Natural Gas Regulatory Board (Code of Practice for Quality of Service for City or Local Natural Gas Distribution Networks) Regulations, 2010.

8. Gas parameters:

(1) The authorised entity shall, on a non-discriminatory basis, specify the threshold limits for gas parameters at the entry point, such as the acceptable ranges of pressure, temperature and calorific value and the acceptable threshold limits for other elements in gas, such as carbon dioxide (CO2), nitrogen (N2) and oxygen (O2) in the access arrangement:

Provided that the aforesaid ranges or the threshold limits shall be in conformity with those specified in Schedule-VI.

Provided further that in case the CGD network has been established largely based on Coal Bed Methane

(CBM) gas, or Coal Mine Methane (CMM) gas from open cast mining, the Board may on an application from the authorised entity allow deviation from the specifications given in Schedule-VI.

(2) If the gas delivered by the shipper at the entry points does not meet the requirements of gas parameters as specified in the access arrangement and as specified in these regulations, the authorised entity may—

(a) refuse to accept it; or

(b) accept it and charge as per the access arrangement on a non-discriminatory basis, a cost of service (―off- spec gas charges‖) from the shipper, as per the access arrangement, for any additional facilities or treatment

for upgrading the gas to the network requirements:

Provided that such off-spec gas does not adversely affect the quality-specifications committed by the authorised entity at the exit points to the existing customers.

(3) The authorised entity may deliver commingled gas at the exit points, and the quality of gas at the exit points shall be within the acceptable band agreed in the access arrangement.

(4) The authorised entity shall odourise the entire gas as per the provisions of relevant standards notified by the Petroleum and Natural Gas Regulatory Board before delivering to the shipper.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 31

9. Facilities at the entry points and exit points:

(1) The shipper shall arrange to deliver natural gas at the entry points. The authorised entity shall provide facilities for transfer of custody and delivery of natural gas at the entry points at the cost of the shipper,

including measuring equipment:

Provided that the shipper may install its check meter at the entry points at its own cost in case it desires so.

(2) The shipper shall provide ready access to the authorized entity for the measuring equipment wherever installed by the authorizes entity in the premise of the shipper.

(3) The authorised entity shall provide CGD network and CNG compression facility to shipper in consideration of payment of transportation rates for CGD and transportation rate for CNG determined in accordance with Petroleum and Natural Gas Regulatory Board (Determination of Transportation Rate for CGD and Transportation Rate for CNG) Regulations, 2020.

(4) The authorised entity shall provide at its own cost facilities, including measuring equipment, pressure reduction and control facilities, gas chromatography or any other system as agreed between the authorised entity and the shipper, required for transfer of custody and delivery of natural gas to the shipper at all the exit points.

Provided that the shipper may install its check meter at the exit points at its own cost in case it desires so.

(5) The maintenance of the facilities at the entry points and exit points shall respectively be carried out by the shipper and the authorised entity unless otherwise agreed in the access arrangement.

10. Nomination, scheduling, metering, allocation and billing:

(1) The nomination, scheduling, metering, allocation and billing procedure shall be specified in the access arrangement and the shipper shall nominate the quantity for the following day by 10:00 hours of the previous day and for weekly nomination by 10:00 hours on Friday of the previous week. The nomination and scheduling for each entry point and exit point shall be made for each hour of the following day on a best endeavor basis for system operation purpose.

(2) The authorised entity shall regularly measure the quality of gas by the gas chromatograph unless otherwise agreed between the authorised entity and the shipper in the access arrangement.

(3) Total error limit and accuracy of the measuring equipment shall be as agreed to between the authorised entity and the shipper subject to any mandatory specifications, if any, laid down by the Board through regulations.

(4) The authorised entity shall carry out verification, calibration or proving of measuring equipment as per relevant codes and standards.

11. Gas accounting and reconciliation:

(1) Gas accounting shall be done on a daily basis in energy terms, that is in MMBTU, and shall be based on Gross Calorific Value as defined in ISO 6976-1:1983(E) as amended or modified from time to time:

Provided that—

(a) the daily gas delivered at the relevant entry points shall be directly measured through system as agreed between the authorised entity and the shipper;

(b) for industrial and commercial customers, the daily off-take at the relevant exit points shall be measured through system as agreed between the authorised entity and the shipper;

(c) for PNG domestic customers, the daily off-take for gas accounting shall be assumed based on the average consumption of gas by the relevant PNG domestic customers and reconciliation shall be done within seven days of the end of every billing cycle as per the methodology agreed in access arrangement;

(d) for CNG, the daily off-take of gas shall be measured in kilogram (kgm) on the meter at the outlet of the online compressor and shall be converted to MMBTU for gas accounting based on the average quality parameters of the gas in the network on the relevant day, measured at CGS in the event gas quality measurement are not available at CNG station. It may be possible that gas chromatograph is not available at every CNG station. Gas quality at the point of chromatography shall be assumed to be same in that particular zone of the network and gas quality parameters shall be considered for CNG station accordingly.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(2) The detailed measurement and gas accounting procedure shall be specified in the access arrangement.

