और उक्त जिजनयमं की राजपत्र प्रजतयां उक्त राजपत्र म ें 2 जलु ाई, 2021 को प्रकाजित की गई थी; और जबदक उक्त प्रारूप जिजनयमं के संबंध म ेंपूिोय अिजध के भीतर सझु ाि प्राप्त हुए ह;ैं और इस संबंध म ेंप्राप्त सझु ािं पर जिचार कर जलया गया ह;ै अत:, अब, ऊजाा संरक्षण अजधजनयम, 2001 (2001 का 52) की धारा 13 की उपधारा (2) के खंड (ढ) और धारा 14 के खंड (घ) के साथ पठठत धारा 58 की उपधारा (2) के खडं (i) द्वारा प्रदि िजययं का प्रयोग करत े हुए, ब्यूरो, केन्‍द रीय सरकार के पूि ा अनुमोदन स,े एतद्द्वारा जनम्नजलजखत जिजनयम बनाता ह,ै अथाात्: -

1. सजं क्षप्त नाम और प्रारंभ – (1) इन जिजनयमं का संजक्षप् त नाम ऊजाा दक्षता ब्यरू ो (इलेजक्रक सीललग टाइप फैन के लेबल पर उनके प्रदिना का जििरण और रीजत) जिजनयम, 2022 ह।ै

2. पठरभाषाए ं– (1) इन जनयमं म,ें जब तक दक संदभ ा स े अन्‍दयथा अपेजक्षत न हो:- (क) "अजधजनयम" स े ऊजा ा संरक्षण अजधजनयम, 2001 (2001 का 52) अजभप्रेत ह;ै (ख) “इलेजक्रक सीललग टाइप फैन” स े अजधजनयम की धारा 14 के खंड (ख) के अधीन अजधसूजचत उपकरण अजभप्रेत ह;ै (ग) “फैजमली ऑफ मॉडल् स” स े उन माडलं का समूह अजभप्रेत ह ैजजसके जलए सभी जनष्प ादन मानदडं समान हं;

(घ) “प्ररूप” स े इन जिजनयमं के साथ संलग् न प्ररूप अजभप्रेत ह;ै (ङ) “लेबल” स े इ लेजक्रक सीललग टाइप फैन पर जचपकायी हुई अथिा प्रकाजित कोई जलजखत, मुदरत, माक्ड ा, स्ट् टैंप् ड अथिा ग्रादफक सामग्री अजभप्रेत ह;ै (च) "लेबल अिजध" स े अजधजनयम की धारा 14 के खडं (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत ऊजा ा खपत मानक के अधीन सेिा मान की िैधता अिजध अजभप्रते ह ै और यदद सेिा मान की समाजप्त अिजध जनर्ददष्ट नहीं ह,ै तो इस े तब तक िैध माना जाएगा जब तक दक केन्‍द रीय सरकार द्वारा कोई सेिा मान जनर्ददष्ट नहीं दकया जाता;

(छ) “अनुज्ञापत्रधारी” स े िह व् यजय अथिा अजभकरण अजभप्रते ह ै जजसे जिजनयम 7 के अधीन लेबल जचपकाने हते ु परजमट प्रदान दकया गया ह;ै (ज) “अनुसूची” स े इन जिजनयमं के साथ संलग् न अनुसूची अजभप्रेत ह;ै (झ) "स्ट्टार रेटटग या स्ट्टार लेिल" स े अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत सिे ा मान के आधार पर इलेजक्रक सीललग टाइप फैन के लेबल पर प्रदर्शित ऊजाा दक्षता का ग्रडे अजभप्रेत ह;ै (ञ) दकसी भी इलेजक्रक सीललग टाइप फैन के संबंध म ें "व्यापारी या जिक्रेता" स े िह व्यजय अजभप्रेत ह ै जो ऐसे पंखं का जिक्रय अथिा जितरण करता ह ै और इसम ें दकु ानदार, व्यापारी, जिजनमााता और अनुज्ञापत्रधारी िाजमल ह ैं जजन्‍दह ें ऐस े इलेजक्रक सीललग टाइप फैन पर लेबल जचपकाने की अनुमजत दी गई ह।ै

(2) ऐसे िब् द और अजभव् यजययां जो यहां प्रयोग दकए गए और पठरभाजषत नहीं दकए गए, ककतु अजधजनयम म ें पठरभाजषत ह ैंउनका िही अथा होगा जो अजधजनयम म ें उनके जलए ददया गया ह।ै

3. लबे ल पर प्रदर्शित दकया जान े िाला जििरण- (1) प्रत् यके इलेजक्रक सीललग टाइप फैन पर, इसके लेबल पर जनम्न जलजखत जििरण प्रदर्शित दकया जाएगा, अथाात:् - (क) ऊजाा दक्षता ब् यूरो का प्रतीक जचन्‍द ह; (ख) जनमााता अथिा आयातक और ब्ांड का नाम;

