L.-33004/99 सी.जी.-डी.एxलx.x-GअID.-H2x0x0x 82026-275604 CG-DLxx-xEG-I2D0E0x8x2x0 26-275604 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4411] नई दिल्ली, बुधिार, अगस्ट्त 19, 2026/श्रािण 28, 1948 No. 4411] NEW DELHI, WEDNESDAY, AUGUST 19, 2026/SHRAVAN 28, 1948 परे ोजलयम और प्राकृजतक गसै मत्रं ालय अजधसचू ना नई दिल्ली, 18 अगस्ट् त, 2026 का.आ. 4591(अ) .— केन्द्रीय सरकार न े पेरोजलयम और खजनि पाइपलाइन (भूजम म ें उपयोग के अजधकार का अिजन) अजधजनयम, 1962 (1962 का 50) (जिसे इसमें इसके पश्चात उक्त अजधजनयम कहा गया है) की धारा 3 की उपधारा (1) के अधीन िारी की गई भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की अजधसूचना संख्या का. आ. 1832 (अ.) तारीख 8 अप्रलै , 2026, िो भारत के असाधारण रािपत्र तारीख 10 अप्रलै , 2026, में प्रकाजित की गई थी, द्वारा उस अजधसूचना से संलग्न अनुसूची में जिजनर्दिष्ट भूजम में पजश्चम बंगाल राज्य में एल पी िी पररिाहन के जलए जहन्द्िस्ट्ु तान पेरोजलयम कॉपोरेिन जलजमटेड द्वारा हाजल्िया से पानागढ़ पाइपलाइन जबछान े के प्रयोिन के जलए उपयोग के अजधकार का अिजन के अपने आिय की घोषणा की थी;
और उक्त असाधारण रािपत्र अजधसूचना की प्रजतयां िनता को तारीख 16 अप्रैल, 2026 को उपलब्ध करा िी गई थी ; और सक्षम प्राजधकारी न,े उक्त अजधजनयम की धारा 6 की उपधारा (1) के अधीन केन्द्रीय सरकार को ररपोटज िे िी ह;ै 6405 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और केन्द्रीय सरकार न,े उक्त ररपोटज पर जिचार करने के पश्चात, और यह समाधान हो िाने पर दक उक्त भूजम पाइपलाइन जबछाने के जलए अपेजक्षत ह,ै उसमें उपयोग के अजधकार का अिनज करने का जिजनश्चय दकया ह ै ;
अतः अब, केन्द्रीय सरकार, उक्त अजधजनयम की धारा 6 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, यह घोषणा करती ह ै दक इस अजधसूचना से सलं ग्न अनुसूची में जिजनर्दिष्ट भूजम म ें पाइपलाइन जबछान े के जलए उपयोग के अजधकार का अिजन दकया िाए ;
और केन्द्रीय सरकार उक्त अजधजनयम की धारा 6 की उपधारा (4) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, यह जनिेि िेती ह ैदक उक्त भूजम में उपयोग का अजधकार इस घोषणा के प्रकािन की तारीख से केन्द्रीय सरकार में जनजहत होने के बिाए, सभी जिल्लंगमों से मक्तु होकर जहन्द्िस्ट्ु तान पेरोजलयम कॉपोरेिन जलजमटेड म ेंजनजहत होगा। पेरोजलयम और खजनि पाइपलाइन अजधजनयम, 1962 की धारा 10 के अधीन दकसी भी क्षजतपूर्तत के जलए जहन्द्िस्ट्ु तान पेरोजलयम कॉपोरेिन जलजमटेड पूणतज या उत्तरिायी होगी और पाइपलाइन से सम्बजन्द्धत दकसी भी मामले पर केन्द्रीय सरकार के जिरूद्ध कोई िाि, िािा या कानूनी कायजिाही नहीं हो सकेगी ;

NOTIFICATION New Delhi, the 18th August, 2026 S.O. 4591(E).— Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas number S.O.1832(E) dated the 8th April, 2026, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Extra Ordinary Gazette of India dated the 10th April, 2026, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for transportation of LPG from Haldia to Panagarh Pipeline in the State of West Bengal by Hindustan Petroleum Corporation Limited;
And whereas copies of the said Extra Ordinary Gazette notification were made available to the public on the 16th April, 2026;
And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act submitted his report to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying this pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this
notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of this declaration, in Hindustan Petroleum Corporation Limited, free from all encumbrances.
Hindustan Petroleum Corporation Limited shall be exclusively liable for any compensation in terms of
Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 SCHEDULE