12. Charges:

(1) The shipper shall pay to the authorised entity the following charges for using its CGD network or compression facility and availing other services, namely:–

(a) ―transportation rate for CGD‖ in accordance with Petroleum and Natural Gas Regulatory Board (Determination of Transportation Rate for CGD and Transportation Rate for CNG) Regulations, 2020;

(b) ―transportation rate for CNG‖ in accordance with Petroleum and Natural Gas Regulatory Board (Determination of Transportation Rate for CGD and Transportation Rate for CNG) Regulations, 2020;

(c) overrun charges, if applicable;

(d) system imbalance charges, if applicable;

(e) off-spec gas charges, if applicable, as agreed in access arrangement;

(f) applicable taxes and duties;

(g) any other charges in the access arrangement such as— i. ship or pay; ii. transport or pay; iii. technical upgradation of system, if such service has been specifically requested by shipper; iv. R&D, if such service has been specifically requested by shipper;

(h) any other charges as approved by the Board from time to time.

Charges specified in clauses (c) to (g) shall be in accordance with provisions of Schedule-I and charges given in regulations 14, 15 and 16.

13. Authorised entity‟s shortfall charges:

The authorised entity shall have an obligation to provide capacity to the shipper up to the scheduled quantity unless there is a planned maintenance as specified in regulation 19 or a force majeure as specified in regulation 20 or an emergency as specified in regulation 21.

14. Overrun charges:

(1) The methodology for calculation of the overrun quantity for a shipper at each entry point, in MMBTU, on a day shall be specified in the access arrangement on a non-discriminatory manner.

(2) The shippers shall not have to pay any overrun charges for overruns up to five percent of the scheduled quantity. Overruns beyond five percent of the scheduled quantity shall attract overrun charges.

(3) Overrun charges for overruns greater than five percent of the scheduled quantity shall be reasonable, transparent and non-discriminatory and shall be specified in the access arrangement.

(4) Overrun charges payable by the shipper in respect of a day shall be equal to the sum of the overrun charges payable in respect of each entry point on that day.

15. System imbalance charges:

(1) Positive imbalance quantity on a day, in MMBTU, shall be the excess of the aggregate of the shipper‘s quantities delivered at all the entry points over the aggregate of the shipper‘s quantities off-taken at all the exit points.

(2) Negative imbalance quantity on a day, in MMBTU, shall be the excess of the aggregate of the shipper‘s off-taken quantities at all the exit points over the aggregate of the shipper‘s delivered quantities at the all entry points.

(3) The cumulative imbalance at the start of a day shall be equal to the cumulative imbalance at the end of the previous day. At the start of the first day when natural gas is delivered by the shipper, the cumulative imbalance shall be zero.

(4) The cumulative imbalance at the end of a day shall be equal to the sum of the cumulative imbalance at the start of the day and the imbalance for the day.

(5) The shipper shall not have to pay any imbalance charges up to a cumulative positive or negative imbalance of five percent of sum of MDQ at all the entry points. Authorised entity shall notify the[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 33 imbalance quantity to shipper on daily basis so as to provide an opportunity to shipper to cure imbalances while submitting nominated quantity for subsequent period.

Provided that where the shipper is unable to cure such imbalances in a period of fifteen days, then, the authorised entity shall have the right to adjust daily nomination at the entry points and exit points to cure such imbalances to ensure safety and integrity of the CGD network.

Imbalance charge for cumulative positive imbalance and cumulative negative imbalance in excess of these limits shall be reasonable, transparent and non-discriminatory.

(6) The imbalance charges payable by the shipper for any particular day shall be equal to the product of the cumulative imbalance quantity calculated as stipulated in sub-regulation 4 and the imbalance charge per MMBTU specified in the access arrangement.

(7) The daily imbalance gas quantities shall be settled between the shipper and the authorised entity every fortnight considering actual daily metered amounts for industrial, commercial and CNG segments and assuming a mutually agreed daily consumption quantity of gas for domestic segment; the methodology for the settlement shall be specified in the access arrangement. The reconciliation with actual metered quantity for the domestic segment shall be as agreed in the access arrangement between the shipper and the authorised entity.

(8) Maintenance of escrow account

(a) There shall be established an escrow account to be maintained by the Board from the date of the commencement of these regulations, in which there shall be credited all charges received by the authorised entity on account of imbalances and overruns.

