अनुसंधान राष्ट्रीय िोध प्रजतष्ठान (िार्षडक लेखा जििरण प्रपत्र) जनयमािली, 2023 और अनसु ंधान राष्ट्रीय िोध प्रजतष्ठान (बिट और िार्षडक ररपोटड) जनयमािली, 2023 को जिज्ञान और प्रौद्योजगकी मंत्रालय, भारत सरकार की दिनांक 2 फरिरी, 2024 की अजधसूचना संख्या िीएसआर 85 (अ), िीएसआर 86 (अ), िीएसआर 87 (अ), िीएसआर 88 (अ) के माध्यम से दिनांक 2 फरिरी, 2024 के भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में एतद्दिारा प्रभाजित र्ो सकने िाले सभी व्यजियों स े आपजत्त एिं सुझाि आमंजत्रत करन े के जलए, अनुसंधान राष्ट्रीय िोध प्रजतष्ठान अजधजनयम, 2023 (2023 का 25) की धारा 23 की उप-धारा (1) द्वारा की गई अपेक्षानुसार, प्रकाजित दकया गया था;

और िबदक, उि प्रारूप जनयमािली के संबंध में प्राप्त आपजत्त या सुझाि पर केंद्र सरकार द्वारा जिचार दकया गया र्;ै 3819 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अतः अब, केंद्र सरकार अनुसंधान राष्ट्रीय िोध प्रजतष्ठ ान अजधजनयम, 2023 (2023 का 25) की धारा 23 की उप-धारा (2) के खंड (क), (ख), (ग), (छ), (ि), (झ) और (ञ) के साथ परठत उप-धारा (1) द्वारा प्रित्त िजियों का प्रयोग करते हुए, एतद्द्वारा जनम्नजलजखत जनयमािली बनाती र्,ै अथाडत:्-

1. सजं क्षप्त नाम और प्रारंभ⎯ (1) इन जनयमों का नाम अनुसंधान राष्र ीय िोध प्रजतष्ठ ान जनयमािली, 2024 र्।ै

(2) य ेरािपत्र म ेंप्रकािन की तारीख को प्रिृत्त र्ोंगे।

2. पररभाषाए ं ⎯(1) इन जनयमों म ें िब तक दक संिभड स ेअन्यथा अपेजक्षत न र्ो⎯ (क) 'अजधजनयम' स ेअनुसंधान राष्ट्रीय िोध प्रजतष्ठान अजधजनयम, 2023 (2023 का 25) अजभप्रेत र्;ै (ख) ‘िार्षडक ररपोटड’ से अजधजनयम की धारा 15 के अंतगडत कायड पररषि द्वारा तैयार की गई िार्षडक ररपोटड अजभप्रेत र्ै;

(ग) ‘बिट’ स े अजधजनयम की धारा 14 के अतं गतड कायड पररषि द्वारा तैयार दकया गया बिट अजभप्रेत र्;ै (घ) ‘प्रपत्र’ से इन जनयमों के साथ संलग् न प्रपत्र अजभप्रेत र्;ै (ङ) "अध्यक्ष" स ेअजधजनयम की धारा 5 की उपधारा (2) के खडं (क) म ेंउजल्लजखत िासी बोडड का अध्यक्ष अजभप्रेत र्;ै (च) ‘अनसु चू ी’ से इन जनयमों के साथ संलग्न अनुसूची अजभप्रेत र्;ै (छ) "िष"ड स े दकसी जित्त िषड, िो 01 अप्रैल से प्रारंभ र्ोता र् ै और उसके अगले िषड की 31 माचड को समाप्त र्ोता र्,ै अजभप्रेत र्।ै

(2) िो िब्ि और िाकयांि इन जनयमों में प्रयुि और अपररभाजषत र् ैंदकन्तु अजधजनयम म ेंपररभाजषत र्,ैं उनके िर्ी अजभप्राय र्ोंगे िो इस अजधजनयम में उनके जलए जनयत दकए गए र्।ैं

3. िासी बोड ड के सिस्ट्यों की अर्तड ा और अनभु ि - (1) अजधजनयम की धारा 5 की उपधारा (3) के खडं (क) के अनुसार नाजमत अथिा जनयिु दकए िाने िाल े सिस्ट्य प्रधानमत्रं ीय जिज्ञान, प्रौद्योजगकी और निोन्मेष पररषि के सिस्ट्य र्ोंगे।