(ग) व् यापार का नाम और संख्या; (घ) मॉडल और जिजनमााण अथिा आयात का िष;ा (ङ) यूनीक सीरीज़ कोड; (च) पािर इनपुट िाट म;ें (छ) एयर जडजलिरी घन मीटर/जमनट म;ें (ज) सेिा मान घन मीटर/जमनट/िाट म;ें (झ) इलेजक्रक सीललग टाइप फैन का स्ट् टार लेिल; और (ञ) लेबल अिजध;

(2) लेबल का जडज़ाइन, रंग, आकार और सामग्री इन जिजनयमं के साथ सलं ग्न अनुसूची में जिजनर्ददष्ट के अनुसार होगी।

4. लबे ल प्रदर्शित करन े के जलए समय सीमा - (1) प्रत्येक इलेजक्रक सीललग टाइप फैन पर इन जिजनयमं के लागू होने की तारीख स े छ: मास की अिजध के भीतर जिजनयम 3 में जिजनर्ददष्ट समस्ट्त जििरण सजहत एक लेबल प्रदर्शित दकया जाएगा।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3

(2) अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत संिोजधत ऊजा ा खपत मानकं के प्रारंभ होन े पर, प्रत्येक अनुज्ञापत्रधारी या व्यापारी या जिक्रेता यह सुजनजित करेगा दक- (क) जिक्रय के जलए रखे गए इलेजक्रक सीललग टाइप फैन पर संिोजधत ऊजाा खपत मानकं के साथ समकाजलक करते हुए संिोजधत स्ट्टार लेिल और संिोजधत लेबल अिजध प्रदर्शित दकए जाएंगे और इलेजक्रक सीललग टाइप फैन का जिजनमााण िष ा भी ऐस े संिोजधत ऊजा ा खपत मानकं के समकाजलक होगा, और जपछल े ऊजा ा खपत मानकं िाल े इलेजक्रक सीललग टाइप फैन का उत्पादन नहीं दकया जाएगा;

(ख) इन जिजनयमं के अधीन, डीलरं, खुदरा जिक्रेताओं और उपभोयाओं की जागरूकता, उनकी जिक्षा के जलए अपेजक्षत प्रचार सजहत सभी प्रारंजभक कदम सुजनयोजजत हंग े और अजग्रम रूप स े ऐस े आरंभ की तारीख स े तीन मास पूिा उठाए जाएंगे।

5. लबे ल प्रदिना की रीजत - (1) प्रत्येक इलेजक्रक सीललग टाइप फैन पर एक लेबल होगा जो जिक्रय स्ट्थान पर प्रदर्शित दकया जाएगा और ऐसा लेबल इलेजक्रक सीललग टाइप फैन पर जनम्नजलजखत तरीके स े जचपकाया जाएगा, अथाात:् - (क) पैकेलजग पर जचपकाया हुआ सेल्फ -एड्हजे सि अथिा लप्रटेड लेबल;

(ख) मोटर पर जचपकाया हुआ सल्े फ-एड्हजे सि लेबल;

6. लबे ल प्रदिना की अनमु जत - (1) इलेजक्रक सीललग टाइप फैन पर कोई भी स्ट्टार लेबल ब्यरू ो की पूिाानुमजत प्राप्त दकए जबना नहीं लगाया जाएगा।

(2) उप-जिजनयम (1) के अधीन ब्यूरो की अनुमजत प्राप्त करन े के उद्देश्य स,े रजजस्ट् री के जलए, प्ररूप I म ें यथाजनर्ददष्ट प्रत्येक ब्ांड के जलए पृथक रूप स,े ऑनलाइन अथिा भुगतान के दकसी अन्‍दय स्ट्िीकाय ा इलेक्रॉजनक तरीके स े दये एक लाख रुपय े की लेबल प्रजतभूजत जमा के साथ, आिेदन दकया जाएगा:

परन्‍द त ु दक लघ ु उद्योग के मामले म,ें लेबल प्रजतभूजत जमा केिल पच् चीस हजार रुपए होगा।

(3) उप-जिजनयम (2) के अधीन अनज्ञु ापत्रधारी के प्रत् येक आिेदन के साथ जनम्न जलजखत सलं ग् न करना होगा — (क) ऑनलाइन अथिा भुगतान के दकसी अन्‍दय स्ट्िीकाय ा इलेक्रॉजनक तरीके स े दये , दो हजार रुपए प्रजत मॉडल का आिेदन िल्ु क;

