उ6त राजप: क(cid:27) *ितयां 5 अ6त ूबर, 2017 को जनता को उपल" ध करा दी गई थ<; उ6त पूव=6त अविध के भीतर उ6त *.प िविनयम के सबं ंध म (जनता स े*ा>त आ(cid:19)ेप या सझु ाव *ा> त नह< Bए ह;5 अत: अब, उ6त अिधिनयम क(cid:27) धारा 58 क(cid:27) उपधारा (2) के खंड (1) और उ6 त धारा 13 क(cid:27) उपधारा (2) के खंड (ढ़) के साथ पFठत उ6त धारा 14 के खंड (घ) Jारा *दKत शि6Kय) का *योग करते Bए और ऊजा (cid:13) द(cid:19)ता " यूरो (%ूबलर Lलोरेस(ट के लेबल) पर उनके स*ं दश(cid:13)न क(cid:27) िविशि-यां और रीित) िविनयम, 2009 को उन बात) के िसवाए अिधPांत करत ेBए िजQह ( अिधPमण से पहले (cid:4)कया गया ह ै या करन े का लोप (cid:4)कया गया ह,ै केQ Sीय सरकार के पूव(cid:13) अनमु ोदन स े एतTारा िनUन िलिखत िविनयम बनाती ह,ै अथा(cid:13)त ्:-

1. ससससििंंििंं(cid:7)(cid:7)(cid:7)(cid:7)(cid:17)(cid:17)(cid:17)(cid:17) ननननाााामममम औऔऔऔरररर (cid:21)(cid:21)(cid:21)(cid:21)ााााररररंंंंभभभभ.- (1) इन िविनयम) का संि(cid:19)Z नाम ऊजा (cid:13) द(cid:19)ता (टुबुलर Lलोर(स लैUप) के लेबल) पर उनके सं*दशन(cid:13) क(cid:27) िविशि-यां और रीित) िविनयम, 2018 ह ै।

(2) ये राजप: म (इनके *काशन क(cid:27) तारीख को *वृ^ ह)गे ।

2. पपपप(cid:24)(cid:24)(cid:24)(cid:24)ररररभभभभााााषषषषााााएएएएंं.ंं- (1) इन िविनयम) जब तक (cid:4)क सदं भ(cid:13) से अQयथा अपेि(cid:19)त न हो, (क) "अिधिनयम " स ेऊजा (cid:13)सरं (cid:19)ण अिधिनयम, 2001 (2001 का 52) अिभ*ेत ह ै;

(घ) "लेबल" स ेटुबुलर Lलोर(स लैUप पर िलखा गया, म(cid:4)ु Sत, िचQहा(cid:4)ं कत, aटािUपत या उस पर िचपकाया गया या उपद7श(cid:13)त िचि:त िवषय वaतु अिभ*ेत ह ै; (ङ) "लेबल अविध" स े अिधिनयम क(cid:27) धारा 14 के खंड (क) के अधीन केQSीय सरकार Jारा अिधसिू चत ऊजा (cid:13)खपत मानक के अधीन eिु तमान ((cid:6)यूिमनस) द(cid:19)ता क(cid:27) िविधमाQय अविध अिभ*ते ह ै;

परंतु य(cid:4)द य(cid:4)द (cid:6)यूिमनस अविध क(cid:27) िविधमाQयता अविध क(cid:27) समािZ को अिधसिू चत नह< (cid:4)कया जाता ह ै तो उस े तब तक िविधमाQय समझा जाएगा जब तक केQSीय सरकार Jारा उसके नए मू(cid:6)य अिधसिू चत न कर (cid:4)दए जाए ं। (च) "माडल या माडल) के वग(cid:13)" स े (cid:4)कसी िविश- fांड के उKपाद या उKपाद) के gणे ी अिभ*ेत ह ै िजसके परी(cid:19)ण Fरपोट(cid:13) का एकल सेट लागू होता ह ैऔर जहा ं उKपाद) म (से *Kयके उKपाद का मौिलक aवiप (cid:6)यूिमनस द(cid:19)ता, aटार रेjटंग aतर और सUपादन aव.प समान होता ह ै;

