36) के भाग V के साथ पठित धारा 178 के अधीि प्रित्त िजियों तथा इस जिजमत्त सामर्थययकारी सभी अन्द्य िजियों का प्रयोग करत े हुए तथा पूि य प्रकािि के पश्चात ् केन्द्रीय जिद्युत जिजियामक आयोग (अंतर-राजययक पारेषण प्रभारों और हाजियों की िेयररंग) जिजियम, 2020 (इसके बाि “मलू जिजियम” के रूप में संिर्भयत) को सिं ोजधत करते हुए जिम्नजलजखत जिजियम बिाता ह,ै अथातय ्:-

1. संजिप्त िाम तथा प्रारंभः

(1) इि जिजियमों का संजिप्त िाम केन्द्रीय जिद्युत जिजियामक आयोग (अंतर-राजययक पारेषण प्रभारों और हाजियों की िेयररंग)(िसू रा संिोधि) जिजियम, 2023 ह।ै

(2) ये जिजियम दििांक 1.11.2023 से प्रिृत्त होंगे।

2. मलू जिजियमों के जिजियम 2 का सिं ोधि:

(1) मूल जिजियमों के जिजियम 2 के खंड (1) के उप-खंड (झ) के बाि एक िया उप-खंड (झ-i) जिम्नािुसार िोडा िाएगा:

6836 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “(झ-i) ‘डीम्ड सीओडी’ से (क) जिजियजमत टैठरफ तंत्र के अधीि पारेषण प्रणाली या उसके घटक के जलए, केजिजिआ (भारतीय जिद्युत जिड कोड) जिजियम, 2023 के जिजियम 27(1)(ग)(i) के चौथे परंतुक या टैठरफ जिजियम, 2014 के जिजियम 4 के खंड (3) के परंतकु (ii) या टैठरफ जिजियम, 2019 के जिजियम 5 के खडं (2) के अिुसार आयोग द्वारा अिुमोदित पारेषण प्रणाली या उसके घटक की सीओडी, या (ख) टैठरफ आधाठरत प्रजतस्ट्पधायत्मक बोली के अधीि पारेषण प्रणाली या उसके घटक के जलए, केजिजिआ (भारतीय जिद्युत जिड कोड) जिजियम, 2023 के जिजियम 27(1)(ग)(i) के पााँचिे परंतुक के अिुसार पारेषण अिज्ञु जप्तधारी द्वारा घोजषत या दििांक 1.10.2023 से पूिय पारेषण सेिा करार के अिुसार पारेषण अिज्ञु जप्तधारी द्वारा घोजषत पारेषण प्रणाली या उसके घटक की डीम्ड सीओडी अजभप्रते ह।ै ”

3. मलू जिजियमों के जिजियम 11 का सिं ोधिः मूल जिजियमों के जिजियम 11 के खंड (3) म ें िब्िों “इि जिजियमों के अिुबंध-III के खंड (2) के उप-खंड (घ) के अिुसार ऐसे प्रभारों के समायोिि के बाि” को िब्िों “इि जिजियमों के जिजियम 13 के खडं (12) के उप-खंड (ग) के अिुसार समायोिि से पहल े अिुबंध-III के खंड (2) के उप-खंड (घ) के अिुसार ऐस े प्रभारों के समायोिि के बाि” के साथ प्रजतस्ट्थाजपत दकया िाएगा।

4. मलू जिजियमों के जिजियम 12 का सिं ोधिः

(1) मूल जिजियमों के जिजियम 12 के खंड (3) में िब्िों “आगामी जबललंग माह” से पहले जिम्नजलजखत िब्ि िोड े िाएंगेः “इि जिजियमों के जिजियम 13 के खंड (12) के उप-खंडों (ग) और (ि) के अिुसार ऐसे प्रभारों के समायोिि के बाि”।

5. मलू जिजियमों के जिजियम 13 का सिं ोधिः

(1) मूल जिजियमों के जिजियम 13 के खंड (3) के मुख्य उपबंध म ें “में जिलंब होता ह”ै िब्िों के स्ट्थाि पर “हाजसल िहीं की ह”ै िब्िों को रखा िाएगा।

