No. 128 भाग IV PART IV राष्ट्रीय रािधानी राज्य क्षत्रे दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI खाद्य,आपर्ू त िएव ंउपभोगता मामल ेजवभाग आिेि दिल्ली, 24 िलु ाई, 2026 फा. स.ं 3(65)/नीजत/जनयत्रं ण आिेि/ खा0 एव ं आप0/2026/685-715.— दिल्ली के उप-राज्यपाल का मत ह ै दक राष्ट्रीय रािधानी क्षेत्र दिल्ली म ेंराष्ट्रीय खाद्य सरु क्षा अजधजनयम, 2013 और जवजभन्न जनयंत्रण आिेिों की प्रभावी जनगरानी और कायािन्वयन के जलए ऐसा करना आवश्यक एवं समीचीन है, और चूंदक, राष्ट्रीय खाद्य सुरक्षा अजधजनयम, 2013 और उसके अन् तगित िारी दकए गए जवजभन्न जनयंत्रण आिेिों को ध् यान में रखते हुए, मौिूिा दिल्ली जनर्िष्टि वस्ट्तुएं (जवतरण जवजनयमन) आििे , 1981 को तत्काल अद्यतन करन े की आवश्यकता ह,ै अब, इसजलए, आवश्यक वस्ट्तु अजधजनयम, 1955 (1955 का 10) की उप-धारा 3 के अन्त गित प्रित्त िजियों का प्रयोग करत ेहुए और साथ ही भारत सरकार के कृजि और ससंचाई मंत्रालय (खाद्य जवभाग) के आिेि िीएसआर800 (दिनांक 9 िून 1978), उद्योग और नागररक आपूर्त िमंत्रालय (नागररक आपूर्ति और सहकाररता जवभाग) के आिेि एसओ 681(ई) (दिनाकं 30 नवंबर 1974) और लजक्षत सावििजनक जवतरण प्रणाली (जनयंत्रण) आिेि, 2015 को ध्यान में रखत ेहुए तथा दिल्ली रािपत्र 5664 DG 26 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] (दिनांक 12 िनवरी 1981) में प्रकाजित 'दिल्ली जनर्ििष्ट वस्ट्तुएं (जवतरण जवजनयमन) आििे , 1981' के अजधक्रमण में, ऐसे अजधक्रमण से पूवि की गई या जवलोप की िान े वाली बातों को छोडकर, उप-राज्यपाल राष्ट्रीय खाद्य सुरक्षा अजधजनयम, 2013 और दिल्ली खाद्य सुरक्षा जनयमावली, 2026 के प्रावधानों को लाग ूकरन े के जलए जनम्नजलजखत आििे िारी करत े ह:ैं भाग-I प्रारंजभक

1. सजं क्षप्त िीिकि एव ंप्रारंभ

(a) इस आिेि को दिल्ली जनर्ििष्ट वस्ट्तु (जवतरण जवजनयमन) आिेि, 2026 कहा िाएगा।

(b) इसका जवस्ट्तार दिल्ली के पूरे राष्ट्रीय रािधानी क्षेत्र तक ह।ै

(c) यह आजधकाररक रािपत्र में इसके प्रकािन की जतजथ से लाग ूहोगा।

2. पररभािाए ँ (अ) इस आिेि म,ें िब तक संिभि म ेंअन्यथा अन् यथा अपेजक्षत न हो: (क) “अपीलकताि” का अजभप्राय वह व्यजि िो प्राजधकरण के जनलंबन/रद्द करने के आिेि के जखलाफ अपील करता है, से ह;ै (ख)"प्राजधकृत अजधकारी" का अजभप्राय जवभाग का जविेि / अपर / संयुि / उप / सहायक आयुि और इसमें आयुि द्वारा इस आिेि के अन्त गति सभी या दकन्हीं िजियों का प्रयोग करन े के जलए प्राजधकृत सहायक आयिु के पि से नीचे के स्ट्तर का न होने वाला कोई अन्य अजधकारी भी िाजमल से ह;ै (ग) “आयिु ” का अजभप्राय जवभाग का आयुि से है;

(घ) “ज़िला और सर्किल” का अजभप्राय खंड 9 म ेंउजल्लजखत ज़िला और सर्किल से है; (च) "जवत्तीय आयुि" का अजभप्राय राष्ट्रीय रािधानी क्षेत्र दिल्ली के जलए जनयुि जवत्तीय आयुि से है; (छ) "खाद्य और आपूर्ति अजधकारी" का अजभप्राय जवभाग का खाद्य और आपूर्त ि अजधकारी से है;

(ि) "प्रपत्र" का अजभप्राय इस आिेि के साथ संलग्न प्रपत्र से ह;ै (झ) "उपराज्यपाल" का अजभप्राय भारत के संजवधान के अनुच्छेि 239 के अन्त गति जनयुि राष्ट्रीय रािधानी क्षेत्र दिल्ली के उपराज्यपाल से ह;ै (ञ) “आििे ” का अजभप्राय दिल्ली जनर्ििष्ट वस्ट्तु (जवतरण जवजनयमन) आिेि, 2026 से ह;ै (ट) “जनयम” का अजभप्राय दिनांक 02 फरवरी, 2026 को दिल्ली रािपत्र में प्रकाजित दिल्ली खाद्य सुरक्षा जनयमावली, 2026 से ह;ै (ठ) "जनर्ििष्ट वस्ट्तु" का अजभप्राय सरकार समय-समय पर अजधसूजचत चावल एवं गेह ंऔर कोई अन्य वस्ट्तु स ेहै;[PART IV DELHI GAZETTE : EXTRAORDINARY 3 (आ) इस आििे म ेंप्रयुक्त िब्ि और अजभव् यजियां, िो इस आििे म ेंपररभाजित नहीं ह,ै उनका वही अथि होगा िो 'आवश्यक वस्ट्तु अजधजनयम, 1955', 'राष्ट्रीय खाद्य सुरक्षा अजधजनयम, 2013', 'लजक्षत सावििजनक जवतरण प्रणाली (जनयंत्रण) आिेि, 2015' और 'दिल्ली खाद्य सुरक्षा जनयमावली, 2026' में दिया गया ह।ै

3. उजचत िर की िकु ान के लाइससें िारी करना और उनका जनयमन, जिस ेआग े'लाइससें ' कहा िाएगा (अ) जनयजमत लाइससें (क) जनयजमत लाइसेंस तब तक वैध रहगे ा िब तक दक काननू के अनुसार उसे जनलंजबत या रद्द न कर दिया िाए;

(ख) इसके समय-समय पर नवीनीकरण की आवश्यकता नहीं होगी; (ग) यह हस्ट्तांतरणीय, सौंपन ेयोग्य और जवरासत म ेंजमलन ेयोग्य नहीं होगा, लाइसेंसधारी की मृत्य ुहोन ेपर भी नहीं; और (घ) रद्द होन े या सरेंडर करन े पर यह अपने आप समाप्त हो िाएगा। (आ) अस्ट्थायी लाइससें (क) अस्ट्थायी लाइसेंस केवल सावििजनक जवतरण म ें आकजस्ट्मक सेवा अंतराल को पूरा करन े के जलए दिया िा सकता ह,ै िहा ँ 'राष्ट्रीय खाद्य सुरक्षा अजधजनयम, 2013' के अन् तगित जनर्ििष्ट खाद्य पिाथों की आपूर्त ि मौिूिा उजचत िर िकु ानों के नेटवकि के माध्यम से सुजनजित नहीं की िा सकती है;

(ख) ऐसा लाइसेंस ज़्यािा से ज़्यािा तीन महीने की अवजध के जलए मान्य होगा, और जलजखत कारणों के आधार पर इसे एक बार बढाया िा सकेगा; बिते दक समय-सीमा बढाने की अनुमजत धारा (ख) के अन् तगति केवल तभी िी िाएगी िब प्रिासजनक जनयंत्रण से बाहर के कारणों से जनयजमत लाइसेंससंग परू ी न हो सकी हो;

(ग) अस्ट्थायी लाइसेंस जमलने से जनयजमत लाइसेंस पान े का कोई अजधकार या प्राथजमकता नहीं जमलेगी; (घ) जनयजमत लाइसेंस िने े की प्रदक्रया अस्ट्थायी लाइसेंस जमलने के तीस दिनों के भीतर िरूु कर िी िाएगी। (इ) पात्रता तय ितों को पूरा करन े पर, नीचे िी गई संस्ट्थाएं लाइसेंस के जलए आवेिन करन े की पात्र होंगी:

(क) वैयजिक / एकल स्ट्वाजमत्व; (ख) स्ट्वय-ं सहायता समूह, जिसमें मजहला स्ट्वय-ं सहायता समूह भी िाजमल ह;ैं (ग) दिल्ली सहकारी सजमजत अजधजनयम, 2003 के अन् तगित पंिीकृत सहकारी सजमजत; (घ) लाग ूकानून के अन् तगित पंिीकृत गरै -सरकारी संगठन / सजमजत;

(ङ) साझेिारी अजधजनयम, 1932 के अन्त गति पंिीकृत साझेिारी फमि; (च) सीजमत िेयता साझेिारी; (छ) कंपनी अजधजनयम, 2013 के अन् तगति जनगजमत कंपनी। (ई) लाइससें की सख्ं या पर सीमाएं (क) एकल व्यजि/स्ट्वामी, साझेिारी फमि या सीजमत िेयता भागीिारी केवल एक लाइसेंस के जलए पात्र होगी;