(b) The authorised entity shall raise a separate invoice towards imbalance and overrun charges, including applicable taxes and levies. The authorised entity shall deposit the taxes and levies with the concerned authorities.

(c) The authorised entity shall make all reasonable efforts for recovering the imbalance and overruns charges referred to in sub-regulation 6 from the shipper within the period it allows shipper to pay its transportation charges.

(d) The authorised entity shall deposit the amounts received by it from the shipper on account of the charges referred to in sub-regulation 6 (excluding taxes and levies) into the escrow account maintained by the Board within a period of fifteen days from the end of the calendar quarter during which such amounts were received by it along with such details thereof as the Board may require from time to time.

Provided that the authorised entity is not allowed to retain or deduct any amount (except for taxes and levies) received by it except the claim approved by the Board under clause (h).

(e) The authorised entity shall submit to the Board month-wise, Geographical Area-wise and shipper-wise details of such charges as are recoverable from each shipper, amounts received from the shippers and the amounts due from shippers and its reconciliation with the amount deposited in accordance with provisions of clause (d), quarterly within a period of sixty days from the end of each quarter along with a certificate from a Chartered Accountant certifying such details and further, at the end of each financial year, an annual certificate containing the said details shall be submitted by the authorised entity to the Board along with the certificate for the fourth quarter.

(f) The authorised entity may claim from the escrow account maintained by the Board the amounts incurred by it towards its contractual obligations with reference to supply or pay and system

management of the CGD network due to such imbalances created by the shippers:

Provided that such claim shall not exceed the amount deposited by him in the escrow account.

(g) The claim under clause (d) may be submitted annually by the authorised entity to the Board within 60 days of the end of each financial year with details such as details of amounts incurred by it, its bank account details, Permanent Account Number and detailed rationale of such claim, along with a certificate from a Chartered Accountant certifying such details.

(h) The Board shall consider such claims on merits and may seek such further information as it may deem fit and the Board shall communicate the amount of claim approved to the authorised entity within 60 days from receipt of complete information, which may be deducted by the authorised entity from the subsequent deposits to be made by it into the escrow account only after specific written approval by the Board.34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(i) The balance amount available in the escrow account, after the eligible withdrawal by the authorised entity, under clause (h) may be utilised in such a manner and for such purposes as may be specified by the Board.

16. Hourly delivery, off-take and receipt rates:

(1) The MDR, MOR and the MRR, as well as the authorised deviations from the hourly scheduled rates for which the shipper shall not have to pay any charges, shall be specified in the access arrangement.

(2) The charges for deviations in hourly delivery and off-take rates that exceed these limits shall be

specified in the access arrangement:

Provided that the shipper shall not be required to pay any charges for deviations in hourly delivery and off- take rates that exceed the limits specified in the access arrangement for the first sixty days of commencement of its access to the entry and exit points capacity on the CGD network if the shipper has booked capacity under regulation 5.

17. System Use Gas (SUG), Lost and Unaccounted for Gas (LUAG):

The authorised entity shall absorb SUG and LUAG, if any, and shall not pass on any liability on this

account to the shipper:

Provided that the authorised entity shall be free to arrange the SUG and LUAG from any source.

18. Line Pack (LP):

The authorised entity shall arrange and absorb the LP on its own and shall not pass on any liability on this account to the shipper.

19. Planned maintenance:

(1) The authorised entity shall intimate to the shipper on non-discriminatory basis of its maintenance plan for a defined period well ahead of time, as agreed in the access arrangement, identifying those entry and exit points where natural gas flows may be restricted by such maintenance, the extent of the restrictions and the time of occurrence. The authorised entity shall plan such maintenance so as to minimise disruption to regular gas supply.

(2) The planned maintenance shut down period for any customer, in all the segments, except domestic PNG, shall not exceed the cumulative period of ten days in any calendar year. The service obligations specified in the Petroleum and Natural Gas Regulatory Board (Authorising Entities to Lay, Build, Operate or Expand City or Local Natural Gas Distribution Networks) Regulations, 2008 and other relevant regulations shall prevail in respect of domestic PNG customers.

20. Force majeure:

Force majeure shall be governed by the contract between the authorised entity and shipper.

21. Operating procedures and emergencies:

(1) The operating procedures to be followed by the authorised entity and the shipper during regular operations as well as in the event of an emergency shall be included in the access arrangement.