(छ) "अनkु ािपत lि2" से ऐसा lि2 या अिभकरण अिभ*ेत ह ै िजसे िविनयम 7 के अधीन लेबल िचपकाने क(cid:27) अनkु ा दी गई ह ै; (ज) "अनसु ूची" स ेइन िविनयम) स ेसंलb अनसु ूची अिभ*ते ह ै; (झ) "aटार रेjटंग या aटार लेवल'' स े अिधिनयम के अधीन केQSीय सरकार Jारा अिधसूिचत ऊजा (cid:13) खपत मानक पर आधाFरत टुबलु र Lलोर(स लैUप के लेबल पर सं*द7शत(cid:13) ऊजा(cid:13) द(cid:19)ता का nेड अिभ*ेत ह ै;

(ञ) टुबुलर Lलोर(स लैUप पर लगाए (cid:4)कसी लेबल के संबंध म( ''lापारी या िवPेता'' से ऐसा lि2 अिभ*ते ह ै जो ऐसी टुबलु र Lलोर(स लैUप का िवPय या िवतरण करता ह ै और इसके अQतगत(cid:13) ऐसा दकु ानदार, lापारी, िविनमा(cid:13)ता और अनkु ािपत l(cid:4)कत भी ह ै िजसे ऐसा टुबुलर Lलोर(स लUै प पर लेबल लगाने क(cid:27) अनुkा दी गई ह ै;

(ट) "टुबुलर Lलोर(स लैUप" से अिधिनयम के अधीन केQSीय सरकार Jारा अिधसिू चत कोई सािध: अिभ*ते ह ै;

(2) उन श"द) और पद) के, जो इसम( *यु2 ह 5 और पFरभािषत नह< ह ै oकंतु अिधिनयम म( पFरभािषत ह,5 वही अथ(cid:13) ह)गे जो Pमशः उनके अिधिनयम म (ह 5।

(ख) िविनमा(cid:13)ता या आयातकता(cid:13) या fांड का नाम ; (ग) टुबलु र Lलोर(स लैUप का आकार और रंग तापमान ; (घ) lापार नाम और सrं या ; (ड.) मॉडल और िविनमा(cid:13)ण या आयात का वष (cid:13); (च) िविश- gेणी कोड ;

(छ) वाट म (िवeुत शि2 क(cid:27) खपत ; (ज) टुबुलर Lलोर(स लैUप का aटार लेवल;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 (झ) 1 एम ड"लयू म ((cid:6)युमनस द(cid:19)ता ; (ञ) लेबल अविध ;

(2) लेबल का िडजायन, रंग, आकार और िविशि-या ंइन िविनयम) स ेसंलb अनसु ूची म (यथािविनvद-(cid:13) ह)गी ।

4. ललललबबेेबबेे लललल ककककेेेे सससस(cid:21)(cid:21)ंं(cid:21)(cid:21)ंं ददददशशशशनन(cid:4)(cid:4)नन(cid:4)(cid:4) ककककेेेे ििििललललएएएए ससससममममययययससससीीीीममममाााा---- (1) *Kयके टुबलु र Lलोर(स लैUप पर िविनयम 3 म( िविनvद-(cid:13) सभी िविशि-य) वाल ेलेबल को, इन िविनयम) के *वृ^ होने क(cid:27) तारीख से छह मास क(cid:27) अविध के भीतर सं*द7श(cid:13)त (cid:4)कया जाएगा ।

(2) केQSीय सरकार Jारा अिधसिू चत पुनरीि(cid:19)त ऊजा(cid:13) खपत मानक) के *ारUभ क(cid:27) तारीख से ही *Kयके अनुkािपत lि2 या lापारी या िवPेता यह सिु निwत करेगा (cid:4)क – (क) िवPय के िलए रखे गए टुबुलर Lलोर(स लैUप के बाहरी आवरण पर पुनरीि(cid:19)त aटार ल5प पर पुनरीि(cid:19)त ऊजा (cid:13) खपत मानक) को समसमािहत करत े Bए पनु रीि(cid:19)त aतर लबे ल और पनु रीि(cid:19)त लेबल अविध स*ं द7शत(cid:13) क(cid:27) जाएगी और ऐसे पुनरीि(cid:19)त ऊजा(cid:13) खपत मानक) के साथ टुबुलर Lलोर(स लैUप का िविनमाण(cid:13) वष(cid:13) भी समसमािहत हो और पूव(cid:13)वतx ऊजा (cid:13)खपत मानक) के साथ टुबलु र Lलोर(स लUै प तैयार नह< (cid:4)कया जाएगा । (ख) इन िविनयम) के अधीन lौहाFरय), खुदरा िवPेताy और उपभो2ाy को जागiक बनान,े उQह( िशि(cid:19)त करने के िलए *चार सिहत सभी *ारिUभक उपाय, *ारंभ होन ेक(cid:27) तारीख स ेछह मास पहले (cid:4)कए जाएंगे ।

