36) के भाग V के साथ पठित धारा 178 के अधीि प्रित्त िजियों तथा इस जिजमत्त सामर्थययकारी सभी अन्द्य िजियों का प्रयोग करत े हुए तथा पूि य प्रकािि के पश्चात ् केन्द्रीय जिद्युत जिजियामक आयोग (अंतर-राजययक पारेषण प्रभारों और हाजियों की िेयररंग) जिजियम, 2020 (इसके बाि “मलू जिजियम” के रूप में संिर्भयत) को सिं ोजधत करते हुए जिम्नजलजखत जिजियम बिाता ह,ै अथातय ्:-

1. संजिप्त िाम तथा प्रारंभः

(1) इि जिजियमों का संजिप्त िाम केन्द्रीय जिद्युत जिजियामक आयोग (अंतर-राजययक पारेषण प्रभारों और हाजियों की िेयररंग)(तीसरा संिोधि) जिजियम, 2023 ह।ै

(2) ये जिजिमय आयोग द्वारा िासकीय रािपत्र म ें प्रकािि की जतजथ स े प्रिृत होंगे ।

2. मूल जिजियमों के जिजियम 5 के खंड (3) के उप-खंड (घ) में जिम्नजलजखत परंतुक अतं िेजित दकया िाएगाः “परंत ु यह दक िहााँ जििेष प्रििे को जिद्युत की आपूर्त य के जलए जियोजित अंतर-प्रािेजिक एचिीडीसी पारेषण प्रणाली का प्रचालि, प्रणाली आिश्यकताओं के कारण जिपरीत दििा म ें जिद्युत पहुचाँ ाि े के जलए दकया िाता ह,ै ऐसी पारेषण प्रणाजलयों के राष्ट्रीय घटक म ें जिचार दकए िािे िाले िार्षयक पारेषण प्रभारों का प्रजतित, इि जिजियमों के जिजियम 6 के खडं (1) के उप-खंड (क) के अिुसार 30% या इससे अजधक होगा।” 6837 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

3. मूल जिजियमों के जिजियम 6 के खंड (1) के उप-खंड (क) को जिम्नािुसार प्रजतस्ट्थाजपत दकया िाएगा: “(क) जिजियम 5 के खंड (3) के उपखण्ड (क), (ख) और (ग ) के अधीि किर दकये गए एचिीडीसी पारेषण प्रणाजलयों के जलए िार्षयक पारेषण प्रभारो के जसिाय संबंजधत ित्रे के जलए जिद्युत की आपूर्तय के जलए जियोजित एचिीडीसी पारेषण प्रणाजलयों की िार्षयक पारेषण प्रभारों के 70 प्रजतित को िाजमल करत े हुए एचिीडीसी (आरसी -एचिीडीसी) का प्रािेजिक संघटक:

परंत ु यह दक िहााँ जििेष प्रििे को जिद्युत की आपूर्त य के जलए जियोजित अंतर-प्रािेजिक एचिीडीसी पारेषण प्रणाली का प्रचालि, प्रणाली आिश्यकताओं के कारण जिपरीत दििा म ें जिद्युत पहुचाँ ाि े के जलए दकया िाता ह,ै िहााँ प्रािेजिक घटक और राष्ट्रीय घटक म ें जलए िाि े के जलए ऐसी पारेषण प्रणाजलयों के िार्षयक पारेषण प्रभारों के प्रजतित को जिम्नािुसार पठरकजलत दकया िाएगाः एचिीडीसी (% में) = (जिपरीत दििा म ेंजिद्युत प्रिाह की मगे ािाट िमता / अग्रदिि दििा में जिद्युत प्रिाह की आर मेगािाट िमता)x100 िहााँ एचिीडीसी (% में) 30% से अजधक ह,ै एचिीडीसी के तििुरूप िार्षयक पारेषण प्रभारों को राष्ट्रीय आर आर घटक म ें जलया िाएगा और िषे को प्रािेजिक घटक में। िहााँ एचिीडीसी (% में) 30% के बराबर या उससे कम ह,ै िार्षयक पारेषण प्रभारों के 30% को राष्ट्रीय घटक म ें आर जलया िाएगा और 70% को प्रािेजिक घटक म:ें परंतु यह और दक जिपरीत दििा में जिद्युत प्रिाह की मेगािाट िमता को ऐसी िमता के बराबर के प्रिाह के जलए िाजस्ट्तिक जिद्युत के माध्यम से एिएलडीसी द्वारा सत्याजपत दकया िाएगा; और” हरप्रीत ससंह प्रथु ी, सजचि [जिज्ञापि-III/4/असा./516/2023-24] िोटः

