L.-33004/99 सी.जी.-डी.एल.-अ.-21062021-227749 xxxGIDHxxx CG-DL-E-21062021-227749 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 251] नई ददल्ली, िुक्रिार, िून 18, 2021/ज्य ्‍े ि 28, 1943 No. 251] NEW DELHI, FRIDAY, JUNE 18, 2021/JYAISTHA 28, 1943 ऊिा ादक्षता ब्य रू ो अजधसचू ना नई ददल् ली, 18 िून, 2021 स.ं 2/11 (7)/09-बीईई.—ऊिाा दक्षता ब्यूरो (मान्यता प्राप्त ऊिाा लेखा परीक्षकों के जलए योग्यता और उनकी सूची का अनुरक्षण) जिजनयम, 2009 म ें संिोधन के जलए कुछ जिजनयमों का जनम्नजलजखत प्रारूप, जिन्ह ें केन् रीय सरकार के पूिा अनुमोदन से ब् यरू ो वारारा ऊिाा संरक्षण अजधजनयम, 2001 (2001 का 52) की धारा 58 की उपधारा (2) के खण्ड (च) के साथ पठित धारा 13 की उपधारा (2) के खण्ड (त) वारारा प्रदत्त िजियों का प्रयोग करत े हुए बनाने का प्रस्ट्ताि करता ह,ै इससे संभाजित रूप स े प्रभाजित सभी व्यजियों की सूचना के जलए उक्त अजधजनयम की धारा 58 की उपधारा (1) वारारा यथा: अपेजक्षत रूप से प्रकाजित दकया िाता है; और सूचना दी िाती ह ै दक उक्त प्रारूप जिजनयमों पर सरकारी रािपत्र म ें अजधसूचना के प्रकािन की तारीख से तीस ददन की अिजध समाप् त होने के बाद, जिचार दकया िाएगा। आपजत्त या सुझाि, यदद कोई हों, महाजनदेिक, ऊिाा दक्षता ब्यूरो, जिद्युत मंत्रालय, चौथा तल, सेिा भिन, आर.के. परु म, सेक्टर-1, नई ददल्ली-110066 के पास भेिा िाए और ब्यूरो के ई-मेल पर dg-bee@nic.in पर भेिा िा सकता ह।ै ब् यरू ो वारारा जिजनयमों के उक्त मसौदे के संबंध में जिजन्द्‍ा ट अिजध के अंदर दकसी भी ्‍ यजि की रर से कोई आपजत्त या सुझाि, यदद कोई हो, प्राप् त होता ह ैतो उन पर ब् यरू ो वारारा जिचार दकया िाएगा। 3329 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

1. संजक्षप्त िीर्ाक और प्रारंभ - (1) इन जिजनयमों को ऊिाा दक्षता ब्यरू ो (प्रत्याजयत ऊिा ा लखे ा परीक्षकों और ऊिा ा लेखा परीक्षकों (भिन) की योग्यता और प्रदक्रया और उनकी सूची का रखरखाि), जिजनयम, 2021 कहा िाएगा;

(2) ये जिजनयम सरकारी रािपत्र में इनके अंजतम प्रकािन की तारीख से प्रिृत् त होंगे।

2. पठरभार्ा :- (1) इन जनयमों में, िब तक संदभ ा म ेंअन् यथा अपेजक्षत न हो, - (क) ''अजधजनयम” का अथा ऊिाा संरक्षण अजधजनयम, 2001 ह;ै (ख) "प्रत्यायन सलाहकार सजमजत" का अथ ाह ैजिजनयम 5 के तहत ब्यूरो वारारा गठित सजमजत;

(ग) ''ऊिाा लेखा परीक्षक'' से िह व्यजि अजभप्रेत ह ैजिसे ऊिाा दक्षता ब्यूरो (ऊिाा लेखा परीक्षकों और ऊिाा प्रबंधकों के जलए प्रमाणन प्रदक्रया) जिजनयम, 2020 के जिजनयम 8 के अधीन प्रमाजणत ऊिाा लेखा परीक्षक या प्रमाजणत ऊिाा लेखा परीक्षक (भिन) के रूप म ेंएक प्रमाण पत्र िारी दकया गया ह;ै '' (ग क) ''ऊिाा लेखा परीक्षक'' से िह व्यजि अजभप्रते ह ै जिसे ऊिाा दक्षता ब्यूरो (ऊिाा लेखा परीक्षकों और ऊिाा प्रबंधकों के जलए प्रमाणन प्रदक्रया) जिजनयम, 2020 के जिजनयम 8 के अधीन प्रमाजणत ऊिाा लेखा परीक्षक (भिन) के रूप म ेंएक प्रमाण पत्र िारी दकया गया ह;ै '' (क) "ऊिाा सघन उद्योग और अन्य प्रजतष्ठान" का अथा ह ै ऊिाा सघन उद्योग और अजधजनयम की अनुसूची में जन्दष्टा अन्य प्रजतष्ठान;

(ख) ''प्रपत्र'' का अथा ह ैइन जनयमों के साथ िोडे गए प्रपत्र; (ग) ''अनुसूची'' का अथा ह ैइन जनयमों के साथ सलं ग्न अनुसूची;

(2) इन जिजनयमों में प्रयुक् त िब् द और अजभ्‍ यजियां जिन् ह ें पठरभा जर्त नहीं दकया गया ह ै दकन् तु अजधजनयम में पठरभाजर्त दकया गया ह,ै क्रमि: अजधजनयम के अनुसार इनके अथ ाइन् ह ें प्रदान दकए गए।

3. ऊिाा लेखा परीक्षक और ऊिाा लेखा परीक्षक (भिन) की मान्यता के जलए योग्यता, मानदंड और ित ें :- (1) एक ऊिाा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) को एक प्रत्याजयत ऊिा ा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) बनन े के जलए योग्य होगा, यदद उसके पास ह ै- (क) ऊिाा दक्षता ब्यूरो (ऊिा ा लेखा परीक्षकों और ऊिाा प्रबंधकों के जलए प्रमाणन प्रदक्रया) जिजनयम, 2010 के जिजनयम 8 के अधीन ऊिाा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) के जलए िैध प्रमाण पत्र ह;ै (ख) ऊिाा लेखा परीक्षण म ें पांच िर्ा का अनुभि ह ै जिसमें स े कम से कम तीन िर् ा दकसी भी ऊिाा सघन उद्योग और अन्य प्रजतष्ठानों म ेंहोना चाजहए; तथा (ग) दकसी भी ऊिा ा सघन उद्योगों और व्यजिगत क्षमता म ें या दकसी ऊिाा लेखा परीक्षण दल के दल प्रमुख या सहयोगी या सदक्रय सदस्ट्य के रूप में दकसी भी ऊिाा प्रजतष्ठान म ेंकम से कम पांच जिस्ट्तृत ऊिाा लेखा परीक्षण दकए और पूरे दकए हों; तथा

