1. (1) य ेवववनर्म पंजाब नैशनल बैंक (कमाचारी) पेंशन (संशोधन) वववनर्म, 2024 कहलाएँगे।

(2) र् ेसरकारी राजपत्र म ेंअपन े प्रकाशन की जतजथ स ेलाग ू होंगे।

2. पंजाब नशै नल बैंक (कमाचारी) पशें न वववनर्म, 1995 (इसके बाि यहा ँ उि वववनर्मों के रूप म ें संदर्भजत) म,ें वववनर्म 2 के खंड (एस) म,ें उपखंड (डी) म,ें वनम्नवलवखत परंतुक िाजमल ककय े जाएंग,े अर्ाता ्: - 3839 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] " परंतु नवम्बर, 2012 के पहल े कदवस स ेलागू दकए गए ववशेष भत्त े इसम ें शावमल नहीं ककये िाएंग:े - परंत ु कोई कमाचारी जो 1 नवंबर, 2017 को बैंक की सेवाओं म ें र्ा और वजसकी जस्ट्थर वते न ववृ ि (Stagnation increment) को उनके अवधकतम वेतनमान तक पहुचं ने की तारीख स े संशोवधत आववधकता के अनुसार पनु ः समार्ोवजत दकर्ा गर्ा ह,ै वह 1 नवंबर, 2017 स े पेंशन के प्रर्ोजनों हते ु उक्त सशं ोवधत जस्ट्थर वेतन वृजि (Stagnation increment) के वलए आनुमाजनक रूप स े पात्र होगा, परंतु ऐसे पुनः समार्ोजन के कारण मौदद्रक लाभ केवल 1 नवंबर, 2020 र्ा पात्रता की वास्तववक जतजथ, जो भी बाि म ें हो, स े िर्े होगा।"

3. उि वववनर्मों के वववनर्म 22 म,ें उप-वववनर्म (1) म,ें वनम्नवलवखत परंतुक िोड़ा जाएगा, अर्ाात्: - “परंत ु कोई कमाचारी, जो बैंक की सेवा म ें कार्मजक के रूप में स्र्ार्ी आधार पर पूणाकावलक अथवा स्र्ार्ी आधार पर अंशकावलक वेतनमान पर जनयोजित ह,ै जनष्काजसत होन े पर उसकी पूरी वपछली सेवा की िब्ती नही होगी तथा वह पेंशन संबंधी लाभों के वलए पात्र होगा। ”

4. उि वववनर्मों के वववनर्म 36 म,ें खंड (एफ) के बाि, वनम्नवलवखत खंड िोड़ा िाएगा, अर्ाात्: - “(िी) नवंबर, 2017 के पहल े कदवस को र्ा उसके पश्चात सेवावनवृत्त हुए कमाचारी, अंशकावलक कमाचारी स े वभन्न, कमाचारी के संबंध म ें तीन हजार नौ सौ जपचासी रुपर् े प्रवत माह, 1/3 वेतनमान प्राप्त करन े वाल े अंशकावलक कमाचारी के संबंध म ें एक हजार तीन सौ पैंतीस रुपर् े प्रवत माह, ½ वेतनमान प्राप्त करन े वाले अंशकावलक कमाचारी के संबंध म ें िो हजार रुपर् े प्रवत माह, और ¾ वते नमान प्राप्त करने वाल े अंशकावलक कमाचारी के संबंध म ें तीन हजार रुपर् े प्रवत माह, जहां अशं कावलक कमाचारी नवंबर, 2017 के पहले कदवस को र्ा उसके पश्चात सेवावनवृत्त हुआ हो।”

5. उि वववनर्मों के वववनर्म 40 म,ें - (ए) उप-वववनर्म (1) म,ें —

(i) खडं (बी) म,ें पहले परंतुक के स्र्ान पर वनम्नवलवखत परंतुक प्रवतस्र्ावपत दकर्ा जाएगा, अर्ाात्:- “ परंत ु पुत्र र्ा पुत्री (ववधवा र्ा तलाकशिु ा सवहत) को िर्े कुटुंब पेंशन तब बंि कर िी जाएगी र्ा अनुमत्य नहीं होगी जब पात्र पुत्र र्ा पत्रु ी सरकारी र्ा वनजी क्षत्रे म ें रोजगार र्ा स्वरोजगार स े बारह हजार रुपर् े प्रवत माह स ेअवधक की रावश अर्जात करना शुरू कर िेत े ह:ैं”;

