1. संि$Mत नाम और (cid:21)ारंभ :-(1) इन िविनयम(cid:16) का संि$M त नाम ऊजा द$ता (cid:27) यूरो (कलर टेलीिजवन के लेबल(cid:16) पर उनके (cid:21)दश न क’ िविशिNयां और रीित) िविनयम, 2015 ह।ै

(2) ये राजप> म? इनके अंितम (cid:21)काशन क’ तारीख को (cid:21)वृO त ह(cid:16)गे।

2. प,रभाषा :- (1) इन िविनयम(cid:16) म?, जब तक (cid:1)क संदभ म? अ(cid:30) यथा अपेि$त न हो,- (क) “अिधिनयम” से ऊजा संर$ण अिधिनयम, 2001 (2001 का 52) अिभ(cid:21)ेत ह;ै 4368 GI/2015 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ख) “कलर टले ीिवजन” से अिधिनयम क’ धारा 14 के ख) ड (ख) के अधीन अिधसूचना म? यथािविनQदJ ट उपसाधन अिभ(cid:21)ेत ह;ै (ग) “(cid:21)(cid:22)प” से इन िविनयम(cid:16) के साथ संलR न (cid:21)(cid:22)प अिभ(cid:21)ेत ह;ै (घ) “लेबल” से कलर टेलीिवजन पर लगाया गया या (cid:21)दSशत कोई िलिखत, मु(cid:1)(cid:31)त, िचिTनत, मुहर लगी या Uा(cid:1)फक सामUी अिभ(cid:21)ेत है;

(ङ) “लेबल अविध” से धारा 14 के ख)ड (क) के अधीन के(cid:30)(cid:31) ीय सरकार .ारा िविनQदJ ट ऊजा खपत मानक के अधीन तुलनाO मक ऊजा खपत क’ िविधमा(cid:30)य ता अविध अिभ(cid:21)ेत ह ै और य(cid:1)द तुलनाOम क ऊजा खपत क’ िविधमा(cid:30) यता क’ अविध क’ अंितम अविध िविनQदJट नहW क’ गई है, तो उस अविध के िलए के(cid:30) (cid:31)ीय सरकार .ारा िविनQदJ ट नए मू(cid:3) य(cid:16) तक िविधमा(cid:30) य मानी जाएगी;

(च) “मॉडल या मॉडल(cid:16) का वग ” से (cid:1)कसी िवशेष Yा) ड का मॉडल या मॉडल(cid:16) क’ र?ज अिभ(cid:21)ेत ह ैिजसके संबंध म? जांच ,रपोटZ का एकल संवग (cid:21)यो[य ह ै और जहा ं (cid:21)O येक मॉडल के समान भौितक ल$ण, वाSषक िवHुत खपत, ऊजा द$ता $े>(cid:16) और िनJप ादन ल$ण समान ह;@ (छ) “अनु]ाधारक” से ऐसे 7य ि1 या ऐसी अिभकरण अिभ(cid:21)ेत ह ैिजसे िविनयम 7 के अधीन लेबल लगाने के िलए अनु]ा दी गई ह;ै (ज) “6ट ार रे^टग या 6ट ार लेबल” से कलर टेलीिवजन क’ तुलनाO मक िवHुत खपत को सूिचत करने के िलए अिधिनयम क’ धारा 14 के ख)ड (क) के अधीन अिधसूिचत ऊजा खपत मानक पर आधा,रत कलर टेलीिवजन के लेबल पर (cid:21)दSशत ऊजा द$ता का Uेड अिभ(cid:21)ेत है;

(झ) (cid:1)कसी लेबल लगे कलर टेलीिजवन के संबंध म? “7 यापारी या िव_ेता” से वह 7 यि1 अिभ(cid:21)ेत है जो ऐसे कलर टेलीिजवन क’ िब_’ या िवतरण करता ह ै और िजसम? ऐसे दकु ानदार, 7 यापारी, िविनमा ता और कलर टेलीिजवन पर लेबल लगाने के िलए अनुमित (cid:21)ाMत अनु]ाधारक सि(cid:19)मिलत ह@।

(2) उन श(cid:27)द (cid:16) और पद(cid:16) के जो इसम? (cid:21)यु(cid:8)त ह @और प,रभािषत नहW ह @(cid:1)क(cid:30) तु अिधिनयम म? प,रभािषत ह @वही अथ ह(cid:16)गे जो अिधिनयम म? _मश: उनके ह@।