(ख) स्ट्वय-ं सहायता समूह, सहकारी सजमजत, लाग ूकानून के तहत पिं ीकृत गरै -सरकारी सगं ठन/सोसायटी और कंपनी अजधजनयम, 2013 के अन्त गति जनगजमत कंपजनयों को लाइसेंस दिए िा सकते ह,ैं बित:े4 DELHI GAZETTE : EXTRAORDINARY PART IV]

(i) प्रजत रािस्ट्व ज़िला अजधकतम पाँच उजचत िर िकु ानें हों; या

(ii) सरकार द्वारा समय-समय पर अजधसजू चत कोई अन्य कुल सीमा लाग ूहो। (उ) आय,ु िक्षै जणक योग्यता और जनवास आवेिक या अजधकृत प्रजतजनजध के जलए आवश् यक ह ैदक वह: (क) आवेिन की आजखरी तारीख तक इक्कीस साल की आयु पूरी कर चुका हो और साठ साल स ेज़्यािा आय ुका न हो:

बिते दक पूवि-सैजनकों और मजहलाओं को अजधकतम आय ुसीमा में पाँच साल की छूट जमलेगी; आग े यह भी उपबंजधत ह ै दकसफल आवेिक को उस महीन े के आजखरी दिन तक उजचत िर िकु ानचलाने की अनुमजत िी िा सकती ह,ै जिस महीने में वह 70 विि का हो िाता ह।ै 70 विि से अजधक आयु के दकसी भी लाइसेंस-धारक को उजचत िर िकु ानचलाने की अनुमजत नहीं िी िाएगी। (ख) दकसी मान्यता प्राप्त बोडि स ेकम से कम 12वीं कक्षा उत् तीणि हो; और (ग) भारत का नागररक हो और उसी रािस्ट्व ज़िल ेका जनवासी हो िहाँ उजचत िर िकु ान खोलन ेका प्रस्ट्ताव ह।ै (ऊ) अयोग्यताए ँ दकसी ऐसे व्यजि को लाइसेंस नहीं दिया िाएगा िो:

(क) मानजसक रूप से अस्ट्वस्ट्थ हो; (ख) जिसका 'उजचत िर िकु ान’ या केरोजसन तेल जडपो का लाइसेंस पहल े किाचार के कारण रद्द दकया गया हो; (ग) जिसके पास पहले स ेही ऐसा लाइसेंस हो, िहाँ ऐसे लाइसेंस रखने पर रोक हो;

(घ) जिसे 'आवश्यक वस्ट्त ु अजधजनयम, 1955', 'भारतीय न्याय संजहता' के अन् तगित अपराधों, या नैजतक अधमता या आर्थिक अपराध स े िडु े दकसी अपराध के जलए िोिी ठहराया गया हो, या जिसके जवरूद्ध आरोप तय दकए गए हों या संज्ञान जलया गया हो; या (ङ) जिसने गलत िानकारी िी हो या ़िरूरी तथ्यों को जछपाया हो। (ए) उजचत िर िकु ान के जलए पररसर उजचत िर िकु ान की पररसर ऐसी होनी चाजहए:

(क) उसका कम से कम क्षेत्रफल पंद्रह वगि मीटर हो; लेदकन अगर उजचत िर िकु ान के स्ट्थ ान का क्षेत्रफल पच्चीस वगि मीटर स े कम है, तो पास ही मौिूि अजतररि भंडारणका स्ट्थ ान से इसकी कमी पूरी की िानी चाजहए; (ख) वहाँ तक पहुचँ न े के जलए कम स ेकम िस फीट चौडी सडक हो;

(ग) वह पक्का ढांचा हो, और उसे हमिे ा धलू और नमी स ेमुि रखा िाए; (घ) सुरजक्षत भंडारण और आवािाही के जलए पयािप्त ऊँचाई (लगभग 3 मीटर) हो; (ङ) उसमें एक से ज़्यािा िरवा़िा न हो; और जिल वाली जखडकी म ेंदफक्स्ट्ड ग्लास लगा हो; और (च) आवेिन की तारीख पर वह कानूनी कब़्ि े(माजलकाना हक/लीि/दकरायेिारी) म ेंहो, िो आम तौर पर कम से कम तीन साल की अवजध के जलए हो। बितें दक, सुरक्षा, स्ट्वच्छता या सावििजनक जवतरण प्रणाली की अखंडता पर असर न डालने वाली छोटी-मोटी कजमयों को लाइसेंससंग कमेटी जलजखत म ेंकारण ििि करके माफ कर सकती ह।ै[PART IV DELHI GAZETTE : EXTRAORDINARY 5 (ऐ) आविे न प्रदक्रया (क) आवेिन केवल जनर्िष्टि जवभागीय पोटिल के माध्यम से ऑनलाइन िमा दकए िाएंगे;

(ख) आवेिन के साथ अनलु ग्नक-I में जनर्ििष्ट िस्ट्तावे़ि सलं ग्न होने चाजहए; (ग) जवज्ञापन िारी होने के िो सप्ताह के भीतर आवेिन िमा करन ेहोंगे। (ओ) आविे न िल्ु क आवेिन के साथ जनम्नजलजखत गरै -वापसी योग्य िल्ु क सलं ग्न होना चाजहए:

(क) जनयजमत लाइसेंस के जलए ₹1,000; और (ख) अस्ट्थायी लाइसेंस के जलए ₹ 500 । (औ) चयन प्रदक्रया (क) आवेिन आमंजत्रत करन े वाल े जवज्ञापन के साथ पहले स े तय वटे ेि-आधाररत मार्किंग स्ट्कीम (अनुलग्नक-IV) प्रकाजित की िाएगी;

(ख) पररसर का जनरीक्षण जियो-टैग दकए गए जनरीक्षण और फोटो-सबूत के साथ दकया िाएगा; (ग) चयन एक चयन सजमजत द्वारा दकया िाएगा जिसमें जनम् न िाजमल होंगे:

(i) जवभाग के जविेि / अपर आयुि : अध्यक्ष

(ii) एक सहायक आयुि (संबंजधत जिले के अलावा) : सिस्ट्य

(iii) जवभाग के सूचना प्रौद्धयोगी सवगं से एक नाजमत व्यजि : सिस्ट्य (घ) सजमजत की संस्ट् तुजतयां अनुमोिन के जलए माननीय खाद्य एवं आपूर्त ि मंत्री के समक्ष रखी िाएंगी। अनुमोिन के पश् चात, आयुि या उनके द्वारा अजधकृत अजधकारी चयजनत आवेिकों को प्रपत्र-सी (अनलु ग्नक-V) म ें लाइसेंस िारी करेंगे। (उ) सरु क्षा िमा और लाइससें िल्ु क (क) सफल आवेिक को उजचत िर िकु ान से िुडे रािन काडों की सख्ं या के आधार पर जनष्पािन गारंटी (परफॉमेंस गारंटी) प्रस्ट्ततु करनी होगी:

(ख) प्रजत िकु ान रािन काडों की सख्ं या जनष्पािन गारंटी की राजि (₹) 500 तक 50,000 501-750 75,000 750 से अजधक 1,00,000 (ग) एकमुश्त लाइसेंस िल्ु क ₹10,000 होगा। (घ) डुजललकेट लाइसेंस िारी करने का िुल्क ₹500 होगा।

4. जनगरानी, सधु ारात्मक कारिवाई और लाइससें का जनलबं न / जनरस्ट्त ीकरण (अ) इस आिेि, राष्ट्रीय खाद्य सुरक्षा अजधजनयम, 2013, आवश्यक वस्ट्तु अजधजनयम, 1955या लागू जनयंत्रण आििे का कोई भी उल्लघं न होन ेपर, उल्लघं न की गंभीरता के अनुसार सुधारात्मक कारिवाई की िाएगी। इसमें चेतावनी िेना, जनष्प ािन6 DELHI GAZETTE : EXTRAORDINARY PART IV] गारंटी का पूरा या कुछ जहस्ट्सा ़िब्त करना, लाइसेंस जनलबन, जनरस्ट् त करना, और/या आपराजधक कारिवाई िुरू करना िाजमल हो सकता ह,ै िैसा भी मामला हो। (आ) स्ट्टॉक म ेंजभन्नता – लघ ुअजनयजमतता िहां जनर्ििष्ट खाद्य वस्ट्तओंु की कुल मात्रा में अन् तर 25 दकलोिाम से अजधक हो, लेदकन वह 50 दकलोिाम से अजधक भी न हो, तो वहां प्रत् येक अवसर पर जनष्प ािन गारंटी की राजि से ₹2000 ़िब्त दकए िाएंग े और लाइसेंसधारी को एक हफ़्ते के अंिर कम मात्रा की भरपाई करनी होगी। ़िब्त की गई राजि के बराबर राजि लाइसेंसधारी को 15 कैलडें र दिनों के भीतर िमा करनी होगी। (इ) स्ट्टॉक म ेंजभन्नता – बडी अजनयजमतता िहां जनर्ििष्ट खाद्य वस्ट्तओंु की कुल मात्रा में अन् तर 50 दकलोिाम से अजधक हो, लेदकन 100 दकलोिाम से अजधक भी न हो, तो :

(क) जनष्प ािन गारंटी की राजि स े₹10,000 ़िब्त दकए िाएंगे, और उजचत िर िकु ानलाइसेंस को तरु ंत अतं ररम उपाय के तौर पर जनलजम्बत कर दिया िाएगा। ़िब्त की गई राजि के बराबर राजि लाइसेंसधारी को 15 कैलेंडर दिनों के भीतर िमा करनी होगी;

