1. संजक्षि नाम और प्रारंभ। -(1) इन जिजनयमों का संजक्षि नाम ऊजाा दक्षता ब्यरू ो (रेदिजरेटर के लेबल पर उनके प्रदिान का जििरण और तरीका) जिजनयम, 2022 ह।ै

(2) ये आजधकाठरक राजपत्र में प्रकािन की तारीख को प्रिृत्त होंगे।

2. पठरभाषाए:ं- (1) इन जिजनयमों में, जब तक दक संदभ ासे अन्यथा अपेजक्षत न हो,- (क) "अजधजनयम" स ेऊजाा सरं क्षण अजधजनयम, 2001 (2001 का 52) अजभप्रेत ह;ै (ख) "रेदिजरेटर" स ेअजधजनयम की धारा 14 के खडं (बी) के तहत अजधसूचना में जनर्ददष्ट उपकरण अजभप्रेत ह;ै (ग) "फॉमा" से इन जिजनयमों स ेजुडा फॉमा अजभप्र े ह;ै (घ) "लेबल" से रेदिजरेटर पर जचपका या ददखाई दने े िाला कोई जलजखत, मुदद्रत, जचजननत, मुहर लगी या ग्रादफक सामग्री अजभप्रेत ह;ै (ड) "लेबल अिजध" का अथा ह ै धारा 14 के खंड (ए) के तहत केंद्र सरकार द्वारा अजधसूजचत ऊजाा खपत मानक के तहत तुलनात्मक जिद्युत की खपत की िैधता अिजध और यदद तलु नात्मक जिद्युत की खपत की िैधता अिजध की समाजि अिजध अजधसूजचत नहीं ह,ै तो इसे तब तक िैध माना जाएगा जब तक दक इसके जलए नए मूल्य केंद्र सरकार द्वारा अजधसूजचत नहीं दकए जाते ह;ैं (च) "मॉडल या मॉडल का पठरिार" स े एक जििेष ब्ांड के मॉडल या मॉडल की श्रेणी अजभप्रेत ह,ै जजसके जलए परीक्षण ठरपोटा का एक समूह लाग ू होता ह ै और जहां प्रत्येक मॉडल म ें समान भौजतक जििेषताएं, िार्षषक जिद्युत की खपत, ऊजाा दक्षता स्ट्तर और प्रदिान जििेषताएं होती ह;ैं (छ) "अनुमजत प्राि" से उस व्यजि या एजेंसी अजभप्रेत ह ैजजसे जिजनयम 7 के तहत लेबल लगाने की अनुमजत दी गई ह;ै (ज) "स्ट्टार रेटटग या स्ट्टार लेिल" का मतलब रेदिजरेटर के आपेजक्षक जिद्युत खपत को दिााने के जलए अजधजनयम की धारा 14 के खंड (ए) के तहत केंद्र सरकार द्वारा अजधसूजचत ऊजाा खपत मानक के आधार पर रेदिजरेटर के लेबल पर प्रदर्षित ऊजाा दक्षता का ग्रेड ह;ै (झ) दकसी लेबल िाल े रेदिजरेटर के संबंध म ें "व्यापारी या जिक्रेता" का अथा ऐसा व्यजि ह ै जो ऐसे दकसी रेदिजरेटर को बेचता ह ै या जितठरत करता ह ै और इसमें दकु ानदार, व्यापारी, जनमााता और अनुज्ञाधारक िाजमल ह ैं जजन्ह ें ऐस े रेदिजरेटर पर लेबल लगान े की अनुमजत दी गई ह।ै (ञ) "अनुसूची" से इन जिजनयमों से जुडी अनुसूची अजभप्रेत ह;ै

(2) उन िब्दों और पदों के जो इनमें प्रयुि ह ैं और पठरभाजषत नहीं हैं, ककतु अजधजनयम में पठरभाजषत ह,ैं िहीं अथा ह,ैं जो अजधजनयम म ेंह।ैं

3. लेबल पर प्रदर्षित दकए जाने िाल े जििरण - (1) प्रत्येक रेदिजरेटर पर, उसके लेबल पर जनम्नजलजखत जििरण प्रदर्षित दकए जाएंगे, अथाात्:- (क) ऊजाा दक्षता ब्यरू ो का लोगो; (ख) जनमााता या आयातक और ब्ांड का नाम;[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 (ग) उपकरण प्रकार;

(घ) कुल मात्रा; (ड) मॉडल संख्या और जनमाणा या आयात का िष;ा (च) यूजनक सीठरज कोड; (छ) प्रजत िषा इकाइयों में जिद्युत की खपत; (ज) स्ट्टार लेबल; और (झ) लेबल अिजध

(2) लेबल का जडजाइन, रंग, आकार और सामग्री इन जिजनयमों से संबंजधत अनुसूची में जनर्ददष्ट के अनुसार होगी।

