NOTIFICATION

Whereas The draft of the following Rules further to amend the Karnataka Excise (Lease of the Right of Retail Vend of Beer) Rules, 1976, was published as required by sub-section (1) of section 71 of the Karnataka Excise Act, 1965 (Karnataka Act 21 of

1966) in Notification No: FD 09 PES 2025 dated:11-02-2026 in part IV-A of the Karnataka Gazette (Extraordinary) No.147 dated:11-02-2026 inviting Objections and Suggestions from all persons like to be affection within seven days from the date of its publication in the official Gazette.

And, whereas the said Gazette was made available to the public on 11th February,

2026.

And, whereas no objections and suggestions were received in respect of the said draft by the State Government.

Now, therefore, in exercise of the powers conferred by section 71 of the Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966), the Government of Karnataka hereby makes the following rules, namely:-

(1)2 RULES

1. Title and commencement: - (1) These Rules may be called the Karnataka Excise (Lease of the Right of Retail Vend of Beer) (Amendment) Rules, 2026.

(2) They shall come into force from the date of their final publication in the official Gazette.

2. Amendment of Rule 3:- In the Karnataka Excise (Lease of the Right of Retail Vend of Beer) Rules, 1976, (hereinafter referred to as the “said rules”), in rule 3, for the words “Deputy Commissioner”, the words “Deputy Commissioner of Excise” shall be substituted.

3. Amendment of Rule 4:- In the said Rules in rule 4,-

(i) for the words “Deputy Commissioner”, the words “Deputy Commissioner of Excise” shall be substituted.

(ii) the following proviso shall be inserted, namely:- “Provided that, the Deputy Commissioner of Excise shall grant lease to vend Bulk Beer to a holder of a licence in Form CL-4 or Form CL-6A or Form CL-7 or Form CL-9 or Form CL-9A or Form CL-17 or Form CL-18 issued under the Karnataka Excise (Sale of Indian and Foreign Liquors) Rules, 1968. Such attached RVB Licences shall be auto generated in electronic mode after payment of the fees specified in rule 5”.

4. Amendment of Rule 4-A:- In the said rules in rule 4-A for the words “Deputy Commissioner”, the words “Deputy Commissioner of Excise” shall be substituted.

5. Amendment of Rule 7:- In the said rules, in rule 7 for the words “Deputy Commissioner”, the words “Deputy Commissioner of Excise” shall be substituted.3

6. Omission of Rule 12:- In the said rules, rule 12 shall be omitted.

7. Amendment of Form II:- In the said rules in Form II: i. in Part-A, for the words and brackets, “Deputy Commissioner…………District (in case of grant of licence)/Deputy Commissioner of Excise……..……District (in case of renewal of licence)”, in two places where they occur, the words “Deputy Commissioner of Excise………District” shall be substituted.

ii. in Part-B, for the words and brackets, “Deputy Commissioner…………District (in case of grant of licence)/Deputy Commissioner of Excise……..……District (in case of renewal of licence)”, occurring at the end, the words “Deputy Commissioner of Excise………District” shall be substituted.