(2) An emergency may exist—

(a) by reason of a leakage, or a suspected leakage, of gas; or

(b) in following circumstances, namely:—

(i) the safety of the network is at risk;

(ii) the safe conveyance of gas through the network is at risk;

(iii) gas conveyed by the network is at such a pressure or of such a quality as to constitute, when supplied to the customer‘s premises, a danger to life or property; or

(iv) any other circumstances reasonably believed by the authorised entity to constitute an emergency which, for the avoidance of doubt, may include circumstances upstream of an entry point, and, where the context requires, a reference to an emergency includes the event or circumstance which may give rise to such emergency.

(3) The authorised entity shall take steps to restore normal operations of the network as soon as reasonably possible after an emergency. Restoration of services to the various customer segments in case of emergencies or disruptions or interruptions in the CGD network shall be carried out in the following order[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 35 of priority, namely:—

(a) domestic PNG customers;

(b) essential services, like hospitals, clinics, milk supplies;

(c) CNG customers;

(d) Others.

22. Confidentiality of information:

All documentation, information, data, submissions, comments, etc. disclosed, delivered or exchanged whether in writing or otherwise by or between any entity, authorised entity, shipper or any other party either in connection with or in consequence of the requirements of these regulations shall be regarded and treated as confidential and shall not be disclosed either in full or part, including the contents and copies thereof in any form except in connection with any proceedings in any court, Board or other regulatory authorities, or as may be required under any law, unless such documentation, information, data, submissions, comments, etc. is already in public domain.

23. Miscellaneous:

(1) The Board shall have power to issue clarifications with regard to these regulations and in case of any dispute, the clarification given by the Board shall be final and binding.

(2) If any question arises as to the interpretation of these regulations, the same shall be decided by the Board.

24. Repeal:

Petroleum and Natural Gas Regulatory Board (Access Code for City or Local Natural Gas Distribution Networks) Regulations, 2011 shall stand repealed, except as respect things done or omitted to be done under so repealed regulations.

Schedule-I Provisions for Access Arrangement (See regulation 2(1)(a))

1.0 Access arrangement provisions.

This schedule specifies the provisions which shall be complied by the authorised entity while formulating its standardised access arrangement with shippers, in addition to the other requirements of these regulations.

Authorised entity shall publish its standard format of such arrangement on its website within forty-five days of declaration of its CGD network as common carrier or contract carrier.

2.0 Services.

The access arrangement shall contain the following services to be provided by the authorised entity to the

shipper:—

(a) Receipt of gas at entry point;

(b) Transportation of gas from entry point to exit point;

(c) Delivery of gas at exit point;

(d) Measurement of gas quantity, quality, pressure, temperature and any other parameter for the purpose of metering, billing, operational and safety requirements of CGD network;

(e) Maintenance of city or local natural gas distribution network including all associated material, equipment and devices installed to service the customers;

(f) Managing shipper‘s gas inventory in the CGD network.

Authorised entity may provide such other services to shipper as may be requested in writing by the shipper and agreed to between authorised entity and shipper in relation to the CGD network.

3.0 „Know Your Shipper‟ submission to authorised entity and guarantees. a) Shipper shall be required to submit the ‗Know Your Shipper (―KYS‖) information to the authorised entity, as may be reasonably required by him, for establishing the authenticity of the shipper. However, this process shall be dispensed with in respect of an existing authorised entity for any CGD network,

provided such authorisation has not been terminated or cancelled by the Board. The KYS process may be completed before submission of application by the shipper requesting capacity booking. Unless36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] shipper‘s KYS has already been submitted by him and accepted previously by the authorised entity, authorised entity shall ask the shipper to submit such information at the time of capacity booking. The process of KYS shall be completed within a period of fifteen days from the date of initiation thereof.

(b) Shipper shall provide and maintain payment guarantees equivalent to sixty days maximum daily quantity (MDQ) to the authorised entity in form of irrevocable revolving unconditional standby letter of credit or any other instrument as per mutual agreement. In case of gas supply to domestic consumers, the shipper shall provide payment security of forty-five days of average gas consumption in the form of mutually agreed financial instrument in order to avoid any disconnection of supply to this segment in case of failure to supply gas by the shipper.

4.0 Obligations of shipper and authorised entity.

Obligations of the shipper and authorised entity shall include those specified in regulation 7.

5.0 Facilities at the entry point and exit point.

(a) The access arrangement shall list out the facilities to be provided by the authorised entity to the shipper.

(b) The access arrangement shall indicate if the authorised entity or the shipper owns, maintains and operates all facilities at the entry point and exit point.

(c) Authorised entity shall have reasonable access as per regulation 9 for implementing the provisions of the access arrangement and other relevant notified regulations under the Act. The shipper, upon reasonable notice may inspect entry point and exit point facilities of the authorised entity at its own costs.

(d) Authorised entity and shipper shall preferably adhere to the standard time of 0600 hrs, followed by the industry, for the purpose of measurement at the respective locations.

