1. संजिप्त नाम और प्रारंभ. — (1) इन जनयमों का संजिप्त नाम खजनि (नीलामी) तीसरा संिोधन जनयम, 2026 ह।ै

(2) य े रािपत्र म ें उनके प्रकािन की तारीख को प्रिृत होंगे।

2. खजनि (नीलामी) जनयम, 2015 (जिसे इसम ेंइसके पश्चात उि जनयम कहा गया ह)ै , के जनयम 9 म,ें — (क) उप-जनयम (8) के,—

(i) पहले परंतुक के पश्चात, जनम्नजलजखत परंतुक अतं ःस्ट्र्ाजपत दकया िाएगा, अर्ाात:् — 7972 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “परंत ु यह और दक अजधजनयम की प्रर्म अनुसूची के भाग घ म ें जिजनर्िाष्ट खजनि की नीलामी के मामले म,ें तकनीकी रूप स े अर्हता बोली लगान े िालों की संख्या िो स े पांच के बीच ह,ै तब सभी को अर्हता बोली लगान े िालों के रूप म ें माना िाएगा:’’;

(ii) जिद्यमान िसू रे परंतुक म,ें "परंत ु यह और भी दक", िब्िों के स्ट्र्ान पर "परंतु यह भी दक” िब्ि रख े िाएंग;े (ख) उप-जनयम (9) के पश्चात, जनम्नजलजखत परंतुक अतं ःस्ट्र्ाजपत दकया िाएगा, अर्ाात्:— “परंत ु दक अजधजनयम की प्रर्म अनुसूची के भाग घ म ें जिजनर्िाष्ट खजनि की नीलामी के मामले म,ें तकनीकी रूप स े अर्हता बोली लगान े िालों की कुल संख्या िो या अजधक ह,ै तब नीलामी की प्रदक्रया जद्वतीय चक्र म ें उस रीजत म ेंआग े बढेगी िैसा खंड (i) स े (iii) म ेंउपबंजधत दकया गया ह।ै ";

(ग) उप-जनयम (10) के पश्चात, जनम्नजलजखत परंतुक अंतःस्ट्र्ाजपत दकया िाएगा, अर्ाात:् — “परंत ु दक अजधजनयम की प्रर्म अनुसूची के भाग घ म ें जिजनर्िाष्ट खजनि की नीलामी के मामले म,ें तकनीकी रूप स े अर्हता बोली लगान े िालों की कुल संख्या िो स े अन्यनू ह,ै तब दकसी भी तकनीकी रूप स े अर्हता बोली लगान े िाले को अर्हता बोली लगाने िाला नहीं समझा िाएगा और नीलामी के प्रर्म प्रयास को रद्द दकया िाएगा।”।

3. उि जनयमों के, जनयम 19ङ म,ें - (क) उप-जनयम (9) के, पहले परंतुक म,ें “तीन” िब्ि के स्ट्र्ान पर, “िो” िब्ि रखा िाएगा; (ख) उप-जनयम (10) के, “तीन” िब्ि के स्ट्र्ान पर, “िो” िब्ि रखा िाएगा; (ग) उप-जनयम (11) के, “तीन” िब्ि के स्ट्र्ान पर, “िो” िब्ि रखा िाएगा। [फा. स.ं एम. NOTIFICATION New Delhi, the 16th October, 2026 G.S.R. 898(E).— In exercise of the powers conferred by section 13 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules further to amend the Mineral (Auction) Rules, 2015, namely: —

1. Short title and commencement:— (1) These rules may be called the Mineral (Auction) Third Amendment Rules,

2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Mineral (Auction) Rules, 2015 (hereinafter referred to as the said rules), in rule 9, —

(a) in sub-rule (8), —

(i) after the first proviso, the following proviso shall be inserted, namely: — “Provided further that, in case of auction of mineral specified in Part D of the First Schedule to the Act, the number of technically qualified bidders is between two and five, then all of them shall be considered as

qualified bidders:”;

(ii) in the second proviso, for the words “Provided further”, the words “Provided also” shall be substituted;

(b) after sub-rule (9), the following proviso shall be inserted, namely: — “Provided that, in case of auction of mineral specified in Part D of the First Schedule to the Act, the total number of technically qualified bidders is two or more, the auction process shall proceed to the second round of auction in the manner provided in clauses (i) to (iii).”;

(c) after sub-rule (10), the following proviso shall be inserted, namely: — “Provided that, in case of auction of mineral specified in Part D of the First Schedule to the Act, the total number of technically qualified bidders is less than two, then no technically qualified bidder shall be considered to be qualified bidder and the first attempt of auction shall be annulled.”.

3. In the said rules, in rule 19E, —

(a) in sub-rule (9), in the first proviso, for the word “three”, the word “two” shall be substituted;

(b) in sub-rule (10), for the word “three”, the word “two” shall be substituted;
