(2) एव ं (3) द्वारा प्रदत्त शलियों का प्रयोग करत े हुए, केंद्र सरकार पेट्रोलियम लियम, 2002 म ें आगे संशोिि करिे के लिए कलतपय लियमों के लिम्नलिलित मसौदे का प्रस्ताव उसस ेप्रभालवत होि ेवाि ेसभी व्यलियों को सूलित करि ेके लिए, एतद्द्वारा प्रकालशत ककया जाता ह ैतथा एतद्द्वारा यह सिू िा दी जाती ह ैकक उि मसौदा लियमों को शालमि करिे वािे भारत के राजपत्र की प्रलतयां जिता को उपिब्ि करवाए जािे की तारीि से तीस कदिों की अवलि की समालि पर या उसके बाद, उि मसौद े पर लविार ककया जाएगा। उपययुि अवलि के भीतर ककसी भी व्यलि स े प्राि होिे वािी आपलत्तयों और सयझावों पर केंद्र सरकार द्वारा लविार ककया जाएगा। आपलत्तयां और सयझाव, यकद कोई हों, को संययि सलिव (एम एंड ओआर), पेट्रोलियम और प्राकृलतक गैस मंत्रािय, िई कदल्िी-110001 को संबोलित ककए जा सकत ेह ैं या इसे js.mkt- png@gov.in ईमेि पर भजे े जा सकते हैं। 6817 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] मसौदा लियम

1. इि लियमों को पेट्रोलियम (संशोिि) लियम, 2026 कहा जा सकता है।

2. पेट्रोलियम लियम, 2002 म,ें -

(1) लियम 2 म,ें उप-लियम (1) म,ें - (क) िडं (x) के बाद, लिम्नलिलित िंड को अंतःस्थालपत ककया जाएगा, अथाुत् :- “(xक) “लजिा अलिशमि अलिकारी” स े ऐसा अलिकारी अलभप्रेत ह,ै लजसे राज्य सरकार द्वारा ककसी लजिे के लिए अलिशमि एव ंआपातकािीि सेवाओं का प्रभारी िालमत ककया गया हो, िाह े उसे ककसी भी िाम स े पयकारा जाता हो, और इसके अंतगुत राज्य सरकार द्वारा लजिा अलिशमि अलिकारी के कृत्यों का लिवुहि करि ेके लिए प्रालिकृत कोई अन्य अलिकारी भी सलममलित ह;ै ”;

(ि) िडं (xviक) म,ें “और जो” शब्दों के पश्चात् “ISO 1496 अथवा” शब्द एव ं अंक अंतःस्थालपत ककए जाएंगे;

(2) लियम 13 म,ें (क) उप-लियम (3) म,ें शब्दों “अन्य प्रालिकारी को संदये फीस” के पश्चात् “ई-भयगताि के माध्यम स े अथवा” शब्द अंतःस्थालपत ककए जाएंगे; (ि) उप-लियम (4) म,ें i. िंड (i) म,ें उपिंड (क) म,ें शब्दों "यकद फीस िकद या बकैं ड्राफ्ट द्वारा संदत्त की गई ह"ै , के स्थाि पर “उसी रीलत स े लजस रीलत स े फीस की प्रालि हुई ह”ै शब्दों को प्रलतस्थालपत ककया जाएगा;

ii. िडं (ii) म,ें शब्दों "अलिमाितः वसूिी के छह" के स्थाि पर "आवेदि रद्द करिे के दो" शब्दों को प्रलतस्थालपत ककया जाएगा;

(3) लियम 14(क) के स्थाि पर लिम्नलिलित लियम प्रलतस्थालपत ककया जाएगा, अथातु ् :— “14क. आईएसओ टैंक कंटेिरों का आयात तथा पररवहि. -

(1) कोई भी व्यलि मयख्य लियंत्रक या लियंत्रक स े आयात की अियमलत प्राि ककए लबिा पेट्रोलियम स े भरे हुए अथवा भरे जाि ेके लिए आशलयत ककसी भी आईएसओ टैंक कंटेिर का आयात िहीं करेगा।

(2) उप-लियम (1) के अिीि आयात की अियमलत िाहिे वािा कोई भी व्यलि, पेट्रोलियम एव ं लवस्फोटक सयरक्षा संगठि के ऑििाइि अियज्ञापि पोटुि के माध्यम स,े लिम्नलिलित दस्तावजे ों के साथ मयख्य लियंत्रक या लियंत्रक को प्ररूप 7 क म ें आवदे ि प्रस्तयत करेगा, अथाुत् :— (क) आईएसओ टैंक कंटेिर की पूरी सामग्री को समायोलजत करिे की पयाुि क्षमता सलहत प्ररूप 15 म ेंजारी वैि अियज्ञलि;[भाग II—खण्ड 3(i)] भारत का रािपत्र : असाधारण 3 (ि) लिमाुता की लिरीक्षण, परीक्षण ररपोटु और लडजाइि लित्र, लजिम ें लडजाइि के ब्यौरे, टकैं की पािी की क्षमता, इसकी कफटटंग और आईएसओ टकैं कंटिे र के लिमाुण की सामग्री के लवलिदेशों के लववरण कदए गए हों, जो टीपीआईए द्वारा लवलिवत् प्रमालणत हों;

(ग) टीपीआईए द्वारा जारी हाइड्रोटेस्ट प्रमाण-पत्र और कंटेिर सयरक्षा प्रमाण-पत्र सलहत आवलिक लिरीक्षण और जांि; (घ) मयख्य लियंत्रक या लियंत्रक द्वारा लवलिवत् अियमोकदत सड़क माग ुस ेपररवहि के लिए माउंटटंग ड्राइंग;

(ङ) आयात के बंदरगाह स े अलं तम उपयोग स्थाि तक आईएसओ टैंक कंटेिर की हैंडलिंग और पररवहि के लिए सयरलक्षत प्रिािि प्रकिया; (ि) अििोलडंग के पश्चात् आईएसओ टकैं कंटेिर की वापसी अथवा स्थायी आिार पर भारत म ें उसके प्रलतिारण की अियमालित तारीि के लिए स्व-घोषणा;

