1. (1) य ेजिजनयम बैंक ऑफ़ बड़ौदा (ऄजधकारी) सेिा (संिोधन) जिजनयम, 2020 कहलाएंग.े

(2) य ेजिजनयम रजित ऄन्यथा प्रदान ककए गए ऄन सार, ईन्ह ेंनिंबर 2012 के र्पहले कदन से प्रभािी माना जाएगा.

2. बैंक ऑफ़ बड़ौदा (ऄजधकारी) सेिा जिजनयम, 1979 में (आसमें आसके र्पश्चात कजथत जिजनयमन के रूर्प म ें संदर्भभत), जिजनयमन 3 म,ें खंड (एफ़) म ेंजनम्नजलजखत खंड प्रजतस्ट्थाजर्पत ककया जाएगा, ऄथाचत:् - (एफ) “'र्पठरिार' स े ऄजभप्राय ऄजधकारी की र्पत्नी/र्पजत, ऄजधकारी र्पर र्पूण च रूर्प स े अजित ऄजििाजहत बच् चे (जजसम ें सौतले े एि ं कानूनन गोद जलय े गय े बच्च े भी िाजमल ह)ैं , 40% या ऄजधक की कदव्ांगता िाले कदव्ागं भाइ/बहन, जिधिा र्प त्री और अजित तलाकि दा या ऄलग रह रही र्प त्री, बहन जो ऄजििाजहत हो या र्पजत स े ऄलग या तलाकि दा या र्पठरत्यिा हो या जिधिा बहन और जििाजहत मजहला ऄजधकारी के मामल े म ें ऄर्पन े नैसर्भगक माता-जर्पता या सास-सस र, लेककन दोनों नहीं, स े ह.ै 1645 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] स्ट्र्पष्टीकरण : “र्पणू च रूर्प से अजित” से ऄजभप्राय र्पठरिार के ऐस े सदस्ट्य से ह ै जजनकी अय रु.10000/- प्रजतमाह से ऄजधक न हो और यकद र्पणू चतः अजित र्पठरिार के सदस्ट्य माता-जर्पता ह ैं तो ककसी एक की माजसक अय या माता-जर्पता दोनों की सकल अय रु. 10000 प्रजत माह स ेऄजधक ह ै तो दोनों माता-जर्पता ऄजधकारी र्पर र्पूण च रूर्प से अजित नहीं माने जाएंग.े

3. ईर्प-जिजनयमन (6) के जलए कजथत जिजनयम के जिजनयमन 4 में, जनम्नजलजखत ईर्प-जिजनयम प्रजतस्ट्थाजर्पत ककए जाएगं ,े ऄथाचत:् -

(6) 1.11.2012 से प्रत् यके िणे ी के सामने जिजनदिषदष्ट िेतनमान जन‍न ान सार होंगे: क. ईच्च कायचर्पालक िणे ी: िेतनमान VII – रु. 76520 –2120/4-85000 िेतनमान VI - रु. 68680-1960/4-76520 ख. िठरष्ठ प्रबंधन िणे ी िेतनमान V – रु. 59170-1650/2-62470-1800/2-66070 िेतनमान IV – रु. 50030-1460/4-55870-1650/2-59170 ग. मध्य प्रबंधन िणे ी िेतनमान III – रु. 42020-1310/5-48570-1460/2-51490 िेतनमान II – रु. 31705-1145/1-32850-1310/10-45950 घ. कजनष्ठ प्रबंधन िणे ी:

िेतनमान I – रु. 23700-980/7-30560-1145/2-32850-1310/7-42020 स्ट्र्पष्टीकरण : 31.10.2012 स े प्रभािी िेतनमान जजस ऄजधकारी र्पर भी लागू होत े ह ैंईसे 01.11.2012 के आस ईर्प जिजनयम के ऄन सार चरणिार जनधाचठरत िेतनमान म ें जनयत ककया जाएगा ऄथिा संबंजधत िेतनमान म ें प्रथम चरण से तदनरू र्प चरण र्पर तथा जहा ंयकद ऄन्यथा न कदया गया हो तो िेतनिृजि सामान् यतः िर्च र्पूण च होने की जतजथ र्पर ही देय होगी.

(7) ईर्प जिजनयमन (1), (2), (3), (4), (5) और (6) म ें ईजल्लजखत ककसी भी बात का अिय यह नहीं होगा कक बैंक र्पूरे समय आन िेजणयों म ेंऄजधकाठरयों को सेिारत रख.े

(8) 1.11.2012 से ऄजधकाठरयों को जििेर् भत्ता का भ गतान जनम्नान सार ककया जाएगा : िेतनमान िणे ी I-III - मूल िते न का 7.75% + ईस र्पर लाग ूमहगं ाइ भत्ता िेतनमान िणे ी IV-V- मूल िते न का 10% + ईस र्पर लाग ूमहगं ाइ भत्ता िेतनमान िणे ी VI-VII- मूल िेतन का 11% + ईस र्पर लागू महगं ाइ भत्ता

(9) माच च 2020, के 31 िें कदन को और आसके बाद िीर् च कायर्पच ालक िणे ी म ें म ख्य महाप्रबंधक के र्पद के जलए िेतनमान और जििेर् भत्ता जनम्नान सार होगा: (ए) िीर्च कायचर्पालक िणे ी स्ट्केल VIII = रु. 1,03,000 - 2,700/3 - 1,11,100 - 2,800/1 - 1,13,900 (बी) जििेर् भत्ता स्ट्केल VIII = मूल िेतन का 11% + लाग ूमहगं ाइ भत्ता:

बिते कक आस ईर्प-जिजनयमन में ईजल्लजखत ककसी भी बात का अिय यह नहीं होगा कक बैंक र्पूरे समय आन िेजणयों म ें ऄजधकाठरयों को सेिारत रखे. नोट: आसम ें जििेर् महगं ाइ भत्ते के साथ ईर्प-जिजनयम (8) और (9) म ें जनदिषदष्ट जििेर् भत्ते को ऄजधिर्भर्ता लाभ ऄथाचत ् न्य ू र्पेंिन स्ट्कीम, प्रोजिडेंट फंड और ग्रेच्य टी के जलए गणना म ें नहीं जलया जाएगा."[भाग III—खण् ड 4] भारत का राजर्पत्र : ऄसाधारण 3

4. कजथत जिजनयम के जिजनयमन 5 म,ें - i. ईर्प-जनयमन (1) के जलए जनम्नजलजखत ईर्प-जिजनयमन प्रजतस्ट्थाजर्पत ककए जाएगं ,े ऄथाचत्: “(1) कदनांक 01.11.2012 को और ईसके बाद स े जिजनयम 4 के ईर्प जिजनयम (6) के प्रािधानों के ऄधीन िेतनिृजियााँ जनम्नजलजखत के ऄधीन मंजरू की जाएंगी, ऄथाचत:्- ए. जिजनयम 4 के ईर्प जिजनयम (6) में िर्भणत जिजभन्न िेतनमानों में जिजनदिषदष्ट िेतनिृजियााँ, सिम प्राजधकारी की मंजूरी के ऄधीन िार्भर्क अधार र्पर दये होंगी और जजस महीन े में यह देय होती हों ईस महीने की र्पहली तरीख को दी जाएंगी। बी. िेतनमान I और िेतनमान II के ऄजधकाठरयों को ऄर्पन े संबंजधत िेतनमान में ऄजधकतम िते नमान तक र्पहुचं ने के एक साल बाद खंड (सी) म ें जनदिषदष्ट ऄन सार ऄगल े ईच्च िेतनमान म ें ऄिरुि िेतनिृजि सजहत और िेतन िृजि दी जाएगी बिते कक ईन्होंन े दिता सीमा को र्पार ककया ह;ै सी. कजनष्ठ प्रबंधन िेणी िेतनमान I का ऄजधकारी जो जिजनमय (सी) के ऄनरू र्प ऄजधकतम िेतनमान तक र्पहुचं ने के र्पश्चात मध्य प्रबंधन िेणी िेतन मान II म ें र्पहुचं ा ह,ै िह प्रत्येक 3 िर्ों की सेिा र्परू ी होने र्पर चार ऄिरुि िेतनिृजियों के जलए र्पात्र होगा जो रु.1310/- की दो िेतनिृजियां तथा ईसके बाद रु.1460/- की दो िेतनिृजियां होंगी.

डी. मध्य प्रबन्धन िणे ी िेतनमान-II का ऄजधकारी जो जिजनमय (बी) के ऄन रूर्प ऄजधकतम िते नमान तक र्पहुचाँ ने के र्पश्चात मध्य प्रबधं न िेणी-III के िेतनमान में र्पहुचं ा ह ै िह प्रत्येक तीन साल की सेिा र्पूरा करन े र्पर रु.1460/- की तीन ऄिरुि िेतनिृजियों के जलए र्पात्र होगा और तीसरी ऄिरुि िेतनिजृ ि के 2 िर् च के बाद चौथी ऄिरुि िेतनिृजि रु. 1460/- के जलए र्पात्र होगा.

