1. संि’Rत नाम और .ारंभ :::: ----(1) इन िविनयम(cid:16) का सिं ’Rत नाम ऊजा" द’ता (cid:28)यूरो ()ूबलु र *लोरसट(cid:27) लै(cid:9)प(cid:16) पर उनके .दश"न का िववरण और रीित), संशोधन िविनयमन, 2019 ह।ै

(2) ये सरकारी राजपF म (cid:27)उनके अिं तम .काशन क5 तारीख से .वSृ त ह(cid:16)गे।

2. उAत अिधसूचना म,(cid:27)-

(i) िविनयम (6) के उप-िविनयम (2) को इस .कार .ितT थािपत (cid:4)कया जाएगा;

5758 GI/2019 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] “(2) उप-िविनयम (1) के अधीन (cid:28)यरू ो क5 अनमु ित .ाG करने के .योजन के िलए, अनुUाधारक को हर Vांड के िलए अलग स े पंजीकरण करान े के िलए .Wप 1 के अनसु ार ऑनलाइन आवेदन करना होगा, एक लाख Xपए का लेबल .ितभिू त शु(cid:6)क देय होगा, जो केवल भुगतान के (cid:4)कसी भी Tवीकाय" इलेAYॉिनक मोड ;ारा दये होगा;

बशत[ (cid:4)क लघु उKोग के िलए लेबल सुर’ा शु(cid:6)क प\ीस हजार Xपए होगा; "

(ii) िविनयमन (6) के उप-िविनयम (3) के खंड (क) और (ख) को इस .कार .ितTथािपत (cid:4)कया जाएगा; “(क) भुगतान के (cid:4)कसी भी Tवीकाय " इलेAYॉिनक मोड ;ारा दये .ित मॉडल दो हजार Xपए का आवेदन शु(cid:6)क; “(ख) ऑनलाइन आवेदन जमा करते समय पोट"ल पर .Wप I म (cid:27)िनOद]" दTतावेज अपलोड (cid:4)कया जाए;

िजसम,(cid:27) ऑनलाइन आवेदन, .पF I और अ(cid:25)य दTतावेज(cid:16) क5 हाड " कॉपी को ऊजा" द’ता (cid:28) यूरो के काया"लय को भेजना आव^यक नही ह;ै बशत[, इस तरह के हर दTतावजे को िविधवत सीलबंद Wप म (cid:27) और मुहर लगाकर ऑनलाइन आवेदन जमा करते समय पोट"ल पर अपलोड (cid:4)कया गया हो।

(iii) िविनयम (7) के उप-िविनयम (4) को इस .कार .ितT थािपत (cid:4)कया जाएगा; “(4) नवीकरण अनमु ित के िलए अनुUाधारक इसके समाR त होने के छह महीने से पहल,े ले(cid:4)कन इसक5 समािG स े तीन महीन े पहल े नह_, आवेदन करेगा, और (cid:4)कसी भी Tवीकाय " इलेAYॉिनक मोड ;ारा दये एक हजार Xपए के शु(cid:6)क के साथ होगा।”

(iv) )ूबुलर *लोरस(cid:27)ट लै(cid:9)प क5 अनसु ूची के िलए पैरा (1) के उप परै ा (i) के खंड (क) का िवलोपन (cid:4)कया जाए;

(v) )ूबुलर *लोरस(cid:27)ट लै(cid:9)प क5 अनुसूची के िलए परै ा (1) के उप परै ा (i) के खंड (ख) को .ितT थािपत (cid:4)कया जाएगा िजस ेअब (क) के समान माना जाएगा; (क)

(i) बाहरी केaसंग/ Tल ीव पर लगाए जान ेवाल ेलेबल के आयाम (cid:1)(cid:1)(cid:1)(cid:1)टटटट(cid:3)(cid:3)(cid:3)(cid:3)पप पप णणणणीीीी :::: बाहरी के(cid:3)संग के आकार के अनसु ार लेबल के आयाम अपे(cid:9)ाकृत कम हो सकते ह,(cid:13) बशत(cid:17) लेबल के पहलू अनुपात समान बने रह।(cid:19)