4. लेबल प्रदर्षित करने की समय सीमा: - (1) जिजनयम 3 में जिजनर्ददष्ट सभी जििरणों िाला एक लेबल इन जिजनयमों के लाग ूहोने की तारीख से छह महीने की अिजध के भीतर प्रत्येक रेदिजरेटर पर प्रदर्षित दकया जाएगा।

(2) अजधजनयम की धारा 14 के खंड (ए) के तहत केंद्र सरकार द्वारा अजधसूजचत संिोजधत ऊजाा खपत मानकों के िुरू होने पर, प्रत्येक अनज्ञु ा-पत्र धारी या व्यापारी या जिक्रेता यह सुजनजित करेगा दक- (क) जबक्री पर रखा रेदिजरेटर संिोजधत ऊजाा खपत मानकों के साथ ससक्रनाइज करते हुए संिोजधत स्ट्टार लेबल और संिोजधत लेबल अिजध प्रदर्षित करेगा और रेदिजरेटर के जनमााण िषा भी ऐसे संिोजधत ऊजाा खपत मानकों के साथ ससक्रनाइजेिन में होंगे और जपछल ेऊजाा खपत मानकों के साथ रेदिजरेटर का उत्पादन नहीं करेंगे;

(ख) इन जिजनयमों के तहत डीलरों, खुदरा जिक्रेताओं के बारे म ें जागरूकता, उनकी जिक्षा के साथ-साथ उपभोिाओं की जिक्षा के जलए आिश्यक प्रचार सजहत सभी प्रारंजभक कदम सुजनयोजजत और ऐसे िुरू होने की तारीख से छह महीन े पहले जलए जाएगं े।

5. लेबल प्रदर्षित करन े का तरीका -(1) प्रत्येक रेदिजरेटर पर जबक्री के स्ट्थान पर क्यआू र कोड के साथ लेबल प्रदर्षित दकया जाएगा और ऐसा लेबल रेदिजरेटर पर जनम्नजलजखत तरीके से जचपकाया जाएगा, अथाात्:- (क) रेदिजरेटर के ऊपरी दाजहने जहस्ट्से के सामने की तरफ जचपका हुआ क्यआू र कोड के साथ स्ट्ियं जचपकन े िाला लेबल;

(ख) काटान बॉक्स के सामने की तरफ क्यूआर कोड के साथ स्ट्ियं जचपकने िाला लेबल।

(2) रेदिजरेटर के प्रदिान पर नहीं होने के जलए, लेबल को पैककग के बाहरी जहस्ट्से में जचपकाया जा सकता ह ै और जबक्री पर रख ेजाने पर लेबल को यूजनट से जोडा जा सकता ह।ै

6. लेबल प्रदर्षित करने की अनुमजत - (1) ब्यूरो की पूिा अनुमजत प्राि दकए जबना रेदिजरेटर पर कोई स्ट्टार लेबल नहीं लगाया जाएगा।

(2) कंपनी का पंजीकरण - ब्यरू ो की अनुमजत प्राि करने के प्रयोजनों के जलए, प्रत्येक ब्ांड को अलग स े पंजीकृत दकया जाएगा जैसा दक फॉमा I - (ए) में जनर्ददष्ट ह,ै एक लाख रुपये के लेबल सुरक्षा िुल्क के साथ, भुगतान के इलेक्रॉजनक मोड द्वारा देय होंगे। :

परन्त ुलघु उद्योग के मामले म ेंलेबल सुरक्षा िुल्क केिल पच्चीस हजार रुपये देय होगा।

(3) मॉडल पंजीकरण- उप-जिजनयम (2) के तहत अनज्ञु ा-पत्र धारी के प्रत्येक आिेदन के साथ- (क) भुगतान के इलेक्रॉजनक मोड द्वारा देय प्रजत मॉडल दो हजार रुपये का आिेदन िुल्क; और4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) फॉमा I - (बी) में जनर्ददष्ट दस्ट्तािेज

7. अनुमजत प्रदान करना - (1) जिजनयम 6 के तहत एक आिेदन प्राि होन े पर और संतुष्ट होन े के बाद दक सभी आिश्यकताओं का अनुपालन दकया जाता है, ब्यूरो, मानकों और लेबसलग पर अपन े मैनुअल म ें जनर्ददष्ट अिजध के भीतर, ऐसी ितों के अधीन हो सकता ह ैऔर जिजनयम 8 में जिजनर्ददष्ट ितें ह,ैं - (क) इलेक्रॉजनक रूप म ेंफॉमा II-(ए) में ब्ांड पंजीकृत करना; और (ख) इलेक्रॉजनक रूप म ेंफॉमा II-(बी) म ेंरेदिजरेटर पर लेबल लगाने की अनुमजत देना।

(2) ब्यूरो प्रपत्र III में एक रजजस्ट्टर रखगे ा और उसमें अनुज्ञा-पत्र धारी का नाम दजा करेगा।