(ख) प्ररूप II म ें जनर्ददष् ट दस्ट् तािेज।

7. अनमु जत प्रदान करना -(1) जिजनयम 6 के अधीन कोई आिेदन प्राप्त होने पर और संतष्टु होने के बाद दक उसम ें सभी अपेक्षाओं का पालन दकया गया ह,ै ब्यूरो, ऐसी प्राजप्त की तारीख स े मानक एि ं लेबललग संबंधी अपने संचालन मैनुअल म ें यथाजनर्ददष्ट अिजध के भीतर, ऐसे जनबंधन एि ंितों के अधीन हो सकता ह ैजो जिजनयम 8 म ें जिजनर्ददष्ट की गई ह,ैं - (क) ब्ांड को प्ररूप III म ें अथिा इलक्े र ॉजनक रूप म ेंरजजस्ट् रीकृत करे; अथिा (ख) प्ररूप IV म ें अथिा इलेक्र ॉजनक प्ररूप म ें इलेजक्रक सीललग टाइप फैन पर लेबल जचपकान े के जलए अनुमजत प्रदान करे।

(2) ब् यरू ो प्ररूप V म ें एक रजजस्ट्ट र रखगे ा और इसम ेंअनुज्ञापत्रधारी का नाम दजा करेगा।

(3) उप-जिजनयम (1) के अधीन इस प्रकार प्रदान की गई अनुमजत उस अिजध के जलए िैध रहगे ी जब तक दक अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा यथा अजधसूजचत ऊजाा खपत मानक द्वारा जनर्ददष्ट स्ट्टार लेिल लागू रहता ह।ै

(4) अनुज्ञापत्रधारी द्वारा अनुमजत के निीनीकरण के जलए आिेदन इसकी समाजप्त स े छ: मास पूिा दकया जा सकता ह ै और इसके साथ ऑनलाइन अथिा भगु तान के दकसी अन्‍दय स्ट्िीकाय ा इलेक्रॉजनक तरीके स े दये एक हजार रुपय े का िुल्क सलं ग् न दकया जाएगा:4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परन्‍द त ु निीनीकरण का कोई आिेदन, यदद इसकी समाजप्त स े एक मास पूि ा दकया जाता ह,ै तो इसकी अनुमजत नहीं दी जाएगी।

(5) िैधता अिजध की समाजप्त के बाद दकसी आिेदन का निीकरण नहीं दकया जाएगा, ऐसे मामल े म ें अनुज्ञापत्रधारी को नया आिेदन करना होगा।

(6) उपजिजनयम (4) के अधीन निीकरण के जलए आिेदन प्राप्त होने पर और संतुष्ट होन े के बाद दक सभी अपेक्षाओं का पालन दकया गया ह,ै ब्यूरो, ऐसी प्राजप्त की तारीख स े एक मास की अिजध के भीतर, प्ररूप IV म ें अनुमजत का निीकरण कर सकता ह।ै

(7) ऐसा अनुज्ञापत्रधारी जो इलेजक्रक सीललग टाइप फैन के मौजूदा मॉडल पर संिोजधत स्ट् टार लेिल के लागू होन े की तारीख स ेलेबल जचपकाना जारी रखना चाहता ह,ै िह केिल प्ररूप VI म ें एक घोषणा प्रस्ट्तुत करेगा।

(8) यदद संिोजधत स्ट् टार लेिल के साथ समक्रजमक करते हुए इलेजक्रक सीललग टाइप फैन के नए मॉडल को िरूु करने की योजना ह ै तो, अनुज्ञापत्रधारी को लेबल जचपकाने के जलए नए जसरे स े अनुमजत लने ी होगी, ऐसी अनुमजत के जलए आिेदन अजग्रम रूप स ेसंिोजधत स्ट् टार लेिल के लाग ू होने स े छ: मास पूिा करना होगा।

8. लबे ल पर जििरण के प्रदिना के जलए जनबधं न एि ंित ें– प्रत् येक अनुज्ञापत्रधारी, व् यापारी और जिक्रेता,- (क) अजधजनयम की धारा 14 के खडं (क) के अधीन अजधसूजचत इलेजक्रक सीललग टाइप फैन के जलए ऊजा ा खपत मानकं का पालन करेगा;

(ख) केिल इलेजक्रक सीललग टाइप फैन के ऐस े मॉडलं पर ही लेबल जचपकाएगा जजसके जलए अनुमजत प्रदान की गई ह;ै (ग) इलेजक्रक सीललग टाइप फैन पर अनज्ञु ापत्रधारी की लागत पर लेबल जचपकाएगा; (घ) सुजनजित करेगा दक इलेजक्रक सीललग टाइप फैन के लेबल पर प्रदर्शित स्ट् टार लेिल सदैि अनरु जक्षत दकया जाएगा;