(2) अजधजनयम की धारा 5 की उपधारा (3) के खंड (ख) के अनुसार नाजमत अथिा जनयिु दकया िान े िाला सिस्ट्य िर् व्यजि र्ोगा िो दकसी व्यािसाजयक संगठन या उद्योग में अग्रणी पि पर्ले धारण कर चकु ा र् ै अथिा ितडमान में धारण कर रर्ा र्।ै

(3) अजधजनयम की धारा 5 की उपधारा (3) के खडं (ग) के अनुसार नाजमत अथिा जनयुि दकया िाने िाला सिस्ट्य मानजिकी और सामाजिक जिज्ञान के क्षेत्र में पयाडप् त अनुभििाला र्ोगा।

(4) अजधजनयम की धारा 5 की उपधारा (3) के खंड (घ) के अनसु ार नाजमत अथिा जनयिु दकए िाने िाल े सिस्ट्य जिज्ञान और प्रौद्योजगकी के अनुसंधान और जिकास में कायडरत राष्ट्रीय प्रयोगिाला या अनसु ंधान या िैक्षजणक संस्ट्थान के प्रमुख र्ोंगे या ऐसी संस्ट्था में िररष्ठ िैज्ञाजनक या िररष्ठ संकाय सिस्ट्य के पि धारक र्ोंगे जिनके पास पयाडप्त अनुभि र्ो।

(5) अजधजनयम की धारा 5 की उपधारा (3) के खंड (ङ) के अनसु ार नाजमत अथिा जनयुि दकए िाने िाले सिस्ट्य जनम्नजलजखत में स े दकसी एक या एक से अजधक क्षेत्रों म ें डॉकटरेट की उपाजध या अन्य जििेषीकृत िैजक्षक अर्तड ा के धारक र्ोंगे।

(i) स्ट्िास्ट््य;

(ii) गजणतीय और भौजतक जिज्ञान;

(iii) िीि जिज्ञान;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3

(iv) इंिीजनयरी और प्रौद्योजगकी;

(v) निोन्मेष और भागीिारी;

(vi) कम्पप्यूटर और सूचना जिज्ञान और अजभयांजत्रकी और िे उि क्षेत्र म ेंपयाडप्त अनुभि रखने िाले र्ोंगे।

4. काय ड पररषि के सिस्ट्यों की अर्तड ा और अनभु ि - अजधजनयम की धारा 7 की उपधारा (3) के खंड (ख) के अनुसार नाजमत अथिा जनयुि दकए िाने िाल ेसिस्ट्य- (क) अकािजमक िगत, लोकोपकारी क्षेत्रक, अनुसंधान प्रयोगिाला अथिा उद्योग में जिज्ञान और प्रौद्योजगकी क्षेत्र म ें डॉकटरेट जडग्री अथिा अन्य जििेषज्ञीय अर्तड ा के धारक र्ोंगे; और (ख) अपन े क्षेत्र म ेंपयाडप्त अनुभि रखने िाले र्ोंगे।

5. िासी बोडड या काय ड पररषि के सिस्ट्यों का कायकड ाल - िासी बोडड या कायड पररषि के सिस्ट्य जनयुजि की तारीख से तीन िषड की अिजध के जलए पि का धारण आम तौर पर करेंगे और पुनर्नडयुजि र्ते ु पात्र र्ोंगे।

6. िासी बोडड या काय ड पररषि के जनयकु त सिस्ट्यों का भत्ता - (1) अजधजनयम की धारा 5 की उप-धारा (3) के अनुसार िासी बोडड का नाजमत या जनयिु प्रत् यके सिस्ट् य या अजधजनयम की धारा 7 की उप-धारा (3) के खंड (ख) के अनुसार कायड पररषि का नाजमत या जनयुि प्रत्येक सिस्ट्य, िासी बोडड या कायड पररषि की, िो भी उजचत र्ो, बैठक में भाग लेन े र्ते ु या िासी बोडड या काय डपररषि के कृत् य के जनष्प ािन र्ते ु, भारत सरकार के सजचि को अनुमत बैठक िल्ु क, यात्रा एिं िैजनक भत् ता तथा ऐसा अन् य भत् ता प्राप् त करने का र्किार र्ोगा।