(छ) पहिी अियसिू ी के भाग ग म ेंयथा-लिर्दष्टु संवीक्षा शयल्क।

(3) पूणु आवदे ि प्राि होिे पर और सतं यष्ट होिे पर, मयख्य लियंत्रक या लियंत्रक, मयख्य लियंत्रक द्वारा यथालवलहत प्रारूप म,ें अलिकतम तीि वषु की अवलि के लिए विै आयात अियमलत प्रदाि करेगा। परंतय यह कक जहां इस लियम के अिीि भारत में आईएसओ टैंक कंटेिर आयात करिे की अियमलत अियदत्त करिे के लिए आवेदि तथा लियम 75(3) के अिीि भारतीय क्षेत्र के भीतर आईएसओ टैंक कंटेिर म ेंसड़क माग ुस े थोक म ेंपेट्रोलियम "श्रेणी क" या "श्रेणी ि" के पररवहि की अियमलत अियदत्त करिे के लिए आवदे ि एक साथ ककया जाता ह,ै वहां मख्य य लियंत्रक या लियंत्रक, लियम 14क और लियम 75(3) की अपेक्षाओं स े संतष्टय होि ेपर, भारत म ें आईएसओ टैंक कंटेिर आयात करिे और भारतीय क्षेत्र के भीतर आईएसओ टैंक कंटिे र म ें सड़क मागु स े थोक म ें पेट्रोलियम "श्रेणी क" या "श्रेणी ि" का पररवहि करि े के लिए, मयख्य लियत्रं क द्वारा यथालवलहत प्रारूप में, अलिकतम तीि वषु की अवलि के लिए वैि एक संययि अियमलत प्रदाि करेगा।

(4) जहां इस लियम के अिीि ककया गया आवेदि सभी प्रकार स े पूणु है और उसके साथ उसम ें लवलिर्दष्टु सभी दस्तावेज़ संिि हैं, और आवेदि प्रस्तयत करिे की तारीि स े सात कायु कदवस के भीतर ऑििाइि िाइसलें संग पोटुि के माध्यम स े कोई कमी अथवा लिलित आपलत्त संसलू ित िहीं की जाती ह,ै तो उि अवलि की समालि पर अियमलत प्रदत्त मािी जाएगीI”;

(4) लियम 75 म,ें (क) उप-लियम (3) म,ें शब्द 'एक' के स्थाि पर 'तीि' शब्द प्रलतस्थालपत ककया जाएगा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ि) उप-लियम (4) के पश्चात्, लिम्नलिलित उप-लियम अंतःस्थालपत ककए जाएंगे, अथाुत् :— “(5) जहां आईएसओ टकैं कंटिे र का आवलिक परीक्षण/हाइड्रो टस्े ट प्रमाण-पत्र वैि ह,ै वहां उप-लियम (3) के अिीि प्रदाि की गई अियमलत को मयख्य लियंत्रक अथवा लियंत्रक द्वारा, ऑििाइि घोषणा के साथ आवलिक लिरीक्षण एव ंपरीक्षण, लजसमें हाइड्रो टेस्ट प्रमाण-पत्र तथा टीपीआईए द्वारा जारी कंटेिर सयरक्षा प्रमाण-पत्र की प्रलत संिि हो, अलिकतम तीि वषु की अवलि तक अथवा उि प्रमाण-पत्र की वैिता की अवलि तक, इिम ेंस ेजो भी पहि े हो, लवस्ताररत ककया जा सकेगा।

(6) इस लियम की कोई बात, एक बार उपयोग तथा भरिे या लडकैंटेशि के पश्चात् मूि देश को वापस भजे े जािे के लिए आयात ककए गए आईएसओ टैंक कंटेिर म ें पेट्रोलियम श्रेणी ‘क’ या ‘ि’ के बहु-माध्यम (मल्टीमोडि) पररवहि पर िागू िहीं होगी, बशते कक लिम्नलिलित शतें पूरी की जाए:ँ

(i) ट्रेिर िेलसस पर आईएसओ टैंक कंटेिर को माउंट ककए जािे पर, वाहि की लस्थरता सयलिलश्चत की जाएगी।

(ii) वाहि िले सस का रलजस्ट्रीकृत िदाि भार अथवा सकि वाहि भार अथवा सकि संययि भार मोटर वाहि अलिलियम के िागू उपबंिों के अियसार वाहि के रलजस्ट्रीकृत िदाि भार स े अलिक िहीं होगा। प्रत्येक ियरी पर िदाि, एआरएआई प्रमाण-पत्र अथवा समकक्ष प्रमाण-पत्र म ें उलल्िलित उस ियरी की अलिकतम अियमये भार-वहि क्षमता के भीतर होगा।

(iii) पररवहि के दौराि ककसी वाहि पर पेट्रोलियम स ेभरा हुआ केवि एक आईएसओ टैंक कंटिे र ही माउंट ककया जाएगा।

(iv) सड़क मागु द्वारा आईएसओ टैंक कंटेिर वहि करिे वािे वाहि म ें पेट्रोलियम के पररवहि के दौराि षष्ठ अियसूिी म ेंलवलिर्दुष्ट साविालियों का पािि ककया जाएगा।

(5) लियम 106 म,ें (क) उप-लियम (1) म,ें अक्षरों और अंकों “आईएस/आईईसी 60079-26” के पश्चात् “(पृथक्करण अवयवों अथवा संययि संरक्षण स्तरों वािे उपकरण के लिए)” लिह्ि और शब्द अंतःस्थालपत ककए जाएंगे; (ि) उप-लियम (3क) म,ें शब्दों “उपकरण सयरक्षा स्तर (ईपीएि)” के पश्चात् “अथवा इस लियम के उप- लियम (1), (2) और (3)” शब्द और अकं अंतःस्थालपत ककए जाएंगे। (ग) उप-लियम (4) के िंड (i) म,ें शब्दों “सभी आवश्यक आरेिण,” का िोप ककया जाएगा।

(6) लियम 143 के उप-लियम (1) म,ें शब्दों “लिलित म”ें के स्थाि पर “पेट्रोलियम और लवस्फोटक सयरक्षा संगठि के ऑििाइि अियज्ञापि पोटुि के माध्यम स”े शब्द प्रलतस्थालपत ककए जाएंगे।[भाग II—खण्ड 3(i)] भारत का रािपत्र : असाधारण 5

(7) लियम 144 के लिए, लिम्नलिलित लियम प्रलतस्थालपत ककया जाएगा, अथाुत्:- “144.अिापलत्त प्रमाणपत्र -