3. लेबल पर (cid:21)दSशत क’ जाने वाली िविशिNयां। (1) (cid:21)O यके कलर टेलीिजवन पर िन(cid:19) निलिखत िविशिNयां (cid:21)दSशत क’ जाएंगी, अथा त् :- (क) ऊजा द$ता (cid:27)य ूरो का (cid:21)तीक िचTन; (ख) िविनमा ता या आयातक और Yा)ड का नाम;

(ग) स?टीमीटर म? 6 _’न साइज; (घ) िविनमा ण या आयात का मॉडल संaय ा और वष ; (ङ) उपकरण का (cid:21)कार (च) (cid:1)क. वॉ. घ)ट ा. (cid:21)ित वष म? वाSषक ऊजा क’ खपत (छ) 6ट ार 6त र; (ज) लेबल क’ अविध; और (झ) िविशJट cृंखला कोड;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3

(2) लेबल का िडजाइन, रंग, आकार और सामUी इन िविनयम(cid:16) से उपाबd अनुसूची म? यथा: िविनQदJ ट होगा।

4. लेबल(cid:16) के (cid:21)दश न के िलए समय-सीमा (1) िविनयम 3 म? िविनQदJ ट सभी िववरण वाला लेबल इन िविनयम(cid:16) के लागू होने क’ तारीख से छह मास क’ अविध के भीतर (cid:21)Oय ेक कलर टेलीिवजन पर (cid:21)दSशत (cid:1)कया जाएगा।

(2) के(cid:30)(cid:31) ीय सरकार .ारा अिधिनयम क’ धारा 14 के ख) ड (क) के अधीन ऊजा खपत मानक(cid:16) के (cid:21)ारंभ से ही (cid:21)O येक अनु]ाधारक या 7य ापारी या िव_ेता यह सु िनिfत करेगा (cid:1)क : - क) बाजार म? 6 टार 6त र को (cid:21)दSशत करने वाले पूव - संशोिधत लेबल वाले कलर टेलीिवजन का उपल(cid:27) ध 6 टॉक पूरी तरह समाMत हो गया है या इस पर पुन: लेबल लगाए गए ह @ या उस तारीख से पहले बाजार से वापस ले िलया गया ह ैिजस तारीख को संशोिधत 6 टार 6 तर (cid:21)वृO त ह;ै ख) िब_’ के िलए रखे गए कलर टेलीिवजन पुनरीि$त ऊजा खपत मानक(cid:16) के साथ सम_मण कर पुनरीि$त 6 टार 6त र और संशोिधत लेबल अविध भी (cid:21)दSशत कर?गे और ऐसे आरंभ से तीन मास पूव संशोिधत लेबल शु(cid:22) (cid:1)कए जाएं;

ग) डीलर(cid:16), खुदरा 7य ापा,रय(cid:16) को जानकारी दने े के िलए उनक’ जाग(cid:22)कता के साथ ही उपभो(cid:8) ताg को िशि$त करने के िलए अपेि$त (cid:21)चार-(cid:21)सार सिहत सभी (cid:21)ारंिभक उपाय इन िविनयम(cid:16) के अधीन ऐसे (cid:21)ारंभ क’ तारीख से छह मास पूव िनयोिजत और िनJप ा(cid:1)दत (cid:1)कए जाएंगे।

5. लेबल (cid:21)दSशत करने क’ रीित ---- (1) िब_’ 6थ ल पर (cid:21)O येक कलर टेलीिवजन पर लेबल (cid:21)दSशत (cid:1)कया जाएगा और ऐसे लेबल कलर टेलीिवजन पर िन(cid:19)न िलिखत रीित म? िचपकाए जाएगं े, अथा त्:- (क) या तो यह गैर िचपिचपे 6तर पॉप (cid:21)कार या एक h6वग टैग (,टकाऊ ग/े) के (cid:22)प म? यह सामने क’ ओर संलi (cid:1)कया जा सकता है;

(ख) पीछे क’ ओर लगाया 3आ 6व - आसंजक लेबल; और (ग) काटन बॉ(cid:8)स पर लगाया 3आ 6व - आसंजक लेबल।

(2) (cid:21)दSशत न (cid:1)कए गए कलर टेलीिवजन के िलए, लेबल पेkकग के बाहर लगाया जाए और जब इसे िब_’ के िलए रखा जाए तो यह लेबल इकाई के साथ लगाया जाए।