(3) उप-जिजनयम (1) के तहत इस प्रकार दी गई अनुमजत उस अिजध के जलए िैध होगी जब तक दक धारा 14 के खंड (ए) के तहत केंद्र सरकार द्वारा अजधसूजचत ऊजा ाखपत मानक द्वारा जनर्ददष्ट स्ट्टार लेबल लागू ह।ै

(4) स्ट्टार रेटटग योजना के सिं ोधन के मामले में, अनुमजत के निीनीकरण के जलए आिेदन छह महीने से लेदकन इसकी समाजि से तीन महीने पहल े नहीं दकया जाएगा और इसके साथ इलेक्रॉजनक मोड में ऊजाा दक्षता ब्यरू ो, नई ददल्ली के पक्ष में एक हजार रुपय ेका िल्ु क दये होगा। स्ट्टार रेटटग योजना के जिस्ट्तार के मामले म,ें एक हजार रुपय ेके उि निीनीकरण िुल्क से छूट दी जाएगी।

(5) िैधता अिजध की समाजि के बाद दकसी भी आिेदन का निीनीकरण नहीं दकया जाएगा, जजस जस्ट्थजत म ें अनुज्ञापी एक नया आिेदन करेगा।

(6) उप-जिजनयम (4) के तहत निीनीकरण के जलए आिेदन प्राि होने पर और संतष्टु होने के बाद दक सभी आिश्यकताओं का अनुपालन दकया जाता ह,ै ब्यूरो, ऐसी प्राजि की तारीख से एक महीने की अिजध के भीतर, फॉमा II में अनुमजत को निीनीकृत कर सकता ह।ै

(7) जजस तारीख से संिोजधत स्ट्टार लेिल लागू होता ह,ै उस तारीख से रेदिजरेटर के मौजूदा मॉडल पर लेबल लगाने के जलए जारी रखन े की अनुमजत मांगने िाला अनज्ञु ा-पत्र धारी केिल फॉमा IV में घोषणा प्रस्ट्तुत करेगा।

(8) यदद रेदिजरेटर के नए मॉडल को संिोजधत स्ट्टार स्ट्तर के साथ ससक्रोनाइज करन े के जलए लॉन्च करन े की योजना है, तो अनुज्ञा-पत्र धारी नए जसरे से लबे ल लगाने की अनुमजत मांगगे ा और इस तरह की अनुमजत के जलए आिेदन संिोजधत स्ट्टार स्ट्तर के लाग ूहोने से छह महीने पहले दकया जा सकता ह।ै

8. लेबल पर जििरण प्रदर्षित करने के जलए जनयम और ितें।- प्रत्येक अनुज्ञा-पत्र धारी, व्यापारी और जिक्रेता लेबल पर जििरण प्रदर्षित करने म ेंजनम्नजलजखत जनयमों और ितों का पालन करेंगे, अथाात्: - (क) रेदिजरेटर के लेबल पर प्रदर्षित स्ट्टार स्ट्तर अजधजनयम की धारा 14 के खंड (ए) के तहत केंद्र सरकार द्वारा अजधसूजचत रेदिजरेटर के जलए ऊजाा खपत मानकों के अनरूु प होगा;

(ख) लेबल केिल रेदिजरेटर के ऐसे मॉडल पर लगाया जाएगा जजसके जलए अनुमजत दी गई है; (ग) अनज्ञु ा-पत्र धारी की कीमत पर लेबल मुदद्रत और रेदिजरेटर पर जचपका ददया जाएगा; (घ) अनज्ञु ा-पत्र धारी, व्यापारी और जिक्रेता यह सुजनजित करेंगे दक रेदिजरेटर के लेबल पर प्रदर्षित स्ट्टार स्ट्तर हर समय बनाए रखा जाएगा;

(ड) अनुज्ञाप्राजि जिजनयम 9 में जिजनर्ददष्ट लेबल िल्ु क का भुगतान करेगा;[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5 (च) अनज्ञु ा-पत्र धारी जित्तीय िषा की प्रत्येक जतमाही की समाजि के अगले महीन े के भीतर ब्यूरो को एक जििरण प्रस्ट्तुत करेगा जजसमें लेबल दकए गए उपकरणों के उत्पादन और प्रत्येक जतमाही के जलए अर्षजत लेबसलग िल्ु क का जििरण होगा;

(छ) अनुज्ञा-पत्र धारी प्रत्येक िषा के अप्रलै के 30 िें ददन तक अपन े लेबल िाले उत्पादों को बेचने के जलए जनयिु अजधकृत जितरकों, डीलरों, खुदरा जिक्रेताओं, जिक्रेताओं की एक अद्यतन सूची ब्यूरो को प्रस्ट्ततु करेगा;

(ज) ब् यरू ो के मानकों एिं लेबसलग संबंधी प्रचालन मैनुअल में जन जहत जनबंधन एिं ितों सजहत ब् यूरो द्वारा जनर्ददष् ट ऐसी अन् य जनबंधन एि ंितों का पालन करेगा।