(2) मूल जिजियमों के जिजियम 13 के खंड (12) को जिम्नािुसार प्रजतस्ट्थाजपत दकया िाएगाः “(12) इि जिजियमों के जिजियम 13 के खंडों (3), (6) या (9) के अधीि किर दकए गए मामलों के अलािा के जलए, डीम्ड सीओडी के रूप म ें अिुमोदित या घोजषत अंतर-राजययक पारेषण प्रणाली या उसके घटक के जलए िाईटीसी का व्यिहार जिम्नािुसार दकया िाएगाः (क) अंतर-राजययक पारेषण अिुज्ञजप्तधारी को डीम्ड सीओडी की तारीख से छह (6) मास या िास्ट्तजिक जिद्युत प्रिाह के आरंभ तक, िो भी पहले हो, की अिजध के जलए उसकी अतं र-राजययक पारेषण प्रणाली के िाईटीसी के 50% का भुगताि दकया िाएगा। (ख) अंतर-राजययक पारेषण अिज्ञु जप्तधारी को सातिें (7िें) मास से िास्ट्तजिक जिद्युत प्रिाह के आरंभ तक उसकी अंतर-राजययक पारेषण प्रणाली के िाईटीसी का 100% का भुगताि दकया िाएगा, यदि डीम्ड सीओडी की तारीख से 6 मास की अिजध के अंिर िास्ट्तजिक जिद्युत प्रिाह आरंभ िहीं होता ह।ै (ग) इस खंड के उप-खंडों (क) और (ख) के अधीि प्रभारों को इि जिजियमों के जिजियम 12 के खडं (3) के अिुसार िसूल दकए गए प्रभारों में से संजितठरत दकया िाएगाः परंत ु यह दक इि जिजियमों के जिजियम 12 के खडं (3) के अिुसार िसूली म ें कमी के मामल े में, इस जिजियम के उप-खंडों (क) और (ख) के अधीि भगु ताि की आिश्यकता को परू ा करि े के जलए िेष का भुगताि, इि जिजियमों के जिजियम 11 के खंड (3) के अिसु ार टी-िीएिए और टीिीएिए के आरई अधीि िसलू दकए गए प्रभारों में से दकया िाएगाः[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 परंत ु यह और दक इस जिजियम के उप-खंडो (क) और (ख) के अधीि भुगताि की आिश्यकता को परू ा करि े के जलए टी-िीएिए और टीिीएिए के अधीि िसूल दकए गए प्रभारों म ें कमी के मामल े में, आरई िेष का भुगताि डीएसएम जिजियमों के अधीि जिचलि और आिुषंजगक सेिा पूल खाते म ें से दकया िाएगा। (घ) इस खंड के उप-खंड (क), (ख) और (ग) उस रांसफॉमयर घटक (इि जिजियमों के जिजियम 7 के अधीि यथा पठरभाजषत) के अधीि किर दकए गए पारेषण घटकों के जलए लाग ू िहीं होंगे, जिसे डीम्ड सीओडी की तारीख से रायय के संबंजधत अिाकताय डीआईसी को जबल दकया िाएगा। रांसफॉमयर घटक के अधीि किर दकए गए ऐस े पारेषण घटकों के पथृ क िार्षयक पारेषण प्रभारों की अिपु लब्धता के मामले में, इि जिजियमों के जिजियम 7(1) के अिुसार सीटीयू द्वारा इसका पता लगाया िाएगा। (ङ) यदि कोई अंतर-राजययक पारेषण अिुज्ञजप्तधारी, डीम्ड सीओडी हाजसल कर चुके अन्द्य अंतर-राजययक पारेषण अिज्ञु जप्तधारी की अतं र-राजययक पारेषण प्रणाली म ें जिद्युत प्रिाह के आरंभ में जिलंब के जलए उत्तरिायी ह,ै तो जिलंजबत अतं र-राजययक पारेषण प्रणाली का अतं र-राजययक पारेषण अिुज्ञजप्तधारी अपिी जिलंजबत अतं र-राजययक पारेषण प्रणाली के सीओडी हाजसल करि े तक अपिी पारेषण प्रणाली के