स ं . 5506/बीईई/एस&एल/आरआर/2025-26.—ऊिाा संरक्षण अजधजनयम, 2001 (2001 का 52) की धारा 13 की उपधारा (2) के खंड (ढ) और धारा 14 के खंड (ग) और (घ) के साथ पठित धारा 58 की उपधारा (2) के खंड (घ), (झ) और (ि) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, ऊिाा दक्षता ब्यूरो, केंद्र सरकार के पूर् ा अनुमोदन से, संलग्न प्रथम अनुसूची में सूचीबद्ध उपकरणों के जलए अजधसूजचत सभी जर्जनयमों को जनरजसत करने के जलए जनम्नजलजखत जर्जनयमों का प्रस्ट्तार् करता ह।ै प्रस्ट्ताजर्त मसौदा जर्जनयम एतद्द्वारा भारत के रािपत्र, असाधारण में, उि अजधजनयम की धारा 58 की उपधारा (1) में यथाअपेजक्षत, इसके द्वारा प्रभाजर्त होने र्ाले सभी व्यजियों की िानकारी के जलए और उनके सुझार् और आपजत्तयां (यदद कोई हो) आमंजत्रत करते हुए प्रकाजित दकए िाते ह;ैं और एतद्द्वारा यह नोठिस ददया िाता ह ैदक उि मसौदा जर्जनयमों पर भारत के रािपत्र, असाधारण में उनके प्रकािन की जतजथ स ेतीस ददनों की अर्जध की समाजि पर या उसके बाद जर्चार दकया िाएगा;

1. सजं क्षि नाम और प्रारंभ- (1) इन जर्जनयमों को ऊिाा दक्षता ब्यूरो (लेबल पर उनके प्रदिान का जर्र्रण और रीजत) जनरसन जर्जनयम, 2025 कहा िाएगा। 4544 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) ये सरकारी रािपत्र में प्रकािन की जतजथ से लागू होंगे।

2. जर्जनयमों का जनरसन.- भारत के रािपत्र, असाधारण भाग III, खंड 4 में प्रकाजित जर्जनयम, िैसा दक प्रथम अनुसूची में जनर्दाष्ट ह,ै एतद्द्वारा जनरजसत दकये िाते ह।ैं

3. व्यार्जृ त्त.- (1) इन जर्जनयमों का जनरसन- (क) ऐसे दकसी अन्य अजधजनयमन अथर्ा जर्जनयम को प्रभाजर्त नहीं करेगा जिसमें जनरजसत जर्जनयम लागू दकया गया है, िाजमल दकया गया ह ैया संदर्भात दकया गया है; (ख) ऐसी दकसी जर्जध जसद्धातं या जनयम, या स्ट्थाजपत क्षेत्राजधकार, अजभर्चन के रूप या क्रम, अभ्यास या प्रदक्रया, या मौिूदा उपयोग, प्रथा, जर्िेषाजधकार, प्रजतबंध, छूि, कायाालय या जनयुजि को प्रभाजर्त नहीं करेगा, बार्िूद इसके दक उनकी एतद्द्वारा जनरजसत जर्जनयम के द्वारा, में या से क्रमिः दकसी भी रीजत से पुजष्ट की गई हो अथर्ा मान्यता दी गई हो अथर्ा व्युत्पजत्त की गई हो। (ग) दकसी अजधकार क्षेत्र, कायाालय, प्रथा, दाजयत्र्, अजधकार, उपाजध, जर्िेषाजधकार, प्रजतबंध, छूि, उपयोग, अभ्यास, प्रदक्रया या अन्य मामले या र्स्ट्त ु, िो अब जर्द्यमान या लागू नहीं है, को पुन:प्रचजलत या पुन:जनर्मात नहीं करेगा;

(घ) इस प्रकार जनरजसत दकसी जर्जध के पूर्ा प्रर्तान या उसके अधीन जर्जधर्त् दकए गए या सहन दकए गए दकसी काया को प्रभाजर्त नहीं करेगा; (ङ) इस प्रकार जनरजसत जर्जनयम के अंतगात अर्िात, उपार्िात या र्हन दकए गए दकसी अजधकार, जर्िेषाजधकार, दाजयत्र् या देयता को प्रभाजर्त नहीं करेगा;