6. लेबल के (cid:21)दश न के िलए अनु]ा-(1) (cid:27)य ूरो क’ पूव अनु]ा (cid:21)ािA के िबना कलर टेलीिवजन पर कोई 6 टार नहW लगाया जाएगा।

(2) उप-िविनयम (1) के अधीन (cid:27)य ूरो क’ अनु]ा (cid:21)ाM त करने के (cid:21)योजन के िलए, आवेदन (cid:21)प> - I म? और इले(cid:8) lॉिनक (cid:22)प म? (cid:1)कया जाएगा; पर(cid:30)त ु कलर टेलीिवजन के (cid:21)Oय ेक मॉडल के िलए पृथक आवेदन (cid:1)कया जाएगा;

(3) उप- िविनयम (2) के अधीन (cid:21)Oय ेक आवेदन के साथ िन(cid:19) निलिखत लगे ह(cid:16)गे – (क) ऊजा द$ता (cid:27)य ूरो, नई (cid:1)द(cid:3)ल ी के प$ म? आह,रत िडमांड mाnट या संदाय के (cid:1)कसी इलै(cid:8) lािनक ढंग .ारा संदेय दो हजार pपए क’ आवेदन फ’स;

(ख) ऊजा द$ता (cid:27)य ूरो, नई (cid:1)द(cid:3) ली के प$ म? िडमांड mाnट .ारा संदये एक लाख pपए का लेबल (cid:21)ितभूित फ’स या संदाय (cid:1)कसी इले(cid:8) lािनक ढंग से। पर(cid:30)त ु लघु उHोग लेबल (cid:21)ितभूित फ’स केवल पq चीस हजार pपए होगी-; और (ग) (cid:21)(cid:22)प-1 म? िविनQदJट द6त ावेज ;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

7. अनु]ा क’ मंजूरी - (1) िविनयम 6 के अधीन (cid:21)ाM त आवेदन पर िवचार करने के पB चात् और यह समाधान हो जाने के पB चात् (cid:1)क उसम? सभी अपे$ाg का पालन (cid:1)कया गया ह।ै (cid:27)य ूरो इस (cid:21)कार (cid:21)ािA क’ तारीख से एक मास क’ अविध के भीतर, िविनयम 8 म? िविनQदJ ट ऐसे िनबंधन(cid:16) और शतZ के अrय धीन (cid:21)(cid:22)प-2 या इले(cid:8)l ॉिनक (cid:21)(cid:22)प म? कलर टिे लिवजन पर लेबल िचपकाने के िलए आवेदक को अनु]ा जारी करेगा।

(2) (cid:27)य ूरो, (cid:21)(cid:22)प 3 म? रिज6ट र रखेगा और उसम? अनु]ाधारक का नाम रिज6 टर करेगा;

(3) उपिविनयम (1) के अधीन इस (cid:21)कार मंजूर क’ गई अनु]ा ऐसी अविध के िलए िविधमा(cid:30) य होगी िजस तक के(cid:30)(cid:31) ीय सरकार .ारा धारा 14 के ख)ड (क) के अधीन यथा: अिधसूिचत ऊजा खपत मानक .ारा िविनQदJ ट 6 टार 6 तर (cid:21)वृO त ह;ै

(4) अनु]ा के नवीकरण के िलए कोई आवेदन छह मास के भीतर kकतु इस अविध क’ समािA से कम से कम तीन मास पूव (cid:1)कया जाएगा। और उसके साथ ऊजा द$ता (cid:27)य ूरो, नई (cid:1)द(cid:3) ली के प$ म? आह,रत िडमांड mाnट म? या संदाय के इले(cid:8) lॉिनक ढंग .ारा संदये एक हजार pपए क’ फ’स लगी होगी;

5) िविधमा(cid:30)य ता अविध क’ समािA के पB चात् (cid:1)कसी आवेदन को नवीकृत (cid:1)कया जाएगा, ऐसे मामले म? अनु]ाधारक नया आवेदन करेगा;

(6) उप- िविनयम (4) के अधीन नवीकरण के िलए आवेदन क’ (cid:21)ािA पर और सभी अपे$ाएं पूरी होने के संबंध म? संतुJ ट होन े पर, (cid:27)य ूरो ऐसा आवेदन (cid:21)ाMत होने क’ तारीख से एक मास क’ अविध के भीतर (cid:21)(cid:22)प-II म? अनु]ा का नवीकरण कर सकता ह;ै