बितें कक ऐसे ऄजधकारी जजन्होंने तीसरी ऄिरुि िेतनिृजि के बाद दो िर् च या ईसस े ऄजधक की सेिा र्पूरी कर ली ह ैि े01.05.2015 स ेचौथी ऄिरुि िेतनिृजि के जलए र्पात्र होंग.े इ. ऄजधष्ठायी मध्य प्रबंधन िेणी िते नमान III में ऄजधकारीगण (जो मध्य प्रबंधन िेणी/िेतनमान III में भती हुए ह ैं ऄथिा र्पदोन्नत हुए ह)ैं प्रत्येक तीन साल की सेिा र्पणू च करन े बाद प्रत् यके रु.1460/- की तीन ऄिरुि िेतनिृजियों के र्पात्र होंग े और जजन ऄजधकाठरयों ने 01/05/2015 तक तीसरी ऄिरूि िेतनिृजि प्राप्त होने के दो िर् च या ईसके बाद रु.1460/- की चौथी िेतनिृजि और चौथी िेतनिृजि प्राप्त होने के दो िर्ों के बाद रु.1460/- की र्पांचिी ऄिरुि िेतनिृजि के जलए र्पात्र होंगे, बितें कक जजस ऄजधकारी ने चौथी ऄिरूि िेतनिृजि के बाद दो िर्च र्परू े कर जलए ह ैं ईस े 01.05.2015 से र्पााँचिी ऄिरुि िते निृजि प्राप्त होगी.

एफ़. कदनांक 01.05.2015 से िठरष्ठ प्रबन्धन िेणी/िेतनमान -IV के ऄजधकारी ऄजधकतम िते नमान तक र्पहुचाँ ने के तीन िर्ों के बाद रु.1650/- की एक ऄिरुि िेतनिृजि प्राप्त करन े के र्पात्र होंगे. बिते कक आस तरह की िेतनिृजियां ईन ऄजधकाठरयों को नहीं दी जाएंगी जजन्होंन े र्पदोन्नत ककए जाने र्पर र्पदोन्नजत लेन े से मना कर कदया ह.ै स्ट्र्पष्टीकरण : - आस ईर्प-जनयमन के तहत ऄगले ईच्च िेतनमान में ऐसी िेतनिृजि की मंजरू ी र्पदोन्नजत के जलए नहीं ह ै और ऄजधकाठरयों के जििेर्ाजधकार,र्पठरलजधधयां, कतचव् और जज‍मेदाठरयां ईनके मूल र्पदों के रूर्प म ेंजारी रहगे ी.”

(ii) ईर्प-जनयमन (2), स्ट्र्पष्टीकरण म,ें खंड (एफ) के बाद और नोट स े र्पहले, जनम्नजलजखत खंड को प्रजिष्ट ककया जाएगा, ऄथाचत:्- “जी. 01.11.2012 को और ईसके बाद से ऄन्य सारी चीजों के समान रहने र्पर व्ािसाजयक योग्यता भत्ता को जनम्न ताजलका के ऄन सार संिोजधत ककया गया ह ै:4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] ताजलका जजन्होंने जूजनयर एसोजिएट ऑफ आंजडयन आंस्ट्टीट्यूट (i) ऄजधकतम िेतनमान तक र्पहुचाँ ने के एक िर्च र्पश्चात ऑफ बैंकसच (जेएअइअइबी) या सर्टटफाआड एसोजिएट रु.670 /- प्रजत माह ऑफ आंजडयन आंस्ट्टीट्यूट ऑफ बैंकसच (सीएएअइबी) – र्पाटच I ईत्तीणच ककया ह ै जजन्होंने सर्टटफाआड एसोजिएट ऑफ आंजडयन आंस्ट्टीट्यूट (i) ऄजधकतम िेतनमान तक र्पहुचाँ ने के एक िर्च र्पश्चात ऑफ बैंकसच (सीएअइअइबी) के दोनों भाग ईत्तीण च रु.670 /- प्रजत माह ककए ह ैं : (ii) ऄजधकतम िेतनमान तक र्पहुचाँ ने के दो िर् च र्पश्चात रु.1680 /- प्रजत माह.

बिते कक ऄगर कोइ ऄजधकारी जेएअइअइबी/ सीएअइअइबी र्परीिा (कोइ एक भाग/ दोनों भाग) ऄर्पन े िेतनमान की ईच्चत्तम सीमा र्पर र्पहुचं न े के बाद र्पास करता ह,ै ईसे ईस कदन, जजस कदन ईसन े ईि योग्यता प्राप्त की ह,ै से व्ािसाजयक योग्यता भत्ता की र्पहली ककस्ट्त देय होती ह ैऔर व्ािसाजयक योग्यता भत्ता की ऄगली ककस्ट्त व्ािसाजयक योग्यता भत्ता की र्पहली ककस्ट्त प्राप्त होन े की तारीख से संदर्भभत होगी.”

(iii) ईर्प-जनयमन (3) में, खंड (इ) के तहत ताजलका के बाद, जनम्नजलजखत प्रजिष्ट ककया जाएगा, ऄथाचत्: - “(एफ) 1 निंबर, 2012 को और ईसके बाद से ऄन्य चीजों के समान होने र्पर स्ट्थायी िैयजिक भत्ता के साथ-साथ अिास भत्ता जनम्नजलजखत दर र्पर होगा और सेिा की र्परू ी ऄिजध के जलए जनयत रहगे ा.

ताजलका िेतनिृजि घटक (रु.) 01.11.2012 से िेतनिृजि घटक र्पर जहां बैंक का अिास ईर्पलधध महगं ाइ भत्ता (रु.) कराया जाता ह ैिहां क ल स्ट्थायी िैयजिक भत्ता (रु.)

(i) आस ईर्प-जिजनयमन (3) के खडं (बी), (सी), (डी), (इ) और (एफ) के कॉलम (3) में ईजल्लजखत ऄन सार स्ट्थायी िैयजिक भत्ता या स्ट्थायी िैयजिक िेतन ऐसे ऄजधकाठरयों को कदया जाएगा जजन्ह ें बैंक का अिास ईर्पलधध कराया गया ह.ै

(ii) अिास भत्ता र्पान े के र्पात्र ऄजधकाठरयों के जलए स्ट्थायी िैयजिक भत्ता या स्ट्थायी िैयजिक िेतन खडं (एफ) के तहत की ताजलका के कॉलम (1) एि ं (2) म ें जिजनदिषदष्ट राजि तथा जिजनयमन 4 के ईर्प-जिजनयमन (2), (3), (4),

(5), और (6) में जिजनदिषदष्ट संबजन्धत िेतनमान की ऄंजतम िेतनिृजि के समय संबजन्धत ऄजधकारी द्वारा जलए जा रह े अिास भत्ते की राजि का क ल जोड़ होगा.

(iii) केिल ऐस े ऄजधकारी जो बैंक की सेिा म ें 1 निंबर, 1993 को या ईससे र्पहल े थ,े ि े ऄर्पन े संबजन्धत िेतनमान म ें ऄजधकतम िेतनमान तक र्पहुचं ने के एक िर्च र्पश्चात स्ट्थायी ियै जिक िेतन र्पाने के जलए र्पात्र होंगे.[भाग III—खण् ड 4] भारत का राजर्पत्र : ऄसाधारण 5

(iv) 1 निंबर, 1999 को और ईसके बाद से स्ट्थायी िैयजिक िेतन के जारी होने के कारण ईर्प जिजनयमन (2) की व्ाख्या (सी) के ऄन सार व्ािसाजयक योग्यता भत्ता के जारी होने की समयािजध में कोइ र्पठरितचन नहीं ककया जाएगा.

बितें कक र्पहल े के प्रािधानों के कारण यकद व्ािसाजयक योग्यता भत्ता स े संबंजधत कोइ ककस्ट्त एक िर् च अगे बढ़ जाती ह ै और जो 01 निंबर, 1999 को या ईसके बाद जारी होनी ह ै तो यह संबंजधत ऄजधकारी को आसी कदन जारी होगी और व्ािसाजयक योग्यता भत्ता की दसू री ककस्ट्त, यकद कोइ हो, 01 निंबर, 2000 को जारी होगी.

(v) स्ट् थाइ िैयजिक भत्ता या स्ट्थ ाइ िैयजिक िेतन के िृजि घटक को ऄजधिर्भर्ता लाभ के जलए र्पात्र माना जाएगा

(vi) ऐसे ऄजधकारी जजन्होंन े ईर्पय चि खंड (ए) म ें ईजल्लजखत ऄन सार ऄजग्रम िेतनिृजि ल े ली हो िे ऄजधकतम िेतनमान में र्पहुचं ने के एक िर् च र्पश्चात ईर्पय चि खंड (बी), (सी), (डी), (इ) या (एफ) में ईजल्लजखत ऄनस ार स्ट् थाइ िैयजिक भत्ता या स्ट् थाइ िैयजिक िेतन प्राप्त करेंगे.

