(1) द्वारा आिश्यक रूप से प्रकाजित दकया िाता ै; और एतद्द्वारा नोठिस ददया िाता ै दक उि मसौदा जिजनयमों पर या उस तारीख से तीस ददनों की अिजध समाप्त ोने के बाद जिचार दकया िाएगा जिस तारीख को इस अजधसूचना के रािपत्र की प्रजतयां सािािजनक की िाती ैं;

आपज‍ तयां या सुवाि, यदद कोई ों, म ाजनदिे क, ऊिाा दक्षता ब्य ूरो, जिद्युत मंत्रालय, चौथी मंजिल, सेिा भिन, आर.के. पुरम, सेरिर-1, नई ददल्ली-110066 को संबोजधत दकया िाए; उपयुार त पैरा 1 में जनर्दष्टा तीस ददनों की अिजध समाप्त ोने से प ले उि मसौदा जिजनयमों के संबंध में दकसी भी व्यजि से प्राप्त आपज‍ तयों या सुवािों पर ऊिाा दक्षता ब्यूरो द्वारा जिचार दकया िाएगा।

1. लघ ु िीर्का और प्रारंभ.—(1) इन जिजनयमों को ऊिाा दक्षता ब्यूरो (इलेजररक सीललंग िाइप फैन के लेबल पर उनके 3672 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] प्रदिान का जििरण और तरीका) जिजनयम, 2021 क ा िाएगा।

(2) ये सरकारी रािपत्र में उनके प्रकािन की तारीख को लागू ोंगे।

2. पठरभार्ाएं.- (1) इन जिजनयमों में, िब तक दक संदभा में अन् यथा अपेजक्षत न ो, (क) "अजधजनयम" का अथा ैऊिाा संरक्षण अजधजनयम, 2001 (2001 का 52); (ख) "मॉडल पठरिार" का अथा ैमॉडल का समू जिसके जलए सभी जनष् पादन मापदडं समान ;ैं (ग) "प्रपत्र" का अथा ैइन जिजनयमों के साथ संलग्न प्रपत्र;

(घ) "लेबल" का अथा ै दकसी भी जलजखत, मुदद्रत, जचजननत, मु र लगा या जचपके हुए ग्रादफक पदाथा के रूप में, या इलेजररक सीललंग िाइप फैन पर प्रदर्िात; (ड.) "लेबल अिजध" का अथा ै अजधजनयम की धारा 14 के खंड (क) के त त केंद्र सरकार द्वारा अजधसूजचत ऊिाा खपत मानक के त त सेिा मूल्य की िैधता अिजध और यदद सेिा मूल्य की अंजतम अिजध जनर्दष्टा न ीं ै, तो इसे तब तक िैध माना िाएगा िब तक दक केंद्र सरकार द्वारा सेिा मूल्य जनर्दष्टा न ीं कर ददया िाता ै;

(ङ) "अनुमजत प्राप् तकताा" का अथा ै ऐसा व्यजि या एिेंसी जिसे जिजनयम 7 के त त लेबल लगाने की अनुमजत दी गई ;ै (च) "अनुसूची" का अथा ैइन जिजनयमों के साथ संलग्न अनुसूची; (छ) "इलेजररक सीललंग िाइप फैन" का अथा ै अजधजनयम की धारा 14 के खंड (ख) के त त अजधसूजचत एक उपकरण;

(ज) "स्ट्िार रेटिंग या स्ट्िार लेिल" का अथा ै अजधजनयम की धारा 14 के खंड (क) के त त केंद्र सरकार द्वारा अजधसूजचत सेिा मूल्य पर आधाठरत इलेजररक सीललंग िाइप फैन के लेबल पर प्रदर्िात ऊिाा दक्षता का ग्रेड; (ञ) दकसी भी इलेजररक सीललंग िाइप फैन के संबंध में "व्यापारी या जिक्रेता" का अथा ैऐसा व्यजि िो ऐसे पंखों को बेचता ै या जितठरत करता ै और इसमें दकु ानदार, व्यापारी, जनमााता और अनुमजत प्राप् तकताा िाजमल ैजिसे ऐसे इलेजररक सीललंग िाइप फैन पर लेबल लगाने की अनुमजत दी गई ।ै

(2) य ां प्रयुर त िब्द और अजभव्यजियां और जिन् ें य ां पठरभाजर्त न ीं दकया गया ै, लेदकन अजधजनयम में पठरभाजर्त दकया गया ,ै का अजधजनयम में उन् ेंक्रमिः ददया गया अथा ोगा।

3. लेबल पर प्रदर्िता दकए िान े िाल े जििरण.— (1) प्र‍येक इलेजररक सीललंग िाइप फैन पर, जनम्नजलजखत जििरण इसके लेबल पर प्रदर्िात दकए िाएंगे, अथाात:् — (क) ऊिाा दक्षता ब्यूरो का लोगो; (ख) जनमााता या आयातक और ब्ांड का नाम;