(2) जिजनयम 6 के तहत ब्यरू ो वारारा मान्यता का प्रमाण पत्र ददया गया हो।

(3) सक्षमऊिाा लेखा परीक्षण टीम के गिन के उद्देश्य से, आिेदक अपने तकनीकी ज्ञान को बढान ेके जलए और जिजभन्न क्षेत्रों के अजभजहत उपभोिा के संयंत्रों या िाजणजज्यक भिनों या प्रजतष्ठानों म ें अजभजहत उपभोिा के बारे में अजधजनयम की धारा 14 के खंड (i) के तहत केन् रीय सरकार के जनदेि के अनपु ालन म ें ऊिाा लेखा परीक्षण के जलए अपने ऊिाा लेखा परीक्षण कौिल और क्षमताओं को मिबूत करने के जलए या ऊिाा दक्षता ब्यूरो (ऊिाा लेखा परीक्षण के संचालन की रीजत और अंतराल) के अनुसार अजधजनयम की धारा 14 के खंड (ध) के अधीन केन् रीय सरकार के जनदेि के अनुपालन में या 2010 की धारा 14 के उक्त खंड (ध) के अधीन बनाए गए जिजनयम, िैसा भी मामला हो, के जलए कम से कम[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 दो जििेर्ज्ञों जिनम ें पूणाकाजलक ऊिा ा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) या अिं काजलक ऊिा ा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) या सलाहकार जिनके पास तापीय, जिद्युत उपयोजगताओं, प्रक्रमों, िाजणजज्यक भिनों और अजधजनयम की अनसु ूची में उजल्लजखत ऊिाा सघन उद्योगों की स्ट्थापनाओं में जििेर्ज्ञता होगी, के साथ कानूनी रूप से बाध्यकारी व्यिस्ट्थाओं के माध्यम से िुडा होगा,

(4) आिेदक के पास जनम्न जलजखत होगा – क. क्षेत्र जििेर् उपकरणों सजहत ऊिाा लेखा परीक्षण के संचालन के जलए जिजभन्न उपकरणों का उपयोग करने म ें जििेर्ज्ञता; ख. कम से कम चार मलू उपकरणों का आधुजनकतम प्रकार होना चाजहए अथाात,् जक्लप-ऑन-प्रकार, जिद्युत मापने के उपकरण, फ्ल ू गैस जिश्लेर्क, तापमान और लक्स मापने के उपकरण, जिसका अंिाकं न जिजधित रूप से राष्ट्रीय परीक्षण और अिं िोधन प्रत्यायन बोड ा वारारा मान्यता प्राप्त प्रयोगिालाओं वारारा दकया गया है या आिेदक के पास उपरोि उपकरणों के नहीं होन े की जस्ट्थजत म ें आपू्ताकताओंा को ऐस े उपकरणों के कानूनी रूप से बाध्यकारी व्यिस्ट्था करनी होगी।''

4. प्रत्यायन प्रमाणपत्र प्रदान करने की प्रदक्रया - (1) ब्यरू ो, जिजनयम 3 के खंड (क) और (ख) म ें जन्दष्टा योग्यता रखने िाल े ऊिाा लेखा परीक्षकों और ऊिाा लेखा परीक्षक (भिन) के प्रत्यायन के उद्देश्य से योग्य व्यजियों से आिेदन की मांग कर सकता ह।ै

(2) उप-जिजनयम (1) में संद्भात आिेदन प्रपत्र I में दकया िाएगा और इसके साथ होना चाजहए - (क) ऊिाा लेखा परीक्षक और ऊिा ा लेखा परीक्षक (भिन) वारारा व्यजिगत क्षमता म ें या ऊिा ा लेखा परीक्षण दल के एक प्रमुख या सहयोगी या सदक्रय दल सदस्ट्य के रूप में दकसी भी ऊिा ा सघन उद्योग और अन्य प्रजतष्ठानों म ें परू ी की गई पांच जिस्ट्तृत ऊिाा लेखा परीक्षण ठरपोटा;

(ख) ब्यूरो को सौंपी गई पांच ऊिा ा लेखा परीक्षण ठरपोटों पर प्रजतदक्रया, खंड (क) में जन्दष्टा , संबंजधत ग्राहकों की रर से होगी, जिनका ऊिाा लखे ा परीक्षण दकया गया था; (ग) ऊिाा दक्षता ब्यूरो, नई ददल्ली के पक्ष म ें जडमांड ड्राफ्ट वारारा या भुगतान की दकसी भी स्ट्िीकाया इलेक्रॉजनक जिजध देय एक हिार रुपए का आिेदन िुल्क;

(घ) एक िचनबद्धता दक आिेदक के पास जिजनयम 3 के उप-जिजनयम (3) के खडं (ख) म ें जन्द्‍ा ट मलू उपकरण ह ैं या उक्त उपकरणों के आपू्ताकता ाकी रर से एक प्रमाण पत्र; (ड.) ऊिाा लेखा परीक्षण के क्षेत्र म ें न्यूनतम पांच िर्ा के अनुभि का प्रमाण पत्र, जिसमें से तीन िर्ा दकसी भी ऊिा ा सघन उद्योगों और अजधजनयम की अनुसूची म ें जिजन्दष्टा अन्य प्रजतष्ठानों और जिजभन्न संगिनों म ें अनुभि के जििरण में होंगे, उक्त संगिन के लेटरहडे पर अलग से प्रमाण पत्र वारारा जिजधित समथना दकया िाएगा;

(च) संगिन के लेटर हडे पर उनका एक पत्र, उनके वारारा जिसका नाम ऊिाा लेखा परीक्षण का व्यापार करने के जलए उपयोग दकया िाता ह,ै

5. प्रत्यायन सलाहकार सजमजत का गिन - (1) ब्यूरो, प्रत्यायन प्रमाणपत्र प्रदान करन े के प्रयोिन के जलए एक प्रत्यायन सलाहकार सजमजत का गिन कर सकता ह।ै