(1) केन्द्रीय जिद्युत जिजियामक आयोग (अंतर-राजययक पारेषण प्रभारों और हाजियों की िेयररंग) जिजियम, 2020 भारत के रािपत्र (असाधारण) सं.243 के भाग III, खंड 4 म ें दििांक 01.07.2020 को प्रकाजित हुए थे।

(2) केन्द्रीय जिद्युत जिजियामक आयोग (अंतर-राजययक पारेषण प्रभारों और हाजियों की िेयररंग) (पहला संिोधि) जिजियम, 2023 भारत के रािपत्र (असाधारण) सं.149 के भाग III, खंड 4 में दििांक 01.03.2023 को प्रकाजित हुए थे।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 CENTRAL ELECTRICITY REGULATORY COMMISSION

NOTIFICATION New Delhi, the 26th October, 2023 No. L-1/250/2019/CERC1.— In exercise of the powers conferred under Section 178 read with Part V of the Electricity Act, 2003 (36 of 2003), and all other powers enabling it in this behalf, and after previous publication, the Central Electricity Regulatory Commission hereby makes the following regulations to amend the Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) Regulations, 2020 (hereinafter referred to as “the Principal Regulations”), namely:

1. SHORT TITLE AND COMMENCEMENT:

(1) These regulations may be called the Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) (Third Amendment) Regulations, 2023.

(2) These regulations shall come into effect from the date of publication in gazette.

2. The Following Proviso Shall Be Inserted In Sub-Clause (D) Of Clause (3) Of Regulation 5 Of The Principal

Regulations: “Provided that where an inter-regional HVDC transmission system planned to supply power to a particular region is operated to carry power in the reverse direction due to system requirements, the percentage of Yearly Transmission Charges of such transmission systems to be considered in the National component shall be 30% or more in accordance with sub-clause (a) of Clause (1) of Regulation 6 of these regulations.”

3. Sub-clause (a) of clause (1) of regulation 6 of the principal regulations shall be substituted as follows: “(a) Regional Component of HVDC (RC-HVDC) comprising of 70% of Yearly Transmission Charges of HVDC transmission systems planned to supply power to the concerned region, except HVDC transmission systems covered under sub clauses (a), (b) and (c) of Clause (3) of Regulation 5:

Provided that where an inter-regional HVDC transmission system planned to supply power to a particular region is operated to carry power in the reverse direction due to system requirements, the percentage of Yearly Transmission Charges of such transmission systems to be considered in the Regional component and

the National component shall be calculated as follows:

HVDC (in %) = (MW capacity of power flow in the reverse direction / MW capacity of power flow in the r forward direction) X100 Where, HVDCr (in %) is more than 30%, the Yearly Transmission Charges corresponding to HVDCr shall be considered in the National component and the balance in the regional component.

Where, HVDCr (in %) is equal to or less than 30%, 30% of Yearly Transmission Charges shall be considered in the National component and 70% in the Regional component:

Provided further that the MW capacity of power flow in reverse direction shall be certified by NLDC by way of actual power flow equal to such capacity; and” HARPREET SINGH PRUTHI, Secy. [ADVT.-III/4/Exty./516/2023-24]
