2. प्राजधकरण के अध्र्क्ष और सिस्ट्र्, इस अजधसूचना के रािपत्र में प्रकािन की तारीख से चार वर्ा की अवजध के जलए पि धारण करेंगे।

3. प्राजधकरण ऐसी िजिर्ों का प्रर्ोग और ऐसी प्रदक्रर्ाओं का पालन करेगा, िो उि अजधसूचना में जवजनर्िाष्ट ह ै।

5. प्राजधकरण के सभी जनणार् बैठक में जलए िाएंग े और सवासम्मजत से होंग:े परंत ुर्दि कोई जनणार् बहुमत स ेजलर्ा िाता ह,ै तो इसके पक्ष और जवपक्ष म ेंजवचारों का जववरण स्ट्पष्ट रूप से कार्ावृत्त में ििा दकर्ा िाएगा और उसकी एक प्रजत पर्ाावरण और वन मंत्रालर् को भेिी िाएगी।

6. इसके अजतररि, केंद्रीर् सरकार, प्राजधकरण की सहार्ता के प्रर्ोिन से पजिमी बंगाल सरकार के परामिा से, राज्र् स्ट्तरीर् जविेर्ज्ञ अंकन सजमजत (जिसे इसमें इसके पिात् सजमजत कहा गर्ा ह)ै , पजिमी बंगाल का गठन करती है, जिसमें जनम्नजलजखत सिस्ट्र् सजम्मजलत ह,ैं अर्ाात:् क्र.सं अजभजहत सिस्ट्र् पिनाम

7. सजमजत के अध्र्क्ष और सिस्ट्र् इस अजधसूचना के रािपत्र म ें प्रकािन की तारीख से चार वर्ा की अवजध के जलए पि धारण करेंगे।

8. सजमजत ऐसी िजिर्ों का प्रर्ोग और ऐसी प्रदक्रर्ाओं का पालन करेगी, िो उि अजधसूचना में जवजनर्िाष्ट ह ै।

9. सजमजत सामूजहक उत्तरिाजर्त्व के जसद्ांत पर कार्ा करेगी, और अध्र्क्ष प्रत्र्ेक मामले में आम सहमजत तक पहुचं ने का प्रर्ास करेगा, और र्दि आम सहमजत नहीं हो पाती ह,ै तो बहुमत का जवचार अजभभावी होगा।

10. जहतों के टकराव से बचन े के जलए,--

(i) प्राजधकरण के अध्र्क्ष और सिस्ट्र् तर्ा सजमजत के अध्र्क्ष और सिस्ट्र्,-- (क) र्ह घोजर्त करेंग ेदक वे दकस परामिा संगठन और पररर्ोिना के प्रस्ट्तावकों से भी िड़ु े ह ैं ; और (ख) दकसी पररर्ोिना के जलए पर्ावा रण समाघात जनधाारण और पर्ाावरण प्रबंधन र्ोिना तैर्ार करन े के संबंध में कोई परामिा नहीं िगें े र्ा उससे संबद् नहीं होंगे, जिसका जनणार् प्राजधकरण द्वारा दकर्ा िाना ह ैर्ा सजमजत द्वारा उनके कार्ाकाल के िौरान अंकन दकर्ा िाना है; और

(ii) र्दि प्राजधकरण र्ा सजमजत के अध्र्क्ष र्ा दकसी सिस्ट्र् ने जपछले पांच वर्ों के िौरान दकसी पररर्ोिना प्रस्ट्तावक के जलए परामिा सेवाएं प्रिान की ह ैं र्ा पर्ाावरण समाघात जनधाारण अध्र्र्न दकर्ा है, तो उस जस्ट्र्जत म ें वे ऐस े प्रस्ट्तावकों द्वारा प्रस्ट्ताजवत दकसी भी पररर्ोिना के अंकन की प्रदक्रर्ा में प्राजधकरण और सजमजत की बैठकों से स्ट्वर्ं को अलग कर लगें े।