(1) जहा ंअियज्ञापि प्रालिकारी, यथालस्थलत, मयख्य लियंत्रक या लियंत्रक है, वहां प्ररूप III, XI, XVII, XVIII या XIX म ें अियज्ञलि से लभन्न िई अियज्ञलि के लिए आवेदक, िागू भूलम उपयोग, भवि उपलवलियों तथा अन्य सालं वलिक अपेक्षाओं के अियरूप ककसी रलजस्ट्रीकृत वास्तकय ार द्वारा लवलिवत् प्रमालणत, अियज्ञापि के लिए प्रस्थालपत पररसर की लस्थलत दशािु े वािे स्थि-िक्शे की दो प्रलतयों सलहत, इस आशय का प्रमाणपत्र प्राि करिे के लिए लजिा अलिशमि अलिकारी को आवेदि करेगा कक प्रस्तालवत स्थि के लिए आवेदक को अियज्ञलि प्राि करिे म ेंकोई आपलत्त िहीं है। लजिा अलिशमि अलिकारी, यकद उसे कोई आपलत्त िहीं ह,ै तो आवेदक को ऐसा प्रमाणपत्र प्रदाि करेगा। आवेदक उि प्रमाणपत्र को प्ररूप IX म ें अपिे आवेदि के साथ, अियज्ञापि के लिए प्रस्थालपत पररसर लजस भूलम पर लस्थत ह,ै उस भूलम पर आवदे क के स्वालमत्व अथवा लवलिपूणु कब्जे की वैिता के संबंि में ककसी अलिविा द्वारा जारी लवलिक राय की एक प्रलत सलहत, अियज्ञापि प्रालिकारी को भेजेगा

(2) लजिा अलिशमि अलिकारी द्वारा उप-लियम (1) के अिीि जारी ककए गए प्रत्यके प्रमाणपत्र के साथ लजिा अलिशमि अलिकारी की शासकीय मयद्रा के अिीि उसके द्वारा समयक् रूप स े पष्ठृ ाकं कत प्रस्थालपत स्थि-िक्शे की एक प्रलत होगी।

(3) यथालस्थलत, मयख्य लियंत्रक या लियंत्रक, उप-लियम (1) के अिीि कदया गया प्रमाणपत्र रलहत आवेदि को लजिा अलिशमि अलिकारी को उसके लविारों के लिए लिर्दष्टु कर सकता है।

(4) यकद लजिा अलिशमि अलिकारी उसे लिदेश ककए जािे पर अथवा अन्यथा, यथालस्थलत मयख्य लियंत्रक या लियंत्रक को संसूलित करता ह ैकक लजस अियज्ञलि के लिए आवेदि ककया गया ह ैवह उसकी राय म ेंमंजूर िहीं की जािी िालहए, तो ऐसी अियज्ञलि केन्द्रीय सरकार की मजं ूरी के लबिा िहीं जारी की जाएगी।

(5) लजिा अलिशमि अलिकारी यथालस्थलत, उप-लियम (1) के अिीि अिापलत्त प्रमाणपत्र (एि.ओ.सी.) जारी करिे के लिए अपिी जािं और एि.ओ.सी. जारी करिे या जारी करिे स े इिकार करिे के कायु को यथासंभव शीघ्र, ककन्तय आवेदि की प्रालि की तारीि स े एक मास के भीतर पूरा करेगा।

(6) जहां पेट्रोलियम के भंडारण का स्थाि राज्य के लियंत्रणािीि ककसी पत्ति या हवाई अड्डे या रेि के अलिसूलित क्षेत्र के भीतर अथवा भारतीय अंतररक्ष अियसंिाि संगठि या परमाण य ऊजाु लवभाग के ककसी स्थापिा के भीतर लस्थत ह,ै वहां उप-लियम (1) स े(5) में लिर्दष्टु लजिा अलिशमि अलिकारी स ेअिापलत्त प्रमाणपत्र अपले क्षत िहीं होगा:

बशते कक संबंलित अलिसूलित क्षेत्र के सक्षम प्रालिकारी अथवा स्थापिा के प्रमिय , यथालस्थलत, स ेपेट्रोलियम भंडारण की स्थापिा के लिए सहमलत प्राि की गई हो।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(7) लजिा अलिशमि अलिकारी लिम्नलिलित प्ररूप म ें अिापलत्त प्रमाण पत्र जारी करेगा, अथाुत ्:- प्रोफ़ॉमा ु- अिापलत्त प्रमाण-पत्र [लियम 144 देि]ें सख्ं या…………… कदिाकं …………. लवषय: अिापलत्त प्रमाण-पत्र श्री/श्रीमती/मसै स ु ...........................................................

लिवासी/पता........................................................... द्वारा प्रस्तयत आवेदि संख्या .................... तारीि.................... के संदभु म ें और पेट्रोलियम लियम, 2002 के लियम 144 के अियसरण म ें श्री/श्रीमती/मैसस ु ........................................................... लिवासी/पता........................................................... को उिके पररसर, सवेक्षण संख्या .................../गाटा सख्ं या ..................../िसरा संख्या .................... प्ि़ॉट संख्या.................... ग्राम .................... तािकय ा/तहसीि .................... लजिा .................... राज्य ...................., जैसा कक स्थि योजिा म ेंदर्शुत ककया ह ै और इसके साथ लवलिवत पष्ठृ ांककत तथा इसके संिि है, में पेट्रोलियम लियम, 2002 के अिीि पेट्रोलियम उत्पादों के भडं ारण के लिए अियज्ञलि अियदत्त करिे म ेंकोई आपलत्त िहीं है।

(1) इस अिापलत्त प्रमाण पत्र को जारी करत ेसमय लिम्नलिलित लवलशलष्टयों पर लविार ककया गया ह,ै कक - (क) आपातकाि म ें फायर टेंडर के लिए साइट तक पहुिं ; और (ि) इमरजेंसी स ेलिपटि ेके लिए फायर सेवा की तैयारी । अिापलत्त प्रमाण-पत्र जारी करिे वािे लज़िा अलिशमि अलिकारी के हस्ताक्षर और उिके कायाुिय की सीि रटप्पणः- "प्रालिकरण अियज्ञलि अियदत्त करिे पर लविार करिे के लिए इसके जारी होि े की तारीि स े तीि वष ु की अवलि के भीतर अिापलत्त प्रमाण-पत्र स्वीकार करेगा।"