(ङ) जिजनयम 9 में यथा जिजनर्ददष् ट लेबल िल्ु क का भगु तान करेगा; (च) ब् यरू ो को एक जििरण प्रस्ट्त ुत करेगा जजसम ें जित् तीय िषा की प्रत् यके जतमाही की समाजप्त स े अगले मास के भीतर प्रत् यके जतमाही के जलए दये लेबलीकृत उपकरणं के उत्प ादन और उपार्शजत लेबललग िुल् क के ब् यौरे ददए गए हं;

(छ) ब् यरू ो को प्रत् येक िषा के 30 अप्रैल तक अपने लेबलीकृत उत् पादं के जिक्रय के जलए जनयुक्त प्राजधकृत जितरकं, डीलरं, खुदरा जिक्रेताओं, जिक्रेताओं की अद्यतन सूची प्रस्ट् तुत करेगा; (ज) ब् यरू ो के मानकं एि ं लेबललग संबंधी प्रचालन मैनअु ल म ें जन जहत जनबंधन एि ं ितों सजहत ब्य रू ो द्वारा जनर्ददष् ट ऐसी अन्‍द य जनबंधन एि ंितों का पालन करेगा।

9. लबे ल िल्ु क - (1) प्रत् यके अनुज्ञापत्रधारी इलेजक्रक सीललग टाइप फैन पर जचपकाए गए प्रत् येक लेबल के जलए एक रुपए के लेबल िलु क् का भुगतान करेगा;

(2) उप-जिजनयम (1) के अधीन जिजनर्ददष् ट लेबल िल्ु क का भुगतान िार्शषक रूप स े प्रत् येक जित् तीय िषा की समाजप्त की तारीख स े एक मास के भीतर दकया जाएगा: परन्‍द त ु ऐसी जिजनर्ददष् ट अिजध के भीतर लेबल िुल् क के भगु तान म ें जिफल रहन े पर, ब् यरू ो, दये राजि की, जिजनयम 6 के उपजिजनयम (2) के अधीन भगु तान दकए गए लेबल प्रजतभूजत जमा स,े उस पर दस प्रजतित प्रजत िष ा की दर स े ब् याज सजहत िसूली करेगा और यदद प्रस्ट् ततु दकए जाने की अंजतम तारीख के एक िषा के भीतर संपूणा लेबललग िल्ु क िसूल नहीं कर जलया जाता तो, ब् यरू ो अनुज्ञापत्रधारी को प्रदान दकए गए लेबलं को रद्द कर देगा और उसका नाम राष्र ीय अथिा क्षेत्रीय दैजनक समाचार पत्रं और इलेक्र ॉजनक माध् यमं म ें चूककता ा के रूप म ेंप्रकाजित करेगा।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5

10. लबे ल प्रजतभजू त जमा की िापसी – जिजनयम 9 के उपजिजनयम (2) के उपबंधं के अधीन, अनुज्ञापत्रधारी, इलेजक्रक सीललग टाइप फैन का जिजनमााण बंद करन े पर, लेबल सुरक्षा जमा की िापसी का पात्र होगा।

11. ब्य रू ो द्वारा सत्य ापन - (1) ब्यूरो या इसकी नामजनर्ददष् ट एजेंसी द्वारा, स्ट् ित: संज्ञान लेत े हुए अथिा कोई जिकायत प्राप् त होन े पर, यह सुजनजित करन े के जलए दक इलेजक्रक सीललग टाइप फैन स्ट्टार लेिल और उसके लेबल पर प्रदर्शित अन्‍दय जििरणं के अनरूु प ह ै और िह अनुमजत के अन्‍द य जनबधं न एि ं ितों का पालन करता ह,ै इसका सत्यापन दकया जा सकता ह।ै

(2) सत्यापन के प्रयोजनाथ,ा ब्यूरो या इसकी नामजनर्ददष् ट एजेंसी, जैसा उजचत समझ,े जिजनमााण सुजिधा, गोदाम या खुदरा आउटलेट से क्रमरजहत रूप स ेनमून े उठा सकती ह।ै

(3) जहां ब्यूरो के जलए, उपजिजनयम (1) के अधीन प्राप्त जिकायत पर, परीक्षण और अंििोधन प्रयोगिालाओं के जलए राष्ट्रीय प्रत्यायन बोड ा द्वारा जिजधित मान्‍दयता प्राप्त स्ट्ितंत्र प्रयोगिाला म ें इलेजक्रक सीललग टाइप पंख े के आपजि परीक्षण द्वारा सत्यापन दकया जाना अपेजक्षत ह,ै - (क) ब् यरू ो अनुज्ञापत्रधारी को ऐसा परीक्षण करने के जलए एक नोठटस जारी करेगा और जिकायतकत् ता ा को ब् यरू ो द्वारा जनधााठरत समय-सीमा के भीतर, परीक्षण, पठरिहन तथा अन्‍द य प्रासंजगक व् ययं स े संबंजधत ऐसे व् ययं को ब् यरू ो के पास जमा करन े को कहा जाएगा;