(जी) माचच 2020 के 31 ि ें कदन को और ईसके बाद से ऄन्य चीजों के समान होन े र्पर स्ट्थायी िैयजिक भत्ता के साथ-साथ अिास भत्ता, यकद कोइ हो, ईच्च कायचर्पालक िणे ी िेतनमान-VIII में मख् य महाप्रबधं क प्रबंधक के र्पद के जलए, जनम्नजलजखत दर र्पर होगा और सेिा की र्परू ी ऄिजध के जलए जनयत रहगे ा:

5. जिजनयमन 7 के जलए, जनम्नजलजखत जिजनयमन को प्रजतस्ट्थाजर्पत ककया जाएगा, ऄथाचत:् — “7. िगीकरण — (1) माचच 2020 के 31 िें कदन को और ईसके बाद से और जिजनयमन 6 के प्रािधानों के ऄधीन, बैंक में ऄजधकाठरयों के जिजभन्न र्पदों को जनम्नजलजखत ताजलका में जिजनदिषदष्ट ऄन सार िगीकृत ककया जाएगा:

ताजलका र्पद िणे ी या िते नमान जजसम ेंरखा गया ह ै म ख्य महाप्रबंधक ईच्च कायचर्पालक िणे ी िेतनमान-VIII महाप्रबंधक ईच्च कायचर्पालक िणे ी िेतनमान -VII ईर्प महाप्रबंधक ईच्च कायचर्पालक िणे ी िेतनमान -VI सहायक महाप्रबंधक िठरष्ठ प्रबंधन िेणी िेतनमान -V म ख्य प्रबंधक िठरष्ठ प्रबंधन िेणी िेतनमान -IV िठरष्ठ प्रबंधक मध्य प्रबंधन िेणी िेतनमान -III प्रबंधक मध्य प्रबंधन िेणी िेतनमान –II ऄजधकारी ऄथिा ईर्प प्रबन्धक कजनष्ठ प्रबंधन िेणी िेतनमान -I

(2) यकद ईर्परोि िगीकरण से कोइ कठिनाइ या जिसंगजत ईत्र्पन्न होती ह,ै तो आसे प्रबंध जनदेिक और म ख्य कायचर्पालक ऄजधकारी और ऐसे ऄन्य व्जि या व्जियों से संबंजधत सजमजत के र्पास भेजा जाएगा जो आस जनणचय के जलए केंद्र सरकार द्वारा जनय ि ककए जा सकते ह.ैं”.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

6. कजथत जिजनयमन के जिजनयमन 21 म,ें ईर्प-जिजनयमन (5) के बाद, जनम्नजलजखत जिजनयमन को प्रजतस्ट्थाजर्पत ककया जाएगा, ऄथाचत:् — “(6) कदनांक 1.11.2012 को तथा आसके बाद स,े महगं ाइ भत्ता ऄजखल भारतीय औसत िजमक िगच ईर्पभोिा मल्ू य सूचकांक (सामान्य) अधार 1960=100 के जतमाही औसत म ें 4440 र्पॉआंट के उर्पर चार र्पॉआंट की प्रत्येक िृजि ऄथिा जगरािट के जहसाब स े िते न के 0.10% की दर स ेदेय होगा..

स्ट्र्पष्टीकरण.— आस ईर्प-जिजनयमन के ईद्देश्य के जलए,-— (ए) महगं ाइ भत्त े के जलए “िेतन” स ेअिय ऄिरुि िेतन िृजियों और जिजिष्ट भत्ते सजहत मलू िेतन से ह;ै (बी) व्ािसाजयक योग्यता भत्ता/ व्ािसाजयक योग्यता िेतन जैसा कक जिजनयम 5 के ईर्प-जिजनयमन (2) म ें स्ट्र्पष्टीकरण के खडं (सी), (डी), (इ), (एफ) और (जी) म ें जिजनदिषदष्ट ककया गया ह,ै महगं ाइ भत्ते हते गणना म ें जलया जाएगा ”.

7. कजथत जिजनयमन के जिजनयमन 22 म,ें —

(i) ईर्प-जिजनयमन (1) के जलए, जनम्नजलजखत ईर्प-जिजनयमन को प्रजतस्ट्थाजर्पत ककया जाएगा, ऄथाचत:् — (ए) यकद ककसी ऄजधकारी को बकैं द्वारा अिासीय स जिधा प्रदान की जाती ह ैतो िह जजस िेतनमान में ह ै ईस िेतनमान के प्रथम चरण का 0.75 प्रजतित िेतन या अिास के जलए मानक ककराया, जो भी कम हो, िसूल ककया जाएगा;

(बी) यकद ऄजधकारी को बैंक द्वारा मकान नहीं कदया जाता ह,ै तो कदनांक 01.11.2012 को तथा ईसके बाद स े िह जनम्नजलजखत ताजलका म ेंजिजनदिषदष्ट दरों र्पर मकान ककराया भत्ता के जलए र्पात्र होगा:— ताजलका कायस्ट्च थल मकान ककराया भत्ता

(1) (2)

(i) प्रम ख “ए” िगच के नगर तथा समूह ए के प्रोजेक्ट एठरया केन्द्र िेतन का 9.0%

(ii) ित्रे I म ें ऄन्य स्ट्थान तथा समूह बी के प्रोजेक्ट एठरया केन्द्र तथा िेतन का 8.0% गोिा राज्य

(iii) ऄन्य स्ट्थान िेतन का 7.0% बिते कक कोइ ऄजधकारी ककराए की रसीद प्रस्ट्तत करता ह ैतो ईसे दये मकान ककराया भत्ता, जजस िेतनमान म ेंिह ह ै ईसके प्रथम चरण के िेतन के 0.75 प्रजतित स े उर्पर, ईसके द्वारा ऄर्पन े अिास के जलए कदया गया िास्ट्तजिक ककराया दये होगा जो उर्पर कॉलम (2) म ें दिाचयी गयी दरों के ऄनरू र्प दये मकान ककराया भत्त े का ऄजधकतम 150 प्रजतित होगा.

नोट: ऄजधकारी के ऄर्पन े स्ट्िाजमत्ि िाले अिास की लागत से ज ड़े मकान ककराया भत्ते के दािे भी ऄभी तक के समान मकान ककराया भत्ता का 150 प्रजतित तक सीजमत होंग.े ”;

(ii) ईर्प-जिजनयमन 2 हटा कदया जाएगा.”.

8. कजथत जिजनयमन के जिजनयमन 23 म,ें — (ए) ईर्प-जिजनयमन (1), (2), (3), (4) एि ं (5) के जलए, जनम्नजलजखत ईर्प-जिजनयमन को प्रजतस्ट्थाजर्पत ककया जाएगा, ऄथाचत:् — “(1) कदनांक 1.11.2012 को और ईसके बाद से यकद ऄजधकारी जनम्नजलजखत ताजलका के कॉलम (1) म ें ईजल्लजखत ककसी स्ट्थान र्पर कायचरत ह ै तो िह ईस स्ट्थान के सामन े कॉलम (2) म ें ईजल्लजखत दर र्पर िहर प्रजतर्परू क भत्ता र्पान े का र्पात्र होगा:—[भाग III—खण् ड 4] भारत का राजर्पत्र : ऄसाधारण 7 ताजलका स्ट्थान दर

(1) (2)

(i) िेत्र I और गोिा राज्य के स्ट्थान मूल िेतन का 4% जो ऄजधकतम रु. 870/- प्रजतमाह के ऄधीन होगा

(ii) र्पांच लाख या ईससे ऄजधक जनसंख्या िाले स्ट्थान मूल िेतन का 3% जो ऄजधकतम रु. 600/- और राज्यों की राजधाजनयां तथा चंडीगढ़, र्प दच ेरी और प्रजतमाह के ऄधीन होगा र्पोट च धलेयर.

(2) कदनांक 1.11.2012 और ईसके बाद स,े जििेर् िेत्र भत्त े की दरें आन जिजनयमों की ऄनस ूची में जिजनदिषदष्ट की जाएंगी.

(3) कदनांक 1.11.2012 और ईसके बाद से यकद कोइ ऄजधकारी ऐसे ित्रे म ें सेिारत ह ै जजसे समूह ‘ए’ या समूह ‘बी’ के ऄतं गतच अन े िाल े प्रोजेक्ट एठरया के रुर्प म ें जिजनदिषदष्ट ककया गया ह ै तो िह समूह ‘ए’ के जलए रु. 400/- प्रजतमाह और समूह ‘बी’ के जलए रु. 350/- प्रजतमाह की दर स ेप्रोजेक्ट एठरया प्रजतर्पूरक भत्ता र्पाने के जलए र्पात्र होगा.