(2) पेिंन और उपिान सजर्त दकसी अजतररकत धनराजि का भगु तान िासी बोडड या कायड पररषि के दकसी सिस्ट् य को उसके द्वारा इस बोड डया पररषि के जलए की गई सेिा के नाम पर अनुमत नर्ीं र्ोगा।

7. मख्ु य कायपड ालक अजधकारी की चयन प्रदक्रया – (1) राष्र पजत मुख्य कायडपालक अजधकारी की जनयुजि तलाि-सर्- चयन सजमजत की जसफाररिों के आधार पर करेंगे।

(2) राष्ट्रपजत मुख्य कायडपालक अजधकारी की जनयुजि र्ते ु नामों के पैनल की जसफाररि करन े के जलए तलाि-सर्-चयन सजमजत का गठन करेंगे।

8. मख्ु य कायपड ालक अजधकारी की अर्तड ा और अनभु ि – (1) मुख्य कायपड ालक अजधकारी के पि पर जनयुजि के जलए जिचार दकए िाने िाल ेव्यजि के पास जनम्पन जलजखत अर्तड ाए ंर्ोंगी - (क) जिज्ञान म ें जनष्ण ात की जडग्री, अथिा इंिीजनयरी या जचदकत्सािास्ट् त्र म ें स्नातक की जडग्री, या प्रबंधन म ें जनष्ण ात की जडग्री और साथ म ें अनुसंधान, या निोन् मषे , या प्रौद्योजगकी जिकास का प्रमाजणत रैक ररकॉड;ड और (ख) न् यनू तम बीस िषों का जनम्पन जलजखत के रूप म ेंअनुभि, -

(i) दकसी मान्यता प्राप्त राष्ट्रीय या अतं राडष्ट्रीय जिश्वजिद्यालय, या सरकारी जिभाग या अनुसंधान संस्ट्थान, अथिा सरकार या दकसी कंपनी की अनुसधं ान प्रयोगिाला में संकाय सिस्ट् य या िैज्ञाजनक; अथिा

(ii) दकसी कंपनी में िररष्ठ प्रबंधकीय स्ट्तर पर जनष्प ािन, और साथ म ें अनुसंधान और जिकास कायडक्रमों या पररयोिनाओं के प्रबंधन में पांच िषों का अनुभि।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(2) जनयुजि र्ते ु जिचाररत व्यजि की जनयुजि उप-जनयम (1) के अनुसार अल्पकाजलक संजििा सजर्त प्रत्यक्ष जनयोिन या प्रजतजनयुजि/आमले न द्वारा की िाएगी।

(3) जनयुजि र्ते ु जिचाररत व्यजि की आयु उप-जनयम (1) के अनुसार प्रारंजभक जनयुजि के समय पसैं ठ िषड से अजधक नर्ीं र्ोगी।

9. मख्ु य कायपड ालक अजधकारी का कायकड ाल – प्रजतष्ठ ान का मुख्य कायडपालक अजधकारी कायडभार संभालन े की तारीख से तीन िषों की अिजध के जलए पि धारण करेगा, और पुनर्नडयुजि के जलए समय-समय पर जनधाडररत दकए िा सकन े िाल े जनयमों और ितों के अनुसार पात्र र्ोगाः परंतु सत्तर िषड से अजधक आयु का कोई भी व्यजि मख्ु य कायडपालक अजधकारी का पि धारण नर्ीं करेगा।

10. मख्ु य कायपड ालक अजधकारी की सिे ा ित ड- (1) केंद्र सरकार या राज्य सरकार या जिश्वजिद्यालयों या भारत में मान्यता प्राप्त िोध संस्ट्थानों या अध डसरकारी या सांजिजधक या स्ट्िायत्त संगठनों के व्यजि को िो प्रजतजनयुजि पर मख्ु य कायपड ालक अजधकारी के रूप म ेंजनयुि र्ो, उतना िेतन और भत्ता संित्त दकया िाएगा, िो भारत सरकार के सजचि को संित्त दकया िाता र्।ै ऐसी जनयुजि की ितड प्रजतजनयुजि पर लाग ूमौिूिा जनयमों के अनुसार र्ोगी।