(ख) यदद आपजि परीक्षण के अधीन जलया गया नमनू ा जिफल हो जाता ह,ै तो अनज्ञु ापत्रधारी ब्यरू ो को नमून े की लागत, नमून े के पठरिहन और परीक्षण िुल्क संबंधी सभी व् ययं की प्रजतपूर्शत करेगा और ब्यरू ो जिकायतकता ा को उक्त व् यय िापस लौटाएगा; और (ग) जहां उपकरण आपजि परीक्षण म ें पास हो जाता ह,ै तो जिकायतकता ा द्वारा जमा दकया गया व् यय जब्त कर जलया जाएगा।

(4) जहां, उपजिजनयम (1) के अधीन जिकायत प्राप्त होने पर, यदद अनुज्ञापत्रधारी ऐसे समय के भीतर उपजिजनयम (3) म ें जिजनर्ददष्ट ऐसे व् ययं को जमा करने म ेंजिफल रहता ह,ै तो ब्यूरो-

(i) उपजिजनयम (3) म ें संदर्शभत इलेजक्रक सीललग टाइप फैन का आपजि परीक्षण करते हुए सत् यापन जारी रखेगा; और

(ii) जिजनयम 6 के अधीन प्राप् त आिेदन की प्रदक्रया ऐसे व् ययं के जमा दकए जाने तक आस्ट् थजगत रखी जाएगी।

(5) जहां स्ट् ित: संज्ञान द्वारा परीक्षण अथिा आपजि परीक्षण के दौरान परीक्षण के जलए प्रयोग दकए गए इलेजक्रक सीललग टाइप फैन के नमून े परीक्षण म ें जिफल हो जात े ह,ैं तो ब्यूरो अनुज्ञापत्रधारी को एक और अिसर प्रदान करेगा और ब्यूरो अनज्ञु ापत्रधारी की लागत पर परीक्षण और अंििोधन प्रयोगिालाओं के जलए राष्ट्रीय प्रत्यायन बोडा द्वारा जिजधित मान्‍दयता प्राप्त स्ट्ितंत्र प्रयोगिाला म ें पहल े परीक्षण म ें प्रयुक्त इलेजक्रक सीललग टाइप फैन की दोगुनी मात्रा पर दसू रा परीक्षण संचाजलत करेगा।

(6) जहां दसू रा परीक्षण जिफल हो जाता ह ैतो, ब् यरू ो,- (क) सभी राज्य नामजनर्ददष् ट एजेंजसयं को सूजचत करते हुए, प्ररूप VII म ें अनुज्ञापत्रधारी को जनदेि देगा दक अनुज्ञापत्रधारी दो मास की अिजध के भीतर,-

(i) इलेजक्रक सीललग टाइप फैन की पैकेलजग और मोटर पर जचपकाए गए लेबल पर प्रदर्शित स्ट्टार लेिल को सही करे अथिा परीक्षण के दौरान पाए गए दोषं और कजमयं को दरू करे;

(ii) ब् यरू ो के जनदेिं का पालन करन े के जलए बाजार स े समस्ट्त स्ट् टॉक िापस ल;े और

(ग) अजधजनयम की धारा 27 के अधीन अनज्ञु ापत्रधारी और व्यापारी के जिरुद्ध आगे अजधजनणया न कायािाही िुरू करने हते ु संबंजधत राज्य अजभजहत अजभकरण को सूजचत करेगा।

(7) अनज्ञु ापत्रधारी, उप-जिजनयम (6) म ेंजनर्ददष् ट दो मास की अिजध समाप् त होने के दस ददन के भीतर,- (क) जनदेि के अनपु ालन म ें की गई कारािाई के संबंध म ें ब् यरू ो को प्ररूप VIII म ें अनुपालन ठरपोट ा भेजेगा;

और (ख) यदद जिजनर्ददष् ट अिजध के भीतर खंड (क) म ें जनर्ददष् ट अनपु ालन ठरपोट ा प्राप् त नहीं होती अथिा दकसी जनदेि का अनपु ालन दकए जबना प्राप् त होती ह ै तो, इस े जारी जनदेिं का अनुपालन नहीं दकया गया माना जाएगा और ब् यरू ो द्वारा इसके जलए आदेि पाठरत दकया जाएगा।

(9) जहां अनुज्ञापत्रधारी उप-जिजनयम (6) के अधीन ब् यरू ो द्वारा जारी जनदेिं का पालन करने म ें जिफल रहता ह ैतो, ब् यरू ो सभी राज्य नाजमत अजभकरणं को सूजचत करत े हुए- (क) जिजनयम 7 के उप-जिजनयम (1) के अधीन अनुज्ञापत्रधारी को प्रदान की गई अनुमजत िापस ल ेलेगा;