(ग) व्यापार का नाम और संख्या; (घ) मॉडल और जिजनमााण या आयात का िर्ा; (ङ) जिजिष्ि ्रृंंखला संज ता;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (च) िाट्स में पािर इनपुि (छ) घन मी./ जमनि में एयर जडजलिरी; (ि) घन मी./ जमनि/िाट्स में सेिा मूल्य;

(व) इलेजररक सीललंग िाइप फैन का स्ट्िार लेिल; और (ञ) लेबल अिजध;

(2) लेबल का जडिाइन, रंग, आकार और सामग्री को इन जिजनयमों के साथ संलग्न अनुसूची में जनर्दष्टा दकया िाएगा।

4. लेबल के प्रदिान की समय-सीमा-(1) जिजनयम 3 में जनर्दष्टा सभी जििरणों िाला लेबल इन जिजनयमों के लागू ोने की तारीख से छ म ीने की अिजध के भीतर प्र‍येक इलेजररक सीललंग िाइप फैन पर प्रदर्िात दकया िाएगा।

(2) अजधजनयम की धारा 14 के खंड (क) के त त केंद्र सरकार द्वारा अजधसूजचत संिोजधत ऊिाा खपत मानकों के लागू ोने से, प्र‍येक अनुमजत प्राप्तकताा या व्यापारी या जिक्रेता य सुजनजित करेगा दक — (क) जबक्री के जलए रखे गए इलेजररक सीललंग िाइप फैन पर संिोजधत ऊिाा खपत मानकों के अनुरूप संिोजधत स्ट्िार लेबल और संिोजधत लेबल अिजध को प्रदर्िात दकया िाएगा और इलेजररक सीललंग िाइप फैन का जिजनमााण िर्ा भी ऐसे संिोजधत ऊिाा खपत मानकों के अनुरूप ोगा, और जपछले ऊिाा खपत मानकों के साथ इलेजररक, सीललंग िाइप फैन का उ‍पादन न ीं दकया िाएगा;

(ख) डीलरों, खुदरा जिक्रेताओं और उपभोिाओं को िागरूक करने, उनकी सूचना के जलए अपेजक्षत प्रचार सज त सभी तैयारी के उपाय सुजनयोजित ोंगे और इन जिजनयमों के त त इसके िुरू ोने की तारीख से तीन म ीने प ले लागू दकए िाएंगे।

5. लेबल के प्रदिना का तरीका - (l) प्र‍येक इलेजर रक सीललंग िाइप फैन पर एक लेबल ोगा जिस पर जबक्री लबंद ु प्रदर्िात दकया िाएगा और ऐसे लेबल को जनम्नजलजखत तरीके से इलेजररक सीललंग िाइप फैन पर जचपकाया िाएगा, अथाात्:— (क) पैकेलिंग पर स्ट् ित: जचपकने िाला लेबल;

(ख) मोिर पर स्ट्ि त: जचपकने िाला लेबल।

6. लेबल के प्रदिान के जलए अनमु जत — (1) ब्यूरो की पूिा अनुमजत प्राप्त दकए जबना इलेजर रक सीललंग िाइप फैन पर कोई स्ट्ि ॉर लेबल न ीं लगाया िाएगा।

(2) उप-जिजनयम (1) के त त ब्यूरो की अनुमजत प्राप्त करने के उद्देश्य से, प्रपत्र I में जनर्दष्टा अनुसार प्र‍येक ब्ांड के जलए अलग से पंिीकरण के जलए आिेदन दकया िाएगा, जिसके साथ एक लाख रुपए की लेबल सुरक्षा िमा राजि संलग् न की िाएगी, िो ऑनलाइन या दकसी अन्य इलेर रॉजनक मोड के भुगतान द्वारा दये ोगी। बिते लघु उद्योग के मामले में लेबल सुरक्षा िमा राजि केिल पच्चीस िार रुपए ी ोगी;

(3) उप-जिजनयम (2) के त त अनुमजत प्राप् तकताा के प्र‍येक आिेदन के साथ जन्‍न जलजखत संलग् न दकया िाएगा – (क) प्रजत मॉडल दो िार रुपए का आिेदन िुल्क, िो ऑनलाइन या भुगतान के दकसी अन्य स्ट्िीकाया इलेररॉजनक मोड द्वारा दये ोगा;