(2) उद्योग या जनिी क्षेत्र या जििेिी संस्ट्थान या गैर-सरकारी संगठन के व्यजि को अथिा उप-जनयम (1) के अनुसार अननप्रु युि दकसी अन्य व्यजि को, िो मख्ु य कायडपालक अजधकारी के रूप में जनयिु र्ो, जनम्नजलजखत जिकल्प दिए िाएँग,े नामत:- (क) उतनी धनराजि का िेतन और भत्ता, िो भारत सरकार के सजचि के जलए अनप्रु योज्य र्ो; अथिा (ख) प्रजत िषड जछयासठ लाख रुपय े(जनयत) का समेदकत िेतन जिसे केंद्र सरकार द्वारा समय-समय पर संिोजधत दकया िा सकता र्ःै परंत ु िो व् यजि केंद्र सरकार या राज्य सरकार से कोई पेंिन प्राप्त कर रर्ा र्,ै उस व्यजि का िते न उसके द्वारा आर्ररत पेंिन की सकल राजि तक कम कर दिया िाएगा।

(3) उप-जनयम (1) या उप-जनयम (2) के खडं (क) में संिर्भडत मुख्य कायपड ालक अजधकारी, सामान्य पूल में केंद्र सरकार के ररर्ायिी आिास के आबंटन का पात्र उसी ित ड पर र्ोगा, िो भारत सरकार के सजचि के जलए अनुमत र्ोगी ।

11. अिकाि, यात्रा और अन्य भत्ता - मुख्य कायपड ालक अजधकारी भारत सरकार के सजचि के जलए अनुमत अिकाि, यात्रा और अन्य भत्तों का र्किार र्ोगा।

12. केंद्र सरकार स्ट्िास्ट््य योिना र्किारी– प्रजतष्ठ ान का मख्ु य कायडपालक अजधकारी केंद्र सरकार स्ट्िास्ट््य योिना के लाभों का र्किार, इस संबंध म ेंकेंद्र सरकार द्वारा जनधाडररत ितों के अनुसार, र्ोगा।

13. मख्ु य कायपड ालक अजधकारी के कृत्य - मुख्य कायपड ालक अजधकारी प्रजतष्ठ ान के कुिल प्रिासन के जलए उत्तरिायी र्ोगा, और उसके पास प्रजतष्ठ ान के सभी मामलों के सामान्य अधीक्षण, जनिेिन और जनयंत्रण की िजियां र्ोंगी।

14. बिट जनमाणड प्रपत्र ⎯ कायड पररषि, इन जनयमों स े संलग्न अनुसूची में जिजनर्िडष्ट प्रपत्र 'क' में प्रत्येक जित्तीय िष ड के जलए िासी बोड ड द्वारा अनुमोदित बिट तैयार करेगी और उसे प्रत्येक िषड की 31 अकत ूबर तक केन्द्रीय सरकार को प्रस्ट्तुत करेगी।

15. िार्षकड ररपोटड जनमाणड एि ं प्रस्ट्तजु त ⎯ (1) कायड पररषि ्िषड में एक बार िार्षडक ररपोटड तैयार करेगी तथा इसकी एक प्रजत केन्द्रीय सरकार को प्रस्ट्ततु करेगी, जिसमें इन जनयमों स े संलग्न अनुसूची म ें जिजनर्िडष्ट प्रपत्र 'ख' म ें जपछल े जित्तीय िषड के िौरान प्रजतष्ठान के कायडकलापों का िास्ट्तजिक और पूण डजििरण दिया िाएगा।

(2) काय ड पररषि िार्षडक प्रजतििे न म ें ऐसी भी अन्य मि को िाजमल कर सकती र्ै, िो अनुसूची में जिजनर्िडष्ट प्रपत्र 'ख' में िाजमल नर्ीं र्,ै यदि प्रजतष्ठान के कायडकलापों का पूरा जििरण िने े र्ते ु ऐसा करना अपेजक्षत र्ो।

(3) कायड पररषि, िार्षडक प्रजतिेिन को उस िषड की जिस िषड के जलए इसे संसि के प्रत्येक सिन के समक्ष रखने के जलए तैयार दकया गया र्,ै समाजप्त के तुरंत बाि एक सौ अस्ट्सी दिनों की अिजध के भीतर केंद्र सरकार को अग्रेजषत करेगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5