(ख) केन्‍द रीय सरकार द्वारा अजधजनयम की धारा 14 के खंड (ग) के अधीन जिचार करन े और कारािाई करन े के जलए, अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍दर ीय सरकार द्वारा अजधसूजचत ऊजाा खपत मानकं, उपजिजनयम (7) के खंड (क) म ें जनर्ददष् ट ब् यरू ो के जनदेिं के पालन म ें अनुज्ञापत्रधारी की जिफलता के समथना म ेंपरीक्षण ठरपोट ा सजहत, केन्‍द रीय सरकार को ठरपोटा भेजेगा;

2. यह अनुमजत जनजम् न जलजखत के अधीन ह—ै (क) इलेजक्रक सीललग टाइप फैन के लेबल पर प्रदर्शित स्ट् टार लेिल अजधजनयम की धारा 14 के खंड (क) के अधीन अजधसूजचत इलेजक्रक सीललग टाइप फैन के जलए ऊजाा खपत मानकं तथा पूिोक्त जिजनयमं म ें उपबंजधत जनबंधन और ितों के अनुरूप होगा। (ख) यह लेबल केिल इलेजक्रक सीललग टाइप फैन के उस मॉडल पर ही जचपकाया जाएगा जजसके जलए अनुमजत प्रदान की गई ह;ै (ग) इलेजक्रक सीललग टाइप फैन पर यह लेबल अनज्ञु ापत्रधारी की लागत पर छपिाया और जचपकाया जाएगा। (घ) अनुज्ञापत्रधारी सुजनजित करेगा दक इलेजक्रक सीललग टाइप फैन पर प्रदर्शित स्ट् टार लेिल हमेिा बनाए रखा जाएगा;

(ङ) अनुज्ञापत्रधारी ब् यरू ो द्वारा यथाजिजनर्ददष् ट लेबल िुल् क का भुगतान करेगा; (च) अनुज्ञापत्रधारी जित् तीय िषा की प्रत् यके जतमाही की समाजप्त के अगल े मास के भीतर ब् यरू ो को लेबल लगाए गए उपकरण के उत् पादन और प्रत् यके जतमाही के जलए उपार्शजत लेबललग िुल् क के ब् यौरे का एक जििरण प्रस्ट्त ुत करेगा। इन ब् यौरं को ब् यरू ो को ऑनलाइन प्रणाली के माध् यम स े भी प्रस्ट् ततु दकया जाएगा;

(छ) अनुज्ञापत्रधारी जजस इलेजक्रक सीललग टाइप फैन के जलए अनमु जत प्रदान की गई ह,ै उसके बारे म ें ब् यरू ो द्वारा मांगे गए अन्‍द य ब् यौरे उपलब् ध कराएगा।

NOTIFICATION New Delhi, the 19th May, 2022 No. BEE/S&L/Ceiling Fan/05/2019-20.—Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Electric Ceiling Type Fans) Regulations, 2021, were published vide notification number BEE/S&L/Ceiling Fan/05/2019-20, dated the 2nd July, 2021 as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of

2001), inviting objections or suggestions from persons likely to be affected thereby within the specified period of thirty days from the date of publication of the said notification in the Official Gazette;

And whereas Gazette copies of the said draft regulations were published in the aforesaid Gazette on 2nd July, 2021; And whereas suggestions have been received with respect to the said draft regulations within the period aforesaid;

And whereas the suggestions received in this regard have been taken into consideration;

Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations, namely:-

1. Short title and commencement.– (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Electric Ceiling Type Fans) Regulations, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- (1) In these regulations, unless the context otherwise requires,-

(a) ―Act‖ means the Energy Conservation Act, 2001 (52 of 2001);

(b) ―Electric Ceiling Type Fan‖ means an appliance notified under Clause (b) of Section 14 of the Act;

(c) ―Family of models‖ means group of models for which all the performance parameters are same;

(d) ―Form‖ means a Form appended to these regulations;

(e) ―label‖ means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the Electric Ceiling Type Fan;

(f) ―label period‖ means the validity period of the service value under the energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act and in case the end period of the service value is not specified, it shall be deemed to be valid until a service value is specified by the Central Government;

(g) ―permittee‖ means a person or agency to whom permission has been granted to affix label under regulation 7;

(h) ―Schedule‖ means the Schedule annexed to these regulations;

(i) ―star rating or star level‖ means the grade of energy efficiency displayed on the label of the Electric Ceiling Type Fan based on service value notified by the Central Government under clause (a) of section 14 of the Act;

(j) ―trader or seller‖ in relation to any Electric Ceiling Type Fan means a person who sells or distributes such fans and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such Electric Ceiling Type Fans.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.[भाग III—खण्‍ड‍4] भारत‍का‍राजपत्र‍:‍असाधारण‍ 27