(2) प्रत्यायन सलाहकार सजमजत म ें ऊिाा दक्षता ब्यूरो (सलाहकार सजमजत) जिजनयम, 2008 के जिजनयम 3 के तहत गठित सलाहकार सजमजतयों के सदस्ट्यों में ब्यरू ो वारारा नाजमत एक अध्यक्ष और तीन स ेअजधक सदस्ट्य नहीं होंगे।

(3) प्रत्यायन सलाहकार सजमजत जनम्नजलजखत मानदडं ों पर उन ऊिाा लेखा परीक्षकों और ऊिाा लेखा परीक्षकों (भिन) के ऊिाा लेखा परीक्षण अनुभि और क्षमता का आकलन करेगी, जिन् होंने मौजखक साक्षात्कार के आधार पर जिजनयम 4 के तहत मान्यता प्रमाण पत्र के जलए आिेदन दकया ह,ै अथाात:् - क) आिेदन के साथ प्रस्ट्तुत की गई पांच जिस्ट्तृत ऊिा ालेखा परीक्षण ठरपोटों का मल्ू यांकन;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ख) ऊिाा सघन उद्योगों की संख्या और प्रकार जिनमें जिस्ट्ततृ ऊिाा लेखा परीक्षण दकया गया ह;ै ग) तापीय, जिद्युत उपयोजगताओं और प्रक्रमों में जििेर्ज्ञता िाले पणू ाकाजलक ऊिाा लेखा परीक्षकों और ऊिाा लेखा परीक्षक (भिन) या अंिकाजलक ऊिा ा लेखा परीक्षकों और ऊिाा लेखा परीक्षक (भिन) या सलाहकारों की के साथ आिेदक की संलग् नता, जििेर्ज्ञों की संख्या और प्रकार और उक्त संघ की प्रकृजत ;

घ) कम से कम चार अद्यतन बुजनयादी उपकरण होन े चाजहएअथाात जक्लप-ऑन प्रकार, जबिली मापने के उपकरण, फ्लू गसै जिश्लेर्क, तापमान और लक्स मापने के उपकरण, िो राष्ट्रीय परीक्षण और अंिांकन प्रत्यायन बोड ा वारारा मान्यता प्राप्त प्रयोगिाला वारारा जिजधित अंिांदकत दकए गए ह ैं और ऊिाा लखे ा परीक्षण के संचालन के जलए उक्त उपकरणों का उपयोग करने म ेंजििेर्ज्ञता रखत े ह;ैं ड.) ऊिाा लेखा परीक्षण म ें अपनाए गए काया का तरीका;

च) प्रजिक्षण अनुभि; छ) क्षेत्र अध्ययन की गणु ित्ता जिसमें अिलोकन, िांच के कौिल, डेटा संग्रह और उत्पादन, तकनीकी ज्ञान की गहराई और जिश्लेर्णात्मक क्षमताएं िाजमल ह;ैं ि) ऊिाा दक्षता में सुधार या ऊिाा संरक्षण के जलए जसफाठरिों की गुणित्ता;

झ) ऊिाा दक्षता में सुधार के जलए या ऊिाा संरक्षण के जलए संस्ट् तुत उपायों का लागत लाभ जिश्लेर्ण करन े की क्षमता और ऊिाा खपत में कमी के जलए जसफाठरिों के कायाान्ियन के जलए काया योिना तैयार करना; तथा ) ऊिाा लेखा परीक्षण ठरपोटा की गुणित्ता।

(4) उप-जिजनयम (3) के तहत दकए गए मल्ू यांकन के आधार पर, प्रत्यायन सलाहकार सजमजत ऊिाा लेखा परीक्षक और ऊिाा लेखा परीक्षक (भिन) को मान् यता देन े के जलए ब्यरू ो को जसफाठरि करेगी।

6. प्रत्यायन का प्रमाण पत्र - (1) यदद जिजनयम 5 के उप-जिजनयम (4) के तहत प्रत्यायन सलाहकार सजमजत वारारा की गई जसफाठरि ब्यूरो वारारा स्ट्िीकार की िाती है तो आिेदक का नाम, जिजनयम 7 के तहत अनुरजक्षत प्रत्याजयत ऊिाा लेखा परीक्षकों या प्रत्याजयत ऊिाा लखे ा परीक्षक (भिन) की सूची के रजिस्ट्टर,िैसा लाग ू हो, म ें दि ा दकया िाएगा, और आिेदक को, ऊिाा दक्षता ब्यरू ो, नई ददल्ली के पक्ष में जडमांड ड्राफ्ट वारारा या भुगतान के दकसी भी स्ट्िीकाया इलेक्रॉजनक जिजध वारारा एक हिार रुपए के िा्र्ाक प्रत्यायन िुल्क के भगु तान पर फॉमा II में प्रत्यायन का प्रमाण पत्र ददया िाएगा।

(2) ब्यूरो, जलजखत रूप म ें दिा दकए िाने िाले कारणों से ऊिाा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) वारारा मान्यता हते ु ददए गए आिेदन को अस्ट्िीकार कर सकता ह ैऔर एक माह की अिजध के अंदर उन् ह ें इसकी सूचना दे सकता ह।ै

(3) प्रत्यायन प्रमाणपत्र तब तक िैध रहगे ा िब तक दक इसे जिजनयम 9 के तहत रद्द नहीं कर ददया िाता।

7. प्रत्याजयत ऊिा ा लेखा परीक्षक और ऊिाा लेखा परीक्षक (भिन), उनके कायाालयों और फमों की सूची का रखरखाि। -

(1) ब्यूरो एक पंिी रखगे ा जिसमें मान्यता प्राप्त ऊिा ा लेखा परीक्षकों और ऊिाा लेखा परीक्षक (भिन) की सूची प्रपत्र III में होगी।

(2) प्रत्याजयत ऊिाा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) या ऐसे प्रत्याजयत ऊिाा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) की एक फमा, व्यापार नाम या फमा के नाम पर एक कायाालय खोलने से पहले, व्यापार के नाम या फमा के नाम का उपयोग करने के जलए अनुमोदन के जलए ब्यूरो म ेंआिेदन करेगा और इस तरह के अनमु ोदन पर ब्यूरो मान्यता प्राप्त ऊिाा लेखा परीक्षकों और ऊिाा लेखा परीक्षक (भिन) के कायाालयों और फमों के रजिस्ट्टर का रखरखाि प्रपत्र IV में करेगा।