(4) कदनांक 1.6.2015 को और ईसके बाद स,े यकद ककसी ऄजधकारी को िैजिक िर्च के बीच म ेंएक स्ट्थान स े दसू रे स्ट्थान र्पर स्ट्थानांतठरत ककया जाता ह,ै और यकद ईसके एक या एक स े ऄजधक बच्च े र्पूिचिती स्ट्थान र्पर जिद्यालय या महाजिद्यालय म ें ऄध्ययन कर रह े ह ैं तो जजस तारीख को ऄजधकारी नइ जगह र्पर ठरर्पोट च करता ह,ै ईस तारीख स े ईस े िैजिक िर्च के ऄतं तक, सभी बच्चों के जलए रु. 1100/- प्रजत माह मध्य िैजिक िर्च स्ट्थानांतरण भत्ता कदया जाएगा र्परंत यकद ईसके सभी बच्च े र्पूिचिती स्ट्थान र्पर ऄध्ययन करना बंद कर देत े ह ैं तो यह भत्ता जमलना बंद हो जाएगा.

(5) कदनांक 1 जून 2015 को और ईसके बाद से यकद ककसी ऄजधकारी को बैंक से बाहर ककसी सेिा के जलये प्रजतजनयि ककया जाता ह ै तो िह प्रजतजनयज ि के र्पद र्पर देय र्पठरलजधधयों को प्राप्त करन े के जलए ऄर्पना जिकल्र्प दे सकता ह ै ऄथिा िह जिकल्र्प के रूर्प म ें ऄर्पन े िेतन के ऄजतठरि िेतन का 7.75% ऄजधकतम रु. 4000/- प्रजत माह के ऄध् यधीन प्रजतजनय जि भत्ता और ऐस े ऄन्य भत्ते ल े सकता ह ै जो ईसे ईसी स्ट्थान र्पर बैंक की सेिा में तनै ात होने की जस्ट्थजत म ेंजमलत.े बिते कक ईसकी प्रजतजनय जि से र्पूिच ईसकी तैनाती के स्ट्थान र्पर ही जस्ट्थत ककसी संगिन में प्रजतजनय ि ककया जाता ह ैतो ईसे ईसके िेतन का 4% ऄजधकतम रु.2000/- प्रजत माह के ऄध् यधीन प्रजतजनय जि भत्ता जमलेगा.

बिते कक ककसी ऄजधकारी को बैंक के प्रजििण संस्ट्थान में सकं ाय सदस्ट्य के रूर्प म ें प्रजतजनयि ककया जाता ह ै ईस े ईसके िेतन का 4% ऄजधकतम रु. 2000/- प्रजत माह प्रजतजनय जि भत्ता जमलगे ा. (बी) ईर्प-जिजनय मन (8) के जलए जन‍ नजलजखत ईर्प जिजनयमन प्रजतस्ट् थाजर्पत ककए जाएंग,े यथा:- “(8) कदनांक 1 निंबर 2012 को और ईसके बाद से यकद ईसका कायच-समय कदन के दो भागों म ेंबंटा हुअ ह ैऔर कायच समय के आस जिभाजन में कम स ेकम दो घंटे का ऄंतराल ह ैतो ईसे रु.200/- प्रजत माह जिभाजजत कायच-समय भत्ता कदया जाएगा.” (सी) ईर्प-जिजनयमन (10) म ेंके ऄनस ारः (ए) ऄंकों, ऄिरों और िध दों के जलए “निंबर 2007 की र्पहली तारीख”, के स्ट् थान र्पर “निंबर 2012 की र्पहली तारीख”, ऄंकों, ऄिरों और िधद ों में प्रजतस्ट् थाजर्पत ककए जाएंग;े (बी) टेबल के जलए, जन‍न जलजखत टेबल प्रजतस्ट्थ ाजर्पत होगा, यथा:-8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] स्ट्थान दर

(1) (2) i. 1000 मीटर और ईससे ऄजधक र्परंत िेतन का 2% ऄजधकतम 750/- प्रजत माह के ऄध् यधीन 1500 मीटर स े कम उंचाइ िाले स्ट्थान और मेरकरा नगर ii. 1500 मीटर और ईससे ऄजधक र्परंत िेतन का 2.5% ऄजधकतम 1000/- प्रजत माह के 3000 मीटर स े कम उंचाइ िाला ऄध् यधीन स्ट्थान iii. 3000 मीटर और ईससे ऄजधक उंचाइ िेतन का 5% ऄजधकतम 2000/- प्रजत माह िाला स्ट्थान

9. कजथत जिजनयम के जिजनयमन 24 के ऄन सार:-

(i) ईर्प-जिजनयमन (1), के जलए जन‍न जलजखत ईर्प-जिजनयमन प्रजतस्ट् थाजर्पत ककए जाएगं े, यथा:- “(1) कदनांक 01 निंबर 2012 को और ईसके बाद स े ऄजधकारी स्ट्िय ं और ऄर्पन े र्पठरिार हते जचककत्सा व्य की प्रजतर्पूर्भत के जलए जनम्नजलजखत ताजलका म ें ईल्लेख ककए गए ऄन सार दािा की गइ राजि के जलए खातों की जििरणी के साथ ऐसा व्य करने के स्ट् ियं के स्ट्ि-प्रमाणर्पत्र के अधार र्पर र्पात्र होगा, यथा:- ताजलका िणे ी प्रजतर्पर्भू त की ऄजधकतम सीमा प्रजतिर् च

(1) (2) कजनष्ठ प्रबंधन िणे ी और मध्य रु.8000/- या व्य की गइ राजि, जो भी कम हो प्रबंधन िणे ी िठरष्ठ प्रबंधन िणे ी और ईच्च रु.9050/- या व्य की गइ राजि, जो भी कम हो कायचर्पालक िेणी नोट:-

(i) ऄप्रय ि जचककत्सा सहायता संजचत करन े की ऄन मजत ऄजधकारी को दी जा सकती ह ै र्परंत िह ककसी भी समय उर्पर दी गइ ऄजधकतम राजि के तीन ग ना से ऄजधक नहीं होनी चाजहए या;

(ii) िर्च 2012 के जलए, जचककत्सा सहायता योजना के तहत जचककत्सा व्य की प्रजतर्पूर्भत 2 महीने, ऄथाचत ् निंबर, 2012 और कदसंबर 2012 के जलए समान र्पाजतक रूर्प म ेंबढ़ाइ जाएगी. (1ए) कोइ ऄजधकारी जनदिे क मंडल द्वारा जिजनदिषदष् ट जनयम एिं ितों के ऄन सार ऄर्पने और ऄर्पन े र्पठरिार के जलए जचककत् सा बीमा स जिधा के जलए र्पात्र होगा

10. कजथत जिजनयम के जिजनयमन 25 में, ईर्प जिजनयम (2) के जलए जन‍न जलजखत ईर्प-जिजनयमन प्रजतस थ् ाजर्पत ककए जाएगं े, यथा:- “(2) ईर्प-जिजनयम (1) म ेंजनजहत क छ भी के नहीं होते हुए भी यकद बैंक चाह ेतो ऄजधकारी को अिास ईर्पलधध करा सकता ह ै जजसके जलए ऄजधकारी कदनांक 01 निंबर 2012 को और आसके बाद से ऄर्पन े िेतनमान के प्रथम स्ट्तर के

0.75% के समान या अिास के जलए मानक ककराया, जो भी कम हो, का भ गतान करेगा: बिते यकद ऐसे अिास र्पर ऄजधकारी को फनीचर भी ईर्पलधध कराया गया हो तो ईनके िेतनमान के प्रथम स्ट्तर के मूल िेतन का 0.15% के बराबर ऄजतठरि राजि ईनस े िसूल की जाए.[भाग III—खण् ड 4] भारत का राजर्पत्र : ऄसाधारण 9 बिते यह भी कक जहां बैंक द्वारा ऐसी अिास व्िस्ट्था ईर्पलधध कराइ जाती ह,ै तो जबजली, र्पानी, गैस और सफाइ प्रभार, ऄजधकारी द्वारा िहन ककए जाएंग.े

11. कजथत जिजनयम के जिजनयमन 33 में, ईर्प जिजनयम (4) के जलए जन‍न जलजखत ईर्प-जिजनयमन प्रजतस्ट्थ ाजर्पत ककए जाएगं े, यथा:- “(4) कदनांक 01 जून 2015 को और ईसके बाद से ऐसी जस्ट्थजत को छोड़कर जहां ऄिकाि के जलए अिेदन ककया गया ह ै और ईसे ऄस्ट्िीकृत कर कदया गया हो, ऄजधकतम 270 कदन तक का ऄर्भजत ऄिकाि ही संजचत ककया जा सकेगा.