3. Particulars to be displayed on label.- (1) On every Electric Ceiling Type Fan, the following particulars shall be displayed on its label, namely:-

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand;

(c) trade name and number;

(d) model and year of manufacturing or import;

(e) unique series code;

(f) power input in watts ;

(g) air delivery in cu m/min;

(h) service value in cu m/min/Watts;

(i) star level of Electric Ceiling Type Fan ; and

(j) label period;

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.- (1) A label containing all the particulars specified in regulation 3 shall be displayed on every Electric Ceiling Type fan within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller shall ensure that-

(a) the electric ceiling type fan put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year of the Electric Ceiling Type fan shall also be in synchronization with such revised energy consumption standards, and shall not produce the Electric Ceiling Type fan with the previous energy consumption standards;

(b) all preparatory steps including awareness of the dealers, retailers and consumers, requisite publicity for their education shall be well planned and taken three months in advance of the date of such commencement, under these regulations.

5. Manner of display of label.- (1) There shall be a label on every electric ceiling type fan which shall be displayed at the point of sale and such label shall be affixed on the electric ceiling type fan in the following manner, namely:-

(a) Self-adhesive or Printed label affixed on packaging;

(b) Self-adhesive label affixed on motor.

6. Permission for display of label.- (1) No star label shall be affixed on a electric ceiling type fan without obtaining the prior permission of the Bureau.

(2) For the purpose of obtaining permission of the Bureau under sub-regulation (1), an application for registration shall be made for every brand separately as specified in Form I, accompanied by a label security deposit of one lakh rupees, payable online or by any other acceptable electronic mode of

payment:

Provided that in case of small scale industry, label security deposit shall be twenty-five thousand rupees only.

(3) Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable online or by any other acceptable electronic mode of payment;

(b) documents specified in Form II.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

7. Grant of permission. -(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its operation manual on standards and labelling from the date of such receipt, subject to such terms and conditions as are specified in regulation 8, –

(a) register the brand in Form III or in electronic form; or

(b) grant permission for affixing label on electric ceiling type fan in Form IV or in electronic form.

(2) The Bureau shall maintain a register in Form V and enter the name of the permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 of the Act is in force.

(4) An application for renewal of permission may be made by the permittee six months before its expiry and shall be accompanied by a fee of rupees one thousand payable online or by any other

acceptable electronic mode of payment:

Provided that no application for renewal shall be allowed if it is made one month before its expiry.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form IV.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the electric ceiling type fan from the date from which the revised star level comes into force, shall submit only a declaration in Form VI.

(8) The permittee shall seek permission to affix label afresh, if a new model of the electric ceiling type fan is planned to be launched synchronising with the revised star level, an application for such permission shall be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall,-

(a) comply with the energy consumption standards for electric ceiling type fan notified under clause (a) of section 14 of the Act;

(b) affix label only on such model of electric ceiling type fan for which permission has been granted;

(c) affix label on the electric ceiling type fan at the cost of the permittee;

(d) ensure that the star level displayed on the label of electric ceiling type fan shall be maintained at all time;

(e) pay the label fee as specified in regulation 9;

(f) furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of closure of each quarter of the financial year;

(g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell its labelled products by 30th day of April of each year;

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Operation Manual on Standards and Labelling.

9. Label fee. - (1) Every permittee shall pay to the Bureau a label fee of one rupee for each label affixed on the electric ceiling type fan;

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the

Provided that on failure to pay the label fee within the period so specified, the Bureau shall recover the amount due with interest thereon at ten per cent. per annum from the label security deposit paid under sub-regulation (2) of regulation 6 and if complete labelling fees is not recovered within one year of the last date of submission, the Bureau shall cancel the labels granted to the permittee and publish his name in the national or regional daily newspapers and in electronic means as a defaulter.

10. Refund of label security deposit. - Subject to the provisions of sub-regulation (2) of regulation 9, the permittee shall be entitled to a refund of the label security deposit, on ceasing to manufacture electric ceiling type fan.

11. Verification by Bureau.- (1) The Bureau or its designated agency may, either suo motu or on a complaint received by it, carry out verification to ensure that the electric ceiling type fan conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purposes of verification, the Bureau or its designated agency may pick up samples at random from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the electric ceiling type fan in an independent laboratory duly accredited by the National Accreditation Board for testing and calibration laboratories,-

(a) the Bureau shall issue a notice to the permittee for carrying out such testing and the complainant shall be called upon to deposit such expenses related to testing, transportation and other incidental expenses with the Bureau, within such time as may be determined by the Bureau;

(b) if the sample drawn under challenge testing fails, the permittee shall reimburse all expenses towards the cost of sample, transportation of sample and the testing charges to the Bureau and the Bureau shall refund the said expenses to the complainant; and

(c) where the equipment passes the challenge test, then the expenses deposited by the complainant shall stand forfeited.