(ख) उत् तिाजयत् व, प्रयोिन, पररणामी वसूली यदि कोई हो, और उजचत िंडात्मक कारिवाई जिसमें लाइसेंस िारी रखना या जनरस्ट्त करना िाजमल ह ै जनधािररत करन े के जलए प्राजधकृत अजधकारी द्वारा अधि-न्याजयक कायिवाही िुरू की िाएगी। (ई) स्ट्टॉक म ेंअतं र – गभं ीर अजनयजमतता यदि कुल जमलाकर जनर्ििष्ट खाद्य वस्ट् तुओं म ें100 दकलोिाम से ज़्यािा का अंतर पाया िाता है, तो :

(क) संपूणि जनष्प ािन सुरक्षा राजि ़िब्त कर ली िाएगी; (ख) उजचत िर िकु ानलाइसेंस तुरंत जनलंजबत कर दिया िाएगा; (ग) िहाँ अपराध के तत्व पाए िाएगँ े, वहाँ आवश्यक वस्ट्तु अजधजनयम, 1955 की धारा 7 और/या 10 के अन्त गति एफआईआरििि की िाएगी; और (घ) उत् तिाजयत् व, प्रयोिन, पररणामी वसूली यदि कोई हो, और गायब अनाि के जलए उजचत िंडात्मक कारिवाई जिसमें लाइसेंस िारी रखना या जनरस्ट् त करना िाजमल ह ैजनधािररत करने के जलए प्राजधकृत अजधकारी द्वारा अधि- न्याजयक कायिवाही िुरू की िाएगी। (ङ) जनष्पािन गारंटी से ज़्यािा की पररणामी वसूली/िेनिारी लाइसेंसधारी से भू-रािस्ट् व की बकाया राजि के तौर पर वसूल की िाएगी। (उ) स्ट्टॉक म ेंअतं र के अजतररक्त उल्लघं न इन उल्लघं नों के मामल े में, लेदकन इन्हीं तक सीजमत नहीं, तो:

(क) आवश् यक िानकारी िैसे लाइसेंस का जववरण, काम के घंटे, साप्ताजहक छुट्टी, जिकायत जनवारण व्यवस्ट्था, स्ट्टॉक की जस्ट्थजत और मूल्य सूची न दिखाना; (ख) जनर्ििष् ट खाद्य वस्ट् तुओं के नमनू ों को न दिखाना या न रखना;

(ग) ई-पीओएस जडवाइस या व़िन करने वाली मिीनों के साथ छेडछाड या उनका गलत इस्ट्तेमाल; (घ) अजग्न सुरक्षा संबंधी उपकरण न लगाना या उनका रखरखाव न करना; (च) लाभार्थियों के साथ अभद्र व् यवहार ; (छ) भंडारण या जबक्री स्ट् थान की अस्ट्व च् छ जस्ट्थजत; या[PART IV DELHI GAZETTE : EXTRAORDINARY 7 (झ) उजचत िर िकु ान के पररसर में साफ़-सफ़ाई न रखना। आयुक् त या प्राजधकृत अजधकारी, उजचत प्रदक्रया का पालन करने के बाि, उल्लंघन की गंभीरता और बार-बार होन े के आधार पर ₹25,000 (पच्चीस ह़िार रुपय)े तक की राजि ़िब्त कर सकते ह ैंऔर/या लाइसेंस रद्द करने की कारिवाई िरूु कर सकते ह।ैं ़िब्त की गई राजि के बराबर राजि लाइसेंसधारी को पंद्रह दिनों के भीतर िमा करनी होगी। (ऊ) बार-बार जनयमों का उल्लंघन, िान-बूझकर गलत काम करनाया सावििजनक जवतरण को कहीं और भेिन े या उसमें हरे - फेर करने िैसे कायों को गंभीर उल्लंघन माना िाएगा, इसके जलए सख्त सुधारात्मक कारिवाई की िाएगी, जिसमें लाइसेंस रद्द करना (ब्लैकजलसस्ट्टंग के साथ) और एफआईआरिि िकरना िाजमल ह।ै (ए) यदि दकसी प्राजधकृत 'उजचत िर िकु ान' के डीलर को अिालत ने इस आििे या 'आवश्यक वस्ट्तु अजधजनयम' (1955 का

10) की धारा 3 के अन् तगित बन ेदकसी अन्य आिेि या 'भारतीय न्याय संजहता' के प्रावधानों का उल्लघं न करने का िोिी ठहराया हयै ा उस े अनैजतक आचरण या आर्थिक अपराध का िोिी पाया गया है, तो आयुक्त या प्राजधकृत अजधकारी जलजखत आिेि के द्वारा उसका प्राजधकार को तुरंत रद्द कर सकते ह।ैं

5. जवद्धमान लाइससें -धारकों का पररवतनि जिन जवद्धमान लाइसेंस-धारकों को यह आिेि िारी होन े से पवू ि प्राजधकार दिया गया था, उन्ह ें बारह माह की बिलाव की अवजध के भीतर ₹5,000 का भुगतान करके वन टाइम लाइसेंस लेना होगा, बिते उपरोक्त खंड 3 में उजल्लजखत पात्रता ितों को परू ा करता हो;

यह भी उपबंजधत ह ै दक िलु ाई 2015 के बाि जनयिु जवद्धमान लाइसेंस-धारकों के जलए कम से कम िैक्षजणक योग्यता दकसी मान्यता प्राप्त बोडि स े10वीं कक्षा उत् तीणि होना अपेजक्षत होगा; आगे यह भी उपबंजधत ह ै दक िलु ाई 2015 से पूवि जनयिु लाइसेंस-धारकों के जलए न् यनू तम िक्षै जणक योग्यता अपेजक्षत नहीं होगी।

6. जिकायत जनवारण और लाइससें रद्द होन ेके जखलाफ अपील (अ) उजचत िर िकु ान के आवंटन स े असंतष्टु कोई भी आवेिक, जनणिय की सूचना जमलन े के तीस दिनों के भीतर आयक्ु त के पास अपील िायर कर सकता ह।ै आयुक् त अपील िायर होने की जतजथ से पतैं ालीस दिनों के भीतर उजचत कारण बतात े हुए आििे िारी करके इस अपील का जनपटारा करेंगे। आयुक् त का जनणिय अंजतम और बाध्यकारी होगा। (आ) कोई भी लाइसेंसधारी, जिसकी उजचत िर िकु ान का लाइसेंस प्राजधकृत अजधकारी द्वारा रद्द/समाप्त कर दिया गया हो और वह इससे असंतष्टु हो, तो वह आिेि जमलने की जतजथ से तीस दिनों के भीतर आयुक् त या उपायुक् त के पि से नीचे के न होने वाले दकसी प्राजधकृत अजधकारी के समक्ष जलजखत रूप म ेंअपील कर सकता है;

यह भी उपबंजधत ह ै दक आयुक् त या प्राजधकारी अजधकारी तीस दिनों की उि अवजध के बाि भी अपील पर जवचार कर सकते ह,ैं यदि वे इस बात से सतं ुष्ट हों दक अपीलकताि दकसी ठोस कारण स ेसमय पर अपील िायर नहीं कर पाया था:

आग े यह भी उपबंजधत ह ै दक आिेि से असंतुष्ट लाइसेंसधारी को अपील िायर करने से पहले अपनी िमानत राजि (जसक्योररटी जडपॉजिट) से अजधक की िुमािना और िेनिारी की राजि िमा करनी होगी। (इ) खडं (6) के उप-खडं (ख) के अन् तगित िायर प्रत् येक अपील, अपीलकताि के हस्ट्ताक्षर वाले एक ज्ञापन के रूप में होगी और इसके साथ उस आिेि की प्रमाजणत प्रजत भी सलं ग् न होगी जिसके जखलाफ अपील की िा रही ह।ै इस े आयुक् त के पास व् यजिगत रूप से या पंिीकृत डाक द्वारा भेिा िाएगा;8 DELHI GAZETTE : EXTRAORDINARY PART IV] (ई) यदि अपील स्ट्वीकार कर ली िाती है, तो सुनवाई की जतजथ तय की िाएगी और इसकी सूचना अपील करने वाल े और सहायक आयुक् त िोनों को भेिी िाएगी। अपील का जनपटारा होने तक, अपीलीय प्राजधकारी उस आिेि की कायिवाही पर रोक लगा सकता ह ैजिसके जखलाफ अपील की गई है;