तथाजर्प, ऄर्भजत ऄिकाि के नकदीकरण की सीमा ऄजधकतम 240 कदनों की होगी. ऄर्भजत ऄिकाि लेने के आच्छ क ऄजधकारी सामान्यत: ऐसा ऄिकाि लेने के ऄर्पने अिय की सचू ना कम से कम 15 कदन र्पूिच दगें .े

12. कजथत जिजनयम के जिजनयमन 34 म,ें ईर्प जिजनयम (3) के बाद, जन‍न जलजखत ईर्प-जिजनयमन िाजमल ककया जाएगा, यथा:- “(4) कदनांक 1 जून 2015 स े ककडनी/ ऄंग दान करने के जलए ऄजधकारी कमचचारी की र्पूरी सेिा ऄिजध के दौरान ईन्ह ें30 कदनों तक की जििेर् बीमारी ऄिकाि स्ट्िीकृत की जा सकती ह.ै”

13. कजथत जिजनयम के जिजनयमन 36 में, ईर्प जिजनयम (2) और (3) के जलए जन‍न जलजखत ईर्प-जिजनयमन प्रजतस्ट्थ ाजर्पत ककए जाएगं े, यथा:- “(2) 25 मइ 2015 से, जन:संतान मजहला ऄजधकारी के 1 िर्च से कम ईम्र के जिि को कानूनी रूर्प से गोद लेने हते सेिा के दौरान जनम्नजलजखत जनयम एिं ितों के ऄध् यधीन ऄजधकतम 6 माह की ऄिजध के जलए एक बार ऄिकाि स्ट्िीकृत ककया जा सकता ह:ै

(i) केिल एक जिि गोद लेन े हते ऄिकाि स्ट्िीकृत ककया जाएगा.

(ii) जिि ईजचत कानूनी प्रकक्रया स ेगोद जलया जाना चाजहए तथा कमचचारी को ऐस े ऄिकाि की स्ट्िीकृजत हते बैंक को दत्तक जिलेख प्रस्ट्त त करना होगा.

(iii) जन्म देन े िाली मां को ईन मामलों में भी छ ट्टी जमलेगी जहां बच्चे का जन्म सरोगेसी के माध्यम से हुअ ह,ै और

(iv) समग्र सेिा ऄिजध के दौरान 12 महीने की क ल र्पात्रता में ऄिकाि जलया जा सकता ह.ै

(3) कदनांक 25 मइ 2015 स,े 12 महीने की समग्र ऄिजध के भीतर, बच्चेदानी को जनकालन े के मामले म ें भी ऄजधकतम 60 कदनों तक का ऄिकाि स्ट्िीकृत ककया जा सकता है.

(4) मातृत्ि ऄिकाि, जो कक िास्ट्तजिक िेतन र्पर होगा, ककसी मजहला ऄजधकारी को ककसी एक ऄिसर र्पर 6 महीने स े ऄजधक के जलए स्ट्िीकृत नहीं ककया जाएगा और ईनकी समग्र सेिा ऄिजध के दौरान 12 महीने के जलए स्ट्िीकृत ककया जा सकता ह.ै बिते कक 12 माह की समग्र ऄिजध म ें गभचिाि, गभचर्पात या मेजडकल तौर र्पर गभचर्पात कराने की जस्ट्थजत म ें ऄिकाि स्ट् िीकृत ककया जा सकता ह.ै

(5) 1 जून 2015 से दो जीजित बच्चों तक िाले र्प रुर् कमचचारी ऄर्पनी र्पत्नी की प्रसूजत के दौरान 15 कदनों के जर्पतृत्ि ऄिकाि के जलए र्पात्र होंग.े यह ऄिकाि अकजस्ट्मक ऄिकाि को छोड़कर ककसी ऄन्य ऄिकाि के साथ जोड़ा जा सकता ह.ै बिते कक आस ऄिकाि के जलए बच्चे की जडलीिरी की तारीख से 15 कदन र्पहले या 6 महीने तक अिेदन ककया जा सकता ह.ै

14. कजथत जिजनयम के जिजनयमन 38 के जलए जन‍न जलजखत ईर्प-जिजनयमन प्रजतस थ् ाजर्पत ककए जाएगं े, यथा:- “(38) ऄिकाि का व्र्पगत (ल्‍ै स) होना: जन‍न जलजखत को िाजमल करत े हुए, ऄजधकारी के त्यागर्पत्र, सेिा जनिृजत्त,10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] मृत् य, जडस्ट्चाजच, बखाचस्ट्तगी या सेिा समाजप्त र्पर ईसके समस्ट्त ऄिकाि व्र्पगत हो जाएंगे.” बिते बैंक की सेिा से सेिाजनिृत्त होन े िाला ऄजधकारी ककसी भी ऄिजध के जलए ऄर्पन े द्वारा संजचत ऄर्भजत ऄिकाि, जो ऄजधकतम 240 होंगे, की र्पठरलजधधयों की समान राजि के बराबर राजि के भ गतान का र्पात्र होगा.

बिते यह भी कक यकद ककसी ऄजधकारी को दंडस्ट्िरूर्प ऄजनिायच सेिा जनिृत्त ककया गया है, िह ककसी भी ऄिजध के जलए ऄर्पन े द्वारा संजचत ऄर्भजत ऄिकाि जो ऄजधकतम 240 होंगे, की र्पठरलजधधयों की क ल राजि के बराबर राजि के भ गतान के र्पात्र होंग.े बिते यह भी कक यकद ऄजधकारी की सेिा काल के दौरान मृत्य हो जाती ह ैतो ईसकी मृत्य तारीख को ईसके खाते में जनजहत ऄर्भजत ऄिकाि, जो 240 स े ऄजधक न हो, के र्पठरलजधधयों के समकि राजि ईसके कानूनी ईत्तराजधकाठरयों को देय होगी.

बिते यह भी कक जिजनयमन 20 के ईर्प-जिजनयम (2) के ऄन सार ईजचत नोठटस देने के र्पश्चात 01.04.2001 को या ईसके बाद बैंक सेिा से त्याग र्पत्र देने िाल े ऄजधकारी को सिे ा की समाजप्त की तारीख को जनजहत ऐसे ऄिकाि के अधे ऄिकाि, जो 120 कदनों से ऄजधक न हो, के नकदीकरण का र्पात्र होगा.

15. कजथत जिजनयम के जिजनयमन 41 के ऄन सार;

(i) ईर्प-जिजनयम (1) के जलए जन‍न जलजखत ईर्प-जिजनयमन प्रजतस्ट्थ ाजर्पत ककए जांएग,े यथा:- “(1) 1 निंबर 2012 को और से, जब भी ककसी ऄजधकारी को कायाचलीयन ईद्देश् य से यात्रा करनी होगी, ऐसी जस्ट्थजत म ेंजन‍न जलजखत प्रािधान लागू होंगे, यथा:- (ए) कजनष्ठ प्रबंधन िणे ी का ऄजधकारी रेन द्वारा प्रथम िेणी ऄथिा 2टीयर एसी स्ट्लीर्पर से यात्रा करने के जलए र्पात्र ह.ै िह एयर (आकॉनमी ) द्वारा यात्रा करने के जलए र्पात्र होगा बिते कक व्ािसाजयक अकजस्ट्मकताओं ऄथिा लोक जहत को ध्यान म ेंरखत े हुए सिम प्राजधकारी द्वारा ऄन मजत दी गइ हो:

(बी) मध्यम प्रबंधन िणे ी का ऄजधकारी रेन द्वारा प्रथम िेणी ऄथिा एसी 2 टीयर स्ट्लीर्पर से यात्रा के जलए र्पात्र ह.ै िह एयर (आकॉनमी िणे ी) द्वारा यात्रा करन े के जलए र्पात्र होगा बिते कक यात्रा की जाने िाली दरू ी 1000 ककलोमीटर से ऄजधक हो.