9. लेबल िल्ु क.- (1) प्रत्येक अनुज्ञा-पत्र धारी को ब्यूरो को रेदिजरेटर पर जचपकाए गए प्रत्यके लेबल के जलए पांच रुपये की लेबल फीस का भुगतान करना होगा।

(2) उप-जिजनयम (1) के तहत जनर्ददष्ट लेबल िल्ु क का भुगतान प्रत्येक जित्तीय िषा की समाजि की तारीख से एक महीने के भीतर िार्षषक रूप से दकया जाएगा: बिते दक इस प्रकार जनर्ददष्ट अिजध के भीतर लेबल िुल्क का भगु तान करन े म ें जिफल रहन े पर, ब्यूरो देय राजि को ब्याज सजहत दस प्रजतित की दर से िसूल कर सकता ह।ै जिजनयम 6 के उप-जिजनयम (3) के खंड (बी) के तहत दकए गए लेबल सुरक्षा िुल्क से प्रजत िष,ा और यदद जमा करने की अंजतम तारीख के एक िष ा के भीतर पूणा लेबसलग िुल्क की िसूली नहीं की जाती ह,ै तो ब्यूरो उन सभी लेबलों को रद्द कर सकता ह ै जजन्ह ें अनुज्ञा प्रदान दकया गया ह ै और समाचार पत्रों म ें जडफॉल्टर के रूप म ेंअनज्ञु ा-पत्र धारी का नाम प्रकाजित करें।

10. लेबल सुरक्षा िल्ु क की िापसी- जिजनयम 9 के उप-जिजनयम (2) के प्रािधानों के अधीन, अनुज्ञा-पत्र धारी रेदिजरेटर का जनमााण बंद करन े पर लेबल सुरक्षा िल्ु क की िापसी का हकदार होगा।

11. ब्यूरो द्वारा सत्यापन - (1) ब्यूरो या उसकी नाजमत एजेंसी, या तो स्ट्िप्रेरणा स,े या उसके द्वारा प्राि जिकायत पर, यह सुजनजित करने के जलए सत्यापन कर सकती ह ै दक रेदिजरेटर स्ट्टार स्ट्तर और उसके लेबल पर प्रदर्षित अन्य जििरणों के अनुरूप ह ैऔर यह अनुमजत के अन्य जनयमों और ितों का अनपु ालन करता ह।ै

(2) सत्यापन के उद्देश्य के जलए, नमूने को ब्यूरो या इसकी नाजमत एजेंसी द्वारा जिजनमाणा सुजिधा, गोदाम या खुदरा आउटलेट स े यादजृ छछक रूप स े जलया जाएगा, जैसा दक िह उजचत समझे और क) ऊजा ा खपत परीक्षण ख) कुल मात्रा के अधीन होगा और ग) परीक्षण नीचे जगरना।

(3) जहां, उप-जिजनयम (1) के तहत प्राि जिकायत पर, ब्यूरो को परीक्षण और अिं ांकन प्रयोगिालाओं के जलए राष्ट्रीय प्रत्यायन बोडा द्वारा जिजधित मान्यता प्राि एक स्ट्ितंत्र प्रयोगिाला म ें रेदिजरेटर को चनु ौती परीक्षण द्वारा सत्यापन करन े की आिश्यकता होती ह,ै एक नोठटस जारी दकया जाएगा इस तरह के परीक्षण करन े के जलए अनुज्ञा और जिकायतकताा को ब्यूरो के साथ परीक्षण, पठरिहन और अन्य आकजस्ट्मक खचों से संबंजधत ऐसे खच ा जमा करन े के जलए कहा जाएगा, जैसा दक ब्यूरो द्वारा जनधााठरत दकया जा सकता ह,ै और यदद चुनौती परीक्षण के तहत जलया गया नमनू ा जिफल रहता है, नमूने की लागत, नमूने के पठरिहन और परीक्षण िुल्क के सभी खचों की प्रजतपूर्षत अनुज्ञा-पत्र धारी द्वारा ब्यूरो को की जाएगी और ब्यूरो जिकायतकता ा को उपरोि खच ा िापस कर देगा; और जहां उपकरण चनु ौती परीक्षण पास करता ह,ै तो जिकायतकताा द्वारा जमा दकए गए खचा को जब्त कर जलया जाएगा।