5. ललललबबेेबबेे लललल ककककेेेे सससस(cid:21)(cid:21)(cid:21)(cid:21)ंंंं ददददशशशशनन(cid:4)(cid:4)नन(cid:4)(cid:4) कककक!!!! ररररीीीीिििितततत....---- (1) टुबुलर Lलोर(स लैUप पर एक लेबल लगा होगा िजसे िवPय के aथान पर लगाया जाएगा और ऐसे लेबल को िनqिलिखत रीित स ेटुबुलर Lलोर(स लैUप पर िचपकाया जाएगा, अथात(cid:13) ्:- (क) रंग योजना के साथ लेबल क(cid:27) फोटो 16 िमलीमीटर क(cid:27) उंचाई तक छोटा करके नली पर मु(cid:4)Sत क(cid:27) जाएगी ;

(ख) *Kयके िविनमा(cid:13)ता और आयातकता(cid:13) नली पर रंग का तापमान द7श(cid:13)त करेगा ; (ग) टुबुलर Lलोर(स लैUप पर रेjटंग के अनसु ार aटार मा{क|ग क(cid:27) जाएगी, aटार मा{क|ग के िलए aटाUप का आकार 14.5 िमलीमीटर ऊंचा x 8.5 िमलीमीटर चौड़ा होगा और एक पथृ क aतंभ म( aटािUपत (cid:4)कया जाएगा ।

6. ललललबबेेबबेे लललल ककककेेेे सससस(cid:21)(cid:21)ंं(cid:21)(cid:21)ंं ददददशशशशनननन(cid:4)(cid:4)(cid:4)(cid:4) ककककेेेे ििििललललएएएए अअअअनननन’’ुु’’ुु ाााा- (1) "यूरो क(cid:27) पूव(cid:13) अनुkा के िसवाय टुबलु र Lलोर(स लैUप पर कोई aटार लेबल नह< िचपकाया जाएगा ।

(2) उप िविनयम (1) के अधीन "यूरो क(cid:27) अनुkा अिभ*ाZ करने के *योजन) के िलए अनुkािपत lि2 *Kयके fांड के िलए aवयं को एक लाख iपए क(cid:27) लेबल *ितप7ू त (cid:13) फ(cid:27)स के साथ, जो ऊजा (cid:13) द(cid:19)ता "यरू ो, नई (cid:4)द(cid:6)ली के प(cid:19) म( आहFरत मांगदये ~ाLट Jारा या संदाय के (cid:4)कसी अQय aवीकाय(cid:13) इलै6(cid:127)ािनक रीित म ( सदं ये होगी, पृथक iप से रिजa(cid:127)ीकृत करवाएगा:

परंत ुलघ ुउeोग के िलए लेबल *ितभिू त फ(cid:27)स प(cid:128)ीस हजार iपए होगी;

(3) उपिविनयम (2) के अधीन रिजa(cid:127)ीकरण के िलए *Kयके आवेदन के साथ िनqिलिखत सलं b ह)गे (क) *ित माडल दो हजार iपए आवेदन फ(cid:27)स, जो ऊजा(cid:13) द(cid:19)ता "यूरो, नई (cid:4)द(cid:6)ली के प(cid:19) म( आहFरत मांगदये ~ाLट Jारा या संदाय के (cid:4)कसी अQय aवीकाय(cid:13) इलै6(cid:127)ािन6स रीित Jारा संदये होगी । (ख) *iप 1 म( िविनvद-(cid:13) दaतावेज ।