(e) The maintenance of the facilities, whether owned by the shipper or by the authorised entity, shall be done periodically in accordance with the relevant provisions of regulation 20 and other relevant regulations notified under the Act.

(f) The charges for additional facilities as may be required either by shipper or by authorised entity, including automation at entry point or exit point, shall be borne by the party which requires such facilities.

(g) In case of proven acts of pilferage or misconduct by the shipper or shipper‘s customers, the authorised entity shall have the right to suspend or disconnect the supply of natural gas under intimation to the shipper citing valid reasons for the same. The shipper shall thereafter ensure that the gas reconciliation differences are paid to the authorised entity before reinstating the supply of gas.

6.0 Service obligations.

(a) Metering.

The rights, interest, covenants and obligations of shipper and authorised entity in respect of the measurement and analysis of gas transported in city or local natural gas distribution network by authorised entity shall be as set out in authorised entities code of practice for metering.

Code of practice of the authorised entities for metering shall comply with the Petroleum and Natural Gas Regulatory Board (Code of Practice for quality of Service for city or local Natural Gas Distribution Networks) Regulations, 2010, the Petroleum and Natural Gas Regulatory Board (Technical standard and Specifications including Safety Standards for City or Local Natural Gas Distribution Networks) Regulations, 2008 and all other laws and regulations. The authorised entity shall provide metering facilities at entry point at the cost of shipper or as agreed in the access arrangement. The measuring equipment shall be installed and maintained by authorised entity to measure the quantity of gas— i. received into CGD network at each entry point; and ii. delivered through each exit point.

Authorised entity shall make provision for the measurement of quality of gas at each entry point or use the facility provided by the upstream pipeline service provider or gas supplier.

In case of any dispute on the quality of gas at the exit point, measure the same through mutually acceptable methodology.

In case the shipper complains of any fault in the meter of authorised entity, the expenses on checking the fault and correcting the same shall be borne by the authorised entity if any fault is found during checking, otherwise such expenses shall be borne by the shipper.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 37 The design of the metering facility shall comply with all applicable laws and regulations as well as with authorised entity‘s code of practice for metering.

(b) Alternative ownership of measuring equipment.

Alternative ownership of the measuring equipment, if required, shall be mutually agreed between authorised entity and the shipper in the access arrangement. Authorised entity may, where necessary, undertake checks on the measuring equipment owned by shippers.

(c) Validation and calibration.

The process and procedure for the validation and calibration to be carried out on the measuring equipment shall be in accordance with the authorised entity‘s code of practice for metering.

The party responsible for the operation and maintenance of measuring equipment shall validate and calibrate such equipment at its own expense as and when deemed necessary and as may be prescribed in authorised entity‘s code of practice for metering.

Before carrying out validation or calibration, as the case may be, on its measuring equipment, authorised entity shall invite relevant shippers to witness the process. However, such validation or calibration shall not be stopped or withheld or postponed due to non-availability of the shipper.

In the event there is a dispute on the result of the validation or calibration of measuring equipment, the shipper shall notify the authorised entity within seven days from the date of validation.

Authorised entity may instruct an independent expert to verify the validation. If the expert finds the validation to be accurate, then, the shipper shall bear the cost of said verification by the independent expert. In case, the validation of measuring equipment is found inaccurate, the authorised entity shall not only bear the entire cost of the exercise but shall also compensate the shipper towards losses to the extent of error from the date of dispute), if any, arising due to faulty measurement in the next billing cycle.

(d) Operation and maintenance of the measuring equipment.

Entity owning the measuring instrument shall be responsible for the operation and maintenance of all measuring equipment in accordance with the code of practice for metering of the authorised entity.

However, in case of entry point and in case of industrial and commercial customers, wherein the cost of measuring equipment is borne by the shipper, the authorised entity shall charge for the installation, operation and maintenance (including necessary replacements if any) of the measurement facility as per mutual agreement.

7.0 Gas quality.

(a) Gas specification and pressure.

All gas delivered or to be delivered by shipper at entry point for distribution through city or local natural gas distribution network by authorised entity shall confirm to gas parameters as per regulations.

All gas entering CGD network shall be within the range of CGD operating pressure and temperature.

(b) Off-specification gas.

(i) In the event that gas to be delivered at any entry point does not comply with gas specification as per Schedule-VI (Off-specification gas), shipper shall inform authorised entity promptly of a deviation from gas specification.

(ii) Authorised entity shall have the right to refuse off-specification gas at entry point, but otherwise may accept such off-specification gas.

(iii) If gas received at entry point is off-specification gas, authorised entity shall have the right to suspend (completely or partially) receipt of gas from shipper with immediate effect until authorised entity is satisfied that gas which shipper is able to deliver to city or local natural gas distribution network is within gas specification.