(ख) प्रपत्र II में जनर्दष्टा दस्ट्तािेि।

7. अनमु जत प्रदान करना — (1) जिजनयम 6 के त त आिेदन प्राप्त ोने पर और य संतुष्ट ोने पर दक उसमें जनज त4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] सभी आिश्यकताओं का पालन दकया िा र ा ै, ब्यूरो जिजनयम 8 में जिजनर्दष्ा ि ऐसी जनबंधन एिं ितों के अधीन ऐसी अनुमजत प्राप्त ोने की तारीख से मानकों और लेबललंग पर अपनी प्रचालन जनयमािली में जनर्दष्टा अनुसार अिजध के भीतर जनम्नजलजखत प्रदान कर सकता ,ै — (क) प्रपत्र-III या इलेररॉजनक रूप में ब्ांड को पंिीकरृंत करना; या (ख) प्रपत्र-IV में या इलेररॉजनक रूप में इलेजररक सीललंग िाइप फैन पर लेबल जचपकाने के जलए अनुमजत प्रदान करना।

(2) ब्यूरो प्रपत्र- V में एक रजिस्ट्िर रखेगा और उसमें अनुमजत प्राप्त करने िाले का नाम दिा करेगा।

(3) उप-जिजनयम (1) के त त दी गई अनुमजत ऐसी अिजध के जलए मान्य ोगी िब तक दक अजधजनयम की धारा 14 के खंड (क) के त त केंद्र सरकार द्वारा अजधसूजचत अनुसार ऊिाा खपत मानक द्वारा जनर्दष्टा स्ट्िार लेिल लागू ।ै

(4) अनुमजत प्राप्त करने िाले द्वारा अनुमजत के निीकरण के जलए आिेदन छ म ीने प ले ददया िा सकता ै जिसके साथ ऑनलाइन या भुगतान के जलए स्ट्िीकाया दकसी अन्य इलेररॉजनक मोड द्वारा दये एक िार रुपए िुल्क िमा दकया िाएगा:

बिते यदद उसकी समाजप्त से एक मा प ले निीनीकरण के जलए कोई आिेदन न ीं दकया िाता ै तो उसे अनुमजत न ीं दी िाएगी।

(5) िैधता अिजध समाप्त ोने के बाद दकसी भी आिेदन का निीनीकरण न ीं दकया िाएगा, ऐसी जस्ट्थजत में अनुमजत प्राप्त करने िाला नए जसरे से आिेदन करेगा।

(6) उप-जिजनयम (4) के त त निीकरण के जलए आिेदन प्राप्त ोने पर और इस बात से संतुष्ट ोने के बाद दक सभी आिश्यकताओं का अनुपालन दकया गया ै, ब्यूरो ऐसी अनुमजत की प्राजप् त की तारीख से एक म ीने की अिजध के भीतर, प्रपत्र-IV में अनुमजत को निीनीकरृंत कर सकता ।ै

(7) यदद कोई अनुमजत प्राप्त करने िाला, उस तारीख से इलेजररक सीललंग िाइप फैन के मौिूदा मॉडल पर लेबल को जचपकाने की अनुमजत मांगता ै, जिस तारीख से संिोजधत स्ट्िार लेिल लागू ोता ै, तो ि प्रपत्र-VI में केिल एक घोर्णा प्रस्ट्तुत करेगा।

(8) यदद इलेजररक सीललंग िाइप फैन के नए मॉडल को संिोजधत स्ट्िार लेिल के अनुरूप बनाने की योिना बनाई िाती ,ै तो अनुमजत प्राप् त करने िाला नए जसरे से लेबल लगाने के जलए ऐसी अनुमजत प्राप्त करने के जलए संिोजधत स्ट्िार लेिल के लागू ोने से छ म ीने प ले एक आिेदन करेगा।

8. लेबल पर जििरण प्रदर्िता करन े के जलए जनबधं न एि ंितें - प्र‍येक अनुमजत प्राप्त कताा, व्यापारी और जिक्रेता, - (क) अजधजनयम की धारा 14 के खंड (क) के त त अजधसूजचत इलेजररक सीललंग िाइप फैन के जलए ऊिाा खपत मानकों का अनुपालन;

(ख) केिल इलेजररक सीललंग िाइप फैन के ऐसे मॉडल पर ी लेबल जचपकाएं जिसके जलए अनुमजत दी गई ै; (ग) अनुमजत प्राप्त कताा की लागत पर इलेजररक सीललंग िाइप फैन पर लेबल लगाएं; (घ) सुजनजित करें दक इलेजररक सीललंग िाइप फैन के लेबल पर प्रदर्िात स्ट्िार लेिल को र समय बनाए रखा िाएगा;

(ङ) जिजनयम 9 में जनर्दष्टा लेबल िुल्क का भुगतान करें; (च) ब्यूरो को एक जििरण प्रस्ट्तुत करें जिसमें लेबल लगे उपकरण के उ‍पादन का जििरण और जित्तीय िर्ा की[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 प्र‍येक जतमा ी के समाप्त ोने के बाद िाले म ीने के भीतर प्र‍येक जतमा ी के जलए दये उपकरण और अर्िात लेबललंग िुल्क िाजमल ो;