(3) ब्यूरो मान्यता प्राप्त ऊिाा लेखा परीक्षकों और ऊिाा लेखा परीक्षक (भिन) की पहली सचू ी और प्रत्याजयत ऊिाा लेखा परीक्षकों के कायाालयों और फमों की सूची को अंजतम रूप दते े ही प्रकाजित करिाएगा और उसके बाद इन सूजचयों को[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 अद्यतन और जनयजमत रूप से प्रकाजित दकया िाएगा और ब्यूरो की आजधकाठरक िेबसाइट www.beeindia.gov.in और ऊिाा पेिेिरों की िेबसाइट www.beeindia.gov.in पर अपलोड दकया गया ह।ै

(4) प्रत्येक प्रत्याजयत ऊिाा लखे ा परीक्षण और ऊिाा लेखा परीक्षक (भिन) सूची को अद्यतन करने के उद्देश्य से मान्यता के जलए आिेदन म ेंदी गई िानकारी में दकए गए दकसी भी बदलाि का ब् यौरा ब्यरू ो को प्रस्ट्तुत करेगा।

(5) प्रत्याजयत ऊिाा लेखा परीक्षकों और ऊिाा लेखा परीक्षक (भिन) की अद्यतन सूची की एक प्रजत राज्यों की नाजमत एिेंजसयों और नाजमत उपभोिाओं को हर साल अप्रलै के पहल ेददन इलेक्रॉजनक मले के माध्यम से भेिी िाएगी।

8. प्रत्याजयत ऊिा ा लेखा परीक्षकों और ऊिा ा लेखा परीक्षक (भिन) की सूची के रजिस्ट्टर में नामों को हटाना और बहाल करना - ब्यूरो जनम्नजलजखत आधारों पर ऊिा ा लेखा परीक्षक की सूची के रजिस्ट्टर से मान्यता प्राप्त ऊिा ा लेखा परीक्षक और ऊिाा लेखा परीक्षक (भिन) का नाम हटा सकता ह,ै अथाात:् - क) संबंजधत व्यजि को सुनिाई का अिसर देने के बाद ब्यूरो संतुष्ट ह ै दक उक्त प्रत्यायन प्रमाण पत्र गलत, भ्रामक या झूिी िानकारी के आधार पर ददया गया ह;ै ख) व्यजि ऊिा ा लेखा परीक्षक और ऊिाा लेखा परीक्षक (भिन) नहीं ह ै या ऊिाा दक्षता ब्यूरो (ऊिाा लेखा परीक्षण के संचालन की रीजत और अंतराल) जिजनयम 2010 के अनुसार एक ऊिा ा सघन उद्योग और अन्य प्रजतष्ठान की ऊिा ा लेखा परीक्षण करन े में जिफल रहा ह;ै ग) यदद व्यजि ्‍ यािसाजयक कदाचार या धोखाधडी का दोर्ी ह;ै घ) यदद व्यजि िा्र्ाक मान्यता िुल्क का भुगतान करन े में जिफल रहा ह;ै ड) यदद व्यजि ने मान्यता प्राप्त ऊिाा लेखा परीक्षकों या ऊिाा लेखा परीक्षक (भिन) की सूची से अपना नाम हटाने का अनुरोध दकया ह।ै

(2) िहां मान्यता प्राप्त ऊिाा लेखा परीक्षक का नाम उप-जिजनयम (1) के खंड (ख) या खंड (घ) में जन्दष्टा आधार पर हटा ददया िाता ह,ै रजिस्ट्टर में उनका नाम उनके वारारा ऊिाा लेखा परीक्षण का काम दफर से िुरू करने के बाद ददए गए आिेदन या िा्र्ाक मान्यता िल्ु क के भगु तान पर बहाल दकया िाएगा, िैसा भी मामला हो। ''(2क) िहा ं मान्यता प्राप्त ऊिाा लेखा परीक्षक या ऊिा ा लेखा परीक्षक (भिन) का नाम उप-जिजनयम (1) के खडं (ड) म ें जिजन्दष्टा आधारों पर हटा ददया िाता है तो मान्यता प्रदक्रया में उनका नाम बहाल नहीं दकया िाएगा। (2ख) िहां मान्यता प्राप्त ऊिा ा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) का नाम उप-जनयम (1) के खडं (क) या खंड (ग) म ें जिजन्दष्टा आधारों पर हटाया िाना प्रस्ट्ताजित है, ऐसे मान्यता प्राप्त ऊिा ा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन), िैसा लाग ू हो, की मान्यता उक्त खडं म ें जिजन्दष्टा घटनाओं के होने तक तरु ंत जनलंबन के अधीन रखी िाएगी, िब तक दक िांच पूरी न हो िाए और इस घटना में, उक्त मान्यता प्राप्त ऊिा ा लेखा परीक्षक या ऊिा ा लेखा परीक्षक (भिन) के जिरुद्ध लगाया गया आरोप जनणाायक रूप से िांच में जसद्ध हो िाए, ऐसे मान्यता प्राप्त ऊिा ा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) की मान्यता रद्द कर दी िाएगी और उसका नाम सक्षम प्राजधकारी के अनुमोदन से मान्यता प्राप्त ऊिा ा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) की सूची के रजिस्ट्टर स ेहटा ददया िाएगा। (2ग) िहां मान्यता प्राप्त ऊिाा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) का नाम खंड (2 ख) के अधीन, व्यापार के नाम के साथ-साथ फमा का नाम भी कायाालयों और फमों की सूची में से हटा ददया िाएगा। (2घ) िहा ं जिजनयम 7 के उप-जिजनयम (2) में जिजन्दष्टा फम ा म ें एक से अजधक मान्यता प्राप्त ऊिाा लेखा परीक्षक या ऊिा ा लेखा परीक्षक (भिन) ह,ैं ऐसे प्रत्येक व्यजि को उक्त खण्ड (क) या खण्ड (ग) म ें जन्दष्टा घटना के समय गलत, भ्रामक या गलत िानकारी प्रस्ट्तुत करन े या ्‍ यािसाजयक कदाचार या धोखाधडी के दोर् के जलए जिम्मेदार माना िाएगा, यदद ऐसा व्यजि उस फम ा के व्यापार के संचालन के जलए जिम्मेदार था, साथ ही यह समझा िाएगा दक फम ा ने भी उक्त कजथत अजनयजमतता या कदाचार का काया दकया ह ै:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] बिते दक इस उप-जनयम में जनजहत दकसी भी तथ्य के जलए व्यजि को जिम्मेदार नहीं िहराएगा, यदद िह साजबत करता ह ै दक उपरोि प्रािधान का उल्लघं न उसके ज्ञान के जबना दकया गया था या दक उसन े उक्त प्रािधानों के उल्लंघन को रोकन े के जलए उजचत पठरश्रम दकया था।