7. अअअअनननन’’ुु’’ुु ाााा ककककाााा ((((ददददययययाााा जजजजााााननननाााा औऔऔऔरररर ननननववववीीीीककककररररणणणण – (1) "यूरो, िविनयम 6 के अधीन आवदे न *ाZ होने और यह समाधान हो जाने पर (cid:4)क इसम ( सभी अपे(cid:19)ाy का पालन (cid:4)कया गया ह,ै ऐसी *ािZ क(cid:27) तारीख स े एक मास क(cid:27) अविध के भीतर, ऐस े िनबQध) और शत(cid:129) के अधीन रहत े Bए, जो िविनयम 8 म( िविनvद-(cid:13) (cid:4)कए जाएं, म ( टुबुलर Lलोर(स लैUप पर *iप 2 म ( या इलै6(cid:127)ािनक *iप म( लेबल लगाने क(cid:27) अनुkा दे सकेगा।

(2) "यूरो, *iप 3 म( अनुkािपत lि2 का नाम और िविशि-यां *िव- करेगा।

(3) उपिविनयम (1) के अधीन इस *कार दी गई अनkु ा ऐसी अविध के िलए िविधमाQय होगी िजसके िलए केQSीय सरकार Jारा यथा अिधसिू चत ऊजा(cid:13) खपत मानक Jारा िविनvद-(cid:13) aटार लेबल *वृ^ ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(4) अनkु ािपत lि2 अनुkा के नवीकरण के िलए छह पूव(cid:13) मास oकंत ु उसके समाZ होन ेके पवू (cid:13) तीन मास के अपwात ् आवेदन करेगा और उसके साथ एक हजार iपए फ(cid:27)स संलb होगी जो ऊजा (cid:13) द(cid:19)ता "यूरो, नई (cid:4)द(cid:6)ली के प(cid:19) म ( आहFरत मांगदये ~ाLट के .प म (या इलै6(cid:127)ािनक रीित स ेसंदये होगी।

(5) उपिविनयम (4) के अधीन नवीकरण के िलए आवेदन *ाZ होने पर, यह समाधान हो जाने के पwात् (cid:4)क सभी अपे(cid:19)ाy का पालन कर (cid:4)दया गया ह,ै ऐसी *ािZ क(cid:27) तारीख स े एक मास क(cid:27) अविध के भीतर *iप 2 म( अनkु ा का नवीकरण (cid:4)कया जाएगा।

(6) िविधमाQय अविध क(cid:27) समािZ के पwात ् नवीकरण के िलए (cid:4)कया गया कोई आवेदन नामंजूर कर (cid:4)दया जाएगा और अनkु ािपत lि2 अनुkा के िलए नए िसरे स ेआवेदन कर सकेगा।

(7) ऐसा अनुkािपत lि2, जो उस तारीख से िजसस े पुनरीि(cid:19)त aटार लवे ल *वृ^ होत े ह,5 टुबुलर Lलोर(स लैUप के िवeमान माडल पर लेबल लगाने क(cid:27) अनुkा जारी रखन ेक(cid:27) ई>सा करता ह,ै *iप 4 म( एक घोषणा *aतुत करेगा।

(8) पनु रीि(cid:19)त aटार लेवल के समसमाियक टुबुलर Lलोर(स लैUप का नया मॉडल *ारUभ करने क(cid:27) योजना है तो अनुkािपत lि2 नए िसरे स े लेबल लगान े क(cid:27) अनुkा क(cid:27) ई>सा करेगा और ऐसी अनkु ा के िलए आवेदन, पनु रीि(cid:19)त aटार लेवल के *व^ृ होन ेके छह मास पूव (cid:13)(cid:4)कया जाएगा।

8. ललललबबेेबबेे लललल पपपपरररर ििििववववििििशशशशिििि$$$$यययय**** ककककेेेे सससस(cid:21)(cid:21)ंं(cid:21)(cid:21)ंं ददददशशशशनन(cid:4)(cid:4)नन(cid:4)(cid:4) ककककेेेे ििििननननबबबब++++धधधधनननन औऔऔऔरररर शशशशतततत--.--- *Kयेक अनुkािपत lि2, lापारी और िवPेता,- (क) केQSीय सरकार Jारा अिधसिू चत टुबुलर Lलोर(स लैUप के िलए ऊजा (cid:13)खपत मानक) का पालन करेगा;

