No. 21/13/DB&BE(Repl.)/2026/LAS-VIII/Legn./5843.—The Following is Published for General Information:— THE DELHI BED AND BREAKFAST ESTABLISHMENTS (REPEAL) BILL, 2026 Bill No. 08 of 2026 (As introduced in the Legislative Assembly of the National Capital Territory of Delhi on 07th August, 2026) Bill No. 08 of 2026 THE DELHI BED AND BREAKFAST ESTABLISHMENTS (REPEAL) BILL, 2026 BILL Preamble A Bill to repeal the National Capital Territory of Delhi (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) Act, 2007.

BE it enacted by the Legislative Assembly of the National Capital Territory of Delhi in the Seventy‑seventh Year of the

Republic of India as follows:

1. Short title and commencement

1) This Act may be called the Delhi Bed and Breakfast Establishments (Repeal) Act, 2026.

2) It shall come into force on such date as the Government may, by notification in the Official Gazette, appoint.

2. Repeal & Savings:

1) “The National Capital Territory of Delhi (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) Act, 2007” (Delhi Act No. 11 of 2007) and its amendments “The National Capital Territory of Delhi (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) (Amendment) Act, 2009” (Delhi Act 03 of 2010) and“The National Capital Territory of Delhi (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) (Amendment) Act, 2021” (Delhi Act 04 of 2021) are hereby repealed.

2) Notwithstanding such repeal, anything done or any action taken (including any registration granted, certificate issued, order made, approval given or proceedings initiated) under the repealed Acts shall, in so far as it is not inconsistent with the provisions of this Act, be deemed to have been done or taken under the corresponding provisions of this Act.

3) The repeal shall not affect—

(a) the previous operation of the repealed Acts or anything duly done or suffered there under;

(b) any right, privilege, obligation or liability acquired, accrued or incurred under the repealed Acts; or6 DELHI GAZETTE : EXTRAORDINARY PART IV]

(c) any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation or liability may be instituted, continued or enforced as if the repealed Acts had not been repealed.

4) The provisions of section 6 of the General Clauses Act, 1897 shall apply in relation to the repeal of the said enactments.” KAPIL MISHRA, Minister (Tourism) STATEMENT OF OBJECTS AND REASONS The National Capital Territory of Delhi (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) Act, 2007 (Delhi Act No. 11 of 2007) was enacted to regulate and promote bed and breakfast establishments in Delhi. The said Act was subsequently amended by the Amendment Acts of 2010 and 2021.

Over a period of time, the tourism and hospitality sector has undergone significant transformation, including the emergence of new forms of accommodation and evolving policy approaches. In this context, it has been considered necessary to discontinue the existing statutory framework governing bed and breakfast establishments and to replace it with a more flexible and facilitative policy regime.

The Government proposes to revamp and re-initiate the regulation and promotion of bed and breakfast establishments through an executive policy framework, which would be implemented in a more liberalised and supportive manner, while continuing to ensure compliance with applicable laws relating to safety, public health, municipal governance and public order.

A comprehensive policy in this regard is under formulation and will be placed before the Council of Ministers for approval. The repeal of the existing Act is proposed to be brought into force in alignment with the notification of the said policy.

During the transition period, fresh registrations and processing of pending applications under the existing Act shall remain in abeyance. At the same time, matters relating to existing registrations, certificates issued, directories, records maintained by operators, grievance redressal, pending appeals and classification standards shall be suitably addressed under the proposed policy framework. Any penalties, liabilities, non-compliances or legal proceedings arising under the existing Act shall continue to be dealt with in accordance with the provisions of the said Act.

It is, therefore, proposed to repeal the National Capital Territory of Delhi (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) Act, 2007 and its amendment Acts of 2010 and 2021.

The Bill seeks to achieve the above objectives.

KAPIL MISHRA, Minister (Tourism)[PART IV DELHI GAZETTE : EXTRAORDINARY 7 MEMORANDUM REGARDING DELEGATED LEGISLATION Clause 1(2) of the Bill empowers the Government to bring the provisions of the proposed Act into force on such date as may be notified in the Official Gazette.

The timing of enforcement is proposed to be aligned with the notification of the new policy framework relating to bed and breakfast establishments, which is presently under consideration of the Government.

The power delegated is of a routine administrative nature and does not involve any excessive delegation of legislative power.

No other provision of the Bill involves delegation of legislative power.

KAPIL MISHRA, Minister (Tourism) FINANCIAL MEMORANDUM The Bill seeks to repeal the National Capital Territory of Delhi (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) Act, 2007 and its amendment Acts of 2010 and 2021, and to facilitate a transition towards a policy-based regulatory framework.

The proposed repeal does not involve any expenditure of recurring or non-recurring nature from the Consolidated Fund of the National Capital Territory of Delhi.

The proposed policy framework shall be implemented through administrative measures and existing institutional mechanisms. Any expenditure, if required for implementation of the policy, shall be met from within the approved budgetary allocations of the concerned Department.

Accordingly, no additional financial implications are involved in the enactment of this Bill.