(3) िहां मान्यता प्राप्त ऊिाा लेखा परीक्षक या ऊिाा लेखा परीक्षक (भिन) की मान्यता रद्द कर दी िाती ह ै और उसका नाम उप-जिजनयम (1) के खंड (क) या खंड (ग) में जन्दष्टा आधारों पर हटा ददया िाता ह,ै तो ब्यूरो वारारा रजिस्ट्टर में नाम की बहाली नहीं की िाएगी।

9. प्रत्यायन प्रमाण-पत्र का जनरस्ट्तीकरण-(1) जिजनयम 8 के अधीन रजिस्ट्टर से नाम हटान े पर ब्यूरो जिजनयम 6 के अधीन प्रदत्त प्रत्यायन प्रमाण-पत्र को रद्द कर सकता ह।ै

(2) ब्यूरो प्रत्यायन रद्द करन े का आदेि िारी करने से पूि ा उक्त प्रमाण-पत्र रखने िाल े ऊिाा लेखा परीक्षक या ऊिा ा लेखा परीक्षक (भिन) को सुनिाई का अिसर देगा।

(3) िहा ं प्रत्यायन प्रमाणपत्र रद्द कर ददया िाता ह ै तो ब्यूरो उक्त प्रमाणपत्र धारक और संबंजधत नाजमत उपभोिा को अपना आदेि सूजचत करेगा और उसे प्रकाजित भी करेगा और अपनी आजधकाठरक िेब साइट पर आिश्यक पठरितान अपलोड करेगा।

(4) प्रत्यायन प्रमाणपत्र इसे रद्द करन े के आदेि के प्रकािन की तारीख से रद्द माना िाएगा।

(5) प्रत्यायन प्रमाण-पत्र के रद्द होने पर उक्त प्रमाण-पत्र धारक पंरह ददनों के अंदर उसे ब्यरू ो म ेंअभ्य्पात कर देगा।

10. डुप्लीकेट प्रमाण पत्र िारी करना - (1) िहां एक मान्यता प्राप्त ऊिाा लेखा परीक्षक या मान्यता प्राप्त ऊिा ा लेखा परीक्षक (भिन) ने मान्यता का प्रमाण पत्र खो ददया है तो इस संबंध में दकए गए आिेदन पर ब्यूरो संबंजधत पुजलस स्ट् टेिन के साथ दि ा प्रथम सूचना ठरपोटा की एक प्रजत के साथ जिजधित रूप स े ऊिा ा दक्षता ब्यूरो, नई ददल्ली के पक्ष म ें आहठरत जडमांड ड्राफ्ट वारारा या भुगतान की दकसी भी इलेक्रॉजनक जिजध से पांच सौ रुपए के िल्ु क के भगु तान पर एक डुप्लीकेट प्रमाण पत्र िारी कर सकता ह।ै

(2) िहां ब्यरू ो वारारा िारी प्रमाण पत्र क्षजतग्रस्ट्त हो िाता है, ब्यूरो इस संबंध म ें दकए गए आिदे न पर और क्षजतग्रस्ट्त प्रमाण पत्र के अभ्यपणा पर नई ददल्ली म ें देय ऊिा ा दक्षता ब्यरू ो के पक्ष म ें या भगु तान के दकसी भी इलेक्रॉजनक जिजध से जडमाडं ड्राफ्ट के माध्यम स ेपांच सौ रुपए का िल्ु क प्राप्त होने पर डुजप्लकेट प्रमाण पत्र िारी कर सकता ह।ै

11. प्रत्याजयत ऊिाा लेखा परीक्षकों और ऊिाा लेखा परीक्षक (भिन) स े संबंजधत सूचना,-(1) ब्यूरो प्रत्याजयत ऊिाा लेखा परीक्षकों और/या ऊिाा लेखा परीक्षक (भिन) को प्रस्ट्तुत करने के जलए कह सकता ह ै - क) की गई ऊिाा लेखा परीक्षण के क्षेत्र-िार ब्यौरे और पहचानी गई और हाजसल की गई ऊिाा बचत क्षमता से संबंजधत िानकारी; तथा ख) ऐसी अजतठरि िानकारी जिसे िह आिश्यक समझे।

2. जनम्नजलजखत दस्ट्तािेिों की स्ट्िप्रमाजणत फोटो-प्रजतयां संलग्न ह:ैं - (क) प्रमाजणत ऊिाा लेखा परीक्षक / प्रमाजणत ऊिाा लेखा परीक्षक (भिन) का िैध प्रमाण पत्र; (ख) ऊिाा लेखा परीक्षण के क्षेत्र म ें न्यूनतम 5 िर्ों के अनुभि का प्रमाण पत्र, जिसमें से, तीन िर्ा ऊिा ा सघन उद्योगों और ऊिाा संरक्षण अजधजनयम 2001 (2001 का 52) की अनुसूची में जिजन्दष्टा अन्य प्रजतष्ठानों म ें होंगे। जिजभन्न संगिनों में अनुभि का जििरण ग्राहक संगिन के लेटरहडे वारारा प्रमाजणत दकया िाएगा, जिसमें ऊिाा लखे ा परीक्षण आयोजित दकया गया था। (ग) पांच जिस्ट्तृत ऊिा ा लेखा परीक्षण ठरपोटों म ें प्रमाजणत ऊिाा लेखा परीक्षक / प्रमाजणत ऊिाा लेखा परीक्षक (भिन) बनने के बाद उनके वारारा दकए गए ऊिाा सघन उद्योगों की ठरपोटें िाजमल ह,ैं और इस तरह की ठरपोटों में आिेदक के नाम का उल्लेख या तो व्यजिगत क्षमता म ें या ऊिाा लेखा परीक्षण टीम के एक नेता या सहयोगी या सदक्रय टीम के सदस्ट्य के रूप म ेंहोगा;