16. िार्षकड लखे ा जििरण और अन्य प्रासजं गक अजभलखे ⎯ (1) प्रत्येक जित्तीय िषड के अंत म,ें कायड पररषि भारत सरकार के सांजिजधक जनकायों के जलए जनधाडररत जित्तीय जििरण के प्रारूप में अपने िार्षडक लेखा जििरण, तलु न-पत्र, आय और व्यय लेखा, तथा प्राजप्त और भुगतान लेखा तैयार करेगी।

(2) प्रजतष्ठान के अनुमोदित लेखा जििरण को जित्तीय िषड की समाजप्त के तीन मार् के भीतर भारत के जनयंत्रक एि ं मर्ालेखा परीक्षक अथिा उनके द्वारा उनकी ओर से जनयिु दकसी अन्य व्यजि को लेखापरीक्षा के प्रयोिनाथ ड कायड पररषि द्वारा अग्रेजषत दकया िाएगा।

(3) प्रजतष्ठ ान का िार्षडक लेखा जििरण, िो भारत के जनयंत्रक एिं मर्ालेखा परीक्षक अथिा उनके द्वारा उनकी ओर से जनयिु दकसी अन्य व्यजि द्वारा प्रमाजणत र्ो, और इस पर प्रत् येक जित्त िषड की लेखा परीक्षा ररपोटड केन्द्र सरकार को कायड पररषि द्वारा अग्रेजषत की िाएगी, तादक इन् र् ें संसि के प्रत्येक सिन के समक्ष परु :स्ट्थ ाजपत दकया िा सके।

17. लखे ा अनरु क्षण⎯ काय ड पररषि तलु न-पत्र, आय और व्यय लखे ा तथा जनयम 16 के उपजनयम (1) म ें जिजनर्िडष्ट प्राजप्त और संिाय लेख ेको संबंजधत िषड के पश्चात् कम से कम पाँच िषड की अिजध के जलये, परररजक्षत रखगे ी।

18. जिजथलन अजधकार ⎯ िर्ा ं केंद्र सरकार का यर् मत र् ै दक िब यर् करना आिश्यक या समीचीन र्,ै तब िर्ां िर् आिेि द्वारा और कारण को जलजखत में िि डकरके इन जनयमों के दकसी उपबंध को जिजथल कर सकेगी।

19. ऐसा मामला जिसके सबं धं म ें कोई उपबधं नर्ीं दकया गया र् ै - जिस मामले के संबंध में इन जनयमों में कोई स्ट्पष्ट उपबंध नर्ीं दकया गया र्,ै उस ेकेन्द्रीय सरकार को उसके जिजनश् चय के जिचाराथड भेिा िाएगा।

NOTIFICATION New Delhi, the 28th June, 2024 G.S.R. 353(E).—Whereas certain draft rules, namely, the Anusandhan National Research Foundation (Qualifications, Experience, Honorarium, Allowances, and Other Terms and Conditions of Service of Members of the Governing Board and Executive Council) Rules, 2023; the Anusandhan National Research Foundation (Qualifications, Experience, Salary, Allowances, and Other Terms and Conditions of Service of Chief Executive Officer) Rules, 2023; the Anusandhan National Research Foundation (Form of Annual Statement of Accounts) Rules, 2023 and the Anusandhan National Research Foundation (Budget and Annual Report) Rules, 2023, were published as required by sub-section (1) of section 23 of the Anusandhan National Research Foundation Act, 2023 (25 of 2023), in the notification of the Government of India in the Ministry of Science and Technology numbers G.S.R. 85 (E), G.S.R.