यह भी उपबंजधत ह ैदकसुरक्षा राजि ़िब्त करने के आिेि के मामले म ेंकोई रोक का आििे नहीं दिया िाएगा। (उ) आयुक् त या प्राजधकृत अजधकारी, पक्षों को उपरोक्त को सुनन ेका अवसर िने ेके पश् चात, अपील दकए गए आिेि की पुजष्ट कर सकत ेह,ैं उसम ेंबिलाव कर सकते ह,ैं उस ेरद्द कर सकत ेह ैंया कोई ऐसा अन्य आिेि ि ेसकत ेह ैंजिसे वे उजचत समझें। (ऊ) आयुक् त या प्राजधकृत अजधकारी, खाद्य और आपूर्त ि जवभाग या पीजडत व्यजि की ओर से आविे न जमलन े पर या अपनी पहल पर, जविेि / अपर / संयक्ु त / सहायक आयुक् त द्वारा पाररत दकसी भी आिेि को संिोजधत कर सकत े ह ैं या अपन े या अपन ेपूविवती अजधकारी के आिेि की समीक्षा कर सकत े ह।ैं यह भी उपबंजधत ह ैदकउप-खडं (ख), (ग) और (ङ) म ेंअपील स े संबंजधत प्रावधान, संिोधन या समीक्षा के आवेिनों पर भी उसी तरह लाग ूहोंग;े आग े यह भी उपबंजधत ह ै दकऐसा कोई आििे पाररत नहीं दकया िाएगा जिससे दकसी व्यजि पर प्रजतकुल प्रभाव पडन े की संभावना हो, िब तक दक उस व्यजि को अपनी बात रखन ेका अवसर न दिया गया हो। (ए) आयुक् त या प्राजधकृत अजधकारी के आिेि से असंतष्टु कोई भी व्यजि, जवत् तीय आयुक् त, राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के समक्ष जलजखत रूप में अपील कर सकता ह।ै उप-खडं (ख), (ग), (घ) और (ङ) के अन् तगित आयुक्त के समक्ष अपील करन ेके संबंध म ेंजनधािररत प्रदक्रया, इस उप-खंड के अन् तगित जवत् तीय आयुक् त, राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के समक्ष की िान े वाली अपीलों पर भी उसी तरह लाग ूहोगी। (ऐ) इस आिेि म ेंदकसी भी बात के जनजहत होन ेके बाविूि, उप-राज्यपाल स्ट् वय ंसे जवत् तीय आयुक्त , आयुक् त या उनके अधीन दकसी अजधकारी के सामने हुई दकसी भी कायिवाही का ररकॉडि मंगा सकत े ह ैं और उसकी िांच कर सकत े ह।ैं ऐसा वे जवत् तीय आयुक् त, आयुक् त या उनके अधीन दकसी अन्य अजधकारी द्वारा ििि दकए गए या पाररत दकए गए दकसी भी जनष्किि या आििे के सही होन,े कानूनी होने या उजचत होन ेके बारे में स्ट् वयं को संतष्टु करने और उस पर अपनी समझ के अनुसार आिेि पाररत करन े के जलए कर सकते ह।ैं भाग-II जनर्िष्टि वस्ट्तओंु का जवतरण एव ंआपर्ू त।ि

7. उजचत िर िकु ान के डीलरों द्वारा आपर्ू त ि कोई भी उजचत िर िकु ान डीलर, 'राष्ट्रीय खाद्य सुरक्षा अजधजनयम, 2013' और 'दिल्ली खाद्य सरु क्षा जनयमावली, 2026' के अन्त गति स्ट् वीकृत रािन काडि के जबनाया केंद्र सरकार या राज्य सरकार द्वारा इस संबंध म ेंजनर्ििष्ट मूल् यों पर इस आिेि द्वारा या इसके अन्त गति दकये गए प्रावधानों के अनुसार दकसी भी व्यजि को जनर्ििष् ट वस्ट्तुएं नहीं बेचेगा, न आपूर्ति करने के जलए सहमत होगा, नहीं बेचेगा, न आपूर्त ि करेगा या न आपर्ू ति करन े की व्यवस्ट्था करन े से सहमत होगा।

8. जनर्िष्ि ट वस्ट्त ओंु के अजतररक्त अन्य मिों की आपर्ू त िऔर जवतरण के प्राजधकार का अजधकार इस आिेि में दकसी प्रावधान के जनजहत होते हुए, आयुक् त ‘उजचत िर िकु ान’ की आर्थिक व्यवहायिता को बढाने के जलए, जनर्ििष् ट वस्ट् तुओं के अजतररक्त अन् य मिों की आपूर्त ि एवं जवतरण का प्राजधकार ि ेसकते ह।ैं[PART IV DELHI GAZETTE : EXTRAORDINARY 9 भाग III जवजवध

9. जिला/सर्किल का गठन (क) आयुि राष्ट्रीय रािधानी क्षेत्र दिल्ली के संपणू ि क्षेत्र को राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के रािस्ट्व जिलों के साथ समवती जिलों में जवभाजित करेगा। (ख) आयुि इन जिलों को राष्ट्रीय रािधानी क्षेत्र दिल्ली के जवधानसभा क्षेत्रों के साथ समवती सर्किलों म ेंजवभाजित करेगा। यह भी उपबंजधत ह ै दक दिनांक 02.01.2026 के आिेि संख्या 3(58)/नीजत/एफ एंड एस/2025/08-18द्वारा जनर्िष्टि जिला और सर्किलों की सीमाएं इस खडं के अन् तगित संिोजधत या पनु रीजक्षत होन े तक इस आिेि के अन्त गति जनर्िष्टि समझी िाएगी।

10. उजचत िर िकु ान डीलरों के जलए जनिेि राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार म ेंसमस्ट्त उजचत िर िकु ानें: (क) जवभाग द्वारा अनुमोदित ई-पीओएस प्रणाली, जिसमें ई-पीओएस उपकरण, विन मापन ेका पैमाना और बाहरी आईररस स्ट्कैनर िाजमल हयैं ा जवभाग द्वारा समय-समय पर जनर्ििष्ट प्रणाली के माध्यम से संचाजलत होंगी, िब तक दक अन्यथा जनिेि न दिया िाए;

(ख) स्ट्टॉक, आवंटन और लने िेन की वास्ट्तजवक समय ररपोर्टिंग सुजनजित करेंगी; (ग) अजधसूजचत बायोमेररक या वैकजल्पक प्रमाणीकरण प्रोटोकॉल का अनुपालन करेंगी; (घ) सोमवार को साप्ताजहक अवकाि का पालन करेंगी और तीन राष्ट्रीय अवकािोंअथाित ् गणतत्रं दिवस (26 िनवरी), स्ट्वतंत्रता दिवस (15 अगस्ट्त) और गांधी ियंती (2 अक्टूबर) को भी बंि रहगें ी;

(ङ) उजचत िर िकु ान का नाम और पता, खुलने और बंि होन े का समय, िैजनक स्ट्टॉक की जस्ट्थजत, लाभार्थियों की पात्रता, उजचत िर िकु ान/सर्किल स्ट्तर पर सतकिता सजमजत के सिस्ट्यों का जववरण, जवभाग की हल्े पलाइन/टोल फ्री नंबर सजहत सभी वैधाजनक िानकारी प्रिर्िति करेंगी;

(च) खाद्य पिाथों के संरक्षण और जवतरण को सुजनजित करन े के जलए उपाय करेंगी; (छ) जवभाग को जवजभन्न ररपोटें समय पर प्रस्ट्तुत करना सुजनजित करना; (ि) उजचत िर िकु ान पर जनर्ििष्ट खाद्य वस्ट् तुओं की प्राजप्त पर जवभाग की वेबसाइट पर रक जचट/चालान को तरु ंत अद्यतन करना;

(झ) जवभाग द्वारा समय-समय पर िारी दकए गए अन्य जनििे ों का पालन करना।

11. छूट आयुक् त सामान्य या जविेि आिेि द्वारा दकसी व्यजि या व्यजियों के वग ि को इस आिेि के सभी या दकसी भी प्रावधान के िायरे स ेछूट िे सकत े ह ैंऔर दकसी भी समय उसी तरह ऐसी दकसी छूट को जनलंबन या रद्द कर सकते ह।ैं10 DELHI GAZETTE : EXTRAORDINARY PART IV]

12. उपराज्य पाल द्वारा िजियों का प्रत्यायोिन उपराज्य पाल सामान्य या जविेि आिेि द्वारा इस आििे के अन् तगित उन्ह ें प्रत् योजित प्रित् त िजिया ं अपन े अधीनस्ट् थ दकसी अजधकारी को सौंप सकत े ह।ैं

13. जनिेि िारी करन ेकी िजिया ं (क) आयुक् त इस आिेि के प्रावधानों को लागू करने के उद्देश्य से उजचत जनिेि िारी कर सकत े ह।ैं (ख) इस आिेि के प्रावधानों के अन् तगित या उनके द्वारा दिए गए दकसी भी जनिेि का उल्लघं न, इस आिेि का उल्लंघन माना िाएगा।

14. िानकारी और ररकॉडि मागं न ेकी िजि यदि आयुक्त / जविेि / अपर / उप / सहायक आयुक्त / खाद्य और आपूर्त ि अजधकारी इस संबंध म ें सामान्य या जविेि जनिेि िें, तो प्रत् यके अजधकृत उजचत िर िकु ान के डीलर को जनम्न करना होगा:

(क) उन्ह ें वे समस्ट्त अजधकृत िस्ट्तावे़ि और अन्य ररकॉडि सौंपने होंग े िो इस आिेि के अन्त गति या इसके उद्देश्य से उन्ह ें दिए गए थे; और (ख) जनर्ििष्ट वस्ट्तओंु के लेन-िेन और स्ट्टॉक से संबंजधत ऐसी िानकारी, खाते और जववरण िेन े होंगे जिनकी आवश्यकता हो। स्ट्पष्टीकरण: इस खडं के उद्देश्य के जलए, अजधकृत उजचत िर िकु ान डीलर म ेंवह डीलर भी िाजमल ह ैजिसका प्राजधकार जनलंजबत या रद्द कर दिया गया ह।ै