(छ) ब्यूरो को प्र‍येक िर्ा की 30 अप्रैल तक अपने लेबल लगे उ‍पादों को बेचने के जलए जनयुि अजधकरृंत जितरकों, डीलरों, खुदरा जिक्रेताओं, जिक्रेताओं की एक अद्यतन सूची प्रस्ट्तुत करें; (ि) ऐसी अन्य जनबंधन एिं ितों का अनुपालन करें जिन् ें ब्यूरो मानक और लेबललंग पर ब्यूरो की प्रचालन जनयमािली में िाजमल सज त जनर्दष्टा कर सकता ।ै

9. लेबल िल्ु क - (1) प्र‍येक अनुमजत प्राप्त कताा ब्यूरो को इलेजररक सीललंग िाइप फैन पर प्र‍येक लेबल लगाने के जलए एक रुपए का लेबल िुल्क दगे ा;

(2) उप-जिजनयम (1) के त त जनर्दष्टा लेबल िुल्क का भुगतान प्र‍येक जित्तीय िर्ा के समाप्त ोने की तारीख से एक म ीने के भीतर प्रजत िर्ा दकया िाएगा; बिते दक जनर्दष्टा अिजध के भीतर लेबल िुल्क का भुगतान न करने पर, ब्यूरो जिजनयम 6 के उप-जिजनयम (2) के त त भुगतान दकए गए लेबल सुरक्षा िमा राजि से प्रजत िर्ा दस प्रजतित पर ब्याि के साथ दये राजि की िसूली करेगा और यदद प्रस्ट्तुत करने की अंजतम तारीख के एक िर्ा के भीतर पूणा लेबललंग िुल्क की िसूली न ीं की िाती ै, तो ब्यूरो अनुमजत प्राप्त करने िाले को ददए गए लेबल को रद्द कर दगे ा और राष्ट्रीय या क्षेत्रीय दजै नक समाचार-पत्रों में तथा इलेररॉजनक साधनों के रूप में उसका नाम एक चूककताा के रूप में प्रकाजित करेगा।

10. लबे ल सरु क्षा िमा राजि का ठरफंड - जिजनयम 9 के उप-जिजनयम (2) के प्रािधानों के अधीन, इलेजररक सीललंग िाइप फैन के जनमााण को बंद करने पर अनुमजत प्राप्त कताा लेबल सुरक्षा िमा राजि का ठरफंड प्राप् त करने का पात्र ोगा।

11. ब्यरू ो द्वारा स‍यापन (1) ब्यूरो या उसकी नाजमत एिेंसी, या तो स्ट्ितः संज्ञान लेकर या उसके द्वारा प्राप्त जिकायत पर, य सुजनजित करने के जलए स‍यापन कर सकती ै दक इलेजररक सीललंग िाइप फैन स्ट्िार लेिल और उसके लेबल पर प्रदर्िात अन्य जििरणों के अनुरूप ैऔर य अनुमजत की अन्य जनबंधन एिं ितों का अनुपालन करता ।ै

(2) स‍यापन के प्रयोिनों के जलए, ब्यूरो या उसकी नाजमत एिेंसी, िैसा ि उजचत समवे, जिजनमााण सुजिधा, गोदाम या खुदरा जबक्री केंद्र से यादजरृं छछक रूप से नमूने उिा सकती ।ै

(3) ि ां, उप-जिजनयम (1) के अंतगात कोई जिकायत प्राप् त ोती ,ै तो ब्य ूरो को िांच और अंिाकन प्रयोगिालाओं के जलए राष्र ीय प्र‍ यायन बोडा द्वारा जिजधित मान्य ता-प्राप् त दकसी स्ट् ितंत्र प्रयोगिाला में इलेजर रक सीललंग िाइप फैन की िांच करके स‍ यापन कराना ोगा, - (क) ब्यूरो ऐसा परीक्षण करने के जलए अनुमजत दने े िाले को नोठिस िारी करेगा और जिकायतकताा को ब्यूरो के साथ परीक्षण, पठरि न और अन्य आकजस्ट्मक खचों से संबंजधत ऐसे व्य य को िमा करने के जलए क ा िाएगा, िैसा दक ऐसे समय के भीतर ब्यूरो द्वारा जनधााठरत दकया िा सकता ै;

(ख) यदद चुनौती परीक्षण के त त जलया गया नमूना जिफल ो िाता ै, तो अनुमजत प्राप्तकताा नमूने की लागत, नमूने के पठरि न और ब्यूरो को परीक्षण िुल्क के सभी खचों की प्रजतपूर्ता करेगा और ब्यूरो जिकायतकताा को उि व्य य को िापस करेगा; और (ग) ि ां उपकरण चुनौती परीक्षण पास कर लेता ,ै तो जिकायतकताा द्वारा िमा की गई राजि िब्त कर ली िाएगी।