(8) लियम 149 म,ें शब्दों “लजिा प्रालिकरण” के स्थाि पर, “लजिा अलिशमि अलिकारी” शब्द प्रलतस्थालपत ककए जाएंगे;[भाग II—खण्ड 3(i)] भारत का रािपत्र : असाधारण 7

(9) लियम 150 म,ें- (क) उप-लियम (1) के स्थाि पर लिम्नलिलित उप-लियम प्रलतस्थालपत ककया जाएगा अथाुत् :- “(1) लियम 144 के अंतगुत कदया गया अिापलत्त प्रमाणपत्र लजिा अलिशमि अलिकारी या राज्य सरकार द्वारा रद्द ककया जा सकेगा, यकद लजिा अलिशमि अलिकारी या राज्य सरकार इस बात स े सतं यष्ट हो कक अिापलत्त प्रमाणपत्र म ेंलवलिर्दुष्ट शत ुका उल्िंघि ककया गया ह:ै बशते कक अिापलत्त प्रमाण पत्र रद्द करिे स े पहि े िाइसेंसिारी को सिय वाई का उलित अवसर कदया जाएगा।“;

(ि) उप लियम (2) म,ें शब्दों “लजिा प्रालिकरण” शब्दों के स्थाि पर, “लजिा अलिशमि अलिकारी” शब्द प्रलतस्थालपत ककए जाएंग;े

(10) जनयम 152 के उप-जनयम (1) म,ें खण्ड (ii) म ें , िब्िों “जिला प्राजधकरण” के स्ट्थान पर, “जिला अजििमन अजधकारी” िब्ि प्रजतस्ट्थाजपत दकए िाएंगे;

(11) लियम 157 म,ें उप-लियम (2) का िोप ककया जाएगा;

(12) प्रथम अनसु ूची म ें “भाग ग,” अनुज्ञजि फीस स े जभन्न अन्य फीस, क्रम संख्या 9 म ें , स्ट्तंभ (2) म,ें िब्िों “जवद्युत साजधत्र ” के पश्चात, “जवजवधताओं सजहत” िब्ि अंतःस्ट्थाजपत दकए िाएंगे;

(13) लद्वतीय अियसिू ी म ें,- (क) फाम ु7 क के स्थाि पर लिम्नलिलित फाम ु प्रलतस्थालपत ककया जाएगा, अथाुत् : - “फ़ॉम ु7 क” [लियम 14क और 75(3) दिे ें] भारत म ें आईएसओ टकैं कंटेिर आयात करिे या/और भारतीय क्षेत्र के भीतर आईएसओ टैंक कंटिे र म ें सड़क मागु से थोक म ेंपेट्रोलियम "श्रेणी क" या "श्रेणी ि" का पररवहि करिे की अियज्ञा अिदय त्त करिे के लिए आवदे ि :

1. वह िाम, लजस पर अियज्ञा अपले क्षत ह ै :

(i) आवेदक का िाम

(ii) आवेदक का पूरा डाक पता

(iii) दरू भाष िंबर और ई-मेि

2. पेट्रोलियम लियम, 2002 के अिीि प्ररूप 15 म ेंआवेदक द्वारा िाररत भंडारण अियज्ञलि की लवलशलष्टयाँ :

6. रटप्पलणयाँ : म/ैं हम घोषणा करते ह ैं कक ऊपर दी गई लवलशलष्टयों की मेरे/हमारे द्वारा जाँि कर िी गई है और व े सही हैं। म/ैं हम पेट्रोलियम अलिलियम, 1934 के उपबंिों और तद्धीि बिाए गए लियमों और तत्समय प्रवृत्त ककसी भी अन्य लवलि या लियमों के उपबंिों के अियसार आईएसओ टैंक कंटेिर म ेंपेट्रोलियम का पररवहि करिे का वििबद्ध करत े ह,ैं लजसका लववरण ऊपर कदया गया है। म/ैंहम समझते ह ैं कक उि अलिलियम और तद्धीि बिाए गए लियमों का कोई भी उल्िंघि पहिे अपराि के लिए सािारण कारावास स े दडं िीय ह ै लजसे एक मास तक बढाया जा सकता ह ैया जयमाुिा िगाया जा सकता ह ैलजसे एक हजार रुपय ेतक बढाया जा सकता ह ै या दोिों स े दंलडत ककया जा सकता ह ै और तत्पश्चात ् प्रत्येक अपराि के लिए सािारण कारावास, लजसे तीि मास तक बढाया जा सकता ह ै या जयमाुिा, जो पाँि हजार रुपये तक बढाया जा सकता ह ै या दोिों से दंलडत ककया जा सकता है। आवेदि की लतलथ आवेदक के हस्ताक्षर आवेदक का डाक पता इस आवेदि के साथ जमा ककए जािे वािे अपले क्षत दस्तावजे ों की सिू ी—

(1) आईएसओ टैंक कंटेिर के लिए आयात अियज्ञा देिे के लिए 5000 रुपये का संवीक्षा फीस या/और भारतीय क्षेत्र के भीतर आईएसओ टैंक कंटेिर म ेंसड़क मागु स ेथोक म ें"श्रणे ी क" या "श्रेणी ि" पेट्रोलियम के पररवहि के लिए 5000 रुपये की फीस, यथालस्थलत;

(2) प्ररूप 15 म ें जारी वैि अियज्ञलि, लजसम ें आईएसओ टैंक कंटेिर की पूरी अंतवुस्त य को समायोलजत करि े की पयाुि क्षमता हो;

(3) टीपीआईए द्वारा लवलिवत प्रमालणत आईएसओ टकैं कंटेिर के लवलिमाुता की लिरीक्षण और परीक्षण ररपोटु;10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(4) टीपीआईए द्वारा जारी हाइड्रोटेस्ट प्रमाणपत्र और कंटेिर सरय क्षा प्रमाणपत्र (सीएससी) सलहत आवलिक लिरीक्षण और परीक्षण;

(5) आईएसओ टैंक कंटेिर के लडजाइि लववरण दशाुि े वािी लडजाइि रेिांकि, टैंक की जि क्षमता, इसकी कफटटंग और इसके लिमाुण म ें उपयोग की जािे वािी सामग्री के लवलिदेशों के लववरण, जो टीपीआईए द्वारा लवलिवत प्रमालणत हो;