िाईटीसी के 50% या डीम्ड सीओडी प्राप्त कर चुकी पारेषण प्रणाली के िाईटीसी के 50%, िो भी कम हो, का भगु ताि करेगाः परंत ु यह दक पारेषण सेिा करार या पार्टययों के बीच लाग ू दकसी अन्द्य करार म ें इसके जिपरीत दकसी उपबंधों के बाििूि, इस खंड के अधीि जिलंजबत अंतर-राजययक पारेषण अिुज्ञजप्तधारी की िेयता प्रभाजित िहीं होगीः परंत ु यह और दक यदि जिलंजबत अंतर-राजययक अिुज्ञजप्तधारी को सीटीयूआईएल के साथ दकए गए पारेषण सेिा करार के अिुसार पारेषण प्रणाली को परू ा करिे में जिलंब के जलए पठरजिधायठरत हिायिा लगाया िाता ह,ै तो ऐस े अंतर-राजययक पारेषण अिुज्ञजप्तधारी द्वारा सीटीयू को भगु ताि दकए गए पठरजिधायठरत हिायिे की राजि को इस खंड के अिुसार जिलंजबत अंतर-राजययक पारेषण अिुज्ञजप्तधाठरयों की िेयता की सीमा तक ऑफसेट दकया िाएगा और िेष राजि को, यदि कोई हो, इि जिजियमों के जिजियम 12 के खंड (3) के अधीि प्रािेजिक पारेषण जिचलि खाते में िमा दकया िाएगा। (च) यदि कोई अंतःराजययक पारेषण अिज्ञु जप्तधारी डीम्ड सीओडी प्राप्त कर चुकी अतं र-राजययक पारेषण प्रणाली म ें जिद्युत प्रिाह के आरंभ में जिलंब के जलए उत्तरिायी ह,ै तो जिलंजबत अंतःराजययक पारेषण प्रणाली का ऐसा अंतः राजययक पारेषण अिुज्ञजप्तधारी, जिलजं बत अंतः राजययक पारेषण प्रणाली के िाईटीसी का 50% या डीम्ड सीओडी हाजसल कर चुकी अतं र-राजययक पारेषण प्रणाली की िाईटीसी के 50% (इस खडं के उप-खंड (घ) के अधीि किर दकए गए पारेषण घटकों को छोडकर), िो भी कम हो, का भुगताि करेगाः परंतु यह दक इस खंड के उप-खंड (घ) के अधीि किर दकए पारेषण घटकों के मामले में, इस उप-खंड के अधीि प्रभारों को अंतःराजययक पारेषण अिुज्ञजप्तधारी पर िहीं लगाया िाएगाः परंतु यह और दक िहााँ जिलंजबत अंतःराजययक पारेषण प्रणाली की िाईटीसी उपलब्ध िहीं ह ै िहा ाँ सीटीयू, अंतर-राजययक पारेषण प्रणाली में समाि अजभजिन्द्यास की सूचक पूंिीगत लागत के आधार पर, इस खडं के उद्देश्य हते ु, ऐसी अंतःराजययक पारेषण प्रणाली के जलए िाईटीसी का पता लगाएगी। (छ) इस खंड के उप-खंडों (ङ) और (च) के अिुसार प्रभारों की जबललंग और िसूली इि जिजियमों के जिजियम 15 के खंड (3) के अिसु ार की िाएगी। (ि) इस खंड के उप-खंड (छ) के अिुसार िसूल दकए गए प्रभारों की प्रजतपूर्त य इि जिजियमों के जिजियम 12 के खंड (3) के अिुसार की िाएगी। (झ) टैठरफ आधाठरत प्रजतस्ट्पधायत्मक बोली के अधीि अतं र-राजययक पारेषण प्रणाली के मामल े में, प्रथम संजििा िषय उस तारीख से आरंभ होगा िब ऐसा पारेषण अिज्ञु जप्तधारी इि जिजियमों के जिजियम 54 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] से 8 के अधीि या इस खंड के उप-खंड (ख) के अधीि िाईटीसी का 100% प्राप्त करिा आरंभ कर िेगा।” हरप्रीत लसंह प्रथु ी, सजचि [जिज्ञापि-III/4/असा./515/2023-24] िोटः