(ख) केवल ऐसे टुबुलर Lलोर(स लैUप के माडल पर लेबल लगाया जाएगा िजQह (अनुkा दी गई ह ै; (ग) टुबुलर Lलोर(स लैUप पर लेबल अनुkािपत lि2 के खच(cid:130) पर लगाया जाएगा; (घ) यह सिु नशिचत करेगा (cid:4)क टुबलु र Lलोर(स लैUप के लेबल पर सं*द7शत(cid:13) aटार लेवल को सभी समय पर बनाए रखा जाएगा ;

(ङ) िविनयम 9 म( यधा िविनvद-(cid:13) लबे ल फ(cid:27)स का संदाय करेगा; (च) "यूरो को लेबलीकृत उपaकर के उKपादन के "यौरे और िव^ीय वष(cid:13) के *Kयके ितमाही के िलए दये लेबल लगान ेके िलए *ो(cid:131)भतू फ(cid:27)स अ^ं 7व(cid:13)- करके एक िववरण दगे ा ;

(छ) "यूरो को *Kयके वष(cid:13) क(cid:27) 30 अ*ैल तक उसके लेबल लगे उKपाद) के िवPय के िलए िनय2ु *ािधकृत िवतरक), lौहारी, खुदरा िवPेताy, िवPेताy क(cid:27) अeतन सचू ी दगे ा; (ज) ऐस े अQय िनबQधनो और शत(cid:129) का पालन करेगा जो िवनvद-(cid:13) (cid:4)कए जाए िजसके अंतग(cid:13)त वे भी ह 5 जो मानक और लेबल लगान ेसंबंधी "यूरो *चालन मैनअु ल म( अतं 7व(cid:13)- ह ै।

9. ललललबबेेबबेे लललल फफफफ!!!!सससस .-(1) *Kयके अनुkािपत lि2, "यूरो को टुबलु र Lलोर(स लैUप पर लगाए गए *Kयके लेबल के िलए पांच पसै ा लेबल फ(cid:27)स का संदाय करेगा ।

(2) उप-िनयम (1) के अधीन िविनvद-(cid:13) लेबल फ(cid:27)स, *Kयेक िव^ीय वष(cid:13) क(cid:27) समािZ क(cid:27) तारीख स े एक मास के भीतर वा7षक(cid:13) iप स ेसंद^ क(cid:27) जाएगी ।

(3) य(cid:4)द अनुkा*ाZ lि2, इस *कार िविनvद8(cid:13) ट अविध के भीतर लबे ल फ(cid:27)स का संदाय करने म( असफल रहता ह ै तो "यरू ो, िविनयम 6 के उपिविनयम (2) के खंड (ख) के अधीन दी गई लेबल सरु (cid:19)ा फ(cid:27)स से ऐसी शो(cid:132)य रकम को उस पर *ितवष (cid:13) दस *ितशत "याज के साथ वसलू कर सकेगा और य(cid:4)द *aतुत (cid:4)कए जाने क(cid:27) अंितम तारीख स े एक वष(cid:13) के भीतर संपूण (cid:13)लेबल फ(cid:27)स क(cid:27) वसलू ी नह< होती ह ै तो "यूरो अनुkािपत lि2 को (cid:4)दया गया लेबल र(cid:133) कर सकेगा और समाचारप:) म( उसका नाम lितPमी के .प म( *कािशत करवा सकेगा ।

(4) जहां, उपिविनयम (1) के अधीन *ाZ (cid:4)कसी िशकायत पर, य(cid:4)द अनुkािपत lि2, ऐसे समय के भीतर उपिविनयम (3) म( िनvद-(cid:13) ऐसे lय जमा करन े म ( असफल रहता ह ै तो "यूरो उप िविनयम (3) म ( िनvद-(cid:13) टुबुलर Lलोर(स लैUप क(cid:27) चनु ौतीपणू (cid:13) परी(cid:19)ा Jारा सKयापन जारी रखेगा और िविनयम 6 के अधीन *ाZ आवेदन के *गमन म(, ऐस े lय जमा (cid:4)कए जाने तक *ाaथगन रखेगा।