(च) इस प्रकार जनरजसत जर्जनयम के जर्रुद्ध दकए गए दकसी अपराध के संबंध में लगाए गए दकसी अथादंड, िब्ती या दंड को प्रभाजर्त नहीं करेगा; (छ) पूर्ोि दकसी ऐसे अजधकार, जर्िेषाजधकार, दाजयत्र्, अथादंड, िब्ती या दंड के संबंध में दकसी िांच, जर्जधक् कायार्ाही या प्रजतकार को प्रभाजर्त नहीं करेगा, और ऐसा कोई भी िांच, जर्जधक् कायार्ाही या प्रजतकार आरम् भ दकया िा सकता है, िारी रखा िा सकता ह ै या लागू दकया िा सकता ह ै और ऐसा कोई भी अथादंड, िब्ती या दंड लगाया िा सकता है, दक मानो यह जर्जनयम बनाया ही नहीं गया था;

(ि) जर्जनयम के प्रारंभ होने से पूर्ा, इस जनरसन अधीन जर्जनयम के अतं गात लगाए गए, मूल् यांदकत या संग्रहीत दकए गए या लगाए िाने, मूल् यांदकत या संग्रहीत दकए िाने हते ु लजक्षत दकसी ड्यूिी या िुल्क को, जर्जध अनुसार र्ैध रूप से लगाया गया, मूल् यांदकत या संग्रहीत दकया गया माना िाएगा:

NOTIFICATION New Delhi, the 10 July, 2025.

No. 5506/BEE/S&L/RR /2025-26.- In exercise of the powers conferred by clause (d), (i) and (l) of sub-

section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (c) and (d) of Section 14 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau of Energy Efficiency with the previous approval of the Central Government, proposes the following regulations to repeal all the Regulations notified for the appliances, as listed in the appended First Schedule. The proposed draft regulations are hereby published in the Gazette of India, Extraordinary, as required by sub-section (1) of section 58 of the said Act, for the information of all the persons likely to be affected thereby and inviting their suggestions and objections (if any); and the notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date of their publication in the Gazette of India, Extraordinary.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Objections or suggestions, if any, may be addressed to the Director-General of Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, R. K. Puram, Sector-1, New Delhi-110066 through post and email at helpdesk@beeindia.gov.in.

Objections or suggestions which may be received from any person with respect to the said draft

notification before the expiry of the period of thirty days specified in para 1 above shall be taken into consideration by the Bureau of Energy Efficiency.

1. Short Title and Commencement.- (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels) Repeal Regulations, 2025.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Repeal of Regulations.- The Regulations, published in the Gazette of India, Extraordinary Part III,

Section 4 as specified in the First Schedule are hereby repealed.

3. Savings.- (1) The repeal of the Regulations shall not-

(a) affect any other enactment or Regulation in which the repealed Regulation has been applied, incorporated or referred to;

(b) affect any principle or rule of law, or established jurisdiction, form or course of pleading, practice or procedure, or existing usage, custom, privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed or recognised or derived by, in or from any Regulation hereby repealed;

(c) revive or restore any jurisdiction, office, custom, liability, right, title, privilege, restriction, exemption, usage, practice, procedure or other matter or thing not now existing or in force;

(d) affect the previous operation of any law so repealed or anything duly done or suffered thereunder;

(e) affect any right, privilege, obligation or liability acquired, accrued or incurred under this Regulation so repealed;

(f) affect any penalty, forfeiture or punishment incurred in respect of any offence committed against this Regulation so repealed;

(g) affect any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment as aforesaid, and any such investigation, legal proceeding or remedy may be instituted, continued or enforced and any such penalty, forfeiture or punishment may be imposed, as if this Regulation had not been made;

(h) affect any duty, or fee levied, assessed or collected or purported to have been levied, assessed or collected under this Regulation under repeal, before the commencement of the Regulation, shall be deemed to have been validly levied, assessed or collected in accordance with law:

(2) The mention of particular matters referred to in sub-section (2) shall not be held to prejudice or affect the general application of section 6 of the General Clauses Act, 1897 with regard to the effect of repeal.