(6) मयख्य लियंत्रक द्वारा समयकतः अियमोकदत सड़क मागु से पररवहि के लिए लवस्तृत याि माउंटटंग रेिाकं ि;

(7) आयात के स े अंलतम उपयोग अवस्थापि तक आईएसओ टकैं कंटेिर की हैंडलिंग और पररवहि के लिए सयरलक्षत प्रिािि प्रकिया।

(8) आईएसओ टैंक कंटिे र को उतारिे के पश्चात् उसकी वापसी की अियमालित लतलथ अथवा भारत म ें उसके स्थायी रूप स ेरिे जािे की स्व-घोषणा। (ि) प्ररूप 9 म,ें प्ररूप 14, 15, 16 या लवशेष प्ररूप म ें अिज्ञय लि के लिए इस आवदे ि के साथ प्रस्तयत ककए जािे के लिए अपेलक्षत दस्तावेज म,ें -

(i) िम संख्या (iii) म,ें शब्द “लजिा प्रालिकारी” के स्थाि पर “लजिा अलिशमि अलिकारी” शब्द प्रलतस्थालपत ककए जाएंग;े

(ii) िम संख्या (vii) के पश्चात्, लिम्नलिलित िम संख्या अतं ःस्थालपत की जाएगी, अथाुत्: “(viii) अियज्ञलि के लिए प्रस्तालवत पररसर लजस भूलम पर लस्थत ह,ै उस भूलम पर आवदे क के स्वालमत्व अथवा लवलिपूणु कब्ज ेकी वैिता के संबंि म ेंककसी अलिविा द्वारा जारी लवलिक राय की प्रलत।“;

(ग) प्ररूप XVI म,ें शतु 3 म,ें शब्द “आिा” के स्थाि पर “एक-लतहाई” शब्द प्रलतस्थालपत ककए जाएंगे;

(14) पाँिवीं अिसय ूिी के पश्चात् लिम्नलिलित अियसिू ी अंतःस्थालपत की जाएगी, अथाुत ्:-[भाग II—खण्ड 3(i)] भारत का रािपत्र : असाधारण 11 “छठी अिसय िू ी (लियम 75 देिें)

1. अियज्ञलि प्राि वाहि को ििािे अथवा उसकी दिे रेि के लिए केवि ऐसे उत्तरदायी व्यलियों को लियोलजत ककया जाएगा जो पेट्रोलियम लियमों स ेभिी-भालँ त पररलित हों।

2. पेट्रोलियम िे जाि े वािे आईएसओ टैंक कंटेिर वाहि के साथ सदैव एक उत्तरदायी व्यलि रहेगा तथा पेट्रोलियम के पररवहि के दौराि कम-से-कम दो व्यलि उसके साथ रहेंगे।

3. ट्रेिर िेलसस पर आईएसओ टकैं कंटेिर को माउंट ककए जािे पर, वाहि की लस्थरता सयलिलश्चत की जाएगी।

4. परंतय, यकद आईएसओ टैंक कंटेिर वाहि के टैंक और कक्ष िािी हों, तो उसे मयख्य लियंत्रक द्वारा इस प्रयोजि के लिए लिलित रूप स े अियमोकदत स्थाि पर लबिा लिगरािी के छोड़ा जा सकेगा। अियज्ञलिप्राि वाहि म ें प्रत्येक समय लिम्नलिलित सामग्री रहेगी, अथाुत ्:— (क) कम-स-े कम 9 िीटर क्षमता का तथा तेि की आग बयझाि े के लिए उपययि एक सयवाह्य अलिशामक। अलिशामक को लबिा तािे के ऐसे सयगम स्थाि पर रिा जाएगा जो वाहि के लडस्िाजु ििों स ेदरू हो। (ि) वह लजस श्रेणी के पेट्रोलियम का पररवहि कर रहा ह,ै उसकी प्रत्येक श्रेणी के लिए अिग-अिग तेि-रोिी तथा लवद्ययतीय रूप स ेसतत होज़ होगा। प्रत्येक होज़ के दोिों लसरों पर ऐसे तेि-रोिी कपलिंग िगे होंगे, जो आईएसओ टैंक कंटेिर वाहि के लिवुहि िि तथा उस प्रवेश पाइप स ेमेि िाते हों, लजसम ेंवाहि म ेंवहि ककए जा रह े पेट्रोलियम का अििोड ककया जािा है। (ग) लवद्ययत् बंिि के लिए एक मजबूत एव ंििीिी केबि होगी। यह केबि कम-स-े कम 5 मीटर िंबी होगी तथा इसके दोिों लसरों पर उपययि क्िैमप या लक्िप िगी होगी।

5. आईएसओ टैंक कंटिे र वाहि म ें पेट्रोलियम की िोलडंग अथवा अििोलडंग केवि ऐसे स्थाि पर की जाएगी लजस े मयख्य लियंत्रक द्वारा इस प्रयोजि के लिए लिलित रूप स े अियमोकदत ककया गया हो| परंतय यकद दघय ुटिा अथवा िराबी के कारण अििोलडंग आवश्यक हो जाए, तो समयलित साविालिया ँ बरतते हुए तथा पयाुि पयुवेक्षण म ें ककसी अन्य स्थाि पर भी अििोलडंग की जा सकेगी।

6. आईएसओ टकैं कंटेिर म ें िे जाए जा रह े पेट्रोलियम का प्रत्यक्ष अंतरण ककसी अन्य कंटिे र म ें अथवा ककसी मोटर वाहि या आतं ररक दहि इंजि के ईंिि टकैं म ें िहीं ककया जाएगा।

7. यकद ककसी टैंक या कक्ष, पाइप, वाल्व, आपातकािीि लडस्िाजु लियंत्रण अथवा ककसी सयरक्षा कफटटंग म ें ररसाव हो, वह दोषपूण ु हो अथवा अन्यथा असयरलक्षत हो, तो आवश्यक मरममत सतं ोषजिक रूप स े पूण ु होि े तक आईएसओ टैंक कंटेिर में पेट्रोलियम िोड िहीं ककया जाएगा। यकद टकैं या कक्ष म ें ररसाव हो, तो ररसाव का पूणुतः लिराकरण ककए जाि ेतथा सभी टकैं ों अथवा कक्षों के िागू परीक्षणों म ेंसफि होिे तक उसम ेंिोलडंग िहीं की जाएगी।