(4) ि ां, उप-जिजनयम (1) के त त प्राप्त जिकायत पर, यदद अनुमजत प्राप्तकताा ऐसे खचों को उप-जिजनयम (3) में ऐसे समय के भीतर िमा करने में जिफल र ता ै, तो ब्यूरो –

(i) उप-जिजनयम (3) में उजल् लजखत इलेजर रक सीललंग िाइप फैन का चुनौती परीक्षण करके स‍यापन िारी6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] रखेगा; और

(ii) जिजनयम 6 के त त प्राप्त आिेदन की प्रोसेलसंग को तब तक स्ट्थजगत रखा िाएगा िब तक दक ऐसा खचा िमा न ीं कर ददया िाता।

(5) ि ां स्ट्ि त: संज्ञान लेकर परीक्षण या चुनौती परीक्षण के दौरान परीक्षण के जलए उपयोग दकए िाने िाले इलेजररक सीललंग िाइप फैन के नमूने जिफल ो िाते ैं, ि ां ब्यूरो अनुमजत प्राप्तकताा को एक और अिसर प्रदान करेगा और ब्यूरो एक स्ट्ितंत्र परीक्षण प्रयोगिाला में प ले परीक्षण में प्रयुर त इलेजररक सीललंग िाइप फैन की दगु नी मात्रा के साथ दसू रा परीक्षण करेगा िो अनुमजत प्राप्त कताा की लागत पर परीक्षण और अंिांकन प्रयोगिालाओं के जलए राष्ट्रीय प्र‍यायन बोड ा द्वारा जिजधित मान्यता प्राप्त ।ै

(6) ि ां दसू री परीक्षा जिफल ो िाती ,ै ि ां ब्यूरो, - (क) दो म ीने की अिजध के भीतर सभी राज्य नाजमत एिेंजसयों को सूजचत करते हुए प्रपत्र-VII में अनुमजत प्राप्त करने िाले को जनदिे दगे ा दक ि , -

(i) पैकेलिंग और इलेजररक सीललंग िाइप फैन की मोिर पर लगे लेबल पर प्रदर्िात स्ट्ि ॉर लेिल को स ी करे या परीक्षण के दौरान पाए गए दोर् और कजमयों को दरू करे;

(ii) ब्यूरो के जनदिे ों का पालन करने के जलए बािार से सभी स्ट्िॉक को िापस ले; और

(iii) जिज्ञापन सामग्री पर प्रदर्िात जििरणों को बदले; (ख) दकसी भी राष्ट्रीय या क्षेत्रीय दजै नक समाचार-पत्र में और दकसी भी इलेररॉजनक साधनों में या दकसी अन्य तरीके से अनुमजत प्राप् तकताा का नाम, ब्ांड नाम, मॉडल का नाम या मॉडल नंबर, लोगो और अन्य जिजनदिे ों को िैसा उजचत समवेगा, दो म ीने के भीतर प्रकाजित करेगा;

(ग) अजधजनयम की धारा 27 के त त अनुमजत दने े िाले और व्यापारी के जखलाफ स्ट्थ गन कायािा ी िुरू करने के जलए संबंजधत राज्य नाजमत एिेंसी को सूजचत करेगा।

(7) अनुमजत प्राप् त करने िाला उप-जिजनयम (6) में उजल् लजखत दो म ीने की अिजध के समाप्त ोने के दस ददनों के भीतर,— (क) जनदिे के अनुपालन में की गई कारािाई के संबंध में प्रपत्र-VIII में अनुपालन ठरपोिा ब्यूरो को भेिेगा;

और (ख) यदद खंड (क) में उजल् लजखत अनुपालन ठरपोिा प्राप्त न ीं ोती ै या जनर्दष्टा अिजध के भीतर दकसी भी जनदिे का पालन दकए जबना प्राप्त ोती ै, तो इसे िारी दकए गए जनदिे का अनुपालन न ीं माना िाएगा और इस संबंध में ब् यूरो द्वारा आदिे पाठरत दकया िाएगा।

(9) ि ां अनुमजत प्राप्त कताा उप-जिजनयम (6) के त त ब्यूरो द्वारा िारी जनदिे ों का अनुपालन करने में जिफल र ता ,ै ि ां ब्य ूरो सभी राज्य नाजमत एिेंजसयों को सूचना दते े हुए— (क) जिजनयम 7 के उप-जिजनयम (1) के त त अनुमजत प्राप् तकताा को दी गई अनुमजत िापस लेगा;