(4) जहां परीक्षण के जलए उपयोग दकए गए रेदिजरेटर के नमूने स्ट्ित: परीक्षण या चुनौती परीक्षण के दौरान परीक्षण म ें जिफल हो जात े ह,ैं अनुज्ञा-पत्र धारी को एक और अिसर ददया जाएगा और ब्यूरो पहल े परीक्षण म ें उपयोग दकए गए रेदिजरेटर की दगु ुनी मात्रा के साथ दसू रा परीक्षण एक स्ट्ितंत्र परीक्षण प्रयोगिाला म ें करेगा, जो अनुज्ञा-पत्र धारी की कीमत पर परीक्षण और अंिांकन प्रयोगिालाओं के जलए राष्ट्रीय प्रत्यायन बोड ा द्वारा जिजधित मान्यता प्राि ह।ै ब्यूरो उप- जिजनयम (3) में संदर्षभत चनु ौती परीक्षण या उप-जिजनयम (4) में संदर्षभत दसू रे परीक्षण और नमूने की खरीद और परीक्षण के जलए दकए जान े िाल ेखचों को देखने के जलए फॉम ाV में परजमट को सूजचत करेगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(5) यदद दसू रा परीक्षण जिफल हो जाता है, ब्यूरो जनम्न काया करेगा, - (क) सभी राज्य नाजमत एजेंजसयों को सूजचत करत े हुए फॉम ा VI में अनुज्ञा-पत्र धारी को जनदेि द,ें दक अनुज्ञा-पत्र धारी दो महीने की अिजध के भीतर, -

(i) रेदिजरेटर के लेबल पर प्रदर्षित स्ट्टार स्ट्तर को ठीक करें या परीक्षण के दौरान पाए गए दोषों और कजमयों को दरू करें;

(ii) ब्यूरो के जनदिे ों का पालन करने के जलए बाजार से सभी स्ट्टॉक िापस ले लें; और

(iii) जिज्ञापन सामग्री पर प्रदर्षित जििरणों को बदले; (ख) उपभोिाओं के लाभ के जलए, दकसी भी राष्ट्रीय या क्षेत्रीय दैजनक समाचार पत्र में दकसी भी अनुज्ञा का नाम, ब्ांड नाम, मॉडल नाम या मॉडल नंबर, लोगो और अन्य जिजिष्टताओं को प्रकाजित करें और दकसी भी इलेक्रॉजनक माध्यम स ेया दकसी अन्य तरीके स,े जैसा िह उजचत समझे, दो महीने के भीतर प्रकाजित करें ;

(ग) संबंजधत राज्य नाजमत एजसें ी को अजधजनयम की धारा 27 के तहत अनज्ञु ा-पत्र धारी और व्यापारी के जखलाफ न्याजयक कायािाही िुरू करन े के जलए सूजचत करें।

(6) अनज्ञु ा-पत्र धारी उप-जिजनयम (5) में जनर्ददष्ट दो महीने की अिजध के समापन के दस ददनों के भीतर, - (क) जनदेि के अनुपालन म ेंकी गई कारािाई के संबंध म ेंब्यूरो को प्रपत्र VII में अनुपालन ठरपोटा भेजें; और (ख) यदद खंड (ए) में जनर्ददष्ट अनुपालन ठरपोटा जनर्ददष्ट अिजध के भीतर दकसी भी जनदेि का पालन दकए जबना प्राि या प्राि नहीं होती ह,ै तो इसे जारी दकए गए जनदेि का अनपु ालन नहीं माना जाएगा और उस प्रभाि के आदेि ब्यूरो द्वारा पाठरत दकए जाएंगे।

(7) ब्यूरो खडं (ए) में संदर्षभत अनुपालन ठरपोटा की एक प्रजत और उप-जिजनयम (6) के खंड (बी) में पाठरत आदेिों की एक प्रजत आिश्यक दस्ट्तािेजों के साथ सभी राज्य नाजमत एजेंजसयों को अजधजनयम के धारा 17 और उि उप-जिजनयम के खंड (बी) के तहत पाठरत आदिे ों का प्रितान के तहत कारािाई करन ेके उद्देश्य से भेजेगा।

(8) यदद अनुज्ञा-पत्र धारी उप-जिजनयम (5) के तहत ब्यूरो द्वारा जारी जनदेिों का पालन करने में जिफल रहता है, ब्यूरो सभी राज्य नाजमत एजेंजसयों को सूजचत करेगा, - (क) जिजनयम 7 के उप-जिजनयम (1) के तहत अनज्ञु ापी को दी गई अनुमजत को िापस लने ा;

(ख) अजधजनयम की धारा 14 के खंड (ए) के तहत केंद्र सरकार द्वारा अजधसूजचत ऊजाा खपत मानकों के अनरूु प अनुज्ञा-पत्र धारी द्वारा जिफलता के समथना में परीक्षण ठरपोटा के साथ केंद्र सरकार को ठरपोटा भेजें, के जनदेि केंद्र सरकार द्वारा अजधजनयम की धारा 14 के खंड (सी) के तहत जिचार करने और कारािाई करने के जलए ब्यरू ो को उप-जिजनयम (6) के खंड (ए) म ेंसंदर्षभत दकया गया ह;ै (ग) उपभोिाओं के लाभ के जलए, दकसी भी राष्ट्रीय या क्षेत्रीय दैजनक समाचार पत्र में और दकसी भी इलेक्रॉजनक या दकसी अन्य तरीके से दकसी भी परजमट के नाम, ब्ांड नाम, मॉडल नाम या मॉडल नंबर, लोगो और जैसा िह उजचत समझे दो महीने के भीतर अन्य जिजनदेि प्रकाजित करें ;