िह कम दरू ी के जलए भी एयर (आकॉनमी िणे ी) से यात्रा कर सकता ह ै बित े कक सिम प्राजधकारी द्वारा व्ािसाजयक अकजस्ट्मकताओं ऄथिा लोक जहत के संदभच म ें यकद सिम प्राजधकारी द्वारा ऄन मजत दी गइ हो. (सी) िठरष्ठ प्रबंधन िेणी ऄथिा ईच्च कायचर्पालक िेणी का ऄजधकारी रेन द्वारा एसी प्रथम िणे ी ऄथिा एयर (आकॉनमी िेणी) से यात्रा करन े के जलए र्पात्र ह;ै (डी) िठरष्ठ प्रबंधन िणे ी ऄथिा ईच्च कायचर्पालक िणे ी का ऄजधकारी ऐसी जगह जो एयर ऄथिा रेल से नहीं जड़ ी हुइ ह ै ऐसे स्ट्थान र्पर कार स ेयात्रा करने के जलए र्पात्र ह ैं बित े कक दरू ी 500 ककलोमीटर से ऄजधक ना हो;

यकद दो स्ट्थानों के बीच की ऄजधकतम दरू ी एयर ऄथिा रेल द्वारा तय की जा सकती ह ै तो सामान्यतः केिल िेर् दरू ी कार द्वारा तय की जाए. (इ) व्ािसाजयक अकजस्ट्मकताओं को देखते हुए सिम प्राजधकारी द्वारा कोइ भी ऄन्य ऄजधकारी को, ईसके िाहन ऄथिा टैक्सी या बैंक के िाहन से यात्रा के जलए ऄन मजत दी जा सकती ह.ै (एफ) ककसी भी िेणी ऄथिा िते नमान का ऄजधकारी ऐसी जगह जो सड़क ऄथिा एयर या रेल स े ज ड़ा न हो, जल र्पठरिहन के जडलक्स केजबन िणे ी से यात्रा करने के जलए र्पात्र होगा.

(ii) ईर्प जिजनयमन (4) म ेंधारा (ए) और (बी) के जलए जनम्नजलजखत धाराओं को प्रजतस्ट्थाजर्पत ककया जाएगा ऄथाचत् “(ए) 01.06.2015 से तथा आसके र्पश्चात नीचे दी गइ सारणी के कॉलम 1 म ें ईजल्लजखत िणे ी/ िते नमान का ऄजधकारी सार्पेि कॉलम 2 म ेंईजल्लजखत तदनरू र्पी दरों से जिराम भत्ता र्पाने के जलए र्पात्र होगा:[भाग III—खण् ड 4] भारत का राजर्पत्र : ऄसाधारण 11 महानगर प्रमख ‘ए’ िग चके िहर ित्रे I ऄन्य स्ट्थान ऄजधकाठरयों की िणे ी / िते नमान (रु.) स्ट्र्पष्टीकरण: जिराम भत्ता की गणना के ईद्देश्य से “दैजनक” का ऄथच ह ै24 घंट े की प्रत्येक ऄिजध या ईसकी कोइ अंजिक ऄिजध जोकक एयर द्वारा यात्रा ककए जाने की जस्ट्थजत में प्रस्ट्थान होन े के जलए ठरर्पोर्टटग के समय से और ऄन्य मामलों म ें प्रस्ट्थान के समय से लेकर अगमन के िास्ट्तजिक समय तक को गणना में जलया जाएगा और जहां ऄन र्पजस्ट्थजत की क ल ऄिजध चौबीस – घंटे से कम ह ै िहा “दैजनक” का ऄथ चअि घंटे से कम की ऄिजध नहीं होगी.

(3ए) िह माध्यम तथा िेणी जजसके द्वारा ऄजधकारी ऄिकाि यात्रा स जिधा ले रहा ह ै सामान् यतः ईस के समान होगी जजसके जलए ऄजधकारी स्ट्थानांतरण होन े र्पर सामान्य यात्रा के जलए र्पात्र ह ै तथा ऄजधकारी द्वारा ली जान े िाली ऄिकाि यात्रा स जिधा के जलए ऄन्य जनयम ि ित ें जनदेिक मंडल द्वारा समय-समय र्पर जलए गए जनणचयों र्पर अधाठरत होंगी.

NOTIFICATION Mumbai, the 31st March, 2020 No. BCC:HRM:EXE:112/274.—In exercise of powers conferred by section 19, read with sub-

section (2) of section 12 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the Bank of Baroda, after consultation with the Reserve Bank of India and with the previous sanction of the Central Government hereby make the following regulations further to amend the Bank of Baroda (Officers‘) Service Regulations, 1979, namely:—

1. (1) These regulations may be called the Bank of Baroda (Officers') Service (Amendment) Regulations,

2020.

(2) Save as provided in these regulations, they shall be deemed to have come into force with effect from the 1st day of November, 2012.

2. In the Bank of Baroda (Officers‘) Service Regulations, 1979 (hereinafter referred to as the said regulations), in regulation 3, for clause (f), the following clause shall be substituted, namely:— ‗(f) ―family‖ means the spouse of the officer, wholly dependent unmarried children (including step children and legally adopted children), wholly dependent physically and mentally challenged brother or sister with forty per cent or more disability, widowed daughters and dependent divorced or separated daughters, sisters including unmarried or divorced or abandoned or separated from husband or widowed sisters, and parents wholly dependent on the officer and in the case of a married female officer may include her natural parents or parents-in-law, but not both.

Explanation.— ―wholly dependent‖ shall mean such member of the family having an income not exceeding Rs.10,000 per month and where the wholly dependent family member are parents, the income of any parent or aggregate income of both the parents if exceeds Rs.10,000 per month, both the parents shall not be considered as wholly dependent on the officer;‘.

3. In regulation 4 of the said regulations, for sub–regulation (6), the following sub-regulations shall be inserted, namely:— ―(6) With effect from the 1st November, 2012, the scales of pay specified against each grade shall be

as under:

(a) Top Executive Grade Scale VII = Rs.76520 – 2120/4 – 85000 Scale VI = Rs.68680 – 1960/4 – 76520

Explanation.—Every officer who is governed by the scales of pay as in force as on 31st October, 2012 shall be fitted in the scale of pay as set out in this sub–regulation as on 1st November, 2012 on stage-to-stage basis or the corresponding stages from first stage onwards in the respective scales and the increments shall fall on the anniversary date as usual.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(7) Nothing in sub–regulations (1), (2), (3), (4), (5) and (6) shall be construed as requiring the Bank to have at all times, officers serving in all these grades.

(8) With effect from the 1st day of November, 2012, officers shall be paid Special Allowance as

under:

Scale I–III = 7.75% of Basic Pay plus applicable Dearness Allowance thereon Scale IV–V = 10% of Basic Pay plus applicable Dearness Allowance thereon Scale VI–VII = 11% of Basic Pay plus applicable Dearness Allowance thereon.

(9) On and from 31st day of March‘ 2020, the Scale of Pay and Special Allowance for the post of

Chief General Manager in Top Executive Grade shall be as under:

(A) Top Executive Grade Scale VIII = Rs.1,03,000 – 2,700/3 – 1,11,100 – 2,800/1 – 1,13,900

(B) Special Allowance Scale VIII = 11% of Basic Pay plus applicable Dearness Allowance thereon:

Provided that nothing in this sub-regulation shall be construed as requiring the Bank to have at all times officers serving in this grade.

Note: The Special Allowance referred to in sub-regulations (8) and (9) with applicable Dearness Allowance thereon shall not be reckoned for superannuation benefits, such as pension including New Pension Scheme, Provident Fund and Gratuity.‖.

4. In regulation 5 of the said regulations,—

(i) for sub-regulation (1), the following sub-regulation shall be substituted, namely:— ―(1) Subject to the provisions of sub-regulation (6) of regulation 4, on and from the 1st November, 2012, the increments shall be granted subject to the following, namely:—

(a) the increments specified in the scales of pay set out in sub–regulation (6) of regulation 4 shall, subject to the sanction of the Competent Authority, accrue on an annual basis and shall be granted on the first day of the month in which these fall due;

(b) one year after reaching the maximum in their respective Scales, officers in Scale I and Scale II, shall be granted further increments including stagnation increment in the next higher Scale only as specified in clause (c) below subject to their crossing the efficiency bar;

(c) officers in Junior Management Grade Scale I who have moved to Middle Management Grade Scale II in terms of clause (b) after reaching maximum of the higher Scale, shall be eligible for four stagnation increments for every three completed years of service of which the first two shall be Rs. 1310 each and next two, Rs. 1460 each;

(d) officers in Middle Management Grade Scale II who have moved to Middle Management Grade Scale III in terms of clause (b) after reaching maximum of higher scale shall be eligible for three stagnation increments of Rs.1460/- each for every three completed years of service and a fourth stagnation increment of Rs. 1460/- two years after receipt of third

stagnation increment:

Provided that officers who have completed two years or more after receipt of the third stagnation increment shall be granted the fourth stagnation increment with effect from the 1st day of May, 2015;

(e) officers in substantive Middle Management Grade Scale III (those recruited in or promoted to Middle Management Grade Scale III) shall be eligible for three stagnation increments of Rs. 1460/- each for every three completed years of service and fourth stagnation increment of Rs. 1460/- to officers who have completed two years or more after releasing third stagnation increment as on 1st May, 2015 and a fifth stagnation increment of Rs.

1460/- two years after receipt of fourth stagnation increment provided that the officers who[भाग III—खण् ड 4] भारत का राजर्पत्र : ऄसाधारण 19 have completed two years after receipt of the fourth stagnation increment shall be granted the fifth stagnation increment with effect from 1st May, 2015;

(f) officers in Senior Management Grade Scale–IV shall be eligible for one stagnation increment of Rs. 1650/- three years after reaching the maximum of scale with effect from 1st May, 2015:

Provided that such increment shall not be allowed to an officer who refuses promotion when offered.