(5) परी(cid:19)ा के िलए उपयोग (cid:4)कया गया टुबुलर Lलोर(स लUै प का नमूना aव*ेरणा से परी(cid:19)ा के दौरान क(cid:27) गई परी(cid:19)ा या चुनौतीपणू (cid:13)परी(cid:19)ा म (असफल हो जाता ह ैवहा ं"यूरो अनुkािपत lि2 को एक और अवसर *दान करेगा और "यरू ो अनkु ािपत lि2 क(cid:27) लागत पर परी(cid:19)ा और अशाकं न के िलए रा(cid:134)ीय *Kयाययन बोड (cid:13)Jारा सUयक् iप से *Kयाियत (cid:4)कसी aवतं: परी(cid:19)ा *योगशाला म( टुबुलर Lलोर(स लैUप के पहले परी(cid:19)ण नमनू ) क(cid:27) दगु नी मा:ा सिहत दसू रा परी(cid:19)ण करवाएगा।

(6) जहा ंदसू री परी(cid:19)ा असफल हो जाती ह ैवहां "यूरो – (क) *.प 5 म( अनुkािपत lि2 को, सभी रा(cid:135)य अिभहीत अिभकरण) को सूचना के अधीन यह िनदशे दगे ा (cid:4)क अनुkािपत lि2, दो मास क(cid:27) अविध के भीतर,-

(i) टुबलु र Lलोर(स लैUप के ऊपर िचपकाए गए लेबल पर स*ं द7शत(cid:13) aटार लेवल को सही करे या परी(cid:19)ा के दौरान पाई गई :ुFटय) और किमय) को दरू करे;

(ii) "यूरो के िनदशे ) का पालन करने के िलए बाजार स ेपरू ा aटाक वापस ले ; और

(iii) िवkापन सामnी पर सं*द7श(cid:13)त िविशि-य) म (पFरवत(cid:13)न करे; (ख) (cid:4)कसी रा(cid:134)ीय या *ादिे शक दिैनक समाचरप: म ( और (cid:4)कसी इलै6(cid:127)ािनक साधन) म ( या (cid:4)कसी अQय रीित म(, जो वह ठीक समझ,े दो मास के भीतर अनुkािपत lि2 का नाम, fांड का नाम, माडल का नाम या माडल संrया, लोगो और अQय िविनदश(cid:130) *कािशत करेगा;

(ग) रा(cid:135)य अिभिहत अिभकरण को अनkु ािपत lि2 के िवi(cid:136) अिधिनयम क(cid:27) धारा 27 के अधीन क(cid:27) गई काय(cid:13)वािहय) का Qयायिनण(cid:13)यन आरUभ करने के िलए सूिचत करेगा।

(7) अनkु ािपत lि2, उपिविनयम (6) म (िनvद-(cid:13) दो मास क(cid:27) अविध पूरी होने के दस (cid:4)दन के भीतर, (क) "यूरो को, िनदशे ो के अनुपालन म( क(cid:27) गई कार(cid:13)वाई के संबंध म (*iप -6 म (अनुपालन Fरपोट(cid:13) भेजेगा, और (ख) य(cid:4)द खंड (क) म (िनvद-(cid:13) अनपु ालन Fरपोट(cid:13) *ाZ नह< होती ह ैया िविनvद-(cid:13) अविध के भीतर (cid:4)कसी िनदशे का पालन (cid:4)कए िबना *ाZ होती ह,ै तो उसे जारी िनदशे ) का अऩनपु ालन समझा जाएगा और "यरू ो Jारा उस *भाव का आदशे पाFरत (cid:4)कया जाएगा।

NOTIFICATION New Delhi, the 9th March, 2018 No. BEE/S&L/TFL/63/2017-18.— Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2017, were published vide notification number BEE/S&L/TFL/63/2017-18, dated the 5th October, 2017, as required under sub-section (1) of

section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the period of forty-five days from the date on which copies of Official Gazette containing the said notification were made available to the public;

And whereas copies of the said Official Gazette were made available to the public on the 5th October, 2017;

And whereas no objections or suggestions were received from public with respect to the said draft regulations within the aforesaid period;

Now, therefore, in exercise of the powers conferred by clause (d) of section 14 read with clause (i) of sub-

section (2) of section 58 and clause (n) of sub-section (2) of section 13 of the said Act and in supersession of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2009, except as respects things done or omitted to be done before such supersession, the Bureau, with the previous approval of the Central Government, hereby makes the following regulations, namely:-

1. Short title and commencement. - (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Tubular Fluorescent Lamps) Regulations, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. -(1) In these regulations, unless the context otherwise requires,-

(a) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “Bureau” means the Bureau of Energy Efficiency established under sub-section (1) of section 3 of the Act.