86 (E), G.S.R. 87 (E), G.S.R. 88 (E), dated the 2nd February, 2024, in the Gazette of India, Extraordinary, Part II,

Section 3, Sub-section (i), dated the 2nd February, 2024 for inviting objections and suggestions from all persons likely to be affected thereby;

And whereas, the objections or suggestions received in respect of the said draft rules have been considered by the Central Government;

Now, therefore, in exercise of the powers conferred by sub-section (1) read with clauses (a), (b), (c), (g), (h),

(i) and (j) of sub-section (2) of section 23 of the Anusandhan National Research Foundation Act, 2023 (25 of 2023), the Central Government hereby makes the following rules, namely: —

1. Short title and commencement. ⎯ (1) These rules may be called the Anusandhan National Research Foundation Rules, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. ⎯ (1) In these rules, unless the context otherwise requires, ⎯

(a) ‘Act’ means the Anusandhan National Research Foundation Act, 2023 (25 of 2023);

(b) “annual report” means the annual report prepared by the Executive Council under section 15 of the Act;

(c) “budget” means the budget prepared by the Executive Council under section 14 of the Act;

(d) “Form” means the forms appended to these rules;

(e) “President” means a President of the Governing Board referred to in clause (a) of sub-section (2) of

section 5 of the Act;

(f) “Schedule” means the Schedule appended to these rules;

(g) “Year” means a financial year beginning on the 1st day of April and ending on 31st day of March of the immediately following year.

(2) Words and expressions used herein and not defined but defined in the Act shall have the same meanings as assigned to them in the Act.

3. Qualifications and experience of Members of Governing Board. ⎯ (1) The Members to be nominated or appointed under clause (a) of sub-section (3) of section 5 of the Act shall be Members of the Prime Minister’s Science, Technology and Innovation Council.

(2) The Members to be nominated or appointed under clause (b) of sub-section (3) of section 5 of the Act shall be a person who has previously occupied or currently occupies a position of leadership at a business organisation or an industry.

(3) The Member to be nominated or appointed under clause (c) of sub-section (3) of section 5 of the Act shall possess adequate experience in the field of humanities and social sciences.

(4) The Members to be nominated or appointed under clause (d) of sub-section (3) of section 5 of the Act shall hold the position of head of a national laboratory or research or academic institution engaged in scientific and technological research and development, or senior scientist or senior faculty member in such institution, with adequate experience.

(5) The Members to be nominated or appointed under clause (e) of sub-section (3) of section 5 of the Act shall possess a doctorate degree or other specialised educational qualification in one or more of the following fields, ⎯

(ii) mathematical and physical sciences;

(iii) biological sciences;

(iv) engineering and technology;

(v) innovation and partnership;

(vi) computer and information sciences and engineering, and shall have adequate experience in the field.

4. Qualification and experience of Members of Executive Council. ⎯ The Members to be nominated or appointed under clause (b) of sub-section (3) of section 7 of the Act shall ⎯

(a) possess doctorate degree or other specialised qualification in the fields of science and technology in academia, philanthropic sector, research laboratories or industries; and

(b) have adequate experience in the field.

5. Term of office of Members of Governing Board or Executive Council. ⎯ The Members of the Governing Board or Executive Council shall ordinarily hold office for a period of three years from the date of appointment, and shall be eligible for reappointment.

6. Allowances for Members of Governing Board or Executive Council appointed. ⎯ (1) Every Member of the Governing Board nominated or appointed under sub-section (3) of section 5 of the Act or Executive Council nominated or appointed under clause (b) of sub-section (3) of section 7 of the Act, attending the meeting of the Governing Board or Executive Council whichever may be appropriate or for performing the functions of the Governing Board or Executive Council, shall be entitled to draw sitting fees, travelling and daily allowances and such other allowances as are admissible to Secretary to the Government of India.

7. Procedure for selection of Chief Executive Officer. ⎯ (1) The President shall appoint the Chief Executive Officer based on the recommendations of a Search-cum-Selection Committee.

(2) The President shall constitute a Search-cum-Selection Committee for recommending a panel of names for appointment of the Chief Executive Officer.

8. Qualifications and experience of Chief Executive Officer. ⎯ (1) A person being considered for appointment as Chief Executive Officer shall possess ⎯ a) a masters’ degree in science, or a bachelor’s degree in engineering or medicine, or a masters’ degree in management, with proven track record of research, or innovation, or technology development; and b) at least twenty years of experience as, ⎯

(i) a faculty or scientist in a recognised national or international university, or government department or research institution, or research laboratory of the Government or a company; or

(ii) a senior managerial level in a company, with five years of experience in managing research and development programmes or projects.

(2) A person considered for appointment under sub-rule (1) shall be appointed by direct recruitment or deputation/absorption including short-term contract.