(घ) संबंजधत राज्य नाजमत एजेंजसयों को अजधजनयम की धारा 27 के तहत परजमट और व्यापारी के जखलाफ आग े की न्याजयक कायािाही िुरू करन े के जलए सूजचत करें।

12. अनुमजत का जनरस्ट्तीकरण - ब्यरू ो जिजनयम 7 के तहत दी गई अनुमजत को रद्द कर सकता ह,ै यदद अनुज्ञा-पत्र धारी -[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 7 (क) जिजनयम 8 के तहत जनर्ददष्ट दकसी भी जनयम और ितों का पालन करन े में जिफल रहता ह;ै (ख) जिजनयम 9 के तहत जनर्ददष्ट अिजध के भीतर लेबल िुल्क का भुगतान करन े में जिफल रहता है;

2. यह अनुमजत के अधीन ह ै- (क) रेदिजरेटर के लेबल पर प्रदर्षित स्ट्टार स्ट्तर अजधजनयम की धारा 14 के खंड (क) के तहत अजधसूजचत रेदिजरेटर के जलए ऊजाा खपत मानकों और उपरोि जिजनयमनों में प्रदान दकए गए जनयमों और ितों के अनुरूप होगा;

(ख) केिल रेदिजरेटर के ऐस ेमॉडल पर लेबल की मोहर लगाई जाऐगी जजसके जलए अनुमजत दी गई होगी; (ग) रेदिजरेटर पर लेबल की छपाई और जचपकाना अनुज्ञाधारक (परजमटी) की लागत पर होगा; (घ) अनुज्ञाधारक (परजमटी) यह सुजनजित करेगा दक रेदिजरेटर पर प्रदर्षित स्ट्टार स्ट्तर को हर समय बनाए रखगे ा;

(ड.) ब्यूरो द्वारा जिजनर्ददष्ट लेबल िल्ु क का भुगतान अनुज्ञाधारक (परजमटी) द्वारा दकया जाऐगा; (च) अनुज्ञाधारक (परजमटी) जित्तीय िष ा की प्रत्येक जतमाही की समाजि के अगल े महीन े के भीतर प्रत्येक जतमाही के जलए देय लेबल उपकरण और अर्षजत लेबसलग िुल्क के जििरण िाले ब्यूरो को जििरण प्रस्ट्तुत करेगा। िही जििरण एक स्ट्िचाजलत प्रणाली के माध्यम से ब्यूरो को भी प्रस्ट्तुत दकया जाऐगा;

(छ) अनुज्ञाधारक (परजमटी) ब्यरू ो द्वारा मांग े जान े पर रेदिजरेटर के ऐस े अन्य जििरण भी उपलब्ध करायेगा जजसकी अनुमजत प्रदान की गई ह।ै

3. अनुज्ञाधारक (परजमटी) ब्यरू ो के पूिाानुमोदन के जबना और पिू ाानुमोदन के अलािा िैधता अिजध के दौरान बाजार से पंजीकृत ब्ांड और रेदिजरेटर को िापस नहीं लेगा।

1. ब्यूरो ऑफ एनजी एदफजिएंसी (रेदिजरेटर के लबे ल पर उनके कायप्रा दिना का जििरण और तरीका) जिजनयम, 2022 के जिजनयम 7 के प्रािधानों के अनुसार, ब्यूरो आपको एतद्द्वारा इस पत्र के अनुलग्नक म ें जनधााठरत अनुमोदनों के जििरण के अनुसार लेबल लगान े की अनुमजत देता ह।ै

2. यह अनुमजत के अधीन ह-ै (क) रेदिजरेटर के लेबल पर प्रदर्षित स्ट्टार स्ट्तर अजधजनयम के खडं (क) धारा 14 और पूिोि जिजनयमनों में प्रदान दकए गए जनयमों और ितों के तहत अजधसूजचत रेदिजरेटर के जलए ऊजाा खपत मानकों के अनरूु प होगा;

(ख) रेदिजरेटर के केिल ऐस ेमॉडल पर लेबल जचपकाया जाएगा जजसके जलए अनुमजत दी गई है; (ग) रेदिजरेटर पर लेबल की छपाई और लेबल का जचपकाना अनुमती (परजमटी) की कीमत पर होगा; (घ) अनुज्ञाधारक (परजमटी) यह सुजनजित करेगा दक रेदिजरेटर पर प्रदर्षित स्ट्टार स्ट्तर को हर समय बनाए रखगे ा;

(ड.) अनुज्ञाधारक (परजमटी) प्रजत लबे ल पाूँच रुपए की लेबल फीस का भुगतान करेगा; (च) अनुज्ञाधारक (परजमटी) जित्तीय िषा की प्रत्येक जतमाही की समाजि के अगल े महीन े के भीतर प्रत्येक जतमाही के जलए देय लेबल उपकरण और अर्षजत लेबसलग िुल्क के जििरण िाले ब्यरू ो को जििरण प्रस्ट्तुत करेगा। िही जििरण एक स्ट्िचाजलत प्रणाली के माध्यम से ब्यूरो को भी प्रस्ट्ततु दकया जाऐगा ;