(7) जो अनु]ाधारक उस तारीख से कलर टेलीिवजन के िवHमान मॉडल पर लेबल िचपकाने को जारी रखने क’ अनु]ा क’ मांग करता है, िजस तारीख से संशोिधत 6ट ार 6त र (cid:21)वृO त 3आ ह,ै केवल (cid:21)(cid:22)प 4 म? एक घोषणा (cid:21)6 ततु करेगा;

(8) य(cid:1)द कलर टेलीिवजन के नए मॉडल क’ योजना संशोिधत 6 टार लेबल के साथ ताल-मेल िबठाकर शु(cid:22) करने क’ है तो अनु]ाधारक को नया लेबल िचपकाने क’ अनु]ा लेनी होगी और ऐसी अनु]ा के िलए आवेदन संशोिधत 6 टार लेबल के (cid:21)वृO त होने से छह मास पूव (cid:1)कया जाए।

8. लेबल पर िविशिNय(cid:16) को (cid:21)दSशत करने के िलए बंधन और शतs:- (cid:21)O येक अनु]ाधारक और 7 यापारी और िव_ेता लेबल पर िविशिNय(cid:16) को (cid:21)दSशत करने के िलए िन(cid:19)न िलिखत िनबंधन(cid:16) और शतZ का पालन करेगा, अथा त्:- (क) कलर टेलीिवजन के लेबल पर (cid:21)दSशत 6 टार लेबल अिधिनयम क’ धारा 14 के ख) ड (क) के अधीन के(cid:30) (cid:31)ीय सरकार .ारा अिधसूिचत कलर टेलीिवजन के िलए ऊजा खपत मानक(cid:16) के अनु(cid:22)प ह(cid:16)गे; ;

(ख) यह लेबल कलर टेलीिवजन के ऐसे मॉडल(cid:16) पर ही िचपकाया जाएगा िजसके िलए अनु]ा ली गई ह;ै (ग) लेबल को अनु]ाधारक क’ लागत पर मु(cid:1)(cid:31)त और कलर टले ीिवजन पर िचपकाया जाएगा; (घ) अनु]ाधारक, 7य ापारी और िव_ेता यह सुिनिfत करेगा (cid:1)क कलर टेलीिवजन पर लेबल पर (cid:21)दSशत 6 टार लेबल हर समय बना रहगे ा;

(ङ) अनु]ाधारक िविनयम 9 म? यथा: िविनQदJ ट लेबल शु(cid:3) क का भुगतान करेगा; (च) अनु]ाधारक (cid:27)य ूरो को िववरण मुहयै ा करेगा िजसम? लेबल लगे उपकरण(cid:16) को बनाने का (cid:27) यौरा और िव/ीय वष क’ (cid:21)O यके ितमाही के अंत म? िन(cid:19)न िलिखत मास के भीतर (cid:21)O येक ितमाही के िलए दये (cid:21)ोtभूत ल बे hलग शु(cid:3) क का िववरण हो;

(छ) अनु]ाधारक, (cid:27)य ूरो को अपने लेबल लगे उO पाद(cid:16) क’ िब_’ के िलए िनयु(cid:8) त (cid:21)O यके वष 30 अ(cid:21)ैल को (cid:21)ािधकृत िवतरक(cid:16), डीजर(cid:16) और थोक िव_ेताg एवं िव_ेताg क’ सूची मुहयै ा करेगा;

(ज) अनु]ाधारक, 7य ापारी और िव_ेता ऐसे अ(cid:30) य िनबंधन(cid:16) और शतZ का पालन कर?गे िजसे (cid:27) यरू ो, मानक और लेबhलग के संबंध म? (cid:27)य ूरो क’ िनयम पुि6तका म? िविनQदJट (cid:1)कए गए ह(cid:16);

9. लेबल फ’स- (1) (cid:21)Oय ेक अनु]ाधारक, (cid:27)य ूरो को कलर टेलीिवजन पर (cid:21)O येक िचपकाए गए लेबल के िलए 10 pपए का लेबल फ’स भुगतान करेगा।¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5