(ii) खंड (सी) के स्र्ान पर वनम्नवलवखत खंड प्रवतस्र्ावपत दकर्ा जाएगा, अर्ाता ्:— “(सी) माता-वपता के मामले म,ें कुटुंब पेंशन बंि कर िी जाएगी र्ा अनुमत्य नहीं होगी, र्दि सरकारी रोिगार र्ा वनजी क्षत्रे र्ा स्वरोजगार स,े माता-वपता म ें स े दकसी एक की आर् अथवा माता-वपता िोनों की कुल आर् बारह हजार रुपर् ेप्रवत माह स ेअवधक हो िाती ह।ै ” (बी) उप-वववनर्म (4) म,ें—

(i) खडं (ए) म,ें उपखंड (vi) के बाद वनम्नवलवखत उप खडं िोड़ ेिाएंगे, अर्ाात:् - “(vii) नवंबर, 2017 के पहले कदवस को र्ा उसके पश्चात सेवावनवृत्त या मृत हुए कमाचाररर्ों, अवधकाररर्ों और कमजकारों दोनों के संबंध म ेंकेवल छब्बीस हजार पांच सौ साठ रुपए प्रवत माह:

परंतु अप्रलै , 2021 के पहल े कदवस स े उप-खंड (i) स े (vii) प्रभावी नहीं रहगें े और उपर्िुा सभी श्रेणी के कमाचाररर्ों के वलए दोनों पेंशन की रावश, उि वववनर्म 39 के उप-वववनर्म (3) के खंड (ए) के उप-खंड (i) और खंड (बी) के उप-खडं (i) के प्रावधानों के अनुसार िर्े होगी, जैसा भी मामला हो।"[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

(ii) खंड (बी) म,ें उप-खण्ड (vi) के बाद वनम्नवलवखत उप खडं िोड़ा िाएगा, अर्ाात्:- “(vii) नवंबर, 2017 के पहल े कदवस को र्ा उसके पश्चात सेवावनवृत्त या मृत हुए कमाचाररर्ों, अवधकाररर्ों और कमजकारों दोनों के संबंध म ेंकेवल छब्बीस हजार पांच सौ साठ रुपए प्रवत माह:

परंतु अप्रलै , 2021 के पहल े कदवस स े उप-खंड (i) स े (vii) प्रभावी नहीं रहगें े और उपर्िुा सभी श्रेणी के कमाचाररर्ों के वलए दोनों पेंशन की रावश वववनर्म 39 के उप-वववनर्म (1) र्ा उि वववनर्म के उप- वववनर्म (3) के खंड (ए) के उप-खंड (i) और खंड (बी) के उप-खंड (i) के प्रावधानों के अनसु ार िर्े होगी, जैसा भी मामला हो।

(iii) खंड (सी) म,ें उपखडं (vi) के पश्चात ्वनम्नवलवखत उपखडं िोड़ा जाएगा, अर्ाात्:- “(vii) नवम्बर, 2017 के पहले कदवस को र्ा उसके पश्चात सेवावनवृत्त हुए र्ा मृत हुए कमाचाररर्ों, अवधकाररर्ों और कमजकारों दोनों के संबंध म ें केवल तेरह हजार िो सौ अस्सी:

परंत ु अप्रैल, 2021 के पहल े कदवस से उप-खंड (i) स े (vii) प्रभावी नहीं होंग े तथा उपर्िुा सभी श्रेणी के कमाचाररर्ों के वलए िोनों पेंशन की रावश वववनर्म 39 के उप-वववनर्म (1) के प्रावधानों के अनुसार िर्े होगी।

6. उि वववनर्मों के पररवशष्ट-II म,ें खंड (4) के स्र्ान पर वनम्नवलवखत प्रवतस्र्ावपत दकर्ा जाएगा, अर्ाात:् - “(4) 1 मई, 2005 को या उसके बाि सेवावनवृत्त होने वाले कमाचाररर्ों के संबंध म,ें श्रृंखला 1960=100 म ें औद्योवगक कमजकारों के वलए अवखल भारतीर् औसत उपभोिा मूल्र् सूचकांक के जतमाही औसत म ें महगं ाई राहत 2288 अंकों से अजधक प्रत्र्ेक 4 अंकों के जलए प्रत्र्ेक वृवि पर िर्े होगी तथा प्रत्र्ेक वगरावट पर वसूली र्ोग्र् होगी, िैसा भी मामला हो, ऐस े प्रत्येक 4 अंकों की महगं ाई राहत म ें वृवि र्ा जगरावट की गणना मूल पशें न के 0.18 प्रवतशत की िर स े की जाएगी:

परंतु मई, 2005 के पहले कदवस को अथवा उसके बाद स,े उन कमचा ाररर्ों के सबं धं म,ें जो नवम्बर, 2002 के पहल े कदवस से र्ा उसके पश्चात दकन्त ु 30 अप्रलै , 2005 को र्ा उसस े पवू ा सवे ावनवत्तृ हुए हों , इस खंड के अनसु ार महगं ाई राहत िर्े होगी:

परंत ु नवबं र, 2007 के पहल े कदवस को र्ा उसके बाि सवे ावनवत्तृ हुए कमचा ाररर्ों के सबं धं म,ें श्रखृं ला 1960=100 म ें औद्योवगक कमकज ारों के वलए अवखल भारतीर् औसत उपभोिा मल्ू र् सचू काकं के जतमाही औसत म ें महगं ाई राहत 2836 अकं ों स े अजधक प्रत्र्ेक 4 अकं ों के जलए प्रत्र्के ववृ ि पर िर्े होगी तथा प्रत्र्के वगरावट पर वसलू ी र्ोग्र् होगी, िैसा भी मामला हो, और ऐस े प्रत्येक 4 अकं ों की महगं ाई राहत म ें ववृ ि र्ा जगरावट की गणना मलू पशें न के 0.15 प्रवतशत की िर स े की जाएगी:

परंत ु नवंबर,2012 के पहल े कदवस को र्ा उसके पश्चात सेवावनवृत्त हुए कमाचाररर्ों के संबधं म,ें श्रृंखला 1960=100 में औद्योवगक कमजकारों के वलए अवखल भारतीर् औसत उपभोिा मल्ू र् सूचकांक के जतमाही औसत म ें महगं ाई राहत 4440 अंकों से अजधक प्रत्र्ेक 4 अंकों के जलए प्रत्येक वृवि पर िर्े होगी तथा प्रत्र्के वगरावट पर वसूली र्ोग्र् होगी, िैसा भी मामला हो, और ऐस े प्रत्येक 4 अंकों की महगं ाई राहत म ें वृवि र्ा जगरावट की गणना मूल पेंशन के 0.10 प्रवतशत की िर स े की जाएगी:

परंतु नवंबर, 2017 के पहले कदवस को र्ा उसके बाि सेवावनवृत्त हुए कमाचाररर्ों के संबंध म,ें श्रृंखला 1960=100 में औद्योवगक कमजकारों के वलए अवखल भारतीर् औसत उपभोिा मल्ू र् सूचकांक के वतमाही4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] औसत म ें महगं ाई राहत 6352 अंकों से अजधक प्रत्र्ेक 4 अंकों के जलए प्रत्र्ेक वृवि पर िर्े होगी तथा प्रत्र्के वगरावट पर वसूली र्ोग्र् होगी, िैसा भी मामला हो, और ऐसे प्रत्येक 4 अंकों के वलए महगं ाई राहत वृवि र्ा जगरावट की गणना मलू पशें न के 0.07 प्रवतशत की िर स ेकी जाएगी।”

7. उि वववनर्मों के पररवशष्ट III म,ें खंड (एफ) के पश्चात, वनम्नवलवखत खडं िोड़े जाएगं े, अर्ाात्:- “(िी) नवंबर, 2017 के पहल े कदवस को र्ा उसके बाि सेवावनवृत्त हुए अंशकावलक कमचा ाररर्ों के अलावा कमाचाररर्ों (अवधकाररर्ों और कमजकारों िोनों) के संबंध म:ें वते नमान प्रवतमाह मावसक कुटुंब पशें न की रावश

(1) (2) वेतन का 30 प्रवतशत मूल कुटुंब पेंशन होगी तथा भत्त े का अवतररि 30 प्रवतशत, जिसकी गणना रु. 15,880 तक भववष्र् वनवध म ें अंशिान करन े के वलए की िाती ह,ै परंतु महगं ाई भत्त े के वलए नहीं, अवतररि कुटुंब पेंशन होगी:

परंत ु मूल और अवतररि कुटुंब पेंशन का र्ोग न्र्ूनतम रुपर् े3985 प्रवत माह होगा। वेतन का 20 प्रवतशत मलू कुटुंब पेंशन होगी और भत्त े का अवतररि 20 प्रवतशत, जिसकी गणना रु.15,881 स े भववष्र् वनवध म ें अंशिान के वलए की िाती ह,ै परंत ु महगं ाई भत्त े के वलए नहीं, अवतररि कुटुंब रु.31,760 तक पेंशन होगी:

परंत ु मूल और अवतररि कुटुंब पेंशन का र्ोग न्र्ूनतम रुपर् े4900 प्रवतमाह होगा । वेतन का 15 प्रवतशत मलू कुटुंब पेंशन होगी और भत्त े का अवतररि 15 प्रवतशत, जिसकी गणना रु. 31,760 स े भववष्र् वनवध म ें अंशिान के वलए की िाती ह,ै परंत ु महगं ाई भत्त े के वलए नहीं, अवतररि कुटुंब अवधक पेंशन होगी:

परंत ु मूल और अवतररि कुटुंब पेंशन का र्ोग न्र्नू तम रुपर् े 6365 प्रवत माह और अजधकतम रुपर् े 13280 प्रवत माह होगा। (एच) अप्रलै , 2021 के पहल े कदवस से खंड (ए) स े (िी) प्रभावी नहीं रहगें े और उि खंडों म ें उवल्लवखत सभी कमाचाररर्ों (अवधकाररर्ों और कमजकारों िोनों) के संबंध म,ें वेतन का 30 प्रवतशत मूल कुटुंब पेंशन होगा िमा भत्त े का 30 प्रवतशत जिसकी गणना भववष्र् वनवध म ें अंिदान के जलए की िाती ह,ै लेदकन महगं ाई भत्त े के वलए नहीं, अवतररि कुटुंब पेंशन होगी। व्याख्यात्मक ज्ञापन उक्त जवजनयम, जिन्ह ें पूवाव्यापी प्रभाव कदया गया ह ै संबंवधत बकैं ों द्वारा दिए गए जविेष अवधिेश के आधार पर सदस्ट्य बैंकों की ओर से भारतीय बैंक संघ और बैंकों के िीष ज स्ट्तरीय कमजचारी संघों तथा अवधकारी संघों के बीच हस्ताक्षररत संर्िु नोटों और समझौते की सहमत जनयमों व ितों के अनुसार ह ै । अत: इस तरह के पूवजव्यापी प्रभाव से ककसी व्यवि के वहतों पर प्रवतकूल प्रभाव नहीं पडगे ा । समु शे कुमार, महाप्रबधं क-मानव ससं ाधन ववभाग [जवज्ञापन-III/4/असा./222/2024-25] नोट:— मूल वववनर्म भारत के राजपत्र, भाग III, खंड 4 म ेंअवधसूचना संख्र्ा पीएनबी/आईआर/1/95, दिनांक 29 वसतंबर, 1995 द्वारा प्रकावशत ककये गये और तत्पश्चात जपछला संिोधन प्र.का.: पेंशन/ववववध/2023, दिनांक 11 अगस्त, 2023 अवधसूचना द्वारा ककया गया ।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 PUNJAB NATIONAL BANK (Human Resources Department)

NOTIFICATION New Delhi, the 28th June, 2024 No.HO: Pension/Misc/2024(E).— In exercise of the powers conferred by clause (f) of sub-section (2) of section 19 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the Punjab National Bank, after consultation with the Reserve Bank of India and with the previous sanction of the Central Government, hereby makes the following regulations further to amend the Punjab National Bank (Employees’) Pension Regulations, 1995, namely:—

1. (1) These regulations may be called the Punjab National Bank (Employees’) Pension (Amendment) Regulations, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Punjab National Bank (Employees’) Pension Regulations, 1995 (hereinafter referred to as the said regulations), in regulation 2, in clause (s), in sub-clause (d), the following provisos shall be inserted, namely: — “Provided further that special allowance introduced with effect from the 1st day of November, 2012 shall be

excluded:

Provided also that an employee who was in the services of the Bank as on the 1st November, 2017 and whose stagnation increments have been re-adjusted as per revised periodicity from the date of reaching their maximum scale of pay, shall be notionally eligible for such revised stagnation increments with effect from the 1st November, 2017 for the purposes of Pension but the monetary benefit on account of such re- adjustment shall be payable only, with effect from the 1st November, 2020 or the actual date of entitlement, whichever is later.”.

3. In regulation 22 of the said regulations, in sub-regulation (1), the following proviso shall be inserted,

namely: — “Provided that the removal of an employee, who is employed in the service of the Bank as a workman on full time work on permanent basis or on part-time work on permanent basis on scale wages, shall not entail for forfeiture of his entire past service and shall qualify for pensionary benefits.”.

4. In regulation 36 of the said regulations, after clause (f), the following clause shall be inserted, namely: — “(g) rupees three thousand nine hundred and eighty-five per month in respect of an employee, other than a part- time employee, where the employee retired on or after the 1st day of November, 2017, rupees one thousand three hundred and thirty-five per month in respect of a part-time employee drawing 1/3 scale of wages, rupees two thousand per month in respect of part-time employee drawing ½ scale wages, and rupees three thousand per month in respect of a part-time employee drawing ¾ scale wages, where the part-time employee retired on or after the 1st day of November, 2017.”.