(ii) )ूबुलर *लोरोस(cid:27)ट ल,प पर म(cid:31)ु ाकं न करन ेके िलए लेबल का आकार¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 (cid:1)(cid:1)(cid:1)(cid:1)टटटट(cid:3)(cid:3)(cid:3)(cid:3)पप पप णणणणीीीी :::: लेबल के आयाम(cid:24) को (cid:25)ूबलर (cid:28)लोरोस(cid:19)ट ल(cid:13)प के (cid:31)ास के अनसु ार अपे(cid:9)ाकृत कम कया जा सकता ह,ै बशत(cid:17) लेबल के पहलू अनुपात समान बने रह।(cid:19)

(iii) )ूबुलर *लोरस(cid:27)ट लै(cid:9)प क5 अनुसूची के िलए परै ा (1) के उप पैरा (ii) के खंड (क) का िवलोपन (cid:4)कया जाएगा;

(iv) )ूबुलर *लोरस(cid:27)ट लै(cid:9)प क5 अनसु ूची के िलए पैरा (1) के उप पैरा (ii) के खंड (ख) को इस .कार .ितTथ ािपत (cid:4)कया जाएगा, िजस ेअब (क) के समान माना जाएगा; (क)

(v) .Wप II के अनलु cन क म(cid:27) परै ा 3 के उप परै ा (1) के खंड (क), का िवलोपन (cid:4)कया जाएगा;

NOTIFICATION New Delhi, the 6th November, 2019 No. BEE/S&L/TFL/63/2019-20.—The following draft of certain regulations which the Bureau, with the previous approval of the Central Government proposes to amend, that is the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2018, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), is hereby published as required by sub-section (1) of section 58 of the said Act for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public;

Objections or suggestions, if any, may be addressed to the Director-General of Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, R.K.Puram, Sector-1, New Delhi-110066;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] Objections or suggestions which may be received from any person with respect to the said draft regulations before the expiry of the period of thirty days specified in para 1 above shall be taken into consideration by the Bureau of Energy Efficiency.

1. Short title and commencement.- (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps), Amendment Regulations,

2019.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the said notification,-

(i) Sub-regulation (2) of Regulation (6) shall be substituted as; “(2) For the purpose of obtaining permission of the Bureau under sub-regulation (1), permittee shall make online application as per Form I to register himself for every brand separately, accompanied by a label security fee of rupees one lakh, payable only by any acceptable electronic mode of payment:

Provided that the label security fee for small scale industry shall be twenty-five thousand rupees;”

(ii) Clause (a) and (b) of sub-regulation (3) of regulation (6) shall be substituted as; “(a) an application fee of two thousand rupees per model, payable by any acceptable electronic mode of payment; “(b) documents specified in Form I to be uploaded on portal while submitting application online;

Wherein, no hard copy of the online application, Form I and other documents are required to be send to the office of Bureau of Energy Efficiency;

Provided, every such document, duly sealed and stamped has been uploaded on portal while submitting the application online.

(iii) Sub-regulation (4) of Regulation (7) shall be substituted as; “(4) The permittee shall apply for renewal of permission before six months but not later than three months before its expiry and shall be accompanied by a fee of one thousand rupees payable by any acceptable electronic mode of payment.”

(iv) Clause (a) of sub-para (i) of paragraph (1) for schedule of tubular fluorescent lamps shall be deleted;

(v) Clause (b) of sub-para (i) of paragraph (1) for schedule of tubular fluorescent lamps which shall now be re-called as (a) shall be substituted as;

(a)

(i) Dimension of the label to be affixed on outer casing/ sleeve

Note: The dimensions of label may be relatively reduced in accordance with the size of the outer casing,

provided the aspect ratio of the label shall remain the same.

(ii) Dimension of the label to be stamped on the tubular fluorescent lamp¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5

Note: The dimensions of label may be relatively reduced in accordance with the diameter of the tubular fluorescent lamp, provided the aspect ratio of the label shall remain the same.

(vi) Clause (a) of sub-para (ii) of paragraph (1) for schedule of tubular fluorescent lamps shall be deleted;

(vii) Clause (b) of sub-para (ii) of paragraph (1) for schedule of tubular fluorescent lamps which shall now be re-called as (a) shall be substituted as;

(a)

(viii) Clause (a) of sub-paragraph (1) of paragraph 3 in Annexure to Form II, shall be deleted;

(ix) Clause (b) of sub-paragraph (1) of paragraph 3 in Annexure to Form II which shall now be re-called as clause (a), shall be substituted as;

(a) The unique label series code provided in the letter has to be mentioned in the label affixed on the outer casing/ sleeve of the tubular fluorescent lamp.