(घ) ऊिाा लेखा परीक्षण ठरपोटा ऊिाा दक्षता ब्यूरो (ऊिाा लेखा परीक्षण के संचालन के जलए रीजत और अंतराल) के जिजनयम, 2010 के अनपु ालन में होगी; (ड) उपरोक्त (ग) म ें उजल्लजखत लखे ापरीक्षण ठरपोटों पर प्रजतदक्रया ऐसे ग्राहक, ऊिाा सघन उद्योगों या अन्य प्रजतष्ठानों स ेहोगी जिनकी ऊिाा लेखा परीक्षण उनके वारारा पूरी की गई थी;

(च) कम से कम चार मलू उपकरणों के निीनतम रूप की सूची होनी चाजहए, अथाात,् जक्लप-ऑन-प्रकार, जबिली मापने के उपकरण, फ्ल ू गैस जिश्लेर्क, तापमान और लक्स मापन े के उपकरण, जिसका अंिांकन जिजधित रूप से राष्ट्रीय परीक्षण और अिं ांकन प्रत्यायन बोड ा वारारा मान्यता प्राप्त प्रयोगिालाओं वारारा दकया गया है और ऊिाा लेखा परीक्षण के आयोिन के जलए उक्त उपकरणों के उपयोग म ेंजििेर्ज्ञता होनी चाजहए;

(छ) यदद आिेदक के पास ऊिाा लखे ा परीक्षण के मलू उपकरण नहीं ह,ैं िो खण् ड (ग) में जन्दष्टा ह,ैं िह कंपनी या फमा स े एक प्रमाण पत्र प्रस्ट्ततु करेगा, जिनके पास ऐसे उपकरण होंगे िो आिेदक ने अपन े ग्राहक के ऊिा ा लेखा परीक्षण के जलए आिेदक वारारा इस तरह के उपकरणों के उपयोग के जलए कानूनी िैध व्यिस्ट्था में दि ादकए हों;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ि) संगिन की रर से पत्र, जिसका नाम फमा के नाम के रूप में ददया गया ह,ै जिसके अधीन यथाप्रस्ट्ताजित ऊिाा लेखापरीक्षण दकया िाना ह।ै '

NOTIFICATION New Delhi, the 18th June, 2021 No. 02/11(7)/09-BEE.— The following draft of certain regulations to amend the Bureau of Energy Efficiency (Qualifications for Accredited Energy Auditors and Maintenance of their List) Regulations, 2009 which the Bureau, with the previous approval of the Central Government, proposes to make in exercise of the powers conferred by clause (f) of sub-section (2) of section 58 read with clause (p) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), is hereby published as required by sub-section (1) of section 58 of the said Act for the information of all persons likely to the affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date of publication of this notification in the Official Gazette.

Puram, Sector-1, New Delhi – 110066 and may be sent at the e-mail address of the Bureau at dg-bee@nic.in The objections or suggestions, if any, which may be received from any person with respect to the said draft regulations within the period so specified, shall be considered by the Bureau.

1. Short title and commencement. - (1) These regulations may be called the Bureau of Energy Efficiency (Qualification and procedure of Accredited Energy Auditors and Energy Auditors (Building) and Maintenance of their List) Regulations, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. - (1) In these regulations, unless the context otherwise requires, - a) "Act" means the Energy Conservation Act, 2001; b) "Accreditation Advisory Committee" means a committee constituted by the Bureau under regulation 5;

c) "energy auditor" means a person who has been issued a certificate as certified energy auditor or certified energy auditor (buildings) under regulation 8 of the Bureau of Energy Efficiency (Certification Procedure for Energy Auditors, Energy Auditors (Building) and Energy Managers) regulation, 2020;

ca) “Energy Auditors (Building)” means a person who has been issued a certificate as certified energy auditor

(buildings) under regulation 8 of the Bureau of Energy Efficiency (Certification Procedure for Energy Auditors, Energy Auditors (Building) and Energy Managers) Regulations, 2020;” d) "Energy Intensive Industries and Other Establishment" means the Energy Intensive Industries and other establishment specified in the Schedule to the Act;

e) "Form" means a form appended to these regulations; f) "Schedule" means the Schedule appended to these regulations.

(2) Words and expressions used herein and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act.

3. Qualifications, criteria and conditions for accredited energy auditor and Energy Auditor (Building).- (1) An energy auditor or Energy Auditor (Building) shall be qualified to become an accredited energy auditor or Accredited Energy Auditor (Building) if, he- a) has valid certificate for Energy Auditor or Energy Auditor (Building) under regulation 8 of the Bureau of Energy Efficiency (Certification Procedures for Energy Auditors, Energy Auditor (Building) and Energy Managers) Regulations, 2020;

b) has an experience of five years in energy audit out of which at least three years' shall be in any of the Energy Intensive Industries and Other Establishments; and c) has undertaken and completed at least five detailed energy audits in any of the Energy Intensive Industries and Other Establishments in individual capacity or as a team leader or associate or active team member of the energy audit team;.

(2) has been granted a certificate of accreditation by the Bureau under Regulation 6.

(3) For the purpose of constituting capable energy audit team, the applicant shall have an association, through legally binding arrangements, of at least two experts including full time Energy Auditors or Energy Auditor

(Building) or part time Energy Auditors or Energy Auditor (Building) or consultants, with expertise in10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] thermal, electrical utilities, processes, commercial buildings and establishments of the energy intensive industries, referred to in the schedule to the Act, to enhance his technical knowledge, and strengthen his energy audit skills and capabilities for undertaking energy audit in compliance with the direction of Central Government under clause (i) of section 14 of the Act regarding the plants of Designated Consumer of the various sectors or Designated Consumers in the commercial buildings or establishments in compliance with the direction of Central Government under clause (s) of section 14 of the Act in accordance with the Bureau of Energy Efficiency (Manner and Intervals of Time for Conduct of Energy Audit) Regulations, 2010 or the regulations framed under the said clause (s) of section14, as the case may be,

(4) The applicant shall have – a. expertise in using various instruments for conduct of energy audit including sector specific instruments; b. possession of at least four up-to-date basic instruments namely, clip-on-type, power measuring instruments, flue gas analyser, temperatures and lux measuring instruments which are duly calibrated by a laboratory accredited by the National Accreditation Board for Testing and Calibration Laboratories or shall have to submit a legally binding arrangement with the suppliers of such instruments in case the applicant is not in possession of the instruments referred to above.”

4. Procedure for grant of certificate of accreditation.- (1) The Bureau may, for the purpose of accreditation of energy auditors and Energy Auditor (Building) possessing qualifications specified in clauses (a) and (b) of regulation 3, call for applications from qualified persons.