(ख) अजधजनयम की धारा 14 के खंड (क) के त त केंद्र सरकार द्वारा अजधसूजचत ऊिाा खपत मानकों के अनुरूप[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 अनुमजत प्राप्त कताा द्वारा जिफल र ने के समथान में परीक्षण ठरपोिा के साथ केंद्र सरकार को ठरपोिा भेिेगा, जिसमें उप-जिजनयम (7) के खंड (क) में उजल् लजखत ब्यूरो के जनदिे ों के अनुसार जिचार करने और केंद्र सरकार द्वारा अजधजनयम की धारा 14 के खंड (ग) के त त कारािाई करने का जनदिे ददया िाएगा;

(ग) दकसी भी राष्ट्रीय या क्षेत्रीय दजै नक समाचार-पत्र में और दकसी भी इलेररॉजनक साधनों में या दकसी अन्य तरीके से अनुमजत प्राप् तकताा का नाम, ब्ांड नाम, मॉडल का नाम या मॉडल नंबर, लोगो और अन्य जिजनदिे ों को िैसा उजचत समवेगा, दो म ीने के भीतर प्रकाजित करेगा;

(घ) अजधजनयम की धारा 27 के त त अनुमजत दने े िाले और व्यापारी के जखलाफ स्ट्थ गन कायािा ी िुरू करने के जलए संबंजधत राज्य नाजमत एिेंसी को सूजचत करेगा।

2. य अनुमजत जन्‍न जलजखत के अधीन ै –[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 19 (क) इलेजररक सीललंग िाइप फैन के लेबल पर प्रदर्िात स्ट्िार लेिल अजधजनयम की धारा 14 के खंड (क) के त त अजधसूजचत इलेजररक सीललंग िाइप फैन के जलए ऊिाा खपत मानकों तथा उपयुार त जिजनयमों में उपलब् ध जनबंधन एिं ितों के अनुरूप ोगा;

(ख) लेबल केिल इलेजररक सीललंग िाइप के ऐसे मॉडल पर ी जचपकाया िाएगा जिसके जलए अनुमजत दी गई ;ै (ग) लेबल को अनुमजत प्राप्त करने िाले की लागत पर इलेजररक सीललंग िाइप फैन पर मुदद्रत या जचपकाया िाएगा; (घ) अनुमजत प्राप् त करने िाला य सुजनजित करेगा दक इलेजररक सीललंग िाइप फैन पर प्रदर्िात स्ट्िार लेिल को र समय बनाए रखा िाएगा;

(ड.) अनुमजत प्राप्त कताा प्रजत लेबल 1 रुपए के लेबल िुल्क का भुगतान करेगा; (च) अनुमजत प्राप्त करने िाला ब्यूरो को एक जििरण प्रस्ट्तुत करेगा जिसमें जित्तीय िर्ा की प्र‍येक जतमा ी के समाप्त ोने के बाद िाले म ीने में लेबल दकए गए उपकरणों के उ‍पादन और प्र‍येक जतमा ी के जलए उपार्िात लेबललंग िुल्क जििरण ोगा। ऑनलाइन प्रणाली के माध्यम से ब्यूरो को भी ि ी जििरण भेिा िाएगा;

(छ) िब भी ब्यूरो द्वारा मांग की िाएगी, अनुमजत प्राप्त कताा इलेजररक सीललंग िाइप फैन के ऐसे अन्य जििरण उपलब्ध कराएगा, जिसके जलए अनुमजत प्रदान की गई ।ै

3. य अनुमजत.......................से...................तक िैध ोगी और इसे जनधााठरत अनुसार निीनीकरृंत दकया िा सकता ।ै अनुमजत प्राप् त करने िाला ब्य ूरो के पूिा अनुमोदन को छोडकर, िैधता अिजध के दौरान पंिीकरृंत ब्ांड और इलेजररक सीललंग िाइप फैन को बािार से िापस न ीं लेगा।

NOTIFICATION New Delhi, the 2nd July, 2021 No. BEE/S&L/Ceiling Fan/05/2019-20.—The following draft of certain regulations which the Bureau with the previous approval of the Central Government proposes to amend, that is the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Electric Ceiling Type Fans) Regulations, 2021, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of

section 13 of the Energy Conservation Act, 2001 (52 of 2001), is hereby published as required by sub-section (1) of

section 58 of the said Act for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public;

Objections or suggestions, if any, may be addressed to the Director-General of Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, R.K.Puram, Sector-1, New Delhi-110066;

Objections or suggestions which may be received from any person with respect to the said draft regulations before the expiry of the period of thirty days specified in para 1 above shall be taken into consideration by the Bureau of Energy Efficiency.