15. पररसर म ेंप्रविे करन ेऔर जनरीक्षण करने, िानकारी मागं न,े खातों की िाचं करन ेऔर वस्ट्तओंु को ़िब्त करन ेआदि की िजिया ं (अ) आयुक् त या जवभाग का कोई भी अजधकारी िो खाद्य और आपूर्ति जनरीक्षक के पि से नीचे का न हो, वह ये कर सकता ह:ै (क) जनर्ििष्ट वस्ट्तओंु के स्ट्टॉक, दकताबों, खातों या जनर्ििष्ट वस्ट्तओंु के लने -िने से संबंजधत अन्य िस्ट्तावेिों का जनरीक्षण और ऐसे जनरीक्षण के उद्देश्य से दकसी भी पररसर म ेंप्रवेि करना तथा यदि आवश्यक हो, तो दकसी भी जनर्ििष्ट वस्ट्तु की जबक्री या जवतरण या भंडारण के जलए उपयोग दकए िाने वाले या उपयोग दकए िाने की संभावना वाले पररसर या दकसी प्रजतष्ठान के पररसर को तोडकर खोलना या सील करना;

(ख) दकसी भी व्यजि से कोई बयान िेने या कोई िानकारी िेने या उसके कब्िे या जनयंत्रण में दकसी भी िस्ट्तावेि या वस्ट्तु को प्रस्ट्तुत करन े करन े की मांग करना िो दकसी जनर्ििष्ट वस्ट्तु की खरीि, जबक्री, जवतरण तथा भंडारण से संबंजधत हो, और ऐसा कह ेिान े पर उस व्यजि को उस मांग का पालन करना होगा;

(ग) दकसी भी व्यजि से खात े या दकसी जनर्ििष्ट वस्ट्त ु की खरीि, जबक्री, जवतरण या भंडारण स े संबंजधत या उससे संबंजधत मानी िान ेवाली दकताबों, खात ेया अन्य िस्ट्तावेिों को प्रस्ट्तुत करने की मांग करना, और ऐसा कह ेिाने पर उस व्यजि को उस मागं का पालन करना होगा;[PART IV DELHI GAZETTE : EXTRAORDINARY 11 (घ) उप-खंड (ख) या उप-खडं (क) के अंतगित प्रस्ट्तुत दकसी जनर्ििष्ट वस्ट्त ु की खरीि, जबक्री, जवतरण या भंडारण स े संबंजधत दकसी भी िस्ट्तावेि के उद्धरण या प्रजतयां लेना या लने े का कारण बनना, या अन्यथा ऐसे दकसी पररसर में पाया िाना;

(ङ) जनर्ििष्ट वस्ट्तुओं की जबक्री या जवतरण स े संबंजधत दकसी भी लने -िेन म ें उपयोग की िान े वाली या उपयोग दकए िाने की संभावना वाली दकसी भी तौल या माप की सटीकता का परीक्षण करना या परीक्षण करवाना; (च) ऐसे दकसी भी पररसर म ेंपाई िाने वाली सभी या दकसी भी जनर्ििष्ट वस्ट्त ुका तौल करना या तौल करवाना;

(छ) जबक्री के जलए रखी गई जनर्िष्टि वस्ट्तओंु के नमून े लने ा या उन्ह ें लेन े की व्यवस्ट्था करना, तादक जबक्री के जलए प्राजधकृत की गई ऐसी जनर्ििष्ट वस्ट्तुओं के स्ट्वीकृत नमूनों से उनकी तलु ना की िा सके या उनका जवश्लेिण दकया िा सके;

(ि) ऐसी दकसी भी पररसर की तलािी लेना और दकसी भी वस्ट्तु या िस्ट्तावे़ि ़िब्त करना, जिसके बारे में उस े यह मानने का कारण हो दक इस आिेि के अंतगित या इसके अनुसार बनाए गए दकसी जनयम का उल्लघं न दकया गया ह ैया दकया िा रहा ह;ै (आ) भारतीय न्याय संजहता, 2023 के प्रासंजगक प्रावधान, िहां तक संभव हो, इस खंड के अंतगित तलािी और ़िब्ती पर लाग ूहोंगे। (इ) इस खंड के अधीन प्रयोग की िान ेवाली िजियों का प्रयोग इस आिेि के प्रावधानों के अनपु ालन को सुजनजित करन े के उद्देश्य के अजतररि दकसी अन्य उद्देश्य के जलए नहीं दकया िाएगा। (ई) उप धारा (क) के अतं गति अजधकृत दकए िान ेवाल ेगरै -आजधकाररक व्यजि या व्यजियों के समूह को जनर्ििष्ट वस्ट्तओंु के जवतरण के जलए इस आिेि के अंतगित प्राजधकृत उपभोिा खाद्य काडों और उजचत िर िकु ानों के जनरीक्षण के उद्देश्य के अजतररि दकसी अन्य उद्देश्य के जलए प्राजधकृत नहीं दकया िाएगा।

16. इस आिेि के अतं गति की गई कारिवाई का सरं क्षण इस आििे के अंतगित सद्भावनापूविक दकए गए या दकए िान े वाले दकसी भी कायि के जलए दकसी भी व्यजि के जवरुद्ध कोई मुकिमा, अजभयोग या अन्य कानूनी कायिवाही नहीं की िाएगी।

1. यह प्राजधकरण हस्ट्तांतरणीय नहीं ह ै और उजचत िर िकु ान का धारक आयुि या प्राजधकृत अजधकारी स े पूव ि जलजखत अनुमजत के जबना फमि के गठन में दकसी भी प्रकार का पररवतिन नहीं करेगा या उजचत िर िकु ान चलाने के जलए दकसी भी व्यजि को कोई सामान्य अजधकार पत्र नहीं िेगा।

2. यह प्राजधकरण उजचत िर िकु ान में एक प्रमुख स्ट्थान पर प्रिर्िित दकया िाएगा और आवश्यकतानुसार जनरीक्षण के जलए प्रस्ट्तुत दकया िाएगा।

5. उजचत िर िकु ान का धारक कुिलतापूविक, िीघ्रता से और व् यावसाजयक तरीके से तथा समय-समय पर दिए गए जनिेिों और आििे ों के जवजनर्ििष् ट वस्ट् तओंु की खुिरा जबक्री करन े के जलए उत्तरिायी होगा।

6. उजचत िर िकु ान का धारक जवभागअनुमोदित ईपीओएस प्रणाली के माध्यम से संचालन करेगा-, जिसमें ई पीओएस- उपकरण, विन मापने का पैमाना और बाहरी आईआरआईएस स्ट्कैनर िाजमल होंगे, या िैसा दक जवभाग द्वारा समय-समय पर पररभाजित दकया गया हऔै र िब तक अन्यथा जनिेि न दिया िाए; तथा भडं ारण, आवंटन और लेनिेन की वास्ट्तजवक समय ररपोर्टिंग सुजनजित करेगा।

7. उजचत िर िकु ान के धारक को उजचत िर िकु ान का नाम और पता, उसके खलु न ेऔर बंि होन ेका समय, िैजनक भंडारण की जस्ट्थजत, लाभार्थियों की पात्रता, उजचत िर िकु ान सर्किल स्ट् तर पर सतकिता सजमजत के सिस्ट्यों के जववरण, जवभाग की हल्े पलाइन टोल-फ्री नंबर सजहत सभी वैधाजनक िानकारी/प्रिर्िित करना होगा; तथाजवजनर्ििष्ट वस्ट्तओंु के सीलबंि नमनू े अपनी उजचत िर िकु ान म ेंप्रमुख स्ट्थान पर भंडार म ेंरखन े होंगे।

8. उजचत िर िकु ान के धारकद्वारा जिकायत पुजस्ट्तका को प्रमुख स्ट्थान पर प्रिर्िति करना होगा, िो जिकायत ििि करन े के जलए उपभोिाओं को मागं न ेपर उपलब्ध कराई िाएगी।

9. उजचत िर िकु ान के धारक को एक जनरीक्षण पुजस्ट्तका भी अनुरजक्षत रखनी होगी और उस ेअजधकाररयों और जनरीक्षण स्ट् टाफ द्वारा मांग ेिाने पर उपलब्ध कराना होगा।

10. उजचत िर िकु ान के धारक को जनधािररत कायि समय और िोपहर के भोिन के समय का पालन करना होगा। िकु ान को कायि समय के िौरान ऐसे अजधकारी, िो खाद्य एवं आपूर्त ि अजधकारी के रैंक से नीचे का न हो, से पूवि जलजखत अनुमजत के जबना बंि नहीं रखा िाएगा।

11. उजचत िर िकु ान का धारक खुल ेबािार में दकसी भी ऐसी वस्ट्त ुका व्यापार नहीं करेगा जिसे आिेि के अन्त गति जवजनर्ििष्ट वस्ट्तु घोजित दकया गया होअथवा न हीवह कोई आटा चक्की (चक्क ी)लगाएगा या चलाएगाअथवा न ही कोई ऐसा प्रजतष्ठान चलाएगा जिसमें दकसी जवजनर्ििष्ट वस्ट्त ुका उपभोग दकया िाता हो।

12. उजचत िर िकु ानका धारक जनर्ििष्ट वस्ट्तुओं को केवल उि आििे द्वारा या उसके अन्त गति जनधािररत तरीके से ही प्राप्त करेगा और जनर्ििष्ट वस्ट्तओंु की जबक्री के जलए सरकार द्वारा जनधािररत मूल्य से अजधक मल्ू य नहीं लगे ा या आयुि अथवा प्राजधकृत अजधकारी द्वारा उस ेजलजखत रूप में सूजचत दकए गए मल्ू य से अजधक मूल्य नहीं लगे ा।