Explanation.—Grant of such increments in the next higher Scale under this sub–regulation shall not amount to promotion and the privileges, perquisites, duties and responsibilities of the officers shall continue as of their substantive posts.‖;

(ii) in sub-regulation (2), in the Explanation, after clause (f) and before the Note, the following clause shall be inserted, namely:— ―(g) On and from the 1st day of November, 2012, other things being equal, the quantum of

Professional Qualification Pay shall stand revised as specified in the Table below:

(iii) In sub-regulation (3), after the table under clause (e), the following shall be inserted,

namely:— ―(f) On and from the 1st November, 2012, other things being equal, Fixed Personal Pay together with House Rent Allowance shall be at the following rates and shall remain frozen

for the entire period of service:

Note:

(i) Fixed Personal Allowance or Fixed Personal Pay as indicated under column (3) of the tables in clauses (b), (c), (d), (e) and (f) of this sub-regulation shall be payable to those officers who are

provided with Bank‘s accommodation.

(ii) Fixed Personal Allowance or Fixed Personal Pay for officers eligible for House Rent Allowance shall be the aggregate amount specified under columns (1) and (2) of the table under clause (f) and House Rent Allowance drawn by the concerned officer when the last increment of the relevant scale of pay as specified in sub–regulations (2), (3), (4), (5) and (6) of regulation 4 is earned.

(iii) Only officers who were in the service of the Bank on or before 1st November, 1993 shall be eligible for Fixed Personal Pay one year after reaching the maximum scale of pay they are placed.

(iv) On and from the 1st November, 1999 there shall be no change in the schedule of release of Professional Qualification Pay as in Explanation (c) of sub–regulation (2) on account of release of

Fixed Personal Pay:

Provided that where any installment of Professional Qualification Pay which on account of the earlier provisions has been shifted by a year and is scheduled for release on or after the 1st November, 1999, it shall be released to the officer on and from that date and second installment of Professional Qualification Pay, if any, shall be released on the 1st November, 2000.

(v) The increment component of Fixed Personal Allowance or Fixed Personal Pay shall rank for superannuation benefits.

(vi) An officer who has earned the advance increment as in clause (a) of this sub-regulation shall draw the quantum of Fixed Personal Allowance or Fixed Personal Pay as mentioned in clauses (b),

(c), (d), (e) or (f) above, one year after reaching the maximum of the scale.

(g) On and from the 31st day of March 2020, other things being equal, the Fixed Personal Pay together with House Rent Allowance, if any, for the post of Chief General Manager in Top Executive Grade Scale-VIII shall be at the rates given in the table below and shall remain frozen for

the entire period of service:

5. For regulation 7, the following regulation shall be substituted, namely:— ―7. Categorisation.— (1) On and from the 31st day of March 2020 and subject to the provisions of regulation 6, the various posts of officers in the Bank shall be categorized as specified in the table

below:

(2) If any difficulty or anomaly arises out of the above categorization, the same shall be referred to a Committee consisting of the Managing Director and Chief Executive Officer and such other person or persons as may be appointed by the Central Government for this purpose, for its decision.‖.

6. In regulation 21 of the said regulations, after sub–regulation (5), the following sub-regulation shall be inserted, namely:— ―(6) On and from the 1st day of November, 2012, Dearness Allowance shall be payable for every rise or fall of four points over 4440 points in the quarterly average of the All India Average Working Class Consumer Price Index (General) Base 1960=100 at 0.10% of pay.

Explanation.— For the purposes of this sub–regulation,—

(a) ―pay‖ for the purpose of Dearness Allowance shall mean basic pay including Stagnation Increments plus Special Allowance;

(b) Professional Qualification Allowance or Professional Qualification Pay as specified in clauses

(c), (d), (e), (f) and (g) to the explanation in sub–regulation (2) of regulation 5 shall rank for Dearness Allowance.‖.

7. In regulation 22 of the said regulations,—

(i) for sub–regulation (1), the following sub–regulation shall be substituted, namely:— ―(1) On and from the 1st day of November, 2012,—

(a) where an officer is provided with residential accommodation by the Bank, a sum equal to

0.75 per cent of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less, shall be recovered from him;

(b) where an officer is not provided any residential accommodation by the Bank, he shall be eligible for House Rent Allowance at the rates specified in the following table, namely:— TABLE Place of work House Rent Allowance

Provided that if an officer produces a rent receipt, the House Rent Allowance payable to him shall be the actual rent paid by him for the residential accommodation in excess over 0.75 per cent of pay in the first stage of the scale of pay in which he is placed with a maximum of 150 per cent of the House Rent Allowance payable as per aforesaid rates mentioned in column (2) of the above Table.

Note: The claims of officers for House Rent Allowance linked to the cost of their ownership accommodation shall also be restricted to 150 per cent of the House Rent Allowance as hitherto.‖;

(ii) sub-regulation (2) shall be omitted.‖.

8. In regulation 23 of the said regulations,—

(A) for sub-regulations (1), (2), (3), (4) and (5), the following sub-regulations shall be substituted,

namely:—22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] ―(1) On and from the 1st day of November, 2012, if an officer is serving in a place mentioned in column (1) of the table below, a City Compensatory Allowance at the rate mentioned in column (2) thereof against that place shall be payable:— TABLE Places Rate

(ii) Places with population of five lakhs 3% of Basic Pay subject to a and over and State Capitals and maximum of Rs.600 per month.

Chandigarh, Puducherry and Port Blair

(2) On and from the 1st day of November, 2012, the rates of special areas allowances shall be as specified in the Schedule to these regulations.

(3) On and from the 1st day of November, 2012, if an officer is serving in an area specified as Project Area falling in Group A or Group B, he shall be eligible for a Project Area Compensatory Allowance at the rate of Rs.400/- per month or Rs.350/- per month according to the classification of area as Group A or Group B respectively.

(4) On and from the 1st day of June, 2015, if an officer is transferred from one place to another in the midst of an academic year and if he has one or more children studying in school or college, in the former place, he shall be eligible for a mid–academic year transfer allowance of Rs. 1100/- per month from the date he reports to the latter place up to the end of the academic year in respect of all the children, provided that such allowance shall cease if all the children cease studying at the former place.

(5) On and from the 1st day of June, 2015, if an officer is deputed to serve outside the Bank, he may opt to receive the emoluments attached to the post to which he is deputed, or he may in addition to his pay, draw a deputation allowance at the rate of

7.75 per cent of pay subject to a maximum of Rs.4000 per month and such other allowances he would have drawn had he been posted in the Bank‘s service at that

place:

Provided that where he is deputed to an organization which is located at the same place where he was posted immediately prior to his deputation, he shall receive a deputation allowance equal to 4 per cent of his pay subject to a maximum of Rs.2000/-

per month:

Provided further that an officer on deputation to the Training Establishment of the Bank as a faculty member shall be eligible for deputation allowance at the rate of 4 per cent of his pay subject to a maximum of Rs.2000/- per month.‖;

(B) for sub–regulation (8), the following sub–regulation shall be substituted, namely:— ―(8) On and from the 1st day of November 2012, if the working hours during a day are split with minimum interval of two hours, an officer shall be eligible for a Split Duty Allowance at the rate of Rs.200 per month.‖;

(C) in sub–regulation(10),—

(a) for the figures, letters and words ―1st day of November 2007‖, the figures, letters and words ―1st day of November, 2012‖ shall be substituted;

(b) for the Table, the following table shall be substituted, namely:—[भाग III—खण् ड 4] भारत का राजर्पत्र : ऄसाधारण 23 “TABLE Place Rate

9. In regulation 24 of the said regulations,—

(i) for sub–regulation (1), the following sub-regulation shall be substituted, namely:— ―(1) On and from the 1st day of November, 2012, an officer shall be eligible for reimbursement of medical expenses for self and family on the strength of the officer‘s own certificate of having incurred such expenditure supported by a statement of accounts for the amounts claimed as specified in the table below,

Note: (i) an officer may be allowed to accumulate unavailed medical aid so as not to exceed at any time three times the maximum amount provided above; or

(ii) for the year 2012, the reimbursement of medical expenses under the medical aid scheme shall be enhanced proportionately for two months, that is, November, 2012 and December, 2012.

(1A) An officer shall be eligible for Medical Insurance facility for self and his family, as per the terms and conditions specified by the Board.‖.