(2) उप-िविनयम (1) के अधीन िविनQदJट लेबल फ’स, (cid:21)O येक िव/ीय वष क’ अंितम तारीख स ेएक मास के भीतर वाSषक (cid:22)प से संदाय क’ जाएगी; परंतु इस (cid:21)कार िविनQदJट अविध के भीतर लेबल फ’स संदाय करने म? असफल रहने पर िविनयम 6 के उपधारा 3 के खंड ख के अधीन (cid:27)य ूरो लेबल (cid:21)ितभूित फ’स से (cid:21)ितवष दस (cid:21)ितशत (cid:27) याज सिहत संदO त शोr य रकम वसूल कर सकेगा। य(cid:1)द इसे जमा (cid:1)कए जाने क’ अंितम तारीख से एक मास के भीतर पूरा लेबhलग फ’स वसूल नहW (cid:1)कया जाता तो (cid:27) यूरो अनु]ाधारक को 6 वीकृत सभी लेबल रu कर सकता ह ै और अनु]ाधारक का नाम 7य ि1_म करने वाले के (cid:22)प म? समाचार प> म? (cid:21)कािशत कर सकता ह।ै

10. लेबल (cid:21)ितभूित फ’स का (cid:21)ितदाय :- िविनयम 9 के उप-िविनयम (2) के पर(cid:30) तुक के अr यधीन, अनु]ाधारक कलर टेलीिवजन का िविनमा ण बंद करने पर लेबल (cid:21)ितभूित फ’स का (cid:21)ितदाय का हकदार होगा।

11. (cid:27)य ूरो .ारा सOय ापन---- (1) (cid:27)य ूरो या उसक’ नामिनQदJ ट अिभकरण, 6 व(cid:21)ेरणा से या उसे िशकायत (cid:21)ाM त होने पर, यह सुिनिfत करने के िलए सOय ापन करेगा (cid:1)क कलर टले ीिवजन इसके लेबल पर (cid:21)दSशत 6 टार लेबल और अ(cid:30) य िविशिNय(cid:16) के अनु(cid:22)प है और यह (cid:1)क वह अनु]ा के अ(cid:30)य िनबंधन(cid:16) और शतZ के अनुपालन म? ह।ै

(2) सOय ापन के (cid:21)योजन के िलए, (cid:27)य ूरो या िविनमा ता सुिवधा से उसक’ नामिनQदJ ट अिभकरण .ारा जैसे वह उिचत समझ,े भ) डारगृह या फुटकर िव_य के(cid:30)(cid:31) से यादिृqछक तौर पर स(cid:19) यक (cid:22)प से नमूने एक> करेगा;

(i) कलर टले ीिवजन के लेबल पर सही 6 टार लेबल (cid:21)दSशत करेगा या परी$ण के दौरान पायी गई >ु,टय(cid:16) और ख़ािमय(cid:16) को दरू करेगा;

(ii) (cid:27)य ूरो के (cid:1)दशा-िनदxश(cid:16) के अनुपालन म? बाजार से सभी 6 टॉक को वापस लेगा; और

(iii) िव]ािपत सामUी पर (cid:21)दSशत िविशिNय(cid:16) म? प,रवत न करेगा। (ख) उपभो(cid:8)त ाg के लाभ के िलए, दो मास के भीतर अनु]ाधारक का नाम, Yा) ड का नाम, मॉडल का नाम अथवा मॉडल संa या, (cid:21)तीक िचTन और अ(cid:30)य िविनदशे (cid:1)कसी राJ lीय या $े>ीय दिैनक समाचारप> या इले(cid:8) lोिनक साधन अथवा जैसा उिचत समझे (cid:1)कसी अ(cid:30)य रीित से (cid:21)कािशत करेगा;

2. यह अनुमित िनमन ् िलिखत के अधय ् धीन ह ै— (क) कलर टिेलिवजन के लेबल पर दशा(cid:4)या गया सटार स् तर अिधिनयम क- धारा 14 के खण् ड (क) के अधीन कलर टेिलिवजन के िलए अिधसूिचत ऊजा(cid:4) खपत मानक# और उि(cid:25)लिखत िनबंधन#/िविनयम# म0 (cid:24)दए गए िनबंधन# व शतV को पूरा करता हो;

(ख) लेबल कलर टिेलिवजन के उस मॉडल पर ही िचपकाया जाएगा िजसके िलए अनुमित +दान क- गई ह;ै (ग) लेबल, अनुMाधारक क- लागत पर मु(cid:24)fत और कलर टेिलिवजन पर िचपकाया जाएगा; (घ) अनुMाधारक यह सुिनिOत करेगा (cid:24)क कलर टिेलिवजन पर +द5शत स ट् ार स् तर हमेशा बना रहगे ा;