13. उजचत िर िकु ान का धारक उि आिेि के अन् तगित केवल िारी दकए गए और इस उििेश् य हते ु उसके साथ पंिीकृत दकए िाने के जलए प्राजधकृत वैध और प्राजधकृत िस्ट्तावेिों के जनजमत् त जनर्ििष्ट वस्ट्तओंु की आपर्ू ति करेगा।

14. उजचत िर िकु ान का धारक उस भवन के दकसी अन्य भाग तक पहुचँ प्रिान करने वाल े दकसी भी िरवािे या जखडकी को स्ट्थायी रूप से बंि रखगे ा जिसमें उजचत िर िकु ान जस्ट्थत ह।ै

15. उजचत िर िकु ान का धारक इस आििे के दकसी भी प्रावधान या आवश्यक वस्ट्तओंु स े संबंजधत दकसी अन्य कानून का उल्लघं न नहीं करेगा िो उस समय लागू हो।

16. उजचत िर िकु ान का धारक अपने भंडार और खातों की िाँच म ेंजनरीक्षण स्ट् टाफ को परू ा सहयोग और सहायता प्रिान करेगा तथा अपन ेव्यवसाय के संबंध में उनसे यथा अपेजक्षत िानकारी िेगा।

17. उजचत िर िकु ान का धारक प्राजधकृत अजधकारी द्वारा जनर्ििष्ट वस्ट्तुओं की खरीि, जबक्री और भडं ारण तथा उनके खातों के रखरखाव और प्रस्ट्ततु दकए गए जववरणों के तरीकों के संबंध में दिए गए दकसी भी जनिेि या आििे का पालन करेगा।

18. िब भी सरकार द्वारा दकसी जनर्ििष्ट वस्ट्त ु के मौिूिा जनगिम मूल्य म ें या तो वृजद्ध या कमी की िाती है, तो संिोजधत जनगमि मूल्य के लाग ू होन े की जतजथ स े पहली सुबह तक जनर्िष्टि खाद्य पिाथों के भंडार का आकलन दकया िाना चाजहए और इसकी18 DELHI GAZETTE : EXTRAORDINARY PART IV] सूचना सरकार के उन अजधकाररयों को िी िानी चाजहए जिन्ह ेंइस उद्देश्य के जलए जविेि रूप से प्राजधकृत दकया गया हो। मल्ू य में वृजद्ध होने की जस्ट्थजत में, भडं ार में रखी गई जनर्ििष्ट वस्ट्तुओं की मात्रा पर अंतर लागत आयिु या प्राजधकृत अजधकारी द्वारा यथाजवजनर्ििष्ट तरीके से सरकार को भेिी िानी चाजहए। इसी प्रकार, मल्ू य में कमी होने की जस्ट्थजत म,ें अंतर लागत की धन वापसी का िावा सरकार के उन अजधकाररयों को प्रस्ट्तुत दकया िाना चाजहए जिन्ह ें इस उद्देश्य के जलए जविेि रूप से प्राजधकृत दकया गया होऔर िो आवश्यक धन वापसी की व्यवस्ट्था भी करेंगे।

19. उजचत िर िकु ान के धारक से िेय कोई भी राजि भू-रािस्ट्व के बकाया के रूप म ेंवसूल की िाएगी। FOOD, SUPPLIES AND CONSUMER AFFAIRS DEPARTMENT

ORDER Delhi, the 24th July, 2026 F. No. No: F.3(65)/Policy/Control Order/F&S/2026/685-715 — Whereas the Lieutenant Governor, Delhi is of the opinion that it is necessary and expedient so to do for effective monitoring and implementation of National Food Security Act, 2013 and various Control Orders in the National Capital Territory of Delhi,

And whereas, the existing Delhi Specified Articles (Regulation of Distribution) Order, 1981 is urgently required to be updated in view of the National Food Security Act, 2013 and various Control Orders made thereunder,

Now, therefore, in exercise of the powers conferred by sub Section 3 of the Essential Commodities Act, 1955 (10 of 1955) read with the Government of India, Ministry of Agriculture and Irrigation (Department of Food) Order GSR 800 dated 9th June 1978 and Ministry of Industries and Civil Supplies (Department of Civil Supplies and Cooperation) Order S.O.681(E), dated 30th November 1974 and Targeted Public Distribution System (Control) Order, 2015 and in supersession of Delhi Specified Articles (Regulation of Distribution) Order, 1981published in the Delhi Gazette dated 12th January, 1981, except as respects things done or omitted to be done before such supersession, the Lieutenant Governor hereby makes the following

order to carry out the provisions of the National Food Security Act, 2013 and the Delhi Food Security Rules, 2026:

Part-I Preliminary

1. Short title and commencement:

(a) This order shall be called the Delhi Specified Articles (Regulation of Distribution) Order, 2026.

(b) It extends to the whole of the National Capital Territory of Delhi.

(c) It shall come into force from the date of its publication in the Official Gazette.

2. Definitions:

(A) In this Order unless the context otherwise requires:

(a) “Appellant” means a person which makes an appeal against the order of suspension / cancellation of authorization;

(b) "Authorised Officer" means the Special / Additional / Joint / Deputy / Assistant Commissioner of the Department and includes any other officer not below the rank of Assistant Commissionerauthorized by the Commissioner, to exercise all or any of the powers under this

Order;

(c) “Commissioner” means the Commissioner of the Department;(d) “District and Circle" means District and Circle referred to in Clause 9;

(e) "Financial Commissioner" means the Financial Commissioner appointed for the National Capital Territory of Delhi;

(f) "Food and Supplies Officer" means the Food and Supplies Officer of the Department;

(g) "Forms" means a Form appended to this Order;

(h)"Lieutenant Governor" means the Lieutenant Governor of the National Capital Territory of Delhi, appointed under article 239 of the Constitution of India;

(i) “Order” means the Delhi Specified Articles (Regulation of Distribution) Order, 2026;

(j) “Rules” means Delhi Food Security Rules, 2026 published in the Delhi Gazette dated 2nd February, 2026;

(k)"Specified article" means rice and wheat and any other commodity as may be notified by the Government from time to time;

(B) The words and expressions used herein but not defined in this Order shall have the same meaning as assigned to them in the Essential Commodities Act, 1955, the National Food Security Act, 2013, the Targeted Public Distribution System (Control) Order, 2015 and the Delhi Food Security Rules, 2026.

3. Issuance and Regulation of Fair Price Shop Licenses, herein afterwards referred as License:

(A) Regular license

(a) A Regular license shall be valid until suspended or cancelled in accordance with law;

(b) shall not require periodic renewal;

(c) shall be non-transferable, non-assignable and non-inheritable, including on the death of the licensee; and

(d) shall automatically lapse upon cancellation or surrender.

(B) Temporary license

(a) A Temporary license may be granted only to meet emergent service gaps in public distribution where supply of Specified Food Articles under National Food Security Act, 2013 cannot be ensured through existing network of Fair Price Shops;

(b) Such license shall be valid for a maximum period of three months, extendable once for reasons to be recorded in writing;

Provided that the extension shall be permitted under Clause (b) only where regular licensing could not be completed for reasons beyond administrative control;

(c) Grant of a temporary license shall not confer any right or preference for grant of a regular license;

(d) The process for grant of a regular license shall be initiated within thirty days of grant of a temporary license.

(C) Eligibility The following entities shall be eligible to apply for a license, subject to fulfillment of prescribed

conditions:

(a) Individual / Proprietor;

(b) Self-Help Group, including Women Self-Help Group;

(c) Cooperative Societyregistered under the Delhi Cooperative Societies Act, 2003;

(d) Non-Government Organization / Society registered under applicable law;20 DELHI GAZETTE : EXTRAORDINARY PART IV]

(e) Partnership Firm registered under the Partnership Act, 1932;

(f) Limited Liability Partnership;

(g) Company incorporated under the Companies Act, 2013.

(D) Limits on number of licenses

(a) An individual / proprietor, partnership firm or Limited Liability Partnership shall be eligible for only one license;

(b) Self-Help Group, Cooperative Society, Non-Government Organization / Society registered under applicable law and Companies incorporated under the Companies Act, 2013 may be granted

licenses subject to:

(i) a maximum of five Fair Price Shops per revenue district; or

(ii) such other overall ceiling as may be notified by the Government from time to time.

(E) Age, educational qualification and residence

The applicant or authorized representative shall:

(a) have attained the age of twenty-one years and not exceeded sixty years on the last date of

application:

Provided that ex-servicemen and women shall be entitled to a relaxation of five years in the upper age limit;

Provided further that the successful applicant may be allowed to run the FPS till last day of the month in which he/she attains the age of 70 years. No licensee above the age of 70 years shall be allowed to run the FPS.

(b) possess minimum educational qualification of Class XII pass from a recognized Board; and

(c) be a citizen of India and resident of the same revenue district in which the Fair Price Shop is proposed to be located.

(F) Disqualifications

No license shall be granted to a person who:

(a) is of unsound mind;

(b) has previously had his Fair Price Shop or kerosene oil depot license cancelled for malpractice;

(c) already holds a license where such holding is restricted;

(d) has been convicted, or against whom charges have been framed or cognizance taken, for offences under the Essential Commodities Act, 1955, the Bhartiya Nyaya Sanhita, or any offence involving moral turpitude or economic offence; or

(e) has furnished false information or suppressed material facts.