(2) The application referred to in sub-regulation (1) shall be, made in Form I and be accompanied by- a) five detailed energy audit reports in any of the Energy Intensive Industries and Other Establishments undertaken by the energy auditor and Energy Auditor (Building) in an individual capacity or as a leader or associate or active team member of the energy audit team;

b) feed back on five energy audit reports submitted to the Bureau, referred to in clause a), shall be from the respective clients, whose energy audits were conducted; c) application fee of rupees one thousand payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or any acceptable electronic mode of payment;

d) an undertaking that the applicant is in possession of basic instruments referred to in clause (b) of sub-regulation

(3) of regulation 3 or a certificate from the supplier of such instruments; e) certificate(s) of experience of minimum of five years in the field of energy audit, out of which three years shall be in any of Energy Intensive Industries and Other Establishments specified in the Schedule to the Act and details of experience in different organizations, shall be duly supported by separate certificate on the letterhead of such organization;

f) a letter from the organization, on their letter head whose name is used by him for doing the business of energy audit.

5. Constitution of Accreditation Advisory Committee. - (1) The Bureau may, for the purpose of grant of certificate of accreditation, constitute an Accreditation Advisory Committee.

(2) The Accreditation Advisory Committee shall consist of a Chairperson and not more than three members to be nominated by the Bureau from amongst members of the Advisory Committees constituted under regulation 3 of the Bureau of Energy Efficiency (Advisory Committees) Regulations, 2008.

(3) The Accreditation Advisory Committee shall assess the energy audit experience and competence of the energy auditor and Energy Auditor (Building)who has applied for a certificate of accreditation under regulation 4 on the basis of an oral interview on the following criteria, namely:- a) evaluation of five detailed energy audit reports submitted alongwith the application;

b) the number of and the kind of Energy Intensive Industries in which detailed energy audits have been made; c) association of applicant with number of and kind of experts including full time energy auditors and Energy Auditor

(Building)or part time energy auditors and Energy Auditor (Building)or consultants with expertise in thermal, electrical utilities and processes and nature of such association; d) possession of at least four up-to-date basic instruments namely, clip-on type, power measuring instruments, flue gas analyser, temperature and lux measuring instruments which are duly calibrated by a laboratory accredited by the National Accreditation Board for Testing and Calibration Laboratories and expertise in using such instruments for conduct of energy audit;

e) manner of work followed in energy audit;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11 f) training experience; g) quality of field studies including observations, probing skills, collection and generation of data, depth of technical knowledge and analytical abilities;

h) quality of recommendations for improving energy efficiency or for conserving energy; i) capacity to undertake cost benefit analysis of recommended measures for improving energy efficiency or for conserving energy and preparation of action plan for implementation of recommendations fOr reduction of energy consumption; and I) quality of energy audit reports.

(4) On the basis of assessment made under sub-regulation (3), the Accreditation Advisory Committee shall make recommendation to the Bureau for accreditation of energy auditor and Energy Auditor (Building).

6. Certificate of accreditation. - (1) If the recommendation made by the accreditation advisory committee under sub- regulation (4) of regulation 5 is accepted by the Bureau, the name of the applicant shall be entered in the register of List of accredited energy auditors or Accredited Energy Auditor (Building), as applicable,maintained under regulation 7 and a certificate of accreditation in Form II shall be granted to the applicant on payment of annual accreditation fee of rupees one thousand payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or by any acceptable electronic mode of payment.

(2) The Bureau may, for reasons to be recorded in writing, reject the application for accreditation made by an energy auditor or Energy Auditor (Building) and intimate the same to him within a period of one month.

(3) The certificate of accreditation shall be valid until it is cancelled under regulation 9.

7. Maintenance of list of accredited energy auditors and Energy Auditor (Building), their offices and firms.-

(1) The Bureau shall maintain a register containing list of accredited energy auditors and Energy Auditor (Building) in Form III.

(2) The accredited energy auditor or Energy Auditor (Building) or a firm of such accredited energy auditor or Energy Auditor (Building)shall, before opening an office in the trade name or firm name, apply to the Bureau for approval to use the trade name or the firm name and on such approval, the Bureau shall maintain the register of offices and firms of accredited energy auditors and Energy Auditor (Building)in Form IV.

(3) The Bureau shall cause to be published the first list of accredited energy auditors and Energy Auditor (Building) and list of offices and firms of accredited energy auditors as soon as they are finalised and thereafter these lists shall be updated and published regularly and uploaded on the Bureau's official web-site namely, www.beeindia.gov.in. and energy professionals web site on www.beeindia.gov.in..

(4) Every accredited energy auditor and Energy Auditor (Building) shall submit to the Bureau any change in the information given in the application for accreditation for the purpose of updating the list.

(5) A copy of the updated list of accredited energy auditors and Energy Auditor (Building) shall be sent to the designated agencies of the States and designated consumers on the first day of April every year through electronic mail.

8. Removal and restoration of names in the register of list of accredited energy auditors and Energy Auditor (Building) - The Bureau may remove the name of the accredited energy auditor and Energy Auditor (Building)from the register of list of energy auditor on the following grounds, namely:- a) the Bureau, after giving an opportunity of hearing to the person concerned, is satisfied that such certificate of accreditation has been granted on the basis of incorrect, misleading or false information;

b) on the person ceasing to be an energy auditor and Energy Auditor (Building)or on his failure to undertake energy audit of an Energy Intensive Industries and Other Establishment in accordance with the Bureau of Energy Efficiency (Manner and Intervals of Time for Conduct of Energy Audit) Regulation 2010;

c) if the person is guilty of professional misconduct or fraud; d) if the person has failed to pay annual accreditation fee. e) if the person has requested to remove his name from the list of accredited Energy Auditors or Energy Auditor

(Building).

(2) Where the name of the accredited energy auditor is -removed on the grounds specified in clause (b) or clause (d) of sub-regulation (1), his name in the register shall be restored on an application made by him after restarting the work of energy audit or on payment of annual accreditation fee, as the case may be.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2A) where the name of the accredited Energy Auditor or Energy Auditor (Building) is removed on the grounds specified in clause (e) of sub-regulation (1), his name shall not be restored in the accreditation process.