5. In regulation 40 of the said regulations, —

(a) in sub-regulation (1), —

(i) in clause (b), for the first proviso, the following proviso shall be substituted, namely:— “Provided that the family pension payable to son or daughter (including widowed or divorced) shall be discontinued or not be admissible when the eligible son or daughter starts earning a sum in excess of rupees twelve thousand per month from employment in Government or private sector or self–employment:”;

(iii) for clause (c), the following clause shall be substituted, namely:— “(c) in the case of parents, the family pension shall be discontinued or not be admissible if the income6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] of one of the parents or the aggregate income of both the parents from employment in Government or Private sector or self–employment, exceeds rupees twelve thousand per month;”;

(b) in sub-regulation (4),—

(i) in clause (a), after sub-clause (vi), the following shall be inserted, namely:— “(vii) twenty-six thousand five hundred and sixty rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after the 1st day of November, 2017:

Provided that on and from the 1st day of April, 2021, sub-clauses (i) to (vii) shall cease to have effect and the amount of both pensions for all the above said category of employees shall be payable as per the provisions of sub-clause (i) of clause (a) and sub-clause (i) of clause (b) of sub-regulation (3) of regulation

39.”;

(ii) in clause (b), after sub-clause (vi), the following shall be inserted, namely:— “(vii) twenty-six thousand five hundred and sixty rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after the 1st day of November, 2017:

Provided that on and from the 1st day of April, 2021, sub clause (i) to (vii) shall cease to have effect and the amount of both the pension for all the above said category of employees shall be payable as per the provisions of sub-regulation (1) of regulation 39 or sub-clause (i) of clause (a) and sub-clause

(i) of clause (b) of sub-regulation (3) of the said regulation, as the case may be.”;

(iii) in clause (c), after sub-clause (vi), following sub-clauses shall be inserted, namely: — “(vii) thirteen thousand two hundred and eighty only in respect of employees, both officers and workmen, who retired or died on or after the 1st day of November, 2017:

Provided that on and from the 1st day of April, 2021, sub clause (i) to (vii) shall cease to have effect and the amount of the two pensions for all the above said category of employees shall be payable as per the provisions of sub-regulation (1) of regulation 39.”.

6. In Appendix-II to the said Regulations, for clause (4), the following shall be substituted, namely:- “(4) In respect of employees who retire on or after the 1st May, 2005, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2288 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.18 per cent. of

basic pension:

Provided that on and from the 1st day of May, 2005, in respect of employees who retired on or after the 1st day of November, 2002 but on or before the 30th day of April, 2005, dearness relief shall be payable in terms

of this clause:

Provided further that in respect of employees who retired on or after the 1st day of November, 2007, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2836 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.15 per cent. of basic pension:

Provided also that in respect of employees who retired on or after the 1st day of November, 2012, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 4440 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100.Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.10 per cent. of basic pension:

Provided also that in respect of employees who retired on or after the 1st day of November, 2017, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 points over 6352 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. 7. In Appendix III to the said regulations, after clause (f), the following clauses shall be inserted, namely:— “(g) in respect of employees (both officers and workmen) other than part-time employees retiring on or after the 1st day of November, 2017:

(1) (2) Upto Rs.15,880 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowance, which are counted for making contribution to provident fund but not for dearness allowance, shall be the additional family pension:

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.3985 per month.

Rs.15,881 to 20 per cent. of the pay shall be basic family pension and additional 20 per cent. of Rs.31,760 allowance, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional family pension:

Provided that the aggregate of basic and additional family pension shall be subject to minimum of Rs.4900 per month.

Above Rs.31,760 15 per cent. of the pay shall be the basic family pension and additional 15 per cent. of allowances, which are counted for making contributions to provident fund but not for the dearness allowance, shall be the additional family pension:

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.6365 per month and maximum of Rs.13280 per month.

(h) On and from the 1st day of April, 2021 clauses (a) to (g) shall cease to have effect and in respect of all employees (both officers and workmen) mentioned in the said clauses, 30 per cent. of the Pay shall be the basic family pension plus 30 per cent. of allowance which are counted for making contribution to provident fund but not for dearness allowance, shall be the additional family pension.”.

Explanatory Memorandum The regulations which have been given retrospective effect are as per the agreed terms and conditions of the settlements and Joint Notes signed between the Indian Banks’ Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level workmen unions and officers’ associations of the banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