(G) Premises for Fair Price Shop

The Fair Price Shop premises shall:

(a) have a minimum area of fifteen square metres;

Provided that if the area of the FPS premises is less than twenty-five square metres, it shall be made up through additional storage premises located in close proximity;

(b) have road access of not less than ten feet;

(c) be a pucca structure, and be always maintained dust-free and moisture-free;

(d)have adequate vertical clearance (around 3 metres) for safe storage and movement;

(e) not have more than one door, and; grilled window with fixed glass; and

(f) be held under legal possession (ownership/lease/rental) normally for a minimum period of three years on the date of application.[PART IV DELHI GAZETTE : EXTRAORDINARY 21

Provided that minor deviations not affecting safety, hygiene or integrity of public distribution may be condoned by the Licensing Committee with reasons recorded in writing.

(H) Application process

(a) Applications shall be submitted online only through the designated departmental portal;

(b) The application shall be accompanied by documents specified in Annexure-I;

(c) Applications would need to be submitted within two weeks of issuance of advertisement.

(I) Application fee The application shall be accompanied by a non-refundable fee of:

(a) ₹1,000 for a Regular license; and

(b) ₹500 for a Temporary license.

(J) Selection process

(a)A pre-notified weightage-based marking scheme (Annexure-IV)shall be published along with the advertisement inviting applications;

(b) Inspection of premises shall be conducted through geo-tagged inspection with photographic evidence;

(c) Selection shall be made by a Selection Committee comprising:

(i) Special / Additional Commissioner of the Department: Chairperson

(ii) One Assistant Commissioner (other than concerned district): Member

(iii) One nominee from IT Wing of the Department: Member.

(d) Recommendations of the Committee shall be placed before the Hon’ble Minister, Food & Supplies, for approval. After approval, Commissioner or the officer authorized by him shall issue the license to the selected applicants in Form-C (ANNEXURE-V)

(K) Security deposit and license fee

(a) The successful applicant shall furnish a performance guarantee, depending on the number of

Ration Cards attached to the Fair Price Shop:

(c) One-time license fee shall be ₹10,000.

(d) Fee for issue of duplicate license shall be ₹500.

4. Monitoring, Corrective Action and Suspension / Cancellation of License

(A) Any violation of this Order, the National Food Security Act, 2013, the Essential Commodities Act, 1955, or applicable Control Orders shall attract graded and proportionate corrective action, including warning, forfeiture of whole or part of performance guarantee, suspension, cancellation of license, and/or initiation of criminal proceedings, as the case may be.

(B) Stock Variation – Minor Irregularity Where a variation exceeding 25 Kilograms but not exceeding 50 kilograms of SFAs in aggregate is detected a penalty of ₹2000 shall be forfeited from the amount of performance guarantee on each occasion and the deficit quantity will need to be made good in a weeks’ time by the licensee. The equivalent of the amount so forfeited, shall have to be remitted by Licensee within 15 calendar days.

(C) Stock Variation – Major Irregularity22 DELHI GAZETTE : EXTRAORDINARY PART IV] Where a variation exceeding 50 kilograms but not exceeding 100 kilograms of SFAs in aggregate is

detected:

(a) ₹10,000 shall be forfeited from the amount of performance guarantee, and the FPS license shall be suspended forthwith as an interim measure. The equivalent of the amount so forfeited, shall have to be remitted by Licensee within 15 calendar days;

(b) Quasi-judicial proceedings shall be initiated by the Authorized Officer to determine responsibility, intent, consequential recovery, if any, and appropriate penal action, including continuation or cancellation of license.

(D) Stock Variation – Serious Irregularity Where a variation exceeding 100 kilograms of SFAs in aggregate is detected:

(a) forfeiture of entire performance security;

(b) the FPS license shall be suspended immediately;

(c) an FIR shall be lodged under Sections 7 and/or 10 of the Essential Commodities Act, 1955, wherever ingredients of the offence are made out; and

(d) quasi-judicial proceedings shall be initiated by the Authorized Officer for determination of responsibility, intent, consequential recovery, if any, and appropriate penal action for missing food grains, including continuation or cancellation of license.

(e) Consequential recovery/ liability in excess of the performance guarantee shall be recoverable from the licensee as arrear of land revenue.

(E) Violations Other Than Stock Variation In case of violations including, but not limited to:

(a) failure to display mandatory information such as license particulars, working hours, weekly off, grievance redressal mechanism, stock position, and price lists;

(b) non-display or non-maintenance of samples of Specified Food Articles;

(c) tampering with or misuse of e-PoS devices or weigh balances;

(d) non-installation or non-maintenance of fire safety equipment;

(e) discourteous behavior towards beneficiaries;

(f) unhygienic storage or sale conditions; or

(g) failure to maintain cleanliness of the Fair Price Shop premises.

The Commissioner or the Authorized Officer may, after following due process, forfeit amount upto ₹25,000 (Rupees Twenty-Five Thousand Only) and/or initiate license cancellation proceedings, depending upon the gravity and recurrence of the violation. The equivalent of the amount so forfeited, shall have to be remitted by Licensee within fifteen days.

(F) Repeated violations, deliberate malpractice, or acts indicating diversion or manipulation of public distribution shall be treated as aggravating factors for enhanced corrective, including cancellation of license (with blacklisting) and registration of FIR.

(G) Where an authorized Fair Price Shop dealer has been convicted by a court of law in respect of contravention of any of the provisions of this Order or any other Order made under section 3 of the Essential Commodities Act (10 of 1955) or under the provision of the Bhartiya Nyaya Sanhita, or of any offence involving moral turpitude or economic offence, the Commissioner or the Authorized Officer may, by an order in writing, cancel the authorization forthwith.

5.Transition of existing licensees Existing licensees who have been issued authorisation prior to issuance of this Order shall opt for a one-time license on payment of ₹5,000, subject to fulfillment of the eligibility conditions as in Clause 3 above, within a transition period of twelve months;

Provided that the minimum educational qualification requirement in case of existing licensees appointed after July 2015 shall be Class X pass from a recognized Board;

Provided further that for licensees appointed prior to July 2015, the minimum educational qualification shall not be a requirement.[PART IV DELHI GAZETTE : EXTRAORDINARY 23

6. Grievance Redressal and Appeal Against Cancellation of License

(A) Any aggrieved applicant against the allotment of FPS may file an appeal before the Commissionerwithin thirty days of communication of the decision, which shall be disposed of by the Commissioner by a reasoned order within forty-five days from the date of filing of appeal. The decision of the Commissioner shall be final and binding.

(B) Any licensee aggrieved by the cancellation/ termination of license of hisFair Price Shop by the authorized officer may prefer an appeal in writing before the Commissioner or any Authorised Officer, not below the rank of Deputy Commissioner, within a period of thirty days from the date of receipt of the order by such person;

Provided that the Commissioner or the Authorized Officer may entertain the appeal after the said period of thirty days, if he is satisfied that the appellant was prevented by sufficient cause from filing

the appeal in time:

Provided further that the licensee aggrieved by the order shall deposit the penalty and liability amount exceeding beyond his security deposit before filing the appeal.

(C) Every appeal filed under sub-Clause (B) of Clause (6) shall be in the form of a memorandum signed by the appellant and shall be accompanied by an attested copy of the order appealed against. It shall be presented in person or sent by registered post to the Commissioner;

(D) If the appeal is admitted, a date for hearing will be fixed for which notice shall be sent to the appellant as also to the Assistant Commissioner. Pending disposal of the appeal, the appellant authority may stay the operation of the order appealed from;

Provided that no stay order shall be granted in case of an order forfeiting the security amount.

(E) The Commissioner or Authorized Officer, may after giving the parties an opportunity of being heard as aforesaid, confirm, vary or set aside the order appealed from or pass such other order as he may deem fit.

(F) The Commissioner or Authorized Officermay, upon receipt of an application either on behalf of the Food and supplies Department or the aggrieved person or of his own motion revise any order passed by the Special / Additional / Joint/ Deputy / AssistantCommissioner or review his own order or that of his predecessor.

Provided that the provisions relating to appeals contained in sub-Clauses (B), (C),and (E) shall mutatis-mutandis apply to the Applications for revision or review;

Provided further that no order which is likely to affect any person adversely shall be passed unless such a person has been given an opportunity of being heard.

(G) Any person aggrieved by the order of the Commissioner or Authorized Officer may prefer an appeal in writing before the Financial Commissioner, Govt. of NCT of Delhi. The procedure laid down in regard to submission of appeal before the Commissioner under sub-Clause (B), (C), (D)and (E) shall mutatis-mutandis apply to the appeals before the Financial Commissioner, Govt. of NCT of Delhi, under this sub-Clause.

(H) Notwithstanding anything contained in this Order, the Lieutenant Governor may call for and examine suo-moto the record of any proceedings before the Financial Commissioner or the Commissioner or any officer subordinate to him, for the purpose of satisfying himself as to the correctness, legality or propriety of any finding or order recorded or passed by the Financial Commissioner and24 DELHI GAZETTE : EXTRAORDINARY PART IV] Commissioner or any other officer subordinate to him, and to pass thereon such order as he thinks fit.

PART-II DISTRIBUTION AND SUPPLY OF SPECIFIED ARTICLES.

7. Supply by Fair Price Shop dealers:

No Fair Price Shop dealer shall sell or agree to sell or supply or agree to supply or cause to sell or supply specified articles to any person except against the ration cards approved under National Food Security Act, 2013 and Delhi Food Security Rules, 2026 and except at such prices as may be specified by the Central Government or by the State Government in this behalf and except under and in accordance with the provisions made by or under this Order.