(2B) where the name of the accredited Energy Auditor or Energy Auditor (Building) is proposed to be removed on the grounds specified in clause (a) or clause (c) of sub-regulation (1), the accreditation of such accredited Energy Auditor or Energy Auditor (Building), as applicable, shall be placed under suspension immediately on the happening of events specified in such clause until inquiry is completed and in the event, the allegation levelled against such accredited Energy Auditor or Energy Auditor (Building) is conclusively proved in the inquiry, the accreditation of such accredited Energy Auditor or Energy Auditor (Building) shall be cancelled and his name shall be removed from the register containing the list of accredited Energy Auditor or Energy Auditor

(Building) with the approval of competent authority.

(2C) where the name of accredited Energy Auditor or Energy Auditor (Building) has been removed under clause (2B), the trade name as well as firm’s name shall also be removed from the list of offices and firms.

(2D) where the firm referred to in sub-regulation (2) of regulation 7 has on its strength more than one accredited Energy Auditor or Energy Auditor (Building), every such person at the time of happening of the event specified in clause (a) or clause (c) of the aforesaid regulation shall be held responsible for furnishing of incorrect, misleading or false information or guilty of professional misconduct or fraud if such person was responsible for the conduct of the business of that firm as well as the firm shall also be deemed to have acted for commissioning of the aforesaid irregularity

or misconduct:

Provided that nothing contained in this sub-regulation shall render the person responsible, if he proves that contravention of the aforesaid provision was committed without his knowledge or that he exercised due diligence to prevent the contravention of the aforesaid provisions.

(3) Where the accreditation of the accredited Energy Auditor or Energy Auditor (Building) is cancelled and his name is removed on the grounds specified in clause (a) or clause (c) of sub-regulation (1), no restoration of name in the register shall be made by the bureau. 9. Cancellation of certificate of accreditation.-(1) On removal of the name from the register under regulation 8, the Bureau may cancel the certificate of accreditation granted under regulation 6.

(2) Before issuing an order of cancellation of accreditation, the Bureau shall give an opportunity of hearing to the energy auditor or Energy Auditor (Building) holding such certificate.

(3) Where the certificate of accreditation is cancelled, the Bureau shall communicate its order to the holder of such certificate and the concerned designated consumer and shall also publish the same and upload necessary changes on its official web site.

(4) The certificate of accreditation shall stand cancelled with effect from the date of publication of the order of cancellation.

(5) On cancellation of certificate of accreditation, the holder of such certificate shall surrender the same to the Bureau within fifteen days.

10. Issue of duplicate certificate - (1) Where an accredited energy auditor or Accredited Energy Auditor (Building)has lost the certificate of accreditation, the Bureau may, on an application made in this behalf, duly accompanied by a copy of first information report lodged with the concerned police station, issue a duplicate certificate on payment of a fee of rupees five hundred by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or by any electronic mode of payment.

(2) Where the certificate issued by the Bureau is damaged, the Bureau may on an application made in this behalf and on surrendering of the damaged certificate, issue a duplicate certificate on receipt of a fee of rupees five hundred by way of demand draft drawn in favour of Bureau of Energy Efficiency payable at New Delhi or by any electronic mode of payment.

11. Information relating to accredited energy auditors and Energy Auditor (Building),-(1) The Bureau may call upon accredited energy auditors and/or Energy Auditor (Building)to furnish— a) information relating to sector-wise details of energy audit conducted, and the energy saving potential identified and achieved; and b) such additional information as it considers necessary.

(2) The Bureau may make available the information received by it under sub-regulation (1) to the general public through its web site or through any of its publication.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13 “Form – I [See regulation 4 (2)] Application for Certificate of Accreditation To The Secretary The Bureau of Energy Efficiency New Delhi.

Dear Sir, I am working as certified energy auditor/certified energy auditor (building) at ………..…………… ……………………………………. (full address of the place of work) ……………………………………… …………………… and hereby apply for certificate of accreditation.

2. The self – attested photo-copies of the following documents are enclosed: -

(a) Valid certificate of Certified Energy Auditor/Certified Energy Auditor (Building);

(b) Certificate(s) of experience of minimum of 5 years in the field of energy audit, out of which, three years shall be in the Energy Intensive Industries and Other Establishments specified in the Schedule to the Energy Conservation Act, 2001 (52 of 2001). Details of experience in different organizations shall be duly supported by certificates on the letter head of the client organization in which the energy audit was conducted.

(c) five detailed energy audit reports inclusive of Energy Intensive Industries carried out by him after he has become certified energy auditor/certified energy auditor (building) and such reports shall mention the name of the applicant, either in an individual capacity or as a leader or associate or active team member of the energy audit team;

(d) The energy audit reports shall be in compliance with the Bureau of Energy Efficiency (Manner and Intervals of Time for Conduct of Energy Audit) Regulation, 2010;

(e) feedback on audit reports referred to in (c) above shall be from such client, Energy Intensive Industries or Other Establishments whose energy audit was conducted by him;

(f) a list of at least four up-to-date basic instruments, possessed by him, namely, clip-on-type, power measuring instruments, flue gas analyser, temperature and lux measuring instruments, duly calibrated by a laboratory accredited by the National Accreditation Board for Testing and Calibration Laboratories and should have expertise in using such instruments for conduct of energy audit;

(g) in case the applicant does not possess the basic instruments of energy audits, referred to in clause

(c), he shall furnish a certificate from the company or firm having such instruments that the applicant has entered into legal valid arrangements for their use as and when such instruments are required by the applicant for undertaking energy audit of his client;

(h) letter from the organization, whose name is given as Firms’ name, under which energy audit as proposed has to be conducted.’

3. The duly filled in Form-III and Form-IV as it is applicable to him shall also be enclosed.

4. I am enclosing /have paid the following fees by demand draft No………… dated ………. drawn in favour of the Bureau of Energy Efficiency, New Delhi or by an acceptable electronic mode of

payment: -

(i) application fee of rupees on thousand; and

10. In Form II, in existing paragraph 2, 3 and 5, for the existing words “Qualifications for Accredited Energy Auditors and Maintenance of their List”, the following words shall be substituted, namely: - “the qualifications, criteria and conditions subject to which a person may be accredited as an energy auditor and the procedure for such accreditation and maintenance of their list”

1. In Form III and Form IV

(i) in rows against column one, in serial number 3, 5 and 6, for the words “Energy Manager”, the words “Energy Auditor / Energy Auditor (Building)” shall be substituted.

(iv) in rows against column one, the existing serial number 4 shall be omitted.

(v) in rows against column one, in existing serial number 5 (ii) and 6 (ii) shall be deleted.

11. In the principal regulations, the Schedule shall be deleted.