(4) Where, upon a complaint received under sub-regulation (1), if the permittee fails to deposit such expenses referred to in sub-regulation (3) within such time, the Bureau shall-

(i) continue the verification by challenge testing the electric ceiling type fan referred to in sub- regulation (3); and

(ii) the processing of application received under regulation 6 may be kept in abeyance till such expenses are deposited.

(5) Where samples of electric ceiling type fan used for testing fails, the test during suo motu testing or challenge testing, the Bureau shall offer the permittee another opportunity and the Bureau shall conduct a second test with twice the quantity of electric ceiling type fan used in the first test in an independent test laboratory duly accredited by the National Board of Accreditation for testing and calibration laboratories at the cost of the permittee.

(6) Where the second test fails, the Bureau shall,-

(a) direct the permitte in Form VII, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label affixed on the packaging and motor of electric ceiling type fan or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications;30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(7) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub- regulation (6) ,-

(a) send the compliance report in Form VIII to the Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed to be non- compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(8) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub-regulation (7) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.

(9) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation

(6), the Bureau under intimation to all State Designated Agencies shall-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (7) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications;

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission. - The Bureau may cancel the permission granted under regulation 7, if the permittee—

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(c) fails to comply with the directions issued under regulation 11:

Provided that no permission shall be cancelled unless the permittee has been given an opportunity being heard in the matter.

1. Pursuant to the provisions of Regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Electric Ceiling Type fan) Regulations, 2022, the Bureau hereby permits you to register your brand as per details of approvals set out in the Annexure A- III to this letter.

2. This permission is subject to—

(a) the star level displayed on the label of the Electric Ceiling Type fan shall conform to energy consumption standards for Electric Ceiling Type fan notified under clause (a) of

section 14 of the Act and terms and conditions provided in the aforesaid regulations;

(b) the label shall be affixed only on such model of Electric Ceiling Type fan for which permission has been granted;

(c) the label shall be printed or affixed on the Electric Ceiling Type fan at the cost of the permittee;

(d) the permittee shall ensure that the star level displayed on the Electric Ceiling Type fan shall be maintained at all time;

(e) the permittee shall pay the label fee as specified by the Bureau;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of the close of each quarter of the financial year. The same details shall be furnished to the Bureau also through online system;

(g) the permittee shall make available such other details of Electric Ceiling Type fan as and when sought by the Bureau of which the permission has been granted.

3. The permittee shall not withdraw the registered brand………. and the Electric Ceiling Type fan from the market during the validity period except with the prior approval of the Bureau.

1. Pursuant to the provisions of Regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Electric Ceiling Type fan) Regulations, 2022, the Bureau hereby permits you to stamp and print or affix label as per details of approvals set out in the Annexure A- IV to this letter.

2. This permission is subject to—

(a) the star level displayed on the label of the Electric Ceiling Type fan shall conform to energy consumption standards for Electric Ceiling Type fan notified under clause (a) of section 14 of the Act and terms and conditions provided in the aforesaid regulations;42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(b) the label shall be affixed only on such model of Electric Ceiling Type fan for which permission has been granted;

(c) the label shall be printed or affixed on the Electric Ceiling Type fan at the cost of the permittee;

(e) the permittee shall pay the label fee of 1 rupee per label;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of the close of each quarter of the financial year. (g) the permittee shall make available such other details of Electric Ceiling Type fan as and when sought by the Bureau of which the permission has been granted.

2. The Bureau, under regulation … of these regulations, purchased a BEE star labelled Electric Ceiling Type Fans from your authorised distributor, dealer, retailer vide Invoice number .......dated for a price of Rs................ and lifted as a sample dated ……by M/s......................, an agency appointed by the Bureau for verification of the particulars displayed on the label under regulation 3, affixed by you on the aforesaid purchased Electric Ceiling Type Fans. The Bureau through its aforesaid verification agency transported the sample referred to in para 2 to M/s. ..................., a National Board of Accreditation for Testing and Calibration Laboratories accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 4 and 5 of.

6. The test results of second check testing are enclosed which are duly checked and counter signed by the competent authorized personnel of the National Board of Accreditation for Testing and Calibration Laboratories accredited laboratory. The test results confirm that they failed to meet the requisite parameters and standards given in S.O. number.…dated, ….and the terms and conditions of the permission given to you for display of particulars on label affixed to the Electric Ceiling Type Fans manufactured/imported and sold in the market .

7. 8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within ten days after the expiry of two months, i.e., by ...............In case no compliance report is received by the said date, the Bureau shall proceed to take action under these regulations.