(छ) अनुज्ञाधारक (परजमटी) ब्यूरो द्वारा मांगे जाने पर रेदिजरेटर के ऐसे अन्य जििरण भी उपलब्ध करायेगा जजसकी अनुमजत प्रदान की गई ह।ै

5. यदद केंद्र सरकार द्वारा समीक्षा दकये जाने पर स्ट्टार स्ट्तर के प्लानों को संिोजधत दकया जाता है, रेदिजरेटर के स्ट्टार स्ट्तर को जनम्नानुसार संिोजधत दकया जाऐगािः - (क) यदद संिोजधत स्ट्टार स्ट्तर के साथ ससक्रनाइज करन े के जलए एक नया मॉडल लॉन्च दकया जाता ह,ै तो इस तरह की अनुमजत के जलए एक आिेदन ब्यरू ो को उस तारीख से छह महीने पहले दकया जाएगा जहां से नया स्ट्टार स्ट्तर लाग ू होता ह;ै (ख) जहाूँ मौजूदा मॉडल को संिोजधत स्ट्टार स्ट्तर को प्रभािी बनाने के जलए जारी रखा जाता है, एक घोषणा केिल फॉमा II में ही ब्यूरो को प्रस्ट्तुत की जाऐगी।

NOTIFICATION New Delhi, the 10th June, 2022 No. BEE/S&L/Ref/70/2021-22.- The following draft of certain regulations which the Bureau with the previous approval of the Central Government proposes in supersession of the notification of the Government of India in the Ministry of Power, published in the Gazette of India, Extraordinary, Part II,

Section 3, Sub-section (ii), vide number S.O. 183(E), dated the 12th January, 2009 and S.O. 1899 (E), dated the 26th May, 2016 except as respects things done or omitted to be done before such supersession, that is the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Refrigerators) Regulations, 2022, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), is hereby published as required by sub-section (1) of section 58 of the said Act for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public;

Objections or suggestions, if any, may be addressed to the Director-General of Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, R.K.Puram, Sector-1, New Delhi-110066;

Objections or suggestions which may be received from any person with respect to the said draft regulations before the expiry of the period of thirty days specified in para 1 above shall be taken into consideration by the Bureau of Energy Efficiency.

1. Short title and commencement. -(1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Refrigerators) Regulations, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition: - (1) In these regulations, unless the context otherwise requires,-

(a) “Act‖ means the Energy Conservation Act, 2001(52 of 2001);

(b) ―refrigerators‖ means an appliance as specified in the notification under clause (b) of section 14 of the Act;

(c) ―Form‖ means a form appended to these regulations;

(d) ―label‖ means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon, refrigerator;

(e) ―label period‖ means the validity period of the comparative electricity consumption under energy consumption standard notified by the Central Government under clause (a) of section 14 and in case the end period of the validity period of the comparative electricity consumption30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] is not notified, it shall be deemed to be valid until new values for the same are notified by the Central Government;

(f) ―models or family of models‖ means the model or range of models of one particular brand, to which a single set of test reports is applicable and where each of the models has the same physical characteristics, annual electricity consumption, energy efficiency level and performance characteristics;

(g) ―permitee‖ means a person or agency to whom permission has been granted to affix label under regulation 7;

(h) ―star rating or star level‖ means the grade of energy efficiency displayed on the label of the refrigerator based on energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act to denote the comparative electricity consumption of refrigerator;

(i) ―trader or seller‖ in relation to any labelled refrigerator means a person who sells or distributes any such refrigerator and includes the shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such refrigerator.

(j) ―Schedule‖ means the Schedule annexed to these regulations;

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label. - (1) On every refrigerator, the following particulars shall be displayed on its label, namely:-

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand;

(c) appliance type;

(d) total Volume;

(e) model number and year of manufacturing or import;

(f) unique series code;

(g) electricity consumption in units per year;

(h) star level; and

(i) label period.

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels: - (1) A label containing all the particulars specified in regulation 3 shall be displayed on every refrigerator within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller shall ensure that-

(a) the refrigerator put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing years of the refrigerator shall also be in synchronization with such revised energy consumption standards and shall not produce the refrigerator with the previous energy consumption standards;

(b) All preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers shall be well planned and taken six months in advance of the date of such commencement, under these regulations.[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 31

5. Manner of display of label.-(1) On every refrigerator, shall be displayed label along with QR code at the point of sale and such label shall be affixed on the refrigerator in the following manner, namely:-

(a) self-adhesive label along with QR code affixed on the front side of the upper right portion of refrigerator;

(b) self-adhesive label along with QR code affixed on the front side of the carton box.