(1) केन्द्रीय जिद्युत जिजियामक आयोग (अतं र-राजययक पारेषण प्रभारों और हाजियों की िेयररंग) जिजियम, 2020 भारत के रािपत्र (असाधारण) सं.243 के भाग III, खंड 4 म ें दििांक 01.07.2020 को प्रकाजित हुए थे।

(2) केन्द्रीय जिद्युत जिजियामक आयोग (अतं र-राजययक पारेषण प्रभारों और हाजियों की िेयररंग) (पहला संिोधि) जिजियम, 2023 भारत के रािपत्र (असाधारण) स.ं149 के भाग III, खंड 4 म ें दििांक 01.03.2023 को प्रकाजित हुए थे। CENTRAL ELECTRICITY REGULATORY COMMISSION

NOTIFICATION New Delhi, the 20th October, 2023 No. L-1/250/2019/CERC.— In exercise of the powers conferred under Section 178 read with Part V of the Electricity Act, 2003 (36 of 2003), and all other powers enabling it in this behalf, and after previous publication, the Central Electricity Regulatory Commission hereby makes the following regulations to amend the Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) Regulations, 2020 (hereinafter referred to as “the Principal Regulations”) namely:

1. SHORT TITLE AND COMMENCEMENT:

(1) These regulations may be called the Central Electricity Regulatory Commission (Sharing of Inter-State Transmission Charges and Losses) (Second Amendment) Regulations, 2023.

(2) These regulations shall come into effect from 1.11.2023.

2. AMENDMENT TO REGULATION 2 OF THE PRINCIPAL REGULATIONS:

(1) A new sub-clause (i-i) shall be added after sub-clause (i) of Clause (1) of Regulation 2 of the Principal

Regulations as under: “(i-i) ‘Deemed COD’ means

(a) for the transmission system or an element thereof under the regulated tariff mechanism, COD of the transmission system or an element thereof approved by the Commission in terms of fourth Proviso to Regulation 27(1)(c)(i) of CERC (Indian Electricity Grid Code) Regulations, 2023 or proviso (ii) of Clause (3) of Regulation 4 of the Tariff Regulations, 2014 or Clause (2) of Regulation 5 of the Tariff Regulations, 2019, or

(b) for the transmission system or an element thereof under the Tariff Based Competitive Bidding, deemed COD of the transmission system or an element thereof, declared by the transmission licensee, in terms of fifth Proviso to Regulation 27(1)(c)(i) of CERC (Indian Electricity Grid Code) Regulations, 2023 or declared by the transmission licensee in terms Transmission Service Agreement prior to 1.10.2023

3. AMENDMENT TO REGULATION 11 OF THE PRINCIPAL REGULATIONS:

(1) The words “after adjustment of such charges as per sub-clause (d) of Clause (2) of Annexure-III to these regulations” in Clause (3) of Regulation 11 of the Principal Regulations, shall be substituted with words “after adjustment of such charges as per sub-clause (d) of Clause (2) of Annexure-III followed by adjustment as per sub-clause (c) of Clause (12) of Regulation 13 of these regulations”.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5

4. AMENDMENT TO REGULATION 12 OF THE PRINCIPAL REGULATIONS:

(1) The following words shall be inserted after the words “billing month” in Clause

(3) of Regulation 12 of the Principal Regulations: “after adjustment of such charges as per sub-clauses (c) and (h) of Clause

(12) of Regulation 13 of these regulations.”

5. AMENDMENT TO REGULATION 13 OF THE PRINCIPAL REGULATIONS:

(1) The words “is delayed” in the main provision of Clause (3) of Regulation 13 of the Principal Regulations shall be substituted with the words “has not been achieved”.