(d) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the tubular fluorescent lamp;

(e) “label period” means the validity period of the luminous efficacy under energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, the validity period of the luminous efficacy is not notified, it shall be deemed to be valid until new values for the same are notified by the Central Government.

(f) “models or family of models” means the product or range of products of one particular brand, to which a single set of test reports is applicable and where each of the products have the same physical characteristics, luminous efficacy, star rating level and performance characteristics;

(g) “permittee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(h) “Schedule” means the Schedule annexed to these regulations;

(i) “star rating or star level” means the grade of energy efficiency displayed on the label of the tubular fluorescent lamp based on energy consumption standard notified by the Central Government under the Act;

(j) “trader or seller” in relation to any labelled tubular fluorescent lamp means a person who sells or distributes such tubular fluorescent lamp and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such tubular fluorescent lamp;

(k) “tubular fluorescent lamps” means an appliance notified by the Central Government under the Act.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label. -(1) On every tubular fluorescent lamp, the following particulars shall be displayed on its label, namely:-

(a) the logo of the Bureau of Energy Efficiency;

(b) name of manufacturer or importer and brand;

(d) trade name and number;

(e) model and year of manufacturing or import;

(f) unique series code;

(g) power consumption in Watts ;

(h) star level of the tubular fluorescent lamp;

(i) luminous efficacy in lm/W;

(j) label period;

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.- (1) A label containing all the particulars specified in regulation 3 shall be displayed on every tubular fluorescent lamp within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government, every permittee or trader or seller shall ensure that-

(a) outer casing of the tubular fluorescent lamp put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year of the tubular fluorescent lamp shall also be in synchronization with such revised energy consumption standards, and shall not produce the tubular fluorescent lamp with previous energy consumption standards;

(b) all preparatory steps including awareness of the dealers, retailers and consumers, publicity for their education shall be well planned six months in advance from the date of commencement, under these regulations.

5. Manner of display of label.- (1)There shall be a label on every tubular fluorescent lamp which shall display at the point of sale and such label shall be affixed on the tubular fluorescent lamp in the following manner, namely:-

(a) the label with colour programme after photographic reduction to 16 millimetre height shall be printed on the sleeve;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(b) every manufacturer and importer shall mark the colour temperature on the sleeve;

(c) the star marking as per the rating shall be stamped on the tubular fluorescent lamp, the size of the stamp for the star marking shall be 14.5 millimetre height x 8.5 millimetre width and the same shall be stamped in a separate column.

6. Permission for display of label.- (1) No star label shall be affixed on a tubular fluorescent lamp except with the prior permission of the Bureau.

(2) For the purposes of obtaining permission of the Bureau under sub-regulation (1), permittee shall make application as per Form I to register himself for every brand separately, accompanied by a label security fee of rupees one lakh, payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or by

any other acceptable electronic mode of payment:

Provided that the label security fee for small scale industry shall be twenty-five thousand rupees;

(3) Every application for registration under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or by any other acceptable electronic mode of payment;

(b) documents specified in Form I.

7. Grant of permission and renewal. - (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may within a period of one month from the date of such receipt grant, subject to such terms and conditions as are specified in regulation 8, permission for affixing label on tubular fluorescent lamp in Form II or in electronic form.

(2) The Bureau shall enter the name and particulars of the permittee in Form III.

(3) The permission so granted under sub-regulation (1) shall be valid for a period for which the star level specified by the energy consumption standard as notified by the Central Government is in force.

(4) The permittee shall apply for renewal of permission before six months but not later than three months before its expiry and shall be accompanied by a fee of one thousand rupees payable in the form of demand draft or acceptable electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

(5) On receipt of the application for renewal under sub-regulation (4) the Bureau may, after being satisfied that all requirements are complied with, within a period of one month from the date of such receipt, renew permission in Form II.

(6) An application for renewal made after the expiry of validity period shall be rejected and the permittee may make a fresh application for permission.