(2) For refrigerator not on display, the label may be affixed to the exterior of the packing and the label may be attached to the unit when put on sale.

6. Permission for display of label. - (1) No star label shall be affixed on a refrigerator without obtaining the prior permission of the Bureau.

(2) Company registration.- For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees, payable by electronic mode of payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only.

(3) Model registration.- Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by electronic mode of payment; and

(b) documents specified in Form I – (B).

7. Grant of permission.- (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its Manual on standards and labelling, subject to such terms and conditions as specified in regulation 8, –

(a) register the brand in Form II-(A) in electronic form; and

(b) grant permission for affixing label on refrigerator in Form II-(B) in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 is in force.

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee from six months but not later than three months before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

In case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the refrigerator from the date from which the revised star level comes into force shall submit only a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the refrigerator is planned to be launched to synchronise with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely:-

(a) the star level displayed on the label of refrigerator shall conform to energy consumption standards for refrigerator notified by the Central Government under clause (a) of section 14 of the Act;

(b) the label shall be affixed only on such model of refrigerator for which permission has been granted;

(c) the label shall be printed and affixed on the refrigerator at the cost of permittee;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of refrigerator shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year;

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Operation Manual on Standards and Labelling.

9. Label fee.- (1) Every permittee shall pay to the Bureau a label fee of five rupees for each label affixed on the refrigerator.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from

the date of closure of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security fee made under clause (b) of sub-regulation (3) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of label security fee.- Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture refrigerator.

11. Verification by Bureau.- (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the refrigerator conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purpose of verification, samples shall be picked up at random by Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit and shall be subjected to a) energy consumption test b) Total volume and c) Pull down test.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the refrigerator in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories, a notice shall be issued to the permittee for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau, and if the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited.

(4) Where samples of refrigerator used for testing fails the test during suo motu testing or challenge testing, the permittee shall be offered another opportunity and the Bureau shall conduct second test with twice the quantity of refrigerator used in the first test in an independent test[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 33 laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee. The Bureau shall intimate the permittee in Form V to witness the challenge testing referred to in sub-regulation (3) or the second test referred to in sub- regulation (4) and the expenses to be made towards the procurement and testing of sample.

(5) Where the second test fails, the Bureau shall,-

(a) direct the permittee in Form VI, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label of the refrigerator or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months;

(c) Intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(6) The permittee shall within ten days of the conclusion of the period of two months referred to in sub- regulation (5),-

(a) send the compliance report in Form VII to Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non-compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub-regulation (6) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause

(b) of the said sub-regulation.

(8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall,-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (6) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months;

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission.- The Bureau may cancel the permission granted under regulation 7, if the permittee –

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(c) does not comply with the direction issued under regulation 11.

The Bureau, under Regulation … of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Refrigerator) Regulations, 2022, had purchased a Bureau of Energy Efficiency star labelled refrigerator from your authorised Distributor, dealer, retailer vide Invoice number .......dated for a price of Rs................ and lifted as a sample dated ……by M/s......................, an agency appointed by the Bureau for verification of the particulars displayed on the label under regulation 3 of the aforesaid regulations, affixed by you on the aforesaid purchased refrigerator. The sample duly sealed by M/s............... bearing serial number……..was obtained from M/s..........(Name of the Distributor, dealer, retailer) under signatures of the duly authorised representative of the verification Agency.

3. The Bureau through its aforesaid Verification Agency had transported the sample referred to in para 2 to M/s. ..................., a National Accreditation Board for Testing and Calibration Laboratories accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 4 and 5 of S.O.number ……dated the …. for giving Test Report in accordance with the Form ….given in Annexure to S.O.. number…….. dated the ……..

4. The results of the Test Report on the sample bearing Unique Identification serial number is enclosed. The results of the Test Report indicated that the sampled refrigerator failed to meet the electricity consumption in units per year, standard, specified total volume etc. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the Refrigerators manufactured/imported by you. The Test Results were sent to you vide Bureau of Energy Efficiency letter No... ..... dated........in the name of your authorised Contact person. You were also requested to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

5. The Sample for second check verification Test were picked up …. dated the …. through our authorised Agency M/s. ............and transported to the National Accreditation Board for Testing and Calibration Laboratories accredited Laboratory transported by our authorised Agency, duly sealed by50 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] M/s............... and was given Unique Identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification Agency as well as your representatives.

6. The Test results of second check testing are enclosed which are dully checked and counter signed by the competent authorised personnel of the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing. The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O.number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Refrigerators manufactured/imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Refrigerator) Regulations, 2022, the Bureau hereby directs to :-

(i) correct the star level displayed on the label of the Refrigerators or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by .............. .In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b) of sub-regulation (6) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Refrigerator) Regulations, 2022.

9. The Bureau shall take further follow up action in the matter in terms of regulations (5) (6)(7) and (8) of regulation 11 of the Bureau of Energy Efficiency( Particulars and Manner of their Display on Labels of Refrigerator) Regulations, 2022.