8. आईएसओ टकैं कंटेिर वाहि म ेंपेट्रोलियम िोड अथवा अििोड करिे स े पूवु— (क) उसका इंजि बंद कर कदया जाएगा तथा बैटरी को उपययि लस्वि अथवा अन्य सािि द्वारा पृथक कर कदया जाएगा;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ि) उसके पलहयों को ब्रेक िगाकर अथवा स्क़ॉलिंग िगाकर सयरलक्षत ककया जाएगा;

(ग) उसके िेलसस को उस पाइप के साथ, लजसम ेंपेट्रोलियम भरा जािा ह ैअथवा लजसस ेउतारा जािा ह,ै केबि द्वारा लवद्यतय ीय रूप से ब़ॉन्ड ककया जाएगा; (घ) उपययि भराई अथवा लडस्िाजु होज़ का ियि कर उसके दोिों लसरों को तेि-रोिी कपलिंग द्वारा जोड़ा जाएगा;

(ङ) एक उत्तरदायी व्यलि उपलस्थत रहेगा तथा िोलडंग अथवा अििोलडंग समाि होि े और टैंकों तथा कक्षों को सीि ककए जाि ेतक वहीं रहेगा।

9. यातायात सकं ेतों पर रुकिे, अथवा ककसी लिरीक्षक या िमूिा अलिकारी द्वारा रोके जाि ेके अलतररि, आईएसओ टैंक कंटेिर वाहि ककसी सड़क, भीड़भाड़ वािे क्षेत्र अथवा ऐसे स्थाि पर िहीं रोका जाएगा जो इि लियमों के अिीि ऐसे वाहिों की िोलडंग, अििोलडंग अथवा िड़ा करिे के लिए लिलित रूप स े अियमोकदत ि हो।

10. आईएसओ टकैं कंटेिर वाहि पर िूम्रपाि, आग, कृलत्रम प्रकाश अथवा ज्वििशीि वाष्प को प्रज्वलित करिे में सक्षम ककसी भी वस्तय का उपयोग अथवा िे जािा लिलषद्ध होगा।

11.आईएसओ टकैं कंटेिर वाहि का उपयोग, पेट्रोलियम के अिावा यात्री या ककसी अन्य वस्तय को िे जा िे के लिए िहीं ककया जाएगा।

12. आईएसओ टैंक कंटिे र वाहि की मरममत वेलल्डंग, सोल्डटरंग, ब्रेलज़ंग या ति ररवेटटंग द्वारा तब तक िहीं की जाएगी जब तक कक उसके टैंकों, कक्षों, पाइपों और वाल्वों की भिी-भालं त सफाई और जांि ककसी सक्षम इंजीलियर द्वारा ि कर िी गई हो और उसके द्वारा लिलित रूप में यह प्रमालणत ि कर कदया गया हो कक वे ज्वििशीि वाष्प या तेि स ेमयि हIैं

13. मयख्य लवस्फोटक लियंत्रक की पूवु लिलित स्वीकृलत के लबिा आईएसओ टैंक कंटेिर अथवा उसकी सयरक्षा कफटटंगों म ें कोई पररवतुि िहीं ककया जाएगा।

14. इि लियमों तथा इस अियज्ञलि की शतों के समलय ित अियपािि का सत्यापि करिे अथवा िमूिे िेि ेके लिए ककसी भी लिरीक्षक अथवा िमूिा अलिकारी को प्रत्यके ययलिययि समय पर सभी आवश्यक सलय विाए ँ प्रदाि की जाएँगी।

15. आईएसओ टैंक कंटिे र वाहि स े संबंलित ऐसी ककसी दघय ुटिा, आग अथवा लवस्फोट, लजससे मािव जीवि की हालि हुई हो अथवा ककसी व्यलि या संपलत्त को गभं ीर क्षलत पहुँिी हो, की सिू िा तत्काि लिकटतम मलजस्ट्रेट अथवा अलिकाररता रिि े वाि े लिकटतम पयलिस थािे के प्रभारी अलिकारी को तथा दरू भाष/ई-मेि द्वारा मयख्य लवस्फोटक लियंत्रक को दी जाएगी।“.

NOTIFICATION New Delhi, the 3rd September, 2026 G.S.R. 781(E).— The following draft of certain rules further to amend the Petroleum Rules, 2002 which the Central Government proposes to make in exercise of the powers conferred by section 4 and sub-sections (2) and (3) of

section 29 of the Petroleum Act, 1934 (30 of 1934), is hereby published for information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration on or after the expiry of a period of thirty days from the date on which the copies of the Gazette of India containing the draft rules are made available to the public;

Objections and suggestions which may be received from any person within the period specified above will be considered by the Central Government.

Draft Rules

1. These rules may be called the Petroleum (Amendment) Rules, 2026.

2. In the Petroleum Rules, 2002,-

(1) in rule 2, in sub-rule (1),-

(a) after clause (x), the following clause shall be inserted, namely:- “(xa) "District Fire Officer" means the officer designated by the State Government to be in charge of the Fire and Emergency Services for a district, by whatever name called, and includes any officer authorised by the State Government to perform the functions of the District Fire Officer;”

(b) in clause (xvia), after the words, “marking as per”, the words and figures, “ISO 1496 or” shall be inserted;

(2) in rule 13,-

(a) in sub-rule (3), after word, “paid”, words, “through e-payment or” shall be inserted;

(b) in sub-rule (4),- i. in clause (i), in sub-clause (a), for the words, “if the fee has been paid in cash or by bank draft”, words “in the same manner as that of receipt of fees” shall be substituted;

ii. in clause (ii), for the words, “preferably within six months of the realization”, words “within two months of the rejection” shall be substituted;

(3) For rule 14A, the following rule shall be substituted, namely: - “14A. Import and transport of ISO tank containers. -

(1) No person shall import any ISO tank container filled or intended to be filled with petroleum without obtaining import permission from the Chief Controller or Controller.