(7) The permittee who seeks permission to continue to affix label on the existing model of the tubular fluorescent lamp from the date from which the revised star level comes into force shall submit a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of tubular fluorescent lamp is planned to be launched to synchronize with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall,-

(a) comply with the energy consumption standards for tubular fluorescent lamp notified by the Central Government;

(b) affix label only on such model of tubular fluorescent lamps for which permission has been granted;

(d) ensure that the star level displayed on the label of tubular fluorescent lamp shall be maintained at all time;

(e) pay the label fee as specified in regulation 9;

(f) furnish to the Bureau a Statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of closure of each quarter of the financial year;

(g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year;

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Operation Manual on Standard and Labelling.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 23

9. Label Fee. - (1) Every permittee shall pay to the Bureau a label fee of five paisa for each label affixed on the tubular fluorescent lamp;

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure of each financial year;

(3) If a permittee fails to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security fee made under sub-regulation (2) of regulation 6 and if complete labelling fees are not recovered within one year of the last date of submission, Bureau may cancel the labels granted to the permittee and publish his name in the newspapers as a defaulter.

10. Refund of Label Security Fee. - Subject to the provisions to sub-regulations (2) and (3) of regulation 9, the permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture tubular fluorescent lamp.

11. Verification by the Bureau. - (1) The Bureau or its designated agency may, either suo motu or on a complaint received by it, carry out verification to ensure that the tubular fluorescent lamp conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purposes of verification, the Bureau or its designated agency may pick up samples at random from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the tubular fluorescent lamp in an independent laboratory duly accredited by the National Accreditation Board for testing and calibration laboratories and follow the below procedure, namely:-

(a) the Bureau shall issue a notice to the permittee for carrying out such testing and the complainant shall be called upon to deposit such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time as may be determined by the Bureau;

(b) if the sample drawn under challenge testing fails, the permittee shall reimburse all expenses towards the cost of sample, transportation of sample and the testing charges to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and

(4) Where, upon a complaint received under sub-regulation (1), if the permittee fails to deposit such expenses referred to in sub-regulation (3) within such time, the Bureau shall continue the verification by challenge testing the tubular fluorescent lamp referred to in sub-regulation (3) and the processing of application received under regulation 6 be kept in abeyance till such expenses are deposited.

(5) Where samples of tubular fluorescent lamp used for testing fails, either in the suo motu testing or challenge testing, the Bureau shall afford the permittee another opportunity and the Bureau shall conduct a second test with twice the quantity of tubular fluorescent lamp used in the first test in an independent test laboratory duly accredited by the National Accreditation Board for testing and calibration laboratories at the cost of the permittee.

(6) Where the second test fails, the Bureau shall-

(a) direct the permitte in Form V, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label affixed on the outer casing of the tubular fluorescent lamp or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications for public infomation;

(c) intimate to the concerned State Designated Agency to take up the matter with the State Commission to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(7) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub-regulation (6) ,-

(a) send the compliance report in Form VI to the Bureau with respect to action taken in compliance with the direction; and

(b) in case compliance report referred to in clause (a) is not received or received without complying to any of the directions within the specified period, it shall be deemed to be non-compliance of the direction issued and orders to that effect shall be passed by the Bureau.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(8) The Bureau shall send a copy of the compliance report referred to in clause (a) of sub-regulation (7) and order passed in clause (b) of sub-regulation (7) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of sub-regulation (7).

(9) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (6), the Bureau under intimation to all State Designated Agencies shall-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standard notified by the Central Government, the directions of the Bureau referred to in clause (a) of sub-regulation (7) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications for public information;

(d) intimate to the concerned State Designated Agencies to take up the matter with the State Commission to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of Permission. - The Bureau may cancel the permission granted under regulation 7 if the permittee—

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(ii) the same details furnished to the Bureau through automated system;

(g) such other details of tubular fluorescent lamp the permittee shall make available as and when sought by the Bureau of which the permission has been granted.

4. The permittee shall not withdraw the tubular fluorescent lamp from the market during the validity period of permission except with the prior approval of the Bureau.

6. Where the star level plan on review is modified by the Central Government, the star level of the tubular

fluorescent lamp shall be deemed to be modified to the following options namely:-

(b)where the existing model is continued to give effect to the modified star level, only a declaration in Form IV shall be submitted to the Bureau.

6. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within ten days after the expiry of two months i.e. by ...............In case no compliance report is received by the said date, the Bureau shall proceed to take action under these regulations.