1. Short title and commencement.– (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Electric Ceiling Type Fans) Regulations, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- (1) In these regulations, unless the context otherwise requires,-

(a) “Act” means the Energy Conservation Act, 2001 (52 of 2001);

(b) “Family of models” means group of models for which all the performance parameters are same;

(c) “Form” means a form appended to these regulations;

(d) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the Electric Ceiling Type Fan;

(e) “label period” means the validity period of the service value under the energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act and in case the end period of the service value is not specified, it shall be deemed to be valid until a service value is specified by the Central Government;

(f) “permittee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(g) “Schedule” means the schedule annexed to these regulations;

(h) “Electric Ceiling Type Fan” means an appliance notified under clause (b) of section 14 of the Act;

(i) “star rating or star level” means the grade of energy efficiency displayed on the label of the Electric Ceiling Type Fan based on service value notified by the Central Government under clause (a) of section 14 of the Act;

(j) “trader or seller” in relation to any Electric Ceiling Type Fan means a person who sells or distributes such fans and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such Electric Ceiling Type Fans.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label.- (1) On every Electric Ceiling Type Fan, the following particulars shall be displayed on its label, namely:-

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand;

(c) trade name and number;

(d) model and year of manufacturing or import;

(e) unique series code;

(g) air delivery in cu m/min;

(h) service value in cu m/min/Watts;

(i) star level of Electric Ceiling Type Fan ; and

(j) label period;

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.- (1) A label containing all the particulars specified in regulation 3 shall be displayed on every Electric Ceiling Type fan within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller shall ensure that-

(a) the electric ceiling type fan put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year of the Electric Ceiling Type fan shall also be in synchronization with such revised energy consumption standards, and shall not produce the Electric Ceiling Type fan with the previous energy consumption standards;

(b) all preparatory steps including awareness of the dealers, retailers and consumers, requisite publicity for their education shall be well planned and taken three months in advance of the date of such commencement, under these regulations.

5. Manner of display of label.- (1)There shall be a label on every electric ceiling type fan which shall be displayed at the point of sale and such label shall be affixed on the electric ceiling type fan in the following manner,

namely:-

(a) Self-adhesive label affixed on packaging;

(b) Self-adhesive label affixed on motor.

6. Permission for display of label.- (1) No star label shall be affixed on a electric ceiling type fan without obtaining the prior permission of the Bureau.

(2) For the purpose of obtaining permission of the Bureau under sub-regulation (1), an application for registration shall be made for every brand separately as specified in Form I, accompanied by a label security deposit of One lakh rupees, payable online or by any other acceptable electronic mode of payment:

Provided that in case of small scale industry, label security deposit shall be twenty-five thousand rupees only;

(3) Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable online or by any other acceptable electronic mode of payment;

(b) documents specified in Form II.

7. Grant of permission. -(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its operation manual on standards and labelling from the date of such receipt, subject to such terms and conditions as are specified in regulation 8, –

(a) register the brand in Form III or in electronic form; or

(b) grant permission for affixing label on electric ceiling type fan in Form IV or in electronic form.

(2) The Bureau shall maintain a register in Form V and enter the name of the permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 of the Act is in force.

(4) An application for renewal of permission may be made by the permittee six months before its expiry and shall be

accompanied by a fee of rupees one thousand payable online or by any other acceptable electronic mode of payment:

Provided that no application for renewal shall be allowed if it is made one month before its expiry.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form IV.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the electric ceiling type fan from the date from which the revised star level comes into force, shall submit only a declaration in Form VI.

(8) The permittee shall seek permission to affix label afresh, if a new model of the electric ceiling type fan is planned to be launched synchronising with the revised star level, an application for such permission shall be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall,-

(a) comply with the energy consumption standards for electric ceiling type fan notified under clause (a) of section 14 of the Act;

(b) affix label only on such model of electric ceiling type fan for which permission has been granted;

(c) affix label on the electric ceiling type fan at the cost of the permittee;

(d) ensure that the star level displayed on the label of electric ceiling type fan shall be maintained at all time;

(e) pay the label fee as specified in regulation 9;

(f) furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of closure of each quarter of the financial year;

(g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell its labelled products by 30th day of April of each year;

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Operation Manual on Standard and Labelling.

9. Label fee. - (1) Every permittee shall pay to the Bureau a label fee of one rupee for each label affixed on the electric ceiling type fan;

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure of each financial year;

Provided that on failure to pay the label fee within the period so specified, the Bureau shall recover the amount due with interest thereon at ten per cent. per annum from the label security deposit paid under sub-regulation (2) of regulation 6 and if complete labelling fees is not recovered within one year of the last date of submission, the Bureau shall cancel the labels granted to the permittee and publish his name in the national or regional daily newspapers and in electronic means as a defaulter.

10. Refund of label security deposit. - Subject to the provisions of sub-regulation (2) of regulation 9, the permittee shall be entitled to a refund of the label security deposit, on ceasing to manufacture electric ceiling type fan.