(iv) Notwithstanding the above, in the event off-specification gas has entered into CGD network either by one or more shipper or authorised entity, authorised entity may make enquires to other shippers as to whether the shippers or its end-user and customer is willing to accept the off-specification gas.

(v) Such Shippers shall use reasonable endeavour to accept or may refuse to take delivery of off- specification gas at exit point.38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(vi) Authorised entity may dispose of off-specification gas that has entered into CGD network if it is unsafe for the integrity of the network, in a manner deemed fit by authorised entity, in order to protect CGD network and other facilities.

(vii) The cost incurred to manage the off-specification gas shall be borne by shipper who injected such gas into CGD network. The off-specification gas charges so determined by the authorised entity shall be cost neutral.

8.0 System integrity, discipline and grid management.

(a) Nomination.

(i) Shipper shall notify authorised entity about quantities of gas which shipper intends to deliver at each entry point and receive at each exit point of the CGD network on a day (D).

(ii) Shipper may also re-submit nomination on the day, in case, there be any changes to shipper‘s gas delivery requirements (intra-day nomination) and the same may be considered by the authorised entity on reasonable endeavour basis.

(iii) Shipper shall comply with detailed nomination procedure which is as per the access arrangement. A nomination shall— A. specify day or days to which it relates;

B. specify nominated quantity;

C. identify the end-user which shall off-take the corresponding quantity of gas from the CGD network; and D. specify the entry point and exit point.

(iv) In addition to the above, shipper needs to provide annual estimates and weekly nomination in line with authorised entity‘s operating practice.

(v) In the long term, the nomination process shall be as flexible for shippers as is physically possible. There shall be a balance in the principle of flexibility against the cost of introducing new nomination procedures (both in terms of initial systems and set-up costs and any increase in on-going administrative costs or complexity).

(b) Allocation and scheduling.

Allocation is a mathematical arrangement whereby authorised entity allocates capacity to each shipper in a CGD network to transport natural gas from a single or a combination of entry point to a single or combination of exit points and schedule the proper share of the quantity of gas measured from the relevant entry point or exit point.

(i) Allocation process.

Authorised entity shall allocate entry point capacity and exit point capacity among shippers measured in Million British Thermal Unit (MMBTU).

(ii) Scheduling process.

Authorised entity shall allocate entry point quantities, based on the actual quantity of gas received at the entry point for the shipper and exit point quantities, among shippers after actual gas transport day.

Shipper acknowledges that receipt of gas at entry point or delivery of gas at exit point may not exactly match the nomination of intra-day nomination made in respect of it and consequently under delivers and over delivers of gas may occur.

All of entry quantity at entry point and exit quantity at each exit point shall be allocated to shippers regardless of the reason for any such under delivers or over delivers with respect to nominations.

(iii) Allocation and scheduling data.

Authorised entity shall process the data and inform shippers; allocated quantity including overrun, variance and imbalance. Authorised entity shall not disclose such data to other shippers.

Under normal operations, the allocated data shall be based on confirmed nomination, but when capacity curtailment occurs, the allocated data shall be based on the confirmed curtailment quantity imposed by authorised entity.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 39 Authorised entity shall make available the data to relevant shipper on a daily basis.

(iv) Calculation of Scheduled quantity.

Scheduled exit quantity shall be calculated by authorised entity in accordance with the regulation 5 (4).

(c) Over-runs.

(i) Overruns philosophy and principles.

An overrun occurs when a shipper takes gas transportation quantities in excess of scheduled capacity.

All overruns shall be treated as unauthorised and attract unauthorised overrun charges except the overruns authorised in advance if they cause no operational constraints for the authorised entity, e.g. if a shipper requested excess gas transportation quantities for a day, the authorised entity shall authorise the shipper to take such quantities if sufficient capacity were available.

The price of transporting the authorised overrun quantity shall be set beforehand at a rate that shall be— A. high enough, but not more than one point five times the regulated applicable charges so that shippers are not incentivised to rely on overrun service, rather than contracting for firm transmission service; but B. not so high as to be economically inefficient.

The above shall be applied on a uniform, transparent and non -discriminatory basis by the authorised entity.

However, unauthorised overruns shall carry unauthorised overrun charges. Penalising shippers that flow an unauthorised overrun helps to ensure that the market for capacity rights is not disrupted by routine violation of transportation rights.

Capacity overruns, whether authorised or unauthorised, shall in general be discouraged because—

(i) the ability to obtain capacity at short notice from the authorised entity at non penal prices shall tend to underline the value of holding firm capacity rights; and

(ii) Overruns may impose costs, and therefore shippers shall not rely on the use of overruns.