11. पजिमी बंगाल सरकार प्राजधकरण और सजमजत के सजचवालर् के रूप में कार् ा करन े के जलए एक अजभकरण को अजधसूजचत करेगी और सजचवालर् उि अजधसूचना के तहत उनके कार्ों के संबंध में आवास, पररवहन और ऐसी अन्र् सुजवधाओं सजहत सभी जवत्तीर् और संभार तंत्र की सहार्ता प्रिान करेगा।

12. प्राजधकरण और सजमजत के अध्र्क्ष और सिस्ट्र्ों के जलए बैठक फीस, र्ात्रा भत्ते और महगं ाई भत्ते पजिमी बगं ाल सरकार के सुसंगत जनर्मों के उपबंधों के अनुसार भुगतान दकए िाएगं े।

13. प्राजधकरण और सजमजत के अध्र्क्ष र्ा सिस्ट्र्ों को, उनके कार्ाकाल की समाजि से पहले, केंद्रीर् सरकार द्वारा ऐस ेजसद् आरोपों के आधार पर पि स े हटार्ा िा सकता है, िो उि प्राजधकरण और सजमजत के कामकाि को न्र्ार्पूणा, कुिल और जनष्पक्ष तरीके स े संचालन को प्रभाजवत करते ह,ैं । इन आरोपों म ें र्र्ासंिोजधत पर्ावा रण समाघात जनधाारण अजधसूचना, 2006 म ेंजनर्िाष्ट समर् सीमा स ेपरे पर्ाावरणीर् अनापजत्त प्रिान करन ेर्ा अस्ट्वीकृजत करन ेसंबंधी प्रस्ट्तावों के जनस्ट्तारण करने म ेंजवलंब भी िाजमल हो सकता ह ै। [फा. सं. आईए3-13/2/2023-आईए.III] रित अग्रवाल, संर्ु‍ त सजचव4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION New Delhi, the 31st August, 2026 S.O. 4800(E).— ).- In exercise of the powers conferred by sub-section (3) of section 3 of the Environment

(Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, vide number S.O. 1533 (E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority for West Bengal (hereinafter referred to as the Authority) comprising of the following Members, namely:- Sl. 2. The Chairman and Members of the Authority shall hold office for a period of four years from the date of publication of this notification in the Official Gazette.

3. The Authority shall exercise such powers and follow such procedures as specified in the said notification.

4. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 6 of this notification.

5. All decisions of the Authority shall be taken in a meeting and shall be unanimous:

Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Ministry of Environment and Forest.

6. Further, Central Government, in consultation with the Government of West Bengal, for the purpose of assisting the Authority, hereby constitutes the State Level Expert Appraisal Committee (hereinafter referred to as the Committee), West Bengal comprising of the following Members, namely: - Sl. 7. The Chairman and Members of the Committee shall hold office for a period of four years from the date of publication of this notification in the Official Gazette.

8. The Committee shall exercise such powers and follow such procedures as specified in the said notification.

9. The Committee shall function on the principle of collective responsibility, and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.

10. In order to avoid any conflict of interest, -

(i) the Chairman and Members of the Authority and the Chairman and Members of the Committee shall, -

(a) declare as to which consulting organisation they have been associated with and also the project proponents; and

(b) not undertake any consultation or associate with regard to preparation of environment impact assessment and environment management plan for a project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and

(ii) if the Chairman or any Member of the Authority or the Committee has provided consultancy services or conducted environment impact assessment studies for any project proponent during the preceding five years, in that event they shall recuse themselves from the meetings of the Authority and the Committee in the process of appraisal of any project proposed by such proponents.

11. The Government of West Bengal shall notify an agency to act as Secretariat for the Authority and the Committee and the Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification.

12. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee shall be paid in accordance with the provisions of relevant rules of the Government of West Bengal.

13. The Chairman or Members of the Authority and Committee are liable to be removed by the Central Government, prior to expiry of the tenure, on account of proven charges which affect the functioning of the aforesaid Authority and Committee in a just, efficient and fair manner. The charges may include delay in processing the proposals for grant or rejection of Environmental Clearance beyond the timelines specified in the Environment Impact Assessment Notification, 2006, as amended.