NOTIFICATION New Delhi, the 9th October, 2015 No.BEE/S&L/CTV/02/2015-16.—The following draft of certain regulations, which the Bureau, with the previous approval of the Central Government, proposes to make in exercise of the powers conferred by clause (d) of

section 14 read with clause (i) of sub-section (2) of section 58 and clause (n) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), is hereby published as required by sub-section (1) of section 58 of the said Act for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of forty-five days from the date on which copies of this notification as published in the Official Gazette are made available to the public;

Objections or suggestion, if any, may be addressed to Director-General of Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhavan, R.K.Puram, Sector-1, New Delhi-110 066.

Any objection or suggestion which may be received from any person with respect to the said draft regulations before the expiry of the aforesaid period shall be taken into consideration by the Bureau.

Draft Regulations

1. Short title and commencement.-(1)These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Colour Televisions) Regulations, 2015.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. Definition.- (1) In these regulations, unless the context otherwise requires,-

(a) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “colour television” means an appliance as specified in the notification under clause (b) of section 14 of the Act;

(d) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon, Colour Television;

(e) “label period” means the validity period of the annual energy consumption under energy consumption standard specified by the Central Government under clause (a) of section 14 and in case the end period of the validity period of the annual energy consumption is not specified, it shall be deemed to be valid until new values for the same are specified by the Central Government;

(f) “models or family of models” means the model or range of models of one particular brand, to which a single set of test reports is applicable and where each of the models has the same physical characteristics, annual energy consumption, energy efficiency rating and performance characteristics;

(g) “permitee” means a person or agency to whom permission has been granted to affix label under regulation 7;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 19

(h) “star rating or star level” means the grade of energy efficiency displayed on the label of the colour television based on energy consumption standard notified under clause (a) of section 14 of the Act to denote the annual energy performance of colour televisions;

(i) “trader or seller” in relation to any labelled colour television means a person who sells or distributes any such colour television and includes the shopkeeper,trader, manufacturer and permittee who has been given permission to affix label on such colour television.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on the label.- (1) On every colour television the following particulars shall be displayed on its label, namely:-

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand;

(d) model number and year of manufacturing or import;

(e) equipment type;

(f) annual electricity consumption in kWh per year;

(g) star level;

(h) label period; and

(i) unique series code.

(2) The design, colour, size and content of label shall be as specified in the schedule annexed to these regulations.

4. Time limit for display of labels.-(1) A label containing all the particulars specified in regulation 3 shall be displayed on every colour television within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller shall ensure that-

(a) the stock of colour television available in the market with pre-revised label displaying the star level is fully exhausted or re-labelled or withdrawn from the market before the date from which the revised star level comes into force;

(b) the colour television put on sale shall also display revised star level and revised label period synchronizing with the revised energy consumption standards and introduce revised label period three months prior to such commencement;

(c) all the preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers shall be well planned and taken six months in advance of the date of such commencement under these regulations.

5. Manner of display of label.-(1) On every colour television, shall be displayed label at the point of sale and such label shall be affixed on the colour television in the following manner, namely:-

(a) either non-sticky level pop type or it may be attached as a swing tag (Durable cardboard ) on the front side;

(b) self-adhesive label affixed on the back side; and

(2) For colour televisions not on display, the label may be affixed to the exterior of the packing and the label may be attached to the unit when put on sale.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

6. Permission for display of label.-(1) No star label shall be affixed on a colour television without obtaining the prior permission of the Bureau.

(2) For the purpose of obtaining permission of the Bureau under sub-regulation (1) an application shall be made in Form-I and in electronic form:

Provided that separate application shall be made for each model of colour television.

(3) Every application under sub-regulation (2) shall be accompanied by –

(a) an application fee of rupees two thousand shall be payable by demand draft in favour of Bureau of Energy Efficiency, New Delhi or by any acceptable electronic mode of payment;

(b) a label security fee of one lakh rupees payable by demand draft in favour of the Bureau of Energy Efficiency, New Delhi; or by any acceptable electronic mode of payment:

Provided that in case of small scale industry label security fee shall be only twenty five-thousand rupees; and

7. Grant of permission.-(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period of one month from the date of such receipt, grant, subject to such terms and conditions as are specified in regulation 8, permission for affixing label on colour television in Form II or in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 is in force.