11. Verification by Bureau.- (1) The Bureau or its designated agency may, either suo motu or on a complaint received by it, carry out verification to ensure that the electric ceiling type fan conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purposes of verification, the Bureau or its designated agency may pick up samples at random from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the electric ceiling type fan in an independent laboratory duly accredited by the National Accreditation Board for testing and calibration laboratories,-

(a) the Bureau shall issue a notice to the permittee for carrying out such testing and the complainant shall be called upon to deposit such expenses related to testing, transportation and other incidental expenses with the Bureau, within such time as may be determined by the Bureau;

(b) if the sample drawn under challenge testing fails, the permittee shall reimburse all expenses towards the cost of sample, transportation of sample and the testing charges to the Bureau and the Bureau shall refund the said expenses to the complainant; and

(c) where the equipment passes the challenge test, then the expenses deposited by the complainant shall stand forfeited.[भाग III—खण्‍ड 4] भारत‍का‍राजपत्र‍:‍असाधारण 29

(4) Where, upon a complaint received under sub-regulation (1), if the permittee fails to deposit such expenses referred to in sub-regulation (3) within such time, the Bureau shall-

(i) continue the verification by challenge testing the electric ceiling type fan referred to in sub- regulation (3); and

(ii) the processing of application received under regulation 6 may be kept in abeyance till such expenses are deposited.

(5) Where samples of electric ceiling type fan used for testing fails, the test during suo motu testing or challenge testing, the Bureau shall afford the permittee another opportunity and the Bureau shall conduct a second test with twice the quantity of electric ceiling type fan used in the first test in an independent test laboratory duly accredited by the National Accreditation Board for testing and calibration laboratories at the cost of the permittee.

(6) Where the second test fails, the Bureau shall,-

(a) direct the permitte in Form VII, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label affixed on the packaging and motor of electric ceiling type fan or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications;

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(7) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub-regulation

(6) ,-

(a) send the compliance report in Form VIII to the Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed to be non- compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(8) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub-regulation (7) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.

(9) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (6), the Bureau under intimation to all State Designated Agencies shall-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub- regulation (7) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications;

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission. - The Bureau may cancel the permission granted under regulation 7, if the permittee—

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

3. The label design, size, colour scheme, material to be used for the label and the content of the label and colour scheme of the Bureau's logo shall be as specified in the Schedule of this regulation.

Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Electric Ceiling Type Fans) Regulations, 2021 you were permitted to affix label on the Electric Ceiling Type Fans vide Bureau of Energy Efficiency letter No. ..............dated....... subject to the compliance of the terms and conditions specified therein.

2. The Bureau, under regulation … of these regulations, purchased a BEE star labelled Electric Ceiling Type Fans from your authorised distributor, dealer, retailer vide Invoice number .......dated for a price of Rs................ and lifted as a sample dated ……by M/s......................, an agency appointed by the Bureau for verification of the particulars displayed on the label under regulation 3, affixed by you on the aforesaid purchased Electric Ceiling Type Fans. The sample duly sealed by M/s............... bearing serial number……..was obtained from M/s..........(Name of the distributor, dealer, retailer) under signatures of the duly authorised representative of the verification agency.

The Bureau through its aforesaid verification agency transported the sample referred to in para 2 to M/s. ..................., a National Accreditation Board for Testing and Calibration Laboratories accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 4 and 5 of. S.O. number ……dated the ….for giving Test Report in accordance with the form ….given in Annexure to S.O. number ……..dated the ……..

4. The results of the test report of the sample bearing unique identification serial number…….. is enclosed. The results of the test report indicated that the sample of Electric Ceiling Type Fans failed to meet the energy consumption standard, service value, etc. and did not conform to the test details furnished by you in Form I annexed to the application submitted by you for seeking permission to affix label on the Electric Ceiling Type Fans manufactured/imported by you. The test results were sent to you vide the Bureau’s letter No........dated........in the name of your authorized contact person. You were also required to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

The sample for second check verification test was picked up ….dated the …. through our authorized Agency M/s. ............and transported to the National Accreditation Board for Testing and Calibration Laboratories accredited laboratory transported by our authorised agency, duly sealed by M/s............... and was given unique identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification agency as well as your representatives.

6. The test results of second check testing are enclosed which are duly checked and counter signed by the competent authorized personnel of the National Accreditation Board for Testing and Calibration Laboratories accredited laboratory. The test report is also duly signed by your authorized signatory as witness of second check testing. The test results confirm that they failed to meet the requisite parameters and standards given in S.O.

7. The Bureau hereby directs you to correct the star level displayed on the label of the Electric Ceiling Type Fans or remove the defects and deficiencies found during testing; withdraw all the stocks from the market to comply with the directions of the Bureau; and change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within ten days after the expiry of two months, i.e., by ...............In case no compliance report is received by the said date, the Bureau shall proceed to take action under these regulations.

9. The Bureau shall take further follow up action in accordance with the provisions of these regulations.