Following principles need to be followed between authorised entity and shippers, namely:—

(a) no charges up to overrun of five per cent of the allocated quantity;

(b) unauthorised capacity overruns attract a significant charge;

(c) when there is spare physical capacity on the network, capacity overruns are authorised by the authorised entity (so long as it imposes no operational constraints and is on best endeavour basis) for a period of one day at a time;

(d) capacity overruns shall not be authorised when there is a shortage of physical capacity; and

(e) authorised capacity overruns are priced so as to discourage shippers from persistently seeking authorisation rather than purchasing capacity in secondary market when such trading is allowed.

(ii) Unauthorised overrun charges.

Shipper must ensure that quantities of gas received at entry point and delivered at exit point in any day do not exceed the maximum daily quantity of the transportation path.

Unauthorised overrun charges = unauthorised overrun quantity x unauthorised overrun rate Unauthorised overrun rate = two hundred per cent. X applicable charge Unauthorised overrun charges shall be calculated independently for each entry and exit point and aggregated.

(d) Balancing

(a) Balancing principles.

An imbalance arises whenever a shippers‘ deliveries at the entry point in any balancing period differ from the off-takes of the customers that the shipper serves at the exit point. This may occur either because demand is higher or lower than expected or because deliveries are higher or lower than expected, or both. Clear objective and efficient arrangement to address imbalances are required.40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(b) Imbalance charges. i. As specified in sub-regulation (6) of regulation 15, the imbalance charges payable by the shipper for any particular day shall be equal to the product of the cumulative imbalance quantity calculated as stipulated in sub-regulation (4) of that regulation and the imbalance rates specified in the access arrangement.

ii. As specified in sub-regulation (7) of regulation 15, the daily imbalance of gas quantities shall be settled between the shipper and the authorised entity every fortnight considering actual daily metered amounts for industrial, commercial and transport segments and assuming a mutually agreed daily consumption quantity of gas for domestic PNG segment; the methodology for the settlement shall be specified in the access arrangement. The reconciliation with actual metered quantity for the domestic PNG segment shall be as agreed in the access arrangement between the shipper and the authorised entity.

iii. Imbalance charge is calculated on the allocated quantity by applying the percentages as specified in sub- regulation (5) of regulation 15 on the following formula.

Daily imbalance charge = cumulative imbalance quantity x imbalance rate Wherein, cumulative imbalance quantity = cumulative imbalance at the end of a day as specified in sub- regulation (4) of regulation 15.

(c) Imbalance rate. i. The negative imbalance rate.

The negative imbalance quantities in excess of percentages as specified in sub-regulation (5) of regulation 15 shall be calculated at the rate of one hundred twenty percent of the highest cost of gas in

the authorised entities network on the day of imbalance occurrence:

Provided for the negative imbalance quantities up to the percentages as specified in sub-regulation (5) of regulation 15 shall be set-off as per provisions of curing specified in sub-regulation (5) of regulation 15.

ii. The positive imbalance rate.

The Positive imbalance quantities in excess of percentages as specified in sub-regulation (5) of regulation 15 shall be calculated at the rate of one hundred per centof the lowest cost of gas in the

authorised entities network on the day of imbalance occurrence:

Provided that the Positive imbalance quantities up to the percentages as specified in sub-regulation (5) of regulation 15 shall be set-off as per provisions of curing specified in sub-regulation (5) of regulation 15.

(e) Variance charges.

The variance charges are the charges against the deviations in hourly delivery schedule rate of gas.

Allowable limits with respect to the variance and the corresponding charges shall be paid by the shipper to the authorised entity as per the mutually agreed terms and conditions and rates in access arrangement.

9.0 Statutory levies All statutory levies incurred by the authorised entity during the provision of any service for shipper shall be borne by the shipper.

10.0 Other charges Authorised entity‟s shortfall charges The authorised entity shall pay adequate compensation to the shipper in case the authorised entity is unable to provide capacity up to eighty percent of the nominated quantity calculated on a monthly basis unless there is a planned maintenance, breakdown, system or network failure, third party damage, force majeure or any emergency or any other issues as specified in the access arrangement between the shipper and the authorised entity.

The compensation shall be agreed between the authorised entity and the shipper, subject to a minimum of rupees fifteen per MMBTU in respect of shortfall in capacity provided for PNG and rupees one per kilogram of shortfall in capacity provided for CNG.