(2) Any person seeking import permission under sub-rule (1) shall submit an application in FORM VII (A) through the online licensing portal of the Petroleum and Explosives Safety Organisation to the Chief Controller or Controller along with the following documents, namely: -

(a) valid license issued in FORM XV having adequate capacity to accommodate the whole contents of the ISO tank container;14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(b) manufacturer’s inspection, test reports and design drawings showing design details, water capacity of the tank, its fittings and particulars of specifications of the materials of construction of the ISO tank container duly certified by TPIA;

(c) periodic inspection and testing including Hydro Test Certificate and Container Safety Certificate issued by TPIA;

(d) mounting drawing for transportation by road duly approved by the Chief Controller or Controller;

(e) safe operating procedure for handling and transportation of the ISO tank container from the port of import to the end-use location;

(f) self-declaration for the approximate date of return of ISO tank container after unloading or its retention in India on a permanent basis;

(g) scrutiny fees as provided in PART C of the FIRST SCHEDULE.

(3) On receipt of complete application and on being satisfied, the Chief Controller or Controller shall grant import permission valid for a maximum period of three years in the format as may be prescribed by the Chief Controller.

Provided that where an application for grant of permission to import ISO Tank Container in India under this Rule and permission to transport Petroleum Class A or Class B in bulk by road in ISO Tank Container within Indian territory under Rule 75 (3) is made simultaneously, the Chief Controller or Controller on being satisfied with the requirements of Rule 14A and 75(3), shall grant a combined permission in the format as may be prescribed by the Chief Controller to import ISO Tank Container in India and to transport Petroleum Class A or Class B in bulk by road in ISO Tank Container within Indian territory valid for a maximum period of three years.

(4) Where an application is made under this rule is complete in all respects and is accompanied by all the documents specified therein, and no deficiency or written objection is communicated through the online licensing portal within seven working days from the date of submission of the application, the permission shall be deemed to have been granted on the expiry of the said period.”;

(4) in rule 75,-

(a) in sub-rule (3), for the word, “one”, word “three” shall be substituted;

(b) after sub-rule (4), the following sub-rules shall be inserted, namely: - “(5) Where the periodic test/Hydro Test Certificate of ISO Tank Container remains valid, permission granted under sub-rule (3) may be extended by the Chief Controller or Controller for a maximum period up to three years or till the validity of the certificate, whichever is earlier, on an online declaration along with copy of periodic inspection and testing including Hydro Test Certificate and Container Safety Certificate issued by TPIA.

(6) Nothing in this rule shall apply to multimodal transportation of petroleum Class A or B in ISO tank container imported for one time use and return to the country of origin after filling or after decantation

provided the following conditions are fulfilled:

(i) upon mounting of the ISO tank container in trailer chassis, the stability of the vehicle shall be ensured.

(ii) Registered laden weight or gross vehicle weight or gross combined weight of the vehicle chassis shall not exceed the registered laden weight of the vehicle complying with the applicable provisions of the Motor Vehicle Act. The laden weight on each axel shall be within the maximum allowable load bearing capacity of each axel as mentioned in ARAI certificate or equivalent.

(iii) Only single ISO tank container filled with petroleum shall be mounted on a vehicle during transportation.[भाग II—खण्ड 3(i)] भारत का रािपत्र : असाधारण 15

(iv) The precautions specified in SIXTH SCHEDULE shall be complied during transportation of petroleum in ISO tank container carrying vehicle by road.”;

(5) in rule 106,-

(a) in sub-rule (1), after the letters and figures “IS/IEC 60079-26”, the sign and words “(for Equipment with Separation Elements or combined Levels of Protection)” shall be inserted;

(b) in sub-rule (3A), after the words “Chief Controller,” the words and figures “or as per sub-rule (1), (2) and

(3) of this rule.” shall be inserted;

(c) in sub-rule (4), in clause (i), the words “all necessary drawings,” shall be omitted;

(6) in rule 143, in sub-rule (1), for words “in writing”, words “through the online licensing portal of the Petroleum and Explosives Safety Organisation” shall be substituted;

(7) For rule 144, the following rule shall be substituted, namely: - “144. No-Objection Certificate.-

(1) Where the licensing authority is the Chief Controller or the Controller, as the case may be, an applicant for a new licence other than a licence in Forms III, XI, XVII, XVIII, or XIX shall apply to the District Fire Officer with two copies of the site-plan duly certified by a registered architect conforming to the applicable land use, building bye-laws and other statutory requirements, showing the location of the premises proposed to be licensed for a certificate to the effect that there is no objection, to the applicant receiving a licence for the site proposed and District Fire Officer shall, if he sees no objection, grant such certificate to the applicant who shall forward it to the licensing authority with his application in Form IX, accompanied by a copy of the legal opinion issued by an advocate regarding the validity of the applicant's title to, or lawful possession of, the land on which the premises proposed to be licensed is situated.

(2) Every certificate issued by the District Fire Officer under sub-rule (1) shall be accompanied by a copy of the plan of the proposed site duly endorsed by him under his official seal.

(3) The Chief Controller or the Controller as the case may be, may refer an application not accompanied by certificate granted under sub-rule (1) to the District Fire Officer for his observations.

(4) If the District Fire Officer, either on a reference being made to him or otherwise, intimates to the Chief Controller or the Controller as the case may be, that any licence which has been applied for should not, in his opinion, be granted, such licence shall not be issued without the sanction of the Central Government.

(5) The District Fire Officer shall complete his inquiry for issuing NO OBJECTION CERTIFICATE (NOC) under sub-rule (1) and shall complete the action for issue or refusal of the NOC, as the case may be, as expeditiously as possible but not later than one month form the date of receipt of application by him.

(6) Where the location of storage of petroleum is within the notified area of a Port or Airport or Railways under the control of the State, or establishment of Indian Space Research Organisation or Department of Atomic Energy, NO OBJECTION CERTIFICATE from the District Fire Officer referred to in sub-rules (1) to

(5) shall not be required.

Provided that consent for establishment of petroleum storage from the competent authority of concerned notified areas or head of the establishment, as the case may be, is obtained.

(7) District Fire Officer shall issue a no objection certificate in the following proforma, namely: -16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Proforma No Objection Certificate [See rule 144] No…………… Date………….

Subject: No objection certificate With reference to the application No.……. dated ……. submitted by………….and in pursuance of

rule 144 of the Petroleum Rules, 2002, there is no objection for granting licence under the Petroleum Rules, 2002 to Shri/Smt./M/s.………………………… address………………… for storage of petroleum products in their premises at Survey No………./Gata No…….…/Khasra No.……..………Plot No……..….,Village…………Taluka/Tehsil…………….…District…………..State…………………………a s shown in the site plan duly endorsed and enclosed herewith.