(4) An application for renewal of permission shall be made by the permittee from six months but not later than three months before its expiry and shall be accompanied by a fee of one thousand rupees payable in the form of demand draft or electronic mode in favor of the Bureau of Energy Efficiency, New Delhi.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall apply a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II.

(7)The permittee who seeks permission for continuance to affix label on the existing model of the colour television from the date from which the revised star level comes into force shall submit only a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the colour television is planned to be launched to synchronize with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label. – Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely:-

(a) the star level displayed on the label of colour television shall conform to energy consumption standards for colour television notified by the Central Government under clause (a) of section 14 of the Act ;

(b) the label shall be affixed only on such model of colour television for which permission has been granted;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of colour television shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 21

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year;

(h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Manual on Standard and Labelling.

9. Label fee.-(1) Every permittee shall pay to the Bureau a label fee of ten rupees for each label affixed on the colour television.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of

closure of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit made under clause (b) of sub- regulation (3) of regulation 6 and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of label security deposit.- Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture colour television.

11. Verification by the Bureau - (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the colour television conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purpose of verification, samples shall be picked up at random by Bureau or its designated agency from the manufacturing facility, warehouse or the retail oulet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge the colour television testing in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories(NABL), a notice shall be issued to the permittee for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau, and if the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges shall be reimbursed by the permittee to the Bureau and Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then the expenses deposited by the complainant shall stand forfeited.

(4) Where samples of colour television used for testing fails the test during suo-motu testing or challenge testing, the permittee shall be afforded another opportunity and the Bureau shall conduct a second test with twice the quantity of colour television used in the first test in an independent test laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories(NABL) at the cost of the permittee.

(5) Where the second test fails, the Bureau shall,-

(a) direct the permitte in Form V, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months ,-

(i) correct the star level displayed on the label of the Colour Television or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months;

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(6) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub-regulation (5),-

(a) send the compliance report in Form VI to the Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non-compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub- regulation (6) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.

(8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall,-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred in clause (a) of sub-regulation

(6) for consideration and taking action under clause (c) of section 14 of EC Act by the Central Government;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner it deems fit within two months;

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission.-The Bureau may cancel the permission granted under regulation 7, if the permittee –

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

1. Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of display of Label on Colour Televisions) Regulations, 2015, the Bureau hereby permits you to affix label on the colour televisions as per details of approvals set out in the Annexure to this letter.

2. This permission is subject to—

(a) the star level displayed on the label of the colour television shall conform to energy consumption standards for colour television notified under clause (a) section 14 of the Act and terms and conditions provided in the aforesaid regulations;

(b) the label shall be affixed only on such model of colour television for which permission has been granted;

(d) the permittee shall ensure that the star level displayed on the colour television shall be maintained at all time ;

(e) the permittee shall pay the label fee of ten rupees per label;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of the close of each quarter of the financial year. The same details shall be furnished to the Bureau also through automated systems;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 27

(g) the permittee shall make available such other details of colour television as and when sought by the Bureau for which the permission has been granted.

3. This permission shall be valid for from ……… to ……… and may be renewed as prescribed. The permittee shall not withdraw the colour television from the market during the validity period of permission except with the prior approval of the Bureau.

5. where the star level plan is on review is modified by the Central Government, the star level of the

colour television shall stand modified as follows:-

(a) if new model is launched synchronizing with the revised star level, an application for such permission shall be made to Bureau six months in advance of the date from which new star level comes in to force;

(b) where the existing model is continued to give effect to the modified star level, only a declaration in Form IV shall be submitted to the Bureau.

The results of the Test Report indicated that the sampled colour television failed to meet the energy consumption standard, specified standby mode power, on mode power etc. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the colour television manufactured/imported by you. The Test Results were sent to you vide BEE letter No... ..... ………dated..................in the name of your authorised Contact person . 7. In exercise of the power conferred clause (a) of sub-regulation (5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of display of Label on Colour Televisions) Regulations, 2015, you are hereby directed to

comply with the following:

(i) correct the star level displayed on the label of the colour television or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by ............. .In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of sub-regulation

(6) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of display of Label on Colour Televisions) Regulations, 2015.

9. The Bureau shall take further follow up action in the matter in terms of regulations (5), (6), (7) and (8) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of display of Label on Colour Televisions) Regulations, 2015.