11.0 Invoicing and payment Authorised entity and the shipper shall mutually agree the billing cycle, billing date, credit period, set- off and adjustment and dispute provisions, consequences of delayed and non-payment as may be reasonable and in line with the prevalent industry practice.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 41

12.0 Communication

(a) Introduction A clear and well understood communication procedure is essential for parties to react in a timely manner especially in emergency situation in order to protect lives and properties and to minimise gas supply interruptions. This shall help to establish a good rapport and relationship as well as foster mutual understanding and co-operation between authorised entity and shippers in meeting goal of ensuring the safe, reliable and efficient operations of city or local gas distribution network.

Authorised entity and shipper shall establish the communication protocol that shall guide authorised entity and shipper during normal and emergency situation. This protocol shall be adhered to all times to ensure safe, reliable and efficient operations of the CGD network.

(b) Gas management system Authorised entity may secure the establishment and operations of a web-based, gas management system

(GMS) which provides for an electronic transfer of information between authorised entity and shipper.

Authorised entity and shipper may communicate with each other for purposes of the daily operations and monitoring of city or local gas distribution network by means of GMS.

The information provided by authorised entity through GMS shall be limited only to the relevant shipper‘s portfolio.

Authorised entity may provide shipper with access and use of the following— i. Shipper‘s portfolio in GMS; ii. Software installed in respect of the GMS; and iii. Manuals or any materials provided by authorised entity in respect of the GMS.

13.0 Curtailment

(a) Introduction Authorised entity may deem it necessary to curtail services in CGD network on a day in the event capacity to transport the total quantity of gas nominated by all shippers under the access arrangement is insufficient and such curtailment shall not have any financial implications on the authorised entity.

(b) Curtailment for force majeure Authorised entity may curtail provision of services to shipper if— A. An event of force majeure occurs; and B. as a result of the event of force majeure, the scheduled capacity of CGD network is constrained so that authorised entity cannot transport the quantities of gas scheduled.

C. Curtailment for operational or safety reasons. Authorised entity may curtail deliveries to shipper if it considers, in its discretion, it is necessary doing so— i. for maintenance, replacement, installation or repair of CGD network or associated facilities including entry point and exit point, interconnections, and district regulating stations

(DPRS); ii. because of damage to, or an outage on, a city or local gas distribution network segment or associated facility used to provide services to shipper giving rise to the need to curtail.

(c) Curtailment of emergency Authorised entity may curtail deliveries to shipper if it considers, at its discretion, it is necessary to do so by reason of emergency, giving rise to the need to curtail.

The existence of an emergency shall be determined by authorised entity irrespective of the cause of emergency or whether authorised entity or any other person may have caused or contributed to the said emergency.

The procedure applicable in the event of emergency shall be set out in the access arrangement and communication protocol agreed between the parties.

(d) Priority of services for curtailment Authorised entity may curtail the provision of services to shipper to meet its obligations to other shippers.

website based open access system for applying for booking of capacity on common carrier or contract carrier basis:

1. The authorised entity shall maintain an online portal on which applications for booking common carrier or contract carrier capacity may be submitted by the shipper.

2. The authorised entity‘s website shall allow booking of capacity by providing an easily accessible link in the form CGD capacity booking- Apply now- new shipper/ existing shipper.

3. In case of a new shipper, a link for submission of KYS documents along with an online application form for capacity booking shall be made available which shall be duly filled in with the prescribed details by the shipper and submitted. Following this, a unique application number shall be generated along with email confirmation of submission of application.

4. In case of an existing shipper seeking to book capacity, such shipper shall login with its registered ID and password and follow the link for new request for online requisition of CGD network capacity booking. Upon filling of the application form for new request with the requisite details, the existing shipper shall receive a unique application number along with an email confirmation of submission of application.

5. The authorised entity, upon receipt of application from a new shipper shall assess whether its CGD network is/ can be connected to the delivery point of the end customer. If the CGD network cannot be connected to the delivery point, the same has to be communicated to the shipper.

6. If the CGD network can be connected to the delivery point of the customer, the authorised entity shall verify whether adequate common carrier capacity is available on its network to accommodate the request of the shipper.

7. If there is adequate common carrier capacity available, requisitions shall be processed online in a transparent non-discriminatory manner and in cases where the booking for capacity received on a particular day is more than the available common carrier or contract carrier capacity, such common carrier or contract carrier capacity shall be allotted to the entities from whom booking has been received as per the Regulation 5 (4).

8. The terms and conditions for access shall be as per the Access Arrangements guidelines provided in Schedule-I. Once the capacity is allotted, the shipper shall be allowed to access the capacity that has been allotted to it in accordance with these Regulations.

9. If there is no available common carrier or contract carrier capacity, the application shall not be processed further and closed.

10. A system generated email shall be sent at all stages intimating the developments.

Schedule-V (see regulation 5(9)) Format for maintaining records of applications for bookings and allocation of capacity in CGD network by an authorised entity