The following particulars have been considered while issuing this no-objection certificate, that-

(a) accessibility of the site to the fire tenders in case of emergency; and

(b) preparedness of fire services for combating the emergencies.

(8) in rule 149, for words, “District Authority”, the words, “District Fire Officer” shall be substituted;

(9) in rule 150,-

(a) for sub-rule (1), the following sub-rule shall be substituted, namely :- “(1) A no-objection certificate granted under rule 144 shall be liable to be cancelled by the District Fire Officer or the state Government, if the District Fire Officer or the state Government is satisfied, that condition specified in the no-objection certificate has been contravened:

Provided that before cancelling a no-objection certificate, the licensee shall be given a reasonable opportunity of being heard.”;

(b) in sub-rule (2), for words, “District Authority”, the words, “District Fire Officer” shall be substituted;

(10) in rule 152, in sub-rule (1), in clause (ii), for words, “District Authority”, the words, “District Fire Officer” shall be substituted;

(11) in rule 157, sub-rule (2) shall be omitted;

I/We undertake of transport petroleum in ISO tank container particulars of which are given above, in accordance with the provisions of the Petroleum Act, 1934, and the rules framed thereunder and any other law or rules for the time being in force. I/We understand that any contravention of the said Act and the Rules framed thereunder is punishable for the first offence with simple imprisonment which may extend to one month or with fine which may extend to one thousand rupees or with both and for every subsequent offence with simple imprisonment which may extend to three months or with fine which may extend to five thousand rupees or with both.

(6) approved detailed vehicle mounting drawing for transportation by road duly approved by the Chief Controller;

(7) Safe operating procedure for handling and transportation of the ISO tank container from the port of import to the end-use location;

(8) self-declaration for the approximate date of return of ISO tank container after unloading or its retention in India on a permanent basis.”;

(b) in FORM IX, in Documents required to be submitted with this application for a Licence in Forms XIV, XV, XVI or in special Forms,- i. in Sl. No. (iii), for words, “District Authority”, the words, “District Fire Officer” shall be substituted;

ii. after Sl. No. (vii), the following Sl. No. shall be inserted, namely:-[भाग II—खण्ड 3(i)] भारत का रािपत्र : असाधारण 19 “(viii) copy of the legal opinion issued by an advocate regarding the validity of the applicant's title to, or lawful possession of, the land on which the premises proposed to be licensed is situated.”;

(c) in FORM XVI, in condition 3), for the words “one half”, words “one third” shall be substituted;

(14) after FIFTH SCHEDULE, the following schedule shall be inserted, namely: - “SIXTH SCHEDULE (See rule 75)

1. Only responsible persons who are conversant with Petroleum Rules shall be employed for driving the licensed vehicle or attending to it.

2. The vehicle carrying Petroleum ISO container shall be constantly attended to by a responsible person and by at least two persons while it is transporting petroleum.

3. Upon mounting of the ISO tank container in trailer chassis, the stability of the vehicle shall be ensured.

4. Provided that the ISO tank container vehicle may, if its tanks and compartments are empty, be left unattended in a place approved for the purpose in writing, by the Chief Controller. The licensed vehicle shall at all times carry a. a portable fire extinguisher of capacity not less than 9 litres and suitable for extinguishing oil fires. The extinguisher shall be kept unlocked at an easily accessible position which shall be away from the discharge faucets of the vehicle.

b. A separate oil tight and electrically continuous hose for each class of petroleum it is carrying, the hoses shall have at each end oil-light coupling to match the discharge faucet of the ISO tank container vehicle and the inlet pipe into which the petroleum carried in the vehicles is to be unloaded.

c. a strong and flexible cable for electrical bonding; the cable shall be at least 5 meters long and shall have at each and a suitable clamp or clip.

5. The ISO tank container vehicle shall not be loaded or unloaded except in a place approved for the purpose, in writing, by the Chief Controller: Provided that the ISO tank container vehicle may be unloaded at any other place with all due precautions and under adequate supervision if such unloading is necessitated by an accident or breakdown.

6. Petroleum carried in the ISO tank container shall not be directly transferred in to any container or into the fuel tank of any motor conveyance or an internal combustion engine.

7. The ISO tank container shall not be loaded if any tank or compartment, pipe valve, emergency discharge control or any safety fitting becomes leaky, defective or otherwise insecure until necessary repairs have been carried out satisfactorily, and in the event of any leak in the tanks or compartments, until the leak is thoroughly repaired and all the tanks or compartments pass the applicable tests.

8. Before petroleum is loaded into or unloaded from the ISO tank container vehicle a. its engine shall be stopped and the battery shall be isolated by a proper switch or otherwise. b. its wheels shall be secured by brakes or by scotching.

c. its chassis shall be electrically bonded by a cable with the pipe into or from which it is to be unloaded or loaded; d. the correct filling or discharge hose shall be selected and connected by oil-tight coupling at both ends;

e. a responsible person shall be in attendance ad remain so until loading or unloading is over and the tanks and compartments have been sealed.

9. Except when called upon the traffic signals or required by an Inspector or a Sampling Officer, the ISO tank container vehicle shall not stop on any road, congested area or a place which is not a place approved in writing, under these rules for loading, unloading or stabling of such vehicles.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

10. No smoking and no fire or artificial light or any article capable of igniting inflammable vapour shall be allowed on the ISO tank container vehicle.

11. The ISO tank container vehicle shall not be used for carrying passenger or any article other than petroleum.

12. The ISO tank container vehicle shall not be allowed to be repaired by welding, soldering, brazing, or hot riveting until its tanks, compartments, pipes and valves have been thoroughly cleaned and examined by a competent engineer and certified by him in writing to be free from inflammable vapour or oil.

13. No alteration in the ISO tank container or its safety fittings shall be carried out without the previous sanction in writing of the Chief Controller of Explosives.

14. Every facility shall be given at all reasonable time to any inspector or sampling officer for ascertaining that the rules and the conditions of this licence are duly observed or for drawing samples.

15. Any accident, fire or explosion occurring in the ISO tank container vehicle, which is attended with loss of human life or serious injury to person or property shall be immediately reported to the nearest Magistrate or to the officer-in-charge of the nearest police station having jurisdiction and by telephone/email to the Chief Controller of Explosives.”.