8. Power to authorize supply and distribution of Items other than Specified Articles Notwithstanding any other provisions of this Order, the Commissioner may authorize the supply and distribution of items other than specified articles to increase the economic viability of the Fair Price Shop.

Part III Miscellaneous

9. Formation of District / Circle

(A) The Commissioner shall divide the entire area of the National Capital Territory of Delhi into Districts co-terminus with Revenue Districts of GNCT of Delhi.

(B) The Commissioner shall further divide the Districts into Circles co-terminus with Assembly Constituencies of National Capital Territory of Delhi.

Provided that the boundaries of District and Circles specified vide order No.

3(58)/Policy/F&S/2025/08-18, Dated 02.01.2026 shall be deemed to be specified under this Order until modified or revised under this Clause.

10. Instructions to Fair Price Shop dealer:

All Fair Price Shops in Government of National Capital Territory of Delhi shall:

(a) operate through Department-approved e-PoS system including e-PoS device, weighing scale & external IRIS Scanner or as specified by the Department from time to time, and unless otherwise directed;

(b) ensure real-time reporting of stock, allocation and transactions;

(c) comply with biometric or alternate authentication protocols as notified;

(d) observe weekly off on Monday and also remain close on three National holidays, i.e. Republic Day(26th January), Independence Day (15th August) and Gandhi Jayanti (2nd October);

(e) display all statutory information including name and address of Fair Price Shop, opening and closing time of Fair Price Shop, daily stock position, entitlement of beneficiaries, details of members of vigilance committee at Fair Price Shop / Circle level, helpline/ toll free number of the Department;

(f) take measures to ensure food articles are preserved and distributed in good condition;

(g) ensure timely submission of various reports to Department;

(h) update the truck chit/ challan on Department website immediately on receipt of the Specified Food Articles at Fair Price Shop;

(i) follow other instruction as issued by the Department from time to time.[PART IV DELHI GAZETTE : EXTRAORDINARY 25

11. Exemption The Commissionermay by general or special order exempt any person or class of persons from the operation of all or any of the provisions of this Order and may at any time in the like manner suspend or rescind any such exemption.

12. Delegation of Powers by The Lieutenant Governor The Lieutenant Governor may by general or Special Order delegate the powers conferred on him under this order to any officer subordinate to him.

13. Powers to issue directions

(A) The Commissionermay issue appropriate directions for the purpose of giving effect to the provisions of this Order.

(B) Any contravention of any direction given by or under the provisions of this Order shall be deemed to be contravention of this order.

14. Power to call for Information & Records Every authorized Fair Price Shop dealer when so required by general or special directions by the Commissioner / Special / Additional/ Deputy/ Assistant Commissioner / Food & Supplies Officer in

this behalf shall:

(A) Deliver to him all authorized documents and other records surrendered or given to him under or for the purpose of this Order; and

(B) Furnish such particulars, accounts and information relating to his dealings in and stocks of specified articles as may be required.

EXPLANATION: For purpose of this Clause an authorized Fair Price Shop dealer includes a dealer also whose authorization has been suspended or cancelled.

15. Powers to enter and inspect premises, require information, check accounts and seize articles etc.

(A) The Commissioner or any Officer of the Department not below the rank of Food and Supplies

Inspector may:

(a) Inspect any stocks of specified articles, books, accounts or other documents pertaining to dealing in specified articles and for the purpose of such inspection enter and ifnecessary,break- open or seal any premises used or believed to be used for the sale or distribution or storage of any specified article or the premises of an establishment;

(b) require any person to make any statement or furnish any information or produce any document or article in his possession or under his control relating to the purchase, sale, distribution and storage of any specified article and any person so required shall comply with such requisition;

(c) require any person to render an account or to produce books, accounts or other documents relating to or believed to be relating to the purchase, sale distribution or storage of any specified article and any person so required shall comply with such requisition;

(d) take or cause to be taken extracts from or copies of any document relating to the purchase, sale, distribution or storage of any specified article which is produced under sub-Clause (b) or sub- Clause(a) or other-wise found in any such premises;26 DELHI GAZETTE : EXTRAORDINARY PART IV]

(e) test or cause to be tested the correctness of any weight or measure used or believed to be used in any transaction relating to the sale or distribution of any specified articles;

(f) take or cause to be taken the weight of all or any of the specified articles found in any such premises;

(g) take or cause to be taken samples of specified articles kept for sale for comparing with the approved samples of such specified articles authorized for sale or for analysis;

(h) search any such premises and seize any article and document in respect of which he has reason to believe that any provisions made by or in pursuance of thisOrder has been or is being contravened;

(B) The relevant provisions of Bhartiya Nyaya Sanhita, 2023 shall, so far as shall be, apply to searches and seizures under this Clause.

(C) The powers exercisable under this Clause shall not be exercised except for the purpose of securing compliance with provisions of this order.

(D) The non-official persons or body of persons to be authorized under sub-section (A) shall not be authorized for any purpose other than the purpose of inspection of consumer food cards and fair price shops authorized under this order, for the distribution of specified articles.

16. Protection of the action taken under this Order No suit, prosecution, or other legal proceeding shall lie against any person for any action, done or intended to be done under this order in good faith.

17. Repeal and Savings The Delhi specified Food Articles (Regulation and Distribution) order, 1981 is hereby rescinded:

Provided that notwithstanding anything to the Contrary contained in this Order, such rescission shall not affect the previous operation of the Delhi specified Food Articles (Regulation of Distribution)

order, 1981, or anything done or suffered there under or any right, privilege, obligation or liability acquired/accrued or incurred under the said Order-or-any-penalty, forfeiture or punishment incurred or imposed in respect of any offence committed under the said Order or any investigation legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture of punishment as aforesaid and any such investigation, legal proceeding or remedy may be instituted, continued or enforced and any such penalty forfeiture-or punishment may be imposed as if the said

order has not been rescinded.

Provided further that the provisions of this Order shall be in addition to and not in substitution of or in diminution of the requirements imposed by the Act and controls Orders made thereunder.

1. This authorization is non- transferable and the fair price shop holder shall not change the constitution of the firm in any way or give any general power of attorney to any person for running the fair price shop without prior permission in writing from the Commissioner or the Authorized Officer.

2. This authorization shall be displayed at a prominent place in the fair price shop and shall be produced for inspection when required.

3. This authorization is valid only for the premises specified therein and the Fair Price shop holder shall not store any specified article at any other place without prior permission in writing of the Authorised Officer

4. This authorization is liable to be amended withdrawn, suspended, revoked, rescinded or cancelled in accordance with the provision of theOrder

5. The fair price shop holder shall be responsible for carrying out the retail sale of specified articles efficiently, promptly and in a businesslike manner and in accordance with the directions and instructions given to him/her from time to time.

6. The fair price shop holder shall operate through Department-approved e-PoS system including e-PoS device, weighing scale & external IRIS Scanner or as defined by the Department from time to time, and unless otherwise directed; and ensure real-time reporting of stock, allocation and transactions

The fair rice shop holder shall display all statutory information including name and address of Fair Price Shop, opening and closing time of Fair Price Shop, daily stock position, entitlement of beneficiaries, details of members of vigilance committee at Fair Price Shop / Circle level, helpline/ toll free number of the Department; and place sealed samples of the specified articles in stock at conspicuous place at his fair price shop.[PART IV DELHI GAZETTE : EXTRAORDINARY 31

8. The fair price shop holder shall also display at the conspicuous place the complaint Book which shall be made available to consumers on demand for recording complaint.

9. The fair price shop holder shall also maintain an Inspection Book and make the same available on demand by the officers and inspecting staff.

10. The fair price shop holder shall observe the prescribed working hours and lunch interval. The shop shall not be kept closed during working hours without prior permission in writing from an officer not below the rank of Food and Supplies Officer.

11. The fair price shop holder shall not deal in any articlesin the open market which is declared to be a specified article under the Order or install or run any flour mill (chakki) or run any establishment in which any specified article is consumed.

12. The fair price shop holder shall obtain the specified articles only in the manner laid down by or under the said order and shall not charge price higher than the price fixed by the Government for the sale of specified articles or communicated to him/ her in writing by the Commissioner or the Authorized Officer.

13. The fair price shop holder shall supply specified articles only against valid and authorized documents issued under the said order and authorized to be registered with him for that purpose

14. The fair price shop holder shall keep permanently closed any door or windows which offers access to any other portion of the building in which the fair price shop is situated

15. The fair price shop holder shall not contravene any of the provisions of the Order or any other law relating to essential commodities for the time being in force

16. The fair price shop holder shall extend his full cooperation and assistance to the inspecting staff in the checking of his stocks and accounts and give such information as may be required by them in relation to his/ her business.

17. The fair price shop holder shall comply with any directions or instructions given tohim by the authorized officer in regard to the purchase, sale and storage of specified articles and the manner in which accounts thereof shall be maintained and returns submitted.

18. Whenever the existing issue price of any specified article is revised by the government either upward or downward, the stock of specified food articles as on the morning of the day from which the revised issue price comes into force should be assessed and intimated to such officers of Government as may be specifically authorized for the purpose. In the case of revisions of price upward, differential cost, on the quantity of specified articles so held in stock should be remitted to the Government in the manner as specified by the Commissioner or the Authorized Officer. Similarly in the case of revision of prices downward, a refundclaim for the differential cost should be submitted to such officers of Government as may be specifically authorized for the purpose who will arrange for the necessary refunds.

19. Any sum due from the fair price shop holder shall be recoverable as arrears of land revenue.