(3) A person considered for appointment under sub-rule (1) shall not exceed sixty five years of age at the time of initial appointment.

9. Term of office of Chief Executive Officer. ⎯ The Chief Executive Officer of the Foundation shall hold office for a period of three years from the date of assumption of charge, and shall be eligible for reappointment on such terms

and conditions which may be determined from time to time:

Provided that no person above the age of seventy years shall occupy the office of the Chief Executive Officer.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

10. Conditions of service of Chief Executive Officer. ⎯ (1) Person from the Central Government or State Government or universities or recognised research institutions or Semi Government or statutory or autonomous organisations in India, appointed as the Chief Executive Officer on deputation shall be paid a salary and allowances of such amount, as may be applicable to Secretary to the Government of India. Terms and conditions of such appointment shall be as per the extant rules applicable to deputation.

(2) Person from industry or private sector or overseas institution or Non-Government Organisation, or any other person not covered under sub-rule (1), appointed as the Chief Executive Officer, shall be given the following options, namely: ⎯

(a) a salary and allowances of such amount, as may be applicable to Secretary to the Government of India; or

(b) a consolidated salary of sixty six lakh rupees (fixed) per annum which may be revised from time to time by

the Central Government:

Provided that the person who is in receipt of any pension from the Central Government or State Government, the pay of such person shall be reduced by the gross amount of pension drawn by him.

(3) The Chief Executive Officer referred to in sub-rule (1) or clause (a) of sub-rule (2), shall be eligible for allotment of the Central Government residential accommodation in the general pool on the same terms as are admissible to Secretary to the Government of India.

11. Leave, traveling and other allowances. ⎯ The Chief Executive Officer shall be entitled to leave, traveling and other allowances as admissible to Secretary to the Government of India.

12. Entitlement to Central Government Health Scheme. ⎯ The Chief Executive Officer of the Foundation shall be entitled to the benefits of the Central Government Health Scheme on the terms and conditions laid down by the Central Government in this behalf.

13. Functions of Chief Executive Officer. ⎯ The Chief Executive Officer shall be responsible for the efficient administration of the Foundation, and shall have the powers of general superintendence, direction and control in respect of all matters of the Foundation.

14. Form for preparation of budget. ⎯ The Executive Council shall, prepare the budget, as approved by the Governing Board, for each financial year in Form ‘A’ specified in the Schedule appended to these rules and submit the same to the Central Government by 31st October of every year.

15. Preparation and furnishing of the annual report. ⎯ (1) The Executive Council shall prepare once a year an annual report and submit a copy of the same to the Central Government, giving a true and full account of the Foundation’s activities during the previous financial year in Form ‘B’ specified in the Schedule, appended to these rules.

(2) The Executive Council may also include in the annual report any other item, not included in Form ‘B’ specified in the Schedule, if so required to give a full account of the Foundation’s activities.

(3) The Executive Council, shall forward the annual report to the Central Government within a period of one hundred and eighty days immediately following the close of the year for which it has been prepared for laying before each house of Parliament.

16. Annual statement of accounts and other relevant records. ⎯ (1) At the end of every financial year, the Executive Council shall prepare its annual statements of accounts, balance sheet, income and expenditure account, and receipt and payment account in the Forms of financial statement as prescribed for such statutory bodies of the Government of India.

(2) The approved statement of accounts of the Foundation shall be forwarded by the Executive Council to the Comptroller and Auditor General of India or any other person appointed by him on his behalf, for the purposes of audit, within three months of the end of the financial year.

(3) The annual statement of accounts of the Foundation, as certified by the Comptroller and Auditor General of India or any other person appointed by him on his behalf, along with the audit report theron for every financial year shall be forwarded by Executive Council to the Central Government, for laying before each House of Parliament.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11

17. Maintenance of accounts. ⎯ The Executive Council shall preserve the balance sheet, the income and expenditure account, and the receipt and payment account referred to in sub-rule (1) of rule 16, for a period of at least five years, following the year to which they relate.

18. Power to relax. ⎯ Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules.

19. Matters with respect to which no provision has been made. - Matters with respect to which no express provision has been made in these rules, shall be referred to the Central Government for its decision.

20. Interpretation. ⎯ If any queries relating to the interpretation of these rules arise, they shall be decided by the Governing Board.