10. In regulation 25 of the said regulations, for sub–regulation (2), the following sub-regulation shall be substituted, namely:— ―(2) Notwithstanding anything contained in sub–regulation (1), it shall be open to the Bank to provide residential accommodation to an officer on payment by the officer, on and from the 1st day of November, 2012, a sum equal to 0.75 per cent of the basic pay in the first stage of the scale of pay in which he is placed or the standard rent for the accommodation, whichever is less:

Provided that where the officer is provided with furniture at such residence, a further sum equal to 0.15 per cent of basic pay in the first stage of the scale of pay in which he is placed shall

be recovered by the Bank from him:

Provided further that, where such residential accommodation is provided by the Bank, the charges for electricity, water, gas and conservancy shall be borne by the officer.‖.

11. In regulation 33 of the said regulations, for sub–regulation (4), the following sub- regulation shall be substituted, namely:— ―(4) On and from 1st June, 2015, Privilege Leave may be accumulated up to not more than 270 days except where leave has been applied and it has been refused:24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

Provided that encashment of Privilege Leave shall be restricted up to a maximum of 240 days:

Provided further that an officer desiring to avail Privilege Leave shall ordinarily give not less than 15 days notice of his intention to avail such leave.‖.

12. In regulation 34 of the said regulations, after sub–regulation (3), the following sub-regulation shall be inserted, namely:– ―(4) On and from 1st June, 2015, Special Sick Leave up to 30 days may be granted to an officer once during his entire period of service for donation of kidney or organ.‖.

13. In regulation 36 of the said regulations, for sub–regulations (2) and (3), the following sub- regulations shall be substituted, namely:– ―(2) With effect from the 25th May 2015, leave may also be granted once during service to a childless female officer for legally adopting a child who is below one year of age for a

maximum period of six months subject to the following terms and conditions:–

(i) leave will be granted for adoption of only one child;

(ii) the adoption of a child should be through a proper legal process and the employee should produce the adoption deed to the Bank for sanctioning such leave;

(iii) the leave shall also be available to biological mother in cases where the child is born through surrogacy; and

(iv) the leave shall be availed within overall entitlement of twelve months during the entire period of service.

(3) With effect from the 25th May 2015, within the overall period of twelve months, leave may also be granted in case of hysterectomy up to a maximum of sixty days.

(4) Maternity leave, which shall be on substantive pay, shall be granted to a female officer for a period not exceeding six months on any one occasion and twelve months during the

entire period of her service:

Provided that within the overall period of twelve months, leave may also be granted in case of miscarriage or abortion or Medical Termination of Pregnancy.

(5) With effect from 1st June 2015, male officers employees having up to two surviving children shall be eligible for fifteen days paternity leave during his wife‘s confinement

which may be combined with any other kind of leave except casual leave:

Provided that the leave shall be applied up to fifteen days before or up to six months from the date of delivery of the child.‖.

14. For regulation 38 of the said regulations, the following regulation shall be substituted, namely:— ―(38) Lapse of Leave.— Save as provided below, all leave to the credit of an officer shall lapse on resignation, retirement, death, discharge, dismissal or termination:

Provided that where an officer retires from the Bank‘s service, he shall be eligible to be paid a sum equivalent to the emoluments of any period, not exceeding 240 days of

privilege leave that he had accumulated:

Provided further that where an officer has been compulsorily retired including as a measure of punishment, he shall be eligible to be paid a sum equivalent to emoluments of any period, not exceeding 240 days of privilege leave that he has accumulated:

Provided also that where an officer dies while in service, there shall be payable to his legal representatives, a sum equivalent to the emoluments for the period not exceeding 240 days of privilege leave to his credit as on the date of his death:

Provided also that where an officer resigns from service on or after 1st April, 2001 after giving due notice as in sub–regulation (2) of regulation 20, he may be paid a sum equivalent to the emoluments in respect of privilege leave to the extent of half of such leave to his credit on the date of cessation of service, subject to a maximum of 120 days.‖.[भाग III—खण् ड 4] भारत का राजर्पत्र : ऄसाधारण 25

15. In regulation 41 of the said regulations,–

(i) for sub–regulation (1), the following sub-regulation shall be substituted, namely:– ―(1) On and from 1st day of November 2012, wherever an officer is required to travel on duty, the following provisions shall apply, namely:–

(a) an Officer in Junior Management Grade is entitled to travel by 1st class or AC 2-tier

Sleeper by train:

Provided that he may travel by air (economy class) if so permitted by Competent Authority, having regard to the exigencies of business or public interest;

(b) an officer in Middle Management Grade is entitled to travel by 1st Class or AC2-tier

Sleeper by train:

Provided that he may travel by air (economy class) if the distance to be travelled is more than 1000 kilometers:

Provided further that he may travel by air (economy class) even for shorter distance if so permitted by the Competent Authority, having regard to the exigencies of business or public interest;

(c) an officer in Senior Management or Top Executive Grade is entitled to travel by AC 1st Class by train or by air (economy class);

(d) an officer in Senior Management or Top Executive Grade may travel by car between places not connected by air or rail provided that the distance does not exceed 500

kilometers:

Provided that when a major part of the distance between the two places can be covered by air or rail only the rest of the distance should normally be covered by car;

(e) any other officer may be authorized by the Competent Authority, having regard to the exigencies of business, to travel by his own vehicle or by taxi or by the Bank‘s vehicle;

(f) an officer of any grade or scale shall be eligible to travel by water transport in deluxe cabin category between places not connected by road or air or rail.‖;

(ii) in sub-regulation (4), for clauses (a) and (b), the following clauses shall be substituted, namely: ―(a) On and from the 1st June, 2015, an officer in the Grades or Scales set out in column (1) of the table below shall be entitled to per diem Halting Allowance at the corresponding rates set out in column (2) thereof, namely:— TABLE Grade/Scales of Officers Metro Major ‗A‘ Class Area -1 Other (Rs.) Provided that where the total period of absence is less than eight hours but more than four hours, Halting Allowance at half the above rates shall be payable.

Explanation: – For the purposes of computing Halting Allowance ―per diem‖ shall mean each period of twenty-four hours or any subsequent part thereof, reckoned from the reporting time for departure in the case of air travel and the scheduled time of departure in other cases, to the actual time of arrival and where the total period of absence is less than twenty-four hours, ―per diem‖ shall mean a period of not less than eight hours.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(b) On and from the 31st day of March 2020, an Officer in the Grades or Scales set out in column (1) of the table below may be reimbursed the actual hotel expenses restricting to single room accommodation charges in India Tourism Development Corporation hotels of the corresponding star category set out in column (2) thereof, as under:

16. In regulation 42 of the said regulations, for sub-regulation (3), the following sub-regulation shall be substituted, namely:– ―(3) On and from the 1st day of June, 2015, an officer on transfer shall be eligible to draw a lump sum amount for expenses connected with packing, local transportation, insuring the baggage, etc., as specified in the table below, namely:– TABLE Grade/Scale Amount

17. In regulation 44 of the said regulations, for sub–regulation (3), the following sub-regulations shall be substituted, namely:– ―(3) During each block of four years, an officer shall be eligible for leave travel concession for

travel to his place of domicile once in each block of two years:

Provided that, he may travel in one block of two years to his place of domicile and in another

block of two years to any place in India by the shortest route:

Provided further that with effect from 1stJune, 2015, alternatively, an officer by exercising an option anytime during a four year block or two year block, as the case may be, surrender and encash his Leave Travel Concession (other than travel to place of domicile) upon which he shall be entitled to receive an amount equivalent to the eligible fare for the class of travel by train to which he is entitled up to a distance of 4,500 kilometers (one-way) for officers in JMG-Scale I and MMG-Scale II and III and 5,500 kilometers (one-way) for officers in SMG-Scale IV and above:

Provided also that with effect from 1st June, 2015, an officer opting to encash his Leave Travel Concession, shall prefer the claim for himself and his family members only once during the block in which such encashment is availed of and the facility of encashment of privilege leave while availing of Leave Travel Concession is also available while encashing the facility of Leave Travel Concession.

(3A) The mode and class by which an officer may avail of Leave Travel Concession shall be the same as the officer is normally entitled to travel on transfer and other terms and conditions subject to[भाग III—खण् ड 4] भारत का राजर्पत्र : ऄसाधारण 27 which the Leave Travel Concession may be availed of by an officer, shall be as decided by the Board from time-to-time:

Provided that with effect from 1st May, 2010, an officer in Junior Management Grade Scale I while availing Leave Travel Concession shall be entitled to travel by air in the lowest fare economy class in which case the reimbursement will be the actual fare or the fare applicable to AC 1st Class fare by train for the distance travelled whichever is less and the same rules shall apply when an Officer in Middle Management Grade Scale II and Middle Management Grade Scale III while availing Leave Travel Concession where the distance is less than 1000 kilometers.‖.

18. EXPLANATORY MEMORANDUM The retrospective effect given in these regulations relate to the pay and other allowances and benefits to the officers of the Bank of Baroda and are essentially beneficial legislation. Hence, giving retrospective effect to the said provisions of these regulations will not adversely affect the interest of any person as a result of such retrospective application.