(2) Clause (12) of Regulation 13 of the Principal Regulations shall be substituted as under: “(12) For the cases other than those covered under Clauses (3), (6) or (9) of Regulation 13 of these regulations, the YTC for the inter-State transmission system or element thereof approved or

declared as deemed COD shall be treated as follows:

(a) The inter-State transmission licensee shall be paid 50% of YTC of its inter-State transmission system for a period of six (6) months from the date of deemed COD or till the commencement of actual power flow, whichever is earlier.

(b) The inter-State transmission licensee shall be paid 100% of YTC of its inter-State transmission system from the seventh (7th) month till the commencement of actual power flow, in case actual power flow does not commence within a period of 6 months from the date of deemed COD.

(c) The charges under sub-clauses (a) and (b) of this Clause shall be disbursed from charges collected in terms of Clause (3) of Regulation 12 of these regulations:

Provided that in case of shortfall in the collection in terms of Clause (3) of Regulation 12 of these regulations, to meet the requirement of payment under sub-clauses (a) and (b) of this Regulation, the balance shall be paid from charges collected under T-GNA and TGNA in RE terms of Clause (3) of Regulation 11 of these regulations:

Provided further that in case of shortfall in charges collected under T-GNA and TGNA to RE meet the requirement of payment under sub-clauses (a) and (b) of this Regulation, the balance shall be paid from Deviation and Ancillary Service Pool Account under DSM Regulations.

(d) Sub-clause (a), (b) and (c) of this Clause shall not be applicable for transmission elements covered under the Transformer component (as defined under Regulation 7 of these regulations) which shall be billed to respective drawee DIC of the State from the date of deemed COD. In case of non-availability of separate Yearly Transmission Charges of such transmission elements covered under the transformer component, the same shall be worked out by CTU in terms of Regulation 7(1) of these regulations.

(e) In case an inter-State transmission licensee is responsible for the delay in the commencement of power flow in the inter-State transmission system of another inter-State transmission licensee which has achieved deemed COD, inter-State transmission licensee of the delayed inter-State transmission system shall pay 50% of YTC of its transmission system OR 50% of YTC of the transmission system which has achieved deemed COD, whichever is lower, till its delayed inter-State transmission system achieves COD:

Provided that the liability of the delayed inter-State transmission licensee under this Clause shall not be affected, notwithstanding any provisions to the contrary in the Transmission

Service Agreement or any other Agreement in force between the parties:

Provided further that if the delayed inter-State transmission licensee is levied liquidated damages for delay in completion of the transmission system in terms of the Transmission Service Agreement entered into with CTUIL, the amount of liquidated damages paid by such inter-State transmission licensee to CTU shall be offset to the extent of liability of the delayed inter-State transmission licensees in terms of this Clause and the balance amount, if any, shall be credited into Regional Transmission Deviation account under Clause (3) of Regulation 12 of these regulations.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(f) In case an intra-State transmission licensee is responsible for the delay in commencement of power flow in the inter-State transmission system which has achieved deemed COD, such intra-State transmission licensee of the delayed intra-State transmission system shall pay 50% of YTC of the delayed intra-State transmission system OR 50% of YTC of the inter-State transmission system which has achieved deemed COD (excluding transmission elements covered under sub-clause (d) of this Clause), whichever is lower, till the delayed intra-State transmission system achieves COD:

Provided that in case of transmission elements covered under sub-clause (d) of this Clause, charges under this sub-clause shall not be levied on the intra-State transmission licensee:

Provided further that where YTC of the delayed intra-State transmission system is not available, CTU shall work out the YTC for such intra-State transmission system, for the purpose of this clause, based on the indicative capital cost of similar configuration in the inter-State transmission system.

(g) The billing and collection of the charges in terms of sub-clauses (e) and (f) of this Clause shall be made in accordance with Clause (3) of Regulation 15 of these regulations.

(h) The charges collected as per sub-clause (g) of this Clause shall be reimbursed in terms of Clause (3) of Regulation 12 of these regulations.

(i) In case of inter-State transmission system under Tariff based Competitive Bidding, the first contract year shall commence from the date when such transmission licensee starts receiving 100% of YTC under sub-clause (b) of this Clause or under Regulations 5 to 8 of these regulations.” HARPREET SINGH PRUTHI, Secy.
